Tosach feidhme.

3.—Tiocfaidh an tAcht seo i ngníomh cibé lá nó laethanta a shocrófar le hordú nó orduithe ón Aire chuige sin i gcoitinne nó faoi threoir aon chríche nó forála áirithe agus féadfar laethanta éagsúla a shocrú amhlaidh chrun críocha éagsúla agus forálacha éagsúla den Acht seo.

4.—Féadfaidh an tAire le hordú lá a cheapadh ina lá bunaithe chun críocha an Achta seo.

5.—Aisghairtear leis seo na hachtacháin a shonraítear sa Chéad Sceideal a ghabhann leis an Acht seo.

CUID II

Comhairle na nDochtúirí Leighis

Comhairle na nDochtúirí Leighis a bhunú.

6.—(1) Bunófar, de bhua an ailt seo, ar an lá bunaithe, comhlacht ar a dtabharfar Comhairle na nDochtúirí Leighis, nó sa Bhéarla the Medical Council (dá ngairtear an Chomhairle san Acht seo) chun na feidhmeanna a shanntar dó leis an Acht seo a chomhalladh.

(2) Beidh an Chomhairle ina comhlacht corpraithe agus comharbas suthain aici agus beidh cumhacht agartha aici agus beidh sí inagartha ina hainm corpraithe agus beidh cumhacht aici talamh a fháil, a theachtadh agus a dhiúscairt.

(3) Féadfaidh an Chomhairle, faoi réir forálacha an Achta seo, a nós imeachta féin a rialáil.

(4) Bainfidh an Dara Sceideal a ghabhann leis an Acht seo leis an gComhairle.

Comhairle Chláraitheachta na nDochtúirí Leighis a dhíscaoileadh.

7.—(1) Beidh Comhairle Chláraitheachta na nDochtúirí Leighis arna díscaoileadh de bhua an ailt seo an lá bunaithe.

(2) An mhaoin go léir, réadach nó pearsanta (lena n-áirítear ábhair i gcaingean), a bhí, díreach roimh an lá bunaithe, dílsithe do Chomhairle Chláraitheachta na nDochtúirí Leighis nó dá cuid féin aici nó ar teachtadh ar iontaobhas nó faoi réir coinníollacha di, agus na cearta, na cumhachtaí agus na pribhléidí go léir a bhaineann nó a ghabhann le haon mhaoin den sórt sin, tiocfaidh siad chun bheith agus beidh siad, an lá bunaithe, gan tíolacadh ná sannadh ach faoi réir aistriú, i gcás ar gá sin, i leabhair aon bhainc, corparáide nó cuideachta, dá cuid féin ag an gComhairle agus dílsithe nó ar teachtadh ar iontaobhas nó faoi réir coinníollacha di (de réir mar is gá sa chás).

(3) An mhaoin go léir a aistrítear leis an alt seo agus a bhí, díreach roimh an lá bunaithe, i leabhair aon bhainc nó cláraithe i leabhair aon bhainc, corparáide nó cuideachta in ainm Chomhairle Chláraitheachta na nDochtúirí Leighis, déanfaidh an banc, an chorparáid nó an chuideachta, ar an gComhairle á iarraidh sin aon tráth an lá bunaithe nó dá éis, í a aistriú sna leabhair sin chun ainm na Comhairle.

(4) Gach ábhar i gcaingean a aistrítear leis an alt seo féadfaidh an Chomhairle, an lá bunaithe nó dá éis, agairt ina leith, é a ghnóthú, nó é a fheidhmiú ina hainm féin agus ní gá don Chomhairle fógra faoin aistriú a dhéantar leis an alt seo a thabhairt don duine a bheidh faoi cheangal ag aon ábhar i gcaingean den sórt sin.

(5) Gach fiach nó dliteanas eile (lena n-áirítear dliteanais neamhleachtaithe a d'eascair ó thortanna nó ó sháruithe conartha) a bheidh, díreach roimh an lá bunaithe, dlite de Chomhairle Chláraitheachta na nDochtúirí Leighis agus gan íoc agus gan ghlanadh aici, tiocfaidh sé chun bheith agus beidh sé, an lá bunaithe, ina fhiach nó ina dhliteanas ar an gComhairle agus íocfaidh agus glanfaidh an Chomhairle é agus féadfar é a ghnóthú ón gComhairle nó a fheidhmiú ina haghaidh dá réir sin.

(6) Gach conradh a rinneadh agus a bheidh i bhfeidhm díreach roimh an lá bunaithe idir Comhairle Chláraitheachta na nDochtúirí Leighis agus aon duine, leanfaidh sé i bhfeidhm an lá bunaithe nó dá éis ach forléireofar é agus beidh éifeacht leis ionann is dá gcuirfí an Chomhairle ann in ionad Chomhairle Chláraitheachta na nDochtúirí Leighis agus beidh sé infheidhmithe dá réir sin ag an gComhairle nó ina haghaidh.

(7) I gcás a mbeidh, díreach roimh an lá bunaithe, aon imeachtaí dlí ar feitheamh ar páirtí iontu Comhairle Chláraitheachta na nDochtúirí Leighis, cuirfear ainm na Comhairle in ionad ainm Chomhairle Chláraitheachta na nDochtúirí Leighis agus ní rachaidh na himeachtaí ar ceal mar gheall ar an gcur-in-ionad sin.

(8) Ní bhainfidh alt 12 den Finance Act, 1895, leis an maoin nó na cearta a aistrítear leis an alt seo a dhílsiú don Chomhairle.

(9) Aon chonradh seirbhíse (sainráite nó intuigthe) a bheidh i bhfeidhm díreach roimh an lá bunaithe idir Comhairle Chláraitheachta na nDochtúirí Leighis agus aon duine, leanfaidh sé i bhfeidhm an lá bunaithe nó dá éis, ach forléireofar é agus beidh éifeacht leis ionann is dá gcuirfí ainm na Comhairle ann in ionad ainm Chomhairle Chláraitheachta na nDochtúirí Leighis agus beidh gach conradh den sórt sin infheidhmithe dá réir sin ag an gComhairle nó ina haghaidh.

Séala na Comhairle.

8.—(1) Soláthróidh an Chomhairle séala di féin a luaithe is féidir tar éis a bunaithe.

(2) Fíordheimhneofar séala na Comhairle le síniú Uachtarán na Comhairle nó le síniú cibé comhalta eile den Chomhairle a bheidh údaraithe ag an gComhairle gníomhú chuige sin mar aon le síniú oifigigh don Chomhairle a bheidh údaraithe ag an gComhairle gníomhú chuige sin.

(3) Tabharfar aird bhreithiúnach ar shéala na Comhairle, agus glacfar i bhfianaise gach doiciméad a airbheartóidh gur ionstraim é a rinne an Chomhairle agus a bheith séalaithe le séala (a airbheartóidh a bheith fíordheimhnithe de réir an ailt seo) na Comhairle agus measfar gurb é an ionstraim sin é gan a thuilleadh cruthúnais mura suífear a mhalairt.

Comhaltas na Comhairle.

9.—(1) Cúig chomhalta is fiche a bheidh ar an gComhairle agus is mar seo a leanas a cheapfar iad, is é sin le rá—

(a) duine amháin a cheapfaidh gach ceann de na comhlachtaí seo a leanas:

[EN]

(i) an Coláiste Ollscoile, Corcaigh,

[EN]

(ii) an Coláiste Ollscoile, Baile Átha Cliath,

[EN]

(iii) an Coláiste Ollscoile, Gaillimh,

[EN]

(iv) Ollscoil Bhaile Átha Cliath, agus

[EN]

(v) Coláiste Ríoga na Máinleá in Éirinn;

[EN]

(b) beirt daoine eile a cheapfaidh Coláiste Ríoga na Máinleá in Éirinn, a gceapfar duine acu mar ionadaí do speisialtachtaí na máinliachta, agus a gceapfar an duine eile mar ionadaí do speisialtachtaí na n-anaestéiseachtaí agus na raideolaíochta le chéile;

(c) beirt daoine a cheapfaidh Coláiste Ríoga Leá na hÉireann, a gceapfar duine acu mar ionadaí do speisialtachtaí na liachta, agus a gceapfar an duine eile mar ionadaí do speisialtachtaí na paiteolaíochta, na hasaoideolaíochta agus na banliachta le chéile;

(d) duine amháin a cheapfaidh an tAire tar éis dul i gcomhairle le cibé comhlacht nó comhlachtaí atá, dar leis, ionadaitheach don tsíciatracht;

(e) duine amháin a cheapfaidh an tAire tar éis dul i gcomhairle le cibé comhlacht nó comhlachtaí atá, dar leis, ionadaitheach do chleachtadh ginearálta na míochaine;

(f) deichniúr lia-chleachtóir lánchláraithe a bheidh ag gabháil do chleachtadh na míochaine sa Stát ar a mbeidh, ar a laghad—

[EN]

(i) beirt ar sainchomhairleoirí in ospidéil ghinearálta iad nach síciatraithe sainchomhairleacha,

[EN]

(ii) duine amháin ar síciatraí sainchomhairleach é,

[EN]

(iii) duine amháin a bheidh ag gabháil do dhochtúireacht phobail,

[EN]

(iv) duine amháin a bheidh ag cleachtadh in ospidéal, seachas mar shainchomhairleoir, agus

[EN]

(v) beirt ar lia-chleachtóirí ginearálta iad,

[EN]

a cheapfar trína dtoghadh ag lia-chleachtóirí lánchláraithe; agus

[EN]

(g) ceathrar daoine a cheapfaidh an tAire, ar a mbeidh triúr ar a laghad—

(i) nach lia-chleachtóirí cláraithe iad, agus

[EN]

(ii) a bheidh, dar leis an Aire, ionadaitheach do leas an phobail i gcoitinne.

[EN]

(2) Féadfaidh an tAire, le rialacháin a dhéanfar le toiliú na Comhairle, forálacha fho-alt (1) den alt seo a athrú.

(3) Aon uair a bheartóidh an tAire rialacháin a dhéanamh de bhun fho-alt (2) den alt seo, leagfar dréacht de na rialacháin bheartaithe faoi bhráid gach Tí den Oireachtas agus ní dhéanfar na rialacháin go dtí go rithfidh gach Teach rún ag ceadú an dréachta.

Daoine a cheapadh ina gcomhaltaí den Chomhairle.

10.—Déanfaidh an tAire gach beart is gá lena chinntiú go gceapfar comhaltaí chun na chéad Chomhairle a bhunófar tar éis tosach feidhme an Achta seo agus déanfaidh an Chomhairle gach beart is gá lena chinntiú go gceapfar comhaltaí chun aon Chomhairle ina dhiaidh sin.

Comhaltaí den Chomhairle a thoghadh.

11.—(1) Roimh an lá bunaithe, i gcás an chéad toghchán comhaltaí chun na Comhairle de bhun an Achta seo, agus roimh thosach a dtéarma oifige i gcás gach toghchán ina dhiaidh sin, déanfar na comhaltaí den Chomhairle a bheidh le toghadh de réir alt 9 (1) (f) den Acht seo a thoghadh trí thoghchán a dhéanfar de réir rialacháin a bheidh déanta ag an Aire agus féadfaidh aon rialacháin den sórt sin a shonrú, go háirithe, i ndáil le haon aicme daoine a shonrófar sna rialacháin, na cáilíochtaí nach mór a bheith ag iarrthóirí lena dtoghadh chun na Comhairle.

(2) I gcás an chéad toghcháin chun na Comhairle, is é an tAire a cheapfaidh an ceann comhairimh don toghchán sin, agus i gcás gach toghcháin ina dhiaidh sin, is í an Chomhairle a cheapfaidh an ceann comhairimh don toghchán sin.

Céad chruinniú na Comhairle.

12.—(1) Tionólfar céad-chruinniú na Comhairle lá a cheapfaidh an tAire agus cuirfidh an tAire tráth agus ionad an chruinnithe sin in iúl do chomhaltaí na Comhairle.

(2) Tiocfaidh an Chomhairle le chéile cibé tráth agus ionad a cheapfaidh an tAire faoin alt seo dá céad-chruinniú agus air sin rachaidh sí i mbun a dualgas faoin Acht seo.

[EN]

Coistí de chuid na Comhairle.

13.—(1) Féadfaidh an Chomhairle, faoi réir na bhforálacha ina dhiaidh seo den alt seo, coistí a bhunú ó am go ham chun cibé feidhmeanna (más aon fheidhmeanna iad) den Chomhairle a fheidhmiú is fearr agus is caothúla a d'fhéadfaí, i dtuairim na Comhairle, a fheidhmiú ag coiste, agus a shannfaidh an Chomhairle do choiste.

(2) Go háirithe agus gan dochar do ghinearáltacht fho-alt (1) den alt seo, déanfaidh an Chomhairle—

[EN]

(a) coiste a bhunú chun gníomhú i ndáil lena feidhmeanna de bhun Chuid IV den Acht seo, agus

[EN]

(b) coiste a bhunú chun gníomhú i ndáil lena feidhmeanna de bhun Chuid V den Acht seo.

[EN]

(3) Féadfaidh daoine nach comhaltaí den Chomhairle a bheith, más cuí sin leis an gComhairle, ina gcomhaltaí de choiste a bhunófar faoin alt seo, seachas an coiste dá dtagraítear i bhfo-alt (2) (b) den alt seo.

(4) Ní foláir gur comhalta den Chomhairle cathaoirleach gach coiste a bhunófar faoin alt seo ar choinníoll, i gcás an choiste dá dtagraítear i bhfo-alt (2) (b) den alt seo, gur comhalta den Chomhairle seachas Uachtarán nó Leas-Uachtarán na Comhairle an cathaoirleach.

(5) Beidh gach duine a cheapfar chun na Comhairle de bhun alt 9 (1) (a) den Acht seo ina chomhalta den choiste a bhunófar faoi fho-alt (2) (a) den alt seo.

(6) Ní foláir gur comhalta den Chomhairle gach comhalta den choiste dá dtagraítear i bhfo-alt (2) (b) den alt seo agus—

[EN]

(a) daoine a bheidh ceaptha trína dtoghadh chun na Comhairle a bheidh i dtromlach comhaltaí an choiste sin, agus

[EN]

(b) duine, seachas lia-chleachtóir cláraithe, a bheidh ceaptha chun na Comhairle ag an Aire de bhun alt 9 (1) (g) den Acht seo a bheidh i gcomhalta amháin ar a laghad den choiste sin.

(7) Beidh gníomhartha coiste a bhunófar faoin alt seo faoi réir a ndaingnithe ag an gComhairle mura scaoilfidh an Chomhairle, tráth ar bith, leis an daingniú sin a bheith riachtanach.

(8) Féadfaidh an Chomhairle, faoi réir forálacha an Achta seo, nós imeachta coistí a bhunófar faoin alt seo a rialáil ach, faoi réir aon rialála den sórt sin, féadfaidh coistí a bhunófar faoin alt seo a nós imeachta féin a rialáil.

Caiteachais comhaltaí den Chomhairle agus de choistí.

14.—Íocfar le comhalta den Chomhairle nó d'aon choiste a bhunóidh an Chomhairle, as cistí a bheidh faoina réir ag an gComhairle, cibé liúntais i leith caiteachas taistil agus cothaithe a thabhóidh sé i ndáil le freastal ar chruinniú den Chomhairle nó ar shlí eile i ndáil le gnó na Comhairle a chinnfidh an tAire le toiliú Aire na Seirbhíse Poiblí.

An Chomhairle a chur as oifig.

15.—(1) Má mhainníonn nó má fhaillíonn nó má dhiúltaíonn an Chomhairle aon fheidhm a bheidh sannta di faoin Acht seo a fheidhmiú, féadfaidh an tAire, le hordú, a ordú don Chomhairle an fheidhm sin a chomhlíonadh agus chun na críche sin cibé nithe nó rudaí eile a ghabhann nó a bhaineann leis an bhfeidhm agus a bheidh sonraithe san ordú a dhéanamh.

(2) Má mhainníonn an Chomhairle déanamh de réir aon ordachán ón Aire a bheidh in ordú a dhéanfaidh sé faoi fho-alt (1) den alt seo, féadfaidh an tAire, le hordú, comhaltaí na Comhairle a chur as oifig.

(3) Féadfaidh ordú a dhéanfaidh an tAire faoin alt seo cibé forálacha a bheith ann a mheasfaidh an tAire is gá chun go bhféadfar feidhmeanna na Comhairle a fheidhmiú d'ainneoin comhaltaí na Comhairle a bheith curtha as oifig agus féadfaidh aon ordú den sórt sin, go háirithe, duine nó daoine a cheapadh chun gach feidhm nó aon fheidhm de chuid na Comhairle a chomhlíonadh.

An Cláraitheoir.

16.—(1) Beidh príomh-oifigeach ann a ghníomhóidh mar Chláraitheoir na Comhairle agus ar a dtabharfar Cláraitheoir na Comhairle.

(2) Is í an Chomhairle a cheapfaidh an Cláraitheoir agus sealbhóidh sé a oifig ar cibé téarmaí agus coinníollacha agus comhlíonfaidh sé cibé dualgais a chinnfidh an Chomhairle ó am go ham.

(3) Íocfaidh an Chomhairle leis an gCláraitheoir as cistí a bheidh faoina réir aici cibé luach saothair agus liúntais a chinnfidh an Chomhairle ó am go ham le toiliú an Aire.

[EN]

(4) Féadfaidh an tAire, aon uair agus a mhinice is oiriúnach leis, a dhearbhú nach mbeidh aon chumhacht a thugtar don Chomhairle leis an alt seo infheidhmithe ach amháin le toiliú an Aire agus aon uair a bheidh aon dearbhú den sórt sin i bhfeidhm, ní bheidh an chumhacht sin infheidhmithe ach amháin leis an toiliú sin.

Oifigigh agus seirbhísigh eile don Chomhairle.

17.—(1) I dteannta an Chláraitheora, ceapfaidh an Chomhairle cibé daoine agus cibé líon daoine is cuí léi ó am go ham chun bheith ina n-oifigigh agus ina seirbhísigh don Chomhairle.

(2) Sealbhóidh oifigeach nó seirbhíseach don Chomhairle a oifig nó a fhostaíocht ar cibé téarmaí agus coinníollacha agus comhlíonfaidh sé cibé dualgais a chinnfidh an Chomhairle ó am go ham.

18.—(1) Duine is buan-oifigeach don Chomhairle scoirfidh sé de bheith ina bhuan-oifigeach ar é do shlánú 65 bliana d'aois nó, i gcás a mbeidh aois níos mó ná sin socraithe le hordú faoin alt seo ón Aire, ar é do shlánú na haoise sin.

19.—Bainfidh an tAcht Rialtais Áitiúil (Aoisliúntas), 1956, leis an gComhairle agus lena hoifigigh agus lena seirbhísigh ionann is dá mba údarás áitiúil í agus gurbh oifigigh agus seirbhísigh d'údarás áitiúil iad ach faoi réir aon mhodhnuithe (lena n-áirítear modhnuithe i ndáil le seirbhís is ináirithe mar sheirbhís inphinsin) a chinnfidh an tAire, le toiliú an Aire Comhshaoil.

20.—(1) I gcás duine is oifigeach nó seirbhíseach i bhfostaíocht faoin gComhairle teacht chun bheith ina chomhalta de cheachtar Teach den Oireachtas—

(a) beidh sé ar iasacht ón bhfostaíocht sin i gcaitheamh na tréimhse (dá ngairtear an tréimhse iasachta san alt seo) dar tosach an tráth a thiocfaidh sé i dteideal faoi Bhuan-Orduithe an Tí sin suí sa Teach sin agus dar críoch an tráth a scoirfidh sé de bheith ina chomhalta den Teach sin nó, más túisce a tharlóidh, a éireoidh sé as an bhfostaíocht sin nó a scoirfidh sé di nó a fhoirceannfaidh an Chomhairle an fhostaíocht sin,

(b) ní íocfaidh an Chomhairle leis, ná ní bheidh sé i dteideal go bhfaighidh sé ón gComhairle, aon luach saothair ná liúntas i leith na tréimhse iasachta,

(c) ní bheidh sé i dteideal an tréimhse iasachta go léir ná aon chuid di a áireamh le haghaidh aon sochair aoisliúntais is iníoctha faoin Acht seo.

(2) Duine a bheidh de thuras na huaire i dteideal faoi Bhuan-Orduithe cheachtar Tí den Oireachtas suí sa Teach sin beidh sé, fad a bheidh sé i dteideal amhlaidh, dícháilithe chun bheith ina oifigeach nó ina sheirbhíseach don Chomhairle.

Cuntais na Comhairle.

21.—(1) Coimeádfaidh an Chomhairle na cuntais go léir is cuí ar ioncam agus ar chaiteachas uile na Comhairle agus ar fhoinsí an ioncaim sin agus ar ábhar an chaiteachais sin agus coimeádfaidh an Chomhairle na cuntais go léir is cuí ar mhaoin, ar shócmhainní agus ar dhliteanais na Comhairle.

(2) Déanfar cuntais na Comhairle a iniúchadh uair ar a laghad gach bhliain ag iniúchóir a cheapfaidh an tAire chun na críche sin agus déanfaidh an Chomhairle táillí an iniúchóra sin agus caiteachais an iniúchta sin i gcoitinne a íoc a luaithe is feidir tar éis gach iniúchta den sórt sin.

(3) Déanfar, a luaithe is féidir tar éis gach iniúchta faoin alt seo cóip de chuntais na Comhairle agus deimhniú an iniúchóra agus a thuarascáil orthu a thabhairt don Aire.

(4) Cuirfidh an Chomhairle faoi deara, a luaithe is féidir tar éis gach iniúchta faoin alt seo, na cuntais sin agus deimhniú agus tuarascáil an iniúchóra orthu a chló, a fhoilsiú agus a chur ar díol, agus díreach tar éis gach foilsithe den sórt sin, déanfar cóip de na cuntais sin agus an deimhniú agus an tuarascáil sin orthu, arna gcló agus arna bhfoilsiú amhlaidh, a leagan faoi bhráid gach Tí den Oireachtas.

Cumhacht na Comhairle airgead a fháil ar iasacht.

22.—(1) Féadfaidh an Chomhairle, faoi réir aon choinníollacha a fhorchuirfidh an tAire, nó de réir aon ordacháin a thabharfaidh sé, airgead a fháil ar iasacht chun críocha caipitiúla nó críocha reatha.

(2) Féadfar aon airgead a gheobhaidh an Chomhairle ar iasacht de bhun an ailt seo agus aon ús a fhaibhreoidh air a urrú ar ioncam, cistí nó maoin na Comhairle.

An Chomhairle do ghlacadh bronntanas.

23.—(1) Féadfaidh an Chomhairle bronntanais airgid, talún nó maoine eile a ghlacadh ar cibé iontaobhais agus coinníollacha, más ann, a shonróidh an deontóir.

(2) Ní ghlacfaidh an Chomhairle bronntanas má bhíonn na coinníollacha a bheidh curtha lena ghlacadh ag an deontóir ar neamhréir le feidhmeanna na Comhairle.

Caiteachais na Comhairle agus an Aire.

24.—(1) Íocfaidh an Chomhairle as cistí a bheidh faoina réir ag an gComhairle na caiteachais go léir a thabhóidh an Chomhairle.

(2) Déanfar aon chaiteachais a thabhóidh an tAire ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire Airgeadais, as airgead a sholáthróidh an tOireachtas.

25.—Féadfaidh an Chomhairle cibé táillí a ghearradh a chinnfidh an Chomhairle ó am go ham, le toiliú an Aire, i leith—

(b) ainm duine a choinneáil in aon chlár a bheidh á chothabháil ag an gComhairle.

Clárú

An clár a bhunú.

26.—(1) Ullmhóidh agus bunóidh an Chomhairle, a luaithe is féidir tar éis bunú na Comhairle, clár de lia-chleachtóirí (dá ngairtear an clár san Acht seo) ar a dtabharfar Clár Ginearálta na Lia-Chleachtóirí.

(2) Is i cibé foirm a shonróidh an Chomhairle a bheidh an clár agus taispeánfaidh an clár cé acu lánchláraithe, cláraithe go sealadach nó cláraithe go díomuan atá gach duine a bhfuil a ainm cláraithe ann.

(3) Gach duine a dtaifeadar a ainm sa chlár, déanfaidh an Chomhairle a luaithe is féidir tar éis a chlárú a bheith críochnaithe, deimhniú á rá go bhfuil a ainm taifeadta sa chlár a sheoladh chuige.

(4) Gach duine a dtaifeadar a ainm sa chlár, cuirfidh sé faoi deara, a luaithe is féidir tar éis dó an deimhniú a shonraítear i bhfo-alt (3) den alt seo a fháil, an deimhniú sin a chur ar taispeáint san áit a seolann sé cleachtadh na míochaine gach uile thráth fad a leanfaidh a chlárú agus ní aon tráth eile.

(5) D'ainneoin aisghairm Acht na nDochtúirí Leighis, 1927, a dhéantar leis an Acht seo, déanfaidh an Chomhairle an Clár de Dhochtúirí Leighis, a d'ullmhaigh agus a bhunaigh Comhairle Chláraitheachta na nDochtúirí Leighis faoin Acht sin, a chothabháil agus a choimeád go dtí go n-ullmhóidh agus go mbunóidh an Chomhairle an clár de bhun fho-alt (1) den alt seo agus go dtí sin measfar, chun críocha an Achta seo, gurb é an Clár de Dhochtúirí Leighis an clár.

27.—(1) Faoi réir forálacha an Achta seo, déanfar gach duine a mbeidh a ainm, ar dháta an chláir a bhunú, taifeadta sa Chlár de Dhochtúirí Leighis atá á chothabháil ag Comhairle Chláraitheachta na nDochtúirí Leighis de bhun Achtanna na Lia-Chleachtóirí, 1927 go 1961, a chlárú sa chlár.

(a) a bhí, díreach sular bunaíodh an clár, i dteideal a chláraithe de réir Achtanna na Lia-Chleachtóirí, 1927 go 1961, agus nach raibh cláraithe amhlaidh, nó

(b) a ndéanfar, tar éis an clár a bhunú, aon cheann de na buncháilíochtaí a shonraítear sa Cheathrú Sceideal a ghabhann leis an Acht seo a dhámhadh dó, nó

(c) is náisiúnach de Bhallstát agus a mbeidh comhlacht nó údarás inniúil a bheidh ainmnithe chun na críche sin ag Ballstát, de bhun aon Treoir lenar ghlac Comhairle na gComhphobal Eorpach, tar éis cáilíocht sa mhíochaine a dhámhadh dó, nó

déanfar é a chlárú sa chlár ar é do dhéanamh iarratais san fhoirm agus sa tslí a bheidh cinnte ag an gComhairle agus ar an táille iomchuí a íoc.

(3) Ní oibreoidh aon ní san alt seo chun a chosc ar an gComhairle diúltú ainm aon duine a chlárú, is duine a bheidh, thairis sin, i dteideal a chláraithe, ar fhoras neamhfheidhmiúlacht an duine sin gabháil do chleachtadh na míochaine.

(4) Ar chinneadh a dhéanamh faoi fho-alt (3) den alt seo, seolfaidh an Chomhairle láithreach, leis an bpost réamhíoctha, chuig an duine lena mbaineann an cinneadh, fógra i scríbhinn a inseoidh an cinneadh, dáta an chinnidh agus na cúiseanna leis.

(5) Féadfaidh duine lena mbainfidh cinneadh faoi fho-alt (3) den alt seo iarratas a dhéanamh, laistigh den tréimhse dhá mhí dar tosach dáta an chinnidh, chun na hArd-Chúirte go gcealófar an cinneadh agus má dhéanann sé iarratas den sórt sin, féadfaidh an Ard-Chúirt, ar an iarratas a éisteacht—

(a) a dhearbhú gur chuí don Chomhairle an cinneadh a dhéanamh, nó

28.—(1) Ní dhéanfar duine a mbeidh buncháilíocht dáfa dó a chlárú sa chlár seachas trí chlárú sealadach mura mbeidh an comhlacht a dháimh an bhuncháilíocht sin dó tar éis deimhniú taithí a dheonú dó.

(2) Ní dheonófar deimhniú taithí d'aon duine chun críocha fho-alt (1) den alt seo mura mbeidh sé, tar éis an bhuncháilíocht a bheith dáfa dó, tar éis bheith ag gabháil d'fhostaíocht i gcáil dochtúra chónaithigh in oispidéal amháin nó níos mó a bheidh ceadaithe ag an gComhairle chun na críche sin agus é tar éis a bheith ag gabháil dó sin amhlaidh ar feadh cibé tréimhse nó tréimhsí a chinnfidh an Chomhairle.

(3) San alt seo ciallaíonn “fostaíocht i gcáil dochtúra chónaithigh” fostaíocht i gcleachtadh na míochaine i gcás a bhfuil an duine i gceist ina chónaí san ospidéal ina bhfuil sé fostaithe nó cóngarach dó, agus go gceanglaíonn téarmaí a fhostaíochta air a bheith ina chónaí amhlaidh.

29.—(1) I gcás ar deimhin leis an gComhairle—

(2) Féadfaidh an Chomhairle tréimhse a bheidh cinnte faoi fho-alt (1) den alt seo a fhadú go ceann cibé tréimhse nó tréimhsí breise a chinnfidh an Chomhairle, ar choinníoll nach faide ná cúig bliana comhiomlán na dtréimhsí sin.

30.—Féadfaidh an Chomhairle, le toiliú an Aire, clár ar a dtabharfar an Clár de Shaineolaithe Liachta a ullmhú agus a bhunú ina mbeidh rannán maidir le gach speisialtacht ar leith dá dtabharfaidh an Chomhairle aitheantas ó am go ham de bhun alt 38 den Acht seo.

31.—(1) Faoi réir forálacha an Achta seo, beidh na daoine seo a leanas, is daoine a chomhlíonann na coinníollacha a shonraítear i bhfo-alt (2) den alt seo, i dteideal a gcláraithe sa Chlár de Shaineolaithe Liachta, is é sin le rá—

(c) gach náisiúnach de Bhallstát a bhfuil aige dioplóma, deimhniú nó cruthúnas eile ar cháilíocht fhoirmiúil sa sainleigheas dá dtugann an Chomhairle aitheantas agus a bheidh dáfa ag comhlacht nó údarás inniúil a bheidh ainmnithe chun na críche sin ag Ballstát, de bhun aon Treoir lenar ghlac Comhairle na gComhphobal Eorpach, agus

(d) aon duine a dheimhneoidh don Chomhairle go bhfuil clár oiliúna sa sainleigheas críochnaithe aige de chaighdeán a mheasfaidh an Chomhairle a bheith leor-dhóthanach.

(2) Sula gclárófar aon duine sa Chlár de Shaineolaithe Liachta—

(a) beidh sé lánchláraithe sa chlár,

(b) iarrfaidh sé go gclárófar é sa Chlár de Shaineolaithe Liachta san fhoirm agus sa tslí a bheidh cinnte ag an gComhairle, agus

(c) íocfaidh sé cibé táille a bheidh cinnte ag an gComhairle lena n-áirítear, má iarrann sé go gclárófar é i níos mó ná rannán amháin den Chlár de Shaineolaithe Liachta, táille ar leith i ndáil le gach clárú den sórt sin.

(3) Ní oibreoidh aon ní san alt seo chun a chosc ar an gComhairle diúltú ainm aon duine a chlárú, is duine a bheidh, thairis sin, i dteideal a chláraithe, ar fhoras neamhfheidhmiúlacht an duine sin gabháil do chleachtadh na míochaine.

(4) Ar chinneadh a dhéanamh faoi fho-alt (3) den alt seo, seolfaidh an Chomhairle láithreach, leis an bpost réamhíoctha, chuig an duine lena mbaineann an cinneadh, fógra i scríbhinn a inseoidh an cinneadh, dáta an chinnidh agus na cúiseanna leis.

(5) Féadfaidh duine lena mbainfidh cinneadh faoi fho-alt (3) den alt seo iarratas a dhéanamh, laistigh den tréimhse dhá mhí dar tosach dáta an chinnidh, chun na hArd-Chúirte go gcealófar an cinneadh agus má dhéanann sé iarratas den sórt sin, féadfaidh an Ard-Chúirt, ar an iarratas a éisteacht—

32.—(1) Faoi réir fho-alt (2) den alt seo, féadfaidh aon duine atá cláraithe sa chlár, tráth ar bith tar éis a chéad-chláraithe, iarratas a dhéanamh, sa tslí agus san fhoirm a bheidh cinnte ag an gComhairle, go ndéanfar cáilíocht bhreise a thaifeadadh sa chlár i dteannta na gcáilíochtaí dá chuid a bheidh taifeadta ann cheana féin.

(2) Cinnfidh an Chomhairle na cáilíochtaí, nach cáilíochtaí is gá le haghaidh cláraithe, a fhéadfar a thaifeadadh sa chlár mar cháilíochtaí breise, ar iarratas ó aon duine atá cláraithe sa chlár agus ar an táille iomchuí a bheith íoctha.

(3) Aon uair a chinnfidh an Chomhairle, ar iarratas ó aon liachleachtóir cláraithe, aon cháilíocht bhreise i leith an lia-chleachtóra sin a thaifeadadh sa chlár de bhun an ailt seo, déanfaidh an Chomhairle, a luaithe is féidir tar éis an clárú a bheith críochnaithe, deimhniú a sheoladh chuig an lia-chleachtóir sin á rá go bhfuil an cháilíocht bhreise sin taifeadta sa chlár.

Iarratas ó lia-chleachtóir cláraithe go mbainfear a ainm den chlár.

33.—(1) Féadfaidh aon lia-chleachtóir cláraithe iarratas a dhéanamh chun na Comhairle go mbainfear a ainm d'aon chlár a bheidh á chothabháil ag an gComhairle agus ina mbeidh a ainm cláraithe agus, ar an iarratas sin a fháil agus ar an táille iomchuí a bheith íoctha, féadfaidh an Chomhairle ainm an lia-chleachtóra chláraithe a bhaint d'aon chlár den sórt sin.

(2) Féadfaidh aon duine, ar baineadh a ainm de bhun fho-alt (1) den alt seo d'aon chlár a bheidh á chothabháil ag an gComhairle, iarratas a dhéanamh tráth ar bith chun na Comhairle go gcuirfear a ainm ar ais sa chlár sin, agus, faoi réir forálacha an Achta seo agus ar an táille iomchuí a bheith íoctha, féadfaidh an Chomhairle ainm an duine sin a chur ar ais in aon chlár ar baineadh de amhlaidh é.

(3) In aon chás ina ndéanfaidh lia-chleachtóir cláraithe iarratas chun na Comhairle de bhun an ailt seo go mbainfear a ainm d'aon chlár a bheidh á chothabháil ag an gComhairle agus—

(a) go mbeidh iarratas déanta de bhun alt 45 den Acht seo go ndéanfaí fiosrú i dtaobh iompar an lia-chleachtóra chlár aithe sin, nó

(b) gur ciontaíodh an lia-chleachtóir cláraithe sin sa Stát i gcion ab intriailte ar díotáil nó gur ciontaíodh é lasmuigh den Stát i gcion ba ghníomhartha nó neamhghníomhartha ar chion iad ab intriailte ar díotáil dá mba sa Stát a dhéanfaí iad,

ní bhreithneoidh an Chomhairle an t-iarratas ón lia-chleachtóir cláraithe sin go mbainfear a ainm den chlár amhlaidh go dtí go gcinnfidh an Chomhairle ar cheart nó nár cheart ainm an liachleachtóra chláraithe sin a scriosadh as aon chlár den sórt sin de bhun forálacha an Achta seo.

34.—(1) D'fhonn aon chlár a choimeád ceart déanfaidh an Chomhairle ó am go ham de réir mar is gá sa chás gach dearmad focal nó cléireachais sa chlár sin a cheartú, gach taifead ann a tugadh chun críche trí chalaois nó mífhaisnéis a bhaint de, gach athrú a thiocfaidh ar an n-umhail ar sheoltaí na ndaoine a bheith cláraithe in aon chlár a thaifeadadh ann, agus ainmneacha na ndaoine ar fad ar cuireadh i bhfios don Chomhairle nó ar tháinig sé ar umhail na Comhairle go bhfuil siad tar éis bháis a bhaint d'aon chlár.

36.—(1) Cinnteoidh an Chomhairle go mbeidh na ceanglais i ndáil le hoideachas agus oiliúint le haghaidh cáilíochta foirmiúla de réir na gcaighdeán íosta a bheidh sonraithe in aon Treoir a mbeidh glactha léi ag Comhairle na gComhphobal Eorpach i ndáil leis an gcáilíocht sin.

(2) Cinnteoidh an Chomhairle go mbeidh na ceanglais i ndáil le hoideachas agus oiliúint sa sainleigheas sa Stát de réir na gcaighdeán íosta a bheidh sonraithe in aon Treoir a mbeidh glactha léi ag Comhairle na gComhphobal Eorpach i ndáil le hoideachas agus oiliúint den sórt sin.

Buncháilíochtaí.

37.—(1) Is iad na cáilíochtaí a shonraítear sa Cheathrú Sceideal a ghabhann leis an Acht seo na buncháilíochtaí arna ndeonú sa Stát a thabharfaidh teideal do dhuine bheith cláraithe sa chlár.

(2) Féadfaidh an tAire, más cuí leis, ar mholadh ón gComhairle, forálacha an Cheathrú Sceideal a ghabhann leis an Acht seo a leasú le rialacháin faoin alt seo.

38.—(1) Féadfaidh an Chomhairle ó am go ham, le toiliú an Aire, na speisialtachtaí a chinneadh dá dtabharfaidh sí aitheantas chun críche a feidhmeanna faoin Acht seo.

(2) Féadfaidh an Chomhairle a shonrú, ó am go ham, i ndáil le gach speisialtacht dá dtugann sí aitheantas, teidil agus ainmniúcháin na gcáilíochtaí sa sainleigheas a dheonaítear sa Stát a d'fhéadfaí a cheangal chun a chumasú do dhuine é a chlárú sa Chlár de Shaineolaithe Liachta.

(3) Cinnfidh an Chomhairle ó am go ham, i ndáil le gach speisialtacht dá dtugann sí aitheantas, an comhlacht nó na comhlachtaí dá dtabharfaidh an Chomhairle aitheantas sa Stát chun cruthúnas a thabhairt ar shainoiliúint a bheith críochnaithe go sásúil.

CAIBIDIL 2

An Bord Míochaine agus Déidliachta larchéime

An Bord Míochaine agus Déidliachta Iarchéime a bhunú.

39.—(1) Bunófar, de bhua an ailt seo, comhlacht ar a dtabharfar an Bord Míochaine agus Déidliachta Iarchéime, nó sa Bhéarla the Postgraduate Medical and Dental Board (dá ngairtear an Bord san Acht seo) chun na feidhmeanna a shanntar dó leis an Acht seo a chomhalladh.

(2) Beidh éifeacht leis na forálacha seo a leanas i ndáil leis an mBord—

(ii) féadfaidh an Bord daoine nach comhaltaí den Bhord a cheapadh ina gcomhaltaí de choiste a bhunófar faoin mír seo;

(f) féadfaidh an Bord, faoi réir forálacha an Achta seo, a nós imeachta féin a rialáil;

(g) bainfidh an Tríú Sceideal a ghabhann leis an Acht seo leis an mBord.

40.—Is iad feidhmeanna an Bhoird:—

42.—(1) Cúig chomhalta is fiche arna gceapadh ag an Aire a bheidh ar an mBord—

(2) Sula gceapfaidh an tAire aon duine chun an Bhoird, rachaidh sé i gcomhairle—

(3) Íocfaidh an Bord lena oifigigh agus lena sheirbhísigh, as cistí a bheidh faoina réir aige, cibé luach saothair agus liúntais a chinnfidh an Bord ó am go ham le toiliú an Aire.

(4) Féadfaidh an tAire, aon uair agus a mhinice is oiriúnach leis, a dhearbhú nach mbeidh aon chumhacht a thugtar don Bhord leis an alt seo infheidhmithe ach amháin le toiliú an Aire agus aon uair a bheidh aon dearbhú den sórt sin i bhfeidhm, ní bheidh an chumhacht sin infheidhmithe i ndáil le haon oifig nó fostaíocht lena mbaineann an dearbhú, ach amháin leis an toiliú sin.

44.—Bainfidh ailt 8 (2), 8 (3), 12, 14, 18, 19, 20, 21, 22, 23 agus 24 den Acht seo, agus bainfidh Rialacha 8, 10, 11, 12, 13, 14, 15, 16, 18 agus 19 den Dara Sceideal a ghabhann leis an Acht seo, leis an mBord agus chun na críche sin forléireofar aon tagairt sna hailt sin agus sna Rialacha sin don Chomhairle mar thagairt don Bhord agus forléireofar aon tagairt iontu d'Uachtarán nó do Leas-Uachtarán na Comhairle mar thagairt do Chathaoirleach nó do Leas-Chathaoirleach an Bhoird, de réir mar a bheidh.

CUID V

Feidhmiúlacht chun Cleachtadh

45.—(1) Féadfaidh an Chomhairle nó duine ar bith iarratas a dhéanamh chun an Choiste um Fheidhmiúlacht chun Cleachtadh ar fhiosrúchán faoi iompar lia-chleachtóra chláraithe ar na forais seo—

(a) a mhí-iompar gairmiúil líomhnaithe, nó,

[EN]

(b) a fheidhmiúlacht chun gabháil do chleachtadh na míochaine mar gheall ar mhíchumas coirp nó meabhrach,

agus déanfaidh an Coiste um Fheidhmiúlacht chun Cleachtadh, faoi réir forálacha an Achta seo, an t-iarratas a bhreithniú.

(2) I gcás a ndéanfar iarratas faoin alt seo agus gur dóigh leis an gCoiste um Fheidhmiúlacht chun Cleachtadh, tar éis an t-iarratas a bhreithniú, nach bhfuil dóthain cúise ann chun fiosrúchán a sheoladh, cuirfidh sé é sin in iúl don Chomhairle agus féadfaidh an Chomhairle, tar éis an t-ábhar a bhreithniú, a chinneadh nach ndéanfar beart ar bith eile i ndáil leis an ábhar agus cuirfidh sí é sin in iúl don Choiste agus don iarratasóir, nó féadfaidh sí a ordú don Choiste fiosrúchán a sheoladh faoin ábhar de réir forálacha an ailt seo.

(3) I gcás a ndéanfar iarratas ar fhiosrúchán faoin alt seo agus gur dóigh leis an gCoiste um Fheidhmiúlacht chun Cleachtadh, tar éis an t-iarratas a bhreithniú, go bhfuil cás prima facie ann leis an bhfios rúchán a sheoladh nó go mbeidh ordú tugtha dó ag an gComhairle de bhun fho-alt (2) den alt seo an fiosrúchán a sheoladh, beidh éifeacht leis an méid seo a leanas—

(a) rachaidh an Coiste ar aghaidh leis an bhfiosrúchán a sheoladh,

(b) tíolacfaidh an Cláraitheoir, nó aon duine eile le cead ón gCoiste um Fheidhmiúlacht chun Cleachtadh, don Choiste an fhianaise ar an mí-iompar gairmiúil líomhnaithe nó ar an neamhfheidhmiúlacht líomhnaithe chun cleachtadh mar gheall ar mhíchumas coirp nó meabhrach, de réir mar a bheidh,

(5) Ní dhéanfar cinntí an Choiste um Fheidhmiúlacht chun Cleachtadh ar aon ní a cuireadh faoina bhráid ná cinneadh na Comhairle ar aon tuarascáil a thug an Coiste um Fheidhmiúlacht chun Cleachtadh di a phoibliú gan toiliú an duine ab ábhar don fhiosrúchán os comhair an Choiste um Fheidhmiúlacht chun Cleachtadh murar cinneadh, de thoradh an fhiosrúcháin sin, an duine sin a bheith—

(a) ciontach i mí-iompar gairmiúil, nó

[EN]

(b) neamhfheidhmiúil, mar gheall ar mhíchumas coirp nó meabhrach, míochaine a chleachtadh,

(6) Beidh, chun críche fiosrúchán a sheolfar faoi fho-alt (3) den alt seo, ag an gCoiste um Fheidhmiúlacht chun Cleachtadh na cumhachtaí, na cearta agus na pribhléidí a bhíonn dílsithe don Ard-Chúirt nó do bhreitheamh den Ard-Chúirt ar caingean a éisteacht—

(9) Má cheanglaíonn an Coiste um Fheidhmiúlacht chun Cleachtadh taifid liachta othar aon lia-chleachtóra chláraithe a thabhairt ar aird chun críocha aon fhiosrúcháin a bheidh á sheoladh ag an gCoiste sin, ní chuirfear na taifid sin ar fáil don Choiste gan toiliú an othair lena mbaineann mura n-ordóidh an Coiste go sonrach don lia-chleachtóir cláraithe lena mbaineann na taifid sin a thabhairt ar aird.

46.—(1) I gcás lia-chleachtóra chláraithe—

(a) a mbeidh sé fionnta ag an gCoiste um Fheidhmiúlacht chun Cleachtadh ina thaobh ar bhonn fiosrúcháin agus tuarascála de bhun alt 45 den Acht seo go bhfuil sé ciontach i mí-iompar gairmiúil nó neamhfheidhmiúil, mar gheall ar mhíchumas coirp nó mheabhrach, gabháil do chleachadh na míochaine, nó

(b) nach mbeidh táille choinneála a bheidh gearrtha ag an gComhairle faoi alt 25 den Acht seo íoctha aige tar éis don Chomhairle, dhá mhí ar a laghad roimhe sin, a iarraidh air níos mó ná uair amháin, trí fhógra i scríbhinn a seoladh leis an bpost réamhíoctha chuig an duine sin ag a sheoladh mar a bheidh sé sin sa chlár, an táille a íoc, féadfaidh an Chomhairle a chinneadh ainm an duine sin a scriosadh as an gclár nó as an gClár de Shaineolaithe Liachta de réir mar a bheidh nó nach mbeidh éifeacht le linn tréimhse d'fhad sonraithe le clárú a ainm sa chlár lena mbaineann.

(2) Ar chinneadh a dhéanamh faoin alt seo, seolfaidh an Chomhairle láithreach leis an bpost réamhíoctha chuig an duine lena mbaineann an cinneadh, ag a sheoladh mar a bheidh sé sa chlár, fógra i scríbhinn a inseoidh an cinneadh, dáta an chinnidh agus na cúiseanna leis.

(3) Féadfaidh duine lena mbainfidh cinneadh faoin alt seo iarratas a dhéanamh, laistigh den tréimhse 21 lá dar tosach dáta an chinnidh, chun na hArd-Chúirte go gcealófar an cinneadh agus má dhéanann sé iarratas den sórt sin—

(a) féadfaidh an Ard-Chúirt, ar an iarratas a éisteacht—

(i) an cinneadh a chealú, nó,

(c) féadfaidh an Ard-Chúirt a ordú conas mar a íocfar costais an iarratais.

(4) I gcás nach ndéanfaidh duine lena mbainfidh cinneadh ón gComhairle faoin alt seo iarratas chun na hArd-Chúirte, laistigh den tréimhse 21 lá dar tosach dáta an chinnidh, go gcealófar an cinneadh, féadfaidh an Chomhairle iarratas ex parte a dhéanamh chun na hArd-Chúirte go ndaingneofar an cinneadh agus má dhéanann an Chomhairle iarratas den sórt sin, déanfaidh an Ard-Chúirt, ar an iarratas a éisteacht, mura mbeidh cúis mhaith aici lena mhalairt, dearbhú dá réir sin agus (de réir mar is cuí leis an gCúirt) ordóidh sí don Chomhairle ainm an duine sin a scriosadh as an gclár iomchuí nó ordóidh sí nach mbeidh éifeacht le linn tréimhse sonraithe dar tosach tráth nach luaithe ná 7 lá tar éis chinneadh na Cúirte) le clárú a ainm sa chlár sin.

(5) Is cinneadh críochnaitheach cinneadh na hArd-Chúirte ar iarratas faoin alt seo, ach amháin go mbeidh, le cead ón gCúirt sin nó ón gCúirt Uachtarach, ábhar achomhairc ag an gComhairle nó ag an duine iomchuí i gcoinne an chinnidh chun na Cúirte Uachtaraí ar cheist shonraithe dlí.

(7) Féadfar ainm aon duine a bheidh scriosta as aon chlár faoin alt seo a chur ar ais sa chlár sin tráth ar bith le hordú ón gComhairle agus ní ar aon slí eile, agus nuair a chuirfear ainm duine ar ais amhlaidh sa chlár sin, féadfaidh an Chomhairle cibé coinníollacha is cuí léi a chur ag gabháil lena chur ar ais (lena n-áirítear táille a íoc nach mó ná an táille ab iníoctha ag an duine sin i leith cláraithe dá mba é an tráth sin a bheadh sé á chlárú den chéad uair).

(8) I gcás a scoirfidh clárú duine in aon chlár d'éifeacht a bheith leis faoin alt seo ar feadh tréimhse sonraithe, féadfaidh an Chomh airle, más cuí léi, deireadh a chur, le hordú, leis an bhfionraí ar an duine sin á iarraidh sin uirthi.

(9) Ar iarratas a éisteacht faoin alt seo, féadfaidh an Ard-Chúirt, más cuí léi sin a dhéanamh, fianaise a ghlacadh ó aon duine cáiliúil i ngairm na míochaine i dtaobh céard is mí-iompar gairmiúil ann, agus aird a thabhairt ar an bhfianaise sin.

(4) I gcás nach ndéanfaidh duine lena mbainfidh cinneadh ón gComhairle faoin alt seo iarratas chun na hArd-Chúirte, laistigh den tréimhse 21 lá dar tosach dáta an chinnidh, go gcealófar an cinneadh, féadfaidh an Chomhairle iarratas ex parte a dhéanamh chun na hArd-Chúirte go ndaingneofar an cinneadh agus má dhéanann an Chomhairle iarratas den sórt sin, déanfaidh an Ard-Chúirt, ar an iarratas a éisteacht, mura mbeidh cúis mhaith aici lena mhalairt, dearbhú dá réir sin agus (de réir mar is cuí leis an gCúirt) ordóidh sí don Chomhairle cibé coinníollacha a shonróidh an Chúirt a chur ag gabháil le hainm an duine sin a choimeád in aon chlár a chothabháiltear faoin Acht seo.

48.—(1) Tar éis don Choiste um Fheidhmiúlacht chun Cleachtadh fiosrúchán a sheoladh agus tuarascáil a thabhairt de bhun alt 45 den Acht seo i dtaobh iompar duine a mbeidh a ainm taifeadta in aon chlár a chothabháiltear faoin Acht seo, féadfaidh an Chomhairle, ar thuarascáil an Choiste a fháil, comhairle nó rabhadh a thabhairt don duine sin, nó é a cháineadh, i ndáil lena iompar gairmiúil, más cuí sin léi.

49.—(1) I gcás lia-chleachtóir cláraithe a chiontú sa Stát i gcion is intriailte ar díotáil nó a chiontú lasmuigh den Stát i gcion is gníomhartha nó neamhghníomhartha ar chion iad ab intriailte ar díotáil dá mba sa Stát a dhéanfaí iad, féadfaidh an Chomhairle a chinneadh go scriosfar ainm an duine sin as an gclár.

(2) I gcás ainm duine a bheith curtha ar ais sa chlár nó deireadh a bheith curtha lena fhionraí as an gclár, déanfar an t-ainm, má bhí sé cláraithe sa Chlár de Shaineolaithe Liachta, a chur ar ais sa chlár sin nó cuirfear deireadh lena fhionraí as an gclár sin, de réir mar a bheidh.

AN DARA SCEIDEAL

Rialacha i ndáil le Comhaltas agus Cruinnithe Chomhairle na nDochtúirí Leighis

Seilbh Oifige

1. Faoi réir forálacha an Sceidil seo i ndáil le corrfholúntais a líonadh, sealbhóidh gach comhalta den Chomhairle oifig, mura bhfaighidh sé bás, mura n-éireoidh sé as oifig nó mura dtiocfaidh sé faoi dhícháilíocht roimhe sin, ar feadh tréimhse cúig bliana.

2. Ní shealbhóidh aon duine oifig mar chomhalta den Chomhairle ar feadh níos mó ná dhá théarma chomhleanúnacha cúig bliana.

Eirí as Comhaltas agus Foirceannadh Comhaltais

3. Féadfaidh an tAire tráth ar bith ceapadh comhalta den Chomhairle a cheap sé féin a fhoirceannadh.

4. Féadfaidh comhalta den Chomhairle éirí as bheith ina chomhalta trí fhógra scríofa faoina láimh a thabhairt don Chomhairle, ach ní ghlacfaidh an t-eirí-as éifeacht go dtí an chéad chruinniú eile den Chomhairle a thionólfar tar éis an fógra faoin éirí-as a fháil.

5. Scoirfidh duine a ceapadh trina thoghadh de bheith ina chomhalta den Chomhairle nuair a scoirfidh sé de bheith ina lia-chleachtóir cláraithe ag gabháil do chleachtadh na míochaine.

Corrfholúntais

6. (a) Aon uair a tharlóidh corrfholúntas i measc na gcomhaltaí den Chomhairle, seachas na comhaltaí a ceapadh trína dtoghadh, cuirfidh an Chomhairle é sin in iúl láithreach don chomhlacht nó don údarás a cheap an duine sin agus déanfaidh an comhlacht nó an t-údarás sin, a luaithe is caothúil, duine a cheapadh chun an folúntas sin a líonadh agus aon duine a cheapfar amhlaidh fónfaidh sé mar chomhalta den Chomhairle go ceann na tréimhse a bheidh gan chaitheamh de théarma oifige an duine a nglacfaidh sé a ionad.

(b) Aon uair a tharlóidh corrfholúntas i measc na gcomhaltaí den Chomhairle a ceapadh trína dtoghadh, déanfaidh an Chomhairle, tar éis dul i gcomhairle leis an Aire, duine a chomhthoghadh a bheidh, de bhun forálacha an Achta seo, cáilithe chun a thofa chun an folúntas sin a líonadh agus aon duine a chomhthoghfar amhlaidh fónfaidh sé mar chomhalta den Chomhairle go ceann na tréimhse a bheidh gan chaitheamh de théarma oifige an duine a nglacfaidh sé a ionad.

7. Seachtar is córam do chruinniú den Chomhairle; ar choinníoll gur deichniúr an córam i gcás cruinniú den Chomhairle a mbeidh ar chlár na hoibre ainm lia-chleachtóra chláraithe a scriosadh as aon chlár a bheidh á chothabháil ag an gComhairle, nó lia-chleachtóir cláraithe a chur ar fionraí as aon chlár den sórt sin, nó coinníollacha a chur ag gabháil le lia-chleachóir cláraithe do leanúint de bheith cláraithe.

Cruinnithe

8. Tionólfaidh an Chomhairle ceithre chruinniú ar a laghad gach bliain agus féadfaidh sí cibé cruinnithe eile a thionól is gá lena dualgais a chomhlíonadh.

Uachtarán agus Leas-Uachtarán

9. (1) Toghfaidh an Chomhairle ó am go ham duine dá comhaltaí chun bheith ina Uachtarán ar an gComhairle agus duine eile dá comhaltaí chun bheith ina Leas-Uachtarán ar an gComhairle.

(2) Sealbhóidh Uachtarán agus Leas-Uachtarán na Comhairle, de réir mar a bheidh, oifig sa cháil sin, gach duine acu, ar feadh cibé téarma a shonróidh an Chomhairle tráth a cheaptha, mura rud é—

(a) go scoirfidh sé de bheith, nó go dtiocfaidh sé faoi dhícháilíocht chun bheith, ina chomhalta den Chomhairle,

(b) go n-éireoidh sé as oifig Uachtaráin nó Leas-Uachtaráin, de réir mar a bheidh, agus go nglacfaidh a éirí-as éifeacht faoin mír seo,

(c) go ndéanfaidh an Chomhairle le rún, dá vótálfaidh dhá thrian ar a laghad de chomhaltaí na Comhairle agus a ndéanfar fógra seacht lá ar a laghad go bhfuiltear chun é a mholadh a thabhairt do gach comhalta den Chomhairle, a cheapadh mar Uachtarán nó mar Leas-Uachtarán a fhoirceannadh.

(3) Féadfaidh Uachtarán nó Leas-Uachtarán na Comhairle éirí as a oifig mar Uachtarán nó mar Leas-Uachtarán tráth ar bith trí fhógra scríofa faoina láimh a thabhairt don Chomhairle, ach ní ghlacfaidh an t-éirí-as éifeacht go dtí an chéad chruinniú eile den Chomhairle a thionólfar tar éis don Chomhairle an fógra faoin éirí as a fháil.

(4) Aon uair a tharlóidh, le linn Uachtarán nó Leas-Uachtarán don Chomhairle a bheith á thoghadh, gur comhionann an uimhir vótaí do bheirt daoine nó níos mó, cinnfear trí chrannchur cé acu de na daoine sin a bheidh ina Uachtarán nó ina Leas-Uachtarán, de réir mar a bheidh.

Imeachtaí ag Cruinnithe

10. Ní bheidh imeachtaí na Comhairle neamhbhailí mar gheall ar aon fholúntas nó folúntais i measc a comhaltaí nó mar gheall ar aon éalaing ar na ceapacháin chun na Comhairle nó ar cháilíochtaí aon chomhalta di.

11. Féadfaidh Uachtarán nó, má bhíonn sé as láthair, Leas-Uachtarán na Comhairle cruinniú den Chomhairle a ghairm ar a thionsonamh féin nó nuair a iarrfar air é sin a dhéanamh le foréileamh a bheidh sínithe ag seisear ar a laghad de chomhaltaí na Comhairle.

12. (1) Má dhiúltaíonn Uachtarán nó, má bhíonn sé as láthair, Leas-Uachtarán na Comhairle cruinniú den Chomhairle a ghairm tar éis foriarratas chuige sin a bheidh sínithe ag seisear ar a laghad de chomhaltaí na Comhairle a thíolacadh dó, féadfaidh aon triúr comhaltaí den Chomhairle cruinniú den Chomhairle a ghairm láithreach.

(2) Mura ndéanfaidh Uachtarán nó, má bhíonn sé as láthair, Leas-Uachtarán na Comhairle, gan diúltú amhlaidh, cruinniú den Chomhairle a ghairm laistigh de sheacht lá tar éis foriarratas chuige sin a bheidh sínithe ag seisear ar a laghad de chomhaltaí na Comhairle a thíolacadh dó, féadfaidh aon triúr comhaltaí den Chomhairle, ar na seacht lá sin a bheith caite, cruinniú den Chomhairle a ghairm.

13. Trí lá glan ar a laghad roimh gach cruinniú den Chomhairle, déanfar fógra a bheidh sínithe ag Uachtarán nó ag Leas-Uachtarán na Comhairle, de réir mar a bheidh, nó, más comhaltaí den Comhairle a ghairfidh an cruinniú, a bheidh sínithe ag na comhaltaí sin, agus a inseoidh tráth agus ionad an chruinnithe a sheoladh chuig gach comhalta den Chomhairle: más comhaltaí den Chomhairle a ghairfidh an cruinniú, sonróidh an fógra ag gairm an chruinnithe an gnó a dhéanfar ag an gcruinniú.

14. Ag cruinniú den Chomhairle—

(a) is é Uachtarán na Comhairle, má bhíonn sé i láthair, a bheidh ina chathaoirleach,

(b) mura mbeidh agus fad nach mbeidh Uachtarán na Comhairle i láthair nó má bhíonn oifig an Uachtaráin folamh, is é Leas-Uachtarán na Comhairle, má bhíonn sé i láthair, a bheidh ina chathaoirleach,

(c) mura mbeidh agus fad nach mbeidh Uachtarán na Comhairle i láthair nó má bhíonn oifig an Uachtaráin folamh agus nach mbeidh Leas-Uachtarán na Comhairle i láthair nó má bhíonn oifig an Leas-Uachtaráin folamh, toghfaidh na comhaltaí den Chomhairle a bheidh i láthair duine dá líon chun bheith ina chathaoirleach ar an gcruinniú sin.

15. Déanfar miontuairiscí ar imeachtaí cruinnithe uile na Comhairle a dhréachtú agus a thaifeadadh i leabhar a choimeádfar chuige sin agus síneoidh cathaoirleach an chéad chruinnithe eile na miontuairiscí sin.

16. Déanfar ainmneacha na gcomhaltaí go leir a bheidh i láthair ag cruinniú den Chomhairle a thaifeadadh sna miontuairiscí ar imeachtaí an chruinnithe.

17. Faoi réir Airteagail 7 agus 9 (4) den Sceideal seo, féadfar gach gníomh a dhéanfaidh an Chomhairle a dhéanamh, agus féadfar gach ceist a thiocfaidh nó a éireoidh os comhair na Comhairle a chinneadh, ag tromlach na gcomhaltaí sin den Chomhairle a bheidh i láthair agus a vótálfaidh i ndáil leis an ngníomh nó leis an ábhar ag cruinniú den Chomhairle a gaireadh go cuí de réir dlí.

18. I gcás comhionannas vótaí ar aon cheist a éireoidh ag cruinniú den Chomhairle (seachas toghadh an Uachtaráin nó an Leas-Uachtaráin), beidh an dara vóta nó vóta réitigh ag cathaoirleach an chruinnithe sin.

19. Ach amháin mar a fhoráiltear a mhalairt le haon achtachán, lena n-áirítear an tAcht seo, féadfaidh an Chomhairle buan-orduithe a dhéanamh chun a himeachtaí a rialáil agus na buan-orduithe sin a leasú nó a chúlghairm.

AN ACT TO PROVIDE FOR THE SETTING UP OF A COUNCIL TO BE KNOWN AS COMHAIRLE NA nDOCHTUIRI LEIGHIS OR THE MEDICAL COUNCIL WHICH SHALL PROVIDE FOR THE REGISTRATION AND CONTROL OF PERSONS ENGAGED IN THE PRACTICE OF MEDICINE AND TO PROVIDE FOR OTHER MATTERS RELATING TO THE PRACTICE OF MEDICINE AND THE PERSONS ENGAGED IN SUCH PRACTICE AND TO PROVIDE FOR THE SETTING UP OF A BOARD TO BE KNOWN AS AN BORD MIOCHAINE AGUS DEIDLIACHTA IARCHEIME OR THE POSTGRADUATE MEDICAL AND DENTAL BOARD WHICH SHALL PROMOTE AND CO-ORDINATE POSTGRADUATE EDUCATION AND TRAINING FOR PERSONS ENGAGED IN THE PRACTICE OF MEDICINE AND DENTISTRY AND TO PROVIDE FOR THE REPEAL OF THE MEDICAL PRACTITIONERS ACTS, 1927 TO 1961, AND TO PROVIDE FOR OTHER MATTERS CONNECTED WITH THE MATTERS AFORESAID. PART I

Preliminary and General

[GA]

Short title.

1.—This Act may be cited as the Medical Practitioners Act, 1978.

2.—In this Act—

Interpretation.

the Board” means An Bord Míochaine agus Déidliachta Iarchéime or the Postgraduate Medical and Dental Board established by this Act;

[GA]

certificate of experience” means a certificate granted to a person who has complied with the provisions of section 28 of this Act;

[GA]

the Council” means Comhairle na nDochtúirí Leighis or the Medical Council established by this Act;

[GA]

the Dental Board” means the Dental Board constituted under the Dentists Act, 1928;

[GA]

employment in a residential medical capacity” has the meaning specified in section 28 of this Act;

[GA]

establishment day” means the day appointed to be the establishment day for the purposes of this Act under section 4 of this Act;

[GA]

Fitness to Practise Committee” means the committee to be established by the Council under section 13 (2) (b) of this Act;

[GA]

formal qualification” means a primary qualification together with a certificate of experience;

[GA]

full registration” means registration other than provisional registration or temporary registration and “fully registered” shall be construed accordingly;

[GA]

the Medical Registration Council” means the Medical Registration Council established under the Medical Practitioners Act, 1927;

[GA]

Member State” means a state other than the State which is a member of the European Economic Community;

[GA]

the Minister” means the Minister for Health;

[GA]

practice of medicine” includes practice of surgery, midwifery and other disciplines of medicine and “medical practitioner” shall be construed accordingly;

[GA]

prescribe” means prescribe by regulations;

[GA]

primary qualification” means a qualification specified in the Fourth Schedule to this Act;

[GA]

provisional registration” means registration by virtue of section 28 of this Act, and “provisionally registered” shall be construed accordingly;

[GA]

the register” means the General Register of Medical Practitioners established under section 26 of this Act;

[GA]

registered dentist” means a person whose name is entered in the Register of Dentists maintained under the Dentists Act, 1928;

[GA]

registered medical practitioner” means a person whose name is entered in the register;

[GA]

Register of Medical Specialists” means the register referred to in section 30 of this Act;

[GA]

the Registrar” means the chief officer of the Council;

[GA]

retention fee” means a fee payable by a person entitled to be registered in any register maintained by the Council for the retention of his name in that register;

[GA]

temporary registration” means registration by virtue of section 29 of this Act and “temporarily registered” shall be construed accordingly.

Commencement.

3.—This Act shall come into operation on such day or days as may be fixed therefor by order or orders of the Minister either generally or with reference to a particular purpose or provision and different days may be so fixed for different purposes and different provisions of this Act.

Establishment day.

4.—The Minister may by order appoint a day to be the establishment day for the purposes of this Act.

Repeals.

5.—The enactments specified in the First Schedule to this Act are hereby repealed.

PART II

The Medical Council

[GA]

Establishment of the Medical Council.

6.—(1) There shall, by virtue of this section, be established on the establishment day a body to be known as Comhairle na nDochtúiri Leighis, or in the English language as the Medical Council (in this Act referred to as the Council) to fulfil the functions assigned to it by this Act.

[GA]

(2) The Council shall be a body corporate with perpetual succession and power to sue and be sued in its corporate name, and to acquire, hold and dispose of land.

[GA]

(3) The Council may, subject to the provisions of this Act, regulate its own procedure.

[GA]

(4) The Second Schedule to this Act shall apply to the Council.

[GA]

Dissolution of Medical Registration Council.

7.—(1) The Medical Registration Council shall, on the establishment day, be dissolved by virtue of this section.

[GA]

(2) All property, whether real or personal (including choses-in-action), which immediately before the establishment day was vested in or belonged to or was held in trust or subject to conditions for the Medical Registration Council, and all rights, powers and privileges relating to or connected with any such property, shall on the establishment day, without any conveyance or assignment but subject where necessary to transfer in the books of any bank, corporation or company, become and be vested in or the property of or held in trust or subject to conditions for (as the case may require) the Council.

(3) All property transferred by this section which immediately before the establishment day was standing in the books of any bank or was registered in the books of any bank, corporation or company in the name of the Medical Registration Council shall, upon the request of the Council made at any time on or after the establishment day, be transferred in those books by the bank, corporation or company into the name of the Council.

(4) Every chose-in-action transferred by this section may, on or after the establishment day, be sued upon, recovered, or enforced by the Council in its own name and it shall not be necessary for the Council to give notice to the person bound by any such chose-in-action of the transfer effected by this section.

(5) Every debt or other liability (including unliquidated liabilities arising from torts or breaches of contract) which immediately before the establishment day is owing and unpaid and is undischarged by the Medical Registration Council shall, on the establishment day, become and be the debt or liability of the Council and shall be paid and discharged by and may be recovered from and enforced against the Council accordingly.

(6) Every contract which was entered into and is in force immediately before the establishment day between the Medical Registration Council and any person shall continue in force on or after the establishment day but it shall be construed and have effect as if the Council were substituted therein for the Medical Registration Council and shall be enforceable by or against the Council accordingly.

[GA]

(7) Where immediately before the establishment day, any legal proceedings are pending to which the Medical Registration Council is a party, the name of the Council shall be substituted for that of the Medical Registration Council and the proceedings shall not abate by reason of such substitution.

[GA]

(8) Section 12 of the Finance Act, 1895, shall not apply to the vesting in the Council of the property or rights transferred by this section.

[GA]

(9) Any contract of service (express or implied) in force immediately before the establishment day between the Medical Registration Council and any person shall continue in force on or after the establishment day, but shall be construed and have effect as if the name of the Council were substituted therein for the name of the Medical Registration Council and every such contract shall be enforceable accordingly by or against the Council.

Seal of the Council.

8.—(1) The Council shall as soon as may be after its establishment provide itself with a seal.

[GA]

(2) The seal of the Council shall be authenticated by the signature of the President of the Council or such other member thereof as may be authorised by the Council to act in that behalf and the signature of an officer of the Council authorised by the Council to act in that behalf.

[GA]

(3) Judicial notice shall be taken of the seal of the Council, and every document purporting to be an instrument made by the Council and to be sealed with the seal (purporting to be authenticated in accordance with this section) of the Council shall be received in evidence and be deemed to be such instrument without further proof unless the contrary is shown.

[GA]

Membership of the Council.

9.—(1) The Council shall consist of twenty-five members appointed in the following manner, that is to say—

[GA]

(a) one person appointed by each of the following bodies—

[GA]

(i) University College Cork,

[GA]

(ii) University College Dublin,

[GA]

(iii) University College Galway,

[GA]

(iv) the University of Dublin, and

[GA]

(v) the Royal College of Surgeons in Ireland;

[GA]

(b) two other persons appointed by the Royal College of Surgeons in Ireland, of whom one shall be appointed to represent the surgical specialties, and the other shall be appointed to represent jointly the specialties of anaesthetics and radiology;

[GA]

(c) two persons appointed by the Royal College of Physicians of Ireland, of whom one shall be appointed to represent the medical specialties, and the other shall be appointed to represent jointly the specialties of pathology, obstetrics and gynaecology;

[GA]

(d) one person appointed by the Minister after consultation with such body or bodies as, in his opinion, represent psychiatry;

[GA]

(e) one person appointed by the Minister after consultation with such body or bodies as, in his opinion, represent general medical practice;

[GA]

(f) ten fully registered medical practitioners engaged in the practice of medicine in the State of whom at least—

[GA]

(i) two shall be consultants in general hospitals not being consultant psychiatrists,

[GA]

(ii) one shall be a consultant psychiatrist,

[GA]

(iii) one shall be engaged in community medicine,

[GA]

(iv) one shall be engaged in hospital practice, other than as a consultant, and

[GA]

(v) two shall be general practitioners,

[GA]

appointed by election by fully registered medical practitioners; and

[GA]

(g) four persons appointed by the Minister, at least three of whom—

[GA]

(i) shall not be registered medical practitioners, and

[GA]

(ii) shall, in the opinion of the Minister, represent the interests of the general public.

[GA]

(2) The Minister may, by regulations made with the consent of the Council, vary the provisions of subsection (1) of this section.

[GA]

(3) Whenever the Minister proposes to make regulations pursuant to subsection (2) of this section, a draft of the proposed regulations shall be laid before each House of the Oireachtas and the regulations shall not be made until a resolution approving of the draft has been passed by each House.

[GA]

Appointment of persons to be members of Council.

10.—The Minister shall take all steps necessary to secure the appointment of members to the first Council established after the commencement of this Act and the Council shall take all steps necessary to secure the appointment of members to any subsequent Council.

[GA]

Election of members of the Council.

11.—(1) Before the establishment day, in the case of the first election of members to the Council pursuant to this Act, and before the commencement of their term of office in the case of every subsequent election, the members of the Council to be elected in accordance with section 9 (1) (f) of this Act, shall be elected by way of an election held in accordance with regulations made by the Minister and any such regulations may, in particular, specify, in relation to any class of persons specified in the regulations, the qualifications to be held by candidates for election to the Council.

(2) In the case of the first election to the Council, the returning officer for that election shall be appointed by the Minister, and inthe case of every subsequent election, the returning officer for such election shall be appointed by the Council.

[GA]

First meeting of Council.

12.—(1) The first meeting of the Council shall be held on a day to be appointed by the Minister and the Minister shall notify the members of the Council of the time and place of such meeting.

[GA]

(2) The Council shall meet at the time and place appointed by the Minister under this section for its first meeting and shall thereupon enter on its duties under this Act.

[GA]

Committees of the Council.

13.—(1) The Council may, subject to the subsequent provisions of this section, from time to time establish committees to perform such, if any, functions of the Council as, in the opinion of the Council, may be better or more conveniently performed by a committee, and are assigned to a committee by the Council.

[GA]

(2) In particular and without prejudice to the generality of subsection (1) of this section, the Council shall—

[GA]

(a) establish a committee to act in relation to its functions pursuant to Part IV of this Act, and

[GA]

(b) establish a committee to act in relation to its functions pursuant to Part V of this Act.

[GA]

(3) A committee established under this section, other than the committee referred to in subsection (2) (b) of this section may, if the Council thinks fit, include in its membership persons who are not members of the Council.

[GA]

(4) The chairman of every committee established under this section shall be a member of the Council provided that in the case of the committee referred to in subsection (2) (b) of this section the chairman shall be a member of the Council other than the President or the Vice-President of the Council.

[GA]

(5) The committee established under subsection (2) (a) of this section shall include in its membership each person appointed to the Council pursuant to section 9 (1) (a) of this Act.

[GA]

(6) Every member of the committee referred to in subsection (2) (b) of this section shall be a member of the Council and—

[GA]

(a) a majority of the members of such committee shall be persons who have been appointed by election to the Council, and

[GA]

(b) at least one member of such committee shall be a person other than a registered medical practitioner who has been appointed to the Council by the Minister pursuant to section 9 (1) (g) of this Act.

[GA]

(7) The acts of a committee established under this section shall be subject to confirmation by the Council unless the Council, at any time, dispenses with the necessity for such confirmation.

[GA]

(8) The Council may, subject to the provisions of this Act, regulate the procedure of committees established under this section, but, subject to any such regulation, committees established under this section may regulate their own procedure.

[GA]

Expenses of members of Council and committees.

14.—A member of the Council or of any committee established by the Council shall be paid, out of funds at the disposal of the Council, such allowances for travelling and subsistence expenses incurred in respect of his attendance at a meeting of the Council or otherwise in connection with the affairs of the Council as the Minister, with the consent of the Minister for the Public Service, may determine.

Removal of Council from office.

15.—(1) If the Council fails, neglects or refuses to perform any function assigned to it under this Act, the Minister may, by order, direct the Council to discharge that function and for that purpose to do such other matters or things ancillary or incidental thereto as may be specified in the order.

[GA]

(2) If the Council fails to comply with any direction of the Minister contained in an order made by him under subsection (1) of this section, the Minister may, by order, remove from office the members of the Council.

[GA]

(3) An order made by the Minister under this section may contain such provisions as the Minister considers necessary to enable the functions of the Council to be performed notwithstanding the removal from office of its members, and any such order may, in particular, appoint a person or persons to discharge all or any of the functions of the Council.

[GA]

The Registrar.

16.—(1) There shall be a chief officer who shall act and be known as the Registrar of the Council.

[GA]

(2) The Registrar shall be appointed by the Council and shall hold his office on such terms and conditions and shall perform such duties as the Council from time to time determines.

[GA]

(3) There shall be paid by the Council to the Registrar out of funds at its disposal such remuneration and allowances as the Council, with the consent of the Minister, from time to time determines.

[GA]

(4) The Minister may, whenever and so often as he thinks fit, declare that any power conferred on the Council by this section shall be exercisable only with the consent of the Minister and whenever any such declaration is in force, the said power may be exercisable only with such consent.

[GA]

Other officers and servants of the Council.

17.—(1) In addition to the Registrar, the Council shall appoint such and so many persons to be officers and servants of the Council as the Council from time to time thinks proper.

[GA]

(2) An officer or servant of the Council shall hold his office or employment on such terms and conditions and shall perform such duties as the Council from time to time determines.

[GA]

(3) There shall be paid by the Council to its officers and servants out of funds at its disposal such remuneration and allowances as the Council, with the consent of the Minister, from time to time determines.

[GA]

(4) The Minister may, whenever and as often as he thinks fit, declare that any power conferred on the Council by this section shall be exercisable only with the consent of the Minister and whenever any such declaration is in force, the said power may, in relation to any office or employment to which the declaration applies, be exercisable only with such consent.

[GA]

Age limits.

18.—(1) A person who is a permanent officer of the Council shall cease to be a permanent officer on his attaining the age of 65 years or, in a case where a higher age is fixed by order of the Minister made under this section, on his attaining that age.

[GA]

(2) The Minister may, by order, amend or revoke an order made under this section, including this subsection.

[GA]

Superannuation.

19.—The Local Government (Superannuation) Act, 1956, shall apply to the Council and its officers and servants as if it were a local authority and they were officers and servants of a local authority but subject to any modifications (including modifications relating to service reckonable as pensionable service) which may, with the consent of the Minister for the Environment, be determined by the Minister.

Membership of either House of Oireachtas by officer or servant of the Council.

20.—(1) Where a person who is either an officer or a servant in the employment of the Council becomes a member of either House of the Oireachtas—

[GA]

(a) he shall during the period (in this section referred to as the secondment period) commencing on his becoming entitled under the Standing Orders of that House to sit therein and ending either when he ceases to be a member of that House or, if it should happen sooner, upon his resignation or retirement from such employment or upon determination of such employment by the Council, stand seconded from such employment,

[GA]

(b) he shall not be paid by, or entitled to receive from, the Council any remuneration or allowance in respect of the secondment period,

[GA]

(c) he shall not be entitled to reckon the whole or any part of the secondment period for any superannuation benefits payable under this Act.

[GA]

(2) A person who is for the time being entitled under the Standing Orders of either House of the Oireachtas to sit therein shall, while so entitled, be disqualified from becoming an officer or servant of the Council.

[GA]

Accounts of the Council.

21.—(1) The Council shall keep all proper accounts of all income and expenditure of the Council and of the sources of such income and the subject matter of such expenditure and the Council shall keep all proper accounts of property, assets and liabilities of the Council.

[GA]

(2) The accounts of the Council shall be audited at least once in every year by an auditor appointed for that purpose by the Minister and the fees of such auditor and the expenses generally of such audit shall be paid by the Council as soon as may be after each such audit.

[GA]

(3) As soon as may be after each audit under this section, a copy of the accounts of the Council and the auditor's certificate and report thereon shall be given to the Minister.

[GA]

(4) As soon as may be after each audit under this section, the Council shall cause such accounts and the auditor's certificate and report thereon to be printed, published and put on sale, and immediately after each such publication, a copy of such accounts and such certificate and report thereon as so printed and published shall be laid before each House of the Oireachtas.

[GA]

Power of Council to borrow.

22.—(1) The Council may, subject to any conditions which may be imposed by the Minister, or in accordance with any directions given by him, borrow money for capital or current purposes.

[GA]

(2) Any moneys borrowed by the Council pursuant to this section and any interest accruing thereon may be secured on the revenue, funds or property of the Council.

[GA]

Acceptance of gifts by Council.

23.—(1) The Council may accept gifts of money, land or other property upon such trusts and conditions, if any, as may be specified by the donor.

[GA]

(2) The Council shall not accept a gift if the conditions attached to the acceptance by the donor are inconsistent with the functions of the Council.

[GA]

Expenses of Council and Minister.

24.—(1) All expenses incurred by the Council shall be defrayed by the Council out of funds at the disposal of the Council.

[GA]

(2) Any expenses incurred by the Minister in the administration of this Act shall, to such extent as may be approved by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

[GA]

Fees.

25.—The Council may charge such fees as may, from time to time, be determined by the Council, with the consent of the Minister, for—

[GA]

(a) the registration of a person in any register maintained by the Council,

[GA]

(b) the retention of the name of a person in any register maintained by the Council,

[GA]

(c) the restoration in any register maintained by the Council of the name of any person whose name has been erased or removed pursuant to the provisions of this Act from such register,

[GA]

(d) the entry of additional qualifications of any person in any register maintained by the Council,

[GA]

(e) the giving to any person of a certificate of registration, and

[GA]

(f) any other service which the Council may, from time to time, provide.

[GA][GA]

PART III

Registration

[GA]

Establishment of the register.

26.—(1) As soon as may be after the establishment of the Council the Council shall prepare and establish a register of medical practitioners (in this Act referred to as the register) to be known as the General Register of Medical Practitioners.

[GA]

(2) The register shall be in such form as the Council shall specify and shall indicate whether each person whose name is registered therein is fully registered, provisionally registered or temporarily registered.

[GA]

(3) Every person whose name is entered in the register shall, as soon as may be after his registration has been completed, be sent by the Council a certificate stating that his name has been entered in the register.

[GA]

(4) Every person whose name is entered in the register shall, as soon as may be after he has received the certificate specified in subsection (3) of this section, cause the said certificate to be displayed at the place where he conducts the practice of medicine at all times during which his registration continues and at no other time.

[GA]

(5) Notwithstanding the repeal of the Medical Praticitioners Act, 1927, effected by this Act, the Register of Medical Practitioners prepared and established by the Medical Registration Council under that Act shall be maintained and kept by the Council until such time as the Council prepares and establishes the register pursuant to subsection (1) of this section and the Register of Medical Practitioners shall until that time be deemed, for the purposes of this Act, to be the register.

Persons entitled to be registered in the register.

27.—(1) Subject to the provisions of this Act, every person whose name, at the date of the establishment of the register, is entered in the Register of Medical Practitioners maintained by the Medical Registration Council pursuant to the Medical Practitioners Acts, 1927 to 1961, shall be registered in the register.

(2) Any person who—

[GA]

(a) immediately before the establishment of the register was entitled to be registered in accordance with the Medical Practitioners Acts, 1927 to 1961, and was not so registered, or

[GA]

(b) following the establishment of the register, is awarded any of the primary qualifications specified in the Fourth Schedule to this Act, or

[GA]

(c) is a national of a Member State and has been awarded a qualification in medicine by a competent body or authority designated for that purpose by a Member State, pursuant to any Directive adopted by the Council of the European Communities, or

[GA]

(d) satisfies the Council that he has undergone such courses of training and passed such examinations as are specified for the purposes of this section in rules made by the Council, or

[GA]

(e) any person entitled to be registered pursuant to an order made under section 26 of the Medical Practitioners Act, 1927,

[GA]

shall, on making application in the form and manner determined by the Council and on payment of the appropriate fee, be registered in the register.

[GA]

(3) Nothing in this section shall operate to prevent the Council from refusing to register the name of any person, who is otherwise entitled to be registered, on the grounds of the unfitness of that person to engage in the practice of medicine.

[GA]

(4) On making a decision under subsection (3) of this section, the Council shall forthwith send by pre-paid post to the person to whom the decision relates a notice in writing stating the decision, the date thereof and the reasons therefor.

[GA]

(5) A person to whom a decision under subsection (3) of this section relates may, within the period of two months, beginning on the date of the decision, apply to the High Court for cancellation of the decision and if he so applies, the High Court, on the hearing of the application may either—

[GA]

(a) declare that it was proper for the Council to make the decision, or

[GA]

(b) cancel the decision and direct the Council to register the name of the person making the application.

[GA]

Provisional registration.

28.—(1) A person who has been awarded a primary qualification shall not become registered in the register otherwise than by way of provisional registration, unless he has been granted a certificate of experience by the body which awarded him that primary qualification.

[GA]

(2) A certificate of experience shall not be granted to any person for the purposes of subsection (1) of this section unless, after he had been awarded a primary qualification, that person had been engaged in employment in a residential medical capacity in one or more hospitals approved by the Council for this purpose and had been so engaged for such period or periods as may be determined by the Council.

[GA]

(3) In this section “employment in a residential medical capacity” means employment in the practice of medicine where the person in question is resident in a hospital where he is employed or conveniently near thereto, and he is, by the terms of his employment, required to be so resident.

[GA]

Temporary registration.

29.—(1) Where the Council is satisfied—

[GA]

(a) that a person, who is not otherwise entitled to registration, is or intends to be in the State temporarily for the purpose of employment in the practice of medicine in a hospital approved of by the Council for the purposes of this section, and

[GA]

(b) that such person holds a degree, diploma or other qualification which in the opinion of the Council, affords sufficient guarantee that he has the requisite knowledge and skill for the efficient practice of medicine, has passed an examination appropriate for obtaining such degree, diploma or other qualification and possesses a certificate of experience considered by the Council to be equivalent to that required for formal qualification, the Council may, subject to subsection (2) of this section, and upon such person's making application in the form and manner determined by the Council and on payment of the appropriate fee, temporarily register such person in the register for such period as the Council may determine.

(2) The Council may extend a period determined under subsection (1) of this section for such further period or periods as the Council may determine, provided that the aggregate of such periods shall not exceed five years.

[GA]

The Register of Medical Specialists.

30.—The Council may, with the consent of the Minister, prepare and establish a register to be known as the Register of Medical Specialists containing therein a division in respect of each specialty from time to time recognised by the Council pursuant to section 38 of this Act.

[GA]

Persons entitled to be registered in the Register of Medical Specialists.

31.—(1) Subject to the provisions of this Act, the following persons, who comply with the conditions specified in subsection (2) of this section, shall be entitled to be registered in the Register of Medical Specialists, that is to say—

[GA]

(a) every registered medical practitioner who, prior to the establishment of that register, has, in the opinion of the Council, completed his specialist training in a specialty recognised by the Council pursuant to section 38 (1) of this Act,

[GA]

(b) every registered medical practitioner who following the establishment of that register, is granted evidence of satisfactory completion of specialist training by a body recognised by the Council pursuant to section 38 (3) of this Act,

[GA]

(c) every national of a Member State who possesses a diploma, certificate or other evidence of formal qualification in specialised medicine recognised by the Council and awarded by a competent body or authority designated for that purpose by a Member State, pursuant to any Directive adopted by the Council of the European Communities, and

[GA]

(d) any person who satisfies the Council that he has completed a programme of training in specialised medicine of a standard considered by the Council to be adequate.

[GA]

(2) Before any person is registered in the Register of Medical Specialists, he shall—

[GA]

(a) be fully registered in the register,

[GA]

(b) apply for registration in the Register of Medical Specialists in the form and manner determined by the Council, and

[GA]

(c) pay such fee as may be determined by the Council including, if he applies for registration in more than one division of the Register of Medical Specialists, a separate fee in respect of each such registration.

[GA]

(3) Nothing in this section shall operate to prevent the Council from refusing to register the name of any person, who is otherwise entitled to be registered, on the grounds of the unfitness of that person to engage in the practice of medicine.

[GA]

(4) On making a decision under subsection (3) of this section, the Council shall forthwith send by pre-paid post to the person to whom the decision relates a notice in writing stating the decision, the date thereof and the reasons therefor.

[GA]

(5) A person to whom a decision under subsection (3) of this section relates, may, within the period of two months, beginning on the date of the decision, apply to the High Court for cancellation of the decision and if he so applies, the High Court, on the hearing of the application may either—

[GA]

(a) declare that it was proper for the Council to make the decision, or

[GA]

(b) cancel the decision and direct the Council to register the name of the person making the application.

[GA]

Registration of additional degrees and diplomas.

32.—(1) Subject to subsection (2) of this section, any person, who is registered in the register, may at any time after his first registration, apply in the manner and form determined by the Council to have a further qualification entered in the register in addition to his qualifications already entered therein.

[GA]

(2) The Council shall determine the qualifications not being qualifications required for the purpose of registration, which, on application by any person registered in the register and on payment of the appropriate fee, may be entered in the register as additional qualifications.

[GA]

(3) Whenever, on an application by any registered medical practitioner, the Council decides to enter in the register, pursuant to this section, any additional qualification in respect of that medical practitioner, the Council shall, as soon as may be after the registration has been completed, send to that medical practitioner a certificate stating that such additional qualification has been entered in the register.

[GA]

Application by registered medical practitioner to have his name removed from register.

33.—(1) Any registered medical practitioner may apply to the Council to have his name removed from any register maintained by the Council in which his name is registered and, on receipt of such application and on payment of the appropriate fee, the Council may remove the name of the registered medical practitioner from any such register.

[GA]

(2) Any person, whose name has been removed pursuant to subsection (1) of this section from any register maintained by the Council, may, at any time, apply to the Council to have his name restored to such register, and, subject to the provisions of this Act and on payment of the appropriate fee, the Council may restore the name of that person to any register from which it has been so removed.

[GA]

(3) In any case where a registered medical practitioner applies to the Council pursuant to this section to have his name removed from any register maintained by the Council and—

[GA]

(a) an application has been made pursuant to section 45 of this Act for an inquiry into the conduct of that registered medical practitioner, or

[GA]

(b) that registered medical practitioner has been convicted in the State of an offence triable on indictment or has been convicted outside the State of an offence consisting of acts or omissions which would constitute an offence triable on indictment if done or made in the State,

[GA]

the Council shall not consider the application by that registered medical practitioner to have his name so removed until such time as the Council has decided whether or not the name of such registered medical practitioner should be erased from any such register pursuant to the provisions of this Act.

[GA]

(4) Nothing in this section shall operate to prevent the Council from refusing to restore the name of any person, who is otherwise entitled to be registered, on the grounds of the unfitness of that person to engage in the practice of medicine.

[GA]

(5) On making a decision under subsection (4) of this section, the Council shall forthwith send by pre-paid post to the person to whom the decision relates a notice in writing stating the decision, the date thereof and the reasons therefor.

[GA]

(6) A person to whom a decision under subsection (4) of this section relates may, within the period of two months, beginning on the date of the decision, apply to the High Court for cancellation of the decision and if he so applies, the High Court, on the hearing of the application may either—

[GA]

(a) declare that it was proper for the Council to make the decision, or

[GA]

(b) cancel the decision and direct the Council to restore the name of the person making the application.

[GA]

Correction of any register.

34.—(1) For the purpose of keeping any register correct the Council shall from time to time as occasion requires correct all verbal or clerical errors in such register, remove therefrom all entries therein procured by fraud or misrepresentation, enter in any register every change which comes to their knowledge in the addresses of the persons registered therein, and remove from any register the names of all persons whose death has either been notified to, or come to the knowledge of, the Council.

(2) Whenever the Council takes any action pursuant to subsection (1) of this section for the purposes of keeping any register correct, the Council shall forthwith notify the person concerned, or his next of kin, as the case may be, of the action taken and of the reasons therefor.

PART IV

Education and Training

[GA]

CHAPTER 1

Functions of the Council

[GA]

Duties of Council in relation to education and training.

35.—It shall be the duty of the Council from time to time to satisfy itself—

[GA]

(a) as to the suitability of the medical education and training provided by any body in the State recognised by the Council for such purpose,

[GA]

(b) as to the standards of theoretical and practical knowledge required for primary qualifications,

[GA]

(c) as to the clinical training and experience required for the granting of a certificate of experience, and

[GA]

(d) as to the adequacy and suitability of postgraduate education and training provided by bodies recognised by the Council for the purposes of medical specialist training.

[GA]

Functions of the Council in relation to Directives adopted by the Council of the European Communities as to education and training.

36.—(1) The Council shall ensure that the requirements relating to education and training for a formal qualification shall satisfy the minimum standards specified in any Directive adopted by the Council of the European Communities relating to that qualification.

[GA]

(2) The Council shall ensure that the requirements relating to education and training in specialised medicine in the State shall satisfy the minimum standards specified in any Directive adopted by the Council of the European Communities relating to such education and training.

[GA]

Primary qualifications.

37.—(1) The primary qualifications granted in the State which shall entitle a person to be registered in the register shall be the qualifications specified in the Fourth Schedule to this Act.

[GA]

(2) The Minister may, if he thinks fit, on the recommendation of the Council, by regulations made under this section amend the provisions of the Fourth Schedule to this Act.

Training bodies and qualifications for the purposes of the Register of Medical Specialists.

38.—(1) The Council may, from time to time with the consent of the Minister, determine the specialties which it shall recognise for the purpose of its functions under this Act.

(2) The Council may, from time to time specify, in relation to each specialty recognised by it, the titles and designations of qualifications in specialised medicine granted in the State which may be required to enable a person to secure registration in the Register of Medical Specialists.

(3) The Council shall from time to time determine, in relation to each specialty recognised by it, the body or bodies which the Council shall recognise in the State for the purpose of granting evidence of satisfactory completion of specialist training.

(4) The Council may, with the consent of the Minister, withdraw recognition from any body recognised by it pursuant to subsection (3) of this section.

(5) The specialities recognised by the Council pursuant to subsection (1) of this section shall include such specialities as may be designated as applying to the State in any Directive adopted by the Council of the European Communities relating to specialised medicine.

CHAPTER 2

The Postgraduate Medical and Dental Board

[GA]

Establishment of the Postgraduate Medical and Dental Board.

39.—(1) There shall by virtue of this section be established a body to be known as an Bord Míochaine agus Déidliachta Iarchéime, or in the English language as the Postgraduate Medical and Dental Board (in this Act referred to as the Board) to fulfil the functions assigned to it by this Act.

(2) The following provisions shall have effect in relation to the Board—

[GA]

(a) the Board shall be a body corporate with perpetual succession and power to sue and be sued in its corporate name and to acquire, hold and dispose of land;

[GA]

(b) the Board shall not dispose of land or property save with the consent of the Minister;

[GA]

(c) the Board shall as soon as may be after its establishment provide itself with a seal;

[GA]

(d) the Minister may, out of moneys provided by the Oireachtas, make grants towards the expenses of the Board;

[GA]

(e) (i) the Board may appoint such committees as it thinks fit and may define the functions and procedure of any such committee and may delegate specific functions to any such committee;

[GA]

(ii) the Board may appoint as members of a committee established under this paragraph persons who are not members of the Board;

[GA]

(f) the Board may, subject to the provisions of this Act, regulate its own procedure;

[GA]

(g) the Third Schedule to this Act shall apply to the Board.

[GA]

Functions of the Board.

40.—The functions of the Board shall be:—

[GA]

(a) to promote the development of postgraduate medical and dental education and training and to co-ordinate such developments;

[GA]

(b) to advise the Minister, after consultation with the bodies specified in sections 9 (1) (a), 9 (1) (b), 9 (1) (c), 9 (1) (d) and 9 (1) (e) of this Act, and with such other bodies as the Board may consider appropriate, on all matters, including financial matters, relating to the development and co-ordination of postgraduate medical and dental education and training;

(c) to provide career guidance for registered medical practitioners and registered dentists.

[GA]

Assignment to the Board of additional functions.

41.—The Board shall carry out such functions, other than functions assigned to it by this Act, as may be assigned to it from time to time by the Minister following consultation with the Board in relation to postgraduate medical and dental education and training.

Membership of the Board.

42.—(1) The Board shall consist of twenty-five members, appointed by the Minister, of whom—

[GA]

(a) each shall be a person having practical experience or special knowledge of the matters relating to the functions of the Board,

[GA]

and

[GA]

(b) not less than twenty shall either be registered medical practitioners or registered dentists.

[GA]

(2) Before making appointments to the Board, the Minister shall consult with—

[GA]

(a) the Council,

[GA]

(b) the Dental Board,

[GA]

(c) the appropriate bodies, and

[GA]

(d) any organisation which, in the opinion of the Minister, represents, in the State, registered medical practitioners or registered dentists.

[GA]

(3) In this section “the appropriate bodies” means any body or organisation specified in sections 9 (1) (a), 9 (1) (b), 9 (1) (c), 9 (1) (d) or 9 (1) (e) of this Act or any body or organisation recognised by the Council pursuant to section 38 (3) of this Act.

[GA]

Officers and servants of the Board.

43.—(1) The Board shall appoint such and so many persons to be officers and servants of the Board as the Board from time to time thinks proper.

[GA]

(2) An officer or servant of the Board shall hold his office or employment on such terms and conditions and shall perform such duties as the Board from time to time determines.

[GA]

(3) There shall be paid by the Board to its officers and servants out of funds at its disposal such remuneration and allowances as the Board, with the consent of the Minister, from time to time determines.

[GA]

(4) The Minister may, whenever and as often as he thinks fit, declare that any power conferred on the Board by this section shall be exercisable only with the consent of the Minister and whenever any such declaration is in force, the said power may, in relation to any office or employment to which the declaration applies, be exercisable only with such consent.

Application of Act to Board.

44.Sections 8 (2), 8 (3), 12, 14, 18, 19, 20, 21, 22, 23 and 24 of, and Rules 8, 10, 11, 12, 13, 14, 15, 16, 18 and 19 of the Second Schedule to, this Act shall apply to the Board and for this purpose any reference in these sections and Rules to the Council shall be construed as a reference to the Board and any reference therein to the President or Vice-President of the Council shall be construed as a reference to the Chairman or Vice-Chairman of the Board, as the case may be.

PART V

Fitness to Practise

[GA]

Inquiry by the Fitness to Practise Committee into the conduct of a registered medical practitioner.

45.—(1) The Council or any person may apply to the Fitness to Practise Committee for an inquiry into the conduct of a registered medical practitioner on the grounds of—

[GA]

(a) his alleged professional misconduct, or,

[GA]

(b) his fitness to engage in the practice of medicine by reason of physical or mental disability,

[GA]

and the application shall, subject to the provisions of this Act, be considered by the Fitness to Practise Committee.

[GA]

(2) Where an application is made under this section and the Fitness to Practise Committee, after consideration of the application, is of opinion that there is not sufficient cause to warrant the holding of an inquiry, it shall so inform the Council and the Council, having considered the matter, may decide that no further action shall be taken in relation to the matter and shall so inform the Committee and the applicant, or it may direct the Committee to hold an inquiry into the matter in accordance with the provisions of this section.

(3) Where an application for an inquiry is made under this section and the Fitness to Practise Committee, after consideration of the application is either of opinion that there is a prima facie case for holding the inquiry or has been given a direction by the Council pursuant to subsection (2) of this section to hold the inquiry, the following shall have effect

[GA]

(a) the Committee shall proceed to hold the inquiry,

[GA]

(b) the Registrar, or any other person with the leave of the Fitness to Practise Committee, shall present to the Committee the evidence of alleged professional misconduct or unfitness to practise by reason of physical or mental disability, as the case may be,

[GA]

(c) on completion of the inquiry, the Committee shall embody its findings in a report to the Council specifying therein the nature of the application and the evidence laid before it and any other matters in relation to the registered medical practitioner which it may think fit to report including its opinion, having regard to the contents of the report, as to—

[GA]

(i) the alleged professional misconduct of the registered medical practitioner or

[GA]

(ii) the fitness or otherwise of that practitioner to engage in the practice of medicine by reason of his alleged physical or mental disability

[GA]

as the case may be.

[GA]

(4) When it is proposed to hold an inquiry under subsection (3) of this section the person who is the subject of the inquiry shall be given notice in writing by the Registrar sent by pre-paid post to the address of that person as stated in the register of the nature of the evidence proposed to be considered at the inquiry and that person and any person representing him shall be given the opportunity of being present at the hearing.

(5) The findings of the Fitness to Practise Committee on any matter referred to it and the decision of the Council on any report made to it by the Fitness to Practise Committee shall not be made public without the consent of the person who has been the subject of the inquiry before the Fitness to Practise Committee unless such person has been found, as a result of such inquiry, to be—

[GA]

(a) guilty of professional misconduct, or

[GA]

(b) unfit to engage in the practice of medicine because of physical or mental disability,

[GA]

as the case may be.

[GA]

(6) The Fitness to Practise Committee shall for the purpose of an inquiry held under subsection (3) of this section have the powers, rights and privileges vested in the High Court or a judge thereof on the hearing of an action in respect of—

[GA]

(a) the enforcement of the attendance of witnesses and their examination on oath or otherwise, and

[GA]

(b) the compelling of the production of documents,

[GA]

and a summons signed by the Chairman of the Committee or by such other member of the Committee as may be authorised by the Committee for that purpose may be substituted for and shall be equivalent to any formal procedure capable of being issued in an action for enforcing the attendance of witnesses and compelling the production of documents.

[GA]

(7) Where—

[GA]

(a) a person on being duly summoned to attend before the Fitness to Practise Committee makes default in attending, or

[GA]

(b) a person, being in attendance as a witness before the Fitness to Practise Committee, refuses to take an oath lawfully required by the Fitness to Practise Committee to be taken, or to produce any document in his power or control lawfully required by the Fitness to Practise Committee to be produced by him or to answer any question to which the Fitness to Practise Committee may lawfully require an answer, or

[GA]

(c) a person, being in attendance before the Fitness to Practise Committee, does anything which, if the Fitness to Practise Committee were a court of law having power to commit for contempt, would be contempt of court.

[GA]

such person shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £500.

[GA]

(8) A witness before the Fitness to Practise Committee shall be entitled to the same immunities and privileges as if he were a witness before the High Court.

[GA]

(9) If the Fitness to Practise Committee require the medical records of a patient of any registered medical practitioner to be produced for the purposes of any inquiry conducted by that Committee, such records shall not be made available to the Committee, without the consent of the patient concerned, unless the Committee specifically direct the registered medical practitioner concerned to produce such records.

Erasure or suspension of registration from register for professional misconduct, unfitness to practise or failure to pay retention fee.

46.—(1) Where a registered medical practitioner—

[GA]

(a) has been found, by the Fitness to Practise Committee, on the basis of an inquiry and report pursuant to section 45 of this Act, to be guilty of professional misconduct or to be unfit to engage in the practice of medicine because of physical or mental disability,

[GA]

or,

[GA]

(b) has failed to pay a retention fee charged by the Council under section 25 of this Act after the Council had not less than two months previously by notice in writing sent by pre-paid post to the person, at his address as stated in the register, requested payment of the fee on more than one occasion, the Council may decide that the name of such person should be erased from the register or from the Register of Medical Specialists as the case may be or that during a period of specified duration registration of his name in the register concerned should not have effect.

(2) On making a decision under this section, the Council shall forthwith send by pre-paid post to the person to whom the decision relates, at his address as stated in the register, a notice in writing stating the decision, the date thereof and the reasons therefor.

[GA]

(3) A person to whom a decision under this section relates may, within the period of 21 days, beginning on the date of the decision, apply to the High Court for cancellation of the decision and if he so applies—

[GA]

(a) the High Court, on hearing of the application, may either—

[GA]

(i) cancel the decision, or,

[GA]

(ii) declare that it was proper for the Council to make a decision under this section in relation to such person and either (as the Court may consider proper) direct the Council to erase his name from the register concerned or direct that during a specified period (beginning not earlier than 7 days after the decision of the Court) registration of his name in that register shall not have effect,

[GA]

(b) if at any time the Council satisfies the High Court that such person has delayed unduly in proceeding with the application, the High Court shall, unless it sees good reason to the contrary, declare that it was proper for the Council to make a decision under this section in relation to such person and either (as the Court may consider proper) direct the Council to erase his name from the register concerned or direct that during a specified period (beginning not earlier than 7 days after the decision of the Court) registration of his name in that register shall not have effect,

(c) the High Court may direct how the costs of the application are to be borne.

[GA]

(4) Where a person to whom a decision of the Council under this section relates does not, within the period of 21 days beginning on the date of the decision, apply to the High Court for cancellation of the decision, the Council may apply ex parte to the High Court for confirmation of the decision and, if the Council so applies, the High Court, on the hearing of the application shall, unless it sees good reason to the contrary, declare accordingly and either (as the Court may consider proper) direct the Council to erase the name of such person from the register concerned or direct that during a specified period (beginning not earlier than 7 days after the decision of the Court) registration of his name in that register shall not have effect.

(5) The decision of the High Court on an application under this section shall be final, save that, by leave of that Court or the Supreme Court, an appeal, by the Council or the person concerned, from the decision shall lie to the Supreme Court on a specified question of law.

[GA]

(6) (a) On erasing the name of a person from any register under this section, the Council shall forthwith send by pre-paid post to such person, at his address as stated in the register, notice in writing of the erasure.

[GA]

(b) Where a direction is given under this section that during a specified period registration of the name of a person in any register shall not have effect, the Council shall, before the commencement of that period, send by pre-paid post to such person, at his address as stated in the register, notice in writing of such direction.

[GA]

(7) The name of any person which has been erased from any register under this section may at any time be restored to that register by direction of the Council but not otherwise, and when a person's name is so restored to that register, the Council may attach to the restoration such conditions (including the payment of a fee not exceeding the fee which would be payable by such person for registration if he was then being registered for the first time) as the Council thinks fit.

(8) Where the registration of a person in any register has ceased to have effect under this section for a period of specified duration, the Council may, if it so thinks fit, on application made to it by such person, by direction terminate the suspension.

(9) On the hearing of an application under this section, the High Court may, if it thinks proper to do so, admit and have regard to evidence of any person of standing in the medical profession as to what is professional misconduct.

Attaching of conditions to retention on register.

47.—(1) The Council, following an inquiry and report by the Fitness to Practise Committee pursuant to section 45 of this Act, may decide to attach such conditions as it thinks fit to the retention in any register maintained under this Act of a person whose name is entered in such register.

(2) On making a decision under this section, the Council shall forthwith send by pre-paid post to the person to whom the decision relates, at his address as stated in the register, a notice in writing stating the decision, the date thereof and the reasons therefor.

[GA]

(3) A person to whom a decision under this section relates may, within the period of 21 days beginning on the date of the decision, apply to the High Court for cancellation of the decision and if he so applies—

[GA]

(a) the High Court, on the hearing of the application, may either—

[GA]

(i) cancel the decision, or

[GA]

(ii) declare that it was proper for the Council to make a decision under this section in relation to such person and (as the Court may consider proper) direct the Council to attach such conditions as the Court thinks fit to the retention of the name of such person in any register maintained under this Act,

[GA]

(b) if at any time the Council satisfies the High Court that such person has delayed unduly in proceeding with the application, the High Court shall, unless it sees good reason to the contrary, declare that it was proper for the Council to make a decision under this section in relation to such person and (as the Court may consider proper) direct the Council to attach such conditions as the Court may specify to the retention of the name of such person in any register maintained under this Act,

(c) the High Court may direct how the costs of the application are to be borne.

[GA]

(4) Where a person to whom a decision of the Council under this section relates does not within the period of 21 days beginning on the date of the decision, apply to the High Court for cancellation of the decision, the Council may apply ex parte to the High Court for confirmation of the decision and, if the Council so applies, the High Court, on the hearing of the application shall, unless it sees good reason to the contrary, declare accordingly and (as the Court may consider proper) direct the Council to attach such conditions as the Court may specify to the retention of the name of such person on any register maintained under this Act.

(5) The decision of the High Court on an application under this section shall be final save that, by leave of that Court or the Supreme Court, an appeal by the Council or the person concerned from the decision shall lie to the Supreme Court on a specified question of law.

[GA]

(6) On attaching conditions under this section to the retention of the name of a person on any register maintained under this Act, the Council shall forthwith send by pre-paid post to such person, at his address as stated in the register, notice in writing of the conditions.

[GA]

(7) The Council may at any time remove in whole or in part the conditions attached to the retention of the name of any person on any register maintained under this Act.

[GA]

Powers of Council to advise, admonish, etc.

48.—(1) The Council, following an inquiry and report by the Fitness to Practise Committee pursuant to section 45 of this Act into the conduct of a person whose name is entered in any register maintained under this Act may, on receipt of the report of the Committee, if it so thinks fit, advise, admonish or censure such person in relation to his professional conduct.

(2) The powers conferred by subsection (1) of this section may be exercised either in addition to or in substitution for any of the powers conferred by sections 46, 47 and 49 of this Act.

[GA]

Erasure from register of persons convicted of indictable offences.

49.—(1) Where a registered medical practitioner is convicted in the State of an offence triable on indictment or is convicted outside the State of an offence consisting of acts or omissions which would constitute an offence triable on indictment if done or made in the State, the Council may decide that the name of such person should be erased from the register.

(2) On making a decision under this section, the Council shall forthwith send by pre-paid post to the person to whom the decision relates, at his address as stated in the register, a notice in writing stating the decision, the date thereof and the reasons therefor.

[GA]

(3) A person to whom a decision under this section relates may, within the period of 21 days, beginning on the date of the decision, apply to the High Court for cancellation of the decision and if he so applies—

[GA]

(a) the High Court, on the hearing of the application, may either—

[GA]

(i) cancel the decision, or

[GA]

(ii) confirm the decision and direct the Council to erase the name of such person from the register,

[GA]

(b) if at any time the Council satisfies the High Court that such person has delayed unduly in proceeding with the application, the High Court shall, unless it sees good reason to the contrary, confirm the decision and direct the Council to erase the name of such person from the register,

[GA]

(c) the High Court may direct how the costs of the application are to be borne.

[GA]

(4) Where a person to whom a decision of the Council under this section relates does not within the period of 21 days, beginning on the date of the decision, apply to the High Court for cancellation of the decision, the Council may apply ex parte to the High Court for confirmation of the decision and, if the Council so applies, the High Court, on the hearing of the application, shall, unless it sees good reason to the contrary, confirm the decision and direct the Council to erase the name of such person from the register.

(5) The decision of the High Court on an application under this section shall be final, save that, by leave of that Court or the Supreme Court, an appeal, by the Council or the person concerned, from the decision shall lie to the Supreme Court on a specified question of law.

(6) On erasing the name of a person from the register under this section, the Council shall forthwith send by pre-paid post to such person, at his address as stated in the register, notice in writing of the erasure.

[GA]

(7) The name of any person which has been erased from the register under this section may at any time be restored to the register by direction of the Council but not otherwise, and when a person's name is so restored to the register, the Council may attach to the restoration such conditions (including the payment of a fee not exceeding the fee which would be payable by such person if he was then being registered for the first time) as the Council thinks fit.

Continuance of existing inquiry.

50.—Where the Medical Registration Council has decided to hold, or has appointed any member or members of that Council to hold, an inquiry pursuant to section 30 of the Medical Practitioners Act, 1927, and that inquiry has not been completed before the commencement of this Act, the inquiry shall be discontinued and shall be recommenced by the Fitness to Practise Committee as if this Act had been in force at the time at which such decision was taken or such member or members were appointed and the provisions of this Part of this Act shall apply to any inquiry discontinued and recommenced pursuant to this section.

Application by Council for order suspending registration.

51.—(1) Whenever the Council is satisfied that it is in the public interest so to do, the Council may apply to the High Court for an order in relation to any person registered in any register maintained under this Act that, during the period specified in the order, registration of that person's name in that register shall not have effect.

[GA]

(2) An application under this section may be made in a summary manner and shall be heard otherwise than in public.

[GA]

(3) The High Court may make, in any application under this section, such interim or interlocutory order (if any) as it considers appropriate.

[GA]

Privilege in respect of certain matters.

52.—Proceedings under section 45 of this Act, proceedings of or communications to or by the Council pursuant to sections 46, 47, 48 or 49 of this Act, reports made by the Fitness to Practise Committee to the Council under this Part of this Act and any other communications between the Committee and the Council made in the exercise or performance of the powers, duties or functions of the Committee or the Council, as the case may be, shall in any action for defamation, be absolutely privileged.

Erasure or suspension from and restoration to the Register of Medical Specialists.

53.—(1) Where a person's name has been erased or suspended from the register, the name shall, as soon as may be, if it is registered in the Register of Medical Specialists be erased or suspended therefrom, as the case may be.

[GA]

(2) Where a person's name has been restored to the register or its suspension from the register has been terminated, the name shall, if it was registered in the Register of Medical Specialists, be restored to such register or its suspension therefrom be terminated, as the case may be.

[GA]

Notification to Minister of name erased or restored and of suspensions imposed and terminated.

54.—The Council shall notify the Minister, on the occasion of—

[GA]

(a) the erasure of the name of a person from a register maintained under this Act,

[GA]

(b) the restoration of the name of a person to a register maintained under this Act,

[GA]

(c) the suspension of the name of a person from a register maintained under this Act,

[GA]

(d) the termination of a period of suspension from a register maintained under this Act, or

[GA]

(e) the attachment of conditions to the retention of the name of a person on a register maintained under this Act,

[GA]

of the erasure, restoration, suspension, termination of suspension or attachment of conditions, as the case may be.

[GA]

Restoration to register of name removed or termination of suspension for non-payment of retention fee.

55.—(1) The Council shall, on the payment of a special fee to the Council by any person whose name was erased or whose registration was suspended pursuant to section 46 (1) (b) of this Act from any register for non-payment of a retention fee (and for no other reason) restore the person's name to that register or terminate the suspension, as the case may be.

(2) In this section “special fee” means a fee of such amount as may be fixed from time to time by the Council with the consent of the Minister.

PART VI

Miscellaneous

[GA]

Arrangements with persons to assist Council.

56.—The Council may make and carry out arrangements with any person or body to assist the Council or any of its committees in the proper discharge of any of its functions.

[GA]

Publication of registers.

57.—(1) The Council shall print, publish and place on sale copies of any register maintained by it at intervals of not more than five years and, in every year in which any register is not printed and published, the Council shall print, publish and place on sale a supplement to each such register.

[GA]

(2) The most recently published copy of each register maintained by the Council and any supplements thereto shall, at all times, be made available for inspection by any person, during office hours, by the Council at its office and by the chief executive officer of the health board at the headquarters of any health board established under the Health Act, 1970.

[GA]

Construction of references to registered medical practitioner.

58.—Every reference to a registered medical practitioner contained in any enactment or any statutory instrument shall be construed as a reference to a person who is registered in the register.

[GA]

Persons entitled to sign medical certificates.

59.—Every certificate which is required for any purpose by or under any Act for the time being in force (whether passed before or after this Act) to be signed by any physician, surgeon, licentiate in medicine and surgery or other medical practitioner shall on or after the establishment of the register be signed by a person who is registered in the register and no such certificate signed on or after the establishment of the register by a person who is not so registered shall be of any validity or effect.

Prohibition of recovery of fees for medical services by unregistered persons.

60.—On and after the establishment of the register, no person shall be entitled to recover in any legal proceedings any fee or charge for or on account of any medical or surgical advice or attendance given by him, or any surgical operation performed by him, or any medicines both prescribed and supplied by him, unless such person was registered in the register at the date on which such advice or attendance was given or such operation was performed or such medicines were prescribed and supplied, as the case may be.

Offences and penalties in relation to the register.

61.—(1) It shall be an offence for a person to—

[GA]

(a) make any false declaration or misrepresentation for the purpose of obtaining registration in any register maintained by the Council under this Act or to aid and abet the making of any such false declaration or misrepresentation, or

[GA]

(b) falsely represent himself to be a registered medical practitioner when he is not so registered.

[GA]

(2) A person who contravenes the provisions of subsection (1) of this section shall be liable on summary conviction to a fine not exceeding five hundred pounds or to imprisonment for a term not exceeding twelve months or to both such fine and such imprisonment.

Functions in relation to Directives adopted by the Council of the European Communities.

62.—The Council shall carry out such functions as may be assigned to it from time to time by the Minister in relation to the implementation of any Directive adopted by the Council of the European Communities relating to the practice of medicine.

[GA]

Assignment to the Council of additional functions.

63.—The Council shall carry out such functions, other than functions assigned to it by this Act, as may be assigned to it from time to time by the Minister in relation to medical education and training or other matters relating to the practice of medicine and the persons engaged in such practice.

References in enactments etc. to Medical Registration Council.

64.—Every reference to the Medical Registration Council contained in any other enactment or any statutory instrument shall be construed as a reference to the Council.

[GA]

Regulations.

65.—(1) The Minister may make regulations for the purposes of giving effect to any of the provisions of this Act.

[GA]

(2) Every regulation, other than a regulation made under section 9 (2) of this Act, made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either House of the Oireachtas within the next twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.

Regulations regarding adaptations.

66.—The Minister may by regulations make in respect of any statute, order or regulation in force at the passing of this Act and relating to any matter or thing dealt with or affected by this Act, any adaptation or modifications which appear to him to be necessary to enable such statute, order or regulation to have effect in conformity with this Act.

Continuance in force of certain orders.

67.—Notwithstanding the repeal of the Medical Practitioners Act, 1927, effected by this Act, any order made under section 26 of that Act shall continue in force and effect until such time as it may be terminated by an order made by the Government under this section.

Continuance in force of agreement.

68.—(1) Notwithstanding the repeal of the Medical Practitioners Act, 1927, effected by this Act, the agreement specified in the First Schedule to that Act shall continue to have full force and effect until such time as the Minister, by order made under this section, declares that, pursuant to an agreement made between the Government and the Government of the United Kingdom, the said agreement shall cease to have effect.

(2) An order made by the Minister under this section may contain such incidental, supplementary and consequential provisions as appear to the Minister to be necessary.

General advisory functions of the Council.

69.—(1) It shall be a function of the Council to advise the Minister, either at the request of the Minister or on its own initiative, on all matters relating to the functions assigned to the Council under this Act.

(2) It shall be a function of the Council to give guidance to the medical profession generally on all matters relating to ethical conduct and behaviour.

(3) It shall be a function of the Council to inform the public on all matters of general interest relating to the functions of the Council.

SECOND SCHEDULE

Rules in relation to Membership and Meetings of Comhairle na nDochtuiri Leighis (The Medical Council)

Tenure of Office

1. Subject to the provisions of this Schedule in relation to the filling of casual vacancies, every member of the Council shall hold office, unless he sooner dies, resigns or becomes disqualified, for a period of five years.

2. No person shall hold office as a member of the Council for more than two consecutive terms of five years.

Resignations and Termination of Membership

3. The Minister may at any time terminate the appointment of a member of the Council who was appointed by him.

4. A member of the Council may resign his membership by giving notice in writing signed by him to the Council, but the resignation shall not become effective until the meeting of the Council next held after receipt of the notice of resignation.

5. The membership of the Council of a person appointed by election shall terminate on his ceasing to be a registered medical practitioner engaged in the practice of medicine.

Casual Vacancies

6. (a) Whenever a casual vacancy occurs among the members of the Council, other than those appointed by election, the Council shall forthwith notify the body or authority which appointed such person and that body or authority shall, as soon as is convenient, appoint a person to fill such vacancy and any person so appointed shall serve as a member of the Council for such period as is unexpired of the term of office of the person whom he replaces.

(b) Whenever a casual vacancy occurs among the members of the Council appointed by election, the Council, after consultation with the Minister, shall co-opt a person who would, pursuant to the provisions of this Act, be eligible for election to fill such vacancy and any person so co-opted shall serve as a member of the Council for such period as is unexpired of the term of office of the person whom he replaces.

Quorum

7. The quorum for a meeting of the Council shall be seven; provided that, in the case of a meeting of the Council where the matter of the erasure of the name of a registered medical practitioner from any register maintained by the Council, or the matter of the suspension of a registered medical practitioner from any such register, or the matter of the attachment of conditions to the continued registration of a registered medical practitioner, is on the agenda, the quorum shall be ten.

Meetings

8. The Council shall hold at least four meetings in every year and may hold such other meetings as may be necessary for the performance of its duties.

President and Vice-President

9. (1) The Council shall, from time to time, elect one of its members to be President of the Council and another of its members to be Vice-President of the Council.

(2) A President and Vice-President of the Council, as the case may be, shall each hold office as such for such term as may be specified by the Council at the time of his appointment unless—

(a) he ceases to be, or becomes disqualified from being, a member of the Council,

(b) he resigns the office of President or Vice-President, as the case may be, and his resignation becomes effective under this paragraph,

(c) the Council by a resolution, for which not less than two-thirds of the members of the Council vote, and of the intention to propose which not less than seven days notice is given to every member of the Council, terminates his appointment as President or Vice-President.

(3) A President or Vice-President of the Council may at any time resign his office as such by giving notice in writing signed by him to the Council, but the resignation shall not become effective until the meeting of the Council next held after the receipt by the Council of the notice of resignation.

(4) Whenever, at an election of the President or Vice-President of the Council, there is an equality of votes for two or more persons, it shall be determined by lot which of those persons shall be President or Vice-President, as the case may be.

Proceedings at Meetings

10. The proceedings of the Council shall not be invalidated by any vacancy or vacancies among its members or by any defect in the appointments to the Council or in the qualifications of any member thereof.

11. The President, or in his absence, the Vice-President of the Council may convene a meeting of the Council on his own initiative or when he is requested so to do by a requisition signed by not less than six members of the Council.

12. (1) If the President, or in his absence the Vice-President, of the Council refuses to convene a meeting of the Council after a requisition for that purpose signed by not less than six members of the Council has been presented to him, any three members of the Council may forthwith convene a meeting of the Council.

(2) If the President, or in his absence the Vice-President, of the Council, without so refusing, does not, within seven days after the presentation of a requisition for that purpose signed by not less than six members of the Council, convene a meeting of the Council, any three members of the Council may, on the expiration of those seven days, convene a meeting of the Council.

13. At least three clear days before every meeting of the Council, notice, signed by the President or Vice-President of the Council, as the case may be, or, if the meeting is convened by members of the Council, by such members, of the time and place of the meeting shall be sent to every member, of the Council: if the meeting is convened by members of the Council, the notice convening the meeting shall specify the business to be transacted thereat.

14. At a meeting of the Council—

(a) the President of the Council shall, if he is present, be the chairman,

(b) if and so long as the President of the Council is not present, or if the office of President is vacant, the Vice-President of the Council shall, if he is present, be the chairman,

(c) if and so long as the President of the Council is not present or the office of President is vacant and the Vice-President of the Council is not present or the office of Vice-President is vacant, the members of the Council who are present shall elect one of their number to be chairman of that meeting.

15. Minutes of the proceedings of all meetings of the Council shall be drawn up and entered in a book kept for that purpose and such minutes shall be signed by the chairman of the next ensuing meeting.

16. The names of all members present at a meeting of the Council shall be recorded in the minutes of the proceedings of the meeting.

17. Subject to Articles 7 and 9 (4) of this Schedule, all acts of the Council and all questions coming or arising before the Council may be done and decided by a majority of such members of the Council as are present and vote in relation to the act or matter at a meeting of the Council duly convened according to law.

18. In the case of equality of votes on any question arising at a meeting of the Council (other than the election of the President or the Vice-President) the chairman of that meeting shall have a second or casting vote.

19. Save as is otherwise provided by any enactment, including this Act, the Council may make standing orders for the regulation of its proceedings, and may amend or revoke such standing orders.

Rules in Relation to An Bord Miochaine agus Deidliachta Iarcheime (The Postgraduate Medical and Dental Board).
