ACHT UM CHOINNÍOLLACHA FOSTAÍOCHTA, 1936.
CUID I.
Roimhraiteach agus Generalta.

1.—(1) Féadfar an tAcht um Choinníollacha Fostaíochta, 1936, do ghairm den Acht so.
(2) Tiocfaidh an tAcht so i ngníomh pé lá ceapfar chuige sin le hordú ón Aire.
Mínithe.
2.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Tionnscail agus Tráchtála;
cialluíonn an focal “cigire” duine is cigire de thurus na huaire chun críche na Factory and Workshop Acts, 1901 to 1920;
cialluíonn an abairt “gnó tionnscail” gnó ina mbíonn obair thionnscail ar siúl i bhfuirm thrádála no chun sochair d'fháil aisti no chun aon tseirbhís phuiblí do chur ar fáil no ina mbíonn obair thionnscail ar siúl ag údarás áitiúil no ag cólucht puiblí eile i bhfeidhmiú no i gcólíonadh comhacht no dualgas reachtúil;

Obair thionnscail.
3.—(1) San Acht so ní fholuíonn an abairt “obair thionnscail” obair thalmhaíochta, thráchtála ná thighis ná mianadóireacht ná daoine no earraí d'iompar, ach fé réir na teorann san foluíonn an abairt sin gach saghas oibre tionnscail agus go háirithe obair thionnscail a deintear i gcóir no i dtaobh aon ghnímh acu so leanas, se sin le rá:—
(a) aon earra do dhéanamh, d'atharú, do ghlanadh, do dheisiú, d'ornáidiú, do chríochnú, do chur in oiriúint chun a díolta, do thástáil, do ghrádáil, do phacáil, do bhriseadh suas, do léir-scriosadh no do chur i bhfuirm eile;
(b) aon ainmhí no éan do mharbhadh;
(c) aon bhóthar iarainn, trambhealach, cuan, duga, piara, canáil, slí uisce intíre, bóthar, tunal, droichead, uiscrian, camra, dréin, tobar, píopa, gnó leictreachais, obair gheasa, obair uisce, monarcha, no obair eile dhéanmhais do dhéanamh, d'athdhéanamh, do chothabháil, do dheisiú, d'atharú no do léir-scriosadh, no fothaí do chur síos no do thógaint chun siúil, no aon láithreán i gcóir aon déanmhais den tsórt san do leagadh amach no do ghlanadh;
(d) aon ghléas telegrafach no telefónach do chur suas, no aon ghléas den tsórt san a bhíonn curtha suas do chothabháil, d'atharú no do dheisiú;
(e) leictreachas no fuirmeacha eile comhachta do gheiniúint, d'atharú, do tharchur, do roinnt no do rialú;
(f) geas do tháirgeadh agus do roinnt;
(g) uisce do thaisciú agus do roinnt;
(h) camracht do chur de láimh;
(i) coiréaladóireacht, pé doimhneas a bheidh sa choiréal;
(j) aon fhoirgint do dhéanamh, d'athdhéanamh, do chothabháil, do dheisiú, d'atharú, d'fheistiú, do dhathú, do mhaisiú no do léir-scriosadh, no fothaí do dhéanamh, do chur síos no do thógaint chun siúil, no an láithreán ar a mbeidh aon fhoirgint le tógáil do leagadh amach no do ghlanadh;
(k) loingeas do dhéanamh no d'athdhéanamh, do dheisiú, do ghléasadh no d'athghléasadh no do léir-scriosadh;
(l) clocha, slinn no gaineamh do thógaint as an talamh chun críche seachas críche mianaigh;
(m) clódóireacht agus gach modh eile (seachas scríbhneoireacht agus cló-scríobhadh) chun focail, figiúirí, pictiúirí no patrúin do chur síos no do mhacsamhlú;
(n) aon áit ina mbíonn obair thionnscail ar siúl do ghlanadh.
(2) Chun críche an ailt seo—
cialluíonn an abairt “obair thalmhaíochta” obair aon fheirme no gáirdín no obair fhoraoiseachta agus foluíonn sí aon tsaghas oibre tionnscail a deintear mar chuid d'obair fheirme no gháirdín chun gnó an chéanna do choimeád ar siúl agus chuige sin amháin;
cialluíonn an abairt “obair thráchtála” obair chléireachais, obair thionnscail do mhaoirsiú agus do stiúradh agus do bhainistí, no obair a deintear chun no i dtaobh aon earra do dhíol ina mór-choda no ina mion-choda;
foluíonn an abairt “obair thighis” bia d'ullamhú in aon tigh ósta no tigh bídh más sa tigh ósta no sa tigh bídh sin amháin, no in áit ina ndeineann an duine ag á mbíonn an tigh ósta no an tigh bídh sin ar siúl béilí do sholáthar, a bheidh beartuithe an bia a hullamhuítear amhlaidh do chaitheamh.
Fostóir.
4.—(1) San Acht so cialluíonn an focal “fostóir” duine, seachas duine is fostóir saortha chun críche an ailt seo, dhligheann tuarastal no págh d'íoc le hoibrí no teagasc no taithí do sholáthar d'oibrí no an dá ní sin do dhéanamh i gcomaoine aon oibre tionnscail do dhéanamh, no dhligheann tuarastal no págh d'íoc le hoibrí lasmuich ar an gcomaoine sin.
(2) I gcás an méid d'aon tsaghas oibre tionnscail a deintear i gcoimeád aon ghnótha áirithe ar siúl do bheith chó beag san gurb é tuairim an Aire nách féidir forálacha an Achta so do chur i mbaint go caothúil le fostú oibrithe chun an tsaghais sin oibre tionnscail do dhéanamh sa ghnó san, féadfaidh an tAire, ar iarratas sa bhfuirm orduithe ón duine 'na mbíonn an gnó san ar siúl aige, ceadúnas do dheonadh don duine sin chun oibrithe d'fhostú sa ghnó san chun an tsaghais sin oibre tionnscail do dhéanamh agus é saor o fhorálacha an Achta so agus faid a leanfaidh aon cheadúnas den tsórt san i bhfeidhm beidh an duine dá ndeonfar an ceadúnas san ina fhostóir shaortha chun críche an ailt seo alos oibrithe d'fhostú sa ghnó san chun an tsaghais sin oibre tionnscail do dhéanamh.
(3) Mara ndeinidh an tAire é do cheiliúradh roimhe sin leanfaidh gach ceadúnas a deonfar fén alt so i bhfeidhm ar feadh na tréimhse bheidh luaidhte ann agus raghaidh in éag ansan.
(4) Féadfaidh an tAire, tráth ar bith, faid a leanfaidh ceadúnas a deonadh fén alt so i bhfeidhm, an ceadúnas san do cheiliúradh tré fhógra seacht lá i scríbhinn do thabhairt don duine dar deonadh an ceadúnas san.
Fostaíocht leanúnach.
5.—Má thárlann briseadh i bhfostaíocht oibrí le fostóir áirithe de bhíthin breoiteachta an oibrí sin, de bhíthin na hoibre ina mbeidh sé ar fostú amhlaidh do stad go sealadach, de bhíthin laigheaduithe shealadaigh ar mhéid sheachtainiúil na hoibre sin, no de bhíthin aon chúise sealadaighe eile nách é gníomh no faillí an oibrí sin fé ndeár í tuigfear, chun aon tréimhse fostaíochta leanúnaighe leis an bhfostóir sin do réir bhrí aon ailt den Acht so d'áireamh, an t-oibrí sin do bheith i bhfostaíocht an fhostóra san faid a lean an briseadh sin más rud é, agus amháin más rud é, go ndearnadh do réir na gcoinníollacha so leanas, sé sin le rá:—
(a) an t-oibrí sin do dhul, nuair a bhí deireadh leis an mbriseadh sin, thar n-ais i bhfostaíocht an fhostóra ag á raibh sé ar fostú díreach roimh an mbriseadh sin, agus
(b) ná raibh an t-oibrí sin ar fostú in aon tsaghas oibre tionnscail faid a lean an briseadh sin, agus
(c) nár lean an briseadh sin níos sia ná mí.
An tAcht do bhaint le daoine ar fostú ag an Stát.
6.—Tá feidhm ag an Acht so maidir le daoine ar fostú ag an Stát no fé (seachas baill d'Fhórsaí Cosanta Shaorstáit Éireann no den Ghárda Síochána) fé is dá mba ag duine príobháideach do bheadh na daoine sin ar fostú.
Lá saoire puiblí.
7.—(1) Fé réir forálacha an ailt seo isiad na laetheanta so leanas agus ní haon laetheanta eile bheidh ina laetheanta saoire puiblí do réir bhrí agus chun crícheanna an Achta so, sé sin le rá:—
(a) Lá Nodlag nuair a thuitfe sé ar lá den tseachtain no, nuair a thuitfe sé ar an Domhnach, an 27adh lá de Mhí na Nodlag, agus
(b) Lá Fhéile Stiofáin nuair a thuitfe sé ar lá den tseachtain no, nuair a thuitfe sé ar an Domhnach, an chéad Luan ina dhiaidh sin, agus
(c) Lá Fhéile Pádraig nuair a thuitfe sé ar lá den tseachtain no, nuair a thuitfe sé ar an Domhnach, an chéad Luan ina dhiaidh sin, agus
(d) Luan Cásca, Luan Cincíse, agus an chéad Luan de Lúnasa.
(2) Pé uair a déanfar in aon bhliain lá do cheapadh fén Acht Laetheanta Saoire Puiblí, 1924 (Uimh. 56 de 1924), chun bheith ina lá saoire bainc in ionad lae luaidhtear sa bhfo-alt deiridh sin roimhe seo den alt so tuigfear, an bhliain sin, an lá ceapfar amhlaidh do bheith curtha san alt so in ionad an lae luaidhtear amhlaidh agus léireofar an t-alt so agus beidh éifeacht aige dá réir sin.
(3) Féadfaidh fostóir ar bith, ar fhógra mí ar a laighead do thabhairt roimh ré do gach duine ina fhostaíocht, aon lá acu so leanas do chur, chun crícheanna an ailt seo, in ionad Lá Fhéile Stiofáin nuair a thuitfe sé ar lá den tseachtain no, nuair a thuitfe sé ar an Domhnach, in ionad an chéad Luain ina dhiaidh sin, sé sin le rá:—
(a) an 1adh lá d'Eanar,
(b) an 6adh lá d'Eanar,
(c) Déardaoin Deasgabhála,
(d) Féile Chorp Críost,
(e) an 29adh lá de Mheitheamh,
(f) an 15adh lá de Lúnasa,
(g) an 1adh lá de Mhí na Samhna,
(h) an 8adh lá de Mhí na Nodlag.
(4) Féadfaidh fostóir ar bith, ar fhógra mí ar a laighead do thabhairt roimh ré do gach duine ina fhostaíocht, aon lá acu so leanas do chur in ionad Luan Cásca, Luan Cincíse no an chéad Luain i Lúnasa chun crícheanna an ailt seo, bliain ar bith, sé sin le rá:—
(a) Déardaoin Deasgabhála,
(b) Féile Chorp Críost,
(c) an 29adh lá de Mheitheamh,
(d) an 15adh lá de Lúnasa.
(5) Beidh éifeacht ag na forálacha so leanas chun crícheanna an dá fho-alt deiridh sin roimhe seo den alt so, sé sin le rá:—
(a) is i scríbhinn a bheidh an fógra luaidhtear i gceachtar den dá fho-alt deiridh sin roimhe seo agus féadfar é do thabhairt do dhuine ar bith tré chóip de do shíneadh chuige go pearsanta no tré chóip de do phostáil suas in ionad feiceálach san áit 'na mbeidh an duine sin ar fostú;
(b) ní déanfar aon lá luaidhtear i gceachtar den dá fho-alt deiridh sin roimhe seo do chur in ionad lae eile fén bhfo-alt san i mbliain gur ar an Domhnach a thuitfidh an lá san a luaidhtear amhlaidh;
(c) nuair a dhéanfaidh fostóir lá luaidhtear i gceachtar den dá fho-alt deiridh sin roimhe seo do chur in ionad lae eile fén bhfo-alt san maidir le haon bhliain áirithe beidh an lá san a luaidhtear amhlaidh, sa bhliain sin agus maidir le gach duine ar fostú ag an bhfostóir sin, ina lá saoire phuiblí do réir bhrí agus chun crícheanna an Achta so in ionad an lae gur ina ionad a cuirfear é amhlaidh.
Athghairm.
8.—Deintear leis seo na hachtacháin a luaidhtear sa Sceideal a ghabhann leis an Acht so d'athghairm sa mhéid a luaidhtear sa tríú colún den Sceideal san.
Pionóisí mar gheall ar chiontaí fén Acht so.
9.—(1) Gach duine bheidh ciontach i gcionta fé alt ar bith den Acht so, seachas cionta dá bhforáltar pionós speisialta leis an Acht so, dlighfear, ar a chiontú ann ar an slí achmair—
(a) más oibrí an duine sin, fíneáil do chur air—
(i) ná raghaidh thar dhá phúnt másé an chéad chionta den tsórt san aige é agus fós (más cionta leanúnach an cionta san) fíneáil bhreise nách mó ná deich scillinge in aghaidh gach lae leanfar den chionta san, agus
(ii) ná raghaidh thar cúig púint másé an dara cionta no aon chionta ina dhiadh sin den tsórt san aige é agus fós (más cionta leanúnach an cionta san) fíneáil bhreise nách mó ná púnt in aghaidh gach lae leanfar den chionta san, no
(b) marab oibrí an duine sin, fíneáil do chur air—
(i) ná raghaidh thar deich bpúint másé an chéad chionta den tsórt san aige é agus fós (más cionta leanúnach an cionta san) fíneáil bhreise nach mó ná dhá phúnt in aghaidh gach lae leanfar den chionta san, agus
(ii) ná raghaidh thar fiche púnt másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é agus fós (más cionta leanúnach an cionta san) fíneáil bhreise nách mó ná ceithre púint in aghaidh gach lae leanfar den chionta san.
(2) Féadfar cúiseamh mar gheall ar chionta fé aon alt den Acht so do bhunú ar agra an Aire.
(3) Féadfar cúiseamh mar gheall ar chionta fé aon alt den Acht so do bhunú tráth ar bith laistigh de pé tréimhse acu so leanas is déanaí raghaidh in éag, sé sin de rá:—
(a) trí mhí tar éis an dáta ar a ndeimhneofar i scríbhinn ar n-a séalú le séala oifigiúil an Aire, fianaise do theacht i seilbh an Aire no chun bheith ar fáil aige is leor chun é dhéanamh ceart an cúiseamh san do bhunú, no
(b) sé mhí tar éis an chionta do dhéanamh.
Rialacháin do leagadh fé bhráid Tithe an Oireachtais.
10.—Gach rialachán a dhéanfaidh an tAire fén Acht so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta, agus má dheineann ceachtar Tigh den Oireachtas, laistigh den lá is fiche shuidhfidh an Tigh sin ina dhiaidh sin, rún do rith ag cur an rialacháin sin ar nea-mbrí beidh an rialachán san curtha ar nea-mbrí dá réir sin, ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén rialachán san.
Comhacht chun rialacháin do dhéanamh.
11.—Féadfaidh an tAire le hordú rialacháin do dhéanamh ag ordú éinní no aon ruda dá dtagartar san Acht so mar ní no mar rud atá orduithe no le hordú.
Aird do thabhairt ar chonvensiúin eadarnáisiúnta.
12.—I bhfeidhmiú gach comhachta no aon chomhachta chun rialacháin do dhéanamh a bronntar air leis an Acht so féachfaidh an tAire go cuibhe d'fhorálacha na gconvensiún eadarnáisiúnta uile agus fé seach a bheidh daingnithe de thurus na huaire ag Rialtas Shaorstáit Éireann agus mar cheangal ortha.
CUID II.
Coinniollacha maidir le Tasc-Obair, le hAicmi Airithe Daoine d'Fhostu agus le Saoire Bhliantuil.
Toirmeasc ar dhaoine fé bhun cheithre mblian déag d'aois d'fhostú.
13.—(1) Ní bheidh sé dleathach d'fhostóir ar bith éinne fé bhun cheithre mblian déag d'aois d'fhostú chun oibre tionnscail do dhéanamh.
(2) Má fhostuíonn fostóir ar bith duine contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus beidh an duine sin freisin ciontach i gcionta fén alt so.
Cruthúnas ar aois dhuine óig roimh é d'fhostú.
14.—(1) Ní bheidh sé dleathach d'fhostóir ar bith duine óg d'fhostú mara dtugtar ná go dtí go dtabharfar deimhniú beireatais no fianaise shásúil eile ar aois an duine óig sin don fhostóir sin.
(2) Pé uair is gá deimhniú beireatais dhuine óig chun crícheanna an ailt seo beidh an duine óg san no a thuismitheoir no a chaomhnóir, ar iarratas i scríbhinn sa bhfuirm orduithe do thíolacadh ina mbeidh na mion-innste orduithe agus ar tháille de shé pingine d'íoc, i dteideal cóip dheimhnithe d'fháil d'iontráil bheireatais an duine óig sin i gclár na mbeireatas agus í fé láimh an chlárathóra no an cheann-chlárathóra no dhuine eile ag á mbeidh coimeád an chláir sin; agus déanfaidh gach clárathóir beireatas agus gach ceann-chlárathóir no duine eile ag á mbeidh coimeád an chláir fuirmeacha i gcóir an iarratais sin do chur ar fáil in aisce ar iad d'iarraidh.
(3) Má fhostuíonn fostóir ar bith duine óg contrárdha don alt so bheidh an fostóir sin ciontach i gcionta fén alt so agus beidh an duine óg san freisin ciontach i gcionta fén alt so.
Srian le daoine óga d'fhostú.
15.—(1) Féadfaidh an tAire, maidir le haon tsaghas oibre tionnscail agus tar éis do dul i gcomhairle le hionadaithe d'fhostóirí 'na bhfuil leas acu sa tsaghas san oibre tionnscail agus le hionadaithe d'oibrithe 'na bhfuil leas acu amhlaidh, féadfaidh, le hordú, rialacháin do dhéanamh—
(a) á thoirmeasc daoine óga d'fhostú chun an tsaghais sin oibre tionnscail do dhéanamh, no
(b) ag ceapadh an chothruim a bheidh idir líon na ndaoine óga bheidh ar fostú ag aon fhostóir chun an tsaghais sin oibre tionnscail do dhéanamh agus líon na n-oibrithe eile bheidh ar fostú amhlaidh.
(2) I gcás aon rialacháin a déanfar fén alt so do bheith i bhfeidhm de thurus na huaire i dtaobh aon tsaghais oibre tionnscail ní bheidh sé dleathach d'fhostóir ar bith aon duine óg d'fhostú chun an tsaghais sin oibre tionnscail do dhéanamh no (do réir mar bheidh) an oiread san daoine óga d'fhostú chuige sin go mbeadh idir líon na ndaoine óg a bheidh ar fostú amhlaidh ag an bhfostóir sin agus líon na n-oibrithe eile bheidh ar fostú amhlaidh cothrom is mó ná an cothrom a bheidh ceaptha leis na rialacháin sin.
(3) Má dheineann fostóir ar bith, agus aon rialacháin a bheidh déanta fén alt so i bhfeidhm de thurus na huaire, duine óg no roinnt daoine óga d'fhostú contrárdha do sna rialacháin sin beidh an fostóir sin ciontach i gcionta fén alt so.
(4) San alt so ní fholuíonn an abairt “duine óg” aon phríntíseach a bheidh, i dtosach feidhme an Achta so, ar fostú fé dhintiúirí chuireann mar cheangal air fónamh mar phríntíseach ar feadh tréimhse nách giorra ná trí bliana ná aon phríntiseach a bheidh, i dtosach feidhme an Achta so no dá eis sin, ar fostú mar phríntíseach fé rialacha ar n-a ndéanamh ag coiste príntíseachta fén Acht Príntíseachta, 1931 (Uimh. 56 de 1931).

16.—(1) Féadfaidh an tAire, maidir le haon tsaghas oibre tionnscail agus tar éis do dul i gcomhairle le hionadaithe d'fhostóirí 'na bhfuil leas acu sa tsaghas san oibre tionnscail agus le hionadaithe d'obrithe 'na bhfuil leas acu amhlaidh, féadfaidh, le hordú, rialacháin do dhéanamh—
(a) á thoirmeasc ban-oibrithe d'fhostú chun an tsaghais sin oibre tionnscail do dhéanamh, no
(b) ag ceapadh an chothruim a bheidh idir líon na mbanoibrithe bheidh ar fostú ag aon fhostóir chun an tsaghais sin oibre tionnscail do dhéanamh agus líon na n-oibrithe eile bheidh ar fostú amhlaidh.
(2) I gcás aon rialacháin a déanfar fén alt so do bheith i bhfeidhm de thurus na huaire i dtaobh aon tsaghais oibre tionnscail ní bheidh sé dleathach d'fhostóir ar bith aon bhanoibrí d'fhostú chun an tsaghais sin oibre tionnscail do dhéanamh no (do réir mar bheidh) an oiread san ban-oibrithe d'fhostú chuige sin go mbeadh idir líon na mban-oibrithe bheidh ar fostú amhlaidh ag an bhfostóir sin agus líon no n-oibrithe eile bheidh ar fostú amhlaidh cothrom is mó ná an cothrom a bheidh ceaptha leis na rialacháin sin.
(3) Má dheineann fostóir ar bith, agus aon rialacháin a bheidh déanta fén alt so i bhfeidhm de thurus na huaire, ban-oibrí no roinnt ban-oibrithe d'fhostú contrárdha do sna rialacháin sin beidh an fostóir sin ciontach i gcionta fén alt so.

17.—(1) Féadfaidh an tAire, maidir le haon tsaghas oibre tionnscail, rialacháin do dhéanamh le hordú á thoirmeasc oibrithe lasmuich d'fhostú sa tsaghas san oibre tionnscail agus nuair a bheidh aon rialacháin a bheidh déanta fén alt so i bhfeidhm de thurus na huaire ní bheidh sé dleathach d'aon fhostóir aon oibrí lasmuich d'fhostú chun an tsaghais sin oibre tionnscail do dhéanamh.
(2) Féadfar a rá in aon rialacháin a déanfar fén alt so i dtaobh aon tsaghais oibre tionnscail ná bainfid ach le líomatáiste bheidh luaidhte ionta agus pé uair adéarfar sna rialacháin sin ná bainfid ach leis an líomatáiste sin beidh sé nea-dhleathach dá gcionn oibrithe lasmuich a chomhnuíonn sa líomatáiste sin d'fhostú chun an tsaghais sin oibre tionnscail do dhéanamh ach ní chuirfid srian le haon oibrithe eile lasmuich d'fhostú.
(3) Má dheineann fostóir ar bith aon oibrí lasmuich d'fhostú contrárdha d'aon rialacháin a bheidh déanta fén alt so agus a bheidh i bhfeidhm de thurus na huaire beidh an fostóir sin ciontach i gcionta fén alt so agus beidh an t-oibrí sin lasmuich freisin ciontach i gcionta fén alt so.
Cláir d'oibrithe lasmuich.
18.—(1) Gach fostóir fhostóidh aon oibrithe lasmuich déanfaidh clár de sna hoibrithe uile lasmuich a bheidh ar fostú aige de thurus na huaire do choimeád do réir rialachán a bheidh déanta fén alt so.
(2) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh chun na gcrícheanna so leanas, sé sin le rá:—
(a) chun a ordú cadé an fhuirm ina mbeidh an clár d'oibrithe lasmuich a coimeádfar do réir an ailt seo agus, más oiriúnach leis an Aire é, chun fuirmeacha deifriúla den tsórt san d'ordú alos saghsanna deifriúla oibre tionnscail, agus
(b) chun a ordú cadiad na nithe agus na rudaí a hiontrálfar i ngach clár den tsórt san agus, más gá é, chun nithe agus rudaí deifriúla den tsórt san d'ordú alos gach fuirme deifriúla (más ann di) den chlár san.
(3) Gach fostóir ar a gceangailtear leis an alt so clár d'oibrithe lasmuich do choimeád agus ar a dteipfidh an clár san do choimeád do réir an ailt seo agus na rialachán a bheidh déanta fé beidh sé ciontach i gcionta fén alt so.
Págh tasc-oibre.
19.—(1) Fé réir forálacha an ailt seo déanfaidh gach fostóir a bhéarfaidh, as aon obair thionnscail do dhéanamh, d'aon oibrí no d'aon oibrí lasmuich aon luach saothair (dá ngairmtear págh tasc-oibre san Acht so) ar n-a áireamh tré thagairt don méid oibre do rinne an t-oibrí sin no an t-oibrí sin lasmuich déanfaidh, roimh aon obair no le linn aon oibre do thosnú go mbeidh aon íocaíocht áirithe pháigh thasc-oibre le háireamh ina taobh, nóta i scríbhinn (dá ngairmtear duillín mion-innste, tasc-oibre san Acht so) do thabhairt don oibrí sin no don oibrí sin lasmuich ina dtaisbeánfar, mion go leor chun a chur ar chumas an oibrí sin no an oibrí sin lasmuich a dhéanamh amach cadé an págh tasc-oibre is iníoctha leis, mion-innste (dá ngairmtear mion-innste tasc-oibre san Acht so) ar ráta an pháigh thasc-oibre agus ar an obair gur ina taobh a bheidh an ráta san iníoctha.
(2) Ar n-a iarraidh sin air d'fhostóir, féadfaidh an tAire, más dóich leis, ag féachaint do chúrsaí uile an cháis, gur ceart san do dhéanamh, cead do thabhairt amach don fhostóir sin á údarú dho, fé réir cólíonadh pé coinníollacha (más ann dóibh) a luadhfar sa chead san, págh tasc-oibre d'íoc, gan déanamh do réir an fho-ailt deiridh sin roimhe seo den alt so, le hoibrithe agus le hoibrithe lasmuich bheidh ar fostú aige, agus pé uair do bhéarfar aon chead den tsórt san amach amhlaidh d'fhostóir beidh éifeacht ag na forálacha so leanas maidir leis, sé sin le rá:—
(a) féadfaidh an tAire, tráth ar bith, an cead san do cheiliúradh tré fhógra seacht lá i scríbhinn do thabhairt don fhostóir sin no do chur chuige tríd an bpost;
(b) faid a bheidh an cead san gan ceiliúradh agus a chólíonfaidh an fostóir sin na coinníollacha (más ann dóibh) a luadhfar sa chead san, ní bheidh sé d'oblagáid ar an bhfostóir sin déanamh do réir an fho-ailt deiridh sin roimhe seo den alt so.
(3) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so, déanfaidh gach fostóir, a íocann págh tasc-oibre le haon oibrí as aon obair thionnscail do dhéanamh i bhfoirgint fé n-a bhainistí agus fé n-a stiúradh, placárd (dá ngairmtear placárd mion-innste tasc-oibre san Acht so) do choimeád ar taisbeáint i gcomhnaí, do réir an Achta so, i ngach seomra sa bhfoirgint sin ina ndeintear an obair thionnscail sin, placárd ag tabhairt na mion-innste tascoibre i dtaobh na hoibre tionnscail sin.
(4) Beidh gach placárd mion-innste tasc-oibre do réir na gcoinníollacha so leanas, sé sin le rá:—
(a) ní bheidh comharthaí air seachas leitreacha agus figiúirí ar n-a n-úsáid go n-a ngnáth-bhrí,
(b) beidh air na mion-innste tasc-oibre i dtaobh na hoibre tionnscail le n-a mbaineann agus san amháin,
(c) beidh sé ar taisbeáint in áit go bhféadfaidh oibrithe bheidh ar fostú chun na hoibre tionnscail le n-a mbaineann sé do dhéanamh é léigheamh go saoráideach,
(d) coimeádfar é go glan so-léighte,
(e) beidh sé i nGaedhilg agus i mBéarla,
agus má bhíonn aon phlacárd mion-innste tasc-oibre bheidh ar taisbeáint ag fostóir ar bith gan bheith do réir na gcoinníollacha san tuigfear gan an placárd san do bheith ar taisbeáint do réir an Achta so.
(5) Má bhíonn na mion-innste tasc-oibre bhaineann le haon tsaghas oibre tionnscail chó hilfhillte sin nách féidir go caothúil iad do chur ar phlacárd mion-innste tasc-oibre, féadfaidh fostóir ar bith a fhostuíonn oibrithe chun an tsaghais sin oibre tionnscail do dhéanamh ar tuarastal tasc-oibre, féadfaidh, in ionad placárd mion-innste tasc-oibre do choimeád ar taisbeáint, leabhar (dá ngairmtear leabhar mion-innste tasc-oibre san Acht so), ina mbeidh na mion-innste tasc-oibre sin do choimeád, a bheidh ar fáil go saoráideach chun a iniúchta ag gach oibrí ar fostú amhlaidh.
(6) Má theipeann ar fhostóir ar bith déanamh do réir a n-éilítear leis an alt so beidh sé ciontach i gcionta fén alt so.
Pionóisí i dtaobh placárd no duillín d'atharú no i dtaobh eolas sa chéanna do nochtadh.
20.—(1) Má dheineann duine ar bith, chun críche seachas chun dearmhad do cheartú, aon duillín mion-innste tasc-oibre, aon phlacárd mion-innste tasc-oibre no aon leabhar mion-innste tascoibre d'atharú beidh an duine sin ciontach i gcionta fén alt so, agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air no príosúntacht ar feadh tréimhse nách sia ná sé mhí no, más rogha leis an gcúirt é, an fhíneáil sin agus an phríosúntacht san le chéile.
(2) Má dheineann duine ar bith, chun rún trádála do scéith, aon eolas do fuair sé o dhuillín mhion-innste thasc-oibre, o phlacárd mhion-innste thasc-oibre no o leabhar mhion-innste thascoibre do nochtadh beidh sé ciontach i gcionta fén bhfo-alt so, agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air.
(3) Má dheineann duine ar bith, chun críche iomaíochta trádála, eolas do shireadh ar aon duine eile no d'fháil o aon duine eile do fuair an duine eile sin o dhuillín mhion-innste thasc-oibre. o phlacárd mhion-innste thasc-oibre no o leabhar mhion-innste thasc-oibre, no má dheineann sé, chun aon eolas den tsórt san do fuair an duine eile sin amhlaidh d'fháil, aon luach saothair do thabhairt no do thairisgint no a chur fé ndeár é do thabhairt no do thairisgint don duine eile sin, beidh sé ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air.
Tasc-obair d'áireamh.
21.—(1) I gcás fostóir ar bith d'íoc páigh thasc-oibre le haon oibrí no le haon oibrí lasmuich alos aon oibre tionnscail déanfaidh an fostóir sin an méid oibre do rinneadh d'áireamh, chun a fháil amach cadé an págh tasc-oibre bheidh le n-íoc as, ina leithéid sin de shlí go mbeidh caoi ag an oibrí sin no ag an oibrí sin lasmuich ar thoradh an áirimh sin do sheiceáil gach uair roimh an bpágh san d'íoc leis.
(2) Chun an méid oibre do rinneadh d'áireamh d'fhonn a fháil amach cadé an págh tasc-oibre bheidh le n'íoc as féadfar meaisín uathoibritheach (dá ngairmtear áirmhtheoir uathoibritheach san Acht so) d'úsáid agus má bhíonn aon áirmhtheoir uathoibritheach déanta agus á oibriú do réir an Achta so tuigfear caoi chun a thabhairt fé ndeara cadé an méid d'áirimh an t-áirmhtheoir uathoibritheach san do bheith ina caoi chun an méid oibre d'áirimh an t-áirmhtheoir uathoibritheach san do sheiceáil.
(3) Beidh gach áirmhtheoir uathoibritheach do réir na gcoinníollacha so leanas, sé sin le rá:—
(a) ní dhéanfaidh an taisbeántóir na méideanna oibre bheidh áirmhthe do thaisbeáint tré chomharthaí seachas leitreacha agus figiúirí ar n-a n-úsáid go n-a ngnáthbhrí,
(b) feisteofar an taisbeántóir in áit go bhféadfaidh oibrithe é do léigheamh go saoráideach a bheidh ar fostú chun na hoibre tionnscail do dhéanamh gurb é a méid a gheobhaidh an t-áirmhtheoir uathoibritheach amach,
(c) beidh an taisbeántóir go glan so-léighte,
(d) ní foláir an toradh gheobhfar ón áirmhtheoir uathoibritheach do bheith cruinn agus coimeádfar an t-áirmhtheoir i staid mhaith agus i dtreo mhaith oibre,
(e) na mion-innste uile is gá chun a fháil amach ón taisbeántóir cadé an méid oibre tionnscail a bheidh áirmhthe ag áirmhtheoir uathoibritheach beidh siad marcálta go soiléir ar an áirmhtheoir uathoibritheach san,
agus aon áirmhtheoir uathoibritheach ná beidh do réir na gcoinníollacha san tuigfear gan é bheith déanta agus á oibriú do réir an Achta so.
(4) Má dheineann fostóir ar bith áireamh ar shlí seachas do réir an ailt seo ar mhéid aon tsaghais oibre tionnscail a rinne aon oibrí ar phágh thasc-oibre beidh an fostóir sin ciontach i gcionta fén alt so.
Pionós i dtaobh baint le háirmhtheoir uathoibritheach.
22.—Má atharuíonn duine ar bith meicníocht no taisbeántóir áirmhtheora uathoibrithigh, no má bhaineann no má chuireann fé ndeár go mbainfear leis an gcéanna, chun críche seachas chun críche dleathaighe, beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air no príosúntacht ar feadh tréimhse nách sia ná sé mhí no, más rogha leis an gcúirt é, an fhíneáil sin agus an phríosúntacht san le chéile.

23.—Gach Acht agus rialachán a bheidh i bhfeidhm de thurus na huaire i dtaobh fearaistí is meáchain, tomhais, scálaí, meadha, sail-mheadha, meaisíní meáchainte no instruimidí tomhais (dá ngairmtear fearaistí tomhais san alt so) bainfid le fearaistí tomhais a húsáidfear in aon áit chun an méid oibre tionnscail do rinne aon oibrí no oibrí lasmuich d'fháil amach d'fhonn a áireamh cadé an méid páigh thasc-oibre is iníoctha leis, bainfid leo fé is dá mba i ndíol earraí a húsáidfí na fearaistí tomhais sin agus dá mba áit ina gcoimeádtar earraí chun a ndíolta an áit sin, agus beidh feidhm dá réir sin ag gach Acht den tsórt san, agus déanfaidh gach cigire meáchan agus tomhas, no duine eile go n-údarás chun meáchain agus tomhais d'iniúchadh no do scrúdú, na fearaistí tomhais sin d'iniúchadh, do stampáil, do mharcáil, do lorg agus do scrúdú dá réir sin agus chuige sin beidh aige na comhachta agus na dualgaisí céanna atá aige i dtaobh fearaistí tomhais a húsáidtear i ndíol earraí.
Ceart ag oibrí chun saoire bliantúla.
24.—(1) Lomhálfaidh gach fostóir do gach oibrí ina fhostaíocht in aon ghnó tionnscail tréimhse nách giorra ná sé lá saoire as a chéile (dá ngairmtear saoire bhliantúil san Acht so) i ngach bliain iomláin fhostaíochta bheidh curtha isteach ag an oibrí sin agus ina raibh sé go leanúnach i bhfostaíocht an fhostóra san agus ina mbeidh sé tar éis oibriú ar feadh ocht gcéad déag uair a chluig ar a laighead sa bhfostaíocht san.
(2) I gcás oibrí bheidh ar fostú ag fostóir i ngnó tionnscail do scur de bheith ar fostú ag an bhfostóir sin aon tráth seachas i ndeireadh bliana fostaíochta bheidh curtha isteach ag an oibrí sin, déanfaidh an fostóir sin—
(a) sé lá de shaoire bhliantúil, alos na coda den bhliain fhostaíochta san go raibh sé ar fostú amhlaidh ar a feadh, do lomháil don oibrí sin roimh an scur san, no
(b) íoc do dhéanamh leis an oibrí sin, le linn an scurtha san—
(i) i bpágh aon lae amháin (ar n-a áireamh do réir an ráta do bhainfeadh leis an gcás dá mba lá de shaoire bhliantúil a lomálfaí díreach roimh an scur san an lá san) alos gach tréimhse iomláine de dhá mhí sa chuid sin den bhliain fhostaíochta san ina mbeidh sé tar éis oibriú ar feadh trí chéad uair a chluig ar a laighead, agus
(ii) i bpágh aon lae amháin (ar n-a áireamh mar adubhradh) alos na tréimhse (más ann di) sa chuid sin den bhliain fhostaíochta san is giorra ná dhá mhí ach nách giorra ná mí agus ina mbeidh sé tar éis oibriú ar feadh céad go leith uair a chluig ar a laighead.
(3) Féadfaidh an tAire le hordú, pé uair agus chó minic agus is dóich leis san do bheith ceart, rialacháin do dhéanamh a atharóidh, maidir le gach aicme oibrithe no aon aicmí no aicme áirithe oibrithe, gach ceann no aon cheann de sna tréimhsí d'ocht gcéad déag uair a chluig, de thrí chéad uair a chluig, agus de chéad go leith uair a chluig a luaidhtear i bhfo-ailt (1) agus (2) den alt so tré pé tréimhsí no tréimhse eile, is dóich leis an Aire is ceart, do chur in ionad na dtréimhsí no na tréimhse sin, agus pé uair a bheidh aon rialacháin den tsórt san i bhfeidhm beidh éifeacht ag na fo-ailt sin maidir leis na hoibrithe no na haicmí no an aicme oibrithe le n-a mbainfidh na rialacháin sin fé is dá ndeintí na tréimhsí sin, no pé cinn acu dá ndéanfaidh na rialacháin sin deifir, d'atharú sa tslí bheidh luaidhte sna rialacháin sin.
(4) Ní háirmheofar aon Domhnach ná lá saoire puiblí mar lá saoire bliantúil ach má thagann Domhnach no lá saoire puiblí idir laetheanta saoire bliantúla tuigfear na laetheanta san do bheith as a chéile d'ainneoin an Domhnaigh no an lae sin do theacht eatortha.
(5) Ní bheidh sé dleathach d'oibrí ar bith aon obair thionnscail do dhéanamh ar luach saothair le linn aon tréimhse de shaoire bhliantúil chun a mbeidh teideal aige fén alt so, agus má dheineann oibrí ar bith aon obair thionnscail contrárdha don fho-alt so beidh sé ciontach i gcionta fén alt so.
(6) I gcás oibrí is ball den Fhórsa Cúltaca d'Fhórsaí Cosanta Shaorstáit Éireann do bheith as láthair o n-a fhostaíocht chun bheith i láthair agus a dhualgas do chólíonadh, mar bhall den tsórt san, ag aon tréineáil tionnscnaimh, tréineáil bhliantúil, no slógadh tástála tuigfear, chun aon tréimhse fostaíochta no fostaíochta leanúnaighe do réir bhrí an ailt seo d'áireamh, an t-oibrí sin do bheith sa bhfostaíocht san aige le linn é do bheith as láthair amhlaidh, agus dá réir sin déanfar, chun crícheanna an ailt seo, an tréimhse do bhí sé as láthair amhlaidh d'áireamh sa tréimhse fostaíochta no fostaíochta leanúnaighe sin.
(7) I gcás únaerachta gnótha thionnscail d'aistriú tré ghníomh na bpáirtithe no tré oibriú dlí, beidh oibrí bheidh ar fostú sa ghnó san díreach roimh an aistriú san agus díreach dá éis i dteideal an tréimhse dá fhostaíocht leanúnaigh sa ghnó san a thosnuigh roimh an aistriú san agus a chríochnuigh le linn an aistrithe sin agus an tréimhse den fhostaíocht leanúnaigh sin a thosnuigh le linn an aistrithe sin agus a lean dá éis d'áireamh, chun crícheanna an ailt seo, mar aon tréimhse amháin nea-mbriste d'fhostaíocht leanúnaigh sa ghnó san d'ainneoin an aistrithe sin.
(8) Bainfidh an t-alt so leis an mbliain fhostaíochta bheidh, le linn tosach feidhme an Achta so, á caitheamh ag gach oibrí bheidh ar fostú ag fostóir i ngnó tionnscail le linn an rithte sin, agus beidh éifeacht ag an alt so maidir leis an mbliain fhostaíochta san agus maidir leis an oibrí sin fé is dá mbeadh an t-alt so i bhfeidhm i dtosach na bliana fostaíochta san, ach san fé réir na n-atharuithe —
(a) má théigheann an bhliain fhostaíochta san in éag laistigh de mhí tar éis tosach feidhme an Achta so go dtuigfear go ndearna an fostóir sin do réir an ailt seo má lomhálann sé don oibrí sin, ar dháta nách déanaí ná trí mhí tar éis deireadh na bliana fostaíochta san, an tsaoir, bhliantúil sin chun a mbeidh teideal ag an oibrí sin fén alt so alos na bliana fostaíochta san, agus
(b) má bhíonn an fostóir sin, roimh thosach feidhme an Achta so, tar éis saoire lae amháin no níos mó do lomháil don oibrí sin sa bhliain fhostaíochta san do bheadh ina saoire bhliantúil chun crícheanna an ailt seo mara mbeadh ná raibh na laetheanta san as a chéile no gur lugha ná sé cinn iad no ná rabhadar as a chéile agus gur lugha ná sé cinn iad, tuigfear an tsaoire sin do lomháladh amhlaidh do bheith ina saoire bhliantúil chun crícheanna an ailt seo agus ní bheidh teideal ag an oibrí sin, maidir leis an mbliain fhostaíochta san, ach chun an méid sin (más aon mhéid é) laetheanta as a chéile de shaoire bhliantúil tar éis tosach feidhme an Achta so is cóionann leis an méid (más aon mhéid é) laetheanta gur lugha-de ná sé an tsaoire sin do lomháladh amhlaidh.
(9) Déanfar, maidir le baint an ailt seo le hoibrithe is daoine óga, na tréimhsí uile agus fé seach de chúig céad déag uair a chluig, de dhá chéad go leith uair a chluig agus de chéad agus fiche uair a chluig do chur fé seach san alt so in ionad na dtréimhsí uile agus fé seach d'ocht gcéad déag uair a chluig, de thrí chéad uair a chluig agus de chéad go leith uair a chluig, agus beidh éifeacht ag an alt so dá réir sin maidir leis na hoibrithe sin.
(10) San alt so agus sa dá alt díreach ina dhiaidh den Acht so cialluíonn an abairt “bliain fhostaíochta” maidir le haon oibrí tréimhse bhliana dar tosach an lá is déanaí do chuaidh an t-oibrí sin sa bhfostaíocht gur ina taobh a húsáidtear an abairt no lá cinn bliana don lá san.
(11) Má theipeann ar aon fhostóir íoc do dhéanamh le hoibrí ar bith in aon airgead a thiocfaidh chun bheith iníoctha leis an oibrí sin fén alt so, féadfaidh an t-oibrí sin an t-airgead san do bhaint den fhostóir sin mar fhiacha gnáth-chonnartha.
(12) Má theipeann ar aon fhostóir saoire bhliantúil do lomháil d'oibrí ar bith contrárdha don alt so beidh sé ciontach i gcionta fén alt so.
Luach saothair i rith saoire bliantúla.
25.—Pé uair a lomhálfaidh a fhostóir d'oibrí ar tuarastal no ar págh aon tsaoire bhliantúil chun a mbeidh teideal aige de bhuadh an Achta so íocfaidh an fostóir sin leis an oibrí sin, alos gach lae den tsaoire sin, tuarastal no págh do réir pé ráta acu so leanas a bhaineann leis an gcás, sé sin le rá:—
(a) i gcás oibrí go ndeintear a ghnáth-luach saothair d'áireamh ar fad tré thagairt d'aimsir, do réir an ráta gur dá réir a bhí an luach saothair sin iníoctha díreach roimh thosach na saoire bliantúla san, agus
(b) i gcás oibrí gur págh tasc-oibre ar fad is gnáth-luach saothair do, do réir meán-ráta laethiúla a thuillimh (gan págh as obair bhreise d'áireamh) sa tréimhse gur ina haghaidh a lomhálfar an tsaoire bhliantúil sin do, agus
(c) i gcás oibrí go ndeintear cuid dá ghnáth-luach saothair d'áireamh tré thagairt d'aimsir agus gur págh tasc-oibre an chuid eile dá luach saothair, do réir meán-ráta laethiúla a thuillimh (gan págh as obair bhreise d'áireamh) sa tréimhse gur ina haghaidh a lomhálfar an tsaoire bhliantúil sin do.

26.—(1) An t-am in aon bhliain fhostaíochta ina lomhálfaidh fostóir saoire bhliantúil d'oibrí a bheidh i dteideal saoire bliantúla fén Acht so isé an fostóir sin a cheapfaidh é.
(2) Más rud é, in aon bhliain fhostaíochta oibrí le fostóir, go mbeidh oiread san den bhliain fhostaíochta san caithte ná beidh ach sé lá oibre dhi gan caitheamh agus ná beidh an fostóir sin tar éis saoire bhliantúil do lomháil an uair sin don oibrí sin, féadfaidh an t-oibrí sin, má bhíonn sé i dteideal saoire bliantúla fén Acht so, fanúint as láthair o n-a chuid oibre don fhostóir sin ar feadh na sé lá san agus ní tuigfear, de bhíthin é d'fhanúint as láthair amhlaidh, é do dhéanamh aon bhriseadh ar a chonnradh seirbhíse leis an bhfostóir sin, agus íocfaidh an fostóir sin leis an oibrí sin alos na sé lá san an méid a dhlighfeadh sé d'íoc dá lomhálfadh sé an sé lá san mar shaoire bhliantúil.
(3) Má dheineann fostóir in aon bhliain fhostaíochta tréimhse saoire bliantúla do lomháil d'oibrí níos túisce ná an sé lá oibre deiridh den bhliain fhostaíochta san agus má fhágann an t-oibrí sin fostaíocht an fhostóra san roimh dheireadh na bliana fostaíochta san ní bheidh an fostóir sin i dteideal, i dtaobh na saoire bliantúla san do lomháil amhlaidh, tréimhse an fhógra is gá chun deireadh do chur leis an bhfostaíocht san do ghiorrú ná an págh ná an sochar eile do laigheadú chun a mbeidh teideal ag an oibrí sin le linn do an fhostaíocht san d'fhágaint.
(4) Má theipeann ar aon fhostóir íoc do dhéanamh le hoibrí ar bith in aon airgead a thiocfaidh chun bheith iníoctha leis an oibrí sin fén alt so féadfaidh an t-oibrí sin an t-airgead san do bhaint den fhostóir sin mar fhiacha gnáth-chonnartha.
Fógra i dtaobh ama na saoire bliantúla.
27.—(1) Déanfaidh gach fostóir, ar a gceangailtear leis an Acht so saoire bhliantúil do lomháil d'oibrí, fógra i scríbhinn i dtaobh an lae thosnóidh an tsaoire bhliantúil sin do thabhairt do gach oibrí go gceangailtear ar an bhfostóir sin amhlaidh an tsaoire bhliantúil sin do lomháil do, agus bhéarfaidh an fógra san amhlaidh dhá sheachtain ar a laighead roimh an lá san.
(2) Féadfar fógra bhéarfar d'oibrí do réir an ailt seo do thabhairt tríd an bhfógra san do shíneadh chun an oibrí sin no tríd an bhfógra san do chur ar taisbeáint in ionad fheiceálach ar a mbeidh teacht ag an oibrí sin san áit ina mbeidh sé ar fostú.
(3) Gach fostóir ar a gceangailtear leis an alt so an fógra san a luaidhtear sna fo-ailt sin roimhe seo den alt so do thabhairt d'oibrí ar bith agus ar a dteipfidh no fhailleoidh an fógra san do thabhairt do réir an ailt seo d'oibrí ar bith ar aon ócáid ar a gceangailtear air amhlaidh san do thabhairt uaidh beidh sé ciontach i gcionta fén alt so.

Coinniollacha Maidir le Trathanna Oibre.
Míniú.
28.—Nuair a húsáidtear an abairt “obair thionnscail” in alt ar bith sa Chuid seo den Acht so cialluíonn sí san alt san obair thionnscail nách obair thionnscail eiscithe chun críche an ailt sin.
Rialacháin um eisceadh.
29.—(1) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh (dá ngairmtear rialacháin um eisceadh san Acht so) á dhearbhú aon tsaghas áirithe oibre tionnscail do bheith ina obair thionnscail eiscithe chun críche gach ailt no aon ailt den Chuid seo den Acht so.
(2) Ní dhéanfaidh an tAire aon rialacháin á dhearbhú aon tsaghas oibre tionnscail do bheith ina obair thionnscail eiscithe chun críche aon ailt den Chuid seo den Acht so bhaineann leis na huaireanna, leis na laetheanta den tseachtain, no leis na laetheanta den bhliain gur le n-a linn no ortha fhéadfaidh fostóir leigint d'oibrí an obair thionnscail sin do dhéanamh mara mbeidh sé tar éis dul i gcomhairle ar dtúis le hionadaithe d'fhostóirí ag a mbeidh leas sa tsaghas san oibre tionnscail agus le hionadaithe d'oibrithe ag á mbeidh leas amhlaidh.
(3) Pé uair a bheidh rialacháin a bheidh déanta fén alt so i bhfeidhm de thurus na huaire beidh aon tsaghas oibre tionnscail le n-a mbainfidh na rialacháin sin, beidh san, chun críche na n-alt den Chuid seo den Acht so gur ina dtaobh a dearbhuítear leis na rialacháin sin an saghas san oibre tionnscail do bheith ina obair thionnscail eiscithe, ina obair thionnscail eiscithe do réir téarmaí na rialachán san.
Cead um eisceadh.
30.—Féadfaidh an tAire, más deimhin leis méid aon tsaghais oibre tionnscail is gá do dhéanamh chun gnó tionnscail do choimeád ar siúl do bheith méaduithe thar meon aon tráth, cead do dheonadh don duine, ag á mbeidh an gnó tionnscail sin ar siúl, chun oibrithe d'fhostú chun an tsaghais sin oibre tionnscail do dhéanamh aon tráth i dtréimhse (nách sia ná dhá sheachtain) a luadhfar sa chead san, fé is dá mba ghnó tionnscail eiscithe an saghas san oibre tionnscail chun críche gach ailt no aon ailt den Chuid seo den Acht so a luadhfar sa chead san, agus pé uair a bheidh cead ar n-a dheonadh fén alt so i bhfeidhm beidh an saghas oibre tionnscail le n-a mbainfe sé ina obair thionnscail eiscithe chun críche na n-alt san nuair a déanfar é sa ghnó tionnscail sin sa tréimhse luadhfar sa chead san.

31.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so isé an Satharn a bheidh ina ghearr-lá do gach gnó tionnscail chun críche an Achta so.
(2) Féadfaidh fostóir ar bith a fhostuíonn oibrithe chun aon obair thionnscail do dheánamh i ngnó tionnscail ar bith fógra do chur chun an Aire, sa bhfuirm agus sa tslí orduithe, á rá gur mian leis, maidir leis an ngnó san, lá áirithe eile den tseachtain (seachas an Domhnach) do chur mar ghearr-lá in ionad an tSathairn no in ionad aon lae do cuireadh roimhe sin in ionad an tSathairn fén alt so agus, lasmuich de chás dá bhforáltar a mhalairt leis an alt so, nuair a bheidh seacht lá ón lá ar a gcuirfear an fógra san chun an Aire amhlaidh caithte isé an lá áirithe sin a bheidh, maidir leis an ngnó san, ina ghearr-lá chun críche an Achta so.
(3) Má cuirtear fógra fén alt so chun an Aire maidir le haon ghnó tionnscail ní déanfar, go dtí go mbeidh tréimhse thrí mhí caithte o dháta an fhógra san do chur chun an Aire, aon fhógra eile den tsórt san maidir leis an ngnó tionnscail sin do chur chun an Aire agus aon fhógra eile den tsórt san a cuirfear chuige laistigh den tréimhse sin beidh sé gan brí gan éifeacht.
Uain-obair do bheith neadhleathach marab ar phróiseas leanúnach no fé cheadúnas a déanfar í.
32.—(1) Ní bheidh sé dleathach d'fhostóir ar bith aon oibrí d'fhostú ar uain-obair chun obair thionnscail do dhéanamh (seachas obair thionnscail a déanfar chun no i dtaobh páipéirí nuachta do chlóbhualadh no d'fhoillsiú) maran rud é—
(a) gur gá de ghnáth an obair thionnscail sin (dá ngairmtear próiseas leanúnach san Acht so) do choimeád ar siúl gan stad no do choimeád ar siúl ar feadh tréimhsí nách giorra ná cúig uaire déag a chluig sa turus gan stad, no
(b) go n-údarófar don fhostóir sin le ceadúnas (dá ngairmtear ceadúnas uain-oibre san Acht so) ar n-a dheonadh ag an Aire oibrithe d'fhostú ar uain-obair (dá ngairmtear uain-obair cheadúnuithe san Acht so) chun na hoibre tionnscail sin do dhéanamh.
(2) Má fhostuíonn fostóir ar bith aon oibrí contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus beidh an t-oibrí sin freisin ciontach i gcionta fén alt so.
Coinníollacha uain-oibre ar phróiseas leanúnach.
33.—(1) Ní bheidh sé dleathach d'aon fhostóir a leigint d'oibrí ar bith a bheidh ar fostú aige in aon ghnó tionnscail aon phróiseas leanúnach do dhéanamh ar uain-obair (dá ngairmtear uain-obair phróisis leanúnaigh san Acht so) i slí sháródh aon choinníoll acu so leanas, sé sin le rá:—
(a) ní bheidh ré aon uaine níos sia ná naoi n-uaire a chluig;
(b) ní oibreoidh oibrí ar bith ar dhá uain as a chéile;
(c) ní oibreoidh oibrí ar bith ar aon uain mara mbeidh ocht n-uaire a chluig ar a laighead caithte o oibrigh sé ar uain roimhe sin;
(d) ní oibreoidh oibrí ar bith ar feadh níos mó ná 56 uair a chluig in aon tseachtain;
(e) déanfar sos chúig nóimeat déag ar a laighead do lomháil i ngach uain do gach oibrí i gcionn trí huaire a chluig ar a luatha no ceithre huaire a chluig ar a dhéanaí tar éis tosach na huaine sin ach ní bheidh an t-oibrí i dteideal áitreabh an fhostóra d'fhágaint le linn na tréimhse sosa san gan cead ón bhfostóir.
(2) Má dheineann fostóir ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so.
Coinníollacha uain-oibre ceadúnuithe.
34.—(1) Ní bheidh sé dleathach d'aon fhostóir a leigint d'oibrí ar bith a bheidh ar fostú aige in aon ghnó tionnscail aon obair thionnscail do dhéanamh ar uain-obair cheadúnuithe i slí sháródh aon choinníoll a bheidh sa cheadúnas le n-a n-údarófar an uainobair cheadúnuithe sin ná aon choinníoll acu so leanas, sé sin le rá:—
(a) ní bheidh ré aon uaine níos sia ná naoi n-uaire a chluig;
(b) ní oibreoidh oibrí ar bith ar dhá uain as a chéile;
(c) ní oibreoidh oibrí ar bith ar aon uain mara mbeidh ocht n-uaire a chluig ar a laighead caithte o oibrigh sé ar uain roimhe sin;
(d) ní oibreoidh oibrí ar bith oiread san uair a chluig in aon tseachtain go raghadh meán-mhéid na n-uaire a chluig sa tseachtain d'oibrigh sé in aon trí seachtaine as a cheile thar ocht n-uaire agus dachad a chluig;
(e) déanfar sos chúig nóimeat déag ar a leighead i ngach uain do lomháil do gach oibrí i gcionn trí huaire a chluig ar a luatha no ceithre huaire a chluig ar a dhéanaí tar éis tosach na huaine sin ach ní bheidh an t-oibrí i dteideal áitreabh an fhostóra d'fhágaint le linn na tréimhse sosa san gan cead ón bhfostóir.
(2) Má dheineann fostóir ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so.
Iarratas ar cheadúnas uain-oibre.
35.—Féadfaidh duine ar bith, tré iarratas i scríbhinn ina mbeidh na mion-innste orduithe, ceadúnas uain-oibre d'iarraidh ar an Aire.
Ceadúnas uainoibre do dheonadh.
36.—Ar an Aire d'fháil iarratais ar bith fén Acht so ar cheadúnas uain-oibre féadfaidh, do réir mar is rogha leis féin agus tar éis do dul i gcomhairle le hionadaithe d'fhostóirí ag á mbeidh leas sa tsaghas oibre tionnscail le n-a mbaineann an t-iarratas agus le hionadaithe d'oibrithe ag á mbeidh leas amhlaidh, an ceadúnas san do dheonadh no diúltú d'é do dheonadh.
Fuirm cheadúnais uain-oibre.
37.—Beidh gach ceadúnas uain-oibre deonfar fén Acht so sa bhfuirm orduithe agus údaróidh sé don duine dá ndeonfar é oibrithe d'fhostú ar uain-obair go generálta no fé réir pé coinníollacha is dóich leis an Aire is ceart d'fhorchur agus do chur isteach sa cheadúnas san.
Uaireanna oibre.
38.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an Acht so ní bheidh sé dleathach d'fhostóir ar bith fhostuíonn aon oibrí fásta chun obair thionnscail do dhéanamh i ngnó tionnscail ar obair lae a leigint don oibrí fhásta san—
(a) más bean an t-oibrí fásta san, tosnú ar obair níos luatha ná 8 a chlog a.m. aon lá, no
(b) pe'ca fear no bean an t-oibrí fásta san, leanúint d'obair tar éis aon teorann acu so leanas (dá ngairmtear teoranta ama d'obair lae san Acht so), sé sin le rá:—
(i) 8 a chlog p.m. aon ghnáth-lá oibre,
(ii) 1 a chlog p.m. aon ghearr-lá,
(iii) an tráth aon ghnáth-lá oibre 'na mbeidh obair naoi n-uaire a chluig críochnuithe ag an oibrí fásta san an lá san,
(iv) an tráth aon tseachtain 'na mbeidh obair ocht n-uaire is dachad a chluig críochnuithe ag an oibrí fásta san an tseachtain sin.
(2) Ní bhainfidh an t-alt so le haon obair thionnscail a deintear chun no i dtaobh—
(a) páipéirí nuachta do chlóbhualadh agus d'fhoillsiú, no
(b) aon ghléis thelegrafaigh no thelefónaigh do chur suas no aon ghléis den tsórt san a bhíonn curtha suas do chothabháil, d'atharú no do dheisiú, no
(c) stáisiúin fhóirleatha bhíonn á chothabháil agus á oibriú fé Chuid II den Acht Radio-Thelegrafaíochta, 1926 (Uimh. 45 de 1926), do chothabháil no d'oibriú.

(4) San Acht so cialluíonn an abairt “obair lae” obair nách uain-obair phróisis leanúnaigh ná uain-obair cheadúnuithe.

39.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an Acht so ní bheidh sé dleathach d'fhostóir ar bith fhostuíonn aon duine óg chun obair thionnscail do dhéanamh i ngnó tionnscail ar obair lae a leigint don duine óg san—
(a) tosnú ar obair níos luatha ná 8 a chlog a.m. aon lá, no
(b) leanúint d'obair tar éis aon teorann acu so leanas (dá ngairmtear teoranta ama d'obair lae do dhaoine óga san Acht so), sé sin le rá:—
(i) 8 a chlog p.m. aon lá,
(ii) 1 a chlog p.m. aon ghearr-lá,
(iii) an tráth aon ghnáth-lá oibre 'na mbeidh obair ocht n-uaire a chluig críochnuithe ag an duine óg san an lá san,
(iv) an tráth aon ghearr-lá 'na mbeidh obair cheithre huaire a chluig críochnuithe ag an duine óg san an gearr-lá san,
(v) an tráth aon tseachtain 'na mbeidh obair dhachad uair a chluig críochnuithe ag an duine óg san an tseachtain sin.
(2) Má dheineann fostóir ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so.
Uaireanna oibre daoine óg do shíneadh.
40.—(1) Féadfaidh an tAire, más deimhin leis daoine óga bheidh ar fostú chun aon tsaghas oibre tionnscail do dhéanamh do bheith ar fostú amhlaidh mar chongantóirí d'oibrithe fásta agus ná féadfadh obair na n-oibrithe fásta san dul ar aghaidh i slí shásúil mara n-oibríodh na daoine óga san ar feadh na n-uaireanna céanna leis na hoibrithe fásta san, féadfaidh, le hordú, rialacháin do dhéanamh do réir an ailt seo á ordú go dtuigfear gur oibrithe fásta, chun crícheanna an Achta so, daoine óga no daoine óga ag á mbeidh aois áirithe slánuithe faid a bheidh an saghas san oibre tionnscail á dhéanamh acu.
(2) Ní dhéanfaidh an tAire rialacháin maidir le haon tsaghas oibre tionnscail fén alt so mara mbeidh sé tar éis dul i gcomhairle ar dtúis le hionadaithe d'fhostóirí ag á mbeidh leas sa tsaghas san oibre tionnscail agus le hionadaithe d'oibrithe ag á mbeidh leas amhlaidh.
(3) Pé uair a bheidh rialacháin a bheidh déanta fé réim agus do réir an ailt seo i bhfeidhm de thurus na huaire tuigfear na daoine óga le n-a mbainfidh na rialacháin sin do bheith ina n-oibrithe fásta, chun crícheanna an Achta so, faid a bheidh an saghas oibre tionnscail gur ina thaobh do rinneadh na rialacháin sin á dhéanamh acu.
(4) Má tuigtear fén alt so duine ar bith do bheith ina oibrí fásta chun crícheanna an Achta so ní bheidh sé dleathach d'fhostóir ar bith a leigint don duine sin aon tsaghas oibre tionnscail do dhéanamh do idir 10 a chlog p.m. aon lá agus 8 a chlog a.m. an lá ina dhiaidh sin, ná a leigint don duine sin tosnú ar aon obair thionnscail do dhéanamh do aon lá go dtí go mbeidh aon uair déag a chluig caithte ón uair do scuir an duine sin d'obair thionnscail do dhéanamh an lá roimhe sin.
(5) Má dheineann fostóir ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so.
Breis-aimsir nea-rialuithe.
41.—(1) Fé réir forálacha an ailt seo agus fós fé réir na srian a forchuirtear tríd an Acht so le mná agus daoine óga d'fhostú istoíche, ach in ainneoin aon fhorála eile den Acht so, féadfaidh fostóir ar bith oibrí d'fhostú chun obair thionnscail do dhéanamh i ngnó tionnscail ar feadh tréimhse is sia, aon lá áirithe, ná an tréimhse ceaduítear chuige sin leis an Acht so (seachas an t-alt so), ach san fé réir na teorann ná raghaidh an fhaid aimsire gur sia-di an tréimhse sin is sia ná an tréimhse sin a ceaduítear amhlaidh mar adubhradh, ná ragha sí—
(a) maidir le haon oibrí fásta, thar dhá uair a chluig aon lá, ná thar dhá uair déag a chluig aon tseachtain, ná thar dhá chéad agus dachad uair a chluig aon bhliain ná thar sé huaire triochad a chluig in aon tréimhse de cheithre seachtaine as a chéile, no
(b) maidir le haon duine óg, thar dhá uair a chluig aon ghnáthlá ná thar uair a chluig aon ghearr-lá, ná thar deich n-uaire a chluig aon tseachtain, ná thar dhá chéad uair a chluig aon bhliain ná thar triocha uair a chluig in aon tréimhse de cheithre seachtaine as a chéile.
(2) Féadfaidh an tAire tráth ar bith más oiriúnach leis é, le hordú ar n-a dhéanamh tar éis do dul i gcomhairle le hionadaithe d'fhostóirí ag á mbeidh leas sa tsaghas oibre tionnscail le n-a mbainfidh an scéal agus le hionadaithe d'oibrithe ag á mbeidh leas amhlaidh, rialacháin do dhéanamh chun ceachtar críoch no chun an dá chrích acu so leanas, sé sin le rá:—
(a) chun a thoirmeasc oibrithe no aon aicme no aicmí áirithe oibrithe d'fhostú, fén bhfo-alt deiridh sin roimhe seo den alt so, chun aon tsaghas áirithe oibre tionnscail do dhéanamh i ngnó tionnscail ar feadh tréimhse is sia ná an tréimhse ceaduítear leis an Acht so (seachas an t-alt so);
(b) chun laigheadú do dhéanamh ar an fhaid aimsire, de bhreis ar an tréimhse ceaduítear leis an Acht so (seachas an t-alt so), gur ar a feadh a féadfar oibrithe no aon aicme no aicmí áirithe oibrithe d'fhostú, de bhuadh an fho-ailt deiridh sin roimhe seo den alt so, chun aon tsaghas áirithe oibre tionnscail do dhéanamh i ngnó tionnscail.
(3) Pé uair agus faid a bheidh rialacháin a bheidh déanta fén bhfo-alt deiridh sin roimhe seo den alt so i bhfeidhm beidh éifeacht ag fo-alt (1) den alt so fé réir na rialachán san.
Breis-aimsir cheaduithe.
42.—(1) Más dóich leis agus pé uair is dóich leis san do bheith ceart féadfaidh an tAire, ar n-a iarraidh sin air do réir an ailt seo d'fhostóir a fhostuíonn oibrithe chun obair thionnscail do dhéanamh i ngnó tionnscail, cead i scríbhinn do dheonadh don fhostóir sin chun oibrithe no aon aicme no aicmí áirithe oibrithe d'fhostú, ar feadh tréimhse áirithe thosnóidh ar dháta nách luatha ná seacht lá tar éis dáta an iarratais sin, chun obair thionnscail do dhéanamh sa ghnó tionnscail sin ar feadh tréimhse áirithe is sia gach lá ná an tréimhse ceaduítear chuige sin leis an Acht so.
(2) Féadfaidh an tAire coinníollacha do chur ag gabháil leis an gceadú a deonfar le cead fén alt so, pé coinníollacha is dóich leis is ceart agus a luadhfaidh sa chead san.
(3) Féadfaidh an tAire, tráth ar bith, cead a dheoin sé fén alt so do cheiliúradh.
(4) Pé uair a deonfar cead d'fhostóir fén alt so beidh sé dleathach don fhostóir sin, fé réir aon cheiliúrtha déanfar ar an gcead san, oibrithe d'fhostú do réir an cheada san d'ainneoin éinní contrárdha dho san atá san Acht so.

43.—(1) Má dheineann fostóir ar bith a fhostuíonn aon oibrí chun obair thionnscail do dhéanamh ar tuarastal no ar págh leigint don oibrí sin breis-aimsir (dá ngairmtear breis-aimsir laethiúil san alt so) do chaitheamh ag obair aon lá tuigfear gur aontuigh an fostóir sin an t-oibrí sin d'íoc do réir an ráta bhreis-aimsire as aon bhreis-aimsir a chaithfe sé ag obair amhlaidh an lá san.
(2) Má dheineann fostóir ar bith, fhostuíonn aon oibrí chun obair thionnscail do dhéanamh ar tuarastal no ar págh, leigint d'aon oibrí i seachtain ar bith breis-aimsir sheachtainiúil do chaitheamh ag obair agus más mó an bhreis-aimsir sheachtainiúil a chaithfidh an t-oibrí sin ag obair ná iomlán na breis-aimsire laethiúla chaithfidh an t-oibrí sin ag obair an tseachtain sin, tuigfear gur aontuigh an fostóir sin an t-oibrí sin d'íoc do réir an ráta bhreis-aimsire as an méid aimsire gurb é an deifríocht é idir an t-iomlán san agus an bhreis-aimsir sheachtainiúil sin, i dteanta aon luach saothair eile go mbeidh an t-oibrí sin i dteideal é d'fháil as an mbreis-aimsir laethiúil sin.

44.—(1) Ní bheidh sé dleathach d'fhostóir ar bith oibrí d'fhostú chun aon tsaghas oibre tionnscail do dhéanamh aon lá a bheidh an t-oibrí sin tar éis aon tsaghas oibre tionnscail do dhéanamh d'fhostóir eile, ach amháin i gcás ná raghaidh iomlán na dtréimhsí bheidh obair thionnscail á déanamh ag an oibrí sin do gach fostóir acu san fé seach an lá san thar an tréimhse (gan breis-aimsir d'áireamh) a fheadfadh an t-oibrí sin bheith ar fostú go dleathach chun obair thionnscail do dhéanamh d'aon fhostóir amháin an lá san.
(2) Pé uair a fhostóidh fostóir oibrí contrárdha don alt so beidh an fostóir sin ciontach i gcionta fén alt so agus beidh an t-oibrí sin freisin ciontach i gcionta fén alt so.
Aois mhinimum do dhaoine óga.
45.—(1) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh ag ceapadh na haoise minimum ar a mbeidh sé dleathach daoine óga d'fhostú in aon tsaghas oibre tionnscail a luadhfar sna rialacháin sin agus, más oiriúnach leis é, féadfaidh an tAire, le haon rialacháin den tsórt san, aois mhinimum dheifriúil de cheapadh maidir le daoine óga fireannacha agus le daoine óga baineannacha.
(2) Má fhostuíonn fostóir ar bith aon duine óg contrárdha d'aon rialacháin a bheidh déanta fén alt so agus a bheidh i bhfeidhm de thurus na huaire beidh sé ciontach i gcionta fén alt so agus beidh an duine óg san freisin ciontach i gcionta fén alt so.

46.—(1) D'ainneoin aon fhorála den Acht so seachas an fhoráil a bheireann comhacht don Aire rialacháin um eisceadh do dhéanamh ní bheidh sé dleathach d'fhostóir ar bith leigint d'aon mhnaoi aon obair thionnscail a dhéanamh do tráth ar bith idir a 10 a chlog p.m. aon lá agus a 8 a chlog a.m. an lá ina dhiaidh sin ná leigint d'aon mhnaoi tosnú ar aon obair thionnscail a dhéanamh do aon lá go dtí go mbeidh aon uair déag a chluig caithte ón tráth do scuir sí d'obair thionnscail a dhéanamh an lá roimhe sin.
(2) Má dheineann fostóir ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so.

47.—(1) D'ainneoin aon fhorála den Acht so seachas an fhoráil a bheireann comhacht don Aire rialacháin um eisceadh do dhéanamh ní bheidh sé dleathach d'fhostóir ar bith leigint d'aon duine óg, nách duine óg a tuigtear a bheith ina dhuine fásta chun crícheanna an Achta so, aon obair thionnscail a dhéanamh do tráth ar bith sa tréimhse (dá ngairmtear an tréimhse thoirmiscithe san alt so) idir a 8 a chlog p.m. aon lá agus a 8 a chlog a.m. an lá ina dhiaidh sin maran rud é gur duine óg fireannach an duine óg san agus gur fé réim agus do réir rialachán ar n-a ndéanamh ag an Aire fén alt so bheidh sé ar fostú amhlaidh.
(2) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh á údarú daoine óga fireannacha os cionn sé mblian déag d'aois d'fhostú chun aon tsaghas oibre tionnscail acu so leanas do bheith ar siúl acu tráth ar bith sa tréimhse thoirmiscithe, sé sin le rá:—
(a) próiseasaí ina n-úsáidtear foirnéisí frith-chasacha no aith-gheiniúnacha chun iarann agus cruaidh do dhéanamh agus chun leathán-mhiotal no srang do ghalbhánú (ach amháin próiseas an phiclithe);
(b) gloine do dhéanamh;
(c) páipéar do dhéanamh;
(d) siúicre amh do dhéanamh;
(e) obair dhí-ocsoighniú ór-mhianadóireachta;
agus féadfaidh an tAire, leis na rialacháin sin, pé coinníollacha, teoranta no srianta, is dóich leis is ceart d'fhorchur maidir leis an bhfostaíocht san.
(3) Má fhostuíonn fostóir ar bith aon duine óg contrárdha don alt so no contrárdha d'aon choinníoll, teorainn no srian a bheidh forchurtha le rialacháin a bheidh déanta fén alt so agus a bheidh i bhfeidhm de thurus na huaire, beidh an fostóir sin ciontach i gcionta fén alt so.
Eatraimh in obair.
48.—(1) Ní bheidh sé dleathach d'fhostóir ar bith leigint d'aon oibrí bheidh ar fostú aige ar obair lae aon obair thionnscail do dhéanamh do ar feadh tréimhse ar bith is sia ná cúig uaire a chluig aon lá maran rud é go scuirfidh an t-oibrí sin d'obair tar éis tréimhse nách sia ná cúig uaire a chluig ón tráth thosnuigh sé ag obair agus ná tosnóidh sé ag obair arís go mbeidh tréimhse (dá ngairmtear an t-eatramh san alt so) de leath-uair a chluig ar a laighead caithte.
(2) Ní bheidh sé dleathach d'fhostóir ar bith leigint d'aon oibrí, bheidh ar fostú aige chun aon obair thionnscail do dhéanamh ar obair lae, leanúint den obair thionnscail sin do dhéanamh ar breis-aimsir ar feadh tréimhse is sia ná uair go leith a chluig tar éis aon teora aimsire d'obair lae ceaptar leis an Acht so no ceapfar fé alos aon ghnáth-lae oibre maran rud é go mbeidh an t-oibrí sin díreach roimh thosnú dho ar obair do dhéanamh ar breis-aimsir, tar éis scurtha d'obair ar feadh tréimhse (dá ngairmtear an t-eatramh breis-aimsire san alt so) de leath-uair a chluig ar a laighead.
(3) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so, déanfaidh gach fostóir a fhostóidh oibrithe chun obair thionnscail do dhéanamh in aon ghnó tionnscail an t-eatramh do cheapadh an tráth céanna do sna hoibrithe sin, agus ní cheadóidh aon obair thionnscail den tsaghas san do bheith ar siúl le linn an eatraimh sin.
(4) Más deimhin leis an Aire, ar iarratas i scríbhinn d'fháil o fhostóir ar bith, go dtiocfadh, de bhíthin an chinéil oibre tionnscail gur chun é dhéanamh fhostuíonn an fostóir sin oibrithe, cailliúint mhór as an eatramh do cheapadh an tráth céanna do sna hoibrithe sin uile féadfaidh an tAire, le cead a fhéadfaidh an tAire do tharrac siar tráth ar bith, saoirse o fhorálacha an fho-ailt sin roimhe seo do lomháil don fhostóir sin agus pé uair a bheidh aon chead den tsórt san i bhfeidhm de thurus na huaire ní bhainfidh forálacha an fho-ailt sin roimhe seo leis an bhfostóir sin maidir leis an obair thionnscail sin.
(5) Gach oibrí bheidh ar fostú ar obair thionnscail agus a bheidh i láthair in áitreabh a fhostóra faid a bheidh obair thionnscail á déanamh san áitreabh san tuigfear, chun crícheanna an ailt seo, é do bheith i láthair san áitreabh san chun na hoibre tionnscail do dhéanamh gur uirthi bheidh sé ar fostú amhlaidh, maran contrárdha d'orduithe an fhostóra san a bheidh sé i láthair amhlaidh san áitreabh san.
(6) Má dheineann fostóir ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so.
Laetheanta puiblí agus Domhantaí.
49.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an Acht so, ní bheidh sé dleathach d'fhostóir ar bith leigint d'aon oibrí ina fhostaíocht aon obair thionnscail do dhéanamh do, aon lá is Domhnach no lá saoire puiblí, seachas obair thionnscail—
(a) is uain-obair phróisis leanúnaigh,
(b) is uain-obair cheadúnaithe,
(c) a deintear chun no i dtaobh páipéirí nuachta do chlóbhualadh no d'fhoillsiú,
(d) is obair uachtarlainne,
(e) is obair thionnscail a bheidh eiscithe ón bhfo-alt so le rialacháin a dhéanfaidh an tAire tar éis do dul i gcomhairle le hionadaithe d'fhostóirí ag á mbeidh leas san obair thionnscail sin agus le hionadaithe d'oibrithe ag á mbeidh leas amhlaidh,
(f) a deintear chun no i dtaobh aon ghléis thelegrafaigh no thelefónaigh do chur suas no aon ghléis den tsórt san a bheidh curtha suas do chothabháil, d'atharú no do dheisiú,
(g) a deintear chun no i dtaobh stáisiúin fhoirleatha bhíonn á chothabháil agus á oibriú fé Chuid II den Acht Radio-Thelegrafaíochta, 1926 (Uimh. 45 de 1926), do chothabháil agus d'oibriú.
(2) D'ainneoin éinní atá sa bhfo-alt deiridh sin roimhe seo den alt so, féadfaidh fostóir oibrí fásta fireannach d'fhostú aon Domhnach, ar feadh tréimhse nách sia ná trí huaire a chluig no ar feadh dhá thréimhse no níos mó nách sia a n-iomlán ná trí huaire a chluig, chun aon obair thionnscail do dhéanamh le n-a mbaineann an toirmeasc a deintear leis an bhfo-alt deiridh sin roimhe seo.
(3) Má fhostuíonn fostóir ar bith aon oibrí chun aon obair thionnscail, ná baineann an toirmeasc a deintear le fo-alt (1) den alt so léi, do dhéanamh ar an Domhnach in aon tseachtain, déanfaidh an fostóir sin, má fhanann an t-oibrí sin ina fhostaíocht ar feadh na seachtaine sin, sos cheithre huaire fichead a chluig as a chéile do lomháil do roimh an chéad Domhnach ina dhiaidh sin.
(4) Más dóich leis san do bheith ceart, féadfaidh an tAire, le hordú, rialacháin do dhéanamh á cheadú, maidir le haon tsaghas áirithe oibre tionnscail, an tréimhse shosa de cheithre huaire fichead a chluig as a chéile a luaidhtear sa bhfo-alt deiridh sin roimhe seo den alt so do thabhairt d'aon oibrí laistigh de sheacht lá tar éis an Domhnaigh a bhí an t-oibrí sin ar fostú i slí do thug teideal do fén bhfo-alt deiridh sin roimhe seo chun na tréimhse sosa san, agus pé uair a déanfar aon rialacháin den tsórt san amhlaidh beidh éifeacht ag an bhfo-alt deiridh sin roimhe seo fé réir forálacha na rialachán san.
(5) I gcás ina dtoirmeasctar ar fhostóir leis an alt so leigint d'oibrithe ina fhostaíocht obair thionnscail do dhéanamh do lá saoire puiblí, íocfaidh an fostóir sin, in aghaidh gach lae shaoire phuiblí, págh aon lae amháin (ar n-a dhéanamh amach do réir an ráta do bheadh oiriúnach dá mba lá de shaoire bhliantúil an lá saoire puiblí sin) le gach oibrí—
(a) is oibrí le n-a mbaineann an toirmeasc san, agus
(b) a bheidh i bhfostaíocht an fhostóra san an lá oibre díreach roimh an lá saoire puiblí sin, agus
(c) do bhí sa bhfostaíocht san go leanúnach ar feadh iomlán na tréimhse de cheithre seachtaine dar críoch an lá oibre sin, agus
(d) d'oibrigh sa bhfostaíocht san céad go leith uair a chluig ar a laighead ar feadh na tréimhse sin de cheithre seachtaine, agus
(e) d'oibrigh sa bhfostaíocht san fiche uair a chluig ar a laighead i rith an sé lá oibre díreach roimh an lá saoire puiblí sin.
(6) Féadfaidh an tAire le hordú, pé uair agus chó minic agus is dóich leis san do bheith ceart, rialacháin do dhéanamh a atharóidh, maidir le gach aicme oibrithe no aon aicmí no aicme áirithe oibrithe, gach ceann no aon cheann de sna tréimhsí de chéad go leith uair a chluig agus d'fhiche uair a chluig a luaidhtear sa bhfo-alt deiridh sin roimhe seo den alt so tré pé tréimhsí no tréimhse eile, is dóich leis an Aire is ceart, do chur in ionad na dtréimhsí no na tréimhse sin, agus pé uair a bheidh aon rialacháin den tsórt san i bhfeidhm beidh éifeacht ag an bhfo-alt deiridh sin roimhe seo maidir leis na hoibrithe no na haicmí no an aicme oibrithe le n-a mbainfidh na rialacháin sin fé is dá ndeintí na tréimhsí no an tréimhse sin dá ndéanfaidh na rialacháin sin deifir d'atharú sa tslí luaidhtear sna rialacháin sin.
(7) Déanfar, maidir le baint an dá fho-alt deiridh sin roimhe seo den alt so le hoibrithe is daoine óga, na tréimhsí uile agus fé seach de chéad agus fiche uair a chluig agus de shé uair déag a chluig do chur fé seach in ionad na dtréimhsí uile agus fé seach de chéad go leith uair a chluig agus d'fhiche uair a chluig, agus beidh éifeacht ag an dá fho-alt deiridh sin roimhe seo dá réir sin maidir leis na hoibrithe sin.
(8) Má theipeann ar aon fhostóir íoc do dhéanamh le hoibrí ar bith in aon airgead a thiocfaidh chun bheith iníoctha leis an oibrí sin fén alt so, féadfaidh an t-oibrí sin an t-airgead san do bhaint den fhostóir sin mar fhiacha gnáth-chonnartha.
(9) Má dheineann duine ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so.
Clár na gCó-aontuithe Páigh.
50.—(1) Chó luath agus is féidir é tar éis tosach feidhme an Achta so bunóidh an tAire agus coimeádfaidh ar bun ina dhiaidh sin clár (dá ngairmtear an clár san alt so) a bheidh i pé fuirm is dóich leis is ceart agus ar a dtabharfar Clár na gCó-aontuithe Páigh.
(2) Gach có-aontú ar n-a shighniú (pe'ca roimh thosach feidhme an Achta so no dá éis sin é no pe'ca roimh an Acht so do rith no dá éis sin é) ag cólucht no cóluchtaí no thar ceann cóluchta no cóluchtaí (dá ngairmtear fostóir-shighniúirí san alt so) bheidh sáthach ionadathach do sna fostóirí ag á mbeidh leas in aon tsaghas áirithe oibre tionnscail i Saorstát Éireann uile no in aon chuid áirithe dhe, agus ag cólucht no cóluchtaí (dá ngairmtear oibrí-shighniúirí san alt so) bheidh sáthach ionadathach do sna hoibrithe no d'aon aicme áirithe de sna hoibrithe ag á mbeidh leas sa tsaghas áirithe sin oibre tionnscail i Saorstát Éireann uile no sa chuid áirithe sin de (do réir mar bheidh), có-aontú le n-a ndeintear na rátaí tuarastail, páigh no luach saothair eile, is iníoctha leis na hoibrithe no leis an aicme oibrithe sin, do rialáil no do shrianadh, féadfaidh páirtí amháin no níos mó de pháirtithe an chó-aontuithe sin é do thíolacadh, laistigh den am a ceaptar leis an alt so, don Aire chun é do chlárú sa chlár.
(3) Pé uair a déanfar có-aontú, do rinneadh maidir le haon tsaghas áirithe oibre tionnscail, do thíolacadh fén alt so don Aire chun é do chlárú sa chlár agus is deimhin leis an Aire—
(a) na fostóir-shighniúirí ís páirtithe sa chó-aontú san do bheith sáthach ionadathach do sna fostóirí go mbeidh baint acu leis an saghas san oibre tionnscail sa líomatáiste le n-a mbainfidh an có-aontú san, agus
(b) na hoibrí-shighniúirí is páirtithe sa chó-aontú san do bheith sáthach ionadathach do sna hoibrithe no d'aicme áirithe oibrithe go mbeidh baint acu leis an saghas san oibre tionnscail sa líomatáiste le n-a mbainfidh an có-aontú san, agus
(c) más tar éis tosach feidhme an Achta so déanfar an có-aontú san, forálacha do bheith ann chun ré an chó-aontuithe sin do rialáil no chun socruithe do dhéanamh chun deireadh do chur leis agus na forálacha san do bheith curtha le chéile i slí chuirfidh in áirithe an có-aontú san do bheith i ngníomh ar feadh bliana ar a laighead o dháta an chéanna, agus
(d) an có-aontú san do bheith oiriúnach ar gach slí chun é do chlárú sa chlár,
cláróidh an tAire an có-aontú san sa chlár.
(4) Pé uair a clárófar có-aontú sa chlár beidh éifeacht ag na forálacha so leanas an dáta clárófar an có-aontú san amhlaidh agus dá éis sin agus an fhaid ina dhiaidh sin a leanfa sé de bheith ina cheangal ar pháirtithe an chéanna, beidh éifeacht acu maidir leis an gcó-aontú san, se sin le rá:—
(a) beidh an có-aontú san ina cheangal ar gach fostóir go mbeidh baint aige leis an saghas oibre tionnscail sa líomatáiste le n-a mbainfidh an có-aontú san agus ar gach oibrí no, i gcás gan an có-aontú san do bhaint ach le haicme oibrithe, ar gach oibrí den aicme sin a bheidh ar fostú sa tsaghas san oibre tionnscail sa líomatáiste sin;
(b) ní bheidh sé dleathach d'fhostóir ar bith den tsórt san aon oibrí den tsórt san d'fhostú ná d'íoc ná d'aon oibrí den tsórt san oibriú d'fhostóir ar bith den tsórt san ná íocaíocht do ghlacadh uaidh do réir ráta tuarastail, páigh no luach saothair eile is lugha ná an ráta bheidh socair leis an gcó-aontú san agus a bhainfidh leis an oibrí sin;
(c) má dheineann fostóir ar bith den tsórt san aon oibrí den tsórt san d'fhostú no d'íoc contrárdha don mhír dheiridh sin roimhe seo den fho-alt so, beidh an fostóir sin ciontach i gcionta fén alt so agus má ghlacann aon oibrí den tsórt san aon fhostaíocht no íocaíocht contrárdha don mhír dheiridh sin roimhe seo, beidh an t-oibrí sin freisin ciontach i gcionta fén alt so;
(d) fé réir forálacha na céad mhíre ina dhiaidh seo den fho-alt so beidh gach oibrí den tsórt san, d'ainneoin aon chonnartha contrárdha dho san, i dteideal tuarastail, páigh no luach saothair eile, do réir an ráta bheidh socair leis an gcó-aontú san agus a bhainfidh leis an oibrí sin, d'éileamh ar a fhostóir agus d'fháil mar íocaíocht uaidh agus do bhaint de;
(e) ní oibreoidh éinní atá sa bhfo-alt so chun a chosc ar fhostóir ar bith den tsórt san aon oibrí den tsórt san d'fhostú no tuarastal, págh no luach saothair eile d'íoc leis do réir ráta is mó no is tairbhighe don oibrí sin ná an ráta bheidh socair leis an gcó-aontú san agus a bhainfidh leis an oibrí sin, ná ní oibreoidh chun a chosc ar aon oibrí den tsórt san, a bheidh ar fostú amhlaidh do réir an ráta tuarastail, páigh, no luach saothair eile sin is mó no is tairbhighe, tuarastal, págh, no luach saothair eile do réir an ráta san is mó no is tairbhighe do bhaint dá fhostóir.
(5) Pé uair a tíolaicfear có-aontú don Aire chun é chlárú fén alt so, déanfaidh an páirtí no na páirtithe thíolacfaidh an có-aontú san amhlaidh cóip de do thabhairt don Aire chun eisean dá coimeád agus an t-eolas san uile (más aon eolas é) bheidh ag teastáil ón Aire i dtaobh an chó-aontuithe sin do thabhairt do agus má theipeann ar an bpáirtí no na páirtithe sin an chóip agus an t-eolas san do thabhairt do féadfaidh an tAire, ar scór na teipe sin, diúltú don chó-aontú san do chlárú.
(6) Pé uair a clárófar có-aontú sa chlár beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) cuirfidh oifigeach don Aire, go n-údarás chuige sin ón Aire, fé ndeár deimhniú á rá go bhfuil an có-aontú san cláruithe amhlaidh agus ag luadh an dáta ar ar cláruíodh é amhlaidh do chúlscríobhadh ar an ionstruim sin agus sighneoidh sé an deimhniú san;
(b) cuirfidh an tAire fé ndeár fógra i dtaobh an chó-aontuithe sin do chlárú sa chlár (i dteanta pé mion-innste i dtaobh an chó-aontuithe sin agus an chláruithe sin is dóich leis an Aire is ceart) d'fhoillsiú san Iris Oifigiúil;
(c) féadfaidh duine ar bith cóip de chóip an chó-aontuithe sin a choimeádfaidh an tAire fén alt so d'fháil ón Aire ar san d'iarraidh sa tslí orduithe agus ar an táille orduithe d'íoc.
(7) Deimhniú bheidh cúlscríobhtha agus sighnithe ar chó-aontú do réir an fho-ailt deiridh sin roimhe seo den alt so glacfar é i ngach cúirt mar fhianaise dhochlaoite go bhfuil an có-aontú san cláruithe go cuibhe sa chlár agus gur cláruíodh é amhlaidh an dáta bheidh luaidhte chuige sin sa deimhniú san, agus glacfar an deimhniú san gan cruthú ar shighniú an oifigigh a bheireann le tuisgint gur shighnigh sé an deimhniú san do réir an fho-ailt sin ná gurbh oifigeach don Aire é ná go raibh údarás aige ón Aire an deimhniú san do shighniú.
(8) Pé uair a clárófar có-aontú sa chlár féadfaidh duine ar bith, laistigh de mhí tar éis fógra i dtaobh an chláruithe sin d'fhoillsiú san Iris Oifigiúil, a iarraidh ar an Ard-Chúirt i slí achmair an clárú san do chur ar neambrí agus, ar an iarratas san d'éisteacht, féadfaidh an Ard-Chúirt, más deimhin léi gur fíor ceachtar de sna nithe seo leanas no iad araon, sé sin le rá:—
(a) ná raibh na fostóir-shighniúirí is páirtithe sa chó-aontú san sáthach ionadathach, ar dháta an chó-aontuithe sin, do sna fostóirí ag á bhfuil leas sa tsaghas oibre tionnscail le n-a mbaineann an có-aontú san i Saorstát Éireann no, i gcás gan an có-aontú san do bhaint ach le cuid de Shaorstát Éireann, sa chuid sin de Shaorstát Éireann, no
(b) ná raibh na hoibrí-shighniúirí is páirtithe sa chó-aontú san sáthach ionadathach, ar dháta an chó-aontuithe sin, do sna hoibrithe no don aicme áirithe oibrithe le n-a mbaineann an có-aontú san agus a bhíonn ar fostú sa tsaghas oibre tionnscail le n-a mbaineann an có-aontú san i Saorstát Éireann no, i gcás gan an có-aontú san do bhaint ach le cuid de Shaorstát Éireann, sa chuid sin de Shaorstát Éireann,
féadfaidh clárú an chó-aontuithe sin sa chlár do chur ar neambrí.
(9) Isé am gur laistigh de féadfar có-aontú do thíolacadh don Aire fén alt so chun é do chlárú sa chlár ná—

51.—Más rud é, chun déanamh do réir an Achta so, go ndéanfar na huaireanna oibre bheidh ann díreach roimh thosach feidhme an Achta so, maidir le gach duine no le daoine no le duine áirithe bheidh ar fostú in aon tsaghas áirithe oibre tionnscail, do laigheadú no d'atharú ar shlí eile, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) ní déanfar an ráta tuarastail, páigh, no luach saothair eile is iníoctha le haon duine den tsórt san díreach roimh thosach feidhme an Achta so do laigheadú ná d'atharú ar shlí eile chun dochair don duine sin de bhíthin an laigheaduithe no an atharuithe sin ar uaireanna oibre an duine sin agus dá bhíthin sin amháin;
(b) ní dhéanfaidh an laigheadú no an t-atharú san ar na huaireanna oibre deireadh do chur leis an gconnradh seirbhíse fé n-a mbeidh aon duine den tsórt san ar fostú amhlaidh díreach roimh thosach feidhme an Achta so ná ní dhéanfaidh dochar don chonnradh san, agus leanfaidh gach connradh den tsórt san i bhfeidhm tar éis an tosach feidhme sin gus na hatharuithe sin amháin is gá chun déanamh do réir an Achta so, agus go sonnrách gus an atharú ná déanfar, d'ainneoin an laigheaduithe no an atharuithe sin ar uaireanna oibre, an meán-tuilleamh seachtainiúil is iníoctha i ngnáth-sheachtain iomlán oibre leis an duine sin fén gconnradh san do laigheadú;
(c) gach có-aontú, idir fostóirí no cólucht is ionadathach d'fhostóirí ar thaobh agus oibrithe no cólucht is ionadathach d'oibrithe ar an taobh eile, a bheidh i bhfeidhm díreach roimh thosach feidhme an Achta so agus le n-a rialálfar no le n-a srianfar an ráta tuarastail, páigh, no luach saothair eile is iníoctha le haon duine den tsórt san, leanfa sé i bhfeidhm tar éis tosach feidhme an Achta so d'ainneoin an laigheaduithe no an atharuithe sin ar uaireanna oibre ach san gus an atharú go bhfanfaidh gach ráta tuarastail, páigh, no luach saothair eile bheidh socair no go mbeidh modh a áirmhithe socair leis an gcó-aontú san, agus gach srian le haon ráta tuarastail, páigh, no luach saothair eile bheidh sa chó-aontú san, gan atharú maidir le méid;
(d) gach ráta minimum tuarastail, páigh, no luach saothair eile bheidh socair le reacht no fé údarás reachtúil agus a bheidh i bhfeidhm díreach roimh thosach feidhme an Achta so, leanfaidh, má bhaineann agus sa mhéid go mbainfidh le haon duine den tsórt san, leanfaidh, tar éis an tosach feidhme sin, de bheith i bhfeidhm agus gan atharú maidir le méid d'ainneoin an laigheaduithe no an atharuithe sin ar uaireanna oibre.
(2) Beidh feidhm agus éifeacht ag an bhfo-alt san roimhe seo den alt so maidir le gach rialachán a dhéanfaidh an tAire fén Acht so ag ceapadh uaireanna oibre maidir le haon tsaghas oibre tionnscail (pe'ca do gach aicme no d'aon aicmí no aicme áirithe oibrithe bheidh ag gabháil do é) gus na hatharuithe agus fé réir na n-atharuithe go ndéanfar gach tagairt sa bhfo-alt san do thosach feidhme an Achta so do léiriú agus go mbeidh éifeacht aici mar thagairt do theacht i ngníomh don rialachán san, agus go ndéanfar gach tagairt sa bhfo-alt san i dtaobh déanamh do réir an Achta so do léiriú agus go mbeidh éifeacht aici mar thagairt do chólíonadh na rialachán san.
(3) Bainfidh an t-alt so le págh tasc-oibre agus le págh ar n-a áireamh tré thagairt díreach don méid uair a hoibríodh, ach san gus an atharú go ndéanfar, chun crícheanna an iarratais sin, gach foráil san alt so, gurb é a ciall go bhfanfaidh ráta páigh no ráta minimum páigh no srian le ráta páigh gan atharú, do léiriú agus go mbeidh éifeacht aici mar fhoráil go ndéanfar an ráta páigh thasc-oibre no an ráta páigh in aghaidh na huaire a chluig (pe'ca aca é) do choigeartú no d'atharú i slí go bhfanfaidh an meántuilleamh seachtainiúil gan atharú.

52.—(1) Pé uair a dhéanfaidh an tAire rialacháin á dhearbhú aon tsaghas oibre tionnscail do bheith ina obair thionnscail eiscithe chun críche aon ailt den Chuid seo den Acht so bhaineann leis na huaireanna gur ar a bhfeadh a fhéadfaidh fostóir ar bith leigint d'aon oibrí aon tsaghas oibre tionnscail do dhéanamh do féadfaidh an tAire, le hordú, rialacháin do dhéanamh le n-a gceapfar, i pé slí is oiriúnach leis, na huaireanna oibre maidir leis an saghas san oibre tionnscail do sna haicmí oibrithe uile no d'aon aicmí oibrithe bheidh ag gabháil don tsaghas san oibre tionnscail agus, faid a bheidh na rialacháin sin i bhfeidhm, ní bheidh sé dleathach d'fostóir ar bith leigint d'aon oibrí le n-a mbainfidh na rialacháin sin an obair thionnscail sin do dhéanamh do ach amháin ar feadh pé uaireanna ceapfar leis an ordú san.
(2) Pé uair a cheapfaidh an tAire, le rialacháin ar n-a ndéanamh fén alt so, na huaireanna oibre maidir le haon tsaghas oibre tionnscail (pe'ca do gach aicme no d'aon aicmí no aicme áirithe oibrithe bheidh ag gabháil do é) féadfaidh an tAire, leis na rialacháin chéanna, pé socruithe do dhéanamh is dóich leis is gá no is ceart chun a chur in áirithe ná déanfar an meán-tuilleamh seachtainiúil is iníoctha i ngnáth-sheachtain iomlán oibre le duine ar bith, go laigheadeofar a uaireanna oibre leis na rialcháin sin, do laigheadú de bhíthin an laigheaduithe sin ar a uaireanna oibre agus dá bhíthin sin amháin.
(3) Ní dhéanfaidh an tAire aon rialacháin fén alt so mara mbeidh sé tar éis dul i gcomhairle ar dtúis le hionadaithe d'fhostóirí ag á mbeidh leas sa tsaghas oibre tionnscail le n-a mbainfidh na rialacháin sin agus le hionadaithe d'oibrithe ag á mbeidh leas amhlaidh.
(4) Má leigeann fostóir ar bith d'aon oibrí obair do dhéanamh do, no má fhostuíonn sé aon oibrí chun obair do dhéanamh do, contrárdha d'aon rialacháin a bheidh déanta fén alt so agus a bheidh i bhfeidhm de thurus na huaire beidh an fostóir sin ciontach i gcionta fén alt so agus beidh an t-oibrí sin freisin ciontach i gcionta fén alt so.
Achmaireacht agus fógraí do bheith ar taisbeáint.
53.—(1) Gach fostóir fhostóidh aon oibrí chun obair thionnscail do dhéanamh in aon áitreabh ina mbeidh gnó tionnscail ar siúl beidh ar taisbeáint aige, ag an slí isteach chun an áitreibh sin agus i pé áiteanna eile ordóidh cigire é bheith de thurus na huaire, agus é in a leithéid sin d'ionad go bhféadfaidh daoine bheidh ar fostú amhlaidh san áitreabh san é léigheamh go saoráideach—
(a) an achmaireacht orduithe ar an Acht so, agus
(b) fógra sa bhfuirm orduithe i dtaobh na n-uaireanna oibre d'oibrithe bheidh ag déanamh na hoibre tionnscail sin, agus
(c) fógra ag luadh na laetheanta sa bhliain reatha is laetheanta saoire puiblí de thurus na huaire chun crícheanna an Achta so maidir leis an ngnó tionnscail sin, agus
(d) má bhíonn aon obair thionnscail ar siúl tré uain-obair phróisis leanúnaigh no tré uain-obair cheadúnaithe, liost de sna daoine uile go mbíonn an obair thionnscail sin ar siúl acu amhlaidh agus mion-innste i dtaobh na n-uain ar a mbíd ag obair, agus
(e) fógra i dtaobh an chluig gur dá réir a deintear an tréimhse fostaíochta agus na tráthanna i gcóir béilí do rialáil sa ghnó tionnscail sin, agus
(f) fógra i dtaobh gach có-aontuithe bheidh cláruithe i gClár na gCó-aontuithe Páigh agus a dheineann deifir d'aon oibrithe bhíonn ag déanamh oibre tionnscail san áitreabh san.
(2) Gach fostóir ar a gceangailtear leis an alt so aon fhógra, liost no achmaireacht do bheith ar taisbeáint aige beidh an fógra, an liost no an achmaireacht san ar taisbeáint aige i nGaedhilg agus i mBéarla.
(3) Má theipeann ar fhostóir ar bith déanamh do réir a n-éilítear leis an alt so beidh sé ciontach i gcionta fén alt so.
Cionntapacht mar chosaint.
54.—(1) Beidh sé ina chosaint mhaith in aon imeachta bunófar i gcoinnibh duine ar bith mar gheall ar aon fhoráil d'fhorálacha na Coda so den Acht so do shárú an duine sin dá chur ina luighe ar an gCúirt gur os a cóir a bunófar na himeachta san gur ghá, no gur cheart do réir réasúin, aon ghníomh gurb é an sárú san é do dhéanamh de bhíthin tóiteán, tuile, stoirm, éigean, loiceadh gléasra no meaisínteachta no aon chionntapacht eile do thárlachtaint no do bheith ag bagairt no coinne réasúnta do bheith leis an gcéanna.
(2) Beidh deimhniú ar n-a shighniú ag Aire ar bith agus á rá, maidir le gníomh do rinne éinne no do rinneadh i dtaobh éinne do bhí ar fostú ag an Aire sin, gur ghá an gníomh san de bhíthin cionntapachta, beidh san ina fhianaise dhochlaoite gur ghá an gníomh san dá bhíthin sin.
Fostaíocht mheasctha.
55.—Má dheineann fostóir ar bith aon oibrí d'fhostú chun aon obair thionnscail do dhéanamh aon chuid d'aon lá agus an t-oibrí sin d'fhostú chun obair eile nách obair thionnscail do dhéanamh aon chuid eile den lá san tuigfear, chun críche na Coda so den Acht so, an t-oibrí sin do bheith ar fostú chun an obair thionnscail sin do dhéanamh faid a bheidh sé ag déanamh na hoibre eile sin.

Ilghneitheach.
Connartha bheidh ar feitheamh d'atharú.
56.—(1) I gcás connradh do dhéanamh roimh thosach feidhme na Coda so den Acht so, chun aon obair do dhéanamh no chun aon earra no substaint do dhéanamh no do tháirgeadh no chun aon tsaghas eile oibre tionnscail do dhéanamh, agus gan é bheith curtha i ngníomh go hiomlán le linn an tosach feidhme sin, agus an duine dhlighfidh fén gconnradh san an obair sin do dhéanamh no an earra no an tsubstaint sin do dhéanamh no do tháirgeadh no an obair eile thionnscail sin do dhéanamh d'éileamh aon cheann no gach ceann den dá ní seo leanas, sé sin le rá:—
(a) gur thárla, de bhíthin na n-oblagáidí forchuirtear ar fhostóirí leis an Acht so, go dtáinig teora ama, atá sa chonnradh san chun éinní áirithe do dhéanamh, chun bheith mí-réasúnta agus gur cheart í shíneadh, no
(b) gur thárla, de bhíthin na n-oblagáidí sin, go dtáinig aon phraghas no íocaíocht eile áirithe ceapadh leis an gconnradh san chun bheith mí-réasúnta agus gur cheart é mhéadú,
ansan agus i ngach cás den tsórt san déanfar, mara n-aontuighidh na páirtithe le n-a mbainfidh an scéal, an t-éileamh san do chur fé eadrascán fén alt so ar n-a iarraidh sin d'aon pháirtí den tsórt san.
(2) Má deintear éileamh do chur fé eadrascán fén alt so beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) déanfaidh eadrascánaí amháin an t-eadrascán san d'éisteacht agus breith do thabhairt air agus déanfaidh an tAire, mara n-aontuighidh na páirtithe le n-a mbainfidh an scéal, an t-eadrascánaí sin do cheapadh ar iarratas aon pháirtí den tsórt san;
(b) i gcás éilimh á iarraidh teora ama do shíneadh cinnfidh an t-eadrascánaí an ceart an síneadh sin do dhéanamh no nách ceart agus (má chinneann sé gur ceart an síneadh sin do dhéanamh) cadé faid an tsínte sin;
(c) i gcás éilimh á iarraidh praghas no íocaíocht eile do mhéadú cinnfidh an t-eadrascánaí an ceart an méadú san do dhéanamh no nách ceart agus (má chinneann sé gur ceart an méadú san do dhéanamh) cadé méid an mhéaduithe sin;
(d) íocfar leis an eadrascánaí as gníomhú mar eadrascánaí an táille sin a cheapfaidh an tAire cheal có-aontuithe, agus déanfaidh pé páirtí no páirtithe san eadrascán san ordóidh an t-eadrascánaí an táille sin agus na costaisí agus na caiteachaisí generálta eile go léir a bhainfidh leis an eadrascán san d'íoc agus san i pé cionúireachtaí ordóidh an t-eadrascánaí i gcás níos mó ná páirtí amháin acu san á n-íoc;
(e) cinnfidh an t-eadrascánaí conus a híocfar na costaisí agus na caiteachaisí fé n-a raghaidh gach páirtí san eadrascán i dtaobh no alos bheith i láthair agus éisteacht d'fháil ag an gcéanna;
(f) má chinneann an t-eadrascánaí gur cheart teora ama do shíneadh no praghas do mhéadú, déanfaidh an t-eadrascánaí an connradh is abhar don eadrascán do leasú i pé slí is dóich leis is ceart chun éifeacht do thabhairt don chinneadh sin;
(g) beidh breith an eadrascánaí ina breith dheiridh gan aon dul tháirse agus beidh sí ina ceangal ar na páirtithe uile le n-a mbainfidh.
Saghas oibre tionnscail.
57.—Pé uair a dhéanfaidh an tAire rialacháin no dheonfa sé ceadúnas no cead fén Acht so maidir le saghas áirithe oibre tionnscail, féadfaidh an tAire, sna rialacháin sin no sa cheadúnas no sa chead san (do réir mar bheidh)—
(a) an obair thionnscail sin do luadh go generálta no i gcás í dhéanamh in aon áit áirithe no saghas áirithe áiteanna no ag aon oibrithe áirithe no aicme áirithe oibrithe;
(b) aon tsaghas oibre tionnscail do luadh tré thagairt do chineál na hoibre tionnscail sin, do sna hoibrithe no don aicme oibrithe dheineann an obair thionnscail sin, no i pe slí eile is oiriúnach leis;
(c) i gcás saghsanna deifriúla oibre tionnscail do bheith á ndéanamh in aon ghnó tionnscail no in aon chineál gnóthaí tionnscail tagairt do dhéanamh tré aon chóthuairisc do sna saghsanna san no d'aon cheann de sna saghsanna san oibre tionnscail a bheidh á ndéanamh sa ghnó tionnscail sin no sa chineál san gnóthaí tionnscail agus an céanna do luadh mar aon tsaghas amháin oibre tionnscail;
(d) pé eiscithe agus dúnta amach is oiriúnach leis do dhéanamh nuair a bheidh aon tsaghas oibre tionnscail á luadh aige.

58.—(1) Más oiriúnach agus pé uair is oiriúnach leis é féadfaidh an tAire le hordú, ar n-a iarraidh sin air d'fhostóir ag á mbeidh gnó tionnscail ar siúl, a dhearbhú go dtuigfear, chun crícheanna uile an Achta so no chun aon chrícheanna áirithe dhe, gur gnóthaí tionnscail ar leithligh aon cheann amháin no níos mó de ranna, de bhrainsí no de choda eile an ghnótha san, agus go mbeidh feidhm agus éifeacht ag an Acht so dá réir sin maidir leis an ngnó san.
(2) Féadfaidh an tAire le hordú, pé uair is oiriúnach leis é, ordú do rinne sé roimhe sin fén alt so, ar a n-áirmhítear ordú do rinneadh fén bhfo-alt so, do cheiliúradh no do leasú.
(3) Pé uair agus faid a bheidh ordú do rinneadh fén alt so i bhfeidhm maidir le gnó tionnscail, beidh feidhm agus éifeacht ag an Acht so maidir leis an ngnó san fé réir agus do réir an orduithe sin.
Costaisí.
59.—Sa mhéid go gceadóidh an tAire Airgid é, is amach as airgead a sholáthróidh an tOireachtas a híocfar aon chostaisí fé n-a raghfar chun an Achta so do chur i bhfeidhm.
Comhach chigirí.
60.—Chun an Achta so do chur i bhfeidhm beidh comhacht ag cigire gach ní no éinní do dhéanamh, go bhfuil comhacht ag cigire é dhéanamh chun an Factory and Workshop Act, 1901, do chur i bhfeidhm, fé is dá mba thagairtí don Acht so na tagairtí atá don Acht san in alt 119 de, agus chun na gcomhacht san d'fheidhmiú tuigfear gur monarcha do réir bhrí an Achta san gach áit ina mbíonn aon obair thionnscail ar siúl.

61.—I gcás obair thionnscail in aon ghnó tionnscail do bheith á déanamh i bpáirt no go hiomlán ag daoine ná faghann aon tuarastal ná págh as a gcuid oibre tuigfear, chun crícheanna an Achta so, gurb é an duine ag á mbíonn an gnó tionnscail sin ar siúl fostóir na ndaoine sin a bhíonn ag déanamh na hoibre tionnscail sin agus, chun crícheanna an Achta so, tuigfear gur oibrithe i bhfostaíocht an duine sin na daoine sin.
Obair thionnscail i bhfund uireachtaí.
62.—(1) Ach amháin sa mhéid go mbainid le hoibrithe d'íoc, beidh feidhm ag forálacha an Achta so maidir le hobair thionnscail a deintear in aon fhundúireacht fé is dá mba oibrithe bheadh ar fostú ag na daoine i gceannas na fundúireachta san chun na hoibre tionnscail sin do dhéanamh na daoine dheineann an obair thionnscail sin, maran rud é ná deintear an obair thionnscail sin ach chun freastal ar riachtanaisí na fundúireachta san.
(2) Chun críche an ailt seo cialluíonn an focal “fundúireacht” fundúireacht a bhíonn ar siúl chun crícheanna déirciúla no ceartúcháin, seachas príosún, fundúireacht bhorstail, teaghlach meabhair-ghalar no teaghlach contae.
Tuairisceáin staitistíochta.
63.—(1) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh chun gach críche no aon chríche acu so leanas, sé sin le rá:—
(a) chun a cheangal ar dhaoine ag á mbíonn gnóthaí tionnscail ar siúl tuairisceáin staitistíochta do thabhairt don Aire;
(b) chun a ordú cadé an cineál no cadiad na cinéil gnóthaí tionnscail ar a dtabharfar na tuairisceáin sin;
(c) chun a ordú cadiad na habhair agus na nithe ar a dtabharfar na tuairisceáin sin;
(d) chun a ordú cadiad na fuirmeacha ina dtabharfar agus cadiad na tráthanna do bhéarfar na tuairisceáin sin.
(2) Gach duine ar a gcuirfear mar cheangal, le rialacháin a déanfar fén alt so, tuairisceáin staitistíochta do thabhairt uaidh agus ar a dteipfidh na tuairisceáin sin do thabhairt uaidh do réir na rialachán san beidh sé ciontach i gcionta fén alt so.
Breacacháin.
64.—(1) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh ag ordú breacachán, a bheidh le coimeád ag fostóirí no ag aon aicme fostóirí, i dtaobh éinní no aon ruda gur gá, dar leis an Aire, breacachán do choimeád ina thaobh chun an Achta so do chur i bhfeidhm agus féadfaidh, le haon ordú den tsórt san, más oiriúnach leis é, an fhuirm ina mbeidh aon bhreacacháin den tsórt san d'ordú.
(2) Féadfaidh an tAire, fén alt so, rialacháin deifriúla do dhéanamh maidir le haicmí deifriúla fostóirí.
(3) Féadfaidh an tAire, más oiriúnach leis é, a ordú le haon rialacháin a déanfar fén alt so cadé an áit no cadiad no háiteanna ina gcoimeádfar na breacacháin a hordófar leis na rialacháin sin agus féadfaidh pé rialacháin is oiriúnach leis do dhéanamh i dtaobh na mbreacachán san do thaisbeáint agus d'iniúchadh.
(4) Duine ar bith go dteipfidh air déanamh do réir aon rialacháin a bheidh déanta fén alt so agus a bheidh i bhfeidhm de thurus na huaire, agus a bhainfidh leis an duine sin, beidh sé ciontach i gcionta fén Acht so.

CONDITIONS OF EMPLOYMENT ACT, 1936.
PART I.
Preliminary and General.
Short title and commencement.
1.—(1) This Act may be cited as the Conditions of Employment Act, 1936.
(2) This Act shall come into operation on such day as shall be fixed for that purpose by order of the Minister.
Definitions.
2.—In this Act—
the expression “the Minister” means the Minister for Industry and Commerce:
the word “inspector” means a person who is for the time being an inspector for the purpose of the Factory and Workshop Acts, 1901 to 1920;
the expression “industrial undertaking” means an undertaking in which industrial work is carried on by way of trade or for the purposes of gain or for the supply of any public service or is carried on by a local authority or other public body in the exercise or performance of statutory powers or duties;
the word “worker” means a person, other than an outworker, who does industrial work for a salary or wages, or for the purpose of learning any trade or calling;
the word “outworker” means a person who for salary or wages does industrial work in his own home or in some other place not under the control or management of his employer on articles given out by or provided at the expense of such employer for delivery to such employer or to some other person nominated by such employer after the doing of such industrial work;
the expression “adult worker” means a worker whose age is not less than eighteen years;
the expression “young person” means a worker whose age is less than eighteen and more than fourteen years;
the word “woman” means a woman whose age is not less than eighteen years;
the expression “representatives of employers” means such association or all such associations of employers as are, in the opinion of the Minister, representative of the employers in relation to whom the expression is used or, where in the opinion of the Minister there is no such association, persons who are, in the opinion of the Minister, representative of such employers;
the expression “representatives of workers” means such association or all such associations of workers as are, in the opinion of the Minister, representative of the workers in relation to whom the expression is used or, where in the opinion of the Minister there is no such association, persons who are, in the opinion of the Minister, representative of such workers;
the expression “short day” means the day which is for the time being the short day for any industrial undertaking for the purposes of this Act;
the expression “ordinary working day” means any day which is not a short day, a Sunday, nor a public holiday;
the word “premises” includes buildings of every description, and also includes land with no building thereon, whether such land is or is not used in connection with a building;
the word “prescribed” means prescribed by regulations made by the Minister under this Act.
Industrial work.
3.—(1) In this Act the expression “industrial work” does not include agricultural, commercial, nor domestic work nor mining nor the transport of persons or goods, but subject to that limitation the said expression includes all forms of industrial work and in particular industrial work done for or in connection with any of the following activities, that is to say:—
(a) manufacturing, altering, cleaning, repairing, ornamenting, finishing, adapting for sale, testing, grading, packing, breaking up, demolishing or transforming any article;
(b) the killing of any animal or bird;
(c) constructing, reconstructing, maintaining, repairing, altering, demolishing any railway, tramway, harbour, dock, pier, canal, inland waterway, road, tunnel, bridge, viaduct, sewer, drain, well, pipe, electrical undertaking, gas work, waterwork, factory, or other work of construction, laying or removing foundations, or laying out or clearing any site for any such construction;
(d) the construction, maintenance, alteration or repair of any telegraphic or telephonic installation;
(e) the generation, transformation, transmission, distribution or control of electricity or other forms of power;
(f) the production and distribution of gas;
(g) the storage and distribution of water;
(h) the disposal of sewage;
(i) quarrying, irrespective of the depth of the quarry;
(j) constructing, reconstructing, maintaining, repairing, altering, fitting, painting, decorating or demolishing any building or constructing, laying or removing foundations, or laying out or clearing the site for the construction of any building;
(k) shipbuilding, or reconstructing, repairing, fitting or refitting or demolishing ships;
(l) removing from the ground stone, slate or sand otherwise than for the purpose of a mine;
(m) printing and all other modes (exclusive of writing and typewriting) of representing or reproducing words, figures, pictures, or designs;
(n) the cleaning of any place where industrial work is carried on.
(2) For the purpose of this section—
the expression “agricultural work” means the work of any farm or garden or of forestry and includes any form of industrial work done as part of the work of a farm or garden for the purpose of carrying on the business thereof and for no other purpose;
the expression “commercial work” means work of a clerical nature, the work of overseeing, directing and managing industrial work, or work done for or in connection with the sale, wholesale or retail, of any article;
the expression “domestic work” includes the work of preparing food in any hotel or restaurant if the food so prepared is intended only for consumption in such hotel or restaurant or in a place where the person who carries on such hotel or restaurant caters for the supply of meals.
Employer.
4.—(1) In this Act the word “employer” means a person, other than a person who is an exempted employer for the purpose of this section, who is liable for the payment of salary or wages or for the provision of instruction or experience or for both such payment and provision to a worker in consideration of the doing of any industrial work, or who is liable for the payment of salary or wages to an outworker for such consideration.
(2) Where the amount of any form of industrial work done in the carrying on of any undertaking is so small that in the opinion of the Minister the provisions of this Act cannot be conveniently applied to the employment of workers to do such form of industrial work in such undertaking, the Minister may, upon the application in the prescribed form of the person carrying on such undertaking, grant to such person a licence to employ workers in such undertaking to do such form of industrial work while remaining exempt from the provisions of this Act and while any such licence remains in force the person to whom such licence is granted shall in respect of the employment of workers in such undertaking to do such form of industrial work, be an exempted employer for the purpose of this section.
(3) Every licence granted under this section, unless previously revoked by the Minister, shall remain in force for the period specified therein and shall then expire.
(4) The Minister may at any time while a licence granted under this section remains in force revoke such licence by seven days' notice in writing to the person to whom such licence was granted.
Continuous.
5.—Where the employment of a worker with a particular employer is interrupted by reason of the illness of such worker, the temporary cessation of the work on which he is so employed, the temporary reduction of the weekly quantity of such work, or any other temporary cause not due to the act or default of such worker, such worker shall, for the purpose of reckoning any period of continuous employment with such employer within the meaning of any section of this Act, be deemed to have been in the employment of such employer during such interruption if, but only if, the following conditions are complied with, that is to say:—
(a) at the end of such interruption such worker returns to employment with the employer with whom he had been employed immediately before such interruption, and
(b) such worker is not employed in any form of industrial work during such interruption, and
(c) the duration of such interruption does not exceed one month.
Application of Act to persons employed by the State.
6.—This Act applies in relation to persons employed by or under the State (other than members of the Defence Forces of Saorstát Eireann or of the Gárda Síochána) in like manner as if such persons were employed by a private person.
Public holiday.
7.—(1) Subject to the provisions of this section, the following days and no other days shall be public holidays within the meaning and for the purposes of this Act, that is to say:—
(a) Christmas Day when it falls on a weekday or, when it falls on a Sunday, the 27th day of December, and
(b) St. Stephen's Day when it falls on a weekday or, when it falls on a Sunday, the next following Monday, and
(c) St. Patrick's Day when it falls on a weekday or, when it falls on a Sunday, the next following Monday, and
(d) Easter Monday, Whit Monday, and the first Monday in August.
(2) Whenever in any year a day is appointed under the Public Holidays Act, 1924 (No. 56 of 1924), to be a bank holiday instead of a day mentioned in the next preceding sub-section of this section, the day so appointed shall in that year be deemed to be substituted throughout this section for the day so mentioned and this section shall be construed and have effect accordingly.
(3) Any employer may, on giving not less than one month's previous notice to all persons in his employment, substitute for the purposes of this section, any of the following days for St. Stephen's Day when it falls on a weekday or, when it falls on a Sunday, for the next following Monday, that is to say:—
(a) the 1st day of January,
(b) the 6th day of January,
(c) Ascension Thursday,
(d) the Feast of Corpus Christi,
(e) the 29th day of June,
(f) the 15th day of August,
(g) the 1st day of November,
(h) the 8th day of December.
(4) Any employer may, on giving not less than one month's previous notice to all persons in his employment, substitute, for the purposes of this section, in any year any of the following days for Easter Monday, Whit Monday, or the first Monday in August, that is to say:—
(a) Ascension Thursday,
(b) the Feast of Corpus Christi,
(c) the 29th day of June,
(d) the 15th day of August.
(5) The following provisions shall have effect for the purposes of the two next preceding sub-seections of this section, that is to say:—
(a) the notice mentioned in each of the said two next preceding sub-sections shall be in writing and may be given to any person by handing a copy thereof to him personally or by posting a copy thereof in a conspicuous position in the place in which such person is employed;
(b) no day mentioned in either of the said two next preceding sub-sections shall be substituted under that sub-section in a year in which such day falls on a Sunday;
(c) when a day mentioned in either of the said two next preceding sub-sections is substituted under that sub-section by an employer in respect of any year, the day so substituted shall, in that year and in respect of all persons employed by such employer, be a public holiday within the meaning aud for the purposes of this Act instead of the day for which it is so substituted.
Repeals.
8.—The enactments specified in the Schedule to this Act are hereby repealed to the extent mentioned in the third column of the said Schedule.
Penalties for offences under this Act.
9.—(1) Every person guilty of an offence under any section of this Act shall, save in the case of an offence for which a special penalty is provided by this Act, be liable on summary convict on thereof—
(a) where such person is a worker, to a fine—
(i) in the case of a first such offence, not exceeding two pounds, together with (where such offence is a continuing offence) a further fine not exceeding ten shillings for every day on which such offence is continued, and
(ii) in the case of a second or any subsequent such offence, not exceeding five pounds, together with (where such offence is a continuing offence) a further fine not exceeding one pound, for every day on which such offence is continued, or
(b) where such person is not a worker, to a fine—
(i) in the case of a first such offence, not exceeding ten pounds, together with (where such offence is a continuing offence) a further fine not exceeding two pounds for every day on which such offence is continued, and
(ii) in the case of a second or any subsequent such offence, not exceeding twenty pounds, together with (where such offence is a continuing offence) a further fine not exceeding four pounds for every day on which such offence is continued.
(2) A prosecution for an offence under any section of this Act may be brought at the suit of the Minister.
(3) A prosecution for an offence under any section of this Act may be brought at any time within whichever of the following periods latest expires, that is to say:—
(a) three months after the date on which it is certified in writing sealed with the official seal of the Minister that evidence sufficient to justify the institution of such prosecution came into the possession or procurement of the Minister, or
(b) six months after the commission of the offence.
Laying of regulations before Houses of Oireachtas.
10.—Every regulation made by the Minister under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either House of the Oireachtas within the next subsequent twenty-one days on which that House has sat annulling such regulation, such regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under such regulation.
Power to make regulations.
11.—The Minister may by order make regulations prescribing any matter or thing referred to in this Act as prescribed or to be prescribed.
Observance of international conventions.
12.—The Minister shall, in the exercise of every or any power of making regulations conferred on him by this Act, have due regard to the provisions of the several international conventions for the time being ratified by and binding on the Government of Saorstát Eireann.
PART II.
Conditions as to Piece Work, the Employment of Certain Classes of Persons and Annual Leave.
Prohibition of employment of persons under fourteen years of age.
13.—(1) It shall not be lawful for any employer to employ any person whose age is less than fourteen years to do industrial work.
(2) If any employer employs a person in contravention of this section he shall be guilty of an offence under this section and such person shall also be guilty of an offence under this section.
Proof of age of young person before employment.
14.—(1) It shall not be lawful for any employer to employ a young person unless or until a birth certificate or other satisfactory evidence of the age of such young person has been produced to such employer.
(2) Whenever a birth certificate of a young person is required for the purposes of this section, such young person or his parent or guardian shall, on presenting a written requisition in the prescribed form and containing the prescribed particulars and on payment of a fee of sixpence, be entitled to obtain a certified copy of the entry of the birth of such young person in the register of births under the hand of the registrar or superintendent registrar or other person having the custody thereof; and forms for such requisition shall on request be supplied without any charge by every registrar of births and by every superintendent registrar or other person having the custody of the register.
(3) If any employer employs a young person in contravention of this section, such employer shall be guilty of an offence under this section and such young person shall also be guilty of an offence under this section.
Restrictions on employment of young persons.
15.—(1) The Minister may in respect of any form of industrial work, after consultation with representatives of employers interested in such form of industrial work and with representatives of workers so interested, by order make regulations either—
(a) prohibiting the employment of young persons to do such form of industrial work, or
(b) fixing a proportion which the number of young persons employed by any employer to do such form of industrial work may bear to the number of other workers so employed.
(2) Where any regulations made under this section are for the time being in force in respect of any form of industrial work it shall not be lawful for any employer to employ to do such form of industrial work either (as the case may be) any young person or so many young persons that the number of young persons so employed by such employer bears to the number of other workers so employed a proportion greater than that fixed by such regulations.
(3) If, when any regulations made under this section are for the time being in force, any employer employs a young person or a number of young persons in contravention of such regulations such employer shall be guilty of an offence under this section.
(4) In this section the expression “young person” does not include any apprentice who at the commencement of this Act is employed under indentures whereby he is bound to serve as apprentice for a period not less than three years or any apprentice who, at or after such commencement, is employed as apprentice under rules made by an apprenticeship committee under the Apprenticeship Act, 1931 (No. 56 of 1931).
Restrictions on employment of female workers.
16.—(1) The Minister may in respect of any form of industrial work, after consultation with representatives of employers interested in such form of industrial work and with representatives of workers so interested, by order make regulations either—
(a) prohibiting the employment of female workers to do such form of industrial work, or
(b) fixing a proportion which the number of female workers employed by any employer to do such form of industrial work may bear to the number of other workers so employed.
(2) When any regulations made under this section are for the time being in force in respect of any form of industrial work it shall not be lawful for any employer to employ to do such form of industrial work either (as the case may be) any female worker or so many female workers that the number of female workers so employed by such employer bears to the number of other workers so employed a proportion greater than that fixed by such regulations.
(3) If, when any regulations made under this section are for the time being in force, any employer employs a female worker or a number of female workers in contravention of such regulations such employer shall be guilty of an offence under this section.
Prohibition of employment of outworkers.
17.—(1) The Minister may in respect of any form of industrial work by order make regulations prohibiting the employment of outworkers in such form of industrial work and when any regulations made under this section are for the time being in force it shall not be lawful for any employer to employ any outworker to do such form of industrial work.
(2) Any regulations made under this section in respect of any form of industrial work may be expressed to be limited in effect to an area specified therein and whenever such regulations are expressed to be so limited they shall render unlawful the employment of outworkers resident in that area to do such form of industrial work but shall not restrict the employment of any other outworkers.
(3) If any employer employs any outworker in contravention of any regulations made under this section and for the time being in force such employer shall be guilty of an offence under this section and such outworker shall also be guilty of an offence under this section.
Registers of outworkers.
18.—(1) Every employer who employs any outworkers shall keep in accordance with regulations made under this section, a register of all outworkers for the time being employed by him.
(2) The Minister may by order make regulations for the following purposes, that is to say:—
(a) prescribing the form of the register of outworkers to be kept in pursuance of this section and, if the Minister so thinks fit, prescribing different such forms in respect of different classes of industrial work, and
(b) prescribing the matters and things to be entered in every such register and, where necessary, prescribing different such matters and things in respect of every different form (if any) of such register.
(3) Every employer who is required by this section to keep a register of outworkers and fails to keep such a register in accordance with this section and the regulations made thereunder shall be guilty of an offence under this section.
Piece work wages.
19.—(1) Subject to the provisions of this section every employer who for the doing of any industrial work pays to any worker or outworker any remuneration (in this Act referred to as piece work wages) calculated by reference to the amount of work done by such worker or outworker shall, before or at the commencement of any work in respect of which any particular payment of piece work wages is to be calculated, give to such worker or outworker a note in writing (in this Act referred to as a piece work particulars docket) showing, in sufficient detail to enable such worker or outworker to compute the piece work wages payable to him, particulars (in this Act referred to as piece work particulars) of both the rate of piece work wages and of the work in respect of which such rate is payable.
(2) On the application of an employer, the Minister may, if he thinks proper so to do having regard to all the circumstances of the case, issue to such employer a permit authorising him, subject to compliance with such conditions (if any) as may be stated in such permit, to pay piece-work wages to workers and outworkers employed by him without complying with the next preceding sub-section of this section, and whenever any such permit is so issued to an employer the following provisions shall have effect in regard thereto, that is to say:—
(a) the Minister may at any time revoke such permit by seven days' notice in writing given or sent by post to such employer;
(b) so long as such permit remains unrevoked and such employer complies with the conditions (if any) stated in such permit, it shall not be obligatory on such employer to comply with the said next preceding sub-section of this section.
(3) Save as otherwise provided by this section, every employer who for the doing of any industrial work in a building under his management and control pays to any worker piece work wages shall exhibit continually, in accordance with this Act, in every room in such building where such industrial work is done, a placard (in this Act referred to as a piece work particulars placard) giving the piece work particulars in respect of such industrial work.
(4) Every piece work particulars placard shall comply with the following conditions, that is to say:—
(a) shall not contain symbols other than letters and figures used with their ordinary significance,
(b) shall contain the piece work particulars in respect of the industrial work to which it relates and no other matter,
(c) shall be exhibited in such a position that it may be easily read by workers employed to do the industrial work to which it relates,
(d) shall be maintained in a clean and legible state,
(e) shall be in both the Irish and English languages,
and if any piece work particulars placard exhibited by any employer does not comply with such conditions such placard shall be deemed not to be exhibited in accordance with this Act.
(5) Where the piece work particulars relating to any form of industrial work are of such a complicated character that they cannot conveniently be comprised in a piece work particulars placard, any employer who employs workers to do such form of industrial work for piece work wages may, in lieu of exhibiting a piece work particulars placard, keep a book (in this Act referred to as a piece work particulars book) containing such piece work particulars readily available for inspection by all workers so employed.
(6) If any employer fails to comply with the requirements of this section he shall be guilty of an offence under this section.
Penalties for alteration of or disclosing information in placard or docket.
20.—(1) If any person, otherwise than for the purpose of correcting a mistake, alters any piece work particulars docket, any piece work particulars placard or any piece work particulars book such person shall be guilty of an offence under this section, and shall on summary conviction thereof be liable to a fine not exceeding twenty pounds or to imprisonment for a period not exceeding six months, or at the discretion of the court to both such fine and such imprisonment.
(2) If for the purpose of divulging a trade secret any person discloses any information derived by him from a piece work particulars docket, from a piece work particulars placard or from a piece work particulars book he shall be guilty of an offence under this sub-section, and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
(3) If any person for the purpose of trade competition solicits or procures from any other person information derived by such other person from a piece work particulars docket, from a piece work particulars placard or from a piece work particulars book, or for the purpose of securing any such information so derived gives or offers or causes to be given or offered to such other person any reward such person shall be guilty of an offence under this sub-section and shall on summary conviction thereof be liable to a fine not exceeding ten pounds.
Reckoning of piece work.
21.—(1) If piece work wages are paid by any employer to any worker or outworker in respect of any industrial work the amount of work done shall be reckoned by such employer for the purpose of ascertaining the piece work wages to be paid in respect thereof in such a manner that such worker or outworker shall have an opportunity of checking the result of such reckoning before each payment of such wages.
(2) For reckoning the amount of work done for the purpose of ascertaining the piece work wages to be paid in respect thereof an automatic machine (in this Act referred to as an automatic reckoner) may be used and if any automatic reckoner is made and operated in accordance with this Act an opportunity of observing the amount reckoned by such automatic reckoner shall be deemed to be an opportunity of checking the amount of work reckoned by such automatic reckoner.
(3) Every automatic reckoner shall comply with the following conditions, that is to say:—
(a) the indicator shall not show the amounts of work reckoned in symbols other than letters and figures used with their ordinary significance,
(b) the indicator shall be fixed in such a position that it may be easily read by workers employed to do the industrial work the amount of which is ascertained by the automatic reckoner,
(c) the indicator shall be clean and legible,
(d) the automatic reckoner shall be accurate in its results and shall be maintained in good repair and working order,
(e) all particulars which may be necessary for the purpose of ascertaining from the indicator the amount of industrial work reckoned by an automatic reckoner shall be legibly marked on such automatic reckoner,
and any automatic reckoner which does not comply with the said conditions shall be deemed not to be made and operated in accordance with this Act.
(4) If any employer reckons otherwise than in accordance with this section the amount of any form of industrial work done by any worker for piece work wages such employer shall be guilty of an offence under this section.
Penalty for interfering with automatic reckoner.
22.—If any person, otherwise than for a lawful purpose alters, interferes with, or causes any interference with the mechanism or indicator of an automatic reckoner such person shall be guilty of an offence under this section and shall on summary conviction thereof be liable to a fine not exceeding twenty pounds or to imprisonment for a period not exceeding six months, or at the discretion of the court to both such fine and such imprisonment.
Inspection of weights and measures used in ascertaining wages.
23.—Every Act and regulations for the time being in force relating to appliances which are weights, measures, scales, balances, steelyards, weighing machines or measuring instruments (in this section referred to as measuring appliances) shall extend to measuring appliances used in any place for ascertaining the amount of industrial work done by any worker or outworker for the purpose of calculating the amount of piece work wages payable to him, in like manner as if such measuring appliances were used in the sale of goods and if such place were a place where goods are kept for sale, and every such Act shall apply accordingly, and every inspector of weights and measures or other person authorised to inspect or examine weights and measures shall inspect, stamp, mark, search for and examine the said measuring appliances accordingly and for that purpose shall have the same powers and duties as he has in relation to measuring appliances used in the sale of goods.
Right of worker to annual leave.
24.—(1) Every employer shall allow to each worker in his employment in any industrial undertaking a period of not less than six consecutive days leave (in this Act referred to as annual leave) in every complete employment year of such worker during which he has been continuously in the employment of such employer and has worked in such employment not less than eighteen hundred hours.
(2) Where a worker employed by an employer in an industrial undertaking ceases, at any time other than the end of an employment year of such worker, to be in the employment of such employer, such employer shall either—
(a) allow such worker, before such cesser, six days annual leave in respect of the portion of such employment year during which he was so employed, or
(b) pay such worker, at such cesser—
(i) one day's pay (calculated at the rate which would be applicable if such day were a day of annual leave allowed immediately before such cesser) in respect of every complete period of two months in the said portion of such employment year during which he has worked not less than three hundred hours, and
(ii) one day's pay (calculated as aforesaid) in respect of the period (if any) in the said portion of such employment year which is less than two months but not less than one month and during which he has worked for not less than one hundred and fifty hours.
(3) The Minister may, whenever and so often as he so thinks proper, by order make regulations varying, in respect of all or any particular classes or class of workers, all or any of the periods of eighteen hundred hours, three hundred hours, and one hundred and fifty hours mentioned in sub-sections (1) and (2) of this section by substituting for such periods or period such other periods or period as the Minister shall think proper, and whenever any such regulations are in force the said sub-sections shall have effect, in respect of the workers or the classes or class of workers to which such regulations apply, as if the said periods or such of them as are affected by such regulations were varied in the manner stated in such regulations.
(4) No Sunday nor public holiday shall be reckoned as a day of annual leave but if a Sunday or public holiday intervene between days of annual leave such days shall be deemed to be consecutive notwithstanding such intervention.
(5) It shall not be lawful for any worker, during any period of annual leave to which he is entitled under this section, to do for reward any industrial work, and if any worker does any industrial work in contravention of this sub-section he shall be guilty of an offence under this section.
(6) Where a worker who is a member of the Reserve Force of the Defence Forces of Saorstát Eireann is absent from his employment for the purpose of attending and performing his duty as such member at any initial training, annual training, or test mobilisation, such worker shall, for the purpose of reckoning any period of employment or of continuous employment within the meaning of this section, be deemed to have been in his said employment during his said absence, and accordingly the period of his said absence shall for the purposes of this section be reckoned in the said period of employment or continuous employment.
(7) Where the ownership of an industrial undertaking is transferred by act of the parties or operation of law, a worker who is employed in such undertaking immediately before and immediately after such transfer shall be entitled to reckon, for the purposes of this section, the period of his continuous employment in such undertaking beginning before and ending at such transfer and the period of such continuous employment beginning at and continuing after such transfer as one uninterrupted period of continuous employment in such undertaking notwithstanding such transfer.
(8) This section shall apply to the employment year current at the commencement of this Act of every worker who, at such passing, is in the employment of an employer in an industrial undertaking, and this section shall have effect in respect of such employment year and such worker as if this section had been in force at the beginning of such employment year, but subject to the modifications that—
(a) if such employment year expires within one month after the commencement of this Act, such employer shall be deemed to have complied with this section if he allows to such worker, not later than three months after the expiration of such employment year, such annual leave as such worker may be entitled to under this section in respect of such employment year, and
(b) if such employer shall, before the commencement of this Act, have allowed to such worker in such employment year one or more days' leave which would be annual leave for the purposes of this section but for the fact that such days were not consecutive or were less than six or were both not consecutive and less than six, the said leave so allowed shall be deemed to be annual leave for the purposes of this section and such worker shall only be entitled in respect of such employment year to such number (if any) of consecutive days' annual leave after the commencement of this Act as is equal to the number (if any) of days by which the said leave so allowed is less than six.
(9) In the application of this section to workers who are young persons, the several periods of fifteen hundred hours, two hundred and fifty hours and one hundred and twenty hours shall respectively be substituted throughout this section for the several periods of eighteen hundred hours, three hundred hours and one hundred and fifty hours, and this section shall have effect in relation to such workers accordingly.
(10) In this section and the two next following sections of this Act the expression “employment year” in relation to any worker means a period of one year beginning on the day on which such worker last entered the employment in relation to which the expression is used or on an anniversary of that day.
(11) If any employer fails to pay to any worker any moneys which become payable to such worker under this section such worker may recover such moneys as a simple contract debt from such employer.
(12) If any employer fails to allow annual leave to any worker in contravention of this section he shall be guilty of an offence under this section.
Remuneration during annual leave.
25.—Whenever a worker for salary or wages is allowed by his employer any annual leave to which he is entitled by virtue of this Act, such employer shall pay to such worker, in respect of each day of such leave, salary or wages at whichever of the following rates is applicable, that is to say:—
(a) in the case of a worker whose ordinary remuneration is wholly calculated by reference to time, at the rate at which such remuneration was payable immediately before the commencement of such annual leave, and
(b) in the case of a worker whose ordinary remuneration is wholly piece-work wages, at the average daily rate of his earnings (exclusive of pay for overtime) in the period in respect of which he is allowed such annual leave, and
(c) in the case of a worker whose ordinary remuneration is partly calculated by reference to time and is partly piece-work wages, at the average daily rate of his earnings (exclusive of pay for overtime) in the period in respect of which he is allowed such annual leave.
Time of annual leave.
26.—(1) The time in any employment year at which an employer shall allow annual leave to a worker who is entitled to annual leave under this Act shall be selected by such employer.
(2) If in any employment year of a worker with an employer such employment year has so far expired that there remains only six working days thereof unexpired and such employer has not at that time allowed such worker annual leave, such worker if he is entitled to annual leave under this Act may absent himself from his work for such employer for such six days and shall not by reason of so absenting himself be deemed to have committed any breach of his contract of service with such employer, and such employer shall pay to such worker in respect of such six days the amount which he would be liable to pay if he had allowed such six days as annual leave.
(3) If an employer allows to a worker in any employment year a period of annual leave earlier than the last six working days of such employment year and such worker leaves the employment of such employer before the termination of such employment year, such employer shall not be entitled in respect of such allowance of annual leave to reduce the period of notice required for terminating such employment, nor the pay nor other emoluments to which such worker may be entitled at the time of leaving such employment.
(4) If any employer fails to pay to any worker any moneys which become payable to such worker under this section such worker may recover such moneys as a simple contract debt from such employer.
Notice of time of annual leave.
27.—(1) Every employer who is required by this Act to allow annual leave to a worker, shall give to every worker to whom he is so required to allow such annual leave notice in writing of the day on which such annual leave will begin, and shall so give such notice not less than two weeks before such day.
(2) A notice given in pursuance of this section to a worker may be given either by handing such notice to such worker or by exhibiting such notice in a prominent position to which such worker has access in the place in which he is employed.
(3) Every employer, required by this section to give to any worker such notice as is mentioned in the preceding sub-sections of this section, who fails or neglects to give in accordance with this section such notice to any worker on any occasion on which he is so required so to do shall be guilty of an offence under this section.
PART III.
Conditions as to Times of Work.
Definition.
28.—The expression “industrial work” when used in any section in this Part of this Act means in such section industrial work which is not excluded industrial work for the purpose of such section.
Exclusion regulations.
29.—(1) The Minister may by order make regulations (in this Act referred to as exclusion regulations) declaring any specified form of industrial work to be excluded industrial work for the purpose of all or any of the sections of this Part of this Act.
(2) The Minister shall not make any regulations declaring any form of industrial work to be excluded industrial work for the purpose of any section of this Part of this Act which relates to the hours, the days of the week, or the days of the year during or on which an employer may permit a worker to do such industrial work unless he has first consulted with representatives of employers interested in such form of industrial work and with representatives of workers so interested.
(3) Whenever regulations made under this section are for the time being in force any form of industrial work to which such regulations relate shall, for the purpose of the sections of this Part of this Act in respect of which such form of industrial work is declared by such regulations to be excluded industrial work, be excluded industrial work in accordance with the terms of such regulations.
Exclusion permit.
30.—The Minister, if he is satisfied that the amount of any form of industrial work which is required to be done for the purpose of carrying on an industrial undertaking is at any time abnormally increased, may grant to the person who carries on such industrial undertaking a permit to employ workers to do such form of industrial work at any time in a period (not being longer than two weeks) specified in such permit, in the same manner as if such form of industrial work were excluded industrial work for the purpose of all or any of the sections of this Part of this Act as may be specified in such permit, and whenever a permit granted under this section is in force the form of industrial work to which it relates shall be excluded industrial work for the purpose of such sections when done in such industrial undertaking in the period specified in such permit.
The short day.
31.—(1) Save as otherwise provided by this section Saturday shall be the short day for every industrial undertaking for the purpose of this Act.
(2) Any employer who employs workers to do any industrial work in any industrial undertaking may send to the Minister, in the prescribed form and manner, a notice stating that for such undertaking he wishes to substitute another specified day of the week (not being Sunday) as the short day instead of Saturday or any day previously substituted for Saturday under this section and save as otherwise provided by this section, on the expiration of seven days from the day on which such notice is so sent such specified day shall be in respect of such undertaking the short day for the purpose of this Act.
(3) Where in respect of any industrial undertaking a notice under this section has been sent to the Minister, until the expiration of a period of three months from the date of the sending of such notice no further such notice in respect of such industrial undertaking shall be sent to the Minister and any further such notice sent within such period shall be void and of no effect.
Shift work unlawful unless on continuous process or under licence.
32.—(1) It shall not be lawful for any employer to employ any worker on shift work to do industrial work (other than industrial work done in or about the printing or publishing of newspapers) unless—
(a) such industrial work (in this Act referred to as a continuous process) normally requires to be carried on without intermission or to be carried on for periods of not less than fifteen hours at a time without intermission, or
(b) such employer is authorised by a licence (in this Act-referred to as a shift work licence) granted by the Minister to employ workers on shift work (in this Act referred to as licensed shift work) to do such industrial work.
(2) If any employer employs any worker in contravention of this section he shall be guilty of an offence under this section and such worker shall also be guilty of an offence under this section.
Conditions of shift work on continuous process.
33.—(1) It shall not be lawful for any employer to permit any worker employed by him in any industrial undertaking to do any continuous process on shift work (in this Act referred to as continuous process shift work) in such a manner as to contravene any of the following conditions, that is to say:—
(a) no shift shall be longer than nine hours in duration;
(b) no worker shall work on two consecutive shifts;
(c) no worker shall work on any shift unless at least eight hours have elapsed since he worked on a previous shift;
(d) no worker shall work for more than 56 hours in any week;
(e) every worker shall be allowed at least fifteen minutes rest in each shift not less than three nor more than four hours after the commencement of such shift but shall not be entitled to leave the premises of the employer during such period of rest without the permission of the employer.
(2) If any employer acts in contravention of this section he shall be guilty of an offence under this section.
Conditions of licensed shift work.
34.—(1) It shall not be lawful for any employer to permit any worker employed by him in any industrial undertaking to do any industrial work on licensed shift work in such a manner as to contravene any condition contained in the licence authorising such licensed shift work or any of the following conditions. that is to say:—
(a) no shift shall be longer than nine hours in duration;
(b) no worker shall work on two consecutive shifts;
(c) no worker shall work on any shift unless at least eight hours have elapsed since he worked on a previous shift;
(d) no worker shall work for so many hours in any week that the average number of hours per week worked by him in any three consecutive weeks would exceed forty-eight;
(e) every worker shall be allowed at least fifteen minutes rest in each shift not less than three nor more than four hours after the commencement of such shift but shall not be entitled to leave the premises of the employer during such period of rest without the permission of the employer.
(2) If any employer acts in contravention of this section he shall be guilty of an offence under this section.
Application for shift work licence.
35.—Any person may apply in writing, stating the prescribed particulars, to the Minister for a shift work licence.
Grant of shift work licence.
36.—On receipt of any application under this Act for a shift work licence the Minister may at his absolute discretion, after consultation with representatives of employers interested in the relevant form of industrial work and with representatives of workers so interested, grant or refuse such licence.
Form of shift work licence.
37.—Every shift work licence granted under this Act shall be in the prescribed form and shall authorise the person to whom it is granted to employ workers on shift work either generally or subject to such conditions as the Minister may think fit to impose and to insert in such licence.
Working hours.
38.—(1) Save as otherwise provided by this Act it shall not be lawful for any employer who employs any adult worker to do industrial work in an industrial undertaking on day work to permit such adult worker—
(a) if a woman, to commence work earlier than the hour of 8 a.m. on any day, or
(b) whether a man or a woman, to continue work after any of the following limits (in this Act referred to as time limits for day work), that is to say:—
(i) the hour of 8 p.m. on any ordinary working day,
(ii) the hour of 1 p.m. on any short day,
(iii) the time in any ordinary working day when such adult worker has completed nine hours work on that day,
(iv) the time in any week when such adult worker has completed forty-eight hours work in that week.
(2) This section shall not apply to any industrial work done in or about—
(a) the printing and publishing of newspapers, or
(b) the construction, maintenance, alteration, or repair of any telegraphic or telephonic installation, or
(c) the maintenance or working of a broadcasting station maintained and worked under Part II of the Wireless Telegraphy Act, 1926 (No. 45 of 1926).
(3) If any employer acts in contravention of this section he shall be guilty of an offence under this section.
(4) In this Act the expression “day work” means work which is neither continuous process shift work nor licensed shift work.
Working hours for young persons.
39.—(1) Save as otherwise provided by this Act it shall not be lawful for any employer who employs any young person to do industrial work in an industrial undertaking on day work to permit such young person to—
(a) commence work earlier than the hour of 8 a.m. on any day, or
(b) continue work after any of the following limits (in this Act referred to as time limits of day work for young persons), that is to say:—
(i) the hour of 8 p.m. on any day,
(ii) the hour of 1 p.m. on any short day,
(iii) the time in any ordinary working day when such young person has completed eight hours work on that day,
(iv) the time in any short day when such young person has completed four hours work on that short day,
(v) the time in any week when such young person has completed forty hours work in that week.
(2) If any employer acts in contravention of this section he shall be guilty of an offence under this section.
Extension of hours of employment of young persons.
40.—(1) The Minister, if he is satisfied that young persons employed to do any form of industrial work are so employed as assistants to adult workers and that the work of such adult workers could not proceed in a satisfactory manner if such young persons did not work for the same hours as such adult workers, may by order make regulations in accordance with this section directing that young persons or young persons who have attained a specified age while doing such form of industrial work shall be deemed to be adult workers for the purposes of this Act.
(2) The Minister shall not make regulations in respect of any form of industrial work under this section unless he has first consulted with representatives of employers interested in such form of industrial work and with representatives of workers so interested.
(3) Whenever regulations made under and in accordance with this section are for the time being in force the young persons to whom such regulations relate shall be deemed to be adult workers for the purposes of this Act while doing the form of industrial work in respect of which such regulations are made.
(4) Where any person is under this section deemed to be an adult worker for the purposes of this Act, it shall not be lawful for any employer to permit such person to do for him any form of industrial work between the hour of 10 p.m. on any day and 8 a.m. on the following day, or to permit such person to commence to do for him any industrial work on any day until after the expiration of eleven hours from the time at which such person ceased to do industrial work on the previous day.
(5) If any employer acts in contravention of this section he shall be guilty of an offence under this section.
Uncontrolled overtime.
41.—(1) Subject to the provisions of this section and subject also to the restrictions imposed by this Act on the employment of women and young persons at night but notwithstanding any other provision of this Act, an employer may employ a worker to do industrial work in an industrial undertaking for a longer period on any particular day than the period permitted in that behalf by this Act (other than this section), but subject to the limitation that the length of time by which such longer period exceeds the said period so permitted as aforesaid shall not exceed:—
(a) in respect of any adult worker, two hours on any day, or twelve hours in any week, or two hundred and forty hours in any year or thirty-six hours in any period of four consecutive weeks, or
(b) in respect of any young person, two hours on any ordinary day or one hour on any short day, or ten hours in any week, or two hundred hours in any year or thirty hours in any period of four consecutive weeks.
(2) The Minister may at any time if he thinks fit by order, made after consultation with representatives of employers interested in the relevant form of industrial work and with representatives of workers so interested, make regulations for either or both of the following purposes, that is to say:—
(a) prohibiting the employment, under the next preceding sub-section of this section, of workers or any specified class or classes of workers to do any particular form of industrial work in an industrial undertaking for a longer period than the period permitted by this Act (other than this section);
(b) reducing the length of time during which workers or any specified class or classes of workers may, by virtue of the next preceding sub-section of this section, be employed to do any particular form of industrial work in an industrial undertaking in excess of the period permitted by this Act (other than this section).
(3) Whenever and so long as regulations made under the next preceding sub-section of this section are in force, sub-section (1) of this section shall have effect subject to such regulations.
Permitted overtime.
42.—(1) The Minister may, if and whenever he so thinks fit on the application in accordance with this section of an employer who employs workers to do industrial work in an industrial undertaking, grant to such employer a permit in writing to employ, during a specified period beginning not less than seven days after the date of such application, workers or any specified class or classes of workers to do industrial work in the said industrial undertaking for a specified longer period on each day than the period permitted in that behalf by this Act.
(2) The Minister may attach to the permission granted by a permit under this section such conditions as he shall think proper and shall specify in such permit.
(3) The Minister may at any time revoke a permit granted by him under this section.
(4) Whenever a permit has been granted under this section to an employer it shall be lawful for such employer, subject to any revocation of such permit, to employ workers in accordance with such permit notwithstanding anything to the contrary contained in this Act.
Overtime pay.
43.—(1) Where any employer who employs any worker to do industrial work for a salary or wages permits such worker to work overtime (in this section referred to as daily overtime) on any day such employer shall be deemed to have agreed to pay such worker at the overtime rate for any time for which he so works overtime on such day.
(2) Where in any week any employer who employs any worker to do industrial work for a salary or wages permits any worker to work weekly overtime, and the weekly overtime worked by such worker exceeds the total daily overtime worked by such worker in that week, such employer shall be deemed to have agreed to pay such worker at the overtime rate for the amount of time which is the difference between such total and such weekly overtime, in addition to any other remuneration which such worker may be entitled to receive for such daily overtime.
(3) In this section the expression “weekly overtime” means the amount of time in any week for which any employer permits any worker to work after having completed, in the case of an adult worker, forty-eight hours of work, and, in the case of a young person, forty hours work in that week, and the expression “overtime rate” when used in relation to the pay of any worker for doing any industrial work means a rate calculated by increasing by not less than twenty-five per cent. the rate at which such worker would be entitled to be paid for doing such industrial work if it were not done in overtime.
Prohibition of double employment.
44.—(1) It shall not be lawful for an employer to employ a worker to do any form of industrial work on any day on which such worker has done any form of industrial work for another employer, except where the aggregate of the periods for which such worker does industrial work for each of such employers respectively on that day does not exceed the period (exclusive of overtime) for which such worker could lawfully be employed to do industrial work for one employer on that day.
(2) Whenever an employer employs a worker in contravention of this section, such employer shall be guilty of an offence under this section, and such worker shall also be guilty of an offence under this section
Minimum age for young persons.
45.—(1) The Minister may by order make regulations fixing the minimum age at which it shall be lawful to employ young persons in any form of industrial work specified in such regulations and the Minister may if he so thinks fit by any such regulations fix a different minimum age in respect of male young persons and female young persons.
(2) If any employer employs any young person in contravention of any regulations made under this section and for the time being in force he shall be guilty of an offence under this section and such young person shall also be guilty of an offence under this section.
Restrictions on employment of women at night.
46.—(1) Notwithstanding any provision of this Act other than the provision empowering the Minister to make exclusion regulations, it shall not be lawful for any employer to permit any woman to do for him any industrial work at any time between the hour of 10 p.m. on any day and the hour of 8 a.m. on the following day or to permit any woman to commence to do for him any industrial work on any day until after the expiration of eleven hours from the time at which she ceased to do industrial work on the previous day.
(2) If any employer acts in contravention of this section he shall be guilty of an offence under this section.
Restrictions on employment of young persons at night.
47.—(1) Notwithstanding any provision of this Act other than the provision empowering the Minister to make exclusion regulations, it shall not be lawful for any employer to permit any young person not being a young person deemed to be an adult for the purposes of this Act, to do for him any industrial work at any time in the period (in this section referred to as the prohibited period) between the hour of 8 p.m. on any day and the hour of 8 a.m. on the following day unless such young person is a male young person and is so employed under and in accordance with regulations made by the Minister under this section.
(2) The Minister may by order make regulations authorising the employment of male young persons whose age is over sixteen years to carry on at any time in the prohibited period any of the following forms of industrial work, that is to say:—
(a) processes in which reverberatory or regenerative furnaces are used for the manufacture of iron and steel and the galvanising of sheet metal or wire (except the pickling process);
(b) manufacture of glass;
(c) manufacture of paper;
(d) manufacture of raw sugar;
(e) gold mining reduction work;
and the Minister may by such regulations impose in respect of such employment such conditions, limitations or restrictions as he may think proper.
(3) If any employer employs any young person in contravention of this section or in contravention of any condition, limitation or restriction imposed by regulations made under this section and for the time being in force, such employer shall be guilty of an offence under this section.
Intervals in work.
48.—(1) It shall not be lawful for any employer to permit any worker employed by him on day work to do for him any industrial work for any period exceeding five hours in any day unless such worker ceases work after a period not exceeding five hours from the time at which he commenced work and does not again commence work until after the expiration of a period (in this section referred to as the interval) of at least half an hour.
(2) It shall not be lawful for any employer to permit any worker, employed by him to do any industrial work on day work, to continue to do such industrial work overtime for more than one and one-half hours after any time limit for day work fixed in respect of any ordinary working day by or under this Act unless immediately before commencing to work overtime such worker has ceased work for a period (in this section referred to as the overtime interval) of at least half an hour.
(3) Save as otherwise provided by this section every employer who employs workers to do industrial work in any industrial undertaking shall fix the interval at the same time for such workers and shall not permit any such industrial work to be carried on during such interval.
(4) Where on the application in writing of any employer the Minister is satisfied that on account of the nature of the industrial work to do which such employer employs workers the fixing of the interval at the same time for all such workers would occasion serious loss, the Minister may by a permit which may at any time be withdrawn by the Minister allow such employer exemption from the provisions of the foregoing sub-section and whenever any such permit is for the time being in force the provisions of the foregoing sub-section shall not apply to such employer in respecet of such industrial work.
(5) Every worker employed on industrial work who is present on the premises of his employer while industrial work is being done on such premises shall, unless he is so present on such premises in contravention of the orders of such employer, be deemed for the purposes of this section to be present on such premises for the purposes of doing the industrial work on which he is so employed.
(6) If any employer acts in contravention of this section he shall be guilty of an offence under this section.
Public holidays and Sundays.
49.—(1) Save as otherwise provided by this Act it shall not be lawful for any employer to permit any worker in his employment to do for him on any day which is a Sunday or a public holiday any industrial work other than industrial work which is—
(a) continuous process shift work,
(b) licensed shift work,
(c) done in or about the printing or publishing of newspapers,
(d) the work of a creamery,
(e) industrial work excepted from this sub-section by regulations made by the Minister after consultation with representatives of employers interested in such industrial work and with representatives of workers so interested,
(f) done in or about the construction, maintenance, alteration, or repair of any telegraphic or telephonic installation,
(g) done in or about the maintenance or working of a broad-casting station maintained and worked under Part II of the Wireless Telegraphy Act, 1926 (No. 45 of 1926).
(2) Notwithstanding anything contained in the next preceding sub-section of this section, an employer may employ an adult male worker to do, on any Sunday, for a period not exceeding three hours or for two or more periods not exceeding in the aggregate three hours, any industrial work to which the prohibition effected by the said next preceding sub-section applies.
(3) If any employer employs any worker to do on the Sunday in any week any industrial work to which the prohibition effected by sub-section (1) of this section does not apply, such employer, if such worker remains in his employment for such week, shall allow to him twenty-four consecutive hours of rest before the next following Sunday.
(4) The Minister may, if he so thinks proper, by order make regulations permitting, in respect of any particular form of industrial work, the period of twenty-four consecutive hours' rest mentioned in the next preceding sub-section of this section to be given to any worker within seven days after the Sunday on which such worker was so employed as to be entitled under the said next preceding sub-section to such period of rest, and whenever any such regulations are so made the said next preceding sub-section shall have effect subject to the provisions of such regulations.
(5) Where an employer is prohibited by this section from permitting workers in his employment to do industrial work for him on a public holiday, such employer shall pay in respect of every public holiday one day's pay (calculated at the rate which would be applicable if such public holiday were a day of annual leave) to every worker who—
(a) is a worker to whom such prohibition applies, and
(b) is in the employment of such employer on the working day next before such public holiday, and,
(c) has been continuously in such employment during the whole of the period of four weeks ending on the said working day, and
(d) has worked in such employment not less than one hundred and fifty hours during the said period of four weeks, and
(e) has worked in such employment not less than twenty hours during the six working days next preceding such public holiday.
(6) The Minister may, whenever and so often as he so thinks proper, by order make regulations varying, in respect of all or any particular classes or class of workers, both or either of the periods of one hundred and fifty hours and twenty hours mentioned in the next preceding sub-section of this section by substituting for such periods or period such other periods or period as the Minister shall think proper, and whenever any such regulations are in force the said next preceding sub-section shall have effect, in respect of the workers or the classes or class of workers to which such regulations apply, as if the said periods or period affected by such regulations were varied in the manner stated in such regulations.
(7) In the application of the two next preceding sub-sections of this section to workers who are young persons, the several periods of one hundred and twenty hours and sixteen hours shall respectively be substituted for the several periods of one hundred and fifty hours and twenty hours, and the said two next preceding sub-sections shall have effect in relation to such workers accordingly.
(8) If any employer fails to pay to any worker any moneys which become payable to such worker under this section, such worker may recover such moneys as a simple contract debt from such employer.
(9) If any person acts in contravention of this section he shall be guilty of an offence under this section.
Wages Agreements Register.
50.—(1) As soon as may be after the commencement of this Act the Minister shall establish and thereafter maintain a register (in this section referred to as the register) in such form as he shall think proper to be styled and known as the Wages Agreements Register.
(2) Every agreement, signed (whether before or after the commencement or before or after the passing of this Act) by or on behalf of a body or bodies (in this section referred to as the employer signatories) substantially representative of the employers interested in any particular form of industrial work in the whole or in any particular part of Saorstát Eireann and by a body or bodies (in this section referred to as the worker signatories) substantially representative of the workers or of any particular class of the workers interested in the said particular form of industrial work in (as the case may be) the whole or in the said particular part of Saorstát Eireann, whereby the rates of salary, wages, or other reward payable to such workers or class of workers are regulated or restricted may be presented, within the time limited by this section, to the Minister by one or more of the parties thereto for registration in the register.
(3) Whenever an agreement made in respect of any particular form of industrial work is presented under this section to the Minister for registration in the register and the Minister is satisfied—
(a) that the employer signatories to such agreement are substantially representative of the employers concerned in such form of industrial work in the area to which such agreement relates, and
(b) that the worker signatories to such agreement are substantially representative of the workers or of a particular class of workers concerned in such form of industrial work in the area to which such agreement relates, and
(c) that such agreement, if made after the commencement of this Act, contains provisions regulating the duration or providing for the termination of such agreement and that such provisions are so framed as to secure that such agreement shall be operative for at least one year from the date thereof, and
(d) that such agreement is in all respects suitable for registration in the register, the Minister shall register such agreement in the register.
(4) Whenever an agreement is registered in the register, the following provisions shall, on and after the date on which such agreement is so registered and for so long thereafter as it continues to be binding on the parties thereto, have effect in relation to such agreement, that is to say:—
(a) such agreement shall be binding on every employer concerned in the form of industrial work in the area to which such agreement relates and on every worker or, where such agreement relates only to a class of workers, every worker in such class employed in the said form of industrial work in the said area;
(b) it shall not be lawful for any such employer to employ or pay any such worker or for any such worker to accept any employment or payment with or from any such employer at a rate of salary, wages, or other reward which is less than the rate provided by such agreement and applicable to such worker;
(c) if any such employer employs or pays any such worker in contravention of the next preceding paragraph of this sub-section, such employer shall be guilty of an offence under this section and if any such worker accepts any employment or payment in contravention of the said next preceding paragraph, such worker shall also be guilty of an offence under this section;
(d) subject to the provisions of the next following paragraph of this sub-section, every such worker shall notwithstanding any contract to the contrary, be entitled to demand from and be paid by and to recover from his employer, salary, wages, or other reward at the rate provided by such agreement and applicable to such worker;
(e) nothing contained in this sub-section shall operate to prevent any such employer from employing or paying any such worker salary, wages or other reward at a rate greater or more beneficial to such worker than the rate provided by such agreement and applicable to such worker, or operate to prevent any such worker who is so employed at such greater or more, beneficial rate of salary, wages, or other reward from recovering from his employer salary, wages, or other reward at such greater or more beneficial rate.
(5) Whenever an agreement is presented to the Minister for registration under this section the party or parties so presenting such agreement shall furnish to the Minister a copy thereof to be retained by him and shall furnish to the Minister all such information (if any) as he may require concerning such agreement and if such party or parties fail to furnish such copy and information the Minister may, on the ground of such failure, refuse the registration of such agreement.
(6) Whenever an agreement is registered in the register, the following provisions shall have effect, that is to say:—
(a) an officer of the Minister authorised in that behalf by the Minister shall cause to be endorsed on such instrument and shall sign thereon a certificate stating that such agreement is so registered and the date on which it was so registered;
(b) the Minister shall cause notice of the registration of such agreement in the register (with such particulars of such agreement and such registration as the Minister shall think proper) to be published in the Iris Oifigiúil;
(c) any person may obtain from the Minister, on –applying therefor in the prescribed manner and paying the prescribed fee, a copy of the copy of such agreement retained by the Minister under this section.
(7) A certificate endorsed and signed on an agreement in pursuance of the next preceding sub-section of this section shall be accepted in every court as conclusive evidence that such agreement is duly registered in the register and was so registered on the date stated in that behalf in such certificate and such certificate shall be so accepted without proof of the signature of the officer purporting to sign such certificate in pursuance of the said sub-section or that he was an officer of the Minister or was authorised by the Minister to sign such certificate.
(8) Whenever an agreement has been registered in the register, any person may, within one month after the publication in the Iris Oifigiúil of notice of such registration, apply to the High Court in a summary manner for the annulment of such registration, and on the hearing of such application the High Court may, if it is satisfied of either or both of the following matters that is to say:—
(a) that the employer signatories to such agreement were not, at the date of such agreement, substantially representative of the employers interested in the form of industrial work to which such agreement relates in Saorstát Eireann or, where such agreement applies to part only of Saorstát Eireann, in such part of Saorstát Eireann, or
(b) that the worker signatories to such agreement were not, at the date of such agreement, substantially representative of the workers or the particular class of workers to which such agreement relates employed in the form of industrial work to which such agreement relates in Saorstát Eireann or, where such agreement applies to part only of Saorstát Eireann, in such part of Saorstát Eireann,
annul the registration of such agreement in the register.
(9) The time within which an agreement may be presented under this section to the Minister for registration in the register shall be—
(a) in the case of an agreement bearing date before the date of the commencement of this Act, within six months after such commencement, or
(b) in the case of an agreement bearing date as of or after the date of the commencement of this Act, within six months after the date of such agreement.
Preservation of existing rates of wages.
51.—(1) Where, in order to comply with this Act, the hours of work prevailing immediately before the commencement of this Act in regard to all persons or any particular persons or person employed in any particular form of industrial work are reduced or otherwise altered, the following provisions shall have effect, that is to say:—
(a) the rate of salary, wages, or other reward payable to any such person immediately before the commencement of this Act shall not be reduced or be otherwise altered to the detriment of such person merely because of the said reduction or alteration in the hours of work of such person;
(b) the said reduction or alteration of hours of work shall not terminate nor prejudicially affect the contract of service under which any such person is so employed immediately before the commencement of this Act, and every such contract shall continue in force after such commencement with such modifications only as may be necessary in order to comply with this Act and in particular the modification that notwithstanding the said reduction or alteration of hours of work the average weekly earnings payable in a normal full working week to such person under such contract shall not be reduced;
(c) every agreement between employers or a body representative of employers on the one hand and workers or a body representative of workers on the other hand which is in force immediately before the commencement of this Act and regulates or restricts the rate of salary, wages, or other reward payable to any such person shall continue in force after the commencement of this Act notwithstanding the said reduction or alteration of hours of work but with the modification that every rate of salary, wages, or other reward which is fixed or the method of calculating which is fixed by such agreement and every restriction on any rate of salary, wages, or other reward contained in such agreement shall remain unchanged in amount;
(d) every minimum rate of salary, wage, or other reward fixed by statute or under statutory authority which is in force immediately before the commencement of this Act shall, if and so far as it is applicable to any such person, continue after such commencement in force and unchanged in amount notwithstanding the said reduction or alteration of hours of work.
(2) The foregoing sub-section of this section shall apply and have effect in relation to every regulation made under this Act by the Minister fixing hours of work in respect of any form of industrial work (whether for all or for any particular classes or class of workers engaged therein) with and subject to the modifications that every reference in the said sub-section to the commencement of this Act shall be construed and have effect as a reference to the coming into operation of such regulation and every reference in the said sub-section to compliance with this Act shall be construed and have effect as a reference to compliance with such regulations.
(3) This section shall apply to piece work wages and to wages calculated by direct reference to the number of hours worked, but with the modification that for the purposes of such application every provision in this section to the effect that a rate of wages or a minimum rate of wages or a restriction on a rate of wages is to remain unchanged shall be construed and have effect as a provision that the rate of piece work wages or of wages by the hour (as the case may be) shall be so adjusted or varied that the average weekly earnings shall remain unchanged.
Limitation of hours of work.
52.—(1) Whenever the Minister makes regulations declaring any form of industrial work to be excluded industrial work for the purpose of any section of this Part of this Act which relates to the hours during which an employer may permit any worker to do for him any form of industrial work, the Minister may by order make regulations fixing in such manner as he may think fit the hours of work in respect of such form of industrial work for all or any classes of workers engaged in such form of industrial work, and so long as such regulations remain in force it shall not be lawful for any employer to permit any worker to whom such regulations relate to do for him such industrial work save during such hours as may be fixed by such order.
(2) Whenever the Minister fixes by regulations made under this section the hours of work in respect of any form of industrial work (whether for all or for any particular classes or class of workers engaged therein) the Minister may by the same regulations make such provisions as he shall consider to be necessary or proper for securing that the average weekly earnings payable in a normal full working week to any person whose hours of work are reduced by such regulations shall not be reduced merely because of such reduction in his hours of work.
(3) The Minister shall not make any regulations under this section unless he has first consulted with representatives of employers interested in the form of industrial work to which such regulations relate and with representatives of workers so interested.
(4) If any employer permits or employs any worker to work for him in contravention of any regulations made under this section and for the time being in force such employer shall be guilty of an offence under this section and such worker shall also be guilty of an offence under this section.
Display of abstract and notices.
53.—(1) Every employer who employs any worker to do industrial work on any premises where an industrial undertaking is carried on shall display at the entrance to such premises and in such other places as an inspector shall for the time being direct in such a position that it may be easily read by persons so employed on such premises—
(a) the prescribed abstract of this Act,
(b) notice in the prescribed form of the hours of work for workers doing such industrial work,
(c) a notice stating the days in the current year which are for the time being public holidays for the purposes of this Act in respect of such industrial undertaking, and
(d) where any industrial work is carried on by continuous process shift work or by licensed shift work, a list of all persons so carrying on such industrial work and particulars as to the shifts on which they are working, and
(e) a notice of the clock by which the period of employment and times for meals are regulated in such industrial undertaking, and
(f) notice of every agreement registered in the Wages Agreements Register which affects any workers doing industrial work on such premises.
(2) Every employer who is by this section required to display any notice, list or abstract shall display such notice, list or abstract in both the Irish and English languages.
(3) If any employer fails to comply with the requirements of this section he shall be guilty of an offence under this section.
Emergency as defence.
54.—(1) It shall be a good defence to any proceedings taken against any person for breach of any of the provisions of this Part of this Act if such person shows to the satisfaction of the Court before which such proceedings are brought that any act occasioning such breach was rendered necessary or reasonably proper by the actual occurrence or the threat or reasonable anticipation of fire, flood, storm, violence, a breakdown of plant or machinery, or any other emergency.
(2) A certificate signed by any Minister that an act done by or in relation to any person employed by such Minister was rendered necessary by an emergency shall be conclusive evidence that such act was so rendered necessary.
Mixed employment.
55.—If any employer employs any worker to do any industrial work for any part of any day and employs such worker to do other work which is not industrial work for any other part of that day such worker shall for the purpose of this Part of this Act be deemed to be employed to do such industrial work while doing such other work.
PART IV.
Miscellaneous.
Variation of pending contracts.
56.—(1) Where a contract for the execution of any work or the manufacture or production of any article or substance or the doing of any other form of industrial work was entered into before the commencement of this Part of this Act and is at such commencement not fully carried out, and the person liable under such contract to execute such work, manufacture or produce such article or substance or do such other industrial work claims either or both of the following things, that is to say:—
(a) that, by reason of the obligations imposed on employers by this Act, a limitation of time contained in such contract for the doing of any particular thing has become unreasonable and should be extended, or
(b) that, by reason of the said obligations, any particular price or other payment fixed by such contract has become unreasonable and should be increased,
then and in every such case, such claim shall, in default of agreement between the parties concerned, be referred, on the demand of any such party, to arbitration under this section.
(2) Where a claim is referred under this section to arbitration, the following provisions shall have effect, that is to say:—
(a) such arbitration shall be heard and determined by one arbitrator who, in default of agreement between the parties concerned, shall be appointed by the Minister on the application of any such party;
(b) in the case of a claim for the extension of a limitation of time, the arbitrator shall determine whether such extension should or should not be made and (if he determines that such extension should be made) the amount of such extension;
(c) in the case of a claim for the increase of a price or other payment, the arbitrator shall determine whether such increase should or should not be made and (if he determines that such increase should be made) the amount of such increase;
(d) the arbitrator shall be paid such fee for acting as arbitrator as shall, in default of agreement, be fixed by the Minister, and such fee and all other general costs and expenses of the arbitration shall be paid by such one or more of the parties to the arbitration and, if by more than one of such parties, in such proportions as the arbitrator shall direct;
(e) the arbitrator shall determine how the costs and expenses incurred by each of the parties to the arbitration of or incidental to appearing and being heard thereat shall be borne;
(f) if the arbitrator determines that a limitation of time should be extended or that a price should be increased, the arbitrator shall amend the contract which is the subject of the arbitration in such manner as he shall think proper in order to give effect to such determination;
(g) the determination of the arbitrator shall be final and conclusive and shall be binding on all parties concerned.
Form of industrial work.
57.—Whenever the Minister makes regulations or grants a licence or permit under this Act in respect of a particular form of industrial work, the Minister may, in such regulations, licence, or permit (as the case may be)—
(a) specify such industrial work either generally or when done in any particular place or class of places or by any particular workers or class of workers;
(b) specify any form of industrial work by reference to the nature of such industrial work, to the workers or class of workers by whom such industrial work is done, or in such other manner as he may think fit:
(c) when different forms of industrial work are done in any industrial undertaking or class of industrial undertakings refer to by any collective description and specify as one form of industrial work such forms or any of such forms of individual work done in such industrial undertaking or class of industrial undertakings;
(d) in specifying any form of industrial work make such exceptions and exclusions as he may think fit.
Separation of parts of industrial undertakings.
58.—(1) The Minister may by order, if and whenever he so thinks fit on the application of an employer carrying on an industrial undertaking, declare that any one or more of the departments, branches, or other parts of such undertaking shall, for all the purposes or any specified purposes of this Act, be deemed to be separate industrial undertakings, and that this Act shall apply and have effect in relation to such undertaking accordingly.
(2) The Minister may by order, whenever he so thinks fit, revoke or amend an order previously made by him under this section, including an order made under this sub-section.
(3) Whenever and so long as an order made under this section is in force in respect of an industrial undertaking, this Act shall apply and have effect in relation to such undertaking subject to and in accordance with such order.
Expenses.
59.—Any expenses incurred in carrying this Act into execution shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Power of inspectors.
60.—An inspector shall for the purpose of the execution of this Act have power to do all or any of the things which an inspector has power to do for the purpose of the execution of the Factory and Workshop Act, 1901, as if references to that Act in section 119 thereof were references to this Act, and for the purpose of the exercise of such powers every place in which any industrial work is carried on shall be deemed to be a factory within the meaning of that Act.
Employment of persons not in receipt of wages or salary.
61.—Where industrial work in any industrial undertaking is done wholly or partly by persons who do not receive any salary or wages in respect of their work, the person carrying on such industrial undertaking shall for the purposes of this Act be deemed to be the employer of such persons doing such industrial work, and such persons shall for the purposes of this Act be deemed to be workers in the employment of such person.
Industrial work in institutions.
62.—(1) The provisions of this Act, except in so far as they relate to the payment of workers, shall apply in relation to industrial work done in any institution as if the persons doing such industrial work were workers employed to do such industrial work by the persons having control of such institution unless such industrial work is done for the purpose only of supplying the needs and requirements of such institution.
(2) For the purpose of this section the word “institution” means an institution carried on for charitable or reformatory purposes, other than a prison, a borstal institute, a mental home, or a county home.
Statistical returns.
63.—(1) The Minister may by order make regulations for all or any of the following purposes, that is to say:—
(a) requiring persons carrying on industrial undertakings to make and furnish to the Minister statistical returns;
(b) prescribing the class or classes of industrial undertakings in respect of which such returns are to be made;
(c) prescribing the subjects and matters in respect of which such returns are to be made;
(d) prescribing the forms in which and the times at which such returns are to be made.
(2) Every person, required by regulations made under this section to make statistical returns, who fails to make such returns in accordance with such regulations shall be guilty of an offence under this section.
Records.
64.—(1) The Minister may by order make regulations prescribing records, to be kept by employers or any class of employers, of any matter or thing a record of which is in the opinion of the Minister required for the enforcement of this Act and may by any such order, if he so thinks fit, prescribe the form of any such records.
(2) The Minister may under this section make different regulations in respect of different classes of employers.
(3) The Minister may, if he so thinks fit, by any regulations made under this section prescribe the place or places where the records prescribed by such regulations shall be kept and may make such regulations as to the production and inspection of such records as he may think fit.
(4) Any person who fails to comply with any regulation made under this section and for the time being in force, and applicable to such person, shall be guilty of an offence under this Act.
