AN tACHT RIALTAIS ÁITIÚIL (PLEANÁIL AGUS FOR-BAIRT), 1976

Léiriú.
1.—San Acht seo—
ciallaíonn “an lá iomchuí” an lá a thiocfaidh alt 14 den Acht seo i ngníomh;
tá le “an Bord” an bhrí a thugtar dó le halt 3 den Acht seo;
ciallaíonn “cuideachta”, ach amháin in alt 34 (4), cuideachta de réir brí alt 2 d'Acht na gCuideachtaí, 1963, nó cuideachta atá corpraithe lasmuigh den Stát;
ciallaíonn “an lá bunaithe” an lá a cheapfar mar lá bunaithe chun críocha an Achta seo le hordú ón Aire faoi alt 2 den Acht seo;
ciallaíonn “oifig bhreithiúnach” oifig, arb í oifig an Phríomh-Bhreithimh, Uachtarán na hArd-Chúirte, gnáth-bhreithimh den Chúirt Uachtarach nó gnáth-bhreithimh den Ard-Chúirt í;
ciallaíonn “bainisteoir” bainisteoir de réir brí alt 1 den Acht um Bainistí Chathrach agus Contae (Leasú), 1955;
ciallaíonn “an Príomh-Acht” an tAcht Rialtais Áitiúil (Pleanáil agus Forbairt), 1963;
folaíonn “scaireanna” stoc agus forléireofar “scairchaipiteal” dá réir sin.
An lá bunaithe.
2.—Féadfaidh an tAire, le hordú, lá a cheapadh mar lá bunaithe chun críocha an Achta seo.
Bord Pleanála a bhunú.
3.—(1) Bunófar, an lá bunaithe, comhlacht dá ngairfear An Bord Pleanála (ar a dtugtar an Bord san Acht seo) chun na feidhmeanna a chomhlíonadh a shanntar dó leis an Acht seo.
(2) Beidh éifeacht maidir leis an mBord le forálacha an Sceidil a ghabhann leis an Acht seo.
Cathaoirleach an Bhoird.
4.—(1) Is é a bheidh ina chathaoirleach ar an mBord—
(a) cibé gnáth-bhreitheamh den Ard-Chúirt a bheidh ainmnithe de thuras na huaire lena thoiliú féin ag an Rialtas tar éis dul i gcomhairle le hUachtarán na hArd-Chúirte, nó
(b) duine a ainmneoidh an Rialtas agus a shealbhaigh tráth, ach nach sealbhaíonn faoi láthair, oifig bhreithiúnach.
(2) Má bhíonn, díreach sula bhfeidhmeoidh an Rialtas cumhacht faoi fho-alt (1) den alt seo, ainmniúchán i bhfeidhm faoin bhfo-alt sin, ansin, nuair a fheidhmeoidh, scoirfidh an t-ainmniúchán d'éifeacht a bheith leis.
(3) Breitheamh den Ard-Chúirt is cathaoirleach ar an mBord scoirfidh sé de bheith ina chathaoirleach ar an mBord ar scor dó de bheith ina ghnáth-bhreitheamh den Ard-Chúirt.
(4) Duine a scoirfidh de bheith ina chathaoirleach ar an mBord de bhua fho-alt (3) den alt seo féadfar é a cheapadh faoi fho-alt (1) den alt seo.
(5) I gcás a n-ainmneofar duine faoi fho-alt (1) den alt seo, beidh feidhm ag na forálacha seo a leanas ar feadh na tréimhse iomchuí, is é sin,
(a) ní chuirfear san áireamh, le linn alt 1 (1) d'Acht na gCúirteanna, 1973, a bheith á fheidhmiú, gur gnáth-bhreitheamh den Ard-Chúirt an duine, agus
(b) beidh éifeacht dá réir sin leis an alt sin 1 (1).
(6) San alt seo ciallaíonn “an tréimhse iomchuí”, maidir le duine atá ainmnithe faoi fho-alt (1) den alt seo, an tréimhse dar tosach lá an duine sin a ainmniú amhlaidh agus dar críoch—
(a) an lá a scoirfidh an duine de bheith ina ghnáth-bhreitheamh den Ard-Chúirt, nó
(b) an lá a dhéanfar an chéad ainmniúchán eile den sórt sin,
cibé lá acu is túisce.
Coinneoidh an Bord é féin eolasach ar pholasaithe agus ar chuspóirí áirithe.
5.—(1) Coinneoidh an Bord, a mhéid is dóigh leis is gá lena fheidhmeanna a chomhlíonadh, é féin eolasach ar na polasaithe agus ar na cuspóirí arb iad, de thuras na huaire, na polasaithe agus na cuspóirí atá ag an Aire, ag údaráis phleanála agus aon chomhlacht eile is comhlacht poiblí a bhfuil baint, nó a bhféadfadh baint a bheith, ag a fheidhmeanna le pleanáil chuí agus le forbairt chuí (lena n-áirítear caomhnú agus forbairt taitneamhachtaí) cathracha, bailte nó limistéir eile, uirbeach nó tuaithe.
(2) San alt seo ciallaíonn “údarás poiblí” aon Aire Stáit seachas an tAire, Coimisinéirí na nOibreacha Poiblí in Éireann, Coimisiún Talún na hÉireann, údarás cuain de réir brí alt 2 den Acht Cuanta, 1946, agus aon chomhlacht eile a bunaíodh le reacht nó faoi reacht a mbeidh sé dearbhaithe de thuras na huaire, le rialachán a rinne an tAire, gur údarás poiblí é chun críocha an ailt seo.
Treoracha ginearálta polasaí maidir le forbairt.
6.—(1) Tabharfaidh an tAire, ó am go ham, don Bhord cibé treoracha ginearálta is dóigh leis is gá maidir le polasaí i ndáil le pleanáil agus forbairt.
(2) Beidh aird ar aon treoir faoin alt seo ag an mBord ag comhlíonadh a fheidhmeanna dó.
(3) Ní fhorléireofar aon ní san alt seo mar ní a chumasaíonn don Aire aon chumhacht nó rialú a fheidhmiú i ndáil le haon chás áirithe a mbeidh baint, nó a bhféadfadh baint a bheith, ag an mBord leis.
(4) Nuair a thabharfaidh an tAire treoir faoin alt seo, beidh feidhm ag na forálacha seo a leanas, is é sin—
(a) cuirfidh an tAire faoi deara, a luaithe is féidir, cóip den treoir a leagan faoi bhráid gach Tí den Oireachtas,
(b) foilseofar an treoir san Iris Oifigiúil, agus
(c) cuirfidh an tAire faoi deara cóip den treoir a sheoladh go dtí gach údarás pleanála.
Deontais don Bhord.
7.—Féadfar, faoi réir cibé coinníollacha, más ann, is cuí leis an Aire, deontas nó deontais a íoc leis an mBord gach bliain airgeadais as airgead a sholáthróidh an tOireachtas agus ina mbeidh cibé méid nó méideanna a shocróidh an tAire le toiliú an Aire Airgeadais agus tar éis dul i gcomhairle leis an mBord i ndáil le clár caiteachais an Bhoird don bhliain sin.
Cuntais agus iniúchadh.
8.—(1) Coimeádfaidh an Bord, i cibé foirm a cheadóidh an tAire, tar éis dul i gcomhairle leis an Aire Airgeadais, na cuntais go léir is cuí agus is gnách ar an airgead uile a fuair nó a chaith an Bord.
(2) Déanfaidh an Bord na cuntais a choimeádfar de bhun an ailt seo a chur faoi bhráid an Ard-Reachtaire Cuntas agus Ciste lena n-iniúchadh cibé tráthanna a ordóidh an tAire agus, nuair a bheidh siad iniúchta aige, tíolacfar iad, mar aon le tuarascáil an Ard-Reachtatire Cuntas agus Ciste orthu, don Aire agus cuirfidh seisean faoi deara cóipeanna a leagan faoi bhráid gach Tí den Oireachtas.
Tuarascáil bhliantúil agus eolas don Aire.
9.—(1) Tabharfaidh an Bord, tráth nach déanaí ná an 30ú lá de Mhéan Fómhair gach bliain, tuarascáil don Aire ar imeachtaí an Bhoird i gcaitheamh na bliana roimhe sin agus cuirfidh an tAire faoi deara cóipeanna den tuarascáil a leagan faoi bhráid gach Tí den Oireachtas.
(2) Tabharfaidh an Bord don Aire cibé eolas a iarrfaidh an tAire ó am go ham i dtaobh comhlíonadh feidhmeanna an Bhoird.
Fostaithe an Bhoird.
10.—(1) Ceapfaidh an Bord cibé daoine agus cibé líon daoine chun bheith ina bhfostaithe don Bhord is dóigh leis an mBord, faoi réir ceadú an Aire maidir leis an líon agus leis an gcineál fostaithe den sórt sin, ó am go ham is cuí.
(2) Féadfaidh an Bord duine a fhostú i gcáil pháirt-aimsire lena n-íocfar luach saothair ar mhodh táillí ina mbeidh cibé méideanna a chinnfidh an Bord ó am go ham le ceadú ón Aire a thabharfar le toiliú Aire na Seirbhíse Poiblí.
(3) Sealbhóidh fostaí don Bhord a fhostaíocht ar cibé téarmaí agus coinníollacha a chinnfidh an Bord ó am go ham faoi réir ceadú an Aire.
(4) Íocfaidh an Bord lena fhostaithe, as airgead a bheidh faoina réir aige, cibé luach saothair agus liúntais a chinnfidh an Bord ó am go ham faoi réir ceadú an Aire le toiliú Aire na Seirbhíse Poiblí.
Aoisliúntas d'fhostaithe an Bhoird.
11.—(1) A luaithe is caothúil tar éis an lae bunaithe, ullmhóidh an Bord, agus cuirfidh faoi bhráid an Aire lena cheadú a fháil, scéim nó scéimeanna le pinsin, aiscí agus lúntais eile a dheonú ar scor nó ar éag dóibh do cibé fostaithe lánaimsire, nó i leith cibé fostaithe lánaimsire, de chuid an Bhoird is cuí leis an mBord.
(2) Féadfaidh an Bord, tráth ar bith, scéim do leasú scéime faoin alt seo a ullmhú agus a chur faoi bhráid an Aire.
(3) I gcás a gcuirfear scéim faoi bhráid an Aire de bhun an ailt seo, féadfaidh an tAire, le comhthoiliú Aire na Seirbhíse Poiblí, an scéim a cheadú gan mhodhnú nó fara cibé modhnú (trí chur léi, baint aisti nó athrú) is dóigh leis an Aire, leis an gcomhthoiliú sin, is cuí.
(4) Déanfaidh an Bord aon scéim a chuirfear faoi bhráid an Aire faoin alt seo, má cheadaíonn an tAire í le comhthoiliú Aire na Seirbhíse Poiblí, a chur i gcrích de réir a téarmaí.
(5) Socróidh scéim a chuirfear faoi bhráid an Aire agus a cheadófar faoin alt seo an tráth scoir agus na coinníollacha scoir do na daoine go léir a mbeidh pinsin, aiscí nó liúntais eile iníoctha leo nó ina leith faoin scéim, agus féadfar tráthanna éagsúla agus coinníollacha éagsúla a shocrú i leith aicmí éagsúla daoine.
(6) Má tharlaíonn aon díospóid i dtaobh éileamh aon duine ar aon phinsean, aisce nó liúntas eile is iníoctha de bhun scéime faoin alt seo, nó i dtaobh méid an chéanna, cuirfear an díospóid sin faoi bhráid an Aire agus tarchuirfidh seisean chun Aire na Seirbhíse Poiblí í, agus is cinneadh críochnaitheach a chinneadhsan.
(7) Gach scéim a chuirfear faoi bhráid an Aire agus a cheadófar faoin alt seo leagfar í faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a ceadaithe agus má dhéanann ceachtar Teach, laistigh den lá is fiche a shuífidh an Teach sin tar éis an scéim a leagan faoina bhráid, rún a rith ag neamhniú na scéime, beidh an scéim ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin scéim.
Fostaithe an Bhoird a bheith ina gcomhaltaí de cheachtar Teach den Oireachtas nó d'údarás áitiúil.
12.—(1) I gcás a ndéanfar duine is fostaí don Bhord a ainmniú mar chomhalta de Sheanad Éireann nó le toghadh chun ceachtar Teach den Oireachtas nó é teacht chun bheith ina chomhalta d'údarás áitiúil, beidh sé ar iasacht ó fhostaíocht an Bhoird agus ní íocfaidh an Bord leis, ná ní bheidh sé i dteideal go bhfaighidh sé ón mBord, aon luach saothair ná liúntais—
(a) i gcás a ndéanfar é a ainmniú mar chomhalta de Sheanad Éireann, in aghaidh na tréimhse dar tosach an tráth a ghlacann sé leis an ainmniúchán agus dar críoch an tráth a scoireann sé de bheith ina chomhalta den Teach sin,
(b) i gcás a n-ainmneofar é le toghadh chun ceachtar Teach acu sin, in aghaidh na tréimhse dar tosach an tráth a ainmneofar é agus dar críoch an tráth a scoirfidh sé de bheith ina chomhalta den Teach sin nó a chinnfidh toghchán air nó a tharraingeoidh sé siar ó bheith ina iarrthóir, de réir mar is iomchuí,
(c) i gcás a dtiocfaidh sé chun bheith ina chomhalta d'údarás áitiúil, in aghaidh na tréimhse dar tosach an tráth a thiocfaidh sé chun bheith ina chomhalta den údarás áitiúil agus dar críoch an tráth a scoirfidh sé de bheith ina chomhalta den údarás sin.
(2) Duine a bheidh de thuras na huaire i dteideal faoi Bhuan-Orduithe ceachtar Tí den Oireachtas suí sa Teach sin beidh sé, fad a bheidh sé i dteideal amhlaidh, dícháilithe chun bheith ina fhostaí don Bhord.
(3) Duine a bheidh de thuras na huaire ina chomhalta d'údarás áitiúil beidh sé, fad a shealbhóidh sé oifig mar chomhalta den sórt sin, dícháilithe chun bheith ina fhostaí don Bhord.
Sainchomhairleoirí agus comhairleoirí.
13.—(1) Féadfaidh an Bord cibé sainchomhairleoirí nó comhairleoirí a fhruiliú ó am go ham a mheasfaidh sé is gá lena fheidhmeanna a chomhlíonadh agus íocfaidh an Bord as airgead a bheidh faoina réir aige aon táillí a bheidh dlite do shainchomhairleoir nó do chomhairleoir a fhruileofar de bhun an ailt seo.
(2) Féadfaidh aon duine fógra a thabhairt don Bhord i scríbhinn go bhfuil sé toilteanach go bhfruileodh an Bord é mar shainchomhairleoir nó mar chomhairleoir de bhun an ailt seo agus nuair a thabharfaidh an duine sin an fógra sin don Bhord tabharfaidh sé sonraí ar a cháilíochtaí agus ar a thaithí don Bhord.
(3) Coimeádfaidh an Bord liosta de na daoine a thabharfaidh go cuí don Bhord fógra de bhun fho-alt (2) den alt seo.
(4) Nuair a fhruileoidh an Bord sainchomhairleoir nó comhairleoir faoin alt seo beidh aird aige ar an liosta a bheidh á choimeád faoi fho-alt (3) den alt seo, ach ní fhorléireofar na forálacha sin roimhe seo den fho-alt seo mar fhorálacha a choisceann ar an mBord duine nach bhfuil a ainm ar an liosta sin a fhruiliú mar shainchomhairleoir nó mar chomhairleoir.
(5) Cuirfidh an Bord i ngach tuarascáil a thabharfar faoi alt 9 den Acht seo ráiteas ina mbeidh ainmneacha na ndaoine (má b'ann) a fruilíodh de bhun an ailt seo in imeacht na bliana lena mbainfidh an tuarascáil.
Is chun an Bhoird nó faoi bhráid an Bhoird a chuirfear achomhairc áirithe agus ábhair eile.
14.—(1) In ionad achomharc faoi alt iomchuí den Phríomh-Acht a dhéanamh chun an Aire, déanfar é chun an Bhoird agus mura dtarraingeofar siar é cinnfidh an Bord é, agus
(a) más le hiarratas, fógra nó ordú a bhainfidh an t-achomarc, déanfar an t-iarratas, an fógra nó an t-ordú a chinneadh nó a dhaingniú nó a neamhniú (de réir mar a bheidh) dá réir sin, agus
(b) más le ceadúnas faoi alt 89 den Phríomh-Acht a bhainfidh an t-achomharc, tabharfar cibé treoracha is iomchuí i ndáil leis an gceadúnas a tharraingt siar, a dheonú nó a athrú.
(2) Aon cheist a bheidh ann in aon chás áirithe i dtaobh céard is forbairt nó forbairt dhíolmhaithe ann nó céard nach ea, ansin, in ionad í a chur faoi bhráid an Aire agus an tAire á cinneadh faoi alt 5 (1) den Phríomh-Acht, tarchuirfear chun an Bhoird í agus cinnfidh an Bord í.
(3) I gcás a mbeidh coinníoll dá dtagraítear i bhfo-alt (2) (f) d'alt 26 den Phríomh-Acht ag gabháil le cead nó le ceadú a thabharfar faoin alt sin agus nach mbeidh comhaontú ann maidir leis an ranníoc a cheanglaítear le fo-alt (7) den alt sin 26 a dhéanfadh údarás áitiúil, ansin, in ionad an tAire do chinneadh an ábhair faoin bhfo-alt sin (7), tarchuirfear chun an Bhoird é agus cinnfidh an Bord méid an ranníoca.
(4) I gcás a mbeidh ag gabháil le cead nó le ceadú a thabharfar faoi alt 26 den Phríomh-Acht coinníoll á fhoráil go gcomhaontóidh an t-údarás pleanála agus an duine dá dtabharfar an cead nó an ceadú ar ranníoc nó ar ábhar eile agus, mura mbeidh comhaontú ann, go gcinnfidh an tAire an ranníoc nó an t-ábhar eile, forléireofar an coinníoll mar choinníoll a fhorálann go gcinnfidh an Bord an ranníoc nó an t-ábhar eile mura mbeidh comhaontú ann.
(5) Déantar leis seo feidmeanna an Aire faoi alt 29 den Phríomh-Acht a aistriú chun an Bhoird agus gan dochar do ghinearáltacht fho-alt (9) den alt seo déanfar gach ceann de na tagairtí san alt sin 29 don Aire a fhorléiriú mar thagairt don Bhord.
(6) Aon cheist nó díospóid a bheidh ann i dtaobh an nglacfadh nó an nglacann déanmhas nua go substaintiúil, de réir brí alt 56 den Phríomh-Acht, ionad déanmhais a scartáladh nó a scriosadh, cinnfidh an Bord í in ionad an tAire á cinneadh.
(7) Chun críocha na bhfo-alt sin roimhe seo den alt seo, bainfidh an Príomh-Acht (arna leasú leis an Acht seo), fara aon mhodhnuithe is gá, leis an méid seo a leanas, is é sin—
(a) achomharc a dhéanamh chun an Bhoird,
(b) tarchur chun an Bhoird,
(c) cinneadh an Bhoird ar achomharc,
(d) an Bord do dhaingniú nó do neamhniú (de réir mar a bheidh) an fhógra nó an ordaithe lena mbainfidh an t-achomharc,
(e) an Bord do chinneadh ceist nó díospóid lena mbaineann tarchur faoi alt 5 (1) den Phríomh-Acht,
(f) an Bord do chinneadh easaontas, ceist nó díospóid lena mbaineann alt 26 (7) nó alt 56 (3) den Príomh-Acht,
(g) fógra ceannaigh a seirbheáladh ar údarás pleanála faoi alt 29 den Príomh-Acht a dhaingniú,
(h) déanamh de réir orduithe ón mBord i ndáil le hachomcharc i leith ceadúnais faoi alt 89 den Phríomh-Acht, agus
(i) an Bord do chinneadh ranníoca nó ábhair eile a bheidh le cinneadh ag an mBord de bhua fho-alt (4) den alt seo,
mar a bhain sé, díreach roimh an lá iomchuí, le cibé acu seo a leanas is iomchuí, is é sin, achomharc comhréire a dhéanamh chun an Aire nó ní comhréire a tharchur chun an Aire faoin bPríomh-Acht, cinneadh an Aire ar achomharc den sórt sin, an tAire do dhaingniú nó do neamhniú nó do chinneadh fógra, ordú, ceist nó díospóid a bhaineann le hachomharc nó le tarchur den sórt sin, an tAire do chinneadh easaontas, ceist nó díospóid lena mbaineann an t-alt sin 26 (7) nó an t-alt sin 56 (3), an tAire do dhaingniú fógra ceannaigh, déanamh de réir orduithe ón Aire i ndáil le hachomharc i leith ceadúnais faoin alt sin 89 nó an tAire do chinneadh ranníoca nó ábhair eile de bhun coinníoll a luaitear san fho-alt sin (4).
(8) Féadfaidh an Bord nuair a bheidh achomharc faoi alt 26 nó alt 27 den Phríomh-Acht á chinneadh aige a chinneadh cead nó ceadú a thabhairt bíodh is go ndéanann an fhorbairt bheartaithe sárú ábhartha ar an bplean forbartha nó ar aon ordú um limistéar taitneamhachta speisialta a bhaineann le limistéar an údaráis phleanála ar lena chinneadh a bhaineann an t-achomharc.
(9) Gach áit a dtagraíonn an Príomh-Acht don Aire i ndáil le haon ní acu seo a leanas—
(a) achomharc faoi alt iomchuí,
(b) tarchur faoi alt 5 (1) den Phríomh-Acht,
(c) easaontas, ceist nó díospóid lena mbaineann alt 26 (7) nó alt 56 (3) den Phríomh-Acht a chinneadh,
(d) cinneadh ar achomharc faoi alt iomchuí,
(e) cinneadh de bhun alt 85 den Phríomh-Acht i dtaobh ar coimeádadh toilú siar go míreasúnach.
(f) cinneadh, daingniú nó neamhniú (de réir mar a bheidh) ar an bhfógra nó ar an ordú, ar an gceist nó ar an díospóid lena mbaineann achomharc faoi alt iomchuí nó tarchur a luaitear i mír (b) den fho-alt seo,
(g) ceanglas á cheangal ar iarratasóirí nó ar údaráis phleanála aon eolas sonraithe a thabhairt don Aire, nó
(h) aon fhocal atá gaolmhar le hachomharc, tarchur, cinneadh, daingniú no neamhniú,
forléireofar an tAcht sin, seachas alt 18 de, mar Acht a thagraíonn don Bhord.
(10) San alt seo ciallaíonn “alt iomchuí” alt is alt 26, 27, 30, 33, 36, 37, 44, 45, 46, 48, 85 nó 89 den Phríomh-Acht.
Achomharcóirí do thaisceadh éarlais £10.
15.—(1) Déanfaidh achomharcóir éarlais £10 a thaisceadh leis an mBord i dteannta a achomhairc agus ní bailí d'aon achomharc chun an Bhoird nach mbeidh an éarlais sin ina theannta.
(2) A luaithe is féidir é tar éis achomharc chun an Bhoird a tharraingt siar nó a chinneadh, tabharfaidh an Bord an éarlais ar ais don achomharcóir, ach sin faoi réir alt 18 (3) den Acht seo.
Eisteacht ó bhéal.
16.—(1) Ach amháin i gcás a dtabharfaidh an tAire ordú faoin alt seo, beidh de lán-rogha ag an mBord aon tarchur nó achomharc chun an Bhoird a éisteacht ó bhéal.
(2) I gcás a n-iarrfar ar an mBord tarchur nó achomharc a éisteacht ó bhéal agus go socróidh sé an tarchur nó an t-achomharc a chinneadh gan éisteacht ó bhéal—
(a) seirbhéalfaidh an Bord fógra faoina chinneadh ar an duine a d'iarr an éisteacht sin, agus
(b) ní rachaidh an Bord do chinneadh an tarchuir nó an achomhairc go dtí go rachaidh an tréimhse a luaitear i bhfo-alt (3) den alt seo in éag.
(3) Aon duine ar a seirbheálfar fógra faoi fho-alt (2) den alt seo, seachas duine a mbeidh fógra faoi alt 18 den Acht seo a bhaineann leis an tarchur iomchuí nó leis an achomharc iomchuí seirbheáilte air freisin, féadfaidh sé, aon tráth sula mbeidh ceithre lá dhéag dar tosach lá seirbheála an fhógra faoin bhfo-alt sin (2) caite, ordú faoin alt seo maidir leis an tarchur iomchuí nó leis an achomharc iomchuí a iarraidh i scríbhinn ar an Aire.
(4) I gcás a ndéanfar iarratas faoi fho-alt (3) den alt seo chun an Aire, ní dhéanfaidh an Bord, mura socróidh sé an tarchur iomchuí nó an t-achomharc iomchuí a éisteacht ó bhéal, an tarchur nó an t-achomharc sin a chinneadh go dtí go ndéanfaidh an tAire cinneadh ar an iarratas.
(5) Féadfaidh an tAire a ordú don Bhord aon tarchur nó achomharc chun an Bhoird a éisteacht ó bhéal agus déanfaidh an Bord de réir aon ordú den sórt sin.
Féadfar ábhair, seachas ábhair ó pháirtithe, a chur i gcuntas le linn tarchuir nó achomhairc a bheith á gcinneadh.
17.—Féadfaidh an Bord, ag cinneadh tarchuir nó achomhairc dó, ábhair a chur i gcuntas seachas ábhair a bheidh tarraingthe anuas ag na páirtithe sa tarchur nó san achomharc má bhaineann na hábhair le pleanáil chuí agus le forbairt chuí limistéar an údaráis phleanála iomchuí nó más ábhair iad a mbeidh aird orthu ag an mBord de bhua alt 24 (2) den Acht seo, ar choinníoll go mbeidh aird na bpáirtithe sin tarraingthe orthu agus go mbeidh deis tugtha dóibh ar thuairimí orthu a chur in iúl don Bhord nó, i gcás éisteachta ó bhéal, don duine a sheolfaidh an éisteacht.
Cumhacht an Bhoird maidir le tarchuir nó achomhairc chráiteacha, etc.
18.—(1) I gcás arb é tuairim an Bhoird gur tarchur nó achomharc cráiteach tarchur nó achomharc, nó tarchur nó achomharc a bheith á mhoilliú gan riachtanas ag aon pháirtí, féadfaidh an Bord fógra a sheirbheáil ar an bpáirtí á rá go ndéanfaidh sé, tráth tar éis an lae a shonrófar san fhógra (ar lá é nach luaithe ná seacht lá tar éis an fógra a sheirbheáil) gan aon fhógra eile a thabhairt don pháirtí, an tarchur nó an t-achomharc lena mbainfidh an fógra a chinneadh, agus go bhféadfaidh an Bord an tarchur nó an t-achomharc a chinneadh amhlaidh d'ainneoin nach mbeidh aon aighneacht déanta chuig an mBord ag an bpáirtí i ndáil leis an tarchur nó leis an achomharc.
(2) I gcás a mbeidh fógra seirbheáilte faoin alt seo féadfaidh an Bord, aon tráth tar éis an lae a bheidh sonraithe san fhógra, gan aon fhógra eile a thabhairt don pháirtí ar ar seirbheáladh an fógra, an tarchur nó an t-achomharc a chinneadh, agus féadfaidh an Bord an tarchur nó an t-achomharc a chinneadh amhlaidh d'ainneoin nach mbeidh aon aighneacht déanta chuig an mBord ag an bpáirtí sin i ndáil leis an tarchur nó leis an achomharc.
(3) Más é tuairim an Bhoird ag cinneadh achomharc dó gur achomharc cráiteach é, féadfaidh an Bord a ordú go bhforghéillfear don Bhord an éarlais a taisceadh i ndáil leis an achomharc.
Caiteachais achomhaire.
19.—(1) Faoi réir fho-alt (2) den alt seo, i gcás a ndéanfar achomharc chun an Bhoird in aghaidh cinneadh a rinne údarás pleanála—
(a) féadfaidh an Bord, más cuí leis agus ar neamhspleidh le toradh an achomhairc, a ordú don údárás pleanála—
(i) cibé suim a íoc leis an achomharcóir a shonróidh an Bord, dá lán-rogha féin, mar chúiteamh don achomharcóir sa chaiteachas a bhain dó i ndáil leis an achomharc,
(ii) cibé suim a íoc leis an mBord a shonróidh an Bord dá lán-rogha féin, mar chúiteamh don Bhord i leith an chaiteachais a thabhaigh an Bord i ndáil leis an achomharc a éisteacht;
(b) i gcás a ndaingneofar ar achomharc cinneadh an údaráis phleanála, nó i gcás a n-athrófar ar achomharc an cinneadh, mura dtabharfaidh an Bord, ag cinneadh an achomhairc dó, aontachas do bhrí fhoras achomhairc an achomharcóra, féadfaidh an Bord, más cuí leis, a ordú don achomharcóir—
(i) cibé suim a íoc leis an údarás pleanála a shonróidh an Bord, dá lán-rogha féin, mar chúiteamh don údarás pleanála sa chaiteachas a bhain dóibh i ndáil leis an achomharc,
(ii) cibé suim a shonróidh an Bord, dá lán-rogha féin, a íoc le haon cheann de na páirtithe eile san achomharc, mar chúiteamh don pháirtí sa chaiteachas a bhain dó i ndáil leis an achomharc,
(iii) cibé suim a íoc leis an mBord a shonróidh an Bord, dá lán-rogha féin, mar chúiteamh don Bhord i leith an chaiteachais a thabhaigh an Bord i ndáil leis an achomharc a éisteacht.
(2) Is tar éis dul i gcomhairle leis an Aire, agus ansin amháin, a thabharfaidh an Bord ordú faoi fho-alt (1) den alt seo aon suim is mó ná £50 a íoc.
(3) Beidh aon suim a ordófar faoin alt seo a íoc inghnóthaithe, mura n-íocfar í, mar fhiach conartha shimplí in aon chúirt dlínse inniúla.
Forálacha forlíontacha a bhaineann le tarchuir agus le hachomhairc.
20.—(1) Féadfaidh an tAire rialacháin a dhéanamh do dhéanamh socrú d'aon cheist nós imeachta i ndáil le tarchuir nó achomhairc chun an Bhoird.
(2) Déanfar rialacháin faoin alt seo do dhéanamh socrú go ndéanfar aon éisteacht ó bhéal ag an mBord ar tharchur nó ar achomharc a sheoladh ag duine a cheapfaidh an Bord chuige sin.
(3) Féadfaidh an tAire rialacháin a dhéanamh dá chumasú don Bhord, nuair a bheidh achomharc faoi alt 26 nó 27 den Phríomh-Acht á bhreithniú aige, cuireadh a thabhairt d'iarratasóir agus dá chumasú d'iarratasóir dar tugadh cuireadh amhlaidh pleananna nó líníochtaí eile athscrúdaithe ag déanamh modhnú, nó sonraí eile ina mbeidh socrú le modhnú a dhéanamh, ar an bhforbairt lena mbaineann an t-achomharc a chur faoi bhráid an Bhoird.
(4) I gcás ina gcuirfear pleananna, líníochtaí nó sonraí a luaitear i bhfo-alt (3) den alt seo faoi bhráid an Bhoird de bhua rialacháin a rinneadh faoin bhfo-alt sin, féadfaidh an Bord ag cinneadh an achomhairc dó cead nó ceadú a thabhairt i leith na forbartha iomchuí arna modhnú le gach ceann nó le haon cheann de na pleananna, de na líníochtaí nó de na sonraí sin.
Eatramhach.
21.—(1) Má bhí, díreach roimh an lá iomchuí, achomharc, ranníoc, ceist nó díospóid dá dtagraítear in alt 14 den Acht seo nó achomharc de bhun alt 25 den Acht seo á bhreithniú ag an Aire, beidh feidhm ag an alt sin 14 agus ag ailt 16, 17, 18, 19 agus 20 den Acht seo i ndáil leis an achomharc, leis an ranníoc, leis an gceist nó leis an díospóid a ndéanfar, in ionad an tAire dá bhreithniú tuilleadh faoin bPríomh-Acht, é a chinneadh, mura dtarraingeofar siar é, ag an mBord ionann is dá mba chun an Bhoird a rinneadh nó a tarchuireadh i gcéaduair é faoin Acht seo.
(2) I gcás a mbeidh fógra ceannaigh de réir brí alt 29 don Phríomh-Acht seirbheáilte roimh an lá iomchuí ar údarás pleanála agus nach mbeidh fógra i ndáil leis sin seirbheáilte roimh an lá sin ag an údarás faoi fho-alt (2) den alt sin á rá go bhfuil siad toilteanach déanamh de réir an fhógra ceannaigh, beidh éifeacht leis na forálacha seo a leanas:
(a) i gcás a mbeartóidh an t-údarás pleanála fógra a sheirbheáil ar an úinéir iomchuí de réir mhír (b) den fho-alt sin (2) agus nach mbeidh cóipeanna de na fógraí dá dtagraítear i bhfo-alt (4) den alt sin 29 curtha, roimh an lá sin, ag an údarás chun an Aire, ansin, chun amhras a sheachaint, dearbhaítear leis seo go mbeidh feidhm ag alt 14 (5) den Acht seo i ndáil leis an bhfógra,
(b) i gcás a mbeidh na cóipeanna de na fógraí dá dtagraítear san fho-alt sin (4) curtha ag an údarás pleanála chun an Aire roimh an lá iomchuí ach nach mbeidh an tAire, roimh an lá iomchuí, tar éis an fógra ceannaigh a dhaingniú ná aon ghníomh eile a dhéanamh den sórt a luaitear i mír (i) nó i mír (ii) den choinníoll a ghabhann leis an bhfo-alt sin (4), ná a chur in iúl don úinéir a sheirbheáil an fógra nach mbeartaíonn sé an fógra a dhaingniú, ansin, in ionad an tAire do bhreithniú an fhógra tuilleadh, breithneoidh an Bord é ionann is dá mba gur cuireadh cóip de chun an Bhoird an lá iomchuí, agus beidh feidhm fara aon mhodhnuithe is gá i ndáil leis an bhfógra ag an bhfo-alt sin (4) agus ag an bhfo-alt sin (5) den alt sin 29, arna leasú leis an Acht seo, agus
(c) i gceachtar cás, d'ainneoin alt 14 (9) den Acht seo, beidh éifeacht leis an bhfo-alt sin (2) i ndáil leis an bhfógra a cheanglaítear leis an bhfo-alt sin a sheirbheáil ionann is dá ndéanfaí “chun an Aire nó chun an Bhoird, de réir mar is iomchuí” a chur ann in ionad “chun an Aire”.
(3) D'fhonn a chumasú don Bhord a fheidhmeanna a chomhlíonadh an lá iomchuí agus uaidh sin amach, féadfaidh an Bord socruithe a dhéanamh, mar ghníomh eatramhach, chun an tAire do sholáthar don Bhord aon seirbhísí a theastóidh ón mBord go dtí go ndéanfaidh an Bord dóthain ceapachán de bhun alt 10 den Acht seo agus féadfaidh an tAire seirbhísí dá ndéanfar socruithe faoin alt seo a sholáthar agus féadfaidh an Bord leas a bhaint as na seirbhísí sin.
Am d'achomhairc i gcoitinne.
22.—(1) I gcás nach dtugann foráil den Acht seo a údaraíonn achomharc (seachas achomharc chun cúirte) cumas achomharc a dhéanamh ach amháin laistigh de thréimhse shonraithe, gheofar an t-achomharc, más leis an bpost a sheolfar é, tráth nach déanaí ná an tríú lá tar éis na tréimhse sin agus aon achomharc a sheolfar amhlaidh agus nach bhfaighfear amhlaidh beidh sé neamhbhailí mar achomharc nach ndearnadh in am.
(2) I gcás nach dtugann foráil den Phríomh-Acht a údaraíonn achomharc (seachas achomharc chun cúirte) cumas achomharc a dhéanamh ach amháin laistigh de thréimhse shonraithe nó roimh éag do thréimhse shonraithe nó roimh lá sonraithe, forléireofar an fhoráil mar fhoráil a fholaíonn—
(a) ceanglas nach foláir an t-achomharc, más leis an bpost a sheolfar é, a fháil tráth nach déanaí ná an tríú lá tar éis na tréimhse sin nó an lae sin, agus
(b) foráil go mbeidh aon achomharc a sheolfar amhlaidh agus nach bhfaighfear amhlaidh neamhbhailí mar achomharc nach ndearnadh in am.
Tuarascálacha ar iniúchadh, etc.
23.—I gcás a dtarlóidh i ndáil leis an Aire do chomhlíonadh aon cheann de na feidhmeanna a shanntar dó faoi na hAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 agus 1976, nó i ndáil leis an mBord do chomhlíonadh a fheidhmeanna go ndéanfaidh duine, is duine a cheapfar chuige ag an Aire nó ag an mBord, iniúchadh, nó go seolfaidh sé éisteacht ó bhéal, thar ceann an Aire nó an Bhoird, de réir mar a bheidh, tabharfaidh an duine a cheapfar amhlaidh don Aire nó don Bhord, de réir mar is iomchuí, tuarascáil scríofa ar an iniúchadh nó ar an éisteacht, de réir mar a bheidh, agus cuirfidh sé ina thuarascáil moladh maidir leis an ábhar lenar bhain an t-iniúchadh nó an éisteacht, agus breithneoidh an tAire nó an Bord, de réir mar is iomchuí, an tuarascáil (lena n-áirítear aon mholadh a bheidh inti) roimh chinneadh a thabhairt ar an ábhar ar i ndáil leis a rinneadh an t-iniúchadh nó a seoladh an éisteacht.
Abhair bhreise a bhféadfaidh údarás pleanála nó an Bord aird a thabhairt orthu le linn bheith ag breithniú iarratas áirithe, etc. agus achomharc áirithe.
24.—(1) D'ainneoin aon ní sa Phríomh-Acht, le linn d'údarás pleanála bheith ag déanamh breithnithe,
(a) ar iarratas ar chead faoi alt 26 nó 27 den Acht sin.
(b) ar fóirsteanach nó nach fóirsteanach fógra a sheirbheáil faoi alt 30, 31, 32, 33 nó 35 den Acht sin,
(c) an seirbheálfaidh siad nó nach seirbheálfaidh siad fógra faoi alt 36 nó 37 den Acht sin,
beidh aird acu, i gcás arb iomchuí leo é, ar cheachtar de na nithe seo a leanas nó orthu araon, is é sin,
(i) an éifeacht is dóigh a bheadh ag cinneadh áirithe dá gcuid ar an ábhar ar aon áit nach áit laistigh, nó ar aon limistéar lasmuigh, dá limistéar, agus
(ii) aon ábhar eile a bhaineann le forbairt lasmuigh dá limistéar.
(2) D'ainneoin aon ní sa Phríomh-Acht, le linn don Bhord bheith ag breithniú achomhairc a rinneadh faoi alt 26, 27, 30, 33, 36 nó 37 den Acht sin, beidh aird aige, i gcás arb iomchuí leis é, ar cheachtar de na nithe seo a leanas nó orthu araon, is é sin.
(a) an éifeacht is dóigh a bheadh ag cinneadh áirithe dá chuid ar an ábhar ar aon áit nach áit laistigh, nó ar aon limistéar lasmuigh. de limistéar an údaráis phleanála iomchuí, agus
(b) aon ábhar eile a bhaineann le forbairt lasmuigh de limistéar an údaráis sin.
Rialú pleanála (spásanna oscailte) a chur i bhfeidhm.
25.—(1) I gcás—
(a) a bhfuil forbairt á déanamh nó déanta de bhun cead faoi alt 26 den Phríomh-Acht, agus
(b) (i) a raibh coinníoll á cheangal talamh a sholáthar nó a chothabháil mar spás oscailte, ar spás oscailte é lena mbaineann an t-alt seo, ag gabháil leis an gcead, nó
(ii) a raibh sé dearfa nó intuigthe san iarratas ar an gcead sin go soláthrófaí nó go gcothabhálfaí talamh mar spás oscailte den sórt sin, agus
(c) a mbeidh iarratas scríofa seirbheáilte ag an údarás pleanála ar úinéir na talún go ndéanfaidh sé, laistigh de thréimhse a bheidh sonraithe san iarratas (is tréimhse nach giorra na dhá mhí dar tosach dáta an iarratais), an talamh sin a sholáthar, a chothromú, a phlandáil nó a oiriúnú ar shlí eile nó a chothabháil ar mhodh a shonrófar amhlaidh, ar modh é a dhéanfaidh, dar leo, oiriúnach é don chríoch a raibh an spás oscailte le soláthar chuici, agus
(d) go mainneoidh an t-úinéir déanamh de réir an iarratais nó a áirithiú go ndéanfaí dá réir laistigh den tréimhse a bheidh sonraithe amhlaidh,
féadfaidh an t-údarás pleanála, más oiriúnach leo, fógra (dá ngairtear fógra fála ina dhiaidh seo san alt seo) a fhoilsiú i nuachtán a léitear sa cheantar go bhfuil siad chun an talamh a fháil le hordú faoin alt seo agus sonrófar san fhógra fála tréimhse (is tréimhse nach giorra na dhá mhí dar tosach dáta an fhógra a fhoilsiú) ar féidir achomharc a dhéanamh faoin alt seo laistigh di.
(2) I gcás a bhfoilseoidh údarás pleanála fógra fála, déanfaidh siad, tráth nach déanaí ná deich lá tar éis dáta an fhoilsithe, cóip den fhógra a sheirbheáil ar úinéir na talún lena mbainfidh an fógra.
(3) Aon duine a mbeidh, de thuras na huaire, leas aige sa talamh lena mbainfidh fógra fála féadfaidh sé, laistigh den tréimhse a shonrófar san fhógra, achomharc a dhéanamh—
(a) i gcás ar roimh an lá iomchuí a dhéanfar an t-achomharc chun an Aire.
(b) i gcás arb é an lá iomchuí nó dá éis sin a dhéanfar an t-achomharc, chun an Bhoird.
(4) I gcás a ndéanfar achomharc faoin alt seo, féadfaidh an tAire nó an Bord, de réir mar is iomchuí—
(a) an fógra fála lena mbainfidh an t-achomharc a neamhniú, nó
(b) an fógra fála a dhaingniú, modhnaithe nó gan mhodhnú, i leith na talún iomchuí go léir nó i leith na coda sin den talamh iomchuí a mheasfaidh an tAire nó an Bord a bheith réasúnach.
(5) Má fhoilsíonn údarás pleanála fógra fála agus—
(a) go mbeidh an tréimhse chun achomharc a dhéanamh in aghaidh an fhógra caite agus nach mbeidh aon achomharc déanta, nó
(b) go mbeidh achomharc déanta in aghaidh an fhógra agus go mbeidh an t-achomharc tarraingthe siar nó go mbeidh an fógra daingnithe gan choinníoll nó faoi réir modhnuithe,
féadfaidh an t-údarás pleanála ordú a dhéanamh san fhoirm fhorordaithe is ordú a bheidh sainráite agus a oibreoidh chun an talamh lena mbaineann an fógra fála, nó, i gcás ar iomchuí sin, an fógra fála arna dhaingniú, a dhílsiú don údarás pleanála ar dháta sonraithe ar feadh an eastáit, an téarma nó an leasa go léir a raibh an talamh sin i seilbh ag an úinéir ar a fheadh díreach roimh dháta an ordaithe mar aon leis na cearta agus na dliteanais go léir a theacht nó a thabhaigh an t-úinéir i ndáil leis an gcéanna díreach roimh an dáta sin mar aon le hoibleagáid déanamh de réir an iarratais a rinneadh faoi mhír (c) d'fho-alt (1) den alt seo.
(6) I gcás a mbeidh údarás pleanála tar éis talamh á fháil faoi ordú faoin alt seo is talamh atá, leis féin nó i dteannta talún eile, faoi réir blianachta ceannaigh, íocaíochta in ionad cíosa, nó suime bliantúla eile (nach é atá inti go heisiatach cíos faoi chonradh tionóntachta) is iníoctha le Coimisiún Talún na hÉireann nó le Coimisinéirí na nOibreacha Poiblí in Éirinn, tiocfaidh an t-údarás chun bheith agus beidh siad faoi dhliteanas, amhail ó dháta na talún a dhílsiú dóibh leis an ordú dílseacháin, go n-íocfaidh siad le Coimisiún Talún na hÉireann nó le Coimisinéirí na nOibreacha Poiblí in Éirinn, de réir mar a bheidh, an tsuim bhliantuil nó an chuid sin di a chionroinnfidh Coimisiún Talún na hÉireann nó Coimisinéirí na nOibreacha Poiblí in Éirinn, de réir mar a bheidh, ar an talamh ionann is dá mbeadh an talamh aistrithe chuig an údarás ag úinéir na talún sin ar an dáta sin.
(7) Nuair a dhéanfaidh údarás pleanála ordú faoin alt seo i ndáil le haon talamh, cuirfidh siad an t-ordú go dtí an t-údarás clárúcháin faoin Acht um Chlárú Teidil, 1964, agus air sin cuirfidh an t-údarás clárúcháin faoi deara an t-údarás pleanála a chlárú mar úinéir na talún de réir an ordaithe.
(8) I gcás a ndéanfar éileamh ar chúiteamh i leith talún lena mbaineann ordú faoin alt seo agus go mbeidh an t-ábhar le cinneadh trí eadráin de bhua alt 68 den Phríomh-Acht, beidh feidhm ag na forálacha seo a leanas:
(a) mura suífidh an t-úinéir nó mura suífear thar a cheann nach ndearnadh cóimhéid luach na talún lena mbaineann an cead iomchuí faoi alt 26 den Phríomh-Acht, arbh é an luach sin é an tráth a iarradh an cead, a ghnóthú de thoradh na forbartha agus nach mbeidh sé, mar thoradh breise den sórt sin, inghnóthaithe san am le theacht tríd an talamh a dhiúscairt ar talamh é lena mbaineann an cead agus nach talamh é lena mbaineann an tordú, déanfaidh an t-eadránaí dámhachtain nialais. agus
(b) ní thabharfar aird sa mheasúnacht ar luach na talún lena mbaineann an t-ordú ar luach na talún sin le haghaidh úsáide seachas mar spás oscailte agus déanfar asbhaint i leith costas cibé oibreacha a dhéanamh is gá le géilleadh don iarratas a rinneadh de bhun mhír (c) d'fho-alt (1) den alt seo.
(9) Taifeadfaidh údarás pleanála sa chlár—
(a) sonraí aon fhógra fála a bheidh foilsithe acu,
(b) dáta agus éifeacht aon chinneadh ar achomharc i ndáil leis an bhfógra sin,
(c) sonraí aon ordaithe a bheidh déanta faoin alt seo,
agus déanfar gach taifeadadh den sórt sin laistigh den tréimhse seacht lá dar tosach lá an fhoilsithe, lá an fhógra faoin gcinneadh a fháil nó lá an ordaithe a dhéanamh, de réir mar is iomchuí.
(10) Baineann an t-alt seo le haon sórt spás ocailte (is cuma cé acu spás oscailte nó tuairisc eile a thugtar air san iarratas iomchuí ar chead nó i gcoinníoll a ghabhann leis an gcead iomchuí) is talamh nach dtuairiscítear san iarratas sin nó sa choinníoll sin mar spás oscailte príobháideach nó i dtéarmaí ag insint nach mbeartaítear go mbeadh cead gan srian isteach ann ag an bpobal.
Fógra rabhaidh.
26.—(1) I gcás ar dealraithach d'údarás pleanála—
(a) go bhfuil talamh á fhorbairt nó gur dóigh go bhforbrófar é contrártha d'alt 24 den Phríomh-Acht, nó
(b) go bhfuil aon úsáid neamhúdaraithe á dhéanamh de thalamh, nó
(c) go bhféadfaidh go n-aistreofaí nó go ndamáisteofaí aon chrann nó airí eile (is déanmhas nó airí nádúrtha) nó aon ní eile a gceanglaítear le coinníoll ar deonaíodh faoina réir cead aon talamh a fhorbairt é a chaomhnú.
féadfaidh an t-údarás pleanála fógra (dá ngairtear fógra rabhaidh ina dhiaidh seo san alt seo) a sheirbheáil ar úinéir na talún agus féadfaidh siad cóip den fhógra sin a thabhairt d'aon duine eile ar dóigh leo baint a bheith aige leis na hábhair lena mbainfidh an fógra.
(2) Tagróidh fógra rabhaidh don talamh iomchuí agus—
(a) ceanglóidh sé, i ndáil le haon talamh a bheidh á fhorbairt nó ar dóigh go bhforbrófar é, nach dtosófar á fhorbairt contrártha d'alt 24 den Phríomh-Acht nó, má bhíonn an fhorbairt sin tosaithe, go scoirfear di láithreach,
(b) ceanglóidh sé, i ndáil le haon úsáid neamhúdaraithe de thalamh, go scoirfear láithreach den úsáid neamhúdaraithe,
(c) ceanglóidh sé, i ndáil le coinníoll a cheanglaíonn aon chrann, airí eile nó ní eile a chaomhnú, nach ndéanfar an crann, an airí eile nó an ní eile, de réir mar is iomchuí, a aistriú ná a dhamáistiú agus go ndéanfaidh úinéir na talún aon bhearta réasúnacha is gá lena chaomhnú,
agus ceanglóidh an fógra sin freisin ar úinéir na talún leorbhearta a dhéanamh lena chinntiú go ndéanfar de réir an fhógra agus beidh rabhadh ann go bhféadfaidh an t-údarás pleanála iomchuí imeachtaí faoin alt seo a bhunú ina aghaidh agus in aghaidh aon duine eile a mhainneoidh déanamh de réir ceanglais an fhógra nó a thabharfaidh cabhair nó cead le haghaidh aon fhorbairt a dhéanamh ar thalamh nó aon úsáid a dhéanamh de thalamh nó aon ní eile a dhéanamh contrártha don fhógra.
(3) I gcás a mbeidh fógra rabhaidh seirbheáilte i ndáil le sárú ar choinníoll a luaitear i mír (c) d'fho-alt (2) den alt seo, ní cion faoin alt seo aon ní a dhéanfar i ndáil leis an gcrann, leis an airí eile nó leis an ní eile lena mbaineann an fógra má dhéantar é le toiliú i scríbhinn ón údarás pleanála a sheirbheáil an fógra.
(4) Aon duine—
(a) a mhainneoidh go feasach déanamh de réir ceanglais fógra rabhaidh, nó
(b) a thabharfaidh go feasach cabhair nó cead,
(i) do dhuine eile chun aon fhorbairt a dhéanamh a gceanglaíonn fógra rabhaidh nach dtosófar uirthi nó nach foláir scor di, nó
(ii) do dhuine eile leanúint d'úsáid a gceanglaíonn fógra rabhaidh nach foláir scor di, nó
(iii) do dhuine eile aon ní eile a dhéanamh contrártha do fhógra rabhaidh, nó
(c) a dhamáisteoidh ar shlí eile nó a aistreoidh aon chrann, airí eile nó ní eile lena mbainfidh fógra rabhaidh,
beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná dhá chéad agus caoga punt a chur air.
(5) I gcás a gciontófar duine i gcion faoin alt seo agus go leanfaidh sé den chion tar éis a chiontaithe, dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná céad punt in aghaidh gach lae a leanfar amhlaidh den chion nó príosúnacht ar feadh téarma nach faide ná sé mhí nó an fhíneáil agus an phríosúnacht le chéile a chur air.
(6) Féadfar fógra forfheidhmiúcháin de réir brí alt 31, 32 nó 35 den Phríomh-Acht a sheirbheáil cibé acu a bheidh nó nach mbeidh ionchúiseamh tionscanta faoin alt seo.
(7) Beidh feidhm ag na forálacha seo a leanas i ndáil le himeachtaí faoin alt seo inarb é an cion a líomhnaítear crann, airí eile nó ní eile lena mbaineann fógra rabhaidh a aistriú nó a dhamáistiú, is é sin—
(a) más é an cosantóir úinéir na talún lena mbaineann an fógra rabhaidh,
(i) is leor don ionchúiseamh a chruthú gur aistríodh nó gur damáistíodh an crann, an airí eile nó an ní eile, de réir mar is iomchuí, agus
(ii) gan dochar d'aon chosaint eile a bheidh ar a dheis aige, is cosaint mhaith don chosantóir má chruthaíonn sé go ndearna sé, nó gur chuir sé faoi deara go ndéanfaí, bearta réasúnacha á áirithiú go ndéanfaí de réir ceanglais an fhógra rabhaidh agus gur le deámhéin a ghníomhaigh sé i gcónaí i ndáil leis an bhfógra,
(b) in aon chás eile, má chruthaíonn an t-ionchúiseamh agus ar an gcuntar amháin go gcruthóidh—
(i) go ndearnadh, tar éis an fógra rabhaidh a sheirbheáil, bearta lena chur in iúl do dhaoine an fógra a bheith ann, nó an crann, an airí eile nó an ní eile, de réir mar a bheidh, lena mbaineann an cion líomhnaithe a chosaint ar dhamáiste nó a chaomhnú, agus
(ii) gur tar éis na bearta a luaitear i bhfomhír (i) den mhír seo a dhéanamh a tharla an t-aistriú nó an damáiste líomhnaithe,
toimhdeofar, go dtí go suífidh an cosantóir a mhalairt, go ndearna an cosantóir, go feasach, an crann, an airí eile nó an ní eile a aistriú nó a dhamáistiú, de réir mar is iomchuí.
(8) In ionchúiseamh i leith cion faoin alt seo, ní gá don ionchúiseamh a shuíomh, agus toimhdeofar go dtí go suífidh an cosantóir a mhalairt, nárbh fhorbairt dhíolmhaithe ná forbairt ar ar tosaíodh roimh an lá ceaptha an fhorbairt (más ann) a bheidh i gceist.
(9) Chun críocha an ailt seo, measfar crann a bheith aistrithe má bhíonn sé gearrtha de thalamh nó damáistithe go toiliúil ar shlí eile.
(10) I gcás a seirbheálfaidh údarás pleanála fógra rabhaidh faoin alt seo, taifeadfaidh an t-údarás sonraí i dtaobh an fhógra sa chlár.
Féadfaidh an Ard-Chúirt forbairt nó úsáid neamhúdaraithe talún a thoirmeasc.
27.—(1) I gcás—
(a) forbairt, is forbairt ar gá cead chuici faoi Chuid IV den Phríomh-Acht, a bheith á déanamh ar thalamh gan cead den sórt sin, nó
(b) úsáid neamhúdaraithe a bheith á déanamh de thalamh,
féadfaidh an Ard-Chúirt, ar iarratas ó údarás pleanála nó ó aon duine eile, bíodh nó ná bíodh leas sa talamh ag an duine, toirmeasc a chur, le hordú, leis an bhforbairt nó leis an úsáid neamhúdaraithe leanúint ar aghaidh.
(2) I gcás a mbeidh aon fhorbairt a údaraíodh le cead a deonaíodh faoi Chuid IV den Phríomh-Acht tosaithe ach nach mbeidh sí déanta, nó á déanamh, de réir an cheada mar gheall ar cheanglais coinníll atá ag gabháil leis an gcead a bheith gan chomhlíonadh nó mar gheall ar aon chúis eile, féadfaidh an Ard-Chúirt, ar iarratas ó údarás pleanála nó ó aon duine eile, bíodh nó ná bíodh leas sa talamh ag an duine sin, a cheangal le hordú ar aon duine a shonrófar san ordú aon ní is dóigh leis an gCúirt is gá chun a áirithiú go mbeidh an fhorbairt déanta de réir an cheada agus a shonróidh sé san ordú a dhéanamh nó gan é a dhéanamh nó scor de bheith á dhéanamh.
(3) Is trí fhoriarratas a dhéanfar iarratas chun na hArd-Chúirte ar ordú faoin alt seo agus féadfaidh an Chúirt, nuair a bheidh sí ag breithniú an ábhair, cibé ordú eatramhach nó idirbhreitheach (más ann) a dhéanamh is dóigh léi is iomchuí. Féadfaidh cibé téarmaí agus coinníollacha (más ann), maidir le costais a íoc, a mheasfaidh an Chúirt is iomchuí a bheith in ordú trína gcinnfear iarratas faoin alt seo.
Údarás pleanála do tharraingt fógraí áirithe siar agus taifid iomchuí sa chlár a chealú.
28.—(1) I gcás a seirbheálfaidh údarás pleanála fógra a luaitear in alt 30, 31, 32, 35, 36, 37 nó 44 den Phríomh-Acht féadfaidh siad, trí fhógra i scríbhinn, an fógra a tharraingt siar.
(2) I gcás a dtarraingeoidh údarás pleanála fógra siar faoin alt seo taifeadfaidh an t-údarás sa chlár gur tarraingíodh siar é.
Teorainn le ré cead pleanála.
29.—(1) Faoi réir na bhfo-alt seo a leanas den alt seo, aon chead a deonaíodh faoi Chuid IV den Phríomh-Acht, roimh dháta an Achta seo a rith nó dá éis sin, scoirfidh sé, ar éag don tréimhse chúig bliana dar tosach dáta an ailt seo a theacht i ngníomh nó ar dháta an cheada a thabhairt, cibé dáta acu is déanaí, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin dá bhun roimh éag don tréimhse sin, d'éifeacht a bheith leis—
(a) i gcás gan an fhorbairt lena mbaineann an cead a bheith tosaithe i rith na tréimhse sin, maidir leis an bhforbairt go léir, agus
(b) i gcás an fhorbairt sin a bheith tosaithe amhlaidh, maidir leis an méid sin de nach mbeidh críochnaithe laistigh den tréimhse sin.
(2) Ní bheidh feidhm mar a leanas ag fo-alt (1) den alt seo:
(a) i gcás teach, siopa, oifig ná foirgneamh eile atá críochnaithe é féin, i ndáil le soláthar aon déanmhais nó oibreacha atá ar áireamh sa chead iomchuí faoi Chuid IV den Phríomh-Acht agus atá riachtanach nó cumhalda nó foghabhálach i ndáil le húsáid an fhoirgnimh de réir an cheada sin, agus
(b) i gcás forbairt a chuimsíonn uimhir foirgneamh nach bhfuil ach cuid acu críochnaithe, i ndáil le bóithre, seirbhísí agus spásanna oscailte a sholáthar atá ar áireamh sa chead iomchuí sin agus atá riachtanach nó cumhalda i ndáil leis na foirgnimh chríochnaithe sin.
(3) I gcás—
(a) a mbeidh forbairt críochnaithe an oiread sin a thuairiscítear i bhfo-alt (2) den alt seo agus go mbeidh coinníoll a ghabhann leis an gcead sin gan chomhlíonadh, nó
(b) a mbeidh forbairt críochnaithe amhlaidh agus go ngabhann leis an gcead sin coinníoll á cheangal rud éigin a fhágáil gan déanamh, nó
(c) a mbeidh forbairt críochnaithe ach amháin coinníoll a chomhlíonadh a ghabhann leis an gcead iomchuí, nó
(d) a mbeidh forbairt críochnaithe ach go ngabhann leis an gcead iomchuí coinníoll á cheangal rud éigin a fhágáil gan déanamh,
ansin, mura ndéanfar fógra (dá ngairtear fógra tarscaoilidh ina dhiaidh seo san alt seo) á rá nach gá an coinníoll a chomhlíonadh a eisiúint faoin alt seo ní fhorléireofar fo-alt (1) den alt seo mar fho-alt a dhéanann difear, ná ní oibreoidh sé le difear a dhéanamh, d'oibleagáid aon duine ceanglais an choinníll a chomhlíonadh.
(4) Féadfaidh údarás pleanála, más oiriúnach leo, fógra tarscaoilidh a eisiúint ar iarratas a bheith déanta chuige sin.
(5) Féadfaidh aon duine arb éagóir leis cinneadh ag údarás pleanála ar iarratas ag iarraidh fógra tarscaoilidh achomharc a dhéanamh chun an Bhoird laistigh de lá agus fiche dar tosach an dáta a chuirfidh an t-údarás pleanála a gcinneadh in iúl don iarratasóir.
(6) I gcás a ndéanfar achomharc faoi fho-alt (5) den alt seo, féadfaidh an Bord—
(a) má bhíonn fógra tarscaoilidh eisithe ag údarás pleanála, an fógra a dhaingniú nó a neamhniú, nó
(b) mura mbeidh fógra tarscaoilidh eisithe amhlaidh, cinneadh an údaráis phleanála a dhaingniú nó fógra tarscaoilidh a eisiúint.
(7) I gcás—
(a) a mbeidh cead tugtha faoi Chuid IV den Phríomh-Acht le haghaidh forbartha agus go mbeidh an fhorbairt lena mbaineann an cead tosaithe ach nach mbeidh sí críochnaithe sula scoirfidh an cead d'éifeacht a bheith leis, agus
(b) ar deimhin leis an údarás pleanála iomchuí go bhfuil díospóid ann—
(i) i dtaobh cé acu a bhí nó nach raibh cuid áirithe den fhorbairt críochnaithe sular scoir an cead d'éifeacht a bheith leis, nó
(ii) i dtaobh arb éard cuid áirithe den fhorbairt aon cheann amháin nó níos mó acu seo a leanas a sholáthar, is é sin, déanmhas a luaitear i bhfo-alt (2) den alt seo, oibreacha, bóithre, seirbhísí agus spásanna oscailte a luaitear amhlaidh,
ansin, más deimhin leis an údarás gur críochnaíodh amhlaidh an chuid den fhorbairt nó gurb í sin í, de réir mar is iomchuí, féadfaidh siad, ar an táille iomchuí (más ann) a bheith íoctha, deimhniú (dá ngairtear deimhniú forbartha ina dhiaidh seo san alt seo) sa chéill sin a eisiúint.
(8) In aon imeachtaí dlíthiúla beidh deimhniú forbartha ina fhianaise prima facie ar na fíorais a bheidh deimhnithe leis, agus aon doiciméad a airbheartóidh gur deimhniú forbartha é glacfar i bhfianaise é gan cruthúnas ar shíniú an duine a airbheartaítear a shínigh an deimhniú nó gur oifigeach don údarás pleanála iomchuí an duine, go dtí go suífear a mhalairt.
(9) Más oiriúnach le húdarás pleanála é féadfaidh siad, maidir le cead áirithe, le hordú, an tréimhse dá dtagraítear i bhfo-alt (1) den alt seo a shíneadh, nó a shíneadh tuilleadh, ó am go ham, cibé tréimhse bhreise a mheasfaidh an t-údarás is iomchuí agus i gcás a ndéanfaidh údarás pleanála ordú den sórt sin, déanfar an tagairt san fho-alt sin (1) don tréimhse chúig bliana a fhorléiriú, maidir leis an gcead lena mbaineann an t-ordú, mar thagairt don tréimhse sin arna síneadh amhlaidh nó arna síneadh agus arna síneadh tuilleadh amhlaidh, de réir mar is iomchuí.
(10) Nuair a dhéanfaidh údarás pleanála tréimhse a shíneadh nó a shíneadh tuilleadh, nó deimhniú forbartha a eisiúint, taifeadfar sonraí ina thaobh sin ar an taifead iomchuí sa chlár.
(11) Féadfaidh aon duine arb éagóir leis cinneadh ag údarás pleanála ar iarratas ar dheimhniú forbartha achomharc a dhéanamh chun na Cúirte Cuarda laistigh de shé mhí ó dháta an chinnte sin.
(12) I gcás a ndéanfar achomharc faoi fho-alt (11) den alt seo, féadfaidh an Chúirt, más deimhin léi go mbaineann mír (a) d'fho-alt (7) den alt seo leis an gcás agus go bhfuil díospóid ann a luaitear i mír (b) den fho-alt sin (7), breith dá réir a thabhairt agus, de réir mar is iomchuí, ceachtar de na nithe seo a leanas nó iad araon a chinneadh, is é sin, a mhéid a bhí an fhorbairt iomchuí críochnaithe sular scoir an cead iomchuí faoi Chuid IV den Phríomh-Acht d'éifeacht a bheith leis, nó cibé acu an éard nó nach éard an chuid faoi dhíospóid den fhorbairt iomchuí nithe a sholáthar a luaitear i bhfomhír (ii) den mhír sin (b), a breith a chur in iúl don údarás pleanála iomchuí agus a ordú don údarás deimhniú forbartha iomchuí a eisiúint láithreach, mura mbeidh sin déanta cheana féin acu nó, má bhíonn deimhniú forbartha eisithe nach deimhniú forbartha iomchuí é ag féachaint do bhreith na Cúirte, an deimhniú sin a chur go dtí an t-údarás agus a ordú go ndéanfaidh an t-údarás deimhniú forbartha iomchuí a eisiúint ina ionad láithreach.
(13) I gcás ar deimhin leis an gCúirt Chuarda, ar dhuine do dhéanamh iarratais, gur mhoilligh údarás pleanála go míréasúnach déileáil le hiarratas ar dheimhniú forbartha agus ar deimhin freisin leis an gCúirt maidir leis an dá ní a luaitear i bhfo-alt (12) den alt seo, féadfaidh an Chúirt breithniú dá réir sin agus an cinneadh a dhéanamh a luaitear san fho-alt sin (12) agus is iomchuí, a cinneadh a chur in iúl don údarás agus a ordú don údarás deimhniú forbartha iomchuí a eisiúint láithreach.
Imeachtaí achomaire.
30.—(1) Faoi réir fho-alt (2) den alt seo, féadfar imeachtaí achomaire lena mbaineann an t-alt seo a thionscnamh—
(a) aon tráth laistigh de shé mhí ón dáta a rinneadh an cion, nó
(b) aon tráth laistigh de thrí mhí ón dáta a thiocfaidh fianaise ar umhail an duine a thionscnóidh na himeachtaí is leor. i dtuairim an duine sin. le gur chóir imeachtaí a thionscnamh,
cibé tráth acu sin is déanaí.
(2) Ní dhéanfar imeachtaí achomaire a luaitear i bhfo-alt (1) den alt seo a thionscnamh tráth is déanaí ná cúig bliana ón dáta a rinneadh an cion.
(3) Chun críocha an ailt seo, beidh deimhniú a bheidh sínithe ag an duine, nó thar ceann an duine, a thionscnóidh na himeachtaí maidir leis an dáta a tháinig fianaise a thuairiscítear i bhfo-alt (1) den alt seo ar umhail an duine sin ina fhianaise prima facie ar an gcéanna agus, in aon imeachtaí dlíthiúla, doiciméad a airbheartóidh gur deimhniú é a eisíodh chun críocha an ailt seo agus a bheith sínithe amhlaidh measfar é a bheith sínithe amhlaidh agus glacfar mar fhianaise é gan cruthúnas ar shíniú an duine a airbheartaítear a shínigh an deimhniú, mura suífear a mhalairt.

(4) Beidh éifeacht le fo-alt (1) den alt seo d'ainneoin alt 10 (4) den Petty Sessions (Ireland) Act, 1851.
(5) Baineann an t-alt seo leis na himeachtaí achomaire seo a leanas. is é sin:

Aighneachtaí agus glacadh comhairle.
31.—(1) Féadfaidh an Bord aighneachtaí a dhéanamh chun an Aire maidir le haon ábhair a bhaineann le feidhmeanna an Bhoird.
(2) Féadfaidh an tAire comhairle a ghlacadh leis an mBord i ndáil le comhlíonadh aon fheidhme de chuid an Aire faoi na hAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 agus 1976.
Dearbhú ó chomhaltaí agus ó fhostaithe an Bhoird, agus ó chomhaltaí agus ó oifigigh údarás pleanála i dtaobh leasanna áirithe.
32.—(1) Is é dualgas duine lena mbaineann an t-alt seo dearbhú san fhoirm fhorordaithe, a bheidh sínithe aige agus ina mbeidh sonraí faoi gach leas dá chuid is leas lena mbaineann an t-alt seo, a thabhairt don chomhlacht iomchuí agus fad is duine é lena mbaineann an t-alt seo is é a dhualgas, nuair a tharlóidh athrú maidir le leas a mbeidh sonraí faoi sa dearbhú nó i gcás a bhfaighidh sé aon leas eile lena mbainfidh an t-alt seo, dearbhú den sórt sin a thabhairt as an nua don chomhlacht iomchuí.
(2) (a) Baineann an t-alt seo leis na daoine seo a leanas, is é sin:
(i) comhalta den Bhord,
(ii) comhalta d'údarás pleanála,
(iii) fostaí don Bhord nó aon duine eile,
(I) a mbainfidh an Bord leas as a sheirbhísí, agus
(II) is d'aicme, de thuairisc nó de ghrád a bheidh forordaithe chun críocha an ailt seo,

(iii) aon ghairm, gnó nó slí bheatha dá bhfuil an duine sin ag gabháil, dó féin nó ar shlí eile, agus a bhaineann le déileáil i dtalamh nó le forbairt talún.
(3) Duine lena mbaineann an t-alt seo agus a bhfuil leas aige lena mbaineann an t-alt seo measfar go gcomhlíonann sé ceanglais fho-alt (1) den alt seo má thugann sé, agus amháin má thugann sé, don chomhlacht iomchuí dearbhú a luaitear san fho alt sin laistigh den tréimhse ocht lá is fiche dar tosach—
(a) i gcás ar duine den sórt sin an duine ar dháta thosach feidhme an ailt seo, ar an dáta sin,
(b) i gcás a dtiocfaidh an duine chun bheith ina dhuine den sórt sin tar éis tosach feidhme an ailt seo, an lá a thiocfaidh sé chun bheith ina dhuine den sórt sin,
(c) i gcás a dtarlóidh athrú maidir le leas a mbeidh sonraí faoi i ndearbhú a bheidh tugtha cheana féin ag an duine nó i gcás a bhfaighidh an duine aon leas eile lena mbainfidh an t-alt seo, an lá a tharlóidh an t-athrú nó a gheofar an leas eile den sórt sin.
(4) Chun críocha an ailt seo, measfar eastát nó leas i dtalamh a bheith ag duine lena mbaineann an t-alt seo más comhalta de chuideachta nó de chomhlacht eile ag a bhfuil eastát nó leas sa talamh eisean nó aon ainmní dá chuid.
(5) Chun críocha an ailt seo, ní mheasfar leas lena mbaineann an t-alt seo a bheith ag duine más leas chomh fánach nó chomh beag sin é nach inmheasta le réasún gur dóigh dó dul i gcion ar dhuine agus é ag breithniú nó ag plé aon cheist, nó ag vótáil ar aon cheist, i ndáil le haon ábhar a éireoidh nó a thiocfaidh os comhair an Bhoird nó an údaráis, de réir mar is iomchuí, nó le linn dó bheith ag comhlíonadh aon fheidhme i ndáil le haon ábhar den sórt sin.
(6) I gcás a bhfuil leas lena mbaineann an t-alt seo ag duine lena mbaineann an t-alt de dhroim agus amháin de dhroim scaireanna i gcuideachta nó i gcomhlacht eile a bheith ar úinéireacht tairbhiúil aige nó ag a ainmní agus nach mó luach ainmniúil iomlán na scaireanna sin ná cibé acu seo a leanas is lú—
(a) cúig chéad punt, nó
(b) an céadú cuid de luach ainmniúil iomlán scairchaipiteal eisithe na cuideachta nó an chomhlachta nó, i gcás ar eisíodh an caipiteal sin ina scaireanna d'aicmí de bhreis ar aon aicme amháin, scairchaipiteal eisithe na haicme nó na n-aicmí scaireanna ina bhfuil leas aige,
ní bheidh éifeacht le fo-alt (1) den alt seo i ndáil leis an leas sin.
(7) Coimeádfaidh an Bord agus gach údarás pleanála clár (clár dá ngairtear an clár leasanna san alt seo) chun críocha an ailt seo agus taifeadfaidh ann na sonraí a bheidh i ndearbhuithe a thabharfar don Bhord nó don údarás, de réir mar a bheidh, de bhun an ailt seo. Coimeádfar an clár leasanna in oifigí an Bhoird nó an údaráis phleanála, de réir mar a bheidh, agus beidh sé ar fáil lena iniúchadh ag an bpobal le linn uaire oifige.
(8) I gcás a scoirfidh duine de bheith ina dhuine lena mbaineann an t-alt seo, déanfaidh an comhlacht iomchuí aon sonraí a bheidh taifeadta sa chlár leasanna de thoradh an duine do thabhairt dearbhaithe don chomhlacht sin de bhun an ailt seo a bhaint as an gclár sin a luaithe is féidir tar éis éag don tréimhse chúig bliana dar tosach an lá a scoirfidh an duine de bheith ina dhuine den sórt sin.
(9) Faoi réir fho-alt (10) den alt seo, duine a mhainneoidh déanamh de réir fho-alt (1) den alt seo, nó a thabharfaidh, nuair a airbheartóidh sé a bheith ag déanamh de réir ceanglais an fho-ailt sin (1), sonraí a bheidh bréagach nó is eol dó a bheith míthreorach i bponc ábhartha, beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná dhá chéad is caoga punt nó, de rogha na cúirte, príosúnacht ar feadh téarma nach faide ná sé mhí, nó an fhíneáil agus an phríosúnacht le chéile, a chur air.
(10) In aon imeachtaí mar gheall ar chion faoin alt seo is cosaint don chosantóir a chruthú gur chreid sé, de mheon macánta agus ar chúis mhaith, an tráth iomchuí—
(a) gurbh fhíor na sonraí iomchuí,
(b) nach raibh aon ábhar a raibh sé faoi cheangal an uair sin dearbhú a dhéanamh maidir leis faoi fho-alt (1) den alt seo, nó
(c) nárbh ábhar a raibh sé faoi cheangal amhlaidh an dearbhú sin a dhéanamh maidir leis an t-ábhar a mbeidh an cion líomhnaithe i ndáil leis.
(11) (a) Chun críocha an ailt seo agus alt 33 den Acht seo,
(i) measfar, maidir le bainisteoir, gur oifigeach é do gach údarás pleanála dar bainisteoir é,
(ii) measfar, maidir le bainisteoir contae cúnta do chontae, gur oifigeach é do gach údarás pleanála sa chontae, agus
(iii) oifigeach d'údarás pleanála atá, de bhua comhshocraíocht nó comhaontú a rinneadh faoi aon achtachán, ag comhlíonadh dualgas faoi údarás pleanála eile, measfar gur oifigeach don údarás eile é freisin.
(b) San alt seo ciallaíonn an “comhlacht íomchuí”,
(i) i gcás ar comhalta den Bhord nó fostaí don Bhord, nó duine eile a mbaineann an Bord leas as a sheirbhísí, duine lena mbaineann an t-alt seo, an Bord, agus
(ii) i gcás ar comhalta de údarás pleanála nó oifigeach do údarás pleanála duine den sórt sin, an t-údarás.
Ceanglais a bhaineann le comhaltaí agus le fostaithe an Bhoird, le comhaltaí de údaráis phleanála, le hoifigigh áirithe do údaráis phleanála agus le daoine áirithe eile ag a bhfuil leasanna tairbhiúla áirithe.
33.—(1) I gcás a mbeidh leas airgid nó leas tairbhiúil eile in aon achomharc, ranníoc, ceist nó díospóid a bheidh le cinneadh ag an mBord, nó is leas ábhartha i ndáil leis an gcéanna, ag comhalta den Bhord, déanfaidh sé de réir na gceanglas seo a leanas:
(a) nochtfaidh sé don Bhord cad é an leas a leas,
(b) ní ghlacfaidh sé aon pháirt i bplé nó i mbreithniú an ábhair,
(c) ní vótálfaidh ná ní ghníomhóidh sé ar aon slí eile mar chomhalta den Bhord i ndáil leis an ábhar, agus
(d) ní fheidhmeoidh sé a chomhairle, ná ní fhéachfaidh sé lena chomhairle a fheidhmiú, ar chinneadh ag an mBord maidir leis an ábhar.
(2) I gcás a dtarlóidh ag cruinniú d'údarás pleanála nó d'aon choiste d'údarás pleanála go molfar, nó go n-éireoidh ar shlí eile, rún, tairiscint, ceist nó ábhar eile de bhun na nAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 agus 1976, nó maidir leis an údarás do chomhlíonadh feidhme faoi na hAchtanna sin nó i ndáil leis an údarás d'fháil nó do dhiúscairt talún faoi réim nó chun críocha na nAchtanna sin nó aon achtacháin eile, ansin, aon chomhalta den údarás nó den choiste a bheidh i láthair ag an gcruinniú agus leas airgid nó leas tairbhiúil eile aige san ábhar nó is leas ábhartha maidir leis an ábhar—
(a) nochtfaidh sé ag an gcruinniú, sula dtosófar ag plé nó ag breithniú an ábhair, cad é an leas a leas,
(b) fágfaidh sé an cruinniú fad a bheidh an t-ábhar á phlé nó á bhreithniú,
agus dá réir sin, ní ghlacfaidh sé aon pháirt i bplé ná i mbreithniú an ábhair agus ní vótálfaidh sé i ndáil leis.
(3) Aon chomhalta d'údarás pleanála nó d'aon choiste d'údarás pleanála a mbeidh leas airgid nó leas tairbhiúil eile aige in ábhar a éireoidh de bhun na nAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 agus 1976, nó maidir leis an údarás do chomhlíonadh feidhme faoi na hAchtanna sin nó i ndáil leis an údarás d'fháil nó do dhiúscairt talún faoi réim nó chun críocha na nAchtanna sin nó aon achtacháin eile, nó is leas ábhartha i ndáil leis an ábhar sin, ní fheidhmeoidh sé a chomhairle, ná ní fhéachfaidh sé lena chomhairle a fheidhmiú, ar chinneadh ag an údarás maidir leis an ábhar.
(4) I gcás a mbeidh ag bainisteoir údaráis phleanála leas airgid nó leas tairbhiúil eile in aon ábhar a éireoidh nó a thiocfaidh os comhair an údaráis de bhun na nAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 agus 1976, nó maidir leis an údarás do chomhlíonadh feidhme faoi na hAchtanna sin nó i ndáil leis an údarás d'fháil nó do dhiúscairt talún faoi réim nó chun críocha na nAchtanna sin nó aon achtacháin eile, nó is leas ábhartha i ndáil leis an ábhar sin, nochtfaidh sé, a luaithe is féidir, do chomhaltaí an údaráis phleanála cad é an leas a leas.
(5) (a) I gcás a mbeidh leas airgid nó leas tairbhiúil eile in aon achomharc, ranníoc, ceist nó díospóid a bheidh le cinneadh ag an mBord, nó is leas ábhartha i ndáil leis an gcéanna, ag fostaí don Bhord nó ag aon duine eile a mbaineann an Bord leas as a sheirbhísí, déanfaidh sé de réir na gceanglas seo a leanas:
(i) ní fheidhmeoidh sé a chomhairle, ná ní fhéachfaidh sé lena chomhairle a fheidhmiú, ar chinneadh ag an mBord maidir leis an ábhar, agus
(ii) má bhíonn baint aige, mar fhostaí nó mar dhuine eile den sórt sin, leis an ábhar, nochtfaidh sé don Bhord cad é an leas a leas agus déanfaidh sé de réir aon orduithe a thabharfaidh an Bord dó i ndáil leis an ábhar.
(b) I gcás a mbeidh leas airgid nó leas tairbhiúil eile in aon ábhar a éireoidh nó thiocfaidh os comhair an údaráis de bhun na nAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 agus 1976, nó maidir leis an údarás do chomhlíonadh feidhme faoi na hAchtanna sin nó i ndáil leis an údarás d'fháil nó do dhiúscairt talún faoi réim nó chun críocha na nAchtanna sin nó aon achtacháin eile, nó is leas ábhartha i ndáil leis an ábhar sin, ag oifigeach d'údarás pleanála nach é an bainisteoir é, déanfaidh sé de réir na gceanglas seo a leanas:
(i) ní fheidhmeoidh sé a chomhairle, ná ní fhéachfaidh sé lena chomhairle a fheidhmiú, ar chinneadh ag an údarás maidir leis an ábhar, agus
(ii) má bhíonn baint aige, mar oifigeach den sórt sin, leis an ábhar, nochtfaidh sé do bhainisteoir an údaráis cad é an leas a leas agus déanfaidh sé de réir aon orduithe a thabharfaidh an bainisteoir dó i ndáil leis an ábhar.
(6) Chun críocha an ailt seo ach gan dochar do ghinearáltacht aon fho-ailt de na fo-ailt sin roimhe seo den alt seo, measfar leas tairbhiúil a bheith ag duine—
(a) más duine é féin nó a chéile, nó más duine aon ainmní dá chuid féin nó de chuid a chéile, is comhalta de chuideachta nó d'aon chomhlacht eile ag a bhfuil leas tairbhiúil i rún, tairiscint, ceist nó ábhar eile a luaitear sna fo-ailt sin roimhe seo den alt seo nó leas is leas ábhartha i ndáil leis an gcéanna,
(b) má tá sé féin nó a chéile i gcomhpháirtíocht le duine, nó ar fostú ag duine, ag a bhfuil leas tairbhiúil i rún, tairiscint, ceist nó ábhar den sórt sin nó is leas ábhartha i ndáil leis an gcéanna,
(c) más páirtí é féin nó a chéile in aon chomhshocraíocht nó comhaontú (is infheidhmithe nó nach infheidhmithe) i ndáil le talamh lena mbaineann rún, tairiscint, ceist nó ábhar eile den sórt sin,
(d) má tá leas tairbhiúil ag a chéile i rún, tairiscint, ceist nó ábhar eile den sórt sin nó is leas ábhartha i ndáil leis an gcéanna.
(7) Chun críocha an ailt seo, ní mheasfar leas tairbhiúil a bheith ag duine in aon rún, tairiscint, ceist nó ábhar eile, nó is leas ábhartha i ndáil leis an gcéanna, mar gheall, agus amháin mar gheall, ar leas dá chuid nó de chuid aon chuideachta nó de chuid aon comhlachta nó duine eile a luaitear i bhfo-alt (6) den alt seo atá chomh fánach nó chomh beag sin nach inmheasta le réasún gur dóigh dó dul i gcion ar dhuine agus é ag breithniú nó ag plé aon cheist, nó ag vótail ar aon cheist, maidir leis an ábhar, nó ag comhlíonadh aon fheidhme i ndáil leis an ábhar sin.
(8) I gcás a bhfuil leas tairbhiúil a luaitear i bhfo-alt (1), (2), (3), (4) nó (5) den alt seo ag duine de dhroim, agus amháin de dhroim, scaireanna i gcuideachta nó i gcomhlacht eile a bheith ar úinéireacht tairbhiúil aige féin nó ag a chéile agus nach mó luach ainmniúil na scaireanna sin ná cibé acu seo a leanas is lú—
(a) cúig chéad punt, nó
(b) an céadú cuid de luach ainmniúil iomlán scairchaipiteal eisithe na cuideachta nó an chomhlachta nó, i gcás ar eisíodh an caipiteal sin ina scaireanna d'aicmí de bhreis ar aon aicme amháin, scairchaipiteal eisithe na haicme scaireanna ina bhfuil leas aige.
ní bheidh éifeacht le haon fho-alt acu sin i ndáil leis an leas tairbhiúil sin.
(9) I gcás ina ndéanfar nochtadh faoi fho-alt (2) den alt seo ag cruinniú a thuairiscítear san fho-alt sin, taifeadfar i miontuairiscí an chruinnithe sonraí faoin nochtadh agus faoi aon duine d'fhágáil an chruinnithe de bhun an fho-ailt sin.
(10) Faoi réir fho-alt (11) den alt seo, aon duine a sháróidh ceanglas, nó a mhainneoidh déanamh de réir ceanglais, den alt seo beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná dhá chéad is caoga punt nó, de rogha na cúirte, príosúnacht ar feadh téarma nach faide ná sé mhí, nó an fhíneáil agus an phríosúnacht le chéile, a chur air.
(11) In aon imeachtaí mar gheall ar chion faoin alt seo, is cosaint don chosantóir a chruthú nach raibh a fhios aige, agus nach raibh aon chúis aige a chreidiúint, tráth an chiona líomhnaithe, go raibh ábhar a raibh leas tairbhiúil aige ann nó i ndáil leis éirithe nó tógtha os comhair an Bhoird nó an údaráis phleanála nó an choiste, de réir mar is iomchuí, nó á bhreithniú ag an mBord, ag an údarás nó ag an gcoiste sin, nó gur leas lenar bhain ceanglas de chuid an ailt seo an leas tairbhiúil lena mbaineann an cion líomhnaithe.
Forálacha forlíontacha a bhaineann le hailt 32 agus 33.
34.—(1) Ní thionscnófar imeachtaí i leith cion faoi alt 32 nó 33 den Acht seo ach amháin ag an Stiúrthóir Ionchúiseamh Poiblí nó lena thoiliú.
(2) I gcás a gciontófar duine i gcion faoi alt 32 nó 33 den Acht seo, beidh éifeacht leis na forálacha seo a leanas:
(a) beidh an duine dícháilithe chun bheith ina chomhalta den Bhord,
(b) i gcás ar comhalta den Bhord an duine, scoirfidh sé dá réir sin, ar é a chiontú amhlaidh, de bheith ina chomhalta den Bhord,
(c) i gcás ar comhalta d'údarás pleanála nó ar comhalta d'aon choiste d'údarás pleanála an duine, scoirfidh sé, ar é a chiontú amhlaidh, de bheith ina chomhalta den údarás nó den choiste, de réir mar is iomchuí,
(d) i gcás ar comhalta d'údarás pleanála agus, freisin, d'aon choiste nó coistí den sórt sin an duine, scoirfidh sé amhlaidh de bheith ina chomhalta den údarás agus. freisin, de gach coiste den sórt sin, agus
(e) i gcás a scoirfidh an duine de bhua an fho-ailt seo de bheith ina chomhalta d'údarás pleanála nó d'aon choiste den sórt sin, beidh sé dícháilithe chun bheith ina chomhalta den údarás nó den choiste ar feadh na tréimhse arb í, mura mbeadh é scor de bheith ina chomhalta den údarás nó den choiste faoin alt seo, iarmhar a théarma í.
(3) I gcás a sáróidh duine ceanglas, nó i gcás é mainniú déanamh de réir ceanglais, de chuid alt 32 nó 33 den Acht seo, nó é do ghníomhú mar chomhalta den Bhord, d'údarás pleanála nó de choiste d'údarás pleanála le linn dó bheith dícháilithe chun bheith ina chomhalta de bhua an ailt seo, ní chuirfidh an sárú, an mhainneachtain nó an gníomhú sin aige, de réir mar a bheidh, ó bhailíocht aon ghníomh nó imeacht de chuid an Bhoird, an údaráis nó an choiste.
(4) I gcás a meastar faoi alt 155 d'Acht na gCuideachtaí, 1963, aon chomhlacht is cuideachta de réir brí an ailt sin a bheith ina fhochuideachta do chuideachta eile nó a bheith ina chuideachta shealbhaíochta de chuid cuideachta eile den sórt sin, measfar, chun críocha ailt 32 agus 33 den Acht seo, duine is comhalta den chuideachta chéadluaite sin a bheith, freisin, ina chomhalta den chuideachta eile.
Rialacháin.
35.—Féadfaidh an tAire rialacháin a dhéanamh,
(a) ina mbeidh foráil,
(i) i ndáil le hiarratasóirí d'íoc táillí forordaithe le húdaráis phleanála ar fhógra tarscaoilidh faoi alt 29 den Acht seo,
(ii) i ndáil le húdaráis phleanála d'fhoilsiú fógraí forordaithe i leith iarratas ar chead faoin bPríomh-Acht talamh a fhorbairt nó ar fhógra tarscaoilidh den sórt sin,
(b) dá chumasú d'iarratasóir achomharc a dhéanamh chun an Bhoird in aghaidh diúltú ceadú a thabhairt is gá a fháil ar choinníoll ar faoina réir a thugtar cead nó ceadú faoin bPríomh-Acht,
(c) agus cibé socrú foghabhálach, iarmhartach, eatramhach nó forlíontach a dhéanamh iontu is dóigh leis is gá nó is cuí chun aon chríche den Acht seo nó de dhroim aon cheann dá fhorálacha nó chun lán-éifeacht a thabhairt d'aon cheann dá fhorálacha.
Dualgas cruthúnais.
36.—In aon imeachtaí mar gheall ar chion faoin Acht seo nó faoin bPríomh-Acht, ní gá aon chead a tugadh faoi Chuid IV den Phríomh-Acht a bheith ann a fhrisnéis le fianaise agus is ar an duine a bheidh ag iarraidh leas a bhaint as an gcead sin a bheidh de dhualgas an cead sin a chruthú.
Leasú ar dhréachtphlean forbartha nó ar dhréachtathfhoirmiú.
37.—Leasaítear leis seo an Príomh-Acht tríd an alt seo a leanas a chur isteach i ndiaidh alt 21:
“21A.—(1) I gcás a mbeidh údarás pleanála tar éis dréacht de phlean forbartha beartaithe nó d'athfhoirmithe beartaithe ar phlean forbartha a ullmhú agus, tar éis déanamh de réir ceanglais fho-alt (1) agus (2) d'alt 21 den Acht seo, gur dealraitheach don údarás gur ceart an dréacht a leasú, faoi réir fho-alt (2) den alt seo féadfaidh siad an dréacht a leasú agus an plean forbartha nó na hathfhoirmithe a dhéanamh dá réir sin.
(2) I gcás arbh athrú ábhartha ar an dréacht iomchuí an leasú beartaithe, dá ndéanfaí é, cuirfidh an t-údarás pleanála faoi deara fógra faoin leasú beartaithe a fhoilsiú san Iris Oifigiúil agus i nuachtán amháin ar a laghad a léitear ina limistéar, agus, tar éis dóibh déanamh de réir ceanglais fho-alt (3) agus, i gcás ar iomchuí é, de réir ceanglas de chuid fho-alt (4) den alt seo, agus ar aon uiríolla a chur i gcuntas, féadfaidh siad, de réir mar is oiriúnach leo, an plean beartaithe nó an t-athfhoirmiú beartaithe, de réir mar a bheidh, a dhéanamh maille leis an leasú beartaithe nó dá éagmais nó maille le cibé leasú eile (nach leasú do dhéanamh socrú le déanmhas nó ceart slí poiblí a chaomhnú) a mheasfaidh siad, ag féachaint do na himthosca áirithe, is iomchuí.
(3) Déarfar i bhfógra faoin bhfo-alt sin roimhe seo—
(a) go bhféadfar cóip den leasú a bheartaítear a dhéanamh ar an dréacht a iniúchadh in áit a luafar agus tráthanna a luafar i rith tréimhse a luafar nach giorra ná mí (agus coimeádfar an chóip ar fáil le hiniúchadh dá réir sin), agus
(b) go gcuirfear san áireamh, sula ndéanfar aon leasú, uiríolla scríofa maidir leis an leasú a bheartaítear a dhéanamh ar an dréacht, a dhéanfar chun an údaráis phleanála sa tréimhse sin (agus cuirfear aon uiríolla den sórt sin san áireamh dá réir sin).
(4) (a) I gcás a mbeidh sa leasú beartaithe aon fhoráil chun aon déanmhas a chaomhnú mar gheall ar a spéisiúlacht ó thaobh ealaíne, staire nó ailtireachta, déanfaidh an t-údarás pleanála, i dteannta déanamh de réir ceanglais fho-alt (2) den alt seo, fógra ina mbeidh sonraí faoin bhforáil a sheirbheáil ar úinéir agus ar áititheoir an déanmhais.
(b) I gcás a mbeidh sa leasú beartaithe aon fhoráil chun ceart slí poiblí a chaomhnú, déanfaidh an t-údarás pleanála, i dteannta déanamh de réir ceanglais an fho-ailt sin (2), cóip den fhógra ina mbeidh sonraí na forála agus léarscáil ag taispeáint an chirt slí a sheirbheáil ar úinéir agus ar áititheoir na talún.
(5) Féadfaidh aon duine, sula mbeidh an lá is fiche díreach i ndiaidh na tréimhse a luafar de bhun mhír (a) d'fho-alt (3) den alt seo caite, achomharc a dhéanamh chun na Cúirte Cuarda in aghaidh aon fhoráil den sórt dá dtagraítear i bhfo-alt (4) (b) den alt seo a chur sa leasú beartaithe agus, más deimhin leis an gCúirt nach bhfuil aon cheart slí poiblí ann, dearbhóidh an Chúirt sin agus ní chuirfear an fhoráil isteach dá réir sin.”.

38.—(1) Déantar leis seo an fhíneáil is mó is féidir a ghearradh mar gheall ar chion faoi alt den Phríomh-Acht a luaitear i bhfo-alt (3) (a) den alt seo (seachas cion ar cion breise é faoi alt den sórt sin nó cion leanúnach) a mhéadú go dtí dhá chéad is caoga punt, agus dá réir sin—
(a) gach tagairt do chéad punt sna hailt den Príomh-Acht a luaitear i mír (a) (i) d'fho-alt (3) den alt seo forléireofar í agus beidh éifeacht léi ionann is dá mba thagairt í do dhá chéad is caoga punt, agus
(b) cuirfear tagairt do dhá chéad is caoga punt in ionad na tagartha do dhá chéad punt in alt 45 (8) den Phríomh-Acht agus cuirfear na focail “agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná dhá chéad is caoga punt a chur air” i ndiaidh na bhfocal “i gcion” in alt 46 (8) den Phríomh-Acht.
(2) Gach tagairt d'fhiche punt sna hailt den Phríomh-Acht a luaitear i bhfo-alt (3) (b) den alt seo forléireofar í agus beidh éifeacht léi ionann is dá mba thagairt í do chaoga punt.

“(dd) á chumasú d'údaráis phleanála a iarraidh ar iarratasóir go gcuirfidh sé faoina mbráid pleananna athscrúdaithe nó líníochtaí eile ag déanamh modhnaithe, nó sonraí eile do dhéanamh socraithe le modhnú a dhéanamh, ar an bhforbairt lena mbaineann an t-iarratas agus, i gcás a gcuirfear pleananna, líníochtaí nó sonraí den sórt sin faoi bhráid údaráis phleanála de fhreagra ar iarraidh den sórt sin, á chumasú don údarás ag cinneadh an iarratais dóibh cead nó ceadú a dheonú le haghaidh na forbartha iomchuí arna modhnú le gach ceann nó le haon cheann de na pleananna, de na líníochtaí nó de na sonraí sin,”;
(c) tríd an mír seo a leanas a chur isteach in alt 26 (2) i ndiaidh mhír (b):
“(bb) coinníollacha chun a cheangal go ndéanfar bearta le go laghdófar nó go gcoiscfear—
(i) aon torann nó tonnchrith amach as aon déanmhas a bheidh ar áireamh san fhorbairt a bheidh údaraithe leis an gcead a thabharfadh cúis réasúnach bearráin do dhaoine in aon áitreabh i gcomharsanacht na forbartha nó do dhaoine a bheidh go dleathach ag úsáid aon áit phoiblí sa chomharsanacht sin, nó
(ii) aon torann nó tonnchrith isteach a thabharfadh cúis réasúnach bearráin d'aon duine a bheidh go dleathach ag áitiú aon déanmhais den sórt sin,”;
(d) tríd an bhfo-alt seo a leanas a chur in ionad fho-ált (3) d'alt 26:
“(3) (a) I gcás a sáródh an fhorbairt iomchuí go hábhartha an plean forbartha nó aon ordú um limistéar taitneamhachta speisialta, féadfaidh údarás pleanála, d'ainneoin aon fhorála eile den Acht seo, a chinneadh cead a thabhairt faoin alt seo, ar choinníoll go mbeidh na coinníollacha seo a leanas comhlíonta sula ndéanfar an cinneadh, is é sin,
(i) déanfar fógra san fhoirm fhorordaithe go bhfuil an t-údarás pleanála chun a bhreithniú an gcinnfidh siad an cead a dheonú a fhoilsiú i nuachtán amháin ar a laghad a léitear ina limistéar,
(ii) tabharfar cóipeanna den fhógra don iarratasóir agus d'aon duine a mbeidh agóid i scríbhinn déanta aige in aghaidh na forbartha lena mbainfidh an t-iarratas,
(iii) breithneiodh an t-údarás pleanála go cuí aon agóid nó uiríoll maidir lena chinneadh cead a dheonú agus a gheobhaidh an t-údarás pleanála tráth nach déanaí ná lá is fiche tar éis an fógra a fhoilsiú den chéad uair, agus
(iv) rithfidh an t-údarás rún á cheangal go gcinnfear cead a dheonú.
(b) Is gá le rún dá dtagraítear i mír (a) den fho-alt seo a rith gur mó ná trian de líon iomlán comhaltaí an údaráis phleanála an líon comhaltaí den údarás pleanála a votálfaidh i bhfabhar an rúin, agus is ceanglas i dteannta, agus ní ceanglas in ionad, aon cheanglas eile ag a mbeidh feidhm i ndáil le rún den sórt sin ceanglas na míre seo.
(c) I gcás a dtabharfar fógra de bhun alt 4 den Acht um Bainistí Chathrach agus Contae (Leasú), 1955, go bhfuiltear le rún a mholadh a cheanglódh, dá rithfí é, ar an mbainisteoir a chinneadh cead a thabhairt faoin alt seo, ansin más é tuairim an bhainisteora go sáródh an fhorbairt iomchuí go hábhartha an plean forbartha nó aon ordú um limistéar taitneamhachta speisialta, déanfaidh sé, laistigh de sheacht lá ón tráth a gheobhaidh sé an fógra ordú (a dtabharfaidh sé cóip de do gach duine de shínitheoirí an fhógra) á cheangal go gcomhlíonfar forálacha fomhíreanna (i), (ii) agus (iii) de mhír (a) den fho-alt seo sa chás áirithe agus oibreoidh an t-ordú, nuair a dhéanfar é, le nach mbeidh éifeacht feasta leis an bhfógra iomchuí a tugadh de bhun an ailt sin 4.
(d) Má ritear go cuí rún dá dtagraítear i mír (a) (iv) den fho-alt seo, cinnfidh an bainisteoir an cead iomchuí a dheonú.”;
(e) tríd an bhfomhír seo a leanas a chur in ionad fhomhír (ii) d'alt 26 (4) (b):
“(ii) i gcás a ndéanfar fógra dá dtagraítear i bhfo-alt (3) den alt seo a fhoilsiú i ndáil leis an iarratas, laistigh den tréimhse dhá mhí dar tosach an lá a céadfhoilsíodh an fógra,”;
(f) tríd an bhfo-alt seo a leanas a chur isteach i ndiaidh fho-alt (4) d'alt 26:
“(4A) Má tharlaíonn, agus amháin má tharlaíonn, roimh éag don tréimhse iomchuí de réir brí fho-alt 4 (a) den alt seo, go dtabharfaidh iarratasóir ar chead faoin alt seo don údarás pleanála a thoiliú i scríbhinn le hiad do shíneadh na tréimhse sin, féadfaidh an t-údarás pleanála an tréimhse a shíneadh agus i gcás, de bhun an mhéid sin roimhe seo, a ndéanfaidh údarás pleanála síneadh, ansin, maidir leis an gcás áirithe lena mbainfidh an síneadh, forléireofar fo-alt 4 (b) den alt seo agus beidh éifeacht leis de réir an tsínte.”;
(g) tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (8) d'alt 26:
“(8) Aon chinneadh a thabharfar faoin alt seo agus an fógra ag insint an chinnte sin—
(a) i gcás an cinneadh a dhéanamh ag údarás pleanála agus ar cinneadh é trína ndiúltófar aon chead nó ceadú a thabhairt nó trína dtabharfar aon chead nó ceadú faoi réir coinníollacha, beidh ráiteas ann ag sonrú na gcúiseanna a bheidh leis an diúltú nó leis na coinníollacha a fhorchur, agus
(b) i gcás ar cinneadh é ar achomharc, beidh sonraí ann ag sonrú na gcúiseanna a bheidh leis an gcinneadh,
ar choinníoll, i gcás ar coinníoll a thuairiscítear i mír (a) nó in aon mhír ina dhiaidh sin d'fho-alt (2) den alt seo coinníoll a fhorchuirfear, gur leor mar chomhlíonadh ar cheanglais an fho-ailt seo tagairt don mhír den fho-alt sin (2) ina dtuairiscítear an coinníoll.”;
(h) trí “a bhféadfar nó nach bhféadfar an déanmhas a úsáid chucu, agus i gcás a sonróidh an tabhairt sin úsáid mar theaghais mar chríoch chun a bhféadfar an déanmhas a úsáid, féadfar an cead a thabhairt freisin faoi réir coinníll gurb í an úsáid amháin a dhéanfar de mar theaghais a úsáid ag daoine d'aicme nó de thuairisc áirithe agus go gcuirfear foráil sa chéill sin i gcomhaontú de bhun alt 38 den Acht seo” a chur in alt 28 (6) in ionad “chun a bhféadfar an déanmhas a úsáid”;
(i) trí na fo-ailt seo a leanas a chur isteach i ndiaidh fho-alt (2) d'alt 30:
“(2A) Ní chúlghairfidh ná ní mhodhnóidh údarás pleanála cead faoin alt seo mura mbeidh athrú ar imthosca a bhaineann le cuí-phleanáil agus le cuífhorbairt an limistéir lena mbainfidh agus gur tháinig an t-athrú sin ar imthosca,
(a) i gcás a ndearnadh fógra i ndáil leis an gcead a sheirbheáil faoin alt seo agus gur neamhníodh é, ó neamhníodh an fógra,
(b) i gcás nár seirbheáladh aon fhógra amhlaidh, ó tugadh an cead.
(2B) I gcás a ndéanfaidh údarás pleanála cead a chúlghairm nó a mhodhnú de bhun an ailt seo, sonróidh siad ina gcinneadh an t-athrú ar imthosca a thug gur cheart an chúlghairm nó an modhnú.”;
(j) tríd an bhfo-alt seo a leanas a chur isteach i ndiaidh fho-alt (1) d'alt 38:
“(1A) Féadfaidh údarás pleanála agus iad ag déanamh comhaontaithe faoin alt seo uamadh le haon chomhlacht is údarás forordaithe chun críocha alt 21 den Acht seo.”;
(k) trí “nó aon chomhlacht a bheidh uamtha leo” a chur isteach i ndiaidh “an t-údarás pleanála” agus “nó ag an gcomhlacht sin, de réir mar is iomchuí,” a chur isteach i ndiaidh “ag an údarás pleanála” in alt 38 (2); agus

Leasú ar Chuid V den Phríomh-Acht.
40.—Leasaítear leis seo Chuid V den Phríomh-Acht—
(a) trí na fo-ailt seo a leanas a chur in ionad fho-alt (1) d'alt 42:
“(1) Nuair a fheictear don údarás pleanála gur ceart a dhearbhú faoin alt seo i ndáil le limistéar, mar gheall ar—
(a) a shár-áilleacht nádúrtha,
(b) a luachmhaireacht speisialta chun caithimh aimsire, nó
(c) riachtanas a bheith le dúlra a chaomhnú,
gur limistéar taitneamhachta speisialta é, féadfaidh siad sin a dhéanamh le hordú agus féadfar cuspóir an údaráis phleanála i ndáil le gné nó airíona speisialta an limistéir a chaomhnú nó i ndáil le méadú ar a dtaitneamhacht, lena n-áirítear cuspóirí le forbairt sa limistéar a chosc nó a theorannú, a insint san ordú.
(1A) Féadfaidh an tAire, más dóigh leis gur gá é, a threorú d'údarás pleanála ordú a dhéanamh faoin alt seo i ndáil le limistéar a shonrófar sa treoir agus féadfaidh sé, más oiriúnach leis, a cheangal go gcuirfidh an t-údarás pleanála cuspóirí a bheidh sonraithe sa treoir ina n-ordú i leith ábhair agus i slí a bheidh sonraithe amhlaidh agus i gcás a dtabharfaidh an tAire treoir faoin bhfo-alt seo comhlíonfaidh an t-údarás pleanála iomchuí an treoir agus ní dhéanfar ordú a rinneadh de bhun treoir faoin bhfo-alt seo a chúlghairm ná a athrú ach amháin le toiliú an Aire.”;
(b) tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (1) d'alt 46:

(c) trí “caoga punt a chur air; agus má leantar, i gcás ciona leanúnaigh, den alt seo a shárú tar éis ciontaithe, beidh sé ciontach i gcion breise agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná deich bpunt a chur air in aghaidh gach lae a leanfar den sárú” a chur i bhfo-alt (4) d'alt 51 in ionad “deich bpunt a chur air”

42.—Leasaítear leis seo Cuid VIII den Phríomh-Acht—
(a) trí na fo-ailt seo a leanas a chur in ionad fho-ailt (1), (2) agus (3) d'alt 82:
“(1) Féadfaidh foráil a bheith i rialacháin faoi aon ábhair a bhaineann le nós imeachta i ndáil le hachomhairc chun an Aire faoi alt 88 den Acht seo nó i ndáil le haon éisteacht faoi alt 76.
(2) Déanfar rialacháin faoin alt seo ina mbeidh foráil—
(a) chun go n-éistfear ó bheal aon achomharc den sórt sin chun an Aire a n-iarrfaidh an t-achomharcóir go n-éistfí ó bhéal é,
(b) chun aon éisteacht ó bhéal den sórt sin nó aon éisteacht faoi alt 76 a sheoladh ag duine a cheapfaidh an tAire chun na críche sin.
(3) I gcás a n-éireoidh ceist dlí ar aon tarchur, achomharc nó éisteacht faoi alt 76, ansin, le go dtabharfaidh an Ard-Chúirt breith uirthi,
(a) féadfaidh an Bord, i gcás tarchuir nó achomhairc, seachas achomharc chun an Aire faoi alt 88 den Acht seo, í a tharchur chun na cúirte sin,
(b) féadfaidh an tAire, i gcás achomhairc chun an Aire faoi alt 88 den Acht seo nó i gcás éisteachta faoi alt 76, í a tharchur chun na cúirte sin.
(3A) Ní dhéanfaidh duine, trí thoirmeasc, certiorari ná in aon imeachtaí dlí eile ar aon chor—
(a) bailíocht chinneadh údaráis phleanála ar iarratas ar chead nó ar cheadú faoi Chuid IV den Phríomh-Acht,
(b) bailíocht chinneadh an Bhoird ar aon achomharc nó ar aon tarchur,
(c) bailíocht chinneadh an Aire ar aon achomharc,
a cheistiú mura dtionscnófar na himeachtaí laistigh den tréimhse dhá mhí dar tosach dáta an chinnte a thabhairt.”;
(b) trí na fo-ailt seo a leanas a chur in alt 82 in ionad fho-alt (8):
“(8) Beidh feidhm ag fo-ailt (4) go (7) den alt seo, modhnaithe mar is gá, i ndáil le duine ag seoladh éisteachta faoi alt 76.
(9) I bhfo-ailt (3) go (7) den alt seo—

(2) I gcás a ndéanfar achomharc faoin alt seo in aghaidh cinneadh ó údarás pleanála agus nach dtarraingeofar siar é, cinnfidh an tAire an t-iarratas ionann is dá mba chuige, faoi alt 87 den Acht seo, arna leasú le halt 42 den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1976, a rinneadh é sa chéad ásc, agus oibreoidh a chinneadh le cinneadh an údaráis phleanála a neamhniú amhail ón tráth a tugadh é; ar choinníoll nach bhforléireofar an fo-alt seo mar fho-alt a cheanglaíonn ar an Aire dul i gcomhairle le húdarás pleanála i ndáil le hachomharc a dhéanfar faoin alt seo.”. |

43.—(1) Leasaítear leis seo an Phríomh-Acht—
(a) tríd an mír seo a leanas a chur le fo-alt (6) d'alt 2:
“(c) Féadfaidh comhairle contae a rinne dearbhú faoin bhfo-alt seo an dearbhú sin a leasú agus is feidhm fhorcoimeádta aon leasú den sórt sin a dhéanamh.”;
(b) trí “agus nach oibreacha a áirítear ar fhálú nó iamh talún a bhí ar oscailt don phobal nó á úsáid ag an bpobal laistigh de na deich mbliana roimh an dáta ar tosaíodh ar na hoibreacha” a chur isteach i ndiaidh “san Acht um Míntíriú Talún, 1949” i mír (i) d'alt 4 (1);
(c) tríd an bhfo-alt nua seo a leanas a chur isteach i ndiaidh fho-alt (1) d'alt 4:
“(1A) I gcás a luafaidh údarás pleanála, ina bplean forbartha, chun na críche a luaitear i mír 5A de Chuid IV den Tríú Sceideal a gabhann leis an Acht seo (a cuireadh isteach ann le halt 43 den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1976), cuspóirí chun daingneáin shonraithe nó airíona sonraithe a chaomhnú is cuid den taobh istigh de dhéanmhas a shonraítear sa phlean forbartha agus a ndeirtear sa phlean sin gur díol spéise iad ó thaobh ealaíne, staire nó ailtireachta, ansin, d'ainneoin fho-alt (1) den alt seo, ní forbairt dhíolmhaithe chun críocha an Achta seo oibreacha ar cuid díobh daingneán nó airí den sórt sin a athrú nó a asláithriú nó a d'fhéadfadh díobháil a dhéanamh don chéanna.”;
(d) tríd an mír nua seo a leanas a chur isteach i ndiaidh mhír (c) d'alt 14 (2):
“(cc) comhlacht nó duine a sholáthraíonn tearmainn nó scáthláin do mhadraí agus do chait atá ar fán nó gan éileamh orthu,”;
(e) trí “, nó déanfaidh siad plean forbartha nua” a chur le halt 20 (1);

(i) trí “má dhéantar agóid in aghaidh an ordaithe agus nach dtarraingeofar siar an agóid, cuirfidh an tAire faoi deara éisteacht ó bhéal a sheoladh agus tabharfaidh sé don duine a rinne an agóid deis ar éisteacht a fháil” a chur i bhfo-alt (1) d'alt 76 in ionad na bhfocal go léir ó “ní cheadóidh an tAire” go dtí deireadh an fho-ailt;
(j) tríd an bhfo-alt seo a leanas a chur le halt 76:

AN SCEIDEAL
An Bord Pleanála
1. Beidh an Bord ina chomhlacht corpraithe le comharbas suthain agus beidh cumhacht aige agairt a dhéanamh agus bheith inagartha faoina ainm corpraithe agus talamh a fháil, a shealbhú agus a dhiúscairt.
2. Cathaoirleach agus líon gnáth-chomhaltaí nach lú ná ceathrar ná nach mó ná deichniúr a bheidh ar an mBord.
3. Duine atá de thuras na huaire i dteideal faoi Bhuan-Orduithe cheachtar Tí den Oireachtas suí sa Teach sin nó is comhalta d'údarás áitiúil de thuras na huaire beidh sé dícháilithe chun bheith ina chomhalta den Bhord.
4. 26. Fíordheimhneofar séala an Bhoird le síniú chathaoirleach an Bhoird nó le síniú comhalta éigin eile den Bhord a bheidh údaraithe ag an mBord gníomhú chuige sin.
27. Tabharfar aird bhreithiúnach ar shéala an Bhoird agus gach doiciméad a airbheartóidh gur ionstraim é a rinne an Bord agus a bheith séalaithe le séala (a airbheartóidh a bheith fíordheimhnithe de réir Airteagal 26 den Sceideal seo) an Bhoird glacfar i bhfianaise é agus measfar gur ionstraim den sórt sin é gan chruthúnas mura suífear a mhalairt.
28. (1) Féadfaidh an tAire, le comhthoiliú Aire na Seirbhíse Poiblí, scéim a dhéanamh chun pinsin, aiscí nó liúntais eile a dheonú do chathaoirleach agus do ghnáth-chomhaltaí lánaimsire an Bhoird, nó ina leith, ar scor dóibh d'oifig a shealbhú, seachas daoine ar féidir dámhachtain a dhéanamh ina leith faoi na hAchtanna Aoisliúntas, 1834 go 1963.
(2) Ní dhéanfaidh scéim faoin Airteagal seo socrú le pinsean, aisce ná liúntas eile a dheonú do chathaoirleach den Bhord in aghaidh tréimhse ar breitheamh den Ard-Chúirt é lena linn.
(3) Féadfaidh scéim faoin Airteagal seo a fhoráil nach gcuirfidh ceapadh an chathaoirligh nó gnáth-chomhalta den Bhord a fhoirceannadh le linn téarma oifige an duine sin cosc le pinsean, aisce nó liúntas eile a dhámhadh dó faoin scéim.
(4) Féadfaidh an tAire, le comhthoiliú Aire na Seirbhíse Poiblí, scéim a rinne sé faoin Airteagal seo a leasú.
(5) Má tharlaíonn aon díospóid i dtaobh éileamh aon duine ar aon phinsean, aisce nó liúntas is iníoctha de bhun scéim faoin Airteagal seo nó i dtaobh méid an chéanna, cuirfear an díospóid sin faoi bhráid an Aire agus tarchuirfidh seisean chun Aire na Seirbhíse Poiblí í, agus is cinneadh críochnaitheach a chinneadhsan.

LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) ACT, 1976
Interpretation.
1.—In this Act—
“the appropriate day” means the day on which section 14 of this Act comes into operation;
“the Board” has the meaning assigned to it by section 3 of this Act;
“company” except in section 34 (4), means a company within the meaning of section 2 of the Companies Act, 1963, or a company incorporated outside the State;
“the establishment day” means the day appointed to be the establishment day for the purposes of this Act by order of the Minister under section 2 of this Act;
“judicial office” means an office, being the office of Chief Justice, President of the High Court, ordinary judge of the Supreme Court or ordinary judge of the High Court;
“manager” means a manager within the meaning of section 1 of the City and County Management (Amendment) Act, 1955;
“the Principal Act” means the Local Government (Planning and Development) Act, 1963;
“shares” includes stock and “share capital” shall be construed accordingly.
Establishment day.
2.—The Minister may by order appoint a day to be the establishment day for the purposes of this Act.
Establishment of Bord Pleanála.
3.—(1) On the establishment day there shall be established a body to be known as An Bord Pleanála (in this Act referred to as the Board) to perform the functions assigned to it by this Act.
(2) The provisions of the Schedule to this Act shall have effect with respect to the Board.
Chairman of Board.
4.—(1) The chairman of the Board shall be either—
(a) such ordinary judge of the High Court as is for the time being nominated with his consent by the Government after consultation with the President of the High Court, or
(b) a person who is appointed by the Government and formerly held, but who no longer holds, judicial office.
(2) If immediately before the exercise by the Government of a power under subsection (1) of this section there is in force a nomination under that subsection, then on the exercise the nomination shall cease to have effect.
(3) A judge of the High Court who is chairman of the Board shall on ceasing to be an ordinary judge of the High Court also cease to be chairman of the Board.
(4) A person who ceases to be chairman of the Board by virtue of subsection (3) of this section may be appointed under subsection (1) of this section.
(5) Where a person is nominated under subsection (1) of this section, the following provisions shall apply for the duration of the relevant period, namely,
(a) the fact that the person is an ordinary judge of the High Court shall be disregarded in applying section 1 (1) of the Courts Act, 1973, and
(b) the said section 1 (1) shall have effect accordingly.
(6) In this section “the relevant period” means, as regards a person nominated under subsection (1) of this section, the period beginning on the day on which the person is so nominated and ending on either—
(a) the day on which the person ceases to be an ordinary judge of the High Court, or
(b) the day on which the next subsequent such nomination is made,
whichever first occurs.
Board to keep itself informed on certain policies and objectives.
5.—(1) The Board shall, so far as may in the opinion of the Board be necessary for the performance of its functions, keep itself informed of the policies and objectives for the time being of the Minister, planning authorities and any other body which is a public authority whose functions have, or may have, a bearing on the proper planning and development (including the preservation and development of amenities) of cities, towns or other areas, whether urban or rural.
(2) In this section “public authority” means any Minister of State not being the Minister, the Commissioners of Public Works in Ireland, the Irish Land Commission, a harbour authority within the meaning of section 2 of the Harbours Act, 1946, and any other body established by or under statute which is for the time being declared, by regulation made by the Minister, to be a public authority for the purposes of this section.
General policy directives as to development.
6.—(1) The Minister shall, from time to time, give to the Board such general directives as to policy in relation to planning and development as he considers necessary.
(2) The Board shall in performing its functions have regard to any directive under this section.
(3) Nothing in this section shall be construed as enabling the Minister to exercise any power or control in relation to any particular case with which the Board is or may be concerned.
(4) Where the Minister gives a directive under this section, the following provisions shall apply, namely—
(a) as soon as may be the Minister shall cause a copy of the directive to be laid before each House of the Oireachtas,
(b) the directive shall be published in the Iris Oifigiúil, and
(c) the Minister shall cause a copy of the directive to be sent to each planning authority.
Grants to Board.
7.—There may, subject to such conditions, if any, as the Minister thinks proper, be paid to the Board in each financial year out of moneys provided by the Oireachtas a grant or grants of such amount or amounts as the Minister, with the consent of the Minister for Finance and after consultation with the Board in relation to its programme of expenditure for that year, may fix.
Accounts and audits.
8.—(1) The Board shall keep in such form as may be approved by the Minister, after consultation with the Minister for Finance, all proper and usual accounts of all moneys received or expended by it.
(2) Accounts kept in pursuance of this section shall be submitted by the Board to the Comptroller and Auditor General for audit at such times as the Minister shall direct and, when audited by him, shall, together with the report of the Comptroller and Auditor General thereon, be presented to the Minister who shall cause copies to be laid before each House of the Oireachtas.
Annual report and information to Minister.
9.—(1) The Board shall, not later than the 30th day of September in each year, make a report to the Minister of its proceedings during the preceding year and the Minister shall cause copies of the report to be laid before each House of the Oireachtas.
(2) The Board shall supply the Minister with such information relating to the performance of its functions as he shall from time to time request.
Employees of Board.
10.—(1) The Board shall appoint such and so many persons to be employees of the Board as the Board, subject to the approval of the Minister as to the number and kind of such employees, from time to time thinks proper.
(2) The Board may employ a person in a part-time capacity to be remunerated by the payment of fees of such amounts as the Board may, with the approval of the Minister given with the consent of the Minister for the Public Service, from time to time determine.
(3) An employee of the Board shall hold his employment on such terms and conditions as the Board, subject to the approval of the Minister, from time to time determines.
(4) There shall be paid by the Board to its employees out of moneys at its disposal such remuneration and allowances as the Board, subject to the approval of the Minister, with the consent of the Minister for the Public Service, from time to time determines.
Superannuation of employees of Board.
11.—(1) As soon as conveniently may be after the establishment day, the Board shall prepare and submit to the Minister for his approval, a scheme or schemes for the granting of pensions, gratuities and other allowances on retirement or death to or in respect of such wholetime employees of the Board as it may think fit.
(2) The Board may at any time, prepare and submit to the Minister, a scheme amending a scheme under this section.
(3) Where a scheme is submitted to the Minister pursuant to this section, the Minister may, with the concurrence of the Minister for the Public Service, approve the scheme without modification or with such modification (whether by way of addition, omission or variation) as the Minister shall, with such concurrence, think proper.
(4) A scheme submitted to the Minister under this section shall, if approved of by the Minister with the concurrence of the Minister for the Public Service, be carried out by the Board in accordance with its terms.
(5) A scheme submitted and approved of under this section shall fix the time and conditions of retirement for all persons to or in respect of whom pensions, gratuities or other allowances are payable under the scheme, and different times and conditions may be fixed in respect of different classes of persons.
(6) If any dispute arises as to the claim of any person to, or the amount of, any pension, gratuity or other allowance payable in pursuance of a scheme under this section, such dispute shall be submitted to the Minister who shall refer it to the Minister for the Public Service, whose decision shall be final.
(7) Every scheme submitted and approved of under this section shall be laid before each House of the Oireachtas as soon as may be after it is approved of and if either House within the next twenty-one days on which that House has sat after the scheme is laid before it, passes a resolution annulling the scheme, the scheme shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Membership of either House of Oireachtas or of local authority of employees of Board.
12.—(1) Where a person who is an employee of the Board is nominated as a member of Seanad Éireann or for election to either House of the Oireachtas or becomes a member of a local authority, he shall stand seconded from employment by the Board and shall not be paid by, or be entitled to receive from, the Board any remuneration or allowances—
(a) in case he is nominated as a member of Seanad Éireann, in respect of the period commencing on his acceptance of the nomination and ending when he ceases to be a member of that House,
(b) in case he is nominated for election to either such House, in respect of the period commencing on his nomination and ending when he ceases to be a member of that House or fails to be elected or withdraws his candidature, as may be appropriate,
(c) in case he becomes a member of a local authority, in respect of the period commencing on his becoming a member of the local authority and ending when he ceases to be a member of that authority.
(2) A person who is for the time being entitled under the Standing Orders of either House of the Oireachtas to sit therein shall, while so entitled, be disqualified from becoming an employee of the Board.
(3) A person who is for the time being a member of a local authority shall, while holding office as such member, be disqualified from becoming an employee of the Board.
Consultants and advisers.
13.—(1) The Board may from time to time engage such consultants or advisers as it may consider necessary for the discharge of its functions and any fees due to a consultant or adviser engaged pursuant to this section shall be paid by the Board out of moneys at its disposal.
(2) Any person may notify the Board in writing of his willingness to be engaged by the Board as a consultant or adviser pursuant to this section and such person when so notifying the Board shall give to the Board particulars of his qualifications and experience.
(3) The Board shall maintain a list of the persons who duly give to the Board a notification pursuant to subsection (2) of this section.
(4) The Board shall, in engaging a consultant or adviser under this section, have regard to the list maintained under subsection (3) of this section, but the foregoing provisions of this subsection shall not be construed as precluding the Board from engaging as a consultant or adviser a person whose name is not on the said list.
(5) The Board shall include in each report made under section 9 of this Act a statement of the names of the persons (if any) engaged pursuant to this section during the year to which the report relates.
Certain appeals and other matters to be brought or referred to Board.
14.—(1) An appeal under a relevant section of the Principal Act shall, in lieu of being brought to the Minister, be brought to the Board and if it is not withdrawn, be decided by the Board, and—
(a) in case the appeal relates to an application, notice or order, the application, notice or order shall be determined or confirmed or annulled (as the case may be) accordingly, and
(b) in case the appeal relates to a licence under section 89 of the Principal Act, such directions shall be given with respect to the withdrawing or granting or altering of the licence as may be appropriate.
(2) Any question as to what, in any particular case, is or is not development or exempted development shall, in lieu of being referred to and decided by the Minister under section 5 (1) of the Principal Act, be referred to and be decided by the Board.
(3) In case a condition referred to in subsection (2) (f) of section 26 of the Principal Act is attached to a permission or approval granted under that section and there is not agreement in relation to the contribution required by subsection (7) of the said section 26 to be made by a local authority, the matter shall, in lieu of being determined by the Minister under the said subsection (7), be referred to the Board which shall determine the amount of the contribution.
(4) In case there is attached to a permission or approval granted under section 26 of the Principal Act a condition which provides that a contribution or other matter is to be agreed between the planning authority and the person to whom the permission or approval is granted and that in default of agreement the contribution or other matter is to be determined by the Minister, the condition shall be construed as providing that in default of agreement the contribution or other matter is to be determined by the Board.
(5) The functions of the Minister under section 29 of the Principal Act are hereby transferred to the Board and without prejudice to the generality of subsection (9) of this section the references in the said section 29 to the Minister shall each be construed as referring to the Board.
(6) Any question or dispute whether a new structure would or does replace substantially within the meaning of section 56 of the Principal Act a demolished or destroyed structure shall, in lieu of being determined by the Minister, be determined by the Board.
(7) For the purposes of the foregoing subsections of this section, the Principal Act (as amended by this Act) shall, with any necessary modifications, apply to the following, namely—
(a) the bringing of an appeal to the Board,
(b) the making of a reference to the Board,
(c) a decision of the Board on an appeal,
(d) the confirmation or annulment (as the case may be) by the Board of the notice or order to which an appeal relates,
(e) the determination of a question or dispute by the Board to which a reference under section 5 (1) of the Principal Act relates,
(f) the determination by the Board of a disagreement, question or dispute to which section 26 (7) or section 56 (3) of the Principal Act relates,
(g) the confirmation of a purchase notice served on a planning authority under section 29 of the Principal Act,
(h) the compliance with directions given by the Board in relation to an appeal relating to a licence under section 89 of the Principal Act, and
(i) the determination by the Board of a contribution or other matter to be determined by the Board by virtue of subsection (4) of this section,
as, immediately before the appropriate day, it applied to whichever of the following is appropriate, namely, the bringing or making of a corresponding appeal or reference to the Minister under the Principal Act, a decision of the Minister on such an appeal, the confirmation or annulment or determination by the Minister of a notice, order, question or dispute relating to such an appeal or reference, the determination by the Minister of a disagreement, question or dispute to which the said section 26 (7) or 56 (3) relates, the confirmation by the Minister of a purchase notice, the compliance with directions given by the Minister in relation to an appeal relating to a licence under the said section 89 or the determination by the Minister of a contribution or other matter pursuant to a condition mentioned in the said subsection (4).
(8) The Board may in determining an appeal under section 26 or 27 of the Principal Act decide to grant a permission or approval even if the proposed development contravenes materially the development plan or any special amenity area order relating to the area of the planning authority to whose decision the appeal relates.
(9) Wherever the Principal Act refers to the Minister in relation to—
(a) an appeal under a relevant section,
(b) a reference under section 5 (1) of the Principal Act,
(c) a determination of a disagreement, question or dispute to which section 26 (7) or section 56 (3) of the Principal Act relates,
(d) a decision on an appeal under a relevant section,
(e) a determination pursuant to section 85 of the Principal Act as to whether a consent was unreasonably withheld,
(f) a determination, confirmation or annulment (as the case may be) of the notice or order, question or dispute to which an appeal under a relevant section or a reference mentioned in paragraph (b) of this subsection relates,
(g) a requirement requiring applicants or planning authorities to furnish to the Minister any specified information, or
(h) any word cognate to appeal, reference, decision, determination, confirmation or annulment,
that Act, other than section 18 thereof, shall be construed as referring to the Board.
(10) In this section “a relevant section” means a section which is section 26, 27, 30, 33, 36, 37, 44, 45, 46, 48, 85 or 89 of the Principal Act.
£10 deposit to be lodged by appellants.
15.—(1) A deposit of £10 shall be lodged with the Board by an appellant with his appeal and any appeal to the Board which is not accompanied by such deposit shall be invalid.
(2) As soon as may be after an appeal to the Board is either withdrawn or determined, subject to section 18 (3) of this Act, the Board shall return the deposit to the appellant.
Oral hearings.
16.—(1) Except where a direction is given by the Minister under this section, the Board shall have an absolute discretion to hold an oral hearing of any reference or appeal to the Board.
(2) Where the Board is requested to hold an oral hearing of a reference or appeal and decides to determine the reference or appeal without an oral hearing, the Board—
(a) shall serve notice of its decision on the person who requested such hearing, and
(b) shall not proceed to determine the reference or appeal until after the expiration of the period mentioned in subsection (3) of this section.
(3) Any person on whom a notice is served under subsection (2) of this section, other than a person on whom there has also been served a notice under section 18 of this Act relating to the relevant reference or appeal, may, at any time before the expiration of fourteen days beginning on the day on which the notice under the said subsection (2) is served, apply in writing to the Minister for a direction under this section as regards the relevant reference or appeal.
(4) In case an application is made under subsection (3) of this section to the Minister, unless the Board decides to hold an oral hearing of the relevant reference or appeal, it shall not determine such reference or appeal pending the decision of the Minister on the application.
(5) The Minister may direct the Board to hold an oral hearing of any reference or appeal to the Board and any such direction shall be complied with by the Board.
Matters other than those raised by parties may be taken into account in determining references or appeals.
17.—The Board in deciding a reference or appeal may take into account matters other than those raised by the parties to the reference or appeal if the matters either relate to the proper planning and development of the area of the relevant planning authority or are matters to which by virtue of section 24 (2) of this Act the Board may have regard, provided that the matters are brought to the notice of those parties and they are accorded an opportunity of making observations thereon to the Board or, in the case of an oral hearing, the person conducting the hearing.
Power of Board as regards vexatious references or appeals, etc.
18.—(1) Where the Board is of opinion that a reference or appeal is vexatious or is being unnecessarily delayed by any party, the Board may serve a notice on the party stating that it will, at a time after the day specified in the notice (being a day which is not less than seven days after the service of the notice) without further notice to the party, determine the reference or appeal to which the notice relates, and that the reference or appeal may be so determined by the Board notwithstanding the fact that no submission has been made to the Board by the party in relation to the reference or appeal.
(2) Where a notice has been served under this section the Board may, at any time after the day specified in the notice, without further notice to the party on whom the notice was served, determine the reference or appeal, and the reference or appeal may be so determined by the Board notwithstanding the fact that no submission has been made to the Board by such party in relation to the reference or appeal.
(3) In case the Board in determining an appeal is of opinion that the appeal is vexatious, the Board may direct that the deposit lodged in relation to the appeal shall be forfeited to the Board.
Expenses of appeal.
19.—(1) Subject to subsection (2) of this section, where there is an appeal to the Board against a decision of a planning authority—
(a) the Board, if it so thinks proper and irrespective of the result of the appeal, may direct the planning authority to pay—
(i) to the appellant, such sum as the Board, in its absolute discretion, specifies as compensation to the appellant for the expense occasioned to him in relation to the appeal,
(ii) to the Board, such sum as the Board, in its absolute discretion, specifies as compensation to the Board towards the expense incurred by the Board in relation to the hearing of the appeal;
(b) in case the decision of the planning authority is confirmed on appeal, or where the decision is varied on appeal, if the Board in determining the appeal does not accede in substance to the appellant's grounds of appeal, the Board, if it so thinks proper, may direct the appellant to pay—
(i) to the planning authority, such sum as the Board, in its absolute discretion, specifies as compensation to the planning authority for the expense occasioned to them in relation to the appeal,
(ii) to any of the other parties to the appeal, such sum as the Board, in its absolute discretion, specifies as compensation to the party for the expense occasioned to him in relation to the appeal,
(iii) to the Board, such sum as the Board, in its absolute discretion, specifies as compensation to the Board towards the expense incurred by the Board in relation to the hearing of the appeal.
(2) A direction to pay any sum exceeding £50 shall be given by the Board under subsection (1) of this section only after consultation with the Minister.
(3) Any sum directed under this section to be paid shall, in default of being paid, be recoverable as a simple contract debt in any court of competent jurisdiction.
Supplemental provisions relating to references and appeals.
20.—(1) The Minister may make regulations providing for any matter of procedure in relation to references or appeals to the Board.
(2) Regulations shall be made under this section providing for any oral hearing by the Board of a reference or appeal being conducted by a person appointed for that purpose by the Board.
(3) The Minister may make regulations enabling the Board when considering an appeal under section 26 or 27 of the Principal Act to invite an applicant and to enable an applicant so invited to submit to the Board revised plans or other drawings modifying, or other particulars providing for the modification of, the development to which the appeal relates.
(4) In case plans, drawings or particulars mentioned in subsection (3) of this section are submitted to the Board by virtue of regulations made under that subsection, the Board may in deciding the appeal grant a permission or an approval for the relevant development as modified by all or any of such plans, drawings or particulars.
Transitional.
21.—(1) In case immediately before the appropriate day an appeal, contribution, question or dispute referred to in section 14 of this Act or an appeal pursuant to section 25 of this Act was being considered by the Minister, the said section 14 and sections 16, 17, 18, 19 and 20 of this Act shall apply in relation to the appeal, contribution, question or dispute which, in lieu of being further considered by the Minister under the Principal Act, shall, unless it is withdrawn, be decided or determined by the Board as if it had been originally brought or referred to the Board under this Act.
(2) In case before the appropriate day a purchase notice within the meaning of section 29 of the Principal Act has been served on a planning authority and the authority have not served before that day a notice in relation thereto under subsection (2) of that section stating that they are willing to comply with the purchase notice, the following provisions shall have effect:
(a) in case the planning authority propose to serve on the relevant owner a notice in accordance with paragraph (b) of the said subsection (2) and the authority have not before the said day transmitted to the Minister copies of the notices referred to in subsection (4) of the said section 29, for the avoidance of doubt it is hereby declared that section 14 (5) of this Act shall apply in relation to the notice.
(b) in case the planning authority have before the appropriate day transmitted to the Minister the copies of the notices referred to in the said subsection (4) but the Minister before the appropriate day has neither confirmed the purchase notice nor taken any such other action as is mentioned in paragraph (i) or paragraph (ii) of the proviso to the said subsection (4), nor notified the owner by whom the notice was served that he does not propose to confirm the notice, the notice in lieu of being further considered by the Minister shall be considered by the Board as if the copy of it had been transmitted to the Board on the appropriate day, and the said subsection (4) and subsection (5) of the said section 29, as amended by this Act, shall with the necessary modifications apply in relation to the notice, and
(c) in either case, notwithstanding section 14 (9) of this Act, the said subsection (2) shall have effect in relation to the notice required to be served by that subsection as if “the Minister or the Board, as may be appropriate” were therein substituted for “the Minister”.
(3) For the purpose of enabling the Board to perform its functions on and from the appropriate day, the Board may, as an interim measure, make arrangements for the supply to the Board by the Minister of any services required by the Board pending the making by the Board of sufficient appointments pursuant to section 10 of this Act and the Minister may supply and the Board may avail of services for which arrangements are made under this subsection.
Time for appeals generally.
22.—(1) Where a provision of this Act authorising an appeal (other than an appeal to a court) enables the appeal only to be made within a specified period, the appeal, if sent by post, shall be received not later than the third day after that period and any appeal so sent which is not so received shall be invalid as not being made in time.
(2) Where a provision of the Principal Act authorising an appeal (other than an appeal to a court) enables the appeal only to be made within, or before the expiration of, a specified period or before a specified day, that provision shall be construed as including—
(a) a requirement that the appeal is, if sent by post, to be received not later than the third day after that period or day, and
(b) a provision that any appeal so sent which is not so received shall be invalid as not being made in time.
Reports of inspections, etc.
23.—Where in connection with either the performance by the Minister of any of the functions assigned to him under the Local Government (Planning and Development) Acts, 1963 and 1976, or the performance by the Board of its functions an inspection is carried out or an oral hearing is conducted on behalf of the Minister or the Board, as the case may be, by a person appointed for the purpose by the Minister or the Board, the person so appointed shall make to the Minister or the Board, as may be appropriate, a written report on the inspection or hearing, as the case may be, and shall include in his report a recommendation relating to the matter with which the inspection or hearing was concerned, and the Minister or the Board, as may be appropriate, shall, before determining the matter in relation to which the inspection was carried out or the hearing was conducted, consider the report (including any recommendation contained therein).
Additional matters to which planning authority or Board may have regard in considering certain applications, etc. and certain appeals.
24.—(1) Notwithstanding anything contained in the Principal Act, a planning authority in considering,
(a) an application for a permission under section 26 or 27 of that Act,
(b) whether or not it is expedient to serve a notice under section 30, 31, 32, 33 or 35 of that Act,
(c) whether or not to serve a notice under section 36 or 37 of that Act,
shall, where they consider it appropriate, have regard to either or both of the following, namely,
(i) the probable effect which a particular decision by them on the matter would have on any place which is not within, or on any area which is outside, their area, and
(ii) any other consideration relating to development outside their area.
(2) Notwithstanding anything contained in the Principal Act, the Board in considering an appeal brought under section 26, 27, 30, 33, 36 or 37 of that Act shall, where it considers it appropriate, have regard to either or both of the following namely,
(a) the probable effect which a particular decision by it on the matter would have on any place which is not within, or on any area which is outside, the area of the relevant planning authority, and
(b) any other consideration relating to development outside the area of that authority.
Enforcement of planning control (open spaces).
25.—(1) Where—
(a) development is being or has been carried out pursuant to a permission under section 26 of the Principal Act, and
(b) (i) a condition requiring the provision or maintenance of land as open space, being open space to which this section applies, was attached to the permission, or
(ii) it was either explicit or implicit in the application for the said permission that land would be provided or maintained as such open space, and
(c) the planning authority have served on the owner of the land a written request that, within a period specified in the request (being a period of not less than two months commencing on the date of the request), he will provide, level, plant or otherwise adapt or maintain such land in a manner so specified, being a manner which in their opinion would make it suitable for the purpose for which the open space was to be provided, and
(d) the owner fails to comply or to secure compliance with such request within the period so specified,
the planning authority may, if they think fit, publish in a newspaper circulating in the district a notice (subsequently in this section referred to as an acquisition notice) of their intention to acquire the land by order under this section and the acquisition notice shall specify a period (being a period of not less than two months commencing on the date on which the notice is published) within which an appeal may be made under this section.
(2) Where a planning authority publish an acquisition notice, they shall serve a copy of the notice on the owner of the land to which the notice relates not later than ten days after the date of the publication.
(3) Any person for the time being having an interest in the land to which an acquisition notice relates may within the period specified in the notice appeal—
(a) in case the appeal is made before the appropriate day, to the Minister,
(b) in case the appeal is made on or after the appropriate day, to the Board.
(4) Where an appeal is brought under this section, the Minister or the Board, as may be appropriate, may—
(a) annul the acquisition notice to which the appeal relates, or
(b) confirm the acquisition notice, with or without modification, in respect of all or such part of the relevant land as the Minister or the Board considers reasonable.
(5) In case a planning authority publish an acquisition notice and either—
(a) the period for appealing against the notice has expired and no appeal has been taken, or
(b) an appeal has been taken against the notice and the appeal has been withdrawn or the notice has been confirmed whether unconditionally or subject to modifications, the planning authority may make an order in the prescribed form which order shall be expressed and shall operate to vest the land to which the acquisition notice, or, where appropriate, the acquisition notice as confirmed, relates in the planning authority on a specified date for all the estate, term or interest for which immediately before the date of the order the said land was held by the owner together with all rights and liabilities which, immediately before the said date, were enjoyed or incurred in connection therewith by the owner together with an obligation to comply with the request made under paragraph (c) of subsection (1) of this section.
(6) Where a planning authority have acquired by an order under this section land which is subject, either alone or in conjunction with other land, to a purchase annuity, payment in lieu of rent, or other annual sum (not being merely a rent under a contract of tenancy) payable to the Irish Land Commission or to the Commissioners of Public Works in Ireland, the authority shall become and be liable, as from the date on which the land is vested in them by the vesting order, for the payment to the Irish Land Commission or to the Commissioners of Public Works in Ireland, as the case may be, of the annual sum or such portion thereof as shall be apportioned by the Irish Land Commission or by the Commissioners of Public Works in Ireland, as the case may be, on the land as if the land had been transferred to the authority by the owner thereof on that date.
(7) When a planning authority make an order under this section in relation to any land, they shall send the order to the registering authority under the Registration of Title Act, 1964, and thereupon the registering authority shall cause the planning authority to be registered as owner of the land in accordance with the order.
(8) Where a claim is made for compensation in respect of land to which an order under this section relates and the matter falls to be determined by arbitration in pursuance of section 68 of the Principal Act, the following provisions shall apply:
(a) unless it is shown by or on behalf of the owner that an amount equal to the value of the land to which the relevant permission under section 26 of the Principal Act relates, being that value at the time when the application for the permission was made, as a result of the development has not been recovered and as a further such result will not in the future be recoverable by disposing of the land which is land to which the permission relates and which is not land to which the order relates, the arbitrator shall make a nil award, and
(b) in the assessment of the value of the land to which the order relates, no regard shall be had to its value for use other than as open space and a deduction shall be made in respect of the cost of carrying out such works as may be necessary to comply with the request made pursuant to paragraph (c) of subsection (1) of this section.
(9) A planning authority shall enter in the register—
(a) particulars of any acquisition notice published by them,
(b) the date and effect of any decision on appeal in relation to such notice,
(c) particulars of any order made under this section,
and every such entry shall be made within the period of seven days commencing on the day of publication, receipt of notification of the decision or the making of the order, as may be appropriate.
(10) This section applies to any form of open space (whether referred to as open space or by any other description in the relevant application for a permission or in a condition attached to the relevant permission) being land which is not described in the said application or condition either as private open space or in terms indicating that it is not intended that members of the public are to have resort thereto without restriction.
Warning notice.
26.—(1) Where it appears to a planning authority that—
(a) land is being or is likely to be developed in contravention of section 24 of the Principal Act, or
(b) any unauthorised use is being made of land, or
(c) any tree or other feature (whether structural or natural) or any other thing the preservation of which is required by a condition subject to which a permission for the development of any land was granted, may be removed or damaged,
the planning authority may serve on the owner of the land a notice (in this section subsequently referred to as a warning notice) and may give a copy of the said notice to any other person who in their opinion may be concerned with the matters to which the notice relates.
(2) A warning notice shall refer to the land concerned and—
(a) in relation to any land being developed or likely to be developed, require that development thereof in contravention of section 24 of the Principal Act shall not be commenced or, if such development has been commenced, that it shall be discontinued forthwith,
(b) in relation to any unauthorised use of land, require that the unauthorised use shall be discontinued forthwith,
(c) in relation to a condition requiring the preservation of any tree, other feature or thing, require that the tree, other feature or thing, as may be appropriate, shall neither be removed nor damaged and that any reasonable steps necessary for its preservation shall be taken by the owner of the land,
and such notice shall also require the owner of the land to take adequate steps to ensure compliance with the notice and shall contain a warning that proceedings under this section may be brought by the relevant planning authority against him and any other person who fails to comply with the requirements of the notice or who assists or permits any development or use of land or the doing of any other thing in contravention thereof.
(3) In case a warning notice has been served in relation to the breach of a condition mentioned in paragraph (c) of subsection (2) of this section, anything done in relation to the tree, other feature or thing to which the notice relates shall if it is done with the consent in writing of the planning authority by whom the notice was served not be an offence under this section.
(4) Any person who—
(a) knowingly fails to comply with the requirements of a warning notice, or
(b) knowingly assists or permits,
(i) the carrying out by another of any development required by a warning notice not to be commenced or to be discontinued, or
(ii) the continuance by another of a use required by a warning notice to be discontinued, or
(iii) the doing by another of any other thing in contravention of a warning notice, or
(c) otherwise damages or removes any tree, other feature or thing to which a warning notice relates,
shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding two hundred and fifty pounds.
(5) Where a person is convicted of an offence under this section and there is a continuation by him of the offence after conviction, he shall be liable on summary conviction to a fine not exceeding one hundred pounds for each day on which the offence is so continued or to imprisonment for a term not exceeding six months or to both the fine and the imprisonment.
(6) An enforcement notice within the meaning of section 31, 32 or 35 of the Principal Act may be served whether or not there has been a prosecution under this section.
(7) The following provisions shall apply in relation to proceedings under this section in which the offence alleged is the removal of or damage to a tree, other feature or thing to which a warning notice relates, namely—
(a) in case the defendant is the owner of the land to which the warning notice relates,
(i) it shall be sufficient for the prosecution to prove the fact that the tree, other feature or thing, as may be appropriate, was removed or damaged, and
(ii) without prejudice to any other defence which may be open to him, it shall be a good defence if the defendant proves that he took, or caused to be taken, reasonable steps to secure compliance with the requirements of the warning notice and that he acted at all times in good faith in relation to the notice.
(b) in any other case if, but only if, the prosecution proves that—
(i) after the service of the warning notice steps were taken to inform persons of the existence of the notice, or to protect from damage or to preserve the tree, other feature or thing, as the case may be, with which the alleged offence is concerned, and
(ii) the alleged removal or damage by the defendant occurred after the steps referred to in subparagraph (i) of this paragraph were taken,
it shall be assumed, until the contrary is shown by the defendant, that the tree, other feature or thing was knowingly removed or damaged, as may be appropriate, by the defendant.
(8) In a prosecution for an offence under this section it shall not be necessary for the prosecution to show, and it shall be assumed until the contrary is shown by the defendant, that the development (if any) in question was neither exempted development nor development commenced before the appointed day.
(9) For the purposes of this section, a tree shall be regarded as being removed if it is cut down or otherwise wilfully destroyed.
(10) Where a warning notice is served under this section by a planning authority, particulars of the notice shall be entered by the authority in the register.
High Court may prohibit unauthorised development or use of land.
27.—(1) Where—
(a) development of land, being development for which a permission is required under Part IV of the Principal Act, is being carried out without such a permission, or
(b) an unauthorised use is being made of land,
the High Court may, on the application of a planning authority or any other person, whether or not the person has an interest in the land, by order prohibit the continuance of the development or unauthorised use.
(2) Where any development authorised by a permission granted under Part IV of the Principal Act has been commenced but has not been, or is not being, carried out in conformity with the permission because of non-compliance with the requirements of a condition attached to the permission or for any other reason, the High Court may, on the application of a planning authority or any other person, whether or not that person has an interest in the land, by order require any person specified in the order to do or not to do, or to cease to do, as the case may be, anything which the Court considers necessary to ensure that the development is carried out in conformity with the permission and specifies in the order.
(3) An application to the High Court for an order under this section shall be by motion and the Court when considering the matter may make such interim or interlocutory order (if any) as it considers appropriate. The order by which an application under this section is determined may contain such terms and conditions (if any) as to the payment of costs as the Court considers appropriate.
Withdrawal by planning authority of certain notices and cancellation of relevant entries in register.
28.—(1) Where a planning authority serve a notice mentioned in section 30, 31, 32, 35, 36, 37 or 44 of the Principal Act they may by notice in writing withdraw the notice.
(2) Where a notice is withdrawn pursuant to this section by a planning authority, the fact that the notice was withdrawn shall be recorded by the authority in the register.
Limit of duration of planning permission.
29.—(1) Subject to the following subsections of this section, a permission granted under Part IV of the Principal Act, whether granted before or after the passing of this Act, shall on the expiration of the period of five years beginning on the date on which this section comes into operation or on the date of the granting of the permission, whichever is the later, but without prejudice to the validity of anything done pursuant thereto prior to the expiration of that period, cease to have effect as regards—
(a) in case the development to which the permission relates is not commenced during that period, the entire development, and
(b) in case such development is so commenced, so much thereof as is not completed within that period.
(2) Subsection (1) of this section shall not apply as follows:
(a) in the case of a house, shop, office or other building which itself has been completed, in relation to the provision of any structure or works included in the relevant permission under Part IV of the Principal Act and which are either necessary for or ancillary or incidental to the use of the building in accordance with that permission, and
(b) in the case of a development comprising a number of buildings of which only some have been completed, in relation to the provision of roads, services and open spaces included in the relevant such permission and which are necessary for or ancillary to such completed buildings.
(3) Where—
(a) a development has been completed to an extent described in subsection (2) of this section and a condition attached to the relevant permission is not complied with, or
(b) a development has been so completed and there is attached to such permission a condition requiring something not to be done, or
(c) a development has been completed save for compliance with a condition attached to the relevant permission, or
(d) a development has been completed but there is attached to the relevant permission a condition requiring something not to be done,
then, unless a notice (in this section subsequently referred to as a waiver notice) stating that the condition need not be complied with is issued under this section, subsection (1) of this section shall neither be construed as affecting, nor operate to affect, the obligation of any person to comply with the requirements of the condition.
(4) A planning authority may, if they think fit, issue a waiver notice on an application being made in that behalf.
(5) Any person who is aggrieved by the decision of a planning authority on an application for a waiver notice may appeal to the Board within the period of twenty-one days, beginning on the date on which the planning authority notify the applicant of their decision.
(6) Where an appeal is brought under subsection (5) of this section, the Board may—
(a) in case a waiver notice has been issued by a planning authority, confirm or annul the notice, or
(b) in case a waiver notice has not been so issued, confirm the decision of the planning authority or issue a waiver notice.
(7) Where—
(a) a permission has been granted under Part IV of the Principal Act for development and the development to which the permission relates is commenced but is not completed before the permission ceases to have effect, and
(b) the relevant planning authority are satisfied that a dispute has arisen as to whether or not—
(i) a particular part of the development was completed before the permission ceased to have effect, or
(ii) a particular part of the development consists of the provision of any one or more of the following, namely, a structure mentioned in subsection (2) of this section, works, roads, services and open spaces so mentioned,
that authority, if they are satisfied that the part of the development was so completed or so consists, as may be appropriate, may, on payment of the prescribed fee (if any), issue a certificate (subsequently in this subsection referred to as a development certificate) to that effect.
(8) In any legal proceedings a development certificate shall be prima facie evidence of the facts thereby certified, and any document purporting to be a development certificate shall be admitted as evidence without proof of the signature of the person purporting to sign the certificate or that the person was an officer of the relevant planning authority, until the contrary is shown.
(9) A planning authority, if they think fit, may as regards a particular permission by order extend or, from time to time, further extend the period referred to in subsection (1) of this section by such additional period as the authority consider appropriate and in case a planning authority make such an order, the reference in the said subsection (1) to the period of five years shall, as regards the permission to which the order relates, be construed as a reference to that period as so extended or as so extended and further extended, as may be appropriate.
(10) When a planning authority grant an extension or further extension, or issue a development certificate, particulars thereof shall be recorded on the relevant entry in the register.
(11) Any person who is aggrieved by a decision of a planning authority on an application for a development certificate may appeal to the Circuit Court within six months of the date of such decision.
(12) Where an appeal is brought under subsection (11) of this section, the Court, if satisfied that the case comes within paragraph (a) of subsection (7) of this section and that a dispute mentioned in paragraph (b) of the said subsection (7) has arisen, may decide accordingly and, as may be appropriate, determine either or both of the following, the extent to which the relevant development was completed before the relevant permission under Part IV of the Principal Act ceased to have effect, or whether or not the part in dispute of the relevant development consists of the provision of things mentioned in subparagraph (ii) of the said paragraph (b), inform the appropriate planning authority of its decision and direct the authority to issue forthwith, if they have not already done so, an appropriate development certificate or, if a development certificate has been issued which is inappropriate having regard to the decision of the Court, transmit such certificate to the authority and direct that in lieu thereof an appropriate development certificate be issued by the authority forthwith.
(13) Where on an application by a person, the Circuit Court is satisfied that there has been unreasonable delay by a planning authority in dealing with an application for a development certificate and the Court is also satisfied in both of the respects mentioned in subsection (12) of this section, the Court may decide accordingly and make the determination mentioned in the said subsection (12) which is appropriate, inform the authority of its decision and direct the authority to issue forthwith an appropriate development certificate.
Summary proceedings.
30.—(1) Subject to subsection (2) of this section, summary proceedings to which this section applies may be commenced—
(a) at any time within six months from the date on which the offence was committed, or
(b) at any time within three months from the date on which evidence sufficient, in the opinion of the person by whom the proceedings are instituted, to justify proceedings comes to such person's knowledge,
whichever is the later.
(2) Summary proceedings mentioned in subsection (1) of this section shall not be instituted later than five years from the date on which the offence was committed.
(3) For the purposes of this section, a certificate signed by or on behalf of the person instituting the proceedings as to the date on which evidence described in subsection (1) of this section came to the knowledge of such person shall be prima facie evidence thereof and in any legal proceedings a document purporting to be a certificate issued for the purposes of this section and to be so signed shall be deemed to be so signed and shall be admitted as evidence without proof of the signature of the person purporting to sign the certificate, unless the contrary is shown.
(4) Subsection (1) of this section shall have effect notwithstanding section 10 (4) of the Petty Sessions (Ireland) Act, 1851.
(5) This section applies to the following summary proceedings, namely:
(a) summary proceedings pursuant to section 26 of this Act or in respect of a contravention of section 24 (2) of the Principal Act and which are instituted by the planning authority in whose area the offence is alleged to have been committed,
(b) summary proceedings pursuant to section 32 or 33 of this Act.
Submissions and consultations.
31.—(1) The Board may make submissions to the Minister with respect to any matters pertaining to its functions.
(2) The Minister may consult with the Board in relation to the performance of any of his functions under the Local Government (Planning and Development) Acts, 1963 and 1976.
Declaration by members and employees of Board, and members and officers of planning authorities of certain interests.
32.—(1) It shall be the duty of a person to whom this section applies to give to the relevant body a declaration in the prescribed form, signed by him and containing particulars of every interest of his which is an interest to which this section applies and for so long as he continues to be a person to whom this section applies it shall be his duty where there is a change regarding an interest particulars of which are contained in the declaration or where he acquires any other interest to which this section applies, to give to the relevant body a fresh such declaration.
(2) (a) This section applies to the following persons, namely:
(i) a member of the Board,
(ii) a member of a planning authority,
(iii) an employee of the Board or any other person,
(I) whose services are availed of by the Board, and
(II) who is of a class, description or grade prescribed for the purposes of this section,
(iv) an officer of a planning authority who is the holder of an office which is of a class, description or grade so prescribed.
(b) This section applies to the following interests, namely:
(i) any estate or interest which a person to whom this section applies has, in case the person is a member or officer of a planning authority, in land situated in the area of the relevant authority, and in any other case, in any land,
(ii) any business of dealing in or developing land in which such a person is engaged or employed and any such business carried on by a company or other body of which he, or any nominee of his, is a member,
(iii) any profession, business or occupation in which such a person is engaged, whether on his own behalf or otherwise, and which relates to dealing in or developing land.
(3) A person to whom this section applies and who has an interest to which this section applies shall be regarded as complying with the requirements of subsection (1) of this section if, and only if, he gives to the relevant body a declaration mentioned in that subsection within the period of twenty-eight days beginning—
(a) in case the person is such a person on the commencement of this section, on such commencement,
(b) in case the person becomes such a person after the commencement of this section, on the day on which he becomes such a person,
(c) in case there is a change regarding an interest particulars of which are contained in a declaration already given by the person or where the person acquires any other interest to which this section applies, on the day on which the change occurs or the other such interest is acquired.
(4) For the purposes of this section, a person to whom this section applies shall be regarded as having an estate or interest in land if he, or any nominee of his, is a member of a company or other body which has an estate or interest in the land.
(5) For the purposes of this section, a person shall not be regarded as having an interest to which this section applies if the interest is so remote or insignificant that it cannot reasonably be regarded as likely to influence a person in considering or discussing, or in voting on, any question with respect to any matter arising or coming before the Board or authority, as may be appropriate, or in performing any function in relation to any such matter.
(6) Where a person to whom this section applies has an interest to which this section applies by reason only of the beneficial ownership of shares in a company or other body by him or by his nominee and the total nominal value of those shares does not exceed the lesser of—
(a) five hundred pounds, or
(b) one-hundredth part of the total nominal value of either the issued share capital of the company or body or, where that capital is issued in shares of more than one class, the issued share capital of the class or classes of shares in which he has an interest,
subsection (1) of this section shall not have effect in relation to that interest.
(7) The Board and each planning authority shall for the purposes of this section keep a register (which register is in this section referred to as the register of interests) and shall enter therein the particulars contained in declarations given to the Board or the authority, as the case may be, pursuant to this section. The register of interests shall be kept at the offices of the Board or the planning authority, as the case may be, and shall be available for public inspection during office hours.
(8) Where a person ceases to be a person to whom this section applies, any particulars entered in the register of interests as a result of a declaration being given by the person to the relevant body pursuant to this section shall be removed, as soon as may be after the expiration of the period of five years beginning on the day on which the person ceases to be such a person, from the said register by that body.
(9) Subject to subsection (10) of this section, a person who fails to comply with subsection (1) of this section or who, when purporting to comply with the requirements of the said subsection (1), gives particulars which are false or which to his knowledge are misleading in a material respect, shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding two hundred and fifty pounds or at the discretion of the court, to imprisonment for a term not exceeding six months, or to both the fine and the imprisonment.
(10) In any proceedings for an offence under this section it shall be a defence for the defendant to prove that at the relevant time he believed, in good faith and upon reasonable grounds, that—
(a) the relevant particulars were true,
(b) there was no matter as regards which he was then required to make a declaration under subsection (1) of this section, or
(c) that the matter in relation to which the offence is alleged was not one as regards which he was so required to make such declaration.
(11) (a) For the purposes of this section and section 33 of this Act,
(i) a manager shall be deemed to be an officer of every planning authority for which he is manager,
(ii) an assistant county manager for a county shall be deemed to be an officer of every planning authority in the county, and
(iii) an officer of a planning authority who, by virtue of an arrangement or agreement entered into under any enactment, is performing duties under another planning authority, shall be deemed to be also an officer of the other authority.
(b) In this section the “relevant body” means,
(i) in case a person to whom this section applies is either a member or employee of the Board, or other person whose services are availed of by the Board, the Board, and
(ii) in case such a person is either a member or officer of a planning authority, the authority.
Requirements affecting members and employees of Board, members and certain officers of planning authorities and certain other persons who have certain beneficial interests.
33.—(1) Where a member of the Board has a pecuniary or other beneficial interest in, or which is material to, any appeal, contribution, question or dispute which falls to be decided or determined by the Board, he shall comply with the following requirements:
(a) he shall disclose to the Board the nature of his interest,
(b) he shall take no part in the discussion or consideration of the matter,
(c) he shall not vote or otherwise act as a member of the Board in relation to the matter, and
(d) he shall neither influence nor seek to influence a decision of the Board as regards the matter.
(2) Where, at a meeting of a planning authority or of any committee of a planning authority, a resolution, motion, question or other matter is proposed or otherwise arises either pursuant to, or as regards the performance by the authority of a function under, the Local Government (Planning and Development) Acts, 1963 and 1976, or in relation to the acquisition or disposal by the authority of land under or for the purposes of those Acts or any other enactment, a member of the authority or committee present at the meeting shall, if he has a pecuniary or other beneficial interest in, or which is material to, the matter—
(a) at the meeting, and before discussion or consideration of the matter commences, disclose the nature of his interest,
(b) withdraw from the meeting for so long as the matter is being discussed or considered,
and accordingly, he shall take no part in the discussion or consideration of the matter and shall refrain from voting in relation to it.
(3) A member of a planning authority or of any committee of a planning authority who has a pecuniary or other beneficial interest in, or which is material to, a matter arising either pursuant to, or as regards the performance by the authority of a function under, the Local Government (Planning and Development) Acts, 1963 and 1976, or in relation to the acquisition or disposal by the authority of land under or for the purposes of those Acts or any other enactment, shall neither influence nor seek to influence a decision of the authority as regards the matter.
(4) Where the manager of a planning authority has a pecuniary or other beneficial interest in, or which is material to, any matter which arises or comes before the authority either pursuant to, or as regards the performance by the authority of a function under, the Local Government (Planning and Development) Acts, 1963 and 1976, or in relation to the acquisition or disposal by the authority of land under or for the purposes of those Acts or any other enactment, he shall, as soon as may be, disclose to the members of the planning authority the nature of his interest.
(5) (a) Where an employee of the Board or any other person whose services are availed of by the Board has a pecuniary or other beneficial interest in, or which is material to, any appeal, contribution, question or dispute which falls to be decided or determined by the Board, he shall comply with the following requirements:
(i) he shall neither influence nor seek to influence a decision of the Board as regards the matter, and
(ii) in case, as such employee or other person, he is concerned with the matter, he shall disclose to the Board the nature of his interest and comply with any directions the Board may give him in relation to the matter.
(b) Where an officer of a planning authority, not being the manager, has a pecuniary or other beneficial interest in, or which is material to, any matter which arises or comes before the authority, either pursuant to, or as regards the performance by the authority of a function under, the Local Government (Planning and Development) Acts, 1963 and 1976, or in relation to the acquisition or disposal of land by the authority under or for the purposes of those Acts or any other enactment, he shall comply with the following requirements:
(i) he shall neither influence nor seek to influence a decision of the authority as regards the matter, and
(ii) in case, as such officer, he is concerned with the matter, he shall disclose to the manager of the authority the nature of his interest and comply with any directions the manager may give him in relation to the matter.
(6) For the purposes of this section but without prejudice to the generality of any of the foregoing subsections hereof, a person shall be regarded as having a beneficial interest if—
(a) he or his spouse, or any nominee of his or of his spouse, is a member of a company or any other body which has a beneficial interest in, or which is material to, a resolution, motion, question or other matter mentioned in the foregoing subsections of this section,
(b) he or his spouse is in partnership with or is in the employment of a person who has a beneficial interest in, or which is material to, such a resolution, motion, question or other matter,
(c) he or his spouse is a party to any arrangement or agreement (whether or not enforceable) concerning land to which such a resolution, motion, question or other matter relates.
(d) his spouse has a beneficial interest in, or which is material to, such a resolution, motion, question or other matter.
(7) For the purposes of this section, a person shall not be regarded as having a beneficial interest in, or which is material to, any resolution, motion, question or other matter by reason only of an interest of his or of any company or of any other body or person mentioned in subsection (6) of this section which is so remote or insignificant that it cannot reasonably be regarded as likely to influence a person in considering or discussing, or in voting on, any question with respect to the matter, or in performing any function in relation to that matter.
(8) Where a person has a beneficial interest mentioned in subsection (1), (2), (3), (4) or (5) of this section by reason only of the beneficial ownership of shares in a company or other body by him or by his spouse and the total nominal value of those shares does not exceed the lesser of—
(a) five hundred pounds, or
(b) one-hundredth part of the total nominal value of either the issued share capital of the company or body or, where that capital is issued in shares of more than one class, the issued share capital of the class of shares in which he has an interest,
none of those subsections shall have effect in relation to that beneficial interest.
(9) Where at a meeting described in subsection (2) of this section a disclosure is made under that subsection, particulars of the disclosure and of any subsequent withdrawal from the meeting pursuant to the said subsection shall be recorded in the minutes of the meeting.
(10) Subject to subsection (11) of this section, a person who contravenes or fails to comply with a requirement of this section shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding two hundred and fifty pounds or, at the discretion of the court, to imprisonment for a term not exceeding six months, or to both the fine and the imprisonment.
(11) In any proceedings for an offence under this section it shall be a defence for the defendant to prove that at the time of the alleged offence he did not know and had no reason to believe that a matter in which, or in relation to which, he had a beneficial interest had arisen or had come before, or was being considered by, the Board or the relevant planning authority or committee, as may be appropriate, or that the beneficial interest to which the alleged offence relates was one in relation to which a requirement of this section applied.
Supplemental provisions relating to sections 32 and 33.
34.—(1) Proceedings for an offence under section 32 or 33 of this Act shall not be instituted except by or with the consent of the Director of Public Prosecutions.
(2) Where a person is convicted of an offence under section 32 or 33 of this Act, the following provisions shall have effect:
(a) the person shall be disqualified for being a member of the Board,
(b) in case the person is a member of the Board, he shall on such conviction accordingly cease to be a member of the Board,
(c) in case the person is a member of a planning authority or a member of any committee of a planning authority, he shall on such conviction cease to be a member of the authority or the committee, as may be appropriate,
(d) in case the person is a member of both a planning authority and any one or more such committees, he shall so cease to be a member of both the authority and every such committee, and
(e) in case the person by virtue of this subsection ceases to be a member of a planning authority or any such committee, he shall be disqualified for being a member of the authority or committee during the period which, but for the cessation of his membership of the authority or committee under this section, would be the remainder of his term.
(3) In case a person contravenes or fails to comply with a requirement of section 32 or 33 of this Act, or acts as a member of the Board, a planning authority or committee of a planning authority while disqualified for membership by virtue of this section, the fact of such contravention or failure or of his so acting, as the case may be, shall not invalidate any act or proceeding of the Board, authority or committee.
(4) Where any body which is a company within the meaning of section 155 of the Companies Act, 1963, is deemed under that section to be a subsidiary of another or to be another such company's holding company, a person who is a member of the first-mentioned such company shall, for the purposes of sections 32 and 33 of this Act be deemed also to be a member of the other company.
Regulations.
35.—The Minister may make regulations,
(a) providing for,
(i) the payment to planning authorities of prescribed fees by applicants for a waiver notice under section 29 of this Act,
(ii) the publication by planning authorities of specified notices with respect to applications for permission under the Principal Act to develop land or for such a waiver notice,
(b) enabling an applicant to appeal to the Board against a refusal of an approval which is required to be obtained under a condition subject to which a permission or approval is granted under the Principal Act,
(c) making such incidental, consequential, transitional or supplementary provision as may appear to him to be necessary or proper for any purpose of this Act or in consequence of, or to give full effect to, any of its provisions.
Onus of proof.
36.—In any proceedings for an offence under this Act or under the Principal Act, it shall not be necessary to negative by evidence the existence of any permission granted under Part IV of the Principal Act and the onus of proving such permission shall be on the person seeking to avail himself thereof.
Amendment of draft development plan or draft variation.
37.—The Principal Act is hereby amended by the insertion of the following section after section 21:
“21A.—(1) Where a planning authority have prepared a draft of a proposed development plan or of proposed variations of a development plan and, after complying with the requirements of subsections (1) and (2) of section 21 of this Act, it appears to the authority that the draft should be amended, subject to subsection (2) of this section they may amend the draft and make the development plan or variations accordingly.
(2) In case the proposed amendment would, if made, be a material alteration of the draft concerned, the planning authority shall cause notice of the proposed amendment to be published in the Iris Oifigiúil and in at least one newspaper circulating in their area, and having complied with the requirements of subsection (3) and, where appropriate, a requirement of subsection (4) of this section, and having taken into account any representations, they may, as they shall think fit, make the proposed plan or proposed variation, as the case may be, with or without the proposed amendment or with such other amendment (not being an amendment providing for the preservation of a structure or public right of way) as, having regard to the particular circumstances, they consider appropriate.
(3) A notice under the foregoing subsection shall state that—
(a) a copy of the proposed amendment of the draft may be inspected at a stated place and at stated times during a stated period of not less than one month (and the copy shall be kept available for inspection accordingly), and
(b) written representations with respect to the proposed amendment of the draft made to the planning authority within the said period will be taken into consideration before the making of any amendment (and any such representations shall be taken into consideration accordingly).
(4) (a) Where the proposed amendment includes any provision to preserve any structure because of its artistic, historic or architectural interest, the planning authority shall, in addition to complying with the requirements of subsection (2) of this section, serve a notice incorporating particulars of the provision on the owner and on the occupier of the structure.
(b) Where the proposed amendment includes any provision to preserve a public right of way, the planning authority shall, in addition to complying with the requirements of the said subsection (2), serve a copy of the notice incorporating particulars of the provision and a map indicating the right of way on the owner and on the occupier of the land.
(5) Any person may, before the expiration of twenty-one days next following the period stated pursuant to paragraph (a) of subsection (3) of this section, appeal to the Circuit Court against the inclusion in the proposed amendment of any such provision as is referred to in subsection (4) (b) of this section, and the Court, if satisfied that no public right of way subsists, shall so declare and the provision shall accordingly not be included.”.
Certain fines which may be imposed under the Principal Act increased.
38.—(1) The maximum fine which may be imposed in respect of an offence under a section of the Principal Act which is mentioned in subsection (3) (a) of this section (other than an offence which is either a further offence under such a section or a continuing offence) is hereby increased to two hundred and fifty pounds, and accordingly—
(a) every reference to one hundred pounds in the sections of the Principal Act mentioned in paragraph (a) (i) of subsection (3) of this section shall be construed and have effect as if it were a reference to two hundred and fifty pounds, and
(b) both of the references to two hundred pounds in the sections of the Principal Act mentioned in paragraph (a) (ii) of the said subsection (3) shall be construed and have effect as if they were each a reference to two hundred and fifty pounds.
(2) Every reference to twenty pounds in the sections of the Principal Act mentioned in subsection (3) (b) of this section shall be construed and have effect as if it were a reference to fifty pounds.
(3) (a) The sections of the Principal Act referred to in subsection (1) of this section are,
(i) sections 31 (8), 34 (1), 34 (6), 35 (7), 37 (7), 49 (2) (b) and 86 (8), and
(ii) sections 45 (8) and 46 (8).
(b) The sections of the Principal Act referred to in subsection (2) of this section are sections 31 (8), 34 (5), 34 (6), 35 (8), 37 (7), 49 (2) (b) and 86 (8).
Amendment of Part IV of Principal Act.
39.—Part IV of the Principal Act is hereby amended by—
(a) the insertion in section 25 (2) of the following paragraph after paragraph (c):
“(cc) in cases in which the development to which the application relates will, in the opinion of the relevant planning authority, cost more than an amount specified in the regulations, the furnishing to that authority of a written study of what, if any, effect the proposed development, if carried out, would have on the environment relative to the place where that development is to take place,”;
(b) the insertion in section 25 (2) of the following paragraph after paragraph (d):
“(dd) enabling planning authorities to invite an applicant to submit to them revised plans or other drawings modifying, or other particulars providing for the modification of, the development to which the application relates and, in case such plans, drawings, or particulars are submitted to a planning authority in response to such an invitation, enabling the authority in deciding the application to grant a permission or an approval for the relevant development as modified by all or any of such plans, drawings or particulars,”;
(c) the insertion in section 26 (2) of the following paragraph after paragraph (b):
“(bb) conditions for requiring the taking of measures to reduce or prevent—
(i) the emission of any noise or vibration from any structure comprised in the development authorised by the permission which might give reasonable cause for annoyance either to persons in any premises in the neighbourhood of the development or to persons lawfully using any public place in that neighbourhood, or
(ii) the intrusion of any noise or vibration which might give reasonable cause for annoyance to any person lawfully occupying any such structure,”;
(d) the substitution of the following subsection for subsection (3) of section 26:
“(3) (a) In a case in which the development concerned would contravene materially the development plan or any special amenity area order, a planning authority may, notwithstanding any other provision of this Act, decide to grant permission under this section, provided that the following requirements are complied with before the decision is made, namely,
(i) notice in the prescribed form of the intention of the planning authority to consider deciding to grant the permission shall be published in at least one daily newspaper circulating in their area,
(ii) copies of the notice shall be given to the applicant and to any person who has submitted an objection in writing to the development to which the application relates,
(iii) any objection or representation as regards the making of a decision to grant permission and which is received by the planning authority not later than twenty-one days after the first publication of the notice shall be duly considered by the authority, and
(iv) a resolution shall be passed by the authority requiring that a decision to grant permission be made.
(b) It shall be necessary for the passing of a resolution referred to in paragraph (a) of this subsection that the number of the members of the planning authority voting in favour of the resolution exceeds one-third of the total number of the members of the planning authority, and the requirement of this paragraph is in addition to and not in substitution for any other requirement applying in relation to such a resolution.
(c) Where notice is given pursuant to section 4 of the City and County Management (Amendment) Act, 1955, of intention to propose a resolution which, if passed, would require the manager to decide to grant a permission under this section, then if the manager is of opinion that the development concerned would contravene materially the development plan or any special amenity area order, he shall within seven days of the receipt by him of the notice make an order (a copy of which shall be furnished by him to each of the signatories to the notice) requiring that the provisions of subparagraphs (i), (ii) and (iii) of paragraph (a) of this subsection shall be complied with in the particular case and the order, when made, shall operate to cause the relevant notice given pursuant to the said section 4 to be of no further effect.
(d) If a resolution referred to in paragraph (a) (iv) of this subsection is duly passed, the manager shall decide to grant the relevant permission.”;
(e) the substitution of the following subparagraph for subparagraph (ii) of section 26 (4) (b):
“(ii) in case a notice referred to in subsection (3) of this section is published in relation to the application, within the period of two months beginning on the day on which the notice is first published,”;
(f) the insertion of the following subsection after subsection (4) of section 26:
“(4A) If, but only if, before the expiration of the appropriate period within the meaning of subsection (4) (a) of this section the applicant for a permission under this section gives to the planning authority in writing his consent to the extension by them of that period, the planning authority may extend the period and in case, pursuant to the foregoing, a planning authority make an extension, subsection (4) (b) of this section shall, as regards the particular case to which the extension relates, be construed and have effect in accordance with the extension.”;
(g) the substitution of the following subsection for subsection (8) of section 26:
“(8) A decision given under this section and the notification of such decision shall—
(a) in case the decision is made by a planning authority and is one by which any permission or approval is refused or is granted subject to conditions, comprise a statement specifying the reasons for the refusal or the imposition of conditions, and
(b) in case the decision is made on appeal, comprise a statement specifying the reasons for the decision,
provided that where a condition imposed is a condition described in paragraph (a) or any subsequent paragraph of subsection (2) of this section, a reference to the paragraph of the said subsection (2) in which the condition is described shall be sufficient to meet the requirements of this subsection.”;
(h) the substitution in section 28 (6) of “or may not be used, and in case such grant specifies use as a dwelling as a purpose for which the structure may be used, the permission may also be granted subject to a condition specifying that the use as a dwelling shall be restricted to use by persons of a particular class or description and that provision to that effect shall be embodied in an agreement pursuant to section 38 of this Act” for “be used”;
(i) the insertion of the following subsections after subsection (2) of section 30:
“(2A) A planning authority shall neither revoke nor modify a permission under this section unless there has been a change in circumstances relating to the proper planning and development of the area concerned and such change in circumstances has occurred,
(a) in case a notice relating to the permission is served under this section and is annulled, since the annulment of the notice,
(b) in case no notice is so served, since the granting of the permission.
(2B) In case a planning authority pursuant to this section revoke or modify a permission, they shall specify in their decision the change in circumstances which warranted the revocation or modification.”;
(j) the insertion of the following subsection after subsection (1) of section 38:
“(1A) A planning authority in entering into an agreement under this section may join with any body which is a prescribed authority for the purposes of section 21 of this Act.”;
(k) the substitution in section 38 (2) of “the planning authority or any body joined with them” for “the planning authority” where that expression firstly occurs and of “the planning authority or such body, as may be appropriate,” for “the planning authority” where the expression secondly occurs; and
(l) the insertion in section 38 (3) of “, the Board” after “the Minister”.
Amendment of Part V of Principal Act.
40.—Part V of the Principal Act is hereby amended by—
(a) the substitution of the following subsections for subsection (1) of section 42:
“(1) When it appears to the planning authority that by reason of—
(a) its outstanding natural beauty,
(b) its special recreational value, or
(c) a need for nature conservation,
an area should be declared under this section to be an area of special amenity, they may by order do so and the order may state the objective of the planning authority in relation to the preservation or enhancement of the character or special features of the area including objectives for the prevention or limitation of development in the area.
(1A) The Minister may, if he considers it necessary, direct a planning authority to make an order under this section in relation to an area specified in the direction and may, if he thinks fit, require that objectives specified in the direction be included by the planning authority in their order in respect of matters and in a manner so specified and in case the Minister gives a direction under this subsection the planning authority concerned shall comply with the direction and an order made pursuant to a direction under this subsection shall be revoked or varied only with the consent of the Minister.”;
(b) the substitution of the following subsection for subsection (1) of section 46:
“(1) If it appears to the planning authority, after consultation with the prescribed authorities, that it is expedient in the interests of amenity to make provision to preserve from extinction or otherwise protect any flora or fauna in an area, or part of an area, to which a special amenity area order relates, being flora or fauna which are of special amenity value or special interest, they may make an order prohibiting (subject to any exemptions for which provision may be made by the order) the taking, killing or destroying of such flora or fauna.”; and
(c) the substitution in subsection (4) of section 51 of “fifty pounds; and if in the case of a continuing offence the contravention of this section is continued after conviction, he shall be guilty of a further offence and liable on summary conviction to a fine not exceeding ten pounds for each day on which the contravention is continued” for “ten pounds”.
Amendment of Part VI of Principal Act.
41.—Part VI of the Principal Act is hereby amended by—
(a) the substitution in paragraph (a) of section 55 (2) of “compensation is agreed or determined” for “of the decision”;
(b) the insertion in paragraph (a) of section 55 (6) of “, the Board” after “planning authority”;
(c) the insertion in paragraph (c) of section 56 (1) of the following subparagraph after subparagraph (iv):
“(iva) measures to reduce or prevent air pollution or the emission or the intrusion of noise or vibration,”;
(d) the insertion in section 58 (1) of “or the Board, as the case may be” after “by the Minister”;
(e) the substitution in paragraph (b) of section 59 (1) of “sections 56, 57 and 58” for “sections 56 and 57”;
(f) the addition of the following proviso to section 61 (1):
“; provided that unless an application having been made to him in that behalf, the Minister makes an order declaring that he is satisfied that it would not be just and reasonable in the particular circumstances that payment of compensation should be prevented by the provisions of this proviso, no compensation shall be paid under this section in relation to damage resulting from the imposition under section 37 of this Act of conditions on the continuance of the use of land, being conditions imposed in order to avoid or reduce serious air or water pollution or the danger of such pollution”; and
(g) the substitution in section 61 of the following subsection for subsection (2):
“(2) Subsection (1) of this section shall not apply where the use of land is use for the exhibition of advertising unless at the time of such discontinuance or compliance the land had been used for the exhibition of advertising for less than five years, whether such use was continuous or intermittent or whether or not, while the land was being so used, advertising was exhibited at the same place on the land.”.
Amendment of Part VIII of Principal Act.
42.—Part VIII of the Principal Act is hereby amended by—
(a) the substitution of the following subsections for subsections (1), (2) and (3) of section 82:
“(1) Regulations may provide for any matters of procedure in relation to appeals to the Minister under section 88 of this Act or in relation to any section 76 hearing.
(2) Regulations shall be made under this section providing—
(a) for oral hearing of any such appeal to the Minister in respect of which oral hearing is requested by the appellant,
(b) for any such oral hearing or any section 76 hearing being conducted by a person appointed for that purpose by the Minister.
(3) Where a question of law arises on any reference, appeal or section 76 hearing, the question may be referred to the High Court for decision by it by,
(a) in the case of a reference or appeal, other than an appeal to the Minister under section 88 of this Act, the Board,
(b) in the case of an appeal to the Minister under section 88 of this Act or a section 76 hearing, the Minister.
(3A) A person shall not by prohibition, certiorari or in any other legal proceedings whatsoever question the validity of—
(a) a decision of a planning authority on an application for a permission or approval under Part IV of the Principal Act,
(b) a decision of the Board on any appeal or on any reference,
(c) a decision of the Minister on any appeal,
unless the proceedings are instituted within the period of two months commencing on the date on which the decision is given.”;
(b) the substitution in section 82 of the following subsections for subsection (8):
“(8) Subsections (4) to (7) of this section shall apply, with any necessary modifications, in relation to a person conducting a section 76 hearing.
(9) In subsections (3) to (7) of this section—
‘appeal’, except where the context otherwise requires, means an appeal to the Minister under section 88 of this Act or an appeal to the Board;
‘reference’ means a reference under section 5 of this Act to the Board;
‘section 76 hearing’ means a hearing held pursuant to section 76 of this Act, as amended by section 43 (1) of the Local Government (Planning and (Development) Act, 1976.”;
(c) the substitution in section 83 of—
(i) “A member of the Board or an authorised person” for “An authorised person” in both subsection (1) and subsection (2),
(ii) “a member of the Board or an authorised person” for “an authorised person” in both subsection (3) and subsection (7), and
(iii) the following subsection for subsection (8):
“(8) In this section—
‘authorised person’ means a person who is appointed by the planning authority, the Minister or the Board to be an authorised person for the purposes of this section;
‘appropriate authority’ means—
(a) in a case in which the authorised person was appointed by a planning authority—that authority,
(b) in a case in which the authorised person was appointed by the Minister—the Minister, and
(c) in a case in which the authorised person was appointed by the Board—the Board.”;
(d) the insertion of the following subsection after subsection (4) of section 86:
“(4A) Building regulations may make provision in relation to the special needs of disabled persons.”;
(e) the insertion in section 87 (1) of “, subject to or without conditions,” after “relaxing”; and
(f) the substitution of the following section for section 88:
Appeal against decision of planning authority on application under section 87.
“88.—(1) If a planning authority refuse an application to dispense with or relax any requirement in building regulations which they have power to dispense with or relax, or dispense with or relax such a requirement subject to a condition, the applicant may by notice in writing appeal to the Minister within one month from the date on which the planning authority notify the applicant of their decision.
(2) Where an appeal is brought under this section from a decision of a planning authority and is not withdrawn, the Minister shall determine the application as if it had been made to him in the first instance under section 87 of this Act, as amended by section 42 of the Local Government (Planning and Development) Act, 1976, and his decision shall operate to annul the decision of the planning authority as from the time when it was given; provided that this subsection shall not be construed as requiring the Minister to consult a planning authority in relation to an appeal brought under this section.”.
Miscellaneous amendments of Principal Act.
43.—(1) The Principal Act is hereby amended by—
(a) the addition to subsection (6) of section 2 of the following paragraph:
“(c) A declaration made under this subsection may be amended by the council of a county by whom it was made and the making of any such amendment shall be a reserved function.”;
(b) the insertion in paragraph (i) of section 4 (1) of “, not being works comprised in the fencing or enclosure of land which has been open to or used by the public within the ten years preceding the date on which the works are commenced” after “Land Reclamation Act, 1949”;
(c) the insertion of the following new subsection after subsection (1) of section 4:
“(1A) Where a planning authority in their development plan, for the purpose mentioned in paragraph 5A of Part IV of the Third Schedule to this Act, (inserted therein by section 43 of the Local Government (Planning and Development) Act, 1976), indicate objectives for the preservation of specified fixtures or features which form part of the interior of a structure specified in the development plan and which are stated in such plan to be of artistic, historic or architectural interest, then, notwithstanding subsection (1) of this section, works which involve the alteration or removal of, or which may cause injury to, any such fixture or feature shall not be exempted development for the purposes of this Act.”;
(d) the insertion of the following new paragraph after paragraph (c) of section 14 (2):
“(cc) a body or person providing homes or shelters for stray or unwanted dogs and cats,”;
(e) the addition of “, or make a new development plan” to section 20 (1);
(f) the insertion of the following new subsection after subsection (1) of section 20:
“(1A) The Minister may extend (either in relation to planning authorities generally or in a particular case) the period during which a planning authority may comply with the requirements of subsection (1) of this section.”;
(g) the substitution of the following paragraph for paragraph (c) of section 21 (1):
“(c) where the draft includes any provision relating to any structure or internal fixture or feature proposed to be preserved because of its artistic, historic or architectural interest, they shall serve notice (which shall incorporate particulars of the provision) of the preparation of the draft on the owner and on the occupier of the structure concerned,”;
(h) the addition of the following new subsection to section 22:
“(5) Where under this section the Minister requires a planning authority to vary the development plan, pending compliance by them with the requisition it shall be the duty of the authority to have regard to the requisition in the performance of their functions under this Act.”;
(i) the substitution in subsection (1) of section 76 of “if there is an objection to the order and the objection is not withdrawn, the Minister shall cause an oral hearing to be held and shall afford the person making the objection an opportunity of being heard” for all the words from “the Minister shall” to the end of the subsection;
(j) the addition to section 76 of the following subsection:
“(3) The Minister may, if he thinks fit, approve an order under this section in so far only as it relates to a part specified by him of the right of way which the order proposes to extinguish, and in case the Minister so approves such an order, the order shall be construed and have effect in accordance with the approval.”;
(k) the addition of “buildings or structures for the purpose of providing homes or shelters for stray or unwanted dogs and cats,” to paragraph (b) of section 77 (2); and
(l) the insertion of the following paragraph in Part IV of the Third Schedule before paragraph 6:
“5A. Preservation of plasterwork, staircases, woodwork or other fixtures or features of artistic, historic or architectural interest and forming part of the interior of structures.”.
(2) The reference to the Minister in subsection (6) of section 7 of the Principal Act shall be construed as including a reference to the Board and the provisions of that subsection shall be construed and have effect accordingly.
Amendment of section 42 of Public Health (Ireland) Act, 1878.
44.—Section 42 of the Public Health (Ireland) Act, 1878, as amended by sections 86 and 91 of the Principal Act, shall be construed and have effect as if “or such extended period as may at any time be agreed in writing between that authority and the person proposing to execute the work” and “or such extended period, as may be appropriate,” were inserted therein after “within two months” and “such two months”, respectively.
Repeals.
45.—The following provisions of the Principal Act are hereby repealed, namely, paragraph (b) of section 24 (4); subsections (2), (7) and (10) of section 46; section 55 (5); in paragraph (h) of section 56 (1) all the words from “by reference to” to the end of the paragraph.
Short title, collective citation, commencement and construction.
46.—(1) This Act may be cited as the Local Government (Planning and Development) Act, 1976.
(2) The Principal Act and this Act may be cited together as the Local Government (Planning and Development) Acts, 1963 and 1976.
(3) This Act shall come into operation on such day or days as may be fixed therefor by any order or orders of the Minister, either generally or with reference to any particular purpose or provision and different days may be so fixed for different purposes and different provisions of this Act.
(4) This Act and the Principal Act shall be construed together as one Act.
SCHEDULE
An Bord Pleanála
1. The Board shall be a body corporate with perpetual succession and power to sue and be sued in its corporate name and to acquire, hold and dispose of land.
2. The Board shall consist of a chairman and not less than four or more than ten ordinary members.
3. A person who is for the time being entitled under the Standing Orders of either House of the Oireachtas to sit therein or for the time being is a member of a local authority shall be disqualified from being a member of the Board.
4. The chairmanship of the Board shall be wholetime and where the Government appoints a person who formerly held judicial office to be chairman of the Board the following provisions shall apply, namely, he shall be appointed by the Government in a wholetime capacity and the Government when making the appointment shall fix his term of office and, subject to Articles 6 and 12 of this Schedule, he shall hold his office on such terms and conditions as the Minister, with the consent of the Minister for the Public Service, determines.
5. The chairman of the Board may resign his chairmanship by letter addressed to the Government and the resignation shall take effect as on and from the date of the receipt of the letter by the Government.
6. Where the chairman of the Board is a person who formerly held judicial office, the Government may remove him from the chairmanship if he has become incapable through ill-health of effectively performing his duties, or if he has committed stated misbehaviour, or if his removal appears to the Government to be necessary for the effective performance by the Board of its functions and in case a chairman of the Board is removed under this Article the Government shall cause to be laid before each House of the Oireachtas a statement in writing of the reasons for the removal.
7. Each ordinary member of the Board shall be appointed by the Minister and the Minister when making the appointment shall fix such member's term of office which shall not exceed three years and, subject to the foregoing and to Articles 10 and 12 of this Schedule, such member shall hold his office on such terms and conditions as the Minister, with the consent of the Minister for the Public Service, determines.
8. An ordinary member appointed by the Minister may be appointed from among his serving officers.
9. A member of the Board shall be paid by the Board such remuneration (if any) and allowances for expenses as the Minister, with the consent of the Minister for the Public Service, determines.
10. The Minister may remove from office an ordinary member of the Board who has become incapable through ill-health of effectively performing his duties, or who has committed stated misbehaviour, or whose removal appears to the Minister to be necessary for the effective performance by the Board of its functions, and in case a member of the Board is removed from office under this Article, the Minister shall cause to be laid before each House of the Oireachtas a statement in writing of the reasons for removal.
11. An ordinary member of the Board may resign his office as a member by letter addressed to the Minister and the resignation shall take effect as on and from the date of receipt of the letter by the Minister.
12. Where a member of the Board is nominated as a member of Seanad Éireann or for election to either House of the Oireachtas or becomes a member of a local authority he shall, upon accepting nomination as a member of Seanad Éireann, or upon nomination for such election, or upon becoming a member of the authority, as the case may be, cease to be a member of the Board.
13. A member of the Board whose term of office expires by the effluxion of time shall be eligible for reappointment.
14. Where a casual vacancy occurs among the members of the Board as a result of which there remain less than five such members the Government or the Minister, as may be appropriate, shall take such steps as are necessary to fill the vacancy as soon as possible.
15. The Board shall appoint one of its ordinary members to be deputy chairman but if, at any time, the person appointed ceases to be a member of the Board, he shall also cease at that time to be deputy chairman.
16. The Board shall hold such and so many meetings as may be necessary for the performance of its functions.
17. The Minister shall fix the date, time and place of the first meeting of the Board.
18. The quorum for a meeting of the Board shall be such as may from time to time be fixed by the Minister.
19. The chairman of the Board and each ordinary member of the Board at a meeting thereof shall have a vote.
20. Every question at a meeting of the Board shall be determined by a majority of votes of the members present and, in the event that voting is equally divided, the chairman shall have a casting vote.
21. Subject to Article 18 of this Schedule, the Board may act notwithstanding a vacancy among its members.
22. Subject to the provisions of this Act and to any regulations made by the Minister under the Principal Act or under section 20 of this Act and to the provisions of this Schedule, the Board shall regulate its procedure and business.
23. The Board may perform any of its functions through or by any of its members duly authorised by the Board in that behalf.
24. The Board may perform any of its functions, other than the act of deciding, determining, confirming, approving or extending a reference, appeal, order, notice, dispute or other matter with which the Board is concerned by virtue of section 14 or section 21 of this Act, through or by any person duly appointed by the Board in that behalf.
25. The Board shall, as soon as may be after its establishment, provide itself with a seal.
26. The seal of the Board shall be authenticated by the signature of the chairman of the Board or some other member thereof authorised by the Board to act in that behalf.
27. Judicial notice shall be taken of the seal of the Board and every document purporting to be an instrument made by the Board and to be sealed with the seal (purporting to be authenticated in accordance with Article 26 of this Schedule) of the Board shall be received in evidence and be deemed to be such instrument without proof unless the contrary is shown.
28. (1) The Minister may, with the concurrence of the Minister for the Public Service, make a scheme for the granting of pensions, gratuities or other allowances to or in respect of the chairman and wholetime ordinary members of the Board ceasing to hold office, other than persons in respect of whom an award under the Superannuation Acts, 1834 to 1963, may be made.
(2) A scheme under this Article shall not provide for the granting of a pension, gratuity or other allowance to a chairman of the Board in respect of a period during which he is a judge of the High Court.
(3) A scheme under this Article may provide that the termination of the appointment of the chairman or of an ordinary member of the Board during that person's term of office shall not preclude the award to him under the scheme of a pension, gratuity or other allowance.
(4) The Minister may, with the concurrence of the Minister for the Public Service, amend a scheme made by him under this Article.
(5) If any dispute arises as to the claim of any person to, or the amount of, any pension, gratuity or allowance payable in pursuance of a scheme under this Article, such dispute shall be submitted to the Minister who shall refer it to the Minister for the Public Service, whose decision shall be final.
(6) A scheme made under this Article shall be carried out by the Board in accordance with its terms.
(7) Every scheme made by the Minister under this Article shall be laid before each House of the Oireachtas as soon as may be after it is made and if either House, within the next twenty-one days on which that House has sat after the scheme is laid before it, passes a resolution annulling the scheme, the scheme shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
(8) Where an established civil servant is definitively transferred to the Board as a member thereof, the superannuation benefits to be granted to him shall, if the Minister for the Public Service in his discretion so directs, be calculated in accordance with the provisions of the Superannuation Acts, 1834 to 1963, as if, during the period of his service as a wholetime member of the Board subsequent to his transfer, he had been an established civil servant and had been paid during that period out of moneys provided by the Oireachtas within the meaning of section 17 of the Superannuation Act, 1859.
