Léiriú.
1.—(1) San Acht seo—
ciallaíonn an abairt “an Príomh-Acht” an tAcht Timpeal Toghchán, 1923 (Uimh. 12 de 1923);
ciallaíonn an abairt “an tAire” an tAire Rialtais Áitiúil agus Sláinte Poiblí.
(2) Déanfar tagairtí san Acht seo don Phríomh-Acht a léiriú mar thagairtí don Phríomh-Acht arna leasú leis an Acht seo.
(3) Léireofar mar aon ní amháin an tAcht seo agus an Príomh-Acht.
Alt 41 den Phríomh-Acht a leasú.
2.—Beidh éifeacht ag an bPríomh-Acht amhail is dá gcuirtí an t-alt seo a leanas in ionad ailt 41, is é sin le rá—
“41.—(1) Déanfar gach olltoghchán faoi leith a chomóradh ar an aon lá amháin, agus is é an lá céanna a bheas ann ar fud an Stáit agus ní bheidh an lá sin níos déanaí ná tríocha lá tar éis Dáil Éireann a lán-scor.
(2) Is é an ceann comhairimh a cheapfas an áit toghcháin do gach dáilcheantar agus is é áit a cheapfaidh ná—
(a) i ndailcheantar buirge, áit éigin sa bhuirg, agus
(b) i ndáilcheantar contae, áit éigin sa dáilcheantar nó i gcontae-bhuirg a bheas ag luí leis an gcontae ina mbeidh an dáilcheantar nó an mhórchuid den dáilcheantar.
(3) Tosnóidh an vótaíocht, más ann, in Olltoghchán nó i gCorr-thoghchán ar a 9 a chlog a.m. agus coimeádfar ar siúl í go dtí a 9 a chlog p.m. ach ní coimeádfar ar siúl níos sia í mura rud é, i gcás aon Olltoghcháin nó Corr-thoghcháin áirithe, go n-ordóidh an tAire, le hordú, go gcoimeádfar an vótaíocht san Olltoghchán nó sa Chorr-thoghchán sin ar siúl go dtí 9.30 a chlog p.m., agus sa chás sin coimeádfar an vótaíocht san Olltoghchán nó sa Chorr-thoghchán sin ar siúl go dtí 9.30 a chlog p.m.”.
Cuid I den Chúigiú Sceideal a ghabhas leis an bPríomh-Acht a leasú.
3.—Déantar leis seo Cuid I den Chúigiú Sceideal a ghabhas leis an bPríomh-Acht a leasú mar leanas—
(a) tríd an Riail seo a leanas a chur in ionad Rialach 30—
“30. Déanfaidh an ceann comhairimh do dháilcheantar na nithe seo a leanas—
(a) ceapfaidh sé, mar áit a gcomhaireofar na vótaí ann—
(i) i gcás an dáilcheantar a bheith comhshuite ar fad nó i bpáirt de chontae-bhuirg, áit éigin sa chontae-bhuirg, nó
(ii) in aon chás eile, áit éigin sa dáilcheantar, ach féadfaidh sé, le toiliú an Aire (toiliú ná tabharfar mura deimhin leis an Aire ná fuil ar fáil, laistigh den dáilcheantar, aon áit oiriúnach chun na vótaí a chomhaireamh), áit éigin lasmuigh den dáilcheantar, ach é comhgarach dó, a cheapadh,
(b) comhaireoidh sé na vótaí san áit a bheas ceaptha amhlaidh,
(c) bhéarfaidh sé, ocht n-uaire ceathrachad an chloig ar a laghad roimh a 9 a chlog a.m. lá na vótaíochta, fógra i scríbhinn i dtaobh na háite a bheas ceaptha amhlaidh do ghníomhairí na n-iarrthóirí a bheas ceaptha chun bheith i láthair le linn na vótaí a bheith á gcomhaireamh;”
(b) trí na focail “Sar a raghaidh an ceann comhairimh ar chomhaireamh na vótanna déanfaidh sé”, i Riail 32, a scrios agus na focail seo a leanas a chur ina n-ionad, eadhon, “Ar a 9 a chlog a.m. an lá i ndiaidh críochnú na vótaíochta agus san áit a bheas ceaptha faoi Riail 30 den Chuid seo den Sceideal seo, déanfaidh an ceann comhairimh”;
(c) tríd an Riail seo a leanas a chur in ionad Rialach 33—
“33. Tar éis dó déanamh do réir Rialach 32 den Chuid seo den Sceideal seo, tosnóidh an ceann comhairimh láithreach ar na vótaí a chomhaireamh agus, a mhéid is féidir é, raghaidh ar aghaidh le comhaireamh na vótaí gan stad ach amháin chun biadh a chaitheamh, agus ag eisceadh (ach amháin sa mhéid go n-aontóidh sé féin agus na gníomhairí ar a mhalairt) na n-uaireanna idir a haon déag a chlog san oíche agus a naoi a chlog an mhaidin ina dhiaidh sin. I rith an ama eiscithe cuirfidh an ceann comhairimh na boscaí ballóide agus na doiciméidí eile a bhainfeas leis an toghchán faoina shéala féin agus faoi shéalaí pé gníomhairí do na hiarrthóirí ar mian leo a séalaí a chur orthu, agus glacfaidh cúram cuí chun na páipéir agus na doiciméidí sin a choimeád slán.”.
Cártaí vótaíochta.
4.—(1) Aon uair a bheas toghchán Dála in aon dáilcheantar curtha ar athló chun vótaíocht a dhéanamh, déanfaidh an ceann comhairimh don dáilcheantar sin cárta (dá ngairmtear cárta vótaíochta san alt seo) sa bhfoirm ordaithe a chur leis an bpost do réir an ailt seo chun gach toghthóra a mbeidh a ainm ar an gclár de thoghthóirí Dála don dáilcheantar sin agus ná beidh a ainm ar an liosta de phost-vótálaithe don dáilcheantar sin á chur in iúl don toghthóir sin cad é a uimhir (maille le litir a cheantair vótaíochta) ar an gclár sin agus cá bhfuil an áit vótaíochta ina mbeidh an toghthóir sin i dteideal vótáil sa toghchán sin.
(2) Gach cárta vótaíochta a cuirfear faoin alt seo chun toghthóra in aon dáilcheantar díreofar é chun an toghthóra sin faoin ainm agus an seoladh faoina mbeidh sé cláraithe sa chlár de thoghthóirí Dála don dáilcheantar sin agus cuirfear amach é i dtráth chun go seachadfaí ag an seoladh sin é i ngnáthchúrsa an phoist tráth nach déanaí ná an tríú lá roimh an lá vótaíochta sa toghchán lena mbainfidh.
(3) Déanfaidh an ceann comhairimh gach cárta vótaíochta a sheachadadh don Cheann-Oifig Phoist is comhgaraí nó do pé postoifig eile a socrófar leis an gCeann-Mháistir Poist agus déanfaidh an Ceann-Mháistir Poist nó máistir poist na post-oifige eile sin (pé acu é) é a chur ar aghaidh láithreach saor ó chostas chun é a sheachadadh don dhuine chun a mbeidh sé dírithe.
(4) Na costais faoina raghaidh ceann comhairimh chun an t-alt seo a chomhlíonadh i dtoghchán, áireofar iad mar chostais faoina raghaidh sé chun críocha an toghcháin sin do réir bhrí ailt 25 den Phríomh-Acht, agus beidh feidhm agus éifeacht ag an alt sin dá réir sin.
(5) Ní bheidh aon toghchán neamhbhailí toisc an ceann comhairimh dá fhaillí cárta vótaíochta a chur do réir an ailt seo chun aon toghthóra nó toisc gan cárta vótaíochta a sheachadadh d'aon toghthóir nó toisc aon earráide nó míráitis in aon chárta vótaíochta a cuirfear amach de bhun an ailt seo, ná ní déanfar aon toghchán a chonspóid mar gheall ar aon fhaillí, neamhsheachadadh, carráid nó míráiteas den tsórt sin.
(6) Ní luífidh ná ní bunófar aon aicsean ná imeacht eile i gcoinne ceann comhairimh mar gheall ar aon earráid nó míráiteas in aon chárta vótaíochta a chuirfeas sé amach amhlaidh.
Leas-chinn chomhairimh a cheapadh.
5.—(1) Más é an t-aon duine amháin is ceann comhairimh do dhá dháilcheantar nó níos mó a mbeidh toghchán iomaidh i ngach ceann acu san am chéanna déanfaidh sé—
(a) más dhá dháilcheantar, ar a mhéid, a bheas ann, leascheann comhairimh a cheapadh i leith ceann amháin acu chun na boscaí ballóide a oscailt agus na vótaí a chomhaireamh,
(b) in aon chás eile, leas-cheann comhairimh a cheapadh, i leith gach ceann (ach ceann amháin) de na dáilcheantair sin, chun na boscaí ballóide a oscailt agus na vótaí a chomhaireamh,
agus déanfaidh gach leas-cheann comhairimh a bheas ceaptha amhlaidh i leith dáilcheantair na boscaí ballóide a oscailt agus na vótaí a tugadh sa toghchán sa dáilcheantar sin a chomhaireamh.
(2) Mura féidir leis an gceann comhairimh do dháilcheantar, mar gheall ar bhreoiteacht nó cúis réasúnach eile, an toghchán sa dáilcheantar sin a stiúradh, féadfaidh sé leas-cheann comhairimh a cheapadh chun gach ceann nó aon cheann dá dhualgais a chomhlíonadh, agus déanfaidh aon leas-cheann comhairimh a ceapfar amhlaidh na dualgais dá gceapfar é a chomhlíonadh.
(3) Ní déanfar duine ar bith a cheapadh ina leas-cheann comhairimh faoi fho-alt (1) ná fo-alt (2) den alt seo mura n-aontaí an tAire lena cheapadh amhlaidh.
(4) Folaíonn an abairt “ceann comhairimh” sa Chúigiú Sceideal a ghabhas leis an bPríomh-Acht aon leas-cheann comhairimh arna cheapadh ag an gceann comhairimh faoin alt seo chun aon dualgais de chuid an chinn chomhairimh sin a chomhlíonadh.
E a bheith de dhualgas ar an gceann comhairimh toghchán a stiúradh.
6.—Faoi réir forál fo-ailt (1) d'alt 5 den Acht seo, déanfaidh an ceann comhairimh do dháilcheantar toghchán a stiúradh sa dáilcheantar sin mura rud é nach féidir leis sin a dhéanamh mar gheall ar bhreoiteacht nó cúis réasúnach eile is leor i dtuairim an Aire.
An tAire do cheapadh ceann comhairimh.
7.—Mura féidir leis an gceann comhairimh do dháilcheantar, mar gheall ar bhreoiteacht nó cúis eile, gach ceann nó aon cheann dá dhualgais mar oifigeach den tsórt sin a chomhlíonadh, agus mura mbeidh duine ceaptha aige faoi alt 5 den Acht seo nó mura mbeidh aon tsocrú déanta chun a dhualgais mar oifigeach den tsórt sin a chomhlíonadh, féadfaidh an tAire, más oiriúnach leis, duine a cheapadh chun bheith ina cheann comhairimh don dáilcheantar sin chun pé dualgais de chuid an chinn chomhairimh a chomhlíonadh a bheas gan comhlíonadh agus is tuigthe aon rit a heisíodh faoi alt 54 den Phríomh-Acht chun an chinn chomhairimh a bheith arna eisiúint chun an duine a bheas cheaptha ag an Aire faoin alt seo.

8.—(1) Más rud é—
(a) go mbeidh toghchán Dála in aon dáilcheantar curtha ar athló chun vótaíocht a dhéanamh, agus
(b) gur ar oileán a bheas an stáisiún vótaíochta (dá ngairmtear an stáisiún vótaíochta ceaptha sa bhfo-alt seo) do cheantar vótaíochta sa dáilcheantar sin,
féadfaidh an ceann comhairimh, má mheasann sé gur dócha, mar gheall ar dhrochaimsir nó deacrachta iompair,—
(i) nach féidir an vótaíocht a dhéanamh sa stáisiún vótaíochta ceaptha ar an lá vótaíochta ceaptha nó
(ii) dá ndéantaí an vótaíocht ar an lá vótaíochta ceaptha, ná féadfadh na boscaí ballóide a húsáideadh sa stáisiún vótaíochta ceaptha an áit a bheas ceaptha do chomhaireamh na vótaí a shroichint ar nó roimh a 9 a chlog a.m. an lá i ndiaidh an lae vótaíochta cheaptha,
fógra poiblí a thabhairt sa cheantar vótaíochta sin ina luafaidh an tuairim sin aige agus ina leagfidh amach na forála ina dhiaidh seo den fho-alt seo, agus air sin beidh éifeacht, d'ainneoin aon ní dá bhfuil sa Phríomh-Acht, ag na forála seo a leanas—
(A) féadfaidh an ceann comhairimh an vótaíocht a dhéanamh sa stáisiún vótaíochta ceaptha an chéad lá, i ndiaidh an tríú lae tar éis an toghchán a chur ar athló, is dóigh leis a bheas cúrsaí iompair idir an t-oileán agus an mórthír réasúnta sábhálta,
(B) mura féidir, mar gheall ar dheacrachta iompair, tosnú ar an vótaíocht sa stáisiún vótaíochta ceaptha ar a 9 a chlog a.m., tosnófar uirthi a luaithe is féidir i ndiaidh an ama sin,
(C) más rud é, tar éis an vótaíocht sa stáisiún vótaíochta ceaptha a bheith ar siúl ar feadh ceithre huaire an chloig, ar a laghad, gur dóigh leis an oifigeach ceannais nárbh fhéidir, dá leantaí den vótaíocht níos sia, bheith ag brath air go sroichfeadh na boscaí ballóide an áit a bheas ceaptha do chomhaireamh na vótaí ar nó roimh a 9 a chlog a.m. an lá i ndiaidh an lae vótaíochta cheaptha, féadfaidh sé an vótaíocht a chríochnú ansin,
(D) ní déanfar aon athrú ar fhoirm ná ar lánas an fhógra i dtaobh na vótaíocht faoi Riail 8 de Chuid I den Chúigiú Sceideal a ghabhas leis an bPríomh-Acht de bhíthin an lá agus na huaireanna vótaíochta sa cheantar vótaíochta sin a athrú faoin bhfo-alt seo.
(2) San alt seo—
ciallaíonn an abairt “an lá vótaíochta ceaptha”, maidir le toghchán Dála in aon dáilcheantar, an lá a bheas ceaptha faoi fho-alt (1) nó fo-alt (2) d'alt 18 den Phríomh-Acht mar an lá a déanfar an vótaíocht sa toghchán sin sa dáilcheantar sin;
ciallaíonn an abairt “an áit a bheas ceaptha do chomhaireamh na vótaí”, maidir le toghchán Dála in aon dáilcheantar, an áit a bheas ceaptha faoi Riail 30 de Chuid I den Chúigiú Sceideal a ghabhas leis an bPríomh-Acht mar an áit a gcomhaireofar ann na vótaí a caitheadh sa toghchán sin sa dáilcheantar sin.

9.—Déantar leis seo na hachtacháin a luaitear sa dara colún den Sceideal a ghabhas leis an Acht seo a athghairm a mhéid a luaitear sa tríú colún den Sceideal sin.

ELECTORAL (AMENDMENT) ACT, 1946.
Interpretation.
1.—(1) In this Act—
the expression “the Principal Act” means the Electoral Act, 1923 (No. 12 of 1923);
the expression “the Minister” means the Minister for Local Government and Public Health.
(2) References in this Act to the Principal Act shall be construed as references to the Principal Act as amended by this Act.
(3) This Act shall be construed as one with the Principal Act.
Amendment of section 41 of the Principal Act.
2.—The Principal Act shall have effect as if the following section were substituted for section 41, that is to say—
Place and hours of poll.
“41.—(1) Each general election shall be held on one day only, and such day shall be the same throughout the State and shall be not later than thirty days after the dissolution of Dáil Eireann.
(2) The place of election shall be fixed for each constituency by the returning officer, and shall be,—
(a) in a borough constituency, some place within the borough, and
(b) in a county constituency, some place within the constituency or within a county borough adjoining the county in which the constituency or the greater part thereof is situate.
(3) The poll, if any, at a General Election or a Bye-Election shall commence at the hour of 9 o'clock a.m. and shall be kept open till the hour of 9 o'clock p.m. and no longer, unless in the case of any particular General Election or Bye-Election, the Minister by order directs that the poll at that General Election or Bye-Election shall be kept open until the hour of 9.30 o'clock p.m. in which case the poll at that General Election or Bye-Election shall be kept open until the hour of 9.30 o'clock p.m.”.
Amendment of Part I of the Fifth Schedule to the Principal Act.
3.—Part I of the Fifth Schedule to the Principal Act is hereby amended in the following respects—
(a) by the substitution of the following Rule for Rule 30—
“30. The returning officer for a constituency—
(a) shall appoint, as the place at which the votes will be counted,—
(i) in case the constituency consists wholly or partly of a county borough, some place within the county borough, or
(ii) in any other case, some place within the constituency, but may, with the consent of the Minister (which consent shall not be given unless the Minister is satisfied that there is not, within the constituency, any place available and suitable for the counting of the votes), appoint some place outside, but convenient to, the constituency,
(b) shall count the votes at the place so appointed,
(c) shall, at least forty-eight hours before the hour of 9 o'clock a.m. on the day of the poll, give to the agents of the candidates appointed to attend at the counting of the votes notice in writing of the place so appointed;”
(b) by the deletion, in Rule 32, of the words “Before the returning officer proceeds to count the votes, he shall,” and the substitution therefor of the following, namely, “At the hour of 9 o'clock a.m. on the day after the close of the poll and at the place appointed under Rule 30 of this Part of this Schedule, the returning officer shall”;
(c) by the substitution of the following Rule for Rule 33—
“33. After compliance with Rule 32 of this Part of this Schedule, the returning officer shall forthwith begin to count the votes and, shall so far as practicable, proceed continuously with the counting of the votes allowing only time for refreshment, and excluding (except so far as he and the agents otherwise agree) the hours between eleven o'clock at night and nine o'clock on the succeeding morning. During the excluded time the returning officer shall place the ballot boxes and other documents relating to the election under his own seal and the seals of such of the agents of the candidates as desire to affix their seals, and shall otherwise take proper precautions for the security of such papers and documents.”.
Polling cards.
4.—(1) Whenever a Dáil election in any constituency is adjourned for the purpose of taking a poll, the returning officer for such constituency shall send by post in accordance with this section to every elector whose name is on the register of Dáil electors for such constituency and is not on the postal voters' list for such constituency a card (in this section referred to as a polling card) in the prescribed form informing such elector of his number (including polling district letter) on such register and of the situation of the polling place in which such elector will be entitled to vote at such election.
(2) Every polling card sent under this section to an elector in any constituency shall be addressed to such elector by the name and at the address by and in respect of which he is registered in the register of Dáil electors for that constituency and shall be sent at such time that it would be delivered in the ordinary course of post at that address not later than the third day before the polling day at the election to which it relates.
(3) Every polling card shall be delivered by the returning officer to the nearest Head Post Office or such other post office as may be arranged with the Head Postmaster and shall immediately be forwarded without payment of cost by the Head Postmaster or the postmaster of such other post office (as the case may be) for delivery to the person to whom it is addressed.
(4) The expenses incurred by a returning officer in complying with this section at an election shall be expenses incurred by him for the purposes of such election within the meaning of section 25 of the Principal Act, and that section shall apply and have effect accordingly.
(5) No election shall be invalidated by reason of the failure of the returning officer to send a polling card in accordance with this section to any elector or by reason of the non-delivery of a polling card to any elector or of any error or mis-statement in any polling card sent in pursuance of this section, nor shall any election be questioned on the ground of any such failure, non-delivery, error, or mis-statement.
(6) No action or other proceeding shall lie or be brought against a returning officer in respect of any error or mis-statement in any polling card so sent by him.
Appointment of deputy returning officers.
5.—(1) Where the same person is returning officer for two or more constituencies, in each of which there is at the same time a contested election, he shall—
(a) in case those constituencies are two and no more, appoint, in respect of one of them, a deputy returning officer to open the ballot boxes and count the votes,
(b) in any other case, appoint, in respect of each of the constituencies (except one), a deputy returning officer to open the ballot boxes and count the votes,
and every deputy returning officer so appointed in respect of a constituency shall open the ballot boxes and count the votes cast at the election in that constituency.
(2) Where the returning officer for a constituency is prevented by illness or other reasonable cause from conducting the election in such constituency, he may appoint a deputy returning officer to carry out all or any of his duties, and any deputy returning officer so appointed shall carry out the duties for which he is appointed.
(3) No person shall be appointed a deputy returning officer under subsection (1) or subsection (2) of this section whose proposed appointment is not approved of by the Minister.
(4) The expression “returning officer” in the Fifth Schedule to the Principal Act includes any deputy returning officer appointed by the returning officer under this section for the discharge of any duties of such returning officer.
Duty of returning officer to conduct election.
6.—Subject to the provisions of subsection (1) of section 5 of this Act, the returning officer for a constituency shall conduct an election in such constituency unless he is prevented from so doing by illness or other reasonable cause sufficient in the opinion of the Minister.
Appointment by the Minister of returning officer.
7.—If the returning officer for a constituency is prevented by illness or other cause from carrying out all or any of his duties as such officer, and if he has not made an appointment under section 5 of this Act or if no arrangement has been made for carrying out his duties as such officer, the Minister may appoint, if he thinks fit, a person to be the returning officer for such constituency to carry out such duties of the returning officer as remain to be performed and any writ issued, under section 54 of the Principal Act, to the returning officer shall be deemed to have been issued to the person appointed by the Minister under this section.
Emergency provisions in relation to polling on islands.
8.—(1) Where—
(a) a Dáil election in any constituency is adjourned for the purpose of taking a poll, and
(b) the polling station (in this subsection referred to as the appointed polling station) for a polling district in that constituency is situate on an island,
the returning officer, if he is of opinion that, owing to stress of weather or transport difficulties, either—
(i) it is probable that polling at the appointed polling station cannot be held on the appointed polling day, or
(ii) it is probable that, if the poll were held on the appointed polling day, the ballot boxes used at the appointed polling station could not reach the appointed place for the counting of the votes at or before the hour of 9 o'clock a.m. on the day next after the appointed polling day,
may give public notice in such polling district stating his said opinion and setting out the subsequent provisions of this subsection, and thereupon the following provisions shall, notwithstanding anything contained in the Principal Act, have effect—
(A) the returning officer may hold the poll at the appointed polling station on the first day, after the third day after the adjournment of the election, on which in his opinion transport between the island and the mainland is reasonably safe,
(B) where owing to transport difficulties the poll at the appointed polling station cannot begin at the hour of 9 o'clock a.m. it shall begin as soon as possible after the said hour,
(C) where, after the polling at the appointed polling station has continued for not less than four hours, the presiding officer is of opinion that, if the poll were further continued, the ballot boxes could not be expected to reach the appointed place for the counting of the votes at or before the hour of 9 o'clock a.m. on the day next after the appointed polling day, he may then close the poll,
(D) no alteration shall be made in the form or contents of the notice of the poll under Rule 8 of Part I of the Fifth Schedule to the Principal Act by reason of the alteration under this subsection of the day and hours of poll in such polling district.
(2) In this section—
the expression “the appointed polling day” means, in relation to a Dáil election in any constituency, the day appointed under subsection (1) or subsection (2) of section 18 of the Principal Act, as the day for the holding of the poll at that election in that constituency;
the expression “the appointed place for the counting of the votes” means, in relation to a Dáil election in any constituency, the place appointed under Rule 30 of Part I of the Fifth Schedule to the Principal Act, as the place at which the votes at that election in that constituency will be counted.
Repeals.
9.—The enactments mentioned in the second column of the Schedule to this Act are hereby repealed to the extent specified in the third column of the said Schedule.
Short title and collective citation.
10.—This Act may be cited as the Electoral (Amendment) Act, 1946, and the Electoral Acts, 1923 to 1941, the Electoral (Dáil Éireann and Local Authorities) Act, 1945 (No. 6 of 1945), and this Act may be cited together as the Electoral Acts, 1923 to 1946.
