CUID I.
Roimhraiteach agus Generalta.

1.—(1) Féadfar an tAcht Tora Talmhaíochta (Uibhe), 1939, do ghairm den Acht so.
(2) Tiocfaidh an tAcht so i ngníomh an lá san a cheapfaidh an tAire le hordú.
Mínithe.
2.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Talmhaidheachta;
cialluíonn an focal “orduithe” orduithe le rialacháin ar n-a ndéanamh ag an Aire fén Acht so;
cialluíonn an focal “cigire” duine bheidh ceaptha i scríbhinn (go generálta no d'ócáid áirithe) ag an Aire chun bheith ina chigire chun crícheanna an Achta so;
foluíonn an focal “pacáiste” aon bhosca, cráta, cás, cuairsceann, no gabhadán eile ina mbeidh uibhe no ina bhféadfadh uibhe bheith chun iad d'iompar agus, mara n-éilíonn an có-théacs a mhalairt, foluíonn lánas an ghabhadáin sin;
cialluíonn an focal “uibhe” uibhe éanlaithe tighis agus lachan ina bplaosca;

cialluíonn an abairt “dílseánach cláruithe” duine bheidh iontrálta i gclár a bheidh á choimeád ag an Aire do bhun an Achta so mar dhílseánach ar áitreabh a bheidh cláruithe sa chlár san;
cialluíonn an abairt “áitreabh mórdhíoltóra cláruithe” áitreabh a bheidh cláruithe sa chlár de mhórdhíoltóirí;
cialluíonn an abairt “mórdhíoltóir cláruithe” dílseánach cláruithe áitreibh mhórdhíoltóra chláruithe;
cialluíonn an abairt “deighleálaí cláruithe” an dílseánach cláruithe ar áitreabh a bheidh cláruithe sa chlár de dheighleálaithe;

cialluíonn an abairt “stóráil cheimiciúil” stóráil chun uibhe do leasú le haon phróiseas ná hatharuíonn mianach na bplaosc, agus stóráil in aon ghás, gal no meascán gásúil d'áireamh;
foluíonn an focal “díol” malairtiú agus margáil, agus is dá réir sin a léireofar focail atá gaolmhar dó;
cialluíonn an focal “mórdhíol” díol, mar thrádáil, le duine dheineann, mar ghnó, uibhe d'fháil chun a n-ath-dhíolta, ach ní fholuíonn díol le húnaer no sealbhaire tighe ósta, tighe bhídh, club, no áitreibh eile ina ndíoltar uibhe chun iad do thómhailt ann agus chuige sin amháin, no le duine éigin thar ceann únaera no sealbhaire den tsórt san, agus is dá réir sin a léireofar focail atá gaolmhar dó;
cialluíonn an focal “miondíol” díol nach mórdhíol, agus is dá réir sin a léireofar focail atá gaolmhar dó;
foluíonn an focal “fáil” ceannach agus foluíonn freisin fáil tré mhargáil no tré mhalairtiú no ar aon tslí eile, agus is dá réir sin a léireofar focail atá gaolmhar dó;
nuair a húsáidtear an focal “miondíoltóir” gan coinníoll, cialluíonn sé duine dheineann, mar ghnó, uibhe do mhiondíol, pe'ca dílseánach cláruithe é no nach eadh;
foluíonn an abairt “uibhe bheidh le díol” uibhe bheidh ceannuithe chun a n-ath-dhíolta, uibhe bheidh á gcoimeád chun a ndíolta (láithreach no ar ball), uibhe bheidh á dtairgsint no á dtaisbeáint chun a ndíolta, uibhe bheidh díolta ach ná beidh seachadtha agus uibhe bheidh á n-iompar chun no i gcúrsa a ndíolta.
Na daoine bheidh oilte ar uibhe do thástáil, do ghrádáil, agus do phacáil.
3.—(1) Ní tuigfear chun crícheanna an Achta so duine do bheith oilte ar ghnó thástála, ghrádála agus phacála ubh maran rud é—
(a) go mbeidh deimhniú aige, ar n-a thabhairt amach ag an Aire, á dheimhniú go bhfuil sé oilte ar an ngnó san, no
(b) go gcuirfe sé ina luighe ar an Aire go bhfuil sé oilte ar an ngnó san.
(2) Féadfaidh duine ar bith deimhniú den tsórt a luaidhtear sa bhfo-alt san roimhe seo den alt so d'iarraidh ar an Aire agus féadfaidh an tAire deimhniú den tsórt san roimhráite do thabhairt amach don duine sin más deimhin leis an duine sin do bheith oilte ar ghnó thástála, ghrádála agus phacála ubh.
Rialacháin.
4.—(1) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh ag ordú éinní no aon ruda dá dtagartar san Acht so mar ní no mar rud atá orduithe no le hordú, ach ní déanfar aon rialachán den tsórt san i dtaobh méid no bailiú aon táillí gan an tAire Airgeadais do thoiliú leis.
(2) Gach rialachán a dhéanfaidh an tAire fén alt so no fé aon alt eile den Acht so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta agus má dheineann ceachtar Tigh den Oireachtas, fé cheann an lae agus fiche shuidhfidh an Tigh sin ina dhiaidh sin, rún do rith ag cur an rialacháin sin ar nea-mbrí beidh an rialachán san curtha ar nea-mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén rialachán san.
Ciontaí.
5.—(1) Féadfaidh an tAire no féadfar ar agra an Aire gach cionta fé aon alt den Acht so do chúiseamh.
(2) Má dheineann cólucht corpruithe cionta fé aon alt den Acht so agus go gcruthófar go ndearnadh amhlaidh é le toiliú no le ceadú éinne no gur cuireadh a dhéanamh in usacht le haon fhaillí i bpáirt éinne is stiúrthóir no bainisteoir ar an gcólucht chorpruithe sin no is rúnaí no oifigeach eile dhó, tuigfear an stiúrthóir, an bainisteoir, an rúnaí no an t-oifigeach eile sin do bheith ciontach sa chionta san agus dlighfe sé imeachta do bhunú ina choinnibh agus é phionósú dá réir sin.

6.—Sa mhéid go gceadóidh an tAire Airgeadais é is amach as airgead a sholáthróidh an tOireachtas a híocfar na costaisí uile fé n-a raghaidh an tAire chun an Achta so do chur i bhfeidhm.
Táillí do bhailiú agus do chur de láimh.
7.—(1) Is sa tslí sin ordóidh an tAire Airgeadais o am go ham a baileofar agus a tógfar na táillí uile is iníoctha fén Acht so agus déanfar iad d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste do réir orduithe an Aire sin.
(2) Ní bheidh feidhm ag an Public Offices Fees Act, 1879, maidir le haon táillí is iníoctha fén Acht so.
Cosaint do chomhachta an Aire Riaghaltais Aiteamhail agus Sláinte Poiblidhe.
8.—(1) Na comhachta bheirtear don Aire leis an Acht so beid, agus feidhmeofar iad, gan dochar don Aire Riaghaltais Aiteamhail agus Sláinte Poiblidhe d'fheidhmiú na gcomhacht a bheirtear dó leis an Public Health (Regulations as to Food) Act, 1907.
(2) Ní dhéanfaidh éinní atá san Acht so dochar do sna comhachta ná srian a chur leis na comhachta bheirtear d'údaráis sláintíochta leis na hAchtanna Sláinte Puiblí, 1878 go 1931, no fútha.
Scríbhinní do sheirbheáil.
9.—(1) Más gá no más ceaduithe do réir an Achta so scríbhinn do sheirbheáil ar dhuine ar bith, is i slí éigin acu so leanas a seirbheálfar an scríbhinn, sé sin le rá:—
(a) tríd an scríbhinn do sheachadadh don duine sin; no
(b) tríd an scríbhinn do sheachadadh do dhuine ar bith, a bheidh sé bliana déag d'aois ar a laighead, agus a bheidh i bhfostaíocht an duine sin; no
(c) tríd an scríbhinn do chur tríd an bpost i leitir roimh-íoctha agus í dírithe chun an duine sin ag á áitreabh cláruithe más dílseánach cláruithe é no, in aon chás eile, ag an seoladh ag á mbíonn gnó ar siúl aige no ag an áit chomhnaithe is déanaí is eol do bheith aige.
(2) Chun críche an ailt seo tuigfear gur ina n-oifig chláruithe bhíonn gnó ar siúl ag cólucht corpruithe ar n-a chlárú in Éirinn fé sna hAchtanna Cuideachtan, 1908 go 1924, agus tuigfear gur ina bpríomh-oifig no ina bpríomh-áit ghnótha in Éirinn a bhíonn gnó ar siúl ag gach cólucht corpruithe eile agus ag gach cólucht neamhionchorpruithe.

10.—Athghairmtear leis seo an tAcht Tora Talmhaíochta (Uibhe), 1924 (Uimh. 35 de 1924), agus an tAcht Tora Talmhaíochta (Uibhe), 1930 (Uimh. 36 de 1930).
Cosaint do tháillí fé Acht athghairmthe.
11.—(1) D'ainneoin an Achta Tora Talmhaíochta (Uibhe), 1924 (Uimh. 35 de 1924), d'athghairm leis an Acht so beidh táille bhliantúil fé alt 9 den Acht san iníoctha, in aghaidh na tréimhse dar tosach an 1adh lá d'Eanar roimh thosach feidhme an Achta so agus dar críoch an lá roimh an tosach feidhme sin, ag dílseánach cláruithe (do réir bhrí an ailt sin 9) gach áitreibh fé leith a bheidh cláruithe sa chlár d'easportálaithe fén Acht san ar feadh na tréimhse sin no aon choda dhi.
(2) Gach táille is iníoctha de bhuadh an fho-ailt deiridh sin roimhe seo den alt so—
(a) is leis an Aire bheidh sí iníoctha, agus
(b) áirmheofar í do réir ailt 9 den Acht Tora Talmhaíochta (Uibhe), 1924, fé is dá mba bhliain an tréimhse luaidhtear sa bhfo-alt deiridh sin roimhe seo, agus
(c) tiocfa sí chun bheith dlite díreach i dtosach feidhme an Achta so agus íocfar í fé cheann mí ar a dhéanaí tar éis an tosach feidhme sin, agus
(d) féadfaidh an tAire í bhaint den té ag á mbeidh sí iníoctha mar fhiacha gnáth-chonnartha in aon chúirt dlighinse inniúla.
(3) Gach táille bhliantúil do tháinig chun bheith dlite fé alt 9 den Acht Tora Talmhaíochta (Uibhe), 1924, an 31adh lá de Mhí na Nodlag díreach roimh thosach feidhme an Achta so, beidh sí, mara n-íoctar í roimh an tosach feidhme sin, iníoctha do réir an ailt sin 9 (d'ainneoin a athghairmthe sin leis an Acht so) agus féadfaidh an tAire í bhaint den té ag á mbeidh sí iníoctha mar fhiacha gnáthchonnartha in aon chúirt dlighinse inniúla.
(4) D'ainneoin an Achta Tora Talmhaíochta (Uibhe), 1924, d'athghairm leis an Acht so leanfaidh fo-ailt (5) agus (6) d'alt 9 den Acht san i bhfeidhm chun crícheanna na dtáillí uile bheidh, de bhuadh an ailt seo, iníoctha fén alt san 9 tar éis tosach feidhme an Achta so.
Sean-orduithe agus seanarialacháin do bhuanú.
12.—(1) Gach ordú agus gach rialachán do rinneadh fé sna hAchtanna Tora Talmhaíochta (Uibhe), 1924 agus 1930, agus a bheidh i bhfeidhm díreach roimh thosach feidhme an Achta so, leanfaidh de bheith i bhfeidhm, mara mbeidh agus sa mhéid ná beidh sé buiniscionn leis an Acht so, d'ainneoin an Achta so d'athghairm an Achta fé n-a ndearnadh é.
(2) Gach ordú agus rialachán a leanfaidh de bheith i bhfeidhm de bhuadh an ailt seo tuigfear gur fén Acht so do rinneadh é agus féadfar, i gcás aon orduithe den tsórt san, é cheiliúradh, é leasú no é atharú le haon ordú dhéanfaidh an tAire fén Acht so agus, i gcás aon rialacháin den tsórt san, é cheiliúradh, é leasú no é atharú le haon rialachán a dhéanfaidh an tAire fén Acht so.
CUID II.
Aitreabhacha do Chlaru.
Na cláir agus a lánas.
13.—(1) Cuirfidh an tAire fé ndeár go gcoimeádfar—
(a) clár ar a dtabharfar mar ainm agus mar theideal agus dá ngairmtear san Acht so an clár de mhórdhíoltóirí, agus
(b) clár ar a dtabharfar mar ainm agus mar theideal agus dá ngairmtear san Acht so an clár de dheighleálaithe, agus
(c) clár ar a dtabharfar mar ainm agus mar theideal agus dá ngairmtear san Acht so an clár de mhiondíoltóirí, agus
(d) clár ar a dtabharfar mar ainm agus mar theideal agus dá ngairmtear san Acht so an clár de leasuitheoirí.
(2) Iontrálfar sna cláir uile agus fé seach a bheidh á gcoimeád do bhun an ailt seo na nithe seo leanas maidir le gach áitreabh a clárófar sna cláir sin fé seach, sé sin le rá:—
(a) ainm agus tuairisc iomlán dhílseánaigh an áitreibh, agus
(b) tuairisc ar shuidheamh an áitreibh is leor chun an áitreibh sin agus a theoranta agus a mhéid d'aithint.
(3) Aitreabh a bheidh cláruithe in aon cheann áirithe de sna cláir a bheidh á gcoimeád do bhun an ailt seo, ní bheidh sé, faid a bheidh sé cláruithe amhlaidh, ionchláruithe in aon cheann eile de sna cláir sin.

14.—Gach uair a hiarrfar fén Acht so áitreabh do chlárú in aon chlár seachas an clár de mhiondíoltóirí íocfar leis an Aire táille (dá ngairmtear táille chlárathachta san Acht so) de phunt, agus beidh íoc na táille sin go cuibhe ina choinníoll nach foláir a chólíonadh sara mbreithneoidh an tAire an t-iarratas.

15.—(1) Íocfaidh gach mórdhíoltóir cláruithe leis an Aire, in aghaidh gach leath-bhliana dar críoch an 30adh lá de Mheitheamh no an 31adh lá de Mhí na Nodlag agus go mbeidh sé cláruithe sa chlár de mhórdhíoltóirí ar a feadh no ar feadh aon choda dhi, táille (dá ngairmtear táille fála ubh san Acht so) a háirmheofar do réir an ráta orduithe agus sa tslí orduithe ar mhéid iomlán na n-ubh do fuair sé an leath-bhliain sin, seachas uibhe go gcuirfear ina luighe ar an Aire ina dtaobh—
(a) gur o mhórdhíoltóir chláruithe eile fuair sé iad, no
(b) go rabhadar neamh-oiriúnach mar bhia do dhaoine no salach ar an taobh amuich agus gur cuireadh de láimh iad sa tslí is gá do réir an Achta so maidir le huibhe den tsórt san.
(2) Íocfaidh gach miondíoltóir cláruithe leis an Aire, in aghaidh gach leath-bhliana dar críoch an 30adh lá de Mheitheamh no an 31adh lá de Mhí na Nodlag agus go mbeidh sé cláruithe sa chlár de mhiondíoltóirí ar a feadh no ar feadh aon choda dhi, táille (agus táille fála ubh a gairmtear di sin freisin san Acht so) a háirmheofar do réir an ráta orduithe agus sa tslí orduithe ar mhéid iomlán na n-ubh do fuair sé o tháirgtheoirí an leath-bhliain sin, seachas uibhe go gcuirfear ina luighe ar an Aire ina dtaobh go rabhadar neamhoiriúnach mar bhia do dhaoine no salach ar an taobh amuich agus gur cuireadh de láimh iad sa tslí is gá do réir an Achta so maidir le huibhe den tsórt san.
(3) Lasmuich de chás dá bhforáltar a mhalairt leis an gcéad fho-alt ina dhiaidh seo den alt so, tiocfaidh gach táille fála ubh chun bheith dlite an lá tar éis lae dheiridh na leath-bhliana gur ina haghaidh a bheidh sí iníoctha agus déanfar, i gcás gach táille den tsórt san a thiocfaidh chun bheith dlite amhlaidh an 1adh lá d'Iúl bliain ar bith, í íoc roimh an 1adh lá de Mheán Fhómhair an bhliain sin no, i gcás gach táille den tsórt san a thiocfaidh chun bheith dlite amhlaidh an 1adh lá d'Eanar bliain ar bith, í íoc roimh an 1adh lá de Mhárta an bhliain sin.
(4) Má scuireann mórdhíoltóir cláruithe no miondíoltóir cláruithe, i rith aon leath-bhliana dar críoch an 30adh lá de Mheitheamh no an 31adh lá de Mhí na Nodlag, de bheith cláruithe sa chlár de mhórdíoltóirí no sa chlár de mhiondíoltóirí (do réir mar a bheidh) tiocfaidh an táille fála ubh is iníoctha aige in aghaidh na leath-bhliana san chun bheith dlite an lá tar éis an lae scuirfe sé de bheith cláruithe amhlaidh agus íocfar í fé cheann dhá mhí ón lá thiocfa sí chun bheith dlite amhlaidh.
Táillí bliantúla.
16.—(1) Íocfaidh gach deighleálaí cláruithe leis an Aire, in aghaidh gach bliana go mbeidh sé cláruithe sa chlár de dheighleálaithe ar a feadh no ar feadh aon choda dhi, táille (dá ngairmtear táille bhliantúil san Acht so) den mhéid orduithe no, go dtí go n-ordófar an méid a bheidh sa táille sin, de phunt.
(2) Lasmuich de chás dá bhforáltar a mhalairt leis an gcéad fho-alt ina dhiaidh seo den alt so tiocfaidh gach táille bhliantúil chun bheith dlite an 1adh lá d'Eanar an bhliain gur ina haghaidh a bheidh sí iníoctha agus íocfar í roimh an 1adh lá de Mhárta an bhliain sin.
(3) An táille bhliantúil is iníoctha ag deighleálaí cláruithe in aghaidh na bliana thiocfa sé chun bheith cláruithe sa chlár de dheighleálaithe tiocfa sí chun bheith dlite an lá thiocfa sé chun bheith cláruithe amhlaidh agus íocfar í fé cheann dhá mhí ón lá san.
Táillí do bhaint amach.
17.—(1) Beidh gach táille fála ubh agus gach táille bhliantúil, ná híocfar fé cheann na haimsire ceaptar leis an Acht so chun a híoctha, ionbhainte amach ag an Aire mar fhiacha gnáthchonnartha in aon chúirt dlighinse inniúla agus beidh sí ionbhainte amach amhlaidh d'ainneoin an Aire d'fheidhmiú na comhachta bheirtear dó leis an gcéad fho-alt ina dhiaidh seo den alt so agus gan dochar don fheidhmiú san.
(2) Mara ndeinidh duine dhlighfidh táille fála ubh no táille bhliantúil d'íoc an táille sin d'íoc fé cheann na haimsire ceaptar leis an Acht so chun a híoctha, is dleathach don Aire an clárú sa chlár de mhórdhíoltóirí, sa chlár de mhiondíoltóirí, no sa chlár de dheighleálaithe (do réir mar a bheidh) ar gach áitreabh go mbeidh an duine sin cláruithe sa chlár san ina thaobh do chealú.
(3) Má cealuítear clárú aon áitréibh de bhuadh an fho-ailt deiridh sin roimhe seo den alt so agus go ndéanfar an táille, gurbh é a neamh-íoc fé ndeár an cealú san, d'íoc fé cheann trí mhí tar éis deireadh na haimsire ceaptar leis an Acht so chun a híoctha, féadfaidh an tAire, más ceart san dar leis, an t-áitreabh san do chur thar n-ais, amhail ar dháta agus o dháta íoctha na táille sin amhlaidh, sa chlár inar cealuíodh clárú an áitreibh sin amhlaidh.
Iarrataisí ar chlárú.
18.—(1) Gach iarratas a déanfar ar áitreabh do chlárú i gclár a bheidh á choimeád do bhun an Achta so (seachas an clár de mhiondíoltóirí) isé dílseánach an áitreibh sin a dhéanfaidh é agus is i scríbhinn agus sa bhfuirm agus sa tslí orduithe déanfar é agus beidh na mion-innste orduithe ann.
(2) Pé uair a hiarrfar fén alt so aon áitreabh áirithe do chlárú, cuirfidh an tAire an t-áitreabh san á iniúchadh ag cigire.
(3) Má dhiúltuíonn an tAire d'iarratas fén alt so ar aon áitreabh áirithe do chlárú inneosfar réasúin an diúltuithe don iarratasóir.
(4) Má diúltuítear d'iarratas fén alt so ar áitreabh do chlárú ní choiscfidh san iarratas nua do dhéanamh fén alt so ar an áitreabh céanna do chlárú aon uair ina dhiaidh sin.
(5) Pé uair a hiarrfar fén alt so áitreabh do chlárú i gclár féadfaidh an tAire, más oiriúnach leis é, an t-áitreabh san do chlárú sa chlár san sara n-iniúchtar do bhun an ailt seo é, agus pé uair a chláróidh an tAire aon áitreabh amhlaidh beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) ní bheidh sa chlárú san ach clárú sealadach agus clárú sealadach a gairmtear de san Acht so;
(b) ní shaorfaidh an clárú san an tAire o n-a bheith d'oblagáid air an t-áitreabh san do chur á iniúchadh ag cigire, ach amháin go bhféadfar an t-iniúchadh san do dhéanamh tar éis an chláruithe sin;
(c) ní dhéanfaidh an clárú san dochar ná deifir do chomhacht an Aire chun géilleadh no diúltú don iarratas san ar an áitreabh san do chlárú;
(d) má ghéilleann agus nuair a ghéillfidh an tAire don iarratas san scuirfidh an clárú sealadach san de bheith ina chlárú shealadach;
(e) má dhiúltuíonn agus nuair a dhiúltóidh an tAire don iarratas san cealófar an clárú sealadach san;
(f) pé uair agus faid a bheidh aon áitreabh cláruithe go sealadach i gclár tuigfear, chun crícheanna uile an Achta so ach fé réir na míreanna san roimhe seo den fho-alt so, an t-áitreabh san do bheith ina áitreabh atá cláruithe sa chlár san agus an té bheidh cláruithe amhlaidh ina dhílseánach air, tuigfear ina thaobh, chun na gcrícheanna san ach fé réir na míreanna roimhráite, gurb é is dílseánach cláruithe ar an áitreabh san.
Coinníollacha clárathachta.
19.—(1) Ní chláróidh an tAire aon áitreabh (ach amháin go sealadach) i gclár a bheidh á choimeád do bhun an Achta so (seachas an clár de mhiondíoltóirí) maran deimhin ná go dtí gur deimhin leis an t-áitreabh san do bheith do réir na gcoinníollacha uile seo leanas, sé sin le rá:—
(a) go bhfuil an t-áitreabh oiriúnach ina dhéanmhas chun an ghnótha san do dhéanamh ann a deintear no atá beartuithe a dhéanamh ann agus gur leor a bhfuil ann de ghléasra, d'fheistisí agus d'fhearastí atá oiriúnach don ghnó san; agus
(b) go bhfuil an t-áitreabh agus a chuid gléasra, feistisí agus fearaistí glan agus i dtreo mhaith; agus
(c) go bhfuil san áitreabh cóiríocht is oiriúnach agus is leor chun uibhe agus pacáistí d'uibhe do stóráil ann ar chuma go bhféadfaí teacht ar na huibhe agus na pacáistí bheadh stórálta amhlaidh chun iad d'iniúchadh fén Acht so.
(2) Ní chláróidh an tAire aon áitreabh (ach amháin go scaladach) sa chlár de mhórdhíoltóirí maran deimhin ná go dtí gur deimhin leis an t-áitreabh san do bheith, ní hamháin do réir na gcoinníollacha luaidhtear sa bhfo-alt san roimhe seo den alt so, ach fós do réir na gcoinníollacha uile seo leanas, sé sin le rá:—
(a) go bhfuil san áitreabh cóiríocht is oiriúnach agus is leor chun oiread pacáistí agus abhar pacála do stóráil sa cheart agus is gá, ar feadh na tréimhse sin a bheidh orduithe, i gcóir gnáth-riachtanaisí an ghnótha deintear san áitreabh san; agus
(b) go bhfuil an t-áitreabh gléasta mar is cóir leis na fearaistí agus na riachtanaisí orduithe chun uibhe do thástáil, do ghrádáil, agus do phacáil agus chun uibhe agus na pacáistí ina bpacálfar iad do mharcáil; agus
(c) nach lugha ná an chaindíocht mhinimum orduithe an chaindíocht d'uibhe a tástáltar, a grádáltar, agus a pacáltar san áitreabh i rith gach seachtaine a tástáltar, a grádáltar, nó a pacáltar aon uibhe san áitreabh; agus
(d) go bhfuil an té atá á iarraidh go gclárófaí an t-áitreabh, no éinne amháin ar a laighead ar fostú aige san áitreabh, oilte do réir bhrí an Achta so ar uibhe do thástáil, do ghrádáil, agus do phacáil do réir an Achta so agus do réir rialachán ar n-a ndéanamh fé.
(3) Gan dochar d'aon réasún eile chun diúltuithe eireoidh fén Acht so, is réasún maith gach réasún acu so leanas chun an Aire do dhiúltú d'iarratas ar aon áitreabh áirithe do chlárú i gclár a bheidh á choimeád do bhun an Achta so (seachas an clár de mhiondíoltóirí), sé sin le rá:—
(a) go raibh an t-áitreabh san cláruithe roimhe sin fé sna hAchtanna Tora Talmhaíochta (Uibhe), 1924 agus 1930, agus go ndearnadh a chlárú do chealú fé sna hAchtanna san nó fé cheachtar acu, no
(b) go raibh an t-áitreabh san cláruithe roimhe sin fén Acht so agus go ndearnadh a chlárú do chealú fén Acht so, no
(c) go raibh neach iarrtha an chláruithe sin ina dhílseánach chláruithe roimhe sin ar áitreabh eile a bhí cláruithe fé sna hAchtanna Tora Talmhaíochta (Uibhe), 1924 agus 1930, no fén Acht so agus, le linn é bheith cláruithe amhlaidh, go ndearna an tAire clárú an áitreibh eile sin do chealú fé sna hAchtanna san no fé cheachtar acu no fén Acht so.
Aistriú ón gclár d'easportálaithe atá á choimeád fé sna hAchtanna Tora Talmhíochta (Uibhe), 1924 agus 1930.
20.—(1) Gach duine bheidh cláruithe, díreach roimh thosach feidhme an Achta so, sa chlár d'easportálaithe atá á choimeád do bhun na nAchtanna Tora Talmhaíochta (Uibhe), 1924 agus 1930, ina dhílseánach ar áitreabh a bheidh cláruithe sa chlár san, tuigfear gur iarr sé go cuibhe fén Acht so, díreach tar éis tosach a fheidhme sin, an t-áitreabh san do chlárú sa chlár de mhórdhíoltóirí.
(2) Na forálacha den Acht so bhaineann le hiarrataisí ar áitreabhacha do chlárú sa chlár de mhórdhíoltóirí agus le háitreabhacha do chlárú sa chlár san, beidh feidhm agus éifeacht acu maidir le gach iarratas ar áitreabh do chlárú sa chlár san go dtuigfear ina thaobh, de bhuadh an fho-ailt sin roimhe seo den alt so, é do dhéanamh díreach tar éis tosach feidhme an Achta so agus fós maidir leis an áitreabh san do chlárú sa chlár san ach beidh na forálacha san den Acht so fé réir na n-atharuithe seo leanas, maidir leis na hiarrataisí sin agus leis an gclárú san, sé sin le rá:—
(a) déanfar an t-áitreabh is abhar d'aon iarratas den tsórt san do chlárú go sealadach sa chlár san láithreach, agus
(b) ní bheidh aon táille chlárathachta iníoctha alos aon iarratais den tsórt san.
Fianaise ar lánas na gclár.
21.—(1) Gach clár a bheidh á choimeád do bhun an Achta so—
(a) tuigfear é bheith sa choimeád cheart nuair a bheidh sé i gcoimeád an Aire no aon oifigigh don Aire go n-údarás aige chuige sin ón Aire, agus
(b) beidh sé ionghlactha ina fhianaise gan a thuilleadh cruthúnais ar é thabhairt i láthair as an gcoimeád ceart.
(2) Féadfar fianaise prima facie ar aon iontráil in aon chlár a bheidh á choimeád do bhun an Achta so do thabhairt in aon chúirt no in aon imeachta dlí tré chóip den iontráil sin do bhéarfaidh le tuisgint í bheith deimhnithe bheith ina cóip dhílis ag oifigeach don Aire go n-údarás aige chuige sin do thabhairt i láthair agus ní gá sighniú an oifigigh sin do chruthú ná a chruthú gurbh é an t-oifigeach san é ná go raibh an t-údarás san aige.
(3) Deimhniú, bhéarfaidh le tuisgint é bheith sighnithe ag oifigeach don Aire go n-údarás aige chuige sin ón Aire, á dheimhniú gan áitreabh áirithe a bheidh luaidhte sa deimhniú san do bheith iontrálta sa chlár a bheidh luaidhte sa deimhniú san, is fianaise dhochlaoite é ar na nithe bheidh deimhnithe amhlaidh agus ní gá sighniú an oifigigh sin do chruthú ná a chruthú gurbh é an t-oifigeach san é ná go raibh an t-údarás san aige.
(4) Féadfaidh duine ar bith—
(a) aon chlár a bheidh á choimeád do bhun an Achta so d'iniúchadh ar íoc na táille sin a bheidh orduithe agus nach mó ná scilling in aghaidh gach iniúchta fé leith;
(b) cóip, a bheidh deimhnithe sa tslí luaidhtear anso roimhe seo bheith ina cóip dhílis, d'aon iontráil in aon chlár a bheidh á choimeád do bhun an Achta so d'fháil ar íoc táille de reul ar gach fólio de dhá fhocal sheachtód den chóip;
(c) deimhniú den tsórt a luaidhtear anso roimhe seo, á dheimhniú gan áitreabh áirithe do bheith cláruithe i gclár áirithe bheidh á choimeád do bhun an Achta so, d'fháil ar íoc táille de dhá scilling agus reul ar gach deimhniú.
Aitreabh cláruithe do thuitim agus d'aistriú chun duine.
22.—(1) Má éagann dílseánach cláruithe áitreibh chláruithe beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) ní leor ann féin éag an dílseánaigh chláruithe sin chun a thabhairt gur nea-dhleathach de bhuadh an Achta so an gnó do bhí ar siúl san áitreabh san go dtí an t-éag san do choimeád ar siúl san áitreabh san go ceann tréimhse sé mhí ón éag san;
(b) beidh ionadaí pearsanta an dílseánaigh chláruithe éagtha san no, le haontú ar ionadaí phearsanta san, aon duine eile i dteideal (fé réir forálacha an ailt seo) go ndéanfaí, ar n-a iarraidh sin dó ar an Aire sa bhfuirm agus sa tslí orduithe, é chlárú ina dhílseánach chláruithe ar an áitreabh san;
(c) o éag an dílseánaigh chláruithe éagtha san go dti go gclárófar duine eile ina dhílseánach chláruithe ar an áitreabh san tuigfear gurb é an té go mbeidh an gnó san ar siúl aige san áitreabh san is dílseánach cláruithe air chun cricheanna an mhéide sin den Acht so bhaineann le nithe bheidh le déanamh san áitreabh san no i gcúrsa an ghnótha san do bheith ar siúl agus chun críche fógraí is gá do réir an Achta so do thabhairt don dílseánach cláruithe agus chun críche seirbheála na bhfógraí sin.
(2) Má dheineann dílseánach cláruithe áitreibh chláruithe (dá ngairmtear an t-aistritheoir san alt so) an t-áitreabh san agus an gnó bhíonn ar siúl ann d'aistriú, ar n-a dhíol no eile, chun duine eile (dá ngairmtear an t-aistrí sa bhfo-alt so) beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) ar n-a iarraidh sin dó ar an Aire sa bhfuirm agus sa tslí orduithe agus ar n-a chur ina luighe dhó ar an Aire go bhfuil sé tagtha chun bheith ina dhílseánach ar an áitreabh san, beidh an t-aistrí i dteideal (fé réir forálacha an ailt seo) go gclárófaí é ina dhílseánach chláruithe ar an áitreabh san;
(b) go dtí go gclárófar an t-aistrí amhlaidh ina dhílseánach chláruithe ar an áitreabh san leanfaidh an t-aistritheoir de bheith ina dhílseánach chláruithe ar an áitreabh san chun crícheanna uile an Achta so d'ainneoin an aistrithe sin.
(3) Má hiarrtar ar an Aire fén alt so duine (dá ngairmtear an t-iarratasóir sa bhfo-alt so) do chlárú ina dhílseánach chláruithe ar áitreabh chláruithe beidh feidhm agus éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) i gcás gur ionadaí pearsanta dhílseánaigh chláruithe éagtha an t-iarratasóir agus é bheith á iarraidh fén gcéad fho-alt den alt so mar ionadaí phearsanta an dílseánaigh chláruithe éagtha san agus mar sin go gclárófaí é agus an t-iarratas do dhéanamh go cuibhe do réir an fho-ailt sin, ní dhiúltóidh an tAire don iarratas:
(b) i ngach cás eile is dleathach don Aire, más ceart san dar leis, diúltú don iarratas ar an bhforas go raibh an t-iarratasóir roimhe sin ina dhílseánach chláruithe ar áitreabh eile bhí cláruithe fé sna hAchtanna Tora Talmhaíochta (Uibhe), 1924 agus 1930, no fén Acht so agus, le linn é bheith cláruithe amhlaidh, gur chealuigh an tAire clárú an áitreibh eile sin fé sna hAchtanna san no fé cheachtar acu no fén Acht so.
Clárú d'atharú agus do chealú
23.—(1) Féadfaidh an tAire, tráth ar bith, clárú aon áitreibh fén Acht so d'atharú no do chealú ar n-a iarraidh sin don dílseánach cláruithe no, i gcás pearsan, d'ionadaí phearsanta an dílseánaigh chláruithe no, i gcás cóluchta chorpruithe, do leachtálaí an dílseánaigh chláruithe.
(2) Féadfaidh an tAire tráth ar bith, gan aon iarratas den tsórt san roimhráite, clárú aon áitreibh fén Acht so d'atharú in aon phuínte ina bhfeicfear dó an clárú san do bheith earráideach no mí-threorach.
(3) Féadfaidh an tAire tráth ar bith, gan aon iarratas den tsórt san roimhráite, clárú aon áitreibh fén Acht so do chealú más deimhin leis—
(a) gur tré chalaois no tré cham-thuairisc, pe'ca calaoiseach no neamh-urchóideach di, do tugadh an t-áitreabh do chlárú; no
(b) go bhfuil an t-áitreabh tar éis scurtha de bheith ionchláruithe sa chlár ina bhfuil sé cláruithe de bhíthin gach ceann no aon cheann no cinn de sna coinníollacha clárathachta bhaineann leis do bheith gan cólíonadh ina thaobh; no
(c) gur éag an phearsa ba dhílseánach cláruithe ar an áitreabh agus nár cláruíodh éinne eile ina dhílseánach air in ionad an dílseánaigh chláruithe éagtha san fé cheann sé mhí tar éis an éaga san; no
(d) gur scuireadh an cólucht corpruithe ba dhílseánach cláruithe ar an áitreabh agus nár cláruíodh éinne eile ina dhílseánach air in ionad an dílseánaigh chláruithe scurtha san fé cheann mí tar éis an scurtha san; no
(e) go ndearnadh an dílseánach cláruithe do bhreithiúnú ina fhéimhí i gcás pearsan no d'fhoirceannadh go héigeanta i gcás cóluchta chorpruithe; no
(f) go ndearnadh san áitreabh sárú (le gníomh no le faillí) ar an Acht so no ar rialachán ar n-a dhéanamh fé; no
(g) go ndearna an dílseánach cláruithe connradh chun uibhe do cheannach no do dhíol agus gur theip air no gur fhailligh sé, gan chúis réasúnta, déanamh do réir an chonnartha san; no
(h) go bhfuiltear tar éis scur den ghnó gur ina thaobh atá an t-áitreabh san cláruithe do bheith ar siúl san áitreabh san; no
(i) i gcás áitreibh a bheidh cláruithe sa chlár de mhórdhíoltóirí, gur chuir an dílseánach cláruithe fé ndeár no gur leig go feasach na marcanna do cuireadh do bhun an Achta so ar aon uibhe, no ar aon phacáiste d'uibhe, do heasportáladh ón áitreabh san d'atharú (in Éirinn no lasmuich dhi) no go ndearna, maidir le huibhe no pacáistí d'uibhe do heasportáladh amhlaidh, éinní eile do bhainfeadh o chlú uibhe Éireannacha.
(4) Beidh feidhm agus éifeacht ag na forálacha so leanas maidir le clárú aon áitreibh fén Acht so d'atharú no do chealú fén alt so (ach amháin do réir iarratais chuige sin ar n-a dhéanamh fén alt so), sé sin le rá:—
(a) ní dhéanfaidh an tAire aon atharú ná cealú den tsórt san mara dtugaidh ná go dtí go dtabharfaidh do dhílseánach cláruithe an áitreibh sin no dá ionadaí phearsanta no dá leachtálaí (do réir mar a bheidh) fógra coicís ar a laighead i scríbhinn á rá go bhfuil déanamh an atharuithe no an chealuithe sin á bhreithniú ag an Aire agus ag luadh na bhforas ar a bhfuil an t-atharú no an cealú san á bhreithniú amhlaidh;
(b) breithneoidh an tAire aon chúis i dtaobh an atharuithe no an chealuithe sin a pléidhfear leis, ag éinne le n-a mbainfidh, sara mbeidh ré an fhógra choicís sin caithte;
(c) féadfaidh an tAire, más oiriúnach leis é, fiosrúchán do chur á dhéanamh i dtaobh an atharuithe no an chealuithe sin;
(d) má deintear an t-atharú no an cealú san in aon chor déanfar é fé cheann trí mhí tar éis ré an fhógra choicís sin do bheith caithte.
Lánas na gclár d'fhoillsiú.
24.—(1) Féadfaidh an tAire foillsiú do dhéanamh sa tslí sin is oiriúnach leis—
(a) ar gach ní no éinní dá mbeidh iontrálta in aon chlár a bheidh á choimeád fén Acht so, agus
(b) ar fhógra i dtaobh clárú aon áitreibh chláruithe do chealú no d'atharú, agus
(c) ar fhógra i dtaobh aon chiontuithe i gcionta i gcoinnibh an Achta so no aon ailt de no i gcoinnibh aon rialacháin ar n-a dhéanamh fén gcéanna.
(2) Ní déanfar aon tuairisceán ar leith ná cuid ar leith de thuairisceán a cuirfear isteach do bhun an Achta so d'fhoillsiú ná do nochtadh ach amháin chun crícheanna cúisimh fén Acht so.
(3) Féadfaidh an tAire o am go ham eolas staitistíochta (agus staitistíocht as tuairisceáin a cuirfear isteach do bhun an Achta so d'áireamh) do bhailiú agus d'fhoillsiú i dtaobh méide agus staide na trádála ubh agus go sonnrách i dtaobh méide an ghnótha bheidh ar siúl in áitreabhacha bheidh cláruithe sna cláracha uile agus fé seach a bheidh á gcoimeád do bhun an Achta so.
(4) Sa mhéid gur féidir é do réir réasúin, ní bheidh in aon eolas staitistíochta foillseofar fén alt so aon mhion-innste do chuirfeadh ar chumas éinne a aithint gur mion-innste iad a bhaineann le haon duine no gnó áirithe gan an duine sin no dílseánach an ghnótha san do thoiliú chuige i scríbhinn.
Tuairisceáin o dhílseánaigh chláruithe áitreabhacha cláruithe.
25.—(1) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh á cheangal ar dhílseánaigh chláruithe áitreabhacha cláruithe tuairisceáin tréimhsiúla do chur isteach chun an Aire agus féadfaidh an tAire, leis na rialacháin sin, gach ní no éinní acu so leanas d'ordú, sé sin le rá:—
(a) na tuairisceáin a bheidh le cur isteach amhlaidh ag mórdhíoltóirí cláruithe;
(b) na tuairisceáin a bheidh le cur isteach amhlaidh ag deighleálaithe cláruithe;
(c) na tuairisceáin a bheidh le cur isteach amhlaidh ag miondíoltóirí cláruithe;
(d) na tuairisceáin a bheidh le cur isteach amhlaidh ag leasuitheoirí cláruithe;
(e) na tráthanna bheidh na tuairisceáin sin fé seach le cur isteach;
(f) an fhuirm agus an tslí ina mbeidh na tuairisceáin sin fé seach le cur isteach.
(2) Gach duine ar a gceanglófar le rialacháin ar n-a ndéanamh fén alt so aon tuairisceán do chur isteach agus go dteipfidh air no a dhiúltóidh an tuairisceán san do chur isteach agus é ar gach slí do réir na rialachán san beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar fiche punt.
Cláir a bheidh le coimeád in áitreabhacha cláruithe.
26.—(1) Beidh sé de dhualgas ar gach mórdhíoltóir cláruithe clár do choimeád no a chur fé ndeár é choimeád i ngach áitreabh cláruithe ar ar dílseánach cláruithe é, clár sa bhfuirm orduithe de sna huibhe uile do gheobhaidh agus do bhéarfar isteach san áitreabh san no a díolfar ann no a cuirfear amach as, agus, fé cheann dhá uair dhéag a' chluig tar éis aon uibhe den tsórt san d'fháil no do dhíol no do chur amach, na mion-innste orduithe i dtaobh na n-ubh san do chur sa chlár san no a chur fé ndeár iad a chur sa chlár san.
(2) Beidh sé de dhualgas ar gach deighleálaí cláruithe—
(a) clár do choimeád no a chur fé ndeár é choimeád i ngach áitreabh cláruithe ar ar dílseánach cláruithe é, clár sa bhfuirm orduithe de sna huibhe uile do gheobhfar no a díolfar san áitreabh san no a cuirfear amach as, agus, fé cheann dha uair dhéag a' chluig tar éis aon uibhe den tsórt san d'fháil no do dhíol no do chur amach, na mion-innste orduithe i dtaobh na n-ubh san do chur sa chlár san no a chur fé ndeár iad a chur sa chlár san, agus
(b) clár do choimeád no a chur fé ndeár é choimeád ina áitreabh chláruithe no (má bhíonn níos mó ná aon áitreabh cláruithe amháin aige) sa cheann san a roghnóidh de sna háitreabhacha san, clár sa bhfuirm orduithe de sna huibhe uile do gheobhaidh no dhíolfaidh in aon áit, no chuirfidh amach as aon áit, seachas a áitreabh cláruithe no aon cheann dá áitreabhacha cláruithe, agus, fé cheann sé huaire tríochad a' chluig tar éis aon uibhe den tsórt san d'fháil no do dhíol no do chur amach, na mion-innste orduithe i dtaobh na n-ubh san do chur sa chlár san no a chur fé ndeár iad a chur sa chlár san, agus
(c) a chur in úil don Aire, má bhíonn níos mó ná aon áitreabh cláruithe amháin aige, cadé an t-áitreabh do roghnuigh chun crícheanna na míre deiridh sin roimhe seo den fho-alt so, agus gan an roghnú san d'atharú gan an tAire do thoiliú chuige.
(3) Beidh sé de dhualgas ar gach miondíoltóir cláruithe clár do choimeád no a chur fé ndeár é choimeád i ngach áitreabh cláruithe ar ar dílseánach cláruithe é, clár sa bhfuirm orduithe de sna huibhe uile do gheobhaidh agus do bhéarfar isteach san áitreabh san (pe'ca san áitreabh cláruithe sin do gheobhaidh na huibhe sin no nach eadh), agus, fé cheann dhá uair dhéag a' chluig tar éis aon uibhe den tsórt san d'fháil, na mion-innste orduithe i dtaobh na n-ubh san do chur sa chlár san no a chur fé ndeár iad a chur sa chlár san.
(4) Beidh sé de dhualgas ar gach leasuitheoir cláruithe clár do choimeád no a chur fé ndeár é choimeád i ngach áitreabh cláruithe ar ar dílseánach cláruithe é, clár sa bhfuirm orduithe de sna huibhe uile do gheobhfar san áitreabh san no a cuirfear amach as, agus, fé cheann dhá uair dhéag a' chluig tar éis aon uibhe den tsórt san d'fháil no do chur amach, na mion-innste orduithe i dtaobh na n-ubh san do chur sa chlár san no a chur fé ndeár iad a chur sa chlár san.
(5) Gach clár a bheidh á choimeád do bhun an ailt seo féadfaidh aon chigire é d'iniúchadh uair ar bith i rith tráthanna oifige agus, ar n-a iarraidh sin air, beidh sé de dhualgas ar an dílseánach cláruithe an clár san do thaisbeáint don chigire chun a iniúchta agus fós gach forchuntas, nóta seachadtha no consighneachta, admháil agus scríbhinn eile (ar a n-áirmhítear cóipeanna dhíobh i gcás gan iad féin do bheith ar fáil) a iarrfaidh an cigire do réir réasúin chun féachaint an fíor aon iontráil áirithe sa chlár san no cad fé ndeár éinní áirithe d'fhágaint amach as.
(6) Má thárlann d'aon dílseánach cláruithe—
(a) ná coimeádfa sé no ná cuirfidh fé ndeár go gcoimeádfar an clár no na cláir sin is gá do réir an ailt seo do choimeád, no
(b) ná déanfa sé no ná cuirfidh fé ndeár go ndéanfar in aon chlár den tsórt san, fé cheann na haimsire a horduítear leis an alt so, aon iontráil áirithe is gá do réir an ailt seo do dhéanamh ann, no
(c) ná taisbeánfa sé no ná cuirfidh fé ndeár go dtaisbeánfar, ar n-a iarraidh sin air, chun go n-iniúchfadh cigire é, aon chlár, scríbhinn, no cóip de scríbhinn is gá dhó do réir an ailt seo do thaisbeáint amhlaidh, no go gcoiscfidh aon chigire agus iniúchadh aige á dhéanamh, no
(d) go ndéanfa sé no go gcuirfidh fé ndeár go ndéanfar in aon chlár den tsórt san, go toiliúil no tré fhaillí, aon iontráil a bheidh bréagach no mí-threorach i bponc táchtach,
beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche punt do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar caoga punt.
(7) Chun críche an ailt seo—
(a) folóidh clár no scríbhinn d'iniúchadh cóipeanna do dhéanamh de no sleachta do thógaint as; agus

(c) má diúltuítear no má faillítear clár no scríbhinn eile do thaisbeáint chun a iniúchta agus gur san áitreabh chláruithe, agus ag duine ar fostú ag an dílseánach cláruithe, a déanfar an diúltú no an failliú san tuigfear gurb é an dílseánach cláruithe do rinne an diúltú no an failliú san; agus
(d) cialluíonn an abairt “tráthanna oifige” aon tráth idir a deich a chlog ar maidin agus a cúig a chlog tráthnóna a bhíonn gnó ar siúl no obair á dhéanamh san áitreabh chláruithe.
(8) Tagairtí deintear san Acht so (lasmuich den alt so) do chlár a bheidh á choimeád fén Acht so no do chlár a bheidh á choimeád do bhun an Achta so ní fholóid aon chlár a bheidh á choimeád do bhun an ailt seo.
Aitreabh cláruithe d'iniúchadh.
27.—(1) Beidh teideal ag aon chigire dul isteach, gach tráth réasúnta, in aon áitreabh a bheidh cláruithe i gclár a bheidh á choimeád do bhun an Achta so no 'na mbeifear á iarraidh go gclárófaí in aon chlár den tsórt san é, agus gach ní no éinní acu so leanas do dhéanamh ann, sé sin le rá:—
(a) iomlán an áitreibh sin no aon chuid de agus an gléasra, na fearaistí agus na feistisí ann d'iniúchadh;
(b) féachaint ar an tástáil, an ghrádáil, agus an phacáil a deintear ar uibhe san áitreabh san no ar aon phróiseas no próiseasaí acu san;
(c) na huibhe, na pacáistí agus na habhair phacála uile san áitreabh san no aon chuid acu do scrúdú agus samplaí réasúnta de sna huibhe, de sna pacáistí agus de sna habhair phacála san uile no d'aon chuid acu do thógaint;
(d) uibhe do chuardach agus d'iniúchadh san áitreabh san;
(e) a cheangal ar an dílseánach cláruithe no ar éinne ar fostú ag an dílseánach cláruithe san áitreabh san an t-eolas san, is gá do réir réasúin chun na gcrícheanna bhaineann le riaradh an Achta so, do thabhairt don chigire i dtaobh aon uibhe no pacáiste d'uibhe do gheobhaidh san áitreabh san.
(2) Gach duine—
(a) a choiscfidh no a bhacfaidh cigire agus é ag feidhmiú aon chomhachta dá dtugtar dó leis an alt so; no
(b) a fhailleoidh no a dhiúltóidh aon eolas a bheidh cigire i dteideal a iarraidh fén alt so do thabhairt don chigire sin ar n-a iarraidh sin dó-san air; no
(c) do bhéarfaidh do chigire, go toiliúil no go faillítheach, eolas a bheidh bréagach no mí-threorach i bponc táchtach,
beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar cúig púint do chur air.
Atharú ar dhéanmhasáitreibh chláruithe.
28.—(1) Ní dleathach d'aon dílseánach cláruithe (seachas miondíoltóir cláruithe) aon atharú dhéanamh ná a leigint é dhéanamh, gan an tAire á cheadú roimh ré, ar dhéanmhas aon áitreibh chláruithe ar ar dílseánach cláruithe é.
(2) Pé uair is mian le dílseánach cláruithe áitreibh chláruithe atharú do dhéanamh ar dhéanmhas an áitreibh sin, féadfaidh a iarraidh ar an Aire sa bhfuirm orduithe an t-atharú san a cheadú do réir an ailt seo, agus, chó luath agus is féidir é tar éis an iarratais d'fháil dó, cuirfidh an tAire in úil don dílseánach cláruithe sin i scríbhinn go gceaduíonn no ná ceaduíonn an t-atharú atá beartuithe.
(3) Gach dílseánach cláruithe dhéanfaidh atharú ar dhéanmhas aon áitreibh chláruithe contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air.
Toirmeasc ar dhílseánach chláruithe do dhéanamh gnótha in áitreabh seachas áitreabh cláruithe.
29.—(1) I gcás duine do bheith ina dhílseánach chláruithe ar áitreabh a bheidh cláruithe i gclár a bheidh á choimeád do bhun an Achta so, ní dleathach dó an gnó dheineann sé san áitreabh san do dhéanamh in aon áitreabh ná beidh cláruithe sa chlár san no nach é an dílseánach air a bheidh cláruithe sa chlár san é.
(2) Ní dhéanfaidh mórdhíoltóir cláruithe ná deighleálaí cláruithe gan toiliú an Aire, aon ghnó ina áitreabh cláruithe ná in aon cheann dá áitreabhacha cláruithe seachas an gnó gur ina thaobh a bheidh an t-áitreabh san cláruithe.
(3) Gach dílseánach cláruithe a dhéanfaidh éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga punt do chur air maraon le fíneáil bhreise ná raghaidh thar cúig púint in aghaidh gach lae leanfar den chionta san.
CUID III.

30.—(1) Ní dleathach do dhuine ar bith uibhe d'easportáil mara n-easportáltar na huibhe—
(a) ag mórdhíoltóir cláruithe díreach ón áitreabh mórdhíoltóra cláruithe inar pacáladh iad; no
(b) tré phost na mbeart; no
(c) ina gconsighneacht nach mó a mór-mheáchaint iomlán ná an mheáchaint mhaximum is ceaduithe de thurus na huaire do chur tré phost na mbeart; no
(d) chun iad do ghor agus ina gcaindíochtaí nach mó ná an maximum orduithe agus i bpacáistí bheidh marcálta sa tslí orduithe; no
(e) i bpacáiste a consighneofar agus a cuirfear ar aghaidh tré Éirinn o aon áit lasmuich d'Éirinn go dtí aon áit eile den tsórt san ach ná déanfar éinní eile leis in Éirinn; no
(f) tré fheirmeoir no a sheirbhísigh dá mbreith o Éirinn isteach i dTuaisceart Éireann i gcúrsa a ghnótha mar fheirmeoir; no
(g) fé réim agus do réir cheadúnais easportála ar n-a dheonadh ag an Aire fén gCuid seo den Acht so.
(2) Gach duine dhéanfaidh no thriallfaidh uibhe d'easportáil contrárdha don alt so beidh sé ciontach i gcionta fén bhfo-alt so.
(3) Gach duine iompróidh, ar aon tslí, uibhe ar bith a bheidh á n-easportáil no le heasportáil contrárdha don alt so, beidh sé ciontach i gcionta fén bhfo-alt so más le linn no chun na n-ubh san d'easportáil a déanfar an t-iompar san mara gcruthuighidh an duine sin ná raibh a fhios aige agus ná féadfadh sé, do réir réasúin, a fhios do bheith aige go raibh na huibhe sin á n-easportáil contrárdha don alt so.
(4) Gach duine bheidh ciontach i gcionta fé aon fho-alt den alt so dlighfear, ar a chiontú ann ar an slí achmair, fíneáil ná raghaidh thar fiche punt do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar caoga punt no, más rogha leis an gcúirt é, príosúntacht ar feadh téarma ar bith nach sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile.

31.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so ní consighneofar uibhe o áitreabh mhórdhíoltóra cláruithe go dtí aon áit (in Éirinn ná lasmuich dhi) mara mbeidh na coinníollacha uile seo leanas cólíonta maidir leis na huibhe sin, sé sin le rá:—
(a) beidh na huibhe ina n-uibhe do tástáladh, do grádáladh agus do pacáladh do réir forálacha an Achta so agus rialachán ar n-a ndéanamh fé, agus
(b) beidh gach ceann de sna huibhe, agus fós an pacáiste ina mbeidh na huibhe sin, marcálta leis na marcanna orduithe do réir an Achta so agus rialachán ar n-a ndéanamh fé, agus
(c) beidh na huibhe ina n-uibhe do tástáladh, do grádáladh, do pacáladh agus do marcáladh mar adubhradh san áitreabh mhórdhíoltóra cláruithe o n-a mbeid á gconsighniú agus beidh an pacáiste ina mbeidh na huibhe ina phacáiste do marcáladh mar adubhradh san áitreabh san freisin, agus
(d) beidh na huibhe gan tógaint as an bpacáiste inar pacáladh iad amhlaidh san áitreabh san, agus
(e) beidh na huibhe glan agus oiriúnach mar bhia do dhaoine.
(2) Gach duine dhéanfaidh no thrialfaidh uibhe do chonsighniú contrárdha don alt so beidh sé ciontach i gcionta fén bhfo-alt so.
(3) Gach duine iompróidh, ar aon tslí, aon uibhe consighneofar contrárdha don alt so beidh sé ciontach i gcionta fén bhfo-alt so mara gcruthuighidh an duine sin ná raibh a fhios aige agus ná féadfadh sé, do réir réasúin, a fhios do bheith aige gur contrárdha don alt so do consighníodh na huibhe sin.
(4) Gach duine bheidh ciontach i gcionta fé aon fho-alt den alt so dlighfear, ar a chiontú ann ar an slí achmair, fíneáil ná raghaidh thar fiche punt do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar caoga punt no, más rogha leis an gcúirt é, príosúntacht ar feadh téarma ar bith nach sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile.
(5) Ní bhainfidh an t-alt so le huibhe do chonsighniú o áitreabh chláruithe mórdhíoltóra chláruithe go dtí áitreabh cláruithe mórdhíoltóra chláruithe eile do bhun díola do rinne an mórdhíoltóir cláruithe sin a céad-luaidhtear leis an mórdhíoltóir cláruithe eile sin fé réim agus do réir cheadúnais ar n-a dheonadh ag an Aire fén Acht so.
(6) Ní dhéanfaidh éinní atá san alt so mórdhíoltóir cláruithe do chosc ar uibhe do chur dá láimh sa tslí orduithe do gheobhfar, nuair a tástálfar ina áitreabh chláruithe iad, do bheith neamhoiriúnach mar bhia do dhaoine no salach ar an taobh amuich.
Comhachta cigirí maidir le huibhe do chonsighniú.
32.—(1) Beidh teideal ag cigire ar bith (fé réir an údaráis i scríbhinn a bheidh aige mar chigire den tsórt san do thaisbeáint má hiarrtar san air) chun dul isteach agus saorchead do bheith aige istigh gach tráth réasúnta—
(a) in aon áitreabh cláruithe; no
(b) in aon áitreabh ina ndeintear uibhe do dhíol no iad do thaisbeáint no do choimeád no do stóráil chun a ndíolta no 'na mbeidh cúis réasúnta ag an gcigire sin chun a chreidiúint no chun bheith amhrusach go ndeintear uibhe do dhíol no iad do thaisbeáint no do choimeád no do stóráil chun a ndíolta ann; no
(c) in áitreabh éinne dheineann mar ghnó earraí d'iompar ar luach saothair; no
(d) in aon stóras no áitreabh eile le héinne dheineann mar ghnó earraí do stóráil; no
(e) ar aon phiara, cé, caladh, fánán no duga no in aon áitreabh duga; no
(f) in aon luing, bád, bhaigín traenach, laraí mótair, trucail, no árthach no feithicil eile a húsáidtear chun earraí d'iompar.
(2) Féadfaidh cigire ar bith gach ní no éinní acu so leanas do dhéanamh in aon áit dá luaidhtear sa bhfo-alt san roimhe seo den alt so no in aon áit phuiblí, sé sin le rá:—
(a) aon phacáiste do gheobhfar in aon áit acu san d'iniúchadh;
(b) aon phacáiste den tsórt san d'oscailt 'na mbeidh cúis réasúnta aige chun a chreidiúint no chun bheith amhrusach uibhe do bheith ann;
(c) aon uibhe do gheobhaidh in aon áit acu san do scrúdú, pe'ca i bpacáiste do sna huibhe sin no nach eadh;
(d) gach ní no éinní acu so leanas do thógaint agus do bhreith leis gan íoc as an gcéanna, sé sin le rá:—
(i) somplaí réasúnta d'aon uibhe do gheobhfar in aon áit acu san, pe'ca i bpacáiste do sna huibhe sin no nach eadh,
(ii) somplaí réasúnta d'aon abhar pacála do gheobhfar in aon áit acu san,

(f) más i lámhaibh cairréaraí don phacáiste no do gach ceann no aon cheann no cinn de sna pacáistí coinneofar amhlaidh, ordú do thabhairt i scríbhinn don chairréaraí sin á thoirmeasc an pacáiste no na pacáistí sin d'iompar níos sia (ach amháin chun an chéanna do thabhairt thar n-ais chun an chonsighneora) má chítear don chigire ar an gcéanna do scrúdú go ndearnadh no gur trialadh an tAcht so no aon rialachán ar n-a dhéanamh fé do shárú maidir leis;
(g) a éileamh ar dhuine ar bith a bheidh i bhfeighil aon ubh no aon phacáiste d'uibhe san áit sin ainmneacha agus teasmalta eile únaera no consighneora agus consighní na n-ubh san no an phacáiste sin do thabhairt dó.
(3) Gach duine—

beidh sé ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar cúig púint do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar deich bpúint.
(4) Gach duine dhéanfaidh no thrialfaidh aon phacáiste d'uibhe do chonsighniú no d'iompar go dtí aon áit, in Éirinn no lasmuich dhi, agus cigire tar éis ordú do thabhairt fén alt so á thoirmeasc é iompar níos sia, beidh sé ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche punt do chur air.
(5) Má bheireann cigire ordú fén alt so do chairréaraí á thoirmeasc aon phacáiste áirithe d'uibhe d'iompar níos sia, beidh sé de dhualgas ar an gcigire sin, marab é an cairréaraí únaer an phacáiste, a chur in úil do chonsighneoir an phacáiste, chó luath agus is féidir é tar éis an orduithe do thabhairt, gur tugadh an t-ordú amhlaidh.
(6) Má thógann cigire aon tsompla no pacáiste fén alt so beidh sé de dhualgas ar an gcigire sin an tógaint sin do chur in úil don únaer no don chonsighneoir agus don chonsighní (más rud é agus sa mhéid gurb eol dó a n-ainmneacha agus a seolta no gur féidir dó, do réir réasúin, iad d'fháil amach) agus fós, más in áitreabh cairréaraí no stórasóra do rinneadh an tógaint sin, don chairréaraí no don stórasóir sin.
(7) Má chítear don Aire, ar aon phacáiste tógfar fén alt so do scrúdú, go ndearnadh sárú no gur trialadh sárú do dhéanamh ar an Acht so no ar rialachán ar n-a dhéanamh fé, maidir leis an bpacáiste sin, geallbhruidfear an pacáiste sin don Aire, agus in aon chás eile cuirfear an pacáiste de láimh do réir mar ordóidh an consighneoir no, cheal orduithe uaidh, díolfar é agus íocfar sochar glan an díola san leis an gconsighneoir.
(8) Ní bheidh an tAire ná cigire ar bith freagarthach in aon chailliúint no damáiste no moill réasúnta thiocfaidh as cigire d'fheidhmiú aon chomhachta dá dtugtar dó leis an alt so, agus ní luighfidh aon aicsean i gcoinnibh an chonsighneora ná éinne eile i dtaobh ná alos aon chailliúna no damáiste no moille réasúnta den tsórt san.
(9) Le linn do chigire bheith ag feidhmiú na gcomhacht a bheirtear dó leis an alt so in áitreabh aon chuideachtan bóthair iarainn no loingis, déanfa sé do réir na n-éilithe réasúnta san ón gcuideachtain is gá chun ná déanfaí cosc ná cur isteach ar oibriú an tráchta san áitreabh san.
(10) Uibhe geallbhruidfear don Aire fén alt so, déanfar, i gcás iad do bheith neamh-oiriúnach mar bhia do dhaoine, iad do dhíthiú no déanfaidh an tAire, in aon chás eile, iad do dhíol agus, d'ainneoin éinní atá san Acht so, féadfar iad do dhíol amhlaidh le miondíoltóirí no le mórdhíoltóirí cláruithe agus féadfaid san iad do cheannach.
(11) An sochar glan a gheobhfar as na huibhe uile díolfar fén bhfo-alt deiridh sin roimhe seo den alt so déanfar é d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste sa tslí sin ordóidh an tAire Airgeadais.
(12) Chun críche an ailt seo, pé uair do bhéarfar ordú do chairréaraí fén alt so á thoirmeasc pacáiste d'uibhe d'iompar níos sia agus go mbeidh an pacáiste, an tráth do bhéarfar an t-ordú, ládálta i luing no i bhaigín traenach, ní tuigfear gur hiompruíodh an pacáiste sin níos sia contrárdha don ordú san i gcás an phacáiste sin d'iompar ar an luing sin no sa bhaigín sin má chruthuíonn an cairréaraí sin—
(a) go ndearna sé, chó luath agus a bhí caoi aige air, an pacáiste sin do chur thar n-ais go dtí an port no an stáisiún ag ar cuireadh é sa luing sin no sa bhaigín sin (do réir mar a bheidh) agus é chur i dtír no é sheachadadh ag an bport san no ag an stáisiún san, agus
(b) go raibh an pacáiste sin, ón tráth do tugadh an t-ordú san go dtí go ndearnadh an pacáiste sin do chur thar n-ais agus do chur i dtír no do sheachadadh amhlaidh, i gcúram an chairréaraí sin amháin agus nár hoscladh é agus nár baineadh leis in aon tslí.
(13) San alt so—

Ceadúnaisí chun uibhe d'easportáil.
33.—(1) Féadfaidh an tAire, ar iarratas o dhuine ar bith sa bhfuirm agus sa tslí orduithe, ceadúnas do dheonadh don duine sin chun na consighneachta d'uibhe luadhfar sa cheadúnas d'easportáil chun an chonsighní sin agus den bhealach san agus fé réir na gcoinníollacha san a luadhfar sa cheadúnas.
(2) Oibreoidh ceadúnas a deonfar fén alt so chun a údarú don duine dá ndeonfar é an chonsighneacht d'uibhe luadhfar ann d'easportáil do réir téarmaí an cheadúnais.
(3) Féadfaidh an tAire, tráth ar bith sara n-easportálfar consighneacht d'uibhe bheidh luaidhte i gceadúnas, an ceadúnas a bhaineann leis an gconsighneacht san do cheiliúradh.
(4) Má dheineann duine ar bith dá ndeonfar ceadúnas fén alt so aon cheann de théarmaí no de choinníollacha an cheadúnais sin do shárú beidh sé ciontach i gcionta fén bhfo-alt so.
(5) Gach duine do bhéarfaidh le tuisgint go bréagach, trí mharc ar an gconsighneacht no ar shlí eile, aon chonsighneacht áirithe d'uibhe do bheith á heasportáil fé cheadúnas ar n-a dheonadh fén alt so beidh sé ciontach i gcionta fén bhfo-alt so.
(6) Gach duine bheidh ciontach i gcionta fé aon fho-alt den alt so dlighfear, ar a chiontú ann ar an slí achmair, fíneáil ná raghaidh thar deich bpúint do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar fiche punt.
(7) Íocfar leis an Aire ar gach iarratas ag lorg ceadúnais fén alt so táille den mhéid orduithe agus beidh íoc cuibhe na táille sin ina choinníoll nach foláir a chólíonadh sara mbreithneoidh an tAire an t-iarratas.
Comhachta oifigeach custum agus máil.
34.—Féadfaidh aon oifigeach custum agus máil uibhe ar bith, a bheidh á n-easportáil no go mbeifear ag triail iad d'easportáil contrárdha don Acht so, do choinneáil agus do ghabháil agus chuige sin féadfaidh pacáiste ar bith d'oscailt ina mbeidh uibhe no 'na mbeidh amhrus aige uibhe do bheith ann, agus na forálacha den Customs Consolidation Act, 1876, i dtaobh earraí gheobhfar fén Acht san d'ordú do bheith geallbhruidthe agus do chur de láimh beidh feidhm agus éifeacht acu maidir leis na hearraí uile gheobhfar fén Acht so fé is dá mba fén Customs Consolidation Act, 1876, adubhradh, do gheobhfaí na hearraí sin.
Rialacháin chun uibhe do thástáil, do ghrádáil agus do phacáil in áitreabhacha mórdhíoltóirí.
35.—(1) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh maidir le háitreabhacha mórdhíoltóirí cláruithe, i dtaobh gach ní no aon ní no nithe acu so leanas, sé sin le rá:—
(a) gach ní no aon ní no nithe bhaineann leis an modh agus leis an slí ina dtástálfar uibhe agus an aimsear tar éis iad d'fháil gur laistigh di a tástálfar amhlaidh iad;
(b) gach ní no aon ní no nithe bhaineann leis an modh agus leis an slí ina ngrádálfar uibhe;
(c) gach ní no aon ní no nithe bhaineann leis an modh agus leis an slí ina bpacálfar uibhe agus na habhair agus na pacáistí a húsáidfear chun iad do phacáil;
(d) na grádanna agus na saghsanna ubh a féadfar no ná féadfar a phacáil san aon phacáiste amháin;
(e) toirmeasc do chur le haon ghrádanna no saghsanna áirithe ubh do phacáil;

(2) Féadfar rialacháin deifriúla do dhéanamh fén alt so i dtaobh ubh a consighneofar chun iad d'easportáil agus i dtaobh ubh ná consighneofar amhlaidh.
(3) Na huibhe uile tástálfar, a grádálfar agus a pacálfar in aon áitreabh mhórdhíoltóra chláruithe tástálfar, grádálfar agus pacálfar iad i ngach slí do réir na rialachán a bheidh déanta fén alt so agus a bheidh i bhfeidhm de thurus na huaire.
(4) Gach duine dhéanfaidh éinní, tré ghníomh no tré fhaillí, contrárdha d'aon rialachán a bheidh déanta fén alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighhear fíneáil ná raghaidh thar deich bpúint do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneaíl ná raghaidh thar fiche punt.

36.—(1) Pé uair is deimhin leis an Aire é bheith riachtanach san do dhéanamh chun iniúchadh ubh no pacáistí ubh fén Acht so do chur in usacht, féadfaidh, tré fhógra i scríbhinn ar n-a sheirbheáil ar mhórdhíoltóir chláruithe, a cheangal ar an mórdhíoltóir cláruithe sin an dá ní no ceachtar ní acu so leanas do dhéanamh, sé sin le rá:—
(a) gan uibhe d'easportáil ach den bhealach no de cheann de sna bealaigh a luadhfar chuige sin sa bhfógra san;
(b) na huibhe uile bheidh sé ar intinn d'easportáil do thaisbeáint chun a scrúduithe san áit agus an tráth a luadhfar sa tslí chéanna.
(2) Gach mórdhíoltóir cláruithe ar a seirbheálfar fógra fén alt so déanfa sé do réir an fhógra san agus mara ndeinidh dá réir beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar cúig púint fhichead do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar caoga punt.

37.—(1) Ní dleathach do mhórdhíoltóir chláruithe aon oibriúchán tástála, grádála ná pacála ubh do bheith ar siúl aige ná a leigint é bheith ar siúl in aon áitreabh ar ar dílseánach cláruithe é mara mbeidh an t-oibriúchán san i gcomhnaí fé mhaoirseacht agus fé stiúradh dhuine oilte.
(2) Beidh sé de dhualgas ar gach mórdhíoltóir cláruithe—
(a) duine oilte amháin ar a laighead do bheith ar fostú aige i ngach áitreabh cláruithe ar ar dílseánach cláruithe é, agus
(b) ráiteas do thabhairt do Aire no do chigire, ar san d'iarraidh, i dtaobh an méid daoine oilte bheidh ar fostú ag an mórdhíoltóir cláruithe sin maraon leis an eolas san, i dtaobh gach duine oilte bheidh ar fostú amhlaidh, a bheidh ag teastáil ón Aire no ón gcigire sin.
(3) Más duine oilte an mórdhíoltóir cláruithe féin agus go maoirsíonn agus go stiúrann sé na hoibriúcháin tástála, grádála agus pacála ubh in áitreabh chláruithe ar ar dílseánach cláruithe é, féadfa sé é féin d'áireamh mar dhuine oilte ar fostú aige chun crícheanna na bhfo-alt san roimhe seo den alt so agus leis sin beidh feidhm agus éifeacht ag an alt so fé is dá mba dhuine oilte den tsórt san ar fostú amhlaidh é.
(4) Gach mórdhíoltóir cláruithe dhéanfaidh éinní (tré ghníomh no tré fhaillí) is sárú ar an alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar fiche punt, agus ina theanta san, i gcás ar bith, fíneáil bhreise ná raghaidh thar deich bpúint in aghaidh gach seachtaine no coda de sheachtain a leanfar den chionta.
(5) San alt so cialluíonn an abairt “duine oilte” duine atá oilte do réir bhrí an Achta so ar ghnó tástála, grádála agus pacála ubh.
Rialacháin i dtaobh uibhe do mharcáil.
38.—(1) Féadfaidh an tAire le hordú rialacháin do dhéanamh á ordú cadiad na marcanna cuirfear ar gach pacáiste d'uibhe consighneofar o áitreabh mhórdhíoltóra cláruithe ar bith chun áite ar bith, in Éirinn no lasmuich dhi, chun gach ní no aon ní no nithe acu so leanas do thaisbeáint, sé sin le rá:—
(a) grád na n-ubh a bheidh sa phacáiste sin;
(b) an t-áitreabh inar pacáladh na huibhe sin;
(c) i gcás ubh leasuithe, gur uibhe leasuithe iad;
(d) gur in Éirinn do rugadh na huibhe;
(e) éinní eile is dóich leis an Aire ba cheart a thaisbeáint ar an bpacáiste sin.
(2) Féadfaidh an tAire le hordú rialacháin do dhéanamh á ordú cadiad na marcanna cuirfear ar gach ubh a consighneofar o áitreabh mhórdhíoltóra cláruithe ar bith chun áite ar bith, in Éirinn no lasmuich dhi, chun gach ní no aon ní no nithe acu so leanas do thaisbeáint, sé sin le rá:—
(a) grád an uibh;
(b) an t-áitreabh inar pacáladh é;
(c) an tréimhse inar tástáladh an t-ubh no an tréimhse inar pacáladh an t-ubh san áitreabh san;
(d) i gcás uibh leasuithe, gur ubh leasuithe é;
(e) gur in Éirinn do rugadh an t-ubh;
(f) éinní eile is dóich leis an Aire ba cheart a thaisbeáint ar an ubh.
(3) Féadfar le rialacháin ar n-a ndéanamh fén alt so a ordú conus agus cad leis a déanfar na marcanna a hordófar fén alt so do chur ar na huibhe le n-a mbainfid.
(4) Féadfar rialacháin deifriúla do dhéanamh fén alt so i dtaobh ubh a consighneofar chun iad d'easportáil agus i dtaobh ubh ná consighneofar amhlaidh.
(5) Chun críche an oirid sin den alt so agus a bhaineann le n-a thaisbeáint tré mharcanna cadé an t-áitreabh inar pacáladh uibhe, féadfaidh an tAire marc fé leith do cheapadh do gach áitreabh mhórdhíoltóra chláruithe fé leith, agus féadfaidh, leis na rialacháin a déanfar fén alt so, a chur mar cheangal na marcanna ceapfar amhlaidh d'úsáid mar mharc chun a thaisbeáint cadé an t-áitreabh inar pacáladh pacáistí no uibhe.
(6) Chun críche an oirid sin den alt so agus a bhaineann le n-a thaisbeáint tré mharcanna cadé an tréimhse inar tástáladh uibhe no cadé an tréimhse inar pacáladh uibhe, féadfaidh an tAire o am go ham, tré fhógra ar n-a fhoillsiú san Iris Oifigiúil agus sna páipéirí nuachta agus sna tréimhseacháin sin is dóich leis is ceart, marcanna fé leith do cheapadh chun tréimhsí áirithe do thaisbeáint, agus féadfaidh, leis na rialacháin a déanfar fén alt so, a chur mar cheangal na marcanna ceapfar amhlaidh d'úsáid mar mharcanna chun a thaisbeáint, maidir le huibhe do thástáil no do phacáil, cadiad na tréimhsí gur ina dtaobh a bheidh na marcanna san fé seach ceaptha amhlaidh.
(7) Déanfar na huibhe uile glacfar in aon áitreabh mhórdhíoltóra cláruithe agus na pacáistí ina bpacálfar san áitreabh san iad do mharcáil i ngach slí do réir forálacha an ailt seo agus do réir na rialachán a bheidh déanta fé agus a bheidh i bhfeidhm de thurus na huaire.
(8) Má cuirtear marc a bheidh orduithe fén alt so ar aon uibhe no ar aon phacáistí d'uibhe i gcás ar bith ná beidh a chur amhlaidh údaruithe leis an alt so no leis na rialacháin a bheidh déantá fé no ná beidh a chur amhlaidh do réir an ailt seo no na rialachán san tuigfear a chur amhlaidh do bheith ina thuairisc thrádála bhréagaigh do réir bhrí na nAchtanna Marcanna Earraí Ceannaíochta, 1887 go 1931, agus beidh feidhm dá réir sin ag na hAchtanna san, le n-a n-áirmhítear forálacha peannaideacha an chéanna.
(9) Chun críche an ailt seo tuigfear marc do chur ar ubh no ar phacáiste d'uibhe má deintear amhlaidh do réir bhrí na nAchtanna Marcanna Earraí Ceannaíochta, 1887 go 1931.

39.—(1) Féadfaidh an tAire le hordú rialacháin do dhéanamh á cheangal ar gach mórdhíoltóir cláruithe scríbhinn sa bhfuirm a hordófar leis na rialacháin sin do chur, sara gconsighnítear é, i ngach pacáiste d'uibhe bheidh sé ar intinn a chonsighniú chun áite ar bith in Éirinn no lasmuich dhi, scríbhinn á iarraidh ar chonsighní an phacáiste sin aon éislinní gheobha sé sa phacáiste sin no sna huibhe bheidh ann no i bpacáil na n-ubh san ann do chur in úil don Aire.
(2) Gach mórdhíoltóir cláruithe ná déanfaidh do réir aon rialacháin áirithe bheidh déanta fén alt so beidh sé ciontach i gcionta fén alt so, agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar cúig púint do chur air.

40.—(1) Gach marc a ceangailtear no a húdaruítear leis an Acht so no fé do chur ar aon uibhe no ar aon phacáiste d'uibhe isé chuirfidh ar an gcéanna é ná dílseánach an áitreibh ina ndéanfar, no inar gá, an marc san do chur amhlaidh no duine ar fostú ag an dílseánach san agus údarás aige uaidh chuige sin.
(2) Ní dleathach do dhuine ar bith, seachas na daoine luaidh tear sa bhfo-alt san roimhe seo den alt so, na marcanna luaidhtear sa bhfo-alt san do chur ar aon ubh ná ar aon phacáiste d'uibhe.
(3) Gach duine chuirfidh aon mharc ar aon ubh no ar aon phacáiste d'uibhe contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar fiche punt no, más rogha leis an gCúirt é, príosúntacht ar feadh téarma ar bith nach sia ná trí mhí no an fhíneáil sin agus an phríosúntacht san le chéile.

(a) le marc (dá ngairmtear grád-mharc san alt so) a bheidh orduithe fén Acht so mar mharc d'uibhe de ghrád áirithe, agus
(b) le marc (dá ngairmtear marc meáchana san alt so) chun a thaisbeáint nach lugha meáchaint gach uibh fé leith sa phacáiste ná an mheácaint a bheidh orduithe mar mheáchaint mhinimum d'uibhe den ghrád a cuirfear in úil leis an ngrád-mharc,
ní dleathach do mhórdhíoltóir chláruithe an pacáiste do chonsighniú chun áite ar bith, in Éirinn no lasmuich dhi, maran rud é nach lugha meáchaint gach uibh fé leith sa phacáiste ná an mheáchaint a cuirfear in úil leis an marc meáchana.
(2) Má dheineann no má thrialann duine ar bith uibhe do chonsighniú contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air másé an chéad chionta den tsórt san aige é, agus másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar fiche punt no, más rogha leis an gCúirt é, príosúntacht ar feadh téarma ar bith nach sia ná trí mhí no an fhíneáil sin agus an phríosúntacht san le chéile.

42.—(1) Féadfaidh an tAire le hordú rialacháin do dhéanamh chun gach críche no aon chríche no crícheanna acu so leanas, sé sin le rá:—
(a) chun caighdeán d'ordú le haghaidh ubh úr;
(b) chun caighdeán d'ordú le haghaidh ubh den dara cáilíocht;
(c) chun na marcanna d'ordú cuirfear ar uibhe chun a thaisbeáint gur uibhe den dara cáilíocht iad;
(d) chun na slí d'ordú ina gcuirfear na marcanna san ar uibhe.
(2) San Acht so cialluíonn an abairt “uibhe úra” uibhe den chaighdeán a bheidh orduithe fén bhfo-alt san roimhe seo den alt so le haghaidh ubh úr, agus cialluíonn an abairt “uibhe den dara cáilíocht” uibhe den chaighdeán a bheidh orduithe fén bhfo-alt san roimhe seo den alt so le haghaidh ubh den dara cáilíocht.
(3) Ní dleathach d'aon mhórdhíoltóir chláruithe ná d'aon mhiondíoltóir uibhe ar bith den dara cáilíocht do dhíol ná do thairisgint ná do thaisbeáint chun a ndíolta ná iad do chonsighniú chun áite ar bith (in Éirinn no lasmuich dhi) mara mbeidh na huibhe sin marcálta leis na marcanna agus sa tslí bheidh orduithe fén alt so chun a thaisbeáint gur uibhe den dara cáilíocht iad.
(4) Ní dleathach d'aon mhórdhíoltóir chláruithe uibhe ar bith is uibhe den dara cáilíocht do choinneáil ina sheilbh tar éis deireadh an ama orduithe chun uibhe do thástáil mara mbeidh na huibhe sin marcálta leis na marcanna agus sa tslí bheidh orduithe fén alt so chun a thaisbeáint gur uibhe den dara cáilíocht iad.
(5) Ní dleathach d'aon mhiondíoltóir uibhe ar bith den dara cáilíocht do bheith ar seilbh aige tar éis deireadh na tréimhse bheidh orduithe fén Acht so chun é do scrúdú ubh mara mbeidh na huibhe sin marcálta leis na marcanna agus sa tslí bheidh orduithe fén alt so chun a thaisbeáint gur uibhe den dara cáilíocht iad.

(a) gur mórdhíoltóir cláruithe no deighleálaí cláruithe é, no
(b) gur táirgtheoir é, no
(c) gur fé réim agus do réir cheadúnais chuige sin ar n-a dheonadh dhó fén alt so bheidh na huibhe á ndíol amhlaidh no á gconsighniú no á dtairisgint no á dtaisbeáint amhlaidh aige.
(3) Ní dleathach do mhórdhíoltóir chláruithe uibhe do dhíol le mórdhíoltóir cláruithe eile ach amháin fé réim agus do réir cheadúnais chuige sin ar n-a dheonadh fén Acht so.
(4) Ní dleathach do mhórdhíoltóir chláruithe uibhe d'fháil maran rud é—
(a) gur o dheighleálaí chláruithe do gheobha sé na huibhe, no
(b) gur o tháirgtheoir do gheobha sé na huibhe, no
(c) gur o mhórdhíoltóir chláruithe eile agus fé réim agus do réir cheadúnais chuige sin ar n-a dheonadh fén Acht so gheobha sé na huibhe.

(6) Féadfaidh an tAire aon cheadúnas no ceadúnaisí acu so leanas do dheonadh do dhuine ar bith, sé sin le rá:—
(a) ceadúnas chun uibhe d'fháil chun iad do dhíol ina mórchoda, no
(b) ceadúnas chun uibhe do dhíol ina mórchoda agus chun uibhe do chonsighniú, do thairisgint agus do thaisbeáint chun a ndíolta ina mórchoda, no
(c) más mórdhíoltóir cláruithe an té dá ndeonfar an ceadúnas, ceadúnas chun uibhe do dhíol le mórdhíoltóir eile,
agus féadfaidh an tAire pé coinníollacha do chur ag gabháil le haon cheadúnas den tsórt san is dóich leis is ceart agus a luadhfaidh sa cheadúnas san, agus féadfaidh an tAire tráth ar bith aon cheadúnas den tsórt san do cheiliúradh.

(3) Féadfaidh an tAire ceadúnas do dheonadh d'aon deighleálaí chláruithe, chun uibhe d'fháil chun a n-athdhíolta, fé réir na gcoinníollacha san is oiriúnach leis an Aire, agus féadfaidh tráth ar bith an ceadúnas san do cheiliúradh.

46.—(1) Ní dleathach do dheighleálaí chláruithe uibhe do chur de láimh ar shlí seachas—
(a) tré n-a ndíol le mórdhíoltóir cláruithe fé cheann na haimsire orduithe ón dáta ar a bhfuair an deighleálaí cláruithe sin na huibhe, no
(b) tré n-a ndíol, ina mórchoda no ina mionchoda, fé réim agus do réir cheadúnais ar n-a dheonadh ag an Aire fén alt so.
(2) Gach duine dhéanfaidh no thrialfaidh uibhe do chur de láimh contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar fiche punt no, más rogha leis an gCúirt é, príosúntacht ar feadh téarma ar bith nach sia ná trí mhí no an fhíneáil sin agus an phríosúntacht san le chéile.
(3) Féadfaidh an tAire ceadúnas do dheonadh do dheighleálaí chláruithe, chun uibhe do chur de láimh tré n-a ndíol ina mórchoda no ina mionchoda, fé réir na gcoinníollacha san is oiriúnach leis an Aire, agus féadfaidh tráth ar bith an ceadúnas san do cheiliúradh.
Fógra miondíoltóra.
47.—(1) Is dleathach don Aire fógra (dá ngairmtear fógra miondíoltóra san Acht so) sa bhfuirm orduithe do sheirbheáil no a chur fé ndeár é sheirbheáil ar dhuine ar bith ag á mbíonn gnó ar siúl no bheidh chun gnó do bheith ar siúl aige (dá ngairmtear san alt so an gnó le n-a mbaineann an t-alt so) ag miondíol ubh ar n-a gceannach o mhórdhíoltóirí cláruithe no o tháirgtheoirí no o mhórdhíoltóirí cláruithe amháin no o tháirgtheoirí amháin fógra á cheangal ar an duine sin a iarraidh ar an Aire, do réir an Achta so agus na rialachán a bheidh déanta fé, laistigh den am (nach giorra ná lá is fiche tar éis an fhógra san do sheirbheáil) a luadhfar chuige sin sa bhfógra san an duine sin agus an t-áitreabh ina mbíonn an gnó san ar siúl aige no ina mbeidh sé chun é bheith ar siúl aige do chlárú sa chlár de mhiondíoltóirí.
(2) Pé uair a seirbheálfar fógra miondíoltóra fén alt so, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) déanfaidh an duine ar ar seirbheáladh an fógra san, laistigh den am a luadhfar chuige sin sa bhfógra san, a iarraidh ar an Aire do réir an Achta so an clárú san a luadhfar sa bhfógra san do dhéanamh sa chlár de mhiondíoltóirí;

(3) Má bhíonn an gnó le n-a mbaineann an t-alt so ar siúl ag duine ar bith contrárdha don alt so beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga punt do chur air maraon le fíneáil bhreise ná raghaidh thar cúig púint in aghaidh gach lae bheidh an gnó san ar siúl amhlaidh.

48.—(1) Ní dleathach do dhuine ar bith aon uibhe atá neamhoiriúnach mar bhia do dhaoine do dhíol ná do thairisgint ná do thaisbeáint chun a ndíolta ná iad do chonsighniú chun áite ar bith in Éirinn no lasmuich dhi.

(3) Ní dleathach do dheighleálaí chláruithe ar bith aon uibhe atá neamh-oiriúnach mar bhia do dhaoine do bheith ar seilbh aige tar éis deireadh an ama orduithe chun deighleálaithe cláruithe do chur ubh de láimh tar éis iad d'fháil.
(4) Ní dleathach do mhiondíoltóir ar bith aon uibhe atá neamhoiriúnach mar bhia do dhaoine do bheith ar seilbh aige tar éis deireadh an ama orduithe chun miondíoltóirí do scrúdú ubh tar éis iad d'fháil.

49.—(1) Ní dleathach do dhuine ar bith aon uibhe bheidh salach ar an taobh amuich do dhíol ná do thairisgint ná do thaisbeáint chun a ndíolta ná iad do chonsighniú chun áite ar bith in Éirinn no lasmuich dhi.
(2) Ní dleathach do dhuine ar bith aon uibhe bheidh salach ar an taobh amuich do cheannach chun a n-athdhíolta marar ceannuíodh na huibhe amhlaidh ina leithéid sin de chás ná féadfadh an duine sin do réir réasúin a fhios a bheith aige go raibh na huibhe salach ar an taobh amuich.
(3) Ní dleathach do mhórdhíoltóir chláruithe ar bith aon uibhe bheidh salach ar an taobh amuich do bheith ar seilbh aige tar éis deireadh an ama orduithe chun mórdhíoltóirí cláruithe do thástáil ubh mara mbeidh na huibhe marcálta agus curtha i leataoibh chun iad do chur de láimh sa tslí orduithe.
(4) Ní dleathach do dheighleálaí chláruithe ar bith aon uibhe bheidh salach ar an taobh amuich agus do fuair sé o tháirgtheoir do bheith ar seilbh aige.
(5) Ní dleathach do mhiondíoltóir ar bith aon uibhe bheidh salach ar an taobh amuich do bheith ar seilbh aige tar éis deireadh an ama orduithe chun miondíoltóirí do scrúdú ubh tar éis iad d'fháil.

50.—(1) Féadfaidh an tAire le hordú rialacháin do dhéanamh chun ceachtar críche no chun an dá chrích acu so leanas, sé sin le rá:—
(a) chun a thoirmeasc uibhe do dhíol no do thairisgint no do thaisbeáint chun a ndíolta no iad do choimeád no do stóráil go dtí go ndíolfar iad in aon fhoirgint, feithicil, no áit eile no fé choinníollacha ná tugann cosaint dóthanach do sna huibhe ar fhliuchra, ar thaise, ar shalachar agus ar theas agus ar aimsir mhí-oiriúnach agus ar thruailliú d'aon tsaghas;
(b) chun a chur in áirithe go mbeidh ag uibhe bheidh le díol cosaint dóthanach ar fhliuchra, ar thaise, ar shalachar agus ar theas agus ar thruailliú de gach saghas faid a bheid stórálta no á gcoimeád agus faid a bheid á dtairisgint no á dtaisbeáint chun a ndíolta agus faid a beifear á bpacáil no á n-iompar.

52.—(1) Féadfaidh an tAire le hordú rialacháin do dhéanamh chun gach críche no aon chríche no crícheanna acu so leanas, sé sin le rá:—
(a) chun a chur mar cheangal, maidir le huibhe éanlaithe tighis ina bplaosca a cheannóidh dílseánach cláruithe no ceannófar thar a cheann, gur do réir mheáchainte a ceannófar iad amhlaidh;
(b) chun a cheangal ar dhílseánaigh chláruithe (i gcoitinne no d'aon aicme no aicmí áirithe) do gheobhaidh, pe'ca ina n-áitreabhacha cláruithe no in áit eile é, uibhe o tháirgtheoirí na nithe seo leanas do dhéanamh i dtaobh na n-ubh go léir do gheobhaid amhlaidh, sé sin le rá:—
(i) na huibhe sin do chur, díreach ar iad d'fháil, i gcoimeádán, den dearadh agus de sna tuisí agus de sna habhair a luadhfar chuige sin sna rialacháin a déanfar fén alt so, do gheobhfar o dhéantóir a luadhfar amhlaidh agus é marcálta leis an marc a luadhfar amhlaidh, agus

(c) chun a chur mar cheangal go ndéanfar uibhe (seachas uibhe pacálfar in áitreabh chláruithe mórdhíoltóra chláruithe) a consighneofar, a tairgfear no taisbeánfar chun a ndíolta do phacáil sa tslí sin agus leis na habhair phacála san a luadhfar chuige sin sna rialacháin a déanfar fén alt so;
(d) chun a chur mar cheangal go ndéanfar uibhe (seachas uibhe pacálfar in áitreabh chláruithe mórdhíoltóra chláruithe no deighleálaí chláruithe) a consighneofar, a tairgfear no taisbeánfar chun a ndíolta do mharcáil sa tslí sin agus leis an marc san a luadhfar chuige sin sna rialacháin a déanfar fén alt so;
(e) chun a chur mar cheangal go ndéanfar na pacáistí ina bpacálfar uibhe (seachas uibhe pacálfar in áitreabh chláruithe mórdhíoltóra chláruithe) a consighneofar, a tairgfear no taisbeánfar chun a ndíolta do mharcáil sa tslí sin agus leis an marc san a luadhfar chuige sin sna rialacháin a déanfar fén alt so;
(f) chun a chur mar cheangal, maidir leis na huibhe go léir a díolfar no consighneofar, a tairgfear, a taisbeánfar, no fógrófar chun a ndíolta no forchuntasófar roimh a seachadadh no tar éis a seachadadh ar díol, gur fé thuairisc a luadhfar chuige sin sna rialacháin a déanfar fén alt so a déanfar iad do dhíol, no iad do chonsighniú, do thairisgint, do thaisbeáint, d'fhógairt no d'fhorchuntasú amhlaidh (do réir mar a bheidh);
(g) chun a thoirmeasc uibhe do choimeád in áitreabh chláruithe ar feadh tréimhse is sia ná an tréimhse mhaximum a luadhfar sna rialacháin a déanfar fén alt so agus a bhainfidh leis na huibhe sin;
(h) chun a cheangal ar gach dílseánach cláruithe, no ar gach dílseánach cláruthe ar áitreabh a bheidh cláruithe i gclár áirithe, go mbeidh aon uibhe ina sheilbh go dtoirmeasctar leis an Acht so iad do dhíol gan na huibhe sin do chur de láimh ach i slí luadhfar chuige sin sna rialacháin a déanfar fén alt so.
(2) Chun críche an mhéide sin den alt so bhaineann le huibhe do mharcáil, féadfaidh an tAire (in ionad marcanna, á chur in úil cadé an tréimhse inar tástáladh no inar scrúduíodh uithe no cadé an tréimhse inar pacáladh uibhe, d'ordú le rialacháin ar n-a ndéanamh fén alt so) féadfaidh o am go ham, tré fhógra ar n-a fhoillsiú san Iris Oifigiúil agus sna páipéirí nuachta agus sna tréimhseacháin sin is dóich leis is ceart, marcanna fé leith do cheapadh chun tréimhsí áirithe do chur in úil agus féadfaidh, leis na rialacháin a déanfar fén alt so, a chur mar cheangal na marcanna ceapfar amhlaidh d'úsáid mar mharcanna chun a chur in úil, maidir le huibhe do thástáil no do scrúdú no do phacáil, cadiad na tréimhsí gur ina dtaobh a bheidh na marcanna san fé seach ceaptha amhlaidh.

53.—(1) Ar thosach feidhme an Achta so agus dá éis sin—
(a) an clár atá á choimeád do bhun na nAchtanna Tora Talmhaíochta (Uibhe), 1924 agus 1930, agus dá ngairmtear sna hAchtanna san clár na leasuitheoirí (dá ngairmtear an seana-chlár san alt so) tiocfa sé chun bheith agus beidh sé ina chlár de leasuitheoirí bheidh le coimeád fén Acht so; agus
(b) gach áitreabh do bhí cláruithe sa tseana-chlár díreach roimh thosach feidhme an Achta so tiocfa sé chun bheith agus beidh sé, amhail ón tosach feidhme sin amach agus gan aon iarratas chuige sin, cláruithe sa chlár de leasuitheoirí bheidh le coimeád do bhun an Achta so agus tuigfear é bheith cláruithe amhlaidh fén Acht so agus beidh feidhm agus éifeacht ag an Acht so maidir leis dá réir sin; agus

55.—(1) Féadfaidh an tAire rialacháin (dá ngairmtear sa Chuid seo den Acht so na rialacháin ghenerálta i dtaobh uibhe leasuithe do mharcáil) do dhéanamh i dtaobh gach ní no aon ní no nithe acu so leanas, sé sin le rá:—
(a) na marcanna bheidh ar uibhe cuirfear no consighneofar go dtí aon áitreabh, no a tógfar as aon áitreabh, a bheidh cláruithe sa chlár de leasuitheoirí;
(b) an modh ina gcuirfear agus na meáin tré n-a gcuirfear na marcanna san ar na huibhe sin.
(2) Féadfar marcanna deifriúla d'ordú fén alt so maidir le saghsanna deifriúla ubh chun a thaisbeáint cadé an chóireáil atá beartuithe do chur no do cuireadh ar na huibhe sin san áitreabh san.
Toirmeasc ar uibhe neamarcálta do chur amach no do ghlacadh.
56.—(1) Fé réir forálacha an ailt seo, ní dleathach do dhuine ar bith aon uibhe do chur ná do chonsighniú go dtí aon áitreabh, ná do sheachadadh in aon áitreabh, a bheidh cláruithe sa chlár de leasuitheoirí agus iad, le linn a gcurtha amach no a gconsighnithe no a seachadtha amhlaidh, gan bheith marcálta do réir na rialachán generálta i dtaobh uibhe leasuithe do mharcáil.
(2) Fé réir forálacha an ailt seo, ní dleathach do leasuitheoir chláruithe glacadh ina áitreabh chláruithe le seachadadh aon ubh ná beidh marcálta do réir na rialachán generálta i dtaobh uibhe leasuithe do mharcáil ná aon uibhe ná beidh marcálta amhlaidh do ghlacadh isteach san áitreabh san.
(3) Gach duine dhéanfaidh éinní (tré ghníomh no tré fhaillí) is sárú ar an alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar fiche punt no, más rogha leis an gCúirt é, príosúntacht ar feadh téarma nach sia ná trí mhí no an fhíneáil sin agus an phríosúntacht san le chéile.
(4) Féadfaidh an tAire le hordú a dhearbhú ná beidh feidhm ná éifeacht ag na forálacha san roimhe seo den alt so maidir le huibhe do leasuíodh no bheidh le leasú ar shlí áirithe luadhfar san ordú san, agus pé uair a déanfar aon ordú den tsórt san agus a bheidh sé i bhfeidhm ní bheidh feidhm ná éifeacht ag na forálacha san maidir le huibhe do leasuíodh no bheidh le leasú ar an slí áirithe luadhfar san ordú san.
(5) Féadfaidh an tAire tráth ar bith, le hordú, ceiliúradh no leasú no atharú do dhéanamh ar aon ordú bheidh déanta aige roimhe sin fén alt so, le n-a n-áirmhítear ordú bheidh déanta amhlaidh fén bhfo-alt so.

(2) Ní dleathach do dhuine ar bith aon uibhe d'fháil ag aon áitreabh no as aon áitreabh a bheidh cláruithe sa chlár de leasuitheoirí mara mbeidh ar na huibhe sin go soiléir so-léighte na marcanna oiriúnacha bheidh orduithe leis na rialacháin ghenerálta i dtaobh uibhe leasuithe do mharcáil ná glacadh le seachadadh aon ubh as áitreabh ar bith den tsórt san mara mbeidh na marcanna san go soiléir so-léighte ar na huibhe sin.

AGRICULTURAL PRODUCE (EGGS) ACT, 1939.
PART I.
Preliminary and General.
Short title and commencement.
1.—(1) This Act may be cited as the Agricultural Produce (Eggs) Act, 1939.
(2) This Act shall come into operation on such day as the Minister shall by order appoint.
Definitions.
2.—In this Act—
the expression “the Minister” means the Minister for Agriculture;
the word “prescribed” means prescribed by regulations made by the Minister under this Act;
the word “inspector” means a person appointed in writing (either generally or for a particular occasion) by the Minister to be an inspector for the purposes of this Act,
the word “package” includes any box, crate, case, wrapper or other receptacle containing or capable of containing eggs for transport, and, unless the context otherwise requires, includes the contents of such receptacle;
the word “eggs” means eggs in the shell of domestic fowl and ducks;
the word “mark” includes any word, letter, figure or design, or any combination of words, letters, figures, or designs, or any two or more of them;
the expression “registered premises” means premises registered in a register kept by the Minister in pursuance of this Act;
the expression “registered proprietor” means a person who is entered in a register kept by the Minister in pursuance of this Act as the proprietor of premises registered in that register;
the expression “registered wholesaler's premises” means premises registered in the register of wholesalers;
the expression “registered wholesaler” means the registered proprietor of registered wholesaler's premises;
the expression “registered dealer” means the registered proprietor of premises registered in the register of dealers;
the expression “registered retailer” means the registered proprietor of premises registered in the register of retailers;
the expression “registered preserver” means the registered proprietor of premises registered in the register of preservers;
the word “producer” means a person who carries on the business of poultry-farming or who rears or keeps domestic fowl or ducks for the purpose of disposing of their eggs by sale and does not acquire for resale any eggs from any other person;
the expression “chemical storage” means storage for the purpose of preserving eggs by any process which does not alter the composition of the shells, including storage in any gas, vapour or gaseous mixture;
the word “sale” includes exchange and barter, and cognate words shall be construed accordingly;
the expression “sale by wholesale” means sale by way of trade to a person engaged in the business of acquiring eggs for resale, but does not include sale to, or to some person on behalf of, the owner or occupier of a hotel, restaurant, club or other premises where eggs are sold only for consumption thereon, and cognate expressions shall be construed accordingly;
the expression “sale by retail” means sale otherwise than by wholesale, and cognate expressions shall be construed accordingly;
the word “acquire” includes purchase and also includes acquiring or obtaining by barter, exchange or any other means, and cognate words shall be construed accordingly;
the word “retailer”, when used without qualification, means a person engaged in the business of selling eggs by retail, whether he is or is not a registered proprietor;
the expression “eggs intended for sale” includes eggs purchased for resale, eggs kept for sale (whether immediately or at a future time), eggs offered or exposed for sale, eggs sold but not delivered, and eggs being transported for or in the course of sale.
Persons skilled in testing, grading, and packing eggs.
3.—(1) No person shall be deemed for the purposes of this Act to be skilled in the business of testing, grading and packing eggs unless he either—
(a) holds a certificate, issued by the Minister, certifying that he is skilled in the said business, or
(b) has satisfied the Minister that he is skilled in the said business.
(2) Any person may apply to the Minister for such certificate as is mentioned in the foregoing sub-section of this section and the Minister may, if he is satisfied that such person is skilled in the business of testing, grading and packing eggs, issue to such person such certificate as aforesaid.
Regulations.
4.—(1) The Minister may by order make regulations prescribing any matter or thing which is referred to in this Act as prescribed or to be prescribed, but no such regulation shall be made in relation to the amount or collection of any fees without the consent of the Minister for Finance.
(2) Every regulation made by the Minister under this or any other section of this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either such House within the next subsequent twenty-one days on which that House has sat annulling such regulation, such regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Offences.
5.—(1) Every offence under any section of this Act may be prosecuted by or at the suit of the Minister.
(2) Where an offence under any section of this Act is committed by a body corporate and is proved to have been so committed with the consent or approval of, or to have been facilitated by, any neglect on the part of, any director, manager, secretary, or other officer of such body corporate, such director, manager, secretary, or other officer shall be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly.
Expenses.
6.—All expenses incurred by the Minister in carrying this Act into execution shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of monies provided by the Oireachtas.
Collection and disposal of fees.
7.—(1) All fees payable under this Act shall be collected and taken in such manner as the Minister for Finance shall from time to time direct and shall be paid into or disposed of for the benefit of the Exchequer in accordance with the directions of the said Minister.
(2) The Public Offices Fees Act, 1879, shall not apply in respect of any fees payable under this Act.
Saving as to powers of Minister for Local Government and Public Health.
8.—(1) The powers conferred on the Minister by this Act shall be, and shall be exercised, without prejudice to the exercise by the Minister for Local Government and Public Health of the powers conferred on him by the Public Health (Regulations as to Food) Act, 1907.
(2) Nothing in this Act shall prejudice or restrict the powers conferred on sanitary authorities by or under the Public Health Acts, 1878 to 1931.
Service of documents.
9.—(1) Where a document is required or permitted by this Act to be served on any person, the document shall be served in one or other of the following ways, that is to say:—
(a) by delivering the document to the said person; or
(b) by delivering the document to any person, of not less than sixteen years of age, who is in the employment of the said person; or
(c) by sending the document by post in a prepaid letter addressed to the said person, if he is a registered proprietor, at his registered premises or, in any other case, at the address where he carries on business or at his last known place of abode.
(2) For the purpose of this section a body corporate registered in Ireland under the Companies Acts, 1908 to 1924, shall be deemed to carry on business at its registered office, and every other body corporate and every unincorporated body shall be deemed to carry on business at its principal office or place of business in Ireland.
Repeals.
10.—The Agricultural Produce (Eggs) Act, 1924, (No. 35 of 1924) and the Agricultural Produce (Eggs) Act, 1930 (No. 36 of 1930) are hereby repealed.
Saving for fees under a repealed Act.
11.—(1) Notwithstanding the repeal by this Act of the Agricultural Produce (Eggs) Act, 1924 (No. 35 of 1924), an annual fee under section 9 of that Act shall be payable in respect of the period beginning on the 1st day of January next before the commencement of this Act and ending on the day before such commencement by the registered proprietor (within the meaning of the said section 9) of every premises which are registered in the register of exporters under that Act during the whole or any part of the said period.
(2) Every fee payable by virtue of the next preceding sub-section of this section shall—
(a) be payable to the Minister, and
(b) be calculated in accordance with section 9 of the Agricultural Produce (Eggs) Act, 1924, as if the period mentioned in the said next preceding sub-section were a year, and
(c) shall become due immediately upon the commencement of this Act and shall be paid not later than one month after such commencement, and
(d) may be recovered by the Minister from the person by whom it is payable as a simple contract debt in any court of competent jurisdiction.
(3) Every annual fee which became due under section 9 of the Agricultural Produce (Eggs) Act, 1924, on the 31st day of December next preceding the commencement of this Act shall, if not paid before such commencement, be payable in accordance with the said section 9 (notwithstanding the repeal thereof by this Act) and shall be recoverable by the Minister from the person by whom it is payable as a simple contract debt in any court of competent jurisdiction.
(4) Sub-sections (5) and (6) of section 9 of the Agricultural Produce (Eggs) Act, 1924, shall, notwithstanding the repeal of that Act by this Act, continue in force for the purposes of all fees which are, by virtue of this section, payable under the said section 9 after the commencement of this Act.
Continuance of existing orders and regulations.
12.—(1) Every order and every regulation made under the Agricultural Produce (Eggs) Acts, 1924 and 1930, which is in force immediately before the commencement of this Act shall, if and so far as it is not inconsistent with this Act, continue in force notwithstanding the repeal by this Act of the Act under which it was made.
(2) Every order and regulation continued in force by virtue of this section shall be deemed to have been made under this Act and shall be capable of being revoked, amended or varied, in the case of any such order, by any order made by the Minister under this Act and, in the case of any such regulation, by any regulation made by the Minister under this Act.
PART II.
Registration of Premises.
The registers and their contents.
13.—(1) The Minister shall cause to be kept—
(a) a register to be called and known and in this Act referred to as the register of wholesalers, and
(b) a register to be called and known and in this Act referred to as the register of dealers, and
(c) a register to be called and known and in this Act referred to as the register of retailers, and
(d) a register to be called and known and in this Act referred to as the register of preservers.
(2) There shall be entered in the several registers kept in pursuance of this section the following matters in respect of all premises registered in the said registers respectively, that is to say:—
(a) the full name and description of the proprietor of the premises, and
(b) a description of the situation of the premises sufficient to identify the said premises and the limits and extent thereof
(3) Premises registered in any one of the registers kept in pursuance of this section shall not while so registered be capable of being registered in any other of the said registers.
Registration fees.
14.—On every application under this Act for the registration of premises in any register except the register of retailers there shall be paid to the Minister a fee (in this Act referred to as a registration fee) of one pound, and the due payment of that fee shall be a condition precedent to the entertainment of the application by the Minister.
Eggs acquisition fees.
15.—(1) Every registered wholesaler shall pay to the Minister, in respect of every half year ending on the 30th day of June or the 31st day of December during which or during any part of which he is registered in the register of wholesalers, a fee (in this Act referred to as an eggs acquisition fee) calculated at the prescribed rate and in the prescribed manner on the total quantity of eggs acquired by him in such half year, other than eggs which are shown to the satisfaction of the Minister—
(a) to have been acquired by him from another registered wholesaler, or
(b) to have been unfit for human consumption or externally dirty and to have been disposed of in the manner required by this Act in respect of such eggs.
(2) Every registered retailer shall pay to the Minister, in respect of every half year ending on the 30th day of June or the 31st day of December during which or during any part of which he is registered in the register of retailers, a fee (in this Act also referred to as an eggs acquisition fee) calculated at the prescribed rate and in the prescribed manner on the total quantity of eggs acquired by him from producers in such half year, other than eggs which are shown to the satisfaction of the Minister to have been unfit for human consumption or externally dirty and to have been disposed of in the manner required by this Act in respect of such eggs.
(3) Save as is otherwise provided by the next following sub-section of this section, every eggs acquisition fee shall become due on the day after the last day of the half-year in respect of which it is payable, and shall be paid, in the case of every such fee which so becomes due on the 1st day of July in any year before the 1st day of September in that year or, in the case of every such fee which so becomes due on the 1st day of January in any year, before the 1st day of March in that year.
(4) Where a registered wholesaler or a registered retailer ceases, during any half-year ending on the 30th day of June or the 31st day of December, to be registered in the register of wholesalers or the register of retailers (as the case may be), the eggs acquisition fee payable by him in respect of such half-year shall become due on the day after the day on which he ceases to be so registered, and shall be paid before the expiration of two months from the day on which it so becomes due.
Annual fees.
16.—(1) Every registered dealer shall pay to the Minister, in respect of every year during which or during any part of which he is registered in the register of dealers, a fee (in this Act referred to as an annual fee) of the prescribed amount or, until an amount is prescribed for such fee, of the amount of one pound.
(2) Save as is otherwise provided by the next following sub-section of this section, every annual fee shall become due on the 1st day of January in the year in respect of which it is payable and shall be paid before the 1st day of March in that year.
(3) The annual fee payable by a registered dealer in respect of the year in which he becomes registered in the register of dealers shall become due on the day on which he becomes so registered, and shall be paid before the expiration of two months from that day.
Recovery of fees.
17.—(1) Every eggs acquisition fee and every annual fee which is not paid within the time limited by this Act for the payment thereof shall be recoverable by the Minister as a simple contract debt in any court of competent jurisdiction and shall be so recoverable notwithstanding and without prejudice to the exercise by the Minister of the power conferred on him by the next following sub-section of this section.
(2) Where a person liable to pay an eggs acquisition fee or an annual fee fails to pay such fee within the time limited by this Act for the payment thereof, it shall be lawful for the Minister to cancel the registration in the register of wholesalers, the register of retailers, or the register of dealers (as the case may be) of all premises in respect of which such person is registered in such register.
(3) Where the registration of any premises is cancelled by virtue of the next preceding sub-section of this section and the fee, the non-payment of which occasioned such cancellation, is paid within three months after the expiration of the time limited by this Act for the payment thereof, the Minister may, if he so thinks proper, restore the said premises, as on and from the date on which such fee is so paid, to the register in which the registration of such premises was so cancelled.
Applications for registration.
18.—(1) Every application for the registration of premises in a register kept in pursuance of this Act (other than the register of retailers) shall be made by the proprietor of such premises in writing in the prescribed form and manner and shall contain the prescribed particulars.
(2) Whenever an application is made under this section for the registration of any premises, the Minister shall cause such premises to be inspected by an inspector.
(3) Where an application under this section for the registration of any premises is refused by the Minister, the reasons for the refusal shall be stated to the applicant.
(4) The refusal of an application under this section for the registration of premises shall not prevent the making under this section of a fresh application for the registration of the same premises at any subsequent time.
(5) Whenever an application is made under this section for the registration of premises in a register, the Minister may, if he so thinks fit, register such premises in the said register before they have been inspected in pursuance of this section, and wherever the Minister so registers any premises the following provisions shall have effect, that is to say:—
(a) such registration shall be provisional only and is in this Act referred to as provisional registration;
(b) such registration shall not relieve the Minister from the obligation to cause such premises to be inspected by an inspector, save that such inspection may take place after such registration;
(c) such registration shall not prejudice or affect the power of the Minister to grant or to refuse the said application for the registration of the said premises;
(d) if and when the Minister grants the said application, the said provisional registration shall cease to be provisional;
(e) if and when the Minister refuses the said application, the said provisional registration shall be cancelled;
(f) whenever and so long as any premises are provisionally registered in a register, such premises shall, subject to the foregoing paragraphs of this sub-section, be deemed for all the purposes of this Act to be premises registered in such register and the person who is so registered as the proprietor thereof shall, subject as aforesaid, be deemed for the said purposes to be the registered proprietor of the said premises.
Conditions of registration.
19.—(1) The Minister shall not register (otherwise than provisionally) any premises in a register kept in pursuance of this Act (other than the register of retailers) unless or until he is satisfied that the said premises comply with all the following conditions, that is to say:—
(a) the premises are structurally suited for carrying on the business carried on or proposed to be carried on therein, and are sufficiently provided with equipment fittings and appliances suitable for that business; and
(b) the premises, and the equipment, fittings, and appliances thereof are in a state of cleanliness and good repair; and
(c) the premises contain suitable and adequate accommodation for the storage therein of eggs and of packages of eggs in such manner that the eggs and packages so stored are accessible for inspection under this Act.
(2) The Minister shall not register (otherwise than provisionally) any premises in the register of wholesalers unless or until he is satisfied that, in addition to complying with the conditions specified in the foregoing sub-section of this section, the said premises comply with all the following conditions, that is to say:—
(a) the premises contain suitable and adequate accommodation for the proper storage of a quantity of packages and packing materials to supply for such period as may be prescribed the ordinary requirements of the business carried on in the said premises; and
(b) the premises are properly equipped with the prescribed appliances and requisites for testing, grading and packing eggs, and for marking eggs and the packages in which they are packed; and
(c) the quantity of eggs tested, graded and packed on the premises during each week on which any eggs are tested, graded, or packed on the premises is not less than the prescribed minimum quantity; and
(d) either the applicant for registration of the premises or one person at least employed by him on the premises is skilled within the meaning of this Act in the business of testing, grading and packing eggs in accordance with this Act and regulations made thereunder.
(3) Without prejudice to any other reason for refusal which may arise under this Act, each of the following shall be a good reason for the refusal by the Minister of an application for the registration of any premises in a register kept in pursuance of this Act (other than the register of retailers), that is to say:—
(a) that such premises were previously registered under the Agricultural Produce (Eggs) Acts, 1924 and 1930, and the registration thereof was cancelled under the said Acts or either of them, or
(b) that such premises were previously registered under this Act and the registration thereof was cancelled under this Act, or
(c) that the person applying for such registration was previously the registered proprietor of other premises registered under the Agricultural Produce (Eggs) Acts, 1924 and 1930, or this Act and, while he was so registered, the registration of those other premises was cancelled by the Minister under the said Acts or either of them or under this Act.
Transfer from the register of exporters kept under the Agricultural Produce (Eggs) Acts, 1924 and 1930.
20.—(1) Every person who is, immediately before the commencement of this Act, registered in the register of exporters kept in pursuance of the Agricultural Produce (Eggs) Acts, 1924 and 1930, as the proprietor of premises registered in that register shall be deemed to have duly applied under this Act, immediately after the commencement thereof, for the registration of the said premises in the register of wholesalers.
(2) The provisions of this Act in relation to applications for the registration of premises in the register of wholesalers and in relation to the registration of premises in that register shall apply and have effect in relation to every application for the registration of premises in the said register which is deemed by the foregoing sub-section of this section to have been made immediately after the commencement of this Act and in relation to the registration of the said premises in the said register save that the said provisions of this Act shall, in relation to such applications and in relation to such registration, be subject to the following modifications, that is to say:—
(a) the premises which are the subject of any such application shall forthwith be registered provisionally in the said register, and
(b) no registration fee shall be payable in respect of any such application.
Evidence of the contents of registers.
21.—(1) Every register kept in pursuance of this Act shall be—
(a) deemed to be in the proper custody when in the custody of the Minister or of any officer of the Minister authorised in that behalf by the Minister, and
(b) admissible in evidence without further proof on production from the proper custody.
(2) Prima facie evidence of any entry in any register kept in pursuance of this Act may be given in any court or in any legal proceedings by the production of a copy of such entry purporting to be certified to be a true copy by an officer of the Minister authorised in that behalf, and it shall not be necessary to prove the signature of such officer or that he was in fact such officer or was in fact so authorised.
(3) A certificate, purporting to be signed by an officer of the Minister authorised in that behalf by the Minister, that any premises specified in such certificate are not entered in the register specified in such certificate shall be conclusive evidence of the matters so certified, and it shall not be necessary to prove the signature of such officer, or that he was in fact such officer, or was in fact so authorised.
(4) Any person may—
(a) inspect any register kept in pursuance of this Act on payment of such fee, not exceeding one shilling for each inspection, as shall be prescribed;
(b) obtain a copy, certified in manner hereinbefore mentioned to be a true copy, of any entry in any register kept in pursuance of this Act on payment of a fee of sixpence for each folio of seventy-two words of the copy;
(c) obtain such certificate as is hereinbefore mentioned that any specified premises are not registered in a specified register kept in pursuance of this Act on payment of a fee of two shillings and sixpence for each certificate.
Devolution and transfer of registered premises.
22.—(1) Where the registered proprietor of registered premises dies, the following provisions shall have effect, that is to say:—
(a) the death of the said registered proprietor shall not of itself render unlawful by virtue of this Act the carrying on in the said premises during the period of six months from such death of the business theretofore carried on in the said premises;
(b) the personal representative of the said deceased registered proprietor or, with the assent of such personal representative, any other person shall (subject to the provisions of this section) be entitled, on application in the prescribed form and manner to the Minister, to be registered as the registered proprietor of the said premises;
(c) from the death of the said deceased registered proprietor until the registration of another person as registered proprietor of the said premises, the person actually carrying on the said business in the said premises shall be deemed to be the registered proprietor thereof for the purposes of so much of this Act as relates to things to be done on the said premises or in the course of carrying on the said business and for the purpose of notices required by this Act to be given to the registered proprietor and the service of such notices.
(2) Where the registered proprietor (in this section referred to as the transferor) of registered premises transfers, on sale or otherwise, the said premises and the business carried on therein to another person (in this sub-section referred to as the transferee) the following provisions shall have effect, that is to say:—
(a) the transferee shall (subject to the provisions of this section) be entitled, on application in the prescribed form and manner to the Minister and on satisfying the Minister that he has become the proprietor of the said premises, to be registered as the registered proprietor of the said premises;
(b) until the transferee is so registered as the registered proprietor of the said premises, the transferor shall notwithstanding the said transfer, continue to be for all the purposes of this Act the registered proprietor of the said premises.
(3) Where an application is made under this section to the Minister for the registration of a person (in this sub-section referred to as the applicant) as the registered proprietor of registered premises, the following provisions shall apply and have effect, that is to say:—
(a) where the applicant is the personal representative of a deceased registered proprietor, and is applying under the first sub-section of this section for registration solely in his capacity as such personal representative, and the application is duly made in accordance with the said sub-section, the Minister shall not refuse the application;
(b) in every other case it shall be lawful for the Minister, if he so thinks proper, to refuse the application on the ground that the applicant was previously the registered proprietor of other premises registered under the Agricultural Produce (Eggs) Acts, 1924 and 1930, or this Act and, while he was so registered, the registration of those other premises was cancelled by the Minister under the said Acts or either of them or under this Act.
Alteration and cancellation of registration.
23.—(1) The Minister may at any time alter or cancel the registration of any premises under this Act upon the application of the registered proprietor, or in the case of an individual, the personal representative, or, in the case of an incorporated body, the liquidator, of the registered proprietor.
(2) The Minister may, at any time, without any such application as aforesaid, alter the registration of any premises under this Act in any respect in which such registration appears to him to be erroneous or misleading.
(3) The Minister may, at any time, without any such application as aforesaid, cancel the registration of any premises under this Act if he is satisfied—
(a) that the registration of the premises was procured by fraud or by misrepresentation, whether fraudulent or innocent; or
(b) that the premises have ceased to be eligible for registration in the register in which they are registered by reason of the fact that they do not comply with all or any of the conditions of registration applicable there to; or
(c) that the registered proprietor, being an individual, has died and no other person has, within six months after such death, been registered as proprietor in the place of the said deceased registered proprietor; or
(d) that the registered proprietor, being an incorporated body, has been dissolved and no other person has, within one month after such dissolution, been registered as proprietor in the place of the said dissolved registered proprietor;
(e) that the registered proprietor, if an individual, has been adjudicated a bankrupt or, if an incorporated body, has been compulsorily wound up; or
(f) that there has been a contravention (whether by way of commission or of omission) of this Act or a regulation made thereunder on the premises; or
(g) that the registered proprietor having made a contract for the purchase or sale of eggs has, without reasonable cause failed or omitted to carry out such contract; or
(h) that the business in respect of which such premises are registered has ceased to be carried on in such premises; or
(i) in the case of premises registered in the register of wholesalers, that the registered proprietor has caused or knowingly permitted the marks placed in pursuance of this Act on any eggs, or on any package of eggs, exported from the said premises to be altered (whether in or outside Ireland) or has in any other way acted, in relation to eggs or packages of eggs so exported, in a manner which is prejudicial to the reputation of Irish eggs.
(4) The following provisions shall apply and have effect in relation to the alteration or cancellation under this section (otherwise than in accordance with an application in that behalf made under this section) of the registration of any premises under this Act, that is to say:—
(a) the Minister shall not make any such alteration or cancellation unless or until he has given to the registered proprietor of such premises or his personal representative or its liquidator (as the case may be) at least one fortnight's notice in writing stating that the Minister has under his consideration the making of such alteration or cancellation, and stating the grounds on which such alteration or cancellation is so under consideration;
(b) the Minister shall consider any representations in relation to such alteration or cancellation made to him by any person interested before the expiration of the said notice;
(c) the Minister may, if he thinks fit, cause an inquiry to be held in relation to such alteration or cancellation;
(d) such alteration or cancellation, if made at all, shall be made within three months after the expiration of the said notice.
Publication of contents of registers.
24.—(1) The Minister may publish in such manner as he may think fit—
(a) all or any of the matters entered in any register kept under this Act, and
(b) notice of the cancellation or alteration of the registration of any registered premises, and
(c) notice of any conviction for an offence against this Act or any section thereof or any regulation made thereunder.
(2) No individual return or part of a return furnished in pursuance of this Act shall be published or disclosed except for the purposes of a prosecution under this Act.
(3) The Minister may from time to time collect and publish statistical information (including statistics derived from returns made pursuant to this Act) with respect to the extent and condition of the egg-trade and in particular with respect to the extent of the business carried on in premises registered in the several registers kept in pursuance of this Act.
(4) So far as is reasonably practicable, no statistical information published under this section shall contain any particulars which would enable any person to identify such particulars as being particulars relating to any individual person, business, or concern without the consent in writing of that person or of the proprietor of that business or concern.
Returns by registered proprietors of registered premises.
25.—(1) The Minister may by order make regulations requiring the registered proprietors of registered premises to make periodical returns to the Minister, and the Minister may by such regulations prescribe all or any of the following things, that is to say:—
(a) the returns so to be made by registered wholesalers;
(b) the returns so to be made by registered dealers;
(c) the returns so to be made by registered retailers;
(d) the returns so to be made by registered preservers;
(e) the times at which such returns are respectively to be made;
(f) the form and manner in which such returns are respectively to be made.
(2) Every person, required by regulations made under this section to make any return, who fails or refuses to make such return in accordance in all respects with such regulations shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds and, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds.
Registers to be kept on registered premises.
26.—(1) It shall be the duty of every registered wholesaler to keep or cause to be kept, in every registered premises of which he is the registered proprietor, a register in the prescribed form of all eggs acquired by him and brought on to or sold on or dispatched from those premises and, within twelve hours after the acquisition, sale, or dispatch of any such eggs, to enter or cause to be entered in such register the prescribed particulars in relation to those eggs.
(2) It shall be the duty of every registered dealer—
(a) to keep or cause to be kept, in every registered premises of which he is the registered proprietor, a register in the prescribed form of all eggs acquired at or sold on or dispatched from those premises, and within twelve hours after the acquisition, sale or dispatch of any such eggs, to enter or cause to be entered in such register the prescribed particulars in relation to those eggs, and
(b) to keep or cause to be kept in his registered premises or (where he has more than one registered premises) in such one of those premises as shall be selected by him, a register in the prescribed form of all eggs acquired, sold, or dispatched by him elsewhere than on his, or any of his, registered premises, and within thirty-six hours after the acquisition, sale or dispatch of any such eggs to enter or cause to be entered in such register the prescribed particulars in relation to those eggs, and
(c) where he has more than one registered premises, to notify to the Minister the premises selected by him for the purposes of the next preceding paragraph of this sub-section and not to alter such selection without the consent of the Minister.
(3) It shall be the duty of every registered retailer to keep or cause to be kept, in every registered premises of which he is the registered proprietor, a register in the prescribed form of all eggs acquired by him and brought on to the said premises (whether such eggs are or are not acquired at the said registered premises), and, within twelve hours after the acquisition of any such eggs, to enter or cause to be entered in such register the prescribed particulars in relation to those eggs.
(4) It shall be the duty of every registered preserver to keep or cause to be kept, in every registered premises of which he is the registered proprietor, a register in the prescribed form of all eggs received at or dispatched from those premises and, within twelve hours after the receipt or dispatch of any such eggs, to enter or cause to be entered in such register the prescribed particulars in relation to those eggs.
(5) Every register kept in pursuance of this section may be inspected at any time during office hours by any inspector, and it shall be the duty of the registered proprietor to produce for the inspection of the inspector on demand such register and also all invoices, delivery or consignment notes, receipts and other documents (including copies thereof where the originals are not available) reasonably demanded by the inspector for the purpose of verifying any entry in or explaining any omission from such register.
(6) If any registered proprietor—
(a) fails to keep or cause to be kept such register or registers as is or are required by this section, or
(b) fails to make or cause to be made in any such register within the time prescribed by this section any entry required by this section to be made therein, or
(c) fails to produce or cause to be produced for the inspection of an inspector on demand any register, document or copy of a document which he is required by this section so to produce, or obstructs any inspector in the making of an inspection, or
(d) wilfully or negligently makes or causes to be made in any such register any entry which is false or misleading in a material particular,
he shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding twenty pounds, and in the case of a second or any subsequent such offence, to a fine not exceeding fifty pounds.
(7) For the purpose of this section—
(a) inspection of a register or document shall include taking copies thereof or extracts therefrom; and
(b) a demand for inspection of a register or other document shall be deemed to have been duly made to the registered proprietor if such demand is made verbally on the registered premises to any person in the employment of the registered proprietor; and
(c) a refusal or failure to produce a register or other document for inspection, if made or committed on the registered premises by a person in the employment of the registered proprietor, shall be deemed to have been made or committed by the registered proprietor; and
(d) the expression “office hours” means any time between the hours of ten o'clock in the morning and five o'clock in the afternoon during which business is being carried on or work is being done on the registered premises.
(8) References in this Act (other than this section) to a register kept under this Act or to a register kept in pursuance of this Act shall not include any register kept in pursuance of this section.
Inspection of registered premises.
27.—(1) Any inspector shall be entitled at all reasonable times to enter any premises registered in a register kept in pursuance of this Act or in respect of which an application for registration in any such register has been made, and there do all or any of the following things, that is to say:—
(a) inspect all or any part of such premises and the equipment, appliances and fittings therein;
(b) observe all or any of the processes of testing, grading, and packing eggs conducted on such premises;
(c) examine all or any eggs, packages, and packing materials on such premises, and take reasonable samples of all or any of such eggs, packages and packing materials;
(d) search for and inspect eggs on such premises;
(e) require the registered proprietor or any person employed by the registered proprietor on such premises to furnish the inspector with such information in relation to any eggs or package of eggs found by him on such premises as may be reasonably necessary for the purposes of the administration of this Act.
(2) Every person who—
(a) obstructs or impedes an inspector in the exercise of any of the powers conferred on him by this section; or
(b) fails or refuses to give to an inspector on demand any information which such inspector is entitled to demand under this section; or
(c) wilfully or negligently gives to an inspector information which is false or misleading in a material particular,
shall be guilty of an offence under this section, and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
Structural alteration of registered premises.
28.—(1) It shall not be lawful for any registered proprietor, (other than a registered retailer) to make or permit to be made, without the previous approval of the Minister, any structural alterations in any registered premises of which he is the registered proprietor.
(2) Whenever the registered proprietor of registered premises desires to make structural alterations in those premises, he may apply to the Minister in the prescribed form for the approval thereof in accordance with this section, and the Minister shall, as soon as may be after the receipt of the application, intimate in writing to such registered proprietor his approval or disapproval of the proposed alterations.
(3) Every registered proprietor who makes structural alterations to any registered premises in contravention of this section, shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
Prohibition against registered proprietor carrying on business in premises other than registered premises.
29.—(1) Where a person is the registered proprietor of premises registered in a register kept in pursuance of this Act, it shall not be lawful for him to carry on the business carried on by him in the said premises in any premises which are not registered in the said register or of which he is not the proprietor registered in the said register.
(2) A registered wholesaler or a registered dealer shall not, without the consent of the Minister, carry on in his or any of his registered premises any business other than the business in respect of which such premises are registered.
(3) Every registered proprietor who acts in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds together with a further fine not exceeding five pounds for every day on which such offence is continued.
PART III.
Restrictions on the Export and Consignation (Including Export) of Eggs.
Restriction on export of eggs.
30.—(1) It shall not be lawful for any person to export eggs unless the eggs are exported—
(a) by a registered wholesaler direct from the registered wholesaler's premises on which they were packed; or
(b) by parcel post; or
(c) in a consignment the total gross weight of which does not exceed the maximum weight for the time being allowed to be sent by parcel post; or
(d) for the purpose of incubation in quantities not exceeding the prescribed maximum and contained in packages marked in the prescribed manner; or
(e) in a package consigned and forwarded through Ireland from any place outside Ireland to any other such place but not otherwise dealt with in Ireland; or
(f) by being transported by a farmer or his servants from Ireland into Northern Ireland in the course of his business as a farmer; or
(g) under and in accordance with an export licence granted by the Minister under this Part of this Act.
(2) Every person who exports or attempts to export eggs in contravention of this section shall be guilty of an offence under this sub-section.
(3) Every person who shall carry by any means any eggs which are being or are intended to be exported in contravention of this section shall, if such carrying is done in the course or for the purpose of the exportation of such eggs, be guilty of an offence under this sub-section, unless such person proves that he did not know and could not reasonably have known that such eggs were being exported in contravention of this section.
(4) Every person guilty of an offence under any sub-section of this section shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding twenty pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding fifty pounds or, at the discretion of the court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment.
Restriction on the consigning of eggs from registered wholesaler's premises.
31.—(1) Save as is otherwise provided by this section, eggs shall not be consigned from registered wholesaler's premises to any place (whether in or outside Ireland) unless all the following conditions are complied with in respect of such eggs, that is to say:—
(a) the eggs shall have been tested, graded and packed in accordance with the provisions of this Act and regulations made thereunder, and
(b) each of the eggs and also the package containing such eggs, shall be marked with the prescribed marks in accordance with this Act and regulations made thereunder, and
(c) the eggs shall have been tested, graded, packed, and marked as aforesaid on the registered wholesaler's premises from which they are consigned and the package containing the eggs shall also have been marked as aforesaid on the said premises, and
(d) the eggs shall not have been removed from the package in which they were so packed upon those premises, and
(e) the eggs shall be clean and fit for human consumption.
(2) Every person who consigns or attempts to consign eggs in contravention of this section shall be guilty of an offence under this sub-section.
(3) Every person who shall carry by any means any eggs consigned in contravention of this section shall be guilty of an offence under this sub-section unless such person proves that he did not know and could not reasonably have known that such eggs were consigned in contravention of this section.
(4) Every person guilty of an offence under any sub-section of this section shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding twenty pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding fifty pounds or, at the discretion of the court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment.
(5) This section shall not apply to the consignation of eggs from the registered premises of a registered wholesaler to the registered premises of another registered wholesaler in pursuance of a sale by such first-mentioned registered wholesaler to such other registered wholesaler made under and in accordance with a licence granted by the Minister under this Act.
(6) Nothing in this section shall prevent a registered wholesaler from disposing in the prescribed manner of eggs which, when tested on his registered premises, are found to be unfit for human consumption or externally dirty.
Powers of inspectors in relation to consignation of eggs.
32.—(1) Any inspector shall be entitled at all reasonable times (subject to the production by him if so required of his authority in writing as such inspector) to enter upon and have free access to the interior of—
(a) any registered premises; or
(b) any premises in which eggs are sold, or are exposed, kept or stored for sale or in which such inspector reasonably believes or suspects that eggs are sold or are exposed, kept or stored for sale, or
(c) the premises of any person engaged in the business of carrying goods for reward; or
(d) any warehouse or other premises of any person engaged in the business of warehousing goods; or
(e) any pier, quay, wharf, jetty, dock or dock premises; or
(f) any ship, boat, railway wagon, motor lorry, cart or other vessel or vehicle used for the conveyance of goods.
(2) Any inspector may do all or any of the following things in or upon any of the places mentioned in the foregoing sub-section of this section or in any public place, that is to say:—
(a) inspect any package found in or upon any such place;
(b) open any such package which he reasonably believes or suspects to contain eggs;
(c) examine any eggs found by him in any such place, whether such eggs are or are not contained in a package;
(d) take and remove without payment all or any of the following things, that is to say:—
(i) reasonable samples of any eggs found in any such place, whether such eggs are or are not contained in a package,
(ii) reasonable samples of any packing material found in any such place,
(iii) any package of eggs or any one or more of any packages of eggs found in any such place;
(e) detain for so long as may be reasonably necessary for the purposes of this section, any package or any number of packages found in any such place;
(f) if the package or all or any of the packages so detained is or are in the hands of a carrier, give a direction in writing to such carrier prohibiting the further carriage (except by way of returning to the consignor) of such package or packages where it appears to the inspector on examination that there has been a contravention or attempted contravention of this Act or of any regulation made thereunder in relation thereto;
(g) demand of any person in charge of any eggs or any package of eggs in such place the names and other particulars of the owner or of the consignor and the consignee of such eggs or such package.
(3) Every person who—
(a) obstructs or impedes an inspector in the exercise of any of the powers conferred on him by this section, or
(b) knowing the name or other particulars of the owner, consignor or consignee of any eggs or of any package which an inspector is entitled to inspect under this section, refuses to give such name or other particulars to the inspector, or
(c) wilfully or recklessly gives to the inspector any false or misleading name or other particular of any such owner, consignor or consignee,
shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof, in the case of a first such offence to a fine not exceeding five pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding ten pounds.
(4) Every person who consigns or carries or attempts to consign or carry to any place, whether in or outside Ireland, any package of eggs in respect of which a direction prohibiting the further carriage thereof has been given by an inspector under this section shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
(5) Where an inspector gives a direction under this section to a carrier prohibiting the further carriage of any package of eggs, it shall be the duty of such inspector, if the carrier is not the owner of the package, to notify the consignor of the package as soon as possible after the giving of the direction, that the direction was so given.
(6) Where any sample or package is taken by an inspector under this section it shall be the duty of such inspector to communicate the fact of such taking to the owner or the consignor and the consignee (if and so far as their names and addresses are known to or can reasonably be ascertained by him) and also, where such taking occurred on the premises of a carrier or warehouseman, to such carrier or warehouseman.
(7) If, on the examination of any package taken under this section, it appears to the Minister that there was a contravention or attempted contravention of this Act or a regulation made thereunder in relation to such package, such package shall be forfeited to the Minister, and in any other case the package shall be disposed of in accordance with the directions of the consignor, or in default of such directions, shall be sold and the net proceeds of such sale paid to the consignor.
(8) Neither the Minister nor any inspector shall be liable for any loss, damage, or reasonable delay arising from the exercise by an inspector of any of the powers conferred on him by this section, and no action shall lie against the consignor, or any other person, for or on account of any such loss, damage or reasonable delay.
(9) In the exercise in or upon the premises of any railway or shipping company of the powers conferred on him by this section, an inspector shall conform to such reasonable requirements of the company as are necessary to prevent the working of the traffic on those premises from being obstructed or interfered with.
(10) Eggs forfeited to the Minister under this section shall, if unfit for human consumption, be destroyed or shall, in any other case, be sold by the Minister and, notwithstanding anything contained in this Act, may be so sold to and bought by retailers or registered wholesalers.
(11) The net proceeds of all eggs sold under the next preceding sub-section of this section shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
(12) For the purpose of this section, whenever a direction prohibiting the further carriage of a package of eggs has been given to a carrier under this section and the package is, at the time the direction is given, actually loaded in a ship or a railway wagon, the carriage of such package on that ship or wagon shall not be deemed a further carriage of such package in contravention of such direction if such carrier proves that—
(a) at the first available opportunity, he returned such package to and landed or delivered it at the port or station at which it was loaded into such ship or wagon (as the case may be), and
(b) between the time when such direction was given and the said return and landing or delivery of such package it was in the sole charge of such carrier and was not opened or interfered with in any way.
(13) In this section—
the word “place” includes a ship, boat or other vessel and also includes a railway wagon, motor lorry, cart or other vehicle;
the word “package” includes a package about to be consigned or awaiting consignation or dispatch and a package already delivered to the consignee thereof as well as a package in course of transport from a consignor to a consignee or from one place of business of a person to another place of business of the same person.
Licences to export eggs.
33.—(1) The Minister may, upon the application of any person in the prescribed form and manner, grant to that person a licence to export the consignment of eggs specified in the licence to such consignee, by such route, and subject to such conditions as are stated in the licence.
(2) A licence granted under this section shall operate to authorise the person to whom the same is granted to export, in accordance with the terms of the licence, the consignment of eggs specified therein.
(3) The Minister may, at any time before a consignment of eggs specified in a licence is actually exported, revoke the licence relating to that consignment.
(4) If any person to whom a licence has been granted under this section contravenes any of the terms or conditions therein he shall be guilty of an offence under this sub-section.
(5) Every person who falsely represents by means of a mark on the consignment or otherwise that any consignment of eggs is being exported under a licence granted under this section shall be guilty of an offence under this sub-section.
(6) Every person who is guilty of an offence under any sub-section of this section shall be liable, on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds.
(7) On every application for a licence under this section, there shall be paid to the Minister a fee of the prescribed amount, and the due payment of such fee shall be a condition precedent to the entertainment of the application by the Minister.
Powers of officers of customs and excise.
34.—Any officer of customs and excise may detain and seize any eggs being exported or attempted to be exported in contravention of this Act and may, for that purpose, open any package containing or suspected by him to contain eggs, and the provisions of the Customs Consolidation Act, 1876, relating to the condemnation and disposal of goods seized under that Act shall apply and have effect in relation to all articles seized under this Act in like manner as if such articles had been seized under the said Customs Consolidation Act, 1876.
Regulations for testing, grading and packing eggs in wholesalers' premises.
35.—(1) The Minister may by order make, in respect of registered wholesalers' premises, regulations in regard to all or any of the following matters, that is to say:—
(a) the method and manner in all or any respects of testing eggs and the time after the acquisition thereof within which they shall be so tested;
(b) the method and manner in all or any respects of grading eggs;
(c) the method and manner in all or any respects of packing eggs, including the materials and packages to be used for such packing;
(d) the grades and descriptions of eggs which may or may not be packed in the same package;
(e) the prohibition of packing of any particular grades or descriptions of eggs;
(f) the description of eggs which may or may not be brought on to the premises;
(g) the places and times at which eggs intended for export shall be presented for examination.
(2) Different regulations may be made under this section in respect of eggs which are consigned for export and in respect of eggs which are not so consigned.
(3) All eggs tested, graded and packed in any registered wholesaler's premises shall be tested, graded and packed in accordance in all respects with the regulations made under this section and for the time being in force.
(4) Every person who contravenes, whether by act or omission, any regulation made under this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds.
Power of Minister to fix route of export.
36.—(1) Whenever the Minister is satisfied that it is necessary to do so in order to facilitate the inspection under this Act of eggs or packages of eggs, he may, by notice in writing served on a registered wholesaler, require such registered wholesaler to do both or either of the following things, that is to say:—
(a) to export eggs only by the route or one of the routes specified in that behalf in such notice;
(b) to present all eggs intended to be exported by him for examination at the place and time similarly specified.
(2) Every registered wholesaler on whom a notice is served under this section shall comply with such notice and if he fails so to do he shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding twenty-five pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding fifty pounds.
Obligation to employ skilled persons.
37.—(1) It shall not be lawful for a registered wholesaler to carry on or permit to be carried on any of the operations of testing, grading, and packing eggs on any premises of which he is the registered proprietor unless such operations are continuously under the supervision and control of a skilled person.
(2) It shall be the duty of every registered wholesaler—
(a) to employ at least one skilled person in every registered premises of which he is the registered proprietor, and
(b) to furnish to the Minister or to an inspector on demand a statement of the number of skilled persons employed by such registered wholesaler together with such information in respect of every skilled person so employed as the Minister or such inspector shall require.
(3) Where a registered wholesaler is himself a skilled person and supervises and controls the operations of testing, grading and packing eggs on registered premises of which he is the registered proprietor, he may reckon himself as a skilled person employed by him for the purposes of the foregoing sub-sections of this section and thereupon this section shall apply and have effect as if he were such skilled person so employed.
(4) Every registered wholesaler who does any act (whether of commission or omission) which is a contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds and, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds, together with, in any case, a further fine not exceeding ten pounds for every week or part of a week during which the offence is continued.
(5) In this section the expression “skilled person” means a person who is skilled within the meaning of this Act in the business of testing, grading, and packing eggs.
Regulations as to marking eggs.
38.—(1) The Minister may by order make regulations prescribing the marks to be applied to every package of eggs consigned from any registered wholesaler's premises to any place, whether in or outside Ireland, for the purpose of indicating all or any of the following matters, that is to say:—
(a) the grade of the eggs contained in such package;
(b) the premises in which such eggs were packed;
(c) in the case of preserved eggs, that such eggs are preserved:
(d) that the eggs were produced in Ireland;
(e) any other matter which in the opinion of the Minister should be indicated on such package.
(2) The Minister may by order make regulations prescribing the marks to be applied to every egg consigned from any registered wholesaler's premises to any place, whether in or outside Ireland, for the purpose of indicating all or any of the following matters, that is to say:—
(a) the grade of the egg;
(b) the premises in which it was packed;
(c) the period during which the egg was tested or the period during which the egg was packed in those premises;
(d) in the case of a preserved egg, that it is preserved;
(e) that the egg was produced in Ireland;
(f) any other matter which in the opinion of the Minister should be indicated on the egg.
(3) Regulations made under this section may prescribe the manner in which and the means by which the marks prescribed under this section are to be applied to the eggs to which they are applicable.
(4) Different regulations may be made under this section in respect of eggs consigned for export and in respect of eggs not so consigned.
(5) For the purpose of so much of this section as relates to the indication by marks of the premises on which eggs were packed, the Minister may assign to every registered wholesaler's premises a distinctive mark, and may, by the regulations made under this section, require the marks so assigned to be used as the mark for indicating the premises on which packages or eggs were packed.
(6) For the purpose of so much of this section as relates to the indication by marks of the period during which eggs were tested or the period during which eggs were packed, the Minister may from time to time, by notice published in the Iris Oifigiúil and in such newspapers and periodicals as he shall think proper, appoint distinctive marks to indicate particular periods, and may by the regulations made under this section require the marks so appointed to be used as the marks for indicating, in relation to the testing or the packing of eggs, the periods in respect of which such marks are respectively so appointed.
(7) All eggs received at any registered wholesaler's premises and the packages in which they are packed in those premises shall be marked in accordance in all respects with the provisions of this section and the regulations made thereunder and for the time being in force.
(8) The application of a mark prescribed under this section to any eggs or packages of eggs in any circumstances in which the application thereof is not authorised by or is not in accordance with this section or the regulations made thereunder shall be taken to be a false trade description within the meaning of the Merchandise Marks Acts, 1887 to 1931, and those Acts, including the penal provisions thereof, shall apply accordingly.
(9) For the purpose of this section a mark shall be deemed to be applied if it is applied within the meaning of the Merchandise Marks Acts, 1887 to 1931.
Notification of defects to Minister by consignee.
39.—(1) The Minister may by order make regulations requiring every registered wholesaler to place in every package of eggs intended to be consigned by him to any place whether inside or outside Ireland, before it is consigned, a document in the form prescribed by such regulations requesting the consignee of such package to notify the Minister of any defects found by him in such package or in the eggs contained therein or in the packing of such eggs therein.
(2) Every registered wholesaler who fails to comply with any regulation made under this section shall be guilty of an offence under this section, and shall be liable, on summary conviction thereof, to a fine not exceeding five pounds.
Restriction on application of prescribed marks.
40.—(1) Every mark required or authorised by or under this Act to be applied to any eggs or package of eggs shall be so applied by either the proprietor of the premises in which such mark is, or is required to be, applied or by a person employed and authorised in that behalf by such proprietor.
(2) It shall not be lawful for any person, other than the persons mentioned in the foregoing sub-section of this section, to apply the marks mentioned in the said sub-section to any egg or package of eggs.
(3) Every person who applies to any egg or package of eggs any mark in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds or, at the discretion of the Court, to imprisonment for any term not exceeding three months, or to both such fine and imprisonment.
(4) For the purpose of this section, a mark shall be deemed to be applied if it is applied within the meaning of the Merchandise Marks Acts, 1887 to 1931.
Marking of weights on eggs.
41.—(1) Where a package containing eggs is marked—
(a) with a mark (in this section called a grade mark) prescribed under this Act as the mark for eggs of a particular grade, and
(b) with a mark (in this section called a weight mark) intended to indicate that each egg in the package is not less in weight than the weight prescribed as the minimum weight for eggs of the grade indicated by the grade mark,
it shall not be lawful for a registered wholesaler to consign the package to any place, whether in or outside Ireland, unless each egg contained in the package is not less in weight than the weight indicated by the weight mark.
(2) If any person consigns or attempts to consign eggs in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds or, at the discretion of the Court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.
PART IV.
Restrictions on the Purchase and Sale of Eggs.
Fresh eggs and second quality eggs.
42.—(1) The Minister may by order make regulations for all or any of the following purposes, that is to say:—
(a) prescribing a standard for fresh eggs;
(b) prescribing a standard for second quality eggs;
(c) prescribing the marks to be placed on eggs for the purpose of indicating that they are second quality eggs;
(d) prescribing the manner in which the said marks are to be placed on eggs.
(2) In this Act the expression “fresh eggs” means eggs of the standard prescribed under the foregoing sub-section of this section for fresh eggs, and the expression “second quality eggs” means eggs of the standard prescribed under the said foregoing sub-section for second quality eggs.
(3) It shall not be lawful for any registered wholesaler or any retailer to sell or to offer, or expose for sale, or to consign to any place (whether inside or outside Ireland) any second quality eggs, unless such eggs are marked with the marks and in the manner prescribed under this section for the purpose of indicating that they are second quality eggs.
(4) It shall not be lawful for any registered wholesaler to retain in his possession after the expiration of the prescribed time for testing eggs any eggs which are second quality eggs, unless such eggs are marked with the marks and in the manner prescribed under this section for the purpose of indicating that they are second quality eggs.
(5) It shall not be lawful for any retailer to have in his possession any second quality eggs after the expiration of the period prescribed under this Act for the examination of eggs by him unless such eggs are marked with the marks and in the manner prescribed under this section for the purpose of indicating that they are second quality eggs.
(6) Every person who does any act (whether of commission or omission) which is a contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding twenty pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding fifty pounds or, at the discretion of the Court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment.
Eggs unfit for human consumption.
43.—All eggs which do not reach the standard prescribed under this Act for second quality eggs shall be deemed, for the purposes of this Act, to be unfit for human consumption, and all references in this Act to eggs which are unfit for human consumption shall be construed and have effect accordingly.
Restrictions on purchase and sale by wholesale of eggs.
44.—(1) It shall not be lawful for any person to acquire eggs for sale by wholesale unless either—
(a) he is a registered wholesaler, or a registered dealer, or
(b) he so acquires such eggs under and in accordance with a licence in that behalf granted to him under this section.
(2) It shall not be lawful for any person to sell eggs by wholesale or to consign, offer, or expose eggs for sale by wholesale unless either—
(a) he is a registered wholesaler or a registered dealer, or
(b) he is a producer or,
(c) he is so selling or so consigning, offering or exposing the eggs under and in accordance with a licence in that behalf granted to him under this section.
(3) It shall not be lawful for a registered wholesaler to sell eggs to another registered wholesaler save under and in accordance with a licence in that behalf granted under this Act.
(4) It shall not be lawful for a registered wholesaler to acquire eggs unless either—
(a) the eggs are acquired by him from a registered dealer, or
(b) the eggs are acquired by him from a producer, or
(c) the eggs are acquired by him from another registered wholesaler under and in accordance with a licence in that behalf granted under this Act.
(5) Every person who does any act (whether of commission or omission) which is a contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding twenty pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding fifty pounds or, at the discretion of the Court, to imprisonment for a term not exceeding six months or to both such fine and such imprisonment.
(6) The Minister may grant to any person any one or more of the following licences, that is to say:—
(a) a licence to acquire eggs for sale by wholesale, or
(b) a licence to sell eggs by wholesale and to consign, offer and expose eggs for sale by wholesale, or
(c) where the grantee of the licence is a registered wholesaler, a licence to sell eggs to another wholesaler,
and the Minister may attach to any such licence such conditions as he shall think proper and shall specify in such licence, and the Minister may at any time revoke any such licence.
Restrictions on the acquisition of eggs by registered dealers.
45.—(1) It shall not be lawful for any registered dealer to acquire eggs for resale, either by wholesale or by retail, unless either—
(a) he so acquires the eggs from a producer, or
(b) he so acquires the eggs under and in accordance with a licence granted by the Minister under this section.
(2) Every person who acquires or attempts to acquire eggs in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds or, at the discretion of the Court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.
(3) The Minister may grant to any registered dealer a licence to acquire eggs for resale subject to such conditions as the Minister thinks fit, and may at any time revoke such licence.
Restrictions on the disposal of eggs by registered dealers.
46.—(1) It shall not be lawful for a registered dealer to dispose of eggs otherwise than—
(a) by sale to a registered wholesaler within the prescribed time from the date on which the eggs were acquired by such registered dealer, or
(b) by sale, either by wholesale or by retail, under and in accordance with a licence granted by the Minister under this section.
(2) Every person who disposes or attempts to dispose of eggs in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds, or, at the discretion of the Court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.
(3) The Minister may grant to a registered dealer a licence to dispose of eggs by sale, either by wholesale or by retail, subject to such conditions as the Minister thinks fit, and may at any time revoke such licence.
Retailer's notice.
47.—(1) It shall be lawful for the Minister to serve or cause to be served on any person who carries on or is about to carry on the business (in this section referred to as the business to which this section relates) of selling by retail eggs purchased from registered wholesalers or from producers or from registered wholesalers only or from producers only a notice (in this Act referred to as a retailer's notice) in the prescribed form requiring such person to apply in accordance with this Act and the regulations made thereunder to the Minister within the time (not less than twenty-one days from the service of such notice) specified in that behalf in such notice for the registration in the register of retailers of such person and the premises in which he carries on or is about to carry on the said business.
(2) Whenever a retailer's notice has been served under this section, the following provisions shall have effect, that is to say:—
(a) the person on whom such notice was served shall, within the time specified in that behalf in such notice, apply to the Minister in accordance with this Act for such registration in the register of retailers as is specified in such notice;
(b) if such person duly applies in accordance with this section for registration in the register of retailers, the Minister shall register in that register such person and the remises in which he carries on or proposes to carry on the business to which this section relates;
(c) if such person does not duly apply in accordance with this section for such registration as aforesaid, it shall not be lawful for such person to carry on, after the expiration of the time within which such application is required by this section to be made, the business to which this section relates.
(3) If any person carries on in contravention of this section the business to which this section relates such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds together with a further fine not exceeding five pounds for every day on which such business is so carried on.
Possession, sale, etc., of eggs unfit for human consumption.
48.—(1) It shall not be lawful for any person to sell or to offer or expose for sale or to consign to any place, whether inside or outside Ireland, any eggs which are unfit for human consumption.
(2) It shall not be lawful for any registered wholesaler to have in his possession after the prescribed time for the testing of eggs by registered wholesalers, any eggs which are unfit for human consumption unless such eggs are marked and set aside for disposal in the prescribed manner.
(3) It shall not be lawful for any registered dealer to have in his possession, after the expiration of the prescribed time for the disposal of eggs by registered dealers after acquisition, any eggs which are unfit for human consumption.
(4) It shall not be lawful for any retailer to have in his possession, after the expiration of the prescribed time for the examination of eggs by retailers after acquisition, any eggs which are unfit for human consumption.
(5) Every person who contravenes, whether by act or omission, any sub-section of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding twenty pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding fifty pounds, or at the discretion of the Court, to imprisonment for a term not exceeding six months or to both such fine and such imprisonment.
(6) Where a registered dealer is charged with an offence under this section and the act alleged to constitute the offence is a contravention of sub-section (1) of this section, it shall be a good defence to such charge for such registered dealer to show that he did not know that the eggs were unfit for human consumption and that he sold them within the prescribed time for disposal thereof after acquisition.
Possession, sale, etc., of dirty eggs.
49.—(1) It shall not be lawful for any person to sell or to offer or expose for sale or to consign to any place, whether inside or outside Ireland, any eggs which are externally dirty.
(2) It shall not be lawful for any person to purchase for resale any eggs which are externally dirty unless the eggs were so purchased in such circumstances that such person could not reasonably have known that the eggs were externally dirty.
(3) It shall not be lawful for any registered wholesaler to have in his possession, after the expiration of the prescribed time for the testing of eggs by registered wholesalers, any eggs which are externally dirty unless the eggs are marked and set aside for disposal in the prescribed manner.
(4) It shall not be lawful for any registered dealer to have in his possession any eggs which are externally dirty and were acquired by him from a producer.
(5) It shall not be lawful for any retailer to have in his possession, after the expiration of the prescribed time for the examination of eggs by retailers after acquisition, any eggs which are externally dirty.
(6) Every person who contravenes, whether by act or omission, any sub-section of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding twenty pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding fifty pounds, or, at the discretion of the Court, to imprisonment for a term not exceeding six months or to both such fine and such imprisonment.
(7) Where a registered dealer is charged with an offence under this section and the act alleged to constitute the offence is a contravention of sub-section (1) or sub-section (2) of this section, it shall be a good defence to such charge for such registered dealer to show that he acquired the eggs from another registered dealer.
Protection of eggs from weather and contamination.
50.—(1) The Minister may by order make regulations for either or both of the following purposes, that is to say:—
(a) prohibiting the sale or offering or exposing for sale or keeping or storing pending sale of eggs in any building, vehicle, or other place or under conditions which does or do not afford adequate protection to the eggs against wet, damp, dirt, and heat and against adverse weather conditions and against contamination of any sort;
(b) securing that eggs intended for sale shall, while stored or kept and while being offered or exposed for sale and while in course of packing or transport, be adequately protected against wet, damp, dirt, and heat and against contamination of every sort.
(2) Every person who does any act (whether of commission or omission) which is a contravention of a regulation made under this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds or, at the discretion of the Court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.
Prohibition of washing or steeping eggs.
51.—(1) It shall not be lawful for any person—
(a) to wash, or to steep for the purpose of cleaning, any eggs which are intended for sale, or
(b) to have in his possession any machine or implement designed and constructed primarily for washing or cleaning eggs.
(2) Every person who acts in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds or, at the discretion of the Court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.
Divers regulations as to purchase, sale, and disposal of eggs.
52.—(1) The Minister may by order make regulations for all or any of the following purposes, that is to say:—
(a) requiring that eggs in the shell of domestic fowl purchased by or on behalf of a registered proprietor shall be so purchased by weight;
(b) requiring registered proprietors (either generally or of any particular class or classes) who acquire, whether at their registered premises or elsewhere, eggs from producers to do the following things in respect of all eggs so acquired by them, that is to say:—
(i) to place such eggs, immediately upon the acquisition thereof, in a container of the design, dimensions, and materials specified in that behalf by the regulations made under this section and obtained from a manufacturer similarly specified and marked with the mark similarly specified, and
(ii) to place in or on every such container the note, docket, or mark specified in that behalf by such regulations indicating the producer from whom and the date on which the eggs in such container were acquired, and such other particulars in relation to such eggs as may be so specified, and
(iii) save as may be otherwise provided by the regulations, to retain in such container such note or docket as aforesaid and also all eggs so placed therein until they are removed therefrom in the registered premises of a registered wholesaler for testing and grading, and
(iv) to retain for the prescribed time and in the prescribed manner all notes and dockets placed in such container in pursuance of the regulations;
(c) requiring that eggs (other than eggs packed in the registered premises of a registered wholesaler) consigned, offered or exposed for sale shall be packed in the manner and with the packing materials specified in that behalf by the regulations made under this section;
(d) requiring that eggs (other than eggs packed in the registered premises of a registered wholesaler or a registered dealer) consigned, offered or exposed for sale shall be marked in the manner and with the mark specified in that behalf by the regulations made under this section;
(e) requiring that the packages in which eggs (other than eggs packed in the registered premises of a registered wholesaler). consigned, offered or exposed for sale are packed shall be marked in the manner and with the mark specified in that behalf by the regulations made under this section;
(f) requiring that all eggs sold or consigned, offered, exposed, or advertised for sale or invoiced before or after delivery on sale shall be sold or so consigned, offered, exposed, advertised or invoiced (as the case may be) under a description specified in that behalf by the regulations made under this section;
(g) prohibiting the keeping of eggs on registered premises for longer than the maximum period specified by the regulations made under this section and applicable to such eggs;
(h) requiring that every registered proprietor, or every registered proprietor of premises registered in a particular register, who has in his possession any eggs the sale of which is prohibited by this Act shall dispose of such eggs only in a manner specified in that behalf by the regulations made under this section.
(2) For the purpose of so much of this section as relates to the marking of eggs, the Minister (in lieu of prescribing by regulations made under this section marks indicating the period during which eggs were tested or examined or the period during which eggs were packed) may from time to time by notice published in the Iris Oifigiúil and such newspapers and periodicals as he shall think proper, appoint distinctive marks to indicate particular periods and may by the regulations made under this section require the marks so appointed to be used as the marks for indicating, in relation to the testing, the examining, or the packing of eggs, the periods in respect of which such marks are respectively so appointed.
(3) Every person who shall do any act (whether of commission or omission) which is a contravention of a regulation made under this section shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds.
(4) Every person who shall without lawful authority alter, deface, or remove—
(a) any mark placed on any egg, package or container in pursuance of regulations made under this section, or
(b) any note, docket, or mark placed in or on any container in pursuance of such regulations,
shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to a fine not exceeding twenty-five pounds or, at the discretion of the Court, to imprisonment for a term not exceeding three months or to both such fine and such imprisonment.
PART V.
Restrictions in Relation to the Preserving of Eggs.
Continuation of the register of preservers kept under the Agricultural Produce (Eggs) Acts, 1924 and 1930.
53.—(1) On and after the commencement of this Act—
(a) the register kept pursuant to the Agricultural Produce (Eggs) Acts, 1924 and 1930, and in those Acts referred to as the register of preservers (in this section referred to as the former register) shall become and be the register of preservers to be kept under this Act; and
(b) all premises which were, immediately before the commencement of this Act, registered in the former register shall, without any application in that behalf, become and be registered, as from such commencement, in the register of preservers to be kept in pursuance of this Act and shall be deemed to have been so registered under this Act and this Act shall apply and have effect in respect thereof accordingly; and
(c) every person who was, immediately before the commencement of this Act, registered in the former register as the proprietor of premises registered therein shall, without any application in that behalf, become and be registered, as from such commencement, in the register of preservers to be kept in pursuance of this Act as the proprietor of the said premises and shall be deemed to have been so registered under this Act and this Act shall apply and have effect in respect of him accordingly.
Prohibition of business of preserving eggs in unregistered premises.
54.—(1) It shall not be lawful for any person to carry on by way of trade or gain in premises which are not registered in the register of preservers the business of preserving eggs, whether by cold storage, chemical storage, pickling or otherwise.
(2) If any person acts in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding twenty pounds and, in the case of a second or any subsequent such offence, to a fine not exceeding fifty pounds or, at the discretion of the Court, to imprisonment for a term not exceeding six months or to both such fine and such imprisonment.
General regulations for marking preserved eggs.
55.—(1) The Minister may make regulations (in this Part of this Act referred to as the general regulations for the marking of preserved eggs) in relation to all or any of the following matters, that is to say:—
(a) the marks to be borne on eggs sent or consigned to or removed from any premises registered in the register of preservers;
(b) the mode in and the means by which such marks are to be placed on such eggs.
(2) Different marks may be prescribed under this section in respect of different classes of eggs with the object of indicating the manner in which such eggs are intended to be or have been treated in such premises.
Prohibition of sending or receiving unmarked eggs.
56.—(1) Subject to the provisions of this section, it shall not be lawful for any person to send or consign to or deliver at any premises registered in the register of preservers any eggs which at the time of such sending, consignation or delivery are not marked in accordance with the general regulations for the marking of preserved eggs.
(2) Subject to the provisions of this section, it shall not be lawful for a registered preserver to accept in his registered premises delivery of any eggs which are not marked in accordance with the general regulations for the marking of preserved eggs or to receive into such premises any eggs not so marked.
(3) Every person who does any act (whether of commission or omission) which is a contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds or, at the discretion of the court, to imprisonment for a term not exceeding three months or to both such fine and such imprisonment.
(4) The Minister may by order declare that the foregoing provisions of this section shall not apply or have effect in relation to eggs preserved or intended to be preserved by a particular process specified in such order, and whenever any such order is made and is in force the said provisions shall not apply or have effect in relation to eggs preserved or intended to be preserved by the particular process specified in such order
(5) The Minister may at any time by order revoke, amend, or vary any order previously made by him under this section, including an order so made under this sub-section.
Prohibition of removal, etc., of unmarked eggs.
57.—(1) It shall not be lawful for a registered preserver to sell, consign, or otherwise remove from his registered premises any eggs which do not bear visibly and legibly thereon the appropriate marks prescribed by the general regulations for the marking of preserved eggs.
(2) It shall not be lawful for any person to acquire at or from any premises registered in the register of preservers any eggs which do not bear visibly and legibly thereon the appropriate marks prescribed by the general regulations for the marking of preserved eggs or to accept delivery from any such premises of any eggs which do not bear visibly and legibly thereon such marks.
(3) The foregoing provisions of this section shall not apply or have effect in relation to any eggs to which, by virtue of an order made by the Minister under the next preceding section, the provisions of that section do not apply.
(4) Every person who does any act (whether of commission or omission) which is a contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent such offence, to a fine not exceeding twenty pounds or, at the discretion of the Court, to imprisonment for a term not exceeding three months or to both such fine and such imprisonment.
Prohibition of removal, etc., of marks from preserved eggs.
58.—Every person who—
(a) removes, alters or obliterates from or on any egg a mark prescribed by the general regulations for the marking of preserved eggs, or
(b) sells or offers or exposes for sale any egg from or on which a mark prescribed by the general regulations for the marking of preserved eggs has been removed, altered or obliterated,
shall, unless he proves that he acted without intent to defraud, be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds or, in the case of a second of any subsequent such offence, to a fine not exceeding twenty pounds or, at the discretion of the Court, to imprisonment for a term not exceeding three months or to both such fine and such imprisonment.
