1.—Féadfar an tAcht um Chuideachta Mhór-Bhóithre Iarainn an Deiscirt (Scéim Aoisliúntas), 1947, a ghairm den Acht seo.

ciallaíonn an abairt “an Chuideachta” Córas Iompair Éireann;
ciallaíonn an abairt “an Chorparáid” Corparáid Chiste Aoisliúntais Chórais Imréitigh na nIarnród;

3.—Íocfaidh an Chuideachta leis an gCorparáid suim is comhionann le costais agus caiteachas na Corparáide maidir leis an mBille Breataineach beartaithe, pé acu a hachtófar an Bille sin nó ná hachtófar.

4.—(1) Ní thiocfaidh Cuid II den Acht seo i ngníomh mura n-achtaítear ná go dtí go n-achtófar an Bille Breataineach beartaithe.
(2) I gcás an Bille Breataineach beartaithe d'achtú ar dháta an Achta seo a rith nó roimhe sin, tiocfaidh Cuid II den Acht seo i ngníomh an lá is lá cinn trí mhí ó dháta an Achta seo a rith.
(3) I gcás an Bille Breataineach beartaithe d'achtú tar éis dáta an Achta seo a rith, tiocfaidh Cuid II den Acht seo i ngníomh an lá is lá cinn trí mhí ó dháta an Achta Bhreatainigh bheartaithe d'achtú.
CUID II.
An Sceim Aoisliuntas nua a Dhaingniu agus Forala i dTaobh Rannog C agus D den tSean-Chiste.
An dáta feidhme.
5.—Sa Chuid seo, ciallaíonn an abairt “an dáta feidhme” an dáta ar a dtiocfaidh an Chuid seo i ngníomh.
An scéim aoisliúntas nua a dhaingniú.
6.—(1) Déantar leis seo an scéim aoisliúntas nua a dhaingniú agus feidhm dlí a thabhairt di.
(2) Is tuighthe an Nua-Chiste a bheith arna bhunú faoi iontaobhas nach féidir a chúlghairm.
Costais aistrithe sócmhainní Rannóg C agus D den tSean-Chiste.
7.—Íocfaidh an Chuideachta na costais a ghabhfas agus a bhainfeas leis na sócmhainní atá ar áireamh i Rannóig C agus i Rannóig D den tSean-Chiste d'aistriú chun iontaobhaithe an Nua-Chiste.
E a bheith de dhliteanas ar an gCuideachta sochair d'íoc a mhéid nach acmhainneach an Nua-Chiste.
8.—Má bhíonn an Nua-Chiste, tráth ar bith, neamhacmhainneach chun aon tsochair d'íoc a bheas iníoctha láithreach faoin scéim aoisliúntas nua, íocfaidh an Chuideachta na sochair sin a mhéid a bheas an Nua-Chiste neamhacmhainneach chun na sochair sin d'íoc.

9.—(1) San alt seo, ciallaíonn an abairt “Acht 1944” an tAcht Iompair, 1944 (Uimh. 21 de 1944).
(2) Beidh éifeacht ag alt 45 d'Acht 1944 amhail is ná beadh na focail “agus folaíonn an abairt sin Ciste Aoisliúntais Chórais Imréitigh na nIarnród” i bhfo-alt (1) den alt sin.
(3) Athghairmtear leis seo fo-alt (8) d'alt 45 d'Acht 1944.

10.—(1) San alt seo—
ciallaíonn an abairt “na comhaltaí aistrithe” na daoine is comhaltaí ranníocacha nó comhaltaí aoisliúntais de Rannóig C nó de Rannóig D den tSean-Chiste díreach roimh an dáta feidhme;
ciallaíonn an abairt “dliteanais láithreacha na Corparáide” aon tsuim—
(a) is suim d'fhaibhrigh chun bheith dlite roimh an dáta feidhme ar scór aon íocaíochta tréimhsiúla dob iníoctha faoi Rialacha na Corparáide le comhalta aistrithe nó i leith comhalta aistrithe agus nár híocadh,
(b) aon tsuim eile a tháinig chun bheith dlite, faoi Rialacha na Corparáide, roimh an dáta feidhme do chomhalta aistrithe nó i leith comhalta aistrithe agus nár híocadh;
ciallaíonn an abairt “dliteanais teagmhasacha na Corparáide” aon tsuim a thiocfadh, mura mbeadh an t-alt seo, chun bheith dlite, faoi Rialacha na Corparáide, ar an dáta feidhme nó dá éis do chomhalta aistrithe nó i leith comhalta aistrithe, agus folaíonn sí aon dliteanas faoi Riail 6 de na Rialacha Forlíontacha atá sa Dara Sceideal a ghabhas leis na Rialacha a rinneadh faoi na Railway Clearing System Superannuation Fund Acts, 1873 to 1914.
(2) Ar an dáta feidhme—
(a) scoirfidh gach comhalta aistrithe de bheith ina chomhalta de Rannóig C nó de Rannóig D (pé acu é) den tSean-Chiste,
(b) scoirfidh dliteanais láithreacha na Corparáide agus dliteanais teagmhasacha na Corparáide de bheith ina n-éilithe i gcoinne na Corparáide, agus ní beidh aon éileamh intsuite ag duine ar bith i gcoinne na Corparáide ná i gcoinne iontaobhaithe an tSean-Chiste maidir leis na dliteanais sin,
(c) tiocfaidh dliteanais láithreacha na Corparáide chun bheith, agus beid, ina muirir ar an Nua-Chiste agus déanfaidh iontaobhaithe an Nua-Chiste iad d'íoc as an Nua-Chiste.
(3) Íocfaidh an Chuideachta leis an gCorparáid suim is comhionann le haon chaiteachas a mbeidh an Chorparáid tar éis dul faoi maidir le Rannóig C nó Rannóig D den tSean-Chiste a riaradh agus nár híocadh as Rannóig C nó as Rannóig D den tSean-Chiste roimh an dáta feidhme.
AN SCEIDEAL.
An Sceim Aoisliuntas Nua.
1.—Is é is ainm don scéim seo “Scéim Aoisliúntas Cléireach agus Oifigeach Tuarastail (M.I.D.), Córas Iompair Éireann” agus is i mBaile Atha Cliath a bheas oifigí na scéime.
2.—(1) Sa scéim seo tá leis na habairtí seo a leanas na bríonna faoi seach a ceaptar dóibh sa riail seo mura bhfuil aon ní ar neamhréir leis sin san abhar nó sa chomhthéacs:—
ciallaíonn “an chuideachta” Córas Iompair Éireann;
ciallaíonn “na stiúrthóirí” na daoine is stiúrthóirí de thuras na huaire ar an gcuideachta;
ciallaíonn “na hiontaobhaithe” Folucht Iompair Teoranta nó an t-iontaobhaí nó na hiontaobhaithe eile de thuras na huaire don scéim seo;
ciallaíonn “an tAire” an tAire Tionscail agus Tráchtála;
ciallaíonn “an ciste” an ciste a bunaítear leis an scéim seo;
ciallaíonn “oifigeach nó cléireach tuarastail”
(a) oifigeach nó seirbhíseach (fireannach nó baineannach) lena n-íoctar tuarastal atá socair do réir ráta sa bhliain; nó
(b) duine in aon ghrád de na gráid mhaoirseoireachta; nó
(c) banchléireach sa tseirbhís lena n-íoctar luach saothair atá socair ar shlí seachas do réir ráta sa bhliain;
ciallaíonn “na gráid mhaoirseoireachta” na gráid sin a dtugtar an tuairisc sin orthu sna comhaontuithe iomaí idir Cuideachta Mhór-Bhóithre Iarainn an Deiscirt agus ceardchumainn iomaí i dtaobh rátaí páighe agus/nó coinníollacha seirbhíse;
ciallaíonn “an tseirbhís” seirbhís na cuideachtan nó seirbhís Chuideachta Mhór-Bhóithre Iarainn an Deiscirt i gcáil oifigigh nó chléirigh thuarastail;
ciallaíonn “an sean-chiste” ciste Chorparáid Chiste Aoisliúntais Chórais Imréitigh na nIarnród;
ciallaíonn “comhalta ranníocach” comhalta, séachas comhalta aoisliúntais, den scéim nó de Rannóig C nó de Rannóig D den tsean-chiste;
ciallaíonn “comhalta aoisliúntais” comhalta den scéim nó de Rannóig C nó de Rannóig D den tsean-chiste atá tar éis teacht i dteideal sochair d'fháil fúithi;
ciallaíonn “dáta an aistrithe” an lá a déanfar Rannóga C agus D den tsean-chiste d'aistriú chun na n-iontaobhaithe chun tairbhe an chiste;
ciallaíonn “comhalta roimh 1913” comhalta a tháinig chun bheith ina chomhalta ranníocach roimh an gcéad lá d'Iúil, 1913;
ciallaíonn “comhalta 1913-1941” comhalta a tháinig chun bheith ina chomhalta ranníocach tar éis an tríochadú lá de Mheitheamh, 1913, agus roimh an 1ú lá d'Iúil, 1941;
ciallaíonn “comhalta d'éis 1941” comhalta a tháinig chun bheith ina chomhalta ranníocach an chéad lá d'Iúil, 1941, nó dá éis;
ciallaíonn “an coiste” an coiste a ceapfar ó am go ham faoi na rialacha seo;
ciallaíonn “na coisteoirí ranníocóirí” na comhaltaí den choiste a cheapfas na comhaltaí ranníocacha ó am go ham;
ciallaíonn “na coisteoirí stiúrthóirí” na comhaltaí den choiste a cheapfas na stiúrthóirí ó am go ham;
ciallaíonn “na hiniúchóirí” an bheirt iniúchóirí don chiste a luaitear i Riail 50 den scéim seo;
ciallaíonn “an rúnaí” an duine is sealbhóir de thuras na huaire ar oifig an rúnaí don choiste;
ciallaíonn “dochtúir oifigiúil” duine de na dochtúirí oifigiúla don chuideachta nó dochtúir oifigiúil arna cheapadh ag an gcoiste;
ciallaíonn “cruinniú ginearálta” cruinniú ginearálta de na comhaltai ranníocacha arna ghairm agus arna chóiriú go cuí agus aon atráthú ar an gcruinniú sin;
ciallaíonn “mí” mí caileandair.
(2) Sa scéim seo, ach amháin mar a n-éilíonn an comhthéacs a mhalairt:—
(a) focail lena ngabhann brí na huimhreach uatha folaíd an uimhir íolra;
(b) focail lena ngabhann brí na huimhreach iolra folaíd an uimhir uatha;
(c) focail lena ngabhann brí na firinscne folaíd an bhaininscne.
3.—Bunaítear an ciste chun blianachta agus sochair eile a sholáthar le haghaidh:—
(a) daoine a bhí i bhfostaíocht Chuideachta Mhór-Bhóithre Iarainn an Deiscirt díreach roimh an 1ú lá d'Eanáir, 1945, agus a bheas sa tseirbhís ar dháta an aistrithe nó a raghas sa tseirbhís i ndiaidh an dáta sin, agus
(b) daoine is comhaltaí aoisliúntais díreach roimh dháta an aistrithe.
4.—Déanfaidh na hiontaobhaithe socrú chun go n-íocfar as an gciste na costais, na muirir agus an caiteachas uile facina raghfar go cuí ag riaradh an chiste agus ná fuil aon tsocrú eile déanta leis an scéim seo chun iad d'íoc agus a ghlanadh.
5.—(1) Is é Folucht Iompair Teoranta céad-iontaobhaí na scéime seo.
(2) Dílsítear sa chuideachta an chumhacht chun iontaobhaí nó iontaobhaithe nua don chiste a cheapadh tar éis dul i gcomhairle leis an gcoiste agus faoi réir ceaduithe an Aire.
(3) Dílsítear sa chuideachta an chumhacht chun iontaobhaí a chur as oifig mar iontaobhaí don scéim tar éis dul i gcomhairle leis an gcoiste agus le toiliú an Aire.
(4) Má tharlann aon tráth ná beidh aon iontaobhaí don chiste ann féadfaidh an chuideachta gníomhú mar iontaobhaí don chiste go dtí go gceapfar iontaobhaí nó iontaobhaithe nua.
(5) Má dhéanann an chuideachta aon tráth, le toiliú an Aire, pearsain a cheapadh ina n-iontaobhaithe in ionad Foluchta Iompair Teoranta nó in ionad aon chorparáide a bheas ina hiontaobhaí don scéim seo, ní mó ná cúigear an líon iontaobhaithe a ceapfar amhlaidh agus, má tharlann aon tráth gur lú ná triúr a lion, déanfaidh an chuideachta, le toiliú an Aire, iontaobhaí nua amháin nó níos mó a cheapadh ionas go mbeidh triúr iontaobhaí ar a laghad ann.
6.—(1) Bunófar an ciste ar dháta an aistrithe.
(2) Beidh an ciste comhdhéanta díobh seo a leanas:—
(a) an t-airgead, na sócmhainní agus na suncála sin a haistreofar ón sean-chiste;
(b) ranníocaíochta na gcomhaltaí ranníocacha;
(c) ranníocaíochta na cuideachtan;
(d) aon ús ó airgead a shuncáil is leis an gciste agus a bheas ar láimh ag na hiontaobhaithe; agus
(e) aon tsuimeanna eile a híocfar ó am go ham leis na hiontaobhaithe nó leis an gcoiste chun críocha na scéime seo.
7.—(1) Dílseofar an ciste sna hiontaobhaithe agus coimeádfaidh na hiontaobhaithe cuntais chuí ar an gciste agus déanfar na cuntais sin d'iniúchadh mar foráltar anseo ina dhiaidh seo.
(2) Aon airgead leis an gciste a bheas ar láimh ag na hiontaobhaithe agus ná beidh ag teastáil chun críocha láithreacha na scéime seo, déanfar, a luaithe is féidir, é a shuncáil in ainm nó faoi urlámhas na n-iontaobhaithe i pé urrúis is dóigh leis an gcuideachta, tar éis dul i gcomhirale leis an gcoiste, is cuí nó féadfar é a thabhairt ar iasacht don chuideachta agus é inaisíochta arna éileamh faoi ráta úis comhaontaithe.
8.—Déanfaidh an coiste an scéim seo a riaradh.
9.—(1) Beidh na hiontaobhaithe i seilbh an chiste, ar iontaobhas, as ioncam an chéanna agus, a mhéid is gá sin, as an gcaipiteal chun socrú a dhéanamh (mar luaitear sa chéad mhír ina dhiaidh seo den riail seo) le haghaidh na sochar is iníochta faoin scéim seo.
(2) Déanfaidh na hiontaobhaithe socrú chun na sochair go léir faoin scéim d'íoc trí pé suimeanna a lóisteáil ó am go ham i gcuntas reatha ar leithligh a choimeádfas cuntasóir na cuideachtan i mbanc chun na críche sin is suimeanna is dóigh leis na hiontaobhaithe, do réir sonraí deimhnithe a bhéarfas an coiste do na hiontaobhaithe, is gá chun go bhféadfar an t-airgead go léir is iníoctha go cuí as an gciste d'íoc ó am go ham, Áiritheoidh na hiontaobhaithe go dtabharfar cuntas dóibh mar is cuí ar aon iarmhéid neamhchaite a bheas sa chuntas reatha seo ó am go ham,
(3) Na híocaíochta go léir a bheas dlite as an gciste do chomhaltaí aoisliúntais agus do dhaoine eile, is as an airgead a bheas lóisteálta chun creidiúna an chuntais ar leithligh mar adúradh a híofar iad, trí sheiceanna a bheas tarraingte ar an gcuntas sin agus nfhar aon tslí eile. Ullamhóidh an cuntasóir sin na seiceanna uile a tarraingeofar ar an gcuntas sin agus déanfaidh an cuntasóir sin agus Rúnaí na cuideachtan nó a n-ionadaithe na seiceanna sin a shíniú. Soláthróidh an coiste na liostaí, na cuntais agus na cruthúnachta is gá chun a chumasú don chuntasóir na seiceanna d'ullmhú agus beidh gach liosta, cuntas agus cruthúnacht den tsórt sin sínithe ag coisteoir stiúrthóirí agus ag coisteoir ranníocóirí agus ag rúnaí an choiste. Bhéarfaidh an coiste go gcoimeádfar taifid agus cuntais chuí ar na híocaíochta go léir den tsórt sin. Déanfaidh na hiontaobhaithe, a mhéid is féidir do réir réasúin, a dheimhniú dhóibh féin go gcoimeádtar go cruinn na taifid agus na cuntais sin.
10.—(1) Ar dháta an aistrithe tiocfaidh na daoine go léir is comhaltaí aoisliúntais chun bheith, agus beidh, ina gcomhaltaí aoisliúntais den scéim seo agus tiocfaidh na daoine go léir is comhaltaí ranníocacha chun bheith, agus beid, ina gcomhaltaí ranníocacha den scéim seo.
(2) Duine a thiocfas chun bheith ina chomhalta den scéim seo de bhuaidh míre (1) den riail seo ní bheidh fáil thar n-ais aige as an gciste ná as an sean-chiste ar a ranníocaíochta ná ar ús ar a ranníocaíochta faoi fhorála Rialach 6 de na Rialacha Forlíontacha a ghabhas leis an sean-chiste de dhroim an chuideachta nó Cuideachta Mhór-Bhóithre Iarainn an Deiscirt do scor d'íocaíochta d'íoc leis an sean-chiste nó de dhroim é do scor de bheith ina chomhalta den tsean-chiste; agus déanfar gach foráil den scéim seo faoina bhfuil nó faoina mbeidh duine i dteideal na sochair chéanna d'fháil a bheadh sé i dteideal d'fháil as an sean-chiste a léiriú mar fhorála faoi réir forál na míre seo.
(3) Bean a bheas ar buan-fhostú ar dháta an aistrithe ag an gcuideachta agus a bhí ar fostú díreach roimh an 1ú lá d'Eanáir, 1945, ag Cuideachta Mhór-Bhóithre Iarainn an Deiscirt mar oifigeach nó cléireach tuarastail agus ná raibh os cionn 50 bliain d'aois an 1ú lá d'Iúil, 1941, féadfaidh sí teacht chun bheith ina comhalta ranníocach amhail ó dháta an aistrithe má chuireann sí go dtí an rúnaí, lá nach déanaí ná sé mhí tar éis dáta an aistrithe, fógra i scríbhinn go bhfuil ar intinn aici bheith ina comhalta, maraon le pé deimhnithe ó dhohctúirí leighis agus pé fianaise eile lena nglacfaidh an coiste mar chruthú go bhfuil dea-shláinte aici agus go bhfuil sí saor ó laige aigne nó choirp.
(4) Duine ar bith a bhí i bhfostaíocht Chuideachta Mhór-Bhóithre Iarainn an Deiscirt díreach roimh an 1ú lá d'Eanáir, 1945, agus a chuaigh sa tseirbhís dá éis sin agus a bheadh i dteideal teacht chun bheith ina chomhalta den tsean-chiste dá mba nár díscaoileadh Cuideachta Mhór-Bhóithre Iarainn an Deiscirt, féadfaidh sé (faoi réir é do dhéanamh do réir aon nós imeachta agus é do chomhlíonadh aon choinníll a mbeadh air déanamh dá réir nó a chomhlíonadh roimh theacht dó chun bheith ina chomhalta den tsean-chiste) teacht chun bheith ina chomhalta den scéim seo.
(5) Déanfar na modhnuithe seo a leanas sa scéim seo sa mhéid a bhaineas sí le ban-chomhalta, is é sin le rá:—
(a) cuirfear an abairt “cúig bliana caogad” in ionad “cúig bliana seascad” gach áit ina bhfuil sé;
(b) cuirfear an táible atá leagtha amach i Riail 25 in ionad gach ceann de na taiblí atá faoi seach i Rialacha 14 agus 16;
(c) cuirfear gaol cleithiúnach amháin, ná fuil thar dheich mbliana níos óige (más óige é) ná an comhalta, in ionad an duine a tuairiscítear i bhfo-mhír (a) de Riail 23, agus
(d) laghdófar cúig bliana gach aois a luaitear i bhfo-mhír (f) de Riail 23
(6) Scoirfidh comhalta ranníocach de bheith ina chomhalta ranníocach—
(a) má thagann sé chun bheith ina chomhalta aoisliúntais, nó
(b) má fhágann sé seirbhís na cuideachtan gan teacht chun bheith ina chomhalta aoisliúntais faoi na rialacha.
(7) Féadfaidh ban-oifigeach nó banchléireach tuarastail, más mian lé agus faoi réir mar foráltar anseo ina dhiaidh seo, a chomhaltas a réamhdhátú go dtí dáta ar bith nach luaithe ná an dáta ar a ndeachaigh sí sa tseirbhís nó an chéad lá d'Eanáir, 1923, pé dáta acu is déanaí, ar choinníoll go n-íocfaidh sí leis an gciste:—
(a) ranníocaíochta cúlghabhálacha ar an bhforas céanna is dá mba fear-chomhalta ranníocach í ón dáta a réamhdhátófar a comhaltas chuige go dtí dáta a glactha, agus
(b) ús iolraithe do réir ceathair faoin gcéad sa bhliain ar an ranníocaíocht chúlghabhálach sin ón dáta ar a mbeadh sé iníoctha,
ar choinníoll, ámh, má ba mhó ná cúig bliana ceathrachad d'aois i an 1ú lá d'Iúil, 1941, nach foláir a comhaltas a réamhdhátú go dtí dáta roimh an dáta ar ar shlánaigh sí cúig bliana ceathrachad d'aois agus ranníocaíochta cúlghabhálacha agus ús d'íoc leis an gciste, mar foráltar i bhfo-mhír (a) agus i bhfo-mhír (b) den mhír seo.
(8) Beidh gach comhalta den scéim seo faoi cheangal ag na rialacha.
11.—(1) Ranníocfaidh gach comhalta ranníocach (pé acu, i gcás comhalta ranníocaigh a bhí sa tseirbhís díreach roimh an 1ú lá d'Iúil, 1941, a fheidhmeos nó ná feidhmeoidh sé an rogha a forcoimeádtar do chomhaltaí den tsórt sin le mír (1) de Riail 15 chun diúltú do na sochair dá ndéantar socrú i Riail 14) suim is comhionann leis an gcéadchodán sin dá thuarastal dá ndéantar socrú sna scálaí seo a leanas, agus i gcás duine ba chomhalta ranníocach díreach roimh lá an aistrithe íocfaidh sé leis an gciste aon mhéid a bhí a ranníocaíochta i leith athuarastail ón 1ú lá d'Iúil, 1941, níos lú ná an méid a bheidís dá ríomhtaí iad do réir pé scála acu s bhaineas leis:—

(2) Féadfaidh an chuideachta na ranníocaíochta a bheas le híoc ag comhalta ranníocach faoin riail seo a bhaint ó am go ham as a thuarastal agus féadfaidh an chuideachta iad d'íoc leis an gciste do réir ordachán na n-iontaobhaithe; ach mura n-asbhaintear aon ranníocaíocht amhlaidh íocfaidh an comhalta ranníocach féin í leis an gciste do réir ordachán na n-iontaobhaithe.
(3) Ranníocfaidh an chuideachta leis an gciste suimeanna is comhionann leis na méideanna a ranníocfas na comhaltaí agus sin pé trátha a íocfas na comhaltaí a ranníocaíochta, agus íocfaidh sí gach ranníocaíocht den tsórt sin leis an gciste do réir ordachán na n-iontaobhaithe.
12. Chun sochair a ríomh faoin scéim seo is tuigthe gurb é an tsuim ar ar bunaíodh na ranníocaíochta an tuarastal.
13.—(1) Gach duine ba chomhalta aoisliúntais ar dháta an aistrithe beidh, faoi réir míre 2 den riail seo, i dteideal—
(a) na sochair agus na cearta a mbeadh teideal acu chucu as an sean-chiste, agus
(b) na liúntais forlíontacha (más ann) a dheoin an chuideachta nó Cuideachta Mhór-Bhóithre Iarainn an Deiscirt do na daoine sin,
d'fháil as an gciste ach ní bheidh teideal acu chun aon tsochair eile as.
(2) Gach duine a tháinig, an 1ú lá d'Iúil, 1941, agus dá éis, chun bheith agus a bhí, ar dháta an aistrithe, ina chomhalta aoisliúntais:—
(a) más rud é, laistigh de thrí mhí ó dháta an aistrithe, go nglacfaidh sé de roghain, trí fhógra i scríbhinn a chur chun an rúnaí, bheith i dteideal mar foráltar sa riail seo, agus
(b) go n-íocfaidh sé leis an gciste aon mhéid a raibh a ranníocaíochta i leith a thuarastail idir an 1ú lá d'Iúil, 1941, adúradh, agus dáta a scortha níos lú ná mar bheidís dá mba do réir an scála iomchuí i Riail 11 a ríomhfaí iad,
beidh sé i dteideal na sochair agus na cearta iomchuí dá ndéantar socrú anseo ina dhiaidh seo do chomhaltaí ranníocacha den chiste d'fháil, amhail ó dháta a scortha, as an gciste in ionad na sochar, na gceart agus na liúntas a bheadh é, mura mbeadh an rogha sin a ghlacadh agus an t-íoc sin a dhéanamh, i dteideal d'fháil faoi mhír (1) den Riail seo.
14.—(1) Gach comhalta ranníocach a bhí deich mbliana agus os a chionn ina chomhalta ranníocach, beidh sé, ar sheasca bliain d'aois a shlánú dhó nó aon tráth dá éis sin agus ar choinníoll go bhfágfaidh sé an tseirbhís, i dteideal scor de ranníocaíochta d'íoc agus i dteideal aoisliúntais agus beidh sé i dteideal suim chaipitil agus blianacht lena shaol d'fháil mar aoisliúntas as an gciste.
(2) Is é a bheas sa tsuim chaipitil sin suim is comhionann leis an gceathrachadú cuid den tuarastal bliantúil a bhí á fháil ag an gcomhalta ar dháta a scortha arna iolrú faoin uimhir de bhlianta iomlána a bhí sé ina chomhalta ranníocach ach gan an uimhir sin de bhlianta do dhul thar ceathracha bliain ar fad.
(3) Is é a bheas sa bhlianacht sin ná suim bhliantúil is comhionann le comhshuim na méideanna seo a leanas:—
(a) an céad-is-fichiú cuid den mheántuarastal bliantúil a bhí á fháil aige ar feadh tréimhse iomláine a chomhaltais ranníocaigh, mura mó ná ceathracha bliain an tréimhse sin, agus ar feadh na gceathracha bliain deiridh dá chomhaltas ranníocach, má bhí sé ina chomhalta ranníocach ar feadh níos mó ná ceathracha bliain, arna iolrú faoin uimhir de bhlianta iomlána a bhí sé ina chomhalta ranníocach nó faoi cheathracha, pé acu is lú; agus
(b) an céad-is-fichiú cuid den mheántuarastal bliantúil a bhí á fháil aige ar feadh na tréimhse seacht mblian dá chomhaltas ranníocach díreach roimh dháta a scortha arna iolrú faoin uimhir de bhlianta iomlána a bhí sé ina chomhalta ranníocach nó faoi cheathracha, pé acu is lú;
ar choinníoll nach lú an bhlianacht sin in aon chás ná an tsuim a taispeántar leis an scála seo a leanas:—

15.—(1) Féadfaidh gach comhalta ranníocach a bhí sa tseirbhís díreach roimh an gcéad lá d'Iúil, 1941, an rogha chun diúltú do na sochair dá ndéantar socrú i Riail 14 d'fheidhmiú mar sonraítear i mír (2) den riail seo agus ina ionad sin féadfaidh a ghlacadh de roghain na sochair chéanna agus an pinsean forlíontach céanna (más ann) d'fháil as an gciste a bheadh sé i dteideal d'fháil sna tosca agus faoi na coinníollacha a luaitear i mír (1) den Riail sin 14, dá leanadh sé de bheith ina chomhalta den tsean-chiste, agus dá leanadh na hAchta, na rialacha agus na socruithe a bhí ann díreach roimh an 1ú lá d'Eanáir, 1945, de bhaint leis.
(2) Gach comhalta ranníocach mar adúradh ar mian leis an rogha chun diúltú amhlaidh d'fheidhmiú cuirfidh sé an mian sin in iúl i scríbhinn don Rúnaí aon tráth laistigh de dhá mhí dhéag ó dháta an aistrithe mura scoire sé de bheith sa tseirbhís ar dháta is luaithe ná sin agus sa chás sin cuirfidh an mian sin in iúl roimh dháta a scortha de bheith sa tseirbhís.
16.—(1) Aon chomhalta ranníocach a bheas deich mbliana agus os a chionn ina chomhalta ranníocach agus a scoirfeas de bheith sa tseirbhís sar a mbeidh seasca bliain d'aois slán aige mar gheall ar éagumas chun a dhualgais a chomhlíonadh de dheasca tionóisce nó laige aigne nó choirp nach dá mhí-iompar féin agus a shásós an coiste maidir leis an éagumas sin, beidh sé i dteideal, faoi réir forál na rialach seo, suim chaipitil agus blianacht lena shaol arna ríomh ar an bhforas a foráltar i riail 14 d'fháil i bhfoirm aoisliúntais ar é scor de bheith sa tseirbhís ach amháin gur do réir an scála seo a leanas a bheas an méid íosta sa bhliain in ionad an scála atá leagtha amach sa riail sin: —

(2) Beidh feidhm ag na forála seo a leanas maidir le duine a bheas ag fáil blianachta faoi mhír (1) den riail seo, is é sin le rá:—
(a) féadfaidh an coiste tráth ar bith, faid a bheas sé faoi bhun seasca bliain d'aois, a cheangal air pé fianaise a mheasfaid a bheith sásúil a thabhairt ar éagumas a bheith air i gconaí agus ar an méid (más ann) atá á thuilleamh aige agus, mura dtuga sé an fhianaise sin, féadfaid a bhlianacht d'athrú, d'fhionraí nó a chúlghairm agus má chúlghairmid í féadfaid tráth ar bith an chúlghairm sin a chealú;
(b) más dóigh leis an gcoiste leor-théarnó a bheith déanta aige chun ioncam a thuilleamh féadfaidh an coiste a bhlianacht d'fhionraí nó a chúlghairm do réir mar mheasfaid is cóir igcúrsaí an cháis agus féadfaid dá réir sin méid a bhlianachta a shocrú agus d'athrú ó am go ham;
(c) más dóigh leis an gcoiste leor-théarnó a bheith déanta aige chun teacht thar n-ais agus go dtiocfaidh sé thar n-ais sa tseirbhís, féadfaidh an coiste deighleáil lena chás mar is dóigh leo is ceart agus réasúnach tar éis dóibh na tosca go léir a bhreithniú.
(3) Má déantar a bhlianacht a laghdú, d'fhionraí nó a chúlghairm mar adúradh, beidh sé, ar sheasca bliain d'aois a shlánú dhó agus ar feadh na coda eile dá shaol, i dteideal blianacht lena shaol d'fháil do réir míre (1) den riail seo pé acu a mhairfeas nó ná mairfidh a éagumas agus pé acu a bheas nó ná beidh ioncam á thuilleamh aige.
17.—Gach duine a bheas tréimhse is lú ná deich mbliana ina chomhalta ranníocach agus a scoirfeas de bheith sa tseirbhís mar gheall ar éagumas de dheasca tionóisce nó laige aigne nó choirp nach dá mhí-iompar féin agus a shásós an coiste maidir leis an éagumas sin, scoirfidh sé de bheith ina chomhalta ranníocach ar é do scor amhlaidh de bheith sa tseirbhís agus tiocfaidh chun bheith ina chomhalta aoisliúntais agus beidh sé, ar é do scor de bheith sa tseirbhís, i dteideal blianacht fiche punt sa bhliain lena shaol d'fháil faoi réir forál míre (2) de Riail 16, forála a bhainfeas lena chás.
18.—Má bhíonn duine a bheas tar éis teacht i dteideal aoisliúntais nó íocaíochta eile faoin scéim seo neamhábalta de dheasca díchumais choirp nó aigne ar a chúrsaí a bhainistí nó doiciméidí a shíniú, féadfaidh an coiste, ó am go ham, a ordú an liúntas nó an iocaíocht eile d'íoc lena bhean chéile nó le duine eile a bheas ina fheighil. Agus déanfar an t-íoc sin dá réir sin agus is tuigthe gur íoc leis an gcomhalta é agus ní bheidh aon éileamh ag an gcomhalta dá dhroim sin i gcoinne na n-iontaobhaithe ná an choiste ná an chiste.
19.—Má gheibheann aon chomhalta ranníocach bás roimh theacht dó chun bheith ina chomhalta aoisliúntais, íocfar as an gciste lena ionadaithe suim is comhionann leis an tríochadú cuid den tuarastal bliantúil a bhí á fháil aige ar dháta a bháis arna iolrú faoin uimhir de bhlianta iomlána a bhí sé ina chomhalta ranníocach nó suim is comhionann le leath an tuarastail bhliantúil sin, pé acu is mó, ar choinníoll nach lú an méid a bheas iníoctha ná an méid iomlán ranníocaíocht d'íoc an comhalta sin leis an gciste agus leis an sean-chiste maraon le suim is comhionann le dó go leith faoin gcéad ar an tuarastal iomlán ar a ndearna sé ranníocaíochta leis an gciste agus leis an sean-chiste.
20.—Ar chomhalta aoisliúntais d'fháil bháis beidh a ionadaithe i dteideal, nó, i gcás comhalta den tsórt sin a mbeifear tar éis a phinsean rialta nó cuid dá phinsean rialta a chomhshó ina chomhbhlianacht de bhun rialach 23, ar an gcomhalta agus an comhbhlianachtóir d'fháil bháis, beidh ionadaithe an té acu is marthanóir i dteideal méid d'fhail as an gciste is comhionann leis an tsuim dob iníoctha faoi Riail 19 dá mb'é lá a fuair an comhalta bás an lá roimh an lá a tháinig sé chun bheith ina chomhalta aoisliúntais, faoi réir an méid a híocadh cheana féin mar bhlianacht agus suim chaipitil ar scór an chomhalta (lena n-áirítear aon mhéid a híocadh leis an gcomhalta nó leis an gcomhbhlianachtóir i leith comhbhlianachta faoi Riail 23) a bhaint, i ngach cás, as an tsuim is iníoctha amhlaidh.
21.—Aon chomhalta ranníocach a stopfar a thuarastal de dheasca easláinte, beidh sé i dteideal, faid a fhanfas a ainm ar leabhair na cuideachtan ach gan an tréimhse a bheith níos sia ná dhá bhliain in aon chás, leanúint dá chomhaltas ar choinníoll go n-íocfar na ranníocaíochta céanna leis an gciste d'íoc an comhalta sin agus a híocadh thar a cheann sar ar stopadh a thuarastal. Tar éis na tréimhse sin deighleálfar leis do réir Rialach 16, 17 nó 18, do réir mar dhlífeas an cás.
22.—Aon chomhalta ranníocach a scoirfeas go saorálach de bheith i seirbhís na cuideachtan nó a brisfear aisti sar a dtaga sé chun bheith i dteideal aon aoisliúntais, scoirfidh sé de bheith ina chomhalta agus beidh sé i dteideal a ranníocaíochta féin, gan ús, d'fháil as an gciste agus ní bheidh aon éileamh eile aige ar an gciste. Ar choinníoll go mbeidh ag an gcuideachta, i gcás aon chomhalta den tsórt sin a brisfear as an tseirbhís mar gheall ar mhímhacántacht nó calaois, lian ar mhéid a ranníocaíochta i leith aon tsuimeanna a bheas dlite uaidh dóibh agus faoi réir an liain sin go bhféadfaidh an coiste, as a gcomhairle féin, a ordú na ranníocaíochta nó a n-iarmhéid d'íoc, go hiomlán nó go páirteach, le haon chleithiúnaí leis an gcomhalta nó le pé duine eile a chinnfeas an coiste in ionad sin d'íoc leis an gcomhalta agus déanfar an t-íoc sin dá réir sin agus is tuigthe gur íoc leis an gcomhalta é agus ní bheidh aon éileamh ag an gcomhalta dá dhroim sin i gcoinne na n-iontaobhaithe ná an choiste ná an chiste.
23.—Aon chomhalta a bheas faoi réir forál na Rialach seo beidh de roghain aige an bhlianacht a mbeidh teideal aige chuici ar theacht dó chun bheith ina chomhalta aoisliúntais faoi Riail 14 do réir an ráta a foráltar sa Riail sin (dá ngairmtear an “pinsean rialta” anseo feasta) nó aon chuid di a chomhshó ina comhbhlianacht mar sonraítear i mír (b) den riail seo agus í iníoctha le comhshaoil an chomhalta sin agus dhuine (dá ngairmtear an comhbhlianachtóir anseo feasta) den tuairisc a luaitear i mir (a) den riail seo agus le saol an té acu is marthanóir.
(a) Is é seo a leanas tuairisc an duine dá dtagartar thuas sa riail seo:—
(i) i gcás fearchomhalta phósta, a bhean chéile más beo dhi;
(ii) i gcás comhalta gan phósadh nó baintrigh fir nó baintrí, gaol cleithiúnach amháin ná fuil thar cúig bliana déag níos óige (más óige é) ná an comhalta;
(b) is é comhbhlianacht inar féidir an pinsean rialta a chomhshó, mar luaitear sa riail seo, ná:—
(i) i gcás inarb í bean chéile an chomhalta an comhbhlianachtóir, comhbhlianacht de mhéid a cinnfear do réir míre (c) den Riail seo; agus
(ii) i gcás inar gaol cleithiúnach an comhbhlianachtóir, comhbhlianacht de pé méid nó méideanna a chinnfeas an coiste ar chomhairle na n-achtúirí;
(c) is iad seo a leanas na scálaí chun pinsean rialta a chomhshó ina bhlianacht a bheas iníoctha le comhshaoil chomhalta agus a mhná céile agus le saol an mharthanóra:—

(d) má gheibheann an comhbhlianachtóir bás roimh an gcomhalta, ní raghaidh aon athrú ar mhéid na blianachta is iníoctha leis an gcomhalta;

(g) aon chomhalta ná beidh tar éis an rogha sin d'fheidhmiú laistigh den am a teorantar le mír (f) den riail seo féadfaidh sé, aon tráth laistigh de thrí mhí díreach roimh dháta a scortha, cead d'iarraidh ar an gcoiste chun an rogha sin d'fheidhmiú. Sar a dtuga an coiste an cead sin cuirfid de cheangal ar an gcomhalta dul faoi scrúdú dochtúra, ach faoina réir sin féadfaid an cead sin a thabhairt nó gan é a thabhairt do réir mar thogróid. Ní hinchúlghairmthe iarratas faoin mír seo ar chead chun an rogha sin d'fheidhmiú agus má bheirtear an cead oibreoidh an t-iarratas amhail is dá mba feidhmiú ar an roghain é ag comhalta déanta an iarratais;
(h) nuair a fheidhmeos comhalta an rogha sin ní hinchúlghairmthe an feidhmiú ach amháin sna cásanna seo a leanas, is é sin le rá:—
(i) má gheibheann an comhbhlianachtóir bás roimh an gcomhalta a theacht chun bheith ina chomhalta aoisliúntais faoi Riail 14, nó má gheibheann an comhalta aoisliúntas faoi fhorála Rialacha 16 agus 17 roimh theacht go haois scortha dhó déanfaidh sin uaidh féin cúlghairm ar fheidhmiú na roghan sin aige;
(ii) féadfaidh an Coiste as a gcomhairle féin, ar iarratas i scríbhinn d'fháil ó chomhalta aon tráth roimh scor dó nó laistigh de mhí dá éis sin, cúlghairm na roghan sin a cheadú más dóigh leo sin a bheith cóir i gcúrsaí an cháis;
(i) ar fheidhmiú na roghan sin ag aon chomhalta a bheith arna chúlghairm uaidh féin nó le cead an choiste, bhéarfar arís don chomhalta na cearta a mbeadh teideal aige chucu faoi Riail 14 de seo amhail is nár fheidhmigh sé an rogha riamh;
(j) is i scribhinn ón gcomhalta a bheas gach iarratas ar chead chun an rogha sin d'fheidhmiú agus díreofar é chun an choiste agus seachadfar é don rúnaí maille le deimhniú breithe an chomhbhlianachtóra agus, i gcás inarb í bean chéile an chomhalta an comhbhlianachtóir, le deimhniú ar an bpósadh nó le pé fianaise eile air sin is oiriúnach leis an gcoiste a ghlacadh
24.—Ar aon chomhalta do scor de bheith sa tseirbhís, féadfaidh an coiste le toiliú na cuideachtan comhaontú leis aon tsuim chaipitil a mbeidh teideal aige chuici faoin scéim a chomhshó ina blianacht fhorlíontach nó féadfaid, i gcásanna neamhghnáthacha, ag féachaint do staid shláinte nó do chúrsaí eile an chomhalta, iomlán aon bhlianachta, nó aon chuid d'aon bhlianacht, a mbeidh teideal aige chuici d'imathrú ina suim chaipitil agus cinnfidh na hachtúirí forais an chomhshó nó an imathruithe i ngach cás.
25.—Is do réir an scála seo a leanas a bheas méid íosta blianacht banchomhaltaí faoin scéim seo:—

26.—Ní lú an méid i bhfoirm aoisliúntais a gheobhaidh aon chomhalta faoin scéim seo ná an méid a mbeadh teideal aige chuige as an sean-chiste agus ó Chuideachta Mhór-Bhóithre Iarainn an Deiscirt dá mba ná hachtófaí an scéim seo.
27.—Ní bheidh aon éileamh, ach amháin mar hordaítear leis an scéim seo, ag aon chomhalta ranníocach ar an gciste.
28.—Íocfar na blianachta go léir in aghaidh an mhí, an lá deiridh de gach mí caileandair nó, más rogha leis an bhfáltóir é, i gceann tréimhsí is sia ná sin má cheadaíonn an coiste é.
29.—Ní bheidh aon chomhalta i dteideal aon tsochair as an gciste faid a bheas sé sa tseirbhís.
30.—(1) Faoi réir forál na scéime seo beidh bainistí agus rialú an chiste dílsithe i gcoiste ochtair—ar coisteoirí stiúrthóirí ceathrar acu agus ar coisteoirí ranníocóirí an ceathrar eile—a ceapfar nó a toghfar mar luaitear anseo ina dhiaidh seo.
(2) Féadfar gníomhartha uile an choiste agus na ceisteanna uile a thiocfas nó éireos os comhair an choiste a dhéanamh agus a chinneadh ag tromlach na gcomhaltaí sin den choiste a bheas i láthair agus a vótálfas ag cruinniú den choiste.
(3) Ní bheidh imeachta an choiste neamhbhaili de dhroim aon fholúntais i measc a gcomhaltaí ná de dhroim aon éalainge i gcáilíocht nó i dtoghadh aon chomhalta.
(4) Beidh an dara vóta nó réitigh, i gcás comhionannais vótaí, ag an gcathaoirleach ag cruinniú den choiste.
(5) Cúigear comhaltaí an córam ag cruinniú den choiste, ar coisteoirí stiúrthóirí beirt ar a laghad acu agus ar coisteoirí ranníocóirí beirt ar a laghad acu.
(6) Ceapfaidh an coiste cathaoirleach an choiste as líon na gcoisteoir stiúrthóirí.
(7) Is é a bheas ina chathaoirleach ar chruinniú den choiste ná cathaoirleach an choiste, má bhíonn sé i láthair, agus, má bhíonn sé as láthair an coisteoir is sinsearaí de na coisteoirí stiúrthóirí a bheas i láthair.
(8) Faoi réir na rialach seo rialóidh an coiste a nós imeachta féin.
31.—Cinnfidh an coiste na héilithe go léir a déanfar ar an gciste.
32.—Aon uair is gá go gcinnfeadh an coiste ceist fíorais beidh cead acu gníomhú ar pé cruthúnais agus toimhdeana a mheasfaid a bheith sásúil, pé acu a bheas nó ná beidh an céanna inghlactha go dlíthiúil mar fhianaise, agus is cinneadh críochnaitheach a gcinneadh.
33.—Ceapfaidh na stiúrthóirí na coisteoirí stiúrthóirí agus rialóidh na stiúrthóirí cáilíochta na gcoisteoirí stiúrthóirí, a gceapadh, agus a scor ó am go ham.
34.—(1) Toghfaidh na comhaltaí ranníocaíocha na coisteoirí ranníocóirí, agus déanfar do réir na rialachán seo a leanas maidir lena dtoghadh:—
(a) Is í an cháilíocht do choisteoir ranníocóirí é a bheith ina chomhalta ranníocach.
(b) Tar éis na coisteoirí ranníocóirí a thoghadh den chéad uair beidh toghchán ann gach trí bliana.
(c) Déanfaidh an rúnaí, sé seachtaine ar a dhéanaí roimh dháta an chruinnithe ghinearálta bhliantúil i mbliain a comórfar toghchán, fógra á iarraidh go n-ainmneofar iarrthóirí a chur, lena thaispeáint ina roinn, go dtí an t-oifigeach don chuideachta a bheas i gceannas aon roinne den chuideachta lena mbainfidh aon chomhalta ranníocach.
(d) Ní foláir ainmniú ar iarrthóir a bheith ag an rúnaí ocht lá fichead ar a laghad roimh dháta an chruinnithe bhliantúil. Ní foláir é a bheith i scríbhinn faoi shíniú ochtar comhaltaí ranníocacha éatacha agus toiliú i scríbhinn faoi láimh an iarrthóra a bheith leis.
(e) Má hainmnítear go bailí níos mó ná ceathrar iarrthóirí cuirfidh an rúnaí go dtí gach comhalta ranníocach éatach, cheithre lá déag ar a dhéanaí roimh an gcruinniú, páipéar ballóide ar a mbeidh ainmneacha na n-iarrthóirí in ord aibítre. Comhalta ranníocach ar mian leis vótáil, féadfaidh sé vótáil do cheathrar iarrthóirí ar a mhéid, agus bhéarfaidh an páipéar ballóide thar n-ais go dtí an rúnai agus cuirfidh seisean sa bhosca ballóide é.
(f) Ceapfaidh an coiste beirt scrúdanóirí a scrúdós na páipéirí ballóide tar éis 1 p.m. an lá roimh lá an chruinnithe ghinearálta bhliantiúl agus a chuirfeas an toradh in iúl don chathaoirleach ag an gcruinniú.
(g) Beidh an ceathrar iarrthóirí is mó a gheobhaidh vótaí arna dtoghadh, nó, má bhíonn comhionannas vótaí ann, cinnfear trí chrannchur cén t-iarrthóir a toghfar.
(h) Dearbhóidh cathaoirleach an chruinnithe ghinearálta bhliantiúil toradh an toghcháin, agus is cinneadh críochnaitheach an cinneadh a dhéanfaidh, maidir leis na hiarrthóirí a bheas arna dtoghadh, sa dearbhú sin.
(2) Aon chorr-fholúntas a tharlós in oifig na gcoisteoirí ranníocóirí de dhroim báis nó éirí-as, déanfaidh na coisteoirí ranníocóirí a bheas fágtha é a líonadh láithreach agus cuirfidh an coiste an ceapadh sin in iúl do na comhaltaí i pé slí a chinnfeas an coiste. Coimeádfaidh an duine a ceapfar amhlaidh a oifig go dtí an chéad toghchán eile.
35.—(1) Déanfar an chéad toghadh ar choisteoirí ranníocóirí sa bhliain 1948.
(2) Aon chomhaltaí is coisteoirí ranníocóirí chun críocha an tsean-chiste díreach roimh dháta an aistrithe beid ina gcoisteoirí ranníocóiri sealadacha go dtí go gcomórfar an chéad toghchán.
(3) Más lú ná ceathrar an líon de choisteoirí rannícóirí sealadacha faoi mhír (2) den Riail seo, déanfaidh na stiúrthóirí an oiread comhaltaí ranníocacha éatacha agus is comhionann leis an easnamh a cheapadh ina gcoisteoirí ranníocóirí sealadacha.
(4) Go dtí an chéad toghchán beidh an coiste comhdhéanta de na coisteoirí stiúrthóirí agus de na coisteoirí ranníocóirí sealadacha.
36.—Ní bheidh ar iontaobhaí ná ar chomhalta den choiste freagairt in aon chaillteanas de dhroim faillí nó sárú iontaoibhe maidir leis an gciste in aon chás inar ghníomhaigh an t-iontaobhaí nó an comhalta sin go macánta réasúnach agus inar chóir gan é a mhilléan.
37.—(1) Tionólfar an cruinniú ginearálta bliantúil ann i Meitheamh gach bliana chun an ráiteas cuntas agus an clár comhardaíochta bliantúil maraon leis an deimhniú agus an tuarascáil (más ann) ar an gcéanna ó na hiniúchóirí a ghlacadh agus chun gnó ginearálta na scéime seo a sheoladh.
(2) Tionólfar cruinnithe ginearálta urghnáthacha aon uair a ghairmfeas an coiste iad.
(3) Gairmfidh an coiste cruinniú ginearálta urghnáthach aon uair a hiarrfar sin orthu trí fhoriarratas faoi shíniú 100 ar a laghad de na comhaltaí ranníocacha éatacha.
(4) Tionólfar na cruinnithe ginearálta pé tráth agus pé áit a cheapfas an coiste ó am go ham.
(5) Gach comhalta ranníocach éatach a bheas i láthair go pearsanta nó trí ionadach, beidh vóta aige ag cruinniú ginearálta.
38.—Aon chomhalta ranníocach ar mian leis rún i dtaobh cúrsaí nó riaradh na scéime seo nó an chiste a thairiscint ag cruinniú bliantúil, ní foláir dó fógra i scríbhinn a thabhairt i slí go mbeidh sé ag an rúnai 28 lá ar a laghad roimh dháta an chruinnithe.
39.—Is i gcló nó i scríbhinn a bheas ionstraimí lena gceapfar ionadaigh ag cruinniú ginearálta, nó go páirteach i gcló agus go páirteach i scríbhinn, agus ní foláir iad a bheith sínithe ag an gceapóir, agus iad a bheith fianaithe agus iad a thabhairt don rúnaí nó iad a lóisteáil in oifig na scéime seo ocht n-uaire ceathrachad a chloig roimh an tráth a bheas ceaptha don chruinniú. Ní ceapfar ina ionadach ach comhalta ranníocach éatach, nó coisteoir arna cheapadh ag na stiúrthóirí faoi Riail 33. Is é seo a leanas foirm na hionstraime ionadachta:—

40.—Ní raghaidh aon chruinniú ginearálta i mbun aon ghnótha ná beidh leagtha amach sa bhfógra lenar gairmeadh é; ná ní cuirfear aon abhar os comhair aon chruinnithe lena bhreithniú mura mbeidh sin curtha in iúl don rúnaí ocht lá fichead roimh an gcruinniú. Féadfar gach cruinniú d'atráthú.
41.—Nuair a ghairmfeas an coiste aon chruinniú ginearálta bhéarfaid fógra lae agus fiche ar a laghad, trí fhógrán nó i pé slí eile a chinnfeas an coiste i dtaobh an lae, an ionaid agus an trátha bheas ceaptha don chruinniú ginearálta agus i gcas cruinnithe ghinearálta bhliantúil beidh ag gabhail leis an bhfógra sin an tuarascáil bhliantúil ón gcoiste agus an ráiteas cuntas deimhnithe agus an tuarascáil ó na hiniúchóirí, más ann.
42.—Is é cathaoirleach an choiste a bheas ina chathaoirleach ar aon chruinniú ginearálta ach má bhíonn seisean as láthair roghnóidh na comhaltaí ranníocacha a bheas i láthair ag aon chruinniú ginearálta cathaoirleach an chruinnithe sin as (a) líon na gcoisteoirí ranníocóirí nó, mura mbíonn coisteoir ranníocóirí i láthair, ansin (b) as líon na gcoisteoirí stiúrthóirí nó, mura mbíonn coisteoir stiúrthóirí i láthair, ansin (c) as líon na gcomhaltaí ranníocacha, ag an gcruinniú sin. I gcás comhionannais vótaí ag aon chruinniú ginearálta beidh vóta réitigh ag cathaoirleach an chruinnithe.
43.—Mura mbeidh deichniúr comhaltaí i láthair i bpearsain laistigh d'uair a chloig tar éis an trátha a bheas ceaptha do chruinniú ginearálta beidh an cruinniú arna atráthú go dtí an lá céanna an tseachtain ina dhiaidh sin san áit chéanna agus an tráth céanna agus dá réir ó sheachtain go seachtain, más gá sin, go dtí go mbeidh an deichniúr comhaltaí sin i láthair.
44.—Déanfaidh an rúnaí miontuairiscí ar imeachta aon chruinnithe ghinearálta a thaifeadadh, ag an gcruinniú sin nó a luaithe is féidir é dá éis sin; i leabhar a coimeádfar chuige sin agus síneoidh cathaoirleach an chruinnithe iad nó i gcás gan eisean dá dhéanamh nó gan é a bheith i gcumas a dhéanta síneofar iad ag aon triúr comhaltaí ranníocacha nó níos mó a bhí i láthair ag an gcruinniú sin agus beidh na miontuairiscí sin arna dtaifeadadh agus arna síniú amhlaidh ina bhfianaise dhochlaíte, mura gcruthaítear earraíd a bheith iontu, ar imeachta an chruinnithe sin.
45.—Ní bheidh aon chumhachta ag aon chruinniú ginearálta seachas mar bheirtear dó go sainraíte nó go hintuigthe leis an scéim seo.
46.—Déanfaidh an coiste ó am go ham, le toiliú na stiúrthóirí maidir leis an bpearsain a roghnófar, duine d'fhoirinn na cuideachtan a cheapadh ina rúnaí don choiste, agus féadfaidh an coiste, le toiliú na stiúrthóirí, an duine a ceapfar amhlaidh a chur as oifig.
47.—Íocfaidh an chuideachta an luach saothair as na seirbhísí go léir a déanfar ag cur na scéime seo i ngníomh.
48.—Gníomhóidh an Rúnai go ginearálta faoi orduithe an choiste, agus comhlíonfaidh na dualgais seo a leanas, is é sin le rá—
Coimeádfaidh sé na leabhair agus na páipéirí taifid a bhainfeas leis an gciste agus le gnó an chiste.
Glacfaidh agus tuairisceoidh don choiste gach iarratas ar chomhaltas den scéim seo agus ar liúntais as an gciste, gach éirí-as agus gach ní eile a bheas le cur faoi bhreithniú an choiste.
Bhéarfaidh sé fógra i dtaobh gach cruinnithe ghinearálta a ghairmfeas an Coiste.
Déanfaidh sé na miontuairiscí ar imeachta gach cruinnithe ghinearálta agus gach cruinnithe den choiste agus freastal comhaltaí an choiste a thaifeadadh.
Comhlíonfaidh sé pé dualgais eile chun críocha na scéime seo a cheapfas an coiste ó am go ham.
Cuirfidh sé faoi ndear go dtabharfar cóip den scéim seo do gach comhalta, agus bhéarfaidh sé cóip bhreise den scéim seo, arna éileamh sin air, d'aon chomhalta, agus cóip den ráiteas cuntas bliantúil maraon leis and deimhniú agus an tuarascáil (más ann) air ó na hiniúchóirí, ar choinníoll go mbeidh íocaíocht deich scillinge agus sé pingne i dteannta an éilimh sin.
49.—Féadfaidh an coiste tráth ar bith, le toiliú na stiúrthóirí, ionadaí sealadach don rúnaí a cheapadh.
50.—(1) Beidh beirt iniúchóirí ann don chiste arb é an duine is iniúchóir de thuras na huaire don chuideachta duine acu, agus déanfar an duine eile acu, dá ngairmfear iniúchóir na ranníocóirí, a cheapadh, agus sealbhóidh sé oifig, do réir na bhforál anseo ina dhiaidh seo den riail seo.
(2) A luaithe is féidir tar éis na coisteoirí ranníocóirí a bheith tofa, déanfaidh na coisteoirí ranníocóirí a toghfar comhalta ranníocach a cheapadh chun gníomhú mar iniúchóir na ranníocóirí don chiste agus cuirfid in iúl don rúnaí ainm an duine a ceapfar amhlaidh.
(3) Má tharlann corr-fholúntas in oifig iniúchóra na ranníocóirí líonfar é a luaithe is féidir tar éis dó tarlachtaint tríd na coisteoirí ranníocóirí a bheas in oifig an uair sin do cheapadh comhalta ranníocaigh.
(4) Duine a ceapfar chun oifige iniúchóra na ranníocóirí beidh sé, mura dtarlaí é d'éag, é d'éirí as nó é a theacht faoi dhícháilíocht, i seilbh na hoifige go dtí go gceapfar a chomharba tar éis an chéad toghcháin eile coisteoirí ranníocóirí.
51.—Ceapfaidh na stiúrthóirí ó am go ham achtúire nó achtúirí a chomhlíonfas na feidhmeanna a sannaítear faoin scéim seo do na hachtúirí, agus déanfaid fiosrúcháin i dtaobh staid an chiste aon uair a mheasfas na stiúrthóirí gur gá sin. Cuirfidh an chuideachta faoi ndear go ndéanfaidh an t-achtúire nó na hachtúirí fiosrú i dtaobh an chiste uair amháin ar a laghad in aghaidh gach cúig bliana agus go dtabharfaidh an t-achtuire nó na hachtúirí tuarascáil don choiste ar gach fiosrúchán den tsórt sin. Leagfar gach tuarascáil den tsórt sin os comhair an chéad chruinnithe ghinearálta bhliantúil eile. Íocfaidh an chuideachta luach saothair an achtúire nó na n-achtúirí.
52.—(1) Cuirfidh na hiontaobhaithe agus an coiste faoi ndear go gcoimeádfar cuntais iomlána fíora, suas go dtí an 31ú Nollaig gach bliain, ar an gciste agus ar na deighleála go léir leis an gciste.
(2) Iniúchfaidh na hiniúchóirí na cuntais agus bhéarfaid deimhniú ar a gcruinneas, nó bhéarfaid tuarascáil orthu in am chun go bhféadfar cóipeanna a chur go dtí na comhaltaí ranníocacha i dteannta an fhógra i dtaobh an chruinnithe ghinearálta bhliantúil.
(3) Déanfaidh na hiontaobhaithe, an coiste agus an rúnaí gach cúnamh réasúnach ar a gcumas a thabhairt do na hiniúchóirí.
53.—Cuirfidh an coiste faoi ndear go gcoimeádfar taifid iomlána fíora ar thrátha agus tosach comhaltais, ar dhátaí na gcéad ranníocaíocht, agus ar na nithe iomchuí uile eile maidir leis na comhaltaí ranníocacha, agus cuirfid faoi ndear freisin go gcoimeádfar clár de na comhaltaí ranníocacha.
54.—(1) Faoi réir forál na rialach seo féadfaidh an chuideachta, agus déanfaid, ar an gcoiste dá iarraidh sin orthu, scéim (dá ngairmtear scéim leasaitheach sa riail seo) ag leasú na scéime seo (trí bhreisiú, fágaint ar lár nó athrú) d'ullmhú agus a chur faoi bhráid an Aire.
(2) I gcás ina gcuirfear scéim leasaitheach faoi bhráid an Aire faoi mhír (1) den riail seo féadfaidh an tAire an scéim a chur thar n-ais chun na cuideachtan chun a hathbhreithnithe agus chun a curtha chuige arís nó féadfaidh, le hordú, an scéim a dhaingniú gan modhnú nó fara pé modhnú (trí bhreisiú, fágaint ar lár nó athrú) is cuí leis an Aire.
(3) Sar a ndéanfaidh nó sar a ndiúltóidh an tAire scéim leasaitheach a dhaingniú éistfidh sé na páirtithe uile ar mian leo éisteacht d'fháil agus ar dóigh leis leas a bheith acu inti.

GREAT SOUTHERN RAILWAYS COMPANY (SUPERANNUATION SCHEME) ACT, 1947.
PART I.
Preliminary and General.
Short Title.
1.—This Act may be cited as the Great Southern Railways Company (Superannuation Scheme) Act, 1947.
Definitions.
2.—In this Act—
the expression “the Company” means Córas Iompair Éireann;
the expression “the Corporation” means the Railway Clearing System Superannuation Fund Corporation;
the expression “the new Fund” means the Fund established by the new superannuation scheme;
the expression “the new superannuation scheme” means the scheme, a copy whereof is set out in the Schedule to this Act;
the expression “the old Fund” means the Fund of the Corporation;
the expression “the proposed British Bill” means a Bill, proposed to be promoted by the Corporation in the Parliament of the United Kingdom of Great Britain and Northern Ireland, providing (amongst other matters) for the transfer to the trustees of the new Fund of all the assets of the Corporation comprised in Section C and Section D of the old Fund, less the sum of £751 16s. 10d. (seven hundred and fifty-one pounds, sixteen shillings and ten pence), being an amount bearing the same proportion of the total expenses borne by the Corporation in connection with the re-organisation of the old Fund under the Railway Clearing System Superannuation Fund Act, 1941, as the membership (contributing and superannuated members) relating to the former Great Southern Railways Company bore to the total membership (contributing and superannuated members) of the old Fund as at the 30th day of June, 1941.
Reimbursement of Corporation's expenses of promoting the proposed British Bill.
3.—The Company shall pay to the Corporation a sum equal to the costs and expenses incurred by the Corporation in connection with the proposed British Bill, whether the said Bill is enacted or not.
Commencement of Part II.
4.—(1) Part II of this Act shall not come into operation unless and until the proposed British Bill has been enacted.
(2) If the proposed British Bill is enacted on or before the date of the passing of this Act, Part II of this Act shall come into operation on the day which is three months after the date of the passing of this Act.
(3) If the proposed British Bill is enacted after the date of the passing of this Act, Part II of this Act shall come into operation on the day which is three months after the date of the enactment of the proposed British Bill.
PART II.
Confirmation of new Superannuation Scheme and Provisions in relation to Sections C and D of the old Fund.
The operative date.
5.—In this Part, the expression “the operative date” means the date on which this Part comes into operation.
Confirmation of the new superannuation scheme.
6.—(1) The new superannuation scheme is hereby confirmed and given the force of law.
(2) The new Fund shall be deemed to be set up under an irrevocable trust.
Expenses of transfer of assets of Sections C and D of the old Fund.
7.—The Company shall bear the expenses incidental to and in connection with the transfer to the trustees of the new Fund of the assets comprised in Section C and Section D of the old Fund.
Liability of Company to pay benefits to the extent to which the new Fund is insufficient.
8.—In the event of the new Fund being at any time insufficient to provide for the payment of any benefits immediately payable under the new superannuation scheme, the Company shall pay the said benefits to the extent to which the new Fund is insufficient to provide for the payment thereof.
Amendment of section 45 of the Transport Act, 1944.
9.—(1) In this section, the expression “the Act of 1944” means the Transport Act, 1944 (No. 21 of 1944).
(2) Section 45 of the Act of 1944 shall have effect as if the words “and includes the Railway Clearing System Superannuation Fund” did not occur in subsection (1) of that section.
(3) Subsection (8) of section 45 of the Act of 1944 is hereby repealed.
Provisions in relation to Sections C and D of the old Fund.
10.—(1) In this section—
the expression “the transferred members” means the persons who, immediately before the operative date, are contributing or superannuated members of Section C or Section D of the old Fund,
the expression “the existing liabilities of the Corporation” means any sum, being either—
(a) a sum which accrued due before the operative date on foot of any periodical payment payable under the Rules of the Corporation to or in respect of a transferred member and which has not been paid,
(b) any other sum which became due before the operative date under the Rules of the Corporation to or in respect of a transferred member and which has not been paid;
the expression “the contingent liabilities of the Corporation” means any sum which, but for this section, would under the Rules of the Corporation become due on or after the operative date to or in respect of a transferred member, and includes any liability under Rule 6 of the Supplemental Rules contained in the Second Schedule to the Rules made under the Railway Clearing System Superannuation Fund Acts, 1873 to 1914.
(2) On the operative date—
(a) every transferred member shall cease to be a member of Section C or Section D (as the case may be) of the old Fund,
(b) the existing liabilities of the Corporation and the contingent liabilites of the Corporation shall cease to be claims against the Corporation, and no claim shall be maintainable by any person against the Corporation or the trustees of the old Fund in respect thereof,
(c) the existing liabilities of the Corporation shall be and become charges on the new Fund and shall be paid thereout by the trustees of the new Fund.
(3) The Company shall pay to the Corporation a sum equal to any expenses incurred by the Corporation in relation to the administration of Section C or Section D of the old Fund and which have not been discharged out of Section C or Section D of the old Fund before the operative date.
SCHEDULE.
The new Superannuation Scheme.
Sections 2 and 6.
Name of scheme and situation of offices.
l.—The name of this scheme is the “Córas Iompair Éireann, Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme” and the offices of the scheme shall be in Dublin.
Definitions.
2.—(1) In this scheme the following expressions have the respective meanings assigned to them in this rule unless there is something inconsistent in the subject matter or the context:—
“the company” means Córas Iompair Éireann;
“the directors” means the directors for the time being of the company;
“the trustees” means the Transport Subsidiary Limited or other trustee or trustees for the time being of this scheme;
“the Minister” means the Minister for Industry and Commerce;
“the fund” means the fund established by this scheme;
“salaried officer or clerk” means either:
(a) an officer or servant (whether male or female) remunerated at a salary fixed at a rate per annum; or,
(b) a person in any of the supervisory grades; or
(c) a woman clerk in the service remunerated otherwise than at a salary fixed at a rate per annum;
“the supervisory grades” means those grades so described in the various agreements between the Great Southern Railways Company and sundry trade unions regarding rates of pay and/or conditions of service;
“the service” means the service of the company or of the Great Southern Railways Company in the capacity of salaried officer or clerk;
“the old fund” means the fund of the Railway Clearing System Superannuation Fund Corporation;
“contributing member” means a member other than a superannuated member either of the scheme or of section C or section D of the old fund;
“superannuated member” means a member either of the scheme or of section C or section D of the old fund, who has become entitled to receive benefits thereunder;
“the date of transfer” means the day on which sections C and D of the old fund are transferred to the trustees for the benefit of the fund;
“pre-1913 member” means a member who became a contributing member before the first day of July, 1913;
“1913–1941 member” means a member who became a contributing member after the thirtieth day of June, 1913, and before the 1st day of July, 1941;
“post 1941 member” means a member who became a contributing member on or after the first day of July, 1941;
“the committee” means the committee from time to time appointed under these rules;
“the contributors' committee-men” means the members of the committee from time to time appointed by the contributing members;
“the directors' committee-men” means the members of the committee from time to time appointed by the directors;
“the auditors” means the two auditors of the fund mentioned in Rule 50 of this scheme;
“the secretary” means the person for the time being holding the office of secretary of the committee;
“medical officer” means one of the medical officers of the company or a medical officer appointed by the committee;
“general meeting” means a general meeting of the contributing members duly called and constituted and any adjournment thereof;
“month” means calendar month.
(2) In this scheme save where the context otherwise requires:—
(a) words importing the singular number include the plural number;
(b) words importing the plural number include the singular number, and
(c) words importing the masculine gender include the feminine gender.
Purpose of the fund.
3.—The fund is established for the purpose of providing annuities and other benefits for:—
(a) persons who having been in the employment of the Great Southern Railways Company immediately before the 1st day of January, 1945, are in the service on the date of transfer or enter the service after that date, and
(b) persons who immediately before the date of transfer are superannuated members.
Expenses.
4.—The trustees shall make provision for payment out of the fund of all costs charges and expenses properly incurred in administering the fund, the payment and discharge of which is not otherwise provided for by this scheme.
The Trustees.
5.—(1) The first trustee of this scheme shall be Transport Subsidiary Limited.
(2) The power of appointing a new trustee or trustees of the fund is vested in the company after consultation with the committee and subject to the approval of the Minister.
(3) The power of removing a trustee from office as trustee of this scheme is vested in the company after consultation with the committee and with the consent of the Minister.
(4) If at any time there is no trustee of the fund the company may act as trustee of the fund pending the appointment of a new trustee or trustees,
(5) If at any time the company with such consent as aforesaid appoints individuals to be trustees in place of Transport Subsidiary Limited or in place of any corporation who may be trustee of this scheme, the number of trustees so appointed shall not exceed five and, if at any time, their number is reduced below three the company with such consent as aforesaid shall forthwith appoint one or more new trustees to bring the number of the trustees to three at the least.
Constitution of the fund.
6.—(1) The fund shall be set up on the date of transfer.
(2) The fund shall consist of:—
(a) such moneys assets and investments as shall be transferred from the old fund;
(b) the contributions of the contributing members;
(c) the contributions of the company;
(d) any interest received from the investment of moneys in the hands of the trustees belonging to the fund, and
(e) any other sums which may be paid to the trustees or the committee from time to time for the purposes of this scheme.
Investment of the fund.
7.—(1) The fund shall be vested in the trustees and the trustees shall keep proper accounts of the fund which shall be audited as hereinafter provided.
(2) Any moneys in the hands of the trustees belonging to the fund and not required for the immediate purposes of this scheme, shall as soon as practicable be invested in the name, or under the control of the trustees in such securities as the company shall, after consultation with the committee think proper or may be lent to the company repayable on demand at an agreed rate of interest,
Administration of this scheme.
8.—This scheme shall be administered by the committee.
Payments and receipts.
9.—(1) The trustees shall stand possessed of the fund, upon trust, out of the income thereof, and as far as may be necessary out of the capital to make provision (as mentioned in the next paragraph of this rule) for the benefits payable under this scheme.
(2) The trustees shall make provision for the payment of all benefits under the scheme by lodging from time to time in a separate current account to be kept in a bank by the accountant of the company for that purpose such sums as according to certified details to be furnished by the committee to the trustees, the trustees shall consider necessary to enable payment to be made from time to time of all moneys properly payable out of the fund. The trustees shall ensure that any unexpended balance on this current account from time to time is duly accounted for to them.
(3) All payments due to superannuated members and others out of the fund shall be made out of the moneys lodged to the credit of the separate account as aforesaid, by cheques drawn on the said account and not otherwise, All cheques drawn on the said account- shall be prepared by the said accountant and signed by him and by the secretary of the company or their deputies. The committee shall supply the necessary lists, accounts and vouchers to enable the accountant to prepare the cheques and each such list, account and voucher shall be signed by one directors' committeeman and by one contributors' committeeman and by the secretary to the committee, The committee shall cause proper records and accounts to be kept of all such payments. The trustees shall so far as is reasonably possible satisfy themselves that such records and accounts are accurately kept.
Membership.
10.—(1) On the date of transfer all persons who are superannuated members shall become and be superannuated members of this scheme and all persons who are contributing members shall become and be contributing members of this scheme.
(2) A person who becomes a member of this scheme by virtue of paragraph (1) of this rule shall not be entitled to receive either from the fund or from the old fund a return of his contributions or of interest on his contributions under the provisions of Rule 6 of the Supplemental Rules of the old fund by reason of the cesser of payments to the old fund by the company or the Great Southern Railways Company or by reason of his having ceased to be a member of the old fund; and every provision of this scheme under which a person is or may be entitled to the same benefits as those to which he would have been entitled from the old fund shall be construed as subject to the provisions of this paragraph.
(3) A woman who is permanently employed at the date of transfer by the company and who was employed immediately before the 1st day of January, 1945, by the Great Southern Railways Company as a salaried officer or clerk, and who was not more than 50 years of age on the 1st day of July, 1941, may become a contributing member as from the date of transfer if she sends to the secretary not later than six months after the date of transfer notice in writing of her intention to become a member, together with such medical certificates and other evidence as satisfies the committee that she is of good health and free from infirmity of mind or body.
(4) Any person who was in the employment of the Great Southern Railways Company immediately before the 1st day of January, 1945, and thereafter enters the service and who would have been entitled to become a member of the old fund if the Great Southern Railways Company had not been dissolved may (subject to his complying with any procedure and satisfying any condition which he would have been required to comply with or satisfy before becoming a member of the old fund) become a contributing member of this scheme.
(5) The following modifications shall be made in this scheme in its application to a woman member, that is to say:—
(a) the expression “fifty-five years” shall be substituted for “sixty years” wherever it occurs;
(b) for each of the tables contained respectively in Rules 14 and 16, there shall be substituted the table set forth in Rule 25;
(c) for the person described in sub-paragraph (a) of Rule 23 there shall be substituted one dependent relative, who (if younger) is not more than ten years younger than the member; and
(d) each of the ages mentioned in sub-paragraph (f) of Rule 23 shall be reduced by five years.
(6) A contributing member shall cease to be a contributing member, if
(a) he becomes a superannuated member, or
(b) he leaves the service of the company without becoming a superannuated member under the rules.
(7) A woman salaried officer or clerk may, if she so desires, and subject as is hereinafter provided have her membership ante-dated to any date not earlier than the date of her entering the service or the first day of January, 1923, whichever is the later on condition that she pays to the fund:—
(a) back contributions on the same basis as if she had been a male contributing member from the date to which her membership is ante-dated until the date of her admission, and
(b) compound interest at four per centum per annum upon such back contribution from the date at which it would have been payable;
provided however that if her age at the 1st day of July, 1941, exceeded forty-five years, her membership must be ante-dated to a day preceding the date of her attaining the age of forty-five years and back contributions and interest paid to the fund, as provided in subparagraph (a) and sub-paragraph (b) of this paragraph.
(8) Every member of this scheme shall be bound by the rules.
Contributions.
11.—(1) Every contributing member (whether or not, in the case of a contributing member who immediately before the 1st day of July, 1941, was in the service, he exercises the option reserved to such members by paragraph (1) of Rule 15 to decline the benefits provided for in Rule 14) shall contribute a sum equal to such percentage of his salary as is provided for in the following scales, and in the case of a person who was a contributing member immediately before the day of transfer shall pay to the fund any amount by which his contributions in respect of his salary since the 1st day of July, 1941, have been less than they would have been if calculated in accordance with whichever of the said scales applies to him:—
(a) for each pre-1913 member:—

(2) The contributions to be made by a contributing member under this rule may be deducted from time to time by the company from his salary and paid by the company to the fund in accordance with the directions of the trustees; but if any contribution is not so deducted it shall be paid by the contributing member himself to the fund in accordance with the directions of the trustees.
(3) The company shall contribute to the fund sums equal to the amounts contributed by the members and at such times as the members make their contributions, and shall pay every such contribution to the fund in accordance with the directions of the trustees.
Salary for the purpose of this scheme.
12.—For the purpose of calculating benefits under this scheme salary shall be deemed to be the sum on which contributions have been based.
Rights of superannuated members at date of transfer.
13.—(1) Every person who was a superannuated member at the date of transfer shall subject to paragraph 2 of this rule be entitled to receive from the fund:—
(a) the benefits and rights which they would have been entitled to from the old fund, and
(b) the supplementary allowances (if any) which were granted to such persons by the company, or by the Great Southern Railways Company;
but no other benefits.
(2) Every person who on and after the 1st day of July, 1941, became and was at the date of transfer a superannuated member if:—
(a) before the expiration of three months from the date of transfer he elects, by notice in writing to the secretary, to be entitled as is in this rule provided, and
(b) he pays to the fund any amount by which his contributions in respect of his salary between the said 1st day of July, 1941, and the date of his retirement were less than they would have been if calculated in accordance with the appropriate scale in Rule 11,
shall be entitled to receive from the fund, as and from the date of his retirement, the appropriate benefits and rights hereinafter provided for contributing members of the fund in place of the benefits, rights and allowances which, save for such election and payment, he would be entitled to receive under paragraph (1) of this rule.
Superannuation allowance.
14.—(1) Every contributing member who has been such for ten years and upwards shall on attaining the age of sixty years or at any time thereafter provided he leaves the service be thereupon entitled to cease making contributions and be superannuated and shall be entitled to receive from the fund by way of superannuation allowance a capital sum and an annuity for life.
(2) The said capital sum shall be a sum equal to one-fortieth part of the annual salary of which the member was in receipt at the date of his retirement multiplied by the number of completed years during which he has been a contributing member but not exceeding forty years in all.
(3) The said annuity shall be an annual sum equal to the aggregate of:—
(a) one one-hundred-and-twentieth part of the average annual salary of which he shall have been in receipt throughout the whole period of his contributing membership, if not exceeding forty years and throughout the last forty years of his contributing membership if he has been a contributing member for more than forty years, multiplied by the number of completed years during which he has been a contributing member or forty, whichever shall be the lesser; and
(b) one one-hundred-and-twentieth part of the average annual salary of which he shall have been in receipt during the period of seven years of his contributing membership immediately prior to the date of his retirement multiplied by the number of completed years during which he shall have been a contributing member or forty, whichever shall be the lesser;
provided that such annuity shall in no case be less than the sum shown by the following scale:—

Exercise of option to decline benefits.
15.—(1) Every contributing member who immediately before the first day of July, 1941, was in the service may exercise in the manner specified in paragraph (2) of this rule the option to decline the benefits provided for in Rule 14 and in lieu thereof may elect to receive from the fund benefits and a supplementary pension (if any) the same as those to which he would have become entitled in the circumstances and under the conditions mentioned in paragraph (1) of the said Rule 14, if he had continued to be a member of the old fund, and the Acts, rules and arrangements existing immediately before the 1st day of January, 1945, had continued to apply to him.
(2) Every contributing member as aforesaid who desires to exercise the option of declining shall notify the secretary in writing of such desire at any time before the expiration of twelve months from the date of transfer unless he shall retire from the service at an earlier date in which case he shall notify such desire before the date of his retirement from the service.
Retirement through incapacity after ten years membership.
16.—(1) Any contributing member, who has been a contributing member for ten years and upwards who retires from the service before attaining sixty years of age in consequence of incapacity to perform his duties, arising from accident or mental or physical infirmity not resulting from his own misconduct, and who satisfies the committee with regard to such incapacity shall be entitled, subject to the provisions of this rule, on his retirement from the service to receive by way of superannuation allowance a capital sum and an annuity for life calculated on the same basis as is provided in Rule 14 except that the minimum amount per annum shall be in accordance with the following scale instead of the scale set forth in that rule:—

(2) The following provisions shall apply in relation to a person who is in receipt of an annuity under paragraph (1) of this rule, that is to say:—
(a) the committee may at any time, while he is under sixty years of age, require him to give such evidence as they shall deem satisfactory of his continued incapacity and of the amount of his earnings (if any) and if he shall not give such evidence may vary suspend or revoke his annuity and if they revoke the same may at any time cancel such revocation;
(b) if in the opinion of the committee he has recovered sufficiently to be able to earn an income the committee may suspend or revoke his annuity as they may think the circumstances justify and may accordingly from time to time fix and vary the amount of his annuity;
(c) if in the opinion of the committee he has recovered sufficiently to return and does return to the service the committee may deal with his case in such manner as they deem just and reasonable taking all the circumstances into consideration.
(3) If his annuity has been reduced, suspended or revoked as aforesaid he shall on attaining sixty years of age and for the remainder of his life be entitled to receive an annuity for life in accordance with paragraph (1) of this rule whether his incapacity continues or not and whether or not he is earning an income.
Retirement through incapacity before ten years membership.
17.—Every person who has been a contributing member for less than ten years and who retires from the service in consequence of incapacity arising from accident or mental or physical infirmity not resulting from his own misconduct and who satisfies the committee with regard to such incapacity shall on such retirement cease to be a contributing member and become a superannuated member and shall be entitled to receive on retirement an annuity for life of twenty pounds per annum subject to the provisions of paragraph (2) of Rule 16, which shall apply to his case.
Disability of superannuated member to manage his affairs, etc.
18.—When a person who shall have become entitled under this scheme to a superannuation allowance or other payment is unable by reason of physical or mental disability to manage his affairs or to sign documents the committee may from time to time order the payment of the allowance or other payment to his wife or other person having charge of him. And such payment shall be made accordingly and shall be deemed to be a payment to the member who shall have no claim in consequence thereof against the trustees or the committee or the fund.
Death before superannuation.
19.—If any contributing member dies before being superannuated there shall be paid out of the fund to his representatives a sum equal to one-thirtieth of the annual salary of which he was in receipt at the date of his death multiplied by the number of completed years during which he was a contributing member or a sum equal to one-half of such annual salary whichever shall be the greater provided that the amount payable shall not be less than the total amount of the contributions of such member to the fund and to the old fund together with a sum equal to two-and-a-half per centum upon the total salary upon which he has contributed to the fund and to the old fund.
Death after superannuation.
20.—Upon the death of a superannuated member his representatives shall be entitled or, in the case of such a member whose normal pension or part of whose normal pension has been converted into a joint annuity pursuant to Rule 23, upon the death of the member and the joint annuitant the representatives of the survivor of them shall be entitled to receive from the fund an amount equal to the sum which would have been payable under Rule 19 if the member had died on the day before that on which he became a superannuated member, subject in each case to a deduction from the sum so payable of the amount already paid as annuity and capital sum on account of the member (including any amount to the member or the joint annuitant in respect of a joint annuity under Rule 23).
Membership after salary is stopped in consequence of ill-health.
21.—Any contributing member the payment of whose salary shall be stopped in consequence of ill-health shall be entitled so long as his name remains on the books of the company but not in any case for a longer period than two years to continue his membership provided that the same contributions be paid to the fund as were paid by and in respect of such member prior to his salary being stopped. After the said period he shall be dealt with in accordance with Rules 16, 17 or 18, as the case may require.
Voluntary retirement or dismissal.
22.—Any contributing member who retires from the service of the company voluntarily, or is dismissed from the service of the company before becoming entitled to any superannuation allowance shall cease to be a member and shall be entitled to receive from the fund his own contributions without interest and shall have no further claim upon the fund. Provided that in the case of any such member dismissed from the service for dishonesty or fraud the company shall have a lien upon the amount of his contributions for any sums which may be due from him to them and subject to that lien the committee may in their discretion order the payment of the contributions or the balance thereof in whole or in part to any dependent of the member or such other person as the committee may determine in lieu of payment to the member and such payment shall be made accordingly and shall be deemed to be a payment to the member who shall have no claim in consequence thereof against the trustees or the committee or the fund.
Joint annuities.
23.—Any member subject to the provisions of this rule shall have the option of electing to convert the annuity to which he is entitled upon becoming a superannuated member under Rule 14 at the rate therein provided (hereinafter referred to as the “normal pension”) or any part thereof into such a joint annuity as is specified in paragraph (b) of this rule payable during the joint lives of himself or a person (hereinafter called the “joint annuitant”) of the description mentioned in paragraph (a) of this rule and during the life of the survivor of them.
(a) The description of the person above referred to in this rule is as follows:—
(i) in the case of a married male, member his wife if alive;
(ii) in the case of an unmarried member, widower or widow one dependent relative who (if younger) is not more than fifteen years younger than the member;
(b) the joint annuity into which the normal pension may be converted as mentioned in this rule shall be:—
(i) in the case where the joint annuitant is the wife of the member a joint annuity of an amount determined in accordance with paragraph (c) of this rule; and
(ii) in the case where the joint annuitant is a dependent relative a joint annuity of such amount or amounts as may be determined by the committee with the advice of the actuaries;
(c) the scales for the conversion of a normal pension into an annuity payable during the joint lives of a member and his wife and the life of the survivor shall be as follows:—

If the member's age at retirement is sixty-six years or more or if the age of his wife is outside the range of Scale A the joint annuity payable to the retired member shall be determined by the actuaries.
scale b.—annuity payable to a member's widow.
One-third of the annuity calculated in accordance with Scale A will be payable to the retired member's widow during her life commencing on the day following that on which the retired member dies.
(d) if the joint annuitant dies before the member the annuity payable to the member will continue unaltered in amount;
(e) the minimum amount of a member's normal pension which may be converted into a joint annuity shall be the whole of the normal pension if not exceeding £120; and £120 of the normal pension if the amount thereof exceeds £120; a part of the normal pension to be so converted must be a whole number of pounds and the difference between such part and the normal pension must not be less than ten pounds;
(f) the said option shall be exercisable only after the member has attained the age of fifty-four years and six months and shall only be exercisable as of right and without medical examination before the member attains the age of fifty-five years;
(g) any member who has not exercised the said option within the time limited by paragraph (f) of this rule may at any time within three months immediately before the date of his retirement apply to the committee for leave to exercise the said option. Before giving such leave the committee shall require the member to submit himself for medical examination but subject thereto may give or withhold such leave in their discretion. An application under this paragraph for leave to exercise the said option shall be irrevocable and if leave is given the application shall operate as an exercise of the option by the member making the application;
(h) every exercise by a member of the said option shall be irrevocable except in the following cases, that is to say:—
(i) if the joint annuitant dies before the member has become a superannuated member under Rule 14, or if the member is under the provisions of Rules 16 and 17 superannuated before attaining the retiring age the exercise of the said option by him shall automatically be revoked;
(ii) the committee may in their discretion on the written request of a member made at any time before or within one month after his retirement permit the revocation of the said option if in their opinion the circumstances justify the revocation;
(i) upon the exercise of the said option by any member being revoked either automatically or with the permission of the committee the member shall be remitted to the rights to which he would have been entitled under Rule 14 hereof as if the option had never been exercised by him;
(j) every application for leave to exercise the said option shall be in writing by the member and addressed to the committee and delivered to the secretary accompanied by a certificate of birth of the joint annuitant and where the joint annuitant is the member's wife a certificate of the marriage or by such other evidence thereof as the committee may think fit to accept.
Commutation of superannuation allowances.
24.—On retirement of any member from the service the committee may with the consent of the company agree with him to convert any capital sum to which he is entitled under the scheme into a supplementary annuity or in exceptional cases and having regard to the state of health or other circumstances of the member to commute the whole or part of any annuity to which he is entitled into a capital sum the basis for conversion or commutation in each case to be decided by the actuaries.
Minimum amount of annuities to female members.
25.—The minimum amount of annuities of female persons admitted to membership of this scheme shall be in accordance with the following scale:—

Minimum superannuation allowance.
26.—No member shall receive under this scheme a lesser amount by way of superannuation allowance than he would have been entitled to from the old fund and the Great Southern Railways Company if this scheme had not been enacted.
No claims on the fund outside this scheme.
27.—Save as prescribed by this scheme no contributing member shall have any claim upon the fund.
Periodical payment of annuities.
28.—All annuities shall be paid monthly on the last day of each calendar month or at the option of the recipient at greater intervals if approved by the committee.
29.—No member shall be entitled to any benefit from the fund whilst in the service.
The committee.
30.—(1) Subject to the provisions of this scheme the management and direction of the fund shall be vested in a committee of eight persons — four of whom shall be directors' committee-men and four contributors' committee-men—who shall be appointed or elected as hereinafter mentioned.
(2) All acts of the committee and all questions coming or arising before the committee may be done and decided by the majority of such members of the committee as are present and vote at a meeting of the committee.
(3) The proceedings of the committee shall not be invalidated by any vacancy among their members or by any defect in the qualification or election of any member.
(4) The chairman at a meeting of the committee shall, in case of equality of votes, have a second or casting vote.
(5) The quorum at a meeting of the committee shall be five members, of whom at least two shall be directors' committee-men and at least two shall be contributors' committee-men.
(6) The chairman of the committee shall be appointed by the committee from among the directors' committee-men.
(7) The chairman of a meeting of the committee shall be the chairman of the committee, if he is present, and in his absence, the senior directors' committee-man who is present.
(8) Subject to this rule the committee shall regulate its own procedure.
Decision of claims.
31.—The committee shall decide on all claims made upon the fund.
Decisions by the committee of questions of fact.
32.—Whenever it shall be needful for the committee to decide a question of fact they shall be at liberty to act upon such proofs and presumptions as they shall deem satisfactory, whether the same shall be legally admissible as evidence or not and their decision shall be final.
The directors committee-men.
33.—The directors' committee-men shall be appointed by the directors, and the qualifications appointment and retirement from time to time of the directors' committee-men shall be regulated by the directors.
The contributors' committee-men.
34.—(1) The contributors' committee-men shall be elected by the contributing members, and the following regulations shall be observed with regard to their election:—
(a) The qualification for a contributors' committee-man shall be that he is a contributing member.
(b) After the first election of the contributors' committee-men an election shall take place every three years.
(c) Not later than six weeks before the date of the annual general meeting in a year in which an election is to be held the secretary shall send to the officer of the company in charge of any department of the company to which any contributing member is attached a notice for exhibition in his department inviting nominations of candidates.
(d) A nomination of a candidate must reach the secretary not less than twenty-eight days before the date of the annual meeting. It must be in writing signed by eight adult contributing members, and be accompanied by a written consent signed by the candidate.
(e) If more than four candidates are validly nominated, the secretary shall send to every adult contributing member not later than fourteen days before the meeting a ballot paper showing the names of the candidates in alphabetical order. A contributing member wishing to vote may vote for not more than four candidates, and shall return the paper to the secretary who shall deposit it in the ballot box.
(f) Two scrutineers shall be appointed by the committee who shall examine the voting papers after 1 p.m. on the day before the day of the annual general meeting and notify the result to the chairman at the meeting.
(g) Those four candidates who have received the greatest number of votes shall be elected, or if there is an equality of votes the candidate to be elected shall be determined by lot.
(h) The chairman of the annual general meeting shall declare the results of the election, and his decision as to the candidates who have been elected embodied in the said declaration shall be final.
(2) Any casual vacancy in the office of contributors' committee-men caused by death or resignation shall be filled immediately by the remaining contributors' committee-men and the committee shall advise the members of such appointment in such manner as the committee shall decide. The person so appointed shall retain his office until the next election.
First election of contributors' committee-men.
35.—(1) The first election of contributors' committee-men shall take place in the year 1948.
(2) Any members who immediately before the date of transfer are contributors' committee-men for the purposes of the old fund shall be provisional contributors' committee-men until the holding of the first election.
(3) If the number of provisional contributors' committee-men under paragraph (2) of this Rule is less than four, the directors shall appoint to be provisional contributors' committee-men, a number of adult contributing members equal to the deficiency.
(4) Until the first election the directors' committee-men and the provisional contributors' committee-men shall constitute the committee.
Liabilities of trustee or member of committee.
36.—A trustee or a member of the committee shall not be held liable for any loss occasioned by negligence or breach of trust in connection with the fund in any case in which such trustee or member has acted honestly and reasonably and ought fairly to be excused.
General meetings.
37.—(1) The annual general meeting shall be held in June of each year for the purpose of receiving the annual statement of accounts and balance sheet with the certificate and report thereon (if any) of the auditors and for the conduct of the general business of this scheme.
(2) Extraordinary general meetings shall be held whenever convened by the committee.
(3) The committee shall convene an extraordinary general meeting whenever required to do so by a requisition signed by not less than 100 adult contributing members.
(4) General meetings shall be held at such time and place as the committee shall appoint from time to time.
(5) All adult contributing members who are present personally or by proxy shall have a vote at a general meeting.
Proposal of motions.
38.—Any contributing member desiring to propose at an annual meeting a motion relating to the affairs or administration of this scheme or the fund must give notice in writing so as to reach the secretary not less than 28 days before the date of the meeting.
Proxies at a general meeting.
39.—Instruments appointing proxies at a general meeting shall be either printed or written, or partly printed and partly written and signed by the appointer, and attested and given to the secretary, or deposited at the office of this scheme forty-eight hours before the time appointed for the meeting. No person shall be appointed a proxy except an adult contributing member, or a committee-man appointed by the directors under Rule 33. The following shall be the form of the instrument of proxy:—

Business of meetings.
40.—No general meeting shall enter upon any business not set forth in the notice by which it shall have been convened; neither shall any subject be brought before any meeting for discussion unless the secretary shall have been apprised twenty-eight days before the meeting. All meetings may be adjourned.
Notice of meetings.
41.—The committee calling any general meeting shall give not less than twenty-one days notice by advertisement or otherwise as the committee may determine of the day, place and hour appointed for the general meeting and in the case of an annual general meeting this notice shall be accompanied by the annual report of the committee and the certified statement of accounts and auditors' report, if any.
Chairman of meeting.
42.—The chairman of the committee shall be the chairman of any general meeting but in his absence the chairman of any general meeting shall be chosen by the contributing members at such meeting from (a) the contributors' committee-men, or if none is available, then from (b) the directors' committee-men, or if none is available, then from (c) the contributing members, at such meeting. In the case of equality of votes at any general meeting the chairman of the meeting shall have a casting vote.
Quorum at meetings
43.—If ten members shall not be present in person within one hour after the time appointed for a general meeting it shall stand adjourned to that day week at the same place and hour and so if need be from week to week until such ten members shall be present.
Minutes of proceedings at meetings.
44.—Minutes of the proceedings of any general meeting shall there at or with all convenient speed thereafter be recorded by the secretary in a book kept for that purpose and be signed by the chairman of the meeting, or in the case of his default or incapacity by any three or more contributing members present thereat and such minutes when so recorded and signed shall in the absence of proof of error therein be conclusive evidence of such proceedings.
Powers of meetings.
45.—No general meeting shall have any powers except such as are conferred upon it expressly or by implication by this scheme.
The secretary.
46.—The committee shall from time to time, with the consent of the directors as to the individual selected, appoint one of the staff of the company to be secretary to the committee, and the person so appointed may at any time be removed from office by the committee with the like consent.
Remuneration for services performed.
47.—The remuneration for all services performed in carrying this scheme into effect shall be paid by the company.
Duties of the secretary.
48.—The Secretary shall act generally under the orders of the committee, and shall perform the following duties, that is to say—
He shall keep the record books and papers relating to the fund and the business thereof.
He shall receive and report to the committee all applications for membership of this scheme and for allowances from the fund, resignations and other matters to be brought under the consideration of the committee.
He shall give notice of all general meetings called by the committee.
He shall record the minutes of the proceedings of all general meetings and of all meetings of the committee and the attendance of members of the committee.
He shall perform such other duties for the purposes of this scheme as the committee from time to time appoint.
He shall see that each member is supplied with a copy of this scheme, and he shall supply on demand to any member an additional copy of this scheme, and a copy of the annual statement of accounts with the certificate and report thereon (if any) of the auditors, provided such demand is accompanied by a payment of two shillings and sixpence.
Substitute for secretary.
49.—A temporary substitute for the secretary may at any time be appointed by the committee with the consent of the directors.
The auditors of the fund.
50.—(1) There shall be two auditors of the fund of whom one shall be the auditor for the time being of the company and the other, who shall be called the contributors' auditor, shall be appointed and hold office in accordance with the subsequent provisions of this rule.
(2) As soon as may be after the election of contributors' committee-men the contributors' committee-men elected thereat shall appoint a contributing member to act as contributors' auditor of the fund and shall notify to the secretary the name of the person so appointed.
(3) A casual vacancy occurring in the office of contributors' auditor shall be filled as soon as may be after such occurrence by the appointment of a contributing member by the contributors' committee-men then in office.
(4) A person appointed to the office of contributors' auditor shall, subject to his death, resignation or disqualification, hold the office until his successor is appointed after the next election of contributors' committee-men.
Actuary—appointment duties and remuneration
51.—The directors shall from time to time appoint an actuary or actuaries who shall discharge the functions assigned under this scheme to the actuaries, and shall carry out investigation of the position of the fund whenever the directors consider it necessary. The company shall cause an investigation of the fund to be made by the actuary or actuaries not less often than once in every five years, and a report on each such investigation to be made to the committee by the actuary or actuaries. Each such report shall be laid before the next following annual general meeting. The remuneration of the actuary or actuaries shall be paid by the company.
Accounts.
52.—(1) The trustees and the committee shall cause full and true accounts to be kept up to the 31st December in each year of the fund, and all dealings with the fund.
(2) The accounts shall be audited by the auditors who shall certify as to their accuracy, or furnish a report thereon in time to enable copies to be sent to the contributing members with the notice of the annual general meeting.
(3) The trustees, the committee and the secretary shall give to the auditors all reasonable assistance in their power.
Records.
53.—The committee shall cause full and true records to be kept of the times and commencement of membership, of the dates of the first contributions, and all other relevant matters in relation to the contributing members, and shall also cause to be kept a register of the contributing members.
Amendment of scheme.
54.—(1) Subject to the provisions of this rule the company may, and shall, if so required by the committee prepare and submit to the Minister a scheme (in this rule referred to as an amending scheme) amending this scheme (whether by addition, omission or variation).
(2) Where an amending scheme is submitted to the Minister under paragraph (1) of this rule the Minister may refer the scheme back to the company for reconsideration and fresh submission or by order confirm the scheme either without modification or with such modification (whether by way of addition, omission or variation) as the Minister thinks proper.
(3) Before confirming or refusing to confirm an amending scheme the; Minister shall hear all parties desirous of being heard and appearing to him to be interested therein.
(4) No amending scheme shall relate to either Rule 3 or Rule 26 or operate so as to prevent a member of this scheme who has been a member of Section C or Section D of the old fund or a person claiming in his right from being entitled to benefits from the fund not less in value than those to which he or such person (as the case may be) would (whether legally or by customary practice) have been entitled from the old fund and the Company if this scheme had not been enacted.
(5) Where an amending scheme is confirmed by the Minister under paragraph (2) of this rule the said amending scheme as so confirmed shall have effect, and this scheme shall be deemed to be amended accordingly.
(6) Whenever this scheme shall be amended by an amending scheme under this rule the Secretary shall cause the amendments to be printed and distributed to the contributing members and to such other persons as the committee shall think fit.
Solvency of the fund.
55.—The solvency of the fund is guaranteed by the company to the extent only that sufficient money shall be available at all times to meet the immediate cash requirements of the fund for the payment at such times of the benefits provided in this scheme.
Disposal of surpluses.
56.—When the purpose of the fund is fully accomplished as the result of the death of the last person entitled to any benefit out of the fund or at any earlier date on which the actuary or actuaries certify that there is a surplus on the fund which will not in any event be required to meet the liabilities of the fund, and such surplus shall become the property of the company.
Saver for right of company to terminate employment.
57.—Nothing in this scheme shall in any way restrict the right of the company to terminate the employment of any member at any time and membership of this scheme is not to be taken as indicating permanence of employment.
Interpretation.
58.—Any question as to the meaning of any provision of this scheme or any matter arising thereout shall be determined by the committee and their decision shall be final.
