Tosach feidhme.
1.—Tiocfaidh an tAcht seo i ngníomh cibé lá nó laethanta a shocrófar chuige sin, le hordú nó le horduithe a dhéanfaidh an tAire faoin alt seo, i gcoitinne nó maidir le haon chríoch nó foráil airithe agus féadfar laethanta éagsúla a shocrú le haghaidh críocha éagsúla agus forálacha éagsúla.

2.—(1) San Acht seo ach amháin i gcás ina n-éilíonn an comhthéacs a mhalairt—
ciallaíonn “an Bord” an Bord Bainne a bhunaítear leis an Acht seo;
tá le “im”, “uachtarlann” “gnó uachtarlainne”, “im uachtarlainne” agus “gnó deighilte uachtair” na bríonna atá leo faoi seach san Acht Toradh Déiríochta, 1924;
ciallaíonn “tobhach ar im” an tobhach ar im dá bhforáiltear faoi alt 37 den Acht seo;
ciallaíonn “tobhach ar stoic ime” an tobhach ar stoic ime dá bhforáiltear faoi alt 38 den Acht seo;
tá le “an Coiste” sa bhrí a thugtar dó le halt 50 den Acht seo;
ciallaíonn “an Chuideachta” Cuideachta na Déirí-Dhéileála, Teoranta;
ciallaíonn “stáisiún deighilte uachtair” áitreabh atá cláraithe faoin Acht Toradh Déiríochta, 1924, sa chlár de stáisiúin deighilte uachtair;
ciallaíonn “an lá bunaithe” an lá a cheapfar chun bheith ina lá bunaithe chun críocha an Achta seo le hordú ón Aire arna dhéanamh faoi alt 3 den Acht seo;
folaíonn “feidhmeanna”, maidir leis an mBord, cumhachtaí agus dualgais, agus folaíonn tagairtí d'fheidhmeanna a chomhlíonadh tagairtí do chumhachtaí a fheidhmiú agus do dhualgais a chomhlíonadh;
ciallaíonn “an Ciste” an Ciste Táirgí Déiríochta a bhunófar le halt 29 den Acht seo;
ciallaíonn “bainne” bainne i bhfoirm leachta agus folaíonn sé fíorbhainne, bainne bearrtha nó bainne deighilte, bláthach, nó meadhg, i bhfoirm leachta;
ciallaíonn “tobhach ar bhainne” an tobhach ar bhainne dá bhforáiltear faoi alt 36 den Acht seo;
folaíonn “táirge bainne” aon substaint atá déanta, go hiomlán nó go páirteach, as bainne nó is táirge nó fo-tháirge bainne agus arb éard é—
(a) im, uachtar, cáis amh, cáis phróisithe, bainne comhdhlúite, bainne tiormaithe nó bainne púdaraithe, grabhróg seacláide nó cáiséin, nó
(b) substaint a mbeidh sé dearbhaithe de thuras na huaire le rialacháin a rinne an tAire faoi fho-alt (2) den alt seo gur táirge bainne í;
ciallaíonn “an tAire” an tAire Talmhaíochta;
ciallaíonn “la ainmniúcháin” lá a cheapfar chun a bheith ina lá ainmniúcháin chun críocha an Achta seo faoi alt 7 den Acht seo;
ciallaíonn “dílseánach cláraithe”, nuair a úsáidtear é maidir le huachtarlann, an duine a sheolann an gnó uachtarlainne san uachtarlann sin, agus, nuair a úsáidtear é maidir le stáisiún deighilte uachtair, an duine a sheolann an gnó deighilte uachtair sa stáisiún sin;
ciallaíonn “dílseánach cláraithe áitribh” an duine a sheolann in áitreabh atá cláraithe faoi Chuid III den Acht Toradh Déiríochta, 1924, an gnó a bhfuil an t-áitreabh cláraithe ina leith;
ciallaíonn “ceann comhairimh”, maidir le ballóid faoin Acht seo, an duine is ceann comhairimh le haghaidh na ballóide sin de bhua alt 12 den Acht seo;
ciallaíonn “cumann” cumann atá cláraithe faoi Achtanna na gCumann Tionscail agus Soláthair, 1893 go 1936;
ciallaíonn “lá an aistrithe” an lá a cheapfar mar lá an aistrithe chun críocha an Achta seo le hordú ón Aire arna dhéanamh faoi alt 50 den Acht seo.
(2) (a) Féadfaidh an tAire, le rialacháin, a dhearbhú gur táirge bainne chun críocha an Achta seo aon substaint (seachas substaint dá dtagraítear go sonrach i mír (a) sa mhíniú ar “táirge bainne” i bhfo-alt (1) den alt seo) a bheidh déanta go hiomlán nó go páirteach as bainne nó as táirge nó fo-tháirge bainne.
(b) Aon uair agus an fad a bheidh rialacháin faoin bhfo-alt seo i bhfeidhm á dhearbhú gur táirge bainne chun críocha an Achta seo substaint áirithe, is tairge bainne chun na gcríocha sin an tsubstaint sin.
An lá bunaithe.
3.—Féadfaidh an tAire le hordú faoin alt seo lá a cheapadb chun bheith ina lá bunaithe chun críocha an Achta seo.
Bunú agus dualgas ginearálta an Bhoird.
4.—(1) Déanfar, de bhua an ailt seo, bord ar a dtabharfar agus dá ngairfear An Bord Bainne a bhunú an lá bunaithe chun na feidhmeanna a shanntar dó leis an Acht seo a chomhlíonadh.
(2) Beidh an Bord ina chomhlacht corpraithe le comharbas suthain agus séala oifigiúil (ar a dtabharfar aird bhreithiúnach) agus beidh cumhacht agartha aige agus beidh sé inagartha faoina ainm chorpraithe agus beidh cumhacht aige talamh a thógáil, a theachtadh, agus a dhiúscairt.
(3) Is é dualgas ginearálta an Bhoird iarracht a dhéanamh ar mhargú táirgí bainne lasmuigh den Stát a fheabhsú agus a fhorbairt agus an margú a dúradh agus a fhorbairt a dhéanamh chomh folúthach sin go n-áiritheofar, a mhéid is féidir é, go mbainfear an úsáid is tairbhí is feidir as an mbainne agus go bhfaighidh táirgeoirí bainne sochar réasúnach as.
Feidhmeanna an Bhoird.
5.—(1) Beidh ag an mBord, i dteannta na bhfeidhmeanna a shanntar dó le haon fhoráil eile den Acht seo, na feidhmeanna ginearálta seo, is é sin:
(a) bainne agus táirgí bainne de cibé saghas nó cineál a shonróidh an tAire ó am go ham, i scríbhinn, don Bhord a onnmhairiú nó socrú a dhéanamh chun iad a onnmhuiriú agus sin, mar a shonróidh an tAire ó am go ham, i scríbhinn, don Bhord, i gcoitinne nó go dtí cibé tír nó tíortha a shonróidh an tAire amhlaidh, agus
(b) onnmhairiú bainne agus táirgí bainne a chur chun cinn, a urasú, a spreagadh, a chomhoirdniú agus a fhorbairt, agus cabhrú (le hairgead nó ar shlí eile) leis an onnmhairiú sin, i cibé cuma is dóigh leis an mBord is gá nó is inmhianaithe.
(2) Gan dochar do ghinearáltacht fho-alt (1) den alt seo, féadfaidh an Bord aon ní nó gach ní acu seo a leanas a dhéanamh:
(a) bainne agus táirgí bainne a fháil, trí cheannach nó ar shlí eile, a stóráil, a dhiúscairt, trí dhíol nó ar shlí eile, a allmhairiú agus a onnmhairiú,
(b) gabháil do ghnó déileála mór-reaca agus mionreaca bainne agus táirgí bainne—
(i) lasmuigh den Stát, agus
(ii) le toiliú i scríbhinn ón Aire agus go dtí cibé tráth (más aon tráth é) a dhéanfaidh an tAire an toiliú a tharraingt siar i scríbhinn, sa Stát,
(c) fiosrúcháin, suirbhéireachtaí, anailíseanna, staidéir agus tuarascálacha maidir le margaí, margaí ionchasacha agus cúrsaí margaidh le haghaidh bainne agus táirgí bainne sa Stát agus lasmuigh den Stát a dhéanamh nó socrú á dhéanamh faoina chomhair sin,
(d) athbhreithnithe, suirbhéireachtaí agus staidéir forleitheadúla, tréimhsiúla maidir le trádáil i mbainne agus i dtáirgí bainne sa Stát agus lasmuigh den Stát a dhéanamh nó socrú a dhéanamh faoina chomhair sin,
(e) obair thurgnamhach agus forbartha agus fiosrúcháin, maidir le soláthar cineálacha nua agus feabhsaithe tairgí bainne, pacála le haghaidh bainne agus táirgí bainne agus modhanna chun bainne agus táirgí bainne a thairiscint le haghaidh an mhargaidh, a dhéanamh nó socrú a dhéanamh faoina chomhair sin agus cabhrú, le hairgead nó ar shlí eile, chuige sin,
(f) poiblíocht in aon fhoirm nó meán a chur ar fáil, nó socrú a dhéanamh lena chur ar fail, sa Stát agus lasmuigh den Stát chun daoine a spreagadh chun tuilleadh bainne agus táirgí bainne a thomhailt agus a úsáid agus chun dlús a chur le méadú ar na cainníochtaí bainne agus táirgí bainne a onnmhaireofar as an Stát,
(g) seomraí taispeántais, buróanna eolais agus bunachais dá samhail a bheidh beartaithe chun dlús a chur le tuilleadh bainne agus táirgí bainne a thomhailt agus a úsáid agus dlús a chur le méadú ar na cainníochtaí bainne agus táirgí bainne a onnmhaireofar as an Stát, a bhunú, a fheistiú agus a oibriú, agus socrú a dhéanamh chun iad a bhunú, a fheistiú agus a oibriú, agus cabhrú leis an oibriú sin, le hairgead nó ar shlí eile, sa Stát agus lasmuigh den Stát,
(h) paimfléid, fógraí irisí, iriseáin, nuachtáin, irisleabhair agus ábhar eile dá samhail is oiriúnach leis a fhoilsiú agus a imdháil, nó a chur dá bhfoilsiú agus dá n-imdháil, sa Stát agus lasmuigh den Stat, chun daoine a spreagadh chun tuilleadh bainne agus táirgí bainne a thomhailt agus a úsáid agus chun dlús a chur le méadú ar na cainníochtaí bainne agus táirgí bainne a onnmhaireofar as an Stát,
(i) aon ghníomhaíocht a mheasfaidh an Bord dá dtiocfaidh nó ar dócha go dtiocfaidh di, go díreach nó go neamhdhíreach, méadú ar na cainníochtaí bainne agus tráigí bainne a onnmhaireofar as an Stát a ghabhail de láimh, a chur chun cinn nó socrú a dhéanamh chun í a chur chun cinn, agus cabhrú, le hairgead nó ar shlí eile, lena cur chun cinn.
Feidhmeanna breise a shannadh don Bhord.
6.—(1) Féadfaidh an tAire, le toiliú an Aire Airgeadais, ó am go ham le hordú—
(a) cibé feidhmeanna breise maidir le bainne nó le táirgí bainne is oiriúnach leis a shannadh don Bhord,
(b) cibé foráil is dóigh leis is inmhianaithe nó is gá a dhéanamh maidir le nithe a ghabhfaidh le sannadh feidhmeanna don Bhord faoin Acht seo nó le comhlíonadh na bhfeidhmeanna sin ag an mBord nó a éireoidh as an sannadh nó an comhlíonadh sin.
(2) Féadfaidh an tAire le hordú ordú faoin alt seo (lena n-áirítear ordú faoin bhfo-alt seo) a chúlghairm nó a leasú.
An bhliain ainmniúcháin agus an lá ainmniúcháin.
7.—(1) Is iad na blianta ainmniúcháin chun críocha an Achta seo—
(a) an bhliain ar lá di an lá bunaithe, agus
(b) gach ceathrú bliain chomhleanúnach ina dhiaidh sin.
(2) Féadfaidh an tAire le rialacháin a dhéanfar faoin alt seo lá a cheapadh gach bliain ainmniúcháin chun bheith, chun críocha an Achta seo, ina lá ainmniúcháin an bhliain ainmniúcháin sin.
Comhdhéanamh an Bhoird.
8.—(1) Naonúr comhaltaí a bheidh ar an mBord agus beidh duine acu ina chathaoirleach agus gnathchomhaltaí a bheidh sna daoine eile.
(2) Is iad a bheidh ina gcomhaltaí den Bhord—
(a) triúr daoine a ainmneofar faoi alt 9 den Acht seo chun bheith ina gcomhaltaí den Bhord,
(b) duine amháin a ainmneofar faoi alt 10 den Acht seo chun bheith ina chomhalta den Bhord,
(c) duine amháin—
(i) is duine a ainmneoidh na monaróirí ceadúnaithe cáise chun bheith ina chomhalta den Bhord agus a ndéanfar fógra i scríbhinn maidir lena ainmniú a sheachadadh don Aire (maraon le ráiteas i scríbhinn arna shíniú ag an duine á chur in iúl go dtoilíonn sé leis an ainmniú) roimh an lá ainmniúcháin an bhliain ainmniúcháin a dhéanfar an t-ainmniú, nó
(ii) má tharlaíonn aon bhliain ainmniúcháin nach ndéanfaidh na monaróirí ceadúnaithe cáise, roimh an lá ainmniúcháin an bhliain sin, duine a ainmniú agus an fógra agus an ráiteas maidir leis an duine dá dtagraítear i bhfomhír (i) den mhír seo a sheachadadh don Aire, is duine a ainmneoidh an tAire agus a mheasfaidh an tAire a bheith ionadach do na monaróirí sin,
(d) duine amháin—
(i) is duine a ainmneoidh na monaróirí ceadúnaithe púdair bainne chun bheith ina chomhalta den Bhord agus a ndéanfar fógra i scríbhinn maidir lena ainmniú a sheachadadh don Aire (maraon le ráiteas i scríbhinn arna shíniú ag an duine á chur in iúl go dtoilíonn sé leis an ainmniú) roimh an lá ainmniúcháin an bhliain ainmniúcháin a dhéanfar an t-ainmniú, nó
(ii) má tharlaíonn aon bhliain ainmniúcháin nach ndéanfaidh na monaróirí ceadúnaithe púdair bainne, roimh an lá ainmniúcháin an bhliain sin, duine a ainmniú agus an fógra agus an ráiteas maidir leis an duine dá dtagraítear i bhfomhír (i) den mhír seo a sheachadadh don Aire, is duine a ainmneoidh an tAire agus a mheasfaidh an tAire a bheith ionadach do na monaróirí sin,
(e) duine amháin—
(i) is duine a ainmneoidh na monaróirí ceadúnaithe grabhróga seacláide chun bheith ina chomhalta den Bhord agus a ndéanfar fógra i scríbhinn maidir lena ainmniú a sheachadadh don Aire (maraon le ráiteas i scríbhinn arna shíniú ag an duine á chur in iúl go dtoilíonn sé leis an ainmniú roimh an lá ainmniúcháin an bhliain ainmniúcháin a dhéanfar an t-ainmniú, nó
(ii) má tharlaíonn aon bhliain ainmniúcháin nach ndéanfaidh na monaróirí ceadúnaithe grabhróga seaclaide, roimh an lá ainmniúcháin an bhliain sin, duine a ainmniú agus an fógra agus an ráiteas maidir leis an duine dá dtagraítear i bhfomhír (i) den mhír seo, is duine a ainmneoidh an tAire agus a mheasfaidh an tAire a bheith ionadach do na monaróirí sin,
(f) duine amháin a ainmneoidh an tAire agus a mheasfaidh an tAire a bheith ionadach don Chuideachta, agus
(g) oifigeach amhain don Aire a ainmneoidh an tAire.
(3) Déanfar na chéad chomhaltaí den Bhord a ainmniú roimh an lá bunaithe.
(4) Gach bliain ainmniúcháin i ndiaidh na bliana ainmniúcháin ar lá di an lá bunaithe ainmneofar comhaltaí an Bhoird roimh an lú lá de Dheireadh Fómhair an bhliain sin.
(5) San alt seo ciallaíonn “na monaróirí ceadúnaithe”, nuair a úsáidtear é maidir le cáis, púdar bainne nó grabhróg seacláide, gach duine a bhíonn ag gabháil do mhonarú cáise, púdair bainne nó grabhróige seacláide, de réir mar a bheidh, in áitreabh a fuarthas, a bunaíodh nó a chothabháiltear faoi réir agus de réir cheadúnas arna ndeonú faoi Acht na nUachtarlann, 1928, do na daoine sin nó dá réamhtheachtaithe i dteideal.
Triúr a ainmniú mar chomhaltaí den Bhord ag comhar-chumainn áirithe.
9.—(1) I rith na tréimhse míosa a chríochnóidh díreach roimh an lá ainmniúcháin aon bhliain ainmniúcháin, féadfaidh cumainn is dílseánaigh chláraithe ar uachtarlanna nó ar stáisiúin deighilte uachtair sna contaetha seo a leanas, is é sin, An Clár, Corcaigh, Ciarraí, Cill Chainnigh, Laoighis, Luimneach, Tiobraid Árann, Port Láirge nó Loch Garman, féadfaidh siad, de réir fhorálacha fho-alt (4) den alt seo, daoine a mholadh le hainmniú mar chomhaltaí den Bhord, ach ní mholfaidh cumann níos mó ná duine amháin faoin bhfo-alt seo aon bhliain ainmniúcháin áirithe.
(2) I rith na tréimhse míosa a chríochnóidh díreach roimh an lá ainmniúcháin aon bhliain ainmniúcháin, féadfaidh cumainn is dílseánaigh chláraithe ar uachtarlanna nó ar stáisiúin deighilte uachtair atá in áiteanna eile sa Stát, seachas na contaetha a shonraítear i bhfo-alt (1) den alt seo, féadfaidh siad, de réir fhorálacha fho-alt (4) den alt seo, daoine a mholadh le hainmniú mar chomhaltaí den Bhord, ach ní mholfaidh cumann níos mó ná duine amháin faoin bhfo-alt seo aon bhliain ainmniúcháin áirithe.
(3) I rith na tréimhse míosa a chríochnóidh díreach roimh an lá ainmniúcháin aon bhliain ainmniúcháin, féadfaidh cumainn is dílseánaigh chláraithe ar uachtarlanna nó ar stáisiúin deighilte uachtair atá in aon áit sa Stát, féadfaidh siad, de réir fhorálacha fho-alt (4) den alt seo, daoine a mholadh le hainmniú mar chomhaltai den Bhord, ach ní mholfaidh cumann níos mó ná duine amháin faoin bhfo-alt seo aon bhliain ainmniúcháin áirithe.
(4) Maidir le moladh aon bhliain ainmniúcháin faoi aon fho-alt acu sin roimhe seo, déanfar é i scr bhinn ag aon sé cinn de na cumainn a shonraítear san fho-alt faoina ndéanfar an moladh (agus, i gcás moladh faoi fho-alt (3) den alt seo, déarfar ann gur faoin bhfo-alt sin atáthar á dhéanamh) agus seachadfar don cheann comhairimh é (maraon le ráiteas i scríbhinn arna shíniú ag an duine a bheidh molta á rá go dtoilíonn sé leis an moladh) i rith na tréimhse míosa a chríochnóidh díreach roimh an lá ainmniúcháin an bhliain sin.
(5) Mura mbeidh ach an t-aon-duine amháin molta faoi fho-alt (1) den alt seo an lá ainmniúcháin aon bhliain ainmniúcháin áirithe, measfar an duine sin a bheith ainmnithe mar chomhalta den Bhord faoin alt seo ag na cumainn a shonraítear san fho-alt sin.
(6) Má bhíonn níos mó ná duine amháin molta faoi fho-alt (1) den alt seo an lá ainmniúcháin in aon bhliain ainmniúcháin áirithe, seolfar ballóid ina mbeidh gach cumann a shonraítear san fho-alt sin i dteideal vótáil do dhuine de na daoine a bheidh molta mar a dúradh, agus—
(a) i gcás ina bhfaighidh duine amhain níos mó vótaí ná aon duine eile sa bhallóid, measfar an duine sin a bheith ainmnithe mar chomhalta den Bhord faoin alt seo ag na cumainn a shonraítear san fho-alt sin, agus
(b) i gcás ina bhfaighidh beirt daoine nó níos mó an uimhir chéanna vótaí sa bhallóid, cinnfidh an ceann comhairimh trí chrannchur cé acu de na daoine sin a bheidh ainmnithe mar chomhalta den Bhord, agus an duine a chinnfear amhlaidh measfar é a bheith ainmnithe ina chomhalta den Bhord faoin alt seo ag na cumainn a shonraítear san fho-alt sin.
(7) (a) Beidh feidhm ag forálacha fho-ailt (5) agus (6) den alt seo maidir le hainmniú daoine a mholfar faoi fho-alt (2) den alt seo sa tslí chéanna ina bhfuil feidhm acu maidir le hainmniú daoine a mholtar faoi fho-alt (1) den alt seo.
(b) Beidh feidhm ag forálacha fho-ailt (5) agus (6) den alt seo maidir le hainmniú daoine a mholfar faoi fho-alt (3) den alt seo sa tslí chéanna ina bhfuil feidhm acu maidir le daoine a mholtar faoi fho-alt (1) den alt seo.
(8) Aon duine a mheasfar a bheith ainmnithe mar chomhalta den Bhord faoin alt seo ag na cumainn a shonraítear i bhfo-alt (3) den alt seo déanfaidh sé a dhícheall eolas a chur ar leasa speisialta na gcumann a dúradh maidir le huachtar úr a tháirgeadh agus an Bord a choimeád eolach ar na leasa sin.
Duine a ainmniú mar chomhalta den Bhord ag daoine a sholáthraíonn bainne d'uachtarlanna leis an gColáiste Ollscoile, Corcaigh, leis an gCuideachta Déirí-Dhéileála, Teoranta, nó a chomhchuideachtaí.
10.—(1) I rith na tréimhse míosa a chríochnóidh díreach roimh an lá ainmniúcháin aon bhliain ainmniúcháin áirithe, féadfaidh daoine a sholáthraíonn bainne d'uachtarlanna nó do stáisiúin deighilte uachtair arb iad a ndílseánaigh chláraithe an Coláiste Ollscoile, Corcaigh, an Chuideachta, Cuideachta Bhainne Chomhdhlúite na hÉireann (1928), Teoranta, nó Cumann Déiríochta Ath Trasna (1932), Teoranta, féadfaidh siad, de réir fhorálacha fho-alt (2) den alt seo daoine a mholadh le hainmniú mar chomhaltaí den Bhord, ach ní mholfaidh duine níos mó ná duine amháin faoin bhfo-alt seo aon bhliain ainmniúcháin áirithe.
(2) Maidir le moladh aon bhliain ainmniúcháin faoi fho-alt (1) den alt seo déanfar é i scríbhinn ag aon fiche duine a ndearna gach duine acu bainne a sholáthar roimh thosach na tréimhse míosa dá dtagraítear san fho-alt sin (1) d'aon uachtarlann nó stáisiúin deighilte uachtair agus seachadfar don cheann comhairimh é (maraon le ráiteas i scríbhinn arna shíniú ag an duine a bheidh molta á rá go dtoilíonn sé leis an moladh) i rith na tréimhse míosa a chríochnóidh díreach roimh an lá ainmniúcháin an bhliain sin.
(3) Má tharlaíonn, an lá ainmniúcháin aon bhliain ainmniúcháin áirithe, nach mbeidh ach an t-aon-duine amháin molta faoin alt seo measfar an duine sin a bheith ainmnithe mar chomhalta den Bhord faoin alt seo.
(4) Má tharlaíonn, an lá ainmniúcháin aon bhliain ainmniúcháin áirithe, go mbeidh níos mó ná duine amháin molta faoin alt seo, seolfar ballóid ina mbeidh gach duine a bheidh i dteideal faoin alt seo duine a ainmniú an bhliain ainmniúcháin sin chun bheith ina chomhalta den Bhord i dteideal vótáil do dhuine de na daoine a bheidh molta mar a dúradh, agus
(a) i gcás ina bhfaighidh duine amháin níos mó vótaí ná aon duine eile sa bhallóid, measfar an duine sin a bheith ainmnithe mar chomhalta den Bhord faoin alt seo, agus
(b) i gcás ina bhfaighidh beirt daoine nó níos mó an uimhir chéanna vótaí sa bhallóid, cinnfidh an ceann comhairimh trí chrannchur cé acu de na daoine sin a bheidh ainmnithe mar chomhalta den Bhord, agus an duine a chinnfear amhlaidh measfar é a bheith ainmnithe ina chomhalta den Bhord faoin alt seo.

11.—(1) Aon duine a bheidh, aon bhliain ainmniúcháin áirithe, tar éis ráiteas i scríbhinn a shíniú á chur in iúl go dtoilíonn sé lena ainmniú mar chomhalta den Bhord ag aon cheann de na grúpaí monaróirí a shonraítear in alt 8 den Acht seo, ní dhéanfaidh sé, an bhliain ainmniúcháin sin, ráiteas i scríbhinn a shíniú—
(a) á chur in iúl go dtoilíonn sé lena ainmniú mar chomhalta den Bhord ag aon ghrúpa eile de na grúpaí monaróirí a shonraítear san alt sin 8, nó
(b) á chur in iúl go dtoilíonn sé le moladh go n-ainmneofaí é mar chomhalta den Bhord faoi alt 9 nó 10 den Acht seo.
(2) Aon duine a bheidh, aon bhliain ainmniúcháin áirithe, tar éis ráiteas i scríbhinn a shíniú á chur in iúl go dtoilíonn sé le moladh faoi aon fhoráil d'alt 9 den Acht seo ó aon cheann de na cumainn a shonraítear san fhoráil sin go n-ainmneofaí mar chomhalta den Bhord é, ní dhéanfaidh sé, an bhliain ainmniúcháin sin, ráiteas i scríbhinn a shíniú—
(a) á chur in iúl go dtoilíonn sé le moladh faoi aon fhoráil eile atá, nó ó aon cheann eile de na cumainn a shonraítear, san alt sin 9 go n-ainmneofaí é mar chomhalta den Bhord,
(b) á chur in iúl go dtoilíonn sé lena ainmniú mar chomhalta den Bhord ag aon cheann de na grúpaí monaróirí a shonraítear in alt 8 den Acht seo, nó
(c) á chur in iúl go dtoilíonn sé le moladh go n-ainmneofaí é mar chomhalta den Bhord faoi alt 10 den Acht seo.
(3) Aon duine a bheidh, aon bhliain ainmniúcháin áirithe, tar éis ráiteas i scríbhinn a shíniú á chur in iúl go dtoilíonn sé le moladh ó aon duine de na daoine a shonraítear in alt 10 den Acht seo go n-ainmneofaí mar chomhalta den Bhord é, ní dhéanfaidh sé, an bhliain ainmniúcháin sin, ráiteas i scríbhinn a shíniú—
(a) á chur in iúl go dtoilíonn sé le moladh ó aon duine eile de na daoine a shonraítear san alt sin 10 go n-ainmneofaí é mar chomhalta den Bhord,
(b) á chur in iúl go dtoilíonn sé lena ainmniú mar chomhalta den Bhord ag aon cheann de na grúpa monaróirí a shonraítear in alt 8 den Acht seo, nó
(c) á chur in iúl go dtoilíonn sé le moladh go n-ainmneofaí é mar chomhalta den Bhord faoi alt 9 den Acht seo.
(4) Má shíníonn duine ráiteas contrártha d'aon cheann de na forálacha sin roimhe seo den alt seo, beidh an t-ainmniú nó an moladh lena mbainfidh an ráiteas ar neamhní.
Forálacha maidir le ballóidí faoi ailt 9 agus 10.
12.—(1) (a) Seolfar ballóid faoi alt 9 nó alt 10 den Acht seo de réir fhorálacha rialachán a dhéanfaidh an tAire faoi alt seo.
(b) Gan dochar do ghinearáltacht mhír (a) den fho-alt seo, féadfaidh foráil a bheith i rialacháin faoin bhfo-alt seo i dtaobh na nithe seo:
(i) foirm an pháipéir bhallóide a bheidh le húsáid sa bhallóid agus foirm an mholta dá dtagraítear in ailt 9 agus 10 den Acht seo,
(ii) an tráth agus an tslí a n-iarrfar go n-eiseofaí foirmeacha molta agus an tráth agus an tslí a n-eiseofar na foirmeacha sin,
(iii) na sonraí nach mór a bheith san fhoirm mholta agus sa pháipéar ballóide maidir le daoine a mholfar go n-ainmneofaí iad faoi alt 9 nó 10 den Acht seo,
(iv) an tslí ina gcomhlánófar agus ina marcálfar foirmeacha molta agus páipéir bhallóide,
(v) an nós imeachta chun a dhéanamh amach cé hiad na daoine a bheidh i dteideal, aon bhliain ainmniúcháin áirithe, daoine a mholadh lena n-ainmniú faoi alt 10 den Acht seo agus chun vótáil i mballóid faoin alt sin agus chun céannacht daoine a mholfaidh daoine go n-ainmneofaí iad mar a dúradh nó a votálfaidh in aon bhallóid den sórt sin nó céannacht daoine a mholfar amhlaidh a dheimhniú,
(vi) dearbhuithe reachtúla a thógáil agus a ghlacadh maidir le céannacht—
(I) daoine a mholfaidh daoine go n-ainmneofaí iad faoi alt 10 den Acht seo agus a votálfaidh i mballóidí faoin alt sin, agus
(II) daoine a mholfar go n-ainmaeofaí iad faoin alt sin 10,
(vii) an tráth agus an tslí a n-eiseofar páipéir bhallóide chun daoine agus chun cumainn a mbeidh vótaí acu,
(viii) na daoine a eiseoidh na foirmeacha molta agus na páipéir bhallóide,
(ix) an tráth agus an tslí a gcuirfear foirmeacha molta agus páipéir bhallóide comhlánaithe chun an chinn comhairimh,
(x) an ceann comhairimh do scrúdú páipéar ballóide,
(xi) an tráth agus an tslí a gcomhairfear vótaí, agus
(xii) an ceann comhairimh do dhiúltú do pháipéir bhallóide agus do dhílamháil vótaí.
(2) Gach duine nó cumann a bheidh i dteideal vótáil i mballóid faoi alt 9 nó 10 den Acht seo is aon vóta amháin a bheidh sé i dteideal a chaitheamh.
(3) Is é a bheidh ina cheann comhairimh chun críocha ballóide faoi alt 9 nó 10 den Acht seo—
(a) i gcás ballóid a sheolfar roimh an lá bunaithe, duine a cheapfaidh an tAire,
(b) in aon chás eile, príomh-oifigeach an Bhoird.
(4) Déanfar an costas agus an caiteachas maidir le ballóid (seachas aon chostais faoina rachaidh an Coláiste Ollscoile, Corcaigh, an Chuideachta, Cuideachta Bhainne Chomhdhlúite na hÉireann (1928), Teoranta, Cuideachta Déiríochta Áth Trasna (1932), Teoranta, cumann, daoine a bheidh molta go n-ainmneofaí iad mar chomhaltaí den Bhord, daoine a bheidh i dteideal na daoine sin a mholadh nó daoine a bheidh i dteideal vótáil sa bhallóid) faoi alt 9 nó 10 den Acht seo, a íoc—
(a) i gcás ballóid a sheolfar roimh an lá bunaithe, as an gciste toradh déiríochta (praghas a dhéanamh seasmhach) agus
(b) in aon chás eile, as an gCiste.
Cathaoirleach an Bhoird.
13.—(1) Déanfaidh an Bord, ó am go ham de réir mar is gá comhalta den Bhord a cheapadh chun bheith ina chathaoirleach ar an mBord.
(2) Cinnfidh an Bord an nós imeachta chun comhalta a roghnú lena cheapadh mar chathaoirleach ar an mBord agus, mura gcinnfidh an Bord an nós imeachta nó mura roghnófar comhalta de réir an nós imeachta, roghnófar an cathaoirleach trí thoghchán a sheolfar i measc comhaltaí an Bhoird ag cruinniú den Bhord agus beidh feidhm ag forálacha mhíreanna (a) go (h) d'fho-alt (1) d'alt 43 den Acht Rialtais Áitiúil, 1941, maidir leis an toghchán ionann agus dá mba thagairtí do chomhaltaí den Bhord na tagairtí atá sna míreanna sin do chomhaltaí.
(3) Féadfaidh cathaoirleach an Bhoird éirí as a oifig tráth ar bith trí litir go dtí príomh-oifigeach an Bhoird agus beidh éifeacht ag an éirí-as amhail ar an dáta a gheobhaidh an príomh-oifigeach an litir agus, má leanann sé de bheith ina chomhalta den Bhord, beidh sí intofa chun a athcheaptha mar chathaoirleach ar an mBord.
(4) Sealbhóidh cathaoirleach an Bhoird a oifig go dtí deireadh a théarma oifige mar chomhalta den Bhord mura n-éireoidh sé as a oifig roimhe sin.
Téarma oifige comhaltaí an Bhoird.
14.—(1) Tosóidh téarma oifige chomhalta den Bhord—
(a) i gcás chéad chomhalta, an lá bunaithe,
(b) i gcás comhalta a líonann corrfholúntas, lá a ainmnithe, agus
(c) i ngach cás eile, an lú lá de Dheireadh Fómhair an bhliain ainmniúcháin iomchuí.
(2) Murab éag, éirí as nó cur as oifig roimhe sin dó, beidh deireadh le téarma oifige chomhalta den Bhord—
(a) i gcás comhalta a líonann corrfholúntas, an lá a chríochnódh téarma oifige an chomhalta arb é a éag, a éirí as, a chur as oifig nó a theacht faoi dhícháilíocht ba chúis leis an bhfolúntas dá mba nár éag sé, nár éirigh sé as, nár cuireadh as oifig é nó nár tháinig sé faoi dhícháilíocht, cibé acu é, agus
(b) in aon chás eile, an 30ú lá de Mheán Fómhair an bhliain ainmniúcháin tar éis dá théarma oifige tosú.
Comhaltaí den Bhord d'éirí as agus a bheith dícháilithe.
15.—(1) Féadfaidh comhalta den Bhord éirí as a oifig tráth ar bith trí litir go dtí príomh-oifigeach an Bhoird agus beidh éifeacht ag an éirí-as amhail ar an dáta a gheobhaidh príomhoifigeach an Bhoird an litir.
(2) Beidh comhalta den Bhord dícháilithe chun oifig a shealbhú agus scoirfidh sé d'oifig a shealbhú má bhreithnítear ina fhéimheach é nó má dhéanann sé imshocraíocht nó comhshocraíocht le creidiúnaithe, nó má thugann cúirt dlínse inniúla pianbhreith phríosúnachta nó phianseirbhíse air nó má scoireann sé de bheith ina ghnáthchónaí sa Stát nó má bhíonn sé as láthair ar aon chúinse, seachas le cead ón mBord nó mar gheall ar bhreoiteacht, ar feadh aon tréimhse de thrí mhí as a chéile, ó gach cruinniú den Bhord a chomórfar i rith na tréimhse sin.
(3) Cuirfidh príomh-oifigeach an Bhoird éirí-as nó dícháiliú in iúl den Aire.
Féadfar comhaltaí a athcheapadh.
16.—Féadfar comhalta den Bhord a dtiocfaidh deireadh lena théarma oifige trí imeacht aimsire a athcheapadh.

17.—Féadfaidh an tAire tráth ar bith comhalta den Bhord, nach comhalta a ainmníodh faoi mhír (c), (d) nó (e) d'fho-alt (2) d'alt 8 nó faoi alt 9 nó 10 den Acht seo, a chur as oifig.
Corrfholúntas i measc comhaltaí an Bhoird.
18.—(1) Má tharlaíonn corrfholúntas i measc comhaltaí an Bhoird líonfar é tríd an Aire d'ainmniú—
(a) i gcás arbh oifigeach don Aire an comhalta ba chúis leis an bhfolúntas, oifigeach don Aire,
(b) i gcás a ndearnadh an comhalta ba chúis leis an bhfolúntas a ainmniú ag aon ghrúpa daoine, monaróirí nó cumann, nó gur dhuine é é a mheas an tAire a bheith ionadach d'aon ghrúpa daoine, monaróirí nó cumann nó don Chuideachta, duine a mheasfaidh an tAire a bheith ionadach don ghrúpa sin nó don Chuideachta, de réir mar a bheidh, agus
(c) i gcás arbh é ba chúis leis an bhfolúntas aon ghrúpa daoine, monaróirí nó cumann dá sonraítear in ailt 9 agus 10 den Acht seo do mhainneachtain duine a ainmniú mar chomhalta, duine a mheasfaidh an tAire a bheith ionadach don ghrúpa sin.
(2) (a) Más rud é—
(i) maidir le foráil ainmniúcháin, nach mbeidh aon duine molta an lá ainmniúcháin aon bhliain ainmniúcháin áirithe faoi bhforáil ainmniúcháin sin, nó
(ii) go dtarlóidh do dhuine a bheidh ainmnithe mar chomhalta den Bhord aon bhliain ainmniúcháin áirithe faoi fhoráil ainmniúcháin nó faoi mhír (c), (d) nó (e) d'fho-alt (2) d'alt 8 den Acht seo, go n-éagfaidh sé roimh thosach a théarma oifige mar chomhalta den sórt sin,
measfar corrfholúntas a bheith i measc comhaltaí an Bhoird an lá a thosóidh téarma oifige na gcomhaltaí den Bhord a bheidh ainmnithe an bhliain sin.
(b) Is foráil ainmniúcháin chun críocha an fho-ailt seo gach ceann de na forálacha seo a leanas den Acht seo, is é sin, fo-ailt (1), (2) agus (3) d'alt 9 agus alt 10.
Luach saothair agus costais comhaltaí an Bhoird.
19.—Íocfar le comhalta den Bhord amach as an gCiste cibé luach saothair agus liúntais i leith costas a chinnfidh an tAire ó am go ham tar éis dó dul i gcomhairle leis an Aire Airgeadais.
Comhaltaí an Bhoird do nochtadh leasa i gconradh a bheidh beartaithe.
20.—Aon chomhalta den Bhord ag a mbeidh—
(a) leas ar bith in aon chuideachta nó gnólacht a mbeartóidh an Bord aon chonradh a dhéanamh leis, nó
(b) leas ar bith in aon chonradh a bheartóidh an Bord a dhéanamh,
nochtfaidh sé don Bhord go bhfuil an leas sin aige agus cad é an cineál leasa é, agus ní ghlacfaidh sé aon pháirt in aon bhreithniú nó cinneadh a dhéanfaidh an Bord maidir leis an gconradh, agus taifeadfar i miontuairiscí an Bhoird go ndearnadh an nochtadh sin.
Beidh comhalta de cheachtar Teach den Oireachtas dícháilithe chun bheith ina chomhalta den Bhord.
21.—(1) Má thagann comhalta den Bhord chun bheith ina chomhalta de cheachtar Teach den Oireachtas, ansin, ar é theacht, faoi Bhuan-Orduithe an Tí sin, chun teideal a bheith aige suí sa Teach sin, scoirfidh sé de bheith ina chomhalta den Bhord.
(2) Aon duine a bheidh, de thuras na huaire, i dteideal faoi Bhuan-Orduithe cheachtar Teach den Oireachtas suí sa Teach sin beidh sé, an fad a bheidh sé i dteideal amhlaidh, dícháilithe chun bheith ina chomhalta den Bhord.
Cruinnithe agus nós imeachta an Bhoird.
22.—(1) Beidh ag an mBord cibé cruinnithe agus cibé méid cruinnithe is gá chun a fheidhmeanna a chomhlíonadh go cuí.
(2) Féadfaidh an tAire dáta, am agus ionad chéad chruinniú an Bhoird a shocrú.
(3) Triúr is córam do chruinniú den Bhord.
(4) Ag cruinniú den Bhord—
(a) is é cathaoirleach an Bhoird, má bhíonn sé i láthair a bheidh ina chathaoirleach ar an gcruinniú,
(b) má bhíonn agus an fad a bheidh cathaoirleach an Bhoird as láthair nó má bhíonn oifig an chathaoirligh folamh, déanfaidh na comhaltaí den Bhord a beidh i láthair duine dá líon a roghnú chun bheith ina chathaoirleach ar an gcruinniú.
(5) Déanfar gach ceist ag cruinniú den Bhord a chinneadh le tromlach vótaí na gcomhaltaí a bheidh i láthair agus a vótalfaidh ar an gceist agus, i gcás comhionannas vótaí, bheidh an dara vóta nó vóta réitigh ag cathaoirleach an chruinnithe.
(6) Féadfaidh an Bord gníomhú d'ainneoin folúntas nó folúntais i measc a chomhaltaí.
(7) Faoi réir fhorálacha an Achta seo, rialóidh an Bord nós imeachta agus gnó an Bhoird le buan-orduithe nó ar shlí eile.
Séala an Bhoird.
23.—(1) Soláthróidh an Bord séala dó féin, agus fíordheimhneofar séala an Bhoird le síniú chathaoirleach an Bhoird nó chomhalta éigin eile den Bhord a mbeidh údarás aige ón mBord gníomhú chuige sin maraon le síniú oifigigh don Bhord a mbeidh údarás aige ón mBord gníomhú chuige sin.
(2) Tabharfar aird bhreithiúnach ar shéala an Bhoird, agus glacfar i bhfianaise gach doiciméad a airbheartóidh a bheith ina ionstraim a rinne an Bord agus a bheith séalaithe le séala an Bhoird (agus é airbheartaithe gur fíordheimhníodh de réir an ailt seo é) agus measfar gurb í an ionstraim sin é gan a thuilleadh cruthúnais, mura suítear a mhalairt.
Conarthaí agus ionstraimí nach mbeidh faoi shéala.
24.—Aon chonradh nó ionstraim nár ghá a bheith faoi shéala dá mba phearsa a dhéanfadh nó d'fhorghníomhódh é, féadfaidh aon duine a bheidh údaraithe go ginearálta nó go speisialta ag an mBord chuige sin é a dhéanamh nó a fhorghníomhú thar ceann an Bhoird.
Foireann an Bhoird.
25.—(1) Féadfaidh an Bord ó am go ham de réir mar is gá cibé daoine agus cibé méid daoine is cuí leis a cheapadh chun bheith ina n-oifigigh agus ina seirbhísigh don Bhord, ach, faoi réir fho-alt (6) den alt seo, ní cheapfar duine faoin alt seo chun bheith in oifigeach don Bhord mura mbeifear tar éis é a roghnú trí chomórtas poiblí.
(2) Sealbhóidh oifigeach nó seirbhíseach don Bhord a oifig nó a fhostaíocht ar cibé téarmaí agus coinníollacha a chinnfidh an Bord ó am go ham.
(3) Íocfaidh an Bord lena oifigigh agus lena sheirbhísigh, as an gCiste, cibé luach saothair agus liúntais a chinnfidh—
(a) an tAire, i gcás an phríomh-oifigigh, ó am go ham le toiliú an Aire Airgeadais, agus
(b) an Bord ó am go ham in aon chás eile.
(4) Féadfaidh an Bord tráth ar bith aon oifigeach no seirbhíseach don Bhord a dhíchur ó bheith ina oifigeach nó ina sheirbhíseach dó.
(5) A mhéid a bheidh téarmaí agus coinníollacha seirbhíse (lena n-áirítear téarmaí agus coinníollacha maidir le luach saothair agus liúntais) a chinnfear faoi fho-ailt (2), (3) agus (4) den alt seo nó a shonraítear sna fo-ailt sin ar neamhréir le haon fhoráil a bheidh i bhfeidhm de thuras na huaire de chonradh seirbhíse a shonraítear in alt 51 den Acht seo maidir le haon oifigeach nó seirbhíseach don Bhord, ní bheidh feidhm acu maidir leis an oifigeach nó an seirbhíseach sin mura gcuirfidh agus go dtí go gcuirfidh sé in iúl don Bhord i scríbhinn gur mhaith leis feidhm a bheith ag na forálacha agus na coinníollacha sin maidir leis, agus, má chuireann sé sin in iúl don Bhord, scoirfidh an fhoráil sin den chonradh seirbhíse d'fheidhm a bheith aici maidir leis, ar sin a bheith curtha in iúl.
(6) Ní bheidh feidhm ag an gceanglas faoi fho-alt (1) den alt seo, i dtaobh duine a roghnú trí chomórtas poiblí, maidir le:
(a) duine a bhí, díreach roimh lá an aistrithe, ina oifigeach don Choiste,
(b) ceapachán is ardú céime do dhuine is oifigeach don Bhord cheana féin,
(c) oifig ar gá, i dtuairim an Bhoird, saincháilíochtaí chuici nach gnách ag daoine, nó
(d) oifig ar go ceann tréimhsí teoranta, tréimhsí dhá bhliain ar a mhéid, a dhéantar ceapacháin chuici.
(7) Má thagann oifigeach nó seirbhíseach don Bhord chun bheith ina chomhalta de cheachtar Teach den Oireachtas ansin, ar é a theacht, faoi Bhuan-Orduithe an Tí sin, chun bheith i dteideal suí sa Teach sin, scoirfidh sé de bheith ina oifigeach nó ina sheirbhíseach den sórt sin.
(8) Aon duine a bheidh de thuras na huaire, faoi Bhuan-Orduithe cheachtar Teach den Oireachtas, i dteideal suí sa Teach sin, beidh sé dícháilithe chun bheith ina oifigeach nó ina sheirbhíseach don Bhord.
Príomh-oifigeach an Bhoird.
26.—(1) Beidh príomh-oifigeach ann don Bhord.
(2) Caithfidh príomh-oifigeach an Bhoird iomlán a ama lena dhualgais mar phríomh-oifigeach agus ní shealbhóidh sí aon oifig ná post eile gan toiliú an Bhoird.
(3) Ní bheidh príomh-oifigeach an Bhoird ina chomhalta den Bhord.
Aoisliúntais d'oifigigh agus do sheirbhísigh an Bhoird.
27.—(1) Féadfaidh an Bord scéim nó scéimeanna a ullmhú agus a chur faoi bhráid an Aire chun pinsin, aiscí agus liúntais eile a dheonú, ar scor dóibh, do cibé oifigigh agus seirbhísigh don Bhord is oiriúnach leis, nó ina leith.
(2) Socróidh gach scéim den sórt sin an tráth scoir agus na coinníollacha scoir do na daoine uile a mbeidh pinsin, aiscí nó liúntais iníoctha leo nó ina leith faoin scéim ar scor dóibh, agus féadfar tráthanna agus coinníollacha éagsúla a shocrú maidir le haicmí éagsúla daoine.
(3) Féadfaidh an Bord tráth ar bith scéim do leasú scéime a cuireadh faoi bhráid an Aire agus a ceadaíodh roimhe sin faoin alt seo a ullmhú agus a chur faoi bhráid an Aire.
(4) Déanfaidh an Bord scéim a chuirfear faoi bhráid an Aire faoin alt seo, má cheadaíonn an tAire í le comhthoiliú an Aire Airgeadais, a chur i gcrích de réir a téarmaí.
(5) Má tharlaíonn aon díspóid maidir le héileamh aon duine ar aon phinsean, aisce nó liúntas is iníoctha de bhun scéime faoi alt seo nó i dtaobh méid an chéanna, cuirfear an díospóid sin faoi bhráid an Aire agus tarchuirfidh seisean chun an Aire Airgeadais í chun a chinneadh a fháil.
(6) Gach scéim a chuirfear faoi bhráid an Aire agus a cheadófar faoin alt seo leagfar í faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a ceadaithe agus má dhéanann ceachtar Teach, laistigh den lá agus fiche a shuífidh an Teach sin tar éis an scéim a leagan faoina bhráid, rún a rith ag neamhniú na scéime, beidh scéim ar an neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin scéim.
(7) Íocfar amach as an gCiste an costas agus an caiteachas faoina rachaidh an Bord ag ullmhú scéime faoin alt seo agus á cur i gcrích.
Feidhmeanna an Bhoird a chomhlíonadh.
28.—Féadfaidh an Bord aon fheidhmeanna a fhorchuirtear ar an mBord leis an Acht seo a chomhlíonadh trí aon chomhalta den Bhord nó aon oifigeach nó seirbhíseach don Bhord a bheidh údaraithe chuige sin ag an mBord.
An Ciste Táirgí Déiríochta.
29.—(1) Bunóidh, cothabhálfaidh agus bainisteoidh an Bord, de réir an Achta seo, ciste (dá ngairtear an Ciste san Acht seo) ar a dtabharfar an Ciste Táirgí Déiríochta.
(2) Beidh feidhm ag na forálacha seo a leanas maidir leis an gCiste:
(a) íocfar isteach sa Chiste an t-airgead go léir a gheobhaidh an Bord as bainne agus táirgí bainne a dhíol agus i leith tobhaigh ar bhainne agus ar im faoin Acht seo agus aon airgead eile a gheobhaidh an Bord,
(b) íocfar amach as an gCiste luach ceannaigh an bhainne agus na dtáirgí bainne a cheannóidh an Bord agus méid aon chaiteachais (lena n-áirítear costas iompair, láimhsithe, stórála (lena n-áirítear fuarstóráil), pacála agus árachais bainne agus táirgí bainne) faoina rachaidh an Bord i ndáil lena idirbhearta maidir le bainne agus táirgí bainne a cheannach nó a dhíol agus an costas agus an caiteachas eile go léir faoina rachaidh an Bord ag comhlíonadh a dhualgas nó ar shlí eile faoin Acht seo,
(c) féadfar suimeanna a gheofar ar iasacht faoi alt 30 den Acht seo a chur faoi urrús an Chiste,
(d) féadfaidh an Bord an méid sin den Chiste nach mbeidh ag teastáil faoi láthair i dtuairim an Bhoird chun íocaíochtaí a dhéanamh faoi mhír (b) den fho-alt seo a infheistiú in urrúis a mbeidh údarás dlí de thuras na huaire ag iontaobhaithe cistí iontaobhais a infheistiú iontu,
(e) féadfaidh an Bord ó am go ham as a chomhairle féin aon airgead (is cuid den Chiste) a bheidh infheistithe faoin bhfo-alt seo a athrú nó a aistriú isteach in infheistíochtaí eile a údaraítear leis an bhfo-alt seo,
(f) déanfar na díbhinní agus an t-ús uile a gheobhaidh an Bord ar infheistíochtaí (is cuid den Chiste) a dhéanfaidh sé faoin bhfo-alt seo agus fós toradh díola aon infheistíochtaí den sórt sin a íoc isteach sa Chiste.
Cumhacht an Bhoird chun airgead a fháil ar iasacht.
30.—Féadfaidh an Bord le toiliú an Aire, cibé suimeanna is dóigh leis an mBord ó am go ham is gá a fháil ar iasacht chun críocha caipitiúla nó chun críocha reatha.
Iasachtaí a ráthú.
31.—(1) Féadfaidh an tAire, más oiriúnach leis agus le toiliú an Aire Airgeadais, iasacht chun an Bhoird a ráthú.
(2) Aon uair a ráthóidh an tAire iasacht faoin alt seo, féadfaidh sé ráthaíocht a thabhairt, i cibé foirm agus slí agus ar cibé téarmaí agus coinníollacha a cheadóidh an tAire Airgeadais, go n-aisíocfaidh an Bord go cuí príomhshuim na hiasachta nó go n-íocfar ús ar an iasacht nó go ndéanfar an phríomhshuim sin a aisíoc agus an t-ús sin a íoc.
(3) Ní dhéanfaidh an tAire na cumhachtaí a thugtar le fo-ailt (1) agus (2) den alt seo a fheidhmiú i slí gur mó ná £5,000,000 an méid, nó an méid comhiomlán, príomhshuime a dhlífidh sé aon tráth a íoc ar scór aon ráthaíochta nó ráthaíochtaí faoi na fo-ailt sin a bheidh i bhfeidhm de thuras na huaire i dteannta méid na príomhshuime (más ann) a bheidh íoctha cheana féin ag an Aire ar scór aon ráthaíochtaí den sórt sin agus nach mbeidh aisíoctha ag an mBord.
(4) I gcás ina dtabharfar nó inar tugadh ráthaíocht faoin alt seo, tabharfaidh an Bord don Aire, má fhoréilíonn an tAire é, cibé urrús a shonrófar san fhoréileamh chun aisíoc aon airgid a urrú don Aire a bheidh sé faoi dhliteanas a íoc nó tar éis a íoc faoin ráthaíocht.
(5) A luaithe is féidir é tar éis deireadh gach bliana airgeadais, leagfaidh an tAire faoi bhráid gach Tí den Oireachtas ráiteas ina luafar, maidir le gach ráthaíocht faoin alt seo a tugadh i rith na bliana sin nó a tugadh aon tráth roimh thosach, agus a bhí i bhfeidhm i dtosach, na bliana sin—
(a) sonraí na ráthaíochta,
(b) má rinne an tAire aon íocaíocht faoin ráthaíocht roimh dheireadh na bliana sin, méid na híocaíochta agus an méid a aisíocadh (má aisíocadh) leis an Aire ar scór na híocaíochta,
(c) an méid príomhshuime a bhí faoi réim na ráthaíochta agus gan aisíoc i ndeireadh na bliana sin.
(6) Déanfaidh an Bord aon airgead a d'íoc an tAire faoi ráthaíocht faoin alt seo a aisíoc leis an Aire (maraon le hús air, má cheanglaíonn an tAire Airgeadais sin, de réir cibé rátaí a cheapfaidh an tAire Airgeadais) laistigh de dhá bhliain ó dháta an airleacain.
(7) Má bhíonn an t-airgead go léir, nó aon chuid den airgead, a cheanglaíonn fo-alt (6) den alt seo a aisíoc leis na Aire gan aisíoc de réir an fho-ailt sin, déanfar an méid a bheidh gan aisíoc amhlaidh a aisíoc leis an bPríomh-Chiste as airgead a sholáthróidh an tOireachtas.
(8) D'ainneoin airgead a sholáthar faoi fho-alt (7) den alt seo chun suim a aisíoc leis an bPríomh-Chiste, leanfaidh an Bord de bheith faoi dhliteanas don Aire i leith na suime sin agus déanfaidh an Bord an tsuim sin (maraon le hús uirthi, má cheanglaíonn an tAire Airgeadais é, de réir cibé rátaí a cheapfaidh an tAire Airgeadais) a aisíoc leis an Aire cibé tráthanna agus i cibé tráthchodanna a cheapfaidh an tAire Airgeadais agus, mura ndéantar aisíoc mar a dúradh, beidh sé, gan dochar d'aon mhodh gnóthaithe eile, inghnóthaithe mar fhiach gnáth-chonartha in aon chúirt dlínse inniúla.
(9) Déanfar airgead a aisíocfaidh an Bord leis an Aire nó a ghnóthóidh an tAire ón mBord faoin alt seo a íoc isteach sa Státchiste nó a chur chun tairbhe don Státchiste.
(10) Is as an bPríomh-Chiste nó a thoradh fáis a airleacfar an t-airgead go léir a theastóidh ó am go ham ón Aire chun suimeanna a íoc a thiocfaidh chun bheith iníoctha aige faoin alt seo.
(11) Féadfaidh an tAire Airgeadais, d'fhonn soláthar a dhéanamh faoi chomhair airleacan as an bPríomh-Chiste faoin alt seo, aon suim nó suimeanna a thógáil ar iasacht ó dhuine ar bith agus féadfaidh sé, chun críocha na hiasachta sin, urrúis a bhunú agus a eisiúint agua iad faoi cibé ráta úis agus faoi réir cibé coinníollacha i dtaobh aisíoca, fuascailte nó eile is oiriúnach leis agus íocfaidh sé isteach sa Státchiste an t-airgead a thógfar ar iasacht amhlaidh.
(12) Déanfar príomhshuim agus ús aon urrús a eiseofar faoin alt seo agus na costais faoina rachfar i ndáil leis na hurrúis sin a eisiúint a mhuirearú ar an bPríomh-Chiste nó a thoradh fáis agus beidh siad iníoctha as an gcéanna.
Deontais don Bhord.
32.—(1) Gach bliain airgeadais, féadfar deontas nó deontais de cibé méid nó méideanna a shocróidh an tAire, le toiliú an Aire Airgeadais tar éis dó dul i gcomhairle leis an mBord maidir le clár caiteachais an Bhoird don bhliain airgeadais sin, a íoc leis an mBord as airgead a sholáthróidh an tOireachtas.
(2) Faoi réir fho-alt (3) den alt seo, úsáidfidh an Bord deontas faoin alt seo chun cibé críche nó críocha agus faoi réir cibé coinníollacha a shonróidh an tAire (má shonraíonn) i scríbhinn, le toiliú an Aire Airgeadais, an tráth a íocfar an deontas.
(3) Féadfaidh an tAire, más oiriúnach leis é agus le toiliú an Aire Airgeadais, na críocha nó na coinníollacha a shonróidh an tAire faoi fho-alt (2) den alt seo maidir le deontas a athrú i slí ar bith nó críoch a n-úsáidfear chuici nó coinníoll ar faoina réir a úsáidfear (nach coinníoll nó críoch a shonraítear faoin bhfo-alt sin (2)) an deontas a shonrú agus má dhéanann an tAire críoch a n-úsáidfear chuici, nó coinníollacha ar faoina réir a úsáidfear, an deontas a shonrú faoin alt seo, úsáidfidh an Bord an deontas chun na críche sin nó faoi réir na gcoinníollacha sin, de réir mar a bheidh.
(4) Ní úsáidfear deontas faoin alt seo chun íoc as níos mó ná—
(a) dhá thrian aon chaillteanais faoina rachaidh an Bord maidir le honnmhairiú táirgí bainne, nó
(b) dhá thrian aon chúnamh airgid, deontais nó íocaíochta eile dá shamhail a dhéanfaidh an Bord maidir le honnmhairiú táirgí bainne,
agus ní dhéanfar críoch nó coinníoll a bheidh ar neamhréir le forálacha an fho-ailt seo a shonrú faoi fho-alt (2) nó (3) den alt seo.
Oifigí agus áitribh.
33.—(1) Soláthróidh an Bord dó féin cibé oifigí, stórais, earralanna, siopaí agus áitribh eile sa Stát agus lasmuigh den Stát is dóigh leis a bheith riachtanach.
(2) Chun críocha fho-alt (1) den alt seo féadfaidh an Bord—
(a) aon talamh nó aon oifigí, stórais, earralanna, siopaí nó áitribh eile a cheannach nó a ghlacadh ar léas, agus
(b) oifigí, stórais, earralanna, siopaí agus áitribh eile a thógáil, a fheistiú agus a chothabháil.
(3) Féadfaidh an Bord aon talamh nó aon oifigí, stórais, earralanna, siopaí nó áitribh eile a bheidh ar teachtadh aige agus nach mbeidh ag teastáil a thuilleadh chun a fheidhmeanna a chomhlíonadh, a dhíol, a léasadh nó a mhalartú.
An Bord d'iompar, do láimhsiú, do stóráil agus do phacáil bainne agus táirgí bainne.
34.—(1) Féadfaidh an Bord cibé saoráidí maidir le hiompar, láimhsiú, stóráil agus pacáil bainne agus táirgí bainne is dóigh leis a bheith riachtanach a sholáthar dó féin.
(2) Gan dochar do ghinearáltacht fho-alt (1) den alt seo, féadfaidh an Bord—
(a) socrú a dhéanamh le húinéirí saoráidí den sórt sin maidir lena n-úsáid ag an mBord nó thar ceann an Bhoird,
(b) aon talamh nó áitreabh a cheannach nó a ghlacadh ar léas,
(c) áitribh a thógáil, a fheistiú agus a chothabháil,
(d) inneallra, trealamh, longa agus feithiclí a cheannach, a ghlacadh ar fruiliú nó a chairtfhostú.
Coistí comhairleacha réigiún.
35.—(1) Féadfaidh an Bord, más oiriúnach leis, coistí comhairleacha réigiún a bhunú i cibé slí is oiriúnach leis a bheidh comhdhéanta de tháirgeoirí bainne, de dhaoine is ionadaithe do mhonaróirí táirgí bainne agus de dhaoine is ionadaithe do thion scal na déiríochta i gcoitinne nó a bheidh comhdhéanta d'aon aicme nó de roinnt de na haicmí sin daoine, chun an Bord a chomhairliú maidir le comhlíonadh a fheidhmeanna agus féadfaidh an Bord, más oiriúnach leis, iomlán caiteachais aon choistí a bhunófar faoin alt seo (lena n-áirítear costais taistil agus cothabhála comhaltaí na gcoistí sin) nó cibé cuid is cuí leis den chaiteachas sin a íoc amach as an gCiste.
(2) Beidh ceapadh duine chun gníomhú mar chomhalta de choiste a bhunófar faoin alt seo faoi réir cibé coinníollacha (lena n-áirítear coinníollacha maidir le téarma agus seilbh oifige an chomhalta) is oiriúnach leis an mBord a fhorchur nuair a bheidh an ceapadh á dhéanamh.
(3) Féadfaidh an Bord tráth ar bith coiste a bheidh ceaptha faoin alt seo a dhíscaoileadh.
Tobhach ar bhainne.
36.—(1) Íocfaidh gach dílseánach cláraithe uachtarlainne nó stáisiúin deighilte uachtair leis an mBord tobhach ar bhainne a cheannóidh sé nó a gheobhaidh sé ar shlí eile, seachas ó dhílseánach eile den saghas céanna, tráth a bheidh ráta le haghaidh tobhaigh den sórt sin socraithe de bhua ordú faoi fho-alt (3) den alt seo, agus beidh sa tobhach cibé méid is iomchuí ag féachaint don ráta a bheidh ceaptha faoin ordú.
(2) Déanfar an méid tobhaigh ar bhainne a bheidh dlite de dhílseánach cláraithe uachtarlainne nó stáisiúin deighilte uachtair i leith bainne a ceannaíodh nó a fuarthas aon mhí a íoc leis an mBord tráth nach déanaí ná seacht lá i ndiaidh lá deiridh na míosa.
(3) (a) Féadfaidh an Bord, aon uair is oiriúnach leis, ordú a dhéanamh ag socrú an ráta tobhaigh ar bhainne agus ag sonrú an dáta a thiocfaidh an ráta a shocrófar amhlaidh i ngníomh.
(b) Féadfaidh an Bord aon uair is oiriúnach leis, le hordú, ordú faoin bhfo-alt seo, lena n-áirítear ordú faoin mír seo, a chúlghairm nó a leasú.
(c) Féadfaidh ordú faoin bhfo-alt seo rátaí éagsúla tobhaigh ar bhainne a shocrú in aghaidh tréimhsí éagsúla a shonrófar san ordú.
(4) San alt seo ciallaíonn “bainne” fíorbhainne.
Tobhach ar im.
37.—(1) Íocfaidh gach dílseánach cláraithe uachtarlainne leis an mBord tobhach ar an im uachtarlainne uile a dhéanfaidh an dílseánach a sheachadadh arna dhíol nó a mhonarú do dhuine éigin eile tráth a bheidh ráta le haghaidh tobhaigh den sórt sin socraithe de bhua ordú faoi fho-alt (4) den alt seo agus beidh sa tobhach cibé méid is iomchuí ag féachaint don ráta a bheidh socraithe faoin ordú.
(2) Íocfaidh gach dílseánach cláraithe uachtarlainne tobhach ar an im allmhairithe uile a sheachadfaidh an dílseánach arna dhíol, seachas im allmhairithe a dhíolfar le dílseánach eile, nó a dhiúscarfar ar shlí éigin eile chun dílseánaigh eile, tráth a bheidh ráta le haghaidh tobhaigh den sórt sin socraithe de bhua ordú faoi fho-alt (4) den alt seo, agus beidh sa tobhach cibé méid is iomchuí ag féachaint don ráta a bheidh socraithe faoin ordú.
(3) Déanfar an méid tobhaigh ar im a bheidh dlite de dhílseánach cláraithe uachtarlainne i leith im a seachadadh arna dhíol nó i leith im uachtarlainne a monaraíodh do dhuine éigin eile aon mhí a íoc leis an mBord tráth nach déanaí ná seacht lá i ndiaidh—
(a) lá deiridh na míosa, nó
(b) dáta déanta an ordaithe faoi fho-alt (4) den alt seo ar faoina threoir a ríomhfar méid an tobhaigh,
cibé acu is déanaí.
(4) (a) Féadfaidh an Bord, aon uair is oiriúnach leis agus le toiliú an Aire, ordú a dhéanamh ag socrú ráta an thobhaigh ar im agus ag sonrú an dáta a thiocfaidh an ráta a cheapfar amhlaidh i ngníomh.
(b) Féadfaidh an Bord aon uair is oiriúnach leis agus le toiliú an Aire, le hordú, ordú faoin bhfo-alt seo, lena n-áirítear ordú faoin mír seo, a chúlghairm nó a leasú.
(c) Féadfaidh an tAire ó am go ham, de réir mar is oiriúnach leis, a ordú i scríbhinn don Bhord—
(i) ordú a dhéanamh faoi bhfo-alt seo ag socrú ráta an tobhaigh ar im, agus féadfaidh ordachán a bheith san ordachán ag sonrú ráta nó rátaí an tobhaigh ar im a shocrófar san ordú agus an dáta nó na dátaí a shocrófar san ordú chun an ráta nó na rátaí a theacht i ngníomh, nó
(ii) ordú a dhéanamh ag cúlghairm nó ag leasú ordú faoin alt seo,
agus déanfaidh an Bord de réir ordacháin faoin mír seo.
(d) In ordú faoin bhfo-alt seo, féadfar—
(i) rátaí tobhaigh ar im a shocrú, i leith ime uachtarlainne, ime allmhairithe nó ime uachtarlainne agus ime allmhairithe le chéile,
(ii) rátaí éagsúla tobhaigh ar im a shocrú i leith saghsanna nó cineálacha éagsúla ime a shonrófar i cibé slí agus faoi threoir cibé nithe is cuí leis an mBord nó leis an Aire, de réir mar is iomchuí,
(iii) rátaí éagsúla tobhaigh ar im a shocrú in aghaidh tréimhsí éagsúla a shonrófar san ordú,
(iv) foráil a dhéanamh chun aon ráta nó rátaí tobhaigh ar im a theacht i ngníomh ar dháta roimh dháta an ordaithe a dhéanamh.
Tobhach ar stoic ime.
38.—(1) Faoi réir fho-alt (4) den alt seo, déanfaidh gach dílseánach cláraithe áitribh agus gach trádálaí ime tobhach—
(a) ar im uachtarlainne (seachas, i gcás dílseánach cláraithe uachtarlainne, im a bhí nó a bheidh ar seilbh ag an dílseánach sin nó a bhí nó a bheidh ar seilbh thar a cheann agus a monaraíodh san uachtarlann sin) a bhí nó a bheidh ar seilbh ag an dílseánach nó an trádálaí sin nó thar a cheann aon lá a shonrófar maidir le him uachtarlainne, in ordú faoi fho-alt (3) den alt seo, agus
(b) ar im allmhairithe a bhí nó a bheidh ar seilbh ag an dílseánach nó an trádálaí sin nó a bhí nó a bheidh ar seilbh thar a cheann aon lá a shonrófar, maidir le him allmhairithe, in ordú faoi fho-alt (3) den alt seo,
a íoc leis an mBord agus is é méid a bheidh sa tobhach sin cibé méid is iomchuí ag féachaint don ráta a bheidh socraithe faoin ordú.
(2) Déanfar an méid tobhaigh ar stoic ime a bheidh dlite de dhuine i leith im a bhí nó a bheidh ar seilbh aige nó a bhí nó a bheidh ar seilbh thar a cheann aon lá a shonrófar in ordú faoi fho-alt (3) den alt seo a íoc leis an mBord tráth nach déanaí ná seacht lá i ndiaidh an lae sin.
(3) (a) Féadfaidh an Bord, aon uair is oiriúnach leis agus le toiliú an Aire, ordú a dhéanamh ag socrú an ráta tobhaigh ar stoic ime agus an lá ar ina aghaidh a bheidh sé le n-íoc.
(b) Féadfaidh an Bord aon uair is oiriúnach leis agus le toiliú an Aire, le hordú, ordú faoin bhfo-alt seo, lena n-áirítear ordú faoin mír seo, a chúlghairm nó a leasú.
(c) Féadfaidh an tAire ó am go ham, de réir mar is oiriúnach leis, a ordú i scríbhinn don Bhord—
(i) ordú a dhéanamh faoin bhfo-alt seo ag socrú an ráta tobhaigh ar stoic ime, agus féadfaidh ordachán a bheith san ordachán sin ag sonrú an ráta nó na ráthaí tobaigh ar stoic ime a shocrófar san ordú agus an lá a shonrófar san ordú ar ina aghaidh a bheidh an tobhach iníoctha, agus féadfaidh baint a bheith aige le him uachtarlainne, le him allmhairithe nó le him uachtarlainne agus im allmhairithe le chéile, nó
(ii) ordú a dhéanamh ag cúlghairm nó ag leasú ordú faoin bhfo-alt seo,
agus déanfaidh an Bord de réir ordacháin faoin mír seo.
(d) In ordú faoin bhfo-alt seo féadfar—
(i) rátaí tobhaigh ar stoic ime a shocrú i leith ime uachtarlainne, ime allmhairithe nó ime uachtarlainne agus ime allmhairithe le chéile,
(ii) rátaí éagsúla tobhaigh ar stoic ime a shocrú i leith saghsanna nó cineálacha éagsúla ime a shonrófar i cibé slí agus faoi threoir cibé nithe is cuí leis an mBord nó leis an Aire, de réir mar is iomchuí.
(4) Má tharlaíonn lá a shonrófar in ordú faoi fho-alt (3) den alt seo a mbeidh tobhach ar stoic ime iníoctha ina aghaidh gur lú na trí chéad meáchain na stoic ime lena mbainfidh an t-ordú agus a bhí nó a bheidh ar seilbh ag dílseánach cláraithe áitribh (seachas dílseánach cláraithe uachtarlainne) nó ag trádálaí ime nó a bhí nó a bheidh ar seilbh thar a cheann, ní bheidh feidhm ag fo-alt (1) den alt seo maidir leis an dílseánach nó an trádálaí ime sin, de réir mar a bheidh, d'íoc tobhaigh ar stoic ime in aghaidh an lae sin.
(5) San alt seo agus in alt 40 den Acht seo ciallaíonn “trádálaí ime” duine (seachas dílseánach cláraithe áitribh) a sheolann gnó díola ime ar mór-reic nó ar mionreic, le haghaidh trádála nó brabúis, as féin nó i dteannta aon ghnó eile.
Tobhaigh a ghnóthú.
39.—(1) Gach suim is iníoctha ag duine leis an mBord de bhua an Achta seo i leith nó ar cuntas tobhaigh ar bhainne, tobhaigh ar im nó tobhaigh ar stoic ime is fiach conartha shimplí í a bheidh dlite den duine sin don Bhord agus féadfaidh an Bord í a ghnóthú dá réir sin ón duine sin in aon chúirt dlínse inniúla.
(2) In aon imeachtaí dlíthiúla ag an mBord i gcoinne duine ar bith ar lorg aon airgid a éilítear a bheith dlite den duine sin don Bhord ar scór tobhaigh ar bhainne, tobhaigh ar im nó tobhaigh ar stoic ime, beidh deimhniú faoi shéala an Bhoird á dheimhniú é a bheith dlite den duine tobhach ar bhainne, tobhachar im nó tobhach ar stoic ime, de réir mar a bheidh, de mhéid áirithe a íoc agus suim shonraithe a bheith dlite den duine sin agus gan íoc aige ar scór an tobhaigh ar bhainne, an tobhaigh ar im nó an tobhaigh ar stoic ime, de réir mar bheidh, maraon le deimhniú faoi shéala an Bhoird á dheimhniú nár íoc an duine an tsuim leis an mBord ina bhfianaise prima facie maidir leis an dliteanas i leith agus méid an tobhaigh ar bhainne, an tobhaigh ar im nó an tobhaigh ar stoic ime, de réir mar a bheidh, agus maidir leis an tsuim a bheidh dlite den duine agus gan íoc aige i leith an chéanna.
Tuairisceáin.
40.—(1) Gach duine a dhlífidh faoin Acht seo aon suim a íoc leis an mBord ar scór tobhaigh ar bhainne, tobhaigh ar im nó tobhaigh ar stoic ime déanfaidh sé, roimh dheireadh na tréimhse a mbeidh ceangal ann an tsuim a íoc laistigh di, cibé sonraí a bheidh forordaithe, a chur chun an Bhoird, i cibé foirm agus slí agus laistigh de cibé tréimhse a bheidh forordaithe, i dtaobh—
(a) i gcás an tsuim a dúradh a bheith iníoctha ar scór tobhaigh ar bhainne, fáil (trí cheannach nó ar shlí eile) bainne agus diúscairt (trí dhíol nó ar shlí eile) bainne ag an duine i gcaitheamh cibé tréimhse a bheidh forordaithe,
(b) i gcás an tsuim a dúradh a bheith iníoctha ar scór tobhaigh ar im, fáil (trí cheannach nó ar shlí eile) ime agus diúscairt (trí dhíol nó ar shlí eile) agus monarú ime ag an duine i gcaitheamh cibé tréimhse a bheidh forordaithe, agus
(c) i gcás an tsuim a dúradh a bheith iníoctha ar scór tobhaigh ar stoic ime, na stoic ime a bhí i seilbh an duine sin nó a bhí i seilbh thar a cheann i gcaitheamh cibé tréimhse nó cibé lá a bheidh forordaithe,
(2) (a) Féadfaidh an Bord fógra i scríbhinn a sheirbheáil ar aon dílseánach cláraithe áitribh nó trádálaí ime á cheangal air tuairisceán a chur chun an Bhoird laistigh de thrí lá tar éis an fógra a sheirbheáil i dtaobh an méid ime a bhí nó a bheidh ar seilbh in áit ar bith ag an dílseánach nó an trádálaí nó a bhí nó a bheidh ar seilbh thar a cheann lá a luafar san fhógra, is lá a mbeidh sé sonraithe in ordú faoi fho-alt (3) d'alt 38 den Acht seo tobhach ar stoic ime a bheith iníoctha ina aghaidh.
(b) Féadfaidh an Bord fógra i scríbhinn a sheirbheáil ar dhuine ar bith a choimeádann im ar stóras do dhílseánach cláraithe áitribh nó do thrádálaí ime á cheangal air tuairisceán a chur chun an Bhoird laistigh de thrí lá tar éis an fógra a sheirbheáil i dtaobh an méid ime a bhí nó a bheidh á choimeád in áit ar bith ag an duine lá a luafar san fhógra, is lá a mbeidh sé sonraithe in ordú faoi fho-alt (3) d'alt 38 den Acht seo tobhach ar stoic ime a bheith iníoctha ina aghaidh agus i dtaobh na ndaoine dá raibh nó dá mbeidh an t-im á choimeád amhlaidh agus an méid a bhí nó a bheidh á choimeád amhlaidh do gach duine den sórt sin.
(c) Is san fhoirm fhorordaithe a bheidh tuairisceán faoin bhfo-alt seo agus beidh ann, i dteannta sonraí a shonraítear i mír (a) nó (b), de réir mar a bheidh, den fho-alt seo, na sonraí forordaithe.
(d) Féadfar fógra faoin bhfo-alt seo a sheirbheáil trína sheachadadh don duine a mbeidh sé dírithe chuige nó trína fhágáil ag duine os cionn sé bliana déag d'aois san áitreabh ina seolann an duine a mbeidh sé dírithe chuige gnó nó trína chur leis an bpost cláraithe chuig an duine a mbeidh sé dírithe chuige chun an áitribh ina seolann sé gnó.
(e) Aon duine a seirbheálfar fógra air faoin bhfo-alt seo, déanfaidh sé de réir téarmaí an fhógra sin.
(3) Féadfaidh an Bord rialacháin a dhéanamh chun críocha an ailt seo agus san alt seo ciallaíonn “forordaithe” forordaithe le rialacháin faoin bhfo-alt seo.
(4) Aon duine a sháróidh aon fhoráil atá san alt seo nó a thabharfaidh tuairisceán is eol dó a bheith bréagach nó míthreorach beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair, dlífear fíneáil nach mó ná fiche punt más é an chéad chion aige é, agus fíneáil nach mó ná céad punt más é an dara cion nó aon chion ina dhiaidh sin aige é, a chur air.
Taifid a iniúchadh.
41.—(1) Féadfaidh oifigeach don Bhord ag a mbeidh údarás i scríbhinn ón mBord chun na cumhachtaí a thugtar leis an alt seo d'oifigeach don Bhord a fheidhmiú na scríbhinní seo a leanas a iniúchadh agus cóipeanna a dhéanamh díobh—
(a) na doiciméid agus na taifid uile a bhaineann le bainne leachtach a fháil (trí cheannach nó ar shlí eile), a dhiúscairt (trí dhíol nó ar shlí eile), a sheachadadh arna dhíol nó a stóráil, agus a bheidh á gcoimeád ag daoine, nó a bheidh á gcoimeád thar ceann daoine, a dhlíonn tobhach ar bhainne a íoc,
(b) na doiciméid agus na taifid uile a bhaineann le him a mhonarú, a fháil (trí cheannach nó ar shlí eile), a dhiúscairt (trí dhíol nó ar shlí eile), a sheachadadh arna dhíol nó a stóráil agus a bheidh á gcoimeád ag daoine, nó á bheidh á gcoimeád thar ceann daoine, a dhlíonn tobhach ar im nó tobhach ar stoic ime a íoc, agus
(c) na doiciméid agus na taifid uile a bhaineann le him a stóráil agus a bheidh á gcoimeád ag aon duine, nó a bheidh á gcoimeád thar ceann aon duine, a choimeádann im i stóras do dhílseánach cláraithe aitribh nó do thrádálaí ime,
agus chuige sin féadfaidh sé dul isteach gach tráth réasúnach in aon áitreabh a bhfuil cúis aige chun a chreidiúint doiciméid nó taifid den sórt sin a bheith á gcoimeád ann.
(2) Aon duine a mbeidh aon cheann de na doiciméid nó de na taifid a dúradh ina sheilbh nó ar a urláimh déanfaidh sé, ar oifigeach don Bhord a bheidh údaraithe mar a dúradh á iarraidh sin air, na doiciméid nó na taifid sin a thabhairt ar aird dó agus aon eolas a theastóidh uaidh le réasún i dtaobh aon ní iontu a thabhairt dó.
(3) Ní dhéanfaidh duine ar bith oifigeach don Bhord a chosc ná a bhac agus é ag feidhmiú aon cheann de na cumhachtaí a thugar leis an alt seo.
(4) Aon duine a sháróidh aon fhoráil atá san alt seo beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná fiche punt más é an chéad chion aige é, agus fíneáil nach mó ná céad punt más é an dara cion nó aon chion ina dhiaidh sin aige é a chur air.
(5) Déanfaidh oifigeach don Bhord, nuair a bheidh sé ag feidhmiú aon cheann de na cumhachtaí a thugtar leis an alt seo, a údarás a thabhairt ar aird, má iarrtar air é, d'aon duine lena mbainfidh.
Gan an Bord do nochtadh eolais.
42.—(1) Faoi réir fho-alt (2) den alt seo, ní dhéanfar eolas a gheofar faoi alt 40 nó 41 den Acht seo nó le linn an Bord nó comhalta, oifigeach nó seirbhíseach dó a bheith ag comhlíonadh feidhmeanna an Bhoird a nochtadh, gan toiliú an duine a mbainfidh an t-eolas leis féin nó lena ghnó, do dhuine nach comhalta den Bhord nó oifigeach nó seirbhíseach ar fostú faoin mBord.
(2) Ní bheidh feidhm ag fo-alt (1) den alt seo maidir le heolas a nochtadh don Aire nó don Ard-Reachtaire Cuntas agus Ciste nó chun críocha, aon imeachtaí dlíthiúla (sibhialta nó coiriúil) a bhunófar nó a bheartófar a bhunú faoin Acht seo.
(3) Aon duine a sháróidh fo-alt (1) den alt seo beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná fiche punt más é an chéad chion aige é, agus fíneáil nach mó ná céad punt más é an dara cion nó aon chion ina dhiaidh sin aige é, a chur air.
Ranníoc ón mBord i leith costas im a choimeád i bhfuarstóras ag uachtarlanna.
43.—(1) Féadfaidh an tAire ó am go ham ordachán i scríbhinn a thabhairt don Bhord á cheangal air—
(a) scéim a dhéanamh agus a chur i gcrích i rith cibé tréimhse nó tréimhsí a shonrófar san ordú chun liúntais a íoc le dílseánaigh chláraithe uachtarlanna i leith costas im a choimeád ar fuarstóras ag na dílseánaigh nó thar ceann na ndílseánach, nó
(b) scéim faoin bhfo-alt seo agus íocaíochtaí fúithi a fhionraí, nó socrú a dhéanamh chun deireadh a bheith leis an gcéanna, go hiomlán nó go páirteach, amhail ó dháta a shonrófar san ordachán.
(2) Déanfaidh an Bord de réir ordachán faoi fho-alt (1) den alt seo.
(3) Beidh téarmaí agus forálacha (lena n-áirítear téarmaí agus forálacha maidir le ráta an liúntais) scéime faoi fho-alt (1) den alt seo faoi réir cheadú an Aire.
(4) Íocfar amach as an gCiste an costas agus an caiteachas faoina rachaidh an Bord ag déanamh scéime faoin alt seo agus á cur i gcrích.
(5) Faoi réir cheadú an Aire, féadfaidh an Bord téarmaí agus forálacha scéime faoi fho-alt (1) den alt seo a leasú ó am go ham i cibé slí is oiriúnach leis an mBord.
(6) Déanfaidh an Bord, ar ordachán a fháil ón Aire, téarmaí agus forálacha scéime faoi fho-alt (1) den alt seo a leasú i cibé slí a shonróidh an tAire don Bhord i scríbhinn.
(7) Féadfaidh an tAire ordachán faoi fho-alt (6) den alt seo a thabhairt don Bhord ó am go ham de réir mar is oiriúnach leis.

44.—(1) Ceannóidh an Bord ar an bpraghas a bheidh socraithe de thuras na huaire faoi fho-alt (2) den alt seo, agus is iomchuí maidir leis an gceannach, an t-im go léir—
(a) a thairgfidh dílseánach cláraithe uachtarlainne don Bhord ar an bpraghas sin,
(b) a monaraíodh san uachtarlann sin, agus
(c) is im de chineál a chomhlíonann na forálacha de na hAchtanna Toradh Déiríochta, 1924 go 1947, agus de na rialacháin fúthu, a bhaineann le him uachtarlainne.
(2) Féadfaidh an Rialtas ó am go ham praghas ime a shocrú chun críocha fho-alt (1) den alt seo nó féadfaidh sé dhá phraghas nó níos mó a shocrú a athróidh de réir ceachtar ní nó an dá ní acu seo leanas, is é sin le rá, an chainníocht ime a dhíolfar agus an tslí ina mbeidh an t-im pacáilte, agus féadfaidh sé dáta nó dátaí a shonrú amhail ar a gceannófar nó óna gceannófar ar an bpraghas nó ar na praghasanna a bheidh socraithe amhlaidh agus cuirfidh an tAire in iúl don Bhord i scríbhinn an praghas nó na praghasanna a shocrófar amhlaidh agus an dáta nó na dátaí a shonrófar amhlaidh.
Díolfaidh an Bord im sa Stát ar phraghas a shocróidh an Rialtas.
45.—(1) Aon uair a dhíolfaidh an Bord im—
(a) a bheidh beartaithe le caitheamh sa Stát, agus
(b) is im de chineál a chomhlíonann na forálacha de na hAchtanna Toradh Déiríochta, 1924 go 1974, agus de na rialacháin fúthu, a bhaineann le him uachtarlainne nó is im allmhairithe,
déanfar an díol ar an bpraghas a bheidh socraithe de thuras na huaire faoi fho-alt (2) den alt seo maidir leis an díol sin agus is iomchuí maidir leis an díol.
(2) Féadfaidh an Rialtas ó am go ham praghas ime a shocrú chun críocha fho-alt (1) den alt seo nó féadfaidh sé dhá phraghas nó níos mó a shocrú a athróidh de réir ceachtar ní nó an dá ní acu seo a leanas, is é sin le rá, an chainníocht ime a dhíolfar agus an tslí ina mbeidh an t-im pacáilte, agus féadfaidh sé dáta nó dátaí a shonrú amhail ar a nó óna mbeidh feidhm ag an bpraghas nó na praghasanna a shocrófar amhlaidh agus cuirfidh an tAire in iúl don Bhord i scríbhinn an praghas nó na praghasanna a shocrófar amhlaidh agus an dáta nó na dátaí a shonrófar amhlaidh.

46.—(1) I gcás ina dtarlóidh, de bhua ordú faoi fho-alt (2) d'alt 2 den Acht Toradh Déiríochta (Praghas a Dhéanamh Seasmhach) (Leasú), 1938, maidir le halt 41 den Acht Toradh Déiríochta (Praghas a Dhéanamh Seasmhach), 1935, (is é sin, an chéad ordú den sórt sin maidir leis an alt sin 41) go scoirfidh an t-alt sin 41 de bheith i bhfeidhm, cuirfidh an tAire, ar dháta an scoir sin má bhíonn aon suim an tráth sin, i gcreidiúint don chiste toradh déiríochta (praghas a dhéanamh seasmhach), a chur faoi deara an tsuim sin go léir a aistriú chun an Bhoird agus a íoc leis an mBord as an gciste sin.
(2) Féadfaidh an tAire, an lá bunaithe nó dá éis agus roimh dháta an scoir a dúradh, más oiriúnach leis é agus má bhíonn aon suim i gcreidiúint don chiste toradh déiríochta (praghas a dhéanamh seasmhach), a chur faoi deara go n-aistreofar chun an Bhoird agus go n-íocfar leis as an gciste sin cibé suim nó suimeanna a chinnfidh an tAire.
Tuarascáil bhliantúil.
47.—(1) A luaithe is féidir tar éis an 31ú lá de Mhárta gach bliain i ndiaidh na bliana 1960, tabharfaidh an Bord tuarascáil don Aire ar imeachtaí an Bhoird faoin Acht seo i gcaitheamh an dá mhí dhéag dar críoch an dáta sin agus cuirfidh an tAire faoi deara cóipeanna den tuarascáil a leagan faoi bhráid gach Tí den Oireachtas.
(2) Aon uair a ordóidh an tAire amhlaidh, beidh sa tuarascáil bhliantúil freisin eolas ar cibé gnéithe áirithe d'imeachtaí an Bhoird faoin Acht seo a shonróidh an tAire.
Cuntais agus iniúchadh.
48.—(1) Coimeádfaidh an Bord, i cibé foirm a cheadóidh an tAire le comhthoiliú an Aire Airgeadais, na cuntais go léir is cuí agus is gnáth ar an airgead go léir a gheobhaidh nó a chaithfidh sé.
(2) A luaithe is féidir tar éis an 31ú lá de Mhárta gach bliain, cuirfidh an Bord a chuntais don dá mhí dhéag dar críoch an dáta sin, clár comhardaithe amhail ar an dáta sin, agus ráiteas cuntas don bhliain dar críoch an dáta sin chuig an Ard-Reachtaire Cuntas agus Ciste agus iniúchfaidh an tArd-Reachtaire Cuntas agus Ciste na cuntais agus tabharfaidh sé tuarascáil orthu agus ar na doiciméid eile a chuirfear faoina bhráid.
(3) Díreach tar éis iniúchadh a bheith déanta faoin alt seo ar chuntais an Bhoird, cuirfidh an Bord chuig an Aire cóip den ráiteas cuntas agus den chlár comhardaithe arna dheimhniú ag an Ard-Reachtaire Cuntas agus Ciste agus coip de thuarascáil an Ard-Reachtaire Cuntas agus Ciste.
(4) Cuirfidh an tAire faoi deara cóipeanna de na doiciméid dá dtagraítear i bhfo-alt (3) den alt seo a leagan faoi bhráid gach Tí den Oireachtas.

49.—Tabharfaidh an Bord don Aire, cibé tráthanna agus i cibé foirm agus slí a shonróidh an tAire, cibé eolas i dtaobh imeachtaí an Bhoird faoin Act seo a iarrfaidh an tAire.
An Coiste Margaíochta Ime a dhíscaoileadh.
50.—(1) Déanfar an Coiste Margaíochta Ime (dá ngairtear an Coiste san Acht seo), is é sin, príomh-eagraíocht margaíochta a oibríonn faoi rialacha arna gceadú ag an Aire faoin Acht Toradh Déiríochta (Praghas a Dhéanamh Seasmhach), 1935, a dhíscaoileadh lá an aistrithe.
(2) Féadfaidh an tAire le hordú faoin alt seo lá, is lá nach luaithe ná an lá bunaithe, a cheapadh mar lá an aistrithe chun críocha an Achta seo.

51.—Gach conradh seirbhíse sainráite nó intuigthe a rinne an Coiste agus a bheidh i bhfeidhm díreach roimh lá an aistrithe leanfaidh sé i bhfeidhm lá an aistrithe agus dá éis ach forléireofar é agus beidh éifeacht aige ionann agus dá gcuirfí an Bord ann in ionad an Choiste, agus beidh gach conradh den sórt sin inchurtha i bhfeidhm dá réir sin ag an mBord nó ina choinne.

52.—(1) Faoi réir fhorálacha an ailt seo, an mhaoin uile réadach nó pearsanta (lena n-áirítear ábhair i gcaingean) a bhí, díreach roimh lá an aistrithe, dílsithe sa Choiste, nó dá chuid féin ag an gCoiste, nó ar teachtadh ar iontaobhas don Choiste, agus na cearta, na cumhachtaí agus na pribhléidí uile a bhaineann nó a ghabhann le haon mhaoin den sórt sin, tiocfaidh siad lá an aistrithe, agus gan tíolachadh ná sannadh ach faoi réir a n-aistriú, más gá sin, i leabhair aon bhainc, corparáide nó cuideachta nó údaráis, chun bheith dá chuid féin ag an mBord agus chun bheith dílsithe sa Bhord nó ar teachtadh ar iontaobhas dó, nó ar sealúchas aige (de réir mar a bheidh) chun an estáit, an iontaobhais nó an leasa uile chun a raibh an céanna, díreach roimh lá an aistrithe, dílsithe sa Choiste nó dá chuid féin aige, nó ar teachtadh ar iontaobhas dó.
(2) An mhaoin uile a aistrítear leis an alt seo agus a bhí, díreach roimh lá an aistrithe, ar seasamh i leabhair aon bhainc nó cláraithe i leabhair aon bhainc, corparáide, cuideachta nó údaráis, déanfaidh an banc, an chorparáid, an chuideachta nó an t-údarás sin, ar an mBord dá iarraidh sin lá an aistrithe nó dá éis, í a aistriú sna leabhair chun ainm an Bhoird.
(3) Lá an aistrithe agus dá éis, féadfaidh an Bord, ina ainm féin, agra a dhéanamh i leith gach ábhair i gcaingean a aistrítear chun an Bhoird leis an alt seo agus é a aisghabháil nó a chur i bhfeidhm agus ní gá don Bhord fógra i dtaobh an aistrithe a dhéantar leis an alt seo a thabhairt don duine a bheidh faoi cheangal an ábhair i gcaingean sin.
(4) A mhéid a oibríonn fo-alt (1) den alt seo chun talamh a aistriú, beidh éifeacht aige chun críocha an Conveyancing Act, 1881, mar thíolacas talún.
Dliteanais an Choiste a aistriú chun an Bhoird.
53.—Gach fiach agus dliteanas eile (lena n-áirítear dliteanais neamhleachtaithe as tortanna nó as sáruithe conartha a bhí, díreach roimh lá an aistrithe, dlite den Choiste agus gan íoc aige, nó tabhaithe agus gan fuascailt aige, tiocfaidh sé chun bheith agus beidh sé lá an aistrithe ina fhiach nó ina dhliteanas ar an mBord, agus íocfaidh nó fuasclóidh an Bord é agus féadfar é a ghnóthú ón mBord nó a chur i bhfeidhm i gcoinne an Bhoird dá réir sin.

54.—Gach banna, ráthaíocht, morgáiste nó urrús eile de chineál leanúnach a rinne an Coiste nó a thug sé d'aon duine nó a rinne aon duine agus a thug sé don Choiste agus a bhí i bhfeidhm díreach roimh lá an aistrithe agus gach conradh nó comhaontú i scríbhinn a rinneadh idir an Coiste agus duine eile agus nár comhlíonadh go hiomlán roimh lá an aistrithe, leanfaidh sé, d'ainneoin an Coiste a dhíscaoileadh, de bheith i bhfeidhm, lá an aistrithe agus dá éis, ach forléireofar é agus beidh éifeacht aige ionann agus dá gcuirfí ainm an Bhoird ann in ionad ainm an Choiste agus beidh an t-urrús, an conradh nó an comhaontú inchurtha i bhfeidhm dá réir sin ag an mBord nó ina choinne.

55.—Gach caingean, agra nó imeachtaí a bheidh ar feitheamh díreach roimh lá an aistrithe in aon chúirt nó binse agus inar páirtí an Coiste tiocfaidh an Bord chun bheith agus beidh sé, lá an aistrithe, ina pháirtí sa chéanna in ionad an Choiste agus leanfaidh an caingean, an t-agra nó na himeachtaí sin, de réir mar a bheidh, idir an Bord agus na páirtithe eile sa chéanna dá réir sin agus ní thitfidh aon chaingean, agra nó imeachtaí den sórt sin ar lár ná ní scoirfear den chéanna ná ní dhéanfar dochar don chéanna de dhroim an Coiste a dhíscaoileadh.

(2) Féadfaidh an tAire le hordú, aon uair agus a mhinicí is oiriúnach leis, a thoirmeasc bainne agus táirgí bainne a allmhairiú isteach sa Stát ach amháin faoi réim agus de réir ceadúnas arna eisiúint faoin Acht seo.
(3) Gan dochar do ghinearáltacht fho-alt (1) den alt seo, féadfaidh baint a bheith ag ordú faoin bhfo-alt sin le bainne agus táirgí bainne nó aon saghas nó cineál áirithe bainne nó táirge bainne (arna shonrú i cibé slí agus faoi threoir cibé nithe is oiriúnach leis an Aire) a onnmhairiú i gcoitinne nó go dtí aon tír nó tíortha a shonrófar nó in aon slí nó slite a shonrófar.
(4) Gan dochar do ghinearáltacht fho-alt (2) den alt seo, féadfaidh baint a bheith ag ordú faoin bhfo-alt sin le bainne agus táirgí bainne nó aon saghas nó cineál áirithe bainne nó táirge bainne (arna shonrú i cibé slí agus faoi threoir cibé nithe is oiriúnach leis an Aire) a allmhairiú i gcoitinne nó ó aon tír nó tíortha nó in aon slí nó slite a shonrófar.
(5) Gan dochar do ghinearáltacht fho-ailt (1) agus (2) den alt seo, féadfaidh foráil a bheith in orduithe faoi na fo-ailt sin maidir le cibé nithe is dóigh leis an Aire is gá chun a áirithiú go gcuirfear na horduithe i bhfeidhm go cuí.
(6) Féadfaidh an tAire, le hordú, ordú faoi fho-alt (1) nó (2) den alt seo nó faoin bhfo-alt seo a chúlghairm nó a leasú.
(7) Ar dhuine do dhéanamh iarratais i cibé foirm, agus ina mbeidh cibé sonraí, a ordóidh an tAire, féadfaidh an tAire, más oiriúnach leis, ceadúnas a eisiúint chun an duine sin chun bainne agus táirgí bainne nó aon saghas nó cineál áirithe bainne nó táirge bainne a allmhairiú nó ceadúnas a eisiúint chuige chun an céanna a onnmhairiú, i gcoitinne nó ó thír go nó dtí tír shonraithe nó ó thíortha nó go dtí tíortha sonraithe, de réir mar a bheidh, i gcás ina mbeidh an t-onnmhairiú nó an t-allmhairiú sin, de réir mar a bheidh, toirmiscthe le hordú faoi fho-alt (1) nó fo-alt (2) den alt seo.

DAIRY PRODUCE MARKETING ACT, 1961.
Commencement.
1.—This Act shall come into operation on such day or days as, by order or orders made by the Minister under this section, may be fixed therefor either generally or with reference to any particular purpose or provision and different days may be so fixed for different purposes and different provisions.
Interpretation.
2.—(1) In this Act save where the context otherwise requires—
“the Board” means An Bord Bainne established by this Act;
“butter”, “creamery”, “creamery business”, “creamery butter” and “cream-separating business” have, respectively, the meanings they have in the Dairy Produce Act, 1924;
“butter levy” means the levy on creamery butter provided for under section 37 of this Act;
“butter stocks levy” means the levy on stocks of butter provided for under section 38 of this Act; “the Committee” has the meaning assigned to it by section 50 of this Act;
“the Company” means the Dairy Disposal Company, Limited;
“cream-separating station” means a premises registered under the Dairy Produce Act, 1924, in the register of cream-separating stations;
“establishment day” means the day appointed to be the establishment day for the purposes of this Act by order of the Minister made under section 3 of this Act;
“functions”, in relation to the Board, includes powers and duties, and references to the performance of functions include references to the exercise of powers and the performance of duties;
“the Fund” means the Dairy Produce Fund established by section 29 of this Act;
“milk” means milk in liquid form and includes whole milk, skimmed or separated milk, buttermilk, or whey, in liquid form;
“milk levy” means the levy on milk provided for under section 36 of this Act;
“milk product” includes any substance which is made wholly or partly from milk or a product or by-product of milk and which is—
(a) butter, cream, raw cheese, processed cheese, condensed milk, dried or powdered milk, chocolate crumb or casein, or
(b) a substance which is for the time being declared by regulations made by the Minister under subsection (2) of this section to be a milk product;
“the Minister” means the Minister for Agriculture;
“nomination day” means a day appointed to be a nomination day for the purposes of this Act under section 7 of this Act;
“registered proprietor” means, when used in relation to a creamery, the person carrying on the creamery business in that creamery, and when used in relation to a cream-separating station, means the person carrying on the cream-separating business in that station;
“registered proprietor of premises” means the person carrying on in premises registered under Part III of the Dairy Produce Act, 1924, the business in respect of which they are registered;
“returning officer” means in relation to a ballot under this Act, the person who, by virtue of section 12 of this Act, is the returning officer for that ballot;
“society” means a society registered under the Industrial and Provident Societies Acts, 1893 to 1936;
“the transfer day” means the day appointed to be the transfer day for the purposes of this Act by order of the Minister made under section 50 of this Act.
(2) (a) The Minister may by regulations declare that any substance (other than a substance specifically mentioned in paragraph (a) in the definition of “milk product” in subsection (1) of this section) made wholly or partly from milk or from a product or by-product of milk shall be a milk product for the purposes of this Act.
(b) Whenever and so long as regulations under this subsection declaring a substance to be a milk product for the purposes of this Act are in force, that product shall be a milk product for those purposes.
Establishment day.
3.—The Minister may by order made under this section appoint a day to be the establishment day for the purposes of this Act.
Establishment and general duty of the Board.
4.—(1) There shall, by virtue of this section, be established on the establishment day a board to be styled and known as An Bord Bainne to perform the functions assigned to it by this Act.
(2) The Board shall be a body corporate with perpetual succession and an official seal (which shall be judicially noticed) and power to sue and be sued in its corporate name and to acquire, hold and dispose of land.
(3) It shall be the general duty of the Board to endeavour to improve and develop the marketing of milk products outside the State and achieve such flexibility in the marketing aforesaid and in its development as will ensure that, in so far as is possible, milk is put to the most profitable uses and the producers of milk obtain reasonable returns thereon.
Functions of Board.
5.—(1) The Board shall, in addition to the functions assigned to it by any other provision of this Act, have the following general functions, namely:
(a) to export, or provide for the exportation of, milk and milk products of such class or kind as the Minister may from time to time specify in writing to the Board either, as the Minister may specify from time to time in writing to the Board, generally or to such country or countries as may be so specified by the Minister, and
(b) to promote, facilitate, encourage, assist (financially or otherwise), co-ordinate and develop the exportation of milk and milk products by such means as the Board considers necessary or desirable.
(2) Without prejudice to the generality of subsection (1) of this section, the Board may do all or any of the following:
(a) acquire, by purchase or otherwise, store, dispose of, by sale or otherwise, import and export milk and milk products,
(b) engage in the business of wholesale and retail dealing in milk and milk products—
(i) outside the State, and
(ii) with the consent in writing of the Minister and until such time (if any) as the consent is withdrawn in writing by the Minister, in the State,
(c) conduct, or provide for the conducting of, investigations, surveys, analyses, studies and reports in relation to markets, potential markets and market conditions for milk and milk products in the State and outside the State,
(d) conduct, or provide for the conducting of, periodic comprehensive reviews, surveys and studies of trade in milk and milk products in the State and outside the State,
(e) carry out, or provide for the carrying out of, and assist, financially or otherwise, experimental and development work and investigations in relation to the provision of new and improved types of milk products, packing for milk and milk products and methods of presentation for marketing of milk and milk products,
(f) provide, or arrange for the provision of, publicity in any form or medium in the State and outside the State for the purpose of encouraging the increased consumption and use of milk and milk products and promoting increases in the quantities of milk and milk products exported from the State,
(g) establish, equip and operate, and provide for the establishment, equipment and operation of, and assist, financially or otherwise, in the operation of, showrooms, information bureaux, and similar establishments, in the State and outside the State, designed to promote the increased consumption and use of milk and milk products and to promote increases in the quantities of milk and milk products exported from the State,
(h) publish and distribute, or provide for the publication and distribution of, pamphlets, notices, bulletins, journals, magazines and such other similar matter as it thinks fit, in the State and outside the State, for the purpose of encouraging the increased consumption and use of milk and milk products and promoting increases in the quantities of milk and milk products exported from the State,
(i) undertake, promote, or provide for the undertaking and promotion of, and assist in, financially or otherwise, any activity which, in the opinion of the Board, is or is likely to result in, directly or indirectly, increases in the quantities of milk and milk products exported from the State.
Assignment of additional functions to the Board.
6.—(1) The Minister may, with the consent of the Minister for Finance, from time to time by order—
(a) assign to the Board such additional functions as he thinks fit in relation to milk or to milk products,
(b) make such provision as he considers desirable or necessary in relation to matters ancillary to or arising out of the assignment of functions to the Board under this Act or the performance by the Board of those functions.
(2) The Minister may by order revoke or amend an order under this section (including an order under this subsection).
Nomination year and nomination day.
7.—(1) The nomination years for the purposes of this Act shall be—
(a) the year in which the establishment day falls, and
(b) each fourth successive year thereafter.
(2) The Minister may by regulations made under this section prescribe a day in each nomination year to be, for the purposes of this Act, the nomination day in that nomination year.
Constitution of the Board.
8.—(1) The Board shall consist of nine members of whom one shall be the chairman and the others shall be ordinary members.
(2) The members of the Board shall comprise—
(a) three persons nominated under section 9 of this Act to be members of the Board,
(b) one person nominated under section 10 of this Act to be a member of the Board,
(c) one person being—
(i) a person who is nominated to be a member of the Board by the licensed manufacturers of cheese and as respects whose nomination notification in writing is delivered to the Minister (together with a statement in writing signed by the person signifying his consent to the nomination) before the nomination day in the nomination year in which the nomination is made, or
(ii) if in any nomination year the licensed manufacturers of cheese do not, before the nomination day in that year, nominate a person and deliver to the Minister the notification and statement in relation to the person referred to in subparagraph (i) of this paragraph, a person nominated by the Minister whom the Minister considers to be representative of those manufacturers,
(d) one person being—
(i) a person who is nominated to be a member of the Board by the licensed manufacturers of milk powder and as respects whose nomination notification in writing is delivered to the Minister (together with a statement in writing signed by the person signifying his consent to the nomination) before the nomination day in the nomination year in which the nomination is made, or
(ii) if in any nomination year the licensed manufacturers of milk powder do not, before the nomination day in that year, nominate a person and deliver to the Minister the notification and statement in relation to the person referred to in subparagraph (i) of this paragraph, a person nominated by the Minister whom the Minister considers to be representative of those manufacturers,
(e) one person being—
(i) a person who is nominated to be a member of the Board by the licensed manufacturers of chocolate crumb and as respects whose nomination notification in writing is delivered to the Minister (together with a statement in writing signed by the person signifying his consent to the nomination) before the nomination day in the nomination year in which the nomination is made, or
(ii) if in any nomination year the licensed manufacturers of chocolate crumb do not, before the nomination day in that year, nominate a person and deliver to the Minister the notification and statement in relation to the person referred to in subparagraph (i) of this paragraph, a person nominated by the Minister whom the Minister considers to be representative of those manufacturers,
(f) one person nominated by the Minister whom the Minister considers to be representative of the Company, and
(g) one officer of the Minister nominated by the Minister.
(3) The first members of the Board shall be nominated before the establishment day.
(4) In each nomination year after the nomination year in which the establishment day falls the members of the Board shall be nominated before the 1st day of October in that year.
(5) In this section “the licensed manufacturers” means, when used in relation to cheese, milk powder or chocolate crumb, all persons carrying on the manufacture of cheese, milk powder or chocolate crumb, as the case may be, in premises acquired, established or maintained under and in accordance with licences granted under the Creamery Act, 1928, to those persons or their predecessors in title.
Nomination of three persons as members of the Board by certain co-operative societies.
9.—(1) During the period of one month ending immediately before the nomination day in any nomination year societies that are the registered proprietors of creameries or cream-separating stations situate in the county of Clare, Cork, Kerry, Kilkenny, Laoighis, Limerick, Tipperary, Waterford or Wexford may, in accordance with the provisions of subsection (4) of this section, propose persons for nomination as members of the Board, but a society shall not propose more than one person under this subsection in any nomination year.
(2) During the period of one month ending immediately before the nomination day in any nomination year, societies that are the registered proprietors of creameries or cream-separating stations situate elsewhere in the State than in the counties specified in subsection (1) of this section may, in accordance with the provisions of subsection (4) of this section, propose persons for nomination as members of the Board, but a society shall not propose more than one person under this subsection in any nomination year.
(3) During the period of one month ending immediately before the nomination day in any nomination year, societies that are the registered proprietors of creameries or cream-separating stations situate anywhere in the State may, in accordance with the provisions of subsection (4) of this section, propose persons for nomination as members of the Board, but a society shall not propose more than one person under this subsection in any nomination year.
(4) A proposal in any nomination year under any of the foregoing subsections shall be made in writing by any six societies specified in the subsection under which the proposal is made (and, in the case of a proposal under subsection (3) of this section, shall contain an indication that it is made under that subsection) and shall be delivered to the returning officer (together with a statement in writing signed by the person proposed signifying his consent to the proposal) during the period of one month ending immediately before the nomination day in that year.
(5) If one person only stands proposed under subsection (1) of this section on the nomination day in any nomination year, that person shall be deemed to be nominated as a member of the Board under this section by the societies specified in that subsection.
(6) If more persons than one stand proposed under subsection (1) of this section on the nomination day in any nomination year, a ballot shall be held in which each society specified in that subsection shall be entitled to vote for one of the persons standing proposed as aforesaid, and—
(a) in case one person secures more votes than any other person in the ballot, that person shall be deemed to be nominated as a member of the Board under this section by the societies specified in that subsection, and
(b) in case two or more persons secure the same number of votes in the ballot, the returning officer shall determine by lot which of those persons shall be nominated as a member of the Board, and the person so determined shall be deemed to be nominated a member of the Board under this section by the societies specified in that subsection.
(7) (a) The provisions of subsections (5) and (6) of this section shall apply in relation to the nomination of persons proposed under subsection (2) of this section in like manner as they apply in relation to the nomination of persons proposed under subsection (1) of this section.
(b) The provisions of subsections (5) and (6) of this section shall apply in relation to the nomination of persons proposed under subsection (3) of this section in like manner as they apply in relation to persons proposed under subsection (1) of this section.
(8) A person deemed to be nominated as a member of the Board under this section by the societies specified in subsection (3) of this section shall endeavour to acquaint himself with, and keep the Board informed of, the special interests of the societies aforesaid in relation to the production of fresh cream.
Nomination of person as member of the Board by suppliers of milk to creameries owned by University College, Cork, the Dairy Disposal Company, Limited, or its associated companies.
10.—(1) During the period of one month ending immediately before the nomination day in any nomination year suppliers of milk to creameries or cream-separating stations of which the registered proprietors are University College, Cork, the Company, the Condensed Milk Company of Ireland (1928), Limited, or the Newmarket Dairy Company (1932), Limited, may, in accordance with the provisions of subsection (2) of this section, propose persons for nomination as members of the Board, but a person shall not propose more than one person under this subsection in any nomination year.
(2) A proposal in any nomination year under subsection (1) of this section shall be made in writing by any twenty persons each of whom supplied milk during the month ending immediately before the commencement of the period of one month referred to in the said subsection (1) to any such creamery or cream-separating station and shall be delivered to the returning officer (together with a statement in writing signed by the person proposed signifying his consent to the proposal) during the period of one month ending immediately before the nomination day in that year.
(3) If on the nomination day in any nomination year one person only stands proposed under this section, that person shall be deemed to be nominated as a member of the Board under this section.
(4) If on the nomination day in any nomination year more persons than one stand proposed under this section, a ballot shall be held in which each person entitled under this section to nominate a person in that nomination year for membership of the Board shall be entitled to vote for one of the persons standing proposed as aforesaid, and
(a) in case one person secures more votes than any other person in the ballot, that person shall be deemed to be nominated as a member of the Board under this section, and
(b) in case two or more persons secure the same number of votes in the ballot, the returning officer shall determine by lot which of those persons shall be nominated as a member of the Board, and the person so determined shall be deemed to be nominated a member of the Board under this section.
Restriction in relation to consents to nomination or proposal for nomination.
11.—(1) A person who, in any nomination year, has signed a statement in writing signifying his consent to nomination as a member of the Board by any one of the groups of manufacturers specified in section 8 of this Act shall not, in that nomination year, sign a statement in writing—
(a) signifying his consent to nomination as a member of the Board by any other of the groups of manufacturers specified in the said section 8, or
(b) signifying his consent to proposal for nomination as a member of the Board under section 9 or 10 of this Act.
(2) A person who, in any nomination year, has signed a statement in writing signifying his consent to proposal under any provision of section 9 of this Act by any of the societies specified in that provision for nomination as a member of the Board shall not, in that nomination year, sign a statement in writing—
(a) signifying his consent to proposal under any other provision of, or by any other of the societies specified in, the said section 9 for nomination as a member of the Board,
(b) signifying his consent to nomination as a member of the Board by any of the groups of manufacturers specified in section 8 of this Act, or
(c) signifying his consent to proposal for nomination as a member of the Board under section 10 of this Act.
(3) A person who, in any nomination year, has signed a statement in writing signifying his consent to proposal by any of the persons specified in section 10 of this Act for nomination as a member of the Board shall not, in that nomination year, sign a statement in writing—
(a) signifying his consent to proposal by any other of the persons specified in the said section 10 for nomination as a member of the Board,
(b) signifying his consent to nomination as a member of the Board by any of the groups of manufacturers specified in section 8 of this Act, or
(c) signifying his consent to proposal for nomination as a member of the Board under section 9 of this Act.
(4) Where a person signs a statement in contravention of any of the foregoing provisions of this section, the nomination or proposal to which it relates shall be null and void.
Provisions in relation to ballots under sections 9 and 10.
12.—(1) (a) A ballot under section 9 or section 10 of this Act shall be conducted in accordance with the provisions of regulations made by the Minister under this section.
(b) Without prejudice to the generality of paragraph (a) of this subsection, regulations under this subsection may provide for—
(i) the form of the ballot paper to be used in the ballot and of the proposal referred to in sections 9 and 10 of this Act,
(ii) the time for and manner of applying for the issue of proposal forms and the time for and manner of issuing such forms,
(iii) the particulars to be contained in the proposal form and ballot paper in relation to persons proposed for nomination under section 9 or 10 of this Act,
(iv) the manner of completing and subscribing proposal forms and ballot papers,
(v) the procedure for ascertaining the persons entitled in any nomination year to propose persons for nomination under section 10 of this Act and to vote in a ballot under that section and for establishing the identity of persons proposing persons for nomination as aforesaid or voting in any such ballot and of persons so proposed,
(vi) the taking and receiving of statutory declarations in relation to the identity of—
(I) persons proposing persons for nomination under section 10 of this Act and voting in ballots under that section, and
(II) persons proposed for nomination under the said section 10,
(vii) the time for and the manner of issuing ballot papers to persons and societies having votes,
(viii) the persons by whom the proposal forms and ballot papers shall be issued,
(ix) the time for and the manner of sending completed proposal forms and ballot papers to the returning officer,
(x) the scrutiny of ballot papers by the returning officer,
(xi) the time for and manner of counting votes, and
(xii) the rejection of ballot papers and the disallowance of votes by the returning officer.
(2) Each person or society entitled to vote in a ballot under section 9 or 10 of this Act shall be entitled to one vote.
(3) The returning officer for the purposes of a ballot under section 9 or 10 of this Act shall—
(a) in the case of a ballot held before the establishment day, be a person appointed by the Minister,
(b) in any other case, be the chief officer of the Board.
(4) The cost of, and the expenses in relation to, a ballot (other than any costs incurred by University College, Cork, the Company, the Condensed Milk Company of Ireland (1928), Limited, the Newmarket Dairy Company (1932), Limited, a society, persons standing proposed for nomination as members of the Board, persons entitled to propose such persons or persons entitled to a vote in the ballot) under section 9 or 10 of this Act shall be paid—
(a) in the case of a ballot held before the establishment day, out of the dairy produce (price stabilisation) fund, and
(b) in any other case, out of the Fund.
Chairman of the Board.
13.—(1) The Board shall, from time to time as occasion requires, appoint a member of the Board to be its chairman.
(2) The Board shall determine the procedure for the selection of a member for appointment as chairman of the Board, and if the Board does not determine the procedure or if a member is not selected in accordance with the procedure, the chairman shall be selected by means of an election held among the members of the Board at a meeting of the Board and the provisions of paragraphs (a) to (h) of subsection (1) of section 43 of the Local Government Act, 1941, shall apply in relation to the election as if the references in those paragraphs to members were references to members of the Board.
(3) The chairman of the Board may at any time resign his office by letter addressed to the chief officer of the Board and the resignation shall take effect as on and from the date of the receipt of the letter by the chief officer and, if he continues to be a member of the Board, shall be eligible for re-appointment as chairman of the Board.
(4) The chairman of the Board shall, unless he sooner resigns his office, hold office until the expiration of his term of office as a member of the Board.
Term of office of members of the Board.
14.—(1) The term of office of a member of the Board shall commence—
(a) in the case of a first member, on the establishment day,
(b) in the case of a member filling a casual vacancy, on the day on which he is nominated, and
(c) in every other case on the 1st day of October in the relevant nomination year.
(2) The term of office of a member of the Board shall, unless he sooner dies, resigns or is removed from office, terminate—
(a) in the case of a member filling a casual vacancy, on the day on which the term of office of the member whose death, resignation, removal or disqualification occasioned the vacancy would have terminated if he had not died, resigned, been removed or been disqualified, as the case may be, and
(b) in any other case, on the 30th day of September in the nomination year following the commencement of his term of office.
Resignation and disqualification of members of the Board.
15.—(1) A member of the Board may at any time resign his office by letter addressed to the chief officer of the Board and the resignation shall take effect on and from the date of the receipt of the letter by the chief officer of the Board.
(2) A member of the Board shall be disqualified from holding and shall cease to hold office if he is adjudged bankrupt, or makes a composition or arrangement with creditors, or is sentenced by a court of competent jurisdiction to suffer imprisonment or penal servitude or ceases to be ordinarily resident in the State or absents himself, otherwise than with the permission of the Board or through illness, during any period of three consecutive months, from every meeting of the Board held during that period.
(3) The chief officer of the Board shall notify the Minister of a resignation or disqualification.
Eligibility of outgoing members.
16.—A member of the Board whose term of office expires by the effluxion of time shall be eligible for reappointment.
Removal of certain members of the Board.
17.—The Minister may at any time remove from office a member of the Board not being a member nominated under paragraph (c), (d) or (e), of subsection (2) of section 8 or under section 9 or 10 of this Act.
Casual vacancy among members of the Board.
18.—(1) A casual vacancy occurring among the members of the Board shall be filled by nomination by the Minister of—
(a) in case the member occasioning the vacancy was an officer of the Minister, an officer of the Minister,
(b) in case the member occasioning the vacancy was nominated for membership by any group of persons, manufacturers or societies or was a person whom the Minister considered to be representative of any group of persons, manufacturers or societies or of the Company, a person whom the Minister considers to be representative of that group or the Company as the case may be, and
(c) in case the vacancy was caused by the failure of any group of persons or societies specified in sections 9 and 10 of this Act to nominate a person for membership, a person whom the Minister considers to be representative of that group.
(2) (a) If—
(i) in relation to a nominating provision, on the nomination day in any nomination year no person stands proposed under that nominating provision, or
(ii) a person nominated as a member of the Board in any nomination year under a nominating provision or under paragraph (c), (d) or (e) of subsection (2) of section 8 of this Act, dies before the commencement of his term of office as such member,
there shall, on the day on which the term of office of members of the Board nominated in that year commences, be deemed to be a casual vacancy among the members of the Board.
(b) Each of the following provisions of this Act, that is to say, subsections (1), (2) and (3) of section 9 and section 10, shall be a nominating provision for the purposes of this subsection.
Remuneration and expenses of members of the Board.
19.—A member of the Board shall be paid out of the Fund such remuneration and allowances for expenses as the Minister, after consultation with the Minister for Finance, from time to time determines.
Disclosure by members of the Board of interest in proposed contract.
20.—A member of the Board who has—
(a) any interest in any company or concern with which the Board proposes to make any contract, or
(b) any interest in any contract which the Board proposes to make,
shall disclose to the Board the fact of the interest and the nature thereof, and shall take no part in any deliberation or decision of the Board relating to the contract, and the disclosures shall be recorded in the minutes of the Board.
Disqualification of member of either House of Oireachtas for membership of the Board.
21.—(1) Where a member of the Board becomes a member of either House of the Oireachtas, he shall, upon his becoming entitled under the Standing Orders of that House to sit therein, cease to be a member of the Board.
(2) A person who is for the time being entitled under the Standing Orders of either House of the Oireachtas to sit therein, shall, while so entitled, be disqualified from being a member of the Board.
Meetings and procedure of the Board.
22.—(1) The Board shall hold such and so many meetings as may be necessary for the due performance of its functions.
(2) The Minister may fix the date, time and place of the first meeting of the Board.
(3) The quorum for a meeting of the Board shall be three.
(4) At a meeting of the Board—
(a) the chairman of the Board shall, if present, be chairman of the meeting,
(b) if and so long as the chairman of the Board is not present or if the office of chairman is vacant, the members of the Board who are present shall choose one of their number to be chairman of the meeting.
(5) Every question at a meeting of the Board shall be determined by a majority of the votes of the members present and voting on the question, and in the case of an equal division of votes, the chairman of the meeting shall have a second or casting vote.
(6) The Board may act notwithstanding one or more vacancies among its members.
(7) Subject to the provisions of this Act, the Board shall regulate by standing orders or otherwise, the procedure of the Board.
Seal of the Board.
23.—(1) The Board shall provide itself with a seal, and the seal shall be authenticated by the signature of the chairman of the Board or some other member thereof authorised by the Board to act in that behalf and the signature of an officer of the Board authorised by the Board to act in that behalf.
(2) Judicial notice shall be taken of the seal of the Board, and every document purporting to be an instrument made by the Board and to be sealed with the seal (purporting to be authenticated in accordance with this section) of the Board shall be received in evidence and be deemed to be such instrument without further proof unless the contrary is shown.
Contracts and instruments not under seal.
24.—Any contract or instrument which, if entered into or executed by an individual, would not require to be under seal may be entered into or executed on behalf of the Board by any person generally or specially authorised by the Board for that purpose.
Staff of the Board.
25.—(1) The Board may, from time to time as occasion requires, appoint such and so many persons to be officers and servants of the Board as it thinks fit, but subject to subsection (6) of this section, a person shall not be appointed under this section to be an officer of the Board unless he has been selected by means of a public competition.
(2) An officer or servant of the Board shall hold his office or employment on such terms and conditions as the Board from time to time determines.
(3) There shall be paid by the Board to its officers and servants out of the Fund such remuneration and allowances as—
(a) in the case of the chief officer, the Minister, with the consent of the Minister for Finance, from time to time determines, and
(b) in any other case, the Board from time to time determines.
(4) The Board may at any time remove any officer or servant of the Board from being its officer or servant.
(5) In so far as the terms and conditions of service (including terms and conditions in relation to remuneration and allowances) determined under or specified in subsections (2), (3) and (4) of this section are inconsistent with any provision for the time being in force of a contract of service specified in section 51 of this Act in relation to any officer or servant of the Board, they shall not apply in relation to that officer or servant unless and until he notifies the Board in writing that he wishes those terms and conditions to apply in relation to him, and if he does so notify the Board, that provision of the contract of service shall, upon such notification, cease to apply in relation to him.
(6) The requirement under subsection (1) of this section of being selected by means of a public competition shall not apply in relation to:
(a) a person who, immediately before the transfer day was an officer of the Committee,
(b) an appointment consisting of the promotion of a person who is already an officer of the Board,
(c) an office for which, in the opinion of the Board, specialised qualifications not commonly held are required, or
(d) an office to which appointments are made for limited periods only, being periods not exceeding two years.
(7) Where an officer or servant of the Board becomes a member of either House of the Oireachtas, he shall, upon his becoming entitled under the Standing Orders of that House to sit therein, cease to be such officer or servant.
(8) A person who is for the time being entitled under the Standing Orders of either House of the Oireachtas to sit therein, shall, while so entitled, be disqualified from becoming an officer or servant of the Board.
Chief officer of the Board.
26.—(1) There shall be a chief officer of the Board.
(2) The chief officer of the Board shall devote the whole of his time to his duties as chief officer and shall not hold any other office or position without the consent of the Board.
(3) The chief officer of the Board shall not be a member of the Board.
Superannuation of officers and servants of the Board.
27.—(1) The Board may prepare and submit to the Minister a scheme or schemes for the granting of pensions, gratuities and other allowances on retirement to or in respect of such officers or servants of the Board as it may think fit.
(2) Every such scheme shall fix the time and conditions of retirement for all persons to or in respect of whom pensions, gratuities or allowances on retirement are payable under the scheme, and different times and conditions may be fixed in respect of different classes of persons.
(3) The Board may at any time prepare and submit to the Minister a scheme amending a scheme previously submitted and approved of under this section.
(4) A scheme submitted to the Minister under this section shall, if approved of by the Minister with the concurrence of the Minister for Finance, be carried out by the Board in accordance with its terms.
(5) If any dispute arises as to the claim of any person to, or the amount of, any pension, gratuity or allowance payable in pursuance of a scheme under this section, such dispute shall be submitted to the Minister who shall refer it to the Minister for Finance, for his decision.
(6) Every scheme submitted and approved of under this section shall be laid before each House of the Oireachtas as soon as may be after it is approved of and if either House, within the next twenty-one days on which that House has sat after the scheme is laid before it, passes a resolution annulling the scheme, the scheme shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
(7) The costs and expenses incurred by the Board in preparing and carrying out a scheme under this section shall be paid out of the Fund.
Performance of functions of the Board.
28.—The Board may perform any functions imposed on the Board by this Act through or by any member of the Board or any officer or servant of the Board authorised by the Board in that behalf.
The Dairy Produce Fund.
29.—(1) The Board shall establish, maintain and manage in accordance with this Act a fund (in this Act referred to as the Fund) to be known as the Dairy Produce Fund.
(2) The following provisions shall apply in relation to the Fund:
(a) there shall be paid into the Fund all moneys received by the Board in respect of the sale of milk and milk products and in respect of levies on milk and on butter under this Act and any other moneys received by the Board,
(b) there shall be paid out of the Fund the purchase price of milk and milk products purchased by the Board and the amount of any expenses (including expenses of carriage, handling, storage (including cold storage), packing and insurance of milk and milk products) incurred by the Board in connection with its transactions in relation to the purchase or sale of milk and milk products and all other outlay or expenses incurred by the Board in performing its functions or otherwise under this Act,
(c) sums borrowed under section 30 of this Act may be secured on the Fund,
(d) so much of the Fund as, in the opinion of the Board, is for the time being not immediately required for making payments under paragraph (b) of this subsection may be invested by the Board in securities in which trustees are for the time being authorised by law to invest trust funds,
(e) the Board may from time to time at its discretion vary or transpose any moneys (being part of the Fund) invested under this subsection into other investments authorised by this subsection,
(f) all dividends and interest received by the Board on investments (being part of the Fund) made by it under this subsection and the proceeds of the sale of any such investments shall be paid into the Fund.
Power of the Board to borrow.
30.—The Board may, with the consent of the Minister, borrow, whether for capital or current purposes, such sums as from time to time it considers necessary.
Guarantee of loans.
31.—(1) The Minister may, if he so thinks fit and with the consent of the Minister for Finance, guarantee a loan to the Board.
(2) Whenever the Minister guarantees a loan under this section, he may guarantee in such form and manner and on such terms and conditions as the Minister for Finance may sanction, the due repayment by the Board of the principal of the loan or the payment of interest on the loan or both the repayment of such principal and the payment of such interest.
(3) The Minister shall not so exercise the powers conferred by subsections (1) and (2) of this section that the amount, or the aggregate amount, of principal which he may at any one time be liable to pay on foot of any guarantee or guarantees under those subsections for the time being in force, together with the amount of principal (if any) which the Minister has previously paid on foot of any such guarantees and has not been repaid by the Board, exceeds £5,000,000.
(4) Where a guarantee under this section is or has been given, the Board shall, if the Minister so requires, give to him such security as may be specified in the requisition for the purpose of securing to the Minister the repayment of any moneys which he may be liable to pay or has paid under the guarantee.
(5) The Minister shall, as soon as may be after the expiration of every financial year, lay before each House of the Oireachtasa statement setting out with respect to each guarantee under this section given during that year or given at any time before, and in force at, the commencement of that year—
(a) particulars of the guarantee,
(b) in case any payment has been made by the Minister under the guarantee before the end of that year, the amount of the payment and the amount (if any) repaid to the Minister on foot of the payment,
(c) the amount of principal covered by the guarantee which was outstanding at the end of that year.
(6) Moneys paid by the Minister under a guarantee under this section shall be repaid to the Minister (with, if the Minister for Finance so requires, interest thereon at such rates as the Minister for Finance appoints) by the Board within two years from the date of the advance.
(7) Where the whole or any part of moneys required by subsection (6) of this section to be repaid to the Minister has not been repaid in accordance with that subsection, the amount so remaining outstanding shall be repaid to the Central Fund out of moneys provided by the Oireachtas.
(8) Notwithstanding the provision of moneys under subsection (7) of this section to repay an amount to the Central Fund, the Board shall remain liable to the Minister in respect of that amount and that amount (with, if the Minister for Finance so requires, interest thereon at such rates as the Minister for Finance appoints) shall be repaid to the Minister by the Board at such times and in such instalments as the Minister for Finance appoints and, in default of repayment as aforesaid and without prejudice to any other method of recovery, shall be recoverable as a simple contract debt in any court of competent jurisdiction.
(9) Moneys repaid by the Board to the Minister, or recovered from the Board by the Minister, under this section shall be paid into or disposed of for the benefit of the Exchequer.
(10) All moneys from time to time required by the Minister to meet sums which may become payable by him under this section shall be advanced out of the Central Fund or the growing produce thereof.
(11) For the purpose of providing for advances out of theCentral Fund under this section, the Minister for Finance may borrow from any person any sum or sums, and for the purpose of such borrowing he may create and issue securities bearing such rate of interest and subject to such conditions as to repayment, redemption or any other matter as he thinks fit, and shall pay the moneys so borrowed into the Exchequer.
(12) The principal of and interest on any securities issued under this section and the expenses incurred in connection with the issue of such securities shall be charged on and payable out of the Central Fund or the growing produce thereof.
Grants to the Board.
32.—(1) There may be paid to the Board in each financial year out of moneys provided by the Oireachtas a grant or grants of such amount or amounts as the Minister, with the consent of the Minister for Finance and after consultation with the Board in relation to its programme of expenditure for that financial year, may fix.
(2) Subject to subsection (3) of this section, a grant under this section shall be used by the Board for such purpose or purposes and subject to such conditions (if any) as may be specified, with the consent of the Minister for Finance, by the Minister in writing at the time of the payment of the grant.
(3) The Minister may, if he so thinks fit and with the consent of the Minister for Finance, vary in any manner the purposes or conditions specified by the Minister under subsection (2) of this section in relation to a grant or specify a purpose for which or a condition subject to which the grant is to be used (not being a condition or purpose specified under the said subsection (2)) and if the Minister specifies under this subsection a purpose for which or conditions subject to which the grant is to be used, the Board shall use the grant for that purpose or subject to those conditions, as the case may be.
(4) A grant under this section shall not be used to defray more than two-thirds of—
(a) any loss incurred by the Board in relation to the export of milk products by the Board, or
(b) any subsidy, grant, or other like payment made by the Board in relation to the export of milk products, and a purpose or condition which is inconsistent with the provisions of this subsection shall not be specified under subsection (2) or (3) of this section.
Offices and premises.
33.—(1) The Board shall provide itself with such offices, stores, warehouses, shops and other premises in and outside the State as it considers necessary.
(2) For the purposes of subsection (1) of this section the Board may—
(a) purchase or take on lease any land or any offices, stores, warehouses, shops or other premises, and
(b) build, equip and maintain offices, stores, warehouses, shops and other premises.
(3) The Board may sell, lease or exchange any land or any offices, stores, warehouses, shops or other premises held by it and no longer required for the performance of its functions.
Carriage, handling, storage and packaging, of milk and milk products by the Board.
34.—(1) The Board may provide itself with such facilities for the carriage, handling, storage and packaging of milk and milk products as it considers necessary.
(2) Without prejudice to the generality of subsection (1) of this section the Board may—
(a) arrange with the owners of such facilities for their use by or on behalf of the Board,
(b) purchase or take on lease any land or premises,
(c) build, equip and maintain premises,
(d) purchase, take on hire, or charter, machinery, equipment, ships and vehicles.
Regional advisory committees.
35.—(1) The Board may, if it so thinks fit, establish in such manner as it thinks fit regional advisory committees composed of milk producers, persons representative of manufacturers of milk products and persons representative of the dairying industry generally, or composed of any or some of those categories of persons, to advise the Board in relation to the performance of its functions and the Board may, if it thinks fit, pay out of the Fund the whole or such part as it thinks proper of the expenses of any committees established under this section (including the expenses of travel and subsistence of the members thereof).
(2) The appointment of a person to act as a member of a committee established under this section shall be subject to such conditions (including conditions in relation to the term and tenure of office of the member) as the Board may think fit to impose when making the appointment.
(3) The Board may at any time dissolve a committee appointed under this section.
Milk levy.
36.—(1) There shall be paid to the Board by every registered proprietor of a creamery or cream-separating station a levy on milk purchased or otherwise acquired by him, other than from another such proprietor, at a time in respect of which a rate for such levy stands fixed by virtue of an order under subsection (3) of this section, and the levy shall be of such amount as may be appropriate having regard to the rate fixed under the order.
(2) The amount of milk levy due by a registered proprietor of a creamery or cream-separating station in respect of milk purchased or acquired in any month shall be paid to the Board not later than seven days after the last day of the month.
(3) (a) The Board may, whenever it thinks fit, make an order fixing the rate of milk levy and specifying the date on which the rate so fixed is to come into operation.
(b) The Board may, whenever it thinks fit, by order revoke or amend an order under this subsection including an order under this paragraph.
(c) An order under this subsection may fix different rates of milk levy in respect of different periods specified in the order.
(4) In this section “milk” means whole milk.
Butter levy.
37.—(1) There shall be paid to the Board by every registered proprietor of a creamery a levy on all creamery butter delivered on sale or manufactured for some other person by the proprietor at a time in respect of which a rate for such levy stands fixed by virtue of an order under subsection (4) of this section, and the levy shall be of such amount as may be appropriate having regard to the rate fixed under the order.
(2) There shall be paid to the Board by every registered proprietor of a creamery a levy on all imported butter delivered on sale by the proprietor, other than imported butter sold or otherwise disposed of to another proprietor, at a time in respect of which a rate for such levy stands fixed by virtue of an order under subsection (4) of this section and the levy shall be of such amount as may be appropriate having regard to the rate fixed under the order.
(3) The amount of butter levy due by a registered proprietor of a creamery in respect of butter delivered on sale or creamery butter manufactured for some other person in any month shall be paid to the Board not later than seven days after—
(a) the last day of the month, or
(b) the date of the making of the order under subsection (4) of this section by reference to which the amount of the levy is calculated,
whichever should later occur.
(4) (a) The Board may, whenever it thinks fit and with the consent of the Minister, make an order fixing the rate of butter levy and specifying the date on which the rate so fixed is to come into operation.
(b) The Board may, whenever it thinks fit and with the consent of the Minister, by order revoke or amend an order under this subsection including an order under this paragraph.
(c) The Minister may from time to time, as he thinks fit, direct the Board in writing—
(i) to make an order under this subsection fixing the rate of butter levy, and the direction may include a direction specifying the rate or rates of butter levy to be fixed in the order and the date or dates to be fixed in the order for the coming into operation of the rate or rates, or
(ii) to make an order revoking or amending an order under this subsection,
and the Board shall comply with a direction under this paragraph.
(d) An order under this subsection may—
(i) fix rates of butter levy, in respect of creamery butter, imported butter or both creamery butter and imported butter,
(ii) fix different rates of butter levy in respect of different kinds or classes of butter defined in such manner and by reference to such matters as the Board or the Minister, as may be appropriate, thinks proper,
(iii) fix different rates of butter levy in respect of different periods specified in the order,
(iv) provide for the coming into operation of any rate or rates of butter levy on a date prior to the date of the making of the order.
Butter stocks levy.
38.—(1) Subject to subsection (4) of this section, there shall be paid to the Board by every registered proprietor of premises and every butter trader a levy on—
(a) creamery butter (other than, in the case of a registered proprietor of a creamery, butter held by or on behalf of that proprietor and manufactured in that creamery) held by or on behalf of such proprietor or trader on any day specified in relation to creamery butter, in an order under subsection (3) of this section, and
(b) imported butter held by or on behalf of such proprietor or trader on any day specified, in relation to imported butter, in an order under subsection (3) of this section,
and the levy shall be of such amount as may be appropriate having regard to the rate fixed under the order.
(2) The amount of butter stocks levy due by a person in respect of butter held by him or on his behalf on any day specified in an order under subsection (3) of this section shall be paid to the Board not later than seven days after that day.
(3) (a) The Board may, whenever it thinks fit and with the consent of the Minister, make an order fixing the rate of butter stocks levy and the day in respect of which it is to be paid.
(b) The Board may, whenever it thinks fit and with the consent of the Minister, by order revoke or amend an order under this subsection including an order under this paragraph.
(c) The Minister may from time to time, as he thinks fit, direct the Board in writing—
(i) to make an order under this subsection fixing the rate of butter stocks levy and the direction may include a direction specifying the rate or rates of butter stocks levy to be fixed in the order and the day to be specified in the order in respect of which the levy is to be payable and may relate to creamery butter, imported butter or both creamery butter and imported butter, or
(ii) to make an order revoking or amending an order under this subsection,
and the Board shall comply with a direction under this paragraph.
(d) An order under this subsection may—
(i) fix rates of butter stocks levy in respect of creamery butter, imported butter or both creamery butter and imported butter,
(ii) fix different rates of butter stocks levy in respect of different kinds or classes of butter defined in such manner and by reference to such matters as the Board or the Minister, as may be appropriate, thinks proper.
(4) Where on a day specified in an order under subsection (3) of this section in respect of which butter stocks levy is payable the stocks of butter to which the order relates held by and on behalf of a registered proprietor of premises (Other than the registered proprietor of a creamery) or a butter trader are less than three hundred-weight in weight, subsection (1) of this section shall not apply in relation to the payment of butter stocks levy in respect of such day by that proprietor or butter trader, as the case may be.
(5) In this section and in section 40 of this Act “butter trader” means a person (other than a registered proprietor of premises), who carries on for trade or gain, whether alone or in conjunction with any other business, the business of selling, by wholesale or retail, butter.
Recovery of levies.
39.—(1) Every sum payable by a person by virtue of this Act to the Board for or on account of milk levy, butter levy or butter stocks levy shall be a simple contract debt due by that person to the Board and shall be recoverable accordingly by the Board from the person in any court of competent jurisdiction.
(2) In any legal proceedings by the Board against a person for any money claimed to be due by the person to the Board in respect of milk levy, butter levy, or butter stocks levy, a certificate under the seal of the Board certifying that the person was liable to pay milk levy, butter levy or butter stocks levy, as the case may be, of a specified amount and that a specified sum is due and unpaid by the person on foot of the milk levy, butter levy or butter stocks levy, as the case may be, together with a certificate under the seal of the Board certifying that the sum has not been paid by the person to the Board shall be prima facie evidence as to the liability for and amount of milk levy, butter levy or butter stocks levy, as the case may be, and as to the sum which is due and unpaid by the person in respect thereof.
Returns.
40.—(1) Every person liable under this Act to pay any sum to the Board on foot of milk levy, butter levy or butter stocks levy shall, before the expiration of the time within which the sum is required to be paid, send to the Board, in such form and manner and within such time as may be prescribed such particulars as may be prescribed of—
(a) in case the sum aforesaid is payable on foot of milk levy, the acquisition (whether by purchase or otherwise) and the disposal (whether by sale or otherwise) of milk by the person during such period as may be prescribed,
(b) in case the sum aforesaid is payable on foot of butter levy, the acquisition (whether by purchase or otherwise), the disposal (whether by sale or otherwise) and manufacture of butter by the person during such period as may be prescribed, and
(c) in case the sum aforesaid is payable on foot of butter stocks levy, stocks of butter held by or on behalf of the person during such period or on such day as may be prescribed.
(2) (a) The Board may serve a notice in writing on any registered proprietor of premises or butter trader requiring him to make to the Board within three days after the service of the notice a return of the amount of butter held anywhere by the proprietor or trader or on his behalf on a day mentioned in the notice, being a day specified in an order under subsection (3) of section 38 of this Act in respect of which butter stocks levy is payable.
(b) The Board may serve a notice in writing on any person who keeps butter in storage for a registered proprietor of premises or a butter trader requiring him to make to the Board within three days after the service of the notice a return of the amount of the butter kept anywhere by the person on a day mentioned in the notice, being a day specified in an order under subsection (3) of section 38 of this Act in respect of which butter stocks levy is payable and of the persons for whom the butter is so kept and of the quantity so kept for each such person.
(c) A return under this subsection shall be in the prescribed form and shall contain in addition to the particulars specified in paragraph (a) or (b), as the case may be, of this subsection, the prescribed particulars.
(d) A notice under this subsection may be served by delivering it to the person to whom it is addressed or by leaving it with a person over the age of sixteen years at the premises where the person to whom it is addressed carries on business or by sending it by registered post to the person to whom it is addressed at the premises where he carries on business.
(e) A person on whom a notice is served under this subsection shall comply with the terms thereof.
(3) The Board may make regulations for the purposes of this section and in this section “prescribed” means prescribed by regulations made under this subsection.
(4) A person who contravenes a provision of this section or who makes a return which to his knowledge is false or misleading shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding twenty pounds and, in the case of a second or any subsequent offence, to a fine not exceeding one hundred pounds.
Inspection of records.
41.—(1) An officer of the Board authorised in writing by the Board to exercise the powers conferred on an officer of the Board by this section may inspect and make copies of—
(a) all documents and records relating to the acquisition (by purchase or otherwise), disposal (by sale or otherwise), delivery on sale or storage of liquid milk and kept by or on behalf of persons liable to pay milk levy,
(b) all documents and records relating to the manufacture, acquisition (by purchase or otherwise), disposal (by sale or otherwise), delivery on sale or storage of butter and kept by or on behalf of persons liable to pay butter levy or butter stocks levy, and
(c) all documents and records relating to the storage of butter and kept by or on behalf of any person who keeps butter in storage for a registered proprietor of premises or butter trader, and for that purpose may enter at all reasonable times any premises in which he has reason to believe such documents or records are kept.
(2) Any person having in his possession or control any of the documents or records aforesaid shall, at the request of an officer of the Board authorised as aforesaid, produce such documents or records and give to him any information which he may reasonably require with regard to any entries therein.
(3) No person shall obstruct or impede an officer of the Board in the exercise of any of the powers conferred by this section.
(4) A person who contravenes a provision of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding twenty pounds and, in the case of a second or any subsequent offence, to a fine not exceeding one hundred pounds.
(5) An officer of the Board, when exercising any of the powers conferred by this section, shall, if so required, produce his authorisation to any person affected.
Non-disclosure of information by the Board.
42.—(1) Subject to subsection (2) of this section, information obtained under section 40 or 41 of this Act or in the performance of the functions of the Board by the Board or a member, officer or servant thereof shall not be disclosed, without the consent of the person to whom or to whose business the information relates, to a person who is not a member of the Board or an officer or servant employed by the Board.
(2) Subsection (1) of this section shall not apply in relation to the disclosure of information to the Minister or the Comptroller and Auditor-General or for the purposes of any legal proceedings (whether civil or criminal) taken or proposed to be taken under this Act.
(3) A person who contravenes subsection (1) of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding twenty pounds and, in the case of a second or any subsequent offence, to a fine not exceeding one hundred pounds.
Contribution by the Board towards cost of cold storage of butter by creameries.
43.—(1) The Minister may from time to time give the Board a direction in writing requiring it—
(a) to make and carry out during such period or periods as may be specified in the direction a scheme for the payment to the registered proprietors of creameries of allowances towards the cost of the cold storage, by or on behalf of the proprietors, of butter, or
(b) to suspend, or provide for the cesser of, as from a date specified in the direction, in whole or in part, a scheme under this subsection and payments thereunder.
(2) The Board shall comply with a direction under subsection (1) of this section.
(3) The terms and provisions (including terms and provisions relating to the rate of allowance) of a scheme under subsection (1) of this section shall be subject to the approval of the Minister.
(4) The costs and expenses incurred by the Board in making and carrying out a scheme under this section shall be paid out of the Fund.
(5) The terms and provisions of a scheme under subsection (1) of this section may, subject to the approval of the Minister, be amended from time to time by the Board in such manner as the Board thinks fit.
(6) The terms and provisions of a scheme under subsection (1) of this section shall, on the direction of the Minister, be amended by the Board in such manner as the Minister specifies in writing to the Board.
(7) The Minister may give a direction under subsection (6) of this section to the Board from time to time as he thinks fit.
Obligation of the Board to purchase butter from creameries.
44.—(1) The Board shall purchase at the price which stands fixed for the time being under subsection (2) of this section and is appropriate in relation to the purchase all butter which—
(a) is offered for sale at that price to the Board by the registered proprietor of a creamery,
(b) was manufactured in that creamery, and
(c) is of a kind which conforms with the provisions in relation to creamery butter of the Dairy Produce Acts, 1924 to 1947, and the regulations made thereunder.
(2) The Government may from time to time fix the price of butter for the purposes of subsection (1) of this section or may fix two or more prices varying in accordance with either or both of the following, that is to say, the quantity of butter sold and the method of packing the butter, and may specify a date or dates as on and from which purchases shall be made at the price or prices so fixed and the Minister shall notify the Board in writing of the price or prices so fixed and the date or dates so specified.
Sales of butter in the State by the Board to be at price fixed by the Government.
45.—(1) Whenever the Board sells butter which—
(a) is intended for consumption in the State, and
(b) is of a kind which conforms with the provisions in relation to creamery butter of the Dairy Produce Acts, 1924 to 1947, and the regulations made thereunder or is imported butter,
the sale shall be made at the price which stands fixed for the time being under subsection (2) of this section in relation to such sale and is appropriate in relation to the sale.
(2) The Government may from time to time fix the price of butter for the purposes of subsection (1) of this section or may fix two or more prices varying in accordance with either or both of the following, that is to say, the quantity of butter sold and the method of packing the butter, and may specify a date or dates as on and from which the price or prices so fixed shall apply and the Minister shall notify the Board in writing of the price or prices so fixed and the date or dates so specified.
Transfer to the Board of moneys in dairy produce (price stabilisation) fund.
46.—(1) Where, by virtue of an order under subsection (2) of section 2 of the Dairy Produce (Price Stabilisation) (Amendment) Act, 1938, in relation to section 41 of the Dairy Produce (Price Stabilisation) Act, 1935, (being the first such order in relation to the said section 41) the said section 41 ceases to be in force, the Minister shall, upon the date of such cesser if there is then any amount standing to the credit of the dairy produce (price stabilisation) fund, cause the whole of such amount to be transferred and paid to the Board out of that fund.
(2) The Minister may, on or after the establishment day and before the date of the cesser aforesaid, if he so thinks fit and if there is then any amount standing to the credit of the dairy produce (price stabilisation) fund, cause to be transferred and paid to the Board out of that fund such sum or sums as he may determine.
Annual report.
47.—(1) As soon as may be after the 31st day of March in each year after the year 1960, the Board shall make a report to the Minister of its proceedings under this Act during the twelve months ending on that date and the Minister shall cause copies of the report to be laid before each House of the Oireachtas.
(2) Whenever the Minister so directs, the annual report shall also include information on such particular aspects of the Board's proceedings under this Act as the Minister may specify.
Accounts and audits.
48.—(1) The Board shall keep, in such form as may be approved by the Minister with the concurrence of the Minister for Finance, all proper and usual accounts of all moneys received or expended by it.
(2) As soon as may be after the 31st day of March in each year after the year 1960, the Board shall submit its accounts for the twelve months ending on that date, a balance sheet as of that date, and a statement of accounts for the year ending on that date to the Comptroller and Auditor-General and the Comptroller and Auditor-General shall audit the accounts and make a report thereon and on the other documents submitted to him.
(3) Immediately after audit under this section of the accounts of the Board, the Board shall send to the Minister a copy of the statement of accounts and the balance sheet certified by the Comptroller and Auditor-General and a copy of the Comptroller and Auditor-General's report.
(4) The Minister shall cause copies of the documents referred to in subsection (3) of this section to be laid before each House of the Oireachtas.
Furnishing of information to the Minister.
49.—The Board shall furnish to the Minister, at such times and in such form and manner as the Minister may specify, such information regarding its proceedings under this Act as the Minister may request.
Dissolution of the Butter Marketing Committee.
50.—(1) The Butter Marketing Committee (in this Act referred to as the Committee), being a central marketing organisation operating under rules approved by the Minister under the Dairy Produce (Price Stabilisation) Act, 1935, shall on the transfer day be dissolved.
(2) The Minister may by order made under this section appoint a day, being a day which falls not earlier than the establishment day, to be the transfer day for the purposes of this Act.
Preservation of contracts of service entered into by the Committee.
51.—Every contract of service, express or implied, which was entered into by the Committee and is in force immediately before the transfer day shall continue in force on and after the transfer day but shall be construed and have effect as if the Board were substituted therein for the Committee, and every such contract shall be enforceable by or against the Board accordingly.
Transfer of property of the Committee to the Board.
52.—(1) Subject to the provisions of this section, all property whether real or personal (including choses-in-action) which immediately before the transfer day was vested in, or belonged to, or was held in trust for, the Committee and all rights, powers and privileges relating to or connected with any such property shall, on the transfer day and without any conveyance or assignment but subject where necessary to transfer in the books of any bank, corporation or company or authority, become the property of and be vested in or held in trust for or enjoyed by (as the case may require) the Board for all the estate, trust or interest for which the same immediately before the transfer day was vested in or belonged to or was held in trust for the Committee.
(2) All property transferred by this section which, immediately before the transfer day, was standing in the books of any bank or was registered in the books of any bank, corporation, company or authority shall, upon the request of the Board made on or after the transfer day be transferred in the books by the bank, corporation, company or authority into the name of the Board.
(3) On and after the transfer day every chose-in-action transferred by this section to the Board may be sued upon, recovered or enforced by the Board in their own name and it shall not be necessary for the Board to give notice to the person bound by such chose-in-action of the transfer effected by this section.
(4) Subsection (1) of this section shall, in so far as it operates to transfer land, have effect, for the purposes of the Conveyancing Act, 1881, as a conveyance of land.
Transfer of liabilities of the Committee to the Board.
53.—Every debt and other liability (including unliquidated liabilities arising from torts or breaches of contract) which immediately before the transfer date was owing and unpaid or has been incurred and is undischarged by the Committee shall, on the transfer day, become and be the debt or liability of the Board and shall be paid or discharged by and may be recovered from or enforced against the Board accordingly.
Preservation of continuing contracts of the Committee.
54.—Every bond, guarantee, mortgage or other security of a continuing nature made or given by the Committee to any person, or by any person to the Committee, and in force immediately before the transfer day, and every contract or agreement in writing made between the Committee and another person and not fully executed and completed before the transfer day shall, notwithstanding the dissolution of the Committee, continue in force on and after the transfer day but shall be construed and have effect as if the name of the Board were substituted therein for the name of the Committee, and the security, contract, or agreement shall be enforceable by or against the Board accordingly.
Continuance of pending legal proceedings to which the Committee is a party.
55.—In every action, suit or proceedings which is pending immediately before the transfer day in any court or tribunal and to which the Committee is a party, the Board shall on the transfer day become and be a party in the place of the Committee and such action, suit or proceedings, as the case may be, shall be continued between the Board and the other parties thereto accordingly and no such action, suit or proceedings shall abate or be discontinued or prejudicially affected by reason of the dissolution of the Committee.
Exemption from stamp duty.
56.—Section 12 of the Finance Act, 1895, shall not apply to the vesting in the Board of the property of the Committee.
Prohibition of export and import of milk and milk products.
57.—(1) The Minister may, whenever and so often as he thinks fit, by order prohibit, save under and in accordance with a licence issued under this Act, the exportation from the State of milk and milk products.
(2) The Minister may, whenever and so often as he thinks fit, by order prohibit, save under and in accordance with a licence issued under this Act, the importation into the State of milk and milk products.
(3) Without prejudice to the generality of subsection (1) of this section, an order under that subsection may relate to the exportation generally or to any specified country or countries or by any specified method or methods of milk and milk products or any specified class or kind (defined in such manner and by reference to such things as the Minister thinks fit) of milk or milk product.
(4) Without prejudice to the generality of subsection (2) of this section, an order under that subsection, may relate to the importation generally or from any specified country or countries or by any specified method or methods of milk and milk products or any specified class or kind (defined in such manner and by reference to such things as the Minister thinks fit) of milk or milk product.
(5) Without prejudice to the generality of subsections (1) and (2) of this section, orders under those subsections may make provision for such matters as appear to the Minister necessary for securing the due enforcement of the orders.
(6) The Minister may by order revoke or amend an order under subsection (1) or (2) of this section or under this subsection.
(7) On the application of a person made in such form and containing such particulars as the Minister may direct, the Minister may, if he thinks fit, issue to such person a licence to import or a licence to export, either generally or from or to, as the case may be, a specified country or countries, milk and milk products or any specified class or kind of milk or milk product of which such exportation or importation, as the case may be, is prohibited by an order under subsection (1) or (2) of this section.
(8) Whenever the Minister issues a licence under this section he may attach to the licence such conditions as he shall think proper and shall specify in the licence.
(9) The Minister may revoke a licence issued under this section.
(10) A person who, for the purpose of obtaining for himself or any other person a licence under this section, makes any statement or representation which is to his knowledge false or misleading in any material respect shall be guilty of an offence under this subsection and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding twenty pounds and, in the case of a second or any subsequent offence to a fine not exceeding one hundred pounds.
(11) In this section references to exportation and importation include reference to exportation and importation by the Board and cognate words shall be construed accordingly.
Amendment of Dairy Produce (Price Stabilisation) (Amendment) Act, 1938.
58.—(1) In this section “the Act of 1938” means the Dairy Produce (Price Stabilisation) (Amendment) Act, 1938.
(2) Section 1 of the Act of 1938 is hereby amended by the substitution for the definition of “the suspendable provisions” of the following definition:
“‘the suspendable provisions’ means the provisions of the Dairy Produce (Price Stabilisation) Acts, 1935 to 1956, other than sections 1 to 3 of this Act”.
(3) An order under section 2 or section 3 of the Act of 1938 may relate to one or more than one of the suspendable provisions, and where an order does not relate to all the suspendable provisions, the references in those sections to the suspendable provisions shall, in relation to the order, be construed as references to the provision or provisions, as the case may be, to which the order relates and the said sections shall be construed and have effect accordingly.
(4) Section 3 of the Act of 1938 is hereby amended by—
(a) the insertion in subsection (3) after “reviving order” of “in relation to section 11 of the Principal Act”, and
(b) the substitution of the following subsection for subsection (4):
“(4) Whenever the Minister makes a reviving order in relation to any paragraph or paragraphs (other than paragraph (a)) of subsection (1) of section 17 of the Principal Act, he may by such order fix a day to be the appointed day for the purposes of that paragraph or those paragraphs, as the case may be, and references to the appointed day in that paragraph or those paragraphs, as the case may be, shall, in relation to any period during which the suspend able provisions are in force by virtue of the order, be construed as references to the day so fixed.”
Amendment of Dairy Produce (Amendment) Act, 1941.
59.—Section 1 of the Dairy Produce (Amendment) Act, 1941, is hereby amended by the insertion in the definition of “authorised body” after means of “An Bord Bainne or”.
Prosecution of offences.
60.—(1) An offence under section 40 or 41 of this Act may be prosecuted by the Board.
(2) An offence under any provision of this Act, other than the said sections 40 and 41 may be prosecuted by the Minister.
Offences in relation to bodies corporate and unincorporated bodies.
61.—(1) Where an offence under any section of this Act is committed by a body corporate or by a person purporting to act on behalf of a body corporate or an unincorporated body of persons and is proved to have been so committed with the consent or approval of, or to have been facilitated by any default on the part of, any person being, in the case of a body corporate, a director thereof, or, in the case of an unincorporated body, a member of the committee of management or other controlling authority thereof, that person shall also be guilty of the offence.
(2) Any summons or other document required to be served for the purpose or in the course of proceedings under this Act on a body corporate may be served by leaving it at or sending it by registered post to the registered office of that body or, if there be no such office in the State, by leaving it at, or sending it by registered post to, the body at any place in the State at which it conducts its business.
Fees on licences.
62.—(1) There shall be payable to the Minister in respect of a licence under section 57 of this Act such (if any) fee as the Minister shall, with the consent of the Minister for Finance, from time to time direct, and the fee shall be collected and taken in such manner as the Minister for Finance shall from time to time direct and shall be paid into or disposed of for the benefit of the Exchequer in accordance with the directions of the said Minister.
(2) The Public Offices Fees Act, 1879, shall not apply in respect of a fee payable under this section to the Minister.
Laying of orders and regulations before Houses of the Oireachtas.
63.—Every order and regulation made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and if a resolution annulling the order or regulation is passed by either such House within the next subsequent twenty-one days on which that House has sat after the order or regulation is laid before it, the order or regulation shall be annulled accordingly but without prejudice to the validity of anything previously done under the order or regulation.
Expenses.
64.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Short title
65.—This Act may be cited as the Dairy Produce Marketing Act, 1961.
