1.—Féadfar an tAcht Bainne agus Déirithe, 1935, do ghairm den Acht so.
Tosach feidhme an Achta.
2.—Tiocfaidh an tAcht so i ngníomh pé lá no laetheanta ceapfar chuige sin le haon ordú no orduithe ón Aire Rialtais Áitiúla agus Sláinte Puiblí go generálta no maidir le haon chríoch no foráil áirithe agus féadfar laetheanta deifriúla do cheapadh amhlaidh chun crícheanna deifriúla agus i gcóir forálacha deifriúla den Acht so.
“Bainne.”
3.—(1) San Acht so (ach amháin i gCuid IV de) cialluíonn an focal “bainne” aon abhar bídh is fíor-bhainne no bainne bearrtha na bainne deighilte no uachtar no bláthach.
(2) I gCuid IV den Acht so cialluíonn an focal “bainne” fíor-bhainne.
(3) San alt so cialluíonn an abairt “fíor-bhainne” bainne nár baineadh aon cheann dá chó-abhair as ar shlí seachas de bharr aon oibrithe ghlantóireachta (ar a n-áirmhítear pasteuráil no seascadh) fé n-ar cuireadh an bainne sin.
Tuigfear bainne díolfar, etc., do dhíol, etc., chun daoine dá chaitheamh i bhfuirm bainne.
4.—Má díoltar bainne no má bhíonn bainne á thaisbeáint no á choimeád chun a dhíolta, tuigfear, chun crícheanna an Achta so, mara gcruthuítear agus go dtí go gcruthófar a mhalairt, é do dhíol, no é do bheith á thaisbeáint no á choimeád chun a dhíolta chun daoine dá chaitheamh i bhfuirm bainne agus sa bhfuirm sin amháin.

5.—Déanfar tagairtí sna forálacha ina dhiaidh seo den Acht so do bhainne do dhíol do léiriú mar thagairtí do bhainne do dhíol chun daoine dá chaitheamh i bhfuirm bainne agus sa bhfuirm sin amháin, agus déanfar tagairtí sna forálacha san ina dhiaidh seo do dhíoltóir bhainne do léiriú dá réir sin.
Mínithe.
6.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Rialtais Áitiúla agus Sláinte Puiblí;
foluíonn an abairt “soláthróir bainne” duine is díoltóir bainne pe'ca ina mhór-choda no ina mhion-choda é;
foluíonn an abairt “déirí” (ach amháin i gcás dá bhforáltar a mhalairt san Acht so) aon fheirm, tigh feirme, bó-theach, stór bainne, siopa bainne, no áit eile as a dtugtar bainne amach ar díol no chun a dhíolta, no ina gcoimeádtar no ina n-úsáidtear bainne chun díolta, agus, i gcás soláthróra bhainne ná bíonn aon áitreabh ar seilbh aige chun bainne do dhíol, foluíonn sí an áit ina gcoimeádann an soláthróir sin na hárthaighe úsáideann sé chun bainne do dhíol;
foluíonn an abairt “reachtaire bainne” (ach amháin i gcás dá bhforáltar a mhalairt san Acht so) duine is sealbhóir déirí, no aon tsoláthróir bainne;
foluíonn an focal “scrúdú” scrúduithe agus tástála ceimiceacha agus bactéarlaíochta agus prótosólaíochta agus aon scrúdú no tástáil eile deintear ar bhainne chun galruithe, truaillithe, eisíodhaine, no aon lochta eile ina chóshuidheamh do bhrath;
cialluíonn an abairt “ceanntar sláintíochta” ceanntar sláintíochta fé sna hAchtanna Sláinte Puiblí, 1878 go 1931;
cialluíonn an abairt “an t-údarás sláintíochta” maidir le ceanntar sláintíochta an t-údarás sláintíochta fé sna hAchtanna Sláinte Puiblí, 1878 go 1931, don cheanntar sláintíochta san;

Déirithe áirithe agus reachtairí áirithe bainne do dhúnadh amach.
7.—I gcás—
(a) ina ndeintear bainne is farisbarr agus do táirgeadh ar fheirm do dhíol uaireanta le daoine chun a chaithte ag na daoine sin no ag á líonta tighe, agus
(b) ná díolann sealbhóir na feirme sin san aon lá amháin níos mó ná galún den bhainne sin, agus
(c) nách cuid de ghnáth-ghnó an tsealbhóra san bainne do dhíol,
ansan, chun crícheanna an Achta so, tuigfear nách déirí an fheirm sin agus tuigfear nách reachtaire bainne an sealbhóir sin agus, chun crícheanna na bhforálacha de Chuid II den Acht so bhaineann le reachtairí áirithe bainne do dhúnadh amach go sealadach o Chuid II agus na bhforálacha de Chuid III den Acht so bhaineann le déirithe áirithe agus reachtairí áirithe bainne do dhúnadh amach go sealadach o Chuid III, tuigfear nár díoladh an bainne sin leis na daoine sin.
“An dochtúir oifigiúil.”
8.—(1) Cialluíonn an abairt “an dochtúir oifigiúil”—
(a) nuair a húsáidtear í maidir le ceanntar sláintíochta is contae-bhuirg, an príomh-dhochtúir oifigiúil sláinte don chontae-bhuirg sin no an duine bheidh de thurus na huaire ag gníomhú mar phríomh-dhochtúir oifigiúil sláinte den tsórt san, agus
(b) nuair a húsáidtear í maidir le haon cheanntar sláintíochta eile, an dochtúir oifigiúil sláinte contae ghníomhuíonn don cheanntar san, no an duine bheidh de thurus na huaire ag gníomhú mar dhochtúir oifigiúil sláinte contae den tsórt san.
(2) I gcás ceanntair íclainne is cuid de cheanntar sláintíochta ná beidh aon dochtúir oifigiúil do réir bhrí an fho-ailt dheiridh sin roimhe seo den alt so ag gníomhú dho de thurus na huaire beidh éifeacht ag na forálacha so leanas, sé sin le rá, faid ná beidh aon dochtúir oifigiúil den tsórt san ann isé dhéanfaidh na comhachta agus na dualgaisí do bheadh infheidhmhithe agus ionchólíonta, fén Acht so ag an dochtúir oifigiúil sin, dá mbeadh a leithéid ann, d'fheidhmiú agus do chólíonadh laistigh den cheanntar íclainne sin agus maidir leis ná dochtúir oifigiúil sláinte an cheanntair íclainne sin.
Tuigfear bainne do dhíol i gcásanna áirithe.
9.—(1) Má coinnítear bainne i ndéirí no i gcoimeád no i seilbh aon reachtaire bainne, tuigfear chun crícheanna an Achta so, mara gcruthuítear agus go dtí go gcruthófar a mhalairt, é do bheith á choinneáil chun é do dhíol.
(2) Gach duine thairgfidh no thaisbeánfaidh bainne chun a dhíolta, no lomhálfaidh bainne do dhíol no do thairiscint no do thaisbeáint chun a dhíolta tuigfear chun crícheanna an Achta so gur dhíol sé an bainne sin.
Nithe ilghnéitheacha do léiriú.
10.—(1) Tuigfear, chun crícheanna an Achta so, gnó reachtaire bhainne do bheith ar siúl ag reachtaire bainne i ngach áitreabh úsáideann sé chun crícheanna a ghnótha mar reachtaire bhainne.
(2) I gcás gan duine 'na mbíonn gnó reachtaire bhainne ar siúl aige i gceanntar sláintíochta do shealbhú aon áitreibh sa cheanntar sláintíochta san chun crícheanna an ghnótha san, tuigfear chun crícheanna an Achta so gur áitreabh sa cheanntar san gach feithicil úsáideann an duine sin chun crícheanna an ghnótha san.
(3) Má foráltar le téarmaí connartha sheirbhíse go mbeidh bainne le tabhairt in aisce ag an bhfostóir don fhostaí tuigfear chun crícheanna an Achta so nár dhíol an fostóir leis an bhfostaí bainne do thug an fostóir don fhostaí fén gconnradh san.
Údaráis sláintíochta do chur an Achta i bhfeidhm.
11.—(1) Beidh sé de dhualgas ar an údarás sláintíochta forálacha an Achta so agus forálacha gach orduithe agus rialacháin a déanfar fé do chur i bhfeidhm agus na comhachta dílsítear ionta leis an Acht so no dílseofar ionta leis an ordú no an rialachán san d'fheidhmiú.
(2) Má theipeann ar údarás áitiúil aon cheann dá ndualgaisí fén Acht so do chólíonadh féadfaidh an tAire pé ordú do dhéanamh is dóich leis is gá no is ceart chun a chur fhiachaint ar an údarás san a ndualgaisí do chólíonadh agus féadfar, gan dochar d'fheidhmiú na gcomhacht a bronntar ar an Aire le halt 72 den Acht Rialtais Áitiúla, 1925 (Uimh. 5 de 1925), aon ordú den tsórt san do chur i bhfeidhm ar agra an Aire tré mhandamus.
Údaráis sláintíochta do cheapadh oifigeach.
12.—Féadfaidh údarás sláintíochta ar bith, le toiliú an Aire agus fé réir forálacha aon achtacháin a bhaineann leis an údarás san do cheapadh oifigeach pé oifigigh agus pé méid oifigeach do cheapadh is dóich leis an údarás san is gá chun na bhfeidhmeanna, na gcomhacht agus na ndualgas a bronntar no forchuirtear leis an Acht so d'fheidhmiú, agus íocfar le gach oifigeach a ceapfar amhlaidh pé luach saothair a chinnfidh an t-údarás sláintíochta le toilliú an Aire.
Ceart chun dul isteach in áitreabh.
13.—(1) Beidh gach oifigeach d'údarás sláintíochta agus gach cigire i dteideal dul isteach gach tráth réasúnta in aon áitreabh chun forálacha an Achta so agus forálacha, aon ordú agus rialachán a déanfar fé do chur i bhfeidhm.
(2) Má dheineann duine ar bith aon oifigeach d'údarás sláintíochta no aon chigire do chose no do bhac agus é ag feidhmiú na comhachta bronntar ar an oifigeach san no ar an gcigire sin leis an alt so beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga púnt do chur air.
(3) Ní dhéanfaidh éinní san alt so a údarú do dhuine ar bith, ach amháin le cead an údaráis áitiúla fé sna hAchtanna um Ghalair Ainmhithe (Éirinn), 1894 go 1934, dul isteach in aon bhó-theach no áit eile ina mbeidh ainmhí ar a mbeidh aon ghalar le n-a mbaineann na hAchtanna san á choimeád agus san suidhte in áit go ndearbhuítear fé sna hAchtanna san an galar san do bheith ann.
Fiosrúcháin phuiblí.
14.—(1) Pé uair a bronntar comhacht ar an Aire leis an Acht so chun aon ordú no rialachán do dhéanamh no chun éinní eile do dhéanamh féadfaidh an tAire roimh an gcomhacht san d'fheidhmiú fiosrú puiblí do dhéanamh i dtaobh an ní is abhar d'fheidhmiú san na comhachta san.
(2) Beidh feidhm ag Airtiogal 32 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898, maidir le gach fiosrúchán puiblí déanfar fén alt so fé mar atá feidhm ag an Airtiogal san maidir leis na fiosrúcháin phuiblí luaidhtear ann.
Rialacháin ghenerálta.
15.—(1) Féadfaidh an tAire Dlí agus Cirt le hordú rialacháin do dhéanamh ag ordú éinní no aon ruda bhaineann leis an gCúirt Dúithche agus dá dtagartar san Acht so mar ní no mar rud atá orduithe.
(2) Féadfaidh an tAire le hordú rialacháin do dhéanamh chun gach críche no aon chríche acu so leanas, sé sin le rá:—
(a) ag ordú éinní no aon ruda dá dtagartar san Acht so mar ní no mar rud atá orduithe agus ná húdaruítear leis an Acht so a ordú le rialacháin ar n-a ndéanamh ag an Aire Dlí agus Cirt;
(b) ag ordú éinní a húdaruítear don Aire le haon alt den Acht so a ordú le rialacháin ar n-a ndeanamh fén alt san.
(3) Aon rialacháin a dhéanfaidh an tAire fén Acht so maidir le táillí beidh sé fé réir cheadú an Aire Airgid.
Rialacháin do leagadh fé bhráid Tithe an Oireachtais.
16.—Gach rialachán a déanfar fén Acht so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis an rialacháin sin do dhéanamh agus má dheineann ceachtar Tigh den Oireachtas, laistigh den lá is fiche shuidhfidh an Tigh sin tar éis an rialacháin sin do leagadh fé n-a bhráid amhlaidh, rún do rith ag cur an rialacháin sin ar nea-mbrí beidh an rialachán san curtha ar nea-mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén rialachán san.
Airgead.
17.—(1) Sa mhéid go gceadóidh an tAire Airgid é, is amach as airgead a sholáthróidh an tOireachtas a híocfar gach costas fé n-a raghaidh Aire Stáit fén Acht so.
(2) Déanfar na costaisí fé n-a raghaidh údarás sláintíochta fén Acht so do chruinniú agus d'íoc sa tslí ina ndeintear na costaisí fé n-a dtéigheann an t-údarás sláintíochta san fé sna hAchtanna Sláinte Puiblí, 1878 go 1931, do chruinniú agus d'íoc, agus i gcás an bhúird sláinte do cheanntair sláinte contae déanfar iad do mhuirearú go cothrom ar iomlán an cheanntair sláinte contae sin.
(3) Gach costas fé n-a raghaidh oifigeach d'údarás sláintíochta do réir réasúin maidir le haon chúiseamh i gcionta fén Acht so déanfaidh an t-údarás sláintíochta don cheanntar sláintíochta ina ndearnadh an cionta san iad d'aisíoc leis.
Cosaint d'Achtanna eile bhaineann le bainne agus le déirithe.
18.—Ní dhéanfaidh éinní atá san Acht so dochar ná deifir d'aon achtachán eile bheidh i bhfeidhm de thurus na huaire i dtaobh bainne agus déirithe.

19.—Deintear leis seo na hachtacháin a luaidhtear sa Sceideal a ghabhann leis an Acht so d'athghairm sa mhéid a luaidhtear sa tríú colún den Sceideal san.
CUID II.
Reachtairi Bainne agus Deirithe do chlaru.
Reachtairí áirithe bainne do dhúnadh amach go sealadach o Chuid II.
20.—(1) Duine—
(a) a dhíolann bainne le daoine is dílseánaigh chláruithe, do réir bhrí na nAchtanna Tora Déiríochta, 1924 go 1934, ar áitreibh atá cláruithe fé sna hAchtanna san agus is sealbhóirí ar cheadúnaisí ainme speisialta ar n-a ndeonadh fé Chuid IV den Acht so, agus
(b) ná díolann bainne le daoine ar bith eile,
tuigfear chun crícheanna na Coda so den Acht so gan gnó reachtaire bhainne do bheith ar siúl aige.
(2) Féadfaidh an tAire, le toiliú an Aire Talmhaíochta, Ordú do dhéanamh tráth ar bith á dhearbhú go scuirfidh fo-alt (1) den alt so de bheith i bhfeidhm ar dháta áirithe agus dá éis sin agus leis sin scuirfidh an fo-alt san (1) de bheith i bhfeidhm ar an dáta san agus dá éis sin.
(3) Duine dhíolann bainne chun a chaithte san áitreabh ina ndíoltar é agus san áit sin amháin tuigfear chun crícheanna na Coda so den Acht so gan gnó reachtaire bhainne do bheith ar siúl aige.
Cláir de reachtairí bainne.
21.—Cuirfidh gach údarás sláintíochta fé ndeár go gcoimeádfar, sa bhfuirm orduithe, clár ar a dtabharfar mar ainm agus mar theideal an clár de reachtairí bainne agus clárofár i ngach clár den tsort san na nithe is gá do réir an Achta so a chlárú ann agus pé nithe eile bheidh orduithe.
Reachtairí bainne do chlárú.
22.—(1) Féadfaidh duine ar bith a bheidh ar aigne gnó reachtaire bhainne do bheith ar siúl aige i gceanntar sláintíochta údaráis sláintíochta a iarraidh ar an údarás san é do chlárú sa chlár de reachtairí bainne bheidh á choimeád ag an údarás san.
(2) Is sa bhfuirm orduithe bheidh gach iarratas chun údaráis sláintíochta fén alt so agus luadhfar ann seoladh an iarratasóra agus mion-innste ar an áitreabh ina mbeidh an t-iarratasóir ar aigne gnó reachtaire bhainne do bheith ar siúl aige i gceanntar sláintíochta an údaráis sin agus gur ina thaobh a bheidh an t-iarratasóir á iarraidh é do chlárú sa chlár de reachtairí bainne bheidh á choimeád ag an údarás san agus pé mion-innste eile (más ann dóibh) a bheidh orduithe.
(3) Ar iarratas d'fháil fén alt so agus dá réir déanfaidh an t-údarás sláintíochta, fé réir forálacha an chéad ailt ina dhiaidh seo, a chur fé ndéar go gclárófar sa chlár de reachtairí bainne bheidh á choimeád acu—
(a) ainm agus seoladh an iarratasóra, agus
(b) mion-innste ar na háitreibh uile agus fé seach a bheidh luaidhte san iarratas san agus gur ina dtaobh a bheidh an t-iarratasóir á iarraidh é do chlárú sa chlár san.
Diúltú do reachtairí bainne do chlárú.
23.—(1) Má hiarrtar ar údarás sláintíochta clárú do dhéanamh sa chlár de reachtairí bainne bheidh á choimeád ag an údarás san, féadfaidh an t-údarás san, más deimhin leo nách duine ceart oiriúnach an t-iarratasóir chun gnó reachtaire bhainne do bheith ar siúl aige no nách áitreabh oiriúnach an t-áitreabh gur ina thaobh a bheidh sé á iarraidh é chlárú, féadfaid le hordú (dá ngairmtear ordú diúltach sa Chuid seo den Acht so)—
(a) diúltú do chlárú do dhéanamh ar an iarratasóir agus ar an áitreabh gur ina thaobh a bheidh clárú á iarraidh ag an iarratasóir, no
(b) más alos áitreabh iomdha bheidh clárú á iarraidh ag an iarratasóir, an t-iarratasóir do chlárú alos coda de sna háitreibh sin ach díultú don iarratasóir do chlárú alos na coda eile de sna háitreibh sin.
(2) Luadhfar i ngach ordú diúltach na forais ar a ndearnadh an t-ordú.
(3) Má dheineann údarás sláintíochta ordú diúltach maidir le hiarratas beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) seirbheálfaidh an t-údarás sláintíochta cóip den ordú san ar an iarratasóir;
(b) cuirfidh an t-údarás sláintíochta cóip den ordú san chun an Aire;
(c) féadfaidh an t-iarratasóir, laistigh de lá is fiche tar éis na cóipe sin do sheirbheáil air, athchomharc do dhéanamh sa tslí orduithe chun an Aire i gcoinnibh an orduithe dhiúltaigh sin;
(d) i gcás an athchomhairc sin do dhéanamh go cuibhe, déanfaidh an tAire, tar éis do an cúrsa do bhreithniú, déanfaidh, fé mar is dóich leis is ceart, ordú ag daingniú an orduithe dhiúltaigh sin no ordú á ordú don údarás sláintíochta an t-athchomharcach do chlárú, sa chlár de reachtairí bainne bheidh á choimeád acu, do réir téarmaí an iarratais no go pé atharuithe chífear don Aire is ceart.
Toirmeasc ar bhainne do dhíol ag reachtairí bainne neachláruithe no in áitreabh nea-chláruithe.
24.—(1) Fé réir forálacha an chéad ailt ina dhiaidh seo ní bheidh sé dleathach do dhuine ar bith, tar éis sé mhí do bheith caithte o thosach feidhme na Coda so den Acht so, gnó reachtaire bhainne do bheith ar siúl aige in aon áitreabh a bheidh suidhte i gceanntar sláintíochta maran rud é—
(a) go mbeidh an duine sin cláruithe sa chlár de reachtairí bainne bheidh á choimeád ag an údarás sláintíochta don cheanntar san, agus
(b) gur áitreabh go mbeidh an duine sin cláruithe ina thaobh sa chlár san an t-áitreabh san.
(2) Má dheineann duine ar bith éinní contrárdha don alt so beidh an duine sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar cúig púint do chur air más é an chéad chionta fén alt so aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é fíneáil ná raghaidh thar caoga púnt, agus i gceachtar cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar dachad scilling in aghaidh gach lae leanfaidh an cionta.
(3) Féadfaidh an t-údarás sláintíochta gur laistigh dá gceanntar sláintíochta do rinneadh cionta fén alt so an cionta san do chúiseamh.

25.—Má éagann duine bheidh cláruithe sa chlár de reachtairí bainne agus má dheineann ionadaí pearsanta no ball de líntighe an duine sin gnó reachtaire bhainne do choimeád ar siúl in aon áitreabh go mbeidh an duine sin cláruithe ina thaobh sa chlár san, ansan, d'ainneoin gan an t-ionadaí pearsanta no an ball san do bheith cláruithe sa chlár san i dtaobh an áitreibh sin, ní tuigfear, ar feadh mí o éagadh an duine sin, an t-ionadaí pearsanta no an ball san do shárú an ailt deiridh sin roimhe seo tríd an ngnó san do choimeád ar siúl amhlaidh.

26.—(1) Más deimhin le húdarás sláintíochta—
(a) go bhfuil duine ar bith atá cláruithe sa chlár de reachtairí bainne atá á choimeád acu gan bheith ina dhuine cheart oiriúnach a thuilleadh chun gnótha reachtaire bhainne do bheith ar siúl aige, no
(b) go ndearnadh duine ar bith atá cláruithe sa chlár san do chiontú i gcionta fén Acht so no i gcionta fé sna hAchtanna um Biadh agus Druganna do Dhíol, 1875 go 1935, maidir le bainne do dhíol, no
(c) gur tré chalaois no tré cham-thuairisc, pe'ca calaoiseach no neamh-urchóideach di do fuarthas duine ar bith do chlárú sa chlár de reachtairí bainne atá á choimeád acu,
féadfaidh an t-údarás sláintíochta san, fé réir forálacha an ailt seo, féadfaid, le hordú (dá ngairmtear ordú nea-mbríochainte san alt so), clárú an duine sin sa chlár san do chur ar nea-mbrí.
(2) Más deimhin le húdarás sláintíochta gan áitreabh áirithe go bhfuil aon duine cláruithe ina thaobh sa chlár de reachtairí bainne atá á choimeád acu do bheith oiriúnach a thuilleadh chun é d'úsáid mar dhéirí féadfaidh an t-údarás sláintíochta san, fé réir forálacha an ailt seo, féadfaid le hordú (dá ngairmtear freisin ordú nea-mbríochainte san alt so) i gcás an duine sin do bheith cláruithe sa chlár san i dtaobh áitreibh eile, iontráil an áitreibh chéad-luaidhte sin sa chlár san do chur ar nea-mbrí no, in aon chás eile, clárú an duine sin sa chlár san do chur ar nea-mbrí.
(3) Luadhfar i ngach ordú nea-mbríochainte na forais ar a ndearnadh an t-ordú san.
(4) Má dheineann údarás sláintíochta ordú nea-mbríochainte ag cur clárú duine sa chlár de reachtairí bainne atá á choimeád acu ar nea-mbrí luadhfar san ordú san tréimhse ag tosnú ar dháta an orduithe sin ná beidh an duine sin ion-athchláruithe ar a feadh sa chlár san.
(5) Beidh éifeacht ag na forálacha so leanas maidir le húdarás sláintíochta do dhéanamh orduithe nea-mbríochainte i dtaobh duine (dá ngairmtear an reachtaire bainne sa bhfo-alt so) bheidh cláruithe sa chlár de reachtairí bainne bheidh á choimeád ag an údarás sláintíochta san, sé sin le rá:—
(a) sara ndéanfaid an t-ordú san cuirfidh an t-údarás sláintíochta san fé ndeár dréacht den ordú bheartuithe d'ullamhú;
(b) déanfaidh an t-údarás sláintíochta san fógra sa bhfuirm orduithe do sheirbheáil ar an reachtaire bainne á rá go bhfuilid ar intinn a iarraidh ar an Aire toiliú le déanamh an orduithe bheartuithe, agus beidh cóip den dréacht san sa bhfógra san;
(c) féadfaidh an reachtaire bainne, laistigh de cheithre lá déag tar éis an fhógra san do sheirbheáil air, cúis do phlé leis an Aire i dtaobh an orduithe bheartuithe;
(d) chó luath agus is féidir é tar éis an fhógra san do sheirbheáil iarrfaidh an t-údarás sláintíochta san ar an Aire toiliú le déanamh an orduithe bheartuithe, agus beidh cóip den fhógra san ag gabháil leis an iarratas san agus dáta seirbheála an fhógra san ar an reachtaire bainne cúlscríobhtha uirthi;
(e) ar an iarratas san d'fháil déanfaidh an tAire, ach ní níos túisce ná ceithre lá déag tar éis dáta seirbheála an fhógra san ar an reachtaire bainne, an t-iarratas san do bhreithniú maraon le haon chúis a phléfidh an reachtaire bainne leis agus tar éis an bhreithnithe sin déanfaidh ní acu so leanas, cadhon—
(i) toileoidh le déanamh an orduithe bheartuithe i dtéarmaí an dréachta san, no
(ii) leasóidh an dréacht san agus toileoidh le déanamh an orduithe bheartuithe i dtéarmaí an dréachta san fé mar a bheidh sé leasuithe amhlaidh, no
(iii) diúltóidh do thoiliú le déanamh an orduithe bheartuithe;
(f) ní dhéanfaidh an t-údarás sláintíochta san an t-ordú beartuithe má dhiúltuíonn an tAire do thoiliú le n-a dhéanamh, agus, má thoilíonn an tAire le n-a dhéanamh, ní dhéanfaid an t-ordú beartuithe ach i dtéarmaí an dréachta san no i dtéarmaí an dréachta san mar a bheidh sé leasuithe ag an Aire (pe'ca aca é).
(6) Má dheineann údarás sláintíochta ordú nea-mbríochainte le toiliú an Aire seirbheálfaid cóip den ordú san ar an duine le n-a mbaineann an t-ordú san, agus tiocfaidh an t-ordú san i bhefidhm an seachtú lá tar éis dáta na seirbheála san.
(7) Má thagann ordú nea-mbríochainte i bhfeidhm ag cur clárú dhuine ar nea-mbrí a bheidh cláruithe sa chlár de reachtairí bainne bheidh á choimeád ag údarás sláintíochta ní dhéanfaidh an t-údarás sláintíochta san, gan toiliú an Aire, an duine sin d'ath-chlárú sa chlár san i rith na tréimhse bheidh luaidhte san ordú san mar an tréimhse ná beidh an duine sin ion-athchláruithe ar a feadh sa chlár san.
(8) Má deintear duine bheidh cláruithe sa chlár de reachtairí bainne bheidh á choimeád ag údarás sláintíochta do chiontú den tríú huair laistigh de thréimhse de chúig bliana i gcionta fén Acht so no i gcionta fé sna hAchtanna um Biadh agus Druganna do Dhíol, 1875 go 1935, maidir le bainne do dhíol, déanfaidh an t-údarás sláintíochta san clárú an duine sin sa chlár san do chur ar nea-mbrí, agus, d'ainneoin éinní atá san Acht so, ní dhéanfaid, gan toiliú an Aire, an duine sin d'ath-chlárú sa chlár san i rith na tréimhse de bhliain dar tosach dáta an chiontuithe dheiridh de sna ciontuithe sin.
Clárú do cheartú agus do chur ar nea-mbrí.
27.—(1) Féadfaidh údarás sláintíochta, tráth ar bith, aon iontráil sa chlár de reachtairí bainne bheidh á choimeád acu d'atharú no do chur ar nea-mbrí ar n-a iarraidh sin i scríbhinn don duine gur i dtaobh a chláruithe do rinneadh an iontráil sin no, más pearsa an duine sin, dá ionadaí pearsanta no, más cólucht corparáideach an duine sin, don tsocruitheoir.
(2) Féadfaidh údarás sláintíochta tráth ar bith, d'éamais iarratais den tsort san roimhráite, clárú dhuine ar bith sa chlár de reachtairí bainne bheidh á choimeád acu do chur ar nea-mbrí más deimhin leis an údarás sláintíochta san go bhfuil an duine sin, más pearsa é, tar éis bháis no, más cólucht corparáideach é, tar éis scurtha, agus ná dearnadh laistigh de mhí tar éis an bháis no an scurtha san aon duine eile do chlárú in ionad an duine do fuair bás no do scuireadh amhlaidh.
(3) Fé réir forálacha fo-ailt (5) den alt so féadfaidh údarás sláintíochta tráth ar bith, d'éamais iarratais den tsórt san roimhráite, clárú dhuine ar bith sa chlár de reachtairí bainne bheidh á choimeád acu do chur ar nea-mbrí más deimhin leis an údarás sláintíochta san—
(a) i gcás gan an duine sin do bheith cláruithe ach i dtaobh aon fhuirinne áitreabh amháin, go bhfuil scurtha ag an duine sin de ghnó reachtaire bhainne do bheith ar siúl aige sa bhfuirinn áitreabh san,
(b) i gcás an duine sin do bheith cláruithe i dtaobh dhá fhuireann áitreabh no níos mó, go bhfuil scurtha ag an duine sin de ghnó reachtaire bhainne do bheith ar siúl aige i ngach fuirinn áitreabh den tsort san.
(4) Fé réir forálacha an chéad fho-ailt ina dhiaidh seo, má bhíonn duine cláruithe, i dtaobh dhá fhuireann áitreabh no níos mó, sa chlár de reachtairí bainne bheidh á choimeád ag údarás sláintíochta féadfaidh an t-údarás sláintíochta san, más deimhin leo go bhfuil scurtha ag an duine sin de ghnó reachtaire bhainne do bheith ar siúl aige in aon fhuirinn áitreabh acu san, féadfaid tráth ar bith, d'éamais iarratais den tsórt san roimhráite, clárú an duine sin i dtaobh na fuirinne áitreabh go bhfuil scurtha aige den ghnó san do bheith ar siúl aige ionta do chur ar nea-mbrí.
(5) Sara ndéanfaidh údarás sláintíochta na comhachta bronntar ortha le fo-alt (3) no le fo-alt (4) den alt so d'fheidhmiú maidir le duine ar bith a bheidh cláruithe sa chlár de reachtairí bainne bheidh á choimeád acu seirbheálfaid fógra ceithre lá déag ar a laighead ar an duine sin á rá go bhfuilid ar intinn na comhachta san d'fheidhmiú.
Clárú do chur ar nea-mbrí i gcásanna eile.
28.—(1) Féadfaidh an t-údarás sláintíochta, uair amháin, ach ní níos mionca, sa bhliain, éileamh do sheirbheáil ar dhuine ar bith bheidh cláruithe sa chlár de reachtairí bainne bheidh á choimeád ag an údarás sláintíochta san á cheangal ar an duine sin, más mian leis leanúint de bheith cláruithe sa chlár san, fógra á rá gur mian leis leanúint de bheith cláruithe amhlaidh do chur chun an údaráis sláintíochta san roimh dheireadh na tréimhse (nách giorra ná mí o dháta seirbheála an éilimh sin) a bheidh luaidhte san éileamh san.
(2) Má thárlann do dhuine ar bith ar a seirbheálfaidh údarás sláintíochta éileamh fén alt so go dteipfidh air no go ndéanfaidh faillí maidir le fógra do chur chun an údaráis sláintíochta san roimh dheireadh na tréimhse bheidh luaidhte san éileamh san, á rá gur mian leis leanúint de bheith cláruithe sa chlár de reachtairí bainne bheidh á choimeád ag an údarás sláintíochta san, féadfaidh an t-údarás sláintíochta san clárú an duine sin sa chlár san do chur ar nea-mbrí.
A mbeidh i gcláir de reachtairí bainne do bheith ina fhianaise.
29.—(1) An clár de reachtairí bainne bheidh á choimeád ag údarás sláintíochta—
(a) tuigfear é bheith i gcoimeád ceart nuair a bheidh sé i gcoimeád oifigigh don údarás sláintíochta san a bheidh údaruithe chuige sin ag an údarás sláintíochta san, agus
(b) beidh sé ionghlactha i bhfianaise gan a thuilleadh cruthúnais ar é do thabhairt i láthair ón gcoimeád ceart.
(2) Féadfar fianaise prima facie i dtaobh aon iontrála sa chlár de reachtairí bainne bheidh á choimeád ag údarás sláintíochta do thabhairt in aon Chúirt no in aon imeachta dlí tré chóip den iontráil sin do thabhairt i láthair do bheireann le tuiscint í bheith deimhnithe mar chóip dhílis ag oifigeach don údarás sláintíochta san go n-údarás chuige sin, agus ní bheidh sé riachtanach sighniú an oifigigh sin do chruthú ná a cruthú gurbh é an t-oifigeach san é ná go raibh údarás aige amhlaidh.
(3) Beidh deimhniú do bheireann le tuiscint é bheith fé láimh oifigigh d'údarás sláintíochta go n-údarás chuige sin agus á rá ná raibh duine áirithe ar fead tráth áirithe cláruithe sa chlár de reachtairí bainne do bhí á choimeád ag an údarás sláintíochta san, beidh san, in aon imeachta dlí, ina fhianaise prima facie ar na fíora bheidh deimhnithe amhlaidh, agus ní bheidh sé riachtanach sighniú an oifigigh sin do chruthú ná a chruthú gurbh é an t-oifigeach san é ná go raibh údarás aige amhlaidh.
(4) Beidh deimhniú do bheireann le tuiscint é bheith fé láimh oifigigh d'údarás sláintíochta go n-údarás chuige sin agus á rá ná raibh áitreabh áirithe ar feadh trátha áirithe iontrálta sa chlár de reachtairí bainne do bhí á choimeád ag an údarás sláintíochta san, beidh san, in aon imeachta dlí ina fhianaise prima facie ar na fíora bheidh deimhnithe amhlaidh, agus ní bheidh sé riachtanach sighniú an oifigigh sin do chruthú ná a chruthú gurb é an t-oifigeach san é ná go raibh údarás aige amhlaidh.
CUID III.
Rialachain Maidir le Deirithe agus Bainne, agus le hAinmhithe do scrudu.
Reachtairí áirithe bainne agus déirithe áirithe do dhúnadh amach go sealadach o Chuid III.
30.—(1) Duine—
(a) a dhíolann bainne le daoine is dílseánaigh chláruithe, do réir bhrí na nAchtanna Tora Talmhaíochta, 1924 go 1934, ar áitreibh atá cláruithe fé sna hAchtanna san agus is sealbhóirí ar cheadúnaisí ainme speisialta ar n-a ndeonadh fé Chuid IV den Acht so, agus
(b) ná díolann bainne le daoine ar bith eile, tuigfear chun crícheanna na Coda so den Acht so gan gnó reachtaire bhainne do bheith ar siúl aige, agus tuigfear chun crícheanna na Coda so den Acht so nách déirí áitreabh an duine sin.
(2) Féadfaidh an tAire, le toiliú an Aire Talmhaíochta, ordú do dhéanamh tráth ar bith á dhearbhú go scuirfidh fo-alt (1) den alt so de bheith i bhfeidhm ar dháta áirithe agus dá éis sin agus leis sin scuirfidh an fo-alt san (1) de bheith i bhfeidhm ar an dáta san agus dá éis sin.
Rialacháin maidir le déirithe agus bainne.
31.—(1) Féadfaidh an tAire o am go ham, le hordú, rialacháin do dhéanamh i dtaobh gach ní no éinní acu so leanas:—
(a) déirithe do dhéanamh;
(b) soillsiú, aeriú, dréineáil agus soláthar uisce déirithe;
(c) glanadh déirithe, agus árthaighe, meaisíní, no feithiclí a húsáidtear maidir le gnó reachtaire bhainne agus an réamh-chúram a bheidh le déanamh chun a chur in áirithe go mbeid glan;
(d) an réamh-chúram a bheidh le déanamh chun bainne do chosaint ar thruailliú no ar shíol ghalair do dhul isteach ann;
(e) an tslí ina ndéanfar bainne d'fhuaradh;
(f) bainne d'iompar agus do thabhairt amach;
(g) duillíní, marcanna no comharthaí aitheantais do chur ar ghabhadáin do bhainne;
(h) an tslí ina ndúnfar gabhadáin a húsáidtear chun bainne d'iompar no do sheachadadh;
(i) ainmhithe do chrudhadh agus na háruistí agus na meaisíní a húsáidfear chuige sin;
(j) cigireacht do dhéanamh ar dhéirithe, agus ar árthaighe, ar mheaisíní agus ar fheithiclí a húsáidtear maidir le gnó reachtaire bhainne, agus ar dhaoine go mbíonn cead dul isteach i ndéirithe acu no teacht acu ar na hárthaighe, na meaisíní no na feithiclí sin;
(k) na daoine dhéanfaidh an chigireacht san;
agus féadfaidh na rialacháin sin bheith ina rialacháin speisialta no ina rialacháin ghenerálta agus féadfar iad do dhéanamh i dtaobh Shaorstáit Éireann ar fad no i dtaobh aon choda áirithe dhe.
(2) Cialluíonn an focal “bainne” i ngach áit ina n-úsáidtear é san alt so bainne a beifear ar intinn a dhíol no bheidh á dhíol.
(3) Is le haontú an Aire Talmhaíochta déanfar gach rialachán fén alt so.
(4) Má dheineann duine ar bith éinní contrárdha d'aon rialachán no má theipeann air déanamh do réir aon rialacháin a déanfar fén alt so beidh an duine sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar cúig púint do chur air másé an chéad chionta fén alt so aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar caoga púnt, agus i gceachtar cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar dachad scilling in aghaidh gach lae leanfaidh an cionta.
(5) Féadfaidh an t-údarás sláintíochta gur laistigh dá gceanntar sláintíochta do rinneadh cionta fén alt so, no féadfar ar agra an údaráis sin mar chúisitheoir, an cionta san do chúiseamh.

32.—(1) Féadfaidh an tAire, le haontú an Aire Talmhaíochta, féadfaidh, o am go ham le hordú, rialacháin do dhéanamh á thoirmeasc aon bhainne, bheidh téighte go dtí teas is aoirde ná an teas a luadhfar sna rialacháin sin no bheidh pasteurálta, do dhíol ach amháin fé ainm speisialta, do réir bhrí Coda IV den Acht so, agus fé réim agus do réir cheadúnais ainme speisialta ar n-a dheonadh fén gCuid sin IV.
(2) Má dheineann duine ar bith éinní contrárdha d'aon rialachán a déanfar fén alt so beidh an duine sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar cúig púint do chur air másé an chéad chionta fén alt so aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar caoga púnt agus i gceachtar cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar dachad scilling in aghaidh gach lae leanfaidh an cionta.
(3) Féadfaidh an t-údarás sláintíochta gur laistigh dá gceanntar sláintíochta do rinneadh cionta fén alt so, no féadfar ar agra an údaráis sin mar chúisitheoir, an cionta san do chúiseamh.
Toirmeasc ar bhainne do dhíol ach amháin fé ainm speisialta.
33.—(1) Féadfaidh an tAire, ar iarratas an údaráis sláintíochta do cheanntar sláintíochta, féadfaidh o am go ham le hordú fén bhfo-alt so, más ceanntar sláintíochta baile do réir bhrí na nAchtanna Sláinte Puiblí, 1878 go 1931, an ceanntar san, a thoirmeasc bainne do dhíol sa cheanntar san no, más ceanntar sláintíochta tuatha do réir bhrí na nAchtanna san an ceanntar san, sa cheanntar san no i gcuid áirithe dhe (do réir mar a luadhfar san ordú san) mara ndíoltar an bainne sin fé ainm speisialta do réir bhrí Coda IV den Acht so.
(2) I gcás ordú do bheith déanta fén bhfo-alt deiridh sin roimhe seo i dtaobh aon cheanntair sláintíochta no i dtaobh coda den chéanna féadfaidh an tAire, ar iarratas an údaráis sláintíochta don cheanntar sláintíochta san, féadfaidh, le hordú fén bhfo-alt so, an t-ordú san a céad-luaidhtear do cheiliúradh.
(3) Beidh éifeacht ag na forálacha so leanas maidir le hiarratas o údarás sláintíochta ag lorg orduithe fén alt so, sé sin le rá:—
(a) sara ndeinidh an t-údarás sláintíochta san an t-iarratas san bhéarfaid uatha an fógra puiblí sin a bheidh orduithe á rá go bhfuilid ar intinn an t-iarratas san do dhéanamh;
(b) beidh déanamh an iarratais sin—
(i) i gcás contae-bhuirge Bhaile Atha Cliath no buirge Dhún Laoghaire, ina fheidhm fhorcoimeádtha chun crícheanna an Achta Rialtais Áitiúla (Baile Atha Cliath), 1930 (Uimh. 27 de 1930), agus
(ii) i gcás contae-bhuirge Chorcaighe, ina fheidhm fhorcoimeádtha chun crícheanna Achta Bainistí Chathair Chorcaighe, 1929 (Uimh. 1 de 1929), agus
(iii) i gcás contae-bhuirge Luimnigh, ina fheidhm fhorcoimeádtha chun crícheanna Achta Bainistí Chathair Luimnigh, 1934 (Uimh. 35 de 1934).
(4) Má dheineann duine ar bith éinní contrárdha d'aon ordú déanfar fé fho-alt (1) den alt so agus a bheidh i bhfeidhm de thurus na huaire beidh an duine sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar cúig púint do chur air másé an chéad chionta fén alt so aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar caoga púnt agus i gceachtar cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar dachad scilling in aghaidh gach lae leanfaidh an cionta.

Cigireacht ar ainmhithe.
34.—(1) Féadfaidh an tAire o am go ham, le hordú, rialacháin do dhéanamh i dtaobh máinliagha beithíoch oifigiúil no máinliagha beithíoch cláruithe eile do dhéanamh cigireachta ar ainmhithe i ndéirithe.
(2) Féadfaidh rialacháin fén alt so a údarú don duine bheidh ag déanamh na cigireachta samplaí no abhar do thógaint o ainmhí ar bith chun a scrúduithe agus a éileamh go gcrúdhfaí ainmhí ar bith ina fhianaise agus samplaí den bhainne do thógaint agus a éileamh go gcoimeádfaí ar leithligh an bainne as aon tsine áirithe agus samplaí ar leithligh den bhainne sin do thógaint.
(3) Is le haontú an Aire Talmhaíochta déanfar gach rialachán fén alt so.
(4) Má dheineann duine ar bith éinní contrárdha d'aon rialachán no má theipeann air déanamh do réir aon rialacháin a déanfar fén alt so beidh an duine sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar cúig púint do chur air másé an chéad chionta fén alt so aige é agus másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar caoga púnt agus i gceachtar cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar dachad scilling in aghaidh gach lae leanfaidh an cionta.
(5) Féadfaidh an t-údarás sláintíochta gur laistigh dá gceanntar sláintíochta do rinneadh cionta fén alt so, no féadfar ar agra an údaráis sin mar chúisitheoir, an cionta san do chúiseamh.
CUID IV.
Bainne do dhiol fe Ainmneacha Speisialta.
Ceadúnaisí ainme speisialta.
35.—(1) Féadfaidh an tAire, le rialacháin a dhéanfa sé fén alt so, a ordú cadiad na hainmneacha féadfar d'úsáid maidir le bainne díolfar no tairgfear no taisbeánfar chun a dhíolta agus déanfar tagairtí sa Chuid seo den Acht so do “ainm speisialta” do léiriú mar thagairtí d'ainm a bheidh orduithe le rialacháin a déanfar fén alt so agus a bheidh i bhfeidhm de thurus na huaire.
(2) Pé uair a dhéanfaidh an tAire rialacháin fén bhfo-alt deiridh sin roimhe seo ag ordú ainme speisialta féadfaidh, leis na rialacháin sin no le rialacháin ina dhiaidh sin, socrú do dhéanamh i dtaobh gach ní no éinní acu so leanas, sé sin le rá:—
(a) ceadúnaisí (dá ngairmtear ceadúnaisí ainme speisialta sa Chuid seo den Acht so) do dheonadh chun bainne do dhíol fén ainm speisialta san;
(b) na húdaráis (ar a n-áirmhítear an tAire) a dheonfaidh na ceadúnaisí sin;
(c) fuirm na gceadúnas san;
(d) na daoine dá bhféadfar na ceadúnaisí sin do dheonadh;
(e) ré na gceadúnas san;
(f) na coinníollacha nách foláir a chólíonadh sara ndeonfar na ceadúnaisí sin;
(g) na téarmaí agus na coinníollacha (ar a n-áirmhítear ceiliúradh agus cur-ar-fiunraoi) gur fé n-a réir a bheidh na ceadúnaisí sin le deonadh;
(h) pé nithe eile maidir leis na ceadúnaisí sin gur dóich leis an Aire gur ceart socrú do dhéanamh ina dtaobh.
(3) Is le haontú an Aire Talmhaíochta a déanfar gach rialachán fén alt so.

36.—(1) Íocfaidh an t-iarratasóir, alos gach ceadúnais ainme speisialta, an táille orduithe leis an údarás do thug amach an ceadúnas san.

37.—(1) Ní bheidh sé dleathach do dhuine ar bith—
(a) aon bhainne do dhíol no do thairiscint no do thaisbeáint chun a dhíolta fé aon ainm speisialta, ná
(b) aon bhainne do thuairisciú no tagairt do fé ainm speisialta le linn no i dtaobh an bhainne sin do dhíol no do thairiscint chun a dhíolta no le linn no i dtaobh aon iarrachta ar é dhíol no in aon fhógrán, cearcalán no fógra i dtaobh bainne,
maran sealbhóir an duine sin ar cheadúnas ainme speisialta bheidh i bhfeidhm de thurus na huaire chun bainne do dhíol fén ainm speisialta san.
(2) Má dheineann duine ar bith éinní contrárdha don alt so beidh an duine sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar cúig púint do chur air másé an chéad chionta fén alt so aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar caoga púnt agus i gceachtar cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar dachad scilling in aghaidh gach lae leanfaidh an cionta.
(3) Féadfar cionta fén alt so do chúiseamh ag an Aire no ag an údarás sláintíochta gur laistigh dá gceanntar sláintíochta do rinneadh an cionta.

38.—(1) Féadfaidh an tAire, tar éis do dul i gcomhairle leis an Aire Talmhaíochta, rialacháin do dhéanamh fén alt so á ordú cadiad na focail no na comharthaí tuairiscithe féadfar d'úsáid, gan ceadúnas ainme speisialta d'fháil, maidir le bainne bheidh á thairiscint no á thaisbeáint chun a dhíolta, agus déanfar tagairtí san alt so do “ainm ghenerálta” do léiriú mar thagairtí d'fhocail agus do chomharthaí beidh orduithe le rialacháin a déanfar fén alt so agus a bheidh i bhfeidhm de thurus na huaire.
(2) Ní bheidh sé dleathach do dhuine ar bith úsáid do dhéanamh in aon fhógrán no cearcalán no fógra maidir le bainne bheidh á thairiscint no á thaisbeáint chun a dhíolta, no ar shlí eile maidir leis an gcéanna, d'aon fhocail no comharthaí nách ainm speisialta ná ainm ghenerálta agus a chuirfidh in úil no bheidh beartuithe chun a chur in úil gur de cháilíocht áirithe an bainne no gur hullamhuíodh é i slí áirithe no go bhfuil sé oiriúnach chun críche áirithe.

39.—Má bhíonn duine ina shealbhóir ar cheadúnas ainme speisialta ar n-a dheonadh ag an Aire féadfaidh an t-údarás sláintíochta don cheanntar sláintíochta ina mbíonn gnó mar sholáthróir bainne ar siúl ag an duine sin, féadfaid, tráth ar bith, agus déanfaid, pé uair iarrfaidh an tAire san ortha, a fháil amach an bhfuil na téarmaí agus na coinníollacha, ar ar deonadh an ceadúnas san á gcóilíonadh agus an toradh a thuairisciú don Aire.
CUID V.
Galar do chosc is baolach a thoicfadh as Bainne Galruithe.
Galair le n-a mbaineann Cuid V.
40.—(1) Baineann an Chuid seo den Acht so—
(a) le gach galar acu so leanas, sé sin le rá, eitinn, fiabhras breac, seach-fhiabhras breac, diftéar, craos-ghalar scannánach agus fiabhras dearg, agus
(b) le gach galar eile dearbhófar o am go ham le hordú ar n-a dhéanamh fén alt so agus a bheidh i bhfeidhm de thurus na huaire do bheith ina ghalar le n-a mbaineann an Chuid seo den Acht so.
(2) Féadfaidh an tAire o am go ham le hordú ar n-a dhéanamh fén alt so—
(a) a dhearbhú aon ghalar (is galar is dóich leis an Aire is baolach a thiocfadh as bainne galruithe no truaillithe) do bheith ina ghalar le n-a mbaineann an Chuid seo den Acht so;
(b) aon ordú do cheiliúradh a bheidh déanta aige roimhe sin fén alt so.
(3) Is le haontú an Aire Talmhaíochta déanfar gach ordú déanfar fén alt so.
(4) Gach ordú déanfar fén alt so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis an orduithe sin do dhéanamh agus má dheineann ceachtar Tigh den Oireachtas laistigh den lá is fiche shuidhfidh an Tigh sin tar éis an orduithe sin do leagadh fé n-a bhráid rún do rith ag cur an orduithe sin ar neambrí beidh an t-ordú san curtha ar nea-mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén ordú san.

41.—(1) Má bhíonn cúis ag dochtúir oifigiúil ceanntair shláintíochta chun amhrais do bheith aige aon ghalar le n-a mbaineann an Chuid seo den Acht so do theacht, no gur baolach é do theacht, as aon bhainne do chaitheamh atá á thaisbeáint no á choimeád chun a dhíolta laistigh den cheanntar sláintíochta san, gheobhaidh amach ionad an déirí ina bhfuil an t-ainmhí no na hainmhithe o n-a bhfuarthas an bainne sin á choimeád no á gcoimeád, agus leis sin beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) más laistigh den cheanntar sláintíochta san a bheidh an déirí sin scrúdóidh sé an déirí agus, más oiriúnach leis é, duine ar bith a bheidh ag gabháil d'obair an déirí sin no bheidh ina chomhnaí sa déirí no bheidh ina chomhnaí in aon áitreabh ina mbeidh duine ar bith bheidh ar fostú sa déirí sin ina chomhnaí, agus, más gá é, cuirfidh mar cheangal ar an máinliagh beithíoch oifigiúil dul ina theanta agus na hainmhithe sa déirí sin do scrúdú, agus
(b) más i gceanntar sláintíochta eile bheidh an déirí sin déanfa sé láithreach, ar an slí is tapúla bheidh ar fáil, fíora an cháis agus ionad an déirí sin do chur in úil don dochtúir oifigiúil don cheanntar sláintíochta eile sin agus leis sin déanfaidh an dochtúir oifigiúil don cheanntar sláintíochta eile sin na nithe seo leanas, sé sin le rá:—
(i) scrúdóidh sé an déirí agus, más oiriúnach leis é, duine ar bith a bheidh ag gabháil d'obair an déirí sin no bheidh ina chomhnaí sa déirí no bheidh ina chomhnaí in aon áitreabh ina mbeidh duine ar bith ar fostú sa déirí sin ina chomhnaí agus, más gá é, cuirfidh mar cheangal ar an máinliagh beithíoch oifigiúil dul ina theanta agus na hainmhithe sa déirí sin do scrúdú, agus
(ii) déanfaidh toradh an scrúduithe sin agus éinní do rinne sé fén gcéad fho-alt ina dhiaidh seo do thuairisciú don údarás sláintíochta dar dochtúir oifigiúil é agus don dochtúir oifigiúil o n-a bhfuarthas an t-eolas san.
(2) Más deimhin leis an dochtúir oifigiúil do cheanntar sláintíochta, bheidh tar éis déirí do scrúdú do réir an fho-ailt deiridh sin roimhe seo, más deimhin leis de bharr an scrúduithe sin aon ghalar le n-a mbaineann an Chuid seo den Acht so do theacht no gur baolach é do theacht as bainne do chaitheamh a soláthruítear ón déirí sin féadfaidh ordú (dá ngairmtear ordú toirmisc san alt so) do dhéanamh á thoirmeasc ar an reachtaire bainne, ar fad no mara ndeintear do réir pé coinníollacha is oiriúnach leis an dochtúir oifigiúil sin a chur san ordú san, aon bhainne as an déirí sin no o aon ainmhí no ainmhithe áirithe ann do dhíol no leigint d'aon duine eile é do dhíol faid a bheidh an t-ordú san i bhfeidhm.
(3) Beidh gach ordú toirmisc sa bhfuirm orduithe agus luadhfar ann na forais ar a ndearnadh an t-ordú san.
(4) Pé uair a déanfar ordú toirmisc déanfaidh an dochtúir oifigiúil na nithe seo leanas, sé sin le rá:—
(a) cóip den ordú san do sheirbheáil ar an duine gur ina thaobh a rinneadh é, agus
(b) cóip den ordú san maraon le haon tuarasgabhála máinliaghachta agus bactéarlaíochta bheidh faighte aige do chur chun an údaráis sláintíochta darb oifigeach é agus chun an Aire.
(5) Tiocfaidh gach ordú toirmisc i bhfeidhm díreach ar é do sheirbheáil ar an duine gur ina thaobh a rinneadh é agus leanfaid i bhfeidhm mara ndeintear agus go dtí go ndéanfar é do tharrac siar no é do chur ar nea-mbrí fén alt so.
(6) Más deimhin le dochtúir oifigiúil ag á mbeidh ordú toirmisc déanta nách baolach a thuilleadh galar le n-a mbaineann an Chuid seo den Acht so do theacht as an mbainne le n-a mbaineann an t-ordú san déanfaidh láithreach tré fhógra i scríbhinn do sheirbheáil ar an duine gur ina thaobh do rinneadh an t-ordú san an t-ordú toirmisc sin do tharrac siar agus beidh éifeacht ag an tarrac siar san o dháta na seirbheála san.
(7) Má ghoilleann sé ar reachtaire bhainne ordú toirmisc do dhéanamh no do leanúint i bhfeidhm féadfaidh an reachtaire bainne sin athchomharc do dhéanamh chun na Cúirte Dúithche sa tslí orduithe.
(8) Beidh éifeacht ag na forálacha so leanas maidir le hathchomharc fén bhfo-alt deiridh sin roimhe seo, sé sin le rá:—
(a) ar an athchomharc san d'éisteacht féadfaidh an Chúirt Dúithche an t-ordú toirmisc is abhar don athchomharc san do dhaingniú, d'atharú no do chur ar nea-mbrí agus féadfaidh a ordú cé leis go n-íocfar agus cé íocfaidh costaisí an athchomhairc;
(b) ar an athchomharc san d'éisteacht cinnfidh an chúirt agus déarfaidh ce'ca do rinneadh an t-ordú toirmisc is abhar don athchomharc san de dheascaibh teipe no faillí an athchomharcaigh no aon duine bhí, díreach roimh an ordú san do dhéanamh, ina fhostaí ag an athchomharcach no ná dearnadh, no ce'ca rinneadh faillí no diúltú go mí-réasúnta maidir leis an ordú san do tharrac siar no ná dearnadh, agus ní bheidh dul thar an gcinneadh sin,
(c) ní luighfidh aon athchomharc chun na Cúirte Cuarda fé alt 84 den Acht Cúirteanna Breithiúnais, 1924 (Uimh. 10 de 1924).
(9) Má deintear ordú toirmisc i gcoinnibh reachtaire bhainne—
(a) beidh an reachtaire bainne sin i dteideal cúiteamh iomlán do bhaint den údarás sláintíochta in aon chaillteanas no damáiste do thárla dho mar gheall ar an ordú do dhéanamh, maran de dheascaibh a theipe no a fhaillí féin no de dheascaibh teipe no faillí duine ar bith dob' fhostaí don reachtaire bhainne sin díreach roimh an ordú san do dhéanamh do rinneadh an t-ordú san;
(b) beidh gach duine, dob' fhostaí don reachtaire bhainne sin díreach roimh an ordú san do dhéanamh, i dteideal cúiteamh iomlán do bhaint den údarás sláintíochta in aon chaillteanas no damáiste do thárla dho mar gheall ar an ordú do dhéanamh maran de dheascaibh aon teipe no faillí ina pháirt féin no i bpáirt an reachtaire bhainne sin do rinneadh an t-ordú san;
(c) beidh an reachtaire bainne sin, agus gach duine dob' fhostaí don reachtaire bhainne sin díreach roimh an ordú san do dhéanamh, i dteideal cúiteamh iomlán do bhaint den údarás sláintíochta in aon damáiste no caillteanas a thárlóidh do de dheascaibh aon fhaillí no diúltuithe mhíréasúnta i bpáirt an dochtúra oifigiúla don údarás sláintíochta san maidir leis an ordú san do tharrac siar.
(10) Beidh éifeacht ag na forálacha so leanas maidir le cúiteamh do bhaint amach fén bhfo-alt san roimhe seo, sé sin le rá:—
(a) fé réir forálacha na céad míre ina dhiaidh seo déanfar aon aighneas, i dtaobh aon damáiste no cailllteanais do thárlachtaint no i dtaobh méide an chúitimh, do shocrú tré eadrascán sa tslí foráltar leis an Public Health (Ireland) Act, 1878, agus féadfar aon tsuim a molfar mar chúiteamh do bhaint amach mar fhiacha gháthchonnnartha i gcúirt dlighinse inniúla;
(b) maran mó ná cúig púint fhichead an cúiteamh a bheidh á éileamh féadfar, más rogha san leis an té bheidh ag éileamh an chúitimh sin, imeachta chun an chéanna do bhaint amach do bhunú sa Chúirt Dúithche.
(11) Pé uair a bheidh ordú toirmisc i bhfeidhm ní luighfidh aicsean mar gheall ar bhriseadh connartha i gcoinnibh reachtaire bhainne másé an t-ordú san fé ndeár an briseadh.
(12) Má thárlann do reachtaire bhainne ar bith go mbeidh ordú toirmisc i bhfeidhm ina thaobh de thurus na huaire go dteipfidh air no go ndéanfaidh faillí no diúltú maidir le déanamh do réir an orduithe sin beidh an reachtaire bainne sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar caoga púnt do chur air másé an chéad chionta fén alt so aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar céad púnt no príosúntacht ar feadh téarma ar bith nách sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile agus i gceachtar cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar cúig púint in aghaidh gach lae leanfaidh an cionta.
(13) Féadfar imeachta i dtaobh cionta fén alt so do bhunú os cóir Breithimh den Chúirt Dúithche go ndlighinse sa cheanntar sláintíochta ina ndearnadh an cionta no sa cheanntar sláintíochta ina mbeidh an déirí le n-a mbaineann an t-ordú toirmisc, agus féadfaidh an dochtúir oifigiúil do cheachtar ceanntar sláintíochta acu san no aon oifigeach go n-údarás chuige sin ón údarás sláintíochta do cheachtar ceanntar acu san na himeachta san do bhunú.

42.—(1) Má dhíolann reachtaire bainne ar bith bainne ina mbeidh síol galair le n-a mbaineann an Chuid seo den Acht so agus má cruthuítear gurbh eol do roimh ré no go bhféadfadh sé ach gnáth-aire do thabhairt a fháil amach go raibh an bainne sin galruithe amhlaidh, beidh an reachtaire bainne sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar caoga púnt do chur air másé an chéad chionta fén alt so aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar céad púnt no príosúntacht ar feadh tearma ar bith nách sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile agus i gceachtar cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar cúig púint in aghaidh gach lae leanfaidh an cionta.
(2) Féadfar an cionta fén alt so do chúiseamh ag an údarás sláintíochta gur laistigh dá gceanntar sláintíochta do galruíodh an bainne no ag an údarás sláintíochta gur laistigh dá gceanntar sláintíochta do rinneadh an cionta.
Fostaí dá fhailliú a chur in úil do reachtaire bhainne i dtaobh síol galair do theacht i mbainne.
43.—Más rud é—
(a) go dtiocfaidh síol galair le n-a mbaineann an Chuid seo den Acht so in aon bhainne bheidh á choimeád ag reachtaire bainne chun é dhíol, agus
(b) gurbh eol d'aon duine bhí, faid a bhí an bainne sin á choimeád amhlaidh ag an reachtaire bainne sin, ar fostú ag an reachtaire bainne sin chun crícheanna a ghnótha mar reachtaire bhainne no go raibh cúis réasúnta aige chun bheith amhrasach go dtáinig síol galair sa bhainne sin, agus
(c) go dteipfidh ar an duine sin no go bhfáilleoidh sé an t-eolas san no an chúis amhrais sin do chur in úil don reachtaire bhainne sin láithreach,
beidh an duine sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar cúig púint do chur air másé an chéad chionta fén alt so aige é agus másé an dara cionta no aon chionta ina dhiaidh sin aige é, fíneáil na raghaidh thar caoga púnt no príosúntacht ar feadh téarma ar bith nach sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile.

44.—(1) Má dhíolann reachtaire bainne bainne go raibh teacht air ag duine ar bith ar a mbeidh galar le n-a mbaineann an Chuid seo den Acht so no do bhí i mbealach galar den tsórt san do thógaint agus má cruthuítear gurbh eol do roimh ré no go bhféadfadh sé ach gnáth-aire do thabhairt a fháil amach go raibh an galar san ar an duine sin no go raibh sé i mbealach é thógaint, beidh an reachtaire bainne sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar cúig púint do chur air másé an chéad chionta fén alt so aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar caoga púnt no príosúntacht ar feadh téarma ar bith nách sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile agus i gceachtear cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar dachad scilling in aghaidh gach lae leanfaidh an cionta.
(2) Féadfar cionta fén alt so do chúiseamh ag an údarás sláintíochta gur laistigh dá gceanntar sláintíochta do bhí an bainne i mbealach a ghalruithe no ag an údarás sláintíochta gur laistigh dá gceanntar sláintíochta do rinneadh an cionta.
Toirmeasc ar theacht do bheith ar bhainne ag daoine galruithe.
45.—(1) Má thárlann do dhuine ar bith, ar a mbeidh galar le n-a mbaineann an Chuid seo den Acht so, teacht do bheith aige, le linn an ghalair sin do bheith air, ar bhainne i ndéirí, beidh an duine sin ciontach i gcionta fén alt so mara gcruthuighe sé chun sástachta na Cúirte (i) ná raibh a fhios aige no ná féadfadh sé agus aire réasúnta thabhairt a fhios a bheith aige go raibh an galar san air, no (ii) go ndearna sé, roimh theacht do bheith aige ar an mbainne sin, a chur in úil d'únaer an déirí sin go raibh an galar san air.
(2) Má thárlann do dhuine ar bith, do bhí i mbealach galar le n-a mbaineann an Chuid seo den Acht so do thógaint, teacht do bheith aige ar bhainne i ndéirí laistigh de cheithre lá déag tar éis dó bheith i mbealach an galar san do thógaint, beidh an duine sin ciontach i gcionta fén alt so mara gcruthuighe sé chun sástachta na Cúirte (i) ná raibh a fhios aige no ná féadfadh sé agus aire réasúnta do thabhairt a fhios a bheith aige go raibh sé i mbealach an galar san do thógaint no (ii) go ndearna sé, roimh theacht do bheith aige ar an mbainne sin, a chur in úil d'únaer an déirí sin go raibh sé i mbealach an galar san do thógaint.
(3) Má thárlann do dhuine ar bith, a chomhnuíonn in aon tigh le duine (dá ngairmtear an duine galruithe sa bhfo-alt so) ar ar tháinig galar le n-a mbaineann an Chuid seo den Acht so, teacht do bheith aige ar bhainne i ndéirí le linn an ghalair sin do bheith ar an duine galruithe, beidh an duine sin ciontach i gcionta fén alt so mara gcruthuighe sé chun sástachta na Cúirte (i) ná raibh a fhios aige no ná féadfadh sé agus aire réasúnta do thabhairt a fhios a bheith aige go raibh an galar san ar an duine galruithe no (ii) go ndearna sé, roimh theacht do bheith aige ar an mbainne sin, a chur in úil d'únaer an déirí sin gur chomhnuigh sé in aon tigh leis an duine galruithe agus go raibh an galar san ar an duine galruithe.
(4) Chun crícheanna an ailt seo tuigfear, maidir le duine ar a mbeidh galar le n-a mbaineann an Chuid seo den Acht so, an galar san do leanúint de bheith air go dtí go ndeimhneoidh dochtúir leighis cuibhe-cháilithe an duine sin do bheith saor ón ngalar san.
(5) Duine ar bith a bheidh ciontach i gcionta fén alt so dlighfear, ar a chiontú ann ar an slí achmair, fíneáil ná raghaidh thar cúig púint do chur air másé an chéad chionta fén alt so aige é agus másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar caoga púnt no príosúntacht ar feadh téarma ar bith nách sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile agus i gceachtar cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar dachad scilling in aghaidh gach lae leanfaidh an cionta.
(6) Féadfar cionta fén alt so do chúiseamh ag an údarás sláintíochta gur laistigh dá gceanntar sláintíochta do bhí an bainne i mbealach a ghalruithe no ag an údarás sláintíochta gur laistigh dá gceanntar sláintíochta do rinneadh an cionta.
Toirmeasc ar bhainne is deallrathach do bhí i mbealach a ghalruithe do dhíol gan fógra.
46.—(1) Má bhíonn galar le n-a mbaineann an Chuid seo den Acht so ar dhuine chomhnuíonn ar thalamh no in áitreabh ar bith ar a ndearnadh no ina ndearnadh aon bhainne do tháirgeadh no do choimeád no ar dhuine thaithíonn an talamh no an t-áitreabh san, beidh sé de dhualgas ar reachtaire bhainne fógra i scríbhinn ar fhíora iomlána an cháis do thabhairt, don dochtúir oifigiúil sláinte don cheanntar íclainne ina bhfuil an talamh no an t-áitreabh san, ceithre huaire fichead a' chluig ar a laighead roimh aon bhainne do táirgeadh no do coimeádadh san áitreabh san do dhíol agus má dhíolann an reachtaire bainne sin an bainne sin gan an fógra san do thabhairt uaidh no (ach amháin le cead an dochtúra oifigiúla san) roimh cheithre huaire fichead a' chluig do bheith caithte o am an fhógra san do thabhairt uaidh agus má cruthuítear gurbh eol do no go bhféadfadh sé ach gnáth-aire do thabhairt a fháil amach, roimh an gcur de láimh sin, go raibh an duine sin galruithe amhlaidh, beidh an reachtaire bainne sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar cúig púint do chur air másé an chéad chionta fén alt so aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar caoga púnt no príosúntacht ar feadh téarma ar bith nách sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile agus i gceachtar cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar dachad scilling in aghaidh gach lae leanfaidh an cionta.
(2) Féadfar cionta fén alt so do chúiseamh ag an údarás sláintíochta gur laistigh dá gceanntar sláintíochta do galruíodh an bainne no ag an údarás sláintíochta gur laistigh dá gceanntar sláintíochta do rinneadh an cionta.
CUID VI.
Bainne o Ainmhithe Galruithe do dhiol.

47.—(1) Baineann an Chuid seo den Acht so—
(a) le gach galar acu so leanas a bhíonn ar ainmhithe, sé sin le rá:—
eitinn an útha,
aon eitinn sa bhroinn,
aon tsaghas eitinne ina scaoiltear amach bacilli tubercle,
aon mhorgthacht sa bhroinn,
mastitis íogair,
mastitis gainsealach,
actinomycosis an últha,
anthrax,
galar coise agus béil,
brachadh an útha,
placenta nea-shlánuithe; agus
(b) le gach galar eile dearbhófar o am go ham le hordú ar n-a dhéanamh fén alt so agus a bheidh i bhfeidhm de thurus na huaire do bheith ina ghalar le n-a mbaineann an Chuid seo den Acht so.
(2) Féadfaidh an tAire o am go ham le hordú ar n-a dhéanamh fén alt so—
(a) a dhearbhú galar ar bith a bhíonn ar ainmhithe do bheith ina ghalar le n-a mhaineann an Chuid seo den Acht so;
(b) aon ordú do cheiliúradh a bheidh déanta aige roimhe sin fén alt so.
(3) Is le haontú an Aire Talmhaíochta déanfar gach ordú déanfar fén alt so.
(4) Gach ordú déanfar fén alt so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis an orduithe sin do dhéanamh agus má dheineann ceachtar Tigh den Oireachtas laistigh den lá is fiche shuidhfidh an Tigh sin tar éis an orduithe sin do leagadh fé n-a bhráid amhlaidh rún do rith ag cur an orduithe sin ar nea-mbrí beidh an t-ordú san curtha ar nea mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén ordú san.

48.—(1) Má dhíolann duine ar bith bainne aon ainmhí ar a mbeidh aon ghalar le n-a mbaineann an Chuid seo den Acht so agus má cruthuítear go raibh an duine sin tar éis fógra d'fháil roimhe sin o oifigeach don údarás sláintíochta á chur in úil do, no gurbh eol do ar shlí eile no go bhféadfadh sé ach gnáth-aire do thabhairt a fháil amach, go raibh an galar san ar an ainmhí sin, beidh an duine sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar caoga púnt do chur air másé an chéad chionta fén alt so aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar céad púnt no príosúntacht ar feadh téarma ar bith nách sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile agus i gceachtar cás, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar cúig púint in aghaidh gach lae leanfaidh an cionta.
(2) Féadfar cionta fén alt so do chúiseamh ag an údarás sláintíochta gur laistigh dá gceanntar sláintíochta bheidh an t-ainmhí á choimeád no ag an údarás sláintíochta gur laistigh dá gceanntar sláintíochta do rinneadh an cionta.
CUID VII.
Scrudu Baictearlaiochta ar Bhainne.
Scrúdóirí baictéarlaíochta do cheapadh.
49.—(1) Ceapfaidh an tAire daoine cáilithe o am go ham, pé daoine agus pé méid díobh is dóich leis is gá, chun bheith ina scrúdóirí baictéarlaíochta chun críche an Achta so agus beidh na daoine ceapfar amhlaidh i seilibh oifige faid is toil leis an Aire é.
(2) Pé uair a cheapfaidh an tAire duine ar bith chun bheith ina scrúdóir bhaictéarlaíochta déanfaidh fógra i dtaobh an cheapacháin sin d'fhoillsiú láithreach san Iris Oifigiúil agus beidh éifeacht ag an gceapachán san o dháta an fhógra san d'fhoillsiú.
(3) San Acht so cialluíonn an abairt “scrúdóir baictéarlaíochta” scrúdóir baictéarlaíochta ar n-a cheapadh ag an Aire fén alt so.
Táillí ar scrúdú bhaictéarlaíochta.
50.—Féadfaidh an tAire, le rialacháin ar n-a ndéanamh fén alt so, a ordú cadiad na táillí bheidh le n'ioc le scrúdóirí baictéarlaíochta as samplaí de bhainne cuirfear chúcha fén Acht so do scrúdú agus do thástáil agus féadfaidh leis na rialacháin sin táillí deifriúla d'ordú maidir le samplaí do scrúdú agus do thástáil chun crícheanna deifriúla agus maidir leis na tástála deifriúla bheidh le déanamh ar shamplaí cuirfear chun na scrúdóirí sin amhlaidh.

51.—(1) Féadfaidh an tAire agus gach údarás sláintíochta agus gach reachtaire bainne samplaí de bhainne do chur chun scrúdóra bhaictéarlaíochta chun iad do scrúdú agus do thástáil.
(2) Beidh i dteanta gach sampla de bhainne cuirfear chun scrúdóra bhaictéarlaíochta fén alt so iarratas i scríbhinn á iarraidh an scrúdú agus an tástáil áirithe bheidh ag teastáil do dhéanamh ar an sampla san agus, fé réir forálacha an chéad fho-ailt ina dhiaidh seo, beidh ina theanta freisin an táille orduithe as an scrúdú agus an tástáil sin do dhéanamh.
(3) Ní bheidh aon táille iníoctha alos aon tsampla de bhainne a dhéanfaidh an tAire fén alt so a chur, chun é do scrúdú agus do thástáil, chun scrúdóra bhaictéarlaíochta bheidh ar fostú i Stát-Sheirbhís Rialtais Shaorstáit Éireann.

52.—Déanfaidh gach scrúdóir baictéarlaíochta gach sampla de bhainne a cuirfear chuige do réir an Achta so do scrúdú agus do thástáil sa tslí orduithe agus, ar an scrúdú agus an tástáil sin do bheith críochnuithe, bhéarfaidh amach don té do chuir an sampla san chuige deimhniú (dá ngairmtear deimhniú baictéarlaíochta san Acht so) á rá cad ba thoradh don scrúdú agus don tástáil sin alos an tsampla san.
CUID VIII.
Comhachta chun Bainne do Shamplail.
Oifigigh shamplála bhainne.
53.—Beidh gach duine acu so leanas ina oifigeach shamplála bhainne chun crícheanna an Achta so, sé sin le rá:—
(a) cigire ar bith,
(b) aon dochtúir oifigiúil sláinte,
(c) aon oifigeach sláintíochta d'údarás sláintíochta bheidh ceaptha (le toiliú an Aire) ag an údarás sláintíochta san chun bheith ina oifigeach shamplála bhainne.
Comhacht chun samplaí de bhainne do thógaint.
54.—(1) Féadfaidh cigire, in áit ar bith, agus féadfaidh dochtúir oifigiúil sláinte no oifigeach sláintíochta is oifigeach samplála bainne, in áit ar bith laistigh den cheanntar sláintíochta dá ngníomhann an t-oifigeach san, sampla de bhainne do thógaint gan íoc as tráth ar bith roimh an mbainne sin do sheachadadh don chaithteoir.
(2) Duine ar bith dá n-údaruítear leis an alt so sampla de bhainne do thógaint féadfaidh, chun an sampla san do thógaint, aon ghabhadán ina mbeidh bainne d'oscailt agus éinní eile do dhéanamh is dóich leis is gá chuige sin.
(3) Gach sampla de bhainne (nách bainne bheidh i ngabhadáin dúnta chun é dhíol ina mhion-choda sna gabhadáin sin) a tógfar fén alt so tógfar é sa tslí orduithe agus beidh an méid orduithe ann.

55.—Nuair a bheidh na comhachta bronntar air leis an gCuid seo den Acht so á bhfeidhmiú ag oifigeach samplála in áitreabh dhuine ar bith 'na mbíonn gnó iompair earraí, de bhóthar no d'uisce no san aer, ar siúl aige déanfaidh do réir pé éilithe réasúnta ón duine sin is gá chun ná beadh cosc ná cur isteach ar oibriú an tráchta san áitreabh san.

56.—(1) Féadfaidh an dochtúir oifigiúil do cheanntar sláintíochta go mbeidh bainne o aon déirí lasmuich den cheanntar sláintíochta san á dhíol no á thaisbeáint chun a dhíolta laistigh de, no oifigeach ar bith eile go n-údarás chuige sin ón údarás sláintíochta don cheanntar san, féadfaidh, tré fhógra i scríbhinn (dá ngairmtear fógra samplála san Acht so), a cheangal ar an dochtúir oifigiúil don cheanntar sláintíochta, ina mbeidh an déirí sin no tré n-a mbeidh an bainne sin ag dul i gcúrsa a iompair ón déirí sin go dtí an ceanntar sláintíochta san, a chur fé ndeár d'oifigeach samplála samplaí den bhainne do thógaint sa déirí sin no i gcúrsa a iompair amhlaidh agus ar an bhfógra san d'fháil do cuirfidh an dochtúir oifigiúil sin is déanaí a luaidhtear fé ndeár na samplaí sin do thógaint dá réir sin.
(2) Aon chostaisí réasúnta fé n-a raghfar ag tógaint sampla de bhainne do réir fógra shamplála isé íocfaidh iad ná an t-údarás sláintíochta gurb é a n-oifigeach a thug an fógra san uaidh agus, cheal có-aontuithe, isé an tAire chinnfidh cadé méid na gcostaisí sin.
(3) Chun crícheanna aon imeachta fén Acht so, maidir le sampla de bhainne do tógadh do réir fógra shamplála, tuigfear an sampla san do thógaint lasmuich no laistigh, pe'ca is rogha leis an gcúisitheoir, de cheanntar an údaráis sláintíochta gurb é a n-oifigeach do thug an fógra san uaidh, agus dá réir sin féadfar imeachta fén Acht so do bhunú os cóir Breithimh den Chúirt Dúithche go ndlighinse laistigh den cheanntar san no os cóir Breithimh den Chúirt Dúithche go ndlighinse sa cheanntar gurb ann a tógadh an sampla san.

57.—(1) Pé uair a dhéanfaidh oifigeach samplála, i bhfeidhmiú na gcomhacht a bronntar air leis an gCuid seo den Acht so, sampla de bhainne (nách bainne bheidh i ngabhadáin dúnta chun é dhíol ina mhion-choda sna gabhadáin sin) do thógaint, ar shlí seachas do réir fógra shamplála, roinnfidh an sampla san ina dhá chuid agus cuirfidh gach cuid i mbuidéal fé leith agus marcálfaidh an buidéal san agus cuirfidh stopaide ann agus séalóidh é sa tslí orduithe agus déanfaidh ansan mar leanas, sé sin le rá:—
(a) i gcás an bhainne sin do bheith, nuair a tógadh é, fé n-a urláimh ag díoltóir no ag consighneoir an chéanna no ag á ghníomhaire, déanfaidh—
(i) má ceangailtear san air, ceann de sna buidéil sin do sheachadadh don díoltóir no don chonsighneoir no don ghníomhaire sin;
(ii) an buidéal eile do choiméad sa tslí orduithe agus, más oiriúnach leis é, é do chur sa tslí orduithe chun scrúdóra bhaictéarlaíochta chun a mbeidh ann do scrúdú;
(b) i gcás gan an bainne sin do bheith, nuair a tógadh amhlaidh é, fé n-a urláimh ag an díoltóir no ag an gconsighneoir no ag á ghníomhaire, déanfaidh—
(i) ceann de sna buidéil sin do chur ar aghaidh sa tslí orduithe chun an chonsighneora;
(ii) an buidéal eile do choimeád sa tslí orduithe agus, más oiriúnach leis é, é do chur sa tslí orduithe chun scrúdóra bhaictéarlaíochta chun a mbeidh ann do scrúdú.

(b) i gcás gan an bainne sin do bheith, nuair a tógadh amhlaidh é, fé n-a urláimh ag an díoltóir no ag an gconsighneoir no ag á ghníomhaire, déanfaidh—
(i) ceann de sna buidéil sin do chur ar aghaidh sa tslí orduithe chun an chonsighneora;
(ii) an buidéal eile do chur sa tslí orduithe chun an dochtúra oifigiúla do thug an fógra samplála san uaidh no, má iarrann an dochtúir oifigiúil sin amhlaidh sa bhfógra samplála san, an buidéal eile sin do chur sa tslí orduithe, thar ceann an dochtúra oifigiúla san, chun scrúdóra bhaictéarlaíochta chun a mbeidh ann do scrúdú.
(3) Ar bhuidéal ina mbeidh sampla de bhainne do tógadh do réir fógra shamplála d'fháil do féadfaidh an dochtúir oifigiúil, más oiriúnach leis é, an buidéal do chur sa tslí orduithe chun scrúdóra bhaictéarlaíochta chun a mbeidh ann do scrúdú.
(4) Beidh éifeacht ag na forálacha so leanas maidir le hoifigeach samplála do thógaint sampla de bhainne, i bhfeidhmiú na gcomhacht a bronntar air leis an gCuid seo den Acht so, is bainne bheidh i ngabhadáin dúnta chun é dhíol ina mhion-choda sna gabhadáin sin, sé sin le rá:—
(a) déanfaidh an t-oifigeach san ceann amháin de sna gabhadáin sin do thógaint mar an sampla san agus marcálfaidh sa tslí orduithe an gabhadán a thógfaidh amhlaidh;
(b) mara mbeidh an gabhadán san, nuair a tógfar é, fé n a urláimh ag díoltóir no ag consighneoir an chéanna no ag á ghníomhaire déanfaidh an t-oifigeach san fógra, á rá gur tógadh an gabhadán san, do sheachadadh don díoltóir no don chonsighneoir sin no do chur chuige tríd an bpost;
(c) maran do réir fógra shamplála do tógadh an gabhadán san coimeádfaidh an t-oifigeach san é agus, más oiriúnach leis é, cuirfidh é sa tslí orduithe chun scrúdóra bhaietéarlaíochta chun a mbeidh ann do scrúdú;
(d) más do réir fógra shamplála do tógadh an gabhadán san—
(i) i gcás ina ndéanfaidh an dochtúir oifigiúil do thug an fógra san uaidh a iarraidh amhlaidh sa bhfógra san, cuirfidh an t-oifigeach samplála san an gabhadán san sa tslí orduithe chun scrúdóra bhaictéarlaíochta chun a mbeidh ann do scrúdú;
(ii) i gcás ar bith eile, cuirfidh an t-oifigeach samplála san an gabhadán san sa tslí orduithe chun an dochtúra oifigiúla san agus féadfaidh seisean, más oiriúnach leis é, é chur sa tslí orduithe chun scrúdóra bhaictéarlaíochta chun a mbeidh ann do scrúdú.
(5) In aon imeachta fén Acht so beidh deimhniú bheireann le tuiscint é bheith fé láimh oifigigh shamplála do thóg sampla de bhainne do réir fógra shamplála agus á rá go ndearna sé do réir forálacha fo-ailt (2) no fo-ailt (4) (pe'ca fo-alt acu san a bhaineann leis an gcás) den alt so maidir leis an sampla san, beidh san ina fhianaise prima facie ar na nithe deimhnítear amhlaidh agus ní gá sighniú an oifigigh sin do chruthú ná a chruthú gurbh é an t-oifigeach san é.
CUID IX.
Foralacha Ilghneitheacha.
Deimhniú baictéarlaíochta do sheirbheáil agus do bheith ina fhianaise.
58.—Beidh éifeacht ag na forálacha so leanas maidir le himeachta fén Acht so i dtaobh sampla de bhainne do tógadh agus le n-ar deighleáladh fé réim agus do réir Coda VIII den Acht so, sé sin le rá:—
(a) más rud é go bhfuair an cúisitheoir no go bhfuarthas thar a cheann deimhniú baictéarlaíochta chun crícheanna na n-imeacht san, seirbheálfar cóip den deimhniú san ar an gcosantóir i dteanta na gairme;
(b) más rud é go mbeidh beartuithe ag an gcosantóir deimhniú baictéarlaíochta do thabhairt i láthair chun críche aon imeachta den tsórt san cuirfear cóip den deimhniú san go dtí an cúisitheoir trí lá glan ar a laighead roimh lá na freagartha, agus mara gcuirtear san chuige amhlaidh féadfaidh an Chúirt, más oiriúnach léi é, an éisteacht do chur siar ar pé téarmaí is dóich léi do bheith ceart;
(c) má dheineann ceachtar páirtí deimhniú baictéarlaíochta do thabhairt i láthair in aon imeachta den tsórt san, beidh san ina leor-fhianaise ar na fíora bheidh luaidhte sa deimhniú san mara n-éilídh an páirtí éile an scrúdóir baictéarlaíochta do thug an deimhniú san uaidh do ghairm mar fhínné.

59.—(1) Ní bheidh sé dleathach do dhuine ar bith aon bhainne bheidh truaillithe no salach do dhíol ná do thaisbeáint ná do thairiscint chun a dhíolta.
(2) Duine ar bith a dhéanfaidh éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar cúig púint do chur air másé an chéad chionta fén alt so aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin fén alt so aige é, fíneáil ná raghaidh thar caoga púnt no príosúntacht ar feadh téarma ar bith nách sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile.
(3) Aon bhainne ar a mbeidh blas colúil no o n-a mbeidh boladh colúil no ina bhfaighfear, ar é do thástáil in aon tslí orduithe, abhar colúil so-fheicse no líon bactéria in aghaidh na toirte aonaid is mó ná an líon orduithe, tuigfear chun crícheanna an ailt seo gur bainne truaillithe é.
(4) Féadfaidh an t-údarás sláintíochta gur laistigh dá gceanntar sláintíochta do rinneadh an bainne do dhíol no do thaisbeáint no do thairiscint chun a dhíolta cionta fén alt so do chúiseamh.
Bainne do dhíol in áiteanna puiblí.
60.—(1) Ní bheidh sé dleathach do dhuine ar bith bainne do dhíol ná do sheachadadh, é féin no tré n-a sheirbhíseach, le ceannuitheoir no dho, ar aon bhóthar mór ná in aon áit phuiblí, as feithicil no as canna no gabhadán eile mara mbeidh a ainm agus a sheoladh agus na focail “Bainne ar díol” no “Uachtar ar díol” no “Bláthach ar díol” (do réir mar bheidh) scríobhtha go so-fheicse ar an bhfeithicil no ar an gcanna no ar an ngabhadán san.
(2) Má dheineann duine ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar dhá phúnt do chur air.
(3) Má deintear bainne do dhíol no do sheachadadh thar ceann duine tuigfear chun crícheanna an ailt seo gurb é an duine sin, agus nách é an duine do dhíol no do sheachaid é dáiríribh, do dhíol no do sheachaid an bainne sin.

61.—(1) Féadfaidh an tAire le hordú, tar éis do dul i gcomhairle leis an Aire Talmhaíochta, rialacháin do dhéanamh fén alt so á chur mar cheangal go ndéanfar, sa tslí foráltar leis na rialacháin sin, duillín no marc do chur ar gach stán no gabhadán eile ina mbeidh bainne deighilte no bearrtha á dhíol no á thaisbeáint no á thairiscint chun a dhíolta.
(2) Má dheineann duine ar bith aon bhainne deighilte no bearrtha do dhíol no do thaisbeáint no do thairiscint chun a dhíolta in aon stán no gabhadán eile ná beidh marc no duillín curtha air sa tslí bheidh forálta le rialacháin ar n-a ndéanamh fén alt so beidh an duine sin ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar deich bpúint do chur air.
(3) Déanfar fo-alt (1) d'alt 1 den Public Health (Regulations as to Food) Act, 1907, mar a leasuitear san le halt 23 den Acht Rialtais Áitiúla, 1925 (Uimh. 5 de 1925), do léiriú agus beidh éifeacht aige fé is dá ndeintí na focail “skimmed or separated” atá anois i mír (d) den fho-alt san, mar a leasuítear san amhlaidh, d'fhágaint ar lár ann.

MILK AND DAIRIES ACT, 1935.
PART I.
Preliminary and General.
Short title.
1.—This Act may be cited as the Milk and Dairies Act, 1935.
Commencement of Act.
2.—This Act shall come into operation on such day or days as may be fixed therefor by any order or orders of the Minister for Local Government and Public Health, either generally or with reference to any particular purpose or provision, and different days may be so fixed for different purposes and different provisions of this Act.
“Milk.”
3.—(1) In this Act (except in Part IV thereof) the word “milk” means any article of food which is whole milk, skimmed or separated milk, cream or buttermilk.
(2) In Part IV of this Act the word “milk” means whole milk.
(3) In this section the expression “whole milk” means milk from which none of the constituents have been abstracted otherwise than as a result of any cleansing process (including pasteurisation or sterilisation) to which such milk has been subjected.
Presumption that milk sold, etc., is sold, etc., for human consumption in the form of milk.
4.—Where milk is sold, or exposed or kept for sale, it shall, unless and until the contrary is proved, be presumed, for the purposes of this Act, to be sold, exposed or kept for sale, for human consumption in the form of milk and in no other form.
Construction of references to sale of milk.
5.—References in the subsequent provisions of this Act to the sale of milk shall be construed as references to the sale of milk for human consumption in the form of milk and in no other form, and references in the said subsequent provisions to a seller of milk shall be construed accordingly.
Definitions.
6.—In this Act—
the expression “the Minister” means the Minister for Local Government and Public Health;
the expression “purveyor of milk” includes a person who is a seller of milk, whether wholesale or by retail;
the expression “dairy” includes (save where otherwise provided in this Act) any farm, farm house, cowshed, milk store, milk shop, or other place from which milk is supplied on or for sale, or in which milk is kept or used for purposes of sale, and, in the case of a purveyor of milk who does not occupy any premises for the sale of milk, includes the place where such purveyor keeps the vessels used by him for the sale of milk;
the expression “dairyman” includes (save where otherwise provided in this Act) a person who is the occupier of a dairy, or any purveyor of milk;
the expression “examination” includes chemical and bacteriological and protozoological examinations and tests and any other examination or test applied to milk for the purpose of detecting infection, contamination, impurity, or any other defects in the composition thereof;
the expression “sanitary district” means a sanitary district under the Public Health Acts, 1878 to 1931;
the expression “the sanitary authority” in relation to a sanitary district means the sanitary authority under the Public Health Acts, 1878 to 1931, for such sanitary district;
the expression “veterinary officer” in relation to a sanitary authority means a sanitary officer appointed by such sanitary, authority under section 11 of the Public Health (Ireland) Act, 1878, as amended by section 22 of the Local Government Act, 1925 (No. 5 of 1925);
the word “inspector” means any person authorised by the Minister in writing (either generally or for a special purpose) to exercise all or any of the powers and perform all or any of the duties conferred or imposed on an inspector under this Act; the word “animals” means cows or goats;
the word “prescribed” when used in relation to the District Court means prescribed by regulations made under this Act by the Minister for Justice and in every other case means prescribed by regulations made under this Act by the Minister.
Exclusion of certain dairies and dairymen.
7.—Where—
(a) surplus milk produced on a farm is occasionally sold to persons for consumption by such persons or their families, and
(b) the occupier of such farm does not in any one day sell more than one gallon of such milk, and
(c) the selling of milk does not form part of the ordinary business of such occupier,
then for the purposes of this Act, such farm shall be deemed not to be a dairy and such occupier shall be deemed not to be a dairyman and, for the purposes of the provisions of Part II of this Act relating to temporary exclusion of certain dairymen from Part II, and the provisions of Part III of this Act relating to temporary exclusion of certain dairies and dairymen from Part III, such milk shall be deemed not to have been sold to such persons.
“The medical officer.”
8.—(1) The expression “the medical officer” means—
(a) when used in relation to a sanitary district which is a county borough, the medical superintendent officer of health for such county borough or the person for the time being acting as such medical superintendent officer of health, and
(b) when used in relation to any other sanitary district, the county medical officer of health who acts for such district, or the person for the time being acting as such county medical officer of health.
(2) In the case of a dispensary district forming part of a sanitary district for which no medical officer within the meaning of the foregoing sub-section of this section is for the time being acting the following provisions shall have effect that is to say, so long as there is no such medical officer, the powers and duties which would be exercisable and performable under this Act by such medical officer, if there were in fact one, shall be exercised and performed within and in relation to such dispensary district by the medical officer of health of such dispensary district.
Presumption of sale of milk in certain cases.
9.—(1) Where milk is kept in a dairy, or in the custody or possession of any dairyman, it shall, unless and until the contrary is proved, be presumed for the purposes of this Act to be kept for the purposes of sale.
(2) Every person who offers or exposes milk for sale, or allows milk to be sold or offered or exposed for sale shall be deemed for the purposes of this Act to have sold such milk.
Miscellaneous matters of interpretation.
10.—(1) A dairyman shall be deemed for the purposes of this Act to carry on the business of a dairyman at every premises used by him for the purposes of his business as a dairyman.
(2) Where a person carrying on the business of a dairyman in a sanitary district does not occupy any premises in such sanitary district for the purposes of such business, every vehicle which such person uses for the purposes of such business shall be deemed for the purposes of this Act to be premises in such district.
(3) Where the terms of a contract of service provide that milk is to be supplied free by the employer to the employee, milk supplied by the employer to the employee under such contract shall be deemed for the purposes of this Act not to have been sold by the employer to the employee.
Enforcement of Act by sanitary authorities.
11.—(1) It shall be the duty of the sanitary authority to enforce the provisions of this Act and of every order and regulation made thereunder and to exercise the powers vested in them by this Act or such order or regulation.
(2) If a sanitary authority fail to perform any of their duties under this Act the Minister may make such order as he thinks necessary or proper for the purpose of compelling such authority to perform their duties and any such order may, without prejudice to the exercise of the powers conferred on the Minister by section 72 of the Local Government Act, 1925 (No. 5 of 1925), be enforced at the suit of the Minister by mandamus.
Appointment of officers by sanitary authorities.
12.—Any sanitary authority may, with the consent of the Minister, and subject to the provisions of any enactment relating to the appointment of officers by such authority, appoint such and so many officers as such authority shall consider requisite for the execution of the functions, powers and duties conferred or imposed by this Act, and every officer so appointed shall be paid such remuneration as the sanitary authority, with the consent of the Minister, shall determine.
Right of entry on premises.
13.—(1) Every officer of a sanitary authority and every inspector shall, for the purposes of enforcing the provisions of this Act and any orders and regulations made thereunder, be entitled to enter at all reasonable times any premises.
(2) If any person obstructs or impedes any officer of a sanitary authority or any inspector in exercise of the power conferred on such officer or inspector by this section, such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.
(3) Nothing in this section shall authorise any person, except with the permission of the local authority under the Diseases of Animals (Ireland) Acts, 1894 to 1934, to enter any cow-shed or other place in which an animal affected with any disease to which those Acts apply is kept and which is situated in a place declared under those Acts to be infected with such disease.
Public inquiries.
14.—(1) Whenever power is conferred on the Minister by this Act to make any order or regulation or to take any other action, the Minister may before exercising such power hold a public inquiry into the matter which is the subject of such exercise of such power.
(2) Article 32 of the Schedule to the Local Government (Application of Enactments) Order, 1898, shall apply in respect of every public inquiry held under this section in like manner as the said Article applies in respect of the local inquiries mentioned therein.
General regulations.
15.—(1) The Minister for Justice may by order make regulations prescribing any matter or thing relating to the District Court which is in this Act referred to as prescribed.
(2) The Minister may by order make regulations for all or any of the following purposes, that is to say:—
(a) prescribing any matter or thing which is in this Act referred to as prescribed and is not authorised by this Act to be prescribed by regulations made by the Minister for Justice;
(b) prescribing anything which the Minister is by any section of this Act authorised to prescribe by regulations made under such section.
(3) Any regulation made by the Minister under this Act in regard to fees shall be subject to the approval of the Minister for Finance.
Laying of regulations before Houses of the Oireachtas.
16.—Every regulation made under this Act shall be laid before each House of the Oireachtas as soon as may be after such regulation is made, and if a resolution annulling such regulation is passed by either House of the Oireachtas within the next subsequent twenty-one days on which that House has sat after such regulation is so laid before it such regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under such regulation.
Finance.
17.—(1) All expenses incurred by a Minister of State under this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
(2) The expenses of a sanitary authority incurred under this Act shall be raised and defrayed in the manner in which the expenses incurred by such sanitary authority under the Public Health Acts, 1878 to 1931, are raised and defrayed, and, in the case of the board of health of a county health district, shall be charged equally over the whole of such county health district.
(3) All expenses reasonably incurred by an officer of a sanitary authority in relation to any prosecution for an offence under this Act shall be refunded to him by the sanitary authority of the sanitary district in which such offence was committed.
Saving for other Acts relating to milk and dairies.
18.—Nothing in this Act shall prejudice or affect any other enactment for the time being in force relating to milk and dairies.
Repeals.
19.—The enactments mentioned in the Schedule to this Act are hereby repealed to the extent specified in the third column of the said Schedule.
PART II.
Registration of Dairymen and Dairies.
Temporary exclusion of certain dairymen from Part II.
20.—(1) A person—
(a) who sells milk to persons who are registered proprietors, within the meaning of the Dairy Produce Acts, 1924 to 1934, of premises registered under the said Acts, and who are holders of special designation licences granted under Part IV of this Act, and
(b) who sells milk to no other persons,
shall be deemed for the purposes of this Part of this Act not to carry on the business of dairyman.
(2) The Minister may, with the consent of the Minister for Agriculture, make at any time an order declaring that sub-section (1) of this section shall cease to be in force on and after a specified date and thereupon on and after such date the said sub-section (1) shall cease to be in force.
(3) A person who sells milk for consumption on the premises in which it is sold and not elsewhere shall be deemed for the purposes of this Part of this Act not to carry on the business of a dairyman.
Registers of dairymen.
21.—Every sanitary authority shall cause to be kept, in the prescribed form, a register, to be called and known as the register of dairymen, and there shall be registered in every such register the matters required by this Act to be registered therein and such other matters as may be prescribed.
Registration of dairymen.
22.—(1) Any person who proposes to carry on in the sanitary district of a sanitary authority the business of dairyman may apply to such authority to be registered in the register of dairymen kept by such authority.
(2) Every application to a sanitary authority under this section shall be in the prescribed form and shall state the address of the applicant and particulars of the premises where the applicant proposes to carry on the business of dairyman in the sanitary district of such authority and in respect of which the applicant seeks to be registered in the register of dairymen kept by such authority and such other particulars (if any) as may be prescribed.
(3) Upon receipt of an application under and in accordance with this section the sanitary authority shall, subject to the provisions of the next following section, cause to be registered in the register of dairymen kept by them—
(a) the name and address of the applicant, and
(b) particulars of the several premises specified in such application in respect of which the applicant seeks to be registered in the said register.
Refusal of registration of dairymen.
23.—(1) Where an application is made to a sanitary authority for registration in the register of dairymen kept by such authority, such authority, if they are satisfied that applicant is not a fit and proper person to carry on the business of a dairyman or that the premises in respect of which he seeks registration are not suitable, may by order (in this Part of this Act referred to as a refusal order)—
(a) refuse to register the applicant and the premises in respect of which the applicant seeks registration, or
(b) where the applicant requests registration in respect of several premises, register the applicant in respect of some of those premises but refuse to register the applicant in respect of the remainder of those premises.
(2) Every refusal order shall state the grounds on which the order is made.
(3) Where a sanitary authority makes in relation to an application a refusal order the following provisions shall have effect, that is to say:—
(a) the sanitary authority shall serve on the applicant a copy of such order;
(b) the sanitary authority shall send to the Minister a copy of such order;
(c) the applicant may within twenty-one days after the service of such copy appeal in the prescribed manner to the Minister against such refusal order;
(d) in the event of such appeal being duly made, the Minister shall, after considering the matter, make, as he thinks proper, either an order confirming such refusal order or an order directing the sanitary authority to register the appellant in the register of dairymen kept by them in accordance with the terms of the application or with such modifications as to the Minister may seem proper.
Prohibition of sale of milk by unregistered dairymen or on unregistered premises.
24.—(1) Subject to the provisions of the next following section, it shall not be lawful for any person after the expiration of six months from the commencement of this Part of this Act to carry on the business of dairyman in any premises situate in a sanitary district unless—
(a) such person is registered in the register of dairymen kept by the sanitary authority for such district, and
(b) the said premises are premises in respect of which such person is registered in the said register.
(2) If any person acts in contravention of this section such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section to a fine not exceeding five pounds, and in the case of a second or any subsequent offence under this section, to a fine not exceeding fifty pounds, and in either case, if the offence is a continuing one, to a further fine not exceeding forty shillings for each day during which the offence continues.
(3) An offence under this section may be prosecuted by the sanitary authority within whose sanitary district the offence was committed.
Carrying on of business on death of registered dairyman.
25.—Where a person who is registered in the register of dairymen dies, the carrying on of the business of dairyman by the personal representative or a member of the family of such person in any premises in respect of which such person is registered in such register shall, notwithstanding that such personal representative or member is not registered in the said register in respect of the said premises, not during the period of one month from the death of such person be deemed a contravention by such personal representative or member of the immediately preceding section.
Cancellation of registration on grounds of unsuitability of dairyman, etc.
26.—(1) Where a sanitary authority are satisfied that—
(a) any person registered in the register of dairymen kept by them is no longer a fit and proper person to carry on the business of dairyman, or
(b) that any person registered in such register has been convicted of an offence under this Act or of an offence under the Sale of Food and Drugs Acts, 1875 to 1935, in relation to the sale of milk, or
(c) that the registration of any person in the register of dairymen kept by them was procured by fraud or by misrepresentation, whether fraudulent or innocent,
such sanitary authority may, subject to the provisions of this section, by order (in this section referred to as a cancellation order) cancel the registration of such person in such register.
(2) Where a sanitary authority are satisfied that any premises in respect of which any person is registered in the register of dairymen kept by them are no longer suitable for use as a dairy, such sanitary authority may, subject to the provisions of this section, by order (in this section also referred to as a cancellation order), in case such person is registered in such register in respect of other premises, cancel the entry of such first-mentioned premises in such register or, in any other case, cancel the registration of such person in such register.
(3) Every cancellation order shall state the grounds on which such order is made.
(4) Where a sanitary authority make a cancellation order cancelling the registration of a person in the register of dairymen kept by them, such order shall specify a period commencing from the date of such order during which such person shall not be eligible for re-registration in such register.
(5) The following provisions shall have effect in respect of the making by a sanitary authority of a cancellation order in relation to a person (in this sub-section referred to as the dairyman) registered in the register of dairymen kept by such sanitary authority, that is to say:—
(a) before making such order, such sanitary authority shall cause a draft of the proposed order to be prepared;
(b) such sanitary authority shall serve on the dairyman a notice in the prescribed form of their intention to apply to the Minister for his consent to the making of the proposed order, and such notice shall incorporate a copy of the said draft;
(c) the dairyman may, within fourteen days after the service of the said notice, make representations to the Minister in relation to the proposed order;
(d) as soon as may be after the service of the said notice, such sanitary authority shall apply to the Minister for his consent to the making of the proposed order, and such application shall be accompanied by a copy of the said notice having endorsed thereon the date of service thereof on the dairyman;
(e) on receipt of the said application the Minister shall, but not earlier than fourteen days after the date of the service of the said notice on the dairyman, consider the said application and any representations made by the dairyman, and shall, after such consideration, do one of the following things, namely—
(i) consent to the making of the proposed order in terms of the said draft, or
(ii) amend the said draft and consent to the making of the proposed order, in terms of the said draft, as so amended, or
(iii) refuse his consent to the making of the proposed order;
(f) such sanitary authority shall not make the proposed order if the Minister has refused his consent and shall not, if the Minister has consented to the making thereof, make the proposed order otherwise than in the terms of the said draft or the said draft, as amended by the Minister (as the case may be).
(6) Where a sanitary authority make, with the consent of the Minister, a cancellation order they shall serve a copy of such order on the person to whom such order relates, and such order shall come into force on the seventh day after the date of such service.
(7) Where a cancellation order cancelling the registration of a person registered in the register of dairymen kept by a sanitary authority comes into force, such sanitary authority shall not, without the consent of the Minister, re-register such person in such register during the period specified in such order as the period during which such person shall not be eligible for re-registration in such register.
(8) Where a person registered in the register of dairymen kept by a sanitary authority is convicted for the third time within a period of five years of an offence under this Act or of an offence under the Sale of Food and Drugs Acts, 1875 to 1935, in relation to the sale of milk, such sanitary authority shall cancel the registration of such person in such register, and, notwithstanding anything contained in this Act, shall not, without the consent of the Minister, re-register such person in such register during the period of one year commencing from the date of the last of such convictions.
Rectification and cancellation of registration.
27.—(1) A sanitary authority may at any time alter or cancel any entry in the register of dairymen kept by them upon the application in writing of the person in respect of whose registration such entry was made or, where such person is an individual, of his personal representative or, where such person is a body corporate, of the liquidator.
(2) A sanitary authority may at any time, without such application as aforesaid, cancel the registration of any person in the register of dairymen kept by them if such sanitary authority are satisfied that such person, if an individual, has died, or if a body corporate, has been dissolved and no other person has within one month after such death or dissolution been registered in place of the person so dead or dissolved.
(3) Subject to the provisions of sub-section (5) of this section, a sanitary authority may at any time, without such application as aforesaid, cancel the registration of any person in the register of dairymen kept by them if such sanitary authority are satisfied—
(a) in case such person is registered in respect of one set of premises only, that such person has ceased to carry on the business of dairyman at such set of premises,
(b) in case such person is registered in respect of two or more sets of premises, that such person has ceased to carry on the business of dairyman at all such sets of premises.
(4) Subject to the provisions of the next following sub-section, where a person is registered in the register of dairymen kept by a sanitary authority, in respect of two or more sets of premises, such sanitary authority may, at any time, without such application as aforesaid, if satisfied that such person has ceased to carry on the business of dairyman at any one of such sets of premises, cancel the registration of such person in respect of the set of premises at which he has ceased to carry on such business.
(5) A sanitary authority shall, before exercising, in relation to any person registered in the register of dairymen kept by them, the powers conferred on them by sub-section (3) or sub-section (4) of this section, serve on such person at least fourteen days' notice of their intention to exercise such powers.
Cancellation of registration in other cases.
28.—(1) The sanitary authority may, once, but not oftener, in every year, serve on any person registered in the register of dairymen kept by such sanitary authority a requisition, requiring such person, if he desires to continue to be registered in such register, to send to such sanitary authority before the expiration of the period (which shall not be less than one month from the date of the service of such requisition) specified in such requisition, notice of his desire to continue to be so registered.
(2) If any person upon whom a requisition under this section has been served by a sanitary authority fails or neglects before the expiration of the period specified in such requisition to send to such sanitary authority notice of his desire to continue to be registered in the register of dairymen kept by such sanitary authority, such sanitary authority may cancel the registration of such person in such register.
Evidence of contents of registers of dairymen.
29.—(1) The register of dairymen kept by a sanitary authority shall be—
(a) deemed to be in proper custody when in the custody of an officer of such sanitary authority authorised in that behalf by such sanitary authority, and
(b) admissible in evidence without further proof, on production from the proper custody.
(2) Prima facie evidence of any entry in the register of dairymen kept by a sanitary authority may be given in any Court or any legal proceedings by the production of a copy of such entry purporting to be certified to be a true copy by an officer of such sanitary authority authorised in that behalf, and it shall not be necessary to prove the signature of such officer or that he was in fact such officer or was so authorised.
(3) A certificate purporting to be under the hand of an officer of a sanitary authority authorised in that behalf that a specified person was not during a specified time registered in the register of dairymen kept by such sanitary authority shall in any legal proceedings be prima facie evidence of the facts so certified, and it shall not be necessary to prove the signature of such officer, or that he was such officer or was so authorised.
(4) A certificate purporting to be under the hand of an officer of a sanitary authority authorised in that behalf that specified premises were not during a specified time entered in the register of dairymen kept by such sanitary authority shall in any legal proceedings be prima facie evidence of the facts so certified, and it shall not be necessary to prove the signature of such officer or that he was such officer or was so authorised.
PART III.
Regulations in Relation to Dairies and Milk, and Inspection of Animals.
Temporary exclusion of certain dairymen and dairies from Part III.
30.—(1) A person—
(a) who sells milk to persons who are registered proprietors, within the meaning of the Dairy Produce Acts, 1924 to 1934, of premises registered under the said Acts and who are holders of special designation licences granted under Part IV of this Act, and
(b) who sells milk to no other persons,
shall be deemed for the purposes of this Part of this Act not to carry on the business of dairyman, and the premises of such person shall be deemed for the purposes of this Part of this Act not to be a dairy.
(2) The Minister may, with the consent of the Minister for Agriculture, make at any time an order declaring that sub-section (1) of this section shall cease to be in force on and after a specified date and thereupon on and after such date the said sub-section (1) shall cease to be in force.
Regulations in relation to dairies and milk.
31.—(1) The Minister may from time to time by order make regulations in relation to all or any of the following matters:—
(a) the construction of dairies;
(b) the lighting ventilation drainage and water supply of dairies;
(c) the cleansing of dairies, vessels, machines, or vehicles used in connection with the business of dairyman, and the precautions to be taken to secure their cleanliness;
(d) the precautions to be taken for the protection of milk against contamination or infection;
(e) the manner of cooling milk;
(f) the conveying and distribution of milk;
(g) the labelling, marking, or identifying of receptacles for milk;
(h) the manner of closing receptacles used for the carriage or delivery of milk;
(i) the milking of animals and the utensils, and machines used for that purpose;
(j) the inspection of dairies, of vessels, machines and vehicles used in connection with the business of dairyman, and of persons who have access to dairies or to such vessels, machines or vehicles;
(k) the persons by whom such inspections are to be carried out;
and such regulations may be either special or general and may be made in relation to the whole of Saorstát Eireann or any specified part thereof.
(2) The word “milk” where it occurs in this section means milk intended to be or in the course of being sold.
(3) Every regulation under this section shall be made with the concurrence of the Minister for Agriculture.
(4) If any person acts in contravention of or fails to comply with any regulation made under this section such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding five pounds, and, in the case of a second or any subsequent offence under this section, to a fine not exceeding fifty pounds, and, in either case, if the offence is a continuing one, to a further fine not exceeding forty shillings for each day during which the offence continues.
(5) An offence under this section may be prosecuted by or at the suit of the sanitary authority within whose sanitary district the offence was committed as prosecutor.
Restriction on sale of pasteurised etc. milk.
32.—(1) The Minister, with the concurrence of the Minister for Agriculture, may from time to time by order make regulations prohibiting the sale, except under a special designation, within the meaning of Part IV of this Act, and under and in accordance with a special designation licence granted under the said Part IV, of any milk which has been heated to a temperature higher than the temperature specified in such regulations or has been pasteurised.
(2) If any person acts in contravention of any regulation made under this section such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding five pounds, and, in the case of a second or any subsequent offence under this section, to a fine not exceeding fifty pounds, and, in either case, if the offence is a continuing one, to a further fine not exceeding forty shillings for each day during which the offence continues.
(3) An offence under this section may be prosecuted by or at the suit of the sanitary authority within whose sanitary district the offence was committed as prosecutor.
Prohibition of sale of milk except under special designation.
33.—(1) The Minister may, on the application of the sanitary authority of a sanitary district, from time to time by order under this sub-section prohibit the sale of milk, in case such district is an urban sanitary district, within the meaning of the Public Health Acts, 1878 to 1931, in such district or, in case such district is a rural sanitary district, within the meaning of the said Acts, either (as may be specified in such order) in such district or a specified part thereof, unless such milk is sold under a special designation, within the meaning of Part IV of this Act.
(2) Where an order has been made under the immediately preceding sub-section in relation to any sanitary district or a part thereof, the Minister may, on the application of the sanitary authority of such sanitary district, by order under this sub-section revoke such first-mentioned order.
(3) The following provisions shall have effect in relation to an application by a sanitary authority for an order under this section, that is to say:—
(a) such sanitary authority shall, before making such application, give such public notice as may be prescribed of their intention to make such application;
(b) the making of such application shall be—
(i) in the case of the county borough of Dublin or the borough of Dun Laoghaire, a reserved function for the purposes of the Local Government (Dublin) Act, 1930 (No. 27 of 1930), and
(ii) in the case of the county borough of Cork, a reserved function for the purposes of the Cork City Management Act, 1929 (No. 1 of 1929), and
(iii) in the case of the county borough of Limerick, a reserved function for the purposes of the Limerick City Management Act, 1934 (No. 35 of 1934).
(4) If any person acts in contravention of any order made under sub-section (1) of this section and for the time being in force such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding five pounds, and, in the case of a second or any subsequent offence under this section, to a fine not exceeding fifty pounds, and, in either case, if the offence is a continuing one, to a further fine not exceeding forty shillings for each day during which the offence continues.
(5) An offence under this section may be prosecuted by or at the suit of the sanitary authority within whose sanitary district the offence was committed as prosecutor.
Inspection of animals.
34.—(1) The Minister may from time to time by order make regulations in relation to the inspection of animals in dairies by veterinary officers or other registered veterinary surgeons.
(2) Regulations under this section may authorise the person making the inspection to take from any animal specimens or material for examination and to require any animal to be milked in his presence and to take samples of the milk and to require that the milk from any particular teat shall be kept separate and to take separate samples thereof.
(3) Every regulation under this section shall be made with the concurrence of the Minister for Agriculture.
(4) If any person acts in contravention of or fails to comply with any regulation made under this section such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding five pounds, and, in the case of a second or any subsequent offence under this section, to a fine not exceeding fifty pounds, and, in either case, if the offence is a continuing one, to a further fine not exceeding forty shillings for each day during which the offence continues.
(5) An offence under this section may be prosecuted by or at the suit of the sanitary authority within whose sanitary district the offence was committed as prosecutor.
PART IV.
Sale of Milk Under Special Designations.
Special designation licences.
35.—(1) The Minister may by regulations made by him under this section prescribe the designations which may be used in connection with milk sold or offered or exposed for sale, and references in this Part of this Act to a “special designation” shall be construed as referring to a designation prescribed by regulations made under this section and for the time being in force.
(2) Whenever the Minister makes regulations under the immediately preceding sub-section prescribing a special designation, he may by the same or subsequent regulations provide for all or any of the following matters, that is to say:—
(a) the grant of licences (in this Part of this Act referred to as special designation licences) to sell milk under such special designation;
(b) the authorities (including the Minister) to grant such licences;
(c) the form of such licences;
(d) the persons to whom such licences may be granted;
(e) the duration of such licences;
(f) the conditions precedent to the grant of such licences;
(g) the terms and conditions (including revocation and suspension) subject to which such licences are to be granted;
(h) such other matters in relation to such licences as the Minister thinks proper to make provision for.
(3) Every regulation under this section shall be made with the concurrence of the Minister for Agriculture.
Fees on special designation licences.
36.—(1) There shall be paid by the applicant in respect of every special designation licence to the authority by whom such licence was issued the prescribed fee.
(2) All fees paid under this section to the Minister shall be collected in money and taken in such manner as the Minister for Finance may from time to time direct, and shall be paid into or disposed of for the benefit of the Exchequer in accordance with the directions of the Minister for Finance.
(3) The Public Offices Fees Act, 1879, shall not apply in respect of any fees payable under this section to the Minister.
(4) All fees paid under this section to an authority (other than the Minister) shall be disposed of by such authority in such manner as may be prescribed.
(5) In making regulations in relation to the fee referred to in sub-section (1) of this section as prescribed, different fees may be prescribed in respect of different classes of special designation licences and in respect of special designation licences granted by the Minister and other authorities.
Prohibition of sale of milk under special designations by unlicensed persons.
37.—(1) It shall not be lawful for any person—
(a) to sell or offer or expose for sale any milk under any special designation, or
(b) on or in connection with any sale or offer for sale or proposed sale of any milk or in any advertisement, circular or notice relating to milk, to describe or refer to such milk by any special designation,
unless such person is the holder of a special designation licence for the time being in force to sell milk under such special designation.
(2) If any person acts in contravention of this section such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding five pounds, and, in the case of a second or any subsequent offence under this section, to a fine not exceeding fifty pounds, and, in either case, if the offence is a continuing one, to a further fine not exceeding forty shillings for each day during which the offence continues.
(3) An offence under this section may be prosecuted by the Minister or the sanitary authority within whose sanitary district the offence was committed.
Restriction on descriptions to be applied to milk on sale.
38.—(1) The Minister may, after consultation with the Minister for Agriculture, make regulations under this section prescribing the descriptive words or signs which may be used, without obtaining a special designation licence, in connection with milk offered or exposed for sale, and references in this section to “a general designation” shall be construed as referring to words and signs prescribed by regulations made under this section and for the time being in force.
(2) It shall not be lawful for any person to use in any advertisement, circular, notice, or otherwise in connection with milk offered or exposed for sale any words or signs which are neither a special designation nor a general designation and which indicate or are intended to indicate that the milk as of a particular quality or prepared in a particular manner or suitable for a particular purpose.
(3) If any person acts in contravention of this section such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding five pounds and in the case of a second or any subsequent offence under this section, to a fine not exceeding fifty pounds and, in either case, if the offence is a continuing one, to a further fine not exceeding forty shillings for each day during which the offence continues.
(4) An offence under this section may be prosecuted by the Minister οr the sanitary authority within whose sanitary district the offence was committed.
Reports by sanitary authorities.
39.—Where a person is the holder of a special designation licence granted by the Minister, the sanitary authority for the sanitary district in which such person carries on business as a purveyor of milk may at any time and shall, whenever required by the Minister, ascertain whether the terms and conditions subject to which such licence was granted are being performed and observed and report to the Minister the result of their action.
PART V.
Prevention of Disease Likely to be Caused by Infected Milk.
Diseases to which Part V applies.
40.—(1) This Part of this Act applies to—
(a) each of the following diseases, that is to say, tuberculosis, typhoid fever, paratyphoid fever, diphtheria, membranous croup and scarlatina, and
(b) every other disease which may from time to time be declared by an order for the time being in force made under this section to be a disease to which this Part of this Act applies.
(2) The Minister may from time to time by order made under this, section—
(a) declare any disease (being a disease which in the opinion of the Minister is likely to be caused by infected or contaminated milk) to be a disease to which this Part of this Act applies;
(b) revoke any order previously made by him under this section.
(3) Every order under this section shall be made with the concurrence of the Minister for Agriculture.
(4) Every order made under this section shall be laid before each House of the Oireachtas as soon as may be after such order is made, and if a resolution annulling such order is passed by either House of the Oireachtas within the next subsequent twenty-one days on which that House has sat after such order is so laid before it such order shall be annulled accordingly, but without prejudice to the validity of anything previously done under such order.
Stoppage of supplies of milk likely to cause disease.
41.—(1) If the medical officer of a sanitary district has reason to suspect that any disease to which this Part of this Act applies is caused, or is likely to be caused, by the consumption of any milk which is being exposed or kept for sale within such sanitary district, he shall ascertain the location of the dairy in which the animal or animals from which such milk was obtained is or are kept, and thereupon the following provisions shall have effect, that is to say:—
(a) if such dairy is within such sanitary district, he shall examine the dairy and, if he so thinks fit, any person engaged in the service thereof, or resident in the dairy, or who may be resident in any premises where any person employed in such dairy may reside, and shall, if necessary, require the veterinary officer to accompany him and to examine the animals therein, and
(b) if such dairy is situate in another sanitary district, he shall forthwith by the most expeditious means available inform the medical officer of such other sanitary district of the facts of the case and the location of such dairy and thereupon the medical officer of such other sanitary district shall do the following things, that is to say:—
(i) he shall examine the dairy and, if he so thinks fit, any person engaged in the service thereof, or resident in the dairy, or who may be resident in any premises where any person employed in such dairy may reside, and shall, if necessary, require the veterinary officer to accompany him and to examine the animals therein, and
(ii) he shall report to the sanitary authority whose· medical officer he is and to the medical officer from whom such information was received, the result of such examination and any action taken by him under the next following sub-section.
(2) If the medical officer of a sanitary district, who has in pursuance of the immediately preceding sub-section examined a dairy, is satisfied as the result of such examination that any disease to which this Part of this Act applies is caused or is likely to be caused by the consumption of milk supplied from such dairy, he may make an order (in this section referred to as a prohibition order) prohibiting the dairyman, either absolutely or unless such conditions as such medical officer may think fit to insert in such order are complied with, from selling or allowing any other person to sell any milk from such dairy or from any particular animal or animals therein so long as such order is in force.
(3) Every prohibition order shall be in the prescribed form and state the grounds upon which such order was made.
(4) Whenever a prohibition order is made the medical officer shall do the following things, that is to say:—
(a) serve a copy of such order on the person in respect of whom it is made, and
(b) send a copy of such order together with any veterinary and bacteriological reports obtained by him to the sanitary authority whose officer he is and to the Minister.
(5) Every prohibition order shall come into force immediately upon the service thereof on the person in respect of whom it is made and shall remain in force unless and until it is withdrawn or annulled under this section.
(6) If a medical officer by whom a prohibition order is made is satisfied that the milk to which such order applies is no longer likely to cause a disease to which this Part of this Act applies he shall forthwith by notice in writing served on the person in respect of whom such order was made withdraw such prohibition order and such withdrawal shall have effect as from the date of such service.
(7) If a dairyman is aggrieved by the making or continuance of a prohibition order such dairyman may appeal to the District Court in the prescribed manner.
(8) The following provisions shall have effect in relation to an appeal under the immediately preceding sub-section, that is to say:—
(a) on the hearing of such appeal the District Court may confirm, vary or annul the prohibition order the subject of such appeal and may direct to and by whom the costs of the appeal are to be paid;
(b) on the hearing of such appeal, the court shall determine and state whether the prohibition order the subject of such appeal was made in consequence of the default or neglect of the appellant or any person who, immediately before the making of such order, was an employee of the appellant, or the withdrawal of such order has been unreasonably neglected or refused and such determination shall be conclusive,
(c) no appeal shall lie to the Circuit Court under section 84 of the Courts of Justice Act, 1924 (No. 10 of 1924).
(9) If a prohibition order is made against a dairyman—
(a) such dairyman shall, unless such order has been made in consequence of his own default or neglect or that of any person who, immediately before the making of such order, was an employee of such dairyman, be entitled to recover from the sanitary authority full compensation for any loss or damage he may have sustained by reason of the making of the order;
(b) every person who, immediately before the making of such order was an employee of such dairyman shall, unless such order was made in consequence of any neglect or default by himself or by such dairyman, be entitled to recover from the sanitary authority, full compensation for any loss or damage he may have sustained by reason of the making of the order;
(c) such dairyman and every person who, immediately before the making of such order, was an employee of such dairyman shall be entitled to recover from the sanitary authority full compensation for any damage or loss which he may sustain in consequence of any unreasonable neglect or refusal by the medical officer of such sanitary authority to withdraw such order.
(10) The following provisions shall have effect in relation to the recovery of compensation under the foregoing sub-section, that is to say:—
(a) subject to the provisions of the next succeeding paragraph, any dispute as to the fact of any damage or loss or as to the amount of compensation shall be settled by arbitration in the manner provided by the Public Health (Ireland) Act, 1878, and any sum awarded as compensation shall be recoverable as a simple contract debt in a court of competent jurisdiction;
(b) if the compensation claimed does not exceed twenty-five pounds, proceedings to recover the same may, at the option of the person claiming such compensation, be brought in the District Court.
(11) Whenever a prohibition order is in force a dairyman shall not be liable for an action for breach of contract if the breach is due to such order.
(12) If any dairyman in respect of whom a prohibition order is for the time being in force fails, refuses or neglects to comply with such order such dairyman shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding fifty pounds, and in the case of a second or subsequent offence under this section, to a fine not exceeding one hundred pounds or to imprisonment for any term not exceeding six months or to both such fine and imprisonment, and in either case, if the offence is a continuing one, to a further fine not exceeding five pounds for each day during which the offence continues.
(13) Proceedings for an offence under this section may be taken before a Justice of the District Court having jurisdiction either in the sanitary district where the offence was committed or the sanitary district where the dairy to which the prohibition order relates is situate, and may be taken by either the medical officer of either such sanitary district or by any officer authorised in that behalf by the sanitary authority of either such district.
Prohibition of sale of infected milk.
42.—(1) If any dairyman sells milk which is infected with a disease to which this Part of this Act applies, such dairyman shall, if it is proved that he previously knew or could by the exercise of ordinary care have ascertained that such milk was so infected, be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding fifty pounds, and, in the case of a second or any subsequent offence under this section, to a fine not exceeding one hundred pounds or to imprisonment for any term not exceeding six months or to both such fine and imprisonment and in either case, if the offence is a continuing one, to a further fine not exceeding five pounds for each day during which the offence continues.
(2) An offence under this section may be prosecuted by the sanitary authority within whose sanitary district the milk was infected, or by the sanitary authority within whose sanitary district the offence was committed.
Neglect of employee to inform dairyman of milk becoming infected.
43.—Where—
(a) any milk, which is kept by a dairyman for the purposes of being sold, becomes infected with a disease to which this Part of this Act applies, and
(b) any person who is employed by such dairyman for the purposes of his business as a dairyman, while such milk was so kept by such dairyman, either knew or had reasonable grounds for suspecting that such milk had become so infected, and
(c) such person fails or neglects to inform such dairyman forthwith of such knowledge or grounds of suspicion,
such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding five pounds, and in the case of a second or any subsequent offence to a fine not exceeding fifty pounds or to imprisonment for any term not exceeding six months or to both such fine and imprisonment.
Prohibition of sale of milk to which an infected person has access.
44.—(1) If a dairyman sells milk to which any person who is infected with or has been exposed to infection by a disease to which this Part of this Act applies has had access, such dairyman shall, if it is proved that he previously knew or could by the exercise of ordinary care have ascertained that such person was so infected or exposed to infection, be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding five pounds and, in the case of a second or any subsequent offence under this section, to a fine not exceeding fifty pounds or to imprisonment for any term not exceeding six months or to both such fine and imprisonment and in either case, if the offence is a continuing one, to a further fine not exceeding forty shillings for each day during which the offence continues.
(2) An offence under this section may be prosecuted by the sanitary authority within whose district the milk was exposed to infection or by the sanitary authority within whose sanitary district the offence was committed.
Prohibition of access to milk by infected persons.
45.—(1) If any person, who has been infected with a disease to which this Part of this Act applies, has, while so infected, access to milk in a dairy, such person shall, unless he proves to the satisfaction of the Court (i) that he did not know or could not by the exercise of reasonable care have known that he had been so infected, or (ii) that, before having such access, he informed the owner of such dairy that he had been so infected, be guilty of an offence under this section.
(2) If any person, who has been exposed to infection with a disease to which this Part of this Act applies has, within fourteen days after such exposure, access to milk in a dairy, such person shall, unless he proves to the satisfaction of the Court (i) that he did not know or could not by the exercise of reasonable care have known of such exposure or (ii) that, before having such access, he informed the owner of such dairy of such exposure, be guilty of an offence under this section.
(3) If any person, who resides in the same house as a person (in this sub-section referred to as the infected person) who has been infected with a disease to which this Part of this Act applies, has, while the infected person is so infected, access to milk in a dairy, such person shall, unless he proves to the satisfaction of the Court (i) that he did not know or could not by the exercise of reasonable care have known that the infected person had been so infected or (ii) that, before having such access, he informed the owner of such dairy that he resided in the same house as the infected person and that the infected person had been so infected, be guilty of an offence under this section.
(4) For the purposes of this section a person who is infected with a disease to which this Part of this Act applies shall be deemed to continue to be so infected until a duly qualified medical practitioner has certified that such person is free from such infection.
(5) Any person who is guilty of an offence under this section shall be liable on summary conviction thereof, in the case of a first offence under this section, to a fine not exceeding five pounds and, in the case of a second or any subsequent offence under this section, to a fine not exceeding fifty pounds or to imprisonment for any term not exceeding six months or to both such fine and imprisonment and in either case, if the offence is a continuing one, to a further fine not exceeding forty shillings for each day during which the offence continues.
(6) An offence under this section may be prosecuted by the sanitary authority within whose district the milk was exposed to infection or by the sanitary authority within whose sanitary district the offence was committed.
Prohibition of sale without notice of milk likely to be exposed to infection.
46.—(1) Where a person residing on any land or premises on or in which any milk has been produced or kept, or a person who frequents such land or premises is infected with a disease to which this Part of this Act applies, it shall be the duty of a dairyman at least twenty-four hours before selling any milk produced or kept on such premises to give to the medical officer of health of the dispensary district in which such land or premises are situate notice in writing of the full facts of the case and if such dairyman sells such milk without giving such notice or (except with the permission of such medical officer) before the expiration of twenty-four hours from the giving of such notice he shall, if it is proved that before such disposal he knew or by the exercise of ordinary care could have ascertained that such person was so infected be guilty of an offence under this section and be liable on summary conviction thereof, in the case of a first offence under this section to a fine not exceeding five pounds and, in the case of a second or any subsequent offence under this section, to a fine not exceeding fifty pounds, or to imprisonment for any term not exceeding six months or to both such fine and imprisonment, and, in either case, if the offence is a continuing one, to a further fine not exceeding forty shillings for each day during which the offence continues.
(2) An offence under this section may be prosecuted by the sanitary authority within whose sanitary district the milk was infected, or by the sanitary authority within whose sanitary district the offence was committed.
PART VI.
Sale of Milk from Diseased Animals.
Diseases to which Part VI applies.
47.—(1) This Part of this Act applies to
(a) each of the following diseases affecting animals, that is to say:—
tuberculosis of the udder,
any tuberculous condition of the uterus,
any form of tuberculosis in which tubercle bacilli are excreted,
any septic condition of the uterus,
acute mastitis,
chronic mastitis,
actinomycosis of the udder,
anthrax,
foot and mouth disease,
suppuration of the udder,
retained placenta; and
(b) every other disease which may from time to time be declared by an order for the time being in force made under this section to be a disease to which this Part of this Act applies.
(2) The Minister may from time to time by order made under this section—
(a) declare any disease affecting animals to be a disease to which this Part of this Act applies;
(b) revoke any order previously made by him under this section.
(3) Every order under this section shall be made with the concurrence of the Minister for Agriculture.
(4) Every order made under this section shall be laid before each House of the Oireachtas as soon as may be after such order is made, and if a resolution annulling such order is passed by either House of the Oireachtas within the next subsequent twenty-one days on which that House has sat after such order is so laid before it such order shall be annulled accordingly, but without prejudice to the validity of anything previously done under such order.
Prohibition of sale of milk from animals suffering from a disease to which Part VI applies.
48.—(1) If any person sells the milk of any animal which is suffering from any disease to which this Part of this Act applies, and it is proved that such person had previously received notice from an officer of the sanitary authority, or that he otherwise knew, or by the exercise of ordinary care could have ascertained, that such animal was suffering from such disease, such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section to a fine not exceeding fifty pounds and, in the case of a second or any subsequent offence under this section, to a fine not exceeding one hundred pounds or to imprisonment for any term not exceeding six months or to both such fine and imprisonment and, in either case, if the offence is a continuing one, to a further fine not exceeding five pounds for each day during which the offence continues.
(2) An offence under this section may be prosecuted by the sanitary authority within whose sanitary district the animal is kept, or by the sanitary authority within whose sanitary district the offence was committed.
PART VII.
Bacteriological Examination of Milk.
Appointment of bacteriological examiners.
49.—(1) The Minister shall from time to time appoint such and so many qualified persons as he may think necessary to be bacteriological examiners for the purpose of this Act and the persons so appointed shall hold office during the pleasure of the Minister.
(2) Whenever the Minister appoints any person to be a bacteriological examiner he shall forthwith publish notice of such appointment in the Iris Oifigiúil and such appointment shall take effect as from the date of the publication of such notice.
(3) In this Act the expression “bacteriological examiner” means a bacteriological examiner appointed by the Minister under this section.
Bacteriological examination fees.
50.—The Minister may by regulations made under this section prescribe the fees to be paid to bacteriological examiners for the examination and testing of samples of milk submitted to them under this Act and may by such regulations prescribe different fees in relation to the examination and testing of samples for different purposes and in relation to the different tests to be applied to samples so submitted.
Submission of milk samples.
51.—(1) The Minister, every sanitary authority, and every dairyman may submit samples of milk to a bacteriological examiner for examination and test.
(2) Every sample of milk submitted to a bacteriological examiner under this section shall be accompanied by a request in writing for the making of the particular examination and test required in respect of such sample and, subject to the provisions of the next following sub-section, by the prescribed fee for the making of such examination and test.
(3) No fee shall be payable in respect of any sample of milk submitted under this section by the Minister for examination and test to a bacteriological examiner who is employed in the Civil Service of the Government of Saorstát Eireann.
Duty of bacteriological examiner.
52.—Every bacteriological examiner shall in the prescribed manner examine and test each sample of milk submitted to him in accordance with this Act and on the completion of such examination and test issue to the person by whom such sample was submitted a certificate (in this Act called a bacteriological certificate) stating the result of such examination and test in respect of such sample.
PART VIII.
Powers of Sampling Milk.
Milk sampling officers.
53.—Each of the following persons shall be a milk sampling officer for the purposes of this Act, that is to say;—
(a) any inspector,
(b) any medical officer of health,
(c) any sanitary officer of a sanitary authority whom such sanitary authority has (with the consent of the Minister) appointed to be a milk sampling officer.
Power to take samples of milk.
54.—(1) An inspector may, in any place, and a medical officer of health or a sanitary officer who is a milk sampling officer, may in any place within the sanitary district for which such officer acts, take without payment a sample of milk at any time before such milk is delivered to the consumer.
(2) Any person authorised by this section to take a sample of milk may for the purpose of taking such sample open any receptacle containing milk and do any other act which he may deem necessary for the said purpose.
(3) Every sample of milk (not being milk which is contained in closed receptacles for sale retail in such receptacles), taken under this section shall be taken in the prescribed manner and shall be of the prescribed amount.
Non-interference with traffic.
55.—In the exercise in or upon the premises of any person engaged in the business of carrying goods by land, water or air, of the powers conferred on him by this Part of this Act a sampling officer shall conform to such reasonable requirements of such person as are necessary to prevent the working of the traffic on such premises being obstructed or interfered with.
Taking of samples of milk outside sanitary district on requisition of medical officer of such district.
56.—(1) The medical officer of a sanitary district within which milk from any dairy situate outside such sanitary district is being sold or exposed for sale or any other officer authorised for the purpose by the sanitary authority of such district may by notice (in this Act referred to as a sampling notice) in writing require the medical officer of the sanitary district in which such dairy is situate or through which such milk passes in course of transit from such dairy to such sanitary district to cause a sampling officer to take samples of the milk at such dairy or in course of such transit, and upon receipt of such notice such last mentioned medical officer shall cause such samples to be taken accordingly.
(2) Any reasonable expenses incurred in the taking of a sample of milk in pursuance of a sampling notice shall be defrayed by the sanitary authority whose officer gave such notice and the amount of such expenses shall, in default of agreement, be determined by the Minister.
(3) For the purposes of any proceedings under this Act in relation to a sample of milk taken in pursuance of a sampling notice such sample shall be deemed to have been taken, at the option of the prosecutor, either without or within the district of the sanitary authority whose officer gave such notice, and accordingly proceedings under this Act may be taken either before a Justice of the District Court having jurisdiction within such district or before a Justice of the District Court having jurisdiction in the district in which such sample was actually taken.
Division of and dealings with samples.
57.—(1) Whenever a sampling officer takes, otherwise than in pursuance of a sampling notice, in exercise of the powers conferred on him by this Part of this Act a sample of milk (not being milk which is contained in closed receptacles for sale retail in such receptacles) he shall divide such sample into two parts and put each part into a separate bottle and mark cork and seal such bottle in the prescribed manner and shall then proceed as follows, that is to say:—
(a) where such milk when taken is under the actual control of the seller or consignor thereof or his agent, he shall—
(i) if required to do so, deliver to such seller, consignor or agent, one of the said bottles;
(ii) retain in the prescribed manner the other bottle and if he thinks fit, send it in the prescribed manner to a bacteriological examiner for examination of its contents;
(b) where such milk when so taken is not under the actual control of the seller or consignor or his agent, he shall—
(i) forward in the prescribed manner to the consignor one of the said bottles;
(ii) retain in the prescribed manner the other bottle and if he thinks fit, send it in the prescribed manner to a bacteriological examiner for examination of its contents.
(2) Whenever, in pursuance of a sampling notice a sampling officer takes, in exercise of the powers conferred on him by this Part of this Act, a sample of milk (not being milk which is contained in closed receptacles for sale retail in such receptacles) he shall divide such sample into two parts and put each part into a separate bottle and mark cork and seal such bottle in the prescribed manner and shall then proceed as follows, that is to say:—
(a) where such milk when taken is under the actual control of the seller or consignor thereof or his agent, he shall—
(i) if required to do so deliver to such seller, consignor or agent, one of the said bottles;
(ii) send in the prescribed manner the other bottle to the medical officer who gave such sampling notice or, if such medical officer so requests in such sampling notice, send in the prescribed manner on behalf of such medical officer such other bottle to a bacteriological examiner for examination of its contents.
(b) where such milk, when so taken is not under the actual control of the seller or consignor or his agent, he shall—
(i) forward in the prescribed manner to the consignor one of the said bottles;
(ii) send in the prescribed manner the other bottle to the medical officer who gave such sampling notice or, if such medical officer so requests in such sampling notice, send in the prescribed manner on behalf of such medical officer such other bottle to a bacteriological examiner for examination of its contents;
(3) Upon receipt of a bottle containing a sample of milk taken in pursuance of a sampling notice, the medical officer may if he thinks fit send in the prescribed manner the bottle to a bacteriological examiner for examination of its contents.
(4) The following provisions shall have effect in relation to the taking by a sampling officer in exercise of the powers conferred on him by this Part of this Act, of a sample of milk which is contained in closed receptacles for sale retail in such receptacles, that is to say:—
(a) such officer shall take as such sample one of the said receptacles, and mark in the prescribed manner the receptacle so taken;
(b) where such receptacle is not at the time it is taken under the actual control of the seller or consignor thereof or his agent, such officer shall deliver or send by post to such seller or consignor a notice that such receptacle was taken;
(c) where such receptacle was not taken in pursuance of a sampling notice, such officer shall retain it, and, if he thinks fit, send it in the prescribed manner to a bacteriological examiner for examination of its contents;
(d) where such receptacle was taken in pursuance of a sampling notice—
(i) in case the medical officer who gave such notice so requests in such notice, such sampling officer shall send in the prescribed manner such receptacle to a bacteriological examiner for examination of its contents;
(ii) in any other case, such sampling officer shall send in the prescribed manner such receptacle to such medical officer who may, if he thinks fit, send it in the prescribed manner to a bacteriological examiner for examination of its contents.
(5) In any proceedings under this Act, a certificate purporting to be under the hand of a sampling officer who took a sample of milk in pursuance of a sampling notice that the provisions of sub-section (2) or sub-section (4) (whichever of the said sub-sections is applicable) of this section were complied with by him in relation to such sample shall be prima facie evidence of the matters so certified, and it shall not be necessary to prove the signature of such officer, or that he was in fact such officer.
PART IX.
Miscellaneous Provisions.
Service and evidence of bacteriological certificate.
58.—The following provisions shall have effect in relation to proceedings under this Act in respect of a sample of milk taken and dealt with under and in accordance with Part VIII of this Act, that is to say:—
(a) where for the purpose of such proceedings a bacteriological certificate has been obtained by or on behalf of the prosecutor, a copy thereof shall be served on the defendant with the summons;
(b) where for the purpose of any such proceedings a bacteriological certificate is intended to be produced by the defendant, a copy thereof shall be sent to the prosecutor at least three clear days before the return day, and if it is not so sent, the court may, if it thinks fit, adjourn the hearing on such terms as it may consider proper;
(c) in any such proceedings, the production by either party of a bacteriological certificate shall be sufficient evidence of the facts stated therein unless the other party requires that the bacteriological examiner who gave such certificate shall be called as a witness.
Prohibition of sale of contaminated, etc., milk.
59.—(1) It shall not be lawful for any person to sell or expose or offer for sale any milk which is contaminated or dirty.
(2) Any person who acts in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section to a fine not exceeding five pounds and, in the case of a second or any subsequent offence under this section, to a fine not exceeding fifty pounds or to imprisonment for any term not exceeding six months or to both such fine and imprisonment.
(3) Any milk which has an offensive taste or smell or which, on being tested in any prescribed manner, is found to contain visible offensive matter, or bacteria to a number per unit volume greater than the prescribed number, shall be deemed for the purposes of this section to be contaminated.
(4) An offence under this section may be prosecuted by the sanitary authority within whose sanitary district the milk is sold or exposed or offered for sale.
Sale of milk in public places.
60.—(1) It shall not be lawful for any person by himself or his servant to sell or deliver to a purchaser in any highway or public place milk from a vehicle or from a can or other receptacle unless there is conspicuously inscribed on such vehicle, can or receptacle his name and address and (as the case may be) the words “Bainne ar díol,” “Uachtar ar díol” or “Bláthach ar díol”.
(2) If any person acts in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding two pounds.
(3) Where milk is sold or delivered on behalf of a person such milk shall for the purposes of this section be deemed to have been sold or delivered by such person and not by the person who actually sold or delivered it.
Sale of separated or skimmed milk.
61.—(1) The Minister, after consultation with the Minister for Agriculture, may by order make regulations under this section requiring every tin or other receptacle, in which separated or skimmed milk is sold or exposed or offered for sale, to be labelled or marked in the manner provided by such regulations.
(2) If any person sells, or exposes or offers for sale any separated or skimmed milk in any tin or other receptacle which is not labelled or marked in the manner provided by regulations made under this section, such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
(3) Sub-section (1) of section 1 of the Public Health (Regulations as to Food) Act, 1907, as amended by section 23 of the Local Government Act, 1925 (No. 5 of 1925), shall be construed and have effect as if the words “skimmed or separated” now contained in paragraph (d) of the said sub-section, as so amended, were omitted therefrom.
Establishment of milk depots by sanitary authorities.
62.—The sanitary authority of a sanitary district may, with the approval of the Minister and subject to compliance with such conditions as the Minister may think fit to impose, establish and maintain in such district depots for the sale of milk specially prepared for consumption by infants under two years of age and may purchase and prepare milk and provide such laboratories, plant and other things and exercise such other powers as may be necessary to enable them to give effect to this section.
Disclosure by dairymen of sources of supply of milk.
63.—(1) The medical officer of a sanitary district may from time to time serve a notice in writing on a dairyman supplying milk in such sanitary district requiring him to furnish to such medical officer within three days after the service of such notice a complete list of all sources from which he has derived such supply during the period specified in such notice.
(2) If any dairyman upon whom a notice is served under this section either refuses or neglects to make a return in accordance with such notice or makes a return which is false or misleading in any material respect, such dairyman shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
Service of documents on dairymen.
64.—(1) Where a document is required by this Act to be served on a dairyman, such document shall be addressed to such dairyman and shall be served on such dairyman in some one of the following ways, that is to say:—
(a) by delivering it to such dairyman;
(b) by leaving it at the address at which such dairyman ordinarily resides;
(c) by sending it by post in a prepaid registered letter addressed to such dairyman at the address at which he ordinarily resides.
(2) For the purposes of this section a company registered under the Companies Acts, 1908 to 1924, shall be deemed to be ordinarily resident at its registered office, and every body corporate and every unincorporated body shall be deemed to be ordinarily resident at its principal office or place of business.
Obstruction of officers.
65.—If any person—
(a) wilfully obstructs or impedes an inspector or a medical officer, or a veterinary officer, or any other officer of a sanitary authority in exercise of the powers conferred on him by or under this Act, or
(b) fails to give such inspector or officer all reasonable assistance in his power, or
(c) fails to furnish such inspector or officer with any information he may reasonably require,
such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence under this section to a fine not exceeding five pounds, and, in the case of a second or subsequent offence under this section, to a fine not exceeding fifty pounds, and in either case, if the offence is a continuing one, to a further fine not exceeding forty shillings for each day during which the offence continues.
