HOUSING (MISCELLANEOUS PROVISIONS) ACT, 1979
Interpretation.
1.—(1) In this Act, save where the context otherwise requires—
“building society” means a society incorporated under the Building Societies Act, 1976;
“certificate of reasonable value” means a certificate granted under section 18 of this Act;
“house” includes any building or part of a building used or suitable for use as a dwelling and any outoffice, yard, garden or other land appurtenant thereto or usually enjoyed therewith and “housing” shall be construed accordingly;
“improvement works”, in relation to a house, includes the provision and installation of a private water supply or private sewerage facilities in the house and any works carried out to the house (whether for the purpose of extending, enlarging, improving, repairing or converting it) that, in the opinion of the Minister, are reasonably necessary for the purpose of rendering the house more suitable for human habitation, but does not include decoration;
“the Principal Act” means the Housing Act, 1966.
(2) References in the Principal Act, as amended, to a grant, loan or contribution under that Act shall be construed as including references respectively to a grant, loan or subsidy under this Act.
Devolution of administration of housing grants.
2.—(1) The Minister may, subject to such regulations as may be made by the Minister for the purposes of this section, authorise designated housing authorities to discharge on his behalf the function of paying grants of one or more, as may be specified in the regulations, of the kinds of grants that the Minister is empowered to pay under the Principal Act or this Act.
(2) Before making regulations under this section, the Minister shall consult with the Minister for Finance and the Minister for the Public Service and with a housing authority affected by the regulations.
(3) Regulations under this section may contain such provisions as the Minister considers necessary or expedient for the purposes of the section, including provisions in relation to the liability for payment of administrative costs incurred by a housing authority under the section.
Grants by Minister for expenses of certain bodies.
3.—(1) The Minister may, with the consent of the Minister for Finance, pay, out of moneys provided by the Oireachtas, a grant in respect of the administrative and general expenses of a body to which this section applies and which is approved of by the Minister for the purposes of this section.
(2) This section applies to a body which represents or promotes the formation of co-operative groups or voluntary associations which have as an object the provision of houses.
(3) A grant under this section shall be subject to such terms and conditions as may be determined by the Minister at the time of the approval of the grant.
(4) This section shall be deemed to have come into operation on the 1st day of January, 1979.
Grants by Minister for provision of new houses.
4.—(1) The Minister may, with the consent of the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, pay, out of moneys provided by the Oireachtas, a grant to a person providing a new house where—
(a) in case the person purchases the house, a contract for the purchase was not made before the 27th day of May, 1977, and
(b) in case the person builds the house, the foundations were not completed before the 27th day of May, 1977.
(2) Regulations under this section may, in particular, but without prejudice to the generality of subsection (1) of this section, make provision in relation to all or any one or more of the following:
(a) the amount of a grant,
(b) the total floor area of a house the subject of a grant, measured in such manner as may be determined by the Minister from time to time,
(c) a requirement that, where a house is provided for sale within the meaning of section 18 of this Act, a grant shall not be paid in respect of the house unless a certificate of reasonable value is granted under that section in respect of such sale and the conditions subject to which the certificate is granted are complied with,
(d) the occupation of the house,
(e) a requirement that the person to whom the grant is paid or the spouse of such person, either separately or with each other, has not previously purchased or built for his or their own occupation another house,
(f) requirements in relation to the financial and family circumstances of the person to whom the grant is paid, and
(g) requirements in relation to the payment of any other grant or subsidy in respect of the house under any enactment (including this Act).
(3) A grant shall not be paid under this section unless the house the subject of the grant complies with such conditions, if any, as may be determined by the Minister from time to time for the purposes of this section in relation to standards of construction of houses and the provision of water, sewerage and other services therein.
(4) Where a house is damaged by fire, explosion or act of God and, in the opinion of the Minister, it would be more reasonable for the owner of the house to provide a new house than to carry out all necessary improvement works to the first-mentioned house and refusal by the Minister to pay a grant under this section in respect of the provision of the new house would cause undue hardship to the owner or his spouse, the Minister may, with the consent of the Minister for Finance, notwithstanding that a requirement of a regulation under this section in relation to matters specified in subsection (2) (e) of this section has not been complied with, pay a grant under this section in respect of such provision if a grant would otherwise fall to be so paid.
Grants by Minister for improvement of houses.
5.—(1) The Minister may, with the consent of the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, pay, out of moneys provided by the Oireachtas, a grant to a person (including a housing authority) carrying out improvement works to a house.
(2) Regulations under this section may, in particular, but without prejudice to the generality of subsection (1) of this section, make provision in relation to all or any one or more of the following:
(a) the amount of a grant,
(b) requirements in relation to the suitability of the house concerned for improvement,
(c) the occupation of the house,
(d) requirements in relation to the type and purpose of the improvement works,
(e) requirements in relation to the financial and family circumstances of the person to whom the grant is paid, and
(f) requirements in relation to the payment of any other grant or subsidy in respect of the house under any enactment (including this Act).
(3) A grant shall not be paid under this section unless the house the subject of the grant, upon completion of the works concerned, complies with such conditions, if any, as may be determined by the Minister from time to time for the purposes of this section in relation to standards of construction of houses and the provision of water, sewerage and other services therein.
Grants and other assistance by housing authorities for provision of new houses and improvement of houses.
6.—(1) A housing authority may, with the consent of the Minister and the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, pay a grant to a person providing a new house or carrying out improvement works to a house.
(2) A housing authority may, with the consent of the Minister and the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, make a contribution in kind (whether by way of building materials or labour or any other contribution) to a person in respect of improvement works which are being carried out by the person.
(3) Regulations under this section may, in particular, but without prejudice to the generality of subsection (1) of this section, make provision in relation to all or any one or more of the matters referred to in sections 4 (2) and 5 (2) of this Act.
(4) Regulations under this section, insofar as they relate to a grant paid by a housing authority in respect of a house for which a grant has previously been paid by the Minister for the Gaeltacht, shall not be made without the consent of that Minister.
(5) The Minister may, with the consent of the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, contribute, out of moneys provided by the Oireachtas, to any expenditure incurred by a housing authority under this section.
(6) A grant shall not be paid, or other assistance given, under this section by a housing authority unless the house or works the subject of the grant or assistance complies or comply on completion with such conditions, if any, as may be determined by the Minister from time to time for the purposes of this section in relation to standards of construction of houses and the provision of water, sewerage and other services therein.
(7) A housing authority may impose, in relation to the payment of a grant or the giving of other assistance by them under this section, such conditions as they think fit.
(8) Section 38 of the Principal Act (which enables certain grants to be paid notwithstanding non-compliance with provisions made by or under statute) shall, with the consent of the Minister, apply to a grant or any contribution by a housing authority under this section as it applies to a grant referred to in that section.
Grants by Minister for housing of elderly persons and others.
7.—(1) The Minister may, with the consent of the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, pay, out of moneys provided by the Oireachtas, a grant to a body, approved of by the Minister, which provides (whether by erection, purchase, improvement or conversion works), one or more than one house for the accommodation of elderly persons or for the accommodation, as his normal place of residence, in the house or houses or within the precincts thereof, of a person providing welfare or caretaker services for such elderly persons.
(2) Regulations under this section may, in particular, but without prejudice to the generality of subsection (1) of this section, make provision in relation to all or any one or more of the matters referred to in sections 4 (2) and 5 (2) of this Act.
(3) A grant shall not be paid under this section unless the house or works the subject of the grant complies or comply on completion with such conditions, if any, as may be determined by the Minister from time to time for the purposes of this section in relation to standards of construction of houses and the provision of water, sewerage and other services therein.
Loans by housing authorities for improvement of houses.
8.—(1) A housing authority may, with the consent of the Minister and the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, make a loan to a person carrying out improvement works to a house.
(2) Subject to subsection (3) of this section, repayment of a loan under this section in respect of a house shall be secured—
(a) by an instrument vesting the ownership of the house in the housing authority subject to a right of redemption by the borrower,
(b) by charging the house under the Registration of Title Act, 1964, with the repayment of the loan (together with the interest payable thereon),
(c) by the deposit with the housing authority of the land certificate issued under the said Act in relation to the house, or
(d) where such ownership is already vested in a person other than the borrower subject to a right of redemption by the borrower, by an instrument of further charge charging the repayment of the loan (together with the interest payable thereon) under this section on the house and making the said right of redemption subject also to the repayment of the loan (together with the interest payable thereon) under this section.
(3) In case a loan to be made under this section does not exceed such amount as may be prescribed from time to time for the purposes of this subsection, the housing authority concerned may make the loan without requiring the security referred to in subsection (2) of this section.
(4) Regulations under this section may, in particular, but without prejudice to the generality of subsection (1) of this section, make provision in relation to all or any one or more of the following:
(a) the amount of a loan,
(b) requirements in relation to the suitability of the house concerned for improvement,
(c) the occupation of the house,
(d) requirements in relation to the type and purpose of the improvement works, and
(e) requirements in relation to the financial and family circumstances of the person to whom the loan is made.
(5) A loan shall not be made under this section unless the house the subject of the loan, upon completion of the works concerned, complies with such conditions, if any, as may be determined by the Minister from time to time for the purposes of this section in relation to standards of construction of houses and the provision of water, sewerage and other services therein.
(6) Any sum due to a housing authority by any person in respect of a loan made under this section may, without prejudice to any other power in that behalf, be recovered by the authority from that person as a simple contract debt in any court of competent jurisdiction.
(7) In this section “ownership” means such interest or combination of interests in a house as constitutes either a fee simple interest in possession or a leasehold interest (including fee farm grant) in possession of such number of years unexpired at the date on which the loan under this section in respect of the house is authorised by the housing authority as is equal to or greater than the term fixed for the repayment of the loan.
Subsidies by Minister to housing authorities for provision of sites for private housing.
9.—The Minister may, with the consent of the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, pay to a housing authority, out of moneys provided by the Oireachtas, a subsidy of such amount as he may determine towards the annual loan charges incurred by the authority in respect of the provision by them of a site for the erection (other than by or for a housing authority) of a house.
Subsidies by Minister for houses provided by housing authorities for letting.
10.—(1) (a) The Minister may, in respect of the period commencing on the 1st day of April, 1973, and ending on the 31st day of December, 1976, with the consent of the Minister for Finance, pay, out of moneys provided by the Oireachtas, a subsidy of such amount as he may determine towards the expenditure incurred by a housing authority in respect of—
(i) moneys borrowed by the authority for the provision of a house for letting in respect of which a grant under section 15 of the Principal Act has not been paid, and
(ii) the maintenance, management and improvement of such a house.
(b) A subsidy under this subsection shall be subject to such conditions, if any, as the Minister may specify and, without prejudice to the generality of the foregoing, the conditions may include conditions relating to rent, purchase of the house concerned, standards of construction, contributions from the housing authority concerned towards the expenditure involved and expenditure on the maintenance, management and improvement of the house concerned.
(2) The Minister may, in respect of the financial year 1977 and subsequent financial years, with the consent of the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, pay to a housing authority, out of moneys provided by the Oireachtas, a subsidy not exceeding an amount equal to the amount of the annual loan charges incurred by the authority in respect of—
(a) the provision of a house for letting and ancillary works in relation to such a house,
(b) the acquisition of land for the purposes of the provision by the authority of houses for letting by the authority, and
(c) works carried out in relation to completed houses provided under section 56 of the Principal Act, being works which, having regard to the exceptional circumstances requiring them, were approved of by the Minister on or before the 31st day of December, 1977.
(3) Regulations under this section may, in particular, but without prejudice to the generality of subsection (2) of this section, make provision in relation to all or any one or more of the following matters:
(a) the rent of the house concerned,
(b) the purchase of the house and the application by the housing authority of the proceeds of such a purchase,
(c) contributions towards the expenditure concerned from the housing authority,
(d) expenditure on the maintenance, management and improvement of the house, and
(e) requirements in relation to the payment of any other grant or subsidy in respect of the house under any enactment (including this Act).
(4) A subsidy shall not be paid under this section unless the house or works the subject of the subsidy complies or comply on completion with such conditions, if any, as may be determined by the Minister from time to time for the purposes of this section in relation to standards of construction of houses and of works and the provision of water, sewerage and other services in houses.
(5) A subsidy under subsection (2) of this section may, with the consent of the Minister for Finance, be made either to the housing authority concerned or to the person who made the loan in respect of which the loan charges concerned were incurred.
(6) The Commissioners of Public Works in Ireland may, with the consent of the Minister for Finance, write off moneys payable to the Commissioners by housing authorities in respect of loans made by the Commissioners to the authorities for the purpose of the provision of houses.
Subsidies by Minister and housing authorities for purchase or construction of houses.
11.—(1) (a) The Minister may, with the consent of the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, pay a subsidy to a housing authority out of moneys provided by the Oireachtas where the authority—
(i) make a loan under section 39 of the Principal Act, or
(ii) sell a house under section 90 of the Principal Act to a person who is not the tenant of the house in a case in which the purchase money is payable by instalments.
(b) Where the Minister pays a subsidy under this subsection to a housing authority, the authority shall reduce the amount of the relevant repayments of the loan concerned or the relevant instalments of the purchase money concerned, as the case may be, by amounts the total of which is equal to the amount of the subsidy.
(2) (a) Where a housing authority—
(i) make a loan under section 39 of the Principal Act, or
(ii) sell a house under section 90 of the Principal Act to a person who is not the tenant of the house and the purchase money is payable by instalments,
the authority may, with the consent of the Minister and the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, pay a supplementary subsidy not exceeding the amount of a subsidy under subsection (1) of this section to the person to whom the loan is made or the house is sold, as the case may be, in respect of expenditure incurred by him in relation to the transaction to which the loan or sale relates.
(b) A subsidy under this subsection shall be paid by means of a reduction of the relevant repayments of the loan concerned or the relevant instalments of the purchase money concerned, as the case may be, by amounts the total of which is equal to the amount of the subsidy.
(3) Regulations under this section may, in particular, but without prejudice to the generality of subsections (1) and (2) of this section, make provision in relation to all or any one or more of the following:
(a) the amount of a subsidy under subsection (1) of this section,
(b) the prohibition of the payment of a subsidy under this section to a person to whom, or to whose spouse, a subsidy under this section has previously been paid,
(c) a requirement that upon—
(i) the sale of a house by a person to whom a loan or sale specified in subsection (1) of this section is made in respect of that house,
(ii) the lease, letting or transfer of a house to which this section refers to a person other than the spouse, parent, son or daughter of such person as aforesaid, or
(iii) the redemption of a loan made under section 39 of the Principal Act or the payment of the purchase money, in relation to a sale under section 90 of the Principal Act,
within a specified period after the payment of a subsidy under this section in relation to the relevant loan or sale, as the case may be, the person shall pay to the housing authority a specified amount not exceeding the amount of the subsidy or subsidies, and the authority shall pay to the Minister a specified amount not exceeding the amount of the subsidy paid under subsection (1) of this section.
Subsidies by Minister for certain loans guaranteed by housing authorities.
12.—The Minister may, with the consent of the Minister for Finance and subject to such regulations as may be made by the Minister for the purposes of this section, pay, out of moneys provided by the Oireachtas, a subsidy to a building society in respect of interest payable for any period commencing on or after the 1st day of June, 1977, on a loan that was or is made by the society for the provision of a house and which was or is guaranteed by a housing authority under section 42 of the Principal Act.
Duty of housing authorities in certain circumstances to put houses into good structural condition.
13.—(1) Where a housing authority propose to make a vesting order under section 17 of the Labourers Act, 1936, or to make a transfer order under section 90 of the Principal Act vesting a house in the tenant thereof in fee simple and the house is not in good structural condition, the authority shall, subject to subsection (2) of this section, before making the order, carry out such works as are necessary to put the house into good structural condition.
(2) Where a housing authority propose to make an order described in subsection (1) of this section and the house concerned is not in good structural condition, the authority may make the order without carrying out such works as are necessary to put the house into good structural condition if the authority and the tenant of the house have entered into an agreement in writing that—
(a) the tenant shall carry out, or cause to be carried out, within a specified time after the making of the order, specified works in relation to the house, being works that in the opinion of the authority and the tenant are necessary to put the house into good structural condition,
(b) the authority shall pay to the tenant a specified sum, not exceeding the amount estimated by the authority to be the cost of the specified works, upon the completion of the works to the satisfaction of the authority within the specified time or such further time, if any, as may be allowed by the authority,
(c) the authority, upon being satisfied that the specified works have been properly completed, shall grant to the tenant a certificate stating that they are so satisfied,
(d) if the tenant fails to complete the specified works to the satisfaction of the authority within the specified time, or such further time, if any, as may be allowed by the authority, the authority shall carry out the works or such part thereof as has not been carried out and shall deduct from the sum otherwise payable by them to the tenant pursuant to paragraph (b) of this subsection the reasonable costs of any such works carried out by them,
(e) the tenant may, not earlier than the commencement of the agreement and not later than the expiration of 21 days beginning on the day on which the authority make a payment to the tenant under this section, and subject to subsection (8) of this section, apply to the Minister for a determination in relation to any doubt, dispute or question as to compliance by the authority with the terms of the agreement, and the Minister shall determine the doubt, dispute or question, and
(f) the authority shall comply with such directions, if any, as may be specified by the Minister in a determination under paragraph (e) of this subsection in relation to compliance by the authority with the terms of the agreement.
(3) Where an agreement under subsection (2) of this section is entered into by a housing authority in relation to a house, the authority, without prejudice to any other power to withhold consent, shall not, in a case where alienation of the house cannot be effected without the consent of the authority, give their consent to the alienation of the house unless they have granted a certificate as described in paragraph (c) of that subsection in relation to the house or unless the Minister has, in exercising his power under paragraph (e) of that subsection, determined that the specified works have been properly completed.
(4) A grant under section 5 or 6 of this Act shall not be paid in respect of the carrying out of works specified in an agreement under subsection (2) of this section.
(5) Where a housing authority make an order of the kind described in subsection (1) of this section, they shall, as soon as may be after the making of the order, notify the purchaser concerned of the making of the order and, where an agreement under subsection (2) of this section has not been entered into, the said notification shall include details of the rights of the purchaser under subsection (6) of this section.
(6) Where a housing authority make an order of the kind described in subsection (1) of this section, and the authority and the purchaser concerned have not entered into an agreement under subsection (2) of this section in relation to the house concerned, the purchaser may, not later than the expiration of the period of 21 days beginning on the day on which he is notified under subsection (5) of this section of the making of the order, apply to the Minister for a determination in relation to any doubt, dispute or question as to whether or not the house is in good structural condition and the Minister shall determine the doubt, dispute or question.
(7) If the Minister determines under subsection (6) of this section that a house is not in good structural condition, he shall specify the works that, in his opinion, are necessary to put the house into good structural condition, and the works so specified shall be carried out by the housing authority and neither the fact that an order of the kind referred to in subsection (1) of this section has been made in relation to the house nor the terms of the order shall be taken as preventing the works from being carried out.
(8) An application under subsection (2) or (6) of this section for a determination by the Minister shall be accompanied by a fee of such amount as may be prescribed from time to time for the purposes of this section.
Amendment of section 5 of Principal Act.
14.—Section 5 of the Principal Act is hereby amended as respects regulations made after the commencement of this section by the insertion of the following subsection:
“(4) Regulations under this Act may be expressed to apply either generally or to specified areas or to areas, houses, loans, persons, works or other matters of a specified class or classes and different provisions of such regulations may be expressed to apply in relation to different areas or to different classes of areas, houses, loans, persons, works or other matters.”.
Amendment of section 33 of Principal Act.
15.—(1) Where, in respect of a new house—
(a) either—
(i) a certificate was or is granted by the Minister on or after the 1st day of January, 1976, stating that the consideration for the sale of the house did not exceed the amount appearing to the Minister to represent reasonable value for the purposes of section 35 (2) (a) (ii) of the Principal Act, or
(ii) a certificate was or is granted by the Minister on or after that date dispensing with a requirement of the Minister that there be in relation to the house a certificate of the kind referred to in subparagraph (i) of this paragraph,
and
(b) a certificate was or is granted by the Minister stating that the house had or has been satisfactorily completed,
section 33 (1) of the Principal Act shall apply, and be deemed always to have applied, in relation to the revised valuation of the tenement consisting of or including the house notwithstanding that a grant referred to in that section was not paid in respect of the house.
(2) Where a grant was or is paid under section 6 of this Act in respect of improvement works to a house for the accommodation of a physically disabled person or a severely mentally handicapped person, section 33 (4) of the Principal Act shall apply, and be deemed always to have applied, in relation to the valuation of the tenement consisting of or including the house.
Amendment of section 60 of Principal Act.
16.—Section 60 of the Principal Act is hereby amended by the substitution for subsection (4) of the following subsection:
“(4) A scheme under this section may specify that—
(a) particular priorities shall be accorded to particular categories of persons in the letting of particular dwellings;
(b) for the purpose of determining the order of priority to be followed in the letting of dwellings to persons in accordance with the scheme, the housing authority shall obtain and have regard to a report from a medical officer of health of the health board established under the Health Act, 1970, in whose functional area the functional area of the housing authority is situate—
(i) in the making of all such lettings, or
(ii) in the making of all such lettings in relation to the making of which priority is claimed on grounds consisting of or including medical grounds.”.
Amendment of section 90 of Principal Act.
17.—(1) The Minister may—
(a) direct a housing authority to offer for sale under section 90 of the Principal Act a house of the authority of such class as may be specified in the direction,
(b) direct a housing authority not to sell a house of the authority of such class as may be specified in the direction,
(c) revoke or amend a direction under this section.
(2) Section 90 of the Principal Act shall apply, and be deemed always to have applied, to a building consisting of a house and a shop, together with any outoffice, yard, garden or other land appurtenant thereto or usually enjoyed therewith.
Certificates of reasonable value.
18.—(1) (a) Subject to subsection (3) of this section and to such regulations as may be made by the Minister for the purposes of this section, the Minister, on the application in writing of a person who appears to the Minister to be providing for sale a new house, may, subject to compliance by the person with the provisions of this section, grant to the person in respect of the sale of the house a certificate (which shall be known as a certificate of reasonable value and is in this section referred to as “a certificate”) stating that the house appears to the Minister at the time of the granting of the certificate and on the basis of the information available to the Minister at that time to represent reasonable value for the amount specified in the certificate, and specifying such other matters, if any, as the Minister considers appropriate.
(b) The Minister may, on the application in writing of a person in relation to a new house, if it appears to the Minister that the house is not being provided for sale, grant to the person a certificate (which shall be known as a certificate of exemption) stating that it so appears to the Minister.
(c) An application under this subsection shall be accompanied by a fee of such amount as may be prescribed from time to time for the purposes of this subsection.
(2) (a) Regulations for the purposes of this subsection may specify the loans to which this subsection applies, and the specification may relate to all loans or to loans that do not exceed a specified amount or to loans that are not less than a specified amount or to loans that do not exceed a specified amount and are not less than another specified amount.
(b) If and whenever regulations for the purposes of this subsection specifying the loans to which this subsection applies are in force, a loan so specified shall not be made by an assurance company, a bank, a building society, or other industrial or commercial organisation or a housing authority (hereinafter referred to as “the lender”) in respect of a new house unless the person who made the application for the loan furnishes to the lender either a certificate in respect of the sale of the house, or a certificate of exemption in respect of the house, and the provisions of any regulations for the purposes of this subsection are complied with.
(c) A person who contravenes paragraph (b) of this subsection shall be guilty of an offence.
(3) The Minister shall not grant a certificate in respect of the sale of a house—
(a) if the amount of the consideration for the sale (in this section subsequently referred to as “the price”) is greater than the greatest amount for which, in the opinion of the Minister, the house represents reasonable value, or
(b) if the price is greater than an amount standing prescribed for the time being under subsection (9) (g) of this section, or
(c) if the sale is completed before the date of the receipt by the Minister of an application for the certificate, or
(d) if the amount of the cost or value of the site of the house included in the price is greater than an amount standing prescribed for the time being under subsection (9) (h) of this section.
(4) (a) The Minister may refuse to grant a certificate in any case where the amount of the cost or value of the site of a house included in the price is greater than the amount for which the site appears to the Minister to represent reasonable value.
(b) For the purposes of paragraph (a) of this subsection, the Minister may, on the application in writing of either the vendor or purchaser of the site of a house indicate in writing in advance of an application for a certificate whether or not a particular amount proposed to be included in the price as the cost or value of the site appears to the Minister to represent reasonable value.
(5) (a) Where the Minister decides under subsection (3) (a) or (4) (a) of this section not to grant a certificate, he shall notify in writing the person who applied for such grant of his decision and the person may, within the period of 21 days beginning on the date of receipt by him of the notification, appeal to the Circuit Court against the decision and that Court may, on the hearing of the appeal, as it thinks proper, affirm the decision or direct the Minister to grant the certificate.
(b) Notice of an appeal under this section shall be given to the Minister and an officer of the Minister shall be entitled to appear and be heard on the hearing of the appeal.
(c) No appeal shall lie from a decision of the Circuit Court on an appeal under this subsection.
(6) The Minister may, on the application in writing of a person to whom a certificate was granted under subsection (1) (a) of this section, or of any other person who appears to the Minister at the time of the application to be providing a house referred to in a certificate, revoke the certificate and grant another certificate in different terms from the first-mentioned certificate in respect of the sale to which the first-mentioned certificate related.
(7) (a) An application to the Minister for the grant of a certificate or a certificate of exemption shall be supported by such information as the Minister may require for the purpose of his functions under this section in relation to the grant.
(b) A person who furnishes information to the Minister under this section that is false or misleading shall be guilty of an offence.
(8) (a) It shall be the duty of a person to whom a certificate is granted in respect of the sale of a house to ensure that the standards in relation to—
(i) the design, specification, construction and finish of the house,
(ii) the nature and quality of the materials used in the construction and finish of the house,
(iii) the total floor area of the house, measured in such manner as may be determined by the Minister from time to time,
(iv) such fixtures, fittings or other articles as are included with the house in the sale, their design, manufacture and finish and their nature and quality, and
(v) the fitting or installation of the fixtures, fittings and articles aforesaid,
are not inferior to or less in value than those specified, expressly or by implication, by the person to the Minister under subsection (7) of this section.
(b) It shall be the duty of a person to whom a certificate is granted in respect of the sale of a house, and of the purchaser of the house on that sale, to ensure that the price charged or paid for the sale, as the case may be, is not greater than the amount specified in the certificate, such amount being varied, where appropriate, to take into account the reasonable additional cost, or saving, caused by any alteration—
(i) of the standards referred to in paragraph (a) of this subsection or in relation to the matters referred to in subparagraphs (i) to (v) of that paragraph, or
(ii) if the price aforesaid is stated in the certificate to be subject to variation, of the cost of the provision of the house and of any fixtures, fittings or other articles included in the sale thereof.
(c) A person who contravenes paragraph (a) or (b) of this subsection shall be guilty of an offence.
(9) Without prejudice to the generality of subsections (1) and (2) of this section, regulations under this section may make provision in relation to all or any one or more of the following:
(a) requirements in relation to an application to the Minister for a certificate or a certificate of exemption that shall be complied with by the person making the application,
(b) conditions to which the grant of a certificate shall be subject,
(c) requirements as to the total floor area of a house to which a certificate relates,
(d) conditions or clauses in a contract for the sale of a house to which a certificate relates providing for the variation of the price for the sale,
(e) requirements in relation to the contents and display of notices at or near houses or sites where houses are being or are to be provided, being houses or proposed houses to which certificates relate,
(f) requirements in relation to the inspection of houses and sites by officers of the Minister,
(g) the amount that is the greatest price that may be specified by the Minister in a certificate, and
(h) the amount that is the greatest amount that may be reckoned by the Minister in respect of the cost or value of the site of a house in determining an application for a certificate.
(10) (a) Without prejudice to any penalties which may be imposed under this section, the Minister may, at his discretion, in any case where he is satisfied that a person to whom a certificate was granted has supplied information under subsection (7) (a) of this section that is false or misleading or has contravened paragraph (a) or (b) of subsection (8) of this section, or a condition subject to which the certificate was granted, do either or both of the following, that is to say:
(i) revoke the certificate in respect of which the contravention has occurred,
(ii) refuse for such period as he considers appropriate (but not exceeding five years from the date of the notification to the person under paragraph (b) of this subsection) to grant a certificate to the person or to a person connected with him (any question whether a person is connected with another person being, for the purposes of this subsection, determined in accordance with section 96 (3) of the Income Tax Act, 1967, with the modification that references in the said section 96 (3) to control in relation to a company shall be construed as references to the ownership of not less than 20 per cent in nominal value of the share capital of the company).
(b) Before the Minister exercises a power under this subsection, he shall notify in writing the person concerned of his intention to do so and shall include in the notification particulars of the nature of and the reasons for such exercise and shall consider any representations from the person concerned if they are received by the Minister not later than the expiration of the period of 21 days beginning on the day on which he is notified under this paragraph.
(c) In exercising a power under this subsection, the Minister shall notify in writing the person concerned of his decision.
(d) A person may, within a period of three months beginning on the date of receipt by him of the Minister's decision under paragraph (a) of this subsection or of his opinion under subsection (16) of this section, appeal to the High Court against the decision or opinion and on such appeal the High Court may affirm, reverse or vary such decision or opinion.
(11) (a) A person shall not forge a document purporting to be a certificate or a certificate of exemption.
(b) A person shall not, with intent to deceive, either alter or use a certificate or a certificate of exemption.
(c) A person who contravenes this subsection shall be guilty of an offence.
(12) Where—
(a) a person to whom a certificate has been granted contravenes a condition subject to which it was granted, or
(b) a person contravenes a regulation under this section,
he shall be guilty of an offence.
(13) Where the commission by any person of an offence under this section is due to the act or default of some other person, that other person shall also be guilty of the offence and may be charged with and convicted of the offence by virtue of this subsection whether or not proceedings are taken against the first-mentioned person.
(14) (a) In any proceedings for an offence under this section (other than subsection (11)) it shall, subject to paragraph (b) of this subsection, be a defence for the person charged to prove—
(i) that the commission of the offence was due to a mistake or to the act or default of another person or the reliance on information supplied to him by another person, an accident or some other cause beyond his control, and
(ii) that he took all reasonable precautions and exercised all due diligence to avoid the commission of such an offence by himself or any other person under his control.
(b) If in any case the defence provided by paragraph (a) of this subsection involves the allegation that the commission of the offence was due to the act or default of another person or to reliance on information supplied by another person, the person charged shall not, without leave of the court, be entitled to rely on that defence unless, not less than seven clear days before the hearing, he has served on the prosecutor a notice in writing giving such information identifying or assisting in the identification of that other person as was then in his possession.
(15) (a) A person guilty of an offence under this section shall be liable on conviction on indictment to a fine not exceeding £10,000.
(b) A Justice of the District Court shall have jurisdiction to try summarily an offence under this section if—
(i) the Justice is of opinion that the facts proved or alleged against a defendant charged with such an offence constitute a minor offence fit to be tried summarily,
(ii) the Director of Public Prosecutions consents, and
(iii) the defendant (on being informed by the Justice of his right to be tried by a jury) does not object to being tried summarily,
and, upon conviction under this paragraph, the said defendant shall be liable to a fine not exceeding £500.
(c) Section 13 of the Criminal Procedure Act, 1967, shall apply in relation to an offence under this section as if, in lieu of the penalties specified in subsection (3) of that section, there were specified therein the penalty provided for by paragraph (b) of this subsection and the reference in subsection (2) (a) of that section to the penalties provided for in subsection (3) of that section shall be construed accordingly.
(16) In this section—
“assurance company” has the meaning assigned to it by the Insurance Acts, 1909 to 1978;
“bank” means the holder of a licence under section 9 of the Central Bank Act, 1971, or a trustee savings bank certified under the Trustee Savings Banks Acts, 1863 to 1979;
“company” means a company within the meaning of section 2 of the Companies Act, 1963, or a company incorporated outside the State;
“sale”, in relation to a house, includes a sale of land and an agreement relating to the erection of a house thereon which, in the opinion of the Minister, is associated with such sale irrespective of whether—
(i) such sale is conditional on the making of such agreement, or
(ii) the vendor of the land is a party to such agreement.
Statutory declarations.
19.—It shall be lawful for a member of the Garda Síochána or a person in Holy Orders or a regular minister of any religious denomination or community to take and receive a statutory declaration for the purpose of the making of an application for a grant, loan or subsidy under this Act.
Amendment of Building Societies Act, 1976.
20.—The Building Societies Act, 1976, is hereby amended—
(a) in section 30, by the substitution of the following subsection for subsection (2):
“(2) If any officer, member or agent of the society refuses to produce to the inspector any book or document which it is his duty under this section to produce or refuses to answer any question put to him by the inspector with respect to the affairs of the society, he shall be guilty of an offence.”, and
(b) in section 77, by the substitution of the following subsection for subsection (1):
“(1) Whenever the Minister considers it expedient, in the interests of the orderly and proper regulation of building society business and having regard to the demand for loans for house purchase and the financial needs of the national housing programme, he may, with the consent of the Minister for Finance and after consultation with the Registrar, make regulations in relation to the purposes and amounts of loans by societies and the conditions subject to which such loans may be made, other than conditions in relation to the rate of interest chargeable on a loan.”.
Transfer of certain land by Minister for Health to Dublin Corporation and Commissioners of Public Works.
21.—(1) In this section—
“the Commissioners” means the Commissioners of Public Works in Ireland;
“the Corporation” means the Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin;
“the Minister” means the Minister for Health.
(2) The Minister may by order—
(a) for such consideration as may be specified in the order, transfer to the Commissioners a specified part of the land acquired by him under Part III of the Saint Laurence's Hospital Act, 1943, and
(b) for such consideration as may be specified in the order, transfer to the Corporation the remainder of the said land for housing purposes.
(3) (a) An order under subsection (2) (a) of this section shall operate to vest the land described in the order in the Commissioners freed and discharged from all trusts for all the estate and interest for which such land is vested in the Minister.
(b) An order under subsection (2) (b) of this section shall operate to vest the land described in the order in the Corporation freed and discharged from all trusts for all the estate and interest for which such land is vested in the Minister.
Validation.
22.—Where—
(a) a grant or subsidy was paid by the Minister or a housing authority, being a grant or subsidy specified in a provision of this Act set out in column (2) of the Table to this section at any reference number in column (1) of the said Table on or after the date specified in column (3) of the said Table at that reference number but before the commencement of the said provision, and
(b) the grant or subsidy would have been a valid and effectual grant or subsidy, as the case may be, under the said provision if it had been paid after such commencement,
the grant or subsidy shall be as valid and effectual, and be deemed always to have been as valid and effectual, as if it had been paid after such commencement.

Repeals.
23.—(1) The enactments specified in column (2) of the Schedule to this Act are hereby repealed to the extent specified in column (3) of that Schedule.
(2) Where—
(a) an application for a grant under section 15, 16 or 18 of the Principal Act was received by the Minister or the council of a county acting on behalf of the Minister on or before the 30th day of December, 1977, and the house to which the application relates was, in the opinion of the Minister or the council, satisfactorily completed on or before the 31st day of December, 1978,
(b) works, consisting of the installation of a group water supply or group sewerage facilities or both and in respect of which a grant is payable under section 2 of the Local Government (Sanitary Services) Act, 1962, commenced on or before the 31st day of October, 1977, and are or were, in the opinion of the Minister, satisfactorily completed on or before the 31st day of December, 1979,
(c) in the case of works in respect of which a grant is payable under the said section 2, not being works of a kind referred to in paragraph (b) of this subsection, an application for a grant under that section was received by the Minister or a sanitary authority acting on behalf of the Minister on or before the 31st day of October, 1977, and the works were, in the opinion of the Minister or the sanitary authority, satisfactorily completed on or before the 31st day of December, 1978,
(d) an application for a grant under section 19, 21, 22, 23, 24 or 25 of the Principal Act was received by the Minister or the council of a county acting on behalf of the Minister on or before the 31st day of January, 1978, and the works concerned commenced on or before the 31st day of October, 1977, and were, in the opinion of the Minister or the council, satisfactorily completed before the 31st day of December, 1978, or
(e) an application for a grant under section 26, 27, 28, 29, 30, 31 or 32 of the Principal Act or section 3 of the Local Government (Sanitary Services) Act, 1962, is received by the appropriate housing authority or sanitary authority on or before the 31st day of December, 1979,
and, but for subsection (1) of this section, the grant would fall to be paid, then, notwithstanding that subsection, the grant may be paid provided that the application for the payment of the grant is received by the Minister or the appropriate housing authority or sanitary authority, as the case may be, on or before the 31st day of January, 1980.
(3) A regulation made under a provision repealed by this section and in force immediately before the commencement of this section shall, insofar as it could have been made under a corresponding provision of this Act, continue in force after such commencement as if it had been made under the corresponding provision of this Act and may be amended or revoked accordingly.
(4) In this section “sanitary authority” means a sanitary authority for the purposes of the Local Government (Sanitary Services) Acts, 1878 to 1964.
Short title, collective citation, construction and commencement.
24.—(1) This Act may be cited as the Housing (Miscellaneous Provisions) Act, 1979.
(2) The Housing Acts, 1966 to 1970, and this Act may be cited together as the Housing Acts, 1966 to 1979, and shall be construed together as one Act.
(3) This Act, save as is otherwise expressly provided for therein, shall come into operation on such day or days as, by order or orders made by the Minister under this section, may be fixed therefor either generally or with reference to any particular purpose or provision and different days may be so fixed for different purposes and different provisions.

(2) Sula ndéanfaidh an tAire rialacháin faoin alt seo, rachaidh sé i gcomhairle leis an Aire Airgeadais agus le hAire na Seirbhíse Poiblí agus le húdarás tithíochta lena mbainfidh na rialacháin.
(3) Féadfaidh rialacháin faoin alt seo cibé forálacha a bheith iontu a mheasfaidh an tAire is gá nó is fóirsteanach chun críocha an ailt, lena n-áirítear forálacha i ndáil leis an dliteanas costais riaracháin a íoc a thabhaigh údarás tithíochta faoin alt.
Deontais ón Aire le haghaidh caiteachais comhlachtaí áirithe.
3.—(1) Féadfaidh an tAire, le toiliú an Aire Airgeadais, deontas a íoc as airgead a sholáthróidh an tOireachtas i leith chaiteachais riaracháin agus chaiteachais ghinearálta comhlacht lena mbaineann an t-alt seo agus a bheidh ceadaithe ag an Aire chun críocha an ailt seo.
(2) Baineann an t-alt seo le comhlacht a dhéanann ionadaíocht do chomhar-ghrúpaí nó do chomhlachais shaorálacha ar cuspóir dóibh tithe a sholáthar nó a thionscnaíonn foirmiú na ngrúpaí nó na gcomhlachas sin.

Deontais ón Aire chun tithe nua a sholáthar.
4.—(1) Féadfaidh an tAire, le toiliú an Aire Airgeadais agus faoi réir cibé rialacháin a dhéanfaidh an tAire chun críocha an ailt seo, deontas a íoc as airgead a sholáthróidh an tOireachtas le duine a sholáthróidh teach nua más rud é—
(a) i gcás an duine do cheannach an tí, nach ndearnadh conradh don cheannach roimh an 27ú lá de Bhealtaine, 1977, agus
(b) i gcás an duine do thógáil an tí, nach raibh an dúshraith críochnaithe roimh an 27ú lá de Bhealtaine, 1977.
(2) Féadfar, go háirithe, le rialacháin faoin alt seo, ach gan dochar do ghinearáltacht fho-alt (1) den alt seo, socrú a dhéanamh i ndáil le gach ní nó le haon ní nó nithe díobh seo a leanas:
(a) méid deontais,

(2) Féadfaidh údarás tithíochta, le toiliú an Aire agus an Aire Airgeadais agus faoi réir cibé rialacháin a dhéanfaidh an tAire chun críocha an ailt seo, cúnamh comhchineáil (i modh ábhair thógála nó saothair nó aon chúnaimh eile) a thabhairt do dhuine i leith oibreacha feabhsúcháin a bheidh á ndéanamh ag an duine.
(3) Féadfar, go háirithe, le rialacháin faoin alt seo, ach gan dochar do ghinearáltacht fho-alt (1) den alt seo, socrú a dhéanamh i ndáil le gach ní nó le haon ní nó nithe dá dtagraítear in ailt 4 (2) agus 5 (2) den Acht seo.
(4) Ní dhéanfar, gan toiliú an Aire, rialacháin faoin alt seo, a mhéid a bhaineann siad le deontas a íocfaidh údarás tithíochta i leith teach ar íoc Aire na Gaeltachta deontas ina leith roimhe sin.
(5) Féadfaidh an tAire, le toiliú an Aire Airgeadais agus faoi réir cibé rialacháin a dhéanfaidh an tAire chun críocha an ailt seo, ranníoc a thabhairt, as airgead a sholáthróidh an tOireachtas, i leith aon chaiteachas a thabhóidh an t-údarás tithíochta faoin alt seo.
(6) Ní íocfaidh údarás tithíochta deontas ná ní thabharfaidh sé aon chabhair eile, faoin alt seo, mura gcomhlíonfaidh an teach nó na hoibreacha is ábhar don deontas nó don chabhair, ar bheith críochnaithe dó nó dóibh, cibé coinníollacha, más ann, a chinnfidh an tAire ó am go ham chun críocha an ailt seo i ndáil le caighdeáin fhoirgníochta tithe agus an soláthar uisce, séarachais agus seirbhísí eile iontu.
(7) Féadfaidh údarás tithíochta cibé coinníollacha is oiriúnach leo a fhorchur i ndáil le deontas a íoc nó cabhair eile a thabhairt faoin alt seo.
(8) Bainfidh alt 38 den Phríomh-Acht (trínar féidir deontais áirithe a íoc d'ainneoin nár comhlíonadh forálacha a rinneadh de réir nó faoi réim reachtaíochta) le deontas nó le haon chúnamh ó údarás tithíochta faoin alt seo mar a bhaineann sé le deontas dá dtagraítear san alt sin.
Deontais ón Aire le haghaidh tithe do dhaoine scothaosta agus do dhaoine eile.
7.—(1) Féadfaidh an tAire, le toiliú an Aire Airgeadais agus faoi réir cibé rialacháin a dhéanfaidh an tAire chun críocha an ailt seo, deontas a íoc, as airgead a sholáthróidh an tOireachtas, le comhlacht a bheidh ceadaithe ag an Aire, a sholáthróidh (trí thógáil, ceannach, oibreacha feabhsúcháin nó comhshó) teach amháin nó níos mó mar chóiríocht do dhaoine scothaosta, nó mar chóiríocht, chun bheith ina maighne, do dhuine a sholáthraíonn seirbhísí leasa nó airígh do dhaoine scothaosta den sórt sin.
(2) Féadfar, go háirithe, le rialacháin faoin alt seo, ach gan dochar do ghinearáltacht fho-alt (1) den alt seo, socrú a dhéanamh i ndáil le gach ní nó le haon ní nó nithe dá dtagraítear in ailt 4 (2) agus 5 (2) den Acht seo.
(3) Ní íocfar deontas faoin alt seo mura gcomhlíonfaidh an teach nó na hoibreacha is ábhar don deontas, ar bheith críochnaithe dó nó dóibh, cibé coinníollacha, más ann, a chinnfidh an tAire ó am go ham chun críocha an ailt seo i ndáil le caighdeáin fhoirgníochta tithe agus an soláthar uisce, séarachais agus seirbhísí eile iontu.
Iasachtaí ó údaráis tithíochta chun tithe a fheabhsú.
8.—(1) Féadfaidh údarás tithíochta, le toiliú an Aire agus an Aire Airgeadais agus faoi réir cibé rialacháin a dhéanfaidh an tAire chun críocha an ailt seo, iasacht a thabhairt do dhuine a dhéanfaidh oibreacha feabhsúcháin ar theach.
(2) Faoi réir fho-alt (3) den alt seo, déanfar aisíoc iasachta faoin alt seo i leith tí a urrú—
(a) le hionstraim ag dílsiú úinéireacht an tí don údarás tithíochta faoi réir ceart fuascailte a bheith ag an iasachtaí,
(b) tríd an teach a mhuirearú faoin Acht um Chlárú Teidil, 1964, le haisíoc na hiasachta (mar aon leis an ús is iníoctha uirthi),
(c) tríd an deimhniú talún a eisíodh faoin Acht sin i ndáil leis an teach a thaisceadh leis an údarás tithíochta, nó
(d) i gcás ina mbeidh an úinéireacht sin dílsithe cheana féin do dhuine seachas an t-iasachtaí faoi réir ceart fuascailte a bheith ag an iasachtaí, trí ionstraim mhuirir bhreise ag muirearú aisíoc na hiasachta (mar aon leis an ús is iníoctha uirthi) faoin alt seo ar an teach agus ag cur an chirt fhuascailte sin freisin faoi réir aisíoc na hiasachta (mar aon leis an ús is iníoctha uirthi) faoin alt seo.
(3) Mura mó iasacht atá le tabhairt faoin alt seo ná cibé méid a fhorordófar ó am go ham chun críocha an fho-ailt seo, féadfaidh an luaitear i bhfo-alt (2) den alt seo a iarraidh.
(4) Féadfar, go háirithe, le rialacháin faoin alt seo, ach gan dochar do ghinearáltacht fho-alt (1) den alt seo, socrú a dhéanamh i ndáil le gach ní nó le haon ní nó nithe díobh seo a leanas:
(a) méid iasachta,
(b) ceanglais i ndáil le hoiriúnacht an tí áirithe lena fheabhsú,
(c) áitiú an tí,
(d) ceanglais i ndáil le cineál agus cuspóir na n-oibreacha feabhsúcháin, agus
(e) ceanglais i ndáil le himthosca airgeadais agus teaghlaigh an duine a bhfuil an iasacht á tabhairt dó.
(5) Ní thabharfar iasacht faoin alt seo mura gcomhlíonfaidh an teach is ábhar don iasacht, ar na hoibreacha áirithe a bheith críochnaithe, cibé coinníollacha, más ann, a chinnfidh an tAire ó am go ham chun críocha an ailt seo i ndáil le caighdeáin fhoirgníochta tithe agus an soláthar uisce, séarachais agus seirbhísí eile iontu.
(6) Aon suim a bheidh dlite do údarás tithíochta ó aon duine i leith iasacht a tugadh faoin alt seo féadfaidh an t-údarás, gan dochar d'aon chumhacht eile chuige sin, í a ghnóthú ón duine sin mar fhiach conartha shimplí in aon chúirt dlínse inniúla.
(7) San alt seo, ciallaíonn “úinéireacht” an leas sin nó an cónasc leasanna sin i dteach a thugann gur leas feo simplí i seilbh é nó gur leas léasach (lena n-áirítear deontas feofheirme) i seilbh é ar feadh an méid sin blianta a bheidh gan chaitheamh ar an dáta a ndéanfaidh an t-údarás tithíochta an iasacht faoin alt seo i leith an tí a údarú agus is comhionann leis an téarma nó is mó ná an téarma a shocrófar chun an iasacht a aisíoc.

9.—Féadfaidh an tAire, le toiliú an Aire Airgeadais agus faoi réir cibé rialacháin a dhéanfaidh an tAire chun críocha an ailt seo, fóirdheontas ina mbeidh cibé méid a chinnfidh sé a íoc le húdarás tithíochta, as airgead a sholáthróidh an tOireachtas, i leith na muirear iasachtaí bliantúil a thabhaigh an t-údarás ag soláthar láithreáin chun teach a thógáil (seachas ag údarás tithíochta nó d'údarás tithíochta).
Fóirdheontais ón Aire le haghaidh tithe a sholáthraigh údaráis tithíochta lena ligean.
10.—(1) (a) Féadfaidh an tAire, i leith na tréimhse dar thosach an 1ú lá d'Aibreán, 1973, agus dar chríoch an 31ú lá de Nollaig, 1976, le toiliú an Aire Airgeadais, fóirdheontas ina mbeidh cibé méid a chinnfidh sé a íoc as airgead a sholáthróidh an tOireachtas i leith an chaiteachais a thabhaigh údarás tithíochta—
(i) maidir le hairgead a fuair an t-údarás ar iasacht chun teach a sholáthar lena ligean is teach nár íocadh deontas ina leith faoi alt 15 den Phríomh-Acht, agus
(ii) maidir le cothabháil, bainistí agus feabhsú tí den sórt sin.
(b) Beidh fóirdheontas faoin bhfo-alt seo faoi réir cibé coinníollacha, más ann, a shonróidh an tAire agus, gan dochar do ghinearáltacht a bhfuil anseo roimhe seo, féadfaidh go mbeidh ar áireamh na gcionníollacha coinníollacha i ndáil le cíos, ceannach an tí áirithe, caighdeáin fhoirgníochta, ranníocaí ón údarás tithíochta áirithe i leith an chaiteachais a bheidh i gceist agus i leith an chaiteachais ar chothabháil, bainistí agus feabhsú an tí áirithe.
(2) Féadfaidh an tAire, maidir leis an mbliain airgeadais 1977 agus blianta airgeadais dá éis sin, le toiliú an Aire Airgeadais agus faoi réir cibé rialacháin a dhéanfaidh an tAire chun críocha an ailt seo, fóirdheontas a íoc le húdarás tithíochta, as airgead a sholáthróidh an tOireachtas, nach mó ná méid is ionann agus méid na muirear iasachtaí bliantúil a thabhaigh an t-údarás—
(a) maidir le teach a sholáthar lena ligean agus le fo-oibreacha i ndáil leis an teach sin,
(b) maidir le talamh a fháil chun an t-údarás do sholáthar tithe lena ligean ag an údarás, agus
(c) maidir le hoibreacha a rinneadh i ndáil le tithe críochnaithe a soláthraíodh faoi alt 56 den Phríomh-Acht, agus ar oibreacha iad, ag féachaint do na himthosca eisceachtúla a thug gur ghá iad, a cheadaigh an tAire an 31ú lá de Nollaig, 1977, nó roimh an lá sin.
(3) Féadfar, go háirithe, le rialacháin faoin alt seo, ach gan dochar do ghinearáltacht fho-alt (2) den alt seo, socrú a dhéanamh i ndáil le gach ní nó le haon ní nó nithe díobh seo a leanas:
(a) cíos an tí áirithe,
(b) ceannach an tí agus an t-údarás tithíochta d'úsáid fáltas an cheannaigh sin,
(c) ranníocaí ón údarás tithíochta i leith an chaiteachais áirithe,
(d) caiteachas ar chothabháil, bainistí agus feabhsú an tí, agus
(e) ceanglais i ndáil le haon deontas nó fóirdheontas eile a íoc i leith an tí faoi aon achtachán (lena n-áirítear an tAcht seo).
(4) Ní íocfar fóirdheontas faoin alt seo mura gcomhlíonfaidh an teach nó na hoibreacha is ábhar don fhóirdheontas, ar bheith críochnaithe dó nó dóibh, cibé coinníollacha, más ann, a chinnfidh an tAire ó am go ham chun críocha an ailt seo i ndáil le caighdeáin fhoirgníochta tithe agus oibreacha agus an soláthar uisce, séarachais agus seirbhísí eile i dtithe.
(5) Féadfar, le toiliú an Aire Airgeadais, fóirdheontas faoi fho-alt (2) den alt seo a thabhairt don údarás tithíochta áirithe nó don duine a thug an iasacht ar tabhaíodh na táillí iasachta áirithe ina leith.
(6) Féadfaidh Coimisinéirí na nOibreacha Poiblí in Éirinn, le toiliú an Aire Airgeadais, airgead a dhíscríobh is iníoctha leis na Coimisinéirí ag údaráis tithíochta i leith iasachtaí a thug na Coimisinéirí do na húdaráis chun tithe a sholáthar.
Fóirdheontais ón Aire agus ó údaráis tithíochta chun tithe a cheannach nó a fhoirgniú
11.—(1) (a) Féadfaidh an tAire, le toiliú an Aire Airgeadais agus faoi réir cibé rialacháin a dhéanfaidh an tAire chun críocha an ailt seo, fóirdheontas a íoc le húdarás tithíochta as airgead a sholáthróidh an tOireachtas i gcás an t-údarás—
(i) do thabhairt iasacht faoi alt 39 den Phríomh-Acht, nó
(ii) do dhíol tí faoi alt 90 den Phríomh-Acht le duine nach é tionónta an tí é i gcás an t-airgead ceannaigh a bheith iníoctha i dtráthchodanna.
(b) I gcás an tAire d'íoc fóirdheontais faoin bhfo-alt seo le húdarás tithíochta, déanfaidh an t-údarás méid aisíocaíochtaí na hiasachta áirithe nó tráthchodanna iomchuí an airgid cheannaigh áirithe, cibé acu é, a laghdú méideanna arb ionann a n-iomlán agus méid an fhóirdheontais.
(2) (a) I gcás údarás tithíochta—
(i) do thabhairt iasacht faoi alt 39 den Phríomh-Acht, nó
(ii) do dhíol tí faoi alt 90 den Phríomh-Acht le duine nach é tionónta an tí é agus go mbeidh an t-airgead ceannaigh iníoctha i dtráthchodanna,
féadfaidh an t-údarás, le toiliú an Aire agus an Aire Airgeadais agus faoi réir cibé rialacháin a dhéanfaidh an tAire chun críocha an ailt seo, fóirdheontas forlíontach nach mó ná méid fóirdheontais faoi fho-alt (1) den alt seo a íoc leis an duine a dtabharfar an deontas dó nó a ndíolfar an teach leis, cibé acu é, i leith an chaiteachais a thabhaigh sé i ndáil leis an idirbheart lena mbaineann an iasacht nó an díol.
(b) Íocfar fóirdheontas faoin bhfo-alt seo trí aisíocaíochtaí iomchuí na hiasachta áirithe nó tráthchodanna iomchuí an airgid cheannaigh áirithe, cibé acu é, a laghdú méideanna arb ionann a n-iomlán agus méid an fhóirdheontais.
(3) Féadfar, go háirithe, le rialacháin faoin alt seo, ach gan dochar do ghinearáltacht fho-ailt (1) agus (2) den alt seo, socrú a dhéanamh i ndáil le gach ní nó le haon ní nó nithe díobh seo a leanas:
(a) méid fóirdheontais faoi fho-alt (1) den alt seo,
(b) toirmeasc a chur le híoc fóirdheontais faoin alt seo le duine a ndearnadh fóirdheontas faoin alt seo a íoc roimhe sin leis féin nó lena chéile,
(c) ceanglas á chur faoi deara—
(i) ar theach a dhíol ag duine ar tugadh iasacht dó nó a ndearnadh díol leis i leith an tí sin is iasacht nó díol a shonraítear i bhfo-alt (1) den alt seo,
(ii) ar theach dá dtagraítear san alt seo a léasú, a ligean nó a aistriú chuig duine seachas céile, tuismitheoir, mac nó iníon duine den sórt sin mar a dúradh, nó
(iii) ar iasacht faoi alt 39 den Phríomh-Acht a fhuascailt nó ar an airgead ceannaigh, i ndáil le díol faoi alt 90 den Phríomh-Acht, a íoc,
laistigh de thréimhse shonraithe tar éis fóirdheontas faoin alt seo a íoc i ndáil leis an iasacht nó leis an díol áirithe, cibé acu é, go n-íocfaidh an duine leis an údarás tithíochta suim shonraithe nach mó ná méid an fhóirdheontais nó na bhfóirdheontas, agus go n-íocfaidh an t-údarás leis an Aire suim shonraithe nach mó ná méid an fhóirdheontais a íocadh faoi fho-alt (1) den alt seo.
Fóirdheontais ón Aire i leith iasachtaí áirithe arna ráthú ag údaráis tithíochta.
12.—Féadfaidh an tAire, le toiliú an Aire Airgeadais agus faoi réir cibé rialacháin a dhéanfaidh an tAire chun críocha an ailt seo, fóirdheontas a íoc, as airgead a sholáthróidh an tOireachtas, le cumann foirgníochta i leith ús is iníoctha d'aon tréimhse dar tosach an 1ú lá de Mheitheamh, 1977, nó aon lá dá éis, ar iasacht a thug nó a thabharfaidh an cumann chun teach a sholáthar agus a bhí nó atá ráthaithe ag údarás tithíochta faoi alt 42 den Phríomh-Acht.
Dualgas ar údaráis tithíochta in imthosca áirithe tithe a chur i ndeisriocht déanmhais.
13.—(1) I gcás a mbeartóidh údarás tithíochta ordú dílseacháin a dhéanamh faoi alt 17 d'Acht na Sclábhaithe, 1936, nó ordú aistriúcháin a dhéanamh faoi alt 90 den Phríomh-Acht ag dílsiú tí do thionónta an tí sin i bhfeo simplí agus nach mbeidh an teach i ndeisriocht déanmhais, déanfaidh an t-údarás, faoi réir fho-alt (2) den alt seo, sula ndéanfaidh sé an t-ordú, cibé oibreacha a dhéanamh is gá chun an teach a chur i ndeisriocht déanmhais.
(2) I gcás a mbeartóidh údarás tithíochta ordú a thuairiscítear i bhfo-alt (1) den alt seo a dhéanamh agus nach mbeidh an teach áirithe i ndeisriocht déanmhais, féadfaidh an t-údarás an t-ordú a dhéanamh gan cibé oibreacha is gá a dhéanamh chun an teach a chur i ndeisriocht déanmhais má bhíonn comhaontú i scríbhinn déanta ag an údarás agus ag tionónta an tí—
(a) go ndéanfaidh an tionónta, nó go gcuirfidh sé faoi deara go ndéanfar, laistigh d'am sonraithe tar éis an t-ordú a dhéanamh, oibreacha sonraithe i ndáil leis an teach, ar oibreacha iad is gá, i dtuairim an údaráis agus an tionónta, chun an teach a chur i ndeisriocht déanmhais,
(b) go n-íocfaidh an t-údarás leis an tionónta suim shonraithe nach mó ná an méid a measfaidh an t-údarás gurb é costas na n-oibreacha sonraithe é, ar na hoibreacha a bheith críochnaithe chun sástacht an údaráis laistigh den am sonraithe nó de cibé am breise, más ann, a cheadóidh an t-údarás,
(c) go dtabharfaidh an t-údarás, ar bheith sásta dóibh gur críochnaíodh na hoibreacha sonraithe go cuí, deimhniú don tionónta á rá go bhfuil siad sásta amhlaidh,
(d) má mhainníonn an tionónta na hoibreacha sonraithe a chríochnú chun sástacht an údaráis laistigh den am sonraithe, nó de cibé am breise, más ann, a cheadóidh an t-údarás, go ndéanfaidh an t-údarás na hoibreacha nó cibé cuid díobh nach mbeidh déanta agus go mbainfidh siad as an tsuim a bheadh, mura mbeadh sin, le híoc acu leis an tionónta de bhun mhír (b) den fho-alt seo costais réasúnacha aon oibreacha den sórt sin a rinne siad,
(e) go bhféadfaidh an tionónta, tráth nach luaithe ná tosach feidhme an chomhaontaithe agus nach déanaí ná deireadh na tréimhse 21 lá dar tosach an lá a thabharfaidh an t-údarás íocaíocht don tionónta faoin alt seo, agus faoi réir fho-alt (8) den alt seo, a iarraidh ar an Aire cinneadh a dhéanamh i ndáil le haon amhras, díospóid nó ceist i dtaobh téarmaí an chomhaontaithe a bheith comhlíonta ag an údarás, agus déanfaidh an tAire an t-amhras, an díospóid nó an cheist a chinneadh, agus
(f) go gcomhlíonfaidh an t-údarás cibé ordacháin, más ann, a shonróidh an tAire i gcinneadh faoi mhír (e) den fho-alt seo i ndáil le téarmaí an chomhaontaithe a bheith comhlíonta ag an údarás.
(3) Má bhíonn comhaontú faoi fho-alt (2) den alt seo déanta ag údarás tithíochta i ndáil le teach, ní dhéanfaidh an t-údarás, gan dochar d'aon chumhacht eile toiliú a choimeád siar, i gcás nach féidir an teach a choimhthiú gan toiliú an údaráis, a dtoiliú a thabhairt leis an teach a choimhthiú mura mbeidh deimhniú mar a thuairiscítear i mír (c) den fho-alt sin tugtha acu i ndáil leis an teach nó mura mbeidh cinnte ag an Aire, i bhfeidhmiú a chumhachta faoi mhír (e) den fho-alt sin, go bhfuil na hoibreacha sonraithe críochnaithe go cuí.
(4) Ní íocfar deontas faoi alt 5 nó 6 den Acht seo chun oibreacha a shonraítear i gcomhaontú faoi fho-alt (2) den alt seo a dhéanamh.
(5) I gcás údarás tithíochta do dhéanamh ordú den sórt a thuairiscítear i bhfo-alt (1) den alt seo, tabharfaidh siad, a luaithe is féidir tar éis an t-ordú a dhéanamh, fógra don cheannaitheoir áirithe á rá go ndearnadh an t-ordú agus, i gcás comhaontú faoi fho-alt (2) den alt seo gan a bheith déanta, tabharfar sonraí san fhógra sin i dtaobh cearta an cheannaitheora faoi fho-alt (6) den alt seo.
(6) I gcás údarás tithíochta do dhéanamh ordú den sórt a thuairiscítear i bhfo-alt (1) den alt seo, agus nach mbeidh comhaontú déanta ag an údarás agus ag an gceannaitheoir áirithe faoi fho-alt (2) den alt seo i ndáil leis an teach áirithe, féadfaidh an ceannaitheoir, tráth nach déanaí ná deireadh na tréimhse 21 lá dar tosach an lá a tugadh fógra dó faoi fho-alt (5) den alt seo á rá go ndearnadh an t-ordú, a iarraidh ar an Aire cinneadh a dhéanamh i ndáil le haon amhras, díospóid nó ceist i dtaobh an teach a bheith nó gan a bheith i ndeisriocht déanmhais agus cinnfidh an tAire an t-amhras, an díospóid nó an cheist.
(7) Má chinneann an tAire faoi fho-alt (6) den alt seo nach bhfuil teach i ndeisriocht déanmhais, sonróidh sé na hoibreacha a mheasfaidh sé is gá leis an teach a chur i ndeisriocht déanmhais, agus déanfaidh an t-údarás tithíochta na hoibreacha a shonrófar amhlaidh agus ní mheasfar gur cosc ar na hoibreacha a dhéanamh ordú den sórt dá dtagraítear i bhfo-alt (1) den alt seo a bheith déanta i ndáil leis an teach ná téarmaí an ordaithe.
(8) Beidh táille ina mbeidh cibé méid a fhorordófar ó am go ham chun críocha an ailt seo ag gabháil le hiarratas faoi fho-alt (2) nó (6) den alt seo ag lorg cinneadh ón Aire.

14.—Leasaítear leis seo alt 5 den Phríomh-Acht maidir le rialacháin a dhéanfar tar éis tosach feidhme an ailt seo tríd an bhfo-alt seo a leanas a chur isteach:
“(4) Féadfaidh rialacháin faoin Acht seo é a bheith sainráite iontu go bhfuil feidhm acu go ginearálta nó maidir le limistéir shonraithe nó le limistéir, tithe, iasachtaí, daoine, oibreacha nó nithe eile d'aicme shonraithe nó d'aicmí sonraithe agus féadfaidh forálacha éagsúla de chuid rialacháin den sórt sin é a bheith sainráite iontu go bhfuil feidhm acu i ndáil le limistéir éagsúla nó le haicmí éagsúla limistéar, tithe, iasachtaí, daoine, oibreacha nó nithe eile.”.

15.—(1) Más rud é, maidir le teach nua—
(a) (i) gur thug nó go dtabharfaidh an tAire deimhniú an 1ú d'Eanáir, 1976, nó aon lá dá éis, á rá nár mhó an chomaoin i leith díol an tí ná an méid is dóigh leis an Aire gur luach réasúnach é chun críocha alt 35 (2) (a) (ii) den Phríomh-Acht, nó d'eile
(ii) gur thug nó go dtabharfaidh an tAire deimhniú ar an dáta sin nó dá éis ag ligean thar ceal ceanglas de chuid an Aire a deir nach foláir deimhniú den sórt dá dtagraítear i bhfomhír (i) den mhír seo a bheith ann i ndáil leis an teach,
agus
(b) gur thug nó go dtabharfaidh an tAire deimhniú á rá go raibh nó go bhfuil an teach críochnaithe go sásúil,
beidh feidhm, agus measfar go raibh feidhm riamh, ag alt 33 (1) den Phríomh-Acht i ndáil le luacháil athscrúdaithe an tionóntáin arb éard é nó ar cuid de an teach d'ainneoin nár íocadh deontas dá dtagraítear san alt sin i leith an tí.
(2) I gcás ar íocadh nó a n-íocfar deontas faoi alt 6 den Acht seo i leith oibreacha feabhsúcháin ar theach mar chóiríocht do dhuine atá faoi mhíchumas coirp nó faoi mhór-éislinn meabhrach, beidh feidhm, agus measfar go raibh feidhm riamh, ag alt 33 (4) den Phríomh-Acht i ndáil le luacháil an tionóntáin arb éard é nó ar cuid de an teach.
Leasú ar alt 60 den Phríomh-Acht.
16.—Leasaítear leis seo alt 60 den Phríomh-Acht tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (4):
“(4) Féadfaidh scéim faoin alt seo a shonrú—
(a) go dtabharfar tosaíochtaí áirithe d'aicmí áirithe daoine nuair a bheidh teaghaisí áirithe á ligean;
(b) d'fonn a chinneadh cén t-ord tosaíochta a bheidh le leanúint le linn teaghaisí a bheith á ligean chun daoine de réir na scéime, go bhfaighidh an t-údarás tithíochta tuarascáil ó dhochtúir oifigiúil sláinte an bhord sláinte a bunaíodh faoin Acht Sláinte, 1970, ar ina limistéar feidhme atá limistéar feidhme an údaráis tithíochta, agus go mbeidh aird acu ar an tuarascáil sin—
(i) nuair a bheidh gach uile ligean den sórt sin á dhéanamh, nó
(ii) nuair a bheidh gach uile ligean den sórt sin á dhéanamh a n-éilítear, i ndáil lena dhéanamh, tosaíocht ar fhoras arb éard é, nó ar a n-áirítear, foras liachta.”.

17.—(1) Féadfaidh an tAire—
(a) ordachán a thabhairt d'údarás tithíochta teach de chuid an údaráis de cibé aicme a shonrófar san ordachán a thairiscint chun a dhíola faoi alt 90 den Phríomh-Acht,
(b) ordachán a thabhairt d'údarás tithíochta gan teach de chuid an údaráis de cibé aicme a shonrófar san ordachán a dhíol,
(c) ordachán faoin alt seo a chúlghairm nó a leasú.
(2) Beidh feidhm, agus measfar go raibh feidhm riamh, ag alt 90 den Phríomh-Acht maidir le foirgneamh arb éard é teach agus siopa, mar aon le haon fhotheach, clós, gairdín nó talamh eile a chomhghabhann leis nó a theachtar de ghnáth ina theannta.
Deimhnithe um luach réasúnach.
18.—(1) (a) Faoi réir fho-alt (3) den alt seo agus faoi réir cibé rialacháin a dhéanfaidh an tAire chun críocha an ailt seo, féadfaidh an tAire, ar iarratas i scríbhinn ó dhuine is dóigh leis an Aire a bheith ag soláthar tí nua chun a dhíola, ach an duine do chomhlíonadh forálacha an ailt seo, deimhniú (ar a dtabharfar deimhniú um luach réasúnach agus dá ngairtear “deimhniú” san alt seo) a dheonú don duine i leith díol an tí á rá gur dóigh leis an Aire tráth an deimhnithe a dheonú agus ar bhonn na faisnéise a bhí ar fáil ag an Aire an tráth sin gur luach réasúnach ar an teach an méid a bheidh sonraithe sa deimhniú agus sonrófar ann cibé nithe eile, más ann, is iomchuí leis an Aire.
(b) Féadfaidh an tAire, ar iarratas i scríbhinn ó dhuine i ndáil le teach nua, más dóigh leis an Aire nach bhfuil an teach á sholáthar lena dhíol, deimhniú (ar a dtabharfar deimhniú díolúine) a dheonú don duine sin á rá gur dóigh sin leis an Aire.
(c) Beidh táille ina mbeidh cibé méid a fhorordófar ó am go ham chun críocha an fho-ailt seo ag gabháil le hiarratas faoin bhfo-alt seo.
(2) (a) Féadfaidh rialacháin chun críocha an fho-ailt seo na hiasachtaí lena mbaineann an fo-alt seo a shonrú, agus féadfaidh an sonrú baint le gach uile iasacht nó le hiasachtaí nach mó ná méid sonraithe nó le hiasachtaí nach lú ná méid sonraithe nó le hiasachtaí nach mó ná méid sonraithe agus nach lú ná méid sonraithe eile.
(b) Má bhíonn, agus aon uair a bheidh, rialacháin chun críocha an fho-ailt seo lena sonrófar na hiasachtaí lena mbaineann an fo-alt seo i bhfeidhm, ní thabharfaidh cuideachta árachais, banc, cumann foirgníochta ná eagraíocht thionscail nó thráchtála eile ná údarás tithíochta (dá ngairtear “an t-iasachtóir” anseo feasta) iasacht a shonrófar amhlaidh i leith tí nua mura dtabharfaidh an duine a d'iarr an iasacht deimhniú i leith díol an tí, nó deimhniú díolúine i leith an tí, don iasachtóir, agus mura gcomhlíonfar forálacha aon rialacháin chun críche an fho-ailt seo.
(c) Duine a sháróidh mír (b) den fho-alt seo beidh sé ciontach i gcion.
(3) Ní dheonóidh an tAire deimhniú i leith díol tí—
(a) más mó méid chomaoin an díola (dá ngairtear “an praghas” dá éis seo san alt seo) ná an méid is mó ar luach réasúnach é, i dtuairim an Aire, ar an teach, nó
(b) más mó an praghas ná méid a bheidh forordaithe de thuras na huaire faoi fho-alt (9) (g) den alt seo, nó
(c) má bhíonn an díol críochnaithe roimh an dáta a gheobhaidh an tAire iarratas ar an deimhniú, nó
(d) más mó méid chostas nó luach láithreán an tí a áirítear sa phraghas ná méid a bheidh forordaithe de thuras na huaire faoi fho-alt (9) (h) den alt seo.
(4) (a) Féadfaidh an tAire diúltú deimhniú a dheonú in aon chás ar mó méid chostas nó luach láithreán tí a áirítear sa phraghas ná an méid ar luach réasúnach é, i dtuairim an Aire, ar an láithreán.
(b) Chun críocha mhír (a) den fho-alt seo, féadfaidh an tAire, ar iarratas i scríbhinn ó dhíoltóir nó ó cheannaitheoir láithreán tí, a thabhairt le fios i scríbhinn, roimh iarratas ar dheimhniú a fháil, an dóigh nó nach dóigh leis an Aire gur luach réasúnach méid áirithe a bheartaítear a bheith ar áireamh sa phraghas mar chostas nó mar luach ar an láithreán.
(5) (a) I gcás a gcinnfidh an tAire faoi fho-alt (3) (a) nó (4) (a) den alt seo gan deimhniú a dheonú, cuirfidh sé a chinneadh in iúl i scríbhinn don duine a d'iarr an deonú sin agus féadfaidh an duine sin, laistigh de thréimhse 21 lá dar tosach an dáta a chuirfear an cinneadh in iúl dó, achomharc a dhéanamh chun na Cúirte Cuarda in aghaidh an chinnidh agus féadfaidh an Chúirt sin, ar an achomharc a éisteacht, de réir mar is cuí léi, an cinneadh a dhaingniú nó a ordú don Aire an deimhniú a dheonú.
(b) Tabharfar fógra i dtaobh achomharc faoin alt seo don Aire agus beidh oifigeach don Aire i dteideal láithriú agus éisteacht a fháil nuair a bheidh an t-achomharc á éisteacht.
(c) Ní bheidh aon ábhar achomhairc in aghaidh cinneadh ón gCúirt Chuarda ar achomharc a dhéanamh faoin bhfo-alt seo.
(6) Féadfaidh an tAire, ar iarratas i scríbhinn ó dhuine dar deonaíodh deimhniú faoi fho-alt (1) (a) den alt seo, nó ó aon duine eile ar dóigh leis an Aire, tráth an iarratais a dhéanamh, go bhfuil teach dá dtagraítear i ndeimhniú á sholáthar aige, an deimhniú a chúlghairm agus deimhniú eile a dheonú i dtéarmaí atá éagsúil leis an deimhniú céadluaite i leith an díola lenar bhain an deimhniú céadluaite.
(7) (a) Mar thaca le hiarratas chun an Aire á iarraidh air deimhniú nó deimhniú díolúine a dheonú tabharfar cibé faisnéis a éileoidh an tAire chun críocha a fheidhmeanna faoin alt seo i ndáil leis an deonú.
(b) Duine a thabharfaidh don Aire faoin alt seo faisnéis atá bréagach nó míthreorach beidh sé ciontach i gcion.
(8) (a) Beidh de dhualgas ar dhuine a ndeonófar deimhniú dó i leith díol tí a áirithiú nach ísle na caighdeáin, ná nach lú luach na gcaighdeán, i ndáil leis na nithe seo a leanas—
(i) dearadh, sonraíocht, foirgniú agus bailchríoch an tí,
(ii) cineál agus cáilíocht na n-ábhar a úsáideadh ag foirgniú an tí agus ag cur bailchríoch air,
(iii) achar urláir iomlán an tí, arna dtomhas ar cibé slí a chinnfidh an tAire ó am go ham,
(iv) cibé daingneáin, feistis nó nithe eile a áirítear leis an teach sa díol, a ndearadh, a monarú agus a mbailchríoch agus a gcineál agus a gcáilíocht, agus
(v) feistiú nó suiteáil na ndaingneán, na bhfeisteas agus na nithe réamhráite,
ná na caighdeáin a bheidh sonraithe, go sainráite nó trína dtabhairt le tuiscint, ag an duine don Aire faoi fho-alt (7) den alt seo.
(b) Beidh de dhualgas ar dhuine a ndeonófar deimhniú dó i leith díol tí, agus ar cheannaitheoir an tí le linn an díola sin, a áirithiú nach mó an praghas a ghearrfar nó a íocfar i leith an díola, cibé acu é, ná an méid a bheidh sonraithe sa deimhniú, agus an méid sin a athrú, más iomchuí, chun go gcuirfear san áireamh an costas breise, nó an choigilt, is réasúnach, a thiocfaidh as aon athrú—
(i) ar na caighdeáin dá dtagraítear i mír (a) den fho-alt seo nó i ndáil leis na nithe dá dtagraítear i bhfomhíreanna (i) go (v) den mhír sin, nó
(ii) má luaitear sa deimhniú go bhfuil an praghas réamhráite faoi réir athrú, ar chostas an teach agus aon daingneáin, feistis nó nithe eile a áireofar i ndíol an tí a sholáthar.
(c) Duine a sháróidh mír (a) nó (b) den fho-alt seo beidh sé ciontach i gcion.
(9) Gan dochar do ghinearáltacht fho-ailt (1) agus (2) den alt seo, féadfaidh rialacháin faoin alt seo socrú a dhéanamh i ndáil le gach ní nó le haon ní nó nithe díobh seo a leanas:
(a) ceanglais i ndáil le hiarratas chun an Aire ar dheimhniú nó ar dheimhniú díolúine nach foláir don duine a rinne an t-iarratas a chomhlíonadh,
(b) coinníollacha a mbeidh deonú deimhnithe faoina réir,
(c) ceanglais i dtaobh achar urláir iomlán theach lena mbaineann deimhniú,
(d) coinníollacha nó clásail i gconradh chun teach a dhíol a mbaineann deimhniú leis ag déanamh socrú don athrú ar an bpraghas i gcóir an díola,
(e) ceanglais i ndáil le hábhar fógraí agus a dtaisealbhadh le hais nó i gcóngar tithe nó láithreáin mar a bhfuil tithe á soláthar nó le soláthar, ar tithe nó tithe beartaithe iad lena mbaineann deimhnithe,
(f) ceanglais i ndáil le hiniúchadh tithe agus láithreán ag oifigigh don Aire,
(g) an méid arb é an praghas is mó é a fhéadfaidh an tAire a shonrú i ndeimhniú, agus
(h) an méid arb é an méid is mó é a fhéadfaidh an tAire a ríomh i leith chostas nó luach láithreán tí le linn iarratas ar dheimhniú a bheith á chinneadh.
(10) (a) Gan dochar d'aon phionóis a fhéadfar a ghearradh faoin alt seo, féadfaidh an tAire, dá rogha féin, in aon chás ar deimhin leis gur thug duine dar deonaíodh deimhniú fais néis faoi fho-alt (7) (a) den alt seo atá bréagach nó míthreorach nó gur sháraigh sé mír (a) nó (b) d'fho-alt (8) den alt seo, nó coinníoll ar deonaíodh an deimhniú faoina réir, ceachtar díobh seo a leanas nó iad araon a dhéanamh, is é sin le rá:
(i) an deimhniú ar tharla an sárú ina leith a chúlghairm,
(ii) diúltú deimhniú a dheonú go ceann cibé tréimhse is iomchuí leis (ach nach faide ná cúig bliana ón dáta a tugadh fógra don duine faoi mhír (b) den fho-alt seo) don duine nó do dhuine a bhfuil baint aige leis (déanfar aon cheist i dtaobh baint a bheith ag duine le duine eile a chinneadh, chun críocha an fho-ailt seo, de réir alt 96 (3) den Acht Cánach Ioncaim, 1967, fara an modhnú go bhforléireofar tagairtí san alt sin 96 (3) do rialú i ndáil le cuideachta mar thagairtí d'úinéireacht 20 faoin gcéad ar a laghad i luach ainmniúil de scairchaipiteal na cuideachta).
(b) Sula bhfeidhmeoidh an tAire cumhacht faoin bhfo-alt seo, tabharfaidh sé fógra i scríbhinn don duine áirithe go bhfuil ar intinn aige sin a dhéanamh agus tabharfaidh sé sonraí san fhógra i dtaobh chineál an fheidhmithe sin agus na fáthanna leis agus breithneoidh sé aon uiríolla ón duine áirithe má fhaigheann an tAire iad tráth nach déanaí ná deireadh na tréimhse 21 lá dar tosach an lá a thabharfar fógra dó faoin mír seo.
(c) Le linn don Aire bheith ag feidhmiú cumhachta faoin bhfo-alt seo, tabharfaidh sé fógra don duine áirithe i dtaobh a chinnidh.
(d) Féadfaidh duine, laistigh de thréimhse trí mhí dar tosach an dáta a gheobhaidh sé cinneadh an Aire faoi mhír (a) den fho-alt seo, nó a thuairim faoi fho-alt (16) den alt seo, achomharc a dhéanamh chun na hArd-Chúirte in aghaidh an chinnidh nó na tuairime agus féadfaidh an Ard-Chúirt, le linn an achomhairc sin, an cinneadh nó an tuairim sin a dheimhniú, a fhreaschur nó a athrú.
(11) (a) Ní bhrionnóidh duine doiciméad a airbheartaíonn a bheith ina dheimhniú nó ina dheimhniú díolúine.
(b) Ní dhéanfaidh duine, le hintinn mheabhlaireachta, deimhniú nó deimhniú díolúine a athrú ná a úsáid.
(c) Duine a sháróidh an fo-alt seo beidh sé ciontach i gcion.
(12) I gcás—
(a) duine dar deonaíodh deimhniú do shárú coinníoll faoinar deonaíodh é, nó
(b) duine do shárú rialachán faoin alt seo,
beidh sé ciontach i gcion.
(13) Más rud é, i gcás cion a rinne aon duine faoin alt seo, gur gníomh nó mainneachtain ag duine éigin eile is siocair lena dhéanamh, beidh an duine eile sin ciontach freisin sa chion agus féadfar é a chúiseamh agus é a chiontú sa chion de bhua an fho-ailt seo cibé acu a thionscnófar nó nach dtionscnófar imeachtaí i gcoinne an duine chéadluaite.
(14) (a) In aon imeachtaí maidir le cion faoin alt seo (seachas fo-alt (11)) is cosaint é, faoi réir mhír (b) den fho-alt seo, don duine a cúisíodh a chruthú—
(i) gur dhearmad nó gur ghníomh nó mainneachtain ag duine eile nó gur mhuinín a chur i bhfaisnéis a sholáthraigh duine eile dó, nó gur thionóisc nó cúis éigin eile nach raibh neart aige air, ba shiocair leis an gcion a dhéanamh, agus
(ii) gur ghlac sé gach réamhchúram ba réasúnach agus gur chaith sé gach dúthracht ba chuí nach ndéanfadh sé féin ná aon duine eile faoina cheannas cion den sórt sin.
(b) In aon chás a líomhnófar sa chosaint dá bhforáiltear le mír (a) den fho-alt seo gur ghníomh nó mainneachtain ag duine eile nó gur mhuinín a chur i bhfaisnéis a sholáthraigh duine eile ba shiocair leis an gcion a dhéanamh, ní bheidh an duine a chúiseofar i dteideal, gan cead ón gcúirt, muinín a chur sa chosaint sin, mura mbeidh, tráth nach luaithe ná seacht lá glan roimh an éisteacht, fógra i scríbhinn seirbheáilte aige ar an ionchúisitheoir ag tabhairt cibé faisnéis a bhí ina sheilbh an tráth sin d'aithint an duine sin nó chun cabhrú lena aithint.
(15) (a) Duine a bheidh ciontach i gcion faoin alt seo dlífear ar é a chiontú ar díotáil fíneáil nach mó ná £10,000 a chur air.
(b) Beidh dlínse ag Breitheamh den Chúirt Dúiche cion faoin alt seo a thriail go hachomair—
(i) más é tuairim an Bhreithimh gur mionchion is intriailte go hachomair na fíorais a cruthaíodh nó a líomhnaíodh i gcoinne cosantóir a bheidh cúisithe i gcion den sórt sin,
(ii) má thoilíonn an Stiúrthóir Ionchúiseamh Poiblí, agus
(iii) mura ndéanfaidh an cosantóir (ar an mBreitheamh á chur in iúl dó go bhfuil de cheart aige go dtrialfadh giúiré é) agóid i gcoinne é a thriail go hachomair,
agus, ar é a chiontú faoin mír seo, dlífear fíneáil nach mó ná £500 a chur ar an gcosantóir sin.
(c) Beidh feidhm ag alt 13 den Acht um Nós Imeachta Coiriúil, 1967, i ndáil le cion faoin alt seo ionann is dá ndéanfaí, in ionad na bpionós a shonraítear i bhfo-alt (3) den alt sin, an pionós dá bhforáiltear le mír (b) den fho-alt seo a shonrú ann, agus déanfar an tagairt i bhfo-alt (2) (a) den alt sin do na pionóis dá bhforáiltear i bhfo-alt (3) den alt sin a fhorléiriú dá réir sin.
(16) San alt seo—
tá le “cuideachta árachais” an bhrí a shanntar dó leis na hAchtanna Árachais, 1909 go 1978;
ciallaíonn “banc” sealbhóir ar cheadúnas faoi alt 9 d'Acht an Bhainc Ceannais, 1971, nó banc taisce iontaobhais arna dheimhniú faoi na hAchtanna um Bainc Thaisce Iontaobhais, 1863 go 1979;
ciallaíonn “cuideachta” cuideachta de réir bhrí alt 2 d'Acht na gCuideachtaí, 1963, nó cuideachta a corpraíodh lasmuigh den Stát;

(i) is coinníoll leis an díol an comhaontú sin a dhéanamh, nó
(ii) is páirtí sa chomhaontú sin díoltóir na talún.

19.—Is dleathach do chomhalta den Gharda Síochána nó do dhuine in Ord Beannaithe nó do mhinistir rialta de chuid aon sainaicme nó cuallacht crábhaidh dearbhú reachtúil a ghlacadh agus a fháil chun go ndéanfar iarratas ar dheontas, ar iasacht nó ar fhóirdheontas faoin Acht seo.

20.—Leasaítear leis seo an tAcht Cumann Foirgníochta, 1976—
(a) tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (2) in alt 30:
“(2) Má dhiúltaíonn aon oifigeach, comhalta nó gníomhaire de chuid an chumainn aon leabhar nó doiciméad a thabhairt ar aird don chigire atá de dhualgas air faoin alt seo a thabhairt ar aird nó má dhiúltaíonn sé aon cheist a chuirfidh an cigire chuige maidir le gnóthaí an chumainn a fhreagairt, beidh sé ciontach i gcion.”, agus
(b) tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (1) in alt 77:
“(1) Aon uair is fóirsteanach leis an Aire é, ar mhaithe le gnó cumann foirgníochta a rialáil go hordúil cuí agus ag féachaint don éileamh ar iasachtaí chun tithe a cheannach agus do riachtanais airgeadais an chláir tithíochta, náisiúnta, féadfaidh sé, le toiliú an Aire Airgeadais agus tar éis comhairle a ghlacadh leis an gCláraitheoir, rialacháin a dhéanamh i ndáil le cuspóirí na n-iasachtaí agus méideanna na n-iasachtaí ó chumainn agus na coinníollacha faoina bhféadfar na hiasachtaí sin a thabhairt, seachas coinníollacha i ndáil leis an ráta úis is inmhuirearaithe ar iasacht.”.

21.—(1) San alt seo—
ciallaíonn “na Coimisinéirí” Coimisinéirí na nOibreacha Poiblí in Éirinn;
ciallaíonn “an Bardas” Ard-Mhéara Ró-Onórach, Seanóirí agus Buirgéisigh Bhaile Átha Cliath;
ciallaíonn “an tAire” an tAire Sláinte.
(2) Féadfaidh an tAire le hordú—
(a) ar cibé comaoin a shonrófar san ordú, cuid shonraithe den talamh a thóg sé faoi Chuid III d'Acht Ospidéil Lorcáin Naomhtha, 1943, a aistriú chuig na Coimisinéirí, agus
(b) ar cibé comaoin a shonrófar san ordú, an chuid eile den talamh sin a aistriú chuig an mBardas le haghaidh tithíochta.

(b) Oibreoidh ordú faoi fho-alt (2) (b) den alt seo chun an talamh a thuairiscítear san ordú a dhílsiú don Bhardas agus í saortha agus urscaoilte ó gach uile iontaobhas ar feadh an eastáit agus an leasa go léir a bhfuil an talamh sin dílsithe don Aire ar a bhfeadh.
Bailíocht a thabhairt.
22.—I gcás—
(a) ar íoc an tAire nó údarás tithíochta deontas nó fóirdheontas, ar deontas nó fóirdheontas é a shonraítear i bhforáil de chuid an Achta seo atá leagtha amach i gcolún (2) den Tábla a ghabhann leis an alt seo ag aon uimhir thagartha i gcolún (1) den Tábla sin ar an dáta nó tar éis an dáta a shonraítear i gcolún (3) den Tábla sin ag an uimhir thagartha sin ach sin roimh thosach feidhme na forála sin, agus
(b) gur dheontas nó fóirdheontas bailí éifeachtúil faoin bhforáil sin an deontas nó an fóirdheontas, cibé acu é, dá mba tar éis an tosach feidhme sin a íocadh é,
beidh an deontas nó an fóirdheontas chomh bailí éifeachtúil, agus measfar go raibh sé riamh chomh bailí éifeachtúil, is dá mba tar éis an tosach feidhme sin a íocadh é.

Aisghairm.
23.—(1) Déantar leis seo na hachtacháin a shonraítear i gcolún (2) den Sceideal a ghabhann leis an Acht seo a aisghairm a mhéid a shonraítear i gcolún (3) den Sceideal sin.
(2) Más rud é—
(a) go bhfuair an tAire nó comhairle contae ag gníomhú thar ceann an Aire iarratas ar dheontas faoi alt 15, 16 nó 18 den Phríomh-Acht an 30ú lá de Nollaig, 1977, nó roimh an lá sin, agus go raibh an teach lena mbaineann an t-iarratas críochnaithe go sásúil, i dtuairim an Aire, an 31ú lá de Nollaig, 1978, nó roimh an lá sin,
(b) gur tosaíodh an 31ú lá de Dheireadh Fómhair, 1977, nó roimh an lá sin, ar oibreacha arb éard iad grúp-sholáthar uisce nó grúp-shaoráidí séarachais nó iad araon a shuiteáil agus ar iníoctha deontas ina leith faoi alt 2 den Acht Rialtais Áitiúil (Seirbhísí Sláintíochta), 1962, agus gur críochnaíodh nó go gcríochnófar go sásúil iad, i dtuairim an Aire, an 31ú lá de Nollaig, 1979, nó roimh an lá sin,
(c) i gcás oibreacha ar iníoctha deontas ina leith faoin alt sin 2, nach oibreacha iad de chineál dá dtagraítear i mír (b) den fho-alt seo, go bhfuair an tAire nó údarás sláintíochta ag gníomhú thar ceann an Aire iarratas ar dheontas faoin alt sin an 31ú lá de Dheireadh Fómhair, 1977, nó roimh an lá sin, agus gur críochnaíodh na hoibreacha go sásúil, i dtuairim an Aire nó an údaráis sláintíochta, an 31ú lá de Nollaig, 1978, nó roimh an lá sin,
(d) go bhfuair an tAire nó comhairle contae ag gníomhú thar ceann an Aire iarratas ar dheontas faoi alt 19, 21, 22, 23, 24 nó 25 den Phríomh-Acht an 31ú lá d'Eanáir, 1978, nó roimh an lá sin, agus gur tosaíodh ar na hoibreacha áirithe an 31ú lá de Dheireadh Fómhair, 1977, nó roimh an lá sin, agus gur críochnaíodh na hoibreacha sin go sásúil, i dtuairim an Aire nó na comhairle, roimh an 31ú lá de Nollaig, 1978, nó
(e) go bhfaighidh an t-údarás tithíochta nó an t-údarás sláintíochta iomchuí iarratas ar dheontas faoi alt 26, 27, 28, 29, 30, 31 nó 32 den Phríomh-Acht nó faoi alt 3 den Acht Rialtais Áitiúil (Seirbhísí Sláintíochta), 1962, an 31ú lá de Nollaig, 1979, nó roimh an lá sin,
agus, mura mbeadh fo-alt (1) den alt seo, go mbeadh an deontas le híoc, ansin, d'ainneoin an fho-ailt sin, féadfar an deontas a íoc ar choinníoll go mbeidh an t-iarratas chun an deontas a íoc faighte ag an Aire nó ag an údarás tithíochta nó ag an údarás sláintíochta iomchuí, cibé acu é, an 31ú lá d'Eanáir, 1980, nó roimh an lá sin.
(3) Rialachán a rinneadh faoi fhoráil a aisghairtear leis an alt seo agus a bhí i bhfeidhm díreach roimh thosach feidhme an ailt seo fanfaidh sé, a mhéid a d'fhéadfaí é a dhéanamh faoi fhoráil chomhréire den Acht seo, i bhfeidhm tar éis an tosach feidhme sin ionann is dá mba faoi fhoráil chomhréire den Acht seo a rinneadh é agus féadfar é a leasú nó a chúlghairm dá réir sin.
(4) San alt seo ciallaíonn “údarás sláintíochta” údarás sláintíochta chun críocha na nAchtanna Rialtais Áitiúil (Seirbhísí Sláintíochta), 1878 go 1964.

24.—(1) Féadfar Acht na dTithe (Forálacha Ilghnéitheacha), 1979, a ghairm den Acht seo.
(2) Féadfar Achtanna na dTithe, 1966 go 1979, a ghairm d'Achtanna na dTithe, 1966 go 1970, agus den Acht seo le chéile agus forléireofar le chéile iad mar aon Acht amháin.
(3) Tiocfaidh an tAcht seo i ngníomh, ach amháin mar a fhoráiltear a mhalairt go sainráite ann, cibé lá nó laethanta a shocrófar chuige sin le hordú nó le horduithe ón Aire faoin alt seo go ginearálta nó faoi threoir críche nó forála áirithe agus féadfar laethanta éagsúla a shocrú amhlaidh chun críocha éagsúla agus le haghaidh forálacha éagsúla.
