AN tACHT UM THOGHCHÁIN ÁITIÚLA, 1966

Athrú ar na blianta chun toghcháin áitiúla a bheith ann.
1.—(1) Leasaítear leis seo alt 81 (1) den Acht Toghcháin, 1963, tríd an mír seo a leanas a chur in ionad mhír (a) :
“ (a) Beidh toghchán do chomhaltaí gach údaráis áitiúil ann sa bhliain 1967 agus i gceann gach cúig bliana ina dhiaidh sin.”
(2) Na téarmaí oifige a bheidh ag rith i dtosach feidhme an Achta seo i gcás comhaltaí údarás áitiúil beidh siad arna síneadh chun bheith de réir na dtoghchán is túisce a bheidh ann sa bhliain 1967 do chomhaltaí d'údaráis áitiúla tar éis tosach feidhme an Achta seo agus measfar gur toghcháin cheann cúig bliana na toghcháin sin.
Athrú ar na blianta chun coistí freastal scoile a cheapadh.
2.—Na ceapacháin is túisce a dhéanfar tar éis tosach feidhme an Achta seo faoi alt 10 den Acht Freastal Scoile, 1926, déanfar iad sa bhliain 1967 agus measfar gur ceapacháin cheann cúig bliana iad.
Forálacha maidir le cruinnithe áirithe.
3.—(1) D'ainneoin an tAcht um Thoghacháin Áitiúla, 1927, a aisghairm, na cruinnithe dá dtagraítear in ailt 8 (1), 9 (1), 9 (2) agus 10 (2) den Acht sin faoi threoir na tréimhse ón 23ú lá de Mheitheamh go dtí an lú lá d'Iúil i mbliain beidh siad ann sa bhliain 1966, agus, chun críocha an fho-ailt seo measfar nár aisghaireadh an tAcht sin (lena n-áirítear, go sonrach, ailt 8 (2), 9 (3), 10 (3) agus 11).
(2) Beidh éifeacht ag fo-alt (1) den alt seo maidir le buirg Dhún Laoghaire mar atá éifeacht aige maidir le buirgí eile, ar choinníoll, áfach, go ndéanfar aon tagairt do mhéara a fhorléiriú mar thagairt don chathaoirleach.
(3) Na cruinnithe is túisce a bheidh ann tar éis tosach feidhme an Achta seo faoi alt 14 den Acht Oideachais Ghairme Beatha 1930, measfar gur cruinnithe ceann cúig bliana iad.
Leasú ar alt 84 (1) den Acht Toghcháin, 1963.
4.—Leasaítear leis seo alt 84 (1) den Acht Toghcháin, 1963, trí “faoi réir na sriantachta gurb é lá a shocrófar mar a dúradh lá i mí Meithimh sa bhliain a bheidh na toghcháin ann lena mbaineann an t-ordú” a chur isteach ag deireadh an ailt sin.

5.—Aisghairtear leis seo ailt 1, 2 (2), 3 (2), agus 3 (3) den Acht um Thoghcháin Áitiúla, 1965.
Gearrtheideal, comhlua, forléiriú agus tosach feidhme.
6.—(1) Féadfar an tAcht um Thoghcháin Áitiúla, 1966, a ghairm den Acht seo.
(2) Féadfar na hAchtanna um Thoghcháin Áitiúla, 1963 go 1966, a ghairm de na hAchtanna um Thoghcháin Áitiúla, 1963 agus 1965, agus den Acht seo le chéile agus forléireofar iad mar aon Acht amháin.
(3) Measfar gur tháinig an tAcht seo i ngníomh an 8ú lá de Mheitheamh, 1966, agus aon ní a rinneadh an lá sin nó dá éis agus roimh an Acht seo a rith agus in ionchas a rite beidh sé bailí dá réir sin.

LOCAL ELECTIONS ACT, 1966
Alteration of years for holding local elections.
1.—(1) Section 81 (1) of the Electoral Act, 1963, is hereby amended by the substitution of the following paragraph for paragraph (a):
“(a) An election of members of every local authority shall be held in the year 1967 and quinquennially thereafter.”
(2) The terms of office of members of local authorities current at the commencement of this Act shall stand extended so as to be in accordance with the holding in the year 1967 of the elections of members of local authorities next after the commencement of this Act and those elections shall be regarded as quinquennial elections.
Alteration of years for making appointments of school attendance committees.
2.—The appointments next after the commencement of this Act under section 10 of the School Attendance Act, 1926, shall be made in the year 1967 and shall be regarded as quinquennial appointments.
Provisions with respect to certain meetings.
3.—(1) Notwithstanding that the Local Elections Act, 1927, has been repealed, the meetings referred to in sections 8 (1), 9 (1), 9 (2) and 10 (2) of that Act by reference to the period from the 23rd day of June to the 1st day of July in a year shall be held in the year 1966, and, for the purposes of this subsection, that Act (including, in particular sections 8 (2), 9 (3), 10 (3) and 11) shall be regarded as not having been repealed.
(2) Subsection (1) of this section shall have effect in relation to the borough of Dun Laoghaire as it has effect in relation to other boroughs, provided however that any reference to a mayor shall be construed as a reference to the chairman.
(3) The meetings next after the commencement of this Act under section 14 of the Vocational Education Act, 1930, shall be regarded as quinquennial meetings.
Amendment of section 84 (1) of Electoral Act, 1963.
4.—Section 84 (1) of the Electoral Act, 1963, is hereby amended by the addition of “subject to the restriction that a day fixed as aforesaid shall be in the month of June in the year in which the elections to which the order relates are held”.
Repeals.
5.—Sections 1, 2 (2), 3 (2) and 3 (3) of the Local Elections Act, 1965, are hereby repealed.
Short title, collective citation, construction and commencement.
6.—(1) This Act may be cited as the Local Elections Act, 1966.
(2) The Local Elections Acts, 1963 and 1965, and this Act may be cited together as the Local Elections Acts, 1963 to 1966, and shall be construed together as one Act.
(3) This Act shall be deemed to have come into operation on the 8th day of June, 1966, and anything done on or after that day and before and in anticipation of the passing of this Act shall be valid accordingly.
