1.—San Acht seo—
ciallaíonn “Acht 1890” an Pharmacy Act (Ireland), 1875, Amendment Act, 1890;
ciallaíonn “an Chomhairle” Comhairle an Chumainn;
tá le “ceadúnach de Halla na bPoitigéirí” an bhrí a shanntar do “licentiate of Apothecaries Hall” sa Phríomh-Acht;
ciallaíonn “an tAire” an tAire Sláinte;
ciallaíonn “an Príomh-Acht” an Pharmacy Act (Ireland), 1875;
ciallaíonn “cláraithe”—
(a) maidir le cógaiseoir agus drugadóir urghnaimh, a bheith cláraithe i gclár na gcógaiseoirí agus na ndrugadóirí urghnaimh,

ciallaíonn “an Cumann” Cumann Cógaiseoirí na hÉireann.
Siopa a choimeád ar oscailt chun oidis liachta a urghnamh agus nimheanna a dhíol.
2.—(1) Ní choimeádfaidh duine siopa ar oscailt chun oidis liachta a urghnamh nó a chumasc mura rud é—
(a) gur duine údaraithe an duine agus go ndéantar an siopa agus an t-urghnamh agus cumasc oidis liachta ann a mhaoirseacht go pearsanta ag an duine féin nó ag duine údaraithe, nó
(b) gurb é an duine—
(i) ionadaí pearsanta dlíthiúil duine a raibh, tráth a bháis, siopa á choimeád ar oscailt go dleathach aige chun oidis liachta a urghnamh nó a chumasc, nó
(ii) iontaobhaí nó cúramaí duine a choimeádann siopa ar oscailt go dleathach chun oidis liachta a urghnamh nó a chumasc agus atá breithnithe ina fhéimeach nó atá ina fhéichiúnaí comhshocraíochta nó ina dhuine mímheabhrach,
agus go ndéantar an siopa agus an t-urghnamh agus cumasc oidis liachta ann a mhaoirseacht go pearsanta ag duine údaraithe, nó
(c) gur comhlacht corpraithe an duine agus go ndéantar an siopa agus an t-urghnamh agus cumasc oidis liachta ann a mhaoirseacht go pearsanta ag duine is cógaiseoir cláraithe, cógaiseoir urghnaimh cláraithe, cógaiseoir agus drugadóir urghnaimh cláraithe nó ceadúnach de Halla na bPoitigéirí agus atá ar fostú ag an gcomhlacht corpraithe i bhfeidhmeannas lánaimsire agus nach bhfuil ag gníomhú i bhfeidhmeannas den sórt céanna d'aon chomhlacht corpraithe eile ná d'aon duine údaraithe ná dó féin.
(2) Ní choimeádfaidh duine siopa ar oscailt chun nimheanna a dhíol mura rud é—
(a) gur duine údaraithe nó drugadóir cláraithe an duine agus go ndéantar an siopa a bhainistí go pearsanta ag an duine féin nó ag duine údaraithe nó ag drugadóir cláraithe, nó
(b) gurb é an duine—
(i) iondaí pearsanta dlíthiúil duine a raibh, tráth a bháis, siopa á choimeád ar oscailt go dleathach aige chun nimheanna a dhíol, nó
(ii) iontaobhaí nó cúramaí duine a choimeádann siopa ar oscailt go dleathach chun nimheanna a dhíol agus atá breithnithe ina fhéimheach nó atá ina fhéichiúnaí comhshocraíochta nó ina dhuine mímheabhrach,
agus go ndéantar an siopa a bhainistí go pearsanta ag duine údaraithe nó ag drugadóir cláraithe, nó
(c) gur comhlacht corpraithe an duine agus go mbainistítear an siopa go pearsanta ag duine is cógaiseoir cláraithe, cógaiseoir agus drugadóir urghnaimh cláraithe, ceadúnach de Halla na bPoitigéirí nó drugadóir cláraithe agus atá ar fostú ag an gcomhlacht corpraithe i bhfeidhmeannas lán-aimsire agus nach bhfuil ag gníomhú i bhfeidhmeannas den sórt céanna d'aon chomhlacht corpraithe eile, d'aon duine údaraithe ná d'aon drugadóir cláraithe ná dó féin.
(3) San alt seo ciallaíonn “duine údaraithe” cógaiseoir cláraithe, cógaiseoir agus drugadóir urghnaimh cláraithe, ceadúnach de Halla na bPoitigéirí, nó lia-chleachtóir cláraithe a thosaigh, roimh thosach feidhme an ailt seo, ar chúrsa staidéir nárbh fholáir a chríochnú chun go bhfaigheadh sé dioplóma cáiliúcháin, de réir bhrí Achtanna na Lia-Chleachtóirí, 1927 go 1961, nó cáilíocht chomhréire arna dámhadh lasmuigh den Stát agus ar éirigh leis nó a n-éireoidh leis i scrúdú sa chógaisíocht chun cáilíocht a ghnóthú ionas go ndeonófaí dó an dioplóma cáiliúcháin nó go ndámhfaí an cháilíocht chomhréire lasmuigh den Stát.
(4) Ní bheidh feidhm ag an alt seo maidir le siopa a choiméad ar oscailt chun nimheanna a dhíol ag aon duine nó aicme daoine a shonraítear i rialacháin faoi alt 14 d'Acht na Nimheanna, 1961, i gcás siopa a choiméad ar oscailt a bheith de réir forálacha na rialachán.
(5) Déanfaidh an Chomhairle, le ceadú an Aire, cibé rialacháin is cuí leis an gComhairle—
(a) chun lán-éifeacht a thabhairt d'fhorálacha an ailt seo agus chun a áirithiú go gcomhlíonfar na forálacha sin, lena n-áirítear forálacha á cheangal—
(i) taifid a choimeád i dtaobh áitribh ina gcoimeádtar siopa ar oscailt chun oidis liachta a urghnamh nó a chumasc nó chun nimheanna a dhíol agus i dtaobh daoine ar fostú i siopaí den sórt sin, agus
(ii) ráitis agus tuairisceáin a thabhairt,
agus
(b) i dtaobh siopa a choimeád ar oscailt chun oidis liachta a urghnamh nó a chumasc nó nimheanna a dhíol ag na daoine dá dtagraítear i mír (b) d'fho-alt (1) agus i mír (b) d'fho-alt (2) den alt seo, lena n-áirítear rialacháin á thoirmeasc siopa a choimeád ar oscailt amhlaidh ag na daoine sin tar éis deireadh tréimhsí a shonrófar sna rialacháin (mura mbeidh údarás acu ón gComhairle sin a dhéanamh go ceann tréimhsí a shonróidh an Chomhairle) agus rialacháin ag sonrú na dtréimhse céanna nó tréimhse éagsúla den sórt sin chun críocha éagsúla.
(6) Aon duine a sháróidh foráil den alt seo nó de rialacháin faoin alt seo beidh sé ciontach i gcion agus ar a chiontú go hachomair dlífear fíneáil nach mó ná céad punt a chur air agus, i gcás ciona leanúnaigh, fíneáil bhreise nach mó ná deich bpunt in aghaidh gach lae a leanfar den chion, nó, de rogha na cúirte, príosúnacht ar feadh aon téarma nach faide ná sé mhí nó an fhíneáil nó na fíneálacha sin agus an phríosúnacht sin le chéile.
(7) Má dhéanann comhlacht corpraithe nó duine a airbheartóídh a bheith ag gníomhú thar ceann comhlachta chorpraithe nó comhlachta neamhchorpraithe daoine cion faoin alt seo nó faoin alt díreach ina dhiaidh seo agus go gcruthófar go ndearnadh an cion le toiliú nó le ceadú, nó gur urasaíodh a dhéanamh le haon mhainneachtain ar thaobh, aon duine agus é, i gcás comhlachta chorpraithe, ina stiúrthóir air, nó é, i gcás comhlachta neamhchorpraithe, ina chomhalta de choiste bainistí nó d'údarás rialaithe eile an chomhlachta neamhchorpraithe sin, beidh an duine sin freisin ciontach sa chion.
(8) Aon toghairm nó doiciméad eile is gá a sheirbheáil ar chomhlacht corpraithe chun críocha nó i gcúrsa imeachtaí faoin alt seo nó faoin alt díreach ina dhiaidh seo féadfar é a sheirbheáil trína fhágáil ag an gcomhlacht in aon áit, nó trína chur leis an bpost cláraithe chuig an gcomhlacht go dtí aon áit, sa Stát ina seolann sé a ghnó.

3.—(1) Ní dhéanfaidh aon duine, i ndáil le haon ghnó nó fostaíocht, ainm ná teideal cógaiseora a ghlacadh ná a úsáid, go haonarach ná i gcomhcheangal le haon fhocal nó litreacha eile, ná aon ainm, teideal, breisiú, tuairisc ná deimhniú a ghlacadh ná a úsáid á chur i gcéill go bhfuil sé cláraithe i gClár na gCógaiseoirí d'Éirinn nó go n-aithníonn an dlí é a bheith cláraithe amhlaidh, mura mbeidh sé cláraithe amhlaidh.
(2) Ní dhéanfaidh aon duine, i ndáil le haon ghnó nó fostaíocht, ainm ná teideal cógaiseora agus drugadóra urghnaimh a ghlacadh ná a úsáid, go haonarach ná i gcomhcheangal le haon fhocal nó litreacha eile, ná aon ainm, teideal, breisiú, tuairisc ná deimhniú a ghlacadh ná a úsáid á chur i gcéill go bhfuil sé cláraithe i gclár na gcógaiseoirí agus na ndrugadóirí urghnaimh nó go n-aithníonn an dlí é a bheith cláraithe amhlaidh, mura mbeidh sé cláraithe amhlaidh.
(3) Ní dhéanfaidh aon duine, i ndáil le haon ghnó nó fostaíocht, ainm ná teideal drugadóra chláraithe a ghlacadh ná a úsáid, go haonarach ná i gcomhcheangal le haon fhocal nó litreacha eile, ná aon ainm, teideal, breisiú, tuairisc ná deimhniú a ghlacadh ná a úsáid á chur i gcéill go bhfuil sé cláraithe i gclár na ndrugadóirí cláraithe in Éirinn nó go n-aithníonn an dlí é a bheith cláraithe amhlaidh, mura mbeidh sé cláraithe amhlaidh.
(4) Ní úsáidfidh aon duine, i ndáil le haon ghnó, teideal, feathal ná tuairisc a thabharfadh go réasúnach le tuiscint go bhfuil aige féin nó ag duine a bheidh ar fostú sa ghnó cáilíocht áirithe maidir le díol, urghnamh nó cumasc druganna nó nimheanna mura mbeidh an cháilíocht aige féin nó ag an duine a bheidh ar fostú amhlaidh, de réir mar a bheidh.
(5) Chun críocha fho-alt (4) den alt seo, má úsáidtear aon tuairisc acu seo a leanas, eadhon, cógaslann, lia-stór, drug-stór, drug-halla, stór soláthar liachta, cógaiseoir, i ndáil le gnó a sheoltar in aon áitreabh agus arb é a bheidh ann nó ar cuid de druganna nó nimheanna a dhíol ar mionreic, measfar gur úsáid é a thabharfadh go réasúnach le tuiscint gur cógaiseoir cláraithe, cógaiseoir agus drugadóir urghnaimh cláraithe nó drugadóir cláraithe an duine a bhainistíonn agus a sheolann an gnó.
(6) Aon duine a sháróidh aon cheann de na fo-ailt roimhe seo den alt seo beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná fiche punt a chur air agus, ina theannta sin, i gcás ciona leanúnaigh, fíneáil bhreise nach mó ná ceithre phunt in aghaidh gach lae a leanfar den chion.
(7) Ní bheidh feidhm ag an alt seo maidir le ceadúnach de Halla na bPoitigéirí a choimeádann siopa ar oscailt chun oidis liachta a urghnamh nó a chumasc nó chun nimheanna a dhíol d'úsáid na tuairisce halla cógaisíochta i leith aitribh ina ndéantar an t-urghnamh nó an cumasc nó an díol.
Rialacháin do chúrsaí traenála agus scrúduithe d'iarrthóirí le haghaidh clárú.
4.—(1) Féadfaidh an Chomhairle, de réir rialacháin a dhéanfaidh an Chomhairle le ceadú an Aire, na cúrsaí traenála agus na scrúduithe a sholáthar, nó socrú a dhéanamh le haghaidh na gcúrsaí traenála agus na scrúduithe, a bheidh le déanamh ag daoine a bheidh ina n-iarrthóirí ar chlárú in aon cheann de na cláir a chothabhálann an Cumann agus féadfaidh na rialacháin an modh agus na coinníollacha a sholáthrófar traenáil a shonrú agus féadfaidh siad, go háirithe, foráil a bheith iontu—
(a) chun an Chomhairle do cheadú, chun críocha na rialachán, léachtóirí, múinteoirí agus scrúdaitheoirí,
(b) i dtaobh na gcoinníollacha a bhainfidh le daoine a ligean isteach chun na scrúduithe,
(c) chun an Chomhairle d'aithint agus do cheadú cúrsaí staidéir agus traenála agus scrúduithe foras nó comhlachtaí seachas an Cumann i gcás inar deimhin leis an gComhairle na forais nó na comhlachtaí a bheith oiriúnach chun na cúrsaí sin a sholáthar nó na scrúduithe sin a sheoladh,
(d) go ndéanfaidh na forais nó na comhlachtaí dá dtagraítear i mír (c) den fho-alt seo na ceanglais a chomhlíonadh a shonrófar sna rialacháin sula dtabharfaidh an Chomhairle aitheantas dá gcúrsaí nó dá scrúduithe,
(e) chun deimhnithe a thabhairt do dhaoine a dhéanfaidh na cúrsaí agus a ghnóthóidh na scrúduithe.
(2) I dtosach feidhme rialachán faoin alt seo—
(a) scoirfidh alt 21 den Phríomh-Acht d'éifeacht a bheith aige, agus
(b) déanfar an tagairt in alt 22 den Phríomh-Acht d'fhorálacha an Achta sin a fhorléiriú agus beidh éifeacht aici mar thagairt d'fhorálacha rialachán faoin alt seo.
Cáilíochtaí coigríche.
5.—Féadfaidh an Chomhairle, de réir rialachán a dhéanfar le ceadú an Aire, a chur faoi deara go gclárófar i gClár na gCógaiseoirí d'Éirinn duine a iarrfaidh an clárú sin agus a shuífidh chun sástachta na Comhairle go ndearna sé, lasmuigh den Stát, na cúrsaí traenála sin agus gur ghnóthaigh sé na scrúdaithe sin a shonrófar chuige sin sna rialachán.
An Chomhairle do ghearradh táillí.
6.—(1) Féadfaidh an Chomhairle táillí a ghearradh i leith aon chlárú, cuir ar ais ar chlár, deimhniú, cúrsa teagaisc a sholáthróidh an Chomhairle nó scrúdú a sheolfaidh an Chomhairle, a údaraítear le haon achtacháin nó faoi aon achtacháin a bhaineann le cógaisíocht.
(2) Féadfaidh an Chomhairle táillí iontrála a ghearradh i leith toghadh daoine chun bheith ina gcomhaltaí den Chumann faoi alt 6 den Phríomh-Acht agus féadfaidh sí táillí bliantúla a ghearradh i leith comhaltas sa Chumann.
(3) Féadfaidh an Chomhairle taillí bliantúla a ghearradh i leith daoine nach comhaltaí den Chumann a choimeád ar chláir a choimeádann an Cumann.
(4) Is é méid a bheidh in aon táille faoin alt seo cibé méid a chinnfidh an Chomhairle ó am go ham le toiliú an Aire agus féadfar táillí de mhéideanna éagsúla a chinneadh—
(a) i leith daoine a bheith ina gcomhaltaí den Chumann is daoine ar a mbeidh teideal Ánra de Chumann Cógaiseoirí na hÉireann bronnta de bhun alt 7 den Acht seo agus i leith daoine eile a bheith ina gcomhaltaí den sórt sin, agus
(b) i leith daoine a choimeád ar chláir a choimeádann an Cumann is daoine dá dtagraítear i bhfo-alt (3) den alt seo a choimeádann siopa ar oscailt chun oidis liachta a urghnamh nó a chumasc nó chun nimheanna a dhíol nó atá ar fostú i siopa a choimeádtar amhlaidh agus i leith daoine dá dtagraítear san fho-alt sin (3), seachas na daoine réamhraíte, a choimeád amhlaidh.
(5) Beidh íoc na táille iomchuí faoin alt seo ina choinníoll nach mór a chomhlíonadh sula dtabharfaidh an Chomhairle aird ar aon iarratas ar chlárú, cuir ar ais ar chlár nó i ndeimhniú, nó ar iarratas chun duine a ligean isteach chun aon chúrsa teagaisc nó scrúdú a údaraítear leis na hachtacháin a bhaineann le cógaisíocht nó fúthu.
(6) Na tagairtí atá in alt 2 agus i bhfo-alt (5) d'alt 3 den Acht seo agus in alt 14 d'Acht na Nimheanna, 1961, agus sna rialacháin faoin alt sin 14 d'aon duine acu seo a leanas, eadhon, cógaiseoir cláraithe, cógaiseoir agus drugadóir urghnaimh cláraithe agus drugadóir cláraithe, measfar gur tagairtí iad nach bhfolaíonn tagairtí d'aon duine den sórt sin a bhfuil táille is iníoctha ina leith de bhun fho-alt (3) den alt seo dlite agus gan íoc.
Anraíocht sa Chumann.
7.—Féadfaidh an Chomhairle an teideal Arna de Chumann Cógaiseoirí na hÉireann a bhronnadh ar duine ar bith.
Srian le halt 22 den Phríomh-Acht.
8.—An méid sin d'alt 22 den Phríomh-Acht a dhéanann foráil le haghaidh ceadúnaigh de Halla na bPoitigéirí a chlárú mar chógaiseoirí scoirfidh sé d'éifeacht a bheith aige—
(a) maidir le daoine is ceadúnaigh de Halla na bPoitigéirí i dtosach feidhme an ailt seo, an 31ú lá de Nollaig, 1963,
(b) maidir le daoine a bheidh, roimh an 31ú lá de Nollaig, 1962, cláraithe i Halla na bPoitigéirí mar mhic léinn de chuid an Halla, an 31ú lá de Nollaig, 1970,
(c) maidir le haon daoine eile, an 31ú lá de Nollaig, 1962.
Leasú ar alt 28 den Phríomh-Acht.
9.—Leasaítear leis seo alt 28 den Phríomh-Acht trí “or to be fined an amount not exceeding one hundred pounds” a chur isteach i ndiaidh “twelve months”.
Aisghairm.
10.—Déantar leis seo na hachtacháin a shonraítear sa Sceideal a ghabhann leis an Acht seo a aisghairm a mhéid a shonraítear sa tríú colún den Sceideal sin.
(2) Na rialacháin a rinneadh de bhun mhíreanna (2) agus (6) d'alt 16 den Phríomh-Acht agus a bheidh i bhfeidhm i dtosach feidhme an ailt seo leanfaidh siad i bhfeidhm agus mesafar gur faoi na forálacha comhréire den Acht seo a rinneadh iad, agus féadfar iad a leasú agus a chúlghairm dá réir sin.
Gearrtheideal, forléiriú, comhlua agus tosach feidhme.
11.—(1) Féadfar an tAcht Cógaisíochta, 1962, a ghairm den Acht seo.
(2) Déanfar an Príomh-Acht, Acht 1890, An tAcht Cógaisíochta, 1951, agus an tAcht seo a fhorléiriú le chéile mar aon Acht amháin agus féadfar na hAchtanna Cógaisíochta, 1875 go 1962, a ghairm díobh le chéile.
(3) Tiocfaidh an tAcht seo i ngníomh cibé lá nó laethanta a shocrófar chuige sin le hordú nó le horduithe ón Aire faoin alt seo go ginearálta nó faoi threoir aon chríche nó forála áirithe agus féadfar laethanta éagsúla a shocrú amhlaidh chun críocha éagsúla agus forálacha éagsúla.

PHARMACY ACT, 1962.
Definitions.
1.—In this Act—
“the Act of 1890” means the Pharmacy Act (Ireland), 1875, Amendment Act, 1890;
“the Council” means the Council of the Society;
“licentiate of Apothecaries Hall” has the meaning assigned to it by the Principal Act;
“the Minister” means the Minister for Health;
“the Principal Act” means the Pharmacy Act (Ireland), 1875;
“registered” means—
(a) in relation to a dispensing chemist and druggist, registered in the register of dispensing chemists and druggists,
(b) in relation to a druggist, registered in the register of registered druggists in Ireland, and
(c) in relation to a pharmaceutical chemist, registered in the Register of Pharmaceutical Chemists for Ireland;
“the Society” means the Pharmaceutical Society of Ireland.
Keeping of open shop for dispensing medical prescriptions and sale of poisons.
2.—(1) A person shall not keep open shop for the dispensing or compounding of medical prescriptions unless—
(a) the person is an authorised person and the shop and the dispensing and compounding of medical prescriptions therein are personally supervised by the person or by an authorised person, or
(b) the person is—
(i) the legal personal representative of a person who at the time of his death was lawfully keeping open shop for the dispensing or compounding of medical prescriptions, or
(ii) the trustee or committee of a person lawfully keeping open shop for the dispensing or compounding of medical prescriptions who is adjudged bankrupt or becomes an arranging debtor or becomes of unsound mind,
and the shop and the dispensing and compounding of medical prescriptions therein are personally supervised by an authorised person, or
(c) the person is a body corporate and the shop and the dispensing and compounding of medical prescriptions therein are personally supervised by a person who is a registered pharmaceutical chemist, a registered dispensing chemist and druggist or a licentiate of Apothecaries Hall and is employed by the body corporate in a whole-time capacity and is not acting in a similar capacity for any other body corporate or any authorised person or on his own behalf.
(2) A person shall not keep open shop for the sale of poisons unless—
(a) the person is either an authorised person or a registered druggist and the shop is personally managed by the person or an authorised person or a registered druggist, or
(b) the person is—
(i) the legal personal representative of a person who at the time of his death was lawfully keeping open shop for the sale of poisons, or
(ii) the trustee or committee of a person lawfully keeping open shop for the sale of poisons who is adjudged bankrupt or becomes an arranging debtor or becomes of unsound mind,
and the shop is personally managed by an authorised person or a registered druggist, or
(c) the person is a body corporate and the shop is personally managed by a person who is a registered pharmaceutical chemist, a registered dispensing chemist and druggist, a licentiate of Apothecaries Hall or a registered druggist and is employed by the body corporate in a whole-time capacity and is not acting in a similar capacity for any other body corporate, any authorised person or any registered druggist or on his own behalf.
(3) In this section “authorised person” means a registered pharmaceutical chemist, a registered dispensing chemist and druggist, a licentiate of Apothecaries Hall, or a registered medical practitioner who, before the commencement of this section, began a course of study to be gone through for the purpose of obtaining a qualifying diploma, within the meaning of the Medical Practitioners Acts, 1927 to 1961, or a corresponding qualification awarded outside the State and who has passed or passes an examination in pharmacy in order to qualify for the grant of the qualifying diploma or the award of the corresponding qualification outside the State.
(4) This section shall not apply in relation to the keeping of open shop for the sale of poisons by any person or class of persons specified in regulations made under section 14 of the Poisons Act, 1961, where the keeping of open shop is in accordance with the provisions of the regulations.
(5) The Council shall, with the approval of the Minister, make such regulations as the Council thinks appropriate—
(a) for the purpose of giving full effect to and ensuring compliance with the provisions of this section, including provisions requiring—
(i) the keeping of records in relation to premises where open shop is kept for the dispensing or compounding of medical prescriptions or the sale of poisons and in relation to persons employed in such shops, and
(ii) the furnishing of statements and returns,
and
(b) in relation to the keeping of open shop for the dispensing or compounding of medical prescriptions or the sale of poisons by the persons referred to in paragraph (b) of subsection (1) and paragraph (b) of subsection (2) of this section, including regulations prohibiting the keeping of such open shop by those persons after the expiration of periods specified in the regulations (unless authorised by the Council to do so for periods specified by the Council) and regulations specifying either the same or different such periods for different purposes.
(6) A person who contravenes a provision of this section or of regulations under this section shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding one hundred pounds and, in the case of a continuing offence, to a further fine not exceeding ten pounds for each day on which the offence is continued, or, at the discretion of the court, to imprisonment for any term not exceeding six months or to both such fine or fines and such imprisonment.
(7) Where an offence under this or the next following section is committed by a body corporate or by a person purporting to act on behalf of a body corporate or an unincorporated body of persons and is proved to have been so committed with the consent or approval of, or to have been facilitated by any default on the part of, any person being, in the case of a body corporate, a director thereof, or, in the case of an unincorporated body, a member of the committee of management or other controlling authority thereof, that person shall also be guilty of the offence.
(8) Any summons or other document required to be served for the purpose or in the course of proceedings under this or the next following section on a body corporate may be served by leaving it at, or sending it by registered post to, the body at any place in the State at which it conducts its business.
Restriction on use of certain titles, emblems and descriptions.
3.—(1) A person shall not, in connection with any business or employment, take or use the name or title of pharmaceutical chemist, either alone or in combination with any other word or letters, or take or use any name, title, addition, description or certificate implying that he is registered in the Register of Pharmaceutical Chemists for Ireland or is recognised by law as being so registered, unless he is so registered.
(2) A person shall not, in connection with any business or employment, take or use the name or title of dispensing chemist and druggist, either alone or in combination with any other word or letters, or take or use any name, title, addition, description or certificate implying that he is registered in the register of dispensing chemists and druggists or is recognised by law as being so registered, unless he is so registered.
(3) A person shall not, in connection with any business or employment, take or use the name or title of registered druggist either alone or in combination with any other word or letters, or take or use any name, title, addition, description or certificate implying that he is registered in the register of registered druggists in Ireland or is recognised by law as being so registered, unless he is so registered.
(4) A person shall not use in connection with any business a title, emblem or description reasonably calculated to suggest that he or a person employed in the business possesses a particular qualification with respect to the selling, dispensing or compounding of drugs or poisons unless he or the person so employed, as the case may be, possesses the qualification.
(5) For the purposes of subsection (4) of this section, the use of any of the following descriptions, namely, pharmacy, medical stores, drug stores, drug hall, medical supply stores, chemist, in connection with a business carried on in any premises and consisting of or including the selling by retail of drugs or poisons shall be deemed to be reasonably calculated to suggest that the person managing and conducting the business on those premises is a registered pharmaceutical chemist, a registered dispensing chemist and druggist or a registered druggist.
(6) A person who contravenes any of the preceding subsections of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds, together with, in the case of a continuing offence, a further fine not exceeding four pounds for each day on which the offence is continued.
(7) This section shall not apply in relation to the use by a licentiate of Apothecaries Hall who keeps open shop for the dispensing or compounding of medical prescriptions or the sale of poisons of the description of medical hall in respect of the premises where the dispensing or compounding or the sale is carried on.
Regulations for courses of training and examinations for candidates for registration.
4.—(1) The Council may, in accordance with regulations made by the Council with the approval of the Minister, provide or make provision for the courses of training and examinations to be taken by candidates for registration in any of the registers maintained by the Society and the regulations may specify the manner in which and the conditions under which training shall be provided and may, in particular, provide—
(a) for the approval by the Council for the purposes of the regulations of lecturers, teachers and examiners,
(b) for the conditions of admission to the examinations,
(c) for the recognition and approval by the Council of courses of study and training and of examinations of institutions or bodies other than the Society where the Council are satisfied that the institutions or bodies are suitable for the provision of such courses or the holding of such examinations,
(d) that the institutions or bodies referred to in paragraph (c) of this subsection shall comply with requirements specified in the regulations before recognition of their courses or examinations is granted by the Council,
(e) for the granting of certificates to persons taking the courses and passing the examinations.
(2) On the commencement of regulations under this section—
(a) section 21 of the Principal Act shall cease to have effect, and
(b) the reference in section 22 of the Principal Act to the provisions of that Act shall be construed and have effect as a reference to the provisions of regulations under this section.
Foreign qualifications.
5.—The Council may, in accordance with regulations made with the approval of the Minister, cause to be registered in the Register of Pharmaceutical Chemists for Ireland a person who applies for such registration and shows to the satisfaction of the Council that he has undergone, outside the State, such courses of training and passed such examinations as are specified for the purpose in the regulations.
Charging of fees by the Council.
6.—(1) The Council may charge fees for any registration, restoration to a register, certificate, course of instruction provided by the Council or examination conducted by the Council, which is authorised by or under the enactments relating to pharmacy.
(2) The Council may charge entrance fees in respect of elections to membership of the Society under section 6 of the Principal Act and may charge annual fees in respect of membership of the Society.
(3) The Council may charge annual fees in respect of the retention on registers maintained by the Society of persons who are not members of the Society.
(4) The amount of any fee under this section shall be such amount as may from time to time be determined by the Council with the consent of the Minister, and fees of different amounts may be determined—
(a) in respect of membership of the Society by persons on whom the title of Fellow of the Pharmaceutical Society of Ireland has been conferred pursuant to section 7 of this Act and in respect of such membership by other persons, and
(b) in respect of the retention on registers maintained by the Society of persons referred to in subsection (3) of this section who keep open shop for the dispensing or compounding of medical prescriptions or the sale of poisons or are employed in a shop so kept and in respect of such retention of persons referred to in the said subsection (3) other than those aforesaid.
(5) Payment of the appropriate fee under this section shall be a condition precedent to the entertainment of any application by the Council for any registration, restoration to a register or certificate, or for admission to any course of instruction or examination which is authorised by or under the enactments relating to pharmacy.
(6) References in section 2 and subsection (5) of section 3 of this Act and in section 14 of the Poisons Act, 1961, and the regulations under the said section 14 to any of the following persons, namely, a registered pharmaceutical chemist, a registered dispensing chemist and druggist and a registered druggist, shall be deemed not to include references to any such person in respect of whom a fee payable pursuant to subsection (3) of this section is due and unpaid.
Fellowship of the Society.
7.—The Council may confer on any person the title of Fellow of the Pharmaceutical Society of Ireland.
Restriction of section 22 of the Principal Act.
8.—So much of section 22 of the Principal Act as provides for the registration of licentiates of Apothecaries Hall as pharmaceutical chemists shall cease to have effect—
(a) as respects persons who, at the commencement of this section, are licentiates of Apothecaries Hall, on the 31st day of December, 1963,
(b) as respects persons who, before the 31st day of December, 1962, are registered in the Apothecaries Hall as students of the Hall, on the 31st day of December, 1970,
(c) as respects any other persons, on the 31st day of December, 1962.
Amendment of section 28 of the Principal Act.
9.—Section 28 of the Principal Act is hereby amended by the insertion after “twelve months” of “or to be fined an amount not exceeding one hundred pounds”.
Repeals.
10.—(1) The enactments specified in the Schedule to this Act are hereby repealed to the extent specified in the third column of that Schedule.
(2) Regulations made pursuant to paragraphs (2) and (6) of section 16 of the Principal Act and in force at the commencement of this section shall continue in force and be regarded as having been made under the corresponding provisions of this Act, and they shall be capable of being amended or revoked accordingly.
Short title, construction, collective citation and commencement.
11.—(1) This Act may be cited as the Pharmacy Act, 1962.
(2) The Principal Act, the Act of 1890, the Pharmacy Act, 1951, and this Act shall be construed together as one Act and may be cited together as the Pharmacy Acts, 1875 to 1962.
(3) This Act shall come into operation on such day or days as, by order or orders made by the Minister under this section, may be fixed therefor either generally or with reference to any particular purpose or provision and different days may be so fixed for different purposes and different provisions.
