1.—Féadfar an tAcht Rialtais Áitiúil (Aoisliúntas), 1948, a ghairm den Acht seo.
Mínithe.
2.—San Acht seo—
ciallaíonn an abairt “Acht 1925” an tAcht Rialtais Áitiúil, 1925 (Uimh. 5 de 1925);
ciallaíonn an abairt “an tAire iomchuí”—
(a) i gcás inar coiste gairm-oideachais an t-údarás áitiúil atá i gceist, an tAire Oideachais,
(b) i gcás inar coiste talmhaíochta an t-údarás áitiúil atá i gceist, an tAire Talmhaíochta,
(c) in aon chás eile, an tAire;
folaíonn an abairt “an stát-sheirbhís” nuair a húsáidtear í gan cháiliú, i dteannta stát-sheirbhíse an Rialtais, na státsheirbhísí a luaitear i míreanna (a), (b), (e) agus (f) d'fho-alt (1) d'alt 2 den Acht Aoisliúntas, 1936 (Uimh. 39 de 1936);
ciallaíonn an abairt “sochar oifige” aon tseomraí, ciondála, nó forliúntais eile in earraí (nó, do réir mar is gá sa chás, íocaíocht airgid in ionad na seomraí, na gciondáil, nó na bhforliúntas eile sin) a ghabhas le hoifig nó fostaíocht;
ciallaíonn an abairt “oifigeach bunaithe” oifigeach d'údarás áitiúil a bhfuil a ainm iontrálta sa chlár d'oifigigh bhunaithe atá á choimeád ag an údarás áitiúil sin faoi alt 8 den Acht seo;
tá leis an abairt “post bunaithe,” nuair a húsáidtear í maidir leis an stát-sheirbhís, an bhrí atá léi san Acht Aoisliúntas, 1936 (Uimh. 39 de 1936);
ciallaíonn an abairt “seirbhíseach bunaithe” seirbhíseach d'údarás áitiúil a bhfuil a ainm iontrálta sa chlár de sheirbhísigh bhunaithe atá á choimeád ag an údarás áitiúil sin faoi alt 38 den Acht seo;
ciallaíonn na habairtí “oifigeach briogáide tóiteáin” agus “seirbhíseach briogáide tóiteáin,” faoi seach, oifigeach nó seirbhíseach d'údarás briogáide tóiteáin faoin Acht Briogáideacha Tóiteáin, 1940 (Uimh. 7 de 1940), is d'aicme a sonrófar i rialacháin faoi alt 71 den Acht seo;
ciallaíonn an abairt “údarás cuain” údarás cuain do réir bhrí an Achta Cuanta, 1946 (Uimh. 9 de 1946);
tá leis an abairt “comhlucht áitiúil” an bhrí atá léi i gCuid IV d'Acht 1925;
ciallaíonn an abairt “údarás áitiúil,” faoi réir fo-ailt (7) d'alt 5 den Acht seo, aon chomhlucht acu seo a leanas:—
(a) údarás áitiúil chun críocha na nAcht Rialtais Áitiúil, 1925 go 1946, seachas bord ospidéil mheabhairghalar,
(b) coiste gairm-oideachais,
(c) coiste talmhaíochta,
(d) coiste freastail scoile,
(e) Bord Ospidéil Fhiabhrais Bhaile Atha Cliath,
(f) Bord Ospidéil Fhiabhrais Chorcaighe;
ciallaíonn an abairt “bord ospidéil mheabhair-ghalar” comhbhord do réir bhrí an Achta Cóireála Meabhair-Ghalar, 1945 (Uimh. 19 de 1945);
ciallaíonn na habairtí “oifigeach d'ospidéal meabhair-ghalar” agus “seirbhíseach d'ospidéal meabhair-ghalar,” faoi seach, oifigeach nó seirbhíseach a mbaineann a dhualgais ar fad leis na feidhmeanna atá dílsithe anois in údarás ospidéil mheabhairghalar faoin Acht Cóireála Meabhair-Ghalar, 1945 (Uimh. 19 de 1945);

ní fholaíonn an focal “oifigeach” oifigeach d'ospidéal meabhairghalar ná duine i seilbh aon oifige dá luaitear in alt 17 den Acht Rialtais Áitiúil, 1941 (Uimh. 23 de 1941);
ciallaíonn an abairt “seirbhís áitiúil inphinsin”—
(a) maidir le hoifigeach bunaithe, a sheirbhís áitiúil inphinsin arna cinneadh faoi Chuid II den Acht seo,
(b) maidir le seirbhíseach bunaithe, a sheirbhís áitiúil inphinsin arna cinneadh faoi Chuid III den Acht seo,
(c) maidir le hoifigeach inphinsin lena mbaineann Cuid IV d'Acht 1925, a sheirbhís chun críocha na Coda sin IV,

(b) i gcás oifigigh atá ag gníomhú mar ard-chláraitheoir breitheanna, básanna agus póstaíocha nó mar chláraitheoir póstaíocha, a bheir iarmhar a chuid aimsire do sheirbhís údaráis áitiúil amháin nó níos mó,
(c) ar gá gur dochtúir leighis cláraithe nó altra nó bean chabhartha a bheas ann, nó
(d) is oifigeach inphinsin chun críocha Coda IV d'Acht 1925;
ciallaíonn an abairt “oifig inphinsin” oifig oifigigh inphinsin;
ciallaíonn an focal “buan-oifigeach” oifigeach seachas oifigeach arna cheapadh—
(a) go ceann tréimhse sonraithe amháin,
(b) go dtí go gcríochnófaí obair nó dualgas sonraithe,

ciallaíonn an focal “buan-tseirbhíseach” seirbhíseach ar fostaíocht bhuan lán-aimsire a fhostaíocht agus nach fostaíocht (seachas fostaíocht i gcáil mhaoirseachta) ar aon obair nó scéim oibreacha í agus a n-íoctar a costais go hiomlán nó go páirteach as airgead arna sholáthar ag an Oireachtas chun fostaíocht a chur ar fáil agus chun fóirithint ar ghátar;
ní fholaíonn an focal “seirbhíseach” seirbhíseach d'ospidéal meabhair-ghalar;
ciallaíonn an abairt “na hAchta Aoisliúntas” na hAchta Aoisliúntas, 1834 go 1946;
ciallaíonn an focal “neamhoiriúnacht” neamhoiriúnacht oifigigh nó seirbhísigh dá oifig nó dá fhostaíocht, ach ní fholaíonn sé neamhoiriúnacht de dheasca éiglíochta coirp nó meabhrach nó sean-aoise.
Rialacháin a leagadh faoi bhráid an Oireachtais.
3.—Gach rialachán a déanfar faoin Acht seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus, má dhéanann ceachtar Teach acu sin, laistigh den lá agus fiche a shuífeas an Teach sin tar éis an rialachán a leagadh faoina bhráid, rún a rith ag neamhniú an rialacháin, beidh an rialachán arna neamhniú dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin rialachán sin.
Tosach feidhme Coda II.
4.—Tiocfaidh Cuid II den Acht seo i ngníomh pé lá a cheapfas an tAire, le hordú, chuige sin.
Tosach feidhme Coda III.
5.—(1) Féadfaidh údarás áitiúil, le rún, a chinneadh go nglacfaid le Cuid III den Acht seo amhail ar dháta sonraithe, agus ó dháta sonraithe, nach luaithe ná mí tar éis dáta an rúin.
(2) Aon rún a rithfear faoin alt seo, beidh ann dearbhú ar an méid uasta daoine atá le bheith, aon tráth áirithe, i bhfostaíocht an údaráis áitiúil mar bhuan-tseirbhísigh.
(3) Is feidhm fhorcoimeádta chun críocha na nAcht um Bainistí Chontae, 1940 agus 1942, agus chun críocha an Achta nó na nAcht i dtaobh bainistí aon chontae-bhuirge, rún a rith faoin alt seo.
(4) Mí ar a laghad nó dhá mhí ar a mhéid roimh rún a rith faoin alt seo déanfar fógra i scríbhinn go bhfuiltear ar intinn an rún a thairiscint do thabhairt don Aire iomchuí agus—
(a) i gcás bardais chontae-bhuirge, do gach comhalta de chomhairle na buirge, nó
(b) in aon chás eile, do gach comhalta den údarás áitiúil.
(5) Má ritheann údarás áitiúil rún faoin alt seo á chinneadh go nglacfaid le Cuid III den Acht seo amhail ar dháta sonraithe agus uaidh sin amach, tiocfaidh an Chuid sin, agus an dearbhú sa rún ar an méid uasta daoine atá le bheith, aon tráth áirithe, i bhfostaíocht an údaráis áitiúil, i bhfeidhm maidir leo ar an dáta sin.
(6) Tiocfaidh Cuid III den Acht seo i ngníomh mar foráltar le fo-alt (5) den alt seo agus ní ar aon tslí eile.
(7) Ní fholaíonn tagairt i gCuid III den Acht seo d'údarás áitiúil tagairt d'aon údarás áitiúil ná beidh an Chuid sin tar éis teacht i ngníomh maidir leo.
(8) Ní bheidh d'éifeacht le tosach feidhme Coda III den Acht seo maidir le húdarás áitiúil go dtabharfaidh sé feidhm d'alt 53 d'Acht 1925 maidir leis an údarás áitiúil sin.
Costais an Aire.
6.—Na costais faoina raghaidh aon Aire ag riaradh an Achta seo déanfar, a mhéid a cheadós an tAire Airgeadais, iad d'íoc as airgead a sholáthrós an tOireachtas.
Athghairm.
7.—Déantar leis seo na hachtacháin a luaitear sa Sceideal a ghabhas leis an Acht seo d'athghairm a mhéid a sonraítear sa tríú colún den Sceideal sin.
CUID II.
Oifigigh Bhunaithe.
Clár d'oifigigh bhunaithe.
8.—(1) Coimeádfaidh údarás áitiúil clár ar a dtabharfar an clár d'oifigigh bhunaithe (dá ngairmtear an clár sa Chuid seo den Acht seo).
(2) Má thagann duine chun bheith ina oifigeach inphinsin d'údarás áitiúil, iontrálfaidh an t-údarás áitiúil a ainm sa chlár.
(3) Má éiríonn aon amhras, díospóid nó ceist i dtaobh ó a bheith ceart ainm duine áirithe d'iontráil sa chlár, is é an tAire iomchuí a chinnfeas an t-amhras, an díospóid nó an cheist agus beidh a chinneadh sin ina chinneadh críochnaitheach.
(4) Ní dhéanfaidh údarás áitiúil ainm aon duine d'iontráil sa chlár ach amháin do réir an ailt seo.
(5) Déanfaidh údarás áitiúil an clár a choimeád ar oscailt ina bpríomh-oifig gach tráth réasúnach chun a iniúchta ag a n-oifigigh agus—
(a) i gcás bardais bhuirge, ag comhaltaí comhairle na buirge, nó
(b) in aon chás eile, ag comhaltaí an údaráis áitiúil.
Tuarastail, sochair oifige, agus oifigí a chur ar taifead sa chlár.
9.—(1) Cuirfidh údarás áitiúil ar taifead ó am go ham sa chlár, maidir le hainm gach oifigigh bhunaithe ann,—
(a) a thuarastal agus an luach bliantúil in airgead atá ar a shochar oifige (más ann) arna chinneadh faoi alt 35 den Acht seo,
(b) sonraí ar gach oifig ina sheilbh fúthu sin nó faoi aon údarás áitiúil eile.
Duine a scoirfeas de bheith ina oifigeach inphinsin a bhaint den chlár.
10.—(1) Bainfidh údarás áitiúil den chlár ainm aon duine a scoirfeas de bheith ina oifigeach inphinsin don údarás áitiúil sin.
(2) Féadfar ainm a bhaint den chlár trí nóta a chur sa chlár á rá go bhfuiltear tar éis an ainm a bhaint de agus an dáta a baineadh de í agus féadfar ainm a chur thar n-ais sa chlár trí nóta chur sa chlár á rá go bhfuiltear tar éis an ainm a chur thar n-ais agus an dáta a cuireadh thar n-ais í.
(3) Duine ar bith ar cúis mhí-shásaimh leis údarás áitiúil do bhaint a ainme den chlár, féadfaidh sé achomharc a dhéanamh chun an Aire iomchuí i gcoinne a ainm a bhaint de agus féadfaidh an tAire sin, le hordú, diúltú don achomharc nó a ordú an ainm a chur thar n-ais sa chlár agus, sa chás deiridh sin, cuirfidh an t-údarás áitiúil an ainm thar n-ais sa chlár.
(4) Beidh cinneadh an Aire iomchuí ar achomharc faoin alt seo ina chinneadh críochnaitheach.
Eolas a thabhairt d'údarás áitiúil ar dhuine do scor de bheith i seilbh oifige faoi údarás áitiúil eile.
11.—Má scoireann oifigeach bunaithe d'údarás áitiúil d'aon oifig a shealbhú fúthu, cuirfid é sin in iúl d'aon údarás áitiúil eile faoina mbeidh aon oifig ar seilbh ag an oifigeach sin.
Gan feidhm a bheith ag achtacháin láithreacha áirithe maidir le hoifigeach bunaithe.
12.—Na forála d'aon Acht, poiblí nó áitiúil (seachas an tAcht seo), trína gcumasaítear d'údarás áitiúil liúntas nó aisce a dheonadh do dhuine ar bith ina seirbhís ar é do scor de bheith i seilbh a phoist, ní bheidh feidhm acu maidir le haon oifigeach bunaithe don údarás áitiúil sin.

13.—(1) Aon fhoráil sa Chuid seo den Acht seo a bheir teideal d'oifigeach bunaithe aon tréimhse d'áireamh mar sheirbhís, beidh sí faoi réir an choinníll sháraithigh nach mbeidh sé i dteideal aon tréimhse acu seo a leanas d'áireamh amhlaidh:—
(a) aon tréimhse a mbeidh cnapshuim, liúntas nó aisce faighte aige cheana ina leith faoin Acht seo nó faoi aon Acht eile a bhaineas le haoisliúntas nó faoi aon scéim maidir le haoisliúntas arna déanamh faoi aon Acht,
(b) aon tréimhse roimh ocht mbliana déag d'aois a bheith slán aige,
(c) aon tréimhse a mbeifear tar éis aon ranníocaíochta ina leith a thabhairt thar n-ais dó faoi alt 32 den Acht seo, mura mbeidh sé tar éis na ranníocaíochta sin d'aisíoc faoi alt 33 den Acht seo,
(d) aon tréimhse a mbeifear tar éis aon ranníocaíochta ina leith a thabhairt thar n-ais dó faoi alt 57 den Acht seo,
(e) aon tréimhse roimh dháta a cuireadh as oifig faoi údarás áitiúil é de dheasca mí-iompair nó neamhoiriúnachta,
(f) aon tréimhse roimh dháta a fhanfas sé as láthair go toiliúil ón áit ina mbíonn a dhualgais á ndéanamh aige nó a staonfas sé óna dhualgais a dhéanamh chun a thabhairt ar an údarás áitiúil darb oifigeach é a thuarastal nó a choinníollacha seirbhíse d'athrú nó chun a thabhairt ar aon údarás áitiúil eile tuarastail, páigh nó coinníollacha seirbhíse aon oifigeach nó seirbhíseach dá gcuid d'athrú.
(2) Más rud é, ag féachaint do mhír (f) d'fho-alt (1) den alt seo, go gcaillfidh oifigeach d'údarás áitiúil tréimhse sheirbhíse—
(a) déanfaidh an t-údarás áitiúil fógra i scríbhinn i dtaobh a cailliúna a thabhairt don oifigeach,
(b) féadfaidh an t-oifigeach, tráth nach déanaí ná mí tar eis an fógra sin a thabhairt dó, achomharc a dhéanamh chun an Aire iomchuí i gcoinne na cailliúna,
(c) féadfaidh an tAire iomchuí, le hordú, diúltú don achomharc nó a dhearbhú go dtabharfar thar n-ais iomlán na tréimhse seirbhíse nó cuid di agus, sa chás deiridh sin, beidh éifeacht ag an mír sin (f) faoi réir an dearbhuithe,
(d) beidh cinneadh an Aire iomchuí ar an achomharc ina chinneadh críochnaitheach.
Seirbhís mar oifigeach bunaithe.
14.—Beidh oifigeach bunaithe d'údarás áitiúil i dteideal na tréimhsí seo a leanas d'áireamh mar sheirbhís—
(a) aon tréimhse a chaith sé ina oifigeach bunaithe don údarás áitiúil sin,
(b) aon tréimhse de dhá bhliain nó níos mó a chaith sé ina oifigeach bunaithe d'aon údarás áitiúil eile,
(c) aon tréimhse faoi bhun dhá bhliain a chaith sé ina oifigeach bunaithe d'aon údarás áitiúil eile agus ar éirigh sé as oifig ar í a bheith thart le cead i scríbhinn ón údarás áitiúil eile sin agus le toiliú an Aire iomchuí.
Seirbhís oifigigh bhunaithe mar oifigeach nó seirbhíseach d'ospidéal meabhair-ghalar.
15.—(1) Beidh oifigeach bunaithe i dteideal na tréimhsí seo a leanas d'áireamh mar sheirbhís—
(a) aon tréimhse de dhá bhliain nó níos mó a chaith sé ina oifigeach nó ina sheirbhíseach d'ospidéal meabhairghalar agus a bhí sé i dteideal d'áireamh mar sheirbhís chun críocha Coda VIII den Acht Cóireála Meabhair-Ghalar, 1945 (Uimh. 19 de 1945), nó aon achtacháin roimhe sin atá i gcomhréir leis an gCuid sin VIII, agus
(b) aon tréimhse faoi bhun dhá bhliain a chaith sé ina oifigeach nó ina sheirbhíseach d'ospidéal meabhairghalar agus a bhí sé i dteideal d'áireamh mar sheirbhís chun críocha Coda VIII den Acht Cóireála Meabhair-Ghalar, 1945 (Uimh. 19 de 1945), nó aon achtacháin roimhe sin atá i gcomhréir leis an gCuid sin VIII agus ar éirigh sé as a oifig nó ar scar sé lena fhostaíocht ar í a bheith thart le cead i scríbhinn ón údarás ospidéil mheabhair-ghalar faoina raibh sé i seilbh a oifige nó a fhostaíochta agus le toiliú an Aire Shláinte,
mura rud é, má rinne sé ranníocaíochta ar feadh na tréimhse chun críocha na Coda sin VIII nó an achtacháin sin roimhe sin, gur haisíocadh na ranníocaíochta sin leis agus nár thug sé thar n-ais iad.
(2) Ní bheidh feidhm ag alt 91 den Acht Cóireála Meabhair-Ghalar, 1945, maidir le hoifigeach bunaithe.

16.—Beidh oifigeach bunaithe i dteideal aon tréimhse d'áireamh mar sheirbhís a chaith sé i seilbh poist inphinsin i seirbhís údaráis chuain.
Seirbhís mar mhúinteoir scoile.
17.—Beidh oifigeach bunaithe do choiste gairm-oideachais i dteideal aon tréimhse d'áireamh mar sheirbhís a ceadaítear dó d'áireamh le rialacháin faoi alt 72 den Acht seo.
Seirbhís sa stát-sheirbhís.
18.—I gcás—
(a) oifigeach bunaithe d'údarás áitiúil a bheith i seilbh poist bhunaithe sa stát-sheirbhís díreach roimh é a cheapadh ina oifigeach inphinsin d'údarás áitiúil, agus
(b) an tAire Airgeadais do thoiliú le feidhm a thabhairt don alt seo maidir leis, agus
(c) gan an t-údarás áitiúil ar chun a seirbhíse a ceapadh é do dhiúltú tráth an cheaptha sin toiliú le feidhm a thabhairt don alt seo maidir leis.
beidh an t-oifigeach i dteideal a sheirbhís chun críocha na nAcht Aoisliúntas roimh dháta an cheaptha sin d'áireamh mar sheirbhís.
Seirbhís mar sheirbhíseach inphinsin.
19.—(1) Beidh oifigeach bunaithe do bhardas contae-bhuirge Bhaile Atha Cliath i dteideal aon tréimhse d'áireamh mar sheirbhís is tréimhse leanúnach dar críoch an lá a chéad-tháinig sé chun bheith ina oifigeach inphinsin don bhardas sin agus a chaith sé ina sheirbhíseach inphinsin don bhardas sin.
(2) Beidh oifigeach bunaithe do bhardas buirge Dhún Laoghaire i dteideal aon tréimhse d'áireamh mar sheirbhís is tréimhse leanúnach dar críoch an lá a chéad-tháinig sé chun bheith ina oifigeach inphinsin don bhardas sin agus a chaith sé ina sheirbhíseach inphinsin don bhardas sin.
(3) Ní tuigthe duine a bheith, chun críocha fo-ailt (1) nó (2) den alt seo, ina sheirbhíseach inphinsin do bhardas ar feadh tréimhse mura raibh sé ar feadh na tréimhse sin ina sheirbhíseach bunaithe don bhardas nó cláraithe sa chlár de bhuan-fhostaithe a bhí á choimeád acu i dtosach feidhme na Coda seo den Acht seo.
(4) Beidh oifigeach bunaithe i dteideal aon tréimhse d'áireamh mar sheirbhís is tréimhse leanúnach a chríochnaigh nuair a chéadtháinig sé chun bheith ina oifigeach bunaithe d'aon údarás áitiúil agus a chaith sé ina sheirbhíseach bunaithe d'aon údarás áitiúil.
Seirbhís áitiúil inphinsin oifigigh bhunaithe.
20.—(1) Chun críocha an Achta seo, is í seirbhís áitiúil inphinsin oifigigh bhunaithe tráth ar bith ná an uimhir de bhlianta iomlána sa tréimhse, nó i gcomhshuim na dtréimhsí, a bheas sé i dteideal an tráth sin, faoin gCuid seo den Acht seo, d'áireamh mar sheirbhís, gan aon chorr-chodán de bhliain iomlán a chur san áireamh.
(2) D'ainneoin fo-ailt (1) den alt seo, más aon agus fiche nó níos mó ná sin an uimhir de bhlianta iomlána a bheas sa tréimhse, nó i gcomhshuim na dtréimhsí, a bheas oifigeach briogáide tóiteáin i dteideal d'áireamh mar sheirbhís faoin gCuid seo den Acht seo, gan aon chorr-chodán de bhliain iomlán a chur san áireamh, ansin, chun críocha na Coda seo den Acht seo, is í seirbhís áitiúil inphinsin an oifigigh sin ná an uimhir sin de bhlianta i dteannta na breise a bheas ag an uimhir sin de bhlianta ar fiche bliain.

21.—(1) Má bhíonn deich mbliana ar a laghad de sheirbhís áitiúil inphinsin ag oifigeach bunaithe d'údarás áitiúil agus—
(a) go gcuirfear as a oifig é ar chúis seachas mí-iompar nó neamhoiriúnacht,
(b) go gcuirfear deireadh lena oifig, nó
(c) gur dóigh leis an Aire iomchuí a phost a bheith athraithe go abhartha chun dochair dó trí athruithe a bheith déanta ar choinníollacha an phoist gan cúis réasúnach, agus go n-éireoidh sé as a oifig le toiliú an Aire iomchuí,
cuirfidh an t-údarás áitiúil lena sheirbhís áitiúil inphinsin pé uimhir de bhlianta breise a cheadós an tAire ach nach mó ná—
(i) i gcás fiche bliain nó níos mó de sheirbhís áitiúil inphinsin a bheith aige—deich mbliana sa bhreis,

(2) I gcás—
(a) ina scoirfidh oifigeach bunaithe d'údarás áitiúil, a mbeidh deich mbliana ar a laghad de sheirbhís áitiúil inphinsin aige, de bheith i seilbh a oifige ar shlí seachas trína chur as oifig de dheasca a mhí-iompair nó a neamhoiriúnachta dá oifig agus in imthosca de shórt nach mbeidh feidhm ag fo-alt (1) den alt seo, agus
(b) inar dóigh leis an údarás áitiúil fátha speisialta a bheith ann a bheir gur cóir blianta a chur lena sheirbhís áitiúil inphinsin,
féadfaidh an t-údarás áitiúil, más oiriúnach leo, uimhir de bhlianta breise nach mó ná deich a chur, le toiliú an Aire, lena sheirbhís áitiúil inphinsin.
Seirbhís oifigigh bhunaithe ar a oifig d'fhorceannadh.
22.—Chun críocha na Coda seo den Acht seo, is í seirbhís oifigigh bhunaithe ar a oifig d'fhorceannadh ná a sheirbhís áitiúil inphinsin i dteannta aon bhlianta breise a cuirfear léi faoi alt 21 den Acht seo.
Cnapshuim agus liúntas a dheonadh d'oifigeach bunaithe ar é do scor de bheith i seilbh oifige.
23.—(1) Más rud é—
(a) go gcoirfidh oifigeach bunaithe d'údarás áitiúil de bheith i seilbh a oifige agus nach gceapfar chun oifige inphinsin eile é faoi údarás áitiúil ná chun bheith ina oifigeach chun críocha Coda VIII den Acht Cóireála Meabhair-Ghalar, 1945 (Uimh. 19 de 1945), agus
(b) gur dóigh leis an údarás áitiúil gur fhónaigh sé i gcoitinne san oifig sin go dícheallach dílis agus chun a sástachta nó, mura dóigh leo sin, go gcinnfid mar sin féin gur ceart, in imthosca speisialta a cháis, cnapshuim agus liúntas laghdaithe a dheonadh dhó,
deonfaidh an t-údarás áitiúil cnapshuim agus liúntas dó in aon chás dá sonraítear i bhfo-alt (2) den alt seo.
(2) Is iad seo a leanas na cásanna dá dtagartar i bhfo-alt (1) den alt seo:—
(a) i gcás an t-oifigeach do scor de bheith i seilbh a oifige ar shlí seachas trína chur as oifig agus—
(i) seasca bliain d'aois a bheith slán aige agus fiche bliain ar a laghad de sheirbhís áitiúil inphinsin a bheith aige,
(ii) é a bheith ina oifigeach briogáide tóiteáin, cúig bliana caogad d'aois a bheith slán aige agus fiche bliain ar a laghad de sheirbhís áitiúil inphinsin a bheith aige, nó
(iii) é a bheith éagumasach ar a dhualgais a chomhlíonadh de dheasca buan-éiglíochta meabhrach nó coirp agus deich mbliana ar a laghad de sheirbhís áitiúil inphinsin a bheith aige;
(b) i gcás an t-oifigeach a chur as a oifig ar chúis seachas mí-iompar nó neamhoiriúnacht agus deich mbliana ar a laghad de sheirbhís áitiúil inphinsin a bheith aige;
(c) i gcás deireadh a chur le hoifig an oifigigh agus deich mbliana ar a laghad de sheirbhís áitiúil inphinsin a bheith aige;
(d) i gcás inar dóigh leis an Aire iomchuí post an oifigigh a bheith athraithe go habhartha chun dochair dó trí athruithe a bheith déanta ar choinníollacha an phoist gan cúis réasúnach, agus é d'éirí as a oifig le toiliú an Aire iomchuí agus deich mbliana ar a laghad de sheirbhís áitiúil inphinsin a bheith aige;
(e) i gcás an t-oifigeach do scor de bheith i seilbh a oifige toisc an teora aoise chuige sin a bheith sroichte aige agus deich mbliana ar a laghad de sheirbhís áitiúil inphinsin a bheith aige.
An chnapshuim a deonfar d'oifigeach bunaithe a chinneadh.
24.—Is é méid na cnapshuime a deonfar faoi alt 23 den Acht seo d'oifigeach bunaithe ná méid is ionann agus—
(a) an tríochadú cuid dá luach saothair inphinsin arna iolrú faoin uimhir de bhlianta seirbhíse a bheas aige ar a oifig d'fhorceannadh, nó
(b) oiread go leith a luach saothair inphinsin,
pé acu sin is lú.
An liúntas a deonfar d'oifigeach bunaithe a chinneadh.
25.—Is é liúntas a deonfar d'oifigeach bunaithe faoi alt 23 den Acht seo ar é do scor de bheith i seilbh oifige ná—
(a) liúntas do réir ráta sa bhliain is comhionann leis an ochtódú cuid dá luach saothair inphinsin arna iolrú faoin uimhir de bhlianta seirbhíse a bheas aige ar a oifig d'fhorceannadh, nó
(b) liúntas do réir ráta sa bhliain is comhionann le leath a luach saothair inphinsin,
pé acu sin is lú.
Cnapshuim agus liúntas oifigigh bhunaithe a laghdú mar gheall ar sheirbhís neamhshásúil.
26.—Má chinneann údarás áitiúil, faoi alt 23 den Acht seo, gur cnapshuim agus liúntas laghdaithe a deonfar d'oifigeach bunaithe, déanfaid méid na cnapshuime agus ráta bliantúil an liúntais a deonfar dó faoi alt 23 den Acht seo a laghdú faoi bhun an méid agus an ráta dob iomchuí dhó sin faoi ailt 24 agus 25 den Acht seo agus oiread nach lú ná caoga faoin gcéad.
Aisce ghearrsheirbhíse a dheonadh d'oifigeach bunaithe.
27.—I gcás oifigeach bunaithe d'údarás áitiúil, a mbeidh bliain ar a laghad agus faoi bhun deich mblian de sheirbhís áitiúil inphinsin aige, do scor de bheith i seilbh a oifige toisc é a bheith éagumasach ar a dhualgais a chomhlíonadh de dheasca buanéiglíochta meabhrach nó coirp, deonfaidh an t-údarás áitiúil aisce dhó de pé méid is dóigh leo is ceart ach nach mó ná an dóú cuid déag dá luach saothair inphinsin arna iolrú faoin uimhir de bhlianta de sheirbhís áitiúil inphinsin a bheas aige.
Aisce a dheonadh d'ionadaí dlíthiúil pearsanta oifigigh bhunaithe mhairbh.
28.—(1) I gcás oifigeach bunaithe d'údarás áitiúil d'fháil bháis i seilbh oifige agus cúig bliana ar a laghad de sheirbhís áitiúil inphinsin aige, deonfaidh an t-údarás áitiúil dá ionadaí dlíthiúil pearsanta aisce de mhéid is ionann agus—
(a) an tríochadú cuid dá luach saothair inphinsin arna iolrú faoin uimhir (nach mó ná cúig ceathrachad) de na blianta sin de sheirbhís áitiúil inphinsin, nó
(b) a luach saothair inphinsin,
pé acu sin is mó.
(2) I gcás oifigeach bunaithe d'údarás áitiúil d'fháil bháis i seilbh oifige agus bliain ar a laghad agus faoi bhun chúig bliana de sheirbhís áitiúil inphinsin aige, deonfaidh an t-údarás áitiúil dá ionadaí dlíthiúil pearsanta aisce de pé méid is dóigh leo is ceart ach nach mó ná an dóú cuid déag dá luach saothair inphinsin arna iolrú faoin uimhir de bhlianta de sheirbhís áitiúil inphinsin a bheas aige.
Aisce a dheonadh faoi alt 23 d'ionadaí dlíthiúil pearsanta deonaí mhairbh.
29.—I gcás duine dob oifigeach bunaithe d'údarás áitiúil agus dar deonadh, faoi alt 23 den Acht seo, cnapshuim agus liúntas ar é do scor de bheith i seilbh oifige, d'fháil bháis sar a mbeidh iomlán na suimeanna a gheobhaidh sé ar scór na cnapshuime agus an liúntas comhionann lena luach saothair inphinsin, deonfaidh an t-údarás áitiúil dá ionadaí dlíthiúil pearsanta aisce is comhionann leis an difríocht idir an méid iomlán sin agus an luach saothair inphinsin sin.
Aisce a dheonadh do bhan-oifigeach bunaithe ar phósadh dhi.
30.—Má scoireann ban-oifigeach bunaithe d'údarás áitiúil, a mbeidh cúig bliana ar a laghad de sheirbhís áitiúil inphinsin aici, de bheith i seilbh a hoifige toisc í a phósadh nó a bheith chun pósadh agus go ndéanfaidh sí, roimh trí mhí a bheith caite tar éis an scoir sin, deimhniú pósta a thabhairt ar aird don údarás áitiúil á chruthú gur pósadh í, beidh éifeacht ag na forála seo a leanas:—
(a) más dóigh leis an údarás áitiúil gur fhónaigh sí ina hoifig go dícheallach dílis agus chun a sástachta, deonfaidh an t-údarás áitiúil aisce dhi de mhéid is ionann agus—
(i) an dóú cuid déag dá luach saothair inphinsin arna iolrú faoin uimhir de bhlianta seirbhíse áitiúla inphinsin a bheas aici, nó
(ii) a luach saothair inphinsin,
pé acu sin is lú;
(b) má dhéanann an t-údarás áitiúil, bíodh nach dóigh leo gur fhónaigh sí ina hoifig go dícheallach dílis agus chun a sástachta, a chinneadh mar sin féin gur ceart, in imthosca speisialta an cháis, aisce laghdaithe a dheonadh di, deonfaid aisce dhi de mhéid is comhionann leis an méid dob iomchuí faoi mhír (a) den alt seo arna laghdú an oiread sin, nach lú ná caoga faoin gcéad, is dóigh leo is ceart.
Ranníocaíochta ó oifigigh bhunaithe.
31.—(1) Déanfaidh oifigeach bunaithe d'údarásá itiúil ranníocaíocht leis an údarás áitiúil sin chun críocha na Coda seo den Acht seo do réir ráta sa bhliain is ionann agus cúig faoin gcéad—
(a) dá thuarastal bliantúil, agus
(b) de luach bliantúil, arna chinneadh faoi alt 35 den Acht seo, a shochair oifige, más ann.
(2) An ranníocaíocht a bheas le déanamh ag oifigeach bunaithe d'údarás áitiúil faoin alt seo, féadfaidh an t-údarás áitiúil sin í d'fháil trí asbhaintí tréimhsiúla as a thuarastal, ach, mura ndéantar aon asbhaint den tsórt sin is dligh d'údarás áitiúil a dhéanamh as a thuarastal, féadfaidh an t-údarás áitiúil sin, gan dochar d'aon leigheas eile, an tsuim d'aisgabháil trína coimeád as aon tsuimeanna a bheas dlite uathu dhó nó as aon chnapshuim nó liúntas is iníoctha acu leis nó ina leith.
(3) Más rud é, faoi alt 64 den Acht seo, go mbeidh cnapshuimeanna, liúntais nó aiscí a dheonfas údarás áitiúil iníoctha ag údarás áitiúil eile, aistreoidh an t-údarás áitiúil céadluaite sin ó am go ham (ach uair sa ráithe ar a laghad) chun an údaráis áitiúil eile—
(a) más coiste gairm-oideachais an t-údarás áitiúil céadluaite—leath na suimeanna uile a fuaireadar i bhfoirm ranníocaíochta faoin alt seo,
(b) in aon chás eile—iomlán na suimeanna sin uile.
Ranníocaíochta ó oifigeach bunaithe a thabhairt thar n-ais.
32.—(1) Sa Chuid seo den Acht seo, ciallaíonn an abairt “na ranníocaíochta,” maidir le hoifigeach bunaithe, a gcomhshuim seo a leanas—
(a) aon ranníocaíochta a bheas déanta aige faoi alt 31 den Acht seo,
(b) i gcás aon ranníocaíochta a bheith déanta aige faoi alt 56 den Acht seo, na ranníocaíochta sin,
(c) i gcás ranníocaíochta a bheith déanta aige faoi alt 85 den Acht Cóireála Meabhair-Ghalar, 1945 (Uimh. 19 de 1945), na ranníocaíochta sin,
(d) i gcás ranníocaíochta a bheith déanta aige faoin Asylum Officers' Superannuation Act, 1909, na ranníocaíochta sin,
ach gan áireamh a dhéanamh ar aon ranníocaíochta acu sin a bheas tugtha thar n-ais dó agus ná beidh aisíoctha aige.
(2) Má scoireann oifigeach bunaithe d'údarás áitiúil, a mbeidh deich mbliana ar a laghad de sheirbhís áitiúil inphinsin aige, de bheith i seilbh a oifige ar aon chúis seachas mí-iompar agus nach ndeonfar aisce faoi alt 28 den Acht seo dhó, bhéarfaidh an t-údarás áitiúil na ranníocaíochta thar n-ais dó.
(3) I gcás oifigeach bunaithe d'údarás áitiúil, a mbeidh níos lú ná bliain de sheirbhís áitiúil inphinsin aige, d'fháil bháis, bhéarfaidh an t-údarás áitiúil na ranníocaíochta thar n-ais dá ionadaí dlíthiúil pearsanta.
(4) Má scoireann oifigeach bunaithe d'údarás áitiúil, a mbeidh deich mbliana ar a laghad de sheirbhís áitiúil inphinsin aige, de bheith i seilbh a oifige ar aon chúis seachas mí-iompar, agus nach nglacfaidh sé aon oifig inphinsin eile faoi údarás áitiúil agus nach mbeidh teideal aige chun cnapshuime agus liúntais faoi alt 23 den Acht seo ná chun aisce phósta d'fháil faoi alt 30 den Acht seo, bhéarfaidh an t-údarás áitiúil na ranníocaíochta thar n-ais dó.
(5) Má cuirtear oifigeach bunaithe d'údarás áitiúil as a oifig de dheasca mí-iompair, féadfaidh an t-údarás áitiúil, más dóigh leo go bhfuil fátha speisialta ann chun déanamh amhlaidh, na ranníocaíochta a thabhairt thar n-ais dó.
(6) Má thugann údarás áitiúil na ranníocaíochta thar n-ais agus go mbeidh sa mhéid a bhéarfar thar n-ais suim i leith ranníocaíocht a rinne an t-oifigeach a bheas i gceist agus atá ar seilbh ag údarás áitiúil eile nó ag bord ospidéil mheabhairghalar, íocfaidh an t-údarás nó an bord sin an tsuim sin thar n-ais leis an údarás áitiúil a thug na ranníocaíochta thar n-ais.
(7) Beidh feidhm, maidir le ranníocaíochta a bhéarfar thar n-ais faoin alt seo, ag an bproviso atá ag gabháil le fo-alt (1) d'alt 31 den Finance Act, 1922.
Ranníocaíochta a tugadh thar n ais d'aisíoc.
33.—Más rud é, tar éis na ranníocaíochta a bheith tugtha thar n-ais faoi alt 32 den Acht seo d'oifigeach bunaithe d'údarás áitiúil ar é do scor de bheith ina oifigeach bunaithe, go mbeidh sé arís ina oifigeach bunaithe d'údarás áitiúil de bhuaidh a cheaptha iardain, beidh teideal aige, roimh dheireadh (ach ní bheidh tar éis deireadh) dhá mhí dhéag i ndiaidh an cheaptha iardain, an tsuim sin d'aisíoc leis an údarás áitiúil céadluaite a thugadar thar n-ais dó amhlaidh ionas go mbeidh ináirmhe aige mar sheirbhís áitiúil inphinsin an tréimhse sheirbhíse den tsórt sin a bhí aige roimh an scor sin agus, má aisíocann sé an tsuim sin agus go ndearna aon údarás áitiúil eile nó aon bhord ospidéil mheabhair-ghalar aon chuid di d'íoc thar n-ais, déanfaidh an t-údarás áitiúil céadluaite an méid a híocadh thar n-ais d'aisíoc leis an údarás áitiúil eile nó leis an mbord ospidéil mheabhairghalar.
Ciall an fhocail “tuarastal.”
34.—(1) Sa Chuid seo den Acht seo, is é ciall atá leis an bhfocal “tuarastal”—
(a) ní fholaíonn sé aon ní acu seo a leanas:—
(i) íocaíochta i leith breisaimsire,
(ii) costais taistil ná liúntais eile in aghaidh costas áirithe,
(iii) íocaíochta as gníomhú mar chléireach do choiste pinsean áitiúil faoi alt 8 den Old Age Pensions Act, 1908, nó d'fho-choiste arna cheapadh ag aon choiste den tsórt sin,
(iv) íocaíochta as gníomhú mar ard-chláraitheoir breitheanna, básanna agus póstaíocha nó mar chláraitheoir póstaíocha,
(v) íocaíochta as obair speisialta chorr-aimsireach nó shealadach nó as post a líonadh go sealadach nó mar ionadaí go dtí go ndéanfar buancheapachán;
(b) faoi réir míre (a) den fho-alt seo, folaíonn sé gach uile tháille, puntáiste agus íocaíocht eile airgid a bhéarfar chun a úsáide féin d'oifigeach i gcáil oifigigh dó.
(2) Féadfaidh an tAire, más oiriúnach leis, a ordú le hordú, maidir le híocaíochta de shaghas sonraithe is saghas a luaitear i bhfo-mhír (i) nó (v) de mhír (a) d'fho-alt (1) den alt seo, go mbeid, chun críocha na Coda seo den Acht seo, ina gcuid de thuarastal oifigigh áirithe nó de thuarastal gach oifigigh agus air sin, d'ainneoin fo-ailt (1) den alt seo, folóidh an focal “tuarastal” sa Chuid seo den Acht seo, maidir leis an oifigeach sin nó le gach oifigeach (do réir mar is iomchuí), íocaíochta den tsaghas sin.
Luach saothair inphinsin oifigigh bhunaithe a ríomh.
35.—(1) Cinnfidh údarás áitiúil, ó am go ham agus aon uair a ordós an tAire amhlaidh, an luach bliantúil in airgead atá ar gach ceann (más ann) de shochair oifige oifigigh bhunaithe agus coimeádfaid ar taispeáint, i ngach oifig nó foras a bheas á chothabháil acu agus in áit fheiceálach a mbeidh teacht air ag a n-oifigigh, liosta de na luacha a cinnfear amhlaidh do shochair oifige na n-oifigeach bunaithe a bheas ar fostú san oifig nó uaithi nó san bhforas sin nó uaidh.
(2) Ní foláir cinneadh faoi fho-alt (1) den alt seo a bheith ceadaithe ag an Aire.
(3) Má bhíonn oifigeach bunaithe ag fáil ráta áirithe tuarastail aon lá faoi leith, is é is luach saothair inphinsin dó chun críocha na Coda seo den Acht seo an lá sin ná—
(a) mura lú ná trí bliana an tréimhse, nó comhshuim na dtréimhsí, a bheas sé i dteideal faoin gCuid seo den Acht seo d'áireamh mar sheirbhís—
(i) más rud é, ar feadh iomlán na tréimhse nó na dtréimhsí arb í nó arb iad na trí bliana deiridh den tréimhse nó de chomhshuim na dtréimhsí a bheas sé i dteideal, faoin gCuid seo den Acht seo, d'áireamh mar sheirbhís, go raibh sé ag fáil tuarastail do réir an ráta áirithe sin nó go raibh sé sa ghrád céanna oifigeach—an méid tuarastail a gheobhadh sé i mbliain arna áireamh do réir an ráta áirithe sin, nó
(ii) in aon chás eile—tríú cuid de chomhshuim na méideanna a fuair sé i bhfoirm tuarastail ar feadh na tréimhse nó na dtréimhsí sin arb í nó arb iad na trí bliana sin, nó, mura raibh sé ar lán-tuarastal ar feadh iomlán na tréimhse nó na dtréimhsí sin, an tríú cuid de chomhshuim na méideanna a gheobhadh sé amhlaidh dá mbeadh sé ar lántuarastal ar feadh iomlán na tréimhse nó na dtréimhsí sin, nó
(b) i gcás inar lú ná trí bliana an tréimhse nó comhshuim na dtréimhsí a bheas sé i dteideal, faoin gCuid seo den Acht seo, d'áireamh mar sheirbhís—
(i) más rud é, ar feadh iomlán na tréimhse nó na dtréimhsí sin, go raibh sé ag fáil tuarastail do réir an ráta áirithe sin nó go raibh sé sa ghrád céanna oifigeach—an méid tuarastail a gheobhadh sé i mbliain arna ríomh do réir an ráta áirithe sin, nó
(ii) in aon chás eile—meánaíocht mhíosúil, arna hiolrú faoi dhó dhéag, na méideanna a fuair sé i bhfoirm tuarastail ar feadh na tréimhse nó na dtréimhsí sin nó, mura raibh sé ar lántuarastal ar feadh iomlán na tréimhse nó na dtréimhsí sin, meánaíocht mhíosúil, arna hiolrú faoi dhó dhéag, na méide a gheobhadh sé amhlaidh dá mbeadh sé ar lán-tuarastal ar feadh iomlán na tréimhse nó na dtréimhsí sin,
maraon leis an luach bliantúil, arna chinneadh an tráth sin faoi fho-alt (1) den alt seo, ar a shochar oifige, más ann.

36.—(1) Beidh oifigeach bunaithe do choiste gairm-oideachais i dteideal aon tréimhse d'áireamh mar sheirbhís is tréimhse, maidir leis an oifigeach sin, a mbaineann an t-alt seo léi.
(2) Aon tréimhse—
(a) a thosnaigh tar éis oifigeach bunaithe do choiste gairmoideachais do shlánú bliain agus fiche d'aois agus a chríochnaigh roimh an 31ú Iúil, 1924, agus
(b) ar deimhin leis an Aire Oideachais ina taobh go ndearna an t-oifigeach sin ar feadh iomlán na tréimhse sin a chuid ama ar fad a thabhairt faoi stiúrú Chonradh na Gaeilge do mhúineadh na Gaeilge nó d'eagrú a múinte,
beidh sí, maidir leis an oifigeach sin, ina tréimhse lena mbaineann an t-alt seo má bhíonn cúig bliana nó níos mó d'fhaid inti nó más ceann í de dhá thréimhse nó níos mó den tsórt sin adúradh a bhfuil cúig bliana nó níos mó d'fhaid ina n-iomlán.

37.—(1) Más rud é, i dtosach feidhme na Coda seo den Acht seo, gur oifigeach inphinsin d'údarás áitiúil duine agus, ar an 1ú lá d'Eanáir, 1947, nach raibh slán aige—
(a) más oifigeach briogáide tóiteáin é, cúig bliana caogad d'aois, nó
(b) in aon chás eile, seasca bliain d'aois,
féadfaidh sé, laistigh de shé mhí ar a fhaid tar éis tosach feidhme na Coda seo den Acht seo, a iarraidh i scríbhinn ar an údarás áitiúil a ainm d'iontráil sa chlár agus air sin iontrálfaidh an t-údarás áitiúil a ainm sa chlár agus beidh éifeacht ag an iontráil amhail is dá ndéantaí é i dtosach feidhme na Coda seo den Acht seo.
(2) Más rud é, i dtosach feidhme na Coda seo den Acht seo, gur oifigeach inphinsin d'údarás áitiúil duine, ní hiontrálfar a ainm i gclár aon údaráis áitiúil mura faoi fho-alt (1) den alt seo a déanfar an iontráil nó mura tar éis a ainm d'iontráil faoin bhfo-alt sin a déanfar sin.
(3) Duine ar bith a n-iontrálfar a ainm faoi fho-alt (1) den alt seo beidh teideal aige go n-áireofaí mar sheirbhís an tseirbhís a bheas aige i dtosach feidhme na Coda seo den Acht seo chun críocha Coda IV d'Acht 1925 nó chun críocha aon Achta den tsórt sin a ritheadh roimh Acht 1925 agus a bhaineas le haoisliúntas agus a mbeidh feidhm aige maidir leis.
(4) Beidh feidhm ag fo-alt (1) d'alt 15 den Acht seo maidir le duine a n-iontrálfar a ainm faoi fho-alt (1) den alt seo amhail is dá bhfágtaí ar lár na focail “de dhá bhliain nó níos mó” i mír (a) agus iomláine mhíre (b).
(5) I gcás duine a n-iontrálfar a ainm faoi fho-alt (1) den alt seo a bheith i seilbh poist bhunaithe sa stát-sheirbhís tráth a cheaptha ina oifigeach inphinsin d'údarás áitiúil, beidh feidhm ag alt 18 den Acht seo maidir leis amhail is dá bhfágtaí míreanna (b) agus (c) de ar lár.
(6) I gcás oifigeach bunaithe a bheith ina oifigeach inphinsin ar dháta an Achta seo a rith agus bliain iomlán ar a laghad de sheirbhís áitiúil inphinsin a bheith aige tráth a rite, déanfar, má bhíonn feidhm ag alt 24 den Acht seo maidir leis, an t-alt sin a léiriú amhail is dá bhforáladh sé go ndéanfaí an tsuim is lú a luaitear ansin a mhéadú leath faoin gcéad den tsuim sin arna hiolrú faoin uimhir de bhlianta iomlána (gan aon chodán de bhliain iomlán d'áireamh) de sheirbhís áitiúil inphinsin a bhí aige tráth a rite.
(7) Ní hiarrfar aon ranníocaíocht faoi alt 31 den Acht seo ar dhuine a mbeidh a ainm iontrálta faoi fho-alt (1) den alt seo ar feadh tréimhse leanúnaí seirbhíse dar tús dáta thosach fe dhme na Coda seo den Acht seo.
(8) Ní hiarrfar aon ranníocaíocht faoi alt 31 den Acht seo ar feadh na tréimhse iomchuí ar dhuine a ceapfar tar éis tosach feidhme na Coda seo den Acht seo ina oifigeach inphinsin d'údarás áitiúil de thoradh scrúduithe (trí chomórtas oscailte nó ar shlí eile) a bhí ann roimh thosach feidhme na Coda seo den Acht seo má ceapadh aon duine eile roimh thosach feidhme na Coda seo den Acht seo chun bheith ina oifigeach inphinsin don údarás áitiúil de thoradh an scrúduithe sin.
Sa bhfo-alt seo, ciallaíonn an abairt “an tréimhse iomchuí,” maidir le duine a ceapfar ina oifigeach inphinsin d'údarás áitiúil, tréimhse sheirbhíse leanúnaí an duine sin dar tosach an dáta a raghaidh i mbun dualgais tar éis a cheaptha amhlaidh.
(9) I gcás—
(a) duine d'fháil bháis an 1ú lá d'Eanáir, 1947, nó dá éis sin, agus roimh thosach feidhme na Coda seo den Acht seo,
(b) an duine sin a bheith, díreach roimh é d'fháil bháis, ina oifigeach inphinsin d'údarás áitiúil, agus
(c) an duine sin a bheith, dá mba nach bhfuair sé bás agus gur fhan sé i seirbhís an údaráis áitiúil, i dteideal a iarraidh go n-iontrálfaí a ainm faoi fho-alt (1) den alt seo,
beidh cumhacht ag an údarás áitiúil, a bheas infheidhmithe acu as a gcomhairle féin agus, d'ainneoin aon fhorála eile den Acht seo, nach mbeidh aon achomharc ina leith, chun an aisce chéanna (más ann) a dheonadh faoi alt 28 den Acht seo a deonfaí dá mba rud é gur tháinig an Chuid seo den Acht seo i bhfeidhm díreach roimh bhás an duine sin agus go raibh a ainm iontrálta an tráth sin faoi fho-alt (1) den alt seo.
(10) Béidh éifeacht ag forála an ailt seo d'ainneoin aon fhorála eile sa Chuid seo den Acht seo.
CUID III.
Seirbhisigh Bhunaithe.
Clár de sheirbhísigh bhunaithe.
38.—(1) Coimeádfaidh údarás áitiúil clár ar a dtabharfar an clár de sheirbhísigh bhunaithe (dá ngairmtear an clár sa Chuid seo den Acht seo).
(2) I gcás duine faoi bhun seasca bliain d'aois a bheith ina bhuan-tseirbhíseach d'údarás áitiúil ar feadh tréimhse leanúnaí de thrí bliana, iontrálfaidh an t-údarás áitiúil a ainm sa chlár.
(3) Má dhéanann seirbhíseach bunaithe d'údarás áitiúil, le toiliú ón údarás áitiúil, a fhostaíocht a thabhairt suas chun bheith ina bhuan-tseirbhíseach d'údarás áitiúil eile agus go dtiocfaidh sé chun bheith ina bhuan-tseirbhíseach don údarás áitiúil eile sin iontrálfaidh an t-údarás áitiúil eile sin a ainm sa chlár.
(4) Má éiríonn aon amhras, díospóid nó ceist i dtaobh é a bheith ceart ainm duine áirithe d'iontráil sa chlár, is é an tAire iomchuí a chinnfeas an t-amhras, an díospóid nó an cheist agus beidh a chinneadh sin ina chinneadh críochnaitheach.
(5) Ní dhéanfaidh údarás áitiúil ainm aon duine d'iontráil sa chlár ach amháin do réir an ailt seo.
(6) Taispeánfar sa chlár an uimhir uasta daoine is cead, de thuras na huaire, a bheith, aon tráth áirithe, i bhfostaíocht an údaráis áitiúil mar bhuan-tseirbhísigh.
(7) Déanfaidh údarás áitiúil an clár a choimeád ar oscailt ina bpríomh-oifig gach tráth réasúnach chun a iniúchta ag a seirbhísigh agus—
(a) i gcás bardais bhuirge, ag comhaltaí comhairle na buirge, nó
(b) in aon chás eile, ag comhaltaí an údaráis áitiúil.
Páigh agus sochair oifige a chur ar taifead sa chlár.
39.—Cuirfidh údarás áitiúil ar taifead ó am go ham sa chlár, maidir le hainm gach seirbhísigh bhunaithe ann, a pháigh agus an luach bliantúil in airgead atá ar a shochar oifige (más ann) arna chinneadh faoi alt 59 den Acht seo.
Duine a scoirfeas de bheith ina bhuantseirbhíseach a bhaint den chlár, etc.
40.—(1) Bainfidh údarás áitiúil den chlár ainm aon duine a scoirfeas de bheith ina bhuan-tseirbhíseach don údarás áitiúil sin.
(2) D'ainneoin fo-alt (1) den alt seo, más gnáthach le húdarás áitiúil aon duine áirithe a ghlacadh ó am go ham ina bhfostaíocht mar bhuan-tseirbhíseach tar éis tréimhse nach raibh sé fostaithe amhlaidh ar a feadh—
(a) ní bhainfidh an t-údarás áitiúil ainm an duine sin den chlár ar aon ócáid áirithe nuair a scoirfeas sé de bheith ar fostú amhlaidh mura mbeid tar éis a chinneadh gan é d'fhostú amhlaidh arís agus, faid a bheas a ainm sa chlár de dhroim na míre seo, is tuigthe, chun críocha ailt 49 nó fo-ailt (2) d'alt 57 den Acht seo, gan é do scor de bheith ar fostú amhlaidh,
(b) má tharlann, le linn aon tréimhse áirithe nuair nach mbeidh an duine sin ar fostú amhlaidh ag aon údarás áitiúil, go gcinnfid gan é d'fhostú amhlaidh arís, bainfid a ainm den chlár agus, chun críocha ailt 49 nó fo-ailt (2) d'alt 57 den Acht seo, is tuigthe é do scor ansin de bheith i seilbh a fhostaíochta.
(3) Más rud é, maidir le seirbhíseach bunaithe d'údarás áitiúil a mbeidh níos lú ná cúig bliana de sheirbhís áitiúil inphinsin aige, go bhfionnfar tar éis aon bhliana áirithe (is bliain dar tosach an lá a chéad-tháinig sé chun bheith ina sheirbhíseach amhlaidh nó aon lá cothroim bliana ón lá sin) a bhí sé gan bheith ag obair don údarás áitiúil mar bhuan-tseirbhíseach dhá chéad lá nó níos mó sa bhliain sin, bainfidh an t-údarás áitiúil a ainm den chlár agus cuirfid in iúl dó go ndearnadh amhlaidh agus a chúis sin.
(4) Féadfar ainm a bhaint den chlár trí nóta a chur sa chlár á rá go bhfuiltear tar éis an ainm a bhaint de agus an dáta a baineadh de í agus féadfar ainm a chur thar n-ais sa chlár trí nóta a chur sa chlár á rá go bhfuiltear tar éis an ainm a chur thar n-ais agus an dáta a cuireadh thar n-ais í.
(5) Duine ar bith ar cúis mhí-shásaimh leis údarás áitiúil do bhaint a ainme den chlár, féadfaidh sé achomharc a dhéanamh chun an Aire iomchuí i gcoinne a ainm a bhaint de agus féadfaidh an tAire sin, le hordú, diúltú don achomharc nó a ordú an ainm a chur thar n-ais sa chlár agus, sa chás deiridh sin, cuirfidh an t-údarás áitiúil an ainm thar n-ais sa chlár.
(6) Beidh cinneadh an Aire iomchuí ar achomharc faoin alt seo ina chinneadh críochnaitheach.
Gan feidhm a bheith ag achtacháin láithreacha áirithe maidir le seirbhíseach bunaithe.
41.—Na forála d'aon Acht, poiblí nó áitiúil (seachas an tAcht seo), trína gcumasaítear d'údarás áitiúil liúntas nó aisce a dheonadh do dhuine ar bith ina seirbhís ar é do scor de bheith i seilbh a phoist, ní bheidh feidhm acu maidir le haon tseirbhíseach bunaithe don údarás áitiúil sin.
Teoranta ginearálta leis an tseirbhís a bheas le háireamh ag seirbhíseach bunaithe.
42.—(1) Aon fhoráil sa Chuid seo den Acht seo a bheir teideal do sheirbhíseach bunaithe aon tréimhse d'áireamh mar sheirbhís beidh sí faoi réir an choinníll sháraithigh nach mbeidh sé i dteideal aon tréimhse acu seo a leanas d'áireamh amhlaidh:—
(a) aon tréimhse a mbeidh cnapshuim, liúntas nó aisce faighte aige cheana ina leith faoin Acht seo nó faoi aon Acht eile a bhaineas le haoisliúntas nó faoi aon scéim maidir le haoisliúntas arna déanamh faoi aon Acht,
(b) aon tréimhse roimh ocht mbliana déag d'aois a bheith slán aige,
(c) aon tréimhse a bheas a ainm sa chlár de dhroim míre (a) d'fho-alt (2) d'alt 40 den Acht seo,
(d) aon tréimhse a mbeifear tar éis aon ranníocaíochta ina leith a thabhairt thar n-ais dó faoi alt 57 den Acht seo,
(e) aon tréimhse a mbeifear tar éis aon ranníocaíochta ina leith a thabhairt thar n-ais dó faoi alt 32 den Acht seo, mura mbeidh sé tar éis na ranníocaíochta sin d'aisíoc faoi alt 33 den Acht seo,
(f) aon tréimhse roimh dháta a hurscaoileadh é as a fhostaíocht faoi údarás áitiúil de dheasca mí-iompair nó neamhoiriúnachta,
(g) aon tréimhse roimh dháta a fhanfas sé as láthair go toiliúil ón áit ina mbíonn a dhualgais á ndéanamh aige nó a staonfas sé óna dhualgais a dhéanamh, chun a thabhairt ar an údarás áitiúil dar seirbhíseach é a pháigh nó a choinníollacha seirbhíse d'athrú nó chun a thabhairt ar aon údarás áitiúil eile tuarastail, páigh nó coinníollacha seirbhíse aon oifigeach nó seirbhíseach dá gcuid d'athrú,
(h) aon tréimhse in aon bhliain, is bliain dar tosach an lá a chéad-tháinig sé chun bheith ina sheirbhíseach amhlaidh nó aon lá cothroim bliana ón lá sin, a bhí sé gan bheith ag obair d'údarás áitiúil mar bhuantseirbhíseach dhá chéad lá nó níos mó.
(2) Más rud é, ag féachaint do mhír (g) d'fho-alt (1) den alt seo, go gcaillfidh seirbhíseach d'údarás áitiúil tréimhse sheirbhíse—
(a) déanfaidh an t-údarás áitiúil fógra i scríbhinn i dtaobh a cailliúna a thabhairt don tseirbhíseach,
(b) féadfaidh an seirbhíseach, tráth nach déanaí ná mí tar éis an fógra sin a thabhairt dó, achomharc a dhéanamh chun an Aire iomchuí i gcoinne na cailliúna,
(c) féadfaidh an tAire iomchuí, le hordú, diúltú don achomharc nó a dhearbhú go dtabharfar thar n-ais iomlán na tréimhse seirbhíse nó cuid di agus, sa chás deiridh sin, beidh éifeacht ag an mír sin (g) faoi réir an dearbhuithe,
(d) beidh cinneadh an Aire iomchuí ar an achomharc ina chinneadh críochnaitheach.
Seirbhís mar sheirbhíseach bunaithe.
43.—Beidh seirbhíseach bunaithe d'údarás áitiúil i dteideal aon tréimhse a chaith sé ina sheirbhíseach bunaithe don údarás áitiúil sin d'áireamh mar shéirbhís.
Seirbhís faoi údarás áitiúil eile.
44.—I gcás seirbhíseach bunaithe d'údarás áitiúil a bheith, díreach roimh é a dhul ina seirbhís, ina oifigeach nó ina sheirbhíseach bunaithe d'údarás áitiúil eile, beidh sé i dteideal a sheirbhís áitiúil inphinsin an tráth a scoir sé de bheith ina oifigeach nó ina sheirbhíseach don údarás áitiúil eile sin d'áireamh mar sheirbhís faoin údarás áitiúil céadluaite.
Seirbhís seirbhísigh bhunaithe mar oifigeach nó seirbhíseach d'ospidéal eabhair-ghalar.
45.—(1) Beidh seirbhíseach bunaithe i dteideal aon tréimhse d'áireamh mar sheirbhís is tréimhse a chaith sé ina oifigeach nó ina sheirbhíseach d'ospidéal meabhair-ghalar agus a bhí sé i dteideal d'áireamh mar sheirbhís chun críocha Coda VIII den Acht Cóireála Meabhair-Ghalar, 1945 (Uimh. 19 de 1945), nó aon achtacháin roimhe sin atá i gcomhréir leis an gCuid sin VIII mura rud é, má rinne sé ranníocaíochta ar feadh na tréimhse chun críocha na Coda sin VIII nó an achtacháin roimhe sin adúradh, gur haisíocadh na ranníocaíochta sin leis agus nár thug sé thar n-ais iad.
(2) Ní bheidh feidhm ag alt 91 den Acht Cóireála Meabhair-Ghalar, 1945, maidir le seirbhíseach bunaithe.
Seirbhís seirbhísigh bhunaithe faoi údarás cuain.
46.—Beidh seirbhíseach bunaithe i dteideal aon tréimhse d'áireamh mar sheirbhís a chaith sé i seilbh poist inphinsin i seirbhís údaráis chuain.
Tréimhse ar dualgas mar chomhalta de Chúltaca na bhFórsaí Cosanta d'áireamh mar sheirbhís.
47.—I gcás seirbhíseach bunaithe d'údarás áitiúil, is comhalta de Chúltaca na bhFórsaí Cosanta, a bheith as láthair óna fhostaíocht chun freastal ar a dhualgas agus é a chomlíonadh mar chomhalta den tsórt sin, beidh sé i dteideal an tréimhse a chaith sé as láthair amhlaidh d'áireamh mar sheirbhís.
Seirbhís áitiúil inphinsin seirbhísigh bhunaithe.
48.—(1) Chun críocha an Achta seo, is í seirbhís áitiúil inphinsin seirbhísigh bhunaithe ná an uimhir de bhlianta iomlána sa tréimhse, nó i gcomhshuim na dtréimhsí, a bheas sé i dteideal, faoin gCuid seo den Acht seo, d'áireamh mar sheirbhís, gan aon chorr-chodán de bhliain iomlán a chur san áireamh.
(2) D'ainneoin fo-ailt (1) den alt seo, más aon agus fiche nó níos mó ná sin an uimhir de bhlianta iomlána a bheas sa tréimhse, nó i gcomhshuim na dtréimhsí, a bheas seirbhíseach briogáide tóiteáin i dteideal d'áireamh mar sheirbhís faoin gCuid seo den Acht seo, gan aon chorr-chodán de bhliain iomlán a chur san áireamh, ansin, chun críocha na Coda seo den Acht seo, is í seirbhís áitiúil inphinsin an oifigigh sin ná an uimhir sin de bhlianta i dteannta na breise a bheas ag an uimhir sin de bhlianta ar fiche bliain.
Liúntas a dheonadh do sheirbhíseach bunaithe ar é de scor de bheith i seilbh fostaíochta.
49.—(1) Más rud é—
(a) go scoirfidh seirbhíseach bunaithe d'údarás áitiúil de bheith i seilbh a fhostaíochta agus nach bhfostóid é mar bhuan-tseirbhíseach i bhfostaíocht eile, agus
(b) gur dóigh leis an údarás áitiúil gur fhónaigh sé sa bhfos taíocht sin go dícheallach dílis agus chun a sástachta nó, mura dóigh leo sin, go gcinnfid mar sin féin, gur ceart, in imthosca speisialta a cháis, liúntas laghdaithe a dheonadh dhó,
deonfaidh an t-údarás áitiúil liúntas dó in aon chás dá sonraítear i bhfo-alt (2) den alt seo.
(2) Is iad seo a leanas na cásanna dá dtagartar i bhfo-alt (1) den alt seo:—
(a) i gcás an seirbhíseach do scor de bheith i seilbh a fhostaíochta ar shlí seachas trína dhíbheadh de dheasca mí-iompair agus—
(i) seasca bliain d'aois a bheith slán aige agus fiche bliain ar a laghad de sheirbhís áitiúil inphinsin a bheith aige,
(ii) é a bheith ina sheirbhíseach briogáide tóiteáin, cúig bliana caogad d'aois a bheith slán aige agus fiche bliain ar a laghad de sheirbhís áitiúil inphinsin a bheith aige,
(iii) é a bheith éagumasach ar a dhualgais a chomhlíonadh de dheasca buan-éiglíochta meabhrach nó coirp agus deich mbliana ar a laghad de sheirbhís áitiúil inphinsin a bheith aige;
(b) i gcás an seirbhíseach do scor de bheith i seilbh a fhostaíochta toisc an teora aoise chuige sin a bheith sroichte aige agus deich mbliana ar a laghad de sheirbhís áitiúil inphinsin a bheith aige.
An liúntas a deonfar do sheirbhíseach bunaithe a chinneadh.
50.—Is é liúntas a deonfar do sheirbhíseach bunaithe faoi alt 49 den Acht seo ar é do scor de bheith i seilbh a fhostaíochta ná—
(a) liúntas do réir ráta sa bhliain is comhionann leis an seascadú cuid dá luach saothair inphinsin arna iolrú faoin uimhir de bhlianta de sheirbhís áitiúil inphinsin a bheas aige, nó
(b) liúntas do réir ráta sa bhliain is comhionann le dhá dtrian dá luach saothair inphinsin,
pé acu sin is lú.
Liúntas seirbhísigh bhunaithe a laghdú mar gheall ar sheirbhís neamhshásúil.
51.—Má chinneann údarás áitiúil, faoi alt 49 den Acht seo, gur liúntas laghdaithe a deonfar do sheirbhíseach bunaithe, déanfaid ráta bliantúil an liúntais a deonfar dó faoi alt 49 den Acht seo a laghdú faoi bhun an ráta dob iomchuí dhó sin faoi alt 50 den Acht seo agus oiread nach lú ná caoga faoin gcéad.
Aisce ghearrsheirbhíse a dheonadh do sheirbhíseach bunaithe.
52.—I gcás seirbhíseach bunaithe d'údarás áitiúil, a mbeidh bliain ar a laghad agus faoi bhun deich mblian de sheirbhís áitiúil inphinsin aige, do scor de bheith i seilbh a fhostaíochta toisc é a bheith éagumasach ar a dhualgais a chomhlíonadh de dheasca buan-éiglíochta meabhrach nó coirp, deonfaidh an t-údarás áitiúil aisce dhó de pé méid is dóigh leo is ceart ach nach mó ná an dóú cuid déag dá luach saothair inphinsin arna iolrú faoin uimhir bhlianta de sheirbhís áitiúil inphinsin a bheas aige.
Aisce a dheonadh d'ionadaí dlíthiúil pearsanta seirbhísigh bhunaithe mhairbh.
53.—(1) I gcás seirbhíseach bunaithe d'údarás áitiúil d'fháil bháis le linn é a bheith ar fostú agus cúig bliana ar a laghad de sheirbhís áitiúil inphinsin aige, deonfaidh an t-údarás áitiúil dá ionadaí dlíthiúil pearsanta aisce de mhéid is comhionann lena luach saothair inphinsin.
(2) I gcás seirbhíseach bunaithe d'údarás áitiúil d'fháil bháis le linn é a bheith ar fostú agus bliain ar a laghad agus faoi bhun chúig bliana de sheirbhís áitiúil inphinsin aige, deonfaidh an t-údarás áitiúil dá ionadaí dlíthiúil pearsanta aisce de pé méid is dóigh leo is ceart ach nach mó ná an dóú cuid déag dá luach saothair inphinsin arna iolrú faoin uimhir de bhlianta de sheirbhís áitiúil inphinsin a bheas aige.
Aisce a dheonadh faoi alt 49 d'ionadaí dlíthiúil pearsanta deonaí mhairbh.
54.—I gcás duine, dob oifigeach bunaithe d'údarás áitiúil agus dar deonadh, faoi alt 49 den Acht seo, liúntas ar é do scor de bheith i seilbh a fhostaíochta, d'fháil bháis sar a mbeidh iomlán na suimeanna a gheobhaidh sé ar scór an liúntais comhionann lena luach saothair inphinsin, deonfaidh an t-údarás áitiúil dá ionadaí dlíthiúil pearsanta aisce is comhionann leis an difríocht idir an méid iomlán sin agus an luach saothair inphinsin sin.
Aisce a dheonadh do bhantseirbhíseach bunaithe ar phósadh dhi.
55.—Má scoireann ban-tseirbhíseach bunaithe d'údarás áitiúil, a mbeidh cúig bliana ar a laghad de sheirbhís áitiúil inphinsin aici, de bheith i seilbh a fostaíochta toisc í a phósadh nó bheith chun pósadh agus go ndéanfaidh sí, roimh trí mhí a bheith caite tar éis an scoir sin, deimhniú pósta a thabhairt ar aird don údarás áitiúil á chruthú gur pósadh í beidh éifeacht ag na forála seo a leanas:—
(a) más dóigh leis an údarás áitiúil gur fhónaigh sí ina fostaíocht go dícheallach dílis agus chun a sástachta, deonfaidh an t-údarás áitiúil aisce dhi de mhéid is ionann agus—
(i) an dóú cuid déag dá luach saothair inphinsin arna iolrú faoin uimhir de bhlianta de sheirbhís áitiúil inphinsin a bheas aici, nó
(ii) a luach saothair inphinsin,
pé acu sin is lú;
(b) má dhéanann an t-údarás áitiúil, bíodh nach dóigh leo gur fhónaigh sí ina fostaíocht go dícheallach dílis agus chun a sástachta, a chinneadh mar sin féin gur ceart, in imthosca speisialta an cháis, aisce laghdaithe a dheonadh di, deonfaid aisce dhi de mhéid is comhionann leis an méid dob iomchuí faoi mhír (a) den alt seo arna laghdú an oiread sin, nach lú ná caoga faoin gcéad, is dóigh leo is ceart.
Ranníocaíochta ó sheirbhísigh bhunaithe.
56.—(1) Déanfaidh seirbhíseach bunaithe d'údarás áitiúil ranníocaíocht leis an údarás áitiúil sin chun críocha na Coda seo den Acht seo do réir ráta sa bhliain is ionann agus ceathair agus séú faoin gcéad—
(a) dá pháigh, arna ríomh ina suim bhliantúil, agus
(b) de luach bliantúil, arna chinneadh faoi alt 59 den Acht seo, a shochair oifige, más ann.
(2) An ranníocaíocht a bheas le déanamh ag seirbhíseach bunaithe d'údarás áitiúil faoin alt seo, féadfaidh an t-údarás áitiúil sin í d'fháil trí asbhaintí tréimhsiúla as a pháigh, ach, mura ndéantar aon asbhaint den tsórt sin is dligh d'údarás áitiúil a dhéanamh as a pháigh, féadfaidh an t-údarás áitiúil sin, gan dochar d'aon leigheas eile, an tsuim d'aisgabháil trína coimeád as aon tsuimeanna a bheas dlite uathu dhó nó as aon liúntas is iníoctha acu leis nó ina leith.

57.—(1) Sa Chuid seo den Acht seo, ciallaíonn an abairt “na ranníocaíochta,” maidir le seirbhíseach bunaithe, a gcomhshuim seo a leanas—
(a) aon ranníocaíochta a bheas déanta aige faoi alt 56 den Acht seo,
(b) i gcás aon ranníocaíochta a bheith déanta aige faoi alt 31 den Acht seo, na ranníocaíochta sin,
(c) i gcás aon ranníocaíochta a bheith déanta aige faoi alt 85 den Acht Cóireála Meabhair-Ghalar, 1945 (Uimh. 19 de 1945), na ranníocaíochta sin,
(d) i gcás ranníocaíochta a bheith déanta aige faoin Asylum Officers Superannuation Act, 1909, na ranníocaíochta sin,
ach gan áireamh a dhéanamh ar aon ranníocaíochta acu sin a bheas tugtha thar n-ais dó agus ná beidh aisíoctha aige.
(2) Má scoireann seirbhíseach bunaithe d'údarás áitiúil, a mbeidh deich mbliana ar a laghad de sheirbhís áitiúil inphinsin aige, de bheith i seilbh a fhostaíochta ar aon chúis seachas mí-iompar agus ná deonfar aisce faoi alt 53 den Acht seo dhó, bhéarfaidh an t-údarás áitiúil na ranníocaíochta thar n-ais dó.
(3) Má baintear ainm seirbhísigh bhunaithe d'údarás áitiúil den chlár faoi fho-alt (3) d'alt 40 den Acht seo, bhéarfaidh an t-údarás áitiúil na ranníocaíochta thar n-ais dó.
(4) Más rud é, maidir le seirbhíseach bunaithe d'údarás áitiúil a mbeidh cúig bliana ar a laghad de sheirbhís áitiúil inphinsin aige, go bhfionnfar tar éis aon bhliana áirithe (is bliain dar tosach lá cothroim bliana an lae a chéad-tháinig sé chun bheith ina sheirbhíseach amhlaidh) go raibh sé gan bheith ag obair don údarás áitiúil mar bhuan-tseirbhíseach dhá chéad lá nó níos mó sa bhliain sin, bhéarfaidh an t-údarás áitiúil thar n-ais dó aon ranníocaíochta a rinne sé faoi alt 56 den Acht seo i leith na bliana sin.
(5) I gcás seirbhíseach bunaithe d'údarás áitiúil a mbeidh níos lú ná bliain de sheirbhís áitiúil inphinsin aige, d'fháil bháis, bhéarfaidh an t-údarás áitiúil na ranníocaíochta thar n-ais dá ionadaí dlíthiúil pearsanta.
(6) Má scoireann seirbhíseach bunaithe d'údarás áitiúil, a mbeidh deich mbliana ar a laghad de sheirbhís áitiúil inphinsin aige, de bheith i seilbh a fhostaíochta ar aon chúis seachas mí-iompar, agus nach nglacfaidh sé aon fhostaíocht eile faoi údarás áitiúil a ndéanfaí seirbhíseach bunaithe de dá buaidh, agus nach mbeidh teideal aige chun liúntais faoi alt 49 den Acht seo ná chun aisce pósta faoi alt 55 den Acht seo, bhéarfaidh an t-údarás áitiúil na ranníocaíochta thar n-ais dó.
(7) Má déantar seirbhíseach bunaithe d'údarás áitiúil a dhíbhe as a fhostaíocht de dheasca mí-iompair, féadfaidh an t-údarás áitiúil, más dóigh leo go bhfuil fátha speisialta ann chun dhéanamh amhlaidh, na ranníocaíochta a thabhairt thar n-ais dó.
(8) Má thugann údarás áitiúil na ranníocaíochta thar n-ais agus go mbeidh sa mhéid a bhéarfar thar n-ais suim i leith ranníocaíocht a rinne an seirbhíseach a bheas i gceist agus atá ar seilbh ag údarás áitiúil eile nó ag bord ospidéil mheabhairghalar, íocfaidh an t-údarás nó an bord sin an tsuim sin thar n-ais leis an údarás áitiúil a thug na ranníocaíochta thar n-ais.
(9) Beidh feidhm, maidir le ranníocaíochta a bhéarfar thar n-ais faoin alt seo ag an bproviso atá ag gabháil le fo-alt (1) d'alt 31 den Finance Act, 1922.
Ciall an fhocail “páigh.”
58.—(1) Sa Chuid seo den Acht seo, is é ciall atá leis an bhfocal “páigh”—
(a) ní fholaíonn sé—
(i) íocaíochta i leith breisaimsire,
(ii) costais taistil ná liúntais eile in aghaidh costas áirithe, nó

59.—(1) Cinnfidh údarás áitiúil, ó am go ham agus aon uair a ordós an tAire amhlaidh, an luach bliantúil in airgead atá ar gach ceann (más ann) de shochair oifige seirbhísigh bhunaithe agus coimeádfaid ar taispeáint, i ngach oifig nó foras a bheas á chothabháil acu agus in áit fheiceálach a mbeidh teacht air ag a seirbhísigh, liosta de na luacha a cinnfear amhlaidh do shochair oifige na seirbhíseach bunaithe a bheas ar fostú san oifig nó uaithi nó sa bhforas sin nó uaidh.
(2) Ní foláir cinneadh faoi fho-alt (1) den alt seo a bheith ceadaithe ag an Aire.
(3) Má bhíonn seirbhíseach bunaithe ag fáil ráta áirithe páighe aon lá faoi leith, is é is luach saothair inphinsin dó chun críocha na Coda seo den Acht seo an lá sin ná—
(a) mura lú ná trí bliana an tréimhse, nó comhshuim na dtréimhsí, a bheas sé i dteideal faoin gCuid seo den Acht seo d'áireamh mar sheirbhís—

(3) Ní rithfear an chéad rún ó údarás áitiúil faoin alt seo mura mbeidh cúig bliana ar a laghad caite ón dáta a tháinig an Chuid seo den Acht seo i bhfeidhm maidir leo agus ní déanfar aon rún ina dhiaidh sin uathu faoin alt seo a rith mura mbeidh cúig bliana ar a laghad caite ó dháta an rúin deiridh roimhe sin den tsórt sin.
(4) Is feidhm fhorcoimeádta chun críocha na nAcht um Bainistí Chontae, 1940 agus 1942, agus chun críocha an Achta nó na nAcht a bhaineas le bainistí aon chontae-bhuirge, rún a rith faoin alt seo.

61.—(1) Más rud é, in aon chás ina mbeidh feidhm maidir le seirbhíseach d'údarás áitiúil ag forála fo-ailt (2) d'alt 38 nó míre (c) d'fho-alt (1) nó míreanna (c) agus (d) d'fho-alt (2) d'alt 63 den Acht seo, go bhfionnfar, má tharla an seirbhíseach a bheith as láthair óna fhostaíocht ag an údarás áitiúil i rith aon cheann de na trí bliana iomchuí, gurbh é ba chúis leis sin é a bheith breoite, an obair ar a raibh sé ar fostú a bheith ar stad go sealadach, méid seachtainiúil na hoibre sin do laghdú go sealadach nó aon chúis sealadach eile nach dá ghníomh ná dá fhaillí féin, is tuigthe chun críocha na bhforál sin gur bhuan-tseirbhíseach don údarás áitiúil é le linn dó bheith as láthair i gcás (agus sa chás sin amháin) ina gcomhlíonfar na coinníollacha seo a leanas, is é sin le rá:—
(a) gur fhill sé ar fhostaíocht an údaráis áitiúil i gceann na tréimhse a chaith sé as láthair nó, má mhair an tréimhse sin i ndiaidh deireadh na bliana sin, i gceann na tréimhse sin i ndiaidh deireadh na bliana sin,

(b) ó sheirbhíseach bunaithe do bhardas buirge Dhún Laoghaire ba sheirbhíseach don bhardas sin díreach roimh an gCuid seo den Acht seo a theacht i bhfeidhm maidir leo agus a bhí cláraithe acu an tráth sin i gclár de bhuan-fhostaithe a bhí á choimeád acu an tráth sin,
(c) ó sheirbhíseach bunaithe do Choiste Gairm-Oideachais Chathair Bhaile Atha Cliath ba sheirbhíseach don choiste sin díreach roimh an gCuid seo den Acht seo a theacht i bhfeidhm maidir leo agus a bhí, an 14ú lá de Shamhain, 1930, ina dhuine lenar bhain alt 53 d'Acht 1925.

Ilghneitheach

64.—(1) I gcás—
(a) ina ndeonfaidh údarás áitiúil cnapshuim, liúntas nó aisce faoin Acht seo, nó
(b) ina ndéanfaidh údarás áitiúil ranníocaíochta a thabhairt thar n-ais faoin Acht seo, nó
(c) ina gceangaltar leis an Acht seo ar údarás áitiúil suim d'íoc thar n-ais,
is iad a dhéanfas an chnapshuim, an liúntas, an aisce nó an ranníocaíocht d'íoc nó an tsuim d'íoc thar n-ais ná—
(i) más coiste gairm-oideachais an t-údarás áitiúil sin—an t-údarás áitiúil a dhéanann, faoin Acht Gairm-Oideachais, 1930 (Uimh. 29 de 1930), an ranníocaíocht áitiúil bhliantúil d'íoc i leith costas an choiste,
(ii) más coiste talmhaíochta do chontae an t-údarás áitiúil sin—comhairle na contae sin,
(iii) más coiste d'aon údarás áitiúil amháin an t-údarás áitiúil sin—an t-aon údarás áitiúil amháin sin,
(iv) in aon chás eile—an t-údarás áitiúil sin.
(2) Má ceangaltar faoin Acht seo ar údarás áitiúil aon chuid d'íoc thar n-ais d'íocaíocht a luaitear i bhfo-alt (1) den alt seo, is leis an údarás áitiúil a rinne an íocaíocht faoin bhfo-alt sin a híocfar thar n-ais í.
(3) Aon íocaíocht a dhéanfas údarás áitiúil de bhun fo-mhíre (i) d'fho-alt (1) den alt seo, ní háireofar í chun críche aon teorann a cuirtear le méid aon ranníocaíochta áitiúla bliantúla is iníoctha ag an údarás áitiúil faoin Acht Gairm-Oideachais, 1930 (Uimh. 29 de 1930), arna leasú le haon achtachán ina dhiaidh sin.

65.—(1) Aon tsuim is gá do dhuine faoin Acht seo d'íoc nó d'aisíoc le hAire Stáit, nó a thabhairt thar n-ais dó nó d'íoc thar n-ais leis, féadfar, gan dochar dá haisgabháil ar aon tslí eile, í d'aisgabháil trína hasbhaint go hiomlán nó go páirteach as aon airgead is iníoctha ag aon Aire Stáit chun críche ar bith leis an duine sin.
(2) An chumhacht chun airgead d'asbhaint faoi fho-alt (1) den alt seo, is cumhacht í atá faoi réir éileamh, agus gan dochar d'éilimh, an Chiste Ráthaíochta faoi na hAchta Talamh-Cheannaigh.

66.—(1) Má dhéanann údarás áitiúil (dá ngairmtear an t-údarás deontach san alt seo) cnapshuim, liúntas nó aisce a dheonadh faoin Acht seo do dhuine ar bith nó ina leith agus, le linn méid an chéanna a chinneadh, go ndearnadh aon tréimhse sheirbhíse faoi údarás áitiúil eile nó faoi údarás cuain nó bord ospidéil mheabhair-ghalar (dá ngairmtear an t-údarás ranníocach san alt seo) a chur san áireamh, íocfaidh an t-údarás ranníocach thar n-ais leis an údarás deontach cuid den chnapshuim, den liúntas nó den aisce (nó, más coiste gairm-oideachais an t-údarás deontach, cuid de leath na cnapshuime, an liúntais nó na haisce) arna cinneadh do réir tréimhsí seirbhíse an duine sin faoin údarás ranníocach agus faoin údarás deontach agus do réir a luach saothair ar fead na dtréimhsí sin, agus socrófar an chuid sin trí chomhaontú idir an údarás ranníocach agus an t-údarás deontach nó, cheal comhaontuithe, socróidh an tAire é (tar éis dó dul i gcomhairle, más údarás cuain an t-údarás ranníocach, leis an Aire Tionscail agus Tráchtála.)
(2) Chun críocha fo-ailt (1) den alt seo is tuigthe gur sheirbhís faoi údarás ranníocach seirbhís faoi choiste den údarás ranníocach sin, agus aon tseirbhís a tugadh faoi chomhchoiste de dhá údarás ranníocacha nó níos mó is tuigthe gur sheirbhís faoi gach údarás ranníocach acu sin í.
Athrú ar chuid de liúntas a deonfar d'oifigeach nó seirbhíseach bunaithe a bheas ag fáil bónais.
67.—Más bónas, arna áireamh do réir treoir-uimhir chostais mhaireachtana, cuid de luach saothair oifigigh nó seirbhísigh bhunaithe tráth a scortha de bheith i seilbh a oifige nó a fhostaíochta, ansin, an chuid d'aon liúntas a deonfar dó faoin Acht seo agus is inchurtha i leith an bhónais sin, beidh sí faoi réir an athrúcháin chéanna, más ann, a mbeadh feidhm aige i gcás aoisliúntais a deonfaí do stát-sheirbhíseach a bhí ag fáil luach saothair den tsamhail chéanna agus a scoir roimh an lú lá de Shamhain, 1946.
Liúntas a chealú ar dhuine a chiontú i gcion.
68.—(1) I gcás duine a ciontófar ar dhíotáil in aon chion agus a gcuirfear pian-tseirbhís, nó aon téarma príosúntachta le daor-obair nó is sia ná dhá mhí dhéag, de phianbhreith air a bheith, tráth an chiontuithe, ag fáil liúntais arna dheonadh ag údarás áitiúil faoin Acht seo, beidh an liúntas arna chealú air sin agus scoirfidh sé de bheith iníoctha.
(2) Má déantar neamhniú ar chiontú a dtiocfaidh cealú liúntais faoin alt seo dá dheasca nó má tugtar saor-mhaithiúnachas don duine ciontaithe déanfar, i gcás an ciontú a neamhniú, an cealú a chur ar neamhní amhail ó dháta an chiontuithe agus, i gcás saor-mhaithiúnachas a thabhairt, amhail ó dháta an tsaormhaithiúnachais.
(3) I gcás aon liúntas a chealú faoin alt seo, féadfaidh an t-údarás áitiúil a dheoin an liúntas, más cuí leo sin, an liúntas d'aisiriú go hiomláin nó go páirteach le toiliú an Aire.
Marthain éiglíochta d'fhionnadh.
69.—(1) Má deontar liúntas faoin Acht seo do dhuine a bheas faoin aois a sonraítear don liúntas sin i bhfo-alt (2) den alt seo ar an bhforas go bhfuil sé éagumasach ar a dhualgas a chomhlíonadh de dheasca buan-éiglíochta meabhrach nó coirp, beidh éifeacht ag na forála seo a leanas:
(a) déanfaidh an t-údarás áitiúil, a mbeidh an liúntas iníoctha acu, a fhionnadh ó am go ham, go dtí go sroichfidh an duine sin an aois sin, an maireann a éiglíocht agus, chuige sin, féadfaid, más cuí leo, socrú a dhéanamh i gcóir scrúduithe dochtúra agus a cheangal air dul faoi na scrúduithe sin;
(b) má fhaillíonn an duine sin go toiliúil nó má dhiúltaíonn sé dul faoi aon scrúdú dochtúra den tsórt sin, scoirfear den liúntas d'íoc;
(c) má dhéanann dhá dhochtúir leighis cláraithe ar a laghad a ainmneos an t-údarás áitiúil sin a dheimhniú go bhfuil deireadh le héiglíocht an duine sin agus má tairgtear dó oifig nó fostaíocht inphinsin faoi údarás áitiúil de shaghas is ionann agus an oifig nó an fhostaíocht a bhí aige agus ar ráta luach saothair nach lú ná an ráta a bhí á íoc leis díreach roimh é do scor de bheith i seilbh na hoifige nó na fostaíochta sin a bhí aige, déanfaidh an t-údarás áitiúil sin, faoi réir a cheaduithe ag an Aire, an liúntas a chealú agus air sin scoirfear dá íoc.
(2) Is í an aois a luaitear i bhfo-alt (1) den alt seo ná—
(a) le haghaidh liúntais a deonfar d'oifigeach nó seirbhíseach briogáide tóiteáin—cúig bliana caogad,
(b) le haghaidh aon liúntais eile—seasca bliain.
(3) Má tairgtear, de bhun míre (c) d'fho-alt (1) den alt seo, oifig nó fostaíocht nua do dhuine dar deonadh liúntas i leith tréimhse de sheirbhís áitiúil inphinsin agus go nglacfaidh sé í, agus go gcealófar an liúntas faoin alt seo, beidh éifeacht ag na forála seo a leanas ar é do scor de bheith i seilbh na hoifige nó na fostaíochta nua:
(a) chun críocha míre (a) d'alt 13 nó míre (a) d'alt 42 den Acht seo, is tuigthe nach tréimhse a bhfuair sé cnap shuim nó liúntas ina leith an tréimhse sin;
(b) aon chnapshuim nó aisce a deonfar dó nó dá ionadaí dlíthiúil pearsanta faoi Chuid II nó Cuid III den Acht seo, laghdófar í de mhéid na cnapshuime (más ann) a deonadh dó i dteannta an liúntais;
(c) is tuigthe an tréimhse sheirbhíse san oifig nó sa bhfostaíocht nua do leanúint as an tréimhse sin agus ní tabharfar aird ar an tréimhse a raibh sé ag fáil an liúntais ar a feadh.
(4) Aon díospóid idir údarás áitiúil agus duine i dtaobh oifig nó fostaíocht nua a tairgfear don duine sin a bheith, chun críocha míre (c) d'fho-alt (1) den alt seo, de shaghas is ionann agus an oifig nó anfhostaíocht a bhí aige, is é an tAire iomchuí a chinnfeas í agus is cinneadh críochnaitheach a chinneadh sin.

70.—Má éiríonn aon amhras, díospóid nó ceist nó más é tuairim an Aire gur dócha sin d'éirí i dtaobh duine a bheith ina oifigeach chun críocha an Achta seo nó ina oifigeach d'ospidéal meabhair-ghalar nó i dtaobh duine a bheith ina sheirbhíseach chun críocha an Achta seo nó ina sheirbhíseach d'ospidéal meabhair-ghalar, is é an tAire a chinnfeas an t-amhras, an díospóid nó an cheist agus is cinneadh críochnaitheach a chinneadh sin.
Rialacháin ag sonrú na n-aicmí d'oifigigh agus seirbhísigh bhriogáide tóiteáin.
71.—Féadfaidh an tAire rialacháin a dhéanamh ina sonróidh—
(a) na haicmí oifigeach d'údaráis bhriogáide tóiteáin faoin Acht Briogáideacha Tóiteáin, 1940 (Uimh. 7 de 1940), is oifigigh bhriogáide tóiteáin chun críocha an Achta seo, agus
(b) na haicmí seirbhíseach do na húdaráis sin is seirbhísigh bhriogáide tóiteáin chun críocha an Achta seo.
Rialacháin á cheadú d'oifigeach do choiste gairmoideachais seirbhís mar mhúinteoir d'áireamh.
72.—(1) Féadfaidh an tAire, tar éis dó dul i gcomhairle leis an Aire Oideachais agus le toiliú an Aire Airgeadais, rialacháin a dhéanamh á cheadú d'oifigeach do choiste gairm-oideachais a raibh aige, roimh é a theacht chun bheith ina oifigeach den tsórt sin, seirbhís mhúinteoireachta mar mhúinteoir scoile náisiúnta nó mar mhúinteoir meánscoile nó mar mhúinteoir scoile gairmoideachais nó ceardscoile nó mar mhúinteoir d'aon dá chineál nó níos mó acu sin an tseirbhís mhúinteoireachta sin d'áireamh mar sheirbhís, agus féadfar a ordú leis na rialacháin sin an cineál seirbise múinteoireachta agus an cion di is féidir d'áireamh amhlaidh agus a mhéid is féidir agus an modh inar féidir an tseirbhís mhúinteoireachta d'áireamh amhlaidh.
(2) Má dhéanann údarás áitiúil onapshuim, liúntas nó aisce d'íoc le hoifigeach nó ina leith agus, le linn méid na cnapshuime, an liúntais nó na haisce a chinneadh, go ndearnadh aon tréimhse a thug an t-oifigeach ina mhúinteoir meánscoile d'áireamh de bhun rialachán faoin alt seo, féadfaidh an tAire Airgeadais, tar éis dó dul i gcomhairle leis an Aire Oideachais, a chinneadh cad é an chuid nó cad iad na coda (más ann) den chnapshuim, den liúntas nó den aisce a híocfar as Ciste Pinsin na Meán-Mhúinteoirí, agus air sin féadfaidh an tAire Oideachais aon chuid nó coda a cinnfear amhlaidh d'íoc thar n-ais leis an údarás áitiúil as an gciste sin.
(3) Má dhéanann údarás áitiúil cnapshuim, liúntas nó aisce d'íoc le hoifigeach nó ina leith agus, le linn méid na cnapshuime, an liúntais nó na haisce a chinneadh, go ndearnadh aon tréimhse a thug an t-oifigeach ina mhúinteoir scoile náisiúnta d'áireamh de bhun rialachán faoin alt seo, féadfaidh an tAire Airgeadais, tar éis dó dul i gcomhairle leis an Aire Oideachais, a chinneadh cad é an chuid nó cad iad na coda (más ann) den chnapshuim, den liúntas nó den aisce a bheas ina muirear ar an Stát, agus air sin féadfaidh an tAire Oideachais aon chuid nó coda a cinnfear amhlaidh d'íoc thar n-ais leis an údarás áitiúil as airgead a sholáthrós an tOireachtas.
Achomhaire chun an Air.
73.—(1) Más cúis mhí-shásaimh le duine údarás áitiúil d'fhaillí nódo dhiúltú cnapshuim, liúntas nó aisce a dheonadh faoin Acht seo nó ranníocaíochta a thabhairt thar n-ais faoin Acht seo, féadfaidh sé achomharc a dhéanamh chun an Aire i gcoinne na faillí nó an diúltuithe sin.
(2) Más cúis mhí-shásaimh le duine méid aon chnapshuime, liúntais nó aisce a dheonfas údarás áitiúil faoin Acht seo, féadfaidh sé achomharc a dhéanamh chun an Aire i gcoinne na méide sin.
(3) Aon achomharc ó dhuine faoin alt seo i gcoinne faillí maidir le ranníocaíochta a dheonadh nó a thabhairt thar n-ais, déanfar é tráth nach déanaí ná ocht mí tar éis na himthosca a theacht a líomhnós sé a chuir de cheangal ar an údarás áitiúil na ranníocaíochta a dheonadh nó a thabhairt thar n-ais agus déanfar aon achomharc eile faoin alt seo tráth nach déanaí ná sé mhí tar éis an chinneadh is abhar don achomharc.
(4) Ar achomharc a dhéanamh faoin alt seo, féadfaidh an tAire, le hordú, diúltú don achomharc nó pé forála a dhéanamh is dóigh leis a bhí sé ceart ag an údarás áitiúil a dhéanamh, agus aon fhorála a dhéanfas an tAire amhlaidh beidh éifeacht acu amhail is dá mb'iad an t-údarás áitiúil a rinne iad.
(5) Is cinneadh críochnaitheach cinneadh an Aire ar achomhare faoin alt seo.

74.—(1) Aon tsuim is iníoctha ag údarás áitiúil faoin Acht seo i leith tréimhse a thug duine ina oifigeach nó ina sheirbhíseach don údarás áitiúil sin, muirearófar í ar an líomatáiste ar a ndéanfaí luach saothair an duine sin a mhuirearú dá leanadh sé de bheith i seilbh na hoifige nó na fostaíochta céanna faoin údarás áitiúil sin.
(2) Aon tsuim is iníoctha ag údarás áitiúil faoin Acht seo i leith tréimhse a thug duine ina oifigeach nó ina sheirbhíseach d'údarás áitiúil eile, muirearófar í ar an líomatáiste ar a muirearaítear na costais faoina ndeachaigh an t-údarás áitiúil céadluaite ag soláthar airgid don údarás áitiúil eile.
(3) Má dhéanann údarás áitiúil cnapshuim, aisce nó liúntas a dheonadh d'oifigeach nó seirbhíseach nó ina leith agus, le linn méid an chéanna a ríomh, go ndearnadh tréimhse sheirbhíse faoi údarás áitiúil eile d'áireamh, is tuigthe chun críocha an ailt seo, íoc na cnapshuime, an liúntais nó na haisce ag an údarás áitiúil céadluaite a bheith arna dhéanamh i leith seirbhíse an duine sin fúthu sin amháin.
Liúntas d'fhionraí nó a laghdú ar an té a bheas á fháil d'athcheapadh.
75.—(1) I gcás duine lena mbeidh liúntas iníoctha faoin Acht seo nó faoi aon Acht eile ag údarás áitiúil nó ag bord ospidéil mheabhair-ghalar d'fháil aon íocaíochta (lena n-áirítear an luach in airgead atá ar shochair oifige, más ann) ó údarás áitiúil nó ó bhord ospidéil mheabhair-ghalar nó as airgead arna sholáthar ag an Oireachtas i leith seirbhísí a tugadh, ní hiocfar níos mó den liúntas leis in aon bhliain áirithe ná an oiread agus is cóimhéid, i dteannta na híocaíochta sin, leis an luach saothair (lena n-áirítear an luach in airgead atá ar shochair oifige, más ann) ar a ndearnadh an liúntas a ríomh.
(2) Aon údarás áitiúil nó bord ospidéil mheabhair-ghalar a bheas ag íoc liúntais le duine lena mbaineann fo-alt (1) den alt seo, féadfaid ó am go ham, do réir mar is cuí leo chun éifeacht a thabhairt d'fho-alt (1) den alt seo, na híocaíochta a rinneadar, a bheas déanta nó le déanamh acu i leith an liúntais d'fhionraí, a mhaolú, a laghdú nó a choigeartú ar shlí eile.
(3) Má bhíonn agus faid a bheas, de bhun an ailt seo, liúntas gan íoc, fágfar gan íoc freisin aon chuid den liúntas sin is iníoctha thar n-ais faoin Acht seo nó faoi aon Acht eile.
(4) Má bhíonn agus faid a bheas, de bhun an ailt seo, maolú nó laghdú ar an méid is iníoctha i leith liúntais, déanfar freisin aon chuid den liúntas sin is iníoctha thar n-ais faoin Acht seo nó faoi aon Acht eile a laghdú i gcomhréir leis sin.
Liúntas, etc., a shannadh.
76.—(1) Beidh éifeacht ag na forála seo a leanas maidir le haon íocaíocht (dá ngairmtear an deontas san alt seo) is iníoctha faoin Acht seo nó faoi Chuid IV d'Acht 1925 ag údarás áitiúil le duine ar bith (dá ngairmtear an fáltaí san alt seo), is é sin le rá:—
(a) gach sannadh agus muirearú a déanfar ar an deontas agus gach comhaontú chun an deontas a shannadh nó a mhuirearú, beid ar neamhní ach amháin sa mhéid gur chun tairbhe do bhean chéile nó d'fhear céile nó do ghaolta cleithiúnacha an fháltaí iad, agus i gcás féimhíochta an fháltaí ní híocfar an deontas le haon iontaobhaí ná duine eile a bheas ag gníomhú thar ceann an chreidiúnaí;
(b) i gcás aon chúnamh poiblí a thabhairt de bhun an Achta um Chúnamh Phoiblí, 1939 (Uimh. 27 de 1939), don fháltaí nó do dhuine ar bith a dhlíos sé faoin Acht sin a chothabháil, féadfaidh an t-údarás áitiúil iomlán an deontais nó aon chuid de d'íoc leis an údarás cúnaimh phoiblí a bhéarfas an cúnamh, agus féadfar an cion den deontas a híocfar amhlaidh d'úsáid chun aisíoctha aon tsuimeanna a bheas caite ar an gcúnamh sin agus, faoina réir sin, déanfaidh an t-údarás cúnaimh phoiblí é d'íoc leis an bhfáltaí nó é d'úsáid chun tairbhe dhó;
(c) má fhaillíonn an fáltaí duine ar bith a chothabháil a dhlíos sé a chothabháil, féadfaidh an t-údarás áitiúil, as a gcomhairle féin, iomlán an deontais nó aon chuid de d'íoc leis an duine sin nó d'úsáid chun tairbhe dhó;
(d) má chítear don údarás áitiúil an fáltaí a bheith ina dhuine mímheabhrach nó a bheith éagumasach i slí eile ar ghníomhú, féadfaid pé cion den deontas is oiriúnach leo d'íoc leis an bhforas nó leis an duine ar a mbeidh cúram an fháltaí, agus féadfaid an barrachas (más ann) nó pé cuid de is oiriúnach leo d'íoc chun nó i leith cothabhála agus tairbhe mná céile nó fir chéile nó gaolta cleithiúnacha an fháltaí;
(e) má bhíonn an fáltaí nó an t-oifigeach nó an seirbhíseach a mbeidh an deontas iníoctha ina leith tar éis bháis agus go mbeidh suim nach nó ná céad punt dlite ar scór an deontais, féadfar, más oiriúnach leis an údarás áitiúil, déanamh d'éagmais promháide nó cruthúnais eile ar theideal ionadaithe pearsanta an duine mhairbh, agus féadfar an tsuim d'íoc leis na daoine nó a roinnt ar na daoine a chífear don údarás áitiúil a bheith i dteideal tairbhiúil chun eastáit phearsanta an duine mhairbh sin nó í d'íoc le haon duine nó daoine nó a roinnt ar aon duine nó daoine acu sin, nó, i gcás neamhdhlisteanachta an duine mhairbh, í d'íoc le pé daoine nó a roinnt ar pé daoine is oiriúnach leis an údarás áitiúil, agus beidh an t-údarás áitiúil agus aon oifigeach dóibh a dhéanfas an íocaíocht saor ó gach dliteanas maidir le haon íocaíocht nó roinnt den tsórt sin;
(f) aon tsuim is iníoctha le mionaoiseach ar scór an deontais, féadfar í d'íoc leis an mionaoiseach féin nó le pé duine agus ar pé coinníollacha chun tairbhe don mhionaoiseach is oiriúnach leis an údarás á itiúil;
(g) má dhéanann an t-údarás áitiúil íocaíocht le haon duine de bhun an ailt seo is cúiteantas maith ar an tsuim a híocfar admháil an duine sin.
(2) Féadfaidh an tAire rialacha a dhéanamh á cheangal dearbhuithe a dhéanamh chun aon chríche a bhaineas le híocaíochta a déanfar de bhun an ailt seo agus ní bheidh duine lena ndéanfar aon íocaíocht den tsórt sin i dteideal an íocaíocht sin d'fháil má fhaillíonn sé aon dearbhú a dhéanamh a ceanglófar air leis na rialacha sin a dhéanamh.
(3) Duine ar bith a dhéanfas míráiteas go toiliúil i dtaobh beachta abhartha in aon dearbhú faoi aon riail arna déanamh faoin alt seo, beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann ar an slí achomair dlífear fíneáil nach mó ná caoga punt a chur air nó príosúntacht ar feadh aon téarma nach sia ná trí mhí.
Aisce nó liúntas i gcás díobhála.
77.—(1) Má déantar díobháil d'oifigeach nó do sheirbhíseach d'údarás áitiúil—
(a) ag comhlíonadh a dhualgais dó, agus
(b) gan faillí uaidh féin, agus
(c) de dheasca díobhála éigin is inchurtha go sonrach i leith nádúir a dhualgais,
féadfaidh an t-údarás áitiúil, le toiliú an Aire, pé aisce nó liúntas saoil nó liúntas ar feadh tréimhse teoranta in airgead, is réasúnach leis an údarás áitiúil agus a ceadófar le rialacháin faoin alt seo, a dheonadh dhó féin agus, má gheibheann sé bás laistigh de sheacht mbliana tar éis dáta na díobhála agus gur de dheasca na díobhála é, dá bhaintrigh (nó, i gcás ban-oifigigh nó ban-tseirbhísigh, dá baintreach fir), dá athair nó dá mháthair, i gcás iad a bheith i lán-chleithiúnas air tráth a bháis, agus dá leanaí nó i leith a leanaí, nó d'aon duine nó i leith aon duine acu sin.
(2) Aon liúntas a deonfar faoin alt seo do dhuine díobhálta ní raghaidh sé, i dteannta aon liúntais eile (lena n-áirítear an luach blianachta, arna ríomh i pé slí a ordós an tAire, ar aon chnapshuim) is iníoctha ag údarás áitiúil agus a mbeidh sé cáilithe chuige, thar cúig séú den luach saothair (lena n-áirítear an luach in airgead atá ar shochair oifige, más ann) ar dá réir a ríomhfar an liúntas eile sin.
(3) Féadfaidh an tAire rialacháin a dhéanamh chun críocha an ailt seo.

78.—(1) Má bhíonn ar intinn ag oifigeach nó seirbhíseach d'údarás áitiúil scor as a oifig nó a fhostaíocht ar dháta áirithe, féadfaidh sé, tráth nach déanaí ná sé mhí agus nach luaithe ná dhá mhí dhéag roimh an dáta sin, fógra a thabhairt i scríbhinn don údarás áitiúil ina n-ineosfaidh—
(a) gurb intinn dó scor ar an dáta sin,
(b) na fátha gurb intinn dó scor,
(c) gur mian leis go dtabharfaí dhó sonraí ar na sochair a bheas aige ar scor dó.
(2) Má thugann oifigeach nó seirbhíseach fógra faoin alt seo d'údarás áitiúil á rá gur mian leis go dtabharfaí dhó sonraí ar na sochair a bheas aige ar scor dó, bhéarfaidh an t-údarás áitiúil, laistigh de dhá mhí, ráiteas don oifigeach nó don tseirbhíseach ina luafaid—
(a) más intinn dóibh, ar scor dó amhlaidh, aon chumhacht d'fheidhmiú a bheirtear dóibh leis an Acht seo nó le haon Acht eile chun aon chnapshuim, liúntas nó aisce a dheonadh dhó nó chun aon ranníocaíochta a thabh airt thar n-ais dó nó chun aon bhlianta a chur lena sheirbhís nó chun méid aon chnapshuime nó liúntais a mbeidh sé ina theideal a mhéadú nó a laghdú,
(b) más intinn dóibh aon chumhacht acu sin a luaitear i mír (a) den fho-alt seo d'fheidhmiú, sonraí ar an modh inarb intinn dóibh an chumhacht d'fheidhmiú,
(c) méid (más aon mhéid é) gach cnapshuime, liúntais nó aisce nó ranníocaíochta ar dóigh leo, ag féachaint dá n-intinn mar bheas luaite de bhun míreanna (a) agus (b) den fho-alt seo, teideal a bheith aige chun a íoctha leis nó a thabhartha thar n-ais dó ar scor dó amhlaidh,
ach má bheartaíd a lua sa ráiteas gurb intinn dóibh aon chumhacht d'fheidhmiú ar gá toiliú nó ceada an Aire chun a feidhmithe, ní thabharfaid an ráiteas mura n-aontaí agus go dtí go n-aontóidh an tAire leis.
(3) Beidh feidhm ag forála ailt 73 den Acht seo (nó, i gcás cumhacht faoi aon Acht eile d'fheidhmiú, ag aon fhorála comhréireacha den Acht sin) maidir le ráiteas, i dtaobh a n-intinne, a bhéarfas údarás áitiúil faoi mhír (a) nó (b) d'fho-alt (2) den alt seo amhail is dá mbeadh an t-oifigeach nó an seirbhíseach lena mbaineann an ráiteas tar éis scor agus amhail is dá mba nithe a chinn an t-údarás áitiúil ar dháta an ráitis a thabhairt na nithe sin is intinn dóibh.
(4) Más rud é—
(a) go dtarlóidh an scor a bheas ar intinn ag oifigeach nó seirbhíseach d'údarás áitiúil agus a bheas luaite i bhfógra faoi fho-alt (1) den alt seo ar an dáta agus ar na fátha a bheas luaite sa bhfógra, agus
(b) go gcuirfear i gcrích an intinn ag údarás áitiúil a bheas luaite sa ráiteas a bhéarfar dó de bhun míreanna (a) agus (b) d'fho-alt (2) den alt seo, nó, má d'athraigh an tAire an intinn sin de thoradh achomhairc, an intinn sin arna hathrú amhlaidh,
ní bheidh an intinn sin, mar bheas sí curtha i gcrích, faoi réir aon achomhairc ansin.
Liúntas a mhéadú i gcásanna áirithe.
79.—(1) Má rinne údarás áitiúil nó bord ospidéil mheabhairghalar liúntas nó cnapshuim a dheonadh roimh an Acht seo a rith do dhuine nó i leith duine maidir lena scor, tar éis an lú lá d'Iúil, 1940, de bheith i seilbh aon oifige nó fostaíochta ina seirbhís, féadfaid, laistigh de dhá mhí dhéag tar éis an tAcht seo a rith, bisiú amháin (ar a mhéid) ar ráta an liúntais nó ar mhéid na cnapshuime a dheonadh, agus is é a bheas sa bhisiú sin bisiú de mhéid a cheadós an tAire iomchuí agus, i gcás bisiú ar liúntas, beidh éifeacht aige amhail ón dáta a scoir an oifig nó an fhostaíocht de bheith ar seilbh nó ón lú lá de Shamhain, 1946, pé acu sin is déanaí.
(2) I gcás aon liúntas den tsórt a luaitear in alt 46 d'Acht 1925 a bheith i gcúrsa a íoctha an lú lá de Shamhain, 1946, coigeartófar an liúntas, go n-éifeacht amháil ón lá sin, ar an modh seo a leanas:—
(a) an chuid (más ann) den liúntas a ríomhadh do réir an bhónais éigeandála faoin Ordú Cumhachta Práinne (Uimh. 312), 1944 (R. & O. R., Uimh. 36 de 1944), scoirfidh sé de bheith iníoctha;
(b) déanfar an bisiú nó an bhreis a cuireadh leis an liúntas faoi fho-alt (2) d'alt 46 d'Acht 1925 a choigeartú amhail is dá mba do réir treoir-uimhir chostais mhaireachtana 270 a ríomhfaí é agus air sin scoirfidh sé de bheith inathruithe.
(3) Má dhéanann údarás áitiúil nó bord ospidéil mheabhairghalar liúntas nó cnapshuim a dheonadh faoin Acht seo nó faoi aon Acht eile do dhuine nó i leith duine maidir lena scor roimh an lú lá d'Aibreán, 1950, de bheith i seilbh aon oifige nó fostaíochta ina seirbhís, féadfaid, i gcás liúntais, é a dheonadh do réir ráta is airde, de mhéid a cheadós an tAire iomchuí, ná an ráta dob iomchuí chuige sin mura mbeadh an fo-alt seo agus, i gcás cnapshuime, suim a dheonadh is mó, de mhéid a cheadós an tAire iomchuí, ná an tsuim dob iomchuí chuige sin mura mbeadh an fo-alt seo.
(4) Más cúis mhí-shásaimh le duine diúltú nó faillí a bhéarfar, i rith na tréimhse de dhá mhí dhéag tar éis an tAcht seo a rith, i mbisiú a dheonadh faoi fho-alt (1) den alt seo, féadfaidh an duine sin, i gcás diúltuithe, achomharc a dhéanamh, tráth nach déanaí ná sé mhí tar éis an diúltuithe, nó, i gcás faillí, achomharc a dhéanamh, tráth nach déanaí ná sé mhí tar éis an tréimhse sin de dhá mhí dhéag a bheith caite, chun an Aire iomchuí i gcoinne an diúltuithe nó na faillí.
(5) Más cúis mhí-shásaimh le duine bisiú a deonfar faoi fho-alt (1) den alt seo, féadfaidh sé, tráth nach déanaí ná sé mhí tar éis an bisiú a dheonadh, achomharc a dhéanamh ina choinne chun an Aire iomchuí.
(6) Ar achomharc a dhéanamh chuige faoin alt seo, féadfaidh an tAire iomchuí le hordú, diúltú don achomharc nó pé socruithe a dhéanamh is dóigh leis ba cheart don údarás áitiúil iomchuí nó don ospidéal meabhair-ghalar iomchuí a dhéanamh, agus aon tsocrú a dhéanfas an tAire iomchuí amhlaidh beidh éifeacht aige amhail is dá mb'iad an t-údarás sin nó an bord sin a rinne é.
(7) Is cinneadh críochnaitheach cinneadh an Aire iomchuí ar achomharc faoin alt seo.
(8) San alt seo—
ciallaíonn an abairt “an tAire iomchuí”—
(a) maidir le húdarás áitiúil seachas údarás ospidéil mheabhair-ghalar, an tAire, agus
(b) maidir le húdarás ospidéil mheabhair-ghalar, an tAire Sláinte.

80.—Ach amháin mar foráltar a mhalairt leis an Acht seo, is liúntas ar feadh saoil an té dá ndeonfar é liúntas a deonfar faoin Acht seo.

81.—Beidh feidhm ag forála ailt 23 den Acht Rialtais Áitiúil, 1941 (Uimh. 23 de 1941) (alt a bhaineas le teoranta aoise d'oifigí faoi údaráis áitiúla áirithe a shocrú) maidir le hoifig oifigigh nó le fostaíocht sheirbhísigh do Bhord Ospidéil Fiabhrais Bhaile Atha Cliath nó do Bhord Ospidéil Fiabhrais Chorcaighe amhail is dá mb'oifig faoi údarás áitiúil chun críocha an Achta sin an oifig nó an fhostaíocht sin.
Oifigeach d'údarás áitiúil a theacht chun bheith ina stát-sheirbhíseach.
82.—(1) An tseirbhís áitiúil inphinsin a bheas ag oifigeach bunaithe d'údarás áitiúil ag a mbeidh deich mbliana ar a laghad de sheirbhís áitiúil inphinsin agus a ceapfar chun poist bhunaithe sa stát-sheirbhís is tuigthe, chun críocha na nAcht Aoisliúntas, gur seirbhís i bpost bunaithe sa stát-sheirbhís aige í.
(2) I gcás duine ag a raibh, tráth an Achta seo a rith, post bunaithe sa stát-sheirbhís agus—
(a) a ceapadh chun an phoist sin tar éis an 6ú lá de Nollaig, 1922, agus
(b) a bhí díreach roimh é a cheapadh amhlaidh ina oifigeach inphinsin faoi chomhlucht áitiúil amháin nó níos mó chun críocha Coda IV d'Acht 1925,
do dhéanamh iarratais, tráth nach déanaí ná bliain tar éis an tAcht seo a rith, chun an Aire iomchuí ag iarraidh deimhniú ar na beachta a luaitear i míreanna (a) agus (b) den fho-alt seo, fiosróidh an tAire sin an scéal agus, más deimhin leis na beachta sin a bheith ann, deimhneoidh sé amhlaidh agus cuirfidh sé sa deimhniú sonraí ar sheirbhís áitiúil inphinsin an duine sin ar dháta a cheaptha amhlaidh.
(3) I gcás deimhniú d'eisiúint faoi fho-alt (2) den alt seo maidir le duine ar bith, is tuigthe chun críocha na nAcht Aoisliúntas gur seirbhís i bpost bunaithe sa stát-sheirbhís aige a sheirbhís áitiúil inphinsin mar bheas sin luaite sa deimhniú.
(4) Más rud é, faoi na hAchta Aoisliúntas agus na hachtacháin (lena n-áirítear an tAcht seo) a bhaineas le deonadh aoisliúntais agus cúitimh i leith cailliúint oifige d'oifigigh d'údaráis áitiúla, go bhfuil difríocht idir na sochair a fhaibhríos nó na coinníollacha a cháilíos daoine chun sochair, féadfaidh an tAire Airgeadais a chinneadh go ndéanfar modhnuithe sonraithe i gcomhréir leis an difríocht sin d'aon chás áirithe lena mbaineann fo-alt (1) nó fo-alt (3) den alt seo in aon mhéid a bheas le deonadh faoi na hAchta Aoisliúntas, agus déanfar dá réir sin na modhnuithe a cinnfear amhlaidh.
(5) I gcás ina ndéanfar, de bhuaidh an ailt seo, liúntas, cnapshuim nó aisce d'íoc le duine nó ina leith faoi na hAchta Aoisliúntas, féadfaidh an tAire Airgeadais a chinneadh cad é an chuid nó cad iad na coda den íocaíocht a bheas ina muirear do réir fo-ailt (6) den alt seo.
(6) I gcás ina gcinnfidh an tAire Airgeadais faoi fho-alt (5) den alt seo go mbeidh cuid nó coda d'íocaíocht le duine nó ina leith ina muirear do réir an fho-ailt seo—
(a) cinnfidh an tAire cé acu ar údarás áitiúil amháin darbh oifigeach an duine sin, nó ar dhá údarás áitiúla nó níos mó arbh oifigeach do gach ceann acu an duine sin, a bheas an chuid nó na coda sin ina muirear,
(b) má chinneann an tAire gur ar údarás áitiúil amháin a bheas an chuid nó na coda sin ina muirear, íocfaidh an t-údarás áitiúil sin méid na coda nó na gcoda sin leis an Aire,
(c) má chinneann an tAire gur ar dhá údarás áitiúla nó níos mó a bheas an chuid nó na coda sin ina muirear, cinnfidh sé freisin an méid a bheas ina mhuirear ar gach údarás áitiúil faoi leith acu sin agus íocfaidh an t-údarás áitiúil sin an méid sin leis an Aire,
(d) aon tsuim a híocfar leis an Aire faoin alt seo íocfar isteach sa Stát-Chiste nó cuirfear chun tairbhe don Stát-Chiste í do réir ordacháin an Aire Airgeadais.

83.—(1) Má bhíonn liúntas, cnapshuim nó aisce iníoctha faoin Acht seo nó faoi aon Acht eile le duine nó ma leith, agus le linn méid na híocaíochta a chinneadh, go ndearnadh aon tréimhse sheirbhíse ag an duine sin i bpost bunaithe sa stát-sheirbhís d'áireamh, féadfaidh an tAire Airgeadais a chinneadh cad é an chuid nó cad iad na coda den íocaíocht a bheas ina muirear ar an Stát agus air sin féadfar an chuid nó na coda sin a cinnfear amhlaidh d'íoc thar n-ais leis an údarás áitiúil as airgead a sholáthrós an tOireachtas.
(2) Más rud é, faoi na hAchta Aoisliúntas agus na hachtacháin (lena n-áirítear an tAcht seo) a bhaineas le deonadh aoisliúntais nó cúitimh i leith cailliúint oifige d'oifigigh d'údaráis áitiúla, go bhfuil difríocht idir na sochair a fhaibhríos nó na coinníollacha a cháilíos daoine chun sochair, féadfaidh an tAire, le toiliú an Aire Airgeadais, a chinneadh, in aon chás áirithe ina mbeidh seirbhís sa stát-sheirbhís le ríomh, go ndéanfar, le linn méid an deontais sin a ríomh, modhnuithe sonraithe sa mhéid sin, agus déanfar dá réir sin na modhnuithe a cinnfear amhlaidh.

84.—(1) Más rud é, maidir le duine is oifigeach inphinsin d'údarás áitiúil tráth an Achta seo a rith, go mbeidh na coinníollacha seo a leanas comhlíonta, is é sin le rá:
(a) go raibh sé, díreach roimh é a cheapadh ina oifigeach den tsórt sin, i seilbh poist bhunaithe ar feadh tréimhse i stát-sheirbhís Shaorstáit Éireann,
(b) go raibh sé, díreach roimh an tréimhse a luaitear i mír (a) den fho-alt seo, i seilbh poist bhunaithe ar feadh tréimhse i stát-sheirbhís an Rialtais Shealadaigh,
(c) go raibh sé, díreach roimh an tréimhse a luaitear i mír (b) den fho-alt seo, i seilbh poist bhunaithe ar feadh tréimhse i stát-sheirbhís Dháil Éireann,
(d) go raibh sé, díreach roimh an tréimhse a luaitear i mír (c) den fho-alt seo, ina oifigeach inphinsin ar feadh tréimhse d'údarás áitiúil,
féadfar na tréimhsí sin uile a chomhshuimiú agus a n-áireamh mar sheirbhís chun críocha aon Achta (lena n-áirítear an tAcht seo), i dtaobh aoisliúntais oifigeach d'údaráis áitiúla, a bhaineas leis an duine sin.

(a) go raibh sé díreach sar a dtáinig sé i seilbh an phoist sin, i seilbh poist bhunaithe ar feadh tréimhse i státsheirbhís Shaorstáit Éireann,
(b) go raibh sé, díreach roimh an tréimhse a luaitear i mír (a) den fho-alt seo, i seilbh poist shealadaigh ar feadh tréimhse i stát-sheirbhís Shaorstáit Éireann,
(c) go raibh sé, díreach roimh an tréimhse a luaitear i mír (b) den fho-alt seo, ina oifigeach inphinsin ar feadh tréimhse d'údarás áitiúil,
féadfar na tréimhsí a luaitear i míreanna (a) agus (c) den fho-alt seo a chomhshuimiú agus a n-áireamh mar sheirbhís chun críocha na nAcht Aoisliúntas mar bhainid leis an duine sin.
(3) Más rud é, maidir le duine i seilbh poist bhunaithe i státsheirbhís an Rialtais tráth an Achta seo a rith, go mbeidh na coinníollacha seo a leanas comhlíonta, is é sin le rá:
(a) go raibh sé, díreach sar a dtáinig sé i seilbh an phoist sin, i seilbh poist bhunaithe ar feadh tréimhse i státsheirbhís Shaorstáit Éireann,
(b) go raibh sé, díreach roimh an tréimhse a luaitear i mír (a) den fho-alt seo, i seilbh poist bhunaithe ar feadh tréimhse i stát-sheirbhís an Rialtais Shealadaigh,
(c) go raibh sé, díreach roimh an tréimhse a luaitear i mír (b) den fho-alt seo, i seilbh poist bhunaithe ar feadh tréimhse i stát-sheirbhís Dháil Éireann,

(a) go raibh sé, díreach sar a dtáinig sé i seilbh an phoist sin, i seilbh poist bhunaithe ar feadh tréimhse i stát-sheirbhís Shaorstáit Éireann,
(b) go raibh sé, díreach roimh an tréimhse a luaitear i mír (a) den fho-alt seo, ina oifigeach inphinsin ar feadh tréimhse d'údarás áitiúil,
(c) go raibh sé, díreach roimh an tréimhse a luaitear i mír (b) den fho-alt seo, i seilbh poist bhunaithe ar feadh tréimhse i stát-sheirbhís Shaorstáit Éireann,
féadfar na tréimhsí sin uile a chomhshuimiú agus a n-áireamh mar sheirbhís chun críocha na nAcht Aoisliúntas mar bhainid leis an duine sin.
(5) Más rud é, faoi na hAchta Aoisliúntas agus na hachtacháin (lena n-áirítear an tAcht seo) a bhaineas le deonadh aoisliúntais agus cúitimh i leith cailliúint oifige d'oifigigh d'údaráis áitiúla, go bhfuil difríocht idir na sochair a fhaibhríos nó na coinníollacha a cháilíos daoine chun sochair, féadfaidh an tAire Airgeadais a chinneadh go ndéanfar modhnuithe sonraithe i gcomhréir leis an difríocht sin d'aon chás áirithe lena mbaineann fo-alt (3) nó fo-alt (4) den alt seo in aon mhéid a bheas le deonadh faoi na hAchta Aoisliúntas, agus déanfar dá réir sin na modhnuithe a cinnfear amhlaidh.
(6) I gcás ina ndéanfar, de bhuaidh an ailt seo, liúntas, cnapshuim nó aisce d'íoc le duine nó ina leith faoi na hAchta Aoisliúntas, féadfaidh an tAire Airgeadais a chinneadh cad é an chuid nó cad iad na coda den íocaíocht a bheas ina muirear do réir fo-ailt (7) den alt seo.
(7) I gcás ina gcinnfidh an tAire Airgeadais faoi fho-alt (6) den alt seo go mbeidh cuid nó coda d'íocaíocht le duine nó ina leith ina muirear do réir an fho-ailt seo—
(a) cinnfidh an tAire cé acu ar údarás áitiúil amháin darbh oifigeach an duine sin nó ar dhá údarás áitiúla nó níos mó arbh oifigeach do gach ceann acu an duine sin a bheas an chuid nó na coda sin ina muirear,
(b) má chinneann an tAire gur ar údarás áitiúil amháin a bheas an chuid nó na coda sin ina muirear, íocfaidh an t-údarás áitiúil sin méid na coda nó na gcoda sin leis an Aire,
(c) má chinneann an tAire gur ar dhá údarás áitiúla nó níos mó a bheas an chuid nó na coda sin ina muirear, cinnfidh sé freisin an méid a bheas ina mhuirear ar gach údarás áitiúil faoi leith acu sin agus íocfaidh an t-údarás áitiúil sin an méid sin leis an Aire,
(d) aon tsuim a híocfar leis an Aire faoin alt seo íocfar isteach sa Stát-Chiste nó cuirfear chun tairbhe don Stát-Chiste í do réir ordacháin an Aire Airgeadais.
Caomhaint ar leanúnacht seirbhíseach seirbhíseach do Bhardas Luimnigh.
85.—(1) I gcás seirbhíseach don bhardas a bheith as láthair óna dhualgas ar feadh aon tréimhse lena mbaineann an t-alt seo agus ina ndéanfaí, mura mbeadh an t-alt seo, an tréimhse a chaith sé as láthair d'áireamh, chun críocha na n-achtachán pinsin, mar bhriseadh ar leanúnacht a sheirbhíse leis an mbardas, beidh éifeacht chun na gcríocha sin ag na forála seo a leanas:—
(a) is tuigthe nach briseadh ar leanúnacht a sheirbhíse leis an mbardas an tréimhse a chaith sé as láthair, agus
(b) d'ainneoin forál na míre sin roimhe seo, ní déanfar faid na tréimhse a chaith sé as láthair a chur san áireamh nuair a beifear ag ríomh faid a sheirbhíse leis an mbardas ná, i gcás liúntas saoil nó aisce a dheonadh dhó, nuair a beifear ag ríomh méid an liúntais nó na haisce sin.
(2) San alt seo—
ciallaíonn an abairt “an bardas” Méara, Seanóirí agus Buirgéisigh Luimnigh;
ciallaíonn an abairt “tréimhse lena mbaineann an t-alt seo” aon tréimhse dar thosach an 30ú lá de Mheitheamh, 1944, nó aon lá dá éis sin, agus dar chríoch an 6ú lá d'Iúil, 1944, nó aon lá roimhe sin;
ciallaíonn an abairt “na hachtacháin phinsin,” maidir le seirbhíseach don bhardas, na hachtacháin (lena n-áirítear an tAcht seo) a rialaíos liúntas saoil nó aisce a dheonadh dhó ar é do scor de bheith ar fostú.
Aoisliúntais áirithe a dheoin Bardas Chorcaighe a dhéanamh bailí.
86.—Aon aoisliúntas a dheoin Ard-Mhéara, Seanóirí agus Buirgéisigh Chorcaighe d'aon duine dá seirbhísigh i rith na tréimhse dar thosach an 9ú lá de Mheán Fómhair, 1926, agus dar críoch an 31ú lá de Mhárta, 1948, beidh sé bailí i ngach slí agus féadfar dá réir sin leanúint den liúntas sin d'íoc tar éis an tAcht seo a rith.

87.—Ní fholóidh an abairt “oifigeach inphinsin” i gCuid IV d'Acht 1925 agus is tuigthe nár fholaigh sí riamh oifigeach ospidéil mheabhair-ghalar d'údarás áitiúil.

88.—(1) Beidh feidhm ag Cuid IV d'Acht 1925 maidir le buan-tseirbhíseach do chomhlucht áitiúil a dtiocfaidh Cuid III den Acht seo i ngníomh maidir leo (nach comhlucht áitiúil lena mbaineann alt 53 d'Acht 1925) is buan-tseirbhíseach a mbeidh, an lá a thiocfas an Chuid sin III i ngníomh maidir leis an gcomhlucht sin, seasca bliain d'aois nó níos mó slán aige, nó, i gcás seirbhísigh bhriogáide tóiteáin, cúig bliana caogad d'aois nó níos mó slán aige, amhail is dá mb'oifig inphinsin a fhostaíocht, agus chun críocha na feidhme sin—
(a) folóidh an focal “tuarastal” páigh,
(b) nuair a beifear ag ríomh a sheirbhíse ar dheireadh a theacht lena fhostaíocht, ní háireofar ach a sheirbhís leanúnach faoin gcomhlucht áitiúil sin.
(2) Beidh feidhm, faoi réir na bhfo-alt ina dhiaidh seo den alt seo, ag Cuid IV d'Acht 1925 maidir le buan-tseirbhíseach do choiste gairm-oideachais a dtiocfaidh Cuid III den Acht seo i ngníomh maidir leo is buan-tseirbhíseach a mbeidh, an lá a thiocfas an Chuid sin III i ngníomh maidir leis an gcoiste sin, seasca bliain d'aois nó níos mó slán aige, amhail is dá mb'oifig inphinsin a fhostaíocht, agus chun críocha na feidhme sin—
(a) folóidh an focal “tuarastal” páigh,
(b) nuair a beifear ag ríomh a sheirbhíse ar dheireadh a theacht lena fhostaíocht ní háireofar ach a sheirbhís leanúnach faoin gcoiste sin nó faoi aon chomhlucht arbh iad an coiste sin a gcomharbaí.

LOCAL GOVERNMENT (SUPERANNUATION) ACT, 1948.
PART I.
Preliminary and General.
Short title.
1.—This Act may be cited as the Local Government (Superannuation) Act, 1948.
Definitions.
2.—In this Act—
the expression “the Act of 1925” means the Local Government Act, 1925 (No. 5 of 1925);
the expression “the appropriate Minister” means—
(a) in case the local authority in question are a vocational education committee, the Minister for Education,
(b) in case the local authority in question are a committee of agriculture, the Minister for Agriculture,
(c) in any other case, the Minister;
the expression “the civil service,” when used without qualification includes, in addition to the civil service of the Government the civil services mentioned in paragraphs (a), (b), (e) and (f) of sub-section (1) of section 2 of the Superannuation Act, 1936 (No. 39 of 1936);
the word “emolument” means any apartments, rations, or other perquisite in kind (or, as the case may require, a monetary payment given in lieu of such apartments, rations, or other perquisites) appertaining to an office or employment;
the expression “established officer” means an officer of a local authority whose name is entered in the register of established officers maintained by such local authority under section 8 of this Act;
the expression “established position”, when used in relation to the civil service, has the same meaning as it has in the Superannuation Act, 1936 (No. 39 of 1936);
the expression “established servant” means a servant of a local authority whose name is entered in the register of established servants maintained by such local authority under section 38 of this Act;
the expressions “fire brigade officer” and “fire brigade servant” mean respectively an officer or a servant of a fire brigade authority under the Fire Brigades Act, 1940 (No. 7 of 1940), coming within a class specified in regulations under section 71 of this Act;
the expression “harbour authority” means a harbour authority within the meaning of the Harbours Act, 1946 (No. 9 of 1946);
the expression “local body” has the same meaning as it has in Part IV of the Act of 1925;
the expression “local authority” means, subject to subsection (7) of section 5 of this Act, any of the following bodies:—
(a) a local authority for the purposes of the Local Government Acts, 1925 to 1946, other than a mental hospital board,
(b) a vocational education committee,
(c) a committee of agriculture,
(d) a school attendance committee,
(e) the Dublin Fever Hospital Board,
(f) the Cork Fever Hospital Board;
the expression “mental hospital board” means a joint board within the meaning of the Mental Treatment Act, 1945 (No. 19 of 1945);
the expressions “mental hospital officer” and “mental hospital servant” mean respectively an officer or a servant whose duties relate wholly to the functions now vested in a mental hospital authority under the Mental Treatment Act, 1945 (No. 19 of 1945);
the expression “the Minister” means the Minister for Local Government;
the word “officer” does not include a mental hospital officer or a person holding any of the offices mentioned in section 17 of the Local Government Act, 1941 (No. 23 of 1941);
the expression “pensionable local service” means—
(a) in relation to an established officer, his pensionable local service determined under Part II of this Act,
(b) in relation to an established servant, his pensionable local service determined under Part III of this Act,
(c) in relation to a pensionable officer to whom Part IV of the Act of 1925 applies, his service for the purposes of the said Part IV,
(d) in relation to a pensionable officer to whom any Act passed before the Act of 1925 and relating to superannuation applies, his service for the purposes of that Act;
the expression “pensionable officer” means a permanent officer who—
(a) devotes the whole of his time to the service of one or more than one local authority,
(b) in the case of an officer who acts as superintendent registrar of births, deaths and marriages or as registrar of marriages, devotes the remainder of his time to the service of one or more than one local authority,
(c) is required to be a registered medical practitioner or a nurse or a midwife, or
(d) is a pensionable officer for the purposes of Part IV of the Act of 1925;
the expression “pensionable office” means the office of a pensionable officer;
the expression “permanent officer” means an officer other than an officer appointed—
(a) for a specified period only,
(b) until the completion of a specified work or duty,
(c) until the appointment of another person to the office, or
(d) during the absence or incapacity of another person;
the expression “permanent servant” means a servant whose employment is of a permanent and whole-time character and is not employment (other than employment in a supervising capacity) on any work or scheme of works the expenses of which are in whole or in part met from moneys provided by the Oireachtas for the provision of employment and the relief of distress;
the word “servant” does not include a mental hospital servant;
the expression “the Superannuation Acts” means the Superannuation Acts, 1834 to 1946;
the word “unfitness” means unfitness of an officer or servant for his office or employment, but does not include unfitness due to physical or mental infirmity or old age.
Laying of regulations before Oireachtas.
3.—Every regulation made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next subsequent twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Commencement of Part II.
4.—Part II of this Act shall come into operation on such day as the Minister by order appoints for that purpose.
Commencement of Part III.
5.—(1) A local authority may by resolution decide to adopt Part III of this Act as on and from a specified date not earlier than one month after the date of the resolution.
(2) A resolution under this section shall contain a declaration of the maximum number of the persons to be at any one time in the employment of the local authority as permanent servants.
(3) The passing of a resolution under this section shall be a reserved function for the purposes of the County Management Acts, 1940 and 1942, and for the purposes of the Act or Acts relating to the management of any county borough.
(4) Not less than one month nor more than two months before a resolution under this section is passed, notice in writing of the intention to propose the resolution shall be given to the appropriate Minister and to either—
(a) in the case of the corporation of a borough, every member of the council of the borough, or
(b) in any other case, every member of the local authority.
(5) Where a local authority pass a resolution under this section deciding to adopt Part III of this Act as on and from a specified date, that Part and the declaration in the resolution as to the maximum number of persons to be at any one time in the employment of the local authority shall come into operation in relation to them on that date.
(6) Part III of this Act shall come into operation as provided by subsection (5) of this section and not otherwise.
(7) A reference in Part III of this Act to a local authority does not include a reference to any local authority in relation to whom that Part has not come into operation.
(8) The commencement of Part III of this Act in relation to a local authority shall not have the effect of applying section 53 of the Act of 1925 to such local authority.
Expenses of the Minister.
6.—The expenses incurred by any Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Repeals.
7.—The enactments mentioned in the Schedule to this Act are hereby repealed to the extent specified in the third column of that Schedule.
PART II.
Established Officers.
Register of established officers.
8.—(1) A local authority shall maintain a register to be known as the register of established officers (in this Part of this Act referred to as the register).
(2) Where a person becomes a pensionable officer of a local authority, the local authority shall enter his name in the register.
(3) If any doubt, dispute or question arises as to whether the name of a particular person should be entered in the register, the doubt, dispute or question shall be determined by the appropriate Minister whose decision shall be final.
(4) A local authority shall not enter the name of any person in the register save in accordance with this section.
(5) A local authority shall keep at their principal office the register open at all reasonable times for inspection by their officers and by either—
(a) in the case of the corporation of a borough, the members of the council of the borough, or
(b) in any other case, the members of the local authority.
Record in the register of salaries, emoluments, and offices.
9.—A local authority shall from time to time record in the register, as respects each name therein of an established officer—
(a) his salary and the annual money value of his emoluments (if any) as determined under section 35 of this Act,
(b) particulars of every office held by him under them or any other local authority.
Removal from the register of person ceasing to be pensionable officer.
10.—(1) A local authority shall remove from the register the name of any person who ceases to be a pensionable officer of such local authority.
(2) The removal of a name from the register may be effected by a note on the register indicating that the name has been removed and the date of the removal and the reinstatement of a name in the register may be effected by a note on the register indicating that the name has been reinstated and the date of the reinstatement.
(3) A person aggrieved by the removal of his name by a local authority from the register may appeal against the removal to the appropriate Minister and that Minister may by order either refuse the appeal or direct the name to be reinstated in the register and, in the latter case, the local authority shall reinstate the name in the register.
(4) The decision of the appropriate Minister on an appeal under this section shall be final.
Notification to local authority of cesser of office under another local authority.
11.—Where an established officer of a local authority ceases to hold any office under them, they shall so inform any other local authority under whom such officer holds any office.
Certain existing enactments not to apply to established officer.
12.—The provisions of any public or local Act (other than this Act) whereby a local authority is empowered to grant to any person in their service an allowance or gratuity on his ceasing to hold his position shall not apply in relation to any established officer of such local authority.
General limitations on service to be reckoned by established officer.
13.—(1) A provision of this Part of this Act entitling an established officer to reckon as service any period shall be subject to the overriding qualification that he shall not be entitled so to reckon any of the following:—
(a) any period in respect of which he has already received a lump sum, an allowance or a gratuity under this or any other Act relating to superannuation or under any scheme relating to superannuation made under any Act,
(b) any period before he reached the age of eighteen years,
(c) any period in respect of which any contributions have been returned to him under section 32 of this Act, unless he has repaid such contributions under section 33 of this Act,
(d) any period in respect of which any contributions have been returned to him under section 57 of this Act,
(e) any period before a date on which he was removed from office under a local authority for misconduct or for unfitness,
(f) any period before a date on which he deliberately absents himself from the place where he performs his duties or refrains from performing his duties with the purpose of inducing the local authority of which he is an officer to alter his salary or conditions of service or of inducing any other local authority to alter the salaries, wages or conditions of service of any of their officers or servants.
(2) Where a period of service of an officer of a local authority has, having regard to paragraph (f) of subsection (1) of this section, become forfeited—
(a) the local authority shall give notice in writing of the forfeiture to the officer,
(b) the officer may, not later than one month after such notice has been given to him, appeal to the appropriate Minister against the forfeiture,
(c) the appropriate Minister may by order either refuse the appeal or declare that all or part of the period of service shall be restored and, in the latter case, the said paragraph (f) shall have effect subject to the declaration,
(d) the decision of the appropriate Minister on the appeal shall be final.
Service as established officer.
14.—An established officer of a local authority shall be entitled to reckon as service—
(a) any period during which he was an established officer of that local authority,
(b) any period of two years or more during which he was an established officer of any other local authority,
(c) any period of less than two years during which he was an established officer of any other local authority and at the termination of which he resigned with the written sanction of such other local authority and with the consent of the appropriate Minister.
Service of established officer as mental hospital officer or servant.
15.—(1) An established officer shall be entitled to reckon as service—
(a) any period of two years or more during which he was a mental hospital officer or servant and which he was entitled to reckon as service for the purposes of Part VIII of the Mental Treatment Act, 1945 (No. 19 of 1945), or any earlier enactment corresponding to the said Part VIII, and
(b) any period of less than two years during which he was a mental hospital officer or servant, which he was entitled to reckon as service for the purposes of Part VIII of the Mental Treatment Act, 1945 (No. 19 of 1945), or any earlier enactment corresponding to the said Part VIII and at the termination of which he resigned from his office or relinquished his employment with the written sanction of the mental hospital authority under whom he held his office or employment and with the consent of the Minister for Health,
unless, if contributions were made by him during the period for the purposes of the said Part VIII or the said earlier enactment, those contributions have been paid back to him and have not been returned by him.
(2) Section 91 of the Mental Treatment Act, 1945, shall not apply in relation to an established officer.
Service of established officer under harbour authority.
16.—An established officer shall be entitled to reckon as service any period during which he held a pensionable position in the service of a harbour authority.
Service as school teacher.
17.—An established officer of a vocational education committee shall be entitled to reckon as service any period which he is permitted to reckon by regulations under section 72 of this Act.
Service in the civil service.
18.—Where—
(a) an established officer of a local authority held an established position in the civil service immediately before he was appointed to be a pensionable officer of a local authority, and
(b) the Minister for Finance consented to the application to him of this section, and
(c) the local authority to whose service he was appointed did not refuse at the time of such appointment to consent to the application to him of this section,
the officer shall be entitled to reckon as service his service for the purposes of the Superannuation Acts prior to the date of such appointment.
Service as pensionable servant.
19.—(1) An established officer of the corporation of the county borough of Dublin shall be entitled to reckon as service any continuous period ending on the day on which he first became a pensionable officer of that corporation during which he was a pensionable servant of that corporation.
(2) An established officer of the corporation of the borough of Dún Laoghaire shall be entitled to reckon as service any continuous period ending on the day on which he first became a pensionable officer of that corporation during which he was a pensionable servant of that corporation.
(3) A person shall not be regarded as having been, for the purposes of subsection (1) or (2) of this section, a pensionable servant of a corporation during a period unless during that period he was either an established servant of the corporation or registered in a register of permanent employees maintained by them at the commencement of this Part of this Act.
(4) An established officer shall be entitled to reckon as service any continuous period ending when he first became an established officer of any local authority during which he was an established servant of any local authority.
Pensionable local service of established officer.
20.—(1) For the purposes of this Act, the pensionable local service of an established officer at any time shall be the number of whole years in the period or in the aggregate of the periods which under this Part of this Act he is entitled at that time to reckon as service, any odd fraction of a whole year being disregarded.
(2) Notwithstanding subsection (1) of this section, where the number of whole years in the period or in the aggregate of the periods which under this Part of this Act a fire brigade officer is entitled to reckon as service, any odd fraction of a whole year being disregarded, is twenty-one or more, then, for the purposes of this Part of this Act, the pensionable local service of such officer shall be that number of years together with the excess of that number of years over twenty years.
Addition of years to pensionable local service of established officer.
21.—(1) Where an established officer of a local authority has not less than ten years of pensionable local service and—
(a) he is removed from his office for a cause other than misconduct or unfitness,
(b) his office is abolished, or
(c) his position has, in the opinion of the appropriate Minister, been materially altered to his detriment by changes in its conditions made without reasonable cause and he resigns his office with the consent of the appropriate Minister,
the local authority shall add to his pensionable local service such number of additional years as may be sanctioned by the Minister, but not exceeding—
(i) if his pensionable local service is twenty years or more—ten additional years,
(ii) if his pensionable local service is an even number of years less than twenty—half that number of additional years, or
(iii) if his pensionable local service is an odd number of years less than twenty—half the next lower whole number of additional years.
(2) Where—
(a) an established officer of a local authority who has not less than ten years of pensionable local service ceases to hold his office otherwise than by removal for his misconduct or unfitness for his office and in circumstances such that subsection (1) of this section does not apply, and
(b) there are, in the opinion of the local authority, special reasons which justify the addition of years to his pensionable local service,
the local authority, if they so think fit, may, with the consent of the Minister, add to his pensionable local service a number of additional years not exceeding ten.
Service of established officer at termination of office.
22.—For the purposes of this Part of this Act, the service of an established officer at the termination of his office shall be his pensionable local service together with any additional years added under section 21 of this Act.
Grant of lump sum and allowance to established officer on his ceasing to hold office.
23.—(1) Where—
(a) an established officer of a local authority ceases to hold his office and is not appointed to another pensionable office under a local authority or to be an officer for the purposes of Part VIII of the Mental Treatment Act, 1945 (No. 19 of 1945), and
(b) the local authority either are of opinion that in general he has served in such office with diligence and fidelity and to their satisfaction or, not being of that opinion, they nevertheless decide that, in the special circumstances of his case, he should be granted a reduced lump sum and allowance,
the local authority shall grant him a lump sum and allowance in any of the cases specified in subsection (2) of this section.
(2) The cases referred to in subsection (1) of this section are the following:—
(a) where the officer has ceased to hold his office otherwise than by removal and—
(i) he has attained the age of sixty years and has not less than twenty years of pensionable local service.
(ii) he is a fire brigade officer, has attained the age of fifty-five years and has not less than twenty years of pensionable local service, or
(iii) he has become incapable of performing his duties by reason of permanent infirmity of mind or body and has not less than ten years of pensionable local service;
(b) where the officer was removed from his office for a cause other than misconduct or unfitness and has not less than ten years of pensionable local service;
(c) where the office of the officer was abolished and he has not less than ten years of pensionable local service;
(d) where the position of the officer was, in the opinion of the appropriate Minister, materially altered to his detriment by changes in its conditions made without reasonable cause and he resigned his office with the consent of the appropriate Minister having not less than ten years of pensionable local service;
(e) where the officer has ceased to hold his office on account of having attained the age limit therefor and has not less than ten years of pensionable local service.
Determination of lump sum granted to established officer.
24.—The amount of the lump sum to be granted under section 23 of this Act to an established officer shall be equal to—
(a) one-thirtieth of his pensionable remuneration multiplied by the number of the years of his service at the termination of his office, or
(b) one and one-half times his pensionable remuneration, whichever is the less.
Determination of allowance granted to established officer.
25.—The allowance to be granted to an established officer under section 23 of this Act on his ceasing to hold office shall be—
(a) an allowance at the rate per annum of one-eightieth of his pensionable remuneration multiplied by the number of the years of his service at the termination of his office, or
(b) an allowance at the rate per annum of one-half of his pensionable remuneration,
whichever is the less.
Reduction of lump sum and allowance of established officer for unsatisfactory services.
26.—Where a local authority decide under section 23 of this Act that an established officer shall be granted a reduced lump sum and allowance, they shall reduce the amount of the lump sum and the rate per annum of the allowance granted to him under section 23 of this Act below the amount and rate that would be appropriate therefor under sections 24 and 25 of this Act and to an extent not less than fifty per cent.
Grant of short service gratuity to established officer.
27.—Where an established officer of a local authority having not less than one year and less than ten years of pensionable local service ceases to hold his office on account of being incapable of performing his duties by reason of permanent infirmity of mind or body, the local authority shall grant to him a gratuity of such amount, not exceeding one-twelfth of his pensionable remuneration multiplied by the number of the years of his pensionable local service, as they consider proper.

28.—(1) Where an established officer of a local authority dies in office having not less than five years of pensionable local service, the local authority shall grant to his legal personal representative a gratuity of an amount equal to—
(a) one-thirtieth of his pensionable remuneration multiplied by the number (subject to a maximum of forty-five) of such years of pensionable local service, or
(b) his pensionable remuneration,
whichever is the greater.
(2) Where an established officer of a local authority dies in office having not less than one year and less than five years of pensionable local service, the local authority shall grant to his legal personal representative a gratuity of such amount, not exceeding one-twelfth of his pensionable remuneration multiplied by the number of the years of his pensionable local service, as they consider proper.
Grant of gratuity to legal personal representative of deceased grantee under section 23.
29.—Where a person, who was an established officer of a local authority and who was granted under section 23 of this Act a lump sum and allowance on ceasing to hold office, dies before the total of all the sums received by him on foot of the lump sum and allowance is equal to his pensionable remuneration, the local authority shall grant to his legal personal representative a gratuity equal to the difference between the said total amount and the said pensionable remuneration.
Grant of gratuity to female established officer on marriage.
30.—Where a female established officer of a local authority who has not less than five years of pensionable local service ceases to hold her office by reason of her marriage or intended marriage and, before the expiration of three months after such cesser, she produces to the local authority a marriage certificate showing that she has been married, the following provisions shall have effect:—
(a) if the local authority are of opinion that she has served in her office with diligence and fidelity and to their satisfaction, the local authority shall grant to her a gratuity of an amount equal to—
(i) one-twelfth of her pensionable remuneration multiplied by the number of years of her pensionable local service, or
(ii) her pensionable remuneration,
whichever is the less;
(b) if the local authority, although not being of opinion that she has served in her office with diligence and fidelity and to their satisfaction, nevertheless decide that in the special circumstances of the case, she should be granted a reduced gratuity, they shall grant to her a gratuity of an amount equal to the amount that would be appropriate under paragraph (a) of this section reduced to such extent, not less than fifty per cent., as they consider proper.
Contributions by established officers.
31.—(1) An established officer of a local authority shall contribute to such local authority for the purposes of this Part of this Act at the rate per annum of five per cent. of—
(a) his annual salary, and
(b) the annual value as determined under section 35 of this Act of his emoluments, if any.
(2) The contribution to be made by an established officer of a local authority under this section may be obtained by such local authority by means of periodical deductions from his salary, but, if any such deduction proper to be made by a local authority from his salary is not made, such local authority may, without prejudice to any other remedy, recover the amount by retaining it out of any sums due by them to him or out of any lump sum or allowance payable by them to or in respect of him.
(3) Where, under section 64 of this Act, lump sums, allowances or gratuities granted by a local authority are paid by another local authority, the first-mentioned local authority shall from time to time (but not less frequently than once in each quarter) transfer to the other local authority—
(a) in case the first-mentioned local authority are a vocational education committee—one-half of all sums received by them by way of contribution under this section,
(b) in any other case—the whole of all such sums.
Return of contributions to established officer.
32.—(1) In this Part of this Act, the expression “the contributions” means, in relation to an established officer, the aggregate amount of—
(a) any contributions made by him under section 31 of this Act,
(b) where he has made any contributions under section 56 of this Act, those contributions,
(c) where he has made contributions under section 85 of the Mental Treatment Act, 1945 (No. 19 of 1945), those contributions,
(d) where he has made contributions under the Asylum Officers' Superannuation Act, 1909, those contributions,
but exclusive of any of the said contributions which have been returned to him and which he has not repaid.
(2) Where an established officer of a local authority who has less than ten years of pensionable local service ceases to hold his office for any cause other than misconduct and is not granted a gratuity under section 28 of this Act, the local authority shall return to him the contributions.
(3) Where an established officer of a local authority who has less than one year of pensionable local service dies, the local authority shall return the contributions to his legal personal representative.
(4) Where an established officer of a local authority having not less than ten years of pensionable local service ceases to hold his office for any cause other than misconduct, does not accept any other pensionable office under a local authority and is not entitled to a lump sum and allowance under section 23 of this Act or a marriage gratuity under section 30 of this Act, the local authority shall return to him the contributions.
(5) Where an established officer of a local authority is removed from office for misconduct, the local authority may, if they are of opinion that there are special reasons for so doing, return to him the contributions.
(6) Where a local authority return the contributions and the amount returned includes a sum for contributions made by the officer in question and held by another local authority or a mental hospital board, that authority or board shall refund such sum to the local authority who returned the contributions.
(7) The proviso to subsection (1) of section 31 of the Finance Act, 1922, shall apply in relation to a return of contributions made under this section.
Repayment of returned contributions.
33.—Where, after the contributions have been returned under section 32 of this Act to an established officer of a local authority on his ceasing to be an established officer, he again becomes an established officer of a local authority by virtue of a subsequent appointment, he shall be entitled, before (but not after) the expiration of twelve months after the subsequent appointment, to repay to the first-mentioned local authority the amount so returned by them for the purpose of enabling him to reckon as pensionable local service his period of such service before such cesser and, if he does repay the said amount and any other local authority or any mental hospital board refunded any part of it, the first-mentioned local authority shall repay to the other local authority or mental hospital board the amount of the refund.
Meaning of salary.
34.—(1) In this Part of this Act, the word “salary”—
(a) does not include any of the following:—
(i) payments for overtime,
(ii) travelling expenses or other allowances to cover particular expenses,
(iii) payments for acting as clerk to a local pensions committee under section 8 of the Old Age Pensions Act, 1908, or to a sub-committee appointed by any such committee,
(iv) payments for acting as superintendent registrar of births, deaths and marriages or as registrar of marriages,
(v) payments for special work of a casual or temporary nature or for filling a position temporarily or as a substitute pending a permanent appointment;
(b) subject to paragraph (a) of this subsection, includes all fees, poundages and other payments in money to an officer as such for his own use.
(2) The Minister may, if he thinks fit, by order direct that payments of a specified kind, being a kind mentioned in sub-paragraph (i) or (v) of paragraph (a) of subsection (1) of this section, shall be for the purposes of this Part of this Act part of the salary of a particular officer or of every officer, and thereupon, notwithstanding subsection (1) of this section, the word “salary” shall in this Part of this Act, include, as respects that officer or every officer (as may be appropriate) payments of that kind.
Calculation of pensionable remuneration of established officer.
35.—(1) A local authority shall, from time to time and whenever so directed by the Minister, determine the annual money value of every (if any) emolument of an established officer and shall keep displayed, in every office or institution which they maintain and in a conspicuous position accessible to their officers, a list of the values so determined of the emoluments of the established officers employed in or from such office or institution.
(2) A determination under subsection (1) of this section shall be subject to the sanction of the Minister.
(3) Where an established officer is in receipt of a particular rate of salary on any day, his pensionable remuneration for the purposes of this Part of this Act on that day shall be—
(a) in case the period or the aggregate of the periods which under this Part of this Act he is entitled to reckon as service is not less than three years—
(i) if, during the whole of the period or periods comprising the last three years of the period or the aggregate of the periods which under this Part of this Act he is entitled to reckon as service, he was either in receipt of salary at the said particular rate or was in the same grade of officers—the amount of salary which he would receive in a year calculated by reference to the said particular rate, or
(ii) in any other case—one-third of the aggregate of the amounts received by him by way of salary during the said period or periods comprising the said three years, or, in a case where he was not on full salary during the whole of the said period or periods, one-third of the aggregate of the amounts which he would have so received if he had been on full salary during the whole of the said period or periods, or
(b) in case the period or the aggregate of the periods which under this Part of this Act he is entitled to reckon as service is less than three years—
(i) if, during the whole of the said period or periods, he was either in receipt of salary at the said particular rate or was in the same grade of officers—the amount of salary which he would receive in a year calculated by reference to the said particular rate, or
(ii) in any other case—the monthly average, multiplied by twelve, of the amounts received by him by way of salary during the said period or periods or, in a case where he was not on full salary during the whole of the said period or periods, the monthly average, multiplied by twelve, of the amount which he would have so received if he had been on full salary during the whole of the said period or periods,
together with the annual value as then determined under subsection (1) of this section of his emoluments, if any.
Transitional provision with respect to service in the teaching of the Irish language.
36.—(1) An established officer of a vocational education committee shall be entitled to reckon as service any period which is, as respects such officer, a period to which this section applies.
(2) A period—
(a) which began after an established officer of a vocational education committee attained the age of twenty-one years and ended before the 31st of July, 1924, and
(b) as respects which the Minister for Education is satisfied that during the whole thereof such officer devoted the whole of his time under the direction of Connradh na Gaedhilge to the teaching of the Irish language or to the organisation of such teaching,
shall, as respects such officer, be a period to which this section applies if it is five years or more in duration or it is one of two or more such periods as aforesaid amounting in the aggregate to five years or more in duration.
General transitional provisions for Part II.
37.—(1) Where on the commencement of this Part of this Act a person is a pensionable officer of a local authority and, on the 1st day of January, 1947, he had not reached—
(a) in case he is a fire brigade officer, the age of fifty-five years, or
(b) in any other case, the age of sixty years,
he may, within but not later than six months after such commencement, apply in writing to the local authority to enter his name in the register and thereupon the local authority shall enter his name in the register and the entry shall have effect as if it had been made on such commencement.
(2) Where on the commencement of this Part of this Act a person is a pensionable officer of a local authority, his name shall not be entered in the register of any local authority unless the entry is made under subsection (1) of this section or it is made after his name has been entered under that subsection.
(3) A person whose name is entered under subsection (1) of this section shall be entitled to reckon as service his service at the commencement of this Part of this Act for the purposes of Part IV of the Act of 1925 or for the purposes of such Act passed before the Act of 1925 and relating to superannuation as may apply to him.
(4) Subsection (1) of section 15 of this Act shall apply in relation to a person whose name is entered under subsection (1) of this section as if the words “of two years or more” in paragraph (a) and the whole of paragraph (b) were omitted.
(5) Where a person whose name is entered under subsection (1) of this section held an established position in the civil service when he was appointed to be a pensionable officer of a local authority, section 18 of this Act shall apply in relation to him as if paragraphs (b) and (c) thereof were omitted.
(6) Where an established officer was a pensionable officer on the date of the passing of this Act and he had at such passing at least one whole year of pensionable local service, in any application to him of section 24 of this Act that section shall be construed as if it provided that the lesser sum therein referred to should be increased by one-half per cent. of that sum multiplied by the number of whole years (any fraction of a whole year being disregarded) in his pensionable local service at such passing.
(7) No contribution under section 31 of this Act shall be required from a person whose name is entered under subsection (1) of this section during a continuous period of service beginning on the commencement of this Part of this Act.
(8) No contribution under section 31 of this Act shall, during the appropriate period, be required from a person who is appointed after the commencement of this Part of this Act to be a pensionable officer of a local authority as a result of an examination (whether by way of open competition or otherwise) held before such commencement if any other person was appointed before such commencement to be a pensionable officer of the local authority as a result of that examination.
In this subsection, the expression “the appropriate period” means, as respects a person appointed to be a pensionable officer of a local authority, the period of continuous service of such person beginning when he takes up duty following such appointment.
(9) Where—
(a) a person died on or after the 1st day of January, 1947, and before the commencement of this Part of this Act,
(b) such person was, immediately before his death, a pensionable officer of a local authority, and
(c) such person, if he had not died and if he had remained in the service of the local authority, could have applied to have his name entered under subsection (1) of this section,
the local authority shall have power, which shall be exerciseable at their discretion and as respects which, notwithstanding any other provision of this Act, there shall be no appeal, to grant under section 28 of this Act the like gratuity (if any) as if this Part of this Act had commenced immediately before the death of such person and his name then stood entered under subsection (1) of this section.
(10) The provisions of this section shall have effect notwithstanding any other provision of this Part of this Act.
PART III.
Established Servants.
Register of established servants.
38.—(1) A local authority shall maintain a register to be known as the register of established servants (in this Part of this Act referred to as the register).
(2) Where a person under the age of sixty years has been a permanent servant of a local authority for a continuous period of three years, the local authority shall enter his name in the register.
(3) Where an established servant of a local authority relinquishes, with their consent, his employment with them for the purpose of becoming a permanent servant of another local authority and does become a permanent servant of the other local authority, the other local authority shall enter his name in the register.
(4) If any doubt, dispute or question arises as to whether the name of a particular person should be entered in the register, the doubt, dispute or question shall be determined by the appropriate Minister whose decision shall be final.
(5) A local authority shall not enter the name of any person in the register save in accordance with this section.
(6) The register shall show the maximum number for the time being of the persons to be at any one time in the employment of the local authority as permanent servants.
(7) A local authority shall keep at their principal office the register open at all reasonable times for inspection by their servants and by either—
(a) in the case of the corporation of a borough, the members of the council of the borough, or
(b) in any other case, the members of the local authority.
Record in the register of wages and emoluments.
39.—A local authority shall from time to time record in the register, as respects each name therein of an established servant his wages and the annual money value of his emoluments (if any) as determined under section 59 of this Act.
Removal from the register of person ceasing to be permanent servant, etc.
40.—(1) A local authority shall remove from the register the name of any person who ceases to be a permanent servant of such local authority.
(2) Notwithstanding subsection (1) of this section, where it is the practice of a local authority to take from time to time any particular person into their employment as a permanent servant after a period during which he is not so employed—
(a) the local authority shall not remove the name of such person from the register on any particular occasion when he ceases to be so employed unless they have decided not to so employ him again and, so long as his name remains in the register on account of this paragraph, he shall for the purposes of section 49 or subsection (2) of section 57 of this Act be regarded as not having ceased to be so employed.
(b) where, during any particular period when such person is not so employed by the local authority, they decide not to so employ him again, they shall remove his name from the register and, for the purposes of section 49 or subsection (2) of section 57 of this Act, he shall be regarded as having then ceased to hold his employment.
(3) Where, as respects an established servant of a local authority having less than five years of pensionable local service, it is ascertained after any particular year (being a year beginning on the day on which he first became such servant or any anniversary of that day) that he has not worked for the local authority as a permanent servant on two hundred or more days in that year, the local authority shall remove his name from the register and shall inform him of such removal and the reason therefor.
(4) The removal of a name from the register may be effected by a note on the register indicating that the name has been removed and the date of the removal and the reinstatement of a name in the register may be effected by a note on the register indicating that the name has been reinstated and the date of reinstatement.
(5) A person aggrieved by the removal of his name by a local authority from the register may appeal against the removal to the appropriate Minister and that Minister may by order either refuse the appeal or direct the name to be reinstated in the register and, in the latter case, the local authority shall reinstate the name in the register.
(6) The decision of the appropriate Minister on an appeal under this section shall be final.
Certain existing enactments not to apply to established servant.
41.—The provisions of any public or local Act (other than this Act) whereby a local authority is empowered to grant to any person in their service an allowance or gratuity on his ceasing to hold his position shall not apply in relation to any established servant of such local authority.
General limitations on service to be reckoned by established servant.
42.—(1) A provision of this Part of this Act entitling an established servant to reckon as service any period shall be subject to the overriding qualification that he shall not be entitled so to reckon any of the following:—
(a) any period in respect of which he has already received a lump sum, an allowance or a gratuity under this or any other Act relating to superannuation or under any scheme relating to superannuation made under any Act,
(b) any period before he reached the age of eighteen years,
(c) any period during which his name remains on the register on account of paragraph (a) of subsection (2) of section 40 of this Act,
(d) any period in respect of which any contributions have been returned to him under section 57 of this Act,
(e) any period in respect of which any contributions have been returned to him under section 32 of this Act, unless he has repaid such contributions under section 33 of this Act,
(f) any period before a date on which he was discharged from his employment under a local authority for misconduct or for unfitness,
(g) any period before a date on which he deliberately absents himself from the place where he performs his duties or refrains from performing his duties with the purpose of inducing the local authority of which he is a servant to alter his wages or conditions of service or of inducing any other local authority to alter the salaries, wages or conditions of service of any of their officers or servants;
(h) any period in any year which is a year beginning on the day on which he first became such servant or any anniversary of that day and during which he did not work for a local authority as a permanent servant on two hundred days or more.
(2) Where a period of service of a servant of a local authority has, having regard to paragraph (g) of subsection (1) of this section become forfeited—
(a) the local authority shall give notice in writing of the forfeiture to the servant,
(b) the servant may, not later than one month after such notice has been given to him, appeal to the appropriate Minister against the forfeiture,
(c) the appropriate Minister may by order either refuse the appeal or declare that all or part of the period of service shall be restored and, in the latter case, the said paragraph (g) shall have effect subject to the declaration,
(d) the decision of the appropriate Minister on the appeal shall be final.
Service as established servant.
43.—An established servant of a local authority shall be entitled to reckon as service any period during which he was an established servant of that local authority.
Service under other local authority.
44.—Where an established servant of a local authority was, immediately before he entered their service, an established officer or servant of another local authority, he shall be entitled to reckon as service under the first-mentioned local authority his pensionable local service at the time when he ceased to be an officer or servant of the other local authority.
Service of established servant as mental hospital officer or servant.
45.—(1) An established servant shall be entitled to reckon as service any period during which he was a mental hospital officer or servant and which he was entitled to reckon as service for the purposes of Part VIII of the Mental Treatment Act, 1945 (No. 19 of 1945), or any earlier enactment corresponding to the said Part VIII, unless, if contributions were made by him during the period for the purposes of the said Part VIII or the said earlier enactment, those contributions have been paid back to him and have not been returned by him.
(2) Section 91 of the Mental Treatment Act, 1945, shall not apply in relation to an established servant.
Service of established servant under harbour authority.
46.—An established servant shall be entitled to reckon as service any period during which he held a pensionable position in the service of a harbour authority.
Reckoning as service period of absence on duty as member of Reserve Force of the Defence Forces.
47.—Where an established servant of a local authority who is a member of the Reserve Force of the Defence Forces is absent from his employment for the purpose of attending and performing his duty as such member, he shall be entitled to reckon as service the period of such absence.
Pensionable local service of established servant.
48.—(1) For the purposes of this Act, the pensionable local service of an established servant shall be the number of whole years in the period or in the aggregate of the periods which under this Part of this Act he is entitled to reckon as service, any odd fraction of a whole year being disregarded.
(2) Notwithstanding subsection (1) of this section, where the number of whole years in the period or in the aggregate of the periods which under this Part of this Act a fire brigade servant is entitled to reckon as service, any odd fraction of a whole year being disregarded, is twenty-one or more, then, for the purposes of this Part of this Act, the pensionable local service of such servant shall be that number of years together with the excess of that number of years over twenty years.
Grant of allowance to established servant on his ceasing to hold employment.
49.—(1) Where—
(a) an established servant of a local authority ceases to hold his employment and is not employed by them as a permanent servant in another employment, and
(b) the local authority either are of opinion that he has served in such employment with diligence and fidelity and to their satisfaction or, not being of that opinion, they nevertheless decide that, in the special circumstances of his case, he should be granted a reduced allowance,
the local authority shall grant him an allowance in any of the cases specified in subsection (2) of this section.
(2) The cases referred to in subsection (1) of this section are the following:—
(a) where the servant has ceased to hold his employment otherwise than by dismissal for misconduct and—
(i) he has attained the age of sixty years and has not less than twenty years of pensionable local service,
(ii) he is a fire brigade servant, has attained the age of fifty-five years and has not less than twenty years of pensionable local service, or
(iii) he has become incapable of performing his duties by reason of permanent infirmity of mind or body and has not less than ten years of pensionable local service;
(b) where the servant has ceased to hold his employment on account of having attained the age limit therefor and has not less than ten years of pensionable local service.
Determination of allowance granted to established servant.
50.—The allowance to be granted to an established servant under section 49 of this Act on his ceasing to hold his employment shall be either—
(a) an allowance at the rate per annum of one-sixtieth of his pensionable remuneration multiplied by the number of the years of his pensionable local service, or
(b) an allowance at the rate per annum of two-thirds of his pensionable remuneration,
whichever is the less.
Reduction of allowance of established servant for unsatisfactory service.
51.—Where a local authority decide under section 49 of this Act that an established servant shall be granted a reduced allowance, they shall reduce the rate per annum of the allowance granted to him under section 49 of this Act below the rate that would be appropriate therefor under section 50 of this Act and to an extent not less than fifty per cent.
Grant of short service gratuity to established servant.
52.—Where an established servant of a local authority having not less than one year and less than ten years of pensionable local service ceases to hold his employment on account of being incapable of performing his duties by reason of permanent infirmity of mind or body, the local authority shall grant to him a gratuity of such amount, not exceeding one-twelfth of his pensionable remuneration multiplied by the number of the years of his pensionable local service, as they consider proper.
Grant of gratuity to legal personal representative of deceased established servant.
53.—(1) Where an established servant of a local authority dies in his employment having not less than five years of pensionable local service, the local authority shall grant to his legal personal representative a gratuity of an amount equal to his pensionable remuneration.
(2) Where an established servant of a local authority dies in his employment having not less than one year and less than five years of pensionable local service, the local authority shall grant to his legal personal representative a gratuity of such amount, not exceeding one-twelfth of his pensionable remuneration multiplied by the number of the years of his pensionable local service, as they consider proper.
Grant of gratuity to legal personal representative of deceased grantee under section 49.
54.—Where a person, who was an established servant of a local authority and who was granted under section 49 of this Act an allowance on his ceasing to hold his employment, dies before the total of all the sums received by him on foot of the allowance is equal to his pensionable remuneration, the local authority shall grant to his legal personal representative a gratuity equal to the difference between the said total amount and the said pensionable remuneration.
Grant of gratuity to female established servant on marriage.
55.—Where a female established servant of a local authority who has not less than five years of pensionable local service ceases to hold her employment by reason of her marriage or intended marriage and, before the expiration of three months after such cesser, she produces to the local authority a marriage certificate showing that she has been married, the following provisions shall have effect:—
(a) if the local authority are of opinion that she has served in her employment with diligence and fidelity and to their satisfaction, the local authority shall grant to her a gratuity of an amount equal to—
(i) one-twelfth of her pensionable remuneration multiplied by the number of years of her pensionable local service, or
(ii) her pensionable remuneration,
whichever is the less;
(b) if the local authority, although not being of opinion that she has served in her employment with diligence and fidelity and to their satisfaction, nevertheless decide that in the special circumstances of the case, she should be granted a reduced gratuity, they shall grant to her a gratuity of an amount equal to the amount that would be appropriate under paragraph (a) of this section reduced to such extent, not less than fifty per cent., as they consider proper.
Contributions by established servants.
56.—(1) An established servant of a local authority shall contribute to such local authority for the purposes of this Part of this Act at the rate per annum of four and one-sixth per cent. of—
(a) his wages, expressed as an annual amount, and
(b) the annual value as determined under section 59 of this Act of his emoluments, if any.
(2) The contribution to be made by an established servant of a local authority under this section may be obtained by such local authority by means of periodical deductions from his wages, but, if any such deduction proper to be made by a local authority from his wages is not made, such local authority may, without prejudice to any other remedy, recover the amount by retaining it out of any sums due by them to him or out of any allowance payable by them to or in respect of him.
(3) Where, under section 64 of this Act, lump sums, allowances or gratuities granted by a local authority are payable by another local authority, the first-mentioned local authority shall transfer from time to time (but not less frequently than once in each quarter) to the other local authority—
(a) in case the first-mentioned local authority are a vocational education committee—one-half of all sums received by them by way of contribution under this section,
(b) in any other case—the whole of all such sums.
Return of contributions of established servant.
57.—(1) In this Part of this Act, the expression “the contributions” means, in relation to an established servant, the aggregate amount of—
(a) any contributions made by him under section 56 of this Act,
(b) where he has made any contributions under section 31 of this Act, those contributions,
(c) where he has made contributions under section 85 of the Mental Treatment Act, 1945 (No. 19 of 1945), those contributions,
(d) where he has made contributions under the Asylum Officers' Superannuation Act, 1909, those contributions,
but exclusive of any of the said contributions which have been returned to him and which he has not repaid.
(2) Where an established servant of a local authority who has less than ten years of pensionable local service ceases to hold his employment for any cause other than misconduct and is not granted a gratuity under section 53 of this Act, the local authority shall return to him the contributions.
(3) Where the name of an established servant of a local authority is removed from the register under subsection (3) of section 40 of this Act, the local authority shall return to him the contributions.
(4) Where, as respects an established servant of a local authority having not less than five years of pensionable local service, it is ascertained after any particular year (being a year beginning on an anniversary of the day on which he first became such servant) that he has not worked for the local authority as a permanent servant on two hundred or more days in that year, the local authority shall return to him any contributions made by him under section 56 of this Act in respect of that year.
(5) Where an established servant of a local authority who has less than one year of pensionable local service dies, the local authority shall return the contributions to his legal personal representative.
(6) Where an established servant of a local authority having not less than ten years of pensionable local service ceases to hold his employment for any cause other than misconduct, does not accept any other employment under a local authority by virtue of which he becomes an established servant and is not entitled to an allowance under section 49 of this Act or a marriage gratuity under section 55 of this Act, the local authority shall return to him the contributions.
(7) Where an established servant of a local authority is dismissed from his employment for misconduct, the local authority may, if they are of opinion that there are special reasons for so doing, return to him the contributions.
(8) Where a local authority return the contributions and the amount returned includes a sum for contributions made by the servant in question and held by another local authority or a mental hospital board, that authority or board shall refund such sum to the local authority who returned the contributions.
(9) The proviso to subsection (1) of section 31 of the Finance Act, 1922, shall apply in relation to a return of contributions made under this section.
Meaning of wages.
58.—(1) In this Part of this Act, the word “wages”—
(a) does not include—
(i) payments for overtime,
(ii) travelling expenses or other allowances to cover particular expenses, or
(iii) payments for work of a casual or temporary nature or for filling a position temporarily, or as a substitute pending a permanent appointment;
(b) subject to paragraph (a) of this subsection, includes all fees, poundages and other payments in money to a servant as such for his own use.
(2) The Minister may, if he thinks fit, by order direct that payments of a specified kind, being a kind mentioned in sub-paragraph (i) or (iii) of paragraph (a) of subsection (1) of this section, shall be for the purposes of this Part of this Act part of the wages of a particular servant, or of every servant of a particular class or of every servant, and thereupon, notwithstanding subsection (1) of this section, the word “wages” shall in this Part of this Act include, as respects that servant, servants of that class, or every servant (as may be appropriate), payments of that kind.
Calculation of pensionable remuneration of established servant.
59.—(1) A local authority shall, from time to time and whenever so directed by the Minister, determine the annual money value of every (if any) emolument of an established servant and shall keep displayed, in every office or institution which they maintain and in a conspicuous position accessible to their servants, a list of the values so determined of the emoluments of the established servants employed in or from such office or institution.
(2) A determination under subsection (1) of this section shall be subject to the sanction of the Minister.
(3) Where an established servant is in receipt of a particular rate of wages on any day, his pensionable remuneration for the purposes of this Part of this Act on that day shall be—
(a) in case the period or the aggregate of the periods which under this Part of this Act he is entitled to reckon as service is not less than three years—
(i) if, during the whole of the period or periods comprising the last three years of the period or the aggregate of the periods which under this Part of this Act he is entitled to reckon as service, he was either in receipt of wages at the said particular rate or was in the same grade of servants—the amount of wages which he would receive in a year calculated by reference to the said particular rate, or
(ii) in any other case—one-third of the aggregate of the amounts received by him by way of wages during the said period or periods comprising the said three years, or, in a case where he was not on full wages during the whole of the said period or periods, one-third of the aggregate of the amounts which he would have so received if he had been on full wages during the whole of the said period or periods, or
(b) in case the period or the aggregate of the periods which under this Part of this Act he is entitled to reckon as service is less than three years—
(i) if, during the whole of the said period or periods, he was either in receipt of wages at the same particular rate or was in the same grade of servants—the amount of wages which he would receive in a year calculated by reference to the said particular rate, or
(ii) in any other case—the weekly average, multiplied by fifty-two, of the amounts received by him by way of wages during the said period or periods or, in a case where he was not on full wages during the whole of the said period or periods, the weekly average, multiplied by fifty-two, of the amounts which he would have so received if he had been on full wages during the whole of the said period or periods,
together with the annual value as then determined under subsection (1) of this section of his emoluments, if any.
Alteration of maximum number of permanent servants.
60.—(1) A local authority may from time to time alter by resolution the maximum number of the persons to be at any one time in their employment as permanent servants.
(2) A resolution under this section shall come into operation on the day specified in that behalf therein, not being earlier than one month after the date of the resolution.
(3) The first resolution by a local authority under this section shall not be passed unless at least five years have elapsed since the commencement of this Part of this Act in relation to them and any subsequent resolution by them under this section shall not be passed unless at least five years have elapsed since the next previous such resolution.
(4) The passing of a resolution under this section shall be a reserved function for the purposes of the County Management Acts, 1940 and 1942, and for the purposes of the Act or Acts relating to the management of any county borough.
Provisions with respect to certain absences from employment.
61.—(1) Where, in the case of any application as respects a servant of a local authority of the provisions of subsection (2) of section 38 or of paragraph (c) of subsection (1) or paragraphs (c) and (d) of subsection (2) of section 63 of this Act, it is ascertained that an absence on the part of the servant from his employment with the local authority occurred during any of the relevant three years on account of his illness, the temporary cessation of the work on which he was employed, the temporary reduction of the weekly quantity of such work or any other temporary cause not due to his act or default, he shall be regarded for the purposes of the said provisions as having been a permanent servant of the local authority during the absence if, but only if, the following conditions are complied with, that is to say:—
(a) at the end of the absence, or, where the absence continued after the end of the said year, at the end of the absence as so continued, he returned to the employment of the local authority,
(b) the absence did not exceed sixty days,
(c) in case the absence was one of two or more such absences occurring in the said year, the aggregate of such absences did not exceed sixty days.
(2) Where, in the case of any application as respects a servant of a local authority who is a member of the Reserve Force of the Defence Forces of the provisions of subsection (2) of section 38 or of paragraph (c) of subsection (1) or paragraphs (c) and (d) of sub-section (2) of section 63 of this Act, it is ascertained that an absence on the part of the servant from his employment with the local authority occurred during the relevant three years on account of his attending and performing his duty as a member of such Reserve Force, he shall be regarded for the purpose of the said provisions as having been a permanent servant of the local authority during the absence.
Age limits for established servants.
62.—(1) The provisions of section 8 of the Agriculture (Amendment) Act, 1944 (No. 3 of 1944) (which section relates to fixing of age limits for offices under a committee of agriculture) shall apply in relation to the employment of an established servant of a committee of agriculture as if such employment were an office.
(2) The provisions of section 6 of the Vocational Education (Amendment) Act, 1944 (No. 9 of 1944) (which section relates to fixing of age limits for offices under a vocational education committee) shall apply in relation to the employment of an established servant of a vocational education committee as if such employment were an office.
(3) The provisions of section 23 of the Local Government Act, 1941 (No. 23 of 1941) (which section relates to fixing of age limits for offices under certain local authorities) shall apply in relation to the employment of an established servant under a local authority, other than a committee of agriculture, a vocational education committee, a school attendance committee, the Dublin Fever Hospital Board or the Cork Fever Hospital Board, as if such employment were an office.
Transitional provisions for Part III.
63.—(1) Where—
(a) on the commencement in relation to a local authority of this Part of this Act a person is a permanent servant of the local authority, and
(b) he has not then reached—
(i) in case he is a fire brigade servant, the age of fifty-five years, or
(ii) in any other case, the age of sixty years, and
(c) the continuous period ending at such commencement during which he was a permanent servant of the local authority is three years or more,
he may, within but not later than six months after such commencement, apply in writing to the local authority to enter his name in the register and thereupon the local authority shall enter his name in the register and the entry shall have effect as if it had been made on such commencement, but his liability (if any) to make contributions under this Part of this Act shall commence at the time when his name is entered in the register.
(2) Where—
(a) on the commencement in relation to a local authority of this Part of this Act a person is a permanent servant of a local authority, and
(b) he has not then reached—
(i) in case he is a fire-brigade servant, the age of fifty-five years, or
(ii) in any other case, the age of sixty years, and
(c) the continuous period ending at such commencement during which he was a permanent servant of the local authority is less than three years, and
(d) he continues to be a permanent servant of the local authority until a time when the continuous period ending at that time during which he was a permanent servant of the local authority is three years,
he may, within but not later than six months after that time, apply in writing to the local authority to enter his name in the register and thereupon the local authority shall enter his name in the register and the entry shall have effect as if it had been made at such commencement, but his liability (if any) to make contributions under this Part of this Act shall commence at the time when his name is entered in the register.
(3) Where, on the commencement in relation to a local authority of this Part of this Act, a person is a permanent servant of the local authority, his name shall not be entered in the register of any local authority unless the entry is made under this section or it is made after his name has been entered under this section.
(4) A person whose name is entered under this section in the register of a local authority shall be entitled to reckon as service any period before the commencement in relation to the local authority of this Part of this Act during which he was a permanent servant of the local authority or of any body whose powers and duties were transferred to the local authority, except any such period in any year which was a year wholly before such commencement, which began on the day on which he first became such servant or on any anniversary of that day, and during which he did not work for such local authority or body as a permanent servant on two hundred days or more.
(5) No contribution shall be required under section 56 of this Act—
(a) from an established servant of a corporation of a county borough who was a servant of that corporation immediately before the commencement in relation to them of this Part of this Act and was then registered in a register of permanent employees then maintained by them,
(b) from an established servant of the corporation of the borough of Dun Laoghaire who was a servant of that corporation immediately before the commencement in relation to them of this Part of this Act and was then registered by them in a register of permanent employees then maintained by them,
(c) from an established servant of the City of Dublin Vocational Education Committee who was a servant of that committee immediately before the commencement in relation to them of this Part of this Act and who, on the 14th day of November, 1930, was a person to whom section 53 of the Act of 1925 applied.
(6) Where—
(a) a person died on or after the 1st day of January, 1947, and before the commencement in relation to the corporation of a county borough or the borough of Dun Laoghaire or the City of Dublin Vocational Education Committee of this Part of this Act,
(b) such person was, immediately before his death, a servant of such corporation then registered in a register of permanent employees then maintained by them or a servant of such Committee, who on the 14th day of November, 1930, was a person to whom section 53 of the Act of 1925 applied, and
(c) such person, if he had not died and if he had remained in the service of such corporation or Committee, could have applied to have his name entered under subsection (1) of this section,
such corporation or Committee of which he was a servant shall have power, which shall be exercisable at their discretion and as respects which, notwithstanding any other provision of this Act, there shall be no appeal, to grant under section 53 of this Act the like gratuity (if any) as if this Part of the Act had commenced in relation to them immediately before the death of such person and his name then stood entered under subsection (1) of this section.
(7) The provisions of this section shall have effect notwithstanding any other provision of this Part of this Act.
PART IV.
Miscellaneous.
Local authority by whom payment is to be made.
64.—(1) Where—
(a) a lump sum, allowance or gratuity is granted under this Act by a local authority, or
(b) contributions are returned under this Act by a local authority, or
(c) a local authority are required by this Act to make a refund,
the lump sum, allowance, gratuity, contribution or refund shall be paid—
(i) in case such local authority are a vocational education committee—by the local authority who pay under the Vocational Education Act, 1930 (No. 29 of 1930), the annual local contribution to the expenses of the committee,
(ii) in case such local authority are a committee of agriculture for a county—by the council of that county,
(iii) in case such local authority are a committee of a single local authority—by that single local authority,
(iv) in any other case—by such local authority.
(2) Where under this Act a local authority are required to refund any portion of a payment mentioned in subsection (1) of this section, the refund shall be made to the local authority by whom the payment was made under that subsection.
(3) A payment made by a local authority pursuant to sub-paragraph (i) of subsection (1) of this section shall not be reckoned for the purpose of any limitation on the amount of any annual local contribution payable by the local authority under the Vocational Education Act, 1930 (No. 29 of 1930), as amended by any subsequent enactment.
(4) There shall be paid out of moneys provided by the Oireachtas to a local authority paying any lump sum, allowance or gratuity granted under this Act by a vocational education committee, in aid of the rate or fund out of which the lump sum, allowance or gratuity is paid, one-half of every payment made by the local authority in respect of the lump sum, allowance or gratuity.
Recovery of payment by Minister of State.
65.—(1) Any sum which is required by this Act to be paid, repaid, returned or refunded by a person to a Minister of State may, without prejudice to its being recovered in any other manner, be recovered by deducting it in whole or in part from any money payable by any Minister of State for any purpose whatsoever to such person.
(2) The power to deduct under subsection (1) of this section shall be subject and without prejudice to the claims of the Guarantee Fund under the Land Purchase Acts.
Refund in respect of service under another authority.
66.—(1) Where a lump sum, allowance or gratuity is granted under this Act to or in respect of any person by a local authority (in this section referred to as the granting authority) and, in determining the amount thereof, any period of service under another local authority or a harbour authority or mental hospital board (in this section referred to as the contributing authority) has been reckoned, the contributing authority shall refund to the granting authority a part of the lump sum, allowance or gratuity (or, if the granting authority are a vocational education committee, a part of one-half of the lump sum allowance or gratuity) determined by reference to such person's periods of service under the contributing authority and the granting authority and his remunerations during those periods, and such part shall be settled by agreement between the contributing authority and the granting authority or, in default of agreement, by the Minister (after consultation, where the contributing authority are a harbour authority, with the Minister for Industry and Commerce).
(2) For the purposes of subsection (1) of this section, service under a committee of a contributing authority shall be deemed to have been service under such contributing authority and service under a joint committee of two or more contributing authorities shall be deemed to have been service under every such contributing authority.
Variation of part of allowance granted to established officer or servant in receipt of bonus.
67.—Where part of the remuneration, at the time he ceases to hold his office or employment, of an established officer or servant consists of bonus computed by reference to a cost-of-living index number, the part of any allowance granted to him under this Act which is referable to such bonus shall be liable to the same variation, if any, which would have applied in the case of a super-annuation allowance granted to a civil servant similarly remunerated who retired before the 1st day of November, 1946.
Cancellation of allowance on conviction of offence.
68.—(1) Where a person who is convicted on indictment of any offence and is sentenced to penal servitude or to any term of imprisonment with hard labour or exceeding twelve months is, at the time of the conviction, in receipt of an allowance granted under this Act by a local authority, the allowance shall thereupon stand cancelled and cease to be payable.
(2) Where a conviction which results in the cancellation under this section of an allowance is quashed or annulled or the convicted person is granted a free pardon, the cancellation shall be annulled, in the case of a quashing or annulment, as from the date of the conviction and, in the case of a free pardon, as from the date of the pardon.
(3) Where any allowance has been cancelled under this section, the local authority by whom the allowance was granted, if they so think proper, may, with the consent of the Minister, restore the allowance either in whole or in part.
Ascertainment of continuance of infirmity.
69.—(1) Where an allowance is granted under this Act to a person who is under the age specified for that allowance in subsection (2) of this section on the ground that he is incapable of performing his duties by reason of permanent infirmity of mind or body, the following provisions shall have effect:
(a) the local authority by whom the allowance is payable shall, until such person reaches the said age, ascertain from time to time whether his infirmity continues and, for that purpose, may, if they think fit, arrange for medical examinations and require him to submit himself thereto;
(b) if such person fails wilfully or refuses to submit himself to any such medical examination, the allowance shall cease to be paid;
(c) if not less than two registered medical practitioners nominated by such local authority certify that such person's infirmity has ceased and he has been offered a pensionable office or employment under a local authority of a kind similar to his former office or employment and at a rate of remuneration not less than that at which he was paid immediately before he ceased to hold his former office or employment, such local authority shall, subject to the sanction of the Minister, cancel the allowance and thereupon it shall cease to be paid.
(2) The age referred to in subsection (1) of this section is—
(a) for an allowance granted to a fire brigade officer or servant—fifty-five years,
(b) for any other allowance—sixty years.
(3) If a person to whom an allowance was granted in respect of a period of pensionable local service is offered in pursuance of paragraph (c) of subsection (1) of this section a new office or employment and accepts it, and the allowance is cancelled under this section, the following provisions shall have effect on his ceasing to hold the new office or employment:
(a) for the purposes of paragraph (a) of section 13 or paragraph (a) of section 42 of this Act, such period shall be regarded as not being a period in respect of which he has received a lump sum or allowance;
(b) any lump sum or gratuity granted to him or his legal personal representative under Part II or Part III of this Act shall be reduced by the amount of the lump sum (if any) granted to him with the allowance;
(c) such period shall be regarded as continuous with his period of service in the new office or employment and the period during which he was in receipt of the allowance shall be disregarded.
(4) Any dispute between a local authority and a person as to whether a new office or employment offered to such person is, for the purposes of paragraph (c) of subsection (1) of this section, of a kind similar to his former office or employment shall be decided by the appropriate Minister whose decision shall be final.
Determination by the Minister of certain doubts, etc.
70.—If any doubt, dispute or question arises or is, in the opinion of the Minister, likely to arise, as to whether a person is an officer for the purposes of this Act or a mental hospital officer or as to whether a person is a servant for the purposes of this Act or a mental hospital servant, the doubt, dispute or question shall be decided by the Minister and his decision shall be final.
Regulations specifying classes of fire brigade officers and servants.
71.—The Minister may make regulations specifying—
(a) the classes of officers of fire brigade authorities under the Fire Brigades Act, 1940 (No. 7 of 1940), who are to be fire brigade officers for the purposes of this Act, and
(b) the classes of servants of such authorities who are to be fire brigade servants for the purposes of this Act.
Regulations permitting reckoning by officer of vocational education committee of service as teacher.
72.—(1) The Minister, after consultation with the Minister for Education and with the consent of the Minister for Finance, may make regulations permitting an officer of a vocational education committee who before he became such an officer had teaching service as a national school teacher or a secondary school teacher or a vocational or technical school teacher or any combination of such services to reckon such teaching service as service, and the regulations may prescribe the nature of the teaching service and the amount thereof which may be so reckoned and the extent to which and the manner in which the teaching service may be so reckoned.
(2) Where a lump sum, allowance or gratuity is paid by a local authority to or in respect of an officer and, in determining the amount of the lump sum, allowance or gratuity, any period during which the officer was a secondary school teacher has been reckoned pursuant to regulations under this section, the Minister for Finance, after consultation with the Minister for Education, may determine what part or parts (if any) of the lump sum, allowance or gratuity shall be paid out of the Secondary Teachers' Pension Fund, and thereupon the Minister for Education may refund to the local authority out of that fund any part or parts so determined.
(3) Where a lump sum, allowance or gratuity is paid by a local authority to or in respect of an officer and, in determining the amount of the lump sum, allowance or gratuity, any period during which the officer was a national school teacher has been reckoned pursuant to regulations under this section, the Minister for Finance, after consultation with the Minister for Education, may determine what part or parts (if any) of the lump sum, allowance or gratuity shall be borne by the State, and thereupon the Minister for Education may refund to the local authority any part or parts so determined out of moneys provided by the Oireachtas.
Appeals to the Minister.
73.—(1) Where a person is aggrieved by the failure or refusal of a local authority to grant under this Act a lump sum, allowance or gratuity or to return under this Act contributions, he may appeal to the Minister against such failure or refusal.
(2) Where a person is aggrieved by the amount of any lump sum, allowance or gratuity granted by a local authority under this Act, he may appeal to the Minister against such amount.
(3) An appeal under this section by a person against a failure to make a grant or return of contributions shall be brought not later than eight months after the circumstances arose which he alleges required the local authority to make the grant or return of contributions and any other appeal under this section shall be brought not later than six months after the decision appealed from.
(4) On an appeal under this section, the Minister may by order either refuse the appeal or make such provisions as should in his opinion have been made by the local authority, and provisions so made by the Minister shall have effect as if made by the local authority.
(5) The decision of the Minister on an appeal under this section shall be final.
Area of charge of payment of local authority.
74.—(1) A sum payable by a local authority under this Act in respect of a period during which a person was an officer or servant of such local authority shall be charged on the area on which the remuneration of such person would have been charged if he had continued to hold the same office or employment under such local authority.
(2) A sum payable by a local authority under this Act in respect of a period during which a person was an officer or servant of another local authority shall be charged on the area on which the expenses incurred by the first-mentioned local authority in supplying moneys to the other local authority are charged.
(3) Where a lump sum, allowance or gratuity is granted by a local authority to or in respect of an officer or servant and in computing the amount thereof a period of service under another local authority has been reckoned, the payment of the lump sum, allowance or gratuity by the first-mentioned local authority shall be regarded for the purposes of this section as solely in respect of service of such person under them.
Suspension or reduction of allowance on reappointment of recipient.
75.—(1) Where a person to whom an allowance is payable under this or any other Act by a local authority or mental hospital board receives any payment (inclusive of the money value of emoluments, if any) from a local authority or mental hospital board or out of moneys provided by the Oireachtas for services rendered, no more of the allowance shall be paid to him in any year than so much as, with the said payment, equals the remuneration (inclusive of the money value of emoluments, if any) on which the allowance was computed.
(2) A local authority or mental hospital board paying an allowance to a person to whom subsection (1) of this section applies may from time to time, as may appear proper to them for the purpose of giving effect to subsection (1) of this section, suspend, abate or reduce or otherwise adjust the payments made or to be made by them in respect of the allowance.
(3) If and so long as, pursuant to this section, an allowance is not paid, any refund of part of such allowance payable under this or any other Act shall also not be paid.
(4) If and so long as, pursuant to this section, the amount payable in respect of an allowance is abated or reduced, any refund of part of such allowance payable under this or any other Act shall also be reduced proportionately.
Assignment of allowance, etc.
76.—(1) The following provisions shall have effect in relation to any payment (in this section referred to as the grant) payable under this Act or under Part IV of the Act of 1925 by a local authority to any person (in this section referred to as the recipient), that is to say:—
(a) every assignment of and charge on the grant and every agreement to assign or charge the grant shall, except so far as it is made for the benefit of the wife or husband or dependent relatives of the recipient, be void, and on the bankruptcy of the recipient the grant shall not be paid to any trustee or other person acting on behalf of the creditor;
(b) where any public assistance is given in pursuance of the Public Assistance Act, 1939 (No. 27 of 1939), to the recipient or to anyone whom he is liable under that Act to maintain, the local authority may pay the whole or any part of the grant to the public assistance authority giving the assistance, and so much of the grant as is so paid may be applied in repayment of any sums expended on such assistance and, subject thereto, shall be paid or applied by the public assistance authority to or for the benefit of the recipient;
(c) if the recipient neglects to maintain any person whom he is liable to maintain, the local authority may in their discretion pay or apply the whole or any part of the grant to or for the benefit of that person;
(d) if the recipient appears to the local authority to be of unsound mind or otherwise incapacitated to act, they may pay so much of the grant as they think fit to the institution or person having the care of the recipient, and may pay the surplus (if any) or such part thereof as they think fit for or towards the maintenance and benefit of the wife or husband or dependent relatives of the recipient;
(e) if the recipient or the officer or servant in respect of whom the grant is payable has died and a sum not exceeding one hundred pounds is due on account of the grant, probate or other proof of title of the personal representatives of the deceased may, if the local authority so think fit, be dispensed with and the sum may be paid or distributed to or among the persons appearing to the local authority to be beneficially entitled to the personal estate of the deceased, or to or among any one or more of those persons, or, in the case of the illegitimacy of the deceased, to or among such persons as the local authority think fit, and the local authority and any of their officers making the payment shall be discharged from all liability as respects any such payment or distribution;
(f) any sum payable to a minor on account of the grant may be paid either to the minor or to such person and on such conditions for the benefit of the minor as the local authority think fit;
(g) where a payment is made to any person by the local authority in pursuance of this section the receipt of that person shall be a good discharge for the sum paid.
(2) The Minister may make rules requiring declarations to be made for any purpose relating to payments made pursuant to this section and a person to whom any such payment may be made shall not be entitled to receive such payment if he fails to make any declarations which he is required by such rules to make.
(3) Any person who makes a wilful misstatement of material fact in any declaration made under any rule made under this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds or to imprisonment for any term not exceeding three months.
Gratuity or allowance in case of injury.
77.—(1) Where an officer or servant of a local authority is injured—
(a) in the actual discharge of his duty, and
(b) without his own default, and
(c) by some injury specifically attributable to the nature of his duty,
the local authority, with the consent of the Minister, may grant to him, and, if within seven years after the date of the injury, he dies as a direct result thereof, to his widow (or, in the case of a female officer or servant, her widowed husband), his father or mother, if wholly dependent on him at the time of his death, and to or in respect of his children, or any of them, such gratuity or allowance in money for life or for a limited period as the local authority may consider reasonable and as may be permitted by regulations under this section.
(2) An allowance granted under this section to an injured person shall not, together with any other allowance (inclusive of the annuity value, calculated in such manner as the Minister directs, of any lump sum) payable by a local authority for which he is qualified, exceed five-sixths of the remuneration (inclusive of the money value of emoluments, if any) on which such other allowance is computed.
(3) The Minister may make regulations for the purposes of this section.
Particulars of benefits in advance of retirement.
78.—(1) Where an officer or servant of a local authority intends to retire from his office or employment on a particular date, he may, not later than six months and not earlier than twelve months before that date, give to the local authority notice in writing stating—
(a) that he intends to retire on that date,
(b) the reasons for which he intends to retire,
(c) that he wishes to be given particulars of his benefits on retirement.
(2) Where an officer or servant gives to a local authority a notice under this section stating that he wishes to be given particulars of his benefits on retirement, the local authority shall within two months give to the officer or servant a statement showing—
(a) whether they intend on such retirement to exercise any power given to them by this or any other Act to grant to him any lump sum, allowance or gratuity or to return to him any contributions or to add any years to his service or to increase or reduce the amount of any lump sum or allowance to which he may be entitled,
(b) where they intend to exercise any power such as is mentioned in paragraph (a) of this subsection, particulars of the manner in which they intend to exercise the power,
(c) the amount of every (if any) lump sum, allowance or gratuity or return of contributions to which, in their opinion having regard to their intentions stated in pursuance of paragraphs (a) and (b) of this subsection, he will be entitled on such retirement,
but where they propose to include in the statement their intention to exercise any power the exercise of which requires the consent or sanction of the Minister, they shall not give the statement unless and until the Minister approves thereof.
(3) The provisions of section 73 of this Act (or, in the case of the exercise of a power under any other Act, any corresponding provisions of that Act) shall apply in relation to a statement of intentions given by a local authority under paragraph (a) or (b) of subsection (2) of this section as if the contemplated retirement to which the statement relates had taken place and as if such intentions were decisions taken by the local authority on the date when the statement was given.
(4) Where—
(a) the intended retirement of an officer or servant of a local authority referred to in a notice under subsection (1) of this section takes place on the date mentioned and for the reasons stated in the notice, and,
(b) the intentions of the local authority shown in the statement given to him in pursuance of paragraphs (a) and (b) of subsection (2) of this section, or, if those intentions have been varied by the Minister on appeal, those intentions as so varied, are implemented,
the said intentions, as implemented, shall not then be subject to any appeal.
Increase of allowance in certain cases.
79.—(1) Where a local authority or mental hospital board granted before the passing of this Act an allowance or a lump sum to or in respect of a person in relation to his having ceased after the 1st day of July, 1940, to hold any office or employment in their service, they may, within twelve months after the passing of this Act, grant one increase (and no more) of the rate of the allowance or the amount of the lump sum, and such increase shall be an increase to such extent as may be sanctioned by the relevant Minister and, in the case of an increase of an allowance, shall have effect as from the date when the office or employment ceased to be held or the 1st day of November, 1946, whichever is the later.
(2) Where any such allowance as is referred to in section 46 of the Act of 1925 was in course of payment on the 1st day of November, 1946, the allowance shall be adjusted, with effect as from that day, in the following manner:—
(a) such part (if any) of the allowance as was computed by reference to the emergency bonus under the Emergency Powers (No. 312) Order, 1944 (S.R. & O., No. 36 of 1944), shall cease to be payable;
(b) the increase or addition added to the allowance under subsection (2) of section 46 of the Act of 1925 shall be adjusted as if it were calculated by reference to a cost-of-living index figure of 270 and shall thereupon cease to be variable.
(3) Where a local authority or mental hospital board grant under this or any other Act an allowance or lump sum to or in respect of a person in relation to his having ceased to hold before the 1st day of April, 1950, any office or employment in their service, they may, in the case of an allowance, grant it at a rate greater, to such extent as may be sanctioned by the relevant Minister, than the rate that would be appropriate therefor apart from this subsection and, in the case of a lump sum, grant it as of an amount greater, to such extent as may be sanctioned by the relevant Minister, than the amount that would be appropriate therefor apart from this subsection.
(4) Where a person is aggrieved by a refusal or failure during the period of twelve months after the passing of this Act to grant an increase under subsection (1) of this section, such person may, in the case of a refusal, not later than six months after the refusal, or, in the case of a failure, not later than six months after the expiration of the said period of twelve months, appeal to the relevant Minister against the refusal or failure.
(5) Where a person is aggrieved by an increase granted under subsection (1) of this section, he may, not later than six months after the grant of the increase, appeal against it to the relevant Minister.
(6) On an appeal under this section, the relevant Minister may by order either refuse the appeal or make such provisions as should in his opinion have been made by the local authority or mental hospital board concerned, and any provision so made by the relevant Minister shall have effect as if made by that authority or board.
(7) The decision of the relevant Minister on an appeal under this section shall be final.
(8) In this section—
the expression “the relevant Minister” means—
(a) in relation to a local authority other than a mental hospital authority, the Minister, and
(b) in relation to a mental hospital authority, the Minister for Health.
General provision as to allowance being for life.
80.—Save as otherwise provided by this Act, an allowance granted under this Act shall be an allowance for the life of the person to whom it is granted.
Age limits for officers and servants of Dublin Fever Hospital Board and Cork Fever Hospital Board.
81.—The provisions of section 23 of the Local Government Act, 1941 (No. 23 of 1941) (which section relates to fixing of age limits for offices under certain local authorities) shall apply in relation to the office of an officer or the employment of a servant of the Dublin Fever Hospital Board or the Cork Fever Hospital Board as if such office or employment were an office under a local authority for the purposes of that Act.
Officer of local authority becoming civil servant.
82.—(1) The pensionable local service of an established officer of a local authority who has not less than ten years of pensionable local service and who is appointed to an established position in the civil service shall be deemed for the purposes of the Superannuation Acts to be service by him in an established position in the civil service.
(2) Where a person holding at the passing of this Act and established position in the civil service who—
(a) was appointed to such a position after the 6th day of December, 1922, and
(b) was immediately before such appointment a pensionable officer under one or more than one local body for the purposes of Part IV of the Act of 1925,
applies not later than one year after the passing of this Act to the appropriate Minister for a certificate of the facts mentioned in paragraphs (a) and (b) of this subsection, that Minister shall inquire into the matter and, if he is satisfied that those facts exist, he shall so certify and shall include in the certificate particulars of the pensionable local service of such person at the date of such appointment.
(3) Where a certificate has been issued under subsection (2) of this section in respect of any person, his pensionable local service as stated in the certificate shall be deemed for the purposes of the Superannuation Acts to be service by him in an established position in the civil service.
(4) Where, under the Superannuation Acts and under the enactments (including this Act) relating to the grant of superannuation and compensation for loss of office to officers of local authorities, the benefits accruing or the conditions qualifying persons for benefit are different, the Minister for Finance may determine that specified modifications corresponding to that difference shall be made for any particular case to which subsection (1) or subsection (3) of this section applies in any amount to be granted under the Superannuation Acts, and the modifications so determined shall be made accordingly.
(5) Where an allowance, lump sum or gratuity is paid to or in respect of a person under the Superannuation Acts by virtue of this section, the Minister for Finance may determine what part or parts of the payment shall be borne in accordance with subsection (6) of this section.
(6) Where the Minister for Finance determines under subsection (5) of this section that part or parts of a payment to or in respect of a person shall be borne in accordance this subsection—
(a) the Minister shall determine whether such part or parts shall be borne by one local authority of which such person was an officer or by two or more local authorities of each of which such person was an officer,
(b) if the Minister determines that such part or parts shall be borne by one local authority, that local authority shall pay to the Minister the amount of such part or parts,
(c) if the Minister determines that such part or parts shall be borne by two or more local authorities, he shall also determine the amount to be borne by each such local authority and that local authority shall pay that amount to the Minister,
(d) any amount paid to the Minister under this section shall be paid into or disposed of for the benefit of the Exchequer in accordance with the direction of the Minister for Finance.
Civil servant becoming officer of local authority.
83.—(1) Where an allowance, lump sum or gratuity is payable under this or any other Act to or in respect of a person and, in determining the amount of the payment, any period of service by such person in an established position in the civil service has been reckoned, the Minister for Finance may determine what part or parts of the payment shall be borne by the State and thereupon the part or parts so determined may be refunded to the local authority out of moneys provided by the Oireachtas.
(2) Where, under the Superannuation Acts and under the enactments (including this Act) relating to the grant to officers of local authorities of superannuation or compensation for loss of office, the benefits accruing or the conditions qualifying persons for benefit are different, the Minister, with the consent of the Minister for Finance, may determine that, for any particular case in which service in the civil service is to be reckoned, in calculating the amount of such a grant specified modifications shall be made in such amount, and the modifications so determined shall be made accordingly.
Special provisions for certain cases.
84.—(1) Where, as respects a person who is a pensionable officer of a local authority on the passing of this Act, the following conditions are complied with, that is to say:
(a) immediately before he was appointed to be such officer, he held an established position in the civil service of Saorstát Eireann for a period,
(b) immediately before the period mentioned in paragraph (a) of this subsection, he held an established position in the civil service of the Provisional Government for a period,
(c) immediately before the period mentioned in paragraph (b) of this subsection, he held an established position in the civil service of Dáil Eireann for a period,
(d) immediately before the period mentioned in paragraph (c) of this subsection, he was a pensionable officer of a local authority for a period,
all the said periods may be aggregated and deemed to be service for the purposes of any Act (including this Act) relating to superannuation of officers of local authorities and applying to such person.
(2) Where, as respects a person who holds an established position in the Civil Service of the Government on the passing of this Act, the following conditions are complied with, that is to say:—
(a) immediately before he commenced to hold such position, he held an established position in the civil service of Saorstát Éireann for a period,
(b) immediately before the period mentioned in paragraph (a) of this subsection, he held a temporary position in the civil service of Saorstát Éireann for a period,
(c) before the period mentioned in paragraph (b) of this sub-section, he was a pensionable officer of a local authority for a period,
the periods mentioned in paragraphs (a) and (c) of this subsection may be aggregated and deemed to be service for the purposes of the Superannuation Acts as applying to such person.
(3) Where, as respects a person who holds an established position in the civil service of the Government on the passing of this Act, the following conditions are complied with, that is to say:
(a) immediately before he commenced to hold such position he held an established position in the civil service of Saorstát Eireann for a period,
(b) immediately before the period mentioned in paragraph (a) of this subsection, he held an established position in the civil service of the Provisional Government for a period,
(c) immediately before the period mentioned in paragraph (b) of this subsection, he held an established position in the civil service of Dáil Eireann for a period,
(d) immediately before the period mentioned in paragraph (c) of this subsection, he was a pensionable officer of a local authority for a period,
all the said periods may be aggregated and deemed to be service for the purposes of the Superannuation Acts as applying to such person.
(4) Where, as respects a person who holds an established position in the civil service of the Government on the passing of this Act, the following conditions are complied with, that is to say:
(a) immediately before he commenced to hold such situation, he held an established position in the civil service of Saorstát Éireann for a period,
(b) immediately before the period mentioned in paragraph (a) of this subsection, he was a pensionable officer of a local authority for a period,
(c) immediately before the period mentioned in paragraph (b) of this subsection, he held an established position in the civil service of Saorstát Éireann for a period,
all the said periods may be aggregated and deemed to be service for the purposes of the Superannuation Acts as applying to such person.
(5) Where, under the Superannuation Acts and under the enactments (including this Act) relating to the grant of superannuation and compensation for loss of office to officers of local authorities, the benefits accruing or the conditions qualifying persons for benefit are different, the Minister for Finance may determine that specified modifications corresponding to that difference shall be made for any particular case to which subsection (3) or subsection (4) of this section applies in any amount to be granted under the Superannuation Acts, and the modifications so determined shall be made accordingly.
(6) Where an allowance, lump sum, or gratuity is paid to or in respect of a person under the Superannuation Acts by virtue of this section, the Minister for Finance may determine what part or parts of the payment shall be borne in accordance with subsection (7) of this section.
(7) Where the Minister for Finance determines under subsection (6) of this section that part or parts of a payment to or in respect of a person shall be borne in accordance with this sub-section—
(a) the Minister shall determine whether such part or parts shall be borne by one local authority of which such person was an officer or by two or more local authorities of each of which such person was an officer,
(b) if the Minister determines that such part or parts shall be borne by one local authority, that local authority shall pay to the Minister the amount of such part or parts,
(c) if the Minister determines that such part or parts shall be borne by two or more local authorities, he shall also determine the amount to be borne by each such local authority and that local authority shall pay that amount to the Minister,
(d) any amount paid to the Minister under this section shall be paid into or disposed of for the benefit of the Exchequer in accordance with the direction of the Minister for Finance.
Preservation of continuity of service of servants of Limerick Corporation.
85.—(1) Where a servant of the corporation was absent from duty during any period in respect of which this section applies and the period of absence would, but for this section, be regarded for the purposes of the pension enactments as breaking the continuity of his service with the corporation, the following provisions shall have effect for those purposes:—
(a) the period of absence shall be regarded as not breaking the continuity of his service with the corporation, and
(b) notwithstanding the provisions of the foregoing paragraph, the length of the period of absence shall not be taken into account in reckoning the length of his service with the corporation nor, where an allowance for life or a gratuity is granted to him, in reckoning the amount thereof.
(2) In this section—
the expression “the corporation” means the Mayor, Aldermen and Burgesses of Limerick;
the expression “period in respect of which this section applies” means any period beginning on or after the 30th day of June, 1944, and ending before or on the 6th day of July, 1944;
the expression “the pension enactments” means, in relation to a servant of the corporation, the enactments (including this Act) governing the grant to him on ceasing to be employed of an allowance for life or a gratuity.
Validation of certain superannuation allowances granted by Cork Corporation.
86.—Any superannuation allowance granted by the Lord Mayor, Aldermen and Burgesses of Cork to any of their servants during the period which began on the 9th day of September, 1926, and ended on the 31st day of March, 1948, shall be valid in all respects and payment of such allowance may accordingly continue to be made after the passing of this Act.
Meaning of pensionable officer in Part IV of Act of 1925.
87.—The expression “pensionable officer” in Part IV of the Act of 1925 shall not include and shall be deemed never to have included a mental hospital officer of a local body.
Application of Part IV of the Act of 1925 to certain permanent servants.
88.—(1) Part IV of the Act of 1925 shall apply in relation to a permanent servant of a local body in relation to whom Part III of this Act has come into operation (not being a local body to whom section 53 of the Act of 1925 applies) who, on the day on which the said Part III came into operation in relation to such body, was sixty years of age or more, or in the case of a fire brigade servant, was fifty-five years of age or more, as if his employment were a pensionable office, and for the purposes of the said application—
(a) the word “salary” shall include wages,
(b) in calculating his service when his employment ceases, only his continuous service under such local body shall be reckoned.
(2) Part IV of the Act of 1925 shall, subject to the subsequent subsections of this section, apply in relation to a permanent servant of a vocational education committee in relation to whom Part III of this Act has come into operation who, on the day on which the said Part III came into operation in relation to such committee, was sixty years of age or more as if his employment were a pensionable office, and for the purposes of the said application—
(a) the word “salary” shall include wages,
(b) in calculating his service when his employment ceases, only his continuous service under such committee or any body of whom such committee were the successors shall be reckoned.
(3) Section 50 of the Act of 1925 shall not apply in respect of vocational education committees and their servants referred to in subsection (2) of this section, and in lieu thereof it is hereby enacted that every sum payable under Part IV of the Act of 1925 as applied by this section in respect of an allowance or gratuity granted thereunder to a person who was previously a servant of a vocational education committee shall be paid by the local authority who under the Vocational Education Act, 1930 (No. 29 of 1930), pays the annual local contribution to the expenses of such committee and shall be raised by means of the same rate and be paid out of the same fund and be charged on the same area as such annual local contribution is raised by means of, paid out of and charged upon, but no such sum shall be reckoned for the purposes of any enactment limiting the amount of such rate.
(4) There shall be paid out of moneys provided by the Oireachtas to a local authority paying any allowance or gratuity in pursuance of subsection (3) of this section, in aid of the rate or fund out of which the allowance or gratuity is so paid, one-half of every payment made by the local authority in respect of the allowance or gratuity.
Reckoning of service in the civil service in certain cases.
89.—An officer of a local body—
(a) who was appointed to be such officer before the commencement of Part II of this Act, and
(b) in relation to whom Part IV of the Act of 1925 or any Act passed before the Act of 1925 and relating to superannuation applies, and
(c) who at the time when he was appointed to be such officer held an established position in the civil service,
shall be entitled to reckon as service for the purposes of the said Part IV or the said Act passed before the Act of 1925 his service for the purposes of the Superannuation Acts at the time of such appointment.
Reckoning of service as school teacher in certain cases.
90.—An officer of a vocational education committee in relation to whom Part IV of the Act of 1925 or any Act passed before the Act of 1925 and relating to superannuation applies shall be entitled to reckon as service for the purposes of the said Part IV or the said Act passed before the Act of 1925 any period which he is permitted to reckon by regulations under section 72 of this Act.
Reckoning of service under harbour authority in certain cases.
91.—An officer of a local body in relation to whom Part IV of the Act of 1925 or any Act passed before the Act of 1925 and relating to superannuation applies shall be entitled to reckon as service for the purposes of the said Part IV or the said Act passed before the Act of 1925 any period during which he held a pensionable position in the service of a harbour authority.
Allowances under Part IV of the Act of 1925 to officers in receipt of cost of living bonus.
92.—(1) This section applies to any officer of a local body whose yearly salary and emoluments within the meaning of Part IV of the Act of 1925 consist on the date on which he ceases to hold office of—
(a) an amount (in this section referred to as the emergency bonus) granted on account of the emergency declared by resolutions passed by each House of the Oireachtas on the 2nd day of September, 1939, to exist, and
(b) a temporary increase or addition (in this section referred to as the cost of living bonus) which was expressed at the time of granting to be granted to meet the increased cost of living, which is calculated according to the amount of the remainder (in this section referred to as the basic salary) of his salary and emoluments apart from the emergency bonus and which, subject to the Local Authorities (Cost of Living) Acts, 1940 and 1945, is variable from time to time in accordance with the average cost of living in the State, and
(c) the basic salary.
(2) An allowance granted under Part IV of the Act of 1925 to any officer of a local body to whom this section applies shall consist of two parts, namely:
(a) a part which shall be in respect of the basic salary and cost of living bonus, which shall be computed by reference to the basic salary only and which shall be increased in the manner specified in subsection (2) of section 46 of the Act of 1925,
(b) a part which shall be in respect of and computed by reference to the emergency bonus.
(3) The foregoing provisions of this section shall apply in relation to an allowance which was granted under Part IV of the Act of 1925 before the passing of this Act and in relation to which those provisions would have applied when the allowance was granted if they had then been in force.
Allowances and gratuities under Part IV of Act of 1925 without consent of Minister.
93.—Notwithstanding anything contained in Part IV of the Act of 1925, the consent of the Minister shall not be required to the grant under that Part of—
(a) an annual allowance the amount of which does not exceed one-sixtieth of the yearly salary and emoluments of the grantee for each completed year of his service, or
(b) a gratuity under subsection (3) or subsection (4) of section 44 of the Act of 1925.
