(3) San Acht seo aon tagairt a déantar do réir uimhreach do Chuid nó d'alt is tagairt í don Chuid nó don alt den Acht seo ar a bhfuil an uimhir sin mura léirítear gur tagairt d'Acht éigin eile í.
(4) Mura n-éilíonn an comhthéacs a mhalairt déanfar tagairtí san Acht seo d'aon achtachán d'fhorléiriú mar thagairtí don achtachán sin arna leasú le haon achtachán ina dhiaidh sin, lena n-áirítear an tAcht seo.
Líomatáiste an Fheabhail.
3.—(1) San Acht seo ciallaíonn “Líomatáiste an Fheabhail” an líomatáiste is ionann agus an ceantar iascaigh a ceapadh agus a míníodh i gcéadóir faoin ainm an Londonderry District le hordú a rinne na Coimisinéirí Iascaigh an 9ú lá d'Iúil, 1855.
(2) Bhéarfar aird bhreithiúnach ar thórainneacha Líomatáiste an Fheabhail.

4.—Ar an dáta bunuithe agus uaidh sin amach scoirfidh na forála, dá dtagartar sa tríú colún den Chéad Sceideal a ghabhas leis an Acht seo, de na hachtacháin dá dtagartar sa dara colún d'fheidhm a bheith acu maidir le Líomatáiste Mhagh Bhile.
Cuntais agus tuarascála a leagadh faoi bhráid an Oireachtais.
5.—Cuirfidh an tAire faoi ndear go leagfar faoi bhráid gach Tí den Oireachtas cóip de chuntais an Choimisiúin do gach bliain arna n-iniúchadh do réir míre 17 den Tríú Sceideal a ghabhas leis an Acht seo, agus cóip de thuarascáil na n-iniúchóirí ar na cuntais sin, agus cóip den tuarascáil bhliantúil a thug an Coimisiún dó.
Cóipeanna d'orduithe agus rialacháin a thaisceadh.
6.—Taiscfear cóip de gach ordú nó rialachán a déanfar faoin Acht seo—
(a) leis an gcláraitheoir contae do chontae Dhún na nGall,
(b) leis an gCléireach Cúirte Dúiche do gach Dúthaigh Chúirte atá, nó a bhfuil cuid di, i Líomatáiste Mhagh Bhile, agus
(c) i ngach stáisiún Gharda Síochána i Líomatáiste Mhagh Bhile.
Caiteachais.
7.—Na caiteachais uile faoina raghaidh an tAire ag cur an Achta seo in éifeacht, déanfar, a mhéid a cheadós an tAire Airgeadais, iad d'íoc as airgead a sholáthrós an tOireachtas.
CUID II.
Cearta Iascaigh an Fheabhail a Thogaint.
Cumhachta chun cearta iascaigh a thógaint, etc.
8.—(1) Údaraítear leis seo don Aire comhaontú (dá ngairmtear an comhaontú dílsithe san Acht seo) a dhéanamh leis an Aireacht agus leis an gCumann Éireannach do réir téarmaí an dréachta atá leagtha amach sa Dara Sceideal a ghabhas leis an Acht seo.
(2) Ar dháta forghníomhuithe an chomhaontuithe dhílsithe oibreoidh an fo-alt seo chun teideal iomlán dochloíte a dhílsiú san Aire agus san Aireacht chun an feo simplí seilbhe ar gach ceart iascaigh sna coda taoidmheara de Loch agus Abha an Fheabhail agus dá shuainmheachán, Abha an Fhachain, saortha agus urscaoilte ó gach eastát, teideal, leas, eire, ceart, saoirse agus pribhléid d'aon tsórt, pé duine ag a bhfuil teachtadh, úsáid feidhmiú nó sealúchas an chéanna, lasmuigh de na cíos-mhuirir dá dtagartar sa chomhaontú dílsithe ach faoi shlánaíocht ina n-aghaidh sin mar foráltar sa chomhaontú sin.
(3) Ní bhainfidh fo-alt (2) den alt seo le ceart a bhí dílsithe, díreach roimh dháta forghníomhuithe an chomhaontuithe dhílsithe, in aon duine, seachas an Cumann Éireannach, chun inneall seasamhach d'úsáid faoi dheimhniú a deonadh faoi alt 6 den Salmon Fishery (Ireland) Act, 1863.
(4) Ar dháta forghníomhuithe an chomhaontuithe dhílsithe oibreoidh an fo-alt seo chun eastát, ceart, teideal agus leas uile an Chumainn Éireannaigh sna coda taoidmheara de Loch agus Abha an Fheabhail agus dá shuainmheachán, Abha an Fhachain, agus i ngrian, grinneall agus urthrá na gcoda taoidmheara sin, agus chucu sin uile, a mhúchadh.
(5) Oibreoidh an comhaontú dílsithe, gan a thuilleadh forcinntithe, chun an mhaoin uile a gcomhaontaítear leis í a dhíol, seachas cearta iascaigh lena mbaineann fo-alt (2) den alt seo, a thíolacadh, a shannadh agus d'aistriú ar dháta déanta an chomhaontuithe sin chun an Aire agus chun na hAireachta.
(6) Beidh cumhacht ag an gCumann Éireannach, d'ainneoin aon tórainneacha lena chumhachta, chun an comhaontú dílsithe a dhéanamh gan toiliú duine ar bith.
(7) Beidh de dhualgas ar an Aire agus ar an gCumann Éireannach, agus cumhachtaítear do gach páirtí dhíobh leis seo, an comhaontú dílsithe a chomhlíonadh a mhéid atá a fhorála le comhlíonadh ag an bpáirtí sin.
(8) Má chruthaíonn duine ar bith, seachas an Cumann Éireannach, gur baineadh aon leas i gceart eisiach iascaigh de le fo-alt (2) den alt seo, beidh sé i dteideal cúiteamh sa chailliúint leasa sin a ghnóthú ón gCoimisiún, agus mura gcomhaontaítear ar aon cheist i dtaobh cúiteamh a bheith iníoctha faoin bhfo-alt seo nó i dtaobh a mhéide cinnfear í faoi réim agus do réir an Acquisition of Land (Assessment of Compensation) Act, 1919, ag eadránaí a ceapfar faoin Acht sin.
(9) Nuair a bheas sé ag measúnú cúitimh faoi fho-alt (8) den alt seo, bhéarfaidh an t-eadránaí aird ar a mhéid a feidhmíodh an ceart áirithe i rith na ndeich mbliana dar críoch an dáta a forghníomhaíodh an chomhaontú dílsithe.
Díolúine ó dhleachta stampa.
9.—(1) Ní oibreoidh alt 12 den Finance Act, 1895, chun a cheangal go seachadfar do na Coimisinéirí Ioncaim cóip den Acht seo ná go n-íocfar dleacht stampa faoin alt sin ar aon chóip den Acht seo.
(2) Ní bheidh dleacht stampa inmhuirir ar an gcomhaontú dílsithe ná ar aon ionstraim a forghníomhófar dá bhun.
CUID III.
Coimisiun Iascaigh an Fheabhail.

10.—Tiocfaidh na forála ina dhiaidh seo den Chuid seo i ngníomh pé lá a cheapfas an tAire, le hordú, tar éis dó dul i gcomhairle leis an Aireacht.
Cóiriú agus Feidhmeanna.
Bunú Coimisiúin Iascaigh an Fheabhail.
11.—(1) Bunaítear leis seo comhlucht dá ngairmfear Coimisiún Iascaigh an Fheabhail.
(2) Is iad feidhmeanna an Choimisiúin—
(a) an mhaoin a dílseofar san Aire agus san Aireacht faoi alt 8 a bhainistí;
(b) iascaigh Líomatáiste an Fheabhail a chaomhaint, a chosaint agus d'fheabhsú i gcoitinne.
(3) Beidh feidhm maidir leis an gCoimisiún ag forála an Tríú Sceidil a ghabhas leis an Acht seo.
Díolúine rátaí agus cánacha.
12.—(1) Ní dhlífidh an Coimisiún cáin ar bith d'íoc i leith na dílseánachta in aon tailte, tíonóntáin agus oidhreachtáin ná i leith a n-áitithe ná i leith aon choda dá ioncam.
(2) Ní bheidh an Coimisiún faoi dhliteanas maidir le ráta is intobhaigh ag aon údarás áitiúil i leith úsáid nó áitiú aon oidhreachtáin nó tionóntáin ag an gCoimisiún, agus aon oidhreachtán nó tionóntán a bheas á úsáid nó á áitiú amhlaidh measfar, chun críche ailt 2 den Valuation (Ireland) Act, 1854, gur de chineál poiblí é agus gur chun na seirbhíse poiblí a háitítear é.
(3) I ngach bliain airgeadais áitiúil íocfar le húdarás áitiúil i Líomatáiste Mhagh Bhile as airgead a sholáthrós an tOireachtas pé suim a mbeadh an t-údarás sin i dteideal, do réir dlí, í d'fháil i leith rátaí mura mbeadh an díolúine a bheirtear le fo-alt (2) den alt seo.
Rialacháin.
13.—(1) Féadfaidh an Coimisiún, le haontú an Aire agus na hAireachta, pé rialacháin a dhéanamh a chífear don Choimisiún a bheith fóirstineach chun iascaigh Líomatáiste an Fheabhail a bhainistí, a chaomhaint, a chosaint agus d'fheabhsú agus, gan dochar do ghinearáltacht an mhéid sin roimhe seo, féadfaidh rialacháin a dhéanamh maidir le gach ní nó aon ní acu seo a leanas —
(a) iascach a rialú agus dea-ord a choimeád i measc lucht iascaigh,
(b) na trátha agus na saosúir le haghaidh iasc nó aon chineál éisc a thógáil nó le haghaidh aon mhodha tógála éisc nó aon chinéil éisc agus na coinníollacha faoina bhféadfar iasc nó aon chineál éisc a thógáil,
(c) aon mhodh tógála nó díthithe éisc nó aon chinéil éisc a thoirmeasc,
(d) na trátha agus na háiteanna nó an modh ina bhféadfar aon inneall iascaigh d'úsáid,
(e) an saghas agus an deilbh líonta a húsáidfear agus toise mhogall na líonta sin,
(f) úsáid aon innill iascaigh a thoirmeasc, go hiomlán nó ar shlí seachas faoi réim agus do réir ceadúnais arna eisiúint ag an gCoimisiún,
(g) ceadúnais d'iarraidh, d'eisiúint, d'athrú, d'athnuachaint agus a chúlghairm, i gcoitinne nó i gcásanna áirithe,
(h) uiscí a chosaint ar nimhiú agus truailliú ag aon ábhar docharach nó nimhiúil nó ó aon éisc nó ainmhithe oirgneacha,
(i) cleachtas ar bith a thoirmeasc is dóigh leis an gCoimisiún a raghadh chun bac a chur le hiasc a ghabháil go dleathach nó a bheadh in aon tslí docharach do na hiascaigh,
(j) míniú a thabhairt, do réir léarscáile nó eile, ar bhéal aon abhann i Líomatáiste an Fheabhail, ar bhéal aon fho-abhann mar a dtéann sí isteach in aon abhainn eile ann, ar an tórainn idir an chuid taoidmhear agus an chuid fíoruisce d'aon abhainn ann, ar an bpointe nó na pointí chun a mbeidh nó óna mbeidh faideanna slí le tomhas faoin Acht seo, nó ar an spás a dtoirmisctear leis an Acht seo nó le rialacháin faoin alt seo modhanna áirithe iascaigh d'úsáid nó a chleachtadh laistigh de,
(k) aon ní dá dtagartar san Acht seo mar ní ordaithe,
(l) aon ní a bhaineas in aon tslí le bainistí agus cosaint na n-iascach.
(2) Féadfaidh rialacháin a dhéanfas an Coimisiún faoin alt seo a fhoráil go n-éileofar i leith aon cheadúnais nó doiciméid eile, a eiseos nó a athrós an Coimisiún, pé táillí, is iníoctha pé tráth agus i pé slí, a hordófar.
(3) Gach rialachán a dhéanfas an Coimisiún faoin alt seo, foilseofar é, a luaithe is féidir tar éis a dhéanta, san Iris Oifigiúil agus i nuachtán nó i nuachtáin a léitear i Líomatáiste an Fheabhail.
(4) Aon ionstraim a rinneadh faoi na hAchta Iascaigh agus a bheas i bhfeidhm díreach roimh an dáta bunuithe agus a bhainfeas leis an gceantar iascaigh dá ngairmtear Ceantar Mhagh Bhile leanfaidh sé i bhfeidhm dá éis sin agus measfar gur faoin alt seo a rinneadh í agus féadfar í a chúlghairm le rialacháin faoin alt seo
(5) Cuirfidh an tAire faoi ndear go leagfar gach rialachán a déanfar faoin Acht seo faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus, má dhéanann ceachtar Teach, laistigh den lá agus fiche a shuífeas an Teach sin tar éis an rialachán a leagadh faoina bhráid, rún a rith ag neamhniú an rialacháin beidh an rialachán ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin rialachán.
(6) Má sháraíonn duine ar bith (trí ghníomh nó neamhghníomh) aon rialacháin faoin alt seo, beidh sé ciontach i gcion i gcoinne an Achta seo.

14.—(1) Ní bheidh an méid ceadúnas le haghaidh iascaigh le hinnill iascaigh d'aon tsórt (seachas slat agus ruaim), in uiscí taoide Líomatáiste an Fheabhail, a fhéadfas an Coimisiún d'eisiúint in aon bhliain, níos mó ná pé méid a bheas ordaithe de thuras na huaire.
(2) Má bhíonn an méid iarratas a déanfar go cuí ar cheadúnais in aon bhliain níos mó ná an méid uasta a forálfar faoin alt seo, dáilfear na ceadúnais i pé slí a bheas ordaithe.

15.—Bhéarfaidh an Coimisiún don Aire an 30ú lá de Shamhain, nó roimhe sin, gach bliain iascaigh, meastachán ar a ioncam agus a chaiteachas don bhliain sin.
Deontais.
16.—(1) Féadfar deontas nó deontais de pé méid a cheadós an tAire, le comhthoiliú an Aire Airgeadais, d'íoc leis an gCoimisiún, as airgead a sholáthrós an tOireachtas, i leith caiteachas an Choimisiúin in aon bhliain iascaigh áirithe.
(2) Nuair a bheas sé ag cinneadh méid an deontais faoin alt seo do bhliain iascaigh áirithe, bhéarfaidh an tAire aird ar mhéid aon deontais a bheas íoctha nó le n-íoc ag an Aireacht leis an gCoimisiún don bhliain sin.
Airleacain
17.—(1) Chun a chumasú don Choimisiún a fheidhmeanna d'fheidhmiú nó a chomhlíonadh, féadfaidh an tAire, le comhthoiliú an Aire Airgeadais, airleachain a thabhairt ó am go ham don Choimisiún as airgead a sholáthrós an tOireachtas.
(2) Aon tsuim a hairleacfar faoin alt seo, beidh sí inaisíoctha ar pé téarmaí ar a gcomhaontóidh an tAire agus an Coimisiún, le comhthoiliú an Aire Airgeadais.
Cumhacht an Choimisiúin chun iasachta sealadacha d'fháil.
18.—Féadfaidh an Coimisiún, trí chomhshocraíocht le bancaeirí, pé suimeanna a theastós uaidh ó am go ham d'fháil ar iasacht go sealadach, suas go dtí méid nach mó ná mar bheas ceadaithe ó am go ham ag an Aire agus ag an Aireacht.
Bord Mhagh Bhile a Dhíscaoileadh.
Bord Coimeádaithe Mhagh Bhile a dhíscaoileadh.
19.—(1) Déantar leis seo Bord Mhagh Bhile a dhíscaoileadh.
(2) Aistrítear leis seo chun an Choimisiúin maoin, cearta agus dliteanais uile Bhord Mhagh Bhile.
Imeachta dlíthiúla ar feitheamh a leanúint.
20.—Ar an dáta bunaithe tiocfaidh an Coimisiún chun bheith, agus beidh sé, ina pháirtí i ngach imeacht dlíthiúil ar feitheamh a bhfuil Bord Mhagh Bhile ina pháirtí inti, in ionad an Bhoird sin, agus leanfar de na himeachta dá réir sin agus ní thitfid ar lár ná ní scoirfear díobh ná ní déanfar dochar dóibh toisc an Bord sin a dhíscaoileadh.

21.—(1) Aon cheadúnas áitiúil speisialta—
(a) d'eisigh Bord Mhagh Bhile faoin Acht Iascaigh (Uiscí Taoide), 1934 (Uimh. 24 de 1934), le haghaidh na n-uiscí taoide d'Abhainn an Fheabhail ar a dtugtar an “Branch Stream” agus ar dearbhaíodh le hordú ón Aire feidhm a bheith ag an Acht sin ina leith, agus
(b) a bheas i bhfeidhm díreach roimh an dáta bunuithe,
leanfaidh sé, d'ainneoin ailt 4, de bheith i bhfeidhm do réir a théarmaí, faoi réir forál an Achta Iascaigh (Uiscí Taoide), 1934, agus ailt 54 den Acht Iascaigh, 1939 (Uimh. 17 de 1939), agus orduithe agus rialachán an Aire fúthu sin, agus déanfar na forála, na horduithe agus na rialacháin sin d'fhorléiriú maidir leis na ceadúnais sin amhail is dá mba thagairtí don Choimisiún na tagairtí do Bhord Mhagh Bhile.
(2) Aon cheadúnas (seachas ceadúnas áitiúil speisialta) d'eisigh Bord Mhagh Bhile agus a bheas i bhfeidhm díreach roimh an dáta bunuithe, leanfaidh sé i bhfeidhm do réir a théarmaí agus measfar gur ceadúnas iascaigh chun críocha an Achta seo é.
An Chomhairle Chomhairlitheach do Líomatáiste an Fheabhail.
Bunú agus feidhmeanna na Comhairle Comhairlithí.
22.—(1) Beidh Comhairle Chomhairlitheach ann do Líomatáiste an Fheabhail.
(2) Is iad feidhmeanna na Comhairle Comhairlithí féachaint i ndiaidh leasa sealbhóirí ceadúnas iascaigh agus áititheoirí iascach i Líomatáiste an Fheabhail, pé molta agus uiríolla is cuí léi a chur faoi bhráid an Choimisiúin maidir le haon fheidhm de chuid an Choimisiúin, agus an Coimisiún a chomhairliú i dtaobh aon ní a chuirfeas an Coimisiún faoina bráid.
(3) Beidh feidhm maidir leis an gComhairle Chomhairlitheach ag forála an Cheathrú Sceidil a ghabhas leis an Acht seo.
CUID IV.
Ratai ar Iascaigh.
Rátaí ar iascaigh.
23.—(1) Sa bhliain iascaigh dár tosach an lú lá de Dheireadh Fómhair, 1952, agus gach bliain iascaigh ina dhiaidh sin, gearrfaidh an Coimisiún, an 31ú lá de Nollaig, nó roimhe sin, ráta is ionann agus fiche scilling sa phunt ar gach iascach (seachas iascach arb é an Coimisiún a áititheoir) i Líomatáiste Mhagh Bhile ar an luacháil ina leith a bheas sa Liosta Luachála athscrúdaithe a ceangailtear faoi na hAchta Luachála ar an gCoimisinéir Luachála d'eisiúint tráth nach déanaí ná an 1ú lá de Mhárta roimhe sin.
(2) Gach ráta a gearrfar faoin alt seo, déanfaidh na daoine ar leithligh ag a mbeidh sé le n-íoc é d'íoc ina dhá leath ar an 1ú lá d'Aibreán agus ar an 1ú lá de Mheán Fómhair sa bhliain iascaigh dá mbeidh an ráta iníoctha agus íocfar é amhlaidh de bhreis agus de bharr ar gach táille cheadúnais nó aon táille cheadúnais a íocfas na daoine sin faoin Acht seo don bhliain iascaigh sin nó d'aon bhliain iascaigh eile.
(3) Duine ar bith a dlífear a rátú faoin Acht seo i leith iascaigh, beidh sé, i leith an iascaigh sin, díolmhaithe ó dhliteanas i leith aon ráta is intobhaigh ag údarás áitiúil.
(4) Beidh feidhm ag fo-alt (7) d'alt 13 den Acht Iascaigh, 1925 (Uimh. 32 de 1925), maidir le Líomatáiste Mhagh Bhile agus, chun críche na feidhme sin, measfar an díolúine a bheirtear le fo-alt (3) den alt seo a bheith tugtha leis an alt sin 13.

24.—Dlífidh áititheoir iascaigh an ráta iascaigh d'íoc i leith an iascaigh.
Ráta iascaigh a bhailiú.
25.—Déanfaidh pé daoine a cheapfas an Coimisiún ó am go ham ráta iascaigh a bhailiú, agus tógfaidh an Coimisiún leor-urrús ó na daoine a ceapfar amhlaidh go dtabharfar cuntas cuí sa ráta a baileofar, agus beidh costas bailithe an ráta ina chuid de chaiteachais an Choimisiúin.
Ráta iascaigh a ghnóthú.
26.—(1) Féadfar ráta iascaigh a ghnóthú ar agra an Choimisiúin mar fhiach conartha shimplí in aon chúirt dlínse inniúla.

27.—Beidh feidhm ag ailt 24, 25 agus 26 maidir le gach ráta iascaigh a ghearr Bord Mhagh Bhile agus a daingníodh faoi alt 13 den Acht Iascaigh, 1925 (Uimh. 32 de 1925), agus nach mbeidh lán-íoctha roimh an dáta bunuithe.

28.—(1) Is é an saosúr coiscthe bliantúil i Líomatáiste an Fheabhail an tréimhse a hordófar chun na críche sin nó, mura n-ordaítear aon tréimhse, an tréimhse dár tosach an lú lá de Mheán Fómhair agus dár críoch an 14ú lá d'Aibreán díreach ina dhiaidh sin.
(2) Is é an saosúr coiscthe bliantúil le haghaidh duánachta i Líomatáiste an Fheabhail an tréimhse a hordófar chun na críche sin nó, mura n-ordaítear aon tréimhse, an tréimhse dár tosach an 13ú lá de Dheireadh Fómhair agus dár críoch an 31ú lá d'Eanáir díreach ina dhiaidh sin.
(3) Is é an tráth coiscthe seachtainiúil i Líomatáiste an Fheabhail an tréimhse a hordófar chun na críche sin nó, mura n-ordaítear aon tréimhse, an tréimhse dár tosach an 6 a chlog a.m. ar an Satharn agus dár críoch an 6 a chlog a.m. ar an Luan ina dhiaidh sin.
(4) Féadfar tréimhsí éagsúla d'ordú faoin alt seo i leith coda éagsúla de Líomatáiste an Fheabhail agus, i gcás tréimhse a bheith ordaithe amhlaidh do chuid áirithe den líomatáiste sin, déanfar tagairtí san Acht seo don tsaosúr coiscthe bliantúil, don tsaosúr coiscthe bliantúil le haghaidh duánachta, nó don tráth coiscthe seachtainiúil, d'fhorléiriú maidir leis an gcuid sin mar thagairtí don tréimhse a bheas ordaithe amhlaidh, do réir mar is gá sa chás.

29.—Duine ar bith—
(a) a dhéanfas bradáin nó bric d'iascach, a thógáil nó a mharú nó a dhéanfas iarracht ar iad a thógáil nó a mharú (ach amháin le slat agus ruaim), le linn an tsaosúir choiscthe bhliantúil, nó
(b) a dhéanfas bradáin nó bric d'iascach, a thógáil nó a mharú nó a dhéanfas iarracht ar iad a thógáil nó a mharú le slat agus ruaim le linn an tsaosúir choiscthe bhliantúil le haghaidh duánachta, nó
(c) a chabhrós nó a chuideos le haon ghníomh nó iarracht den tsórt sin,
beidh sé ciontach i gcion i gcoinne an Achta seo.

30.—Duine ar bith a dhéanfas bradáin nó bric d'iascach, a thógáil nó a mharú nó a dhéanfas iarracht ar iad a thógáil nó a mharú (ach amháin le slat agus ruaim) le linn an trátha choiscthe sheachtainiúil, nó a chabhrós nó a chuideos le haon ghníomh nó iarracht den tsórt sin, beidh sé ciontach i gcion i gcoinne an Achta seo.

31.—(1) Duine ar bith a chuirfeas aon bhacainn, a úsáidfeas aon tsás nó a dhéanfas aon ghníomh chun gluaiseacht bhradán nó breac a bhacainniú i rith an tsaosúir choiscthe bhliantúil nó an trátha choiscthe sheachtainiúil, beidh sé ciontach i gcion i gcoinne an Achta seo,
(2) Ní bheidh feidhm ag aon ní san alt seo maidir le hiascach dleathach le slat agus ruaim.

32.—(1) Cuirfidh áititheoir aon innill sheasamhaigh chun bradáin nó bric a thógáil faoi ndear, díreach tar éis tosach an tsaosúir choiscthe bhliantúil agus go dtí deireadh an tsaosúir sin, agus fós le linn an trátha choiscthe sheachtainiúil, go n-aistreofar an t-inneall seasamhach nó go gcuirfear é ó chumas bradáin agus bric a thógáil nó a ngluaiseacht a bhacainniú.
(2) Duine ar bith nach ndéanfaidh do réir an ailt seo, beidh sé ciontach i gcion i gcoinne an Achta seo.
(3) San alt seo ciallaíonn “inneall seasamhach” aon líon, acra, inneall nó feiste, a greamaítear sa talamh nó a daingnítear le hancairí nó a coinnítear leis an láimh nó a déantar fosaidh in aon tslí eile agus a húsáidtear d'aon-toisc chun iasc a thógáil nó mar chabhair chun iasc a thógáil.

33.—Má mhainníonn nó má fhaillíonn duine ar bith a bheas ag gabháil d'iascach bradán nó breac le líonta d'aon tsaghas nó d'aon chineál na líonta sin d'aistriú agus a thabhairt chun siúil ó aon trá nó ó bhruacha aon abhann nó ó na gaobhair le linn an tsaosúir choiscthe bhliantúil, beidh an duine sin ciontach i gcion i gcoinne an Achta seo.

34.—Duine ar bith a dhéanfas aon ní acu seo a leanas le linn an tsaosúir choiscthe bhliantúil nó an trátha choiscthe sheachtainiúl—
(a) a chuirfeas, a ghreamós nó a cheanglós aon líon ar aon chuaille, droichead, sliús nó bual-ghlasa canálach nó ar aon tógála seasamhacha eile den tsórt sin, nó
(b) a leagfas nó a tharraingeos líon ar bith nó a dhéanfas iascach le líon ar bith,
beidh sé ciontach i gcion i gcoinne an Achta seo.

35.—(1) Duine ar bith a cheannós, a dhíolfas, a thaispeánfas chun a dhíolta nó a mbeidh ina sheilbh aige aon bhradán nó breac a gabhadh go neamhdhleathach, beidh sé ciontach i gcion i gcoinne an Achta seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná cúig puint fhichead a chur air, maraon le fíneáil bhreise nach mó ná dhá phunt in aghaidh gach bradáin nó bric a cheannós sé, a dhíolfas sé, a thaispeánfas sé chun a dhíolta nó a gheofar ina sheilbh amhlaidh.
(2) In aon imeachta faoin alt seo, is ar an gcosantóir a bheas sé de dhualgas a chruthú gur gabhadh go dleathach an bradán nó an breac is ábhar do na himeachta.
(3) I gcás duine, is carraera coiteann, a chúiseamh i gcion faoi aon bhradán nó breac a gabhadh go neamhdhleathach a bheith ina sheilbh aige, is cosaint mhaith in aghaidh an chúisimh é dá chruthú—
(a) gur mar charraera coiteann agus nach in aon tslí eile a bhí an bradán nó an breac ina sheilbh aige, agus
(b) an tráth a ghlac sé an bradán nó an breac chun é d'iompar, gur sheachaid an coinsíneoir dó deimhniú i scríbhinn arna shíniú ag an gcoinsíneoir á chur i gcéill gur go dleathach a gabhadh an bradán nó an breac.
(4) Más rud é—
(a) go gcúiseofar duine i gcion faoin alt seo maidir le bradán nó breac, agus
(b) go gcruthóidh sé gnr gabhadh an t-iasc le slat agus ruaim in áit áirithe i rith tréimhse seachas an tréimhse choiscthe bhliantúil le haghaidh duánachta san áit sin, agus
(c) i gcás é a bheith toirmiscthe an t-iasc a ghabháil ach amháin do réir cheadúnais, go gcruthóidh sé gur sealbhóir ceadúnais den tsórt sin a ghabh an t-iasc.

(d) a ghreamós nó a choinneos líonta leanúnacha sínte trasna aon abhann,
beidh sé ciontach i gcion i gcoinne an Achta seo.

38.—(1) Más rud é, ar aon chuid den chósta nó laistigh d'aon bhá, inbhear nó taoide-bhealach dhe, go n-úsáidfidh duine ar bith aon líon lena mbaineann an t-alt seo a mbeidh a mhogall níos lú ná orlach agus trí cheathrú ó shnaidhm go snaidhm, ag tomhas feadh taobh na cearnóige, nó níos lú ná seacht n-orlach, ag tomhas mórthimpeall gach mogaill faoi leith den tsórt sin, an mogall arna thomhas glan agus an líon fliuch, ansin, faoi réir fo-ailt (2) den alt seo, beidh sé ciontach i gcion i gcoinne an Achta seo.
(2) Féadfaidh an Coimisiún, le rialachán faoi alt 13, a cheadú go n-úsáidfí líonta lena mbaineann an t-alt seo a mbeidh tuise a mogall níos lú ná mar a sonraítear i bhfo-alt (1) den alt seo,
(3) San alt seo ciallaíonn an abairt “líon lena mbaineann an t-alt seo” aon líon nó inneall eile nach bhfuil déanta d'ábhar dolúbtha agus a húsáidtear chun bradáin a thógáil.

39.—(1) Má dhéanann duine ar bith (seachas únaer iascaigh eisiaigh laistigh de thórainneacha an iascaigh sin) aon líon a theilgean, a tharraingt nó d'úsáid chun bradáin a thógáil ag béal aon abhann nó i bhfoisceacht leathmhíle, do leith na farraige nó don leith istigh nó feadh an chósta, do bhéal aon abhann, beidh sé ciontach i gcion i gcoinne an Achta seo.
(2) Má dhéanann duine ar bith aon líon a theilgean, a tharraingt nó a shíneadh go hiomlán trasna béil abhann nó trasna aon choda eile d'abhainn, beidh sé ciontach i gcion i gcoinne an Achta seo.
(3) Má thugann rialacháin faoin Acht seo míniú ar bhéal aon fho-abhann, déanfar tagairtí san alt seo do bhéal aon abhann d'fhorléiriú mar thagairtí a fholaíos tagairtí do bhéal na fo-abhann sin.

(2) Duine ar bith a mbeidh aon líon nó uirlis eile nó aon mhealladh nó baoite ina sheilbh nó faoina urláimh aige contrártha don alt seo, beidh sé ciontach i gcion i gcoinne an Achta seo.
(3) Más rud é—
(a) go bhfaighfear aon líon ina seilbh nó faoina urláimh ag duine i ngaobhar don tórainn idir an chuid taoidmhear agus an chuid fíoruisce d'aon abhainn, agus
(b) go gcúiseofar an duine sin, dá bhithin sin, i gcion faoin alt seo,
is cosaint mhaith ar an gcúiseamh sin an duine sin dá chruthú gur sealbhóir é ar cheadúnas chun an líon sin d'úsáid agus go bhfuil beartaithe é d'úsáid sa chuid taoidmhear sin.

41.—(1) San alt seo—
ciallaíonn “pléascán” dionaimít nó substaint phléascach eile;
ciallaíonn “uiscí” aon abha nó aon chuid de chósta na farraige.
(2) Má úsáideann duine ar bith in aon uiscí aon phléascán chun iasc a ghabháil nó a dhíthiú, beidh sé ciontach i gcion i gcoinne an Achta seo.
(3) Duine ar bith a bheas ar bhruach, nó i bhfoisceacht, aon uiscí agus a mbeidh ina sheilbh aige aon phléascán le hintinn é d'úsáid chun iasc a ghabháil nó a dhíthiú, beidh sé ciontach i gcion i gcoinne an Achta seo.
(4) Gach duine a bheas ciontach i gcion faoi fho-alt (2) nó (3) den alt seo dlífear, ar a chiontú ann go hachomair, fíneáil nach mó ná céad punt a chur air nó príosúnacht ar feadh aon téarma nach sia ná dhá mhí dhéag nó an fhíneáil sin agus an phríosúnacht sin le chéile.

42.—(1) Má úsáideann duine ar bith in aon abhainn aon ábhar docharach nó nimhiúil chun iasc a ghabháil nó a dhíthiú, beidh sé ciontach i gcion i gcoinne an Achta seo.
(2) Duine ar bith a bheas ar bhruach, nó i bhfoisceacht, aon abhann agus a mbeidh ina sheilbh aige aon ábhar docharach nó nimhiúil le hintinn é d'úsáid chun iasc a ghabháil nó a dhíthiú, beidh sé ciontach i gcion i gcoinne an Achta seo.

(3) Ní bheidh feidhm ag fo-alt (2) den alt seo maidir le húsáid, seilbh nó urlámh aon ní acu seo a leanas—
(a) ga nach n-úsáidtear nó nach bhfuil le húsáid ach mar chabhair chun duánacht dleathach a dhéanamh idir éirí gréine agus uair a chloig i ndiaidh luí gréine, nó
(b) ga a húsáidtear nó atá le húsáid ag sealbhóir ceadúnais iascaigh i leith aon bhosca i gcora iascaigh nó i muileann-damba iascaigh chun iasc a thógaint as go dleathach agus chuige sin amháin, nó
(c) sleá easconn a húsáidtear chun easconna a thógáil.

45.—Má dhéanann duine ar bith aon abha nó sruthchúrsa a dhambáil, a thaomadh nó d'fholmhú chun aon bhradáin nó bric a thógáil nó a dhíthiú, beidh an duine sin ciontach i gcion i gcoinne an Achta seo.

46.—(1) Gach duine a aistreos nó a chuirfeas faoi ndear go n-aistreofar, in aon tslí, as aon abhainn—
(a) aon bhradáin nó bric a maraíodh ar shlí seachas le modhanna dleathacha, nó
(b) aon bhradáin nó bric a fuair an duine sin agus iad marbh ó chúis ar bith,
beidh sé ciontach i gcion i gcoinne an Achta seo.
(2) Ní bheidh feidhm ag an alt seo maidir le haon duine acu seo a leanas—
(a) aon duine ag gníomhú faoi údarás an Aire, nó
(b) aon chomhalta nó oifigeach den Choimisiún, nó
(c) aon únaer iascaigh nó a ghníomhaire agus é ag gníomhú faoi údarás scríofa an Choimisiúin, nó
(d) chomh fada is bhaineas le haon bhradáin nó bric ghalraithe, nó le haon bhradáin nó bric a gheofar marbh ó aon chúis, d'aistriú nó a chur faoi ndear iad d'aistriú, aon chomhalta den Gharda Síochána nó aon Oifigeach Sláintíochta.

(b) a bhacainneos go toiliúil gluaiseacht ghealóg nó bhláthán bradán nó breac, nó
(c) a dhéanfas díobháil nó corraí ar eochrais nó blátháin bhradán nó bhreac, nó
(d) a dhéanfas díobháil nó corraí ar aon leaba sceite, port nó tanalach a bhféadfadh eochrais nó blátháin bhradán nó bhreac a bheith ann,
beidh sé ciontach i gcion i gcoinne an Achta seo.

49.—(1) Gach duine a thógfas, a mharós, a dhítheos, a cheannós, a dhíolfas, a thaispeánfas chun a dhíolta nó a mbeidh ina choimeád nó ina sheilbh aige tráth ar bith, go toiliúil, aon bhradán nó breac neamhghlan nó neamhshaosúrach, beidh sé ciontach i gcion i gcoinne an Achta seo agus, ar a chiontú ann go hachomair, dlífear fíneáil nach mó ná céad punt a chur air nó príosúnacht ar feadh aon téarma nach sia ná dhá mhí dhéag nó an fhíneáil sin agus an phríosúnacht sin le chéile.
(2) Má cúisítear duine faoi bhradán nó breac a thógáil contrártha don alt seo, is cosaint mhaith a chruthú gur go tionóisceach a tógadh an bradán nó an breac sin agus gur cuireadh ar ais san uisce é, gan é a dhíobháil, díreach tar éis é a thógáil.

51.—Má dhéanann duine ar bith go toiliúil agus go mailíseach aon inneall iascaigh a shuíomh le hintinn iasc a chosc ar dhul isteach i líonta a bheas curtha agus suite go dleathach ag aon duine eile, beidh an duine céad-luaite sin ciontach i gcion i gcoinne an Achta seo.
Rabhadh a thabhairt do dhaoine a bheas ag iascach go neamhdhleathach.
52.—Má dhéanann duine ar bith, nó má chuireann faoi ndear go ndéanfar, aon chomhartha nó rabhadh a thabhairt, nó má chabhraíonn nó má chuidíonn lena thabhairt, d'aon duine a bheas ag iascach go neamhdhleathach á chur in iúl go bhfuil aon chomhalta nó oifigeach den Choimisiún, comhalta den Gharda Síochána, nó faireoir abhann a ceapadh faoi alt 56, ag teacht, beidh sé ciontach i gcion i gcoinne an Achta seo.

53.—(1) Féadfaidh aon únaer iascaigh, trí chumhacht aturnae faoina láimh, gníomhaire a cheapadh chun gníomhú dhó chun críocha an Achta seo.
(2) Gach ní a dtreoraítear leis an Acht seo gur duine áirithe a dhéanfas é nó gur maidir leis a déanfar é, is dleathach a dhéanamh ag, nó maidir le, gníomhaire a cheapfas sé faoin alt seo agus féadfar déileáil i ngach slí leis an ngníomhaire mar d'fhéadfaí déileáil leis an duine sin féin faoin Acht seo.
(3) Beidh ag gach gníomhaire a ceapfar faoin alt seo lán-chumhacht, in ainm agus thar ceann a phríomhaí, páirt a ghlacadh in aon fhiosrúchán nó gníomhú ar aon fhiosrúchán nó aon ghearán, achomharc, caingean, eascaire, agra nó imeacht eile a thabhairt ar aghaidh, nó cur ina choinne, nó é a chosaint nó freastal ar aon chruinniú agus vótáil agus páirt a ghlacadh ann nó aon ghníomh eile a dhéanamh nó d'fhulang chun críocha an Achta seo.

54.—Sa Chuid seo—
ciallaíonn “duine údaraithe” (mura n-éilíonn an comhthéacs a mhalairt) comhalta den Gharda Síochána, comhalta nó oifigeach don Choimisiún nó faireoir abhann príobháideach;
ciallaíonn “oifigeach don Choimisiún” cigire nó faireoir abhann arna cheapadh faoi alt 55;
ciallaíonn “faireoir abhann príobháideach” faireoir abhann arna cheapadh faoi alt 56.
Cigirí agus faireoirí abhann a cheapadh.
55.—(1) Féadfaidh an Coimisiún, le hionstraim faoina ghnáthshéala, duine a cheapadh chun bheith—
(a) ina chigire, nó
(b) ina fhaireoir abhann,
agus féadfaidh an ionstraim sin a chúlghairm.
(2) Ní bheidh dleacht stampa inmhuirir ar ionstraim faoin alt seo.
Daoine ag a bhfuil suim in iascaigh do cheapadh faireoirí abhann.
56.—(1) Gach duine acu seo a leanas—
(a) aon duine ag a bhfuil suim i gcaomhaint éisc aon abhann i Líomatáiste Mhagh Bhile,
(b) aon daoine atá gaite i gcumann le chéile chun aon iascach in aon abhainn den tsórt sin a chaomhaint,
(c) únaer aon iascaigh in aon abhainn den tsórt sin,
(d) únaer aon iascaigh bhradán ar chósta na farraige,
féadfaidh sé ó am go ham, le hionstraim i scríbhinn sa bhfoirm atá leagtha amach sa Chúigiú Sceideal a ghabhas leis an Acht seo, duine ar bith a cheapadh ina fhaireoir abhann chun na hiascaigh ar an gcuid sin de chósta na farraige nó in aon abhainn den tsórt sin nó i suainmheacháin na habhann sin a chosaint.
(2) Aon duine a ceapfar ina fhaireoir abhann faoin alt seo, ní ghníomhóidh sé sa cháil sin go dtí go mbeidh a cheapachán daingnithe (tríd an ionstraim cheapacháin d'fhormhuiniú) ag aon Bhreitheamh Dúiche a mbeidh an faireoir abhann ceaptha chun gníomhú laistigh dá dhúthaigh.
(3) Féadfaidh Breitheamh Dúiche, ar ghearán a dhéanamh leis, ceapachán duine, a bheas ceaptha faoin alt seo, chun gníomhú laistigh dá dhúthaigh, a chúlghairm, agus leis sin beidh deireadh leis an gceapachán.
(4) Má ghníomhaíonn duine ar bith mar fhaireoir abhann príobháideach gan a cheapachán a bheith daingnithe faoi fho-alt (2) den alt seo nó tar éis a cheapachán a bheith culghairmthe faoi fho-alt (3) den alt seo, beidh sé ciontach i gcion i gcoinne an Achta seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná deich bpuint a chur air.
Tórainn le feidhmiú cumhacht.
57.—(1) Ní feidhmeofar na cumhachta a bheirtear leis an gCuid seo d'fhaireoir abhann príobháideach ach amháin chun na hiascaigh a chosaint a bheas sonraithe ina ionstraim cheapacháin.
(2) Ní feidhmeofar na cumhachta a bheirtear leis an gCuid seo do chomhalta nó d'oifigeach don Choimisiún ach amháin chun na hiascaigh i Líomatáiste an Fheabhail a chosaint.
Barántas chun cumhachta d'fheidhmiú.
58.—Is leor-bharántas d'oifigeach don Choimisiún nó d'fhaireoir abhann príobháideach chun na cumhachta a bheirtear dó leis an gCuid seo d'fheidhmiú é do thabhairt a ionstraime ceapacháin faoin gCuid seo ar aird, ach ní gá dhó, chun na cumhachta sin d'fheidhmiú, an ionstraim sin a thabhairt ar aird murar hiarradh air í a thabhairt ar aird.
Cumhachta ginearálta.
59.—(1) Féadfaidh duine údaraithe, chun na hiascaigh a chosaint, gach ní nó aon ní acu seo a leanas a dhéanamh—
(a) dul isteach ar bhruacha nó imill aon aibhneacha a thaithíos bradáin nó bric, nó ar bhruacha nó imill a suainmheachán, agus gabháil tríothu nó ar a bhfeadh,
(b) dul isteach ar aon aibhneacha den tsórt sin le báid nó ar shlí eile,
(c) dul isteach agus iniúchadh a dhéanamh ar gach cora, sliús, muileann-damba, rás muilinn agus sruthchúrsa a cheanglas leis na haibhneacha sin,
(d) dul isteach in aon bhád a bhí nó atá ag gabháil d'iascach nó atá ar tí gabháil d'iascach,
(e) gach líon ar seasamh nó ar snámh agus gach uile líon eile d'iniúchadh,
(f) aon inneall iascaigh neamhdhleathach, nó aon inneall iascaigh dleathach atá á úsáid go neamhdhleathach, d'urghabháil,
(g) gach gníomh agus ní eile a dhéanamh a húdaraítear dó a dhéanamh leis an Acht seo nó faoi.
(2) Ní forléireofar aon ní san alt seo mar ní a údaraíos d'aon duine dul isteach in aon gharraí fálta ná in aon tigh cónaithe ná ina mhaighean ach amháin mar a dtéann an gnáth-bhóthar nó an gnáth-bhealach go dtí aon chora, damba nó díog trasna an gharraí nó na maighne sin.
Cumhacht Feadhmannaigh Síochána chun barántas a thabhairt chun dul isteach in áiteanna áirithe.
60.—(1) Má chítear d'aon Fheadhmannach Síochána, ar fhaisnéis faoi mhionn, go bhfuil cúis réasúnach chun a chreidiúint go ndearnadh sárú ar fhorála an Achta seo nó aon ionstraime faoin Acht seo laistigh d'aon gharraí fálta nó d'aon tigh cónaithe nó dá mhaighean, féadfaidh sé, le barántas faoina láimh, a chumhasú do dhuine údaraithe dul isteach sa gharraí sin nó sa tigh
cónaithe sin nó ina mhaighean, pé trátha de ló nó d'oíche a luafar sa bharántas.
(2) Ní leanfaidh barántas faoin alt seo i bhfeidhm níos sia ná seacht lá ón dáta a bheas air.
Dul ar bord arthaí iascaigh agus iad a scrúdú.
61.—(1) Féadfaidh comhalta nó oifigeach don Choimisiún nó comhalta den Gharda Síochána, faoi réir aon treoruithe agus rialachán a bhéarfas nó a dhéanfas an Coimisiún, gach ní nó aon ní acu seo a leanas a dhéanamh maidir le haon árthach a húsáidtear chun iascaigh—
(a) dul ar bord an árthaigh sin,
(b) deimhniú cláraitheachta agus innill iascaigh an árthaigh sin a scrúdú, agus féachaint ar comhlíonadh forála an Achta seo nó na nAcht Iascaigh agus an bhfuil an máistir nó na daoine eile ar bord ag iascach ar an modh a cheanglas an tAcht seo,
(c) aon inneall iascaigh neamhdhleathach, nó aon inneall iascaigh dleathach a húsáidtear go neamhdhleathach, d'urghabháil.
(2) Má dhiúltaíonn máistir aon árthaigh iascaigh deimhniú cláraitheachta an árthaigh sin a thabhairt ar aird nuair a iarrfas comhalta nó oifigeach don Choimisiún nó comhalta don Gharda Síochána air é, beidh sé ciontach i gcion i gcoinne an Achta seo.
Ciontóirí a ghabháil.
62.—(1) Má gheibhtear, laistigh de Líomatáiste an Fheabhail, aon duine (dá ngairmtear an ciontóir san alt seo) ag ciontú i gcoinne forál na nAcht Iascaigh nó an Achta seo nó i gcoinne dlí chomhréire Thuaisceart Éireann, beidh éifeacht ag na forála seo a leanas:—
(a) féadfaidh duine údaraithe a cheangal ar an gciontóir aon ní nó an dá ní acu seo a leanas a dhéanamh—
(i) scor den chion sin;
(ii) a ainm agus a sheoladh a thabhairt;
(b) más rud é, tar éis an ceangal sin a chur air, go leanfaidh an ciontóir go toiliúil den chion sin nó go mainneoidh nó go ndiúltóidh a ainm agus a sheoladh a thabhairt, féadfaidh an duine údaraithe agus aon daoine a bheas ag gníomhú ar threoruithe uaidh an ciontóir a ghabháil;
(c) i gcás an ciontóir a ghabháil faoin alt seo ag duine údaraithe nach comhalta den Gharda Síochána, déanfaidh an duine sin, faoi réir fo-ailt (2) den alt seo, an ciontóir a thabhairt láithreach i gcoimeád chomhalta den Gharda Síochána chun go ndéanfar leis do réir an dlí.
(2) Má bhíonn cúis ag an duine údaraithe a ghabh an ciontóir, nó ag comhalta den Gharda Síochána ar tugadh an ciontóir ina choimeád, chun a chreidiúint—
(a) gur i dTuaisceart Éireann a chónaíos an ciontóir, agus
(b) gur cion faoi dhlí comhréire Thuaisceart Éireann adúradh an cion,
féadfaidh sé an ciontóir a thabhairt láithreach i gcoimeád chomhalta d'fhórsaí póilíneachta Thuaisceart Éireann chun go ndéanfar leis do réir an dlí sin.
(3) Nuair a tabharfar duine i gcoimeád chomhalta den Gharda Síochána i gcomhlíonadh airbheartach forála de dhlí Thuaisceart Éireann atá ar comhréir leis an alt seo, tógfaidh an comhalta ina choimeád é chun go ndéanfar leis do réir an dlí.
Cumhachta maidir le hinnill iascaigh, etc.
63.—Má gheibheann duine údaraithe—
(a) i rith an tsaosúir choiscthe bhliantúil nó an trátha choiscthe sheachtainiúil—
(i) aon bhealach dúnta nó bacainnithe in aon inneall iascaigh nó in aon tsás, nó
(ii) aon inneall iascaigh nó aon tsás eile d'aon tsórt suite nó á úsáid contrártha don Acht seo nó d'aon ionstraim arna déanamh faoin Acht seo, nó
(b) tráth ar bith, aon bhacainn i mbealach éisc, nó
(c) tráth ar bith, aon bhacainn sa scéith-gheata a ghabhas le haon mhuileann nó monarcha nuair is gá do réir dlí an scéith-gheata sin a bheith ar oscailt,
féadfaidh sé na bealaigh sin d'oscailt agus na bacainní sin d'aistriú, gan aon damáiste neamhriachtanach a dhéanamh, agus gach ní a gheobhaidh amhlaidh nó a bheas á úsáid amhlaidh contrártha d'fhorála na nAcht Iascaigh nó an Achta seo nó aon ionstraime arna déanamh faoin gcéanna d'urghabháil agus d'aistriú.
Cumhachta iniúchta, scrúduithe agus coinneála.
64.—(1) Údaraítear leis seo do gach duine (dá ngairmtear oifigeach údaraithe san alt seo) is comhalta nó oifigeach don Choimisiún nó comhalta den Gharda Síochána gach ní nó aon ní acu seo a leanas a dhéanamh—
(a) aon duine a stopadh agus a chuardach atá, nó a bhfuiltear in amhras é a bheith, ag iompar éisc d'aon tsaghas nó aon uirlise, nimhe nó pléascáin a húsáidtear nó atá ceaptha chun iasc a mharú nó a thógáil go neamhdhleathach agus aon iasc, uirlis nó substaint a gheofar ar iompar ag an duine sin d'iniúchadh agus, chuige sin, aon fheithicil nó pacáiste d'oscailt agus a chuardach a bhfuil, nó a bhfuiltear in amhras go bhfuil, aon iasc, uirlis nó substaint á iompar ann;
(b) gach tráth réasúnach, dul isteach, agus saor-chead a bheith aige istigh—
(i) in aon áitreabh a ndéantar, nó a gcreidtear go go ndéantar, iasc a dhíol, nó a choimeád, a thaispeáint nó a stóráil chun a dhíolta ann, nó
(ii) in aon áitreabh a gcoimeádtar, nó a gcreidtear go gcoimeádtar, ann aon uirlis nó substaint chun iasc a dhíthiú, nó
(iii) in áitreabh aon duine a bhfuil gnó ar siúl aige ag iompar earraí ar luaíocht, nó
(iv) in aon aeradróm, piara, cé, caladh, lamairne nó duga nó in aon áitreabh ar an gcéanna, nó
(v) in aon loing, bád, aerárthach, bhaigín iarnróid, mótar-loraí, cairt, nó árthach nó feithicil eile a húsáidtear chun earraí d'iompar;
(c) an t-iasc go léir a scrúdú a gheofar in aon áit a n-údaraítear dó leis an alt seo dul isteach ann agus chuige sin aon phacáiste d'oscailt a gheofar san áit sin agus a mbeidh iasc ann nó a mbeifear in amhras iasc a bheith ann;
(d) aon bhád a stopadh agus dul isteach inti agus í a chuardach, ar aon abhainn nó ar bhruacha aon abhann nó in aon chuid den fharraige nó de bhruacha na farraige, a húsáidtear, nó a bhfuiltear in amhras í a bheith á húsáid, le haghaidh iascaigh, nó a bhfuil, nó a bhfuiltear in amhras go bhfuil, iasc inti a gabhadh go neamhdhleathach agus an t-iasc go léir agus na hinnill iascaigh go léir a scrúdú a gheofar inti agus chuige sin aon phacáiste d'oscailt a bhfuil, nó a bhfuiltear in amhras go bhfuil, aon iasc nó inneall iascaigh ann;
(e) aon iasc a thógáil, d'aistriú agus a choinneáil faoina choimeád (i dteannta nó d'éagmais aon phacáiste ina mbeidh sé) a gheofar le linn aon chumhacht a bheirtear leis an alt seo d'fheidhmiú agus a bhfuil, nó a bhfuiltear in amhras go bhfuil, cion faoin Acht seo á dhéanamh ina leith nó a gabhadh, nó a bhfuiltear in amhras gur gabhadh é, go neamhdhleathach;
(f) aon inneall iascaigh nó aon earra a thógáil, d'aistriú agus a choinneáil faoina choimeád a dlitear, nó a gcreidtear go ndlitear, é d'fhorghéilleadh faoi na hAchta Iascaigh nó faoin Acht seo;
(g) ainm agus seoladh an duine d'éileamh agus a thógaint a bhfuil faoina choimeád aon iasc nó earra eile a húdaraítear faoin alt seo don oifigeach údaraithe a scrúdú agus fós ainm agus seoladh únaer an éisc nó na hearra eile sin d'éileamh agus a thógaint ón duine sin.
(2) Má choinníonn oifigeach údaraithe aon iasc nó earra eile faoina choimeád faoi údarás an ailt seo, déanfaidh sé, a luaithe is féidir, pé bearta is cuí chun go ndéanfar do réir an dlí leis an duine atá ciontach, nó a bhfuiltear in amhras é a bheith ciontach, sa chion a rinneadh, nó a bhfuiltear in amhras go ndearnadh é, maidir leis an iasc nó an earra eile sin.
(3) Má choinníonn oifigeach údaraithe aon iasc faoina choimeád faoi údarás an ailt seo agus gur dóigh don iasc sin éirí neamhoiriúnach chun duine dá ithe sara bhféadfadh aon Chúirt déileáil go caothúil leis an gcúis, bhéarfaidh sé an t-iasc sin ar aird d'Fheadhmannach Síochána agus, má údaraíonn an Feadhmannach Síochána sin dó é, déanfaidh an t-iasc sin a dhíthiú nó a dhiúscairt ar shlí eile.
(4) Aon Fheadhmannach Síochána a dtabharfar aon iasc ar aird dó de bhun an ailt seo, bhéarfaidh sé don duine a bhéarfas an t-iasc ar aird, más dóigh leis gur ceart sna himthosca áirithe an t-iasc a dhíthiú nó a dhiúscairt ar shlí eile, deimhniú i scríbhinn ina dtuairisceoidh an t-iasc agus aon mharcanna, sainiúlachta nó sonraí eile maidir leis a chuirfeas an duine sin in iúl do, agus ina n-údaróidh don duine sin an t-iasc sin a dhíthiú nó a dhiúscairt ar shlí eile, agus beidh an deimhniú sin ina fhianaise dochlóite ar gach pointe fíorais den tsórt adúradh a bheas luaite ann.
(5) Gach duine a dhiúltós a ainm agus a sheoladh féin nó ainm agus seoladh aon duine eile (chomh fada agus is eol dó é) a thabhairt nuair a héileofar sin air go dleathach faoin alt seo, beidh sé ciontach i gcion i gcoinne an Achta seo.
An nós imeachta i gcás innill iascaigh neamh dhleathacha, agus innill iascaigh dleathacha a húsáidtear go neamhdhleathach, d'urghabháil.
65.—Má dhéanann duine ar bith, i bhfeidhmiú na gcumhacht a bheirtear dó leis an gCuid seo, aon inneall iascaigh d'urghabháil sa Stát, bhéarfaidh sé é, a luaithe is féidir, i láthair an Bhreithimh Dúiche ar ina dhúthaigh a hurghabhadh é, agus, air sin, beidh éifeacht ag na forála seo a leanas—
(a) má chinneann an Breitheamh Dúiche gur inneall iascaigh é a dtoirmisctear leis an dlí é d'úsáid, ordóidh sé é d'fhorghéilleadh agus a dhíthiú,
(b) má chinneann an Breitheamh Dúiche gur inneall iascaigh dleathach an t-inneall iascaigh agus go rabhthas tar éis é d'úsáid, á úsáid nó ar tí é d'úsáid go neamhdhleathach in aon chuid de Líomatáiste an Fheabhail, ordóidh sé é d'fhorghéilleadh,
(c) má chinneann an Breitheamh Dúiche gur inneall iascaigh dleathach an t-inneall iascaigh agus nach rabhthas, tráth a urghabhála, tar éis é d'úsáid, á úsáid ná ar tí é d'úsáid go neamhdhleathach mar adúradh, ordóidh sé é a thabhairt ar ais don duine ar dóigh leis gurb é a únaer é.
Cosaint do dhaoine údaraithe.
66.—Ní bheidh aon duine údaraithe faoi dhliteanas mar gheall ar aon chaillteanas nó damáiste de dhroim, nó i gcúrsa, aon chumhachta dá dtugtar dó leis an gCuid seo d'fheidhmiú mura go faolrasach nó go mailíseach a tharraing sé an caillteanas nó an damáiste sin.
Pionós mar gheall ar dhaoine údaraithe d'ionsaí nó a chosc.
67.—Má ionsaíonn, má choisceann nó má bhacann duine ar bith aon duine a bheas ag feidhmiú aon chumhachta dá dtugtar leis an gCuid seo, beidh sé ciontach i gcion i gcoinne an Achta seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná fiche punt a chur air nó príosúnacht ar feadh aon téarma nach sia ná dhá mhí nó an fhíneáil sin agus an phríosúnacht sin le chéile.
CUID VIII.
Imeachta Dlithiula.

68.—Baineann forála an Achta seo i dtaobh cionta—
(a) le gníomhartha agus neamhghníomhartha i Líomatáiste an Fheabhail ag aon duine, agus
(b) le gníomhartha agus neamhghníomhartha in aon chuid de Líomatáiste an Fheabhail ag aon duine a chónaíos sa Stát.
Pionóis mar gheall ar chionta.
69.—(1) Aon duine a dhéanfas cion i gcoinne an Achta seo nach bhforáltar pionós dó le haon fhoráil eile den Acht seo, dlífear, ar a chiontú ann go hachomair, fíneáil nach mó ná caoga punt a chur air agus, i gcás ciona leanúnaigh, fíneáil bhreise nach mó ná cúig puint in aghaidh gach lae a leanfas sé den chion tar éis a chiontuithe.
(2) Féadfaidh an Coimisiún pionóis airgid d'ordú i leith sáruithe ar rialachán áirithe a bheas níos lú ná na pionóis a foráltar faoi fho-alt (1) den alt seo agus in aon chás den tsórt sin forléireofar an fo-alt sin amhail is dá gcuirtí na pionóis ísle sin in ionad na bpionós a foráltar amhlaidh.
Cosaint do ghníomhartha a déanfar i gcóir síolruithe shaorga chun críocha eolaíochta nó chun iascaigh d'fheabhsú.
70.—Ní thoirmiscfidh aon ní san Acht seo aon rud a dhéanfas an Coimisiún, nó aon duine a bheas údaraithe chuige sin roimh ré i scríbhinn ag an gCoimisiún, chun iasc a shíolrú go saorga, chun críche eolaíochta éigin nó chun aon iascach d'fheabhsú.

71.—Chun críocha na Coda seo, measfar comhlucht corpraithe a bheith ina chónaí sa Stát m bhíonn sé corpraithe faoi dhlithe an Stáit.

72.—I gcás ina ndearna comhlucht corpraithe cion i gcoinne an Achta seo agus ina gcruthófar go ndearnadh amhlaidh é le toiliú nó le haontú, nó gur hurasaíodh a dhéanamh de dheasca faillí, aon duine is stiúrthóir, bainisteoir, rúnaí nó oifigeach eile don chomhlucht corpraithe, beidh an duine sin freisin ciontach sa chion agus féadfar imeachta a thionscnamh ina choinne agus é a phionósúdá réir.

73.—D'ainneoin aon ní in aon achtachán eile, féadfaidh an Chúirt Dúiche cion i gcoinne an Achta seo d'éisteacht agus a chinneadh, ar ghearán, de bhriartha béil nó eile, ón gCoimisiún nó ó oifigeach don Choimisiún nó ó chomhalta den Gharda Síochána, ach ní ó aon duine eile ach amháin le toiliú an Choimisiúin.

74.—(1) Má mínítear le haon rialacháin—

(d) an pointe nó na pointí chun a ndéanfar nó óna ndéanfar faideanna slí a thomhas faoin Acht seo,
is mar mínítear amhlaidh a bheas an béal, an tórainn, an pointe nó na pointí sin chun críocha aon imeacht faoin Acht seo.
(2) Má mínítear le haon rialacháin an spás a dtoirmisctear leis an Acht seo, nó faoi, innill iascaigh áirithe d'úsáid laistigh de, measfar, chun críocha aon imeacht faoin Acht seo gurb é an spás a mínítear amhlaidh an líomatáiste a dtoirmisctear na hinnill iascaigh sin d'úsáid laistigh de.

75.—(1) (a) Má déantar an duine is sealbhóir ar cheadúnas d'eisigh an Coimisiún a chiontú i gcion lena mbaineann an fo-alt seo, féadfaidh an Chúirt a threorú an ceadúnas d'fhorghéilleadh agus a dhearbhú an duine sin a bheith dícháilithe chun ceadúnas ón gCoimisiún a shealbhú go ceann pé tréimhse, nach sia ná bliain, a threorós an Chúirt.
(b) Baineann an fo-alt seo—
(i) le cion faoi aon alt den Acht seo,
(ii) le cion faoi aon alt de na hAchta Iascaigh.
(2) I gcás duine is sealbhóir ar cheadúnas d'eisigh an Coimisiún a chiontú ag cúirt bhreithiúnais i dTuaisceart Éireann i gcion faoin dlí de chuid Tuaisceart Éireann a bhaineas le hiascaigh agus, de dhroim an chiontuithe sin, go ndearbhófar an ceadúnas a bheith forghéillte agus go ndearbhófar an duine sin a bheith dícháilithe go ceann tréimhse áirithe chun ceadúnas ón gCoimisiún a shealbhú, treoróidh an Coimisiún an ceadúnas d'fhorghéilleadh agus beidh an duine sin dícháilithe chun ceadúnas a shealbhú go ceann na tréimhse sin.
(3) I gcás ina dtreorófar ceadúnas d'fhorghéilleadh faoin alt seo, scoirfidh an ceadúnas, air sin, de bheith i bhfeidhm.
(4) I gcás duine a chiontú ag Cúirt i gcion i gcoinne an Achta seo nó faoi aon fhoráil de na hAchta Iascaigh, cuirfidh cláraitheoir nó cléireach na Cúirte cóip den chiontú, arna dheimhniú do réir na rialacha Cúirte, chun an Choimisiúin a luaithe is féidir.
(5) Aon doiciméad a airbheartós gur cóip í de chiontú nó d'ordú a rinne cúirt bhreithiúnais i dTuaisceart Éireann agus a bheith deimhnithe do réir dlí Thuaisceart Éireann, beidh sé, chun críocha an ailt seo, ina fhianaise ar an gciontú nó ar an ordú sin gan a thuilleadh cruthúnais, mura gcruthaítear a mhalairt.

76.—I gcás duine a chiontú i gcion i gcoinne an Achta seo, beidh aon iasc a bheas go neamhdhleathach tógtha nó ina sheilbh aige tráth an chiona, agus fós aon inneall iascaigh nó aon rud ar leis nó ina leith a rinneadh an cion, ar forghéilleadh mar iarmairt reachtúil de dhroim ciontuithe.
Gan a bheith d'oblagáid ar an gCúirt forghéilleadh d'fhógairt ná a thaifeadadh.
77.—I gcás rud áirithe a bheith ar forghéilleadh mar iarmairt reachtúil dedhroim ciontuithe faoin Acht seo, ansin, d'ainneoin aon rialach dlí, ní gá don Chúirt—
(a) an forghéilleadh sin d'fhógairt tráth an bhreithnithe, ná
(b) an forghéilleadh sin a thaifeadadh i Leabhar Miontuairisce na Cúirte Dúiche ná san ordú ciontuithe.
Diúscairt fíneála.
78.—(1) Baineann an t-alt seo le gach fíneáil a forchuirfear i leith ciona faoi aon alt den Acht seo.
(2) Ní bhainfidh alt 51 den Acht Oifigigh Cúirte, 1926 (Uimh. 27 de 1926), le fíneáil lena mbaineann an t-alt seo.
(3) Déanfar gach fíneáil lena mbaineann an t-alt seo d'íoc isteach sa Stát-Chiste nó a chur chun tairbhe don Stát-Chiste i pé slí a ordós an tAire Airgeadais.
(4) I gcás fíneáil lena mbaineann an t-alt seo a loghadh go hiomlán nó go páirteach tar éis í d'íoc isteach sa Stát-Chiste nó a chur chun tairbhe don Stát-Chiste faoi fho-alt (3) den alt seo, déanfar an fhíneáil sin nó an chuid di a loghadh amhlaidh (pé acu é) d'aisíoc as an Stát-Chiste i pé slí a ordós an tAire Airgeadais.

79.—(1) Baineann an t-alt seo—
(a) le cion faoi aon alt den Acht seo, agus
(b) le cion, faoi aon fhoráil lena mbaineann alt 10 den Acht Iascaigh (Leasú), 1949 (Uimh. 18 de 1949), a rinneadh i Líomatáiste an Fheabhail.
(2) I gcás fíneáil, a forchuireadh i leith ciona lena mbaineann an t-alt seo, d'íoc nó a thobhach, ansin, mura rud é gur loghadh an fhíneáil go hiomlán, beidh feidhm ag na forála seo a leanas—
(a) má chítear don Aire gur comhalta den Gharda Síochána faoi ndear an duine a rinne an cion a thabhairt faoi réim an cheartais, déanfar—
(i) suim is comhionann le dhá dtrian na fíneála nó, má loghadh an fhíneáil go páirteach, le dhá dtrian an mhéid di nár loghadh, d'íoc leis an gCoimisiún, agus
(ii) suim is comhionann le trian na fíneála nó, má loghadh an fhíneáil go páirteach, le trian an mhéid di nár loghadh, d'íoc isteach i gCiste Luaíochta an Gharda Síochána;
(b) in aon chás eile, íocfar leis an gCoimisiún suim is comhionann leis an bhfíneáil nó, má loghadh an fhíneáil go páirteach, leis an méid di nár loghadh.
(3) An t-airgead go léir is iníoctha faoi fho-alt (2) den alt seo, íocfaidh an tAire é, pé trátha is oiriúnach leis, as airgead a sholáthrós an tOireachtas.

80.—(1) I gcás aon ní d'fhorghéilleadh faoin Acht seo, féadfaidh an tAire a threorú é a dhíol nó é a dhiúscairt ar chuma eile i pé slí is oiriúnach leis nó é a thabhairt ar ais don duine ar dóigh leis gurb é a únaer é.
(2) Déanfar glan-fháltas aon díola faoi fho-alt (1) den alt seo d'íoc isteach sa Stát-Chiste nó a chur chun tairbhe don Stát-Chiste i pé slí a threorós an tAire Airgeadais.
(3) (a) Má chítear don Aire gur comhalta den Gharda Síochána d'urghabh ní áirithe a forghéilleadh faoi alt 76 nó faoi aon fhoráil lena mbaineann alt 15 den Acht Iascaigh (Leasú), 1949 (Uimh. 18 de 1949), mar iarmairt reachtúil de dhroim ciontuithe i leith ciona a rinneadh i Líomatáiste an Fheabhail, nó gurb é faoi ndear an duine a thabhairt faoi réim an cheartais a ciontaíodh sa chion dá dtáinig an forghéilleadh, ansin, déanfar suim is comhionann le dhá dtrian an ghlanfháltais dá dtagartar i bhfo-alt (2) den alt seo d'íoc leis an gCoimisiún agus suim is comhionann le trian d'íoc le Ciste Luaíochta an Gharda Síochána.
(b) In aon chás eile déanfar suim is comhionann leis an nglanfháltas d'íoc leis an gCoimisiún.
(4) An t-airgead go léir is iníoctha faoi fho-alt (3) den alt seo, íocfaidh an tAire é, pé trátha is oiriúnach leis, as airgead a sholáthrós an tOireachtas.
Cruthú ar rialacháin, fo-dhlithe, etc.
81.—(1) Aon doiciméad a airbheartós gur cóip é d'aon ionstraim i scríbhinn arna déanamh nó arna heisiúint (pé acu roimh dháta an Achta seo a rith nó dá éis sin é) faoi na hAchta Iascaigh nó faoin Acht seo i leith Líomatáiste an Fheabhail nó aon choda dhe, beidh sé, má bhíonn deimhnithe faoi ghnáthshéala an Choimisiúin é a bheith ina chóip dhílis, ina fhianaise prima facie, in aon imeachta, ar an ionstraim.
(2) Bainfidh alt 4 den Acht um Fhianaise Scríbhinne, 1925 (Uimh. 24 de 1925), le rialacháin a dhéanfas an Coimisiún faoin Acht seo.
Fiosrúcháin.
82.—(1) Féadfaidh an Coimisiún ó am go ham fiosrúchán a dhéanamh i dtaobh na n-iascach i Líomatáiste an Fheabhail nó i dtaobh aon cheann acu agus i dtaobh na meán is fearr a ghlacadh chun an céanna a bhainistí, a chaomhaint, a chosaint nó d'fheabhsú.
(2) Féadfaidh an Coimisiún féin nó duine a cheapfas an Coimisiún chuige sin fiosrúchán a stiúrú.
Cumhachta maidir le fiosrúchán.
83.—(1) Féadfaidh an Coimisiún nó an duine a bheas ag déanamh fiosrúcháin—
(a) finnéithe a thoghairm chun teacht i láthair ag an bhfiosrúchán,
(b) aon fhinnéithe a bheas i láthair ag an bhfiosrúchán a cheistiú faoi mhionn (agus údaraítear leis seo d'aon chomhalta den Choimisiún nó don duine sin, do réir mar bheas, daoine a chur faoi mhionn),
(c) a cheangal ar aon fhinné aon doiciméid a thabhairt ar aird a bheas faoina chumhacht nó faoina urláimh agus a mheasfas an Coimisiún nó an duine sin, do réir mar bheas, a bheith riachtanach chun críocha an fhiosrúcháin.
(2) Beidh teideal ag finné ag fiosrúchán chun na saoirsí agus na bpribhléidí céanna chun a mbeadh teideal aige dá mb'fhinné i láthair na hArd-Chúirte é.
(3) Duine ar bith—
(a) a mhainneos teacht i láthair ar é a thoghairm go cuí chun teacht i láthair mar fhinné ag fiosrúchán, nó
(b) a dhiúltós, ar é a bheith i láthair, mionn a thabhairt a ceanglófar air go dleathach a thabhairt, nó aon doiciméad a thabhairt ar aird a bheas faoina chumhacht nó faoina urláimh agus a ceanglófar air go dleathach a thabhairt ar aird nó aon cheist a fhreagairt a ceanglófar air go dleathach a fhreagairt,
beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná cúig puint fhichead a chur air.

AN DARA SCEIDEAL.
DREACHT-THEARMAI COMHAONTUITHE ATA LE DEANAMH IDIR AN CUMANN ÉIREANNACH MAR DHIOLTOIR AGUS AN tAIRE AGUS AN AIREACHT MAR CHEANNAITHEOIRI.
1. (1) Díolann an Cumann Éireannach agus ceannaíonn na ceannaitheoirí ar an gcomaoin a luaitear anseo ina dhiaidh seo eastát ceart teideal agus leas uile an Chumainn Éireannaigh chucu seo a leanas agus iontu—
(a) an feo simplí seilbhe saor ó eirí ar iascach eisiach sna coda taoidmheara de Loch agus Abha an Fheabhail agus dá shuainmheachán Abha an Fhachain (mar taispeántar faoi dhath buí ar an léarscáil a hullmhaíodh i dtripleacáid agus ar ar ghreamaigh na páirtithe sa Chomhaontú seo a séalaí chun a haithinte díreach roimh an gComhaontú seo d'fhorghníomhú) lasmuigh de na cearta sin i ngrian agus i ngrinneall an chéanna a gcomhaontaítear i mír 2 de seo iad a mhúchadh agus faoi réir a luaitear i míreanna 3 agus 4 de seo;
(b) na tailte a theachtas an Cumann Éireannach chun críocha nó i leith an iascaigh eisiagh sin agus a tuairiscítear níos cruinne san iarscríbhinn a ghabhas leis an gComhaontú seo saor ó eirí ach amháin mar luaitear i mír 3 de seo do réir na n-eastát agus na dteideal ar leithligh chun a bhfuilid agus faoina bhfuilid faoi seach ar teachtadh agus ar sealúchas;
(c) na líonta seasamhacha nó na hinnill seasamhacha eile go léir d'aon tsaghas is leis an gCumann Éireannach agus atá sna huiscí taoide sin; agus
(d) na héasúintí, na seach-éasúintí, na cóiríochta agus na cearta eile go léir atá ar únaeracht ar úsáid nó ar sealúchas ag an gCumann Éireannach chun críocha nó i leith an iascaigh eisiaigh sin thar trasna nó ar aon tailte seachas na tailte a luaitear go sainráiteach sa Chomhaontú seo.
(2) Is é comaoin an díola sin na Ceannaitheoirí d'íoc suime £106,885 leis an gCumann Éireannach (maille le hús ar £102,485 cuid den tsuim sin, arna ríomh do réir trí faoin gcéad sa bhliain ón gcéad lá de Mhárta, 1951, go dtí dáta an Chomhaontuithe seo) (suim agus ús a n-admhaíonn an Cumann Éireannach leis seo a bhfáil).
2. I gcomaoin na suime adúradh d'íoc leis toilíonn agus comhaontaíonn an Cumann Éireannach tríd seo eastát ceart teideal agus leas uile an Chumainn Éireannaigh chun agus i leith grian agus grinneall agus urthrá na coda taoidmhire de Loch agus Abha an Fheabhail adúradh agus na coda taoidmhire d'Abhainn an Fhachain (coda taoidmheara a taispeántar faoi dhath buí ar an léarscáil sin) a mhúchadh trí reachtaíocht agus scaoileann agus urscaoileann tríd seo na ceannaitheoirí agus gach uile dhuine eile in aghaidh agus i gcoinne gach caingin agra agus éilimh ag an gCumann Éireannach (pé acu le haghaidh cúitimh nó eile é) i leith nó de dhroim an mhúchta sin nó an dídhílsithe ar aon eastát ceart teideal nó leas eile leis an gCumann Éireannach chun na gcoda taoidmheara sin nó iontu nó tharstu de bhuaidh oibriú aon reachtaíochta den tsórt sin.
3. Raghaidh an Cumann Éireannach ar a chostas féin nuair a iarrfas na ceannaitheoirí é faoi chúnant a bheas ina cheangal ar an gCumann Éireannach agus ar a chomharbaí i dteideal leis na ceannaitheoirí agus le gach duine acu lena gcomharbaí i dteideal agus le gach duine acu go ndéanfar an cíos-mhuirear de £250 sa bhliain a socraíodh ar Thiarna-Easpag Dhoire agus a chomharbaí go deo le Reacht 3 agus 4 Anne Caibidil I agus an cíos-mhuirear de £12 a socraíodh ar an Easpag sin de bhuaidh Gníomhais Aonpháirtí dar dáta an 11ú Bealtaine, 1705, a mhuirearú ar an gcuid sin de mhaoin an Chumainn Éireannaigh a roghnós na ceannaitheoirí agus d'intinn go ndéanfaidh an Cumann Éireannach agus a chomharbaí i dteideal na cíosmhuirir sin d'íoc ag dímhuirearú na gCeannaitheoirí agus a gcomharbaí i dteideal go hiomlán agus ag slánú na dtailte agus na maoine a díoltar tríd seo agus na n-eastát na gceart an teidil agus na leas a comhaontaítear i mír 2 de seo a mhúchadh trí reachtaíocht agus na gCeannaitheoirí agus gach duine acu agus a gcomharbaí i dteideal agus gach duine acu in aghaidh agus i gcoinne íoca an chéanna nó aon choda dhe agus i gcoinne gach imeachta costais damáiste éilimh agus dliteanais de dheasca an céanna nó aon chuid de a bheith gan íoc.
4. Ní dhéanfaidh aon ní sa chomhaontú seo dochar ná difir d'aon cheart a bhí dílsithe díreach roimh an gcomhaontú seo d'fhorghníomhú in aon duine seachas an Cumann Éireannach chun inneall seasamhach d'úsáid faoi dheimhniú arna dheonadh faoi Alt a sé den Salmon Fishery (Ireland) Act, 1863.
5. Oibreoidh an Comhaontú seo amhail is dá mbeadh cúnaint ann ón gCumann Éireannach:—
(a) maidir leis an iascach eisiach a tuairiscítear i mír 1 (a) de seo, nár fhorghníomhaigh ná nach ndearna an Cumann Éireannach ná nár fhulaing go feasach aon ghníomhas ná rud, ná nach raibh ina pháirtí ná inpháirteach in aon ghníomhas ná rud, trína bhfuiltear nó trína bhféadfadh sé go mbeifí ag táinseamh, ag muirearú nó ag eiriú an iascaigh eisiaigh sin nó aon choda dhe nó ag déanamh difir dó i leith teidil eastáit nó eile nó trína mbactar in aon tslí ar an gCumann Éireannach an t-iascach eisiach sin nó aon chuid de a dhíol agus a thíolacadh mar déantar leis an gcomhaontú seo,
(b) maidir leis na tailte a tuairiscítear i mír 1 (b) de seo, i dtéarmaí mar is intuigthe i gcás tíolacais ar chomaoin luachmhar nach morgáiste (lena n-áirítear maidir le maoin léasach an cúnant breise i leith a sannta) ó dhuine atá ag tíolacadh agus a sainráitear é bheith ag tíolacadh mar únaer tairbhiúil.

AN TRIU SCEIDEAL.
Coimisiun Iascaigh an Fheabhail.
1. Beidh an Coimisiún ina chomhlucht corpraithe le comharbas suthain agus gnáthshéala agus cumhacht agartha agus chun bheith inagartha agus cumhacht chun talamh a thógaint agus a theachtadh gan ceadúnas faoi mhortláimh.
2. I dteannta aon chumhacht agus gan dochar d'aon chumhachta a bheirtear dó faoi aon fhoráil eile den Acht seo, beidh cumhacht ag an gCoimisiún aon ní acu seo a leanas a dhéanamh—
(a) imeachta dlíthiúla a thionscnamh chun aon fhoráil san Acht seo, nó in aon rialacháin a déanfar faoin Acht seo, a chur i bhfeidhm;
(b) aon iascach nó aon bhunachas chun bradáin, bric nó iasc fíoruisce eile a shíolrú nó d'oiliúint go saorga a cheannach nó a ghlacadh ar léas agus aon iascach agus aon bhunhachas den tsórt sin d'oibriú;
(c) an t-airgead go léir a híocfar leis an gCoimisiún d'úsáid agus a chaiteamh, faoi réir forál an Achta seo, i pé slí is cuí leis an gCoimisiún chun na hiascaigh i Líomatáiste an Fheabhail a rialú, a bhainistí, a chothabháil nó d'fheabhsú;
(d) pé oibreacha agus nithe a dhéanamh is dóigh leis an gCoimisiún is oiriúnach chun críocha a fheidhmeanna.
3. 4. Déanfaidh an Coimisiún aon airgead barrachais a bheas ar láimh aige de thuras na huaire a dhiúscairt i pé slí a threorós an tAire agus an Aireacht ó am go ham i gcomhar le chéile.
5. Beidh an Coimisiún comhdhéanta de cheathrar comhaltaí ar comhaltaí sinsearacha beirt acu agus ar comhaltaí sóisearacha beirt acu.
6. (1) Ceapfaidh an tAire comhalta sinsearach amháin agus comhalta sóisearach amháin agus ceapfaidh an Aireacht an comhalta sinsearach agus an comhalta sóisearach eile.
(2) Déanfar gach comhalta, ach amháin comhalta a ceapfar chun corrfholúntas a líonadh, a cheapadh go ceann tréimhse cúig bliana.
(3) Má tharlaíonn corrfholúntas i measc na gcomhaltaí déanfaidh an t-údarás a cheap an comhalta a chuaigh as oifig duine a cheapadh chun an folúntas a líonadh.
(4) Beidh an duine a ceapfar amhlaidh i seilbh oifige ar feadh na coda eile den tréimhse a bheadh a réamhtheachtaí i seilbh oifige dá leanadh sé de bheith ina chomhalta.
(5) Féadfar comhalta a bheas ag dul as oifig d'athcheapadh.
7. (1) Is é an chéad chathaoirleach a bheas ar an gCoimisiún an comhalta sinsearach sin a thoghfas na comhaltaí. Má bhíonn an bheirt ar cothrom toghfar é trí chrannchur.
(2) Beidh an chéad chathaoirleach i seilbh oifige go dtí deireadh an chéad bhliain dá théarma oifige mar chomhalta.
(3) Ag deireadh na bliana sin, beidh an comhalta sinsearach eile ina chathaoirleach go ceann tréimhse bliana, agus as san amach beidh seilbh na hoifige, go ceann bliana, ag gach re duine de na comhaltaí sinsearacha.
(4) Má scoireann duine de bheith ina chomhalta i rith a théarma oifige mar chathaoirleach, beidh an duine a ceapfar mar chomhalta ina ionad i seilbh oifige mar chathaoirleach go ceann na coda eile den téarma sin.
8. (1) Beidh rúnaí ag an gCoimisiún.
(2) Is é a bheas ina rúnaí an comhalta sóisearach a ceapadh chun an Choimisiúin ag an údarás nár cheap an comhalta sinsearach is cathaoirleach de thuras na huaire.
9. Féadfaidh an t-údarás a cheap comhalta an comhalta sin a chur as oifig, agus féadfaidh comhalta éirí as oifig trí litir a seolfar chun an údaráis a cheap é.
10. Beidh oifig sa Stát agus oifig i dTuaisceart Éireann ag an gCoimisiún.
11. (1) Déanfar gnáthshéala an Choimisiúin, nuair a cuirfear ar dhoiciméad é, d'fhianú le síniú comhalta amháin a cheap an tAire agus comhalta amháin a cheap an Aireacht.
(2) Bhéarfar aird bhreithiúnach ar ghnáthshéala an Choimisiúin agus glacfar i bhfianaise gach doiciméad a airbheartós a bheith ina ionstraim arna déanamh ag an gCoimisiún agus a bheith séalaithe le gnáthshéala an Choimisiúin agus a bheith fianaithe do réir na míre seo, agus measfar, gan a thuilleadh cruthúnais, gurb í an ionstraim sin í, mura gcruthaítear a mhalairt.
12. Aon chonradh nó ionstraim nár ghá a bheith faoi shéala dá mba phearsa a dhéanfadh nó d'fhorghníomhódh é, féadfaidh aon duine a bheas údaraithe go ginearálta nó go speisialta ag an gCoimisiún chuige sin é a dhéanamh nó d'fhorghníomhú thar ceann an Choimisiúin.
13. (1) Beirt is córam do chruinniú den Choimisiún, duine acu ina chomhalta a cheap an tAire agus an duine eile ina chomhalta a cheap an Aireacht.
(2) Déanfar gach ceist a éireos ag cruinniú a chinneadh le vótaí thromlach na gcomhaltaí a bheas i láthair agus a vótálfas.
(3) I gcás comhionannas vótaí ag cruinniú ag a mbeidh na comhaltaí go léir i láthair agus ag a vótálfaid, beidh an dara vóta nó vóta réitigh ag an gcathaoirleach.
(4) Faoi réir fo-mhíre (1), féadfaidh an Coimisiún gníomhú d'ainneoin folúntas ina chomhaltas.
(5) Faoi réir forál an Sceidil seo, féadfaidh an Coimisiún, le buan-orduithe nó ar shlí eile, a nós imeachta agus a ghnó a rialú.
14. Coimeádfaidh an rúnaí miontuairiscí ar imeachta an Choimisiúin agus beidh de cheart ag gach comhalta den Choimisiún na miontuairiscí d'iniúchadh agus sleachta a thógaint astu.
15. Féadfaidh an Coimisiún aon talamh a cheannach agus a thógaint ar léas, agus aon áitreabh a dhéanamh, a threalmhú agus a chothabháil, is dóigh leis is gá chun a fheidhmeanna a chomhlíonadh agus féadfaidh aon talamh nó áitreabh den tsórt sin nach mbeidh ag teastáil uaidh a thuilleadh chun na críche sin a dhíol nó a léasú.
16. (1) Féadfaidh an Coimisiún pé foireann d'fhostú is dóigh leis is gá chun a fheidhmeanna a chomhlíonadh.
(2) Is mar chinnfeas an Coímisiún, le haontú an Aire agus na hAireachta, a bheas líon, gráid agus luach saothair agus coinníollacha fostaíochta comhaltaí na foirne.
(3) Ar an dáta bunuithe, beidh na daoine a bhí, díreach roimh an dáta sin, ar fostú ag Bord Mhagh Bhile nó ag an mbord coimeádaithe do Cheantar Dhoire ina gcomhaltaí d'fhoireann an Choimisiúin ar na coinníollacha céanna ar a rabhadar ar fostú amhlaidh.
17. (1) Déanfar suas cuntais an Choimisiúin go dtí an 30ú lá de Mheán Fómhair gach bliain.
(2) Déanfar na cuntais do gach bliain d'iniúchadh ag iniúchóir a cheapfas an tAire agus iniúchóir a cheapfas an Aireacht.
(3) Íocfaidh an Coimisiún táillí na n-iniúchóirí agus costais an iniúchta.
(4) Déanfaidh na hiniúchóirí cóipeanna de na cuntais iniúchta agus de thuarascáil na n-iniúchóirí orthu a chur, díreach tar éis an iniúchta, go dtí an tAire agus an Aireacht.
18. Bhéarfaidh an Coimisiún tuarascáil gach bliain don Aire agus don Aireacht ar a chuid oibre ar feadh na bliana roimhe sin.
19. Íocfaidh an Coimisiún le gach duine dá chomhaltaí na caiteachais taistil agus chothuithe agus na fo-chaiteachais faoina raghaidh sé agus a cheadós an t-údarás a cheap é.
AN CEATHRU SCEIDEAL.
An Chomhairle Chomhairlitheach do Liomataiste an Fheabhail.
1. Is iad a bheas ar an gComhairle Chomhairlitheach—
(a) comhaltaí tofa, agus
(b) comhaltaí ex-officio.
2. Beidh an bhliain 1952 agus gach tríú bliain as a chéile ina dhiaidh sin ina bliain toghcháin chun críche na bhforál ina dhiaidh seo den Sceideal seo.
3. (1) I ngach bliain toghcháin cuirfidh an Coimisiún toghchán ar siúl chun daoine a thoghadh ina gcomhaltaí tofa den Chomhairle Chomhairlitheach.
(2) Beidh teideal ag gach duine is sealbhóir ar cheadúnas iascaigh chun vótáil i dtoghchán agus beidh aige an méid vótaí is iomchuí do réir scála ordaithe a bheas bunaithe ar mhéid na dtáillí a híocadh i leith na gceadúnas iascaigh a bheas aige de thuras na huaire.
(3) Gach duine is áititheoir rátaithe iascaigh nó iascach i Líomatáiste an Fheabhail ar lú ná caoga punt, ach nach lú ná punt, iomlán a luachála inrátuithe, beidh sé freisin i dteideal vótáil i dtoghchán, agus beidh aige an méid vótaí is iomchuí do réir scála ordaithe a bheas bunaithe ar mhéid an ráta iascaigh a híocadh i leith an iascaigh nó na n-iascach don bhliain iascaigh díreach roimh an mbliain toghcháin.
(4) Ní bheidh duine cáilithe le haghaidh oifig chomhalta thofa den Chomhairle Chomhairlitheach mura gcónaíonn sé nó mura bhfuil maoin réadach aige i Líomatáiste an Fheabhail.
(5) Raghaidh na comhaltaí tofa a bheas in oifig de thuras na huaire as oifig ar thoghadh a gcomharbaí a bheith críochnaithe.
4. Chun críocha toghchán féadfaidh an Coimisiún na nithe seo a leanas d'ordú—
(a) na toghranna ina roinnfear Líomatáiste an Fheabhail,
(b) an méid daoine (nach mó ná naonúr agus nach lú ná triúr) a toghfar do gach toghroinn,
(c) pé forála eile is cuí leis.
5. (1) Gach duine (seachas an Coimisiún) is áititheoir rátaithe iascaigh nó iascach i Líomatáiste an Fheabhail, ar caoga punt nó níos mó iomlán a luachála inrátuithe, beidh sé, faoi réir forál na míre seo, ina chomhalta ex-officio den Chomhairle Chomhairlitheach.

6. Aon duine a ciontófar i gcion faoi na hAchta Iascaigh nó i gcoinne an Achta seo, beidh sé dícháilithe chun bheith ina chomhalta den Chomhairle Chomhairlitheach go ceann tréimhse seacht mbliana ó dháta a chiontuithe.
7. (1) Déanfaidh an Chomhairle Chomhairlitheach, ag a céadchruinniú tar éis gach toghcháin agus do réir mar theastós, duine dá comhaltaí a thoghadh ina chathaoirleach agus duine eile dá comhaltaí a thoghadh ina leas-chathaoirleach.

11. FOYLE FISHERIES ACT, 1952.
PART I.
Preliminary and General.
Short title.
1.—This Act may be cited as the Foyle Fisheries Act, 1952.
Interpretation.
2.—(1) In this Act—
“the Advisory Council” means the Advisory Council for the Foyle Area established under section 22;
“authorised person” has the meaning given to it by section 54;
“the Commission” means the Foyle Fisheries Commission established by section 11;
“District Justice” means a justice of the District Court;
“establishment date” means the date appointed by order made under section 10;
“the Fisheries Acts” means the Fisheries Acts, 1842 to 1949;
“fishery rate” means a rate under section 23;
“fishery year” means the period of twelve months commencing on the 1st day of October in any year;
“fishing engine” means any engine, net or instrument whatsoever capable of being used for the taking of fish;
“fishing licence” means a licence issued by the Commission under regulations made by the Commission under this Act;
“the Foyle Area” has the meaning given to it by section 3;
“inquiry” means an inquiry conducted under section 82;
“the Irish Society” means the body entitled the Society of the Governor and Assistants, London, of the New Plantation of Ulster within the Realm of Ireland;
“the Minister” means the Minister for Agriculture;
“the Ministry” means the Ministry of Commerce for Northern Ireland;
“the Moville Area” means the area which was constituted by the Moville Fishery District Order, 1926, as the Moville District;
“the Moville Board” means the board of conservators for the Moville District;
“prescribed” means prescribed by regulations made by the Commission under this Act;
“river” includes lake and estuary;
“salmon” includes sea trout, all fish of the salmon species, and the spawn and fry thereof;
“trout” includes all fish of the brown trout kind and their spawn and fry but does not include sea trout.
(2) References in this Act to a fish shall be construed as including references to part of a fish.
(3) In this Act a reference by number to a Part or section is to the Part or section of this Act bearing that number unless it is indicated that reference to some other Act is intended.
(4) References in this Act to any enactment shall, unless the context otherwise requires, be construed as references to that enactment as amended by any subsequent enactment including this Act.
The Foyle Area.
3.—(1) In this Act “the Foyle Area” means the area comprising the fishery district, originally created and defined as the Londonderry District by an order made on the 9th day of July, 1855, by the Commissioners of Fisheries.
(2) Judicial notice shall be taken of the boundaries of the Foyle Area.
Restriction of Fisheries Acts.
4.—The provisions referred to in the third column of the First Schedule to this Act of the enactments referred to in the second column shall, on and from the establishment date, cease to apply to the Moville Area.
Laying of accounts and reports before Oireachtas.
5.—The Minister shall cause to be laid before each House of the Oireachtas a copy of the accounts of the Commission for each year audited in accordance with paragraph 17 of the Third Schedule to this Act, and of the report of the auditors thereon, and a copy of the annual report furnished to him by the Commission.
Deposit of copies of orders and regulations.
6.—A copy of every order or regulation made under this Act shall be deposited—
(a) with the county registrar for the county of Donegal,
(b) with the District Court Clerk of every Court District which or part of which is situate in the Moville Area, and
(c) in every station of the Garda Síochána situate in the Moville Area,
Expenses.
7.—All expenses incurred by the Minister in carrying this Act into effect shall, to such extent as shall be sanctioned by the Minister for Finance, be defrayed out of moneys provided by the Oireachtas.
PART II.
Acquisition of Foyle Fishery Rights.
Power to acquire fishing rights, etc.
8.—(1) The Minister is hereby authorised to enter into an agreement (in this Act referred to as the vesting agreement) with the Ministry and the Irish Society in the terms of the draft set out in the Second Schedule to this Act.
(2) On the date of execution of the vesting agreement this subsection shall operate to vest in the Minister and the Ministry an absolute and indefeasible title to the fee simple in possession of all rights of fishing in the tidal portions of the Lough and River Foyle and of its tributary, the River Faughan, freed and discharged from all estates, titles, interests, incumbrances, rights, liberties and privileges whatsoever by whomsoever held, used, exercised or enjoyed, except the rentcharges referred to in the vesting agreement but indemnified therefrom as therein provided.
(3) Subsection (2) of this section shall not apply to a right vested, immediately before the date of execution of the vesting agreement, in any person, other than the Irish Society, to use a fixed engine under certificate granted under section 6 of the Salmon Fishery (Ireland) Act, 1863.
(4) On the date of execution of the vesting agreement this subsection shall operate to extinguish all the estate, right, title and interest of the Irish Society in and to the tidal portions of the Lough and River Foyle and of its tributary, the River Faughan, and the ground, soil and foreshore of those tidal portions.
(5) The vesting agreement shall operate, without further assurance, to convey, assign and transfer, on the date of the making thereof, to the Minister and the Ministry all the property thereby agreed to be sold, other than rights of fishing to which subsection (2) of this section applies.
(6) The Irish Society shall, notwithstanding any limitations on its powers, have power to enter into the vesting agreement without the consent of any person.
(7) It shall be the duty of the Minister and the Irish Society, and each such party is hereby empowered, to carry out the vesting agreement so far as the provisions thereof are to be performed by such party.
(8) If any person, other than the Irish Society, proves that he has been divested of an interest in a several right of fishing by subsection (2) of this section he shall be entitled to recover from the Commission compensation for loss of that interest, and any question whether compensation is payable under this subsection or as to the amount thereof shall, in default of agreement, be determined under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, by an arbitrator appointed under that Act.
(9) When assessing compensation under subsection (8) of this section, the arbitrator shall have regard to the extent to which the right in question was exercised during the ten years ending on the execution of the vesting agreement.
Exemption from stamp duties.
9.—(1) Section 12 of the Finance Act, 1895, shall not operate to require the delivery to the Revenue Commissioners of a copy of this Act or the payment of stamp duty under that section on any copy of this Act.
(2) Stamp duty shall not be chargeable on the vesting agreement or on any instrument executed in pursuance thereof.
PART III.
The Foyle Fisheries Commission.
Commencement of this Part.
10.—The subsequent provisions of this Part shall come into operation on such day as the Minister, after consultation with the Ministry, may by order appoint.
Constitution and Functions.
Establishment of Foyle Fisheries Commission.
11.—(1) There is hereby established a body to be known as the Foyle Fisheries Commission.
(2) The functions of the Commission shall be—
(a) the management of the property vested in the Minister and the Ministry under section 8;
(b) the conservation, protection and improvement of the fisheries of the Foyle Area generally.
(3) The provisions of the Third Schedule to this Act shall apply to the Commission.
Exemption from rates and taxes.
12.—(1) The Commission shall not be liable for any tax whatsoever in respect of the property in or occupation of any lands, tenements and hereditaments or in respect of any of its income.
(2) The Commission shall not be liable for a rate leviable by any local authority in respect of the use or occupation by the Commission of any hereditament or tenement and any hereditament or tenement so used or occupied shall, for the purpose of section 2 of the Valuation (Ireland) Act, 1854, be deemed to be of a public nature and occupied for the public service.
(3) In each local financial year there shall be paid to a local authority in the Moville Area out of moneys to be provided by the Oireachtas such sum as that authority would have been entitled under law to receive in respect of rates but for the exemption conferred by subsection (2) of this section.
Regulation.
13.—(1) The Commission may, with the approval of the Minister and the Ministry, make such regulations as appear to the Commission to be expedient for the management, conservation, protection and improvement of the fisheries of the Foyle Area and without prejudice to the generality of the foregoing, may make regulations in relation to all or any of the following matters—
(a) the regulation of fishing and preservation of good order amongst persons fishing,
(b) the times and seasons for the taking of fish or any kind of fish or for any mode of taking fish or any kind of fish and the conditions subject to which fish or any kind of fish may be taken,
(c) prohibiting any mode of taking or destroying fish or any kind of fish,
(d) the times and places or the mode at or in which any fishing engine may be used,
(e) the description and form of nets to be used and the size of the meshes of those nets.
(f) the prohibition, either absolutely or otherwise than under and in accordance with a licence issued by the Commission, of the use of any fishing engine,
(g) the making of applications for, and the issue, alteration, renewal, and revocation of licences, whether generally or in specified cases,
(h) the protection of waters from poisoning and pollution by any deleterious or poisonous matter, or from any predatory fish or animals,
(i) the prohibition of any practice whatsoever tending in the opinion of the Commission to impede the lawful capture of fish or to be in any manner detrimental to the fisheries,
(j) defining, by reference to a map or otherwise, the mouth of any river in the Foyle Area, the mouth of any tributary river at its entrance into any other river therein, the boundary between the tidal and freshwater portions of any river therein, the point or points to or from which distances are to be measured under this Act, or the space within which it is prohibited by this Act or by regulations under this section to use or practise certain methods of fishing,
(k) anything referred to in this Act as prescribed,
(l) anything relating in any manner to the management and protection of the fisheries.
(2) Regulations made by the Commission under this section may provide for charging in respect of any licence or other document issued or varied by the Commission such fees, payable at such time and in such manner, as may be prescribed.
(3) Every regulation made by the Commission under this section shall, as soon as may be after it is made, be published in Iris Oifigiúil and in one or more newspapers circulating in the Foyle Area.
(4) Any instrument made under the Fisheries Acts which is in force immediately before the establishment date and applies to the fishery district known as the Moville District shall thereafter continue in force and be deemed to be made under this section and may be revoked by regulations under this section.
(5) The Minister shall cause every regulation made under this Act to be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either House, within the next twenty-one days on which that House has sat after the regulation has been laid before it, the regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
(6) If any person contravenes (whether by act or omission) any regulations under this section, he shall be guilty of an offence against this Act.
Restriction on number of licences.
14.—(1) The number of licences for fishing with fishing engines of any kind (other than rod and line) in the tidal waters of the Foyle Area which may be issued by the Commission in any year shall not exceed such number as may be for the time being prescribed.
(2) If the number of applications duly made for licences in any year exceeds the maximum number provided for under this section, the licences shall be allocated in such manner as may be prescribed.
Financial Provisions.
Annual Estimate.
15.—The Commission shall furnish to the Minister on or before the 30th day of November in every fishery year an estimate of its income and expenditure for that year.
Grants.
16.—(1) There may be paid to the Commission, out of moneys provided by the Oireachtas, a grant or grants of such amount as the Minister, with the concurrence of the Minister for Finance, may sanction towards the expenses of the Commission for any fishery year.
(2) In determining the amount of a grant under this section for a particular fishery year the Minister shall have regard to the amount of any grant paid or to be paid to the Commission by the Ministry for that year.
Advances.
17.—(1) For the purpose of enabling the Commission to exercise or perform its functions, the Minister may, with the concurrence of the Minister for Finance, make advances from time to time to the Commission, out of moneys provided by the Oireachtas.
(2) A sum advanced under this section shall be repayable on such terms as may, with the concurrence of the Minister for Finance, be agreed between the Minister and the Commission.
Power of the Commission to borrow temporarily.
18.—The Commission may borrow temporarily by arrangement with bankers such sums as it may from time to time require, up to an amount not exceeding such amount as may from time to time be approved by the Minister and the Ministry.
Dissolution of Moville Board.
Dissolution of Moville Board of Conservators.
19.—(1) The Moville Board is hereby dissolved.
(2) All property, rights and liabilities of the Moville Board are hereby transferred to the Commission.
Continuance of pending legal proceedings.
20.—The Commission shall, upon the establishment date, become and be a party to all pending legal proceedings to which the Moville Board is a party, in place of that Board, and the proceedings shall be continued accordingly and shall not abate or be discontinued or prejudicially affected by reason of the dissolution of that Board.
Continuation of licences.
21.—(1) A special local licence—
(a) issued by the Moville Board under the Fisheries (Tidal Waters) Act, 1934 (No. 24 of 1934), for the tidal waters of the River Foyle known as the “Branch Stream” to which that Act was declared by order of the Minister to apply, and
(b) in force immediately before the establishment date,
shall, notwithstanding section 4, continue in force in accordance with its terms subject to the provisions of the Fisheries (Tidal Waters) Act, 1934, and section 54 of the Fisheries Act, 1939 (No. 17 of 1939), and the orders and regulations of the Minister thereunder and those provisions, orders and regulations shall be construed in relation to such licences with the substitution of references to the Commission for references to the Moville Board.
(2) A licence (other than a special local licence) issued by the Moville Board and in force immediately before the establishment date shall continue in force in accordance with its terms and shall be deemed to be a fishing licence for the purposes of this Act.
The Advisory Council for the Foyle Area.
Establishment and Functions of Advisory Council.
22.—(1) There shall be an Advisory Council for the Foyle Area.
(2) The functions of the Advisory Council shall be to watch over the interests of the holders of fishing licences and the occupiers of fisheries in the Foyle Area, to make such suggestions and representations as it thinks proper to the Commission in relation to any of the Commission's functions, and to advise the Commission upon any matter referred to it by the Commission.
(3) The provisions of the Fourth Schedule to this Act shall apply to the Advisory Council.
PART IV.
Rates on Fisheries.
Rates on fisheries.
23.—(1) In the fishery year commencing on the 1st day of October, 1952, and in every subsequent fishery year, the Commission shall, on or before the 31st day of December, make a rate of an amount equal to twenty shillings in the pound on every fishery (other than a fishery of which the Commission is the occupier) in the Moville Area on the valuation thereof appearing in the revised Valuation List required under the Valuation Acts to be issued by the Commissioner of Valuation not later than the preceding 1st day of March.
(2) Every rate under this section shall be paid by the several persons liable therefor in two moieties on the 1st day of April and the 1st day of September in the fishery year for which the rate is payable and shall be so paid over and above all or any licence fees paid by those persons under this Act for that or any other fishery year.
(3) A person who is liable to be rated under this Act in respect of a fishery shall, in respect of that fishery, be exempt from liability for any rate leviable by a local authority.
(4) Subsection (7) of section 13 of the Fisheries Act, 1925 (No. 32 of 1925), shall apply to the Moville Area and for the purpose of such application the exemption conferred by subsection (3) of this section shall be deemed to have been conferred by the said section 13.
Liability of occupier for fishery rate.
24.—The occupier of a fishery shall be liable to pay the fishery rate in respect of the fishery.
Collection of fishery rate.
25.—Fishery rate shall be collected by such persons as the Commission may from time to time appoint, adequate security being taken by the Commission from the persons so appointed for the due accounting for the rate collected, and the costs of the collection of the rate shall be part of the expenses of the Commission.
Recovery of fishery rate.
26.—(1) Fishery rate may be recovered at the suit of the Commission as a simple contract debt in any court of competent jurisdiction.
(2) If any sum due in respect of fishery rate is not paid within one month after the date on which it is required by subsection (2) of section 23 to be paid, such sum shall be recoverable (at the option of the person entitled by law to collect and recover it) from the occupier or from any other person who, when such fishery rate was made or at any subsequent time, held, used or occupied the said fishery or any part thereof and, if such last-mentioned person is a tenant of the occupier, he may, unless the contract of tenancy provides for the payment of fishery rate by the tenant, deduct the amount of any fishery rate so recovered from him from any rent payable to the occupier.
Fishery rates struck by Moville Board.
27.—Sections 24, 25 and 26 shall apply to every fishery rate struck by the Moville Board and confirmed under section 13 of the Fisheries Act, 1925 (No. 32 of 1925), and not fully paid before the establishment date.
PART V.
Times of Fishing and Ancillary Provisions.
Close seasons and close time.
28.—(1) The annual close season in the Foyle Area shall be the period prescribed for that purpose or, if no period is prescribed, the period beginning on the 1st day of September and ending on the 14th day of April next following.
(2) The annual close season for angling in the Foyle Area shall be the period prescribed for that purpose or, if no period is prescribed, the period beginning on the 13th day of October and ending on the 31st day of January next following.
(3) The weekly close time in the Foyle Area shall be the period prescribed for that purpose or, if no period is prescribed, the period beginning at 6 o'clock a.m. on Saturday and ending at 6 o'clock a.m. on the following Monday.
(4) Different periods may be prescribed under this section in respect of different parts of the Foyle Area and, where a period is so prescribed for a particular part of that area, references in this Act to the annual close season, the annual close season for angling or the weekly close time shall, as the case may require, be construed in relation to that part as references to the period so prescribed.
Fishing during close seasons.
29.—If any person—
(a) fishes for, takes, kills or attempts to take or kill salmon or trout (except with a rod and line), during the annual close season, or
(b) fishes for, takes, kills or attempts to take or kill salmon or trout with a rod and line during the annual close season for angling, or
(c) aids or assists in any such act or attempt,
he shall be guilty of an offence against this Act.
Fishing during close time.
30.—If any person fishes for, takes, kills or attempts to take or kill salmon or trout (except with a rod and line) during the weekly close time or aids or assists in any such act or attempt he shall be guilty of an offence against this Act.
Obstruction of salmon and trout.
31.—(1) If any person places any obstruction, uses any contrivance or does any act for the purpose of obstructing the passage of salmon or trout during the annual close season or weekly close time he shall be guilty of an offence against this Act.
(2) Nothing in this section shall apply to lawful fishing with rod and line.
Removal of fixed engines during close season and close time.
32.—(1) The occupier of any fixed engine for taking salmon or trout shall forthwith, after the commencement of the annual close season and until the end of that season, and also during the weekly close time, cause the fixed engine to be removed or rendered incapable of taking or obstructing the passage of salmon and trout.
(2) If any person fails to comply with this section, he shall be guilty of an offence against this Act.
(3) In this section “fixed engine” means any net, implement, engine or device, fixed to the soil or secured by anchors or held by hand or made stationary in any other way and used solely for the purpose of taking or facilitating the taking of fish.
Removal of nets from banks of rivers during close season.
33.—If any person engaged in fishing for salmon or trout by means of nets of any kind or description omits or neglects to remove and carry away from any strand or from the banks of any river or from the vicinity thereof such nets during the annual close season such person shall be guilty of an offence against this Act.
Use of nets during close season or close time.
34.—If any person does any of the following things during the annual close season or weekly close time—
(a) places, affixes or attaches any net to any stake, bridge, sluice or lock gates of a canal or other such fixed erections, or
(b) lays, draws or fishes with any net whatsoever,
he shall be guilty of an offence against this Act.
Prohibition of sale, etc., of salmon and trout unlawfully captured.
35.—(1) If any person buys, sells, exposes for sale or has in his possession any salmon or trout unlawfully captured such person shall be guilty of an offence against this Act and shall be liable on summary conviction thereof to a fine not exceeding twenty-five pounds, together with a further fine not exceeding two pounds for each salmon or trout so bought, sold, exposed for sale or found in his possession.
(2) In any proceedings under this section, the onus of proving that the salmon or trout, the subject of the proceedings, was lawfully captured shall lie on the defendant.
(3) Where a person, being a common carrier, is charged with the offence of having in his possession any salmon or trout unlawfully captured, it shall be a good defence to the charge for him to prove—
(a) that he had the salmon or trout in his possession as a common carrier and not otherwise, and
(b) that at the time at which the salmon or trout was accepted by him for carriage, the consignor delivered to him a certificate in writing signed by the consignor to the effect that the salmon or trout was lawfully captured.
(4) Where—
(a) a person is charged with an offence under this section in relation to a salmon or trout, and
(b) he proves that the fish was caught by rod and line at a particular place during a period other than the annual close season for angling at that place, and
(c) if the capture of the fish was prohibited save in accordance with a licence, he proves that the fish was caught by the holder of such a licence.
the charge against him shall be dismissed.
Restrictions on sale and export for sale of salmon and trout.
36.—(1) The provisions to which this section applies shall have effect in relation to the Moville Area with the substitution of—
(a) references to the Commission for references to a board of conservators,
(b) references to the Moville Area for references to any district, and
(c) references to an officer of the Commission for references to the clerk of a board of conservators.
(2) The Commission is hereby exempted from compliance with the provisions to which this section applies.
(3) The provisions to which this section applies are—
(a) Part III of the Fisheries Act, 1925 (No. 32 of 1925), as amended, and
(b) Sections 42 and 44 of the Fisheries Act, 1939 (No. 17 of 1939).
PART VI.
Protection of Fisheries.
Regulations as to Nets.
Restrictions on use of nets.
37.—If any person—
(a) makes use of or fishes with any net formed with a false bottom (except nets for the taking of eels), or
(b) places two or more nets one behind the other, or
(c) uses any nets covered with canvas, hide, or other substance for the purpose of taking small fish, or
(d) affixes or keeps up continued nets stretched across any river,
he shall be guilty of an offence against this Act.
Mesh of nets for the taking of salmon in the sea and tideways.
38.—(1) If, on any part of the coast or within any bay, estuary or tideway thereof, any person uses any net to which this section applies with a mesh of less size than one and three-quarter inches from knot to knot, to be measured along the side of the square, or seven inches to be measured all round each such mesh, such measurement being taken in the clear when the net is wet, then, subject to subsection (2) of this section, he shall be guilty of an offence against this Act.
(2) The Commission may by regulation under section 13 permit the use of nets to which this section applies having meshes of a less size than that specified in subsection (1) of this section.
(3) In this section the expression “net to which this section applies” means any net or other engine which is not formed of a rigid material and which is used for the taking of salmon.
Use of salmon nets near mouths of rivers.
39.—(1) If any person (other than the owner of a several fishery within the limits thereof) shoots, draws, or uses any net for taking salmon at the mouth of any river or within half a mile seaward or half a mile inwards or along the coast from the mouth of any river, he shall be guilty of an offence against this Act.
(2) If any person shoots, draws, or stretches any net entirely across the mouth or across any other part of a river, he shall be guilty of an offence against this Act.
(3) Where regulations under this Act define the mouth of any tributary river, references in this section to the mouth of any river shall be construed as including references to the mouth of that tributary river.
Restriction on possession of unlawful net, etc.
40.—(1) No person shall have in his possession or control in any river or on or near the banks of any river any net or other instrument or lure or bait the use of which for the purpose of taking salmon, trout or other fish is unlawful.
(2) Any person who has in his possession or control any net or other instrument or lure or bait in contravention of this section shall be guilty of an offence against this Act.
(3) Where—
(a) a person is found in possession of or has in his control any net in the vicinity of the boundary between the tidal and freshwater portions of any river, and
(b) by reason thereof such person is charged with an offence under this section,
it shall be a good defence to such charge for such person to prove that he is the holder of a licence to use such net and that such net is intended for use in such tidal portion.
Prohibition of Certain Methods of Fishing for, and of Practices Liable to Destroy, Salmon and Other Fish.
Use or possession of explosives.
41.—(1) In this section—
“explosive” means dynamite or other explosive substance;
“waters” means any river or any part of the sea coast.
(2) If any person employs in any waters any explosive for the purpose of capturing or destroying fish, he shall be guilty of an offence against this Act.
(3) If any person, being on the bank of or near any waters, has in his possession any explosive with intent to employ it for the purpose of capturing or destroying fish, he shall be guilty of an offence against this Act.
(4) Every person guilty of an offence under subsection (2) or (3) of this section shall be liable on summary conviction to a fine not exceeding one hundred pounds or to imprisonment for any term not exceeding twelve months or to both such fine and such imprisonment.
Use or possession of deleterious or poisonous matter.
42.—(1) If any person employs in any river any deleterious or poisonous matter for the purpose of capturing or destroying fish, he shall be guilty of an offence against this Act.
(2) If any person, being on the bank of or near any river, has in his possession any deleterious or poisonous matter with intent to employ it for the purpose of capturing or destroying fish, he shall be guilty of an offence against this Act.
Penalty for using etc., certain devices for taking fish.
43.—(1) If, for the purpose of taking any fish, any person uses or has in his possession or control in any river or on or near the banks thereof any light or fire of any kind, he shall be guilty of an offence against this Act.
(2) If, for the purpose of taking any fish, any person uses or has in his possession or control in any river or on or near the banks thereof, any otter, spear, strokehaul, gaff or other instrument of a similar kind, he shall, subject to subsection (3) of this section, be guilty of an offence against this Act.
(3) Subsection (2) of this section shall not apply to the use, possession or control of—
(a) a gaff used or to be used solely as an auxiliary to lawful angling between sunrise and one hour after sunset, or
(b) a gaff used or to be used by the holder of a fishing licence in respect of any box in a fishing weir or fishing mill dam solely for the purpose of lawfully removing fish therefrom, or
(c) an eel spear used for taking eels.
(4) Every person guilty of an offence under subsection (1) or (2) of this section shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds or to imprisonment for any term not exceeding twelve months or to both such fine and such imprisonment.
Fishing for salmon or trout in a river by cross lines.
44.—If any person takes, catches or fishes for any salmon or trout by means of cross lines in any river, he shall be guilty of an offence against this Act.
Damming, etc., river or mill race for purpose of taking salmon or trout.
45.—If any person dams, teems or empties any river or watercourse for the purpose of taking or destroying any salmon or trout, such person shall be guilty of an offence against this Act.
Taking fish unlawfully killed or found dead.
46.—(1) Every person who by any means removes or causes to be removed from any river—
(a) any salmon or trout which have been killed otherwise than by lawful means, or
(b) any salmon or trout which have been found dead, from any cause whatever, by such person,
shall be guilty of an offence against this Act.
(2) This section shall not apply to—
(a) any person acting under the authority of the Minister, or
(b) any member or officer of the Commission, or
(c) any owner of a fishery or his agent acting under the written authority of the Commission, or
(d) so far as respects the removal or causing to be removed of any diseased salmon or trout, or any salmon or trout found dead from any cause, any member of the Garda Síochána or any Sanitary Officer.
Protection of Young and Breeding Fish.
Taking, etc., spawn, smolts or fry of salmon or trout.
47.—If any person—
(a) wilfully takes, sells, purchases, or has in his possession the spawn, smolts or fry of salmon or trout, or
(b) wilfully obstructs the passage of the smolts or fry of salmon or trout, or
(c) injures or disturbs the spawn or fry of salmon or trout, or
(d) injures or disturbs any spawning bed, bank or shallow where the spawn or fry of salmon or trout may be,
he shall be guilty of an offence against this Act.
Disturbing fish on spawning beds.
48.—If any person disturbs fish on the spawning beds or attempts (except by means of lawful angling with rod and line) to catch fish thereon, he shall be guilty of an offence against this Act.
Penalties for taking, buying, etc., unseasonable salmon or trout.
49.—(1) Every person who at any time wilfully takes, kills, destroys, buys, sells, exposes for sale or has in his custody or possession any unclean or unseasonable salmon or trout, shall be guilty of an offence against this Act and shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds or to imprisonment for any term not exceeding twelve months or to both such fine and such imprisonment.
(2) Where a person is charged with taking a salmon or trout in contravention of this section it shall be a good defence to prove that such salmon or trout was taken accidentally, and was returned without injury to the water immediately upon being taken.
Miscellaneous Offences.
Obstructing persons lawfully fishing.
50.—If any person obstructs any person lawfully engaged in fishing or in proceeding to or in returning from lawful fishing, such first-mentioned person shall be guilty of an offence against this Act.
Placing fishing engine with intent to prevent fish entering nets lawfully set.
51.—If any person wilfully and maliciously places any fishing engine with intent to prevent fish from entering the nets of any other person set and placed in a lawful manner such first-mentioned person shall be guilty of an offence against this Act.
Giving warning to persons unlawfully fishing.
52.—If any person gives or causes to be given or aids or assists in giving any signal or warning to any person engaged in fishing unlawfully of the approach of any member or officer of the Commission, member of the Garda Síochána, or river watcher appointed under section 56, he shall be guilty of an offence against this Act.
Agents for Fishery Owners.
Appointment.
53.—(1) Any fishery owner may by power of attorney under his hand appoint an agent to act for him for the purposes of this Act.
(2) All things which by this Act are directed to be done by or with relation to any person may be lawfully done by or with relation to an agent appointed by him under this section and the agent may be dealt with in all respects as that person himself might have been dealt with under this Act.
(3) Every agent appointed under this section shall have full power, in the name and on behalf of his principal, to take part in or act upon any inquiry, or prosecute, oppose or defend any complaint, appeal, action, writ, suit or other proceeding or to attend, vote at and take part in any meeting or do or suffer any other act for the purposes of this Act.
(4) Every person who appoints an agent under this section shall be bound by the acts of the agent, according to the authority committed to him, as fully as if that person had so acted.
(5) Every power of attorney under this section shall be produced, inspected or registered and copies and extracts thereof made at such times and places and in such manner as the Commission may prescribe.
(6) A power of attorney under this section may be in the following form—
“I, A. B. of ________________ hereby appoint C. D. of ________________ to be my lawful attorney to act for me in all respects as if I myself were present and acting, and I make this appointment under the Foyle Fisheries Act, 1952.
Dated this _______ day of _________________, 19 _____.

(7) Where a person is convicted of an offence against this Act he shall thereafter be disqualified from being appointed an agent under this section for a period of seven years from the date of conviction.
PART VII.
Powers of Authorised Persons.
Definitions.
54.—In this Part—
“authorised person” means (except where the context otherwise requires) a member of the Garda Síochána, a member or officer of the Commission or a private river watcher;
“officer of the Commission” means an inspector or river watcher appointed under section 55;
“private river watcher” means a river watcher appointed under section 56;
Appointment of inspectors and river watchers.
55.—(1) The Commission may by instrument under its common seal appoint a person to be—
(a) an inspector, or
(b) a river watcher,
and may revoke such instrument.
(2) An instrument under this section shall not be subject to stamp duty.
Appointment of river watchers by persons interested in fisheries.
56.—(1) Each of the following persons—
(a) any person interested in the preservation of the fish of any river in the Moville Area,
(b) any persons who have united themselves into a society for the preservation of any fishery in any such river,
(c) the owner of any fishery in any such river,
(d) the owner of any salmon fishery on the sea coast,
may, from time to time, by instrument in writing in the form set out in the Fifth Schedule to this Act, appoint any person to be a river watcher for the protection of the fisheries on such part of the sea coast or in any such river or the tributaries thereof.
(2) A person appointed to be a river watcher under this section shall not act in that capacity until his appointment is confirmed (which confirmation shall be effected by endorsing the instrument of appointment) by any District Justice within whose district the river watcher is appointed to act.
(3) A District Justice may upon complaint made to him revoke the appointment of a person appointed under this section to act within his district, and thereupon the appointment shall be determined.
(4) If any person acts as a private river watcher without having his appointment confirmed under subsection (2) of this section or after his appointment has been revoked under subsection (3) of this section, he shall be guilty of an offence against this Act and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
Limitations on exercise of powers.
57.—(1) The powers conferred by this Part on a private river watcher shall be exercised only for the protection of the fisheries specified in his instrument of appointment.
(2) The powers conferred by this Part on a member or officer of the Commission shall be exercised only for the protection of the fisheries of the Foyle Area.
Warrant for exercise of powers.
58.—The production by an officer of the Commission or a private river watcher of his instrument of appointment under this Part shall be a sufficient warrant for his exercising the powers conferred on him by this Part, but the production of such instrument by him shall not be necessary in exercising those powers unless he has been first required to produce it.
General powers.
59.—(1) An authorised person may, for the purposes of the protection of the fisheries, do all or any of the following things—
(a) enter into and pass through or along the banks or borders of any rivers frequented by salmon or trout or of the tributaries thereof,
(b) with boats or otherwise enter upon any such rivers,
(c) enter upon and examine all weirs, sluices, mill dams, mill races and watercourses communicating with such rivers,
(d) enter any boat which has been or is engaged or is about to engage in fishing,
(e) examine all standing, floating or other nets whatsoever,
(f) seize any unlawful fishing engine or any lawful fishing engine which is being unlawfully used,
(g) do all such other acts and things as he is authorised to do by or under this Act.
(2) Nothing in this section shall be construed as authorising any person to enter any enclosed garden or any dwelling-house or the curtilage thereof except where the ordinary road or passage to any weir, dam or dyke traverses such garden or curtilage.
Power of Peace Commissioner to grant warrant to enter certain places.
60.—(1) Where upon an information on oath it appears to any Peace Commissioner that there are reasonable grounds for believing that a breach of the provisions of this Act or any instrument made thereunder has been committed within any enclosed garden or any dwelling-house or the curtilage thereof, he may by warrant under his hand empower an authorised person to enter the said garden or dwelling-house or the curtilage thereof, at such times in the day or night as may be mentioned in the warrant.
(2) A warrant under this section shall not continue in force for more than seven days from the date thereof.
Boarding and examination of fishing vessels.
61.—(1) A member or officer of the Commission or member of the Garda Síochána may, subject to any directions and regulations given or made by the Commission, do with respect to any vessel employed in fishing, all or any of the following things—
(a) board such vessel,
(b) examine the certificate of registry and the fishing engines of such vessel, and ascertain whether the provisions of this Act or the Fisheries Acts have been complied with and whether the master or other persons on board are carrying on fishing in the manner required by this Act,
(c) seize any unlawful fishing engine or any lawful fishing engine unlawfully used.
(2) If the master of any fishing vessel refuses to produce the certificate of registry of such vessel when required to do so by a member or officer of the Commission or member of the Garda Síochána, he shall be guilty of an offence against this Act.
Apprehension of offenders.
62.—(1) If, within the Foyle Area, any person (in this section referred to as the offender) is found offending against the provisions of the Fisheries Acts or this Act or the corresponding law of Northern Ireland, the following provisions shall have effect:—
(a) an authorised person may require the offender to do either or both of the following things—
(i) desist from such offence;
(ii) give his name and address;
(b) if the offender, after being so required, wilfully continues such offence or fails or refuses to give his name and address, the authorised person and any persons acting under his directions may apprehend the offender;
(c) where the offender is apprehended under this section by an authorised person who is not a member of the Garda Síochána, that person shall, subject to subsection (2) of this section, forthwith deliver the offender into the custody of a member of the Garda Síochána to be dealt with according to law.
(2) If the authorised person who apprehended the offender or a member of the Garda Síochána into whose custody he has been delivered has reason to believe that—
(a) the offender is resident in Northern Ireland, and
(b) the offence is an offence under the said corresponding law of Northern Ireland,
he may forthwith deliver the offender into the custody of a member of the police forces of Northern Ireland to be dealt with according to that law.
(3) Where a person is delivered into the custody of a member of the Garda Síochána in purported compliance with a provision of the law of Northern Ireland corresponding to this section, the member shall take him into custody to be dealt with according to law.
Powers in relation to fishing engines, etc.
63.—Where an authorised person finds—
(a) during the annual close season or the weekly close time—
(i) any passage in any fishing engine or contrivance closed or obstructed, or
(ii) any fishing engine or other contrivance whatsoever placed or used in contravention of this Act or any instrument made thereunder, or
(b) at any time, any obstruction in a fish pass, or
(c) at any time, any obstruction in the waste gate appurtenant to any mill or factory when such waste gate is required by law to be open,
he may open such passages and remove such obstructions, doing no unnecessary damage, and seize and remove all things so found or used contrary to the provisions of the Fisheries Acts or this Act or any instrument made thereunder.
Powers of inspection, examination, and detention.
64.—(1) Every person (in this section referred to as an authorised officer) being a member or officer of the Commission or member of the Garda Síochána is hereby authorised to do all or any of the following things—
(a) to stop and search any person conveying or suspected to be conveying fish of any kind or any instrument, poison or explosive used or adapted for killing or taking fish unlawfully and to inspect any fish, instrument or substance which such person is found to be conveying and for that purpose to open and search any vehicle or package in which any fish, instrument or substance is being or is suspected to be conveyed;
(b) at all reasonable times to enter upon and have free access to the interior of—
(i) any premises in which fish is or is believed to be sold, or kept, exposed or stored for sale, or
(ii) any premises in which any instrument or substance intended for the destruction of fish is or is believed to be kept, or
(iii) the premises of any person engaged in the business of carrying goods for reward, or
(iv) any aerodrome, pier, quay, wharf, jetty or dock or premises thereon, or
(v) any ship, boat, aircraft, railway wagon, motor lorry, cart, or other vessel or vehicle used for the conveyance of goods;
(c) to examine all fish found in any place which he is authorised by this section to enter and for that purpose to open any package found in such place and containing or suspected to contain fish;
(d) to stop, enter and search, on any river or the banks thereof or any part of the sea or the shores thereof any boat used or suspected to be used for fishing or containing or suspected to contain fish unlawfully captured and to examine all fish and all fishing engines found therein and for that purpose to open any package which contains or is suspected to contain any fish or fishing engine;
(e) to take, remove and detain in his custody any fish (either together with or without any package in which the same may be contained) found in the course of the exercise of any of the powers conferred by this section in respect of which an offence under this Act is being or is suspected of being committed or which have been or are suspected of having been unlawfully captured;
(f) to take, remove and detain in his custody any fishing engine or any article liable or believed to be liable to forfeiture under the Fisheries Acts or this Act;
(g) to demand and take the name and address of the person having custody of any fish or other article which the authorised officer is authorised under this section to examine and also demand and take from such person the name and address of the owner of such fish or other article.
(2) Where an authorised officer detains in his custody under the authority of this section any fish or other article he shall, as soon as may be, take such steps as may be proper to have the person guilty or suspected to be guilty of the offence committed or suspected to have been committed in relation to such fish or other article dealt with according to law.
(3) Where an authorised officer detains in his custody under the authority of this section any fish and such fish is likely to become unfit for human food before the matter can conveniently be dealt with by any Court, he shall produce such fish to a Peace Commissioner, and if authorised so to do by such Peace Commissioner shall destroy or otherwise dispose of such fish.
(4) A Peace Commissioner to whom any fish is produced in pursuance of this section shall, if he is of opinion that the fish ought in the circumstances to be destroyed or otherwise disposed of, give to the person producing the fish a certificate in writing describing the fish and any marks, peculiarities or other particulars thereof pointed out to him by such person and authorising such person to destroy or otherwise dispose of the fish, which certificate shall be conclusive evidence of all such matters of fact as aforesaid stated therein.
(5) Every person who refuses to give his own name and address or the name and address of any other person (so far as known to him) when lawfully demanded under this section shall be guilty of an offence against this Act.
Procedure consequent upon seizure of unlawful fishing engines and lawful fishing engines unlawfully used.
65.—Where a person, in exercise of the powers conferred on him by this Part, seizes in the State any fishing engine, he shall, as soon as may be, bring it before the District Justice in whose district it was seized, and thereupon the following provisions shall have effect—
(a) if the District Justice finds that the fishing engine is one the use of which is prohibited by law, he shall order it to be forfeited and destroyed,
(b) if the District Justice finds that the fishing engine is a lawful fishing engine which at the time of its seizure had been, was being, or was about to be, unlawfully used in any part of the Foyle Area, he shall order it to be forfeited,
(c) if the District Justice finds that the fishing engine is a lawful fishing engine which at the time of its seizure had not been, was not being or was not about to be, unlawfully used as aforesaid, he shall order it to be returned to the person who appears to him to be the owner thereof.
Protection of authorised persons.
66.—No authorised person shall be liable for any loss or damage occasioned by or in the course of the exercise of any of the powers conferred on him by this Part unless such loss or damage was caused by him wantonly or maliciously.
Penalty for assaulting or obstructing authorised persons.
67.—If any person assaults, obstructs, or impedes any person exercising any power conferred by this Part, he shall be guilty of an offence against this Act and shall be liable on summary conviction to a fine not exceeding twenty pounds or to imprisonment for any term not exceeding two months or to both such fine and such imprisonment.
PART VIII.
Legal Proceedings.
Application of penal provisions of Act.
68.—The provisions of this Act relating to offences apply to—
(a) acts and omissions in the Moville Area by any person, and
(b) acts and omissions in any part of the Foyle Area by a person resident in the State.
Penalties for offences.
69.—(1) Any person who commits an offence against this Act for which a penalty is not provided by any other provision of this Act shall be liable on summary conviction to a fine not exceeding fifty pounds and, in the case of a continuing offence, to a further fine not exceeding five pounds for every day during which the offence is continued after conviction.
(2) The Commission may prescribe lower money penalties for breach of a particular regulation than those provided under subsection (1) of this section and that subsection shall, in any such case, be construed as if such lower penalties were substituted for those so provided.
Saving for acts done for artificial propagation, scientific purposes or improvement of fisheries.
70.—Nothing in this Act shall prohibit anything done by the Commission or by a person previously authorised in writing by the Commission in that behalf for the purpose of the artificial propagation of fish, for some scientific purpose or for the improvement of any fishery.
Residence of body corporate.
71.—For the purposes of this Part a body corporate shall be deemed to be resident in the State if it is incorporated under the laws of the State.
Offences by bodies corporate.
72.—Where an offence against this Act was committed by a body corporate and is proved to have been so committed with the consent or approval of, or to have been facilitated by any neglect on the part of any person, being a director, manager, secretary or other officer of the body corporate, that person shall also be guilty of the offence and may be proceeded against and punished accordingly.
Trial of offences.
73.—Notwithstanding anything contained in any other enactment, an offence against this Act may be heard and determined by the District Court upon the complaint, oral or otherwise, of the Commission or an officer of the Commission or a member of the Garda Síochána but not of any other person, except with the consent of the Commission.
Evidence of mouths of rivers, boundaries between tidal and freshwater portions of rivers, points of mouths, of rivers to or from which distances are to be measured.
74.—(1) Where any regulations define—
(a) the mouth of a river, or
(b) the mouth of any tributary river, or
(c) the boundary between the tidal and freshwater portions of any river, or
(d) the point or points to or from which distances are to be measured under this Act,
such mouth, boundary, point or points shall for the purposes of any proceedings under this Act be as so defined.
(2) Where any regulations define the space within which it is by or under this Act prohibited to use certain fishing engines, the space so defined shall for the purposes of any proceedings under this Act be taken to be the area within which it is prohibited to use those fishing engines.
Forfeiture of licences.
75.—(1) (a) If the person who is the holder of a licence issued by the Commission is convicted of an offence to which this subsection applies the Court may direct the licence to be forfeited and declare that person to be disqualified for holding a licence of the Commission for such period, not exceeding one year, as the Court may direct.
(b) This subsection applies to—
(i) an offence under any section of this Act,
(ii) an offence under any section of the Fisheries Acts.
(2) Where a person who is the holder of a licence issued by the Commission is convicted by a court of justice in Northern Ireland of an offence under the law of Northern Ireland relating to fisheries and, as a result of such conviction, the licence is declared to be forfeited and that person is declared to be disqualified for a particular period for holding a licence of the Commission, the Commission shall direct the licence to be forfeited and that person shall be disqualified for holding a licence for that period.
(3) Where a licence is directed to be forfeited under this section, it shall thereupon cease to be in force.
(4) Where a person is convicted by a Court of an offence against this Act or under any provision of the Fisheries Acts, the registrar or clerk of the Court shall as soon as may be forward to the Commission a copy of the conviction certified in accordance with the rules of Court.
(5) A document purporting to be a copy of a conviction or order made by a court of justice in Northern Ireland and to be certified in accordance with the law of Northern Ireland shall, for the purposes of this section, be evidence of such conviction or order without further proof, unless the contrary is shown.
Forfeiture of fishing engines, etc., as statutory consequence of conviction.
76.—Where a person is convicted of an offence against this Act, any fish illegally taken by him or in his possession at the time of the offence and also any fishing engine or thing by means or in respect of which the offence is committed shall, as a statutory consequence of conviction, stand forfeited.
Non-obligation of Court to pronounce or record forfeiture.
77.—Where, as a statutory consequence of a conviction under this Act, a particular thing stands forfeited, then, notwithstanding any rule of law, it shall not be necessary for the Court—
(a) to pronounce the fact of such forfeiture at the time of adjudication, or
(b) to record the fact of such forfeiture in the Minute Book of the District Court or in the order of conviction.
Disposal of fines.
78.—(1) This section applies to every fine imposed for an offence under any section of this Act.
(2) Section 51 of the Court Officers Act, 1926 (No. 27 of 1926), shall not apply to a fine to which this section applies.
(3) Every fine to which this section applies shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
(4) Where a fine to which this section applies is remitted in whole or in part after it has been paid into or disposed of for the benefit of the Exchequer under subsection (3) of this section, such fine or the portion thereof so remitted (as the case may be) shall be repaid out of the Exchequer in such manner as the Minister for Finance shall direct.
Payments to Commission and Gárda Síochána Reward Fund in respect of fines.
79.—(1) This section applies to—
(a) an offence under any section of this Act, and
(b) an offence under any provision to which section 10 of the Fisheries (Amendment) Act, 1949 (No. 18 of 1949), applies committed in the Foyle Area.
(2) Where a fine imposed for an offence to which this section applies has been paid or levied, then, unless the fine has been wholly remitted, the following provisions shall apply—
(a) in case it appears to the Minister that a member of the Garda Síochána was the means of bringing to justice the person by whom the offence was committed, there shall be paid—
(i) to the Commission a sum equal to two-thirds of the fine or, if the fine was remitted in part, of so much thereof as was not remitted, and
(ii) into the Garda Síochána Reward Fund a sum equal to one-third of the fine or, if the fine was remitted in part, of so much thereof as was not remitted;
(b) in any other case, there shall be paid to the Commission a sum equal to the fine or, if the fine was remitted in part, so much thereof as was not remitted.
(3) All moneys payable under subsection (2) of this section shall be paid by the Minister, out of moneys provided by the Oireachtas, at such times as he thinks fit.
Disposal of forfeitures and payments to Commission and Gárda Síochána Reward Fund.
80.—(1) Where any thing is forfeited under this Act, the Minister may direct that it be sold or otherwise disposed of in such manner as he thinks fit or be returned to the person who appears to him to be the owner.
(2) The net proceeds of a sale under subsection (1) of this section shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
(3) (a) In case it appears to the Minister that a member of the Garda Síochána seized a particular thing forfeited under section 76 or under any provision to which section 15 of the Fisheries (Amendment) Act, 1949 (No. 18 of 1949), applies, as a statutory consequence of a conviction for an offence committed in the Foyle Area, or was the means of bringing to justice the person convicted of the offence which resulted in the forfeiture, then a sum equal to two-thirds of the net proceeds referred to in subsection (2) of this section shall be paid to the Commission and a sum equal to one-third shall be paid to the Garda Síochána Reward Fund.
(b) In any other case, a sum equal to the net proceeds shall be paid to the Commission.
(4) All moneys payable under subsection (3) of this section shall be paid by the Minister, out of moneys provided by the Oireachtas, at such times as he thinks fit.
Proof of regulations, bye-laws, etc.
81.—(1) In any proceedings, a document purporting to be a copy of any instrument in writing made or issued (whether before or after the passing of this Act) under the Fisheries Acts or this Act in relation to the Foyle Area or any part thereof shall, if it is certified under the common seal of the Commission to be a true copy, be prima facie evidence of the instrument.
(2) Section 4 of the Documentary Evidence Act, 1925 (No. 24 of 1925), shall apply to regulations made by the Commission under this Act.
Inquiries.
82.—(1) The Commission may from time to time hold an inquiry in relation to the fisheries of the Foyle Area or any of them and the best means to be adopted for the management, conservation, protection or improvement thereof.
(2) An inquiry may be conducted by the Commission or by a person appointed by it for the purpose.
Powers in relation to inquiry.
83.—(1) The Commission or person holding an inquiry may—
(a) summon witnesses to attend at the inquiry,
(b) examine on oath (which any member of the Commission or that person, as the case may be, is hereby authorised to administer) witnesses attending at the inquiry,
(c) require any witness to produce any documents in his power or control which the Commission or that person, as the case may be, considers necessary for the purposes of the inquiry.
(2) A witness at an inquiry shall be entitled to the same immunities and privileges as if he were a witness before the High Court.
(3) If any person—
(a) on being duly summoned to attend as a witness at an inquiry makes default in attending, or
(b) being in attendance, refuses to take an oath which he is lawfully required to take, or to produce any document in his power or control which he is lawfully required to produce, or to answer any question which he is lawfully required to answer,
he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty-five pounds.

SECOND SCHEDULE.
DRAFT TERMS OF AGREEMENT TO BE MADE BETWEEN THE IRISH SOCIETY AS VENDOR AND THE MINISTER AND THE MINISTRY AS PURCHASERS.
1. (1) The Irish Society sells and the purchasers purchase for the consideration hereinafter appearing all the estate right title and interest of the Irish Society to and in—
(a) the fee simple in possession free from incumbrances of a several fishery in the tidal portions of the Lough and River Foyle and of its tributary the River Faughan (as shown coloured yellow on the map prepared in triplicate upon which for the purpose of identification the parties hereto have affixed their seals immediately before the execution of this Agreement) exclusive of such rights in the ground and soil thereof as are in paragraph 2 hereof agreed to be extinguished and save as mentioned in paragraphs 3 and 4 hereof;
(b) the lands held by the Irish Society for the purposes of or in connection with the said several fishery and more par ticularly referred to in the annex to this Agreement free from incumbrances save as mentioned in paragraph 3 hereof according to the several estates and titles for and under which they are respectively held and enjoyed;
(c) all fixed nets or other fixed engines of any kind whatsoever belonging to the Irish Society and situate in the said tidal waters; and
(d) all easements, quasi-easements, accommodations and other rights owned used or enjoyed by the Irish Society for the purposes of or in connection with the said several fishery over across or on any lands other than those herein expressly mentioned.
(2) The consideration for the said sale is the payment by the Purchasers to the Irish Society of the sum of £106,885 (with interest on £102,485 portion of the said sum, calculated at the rate of three per centum per annum from the first day of March, 1951, to the date of this Agreement) (the receipt of which said sum and interest the Irish Society hereby acknowledges).
2. In consideration of the payment to it of the sum aforesaid the Irish Society hereby consents and agrees to all the estate right title and interest of the Irish Society in and to the ground and soil and foreshore of the tidal portion of said Lough and River Foyle and of the tidal portion of the River Faughan (which said tidal portions are shown coloured yellow on the said map) being extinguished by legislation and hereby releases and discharges the purchasers and all other persons whatsoever from and against all actions suits claims and demands by the Irish Society (whether for compensation or otherwise) in respect or in consequence of such extinction or of the divesting of any other estate right title or interest of the Irish Society in to or over the said tidal portions by virtue of the operation of any such legislation.
3. The Irish Society will at its own expense when requested by the purchasers enter into a covenant binding upon the Irish Society and its successors in title with the purchasers and each of them their and each of their successors in title that the rentcharge of £250 per annum settled upon the Lord Bishop of Derry and his successors for ever by Statute 3 and 4 Anne Chapter 1 and the rentcharge of £12 settled upon the said Bishop by virtue of Deed Poll dated 11th May, 1705, shall be charged upon such of the property of the Irish Society as the purchasers shall select and to the intent that the said rentcharges shall be paid by the Irish Society and its successors in title in complete exoneration of the Purchasers and their successors in title and indemnifying the lands and property hereby sold and the estates rights title and interests agreed in paragraph 2 hereof to be extinguished by legislation and the Purchasers and each of them their and each of their successors in title from and against the payment of the same or of any part thereof and against all proceedings costs damages claims demands and liability by reasons of any non-payment of the same or any part thereof.
4. Nothing in this agreement shall prejudice or affect any right vested immediately before the execution hereof in any person other than the Irish Society to use a fixed engine under certificate granted under Section six of the Salmon Fishery (Ireland) Act, 1863.
5. This Agreement shall operate as if it contained covenants by the Irish Society:—
(a) as to the several fishery described in paragraph 1 (a) here of that the Irish Society has not executed or done or knowingly suffered or been party or privy to any deed or thing whereby or by means whereof the said several fishery or any part thereof is or may be impeached, charged, affected or incumbered in title, estate or otherwise or whereby or by means whereof the Irish Society is in anywise hindered from selling and conveying the said several fishery or any part thereof in the manner affected by this agreement,
(b) as to the lands described in paragraph 1 (b) hereof in terms of those implied in a conveyance for valuable consideration other than a mortgage (including in respect of leasehold property the further covenant in respect of an assignment thereof) by a person who conveys and is expressed to convey as beneficial owner.
ANNEX.
1. ALL THOSE two parcels of ground with the buildings thereon situate adjacent to the Fort of Culmore in the Townland of Culmore Parish of Templemore Barony of North West Liberties of Londonderry and County of Londonderry more particularly delineated on the map thereof marked Number 1 prepared in triplicate upon which for the purpose of identification the parties hereto have affixed their seals immediately before the execution of this Agreement and thereon coloured red.
2. ALL THAT parcel of ground with the buildings thereon situate adjoining the road leading to Culmore Point which said road runs between the parcel and the River Foyle as the said parcel is more particularly delineated on the map thereof marked Number 2 prepared in triplicate upon which for the purpose of identification the parties hereto have affixed their seals immediately before the execution of this Agreement whereon the parcel is coloured red and blue which premises are in the Townland of Culmore Parish of Templemore Barony of the North West Liberties of Londonderry and County of Londonderry.
3. ALL THAT parcel of ground with the buildings thereon known as “Shell Rock Hut” situate near Rosses Bay in the Townland of Caw, Parish of Clondermot, Barony of Tirkeeran and County of Londonderry, more particularly delineated on the map thereof marked Number 3 prepared in triplicate upon which for the purpose of identification the parties hereto have affixed their seals immediately before the execution of this Agreement and thereon coloured red.
4. ALL THAT parcel of land containing 8 acres and 15 perches or thereabouts statute measure situate in the Townland of Cloghboy, Barony of Strabane Lower and County of Tyrone, the subject of folio 5349 of the Register County Tyrone together with all buildings and erections thereon and the appurtenances thereunto belonging or in anywise appertaining thereto which said parcel is more particularly delineated on the map thereof marked Number 4 prepared in triplicate upon which for the purpose of identification the parties hereto have affixed their seals immediately before the execution of this Agreement and thereon coloured blue.
THIRD SCHEDULE.
The Foyle Fisheries Commission.
Incorporation.
1. The Commission shall be a body corporate with perpetual succession and a common seal and power to sue and be sued and to acquire and hold land without licence in mortmain.
Particular powers of the Commission.
2. The Commission shall have, in addition and without prejudice to any powers given to it under any other provision of this Act, power to do any of the following things—
(a) to take legal proceedings for the enforcement of any provision of this Act or of any regulations made under this Act;
(b) to purchase or take on lease any fishery or any establishment for the artificial propagation or rearing of salmon, trout or other freshwater fish and to operate any fishery and any such establishment;
(c) to apply and expend, subject to the provisions of this Act, all money paid to the Commission in such manner as the Commission thinks proper for the government, management, maintenance or improvement of the fisheries of the Foyle Area;
(d) to execute such works and do such things as the Commission considers expedient for the purpose of its functions.
Special powers during transitional period.
3. (1) Notwithstanding anything contained in this Act, the Commission may at its discretion, during the transitional period, control, manage and deal with the fishing in that part of the tidal waters of the Foyle Area vested in the Minister and the Ministry which lies between an imaginary straight line drawn across the River Foyle to join the points where the southernmost boundary of the County of Derry meets the river on each side and the defined mouth of the river.
(2) The transitional period for the purpose of this paragraph shall be the period of three years commencing on the establishment date or such longer period as the Minister and the Ministry may from time to time fix by agreement.
Disposal of surplus moneys.
4. Any surplus moneys for the time being in the hands of the Commission shall be disposed of by it in such manner as the Minister and the Ministry may from time to time jointly direct.
Membership.
5. The Commission shall consist of four members, of whom two shall be senior members and two shall be junior members.
Appointment.
6. (1) One senior and one junior member shall be appointed by the Minister and the other senior member and junior member shall be appointed by the Ministry.
(2) Each member, except a member appointed to fill a casual vacancy, shall be appointed for a period of five years.
(3) If a casual vacancy occurs amongst the members, the authority who appointed the outgoing member shall appoint a person to fill the vacancy.
(4) The person so appointed shall hold office for the remainder of the period for which his predecessor, if he had continued to be a member, would have held office.
(5) An outgoing member may be re-appointed.
Chairman.
7. (1) The first chairman of the Commission shall be such senior member as the members may elect. In the event of a tie, he shall be chosen by lot.
(2) The first chairman shall hold office until the end of the first year of his term of office as a member.
(3) At the end of that year, the other senior member shall be chairman for a period of one year and thereafter the office shall be held in rotation for one year by the senior members.
(4) If a person ceases to be a member during his term of office as chairman, the person appointed as a member in his place shall hold office as chairman for the remainder of that term.
The Secretary.
8. (1) The Commission shall have a secretary.
(2) The secretary shall be the junior member who was appointed to the Commission by the authority other than that by whom the senior member who is the chairman for the time being was appointed.
Resignation and removal of members.
9. A member may be removed from office by, and may resign by letter addressed to, the authority by whom he was appointed.
Offices.
10. The Commission shall have an office in the State and an office in Northern Ireland.
Common seal.
11. (1) The common seal of the Commission shall, when applied to a document, be attested by the signature of one member appointed by the Minister and one member appointed by the Ministry.
(2) Judicial notice shall be taken of the common seal of the Commission and every document purporting to be an instrument made by the Commission and to be sealed with the common seal of the Commission and to be attested in accordance with this para graph shall, unless the contrary is shown, be received in evidence and be deemed to be such instrument without further proof.
Contracts and instruments not under seal.
12. Any contract or instrument which, if entered into or executed by an individual, would not require to be under seal may be entered into or executed on behalf of the Commission by any person generally or specially authorised by the Commission for that purpose.
Procedure at meeting.
13. (1) The quorum for a meeting of the Commission shall be two, of whom one shall be a member appointed by the Minister and the other shall be a member appointed by the Ministry.
(2) Every question at a meeting shall be decided by the votes of the majority of those present and voting.
(3) In case of an equal division of votes at a meeting at which all the members are present and voting, the chairman shall have a second or casting vote.
(4) Subject to subparagraph (1), the Commission may act notwithstanding vacancies in its membership.
(5) Subject to the provisions of this Schedule, the Commission may regulate, by standing orders or otherwise, its procedure and business.
Minutes.
14. The secretary shall keep minutes of the proceedings of the Commission and each member of the Commission shall have the right to inspect and make extracts from the minutes.
Power to acquire and dispose of land.
15. The Commission may purchase and take on lease such land and build, equip and maintain such premises as it considers necessary for the performance of its functions and may sell or lease any such land or premises no longer required by it for that purpose.
Staff.
16. (1) The Commission may employ such staff as it considers necessary for the performance of its functions.
(2) The numbers, grades, remuneration and conditions of employment of members of the staff shall be such as the Commission, with the approval of the Minister and the Ministry, may determine.
(3) On the establishment date the persons who, immediately before that date, were employed by the Moville Board or the board of conservators for the Londonderry District shall become members of the staff of the Commission on the same conditions as those subject to which they were so employed.
Accounts and audit.
17. (1) The accounts of the Commission shall be made up to the 30th day of September in each year.
(2) The accounts for each year shall be audited by an auditor appointed by the Minister and an auditor appointed by the Ministry.
(3) The fees of auditors and the expenses of audits shall be paid by the Commission.
(4) Copies of the audited accounts and of the report of the auditors thereon shall, immediately after the audit, be sent by the auditors to the Minister and to the Ministry.
Annual report.
18. The Commission shall annually make to the Minister and the Ministry a report of its work during the preceding year.
Expenses of members.
19. The Commission shall pay to each of its members such travelling, maintenance and incidental expenses incurred by him as the authority by whom he was appointed may sanction.
FOURTH SCHEDULE>.
The Advisory Council for the Foyle Area.
Constitution.
1. The Advisory Council shall consist of—
(a) elected members, and
(b) ex-officio members.
Election year.
2. The year 1952 and every third successive year thereafter shall be an election year for the purpose of the subsequent provisions of this Schedule.
Elected members.
3. (1) In each election year the Commission shall conduct an election of persons to be elected members of the Advisory Council.
(2) Every person who is the holder of a fishing licence shall be entitled to vote at an election and shall have such number of votes as may be appropriate in accordance with a prescribed scale based on the amount of fees paid for fishing licences for the time being held by him.
(3) Every person who is the rated occupier of a fishery or fisheries in the Foyle Area the total rateable valuation of which is less than fifty pounds but not less than one pound shall also be entitled to vote at an election and shall have such number of votes as may be appropriate in accordance with a prescribed scale based on the amount of fishery rate paid in respect of the fishery or fisheries for the fishery year next preceding the election year.
(4) A person shall not be eligible for the office of elected member of the Advisory Council unless he resides or possesses real property in the Foyle Area.
(5) The elected members for the time being in office shall go out of office on the completion of the election of their successors.
Regulations as to elections.
4. For the purposes of elections the Commission may prescribe—
(a) the electoral divisions into which the Foyle Area is to be divided,
(b) the number (not being more than nine or less than three) of persons to be elected for each electoral division,
(c) such other provisions as it thinks proper.
Ex-officio members.
5. (1) Every person (other than the Commission) who is the rated occupier of a fishery or fisheries in the Foyle Area, the total rateable valuation of which is fifty pounds or more, shall, subject to the provisions of this paragraph, be an ex-officio member of the Advisory Council.
(2) A person shall not be an ex-officio member while any sum due by him to the Commission for fishery rate remains unpaid after the expiration of fourteen days from the date upon which it became payable.
Disqualification.
6. A person who is convicted of an offence under the Fisheries Acts or against this Act shall be disqualified from being a member of the Advisory Council for the period of seven years from the date of conviction.
Chairman and vice-chairman.
7. (1) The Advisory Council shall, at its first meeting after each election and as occasion requires, elect one of its members to be chairman and another of its members to be vice-chairman.
(2) Subject to subparagraph (5) the person elected to be chairman or vice-chairman shall, unless he sooner dies, resigns or becomes disqualified, hold office until the election of his successor.
(3) The chairman and vice-chairman shall be eligible for reelection.
(4) The chairman or vice-chairman may at any time resign his office.
(5) If the chairman or vice-chairman ceases to be a member of the Advisory Council he shall cease to be chairman or vice-chairman.
(6) If, at the election of chairman or vice-chairman, there is an equality of votes for two or more persons, one of those persons shall be elected by lot.
The Secretary.
8. The Advisory Council may from time to time as occasion requires appoint a person to be secretary to the council, and may at any time terminate such appointment.
Casual Vacancies.
9. (1) Whenever a casual vacancy occurs amongst the elected members, the Advisory Council may co-opt a person who is a holder of a fishing licence or a rated occupier of a fishery in the Foyle Area to fill the vacancy until the next election.
(2) The Advisory Council may act notwithstanding vacancies in its membership.
Meetings.
10. (1) At a meeting of the Advisory Council—
(a) the chairman shall, when present, be chairman of the meeting;
(b) when the chairman is absent or if the office of chairman is vacant, the vice-chairman shall, when present, be chairman of the meeting;
(c) when the chairman and vice-chairman are absent or if the offices of chairman and vice-chairman are vacant, the members of the Advisory Council who are present shall choose one of their number to be chairman of the meeting.
(2) Every question at a meeting shall be determined by a majority of the votes of the members present and voting on the question, and, in case of an equal division of votes, the chairman of the meeting shall have a second or casting vote, save where the question is the election of the chairman of the Advisory Council.
(3) The quorum for a meeting of the Advisory Council shall be such number as the Council may from time to time fix or, if no quorum is for the time being so fixed, one-third of the membership at the date of the first meeting after the previous election, any fraction being disregarded.
(4) The first meeting of the Advisory Council after each election shall be convened as soon as may be by the Commission.
(5) The Commission may at any time convene a meeting of the Advisory Council.
(6) Members of the Commission shall be entitled to attend and take part in meetings of the Advisory Council but not to vote.
(7) Subject to the provisions of this Schedule, the Advisory Council shall regulate, by standing orders or otherwise, its procedure and business.
Facilities to be provided by the Commission.
11. The Commission shall provide accommodation for the holding of meetings of the Advisory Council and such stationery and office equipment as the Council may reasonably require for the conduct of its affairs, and shall make available the services of members of the staff of the Commission to do all necessary clerical work for the Council.

Form of Appointment of River Watcher under Section 56.
