1.—(1) Féadfar An tAcht Rialtais Áitiúil, 1955, a ghairm den Acht seo.
(2) Féadfar na hAchta Rialtais Áitiúil, 1925 go 1955, a ghairm de na hAchta Rialtais Áitiúil, 1925 go 1953, agus den Acht seo le chéile.
(3) Forléireofar le chéile mar aon Acht amháin na hAchta Rialtais Áitiúil, 1925 go 1953, agus an tAcht seo.
Mínithe.
2.—San Acht seo—
ciallaíonn “Acht 1925” an tAcht Rialtais Áitiúil, 1925 (Uimh. 5 de 1925);
ciallaíonn “Acht 1941” an tAcht Rialtais Áitiúil, 1941 (Uimh. 23 de 1941);
ciallaíonn “Acht 1946” an tAcht Rialtais Áitiúil, 1946 (Uimh. 24 de 1946);
ciallaíonn “an tAire” an tAire Rialtais Áitiúil;
ciallaíonn an briathar “forordú” forordú ag an Aire le rialacháin faoin Acht seo.
Tosach feidhme.
3.—Tiocfaidh an tAcht seo (ach amháin alt 24 a bhforáltar dá theacht i ngníomh san alt sin) i ngníomh pé lá nó laetheanta a socrófar chuige sin le hordú nó le horduithe ón Aire go ginearálta nó maidir le haon chríoch nó foráil áirithe agus féadfar laethe éagsúla a shocrú amhlaidh do chríocha éagsúla agus d'fhorála éagsúla den Acht seo.
Rialacháin.
4.—(1) Féadfaidh an tAire rialacháin a dhéanamh ag forordú aon ní nó ruda dá dtagartar san Acht seo mar ní nó rud atá forordaithe nó le forordú.
(2) Gach rialachán a déanfar faoin alt seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach acu sin, laistigh den lá agus fiche a shuífeas an Teach sin tar éis an rialachán a leagadh faoina bhráid, rún a rith ag neamhniú an rialacháin, beidh an rialachán ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin rialachán.
Athghairm.
5.—Athghairmtear leis seo na hachtacháin a luaitear sa Chéad Sceideal a ghabhas leis an Acht seo a mhéid a luaitear sa tríú colún den Sceideal sin.

6.—Sa Chaibidil seo den Chuid seo den Acht seo tá le “Aire oiriúnach”, “údarás áitiúil”, “mór-oifig”, agus “oifig” na bríonna atá leo faoi seach i gCuid II d'Acht 1941.
Athrú ar dhualgais i gcásanna áirithe.
7.—Más rud é, trí chomhaontú nó comhshocraíocht arna dhéanamh faoin Acht seo nó faoi aon Acht eile, go bhfeidhmíonn nó go gcomhlíonann údarás áitiúil cumhacht, feidhm nó dualgas de chuid chomhluchta eile—
(a) beidh ar gach oifigeach don údarás áitiúil pé dualgais a chomhlíonadh a gcinnfidh an t-údarás áitiúil gur dualgais iad is iomchuí don chineál sin cumhachta, feidhme nó dualgais, agus
(b) más údarás áitiúil an comhlucht eile, beidh ar gach oifigeach don údarás áitiúil sin gan na dualgais sin a chomhlíonadh a gcinnfidh an t-údarás áitiúil sin gur dualgais iad is iomchuí don chineál sin cumhachta, feidhme nó dualgais.
Ceadú nó toiliú ginearálta ón Aire oiriúnach.
8.—Maidir le haon chumhacht de chuid an Aire oiriúnaigh—
(a) is cumhacht faoi Chuid II d'Acht 1941, faoi Cuid III d'Acht 1946 nó faoin gCaibidil seo den Chuid seo den Acht seo, agus
(b) is cumhacht chun gníomhartha aon údarás áitiúla a cheadú nó chun toiliú leo,
féadfaidh an tAire oiriúnach, maidir leis na húdaráis sin go léir nó le haon cheann nó cinn áirithe nó le haon aicme áirithe de na húdaráis sin, ceadú nó toiliú ginearálta a thabhairt a bhainfeas le gníomhartha dá sórt a déanfar feasta i gcásanna inarb eisean an tAire oiriúnach agus ag a mbeidh éifeacht ar an údarás nó na húdaráis a bheas i gceist do chomhlíonadh coinníollacha nó ceanglas sonraithe agus ar an gcomhlíonadh sin amháin.
Luach saothair uileghabhálach.
9.—(1) Féadfaidh an tAire oiriúnach a ordú gur luach saothair uileghabhálach an luach saothair do na hoifigí uile arb eisean an tAire oiriúnach ina leith, nó do pé méid de na hoifigí sin a bhaineas le haicme, tuairisc nó grád sonraithe, nó d'oifig shonraithe de na hoifigí sin.
(2) Faoi réir fo-ailt (3) den alt seo, íocfaidh sealbhóir oifige lena mbaineann treoir faoin alt seo, leis an údarás áitiúil faoina bhfuil an oifig ar seilbh aige, aon táillí nó airgead eile (seachas a luach saothair uileghabhálach) is iníoctha leis an sealbhóir sin agus a fuair sé de bhuaidh na hoifige nó i leith seirbhísí a ceanglaítear ar an té a shealbhaíos an oifig a chomhlíonadh le haon achtachán nó faoi.
(3) Ní bheidh feidhm ag treoir faoin alt seo, mura dtoilí sé féin léi, maidir le duine a bheas, tráth na treorach a thabhairt, ina shealbhóir ar oifig lena mbaineann an treoir an fhad a fhanfas sé i seilbh na hoifige sin.
(4) I gcás sealbhóir oifige lena mbaineann treoir faoin alt seo a bheith freisin i seilbh oifige faoi Roinn Stáit, measfar, chun críocha an ailt seo, gur de bhuaidh na hoifige tosaigh sin a fuair sé aon táillí nó airgead eile a bheas faighte aige de bhuaidh na hoifige deiridh sin.
(5) Aon ordachán a bhí, díreach roimh thosach feidhme an ailt seo, i bhfeidhm faoi alt 22 (a hathghairmtear leis an Acht seo) d'Acht 1941 maidir le sealbhóir oifige, leanfaidh sé d'éifeacht a bheith aige amhail is dá mba threoir faoin alt seo é maidir leis an oifig sin.
Oifigí a chónascadh.
10.—(1) Más é an t-aon Aire amháin an tAire oiriúnach maidir le haon oifigí áirithe, féadfaidh an tAire sin, faoi réir forál an ailt seo agus tar éis dó dul i gcomhairle leis an údarás áitiúil nó leis na húdaráis áitiúla a bheas i gceist, na hoifigí a chónascadh le hordú, agus air sin déanfar aon oifig amháin de na hoifigí sin agus is aon oifig amháin a bheas iontu faoi pé teideal (más ann) a sonrófar san ordú.
(2) Más rud é, maidir le haon oifigí áirithe, go bhfuil beirt Airí nó níos mó ann agus gach duine acu ina Aire oiriúnach maidir le hoifig amháin nó níos mó ná oifig amháin de na hoifigí sin, féadfaidh na hAirí sin, faoi réir forál an ailt seo agus tar éis dóibh dul i gcomhairle leis an údarás áitiúil nó leis na húdaráis áitiúla a bheas i gceist, na hoifigí a chónascadh le hordú, agus air sin déanfar aon oifig amháin de na hoifigí agus is aon oifig amháin a bheas iontu faoi pé teideal (más ann) a sonrófar san ordú agus faoi pé Aire a sonrófar san ordú mar Aire oiriúnach chun críocha Coda II d'Acht 1941, Coda III d'Acht 1946 agus na Caibidle seo den Chuid seo den Acht seo.
(3) Ní cónascfar oifigí faoin alt seo mura rud é—
(a) go bhfuil gach hoifig acu folamh, nó
(b) gurb é an t-aon duine amháin atá i seilbh gach oifige acu, nó
(c) i gcás nach bhfuil gan bheith folamh ach oifig amháin acu, go dtoileoidh sealbhóir na hoifige sin le déanamh an orduithe, nó
(d) in aon chás eile, gurb é an t-aon duine amháin atá i seilbh gach oifige acu nach bhfuil folamh agus go dtoileoidh an duine sin le déanamh an orduithe.
(4) I gcás gan gach aon cheann d'oifigí a cónascfar faoin alt seo a bheith faoin aon údarás áitiúil amháin, beidh éifeacht ag na forála seo a leanas:
(a) is é a dhéanfas ceapacháin chun na hoifige cónasctha ná pé ceann de na húdaráis áitiúla a bheas i gceist a shonrós an tAire oiriúnach le hordú,
(b) íocfaidh an t-údarás áitiúil a dhéanfas ceapacháin chun na hoifige cónasctha a luach saothair le sealbhóir na hoifige cónasctha, agus féadfaidh an t-údarás áitiúil sin pé cuid den luach saothair a ghnóthú ó aon údarás áitiúil eile a bheas i gceist a ndéanfar socrú ina taobh trí chomhaontú eatarthu nó, cheal comhaontuithe, a shocrós an tAire oiriúnach nó má bhíonn beirt Airí nó níos mó i gceist, a socrófar trí chomhaontú idir na hAirí sin.
(5) Aon ordú a rinneadh nó a meastar a rinneadh faoi alt 36 (a hathghairmtear leis an Acht seo) d'Acht 1946, agus a bheas i bhfeidhm díreach roimh thosach feidhme an ailt seo, leanfaidh sé i bhfeidhm agus measfar é a bheith arna dhéanamh faoin alt seo agus é a bheith inleasuithe nó inchúlghairmthe dá réir sin.
Amhrais, etc., áirithe a chinneadh.
11.—(1) Má tharlaíonn aon amhras, díospóid nó ceist, nó más dóigh leis an Aire oiriúnach gur dócha é a tharlachtaint, i dtaobh aon duine áirithe, nó daoine d'aon aicme, tuairisc nó grád áirithe, atá fostaithe ag údarás áitiúil nó údaráis áitiúla, a bheith ina oifigeach nó ina n-oifigigh, nó gan a bheith, chun críocha an Achta seo nó aon cheann de na hAchta Rialtais Áitiúil, 1925 go 1946, nó i dtaobh aon phoist áirithe, nó postanna d'aon aicme, tuairisc nó grád áirithe, faoi údarás áitiúil nó údaráis áitiúla, a bheith ina oifig nó ina n-oifigí, nó gan a bheith, chun na gcríocha sin, is é an tAire oiriúnach a chinnfeas an t-amhras, an díospóid nó an cheist agus is cinneadh críochnaitheach a bheas ann.
(2) Aon chinneadh a rinneadh faoi alt 12 (a hathghairmtear leis an Acht seo) d'Acht 1941, fanfaidh sé i bhfeidhm agus measfar gur faoin alt seo a rinneadh é.
Alt 10 d'Acht 1941 a leasú.
12.—(1) Leasaítear leis seo alt 10 d'Acht 1941 trí na fo-ailt seo a leanas a chur leis:—
“(4) Chun críocha an ailt seo, féadfaidh údarás áitiúil, le haontú ginearálta nó sonrach an Aire oiriúnaigh, oifigí a bhunú ar fhoras buan nó ar fhoras sealadach.
(5) Féadfaidh údarás áitiúil, le haontú ginearálta nó sonrach an Aire oiriúnaigh, deireadh a chur le hoifigí, ach i gcás oifige a bheas ar seilbh ag duine i gcáil bhuan ní cuirfear deireadh léi ach amháin le toiliú an duine sin.
(6) Ní déanfar achomharc faoi fho-alt (2) den alt seo tar éis sé mhí i ndiaidh na breithe a chur in iúl don oifigeach.”
(2) I gcás breithe a tugadh roimh thosach feidhme an ailt seo, forléireofar an tagairt atá i bhfo-alt (6) (a cuireadh isteach le fo-alt (1) den alt seo) d'alt 10 d'Acht 1941 do shé mhí i ndiaidh na breithe a chur in iúl don oifigeach mar thagairt do shé mhí i ndiaidh na breithe a chur in iúl don oifigeach nó i ndiaidh an tosach feidhme sin, pé acu is déanaí.
Ailt 13 agus 16 d'Acht 1941 a leasú.
13.—Forléireofar na tagairtí in ailt 13 agus 16 d'Acht 1941 do Chuid II den Acht sin mar thagairtí a fholaíos tagairtí do Chuid III d'Acht 1946 agus don Chaibidil seo den Chuid seo den Acht seo.
Alt 19 d'Acht 1941 a leasú.
14.—Leasaítear leis seo alt 19 d'Acht 1941 mar leanas:
(I) cuirfear na míreanna seo a leanas in ionad míre (j) d'fho-alt (1):—
“(j) ag déanamh socruithe, i gcás sealbhóirí a bheith breoite, as láthair nó faoi éagumas, chun go gcomhlíonfaidh ionadaí a ndualgais,
(k) ag déanamh socruithe chun srian a chur le sealbhóirí do ghabháil le haon obair shochrach eile,
(l) ag déanamh socruithe chun údaráis áitiúla do chur sealbhóirí a shealbhaíos oifigí i gcáil bhuan as seilbh na n-oifigí sin agus ag forordú an nós imeachta a bheas le leanúint agus na gcoinníollacha a bheas le comhlíonadh maidir lena gcur as oifig,
(m) ag déanamh socruithe chun údaráis áitiúla do chur sealbhóirí ar fionraí ó chomhlíonadh a ndualgas (lena n-áirítear smacht-fhionraí gearrthréimhse, nach sia ná seacht lá), chun gan luach saothair d'íoc ar feadh na fionraí agus, ar dheireadh a theacht leis an bhfionraí, chun an luach saothair a ndéanfaí, mura mbeadh an fhionraí, é d'íoc le linn tréimhsí na fionraí, d'fhorghéilleadh (go hiomlán nó go páirteach) nó d'íoc nó a dhiúscairt ar shlí eile,
(n) ag déanamh socruithe chun na rialacháin d'fhorlíonadh trí threoracha (is treoracha chun éifeacht a thabhairt do na rialacháin, ach nach ndéanann leathnú ar na rialacháin ná fairsingiú ar a réim) a bhéarfas an tAire oiriúnach ó am go ham.”
(II) cuirfear na fo-ailt seo a leanas leis an alt:—
“(4) Más rud é, chun críocha aon achtacháin nó orduithe, gur gá do shealbhóir oifige aon ordú nó moladh a dhéanamh, aon deimhniú, aontú nó ceadú a thabhairt nó aon ghníomh eile a dhéanamh, beidh an t-ordú, an moladh, an deimhniú, an t-aontú, an ceadú nó an gníomh sin, ar a bheith déanta nó tugtha ag ionadaí a bheas ag comhlíonadh dualgas an tsealbhóra de bhun rialachán faoin alt seo le linn an sealbhóir a bheith breoite, as láthair nó faoi éagumas, chomh bailí chun gach críche agus dá mba é an sealbhóir féin a rinne nó a thug é.
(5) Gach rialachán a déanfar faoin alt seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach acu sin, laistigh den lá agus fiche a shuífeas an Teach sin tar éis an rialachán a leagadh faoina bhráid, rún a rith ag neamhniú an rialacháin, beidh an rialachán ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin rialachán.”

15.—Leasaítear leis seo alt 20 d'Acht 1941 tríd an bhfo-alt seo a leanas a chur leis:—
“(3) Féadfar na cumhachta a bheirtear leis an alt seo maidir le haon oifig áirithe d'fheidhmiú d'ainneoin go mbaineann an oifig sin le haicme, tuairisc nó grád ar feidhmíodh cheana maidir léi na cumhachta a bheirtear leis an alt seo.”

16.—Déantar leis seo alt 21 d'Acht 1941, arna leasú le halt 40 d'Acht 1946, a leasú tuilleadh tríd an bhfo-alt seo a leanas a chur leis:—
“(12) Más rud é, maidir le haon oifig, gur dearbhaíodh faoin alt seo gur cháilíocht don oifig sin nárbh fholáir d'aon bhean a shealbhódh í bheith neamhphósta nó ina baintreach, ní bheidh feidhm ag an gcáilíocht sin i gcás mná pósta a shealbhaíos, i gcáil bhuan, oifig a mbaineann a dualgais le nithe atá comhionann nó cosúil leis na nithe lena mbaineann dualgais na hoifige céadluaite agus nach raibh an cháilíocht sin, ná an coinníoll go gcaithfeadh an sealbhóir éirí as an oifig ar phósadh dhí, ag baint leis an oifig nuair a ceapadh í (lena n-áirítear cás inar de bhuaidh an fho-ailt seo a tharla an neamhbhaint sin).”

17.—Leasaítear leis seo alt 24 d'Acht 1941 mar leanas:—
(I) cuirfear an focal agus an mhír seo a leanas isteach i ndiaidh míre (b) d'fho-alt (1):—
“nó
(c) gurb é leas na poiblíochta, mar gheall ar aon athrú (pé acu bheas sé déanta cheana nó a beifear ag cuimhneamh ar é a dhéanamh) ar chineál nó méid na ndualgas a ghabhas leis an oifig sin, deireadh a chur leis an oifig sin,”
(II) i bhfo-mhír (iii) de mhír (b) d'fho-alt (3) cuirfear “aon údarás áitiúil” in ionad “an t-údarás áitiúil iomchuibhe”,
(III) i bhfo-mhír (v) de mhír (b) d'fho-alt (3) cuirfear “oiriúnach” i ndiaidh “an tAire”,
(IV) cuirfear an fo-alt seo a leanas leis an alt:—
“(5) Chun críocha fo-mhíre (v) de mhír (b) d'fho-alt (3) den alt seo, má bhíonn dualgais na hoifige eile le comhlíonadh tamall ón áit nó ó na háiteanna inar comhlíonadh dualgais na céad oifige, ní measfar go ndéanann an ní sin ann féin dochar ábhartha do staid an tsealbhóra.”

18.—Leasaítear leis seo alt 27 d'Acht 1941 trí “údarás áitiúil nó” a scrios as fo-mhír (1), trí “faoi údarás áitiúil” a chur inti in ionad “fén údarás áitiúil sin”, agus trí “ar aon tslí eile”, “an t-údarás áitiúil sin no” agus “(do réir mar a bheidh)” a scrios as an bhfo-mhír sin.

19.—Leasaítear leis seo alt 29 d'Acht 1941 mar leanas:—
(I) cuirfear “nó sealbhóirí na mór-oifigí sin a bhaineas le haicme, tuairisc nó grád áirithe” isteach i ndiaidh “aon mhór-oifige áirithe” agus cuirfear “nó na hoifigí” isteach i ndiaidh “an oifig”,
(II) cuirfear an mhír seo a leanas leis an alt:—
“Féadfar na cumhachta a bheirtear leis an alt seo maidir le sealbhóirí mór-oifige áirithe d'fheidhmiú d'ainneoin go mbaineann an oifig sin le haicme, tuairisc nó grád ar feidhmíodh cheana maidir léi na cumhachta a bheirtear leis an alt seo.”

20.—(1) Ní feidhmeofar cumhacht údaráis áitiúil faoi alt 10 d'Acht 1941 chun luach saothair a cheapadh d'oifigeach ach amháin do réir pé ceann nó cinn acu seo a leanas is iomchuí ó am go ham:—
(a) aon ordú a bhéarfas an tAire oiriúnach faoi alt 29 d'Acht 1941,
(b) aon rialachán a dhéanfas an tAire oiriúnach faoi mhír (a) d'fho-alt (1) d'alt 19 d'Acht 1941,
(c) aon treoir a bhéarfas an tAire oiriúnach i dtaobh na gcúinsí ar chóir luach saothair oifigeach i gcoitinne a rialú dá réir,
(d) aon treoir a bhéarfas an tAire oiriúnach i dtaobh na gcúinsí ar chóir luach saothair oifigeach d'aicme, tuairisc nó grád sonraithe a rialú dá réir, is aicme, tuairisc nó grád lena mbaineann an t-oifigeach,
(e) ceadú an Aire oiriúnaigh.
(2) Ní feidhmeofar cumhacht údaráis áitiúil faoi alt 10 d'Acht 1941 chun luach saothair a cheapadh do sheirbhíseach ach amháin do réir pé ceann nó cinn acu seo a leanas is iomchuí ó am go ham:—
(a) aon treoir a bhéarfas an tAire oiriúnach i dtaobh na gcúinsí ar chóir luach saothair seirbhíseach i gcoitinne a rialú dá réir,
(b) aon treoir a bhéarfas an tAire oiriúnach i dtaobh na gcúinsí ar chóir luach saothair seirbhíseach d'aicme, tuairisc nó grád sonraithe a rialú dá réir, is aicme, tuairisc nó grád lena mbaineann an seirbhíseach,
(c) ceadú an Aire oiriúnaigh.
(3) Féadfaidh an tAire oiriúnach treoracha a thabhairt chun críocha an ailt seo.
Srian le hoifig a shealbhú nó le bheith ar fostú.
21.—(1) Ní shealbhóidh duine ar bith aon oifig shochair faoi aon údarás áitiúil, ná ní bheidh ar fostú ar luach saothair aige ná faoi, le linn dó bheith ina chomhalta den údarás sin.
(2) Ní shealbhóidh duine ar bith aon mhór-oifig faoi údarás áitiúil le linn dó bheith ina chomhalta d'aon údarás áitiúil eile arb é is límistéir fheidhmiúcháin dó an chontae nó an chontaebhuirg chéanna is límistéir fheidhmiúcháin don údarás áitiúil sin nó a bhfuil a límistéir fheidhmiúcháin laistigh den chontae nó den contae-bhuirg chéanna sin nó in aon chontae nó contaebhuirg atá i dtadhall leis an gcontae nó leis an gcontae-bhuirg sin.
(3) Nuair a scoirfeas duine de bheith ina chomhalta d'údarás áitiúil ar shlí seachas trí dhul in éag dá théarma oifige, measfar chun críocha fo-alt (1) agus (2) den alt seo é do leanúint de bheith ina chomhalta den tsórt sin go ceann dhá mhí dhéag tar éis an scoir sin nó go dtí go mbeadh deireadh, mura mbeadh an scor sin, lena théarma oifige, pé tréimhse acu sin is giorra.
(4) San alt seo forléireofar aon tagairt d'údarás áitiúil mar thagairt nach bhfolaíonn tagairt d'aon chomhlucht nach mbaineann a fheidhmeanna ach le comhairliú, breithniú, tuairisciú nó comhchomhairliú.
(5) Scoirfidh fo-alt (1) d'alt 70 d'Acht 1925 d'éifeacht a bheith aige, faoi réir an choinníll go leanfaidh gach srian le haon oifig shochair a shealbhú nó le bheith fostaithe ar luach saothair, is srian a tharla de dhroim aon Acht eile do thabhairt feidhme don alt sin agus a bhí i ngníomh díreach roimh thosach feidhme an ailt seo, de bheith i ngníomh.
Cumhachta, etc., áirithe d'aistriú.
22.—(1) Déantar leis seo gach cumhacht, feidhm nó dualgas a bheirtear le reacht d'aon tsuirbhéir nó suirbhéir cúnta faoi údarás áitiúil d'aistriú chun an údaráis áitiúil sin.
(2) Ní measfar gur dochar ábhartha dá staid an t-aistriú a déantar le fo-alt (1) den alt seo ó aon tsuirbhéir nó suirbhéir cúnta.

23.—(1) Más rud é—
(a) go mbeidh ag duine, i dtosach feidhme an ailt seo, tréimhse de sheirbhís áitiúil inphinsin chun críocha Coda II den Acht Rialtais Áitiúil (Aoisliúntas), 1948 (Uimh. 4 de 1948), agus
(b) ar feadh aon tréimhse nó tréimhsí, nach ináirithe chun críocha na nAcht Aoisliúntas, 1834 go 1954, gur chomhlíon an duine sin dualgais údaráis áitiúil de bhuaidh ceapacháin a rinneadh faoi reacht, féadfar an tréimhse dá dtagartar i mír (a) den fho-alt seo agus an tréimhse nó na tréimhsí dá dtagartar i mír (b) den fho-alt seo a chomhshuimiú agus a mheas gur seirbhís chun críocha na Coda sin II iad.
(2) Más rud é i dtosach feidhme an ailt seo, go sealbhóidh Séamas O Murchadha oifig phríomh-oifigigh fheidhmiúcháin Bhord Cúnaimh Bhaile Atha Cliath:—
(a) measfar a ainm a bheith taifeadta sa chlár atá á choimeád ag an mBord sin faoi Chuid II den Acht Rialtais Áitiúil (Aoisliúntas), 1948, agus a bheith taifeadta amhlaidh de dhroim iarratais arna dhéanamh go cuí faoi fho-alt (1) d'alt 37 den Acht sin,
(b) féadfar iad seo a leanas a chomhshuimiú agus a mheas gur seirbhís chun críocha na Coda sin II iad:
(i) a sheirbhís mar phríomh-oifigeach feidhmiúcháin an Bhoird sin,

Tórainn aoise d'oifigí áirithe.
24.—(1) (a) Leasaítear leis seo alt 23 d'Acht 1941 tríd an bhfo-alt atá leagtha amach i gCuid I den Dara Sceideal a ghabhas leis an Acht seo a chur leis.
(b) Measfar an fo-alt seo a theacht i ngníomh ar thosach feidhme ailt 23 d'Acht 1941 agus beidh gach dearbhú a rinneadh, roimh an Acht seo a rith, i riocht dearbhuithe faoin alt sin, agus measfar go raibh sé riamh, chomh bailí agus dá dtagadh an t-alt seo i ngníomh an uair sin faoi réir an choinníll nach bhforléireofar aon ní sa bhfo-alt seo mar ní a dhéanas difir d'aon imeachta a tionscnadh san Ard-Chúirt roimh an 7ú lá d'Iúil, 1954, i leith aon dearbhuithe den tsórt sin maidir leis na páirtithe sna himeachta sin.

Leasuithe ar Acht na nUdarás nAitiúil (Oifigigh agus Fostaithe), 1926.
An Príomh-Acht.
25.—(1) Sa Chaibidil seo den Chuid seo den Acht seo ciallaíonn “an Príomh-Acht” Acht na nUdarás nAitiúil (Oifigigh agus Fostaithe), 1926 (Uimh. 39 de 1926).
(2) In aon chás ina ndearnadh le haon Acht eile feidhm maidir le haon oifig nó fostaíocht áirithe, nó maidir le haon bhord, coiste nó comhlucht eile (corpraithe nó neamhchorpraithe), a thabhairt don Phríomh-Acht, beidh feidhm ag an bPríomh-Acht maidir leis an oifig nó an fhostaíocht sin nó maidir leis an gcomhlucht sin i dteannta agus faoi réir na leasuithe air a déantar leis na hailt ina dhiaidh seo den Chaibidil seo den Chuid seo den Acht seo.
Alt 2 den Phríomh-Acht a leasú.
26.—Leasaítear leis seo alt 2 den Phríomh-Acht trí “(nach oifig shealadach, oifig pháirt-aimsire mar innealltóir nó suirbhéir faoi chomhairle bhaile-cheantair nó coimisinéirí baile nó oifig mhúinteora)” a chur i mír (b) d'fho-alt (1) in ionad “agus gach fostaíocht (nach oifig ná fostaíocht mhúinteora)” agus trí “nó teicniciúla” a scrios as an mír sin.
Alt 6 den Phríomh-Acht a leasú.
27.—(1) Leasaítear leis seo alt 6 den Phríomh-Acht trí na fo-ailt seo a leanas a chur leis:—
“(5) Beidh éifeacht ag fo-alt (4) den alt seo faoi réir an choinníll, má shonraíonn an t-údarás áitiúil tréimhse (nach 1ú ná trí mhí) ina mbeidh ar an duine a mholfas na Coimisinéirí nó a mheasfas an t-údarás áitiúil is cóir a cheapadh (do réir mar bheas) dul i mbun dualgas agus má chuirid an tréimhse a bheas sonraithe amhlaidh in iúl dó, nach gceapfaidh an t-údarás áitiúil an duine sin mura dté sé i mbun dualgas laistigh den tréimhse sin.
(6) Mura dté duine dá dtagartar i bhfo-alt (5) den alt seo i mbun dualgas laistigh den tréimhse a cuireadh in iúl dó—
(a) iarrfaidh an t-údarás áitiúil ar na Coimisinéirí duine a mholadh dhóibh lena cheapadh chun na hoifige,
(b) mura n-iarra an t-údarás áitiúil, laistigh de thrí mhí tar éis deireadh na tréimhse sin, ar na Coimisinéirí duine a mholadh dhóibh lena cheapadh chun na hoifige, féadfaidh an tAire thar ceann an údaráis áitiúil a iarraidh ar na Coimisinéirí duine a mholadh don údarás áitiúil lena cheapadh chun na hoifige,
(c) ar iarratas a bheith déanta mar adúradh ag an údarás áitiúil nó ag an Aire (do réir mar bheas), beidh feidhm i dtaca leis an iarratas sin ag fo-ailt (3), (4) agus (5) den alt seo agus ag an bhfo-alt seo.”
(2) I dteannta feidhm a bheith acu maidir le haon chás ina ndéanfar iarratas nó moladh faoi alt 6 den Phríomh-Acht tar éis tosach feidhme an ailt seo, beidh feidhm freisin ag na forála atá i bhfo-alt (1) den alt seo in aon chás ina dtarlóidh, ar an tosach feidhme sin, go mbeidh iarratas nár lean moladh as, nó moladh nár lean ceapachán as, arna dhéanamh faoin alt sin 6.
Alt 10 den Phríomh-Acht a leasú.
28.—Leasaítear leis seo mar leanas alt 10 den Phríomh-Acht:—
(I) i bhfo-alt (1) cuirfear “pé táille (lena n-áirítear, má mheasann na Coimisinéirí gur cuí é, táille ar scrúdú dochtúra) is dóigh leis na Coimisinéirí is ceart” in ionad “pé táillí is dóigh leo is ceart”,
(II) cuirfear an fo-alt seo a leanas leis an alt:
“(3) Féadfaidh na Coimisinéirí an táille is féidir d'éileamh de bhun an ailt seo a shocrú ó am go ham, tar éis dóibh dul i gcomhairle leis an Aire, go ginearálta maidir le gach oifig de ghrád áirithe.”

29.—(1) Más dóigh leis na Coimisinéirí um Cheapacháin Áitiúla, le comhthoiliú an Aire oiriúnaigh, gurb amhlaidh, ag féachaint don chineál dualgas a ghabhas le hoifig áirithe lena mbaineann an Príomh-Acht nó a ghabhas leis na hoifigí sin uile d'aicme, tuairisc nó grád áirithe, don eolas agus don taithí is riachtanach chun na dualgais sin a chomhlíonadh go héifeachtúil agus do na cáilíochtaí (mar atáid cheana nó mar atá beartaithe iad a bheith) le haghaidh na hoifige nó na n-oifigí sin, nach féidir an duine nó na daoine a bheas le moladh lena gceapadh chun na hoifige nó na n-oifigí sin a roghnú go sásúil trí scrúdú comórtais, féadfaidh na Coimisinéirí um Cheapacháin Áitiúla, maidir leis an oifig nó na hoifigí sin, an scrúdú comórtais a ceanglaítear leis an bPríomh-Acht a ligean thar ceal agus an duine nó na daoine a bheas le moladh acu a roghnú i pé slí is cuí leo.

30.—(1) San alt seo ciallaíonn “rolla-aicmíocht” aon aicme, tuairisc nó grád oifige a chinnfeas na Coimisinéirí um Cheapacháin Áitiúla chun críocha an ailt seo.
(2) Féadfaidh na Coimisinéirí um Cheapacháin Áitiúla, más oiriúnach leo é, do réir rialacha faoi fho-alt (4) den alt seo, a shocrú ó am go ham go scrúdófar maidir, le gach ceann nó aon cheann de na hoifigí de rolla-aicmíocht áirithe, cáilíochtaí daoine ar mian leo go gceapfaí iad chun aon fholúntas atá nó a bheas ann agus go n-ullmhófar rolla de na daoine sin óna bhféadfar moladh a dhéanamh do réir iarratais (pé acu roimh chríochnú an rolla nó dá éis sin a gheofar é) faoi alt 6 den Phríomh-Acht nó faoi fho-alt (2) d'alt 4 den Acht um Bainistí Chontae, 1940 (Uimh. 12 de 1940).
(3) Má hiarrtar ar na Coimisinéirí um Cheapacháin Áitiúla, faoi alt 6 den Phríomh-Acht nó faoi fho-alt (2) d'alt 4 den Acht um Bainistí Chontae, 1940 (Uimh. 12 de 1940), duine a mholadh lena cheapadh chun oifige de rolla-aicmíocht áirithe, féadfaidh na Coimisinéirí um Cheapacháin Áitiúla, más oiriúnach leo é, duine a roghnú as an rolla iomchuí a hallmhaíodh faoi fho-alt (2) den alt seo agus an duine sin a mholadh lena cheapadh.

CUID III
Bóithre.
Abhair do bhóithre a tháirgeadh.
31.—Féadfar na cumhachta a bheirtear le fo-alt (1) d'alt 10 den Local Government (Ireland) Act, 1898, d'fheidhmiú maidir leis an talamh a luaitear i bhfo-alt (1) d'alt 12 den Acht sin.
Feidhm an Development and Road Improvement Funds Act, 1909, a leathnú.
32.—Leasaítear leis seo alt 17 den Development and Road Improvement Funds Act, 1909, trí “or borough or urban district” a chur isteach i ndiaidh “county borough” sa dá áit ina bhfuil na focail deiridh sin san alt.
Forléiriú abairtí áirithe.
33.—(1) Baineann an t-alt seo leis na habairtí “highway”, “public highway”, “highway repairable by the inhabitants at large” agus le habairtí dá samhail.
(2) D'fhonn deireadh a chur le hamhrais, dearbhaítear leis seo, i gcás ina n-úsáidtear abairt lena mbaineann an t-alt seo i reacht a bhaineas le bóithre poiblí, nó in ionstraim a rinneadh faoi aon reacht den tsórt sin, go dtagrann an abairt sin, agus gur thagair sí riamh, do bhóthar mar a mínítear é in alt 1 d'Acht 1925.
Dearbhú gur bóthar mór bóthar áirithe.
34.—D'fhonn deireadh a chur le hamhrais, dearbhaítear leis seo go bhfuil cumhacht an Aire faoi alt 1 d'Acht 1925 chun a dhearbhú bóthar áirithe a bheith ina bhóthar mór, agus go raibh an chumhacht sin riamh, infheidhmithe maidir le bóthar nua atá beartaithe.
Bóthar a dhúnadh go sealadach.
35.—(1) Féadfaidh an t-údarás áitiúil ar a bhfuil cothabháil bhóthair, tar éis dóibh pé fógra a bheas forordaithe a thabhairt, an bóthar nó aon chuid de a dhúnadh in aghaidh tráchta phoiblí go ceann pé tréimhse agus faoi réir pé coinníollacha is oiriúnach leo.
(2) Más rud é, de bhun cinneadh údaráis áitiúil faoi fho-alt (1) den alt seo, go mbeifear chun bóthar nó cuid de bhóthar a dhúnadh, féadfaidh an t-údarás áitiúil, le hordú, a cheadú go gcuirfí rás bóthair nó ní dá shamhail ar siúl air le linn na tréimhse a bheas sé dúnta.
(3) Má úsáideann aon duine feithicil gan údarás cuí, nó má cheadaíonn sé a húsáid amhlaidh, ar bhóthar a bheas dúnta ina haghaidh faoin alt seo, nó má dhéanann sé go toiliúil bac nó cur isteach ar sheoladh aon ní a bheas ceadaithe faoin alt seo, beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná cúig puint a chur air.
(4) Féadfaidh an tAire, le hordú, aon chinneadh nó ordú a bheas déanta ag údarás áitiúil faoin alt seo a chur ar neamhní nó d'athrú, agus bhéarfaidh an t-údarás áitiúil pé fógra poiblí a bheas forordaithe i dtaobh an orduithe sin ón Aire.
Síne tráchta ar bhóithre.
36.—(1) Déantar leis seo an míniú seo a leanas a chur i bhfo-alt (1) d'alt 69 d'Acht 1946 in ionad an mhínithe ar an abairt “sín tráchta”:—
“ciallaíonn an abairt ‘sín tráchta’ aon tsín, feiste nó fógra nó aon mharc róid, nó aon ghléas chun comharthaí a thabhairt go meicniúil, a dhéanas rud amháin nó níos mó díobh seo a leanas:—
(a) a thugas eolas i dtaobh bóthair, lena n-áirítear na háiteanna a dtéann sé, agus an fhaid chun na n-áiteanna sin nó uathu,
(b) a thugas rabhadh do dhaoine i dtaobh contúirte maidir le bóthar, nó comhairle i dtaobh an chúraim nach foláir a ghlacadh in aghaidh na contúirte sin, nó a thugas an dá rud sin le chéile,
(c) a thaispeánas go bhfuil rialachán bóthair ann maidir le bóthar, nó a chomhlíonas rialachán den tsórt sin, nó a dhéanas an dá rud sin le chéile;”
(2) Déantar leis seo an fo-alt seo a leanas a chur in ionad fo-ailt (2) d'alt 69 d'Acht 1946:—
“(2) (a) Féadfaidh an tAire, más oiriúnach leis é, rialacháin a dhéanamh maidir le síne tráchta sonraithe, agus má chuireann údarás bóthar ar fáil sín tráchta de shórt is ionann agus sín tráchta a sonrófar in aon rialacháin den tsórt sin, beidh sé do réir na rialachán, mura n-údaraí an tAire a mhalairt.
(b) Féadfaidh rialacháin faoin bhfo-alt seo a shonrú cén bhrí a ghabhfas le sín tráchta a sonrófar sna rialacháin, ach ní forléireofar an fhoráil seo mar ní a cheanglaíos go bhforálfaidh na rialacháin go mbeidh sa tsín tráchta aon fhocal, focail nó samhaltán a chuirfeas in iúl go beacht brí na síne tráchta.”
(3) Cuirfear na fo-ailt seo a leanas le halt 69 d'Acht 1946:—
“(14) Ní chuirfidh duine ar bith aon tsín, feiste, fógra ná solas ar fáil de shórt nach sín tráchta, más rud é, ar é a chur ar fáil, go bhfuil sé le feiscint ó bhóthar agus—
(a) gur féidir go gceapfaí gur sín tráchta é,
(b) go ndéanann sé níos deacra do lucht úsáidte bóthair é sín tráchta d'fheiscint a bheas curtha ar fáil do réir an ailt seo, nó
(c) go gcuireann sé bac ar radharc lucht úsáidte bóthair ionas gur contúirt dóibh é.
(15) Beidh áititheoir nó (i gcás talún neamháitithe) únaer na talún ar a mbeidh sín, feiste, fógra nó solas curtha ar fáil contrártha d'fho-alt (14) den alt seo ciontach i gcion faoin bhfo-alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná cúig puint a chur air maraon le fíneáil bhreise de phunt in aghaidh gach lae a leanfar den chion.
(16) Má chuireann údarás bóthar sín tráchta ar fáil faoin alt seo nach sín tráchta lena mbaineann rialacháin faoi fho-alt (2) den alt seo, beidh an tsín tráchta sin do réir aon ordachán ginearálta nó áirithe a bhéarfas an tAire ó am go ham.”

37.—(1) Féadfaidh comhairle chontae, bardas contae-bhuirge nó buirge eile, comhairle cheantair uirbigh nó coimisinéirí baile le toiliú Choimisinéir an Gharda Shíochána, a shocrú go ndéan faidh daoine (dá ngairmtear maoir thráchta san alt seo) a fhostóid nó a ainmneoid patról ar áiteanna a dtéann leanaí scoile trasna an bhóthair.
(2) Féadfaidh maor tráchta pé sín a bheas forordaithe a thaispeáint á cheangal ar an trácht stad agus fanacht ina stad ionas go bhféadfaidh leanaí scoile dul trasna an bhóthair go sábháilte, agus stadfaidh an trácht agus fanfaiadh sé ina stad dá réir sin faid a bheas an sín ar taispeáint.
(3) Aon duine nach stadfaidh feithicil nó ainmhí nó nach gcoimeádfaidh ina stad é do réir fo-ailt (2) den alt seo, beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná cúig puint a chur air.
(4) Ar an lá agus tar éis an lae a cheapfas an tAire le hordú, ní bheidh an chumhacht a bheirtear do mhaor tráchta le fo-alt (2) den alt seo infheidhmithe mura mbeidh an éide a bheas forordaithe á caitheamh ag an maor.
(5) Más cuid de chontae aon bhuirg, ceantar uirbeach nó baile áirithe, ní measfar, chun críocha an ailt seo, gur cuid de límistéir fheidhmiúcháin chomhairle na contae an bhuirg, an ceantar uirbeach nó an baile sin.
(6) San alt seo—
tá le “feithicil” an bhrí a bheirtear di in alt 3 den Acht um Thrácht ar Bhóithre, 1933 (Uimh. 11 de 1933),
tá le “trácht” an bhrí a bheirtear dó i bhfo-alt (6) d'alt 147 den Acht sin,

38.—(1) Féadfaidh an tAire, le hordú, socrú a dhéanamh—
(a) chun aon phasanna taistil, deimhnithe, údaráis nó doiciméid eile a dheonadh agus d'fhíordheimhniú a bhainfeas le feithicil inneallghluaiste nó le tiománaí feithicle den tsórt sin agus ba ghá le haghaidh taistil lasmuigh den Stát ag daoine a chónaíos sa Stát, agus
(b) chun modhnú a dhéanamh, maidir le feithiclí inneallghluaiste a bheas á dtabhairt isteach sa Stát ag daoine a chónaíos lasmuigh den Stát, agus maidir le daoine den tsórt sin atá ag fanacht sa Stát go sealadach, ar fhorála aon achtacháin a bhaineas le clárú feithiclí inneallghluaiste, leis na ceanglais atá le comhlíonadh i gcás na bhfeithiclí sin, agus le ceadúnú tiománaithe.
(2) Beidh éifeacht ag aon mhodhnú den tsórt sin amhail is dá mbeadh sé san Acht a modhnófar.
(3) Féadfar aon ordú faoin alt seo d'athrú nó a chúlghairm le haon ordú ina dhiaidh sin faoin alt seo.
(4) San alt seo tá le “feithicil inneallghluaiste” an bhrí atá léi san Acht um Thrácht ar Bhóithre, 1933 (Uimh. 11 de 1933), agus folaíonn tagairtí di tagairtí d'fheithicil a bheas á tarraingt ag feithicil den tsórt sin.

39.—Leasaítear leis seo alt 1 den Ferries (Acquisition by Local Authorities), Act, 1919, tríd an bhfo-alt seo a leanas a chur leis:—
“(9) In lieu of effecting under this section the acquisition of a ferry, a local authority may, subject to such conditions as they think proper to impose, contribute to the cost of working, maintaining or improving the ferry.”

(5) Má bhíonn d'éifeacht ag déanamh na hoibre go laghdóidh nó go bhforceannfaidh sé ceart príobháideach duine ar bith (lena n-áirítear, go háirithe, ceart loingseoireachta, pé acu ó reacht é nó nach ea), féadfaidh an duine sin, laistigh de dhá mhí dhéag tar éis críochnú na hoibre, cúiteamh i leith an laghduithe nó an fhorceannta sin d'éileamh ar an údarás déanmhach, agus beidh sé i dteideal cúiteamh d'fháil ina leith ón údarás déanmhach agus, mura n-íoctar an cúiteamh sin leis nuair a beifear tar éis comhaontú ar a mhéid nó tar éis é a chinneadh faoin alt seo, é a ghnóthú ón údarás déanmhach in aon chúirt dlínse inniúla.
(6) Cheal comhaontuithe, déanfar méid aon cúitimh is iníoctha ag údarás bóthar faoin alt seo a chinneadh trí eadráin faoin Acquisition of Land (Assessment of Compensation) Act, 1919 (arna leasú le hachtacháin ina dhiaidh sin) amhail is dá mb'é a bhí sa chúiteamh an praghas ar thalamh a tógadh go héigeantach agus beidh dlínse ag an eadránaí chun a chinneadh an bhfuil cúiteamh ar bith iníoctha sna himthosca.”
(2) Leasaítear leis seo alt 53 d'Acht 1946 trí “leasú a dhéanamh ar na forála san ordú droichid a cheanglaíos ranníoc faoin” a chur i bhfo-alt (3) in ionad “athrú a dhéanamh ar ranníocaíocht a ceanglófar a íoc faoi fho-alt (1) den”.
(3) Leasaítear leis seo alt 55 d'Acht 1946 trí na fo-ailt seo a leanas a chur in ionad fo-ailt (2):—

(2) Féadfaidh an tAire, le hordú, aon chumhachta agus dualgais (lasmuigh de chumhachta agus dualgais faoin gCuid seo den Acht seo), maidir le haon chuid de bhóthar atá i dtadhall leis an droichead, d'aistriú, le héifeacht amhail ó chríochnú na hoibre, chun aon údaráis bhóthar lena mbaineann an t-ordú droichid más cumhachta agus dualgais iad de chuid aon údaráis bhóthar eile lena mbaineann an t-ordú droichid.”
(4) Leasaítear leis seo alt 56 d'Acht 1946 trí na míreanna seo a leanas a chur in ionad míre (d) d'fho-alt (2):—

(5) Leasaítear leis seo alt 57 d'Acht 1946 tríd an bhfo-alt seo a leanas a chur in ionad fo-ailt (2):—
“(2) Más rud é de bhuaidh an ailt seo go mbaineann an t-ordú droichid le cuideachta a bhfuil iarnród nó canáil faoina n-urlámhas, ní dhéanfaidh an tAire de bhuaidh an ailt seo ceachtar de na nithe seo a leanas ach amháin le toiliú an Aire Thionscail agus Tráchtála, is é sin le rá:

41.—(1) Féadfaidh údarás bóthar scéimeanna d'ullmhú agus a ghlacadh, faoi réir a gceaduithe ag an Aire, chun droichid ag ceangal áiteanna laistigh dá límistéir fheidhmiúcháin le háiteanna i dTuaisceart Éireann d'fhoirgniú, d'fheabhsú, d'athrú, a chothabháil nó a thréigean.
(2) Aon scéim a glacfar faoin alt seo beidh inti na sonraí sin maidir leis na nithe sin, agus beidh sí sa bhfoirm sin, a cheadós an tAire, agus go háirithe, ach gan dochar do ghinearáltacht na bhforál roimhe seo den alt seo, féadfar a shonrú inti cén modh ar a ndéanfar, agus cé hiad na comhluchta a dhéanfas, agus cén chionúireacht ina ndéanfar, na caiteachais d'íoc a bhainfeas leis an scéim a chur i gcrích agus le haon ní a foirgneofar fúithi a chothabháil.
(3) Aon chumhachta a bheas infheidhmithe de thuras na huaire ag údarás bóthar maidir le bóithre, féadfar iad d'fheidhmiú chun scéim a glacadh faoin alt seo a chur i gcrích.
(4) Is feidhm fhorcoimeádta scéim a ghlacadh faoin alt seo.
CUID IV.
Forála a bhaineas le hAirgeadas Áitiúil.

42.—(1) Chun soláthar go sealadach le haghaidh aon chaitcachais faoina raghaid ag déanamh nó ag comhlíonadh aon cheann dá gcumhachta agus dá ndualgais, féadfaidh údarás áitiúil ag a bhfuil aon chumhacht chun airgead d'fháil ar iasacht airgead d'fháil, le toiliú an Aire, trí iasacht nó rótharraing shealadach.
(2) Is í tréimhse dá bhfaighfear suim ar iasacht faoin alt seo pé tréimhse, nach mó ná deich mbliana, a cheadós an tAire.
(3) Ní déanfar suim a gheobhas údarás áitiúil ar iasacht faoin alt seo d'áireamh mar chuid d'fhiacha an údaráis sin chun críocha aon tórann reachtúla le hairgead d'fháil ar iasacht.
(4) San alt seo folaíonn tagairtí d'airgead d'fháil ar iasacht tagairtí d'airgead d'fháil ar ath-iasacht.

43.—(1) Baineann an t-alt seo le húdarás áitiúil is údarás sláintíochta uirbeach chun críocha na nAcht Rialtais Áitiúil (Seirbhísí Sláintíochta), 1878 go 1952, agus nach bardas contaebhuirge.
(2) Ní déanfar suim a gheobhas údarás áitiúil lena mbaineann an t-alt seo ar iasacht maidir le huisce-sholáthar nó córas séarachais d'áireamh mar chuid d'fhíacha an údaráis sin chun críocha aon tórann reachtúla le hairgead d'fháil ar iasacht.

44.—(1) Leasaítear leis seo alt 6 d'Acht na nUdarás nAitiúil (Forálacha Ilghnéitheacha), 1936 (Uimh. 55 de 1936) trí “nó dá gcothabháil” a chur i ndiaidh “ar fáil” i bhfo-alt (2).
(2) Measfar éifeacht a bheith ag fo-alt (1) den alt seo amhail ón dáta a ritheadh Acht na nUdarás nAitiúil (Forálacha Ilghnéitheacha), 1936.

45.—(1) Ní bheidh ráta a ghearrfas údarás áitiúil ina ráta neamhbhailí de bhíthin amháin nach ndearnadh fógra maidir leis an liosta luachála athbhreithnithe nó an liosta achomharc a hullmhaíodh faoi na hAchta Luachála a chur suas in aon áit do réir na nAcht sin.
(2) I dteannta feidhm a bheith ag fo-alt (1) den alt seo maidir le rátaí a gearrfar tar éis tosach feidhme an ailt seo, beidh feidhm aige freisin, agus measfar go raibh feidhm aige riamh, maidir le rátaí a gearradh roimh an tosach feidhme sin.
(3) D'ainneoin aon fhorála de na hAchta Luachála, ní bheidh aon oifigeach d'údarás áitiúil faoi dhliteanas i dtaobh gan fógra a chur suas in aon áit do réir na nAcht sin.

46.—In ionad fo-ailt (6) (a hathghairmtear leis an Acht seo) d'alt 60 d'Acht 1941, achtaítear leis seo go measfar nach feidhmeanna forcoimeádta na cumhachta, na feidhmeanna agus na dualgais a bheirtear agus a forchuirtear leis an alt sin.
47.—(1) San alt seo ciallaíonn “an tAcht” Acht na nUdarás Áitiúla (Oibreacha), 1949 (Uimh. 17 de 1949).
(2) Na caiteachais faoina raghaidh comhairle chontae ar oibreacha a ghabhfaid de láimh de bhun fo-ailt (2) d'alt 2 den Acht maidir le haon talamh is leo nó maidir le haon déanmhas buan a rinneadar féin nó a ceanglaítear orthu a chothabháil, muirearófar iad sa tslí chéanna ina muirearaítear caiteachais na comhairle maidir le cothabháil na talún nó an déanmhais bhuain.
(3) Muirearófar ar an gceantar sláinte contae na caiteachais faoina raghaidh comhairle chontae ar oibreacha a ghabhfaid de láimh de bhun fo-alt (3) d'alt 2 den Acht maidir le talamh nach leo nó maidir le haon déanmhas buan nach déanmhas buan a rinneadar féin nó a ceanglaítear orthu a chothabháil.
(4) Féadfaidh ordú faoi fho-alt (1) d'alt 3 den Acht, á údarú oibreacha a dhéanamh thar ceann údaráis áitiúil, a fhoráil go ndéanfaidh an t-údarás sin ranníoc i leith costas na n-oibreacha agus, más comhairle chontae an t-údarás sin agus gur dóigh leis an Aire gur chóir an ranníoc a mhuirearú ar an gceantar sláinte contae, a fhoráil gur ar an gceantar sin a muirearófar é.
(5) Féadfaidh comhaontú faoi fho-alt (2) d'alt 3 den Acht, chun oibreacha a dhéanamh thar ceann údaráis áitiúil, a fhoráil go ndéanfaidh an t-údarás sin ranníoc i leith costas na n-oibreacha agus, más comhairle chontae an t-údarás sin, muirearófar an ranníoc sa tslí chéanna ina muirearófaí a gcaiteachais dá mba iad an chomhairle féin a dhéanfadh na hoibreacha.
(6) Déanfar cúiteamh a bheas iníoctha ag comhairle chontae de bhun an Achta a mhuirearú sa tslí chéanna ina muirearaítear costas na n-oibreacha nó ranníoc na comhairle i leith costas na n-oibreacha (do réir mar is iomchuí).
(7) I gcás cúiteamh a bheith iníoctha faoin Acht ag údarás áitiúil a dhéanfas oibreacha thar ceann údaráis áitiúil eile:—
(a) féadfaidh an tAire, le hordú, aon ordú a rinneadh faoi fho-alt (4) den alt seo d'athrú ionas go mbeidh suim i leith cúitimh ar áireamh sa ranníoc,
(b) aon chomhaontú a rinneadh faoi fho-alt (2) d'alt 3 den Acht agus a fhorálas go ndéanfaidh an t-údarás áitiúil eile sin ranníoc, beidh éifeacht aige, faoi réir aon athruithe den tsórt sin, ionas go mbeidh ar áireamh sa ranníoc suim i leith cúitimh a gcomhaontófar uirthi idir na húdaráis áitiúla nó, cheal comhaontuithe, a chinnfeas an tAire.
(8) Féadfaidh comhairle chontae nó bardas contae-bhuirge, chun caiteachais faoin Acht d'íoc, airgead d'fháil ar iasacht faoi Airteagal 22 den Sceideal a ghabhas leis an Local Government (Application of Enactments) Order, 1898, amhail is dá mbeadh sin ar na críocha a luaitear san Airteagal sin, agus ní háireofar airgead a gheofar ar iasacht amhlaidh mar chuid d'fhiacha na comhairle nó an bhardais chun críocha an Airteagail sin.
(9) Féadfaidh bardas buirge (seachas contae-bhuirg) nó comhairle cheantair uirbigh, chun caiteachais faoin Acht d'íoc, airgead d'fháil ar iasacht faoi na hAchta Rialtais Áitiúil (Seirbhísí Sláintíochta), 1878 go 1952, amhail is dá mbeadh sin ar na críocha a bhfuil údarás ag an mbardas nó ag an gcomhairle airgead d'fháil ar iasacht ina leith faoi na hAchta sin, agus ní háireofar airgead a gheofar ar iasacht amhlaidh mar chuid d'fhiacha an bhardais nó na comhairle chun críocha aon tórann le hairgead d'fháil ar iasacht a forchuirtear leis na hAchta sin.

49.—(1) Má dheimhníonn duine a bheas arna áirithiú ag comhlucht poiblí in aon cháil ghairmiúil chomhairleach nó chomhchomhairleach, go bhfuil aon tsuim iníoctha as cistí an chomhluchta phoiblí agus má híoctar an tsuim sin, measfar an duine sin a bheith ina oifigeach don chomhlucht poiblí chun críocha ailt 20 den Local Government (Ireland) Act, 1902, arna leasú le fo-alt (3) d'alt 61 d'Acht 1925, chomh fada is bhaineas leis an íocaíocht a bheas deimhnithe aige.
(2) Ní bheidh feidhm ag fo-alt (1) den alt seo—

51.—(1) Más rud é, roimh thosach feidhme an ailt seo nó dá éis sin, go mbeidh áititheoirí áite i gcontae-bhuirg tar éis comhairle, coiste nó comhlucht eile, corpraithe nó neamhchorpraithe, a bhunú ar mhaithe le leas comhdhaonnach agus eacnamúil na n-áititheoirí sin i gcoitinne, féadfaidh bardas na contae-bhuirge, ar an gcomhlucht sin dá iarraidh sin, a dhearbhú le rún gur comhairle áitiúil fhormheasta chun críocha na Coda seo den Acht seo an comhlucht sin.
(2) Is feidhm fhorcoimeádta dearbhú a dhéanamh faoin alt seo.
(3) Sa Chuid seo den Acht seo ciallaíonn “comhairle áitiúil fhormheasta” comhlucht a mbeidh dearbhú déanta ina leith faoin alt seo agus forléireofar gach tagairt do bhardas, a déanfar maidir le comhairle áitiúil fhormheasta, mar thagairt don bhardas áirithe contae-bhuirge a rinne an dearbhú faoin alt seo maidir leis an gcomhairle áitiúil fhormheasta sin.

52.—(1) Féadfaidh an bardas foirgneamh a chur ar fáil lena úsáid ag comhairle áitiúil fhormheasta le haghaidh cruinnithe, poiblí agus eile, agus le haghaidh léachtaí, taispeántas, caitheamh aimsire i gcoitinne nó cuspóirí comhdhaonnacha eile dá samhail sin, agus féadfaidh cúram agus bainistí an fhoirgnimh a thabhairt don chomhairle, go buan nó go sealadach.
(2) Féadfaidh an bardas, trí chomhaontú, talamh a thógaint ar a mbeidh foirgneamh, nó talamh a thógaint le haghaidh foirgnimh, a bheas le cur ar fáil faoin alt seo.
(3) Féadfaidh an bardas cabhrú le comhairle áitiúil fhormheasta trí throscán, trealamh oifige agus scríobh-ábhar a sholáthar dóibh agus, i gcás foirgneamh a bheith curtha ar fáil faoin alt seo lena úsáid ag comhairle áitiúil fhormheasta, trína pháigh iomlán, nó cuid dá pháigh, d'íoc le duine atá ag gníomhú mar airíoch ar an bhfoirgneamh agus ag déanamh glanacháin agus dualgais dá shamhail maidir leis an bhfoirgneamh.
(4) Féadfaidh an bardas—
(a) deontas a thabhairt do chomhairle áitiúil fhormheasta a chabhródh leis an gcomhairle chun foirgneamh a chur ar fáil le haghaidh cruinnithe, poiblí nó eile, agus le haghaidh léachtaí, taispeántas, caitheamh aimsire i gcoitinne nó cuspóirí comhdhaonnacha eile dá shamhail sin, agus
(b) mar choinníoll a bhainfeas leis an deontas a thabhairt, a cheangal ar an gcomhairle pé comhaontuithe a dhéanamh leis an mbardas (lena n-áirítear comhaontuithe i dtaobh úsáid agus diúscairt an fhoirgnimh) is cuí leis an mbardas.
(5) Féadfaidh comhaontú faoi mhír (b) d'fho-alt (4) den alt seo a fhoráil go n-aisíocfaidh an chomhairle áitiúil fhormheasta iomlán an deontais nó cuid den deontas (lena n-áirítear pé muirir (más ann) a ghearrfas an bardas i leith an deontais) pé trátha agus i pé slí is cuí leis an mbardas.
(6) Féadfaidh an bardas, chun críocha an ailt seo, airgead d'fháil ar iasacht sa tslí chéanna ina bhféadfaid é d'fháil ar iasacht chun caiteachais d'íoc faoi na hAchta Rialtais Áitiúil (Seirbhísí Sláintíochta), 1878 go 1952.
(7) Féadfar airgead a gheofar ar iasacht de bhun an ailt seo a thabhairt ar iasacht don bhardas trí eisiúint as ciste na n-iasacht áitiúla amhail is dá mba é a bhí san iasacht sin iasacht áitiúil do réir bhrí Acht Ciste na nIasacht Áitiúla, 1935 go 1953, agus gur húdaraíodh í le hAcht ón Oireachtas.

(4) In ailt 76 go 79 d'Acht 1946 (lena n-áirítear na fo-ailt a chuireas na fo-ailt roimhe seo den alt seo leis na hailt sin), i gcás tí chónaithe bhig do réir bhrí an Achta Rialtais Áitiúil (Rátaí ar Thithe Cónaithe Beaga), 1928 (Uimh. 4 de 1928), nach é an t-únaer do réir bhrí an Achta sin an t-áititheoir freisin, ciallóidh “rátaíocóir” an t-áititheoir agus ní chiallóidh sé an t-únaer.

54.—(1) Leasaítear leis seo alt 73 d'Acht 1941 trí na fo-ailt seo a leanas a chur leis:—
“(4) Féadfaidh an chomhairle chontae—
(a) deontas a thabhairt do chomhairle áitiúil fhormheasta a chabhródh leis an gcomhairle áitiúil chun foirgneamh a chur ar fáil le haghaidh cruinnithe, poiblí nó eile, agus le haghaidh léachtaí, taispcántas, caitheamh aimsire i gcoitinne nó cuspóirí comhdhaonnacha eile dá samhail sin, agus
(b) mar choinníoll a bhainfeas leis an deontas a thabhairt, a cheangal ar an gcomhairle áitiúil pé comhaontuithe a dhéanamh leis an gcomhairle chontae (lena n-áirítear comhaontuithe i dtaobh úsáid agus diúscairt an fhoirgnimh) is cuí leis an gcomhairle chontae.
(5) Féadfaidh comhaontú faoi mhír (b) d'fho-alt (4) den alt seo a fhoráil go n-aisíocfaidh an chomhairle áitiúil fhormheasta iomlán an deontais nó cuid den deontas (lena n-áirítear pé muirir (más ann) a ghearrfas an chomhairle chontae i leith an deontais) pé trátha agus i pé slí is cuí leis an gcomhairle chontae.
(6) Féadfaidh an chomhairle chontae, chun críocha an ailt seo, airgead d'fháil ar iasacht sa tslí chéanna ina bhféadfaid é d'fháil ar iasacht chun caiteachais d'íoc faoi na hAchta Rialtais Áitiúil (Seirbhísí Sláintíochta), 1878 go 1952.
(7) Féadfar airgead a gheofar ar iasacht de bhun an ailt seo a thabhairt ar iasacht don chomhairle chontae trí eisiúint as ciste na n-iasacht áitiúla amhail is dá mba é a bhí san iasacht sin iasacht áitiúil do réir bhrí Acht Ciste na nIasacht Áitiúla, 1935 go 1953, agus gur húdaraíodh í, le hAcht ón Oireachtas.”
(2) Is feidhmeanna forcoimeádta feidhmeanna comhairle contae faoi fho-alt (1), (2), (3) nó (4) d'alt 73 d'Acht 1941.

55.—(1) Baineann an t-alt seo le húdarás áitiúil is údarás sláintíochta chun críocha na nAcht Rialtais Áitiúil (Seirbhísí Sláintíochta), 1878 go 1952.
(2) Féadfaidh údarás áitiúil lena mbaineann an t-alt seo, le toiliú an Aire agus faoi réir pé téarmaí agus coinníollacha is oiriúnach leis an údarás sin, ranníoc a dhéanamh le cistí cumainn, club, coiste nó comhluchta eile a chuirfeas saoráidí snámha ar fáil nó a bheartós iad a chur ar fáil.
(3) Féadfaidh údarás áitiúil lena mbaineann an t-alt seo airgead d'fháil ar iasacht d'fhonn ranníoc a dhéanamh faoin alt seo sa tslí chéanna ina bhféadfaid é d'fháil ar iasacht chun caiteachais d'íoc faoi na hAchta Rialtais Áitiúil (Seirbhísí Sláintíochta), 1878 go 1952.
(4) Féadfar airgead a gheofar ar iasacht de bhun an ailt seo a thabhairt ar iasacht d'údarás áitiúil trí cisiúint as ciste na n-iasacht áitiúla amhail is dá mba é a bhí san iasacht sin iasacht áitiúil do réir bhrí Acht Ciste na nIasacht Áitiúla, 1935 go 1953, agus gur húdaraíodh í le hAcht ón Oireachtas.

56.—(1) Feadfaidh bardas buirge, seachas contae-bhuirg, comhairle cheantair uirbigh nó coimisinéirí baile, a údarú airgead a chaitheamh ar mhaisiú na buirge, an cheantair uirbigh nó an bhaile ar ócáidí gairdis phoiblí agus ar ócáidí oiriúnacha eile.
(2) Ní bheidh na caiteachais faoina raghaidh bardas buirge, comhairle cheantair uirbigh nó coimisinéirí baile faoin alt seo, in aon bhliain airgeadais áitiúil, níos mó ná an tsuim a shaothródh ráta trí pingne sa phunt ar luacháil inrátuithe na buirge, an cheantair uirbigh nó an bhaile.
(3) Is feidhm fhorcoimeádta caiteachas d'údarú faoin alt seo.
Ranníoc le comhlucht a chuirfeas músaem ar fáil.
57.—(1) Féadfaidh comhairle chontae nó bardas contaebhuirge, le toiliú an Aire, ranníoc a dhéanamh le cistí cumainn, coiste nó comhluchta eile a chuirfeas músaem ar fáil nó a bheartós é a chur ar fáil chun sean-iarsmaí áitiúla a ghlacadh agus féadfaid cabhrú leis an gcumann, leis an gcoiste nó leis an gcomhlucht eile sin trí fhoirgneamh a chur ar fáil dóibh lena úsáid, trí throscán, trealamh oifige agus scríobh-ábhar a sholáthar dóibh nó trí luach saothair iomlán, nó cuid dá luach saothair, d'íoc le haon duine a bheas fostaithe maidir leis an músaem.
(2) Is feidhm fhorcoimeádta ranníoca a dhéanamh nó cabhair a thabhairt faoin alt seo.

58.—(1) I gcás tórainn a bheith curtha do réir reachta le méid aon chíosa, dolaidh, bothaíochta, táille nó muirir eile is féidir le húdarás áitiúil d'éileamh nó a thógaint maidir le margadh nó aonach, nó i leith úsáide, nó le haghaidh, seirbhísí a bheas curtha ar fáil trí abatóir nó seamlas, forléireofar an tagairt sa reacht don tórainn sin mar thagairt a fholaíos tagairt do pé tórainn difriúil a chuirfeas an t-údarás áitiúil ina hionad ó am go ham le toiliú an Aire Thalmhaíochta (arna thabhairt tar éis dó dul i gcomhairle leis an Aire) i gcás abatóra nó seamlais agus, in aon chás eile, le toiliú an Aire (arna thabhairt tar éis dó dul i gcomhairle leis an Aire Talmhaíochta).
(2) Is feidhm fhorcoimeádta tórainn a chur in ionad tórann eile faoin alt seo.

59.—(1) Más rud é—
(a) gur dóigh le húdarás áitiúil, i gcás aon chumhachta, feidhme nó dualgais is féidir leo d'fheidhmiú nó a chomhlíonadh, go mba chaothúla gur údarás áitiúil eile d'fheidhmeodh nó a chomhlíonfadh an chumhacht, an fheidhm nó an dualgas sin, go ginearálta nó i gcás áirithe, agus
(b) go bhfuil an t-údarás áitiúil eile i gcumas agus toilteanach an chumhacht, an fheidhm nó an dualgas d'fheidhmiú nó a chomhlíonadh amhlaidh.

(2) Más rud é—
(a) gur dóigh le comhlucht, is comhlucht a bunaíodh le reacht agus nach údarás áitiúil, gur cheart, i gcás aon chumhachta, feidhme nó dualgais is féidir leo d'fheidhmiú nó a chomhlíonadh, gur údarás áitiúil d'fheidhmeodh nó a chomhlíonfadh an chumhacht, an fheidhm nó an dualgas sin, go ginearálta nó i gcás áirithe, agus
(b) go bhfuil an t-údarás áitiúil i gcumas agus toilteanach an chumhacht, an fheidhm nó an dualgas d'fheidhmiú nó a chomhlíonadh amhlaidh,
féadfaidh an comhlucht agus an t-údarás áitiúil comhaontú a dhéanamh go bhfeidhmeoidh agus go gcomhlíonfaidh an t-údarás áitiúil an chumhacht, an fheidhm nó an dualgas amhlaidh thar ceann an chomhluchta, agus air sin beidh sé infheidhmithe nó inchomhlíonta amhlaidh ag an údarás áitiúil.
(3) Ní dochar an t-alt seo d'alt 47 den Acht Sláinte, 1953 (Uimh. 26 de 1953), agus ní déanfar comhaontú faoin alt seo i gcás ina bhféadfaí comhshocraíocht a dhéanamh faoin alt sin 47.
(4) Is feidhm fhorcoimeádta comhaontú a dhéanamh faoin alt seo.
Coistí comhairleacha.
60.—(1) Féadfaidh údarás áitiúil pé coistí, agus pé méid coistí, a cheapadh is oiriúnach leo chun aon nithe a bhreithniú a bhainfeas le feidhmeanna an údaráis áitiúil (lasmuigh de nithe dá dtagartar i bhfo-alt (4) d'alt 22 d'Acht na Séadchomharthaí Náisiúnta, 1930 (Uimh. 2 de 1930), nó i bhfo-alt (1) d'alt 48 den Acht Sláinte, 1953 (Uimh. 26 de 1953) ), agus an t-údarás áitiúil a chomhairliú sna nithe sin.
(2) Beidh triúr comhaltaí ar a laghad ar choiste faoin alt seo agus féadfaidh an coiste bheith comhdhéanta go hiomlán de chomhaltaí den údarás áitiúil a cheap iad, nó go páirteach de na comhaltaí sin agus go páirteach de dhaoine eile.
Rialacháin maidir le cruinnithe, etc.
61.—(1) Féadfaidh an tAire, le rialacháin, socrú a dhéanamh maidir le gach údarás áitiúil nó le haon údarás áitiúla i leith gach ní nó aon ní acu seo a leanas:—
(a) cruinnithe a ghairm agus a thionól,
(b) nós imeachta,
(c) conartha a dhéanamh,
(d) cuntais,
(e) iniúchadh cuntas,
(f) nithe a ghabhas nó a bhaineas le haon nithe acu sin roimhe seo.
(2) O thosach feidhme rialachán faoin alt seo agus dá éis sin, beidh na nithe ar ina leith a rinneadh na rialacháin, i gcás aon údaráis áitiúil a bheas i gceist, faoi réim forál na rialachán, agus scoirfidh aon fhorála roimhe sin, pé acu le reacht nó faoi reacht a rinneadh iad, a mbeidh feidhm acu maidir leis an údarás sin, agus a bhainfeas leis na nithe sin, d'éifeacht a bheith acu i gcás an údaráis sin.
(3) Ní déanfar rialacháin faoin alt seo a bhainfeas—
(a) le húdaráis ospidéal meabhair-ghalar do réir bhrí an Achta Chóireála Meabhair-Ghalar, 1945 (Uimh. 19 de 1945),
(b) le comhbhoird a bunaíodh le hordú faoi alt 45 den Acht Sláinte, 1953 (Uimh. 26 de 1953), ná
(c) le coistí comhairleacha sláinte a ceapadh faoi alt 48 den Acht Sláinte, 1953, nó faoi rialacháin a rinneadh faoin alt sin,
ach amháin le toiliú an Aire Shláinte.
(4) Gach rialachán a déanfar faoin alt seo, leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach acu sin, laistigh den lá agus fiche a shuífeas an Teach sin tar éis an rialachán a leagadh faoina bhráid, rún a rith ag neamhniú an rialacháin, beidh an rialachán ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin rialachán.
Buan-Orduithe chun imeachta a rialú.
62.—(1) Féadfaidh údarás áitiúil buan-orduithe a dhéanamh chun a n-imeachta a rialú seachas imeachta a bhfuil foráil déanta dá rialú le reacht nó faoi reacht (lena n-áirítear an tAcht seo), agus féadfaid na buan-orduithe sin a leasú nó a chúlghairm.
(2) Aon bhuan-orduithe a bheas i bhfeidhm díreach roimh thosach feidhme an ailt seo, fanfaid i bhfeidhm d'ainneoin an tAcht seo d'athghairm na gcumhacht faoina ndearnadh iad agus féadfar iad a leasú nó a chúlghairm le buan-orduithe faoin alt seo.
Bainisteoir do láithriú ar leithligh ag fiosrúchán áitiúil.
63.—Leasaítear leis seo mar leanas alt 90 d'Acht 1946:
(a) trí “féadfaidh an bainisteoir don údarás áitiúil, le toiliú an Aire, láithriú ar leithligh ag an bhfiosrúchán agus féadfaidh láithriú amhlaidh go pearsanta nó trí abhcóide nó aturnae” a chur i bhfo-alt (1) in ionad “féadfaidh an tAire, más oiriúnach leis, a ordú go bhféadfaidh an bainisteoir don údarás áitiúil láithriú ar leithligh ag an bhfiosrúchán”, agus
(b) tríd an bhfo-alt seo a leanas a chur in ionad fo-ailt (2):
“(2) I gcás an bainisteoir d'údarás áitiúil do láithriú ar leithligh ag fiosrúchán áitiúil de bhun fo-ailt (1) den alt seo, is feidhm fhorcoimeádta fostú agus teagasc an abhcóide nó an aturnae a láithreos ag an bhfiosrúchán thar ceann an údaráis áitiúil.”
Ranníoc i leith costas agus caiteachas maidir le fiosrúchán áitiúil.
64.—Leasaítear leis seo alt 91 d'Acht 1946 trí “nó má rinneadh é ar thionscnamh an Aire faoi aon Acht eile” a chur isteach i bhfo-alt (1) i ndiaidh “Má rinneadh fiosrúchán áitiúil faoi alt 83 d'Acht 1941” agus trí “(lena n-áirítear na costais agus na caiteachais faoina ndeachaigh bainisteoir go réasúnach ag láithriú dhó ar leithligh de bhun fo-ailt (1) d'alt 90 den Acht seo)” a chur isteach sa bhfo-alt sin i ndiaidh “maidir leis an bhfiosrúchán”.
Coimisinéirí baile nach ceantar uirbeach a chorprú.
65.—Beidh éifeacht ag na forála seo a leanas maidir le coimisinéirí baile nach ceantar uirbeach:—
(a) tiocfaidh na coimisinéirí chun bheith agus beid chun gach críche ina gcomhlucht corpraithe le comharbas suthaineach faoin ainm “Coimisinéirí Baile..................” (agus ainm an bhaile a chur isteach);
(b) féadfaidh na coimisinéirí agra a dhéanamh agus féadfar agra a dhéanamh ina gcoinne faoina n-ainm corpraithe agus féadfaid talamh a shealbhú agus a dhiúiscairt chun críocha a gcumhacht agus a ndualgas;
(c) beidh gnáthshéala ag na coimisinéirí ar a dtabharfar aird bhreithiúnach;
(d) an mhaoin uile a bhí, díreach roimh thosach feidhme an ailt seo, dílsithe i nduine ar bith nó á teachtadh ar iontaobhas aige chun críocha na gcoimisinéirí, tiocfaidh sí chun bheith, agus beidh sí, dílsithe sna coimisinéirí gan aon tíolacas ná sannadh;
(e) má déantar am ar bith ordú faoi alt 76 d'Acht 1946 ag athrú ainm an bhaile, beidh ainm na gcoimisinéirí arna athrú dá réir sin amhail ó dháta an orduithe sin a theacht i ngníomh.
Cúlghairm ar ordú a thoirmisceas teaghais sealadacha.
66.—(1) Féadfar ordú a rinne údarás sláintíochta faoi alt 31 den Acht Rialtais Áitiúil (Seirbhísí Sláintíochta), 1948 (Uimh. 3 de 1948), a chúlghairm—
(a) más ordú é a tháinig i bhfeidhm de bhun míre (a) d'fho-alt (8) den alt sin—trí ordú a dhéanfas an t-údarás le toiliú an Aire nó trí ordú a dhéanfas an tAire tar éis dó dul i gcomhairle leis an údarás, agus
(b) in aon chás eile—trí ordú a dhéanfas an t-údarás le toiliú an Aire.
(2) Is feidhm fhorcoimeádta ordú a dhéanamh faoin alt seo ag údarás sláintíochta.
Costais taistil, etc.
67.—(1) Beidh éifeacht ag alt 80 d'Acht 1941 agus ag alt 67 d'Acht 1946, agus ag na hailt sin mar bheirtear feidhm dóibh le halt 8 den Acht Leabharlanna Poiblí, 1947 (Uimh. 40 de 1947), faoi réir na leasuithe seo a leanas:—
(a) déanfar gach tagairt d'áit chónaithe oifigiúil dhuine d'fhorléiriú mar thagairt dá ghnáth-áit chónaithe,
(b) soriosfar fo-alt (6) den alt sin 80,
(c) cuirfear “míle” i bhfo-alt (7) den alt sin 67 in ionad “trí mhíle”,

íocfaidh an chomhairle nó an bord leis an gcomhalta maidir leis an gcruinniú liúntas uileghabhálach (nach mó ná suim a bheas sonraithe leis na rialacha ordaithe) i leith costas taistil agus cothuithe agus, i gcás ina mbeadh, lasmuigh den mhír seo, liúntas iníoctha faoin gcéad mhír den fho-alt seo, is liúntas in ionad an liúntais sin a bheas ann agus ní liúntas ina theannta.
Féadfar rún faoin dara mír den fho-alt seo a chúlghairm tráth ar bith le rún eile ón gcomhairlc nó ón mbord a bheas i gceist.
Is feidhm fhorcoimeádta rún a rith faoin dara mír nó faoin tríú mír den fho-alt seo.”
(2) Gach comhalta de chomhlucht lena mbaineann na hailt sin nó lena mbaineann na hailt sin mar bheirtear feidhm dóibh mar adúradh, déanfaidh sé, díreach tar éis dó teacht chun bheith ina chomhalta den tsórt sin, an seoladh ag a bhfuil gnáth-chónaí air a chur in iúl i scríbhinn don chomhlucht agus cuirfidh sé in iúl freisin aon athrú dá éis sin ar a sheoladh.

68.—(1) Leasaítear leis seo alt 7 den Acht um Chúnamh Phoiblí, 1939 (Uimh. 27 de 1939), trí na fo-ailt seo a leanas a chur leis:—
“(4) D'ainncoin aon fhorála eile den Acht seo, féadfaidh an tAire, le toiliú an Aire Shláinte, tóranta Ceantair Chúnaimh Phoiblí Bhaile Atha Cliath, Ceantair Chúnaimh Phoiblí Ráth Dúin nó Ceantair Chúnaimh Phoiblí Bhaile an Ridire d'athrú, le hordú, agus déanfaidh an t-ordú pé athruithe iarmartacha is iomchuí leis an Aire ar thóranta aon cheantair cúnaimh phoiblí atá i dtadhall le haon cheann acu sin.

(b) bhéarfaidh sé ráiteas ar a thograí lena bhreithniú, i rith tréimhse a shonrós an tAire, ag bardas Bhaile Atha Cliath agus breithneoidh sé aon tuairimí a bhéarfas an bardas sin ar an ráiteas i rith na tréimhse sin.”

LOCAL GOVERNMENT ACT, 1955.
PART I.
Preliminary and General.
Short title, collective citation and construction.
1.—(1) This Act may be cited as the Local Government Act, 1955.
(2) The Local Government Acts, 1925 to 1953, and this Act may be cited together as the Local Government Acts, 1925 to 1955.
(3) The Local Government Acts, 1925 to 1953, and this Act shall be construed together as one Act.
Definitions.
2.—In this Act—
“the Act of 1925” means the Local Government Act, 1925 (No. 5 of 1925);
“the Act of 1941” means the Local Government Act, 1941 (No. 23 of 1941);
“the Act of 1946” means the Local Government Act, 1946 (No. 24 of 1946);
“the Minister” means the Minister for Local Government;
“prescribed” means prescribed by the Minister by regulations made under this Act.
Commencement.
3.—This Act (except section 24 the coming into operation of which is provided for in that section) shall come into operation on such day or days as may be fixed therefor by order or orders of the Minister either generally or with reference to any particular purpose or provision and different days may be so fixed for different purposes and different provisions of this Act.
Regulations.
4.—(1) The Minister may make regulations prescribing any matter or thing referred to in this Act as prescribed or to be prescribed.
(2) Every regulation made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly but without prejudice to the validity of anything previously done thereunder.
Repeals.
5.—The enactments mentioned in the First Schedule to this Act are hereby repealed to the extent mentioned in the third column of that Schedule.
PART II.
Offices and Employments and Amendments of the Local Authorities (Officers and Employees) Act, 1926.
Chapter I.
Offices and Employments.
Definitions for Chapter I of Part II.
6.—In this Chapter of this Part of this Act “appropriate Minister”, “local authority”, “major office” and “office” have the same meanings respectively as in Part II of the Act of 1941.
Alteration of duties in certain cases.
7.—Where, by an agreement or arrangement entered into under this or any other Act, a local authority exercise or perform a power, function or duty of another body—
(a) it shall be the duty of every officer of the local authority to perform such duties appropriate to the nature of the power, function or duty as the local authority may decide, and
(b) in case the other body is a local authority, it shall be the duty of every officer of that local authority to refrain from performing such duties appropriate to the nature of the power, function or duty as that local authority may decide.
General sanction or consent by appropriate Minister.
8.—In relation to any power of the appropriate Minister which—
(a) is a power under Part II of the Act of 1941, Part III of the Act of 1946 or this Chapter of this Part of this Act, and
(b) is a power to sanction or to consent to acts of any local authorities,
the appropriate Minister may, as respects all or any one or more of those authorities or any class of those authorities, give a general sanction or consent applying to future such acts in cases in which he is the appropriate Minister and having effect on fulfilment, and only on fulfilment, by the authority or authorities concerned of specified conditions or requirements.
Inclusive remuneration.
9.—(1) The appropriate Minister may direct that the remuneration of all the offices in relation to which he is the appropriate Minister, or of such of those offices as belong to a specified class, description or grade, or of a specified one of those offices, shall be inclusive remuneration.
(2) Subject to subsection (3) of this section, a holder of an office to which a direction under this section relates shall pay over to the local authority under whom he holds the office any fees or other moneys (other than his inclusive remuneration) payable to and received by him by virtue of the office or in respect of services which a holder of the office is required by or under any enactment to perform.
(3) A direction under this section shall not apply, save with his consent, to a person who, at the time when the direction is given, is the holder of an office to which the direction relates while he continues to hold that office.
(4) Where a holder of an office to which a direction under this section relates also holds an office under a Department of State, any fees or other moneys received by him by virtue of the latter office shall be deemed for the purposes of this section to be received by him by virtue of the former office.
(5) A direction which, immediately before the commencement of this section, was in force under section 22 (repealed by this Act) of the Act of 1941 in relation to the holder of an office shall continue to have effect as if it were a direction under this section in relation to that office.
Amalgamation of offices.
10.—(1) Where the same Minister is the appropriate Minister in relation to any particular offices, such Minister may, subject to the provisions of this section and after consultation with the local authority or local authorities concerned, by order amalgamate the offices, and thereupon the offices shall become and be one office under such title (if any) as is specified in the order.
(2) Where, as respects any particular offices, there are two or more Ministers each of whom is the appropriate Minister in relation to one or more than one of such offices, those Ministers may, subject to the provisions of this section and after consultation with the local authority or local authorities concerned, by order amalgamate the offices, and thereupon the offices shall become and be one office under such title (if any) as is specified in the order and having such Minister as is specified in the order as appropriate Minister for the purposes of Part II of the Act of 1941, Part III of the Act of 1946 and this Chapter of this Part of this Act.
(3) Offices shall not be amalgamated under this section unless—
(a) each of the offices is vacant, or
(b) each of the offices is held by the same person, or
(c) one only of the offices being not vacant, the holder thereof consents to the making of the order, or
(d) in any other case, the same person holds each of such of the offices as are not vacant and such person consents to the making of the order.
(4) Where offices amalgamated under this section are not all under the same local authority, the following provisions shall have effect:
(a) appointments to the amalgamated office shall be made by such one of the local authorities concerned as the appropriate Minister shall by order specify,
(b) the holder of the amalgamated office shall be paid remuneration by such local authority as makes appointments to the amalgamated office, and that local authority may recover from any other local authority concerned such portion of the remuneration as may be settled by agreement between them or, in default of agreement, by the appropriate Minister or where two or more Ministers are concerned, by agreement between them.
(5) An order made or deemed to have been made under section 36 (repealed by this Act) of the Act of 1946 and in force immediately before the commencement of this section shall continue in force and shall be deemed to have been made under this section and to be capable of being amended or revoked accordingly.
Determination of certain doubts, etc.
11.—(1) Where any doubt, dispute or question arises, or in the opinion of the appropriate Minister, is likely to arise as to whether any particular person, or any particular class, description or grade of persons, employed by a local authority or local authorities is or is not an officer, or are or are not officers, for the purposes of this Act or any of the Local Government Acts, 1925 to 1946, or as to whether any particular position, or any particular class, description or grade of positions, under a local authority or local authorities is or is not an office, or are or are not offices, for those purposes, the doubt, dispute or question shall be decided by the appropriate Minister and such decision shall be final.
(2) A decision made under section 12 (repealed by this Act) of the Act of 1941 shall continue in force and shall be deemed to have been made under this section.
Amendment of section 10 of Act of 1941.
12.—(1) Section 10 of the Act of 1941 is hereby amended by the addition of the following subsections:—
“(4) For the purposes of this section, a local authority may, with the general or particular approval of the appropriate Minister, create offices either on a permanent or a temporary basis.
(5) A local authority may, with the general or particular approval of the appropriate Minister, abolish offices, but in the case of an office held by a person in a permanent capacity, it shall not be abolished save with the consent of that person.
(6) An appeal under subsection (2) of this section shall not be brought after the expiration of six months after the decision is communicated to the officer.”
(2) The reference in subsection (6) (inserted by subsection (1) of this section) of section 10 of the Act of 1941 to six months after the decision is communicated to the officer shall, in the case of a decision made before the commencement of this section, be construed as a reference to six months after the decision is communicated to the officer or after such commencement, whichever is the later.
Amendment of sections 13 and 16 of Act of 1941.
13.—The references in sections 13 and 16 of the Act of 1941 to Part II of that Act shall be construed as including references to Part III of the Act of 1946 and this Chapter of this Part of this Act.
Amendment of section 19 of Act of 1941.
14.—Section 19 of the Act of 1941 is hereby amended as follows:
(I) the following paragraphs shall be substituted for paragraph (j) of subsection (1):—
“(j) providing, in case of holders being ill, absent or incapacitated, for the performance of their duties by deputy or substitute,
(k) providing for restrictions on holders engaging in any other gainful occupation,
(l) providing for the removal from office by local authorities of holders who hold in a permanent capacity and prescribing the procedure to be adopted and the conditions to be fulfilled in relation to such removals,
(m) providing for the imposition by local authorities on holders of suspensions from performance of duties (including short-term disciplinary suspensions, not exceeding seven days), the non-payment of remuneration during the continuance of the suspensions and, upon the termination thereof, the forfeiture (in whole or in part), payment or disposal otherwise of remuneration which would, but for the suspensions, have been paid during the periods thereof,
(n) providing for the supplementing of the regulations by directions (being directions for the purpose of giving effect to the regulations, but neither extending the regulations nor widening their scope) given from time to time by the appropriate Minister.”
(II) the following subsections shall be added to the section:—
“(4) Where the making of any order or recommendation, the giving of any certificate, approval or sanction or the doing of any other act by the holder of an office is required for the purposes of any enactment or order, such order, recommendation, certificate, approval, sanction or act, when made, given or done by a deputy or substitute performing the duties of the holder pursuant to regulations under this section during a period when the holder is ill, absent or incapacitated, shall be as valid for all purposes as if it had been made, given or done by the holder in person.
(5) Every regulation made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly but without prejudice to the validity of anything previously done thereunder.”
Amendment of section 20 of Act of 1941.
15.—Section 20 of the Act of 1941 is hereby amended by the addition of the following subsection:—
“(3) The powers conferred by this section in relation to a specified office may be exercised notwithstanding that such office belongs to a class, description or grade in relation to which the powers conferred by this section have already been exercised.”
Amendment of section 21 of Act of 1941.
16.—Section 21 of the Act of 1941, as amended by section 40 of the Act of 1946, is hereby further amended by the addition of the following subsection:—
“(12) Where, as respects any office, the qualification that any woman holding the office be either unmarried or a widow has been declared under this section to be a qualification, that qualification shall not apply in the case of a married woman holding in a permanent capacity an office the duties of which relate to matters the same as or similar to the matters to which the duties of the first-mentioned office relate and as respects which neither that qualification, nor the condition that the holder should resign on marriage, applied when she was appointed (including a case in which such non-application was by virtue of this subsection).”
Amendment of section 24 of Act of 1941.
17.—Section 24 of the Act of 1941 is hereby amended as follows:—
(I) the following word and paragraph shall be inserted after paragraph (b) of subsection (1):—
“or
(c) that, on account of any alteration (whether it has already occurred or is in contemplation) in the nature or extent of the duties attached to such office, it is in the public interest that such office should be abolished,”
(II) in subparagraph (iii) of paragraph (b) of subsection (3) “any local authority” shall be substituted for “the relevant local authority”,
(III) in subparagraph (v) of paragraph (b) of subsection (3) “appropriate” shall be inserted before “Minister”,
(IV) the following subsection shall be added to the section:—
“(5) For the purposes of subparagraph (v) of paragraph (b) of subsection (3) of this section, the fact that the duties of the other office are to be performed at a distance from the place or places at which the duties of the first office were performed shall not of itself be regarded as rendering the position of the holder materially altered to his detriment.”
Amendment of section 27 of Act of 1941.
18.—Section 27 of the Act of 1941 is hereby amended by the deletion in subsection (1) of “of such local authority or”, “otherwise”, “such local authority or” (where those words occur secondly) and “(as the case may be)”.
Amendment of section 29 of Act of 1941.
19.—Section 29 of the Act of 1941 is hereby amended as follows:—
(I) “or holders of such major offices as belong to a specified class, description or grade” shall be inserted after “specified major office” and “or offices” shall be inserted after “such office”,
(II) the following paragraph shall be added to the section:—
“The powers conferred by this section in relation to the holders of a specified major office may be exercised notwithstanding that such office belongs to a class, description or grade in relation to which the powers conferred by this section have already been exercised.”
Restriction on power to assign remuneration.
20.—(1) The power of a local authority under section 10 of the Act of 1941 to assign remuneration to an officer shall not be exercised except in accordance with such one or more of the following as may be appropriate from time to time:—
(a) any order made by the appropriate Minister under section 29 of the Act of 1941,
(b) any regulation made by the appropriate Minister under paragraph (a) of subsection (1) of section 19 of the Act of 1941,
(c) any direction given by the appropriate Minister regarding the considerations that should govern levels of remuneration of officers generally,
(d) any direction given by the appropriate Minister regarding the considerations that should govern levels of remuneration of officers of a specified class, description or grade, the officer being in that class, description or grade,
(e) the sanction of the appropriate Minister.
(2) The power of a local authority under section 10 of the Act of 1941 to assign remuneration to a servant shall not be exercised except in accordance with such one or more of the following as may be appropriate from time to time:—
(a) any direction given by the appropriate Minister regarding the considerations that should govern levels of remuneration of servants generally,
(b) any direction given by the appropriate Minister regarding the considerations that should govern levels of remuneration of servants of a specified class, description or grade, the servant being in that class, description or grade,
(c) the sanction of the appropriate Minister.
(3) The appropriate Minister may give directions for the purposes of this section.
Restriction on holding office or being employed.
21.—(1) No person shall hold any office of profit under or be employed for remuneration by or under any local authority while he is a member of that authority.
(2) No person shall hold any major office under a local authority while he is a member of any other local authority whose functional area is, or is situate in, the same county or county borough as that of or within which is situate the functional area of such local authority or in any county or county borough adjoining to that county or county borough.
(3) Where a person ceases to be a member of a local authority otherwise than by reason of the expiration of his term of office, he shall be regarded for the purposes of subsections (1) and (2) of this section as continuing to be such member for twelve months after such cesser or until his term of office would, but for such cesser, have expired, whichever is the shorter period.
(4) In this section any reference to a local authority shall be construed as not including a reference to any body whose functions are restricted to advice, consideration, report or consultation.
(5) Subsection (1) of section 70 of the Act of 1925 shall cease to have effect, subject to the proviso that every restriction on holding any office of profit or being employed for remuneration which resulted from the application by any other Act of that section and which was in operation immediately before the commencement of this section shall continue in operation.
Transfer of certain powers, etc.
22.—(1) Every power, function or duty conferred by statute on any surveyor or assistant surveyor under a local authority is hereby transferred to that local authority.
(2) The transfer from any surveyor or assistant surveyor effected by subsection (1) of this section shall be deemed not to alter his position materially to his detriment.
Special provisions for certain persons.
23.—(1) Where—
(a) a person, at the commencement of this section, has a period of pensionable local service for the purposes of Part II of the Local Government (Superannuation) Act, 1948 (No. 4 of 1948), and
(b) during any period or periods, being a period or periods not reckonable for the purposes of the Superannuation Acts, 1834 to 1954, such person performed the duties of a local authority by virtue of an appointment made under statute,
the period referred to in paragraph (a) of this subsection and the period or periods referred to in paragraph (b) of this subsection may be aggregated and deemed to be service for the purposes of the said Part II.
(2) Where at the commencement of this section, Séamas O Murchadha holds the office of chief executive officer of the Dublin Board of Assistance:—
(a) his name shall be deemed to be entered in the register kept by that Board under Part II of the Local Government (Superannuation) Act, 1948, and to have been so entered consequent upon an application duly made under subsection (1) of section 37 of that Act,
(b) the following may be aggregated and deemed to be service for the purposes of the said Part II:
(i) his service as chief executive officer of that Board,
(ii) his service as commissioner for that Board,
(iii) his service rendered prior to the service mentioned in subparagraph (ii) of this paragraph which is reckonable for the purposes of the Superannuation Acts, 1834 to 1954, and
(iv) his service as commissioner for Dublin Union, and
(c) he shall be deemed to be a pensionable officer of that Board in respect of the service mentioned in subparagraphs (i), (ii) and (iv) of paragraph (b) of this subsection, but subsection (6) of section 37 of the Local Government (Superannuation) Act, 1948, shall not apply in respect of him.
Age limit for certain offices.
24.—(1) (a) Section 23 of the Act of 1941 is hereby amended by the addition of the subsection set out in Part I of the Second Schedule to this Act.
(b) This subsection shall be deemed to have come into operation on the commencement of section 23 of the Act of 1941 and every declaration made before the passing of this Act and framed as a declaration under that section shall be, and shall be deemed always to have been, as valid as if this section had then come into operation, subject to the proviso that nothing in this subsection shall be construed as affecting any proceedings instituted in the High Court before the 7th day of July, 1954, in relation to any such declaration as respects the parties to those proceedings.
(c) The amendment of section 23 of the Act of 1941 comprised in paragraph (a) of the new subsection added to that section by this subsection shall not be deemed to be or involve a declaration that the law under that section was, or was considered by the Oireachtas to have been, different from the law under that section as so amended.
(2) (a) Section 6 of the Vocational Education (Amendment) Act, 1944 (No. 9 of 1944), is hereby amended by the addition of the subsection set out in Part II of the Second Schedule to this Act.
(b) This subsection shall be deemed to have come into operation on the passing of the Vocational Education (Amendment) Act, 1944, and every declaration made before the passing of this Act and framed as a declaration under that section shall be, and be deemed always to have been, as valid as if this section had then come into operation.
Chapter II.
Amendments of the Local Authorities (Officers and Employees) Act, 1926.
The Principal Act.
25.—(1) In this Chapter of this Part of this Act “the Principal Act” means the Local Authorities (Officers and Employees) Act, 1926 (No. 39 of 1926).
(2) Wherever the Principal Act has been applied by any other Act to any particular office or employment or in relation to any board, committee, or other body (whether corporate or unincorporated), the Principal Act shall apply to such office or employment or in relation to such body with and subject to the amendments thereof effected by the subsequent sections of this Chapter of this Part of this Act.
Amendment of section 2 of Principal Act.
26.—Section 2 of the Principal Act is hereby amended by the substitution in paragraph (b) of subsection (1) of “(not being a temporary office, a part-time office as engineer or surveyor under the council of an urban district or the commissioners of a town or an office as a teacher)” for “and every employment (not being an office or employment as a teacher)” and by the deletion of “or technical” in that paragraph.
Amendment of section 6 of Principal Act.
27.—(1) Section 6 of the Principal Act is hereby amended by the addition of the following subsections:—
“(5) Subsection (4) of this section shall have effect subject to the proviso that where the local authority specify a period (not less than three months) within which the person who is recommended by the Commissioners or who is thought proper by the local authority to be appointed (as the case may be) is to take up duty and notify him of the period so specified, the local authority shall not appoint him unless he takes up duty within that period.
(6) If a person referred to in subsection (5) of this section does not take up duty within the period notified to him—
(a) the local authority shall request the Commissioners to recommend to them a person for appointment to the office,
(b) if the local authority does not, within three months after the expiration of the said period, request the Commissioners to recommend to them a person for appointment to the office, the Minister may on behalf of the local authority request the Commissioners to recommend to the local authority a person for appointment to the office,
(c) when a request has been made as aforesaid by the local authority or the Minister (as the case may be), subsections (3), (4) and (5) of this section and this subsection shall apply by reference to such request.”
(2) As well as applying in any case in which a request or recommendation is made under section 6 of the Principal Act after the commencement of this section, the provisions contained in subsection (1) of this section shall also apply in any case in which, on such commencement, a request which has not been followed by a recommendation or a recommendation which has not been followed by an appointment stands made under the said section 6.
Amendment of section 10 of Principal Act.
28.—Section 10 of the Principal Act is hereby amended as follows:—
(I) in subsection (1) “such fee (including, where the Commissioners consider it appropriate, a charge for medical examination) as the Commissioners, after consultation with the Minister, shall think proper” shall be substituted for “such fee as the Commissioners, after consultation with the Minister, shall think proper”,
(II) the following subsection shall be added to the section:
“(3) The fee which may be charged in pursuance of this section may be fixed from time to time by the Commissioners, after consultation with the Minister, generally in respect of all offices of a particular grade.”
Dispensing with competitive examination.
29.—(1) Where the Local Appointments Commissioners, with the concurrence of the appropriate Minister, are of opinion that, having regard to the nature of the duties of a particular office to which the Principal Act applies or of all such offices of a particular class, description or grade, to the knowledge and experience necessary for the efficient performance of those duties and to the qualifications (whether existing or proposed) for such office or offices, the person or persons to be recommended for appointment to such office or offices cannot be satisfactorily selected by competitive examination, the Local Appointments Commissioners may, as respects such office or offices, dispense with the competitive examination required by the Principal Act and may select the person or persons to be recommended by them in such manner as they think proper.
In this section “the appropriate Minister” has the same meaning as “the Minister” has in the Principal Act as amended and adapted by subsequent enactments.
(2) Section 9 of the Principal Act shall not apply in any case as respects which subsection (1) of this section is applicable unless the Local Appointments Commissioners have, before the commencement of this section, dispensed with competitive examination in such case pursuant to the said section 9.
Panels of persons qualified for appointment to offices.
30.—(1) In this section “panel classification” means any class, description or grade of office determined for the purposes of this section by the Local Appointments Commissioners.
(2) The Local Appointments Commissioners, if they so think fit, may, in accordance with rules under subsection (4) of this section, arrange from time to time for examining, as respects all or any of the offices of a particular panel classification, the qualifications of persons desirous of being appointed to any vacancies that exist or may occur and for preparing a panel of such persons from which a recommendation may be made in compliance with a request (received either before or after the completion of the panel) under section 6 of the Principal Act or subsection (2) of section 4 of the County Management Act, 1940 (No. 12 of 1940).
(3) Where the Local Appointments Commissioners are requested under section 6 of the Principal Act or subsection (2) of section 4 of the County Management Act, 1940 (No. 12 of 1940), to recommend a person for appointment to an office of a panel classification, the Local Appointments Commissioners, if they so think fit, may select a person from the relevant panel prepared under subsection (2) of this section and recommend such person for appointment.
(4) The Local Appointments Commissioners may, with the consent of the appropriate Minister, make rules for the purposes of subsection (2) of this section applying either generally to all panel classifications or to any particular panel classification.
In this section “the appropriate Minister” has the same meaning as “the Minister” has in the Principal Act, as amended and adapted by subsequent enactments.
PART III.
Roads.
Production of road materials.
31.—The powers conferred by subsection (1) of section 10 of the Local Government (Ireland) Act, 1898, may be exercised with respect to the land referred to in subsection (1) of section 12 of that Act.
Extension of application of Development and Road Improvement Funds Act, 1909.
32.—Section 17 of the Development and Road Improvement Funds Act, 1909, is hereby amended by the insertion of “or borough or urban district” after “county borough” in both places where the latter words occur in the section.
Construction of certain expressions.
33.—(1) This section applies to the expressions “highway”, “public highway”, “highway repairable by the inhabitants at large” and similar expressions.
(2) To remove doubts, it is hereby declared that where an expression to which this section applies is used in a statute relating to public roads, or in an instrument made under any such statute, the expression refers, and always referred, to a road as defined in section 1 of the Act of 1925.
Declaration of main road.
34.—To remove doubts, it is hereby declared that the power of the Minister under section 1 of the Act of 1925 to declare a road to be a main road is, and always was, exercisable in relation to a proposed new road.
Temporary closing of road.
35.—(1) The local authority charged with the maintenance of a road may, after giving such notice as may be prescribed, close the road or any part thereof to public traffic for such period and subject to such conditions as they think fit.
(2) Where, pursuant to a decision of a local authority under subsection (1) of this section, a road or part of a road is to be closed, the local authority may by order permit the holding of a road race or similar event on it during the period for which it is to be closed.
(3) If any person without due authority uses or permits the use of a vehicle on a road closed to it under this section, or wilfully obstructs or interferes with the conduct of any event permitted under this section, he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
(4) The Minister may by order annul or vary any decision or order made by a local authority under this section, and the local authority shall give such public notice of the order made by the Minister as may be prescribed.
Traffic signs on roads.
36.—(1) The following definition is hereby substituted in subsection (1) of section 69 of the Act of 1946 for the definition of the expression “traffic sign”:—
“the expression ‘traffic sign’ means any sign, device, notice or roadway marking, or any instrument for giving signals by mechanical means, which does one or more of the following:—
(a) gives information in regard to a road, including the places to which it leads, and the distances to or from such places,
(b) warns persons of danger in relation to a road, or advises the precautions to be taken against such danger, or both,
(c) indicates the existence of a road regulation in relation to a road, or implements such a regulation, or both;”
(2) The following subsection is hereby substituted for subsection (2) of section 69 of the Act of 1946:—
“(2) (a) The Minister, if he so thinks fit, may make regulations with respect to specified traffic signs, and where a traffic sign of the same kind as a traffic sign specified in any such regulations is provided by a road authority, it shall be in accordance with the regulations unless otherwise authorised by the Minister.
(b) Regulations under this subsection may specify the significance to be attached to a traffic sign specified in the regulations, but this provision shall not be construed as requiring the regulations to provide that the traffic sign is to comprise any word, words or symbol indicating precisely the significance of the traffic sign.”
(3) The following subsections shall be added to section 69 of the Act of 1946:—
“(14) A person shall not provide any such sign, device, notice or light as is not a traffic sign if, on provision thereof, it is visible from a road and—
(a) it is capable of being confused with a traffic sign,
(b) it makes a traffic sign provided in accordance with this section less visible to road users, or
(c) it obstructs the view of road users so as to render the road dangerous to them.
(15) The occupier or (in the case of unoccupied land) the owner of land on which a sign, device, notice or light is provided in contravention of subsection (14) of this section shall be guilty of an offence under this subsection and shall be liable on summary conviction thereof to a fine not exceeding five pounds together with an additional fine of one pound for each day on which the offence is continued.
(16) Where a traffic sign, not being a traffic sign to which regulations under subsection (2) of this section relate, is provided under this section by a road authority, such traffic sign shall be in conformity with any general or particular directions that may be given from time to time by the Minister.”
Patrol of places where school-children cross the road.
37.—(1) The council of a county, the corporation of a county or other borough, the council of an urban district or the commissioners of a town may, with the consent of the Commissioner of the Garda Síochána, make arrangements for the patrolling, by persons (in this section referred to as traffic wardens) employed or nominated by them, of places where school-children cross the road.
(2) A traffic warden may exhibit such sign as may be prescribed requiring traffic to stop and remain stopped so as to enable school-children to cross the road in safety, and traffic shall stop and remain stopped accordingly so long as the sign is exhibited.
(3) A person who fails to stop a vehicle or animal or keep it stopped in accordance with subsection (2) of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
(4) On and after such day as may be appointed by the Minister by order, the power conferred on a traffiic warden by subsection (2) of this section shall be exercisable only if the warden is wearing such uniform as may be prescribed.
(5) Where a county includes any borough, urban district or town, the functional area of the council of the county shall, for the purposes of this section, be deemed not to include the borough, urban district or town.
(6) In this section—
“vehicle” has the meaning assigned to it in section 3 of the Road Traffic Act, 1933 (No. 11 of 1933),
“traffic” has the meaning assigned to it in subsection (6) of section 147 of that Act,
“uniform” includes any garment, armlet or cap.
International circulation of mechanically propelled vehicles.
38.—(1) The Minister may by order provide—
(a) for the grant and authentication of any travelling passes, certificates, authorities or other documents relating to a mechanically propelled vehicle or the driver of such a vehicle which may be required for the purpose of travel abroad by persons resident in the State, and
(b) for modifying in relation to mechanically propelled vehicles brought into the State by persons resident outside the State, and in relation to persons so resident who are making a temporary stay in the State, the provisions of any enactment relating to the registration of mechanically propelled vehicles, the requirements to be complied with in respect of such vehicles, and the licensing of drivers.
(2) Any such modification shall have effect as if it were contained in the Act modified.
(3) Any order under this section may be varied or revoked by any subsequent order under this section.
(4) In this section “mechanically propelled vehicle” has the same meaning as in the Road Traffic Act, 1933 (No. 11 of 1933) and references thereto include reference to a vehicle drawn by such a vehicle.
Contribution to cost of working, maintaining or improving ferry.
39.—Section 1 of the Ferries (Acquisition by Local Authorities) Act, 1919, is hereby amended by the addition of the following subsection:—
“(9) In lieu of effecting under this section the acquisition of a ferry, a local authority may, subject to such conditions as they think proper to impose, contribute to the cost of working, maintaining or improving the ferry.”
Bridges, viaducts and tunnels.
40.—(1) Section 52 of the Act of 1946 is hereby amended by the addition of the following subsections:—
“(4) Except where the bridge order relates to the River Shannon the work may be executed notwithstanding that it constitutes or will constitute an interference with any right (including, in particular, a right of navigation, whether or not conferred by statute).
(5) Where the execution of the work has the effect of curtailing or terminating a private right of any person (including, in particular, a right of navigation, whether or not conferred by statute), such person may, within twelve months after completion of the work, make to the executing authority a claim for compensation in respect of such curtailment or termination and he shall be entitled to be paid compensation therefor by the executing authority and, in default of being paid such compensation when the amount thereof has been agreed upon or has been determined under this section, to recover it from the executing authority in any court of competent jurisdiction.
(6) In default of agreement, the amount of any compensation payable by a road authority under this section shall be determined by arbitration under the Acquisition of Land (Assessment of Compensation) Act, 1919 (as amended by subsequent enactments) as if the compensation were the price of land compulsorily acquired and the arbitrator shall have jurisdiction to determine whether compensation is, in the circumstances, payable at all.”
(2) Section 53 of the Act of 1946 is hereby amended by the substitution in subsection (3) of “amend the provisions of the bridge order requiring a contribution under” for “vary a contribution required under subsection (1) of”.
(3) Section 55 of the Act of 1946 is hereby amended by the substitution of the following subsections for subsection (2):—
“(1A) (i) Subsection (1) of this section shall not apply in a case with respect to which the Minister, by order made before the completion of the work, excludes the application of that subsection.
(ii) The Minister may, by order made before the completion of the work and having effect as from such completion, transfer to any road authority to which the bridge order applies any powers and duties in relation to the bridge which are powers and duties of any other road authority to which the bridge order applies, and in a case in which such an order is made, the order shall have effect in lieu of subsection (1) of the section.
(2) The Minister may by order transfer, with effect as from the completion of the work, to any road authority to which the bridge order applies any powers and duties (exclusive of powers and duties under this Part of this Act) in relation to any portion of road adjoining the bridge which are powers and duties of any other road authority to which the bridge order applies.”
(4) Section 56 of the Act of 1946 is hereby amended by the substitution of the following paragraphs for paragraph (d) of subsection (2):—
“(d) amend under subsection (3) of section 53 of this Act a provision of the bridge order requiring a contribution to be made to or by a harbour authority;
(e) make an order under subsection (1A) or subsection (2) of section 55 of this Act transferring to a harbour authority any powers or duties of a road authority.”
(5) Section 57 of the Act of 1946 is hereby amended by the substitution of the following subsection for subsection (2):—
“(2) where by virtue of this section the bridge order applies to a company controlling a railway or canal, the Minister shall not by virtue of this section do either of the following things save with the consent of the Minister for Industry and Commerce, that is to say:
(a) amend under subsection (3) of section 53 of this Act a provision of the bridge order requiring a contribution to be made to or by the company;
(b) make an order under subsection (1A) or subsection (2) of section 55 of this Act transferring to the company any powers or duties of a road authority.”
Schemes for cross-border bridges.
41.—(1) A road authority may, subject to the approval of the Minister, prepare and adopt schemes for the construction, improvement, alteration, maintenance or abandonment of bridges linking places within their functional area with places in Northern Ireland.
(2) A scheme adopted under this section shall contain such particulars with regard to such matters and shall be in such form as the Minister may approve, and in particular, but without prejudice to the generality of the foregoing provisions of this section, may specify the manner in which and the bodies by whom, and in what proportion, the expenses are to be defrayed of carrying the scheme into effect and of the maintenance of anything constructed thereunder.
(3) Any powers for the time being exercisable by a road authority in relation to roads may be exercised for the purpose of carrying into effect a scheme adopted under this section.
(4) Adoption under this section of a scheme shall be a reserved function.
PART IV.
Provisions relating to Local Finance.
Borrowing by way of temporary loan or overdraft.
42.—(1) A local authority having any power to borrow may, for the purposes of providing temporarily for any expenses that may be incurred by them in the execution or performance of any of their powers and duties, borrow with the consent of the Minister by way of temporary loan or overdraft.
(2) The period for which a sum is borrowed under this section shall be such period, not exceeding ten years, as the Minister may sanction.
(3) A sum borrowed by a local authority under this section shall not be reckoned as part of the debt of such authority for the purposes of any statutory limitation of borrowing.
(4) In this section references to borrowing include references to reborrowing.
Exclusion from limitation of borrowing.
43.—(1) This section applies to a local authority being an urban sanitary authority for the purposes of the Local Government (Sanitary Services) Acts, 1878 to 1952, and not being the corporation of a county borough.
(2) A sum borrowed by a local authority to whom this section applies in relation to a water supply or sewerage system shall not be reckoned as part of the debt of such authority for the purposes of any statutory limitation of borrowing.
Borrowing for maintenance of town hall.
44.—(1) Section 6 of the Local Authorities (Miscellaneous Provisions) Act, 1936 (No. 55 of 1936), is hereby amended by the insertion in subsection (2) of “or maintenance” after “provision”.
(2) Subsection (1) of this section shall be deemed to have had effect as from the passing of the Local Authorities (Miscellaneous Provisions) Act, 1936.
Rate not to be invalidated in certain circumstances.
45.—(1) A rate made by a local authority shall not be invalidated by reason only of the fact that notice relating to the revised valuation list or appeal list prepared under the Valuation Acts has not been affixed at any place in accordance with those Acts.
(2) As well as applying to rates made after the commencement of this section subsection (1) of this section also applies, and shall be deemed always to have applied, to rates made before such commencement.
(3) Notwithstanding any provision of the Valuation Acts, no officer of a local authority shall be liable for failure to affix a notice at any place in accordance with those Acts.
Amendment of rates to be deemed not to be reserved function.
46.—In lieu of subsection (6) (repealed by this Act) of section 60 of the Act of 1941, it is hereby enacted that the powers, functions and duties conferred and imposed by that section shall be deemed not to be reserved functions.
Amendment of Local Authorities (Works) Act, 1949.
47.—(1) In this section “the Act” means the Local Authorities (Works) Act, 1949 (No. 17 of 1949).
(2) The expenses incurred by the council of a county on works undertaken in pursuance of subsection (2) of section 2 of the Act in relation to land owned by them or to any permanent construction which was constructed by them or which they are required to maintain shall be charged in the same way as expenses of the council in connection with the maintenance of the land or permanent construction are charged.
(3) The expenses incurred by the council of a county on works undertaken in pursuance of subsection (3) of section 2 of the Act in relation to land not owned by them or to any permanent construction not being a permanent construction which was constructed by them or which they are required to maintain shall be charged on the county health district.
(4) An order under subsection (1) of section 3 of the Act authorising the execution of works on behalf of a local authority may provide for a contribution by that authority towards the cost of the works and, where that authority is the council of a county and the Minister considers that the contribution should be charged on the county health district, for the charge thereof on that district.
(5) An agreement under subsection (2) of section 3 of the Act for the execution of works on behalf of a local authority may provide for a contribution by that authority towards the cost of the works and, where that authority is the council of a county, the contribution shall be charged in the same way as that in which, if the council themselves executed the works, their expenses would be charged.
(6) Compensation payable by the council of a county pursuant to the Act shall be charged in the same way as the cost of the works or the contribution of the council towards the cost of the works (as may be appropriate) is charged.
(7) Where compensation is payable under the Act by a local authority executing works on behalf of another local authority:—
(a) the Minister may by order vary any order made under subsection (4) of this section so that the contribution shall comprise an amount in respect of compensation,
(b) any agreement entered into under subsection (2) of section 3 of the Act and providing for a contribution by such other local authority shall have effect subject to any such variation, so that the contribution shall comprise an amount in respect of compensation, as may be agreed upon between the local authorities or, in default of agreement, as may be determined by the Minister.
(8) The council of a county or corporation of a county borough may, for the purposes of defraying expenses under the Act, borrow under Article 22 of the Schedule to the Local Government (Application of Enactments) Order, 1898, as if those purposes were mentioned in that Article, and money so borrowed shall not be reckoned as part of the debt of the council or corporation for the purposes of that Article.
(9) The corporation of a borough (other than a county borough) or the council of an urban district may, for the purposes of defraying expenses under the Act, borrow under the Local Government (Sanitary Services) Acts, 1878 to 1952, as if those purposes were purposes for which the corporation or council is authorised to borrow under those Acts, and money so borrowed shall not be reckoned as part of the debt of the corporation or council for the purposes of any limitation on borrowing imposed by those Acts.
Audit fees.
48.—Section 69 of the Act of 1941 is hereby amended by the addition of the following subsection:—
“(12) Notwithstanding any other provision of this section, an order under this section may be framed, and shall have effect accordingly, so that in addition to applying in respect of a particular audit or audits, it also applies unless and until it is revoked, in respect of subsequent audits.”
Making of charge.
49.—(1) Where a person retained by a public body in any professional, advisory or consultative capacity certifies any sum as being payable from the funds of the public body and such sum is paid, such person shall be deemed to be an officer of the public body for the purposes of section 20 of the Local Government (Ireland) Act, 1902, as amended by subsection (3) of section 61 of the Act of 1925, in so far as the payment certified by him is concerned.
(2) Subsection (1) of this section shall not apply—
(a) where the certificate was given by a person acting as an arbitrator, or
(b) where the decision on which the certificate was based required the exercise of professional or technical judgment.
Amendment of section 10 of Act of 1946.
50.—Section 10 of the Act of 1946 is hereby amended as follows:—
(I) For subsection (1), the following subsection shall be substituted:
“(1) Expenses of the council of a county shall, save where it is otherwise provided by order of the Minister or elsewhere by law, be charged in accordance with this section over the whole of the county.”,
(II) Subsection (5) shall be deleted,
(III) For subsection (6) the following subsection shall be substituted:
“(6) Where the expenses of the council of a county are charged on an area consisting of both an area which is not an urban area and either an urban area or two or more urban areas, the amount of the expenses to be charged on each area shall be in proportion to the net produce calculated in the prescribed manner and certified in the prescribed form of a rate of one penny in the pound in each area, but, in the case of the urban area consisting of the urban district of Buncrana in relation to any local financial year not later than the local financial year ending on the 31st day of March, 1964, the said net produce shall not be taken and, in lieu thereof, there shall be taken a sum equal to one penny for each pound of the amount specified in respect of that year in the Schedule to the Local Government (Temporary Reduction of Valuation) Act, 1954 (No. 8 of 1954).”
(IV) Subsection (7) shall be deleted, and
(V) two new subsections shall be inserted as follows:—
“(7) The Minister may by order determine, either in respect of counties generally or any particular county, the area or areas on which specified expenses of the council are to be charged, and may amend or revoke any such order.
(8) Orders under section 71 (repealed by this Act) of the Local Government (Ireland) Act, 1898, shall continue in force and may be amended or revoked by order under this section.”
PART V.
Approved Local Councils in County Boroughs.
Approved local councils in county boroughs.
51.—(1) Where the inhabitants of a locality in a county borough have, either before or after the commencement of this section, established a council, committee or other body, whether corporate or unincorporated, for furthering the general social and economic interests of such inhabitants, the corporation of the county borough may, on the application of such body, by resolution declare that such body shall be an approved local council for the purposes of this Part of this Act.
(2) The making of a declaration under this section shall be a reserved function.
(3) In this Part of this Act “approved local council” means a body in respect of which a declaration under this section has been made and every reference to a corporation made in relation to an approved local council shall be construed as a reference to the particular corporation of a county borough which made the declaration under this section relating to that approved local council.
Provision of buildings, etc., for approved local councils.
52.—(1) The corporation may provide a building for use by an approved local council for public and other meetings and for lectures, exhibitions, general recreation or other similar social objects and may entrust the care and management of the building to the council either permanently or temporarily.
(2) The corporation may acquire by agreement land for or including a building to be provided under this section.
(3) The corporation may assist an approved local council by supplying them with furniture, office equipment and stationery and, where a building is provided under this section for use by an approved local council, by paying the whole or part of the wages of a person acting as caretaker of and performing cleansing and similar duties in relation to the building.
(4) The corporation may—
(a) make a grant to an approved local council towards the provision by the council of a building for public or other meetings and for lectures, exhibitions, general recreation or other similar social objects, and
(b) as a condition of making the grant, require the council to enter into such agreements with the corporation (including agreements governing the use and disposal of the building) as the corporation consider proper.
(5) An agreement under paragraph (b) of subsection (4) of this section may provide for the repayment by the approved local council of the whole or part of the grant (inclusive of such (if any) charges as may be made by the corporation in respect of the grant) at such times and in such manner as the corporation consider proper.
(6) The corporation may, for the purposes of this section, borrow in the same manner as they may borrow for the purpose of defraying expenses under the Local Government (Sanitary Services) Acts, 1878 to 1952.
(7) Money borrowed pursuant to this section may be lent to the corporation by means of an issue from the local loans fund as if such loan constituted a local loan within the meaning of the Local Loans Fund Acts, 1935 to 1953, and was authorised by an Act of the Oireachtas.
(8) Functions of the corporation under subsection (1), (2), (3) or (4) of this section shall be reserved functions.
PART VI.
Miscellaneous.
Amendment of sections 76 to 79 of Act of 1946.
53.—(1) Section 76 of the Act of 1946 is hereby amended by the addition of the following subsection:—
“(11) (a) The council of an urban district or the commissioners of a town may cause a list of the ratepayers in the urban district or town to be prepared, and such list when adopted, with or without alterations, by the council or commissioners shall, for the purposes of this section, be the list of ratepayers in the said district or town.
(b) Adoption under this subsection of a list of ratepayers shall be a reserved function.”
(2) Section 77 of the Act of 1946 is hereby amended by the substitution of the following subsection for subsection (4):—
“(4) (a) Where a townland or a non-municipal town is wholly situate in a particular county, the council of the county may cause a list of the ratepayers in the townland or non-municipal town to be prepared, and such list when adopted, with or without alterations, by the council shall, for the purposes of this section, be the list of ratepayers in the said townland or non-municipal town.
(b) Where part only of a townland or a non-municipal town is situate in a particular county, the council may cause a list of the ratepayers in the part of the townland or non-municipal town which is situate in the county to be prepared, and such list when adopted, with or without alterations, by the council shall, for the purposes of this section, be the list of ratepayers in the said part.
(c) Adoption under this subsection of a list of ratepayers shall be a reserved function.”
(3) Section 78 of the Act of 1946 is hereby amended by the substitution for subsection (5) of the following subsections:—
“(5) (a) The appropriate authority may cause a list of the ratepayers in a street to be prepared, and such list when adopted, with or without alterations, by the appropriate authority shall, for the purposes of this section, be the list of ratepayers in the street.
(b) Adoption under this subsection of a list of ratepayers shall be a reserved function.
(6) In this section—
the word ‘street’ includes part of a street and also the whole or part of any road, square, lane or other public place,
the expression ‘appropriate authority’ means—
(a) as respects a street wholly situate, or a building or other erection situate, in a county, the council of the county,
(b) as respects a street wholly situate, or a building or other erection situate, in a county or other borough, the corporation of the borough,
(c) as respects a street wholly situate, or a building or other erection situate, in an urban district, the council of the urban district,
(d) as respects a street wholly situate, or a building or other erection situate, in a town, the commissioners of the town, and
(e) as respects any other street, such two of the said local authorities as may be appropriate acting jointly.”
(4) In sections 76 to 79 of the Act of 1946 (including the subsections added by the foregoing subsections of this section) “ratepayer” shall, with respect to a small dwelling within the meaning of the Local Government (Rates on Small Dwellings) Act, 1928 (No. 4 of 1928), of which the owner within the meaning of that Act is not also the occupier, mean the occupier and not the owner.
Grants by county council towards provision of building by approved local council.
54.—(1) Section 73 of the Act of 1941 is hereby amended by the addition of the following subsections:—
“(4) The county council may—
(a) make a grant to an approved local council towards the provision by the local council of a building for public or other meetings and for lectures, exhibitions, general recreation or other similiar social objects, and
(b) as a condition of making the grant, require the local council to enter into such agreements with the county council (including agreements governing the use and disposal of the building) as the county council consider proper.
(5) An agreement under paragraph (b) of subsection (4) of this section may provide for the repayment by the approved local council of the whole or part of the grant (inclusive of such (if any) charges as may be made by the county council in respect of the grant) at such times and in such manner as the county council consider proper.
(6) The county council may, for the purposes of this section, borrow in the same manner as they may borrow for the purpose of defraying expenses under the Local Government (Sanitary Services) Act, 1878 to 1952.
(7) Money borrowed pursuant to this section may be lent to the county council by means of an issue from the local loans fund as if such loan constituted a local loan within the meaning of the Local Loans Fund Acts, 1935 to 1953, and was authorised by an Act of the Oireachtas.”
(2) Functions of the council of a county under subsection (1), (2), (3) or (4) of section 73 of the Act of 1941 shall be reserved functions.
Contribution to body providing swimming facilities.
55.—(1) This section applies to a local authority being a sanitary authority for the purposes of the Local Government (Sanitary Services) Acts, 1878 to 1952.
(2) A local authority to whom this section applies, may, with the consent of the Minister and subject to such terms and conditions as they think fit, contribute to the funds of a society, club, committee or other body providing or proposing to provide swimming facilities.
(3) A local authority to whom this section applies may borrow for the purpose of making a contribution under this section in the same manner as they may borrow for the purpose of defraying expenses under the Local Government (Sanitary Services) Acts, 1878 to 1952.
(4) Money borrowed pursuant to this section may be lent to a local authority by means of an issue from the local loans fund as if such loan constituted a local loan within the meaning of the Local Loans Fund Acts, 1935 to 1953, and was authorised by an Act of the Oireachtas.
(5) The making of contributions under this section shall be a reserved function.
Decorations.
56.—(1) The corporation of a borough other than a county borough, the council of an urban district or the commissioners of a town may authorise the expenditure of moneys on the decoration of the borough, urban district or town on occasions of public rejoicing and other appropriate occasions.
(2) The expenses incurred under this section in any local financial year by the corporation of a borough, the council of an urban district or the commissioners of a town shall not exceed the amount of a rate of three pence in the pound on the rateable valuation of the borough, urban district or town.
(3) Authorisation of expenditure under this section shall be a reserved function.
Contribution to body providing museum.
57.—(1) The council of a county or corporation of a county borough may, with the consent of the Minister, contribute to the funds of a society, committee or other body providing or proposing to provide a museum for the reception of objects of local antiquarian interest and may assist such society, committee or other body by providing a building for their use, supplying them with furniture, office equipment and stationery or by paying the whole or part of the remuneration of any person employed in relation to the museum.
(2) The making of contributions or the granting of assistance under this section shall be a reserved function.
Alteration of market charges, etc.
58.—(1) Where a limit is imposed by statute on the amount of a rent, toll, stallage, fee or other charge which may be demanded or taken by a local authority in relation to a market or fair, or in respect of the use of or for services provided by means of an abattoir or slaughter-house, the reference in the statute to the limit shall be construed as including a reference to such different limit as may be substituted therefor by the local authority from time to time with, in the case of an abattoir or slaughter-house, the consent of the Minister for Agriculture (given after consultation with the Minister) and, in any other case, the consent of the Minister (given after consultation with the Minister for Agriculture).
(2) Substitution under this section shall be a reserved function.
Exercise or performance of power, function or duty by local authority for another local authority or for other statutory body.
59.—(1) Where—
(a) a local authority are of opinion that it would be more convenient that any power, function or duty which may be exercised or performed by them should be exercised or performed, whether generally or in a particular case, by another local authority, and
(b) the other local authority are able and willing so to exercise or perform the power, function or duty,
the authorities may enter into an agreement that the power, function or duty shall be so exercised or performed on behalf of the first-mentioned authority by the other, and it shall thereupon become so exercisable or performable by the other authority.
(2) Where—
(a) a body, being a body established by statute and not being a local authority, are of opinion that any power, function or duty which may be exercised or performed by them should be exercised or performed, whether generally or in a particular case, by a local authority, and
(b) the local authority are able and willing so to exercise or perform the power, function or duty,
the body and the local authority may enter into an agreement that the power, function or duty shall be so exercised or performed on behalf of the body by the local authority, and it shall thereupon become so exercisable or performable by the local authority.
(3) This section is without prejudice to section 47 of the Health Act, 1953 (No. 26 of 1953), and an agreement shall not be made under this section in a case in which an arrangement could be made under the said section 47.
(4) Entry under this section into an agreement shall be a reserved function.
Advisory Committees.
60.—(1) A local authority may appoint such and so many committees as they think fit to consider any matters connected with the functions of the local authority (exclusive of matters referred to in subsection (4) of section 22 of the National Monuments Act, 1930 (No. 2 of 1930), or subsection (1) of section 48 of the Health Act, 1953 (No. 26 of 1953)) and to advise the local authority on those matters.
(2) A committee under this section shall consist of not less than three members and may be composed wholly of members of the local authority by whom they were appointed, or partly of such members and partly of other persons.
Regulations with respect to meetings, etc.
61.—(1) The Minister may by regulations make provision in relation to all or any local authorities with respect to all or any of the following matters:—
(a) summoning and holding of meetings,
(b) procedure,
(c) making of contracts,
(d) accounts,
(e) audit of accounts,
(f) matters which are subsidiary or ancillary to any of the foregoing matters.
(2) From and after the commencement of regulations under this section, the matters with respect to which the regulations were made shall, as respects any local authority concerned, be governed by the provisions of the regulations, and any previous provisions, whether made by or under statute, applying to that authority and relating to those matters shall cease to have effect as respects that authority.
(3) Regulations under this section relating to—
(a) mental hospital authorities within the meaning of the Mental Treatment Act, 1945 (No. 19 of 1945),
(b) joint boards established by order under section 45 of the Health Act, 1953 (No. 26 of 1953), or
(c) consultative health committees appointed under section 48 of the Health Act, 1953, or under regulations made under that section,
shall not be made save with the consent of the Minister for Health.
(4) Every regulation made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly but without prejudice to the validity of anything previously done thereunder.
Standing Orders for regulation of proceedings.
62.—(1) A local authority may make standing orders for the regulation of their proceedings, other than proceedings the regulation of which is provided for by or under statute (including this Act), and may amend or revoke such standing orders.
(2) Standing orders in force immediately before the commencement of this section shall continue in force notwithstanding the repeal by this Act of the powers under which they were made and may be amended or revoked by standing orders under this section.
Separate appearance at local inquiry by manager.
63.—Section 90 of the Act of 1946 is hereby amended as follows:
(a) by the substitution in subsection (1) of “the manager for the local authority may, with the consent of the Minister, appear separately at the inquiry and such appearance may be personal or by counsel or solicitor” for “the Minister may, if he so thinks proper, order that the manager for the local authority may appear separately at the inquiry”, and
(b) by the substitution for subsection (2) of the following subsection:
“(2) Where the manager for a local authority appears separately at a local inquiry pursuant to subsection (1) of this section, the employment and instruction of the counsel or solicitor appearing at the inquiry on behalf of the local authority shall be a reserved function.”
Contribution towards costs and expenses in relation to local inquiry.
64.—Section 91 of the Act of 1946 is hereby amended by the insertion in subsection (1) after “Where a local inquiry has been held under section 83 of the Act of 1941” of “or has been held at the instance of the Minister under any other Act” and by the insertion in that subsection after “in relation to the inquiry” of “(including the costs and expenses reasonably incurred by a manager appearing separately pursuant to subsection (1) of section 90 of this Act)”.
Incorporation of commissioners of town which is not an urban district.
65.—The following provisions shall have effect in relation to the commissioners of a town which is not an urban district:—
(a) the commissioners shall become and be for all purposes a body corporate with perpetual succession by the name of “the _______ Town Commissioners” (the name of the town being inserted);
(b) the commissioners may sue and be sued in their corporate name and may hold and dispose of land for the purposes of their powers and duties;
(c) the commissioners shall have a common seal which shall be judicially noticed;
(d) all property which, immediately before the commencement of this section, was vested in or held in trust by any person for the purposes of the commissioners shall, without any conveyance or assignment, become and be vested in the commissioners;
(e) if at any time an order is made under section 76 of the Act of 1946 changing the name of the town, the name of the commissioners shall, as from the coming into operation of such order, stand changed correspondingly.
Revocation of order prohibiting temporary dwellings.
66.—(1) An order made by a sanitary authority under section 31 of the Local Government (Sanitary Services) Act, 1948 (No. 3 of 1948), may be revoked—
(a) in case it is an order which has come into force pursuant to paragraph (a) of subsection (8) of that section—by order made by the authority with the consent of the Minister or by order made by the Minister after consultation with the authority, and
(b) in any other case—by order made by the authority with the consent of the Minister.
(2) The making by a sanitary authority of an order under this section shall be a reserved function.
Travelling, etc., expenses.
67.—(1) Section 80 of the Act of 1941 and section 67 of the Act of 1946, and those sections as applied by section 8 of the Public Libraries Act, 1947 (No. 40 of 1947), shall have effect subject to the following amendments:—
(a) every reference to a person's official residence shall be construed as a reference to his ordinary place of residence,
(b) subsection (6) of the said section 80 shall be deleted,
(c) “one mile” shall be substituted in subsection (7) of the said section 67 for “three miles”,
(d) the following paragraphs shall be added to subsection (7) of the said section 67:
“Where—
(i) a member of the council of a county or of a joint mental hospital board attends a meeting of the council or board at a place less than five miles by any route from his official residence and is obliged by reason of such attendance to remain away from his home for a continuous period of not less than three hours, and
(ii) a resolution by the council or board deciding that this paragraph is to apply in relation to the council or board is for the time being in force,
the council or board shall pay to the member in relation to the meeting an inclusive allowance (not exceeding an amount specified by the prescribed rules) in respect of travelling expenses and subsistence, and such allowance shall, in a case in which, apart from this paragraph, an allowance would be payable under the first paragraph of this subsection, be in lieu of, and not in addition to, that allowance.
A resolution under the second paragraph of this subsection may be revoked at any time by another resolution of the council or board concerned.
The passing of a resolution under the second or third paragraph of this subsection shall be a reserved function.”
(2) Every member of a body to whom the said sections or the said sections as applied as aforesaid apply shall, immediately after becoming such member, communicate in writing to the body the address at which he ordinarily resides and shall similarly communicate any subsequent change of his address.
Alteration of boundaries of certain public assistance districts.
68.—(1) Section 7 of the Public Assistance Act, 1939 (No. 27 of 1939), is hereby amended by the addition of the following subsections:—
“(4) Notwithstanding any other provision of this Act, the Minister may, with the consent of the Minister for Health, by order alter the boundaries of the Dublin Public Assistance District, the Rathdown Public Assistance District or the Balrothery Public Assistance District, and the order shall make such consequential alterations in the boundaries of any adjoining public assistance district as the Minister considers appropriate.
(5) Where the Minister proposes to make an order under subsection (4) of this section—
(a) he shall furnish a statement of his proposals for consideration, during a period specified by the Minister, by the council of the county of Dublin and shall consider any observations which they may make on the statement during that period, and
(b) he shall furnish a statement of his proposals for consideration, during a period specified by the Minister, by the corporation of Dublin and shall consider any observations which they may make on the statement during that period.”
(2) Where a statement is furnished under subsection (5) of section 7 of the Public Assistance Act, 1939, the making of observations thereon shall be a reserved function.
Provision of money for certain public assistance authorities.
69.—Section 53 of the Public Assistance Act, 1939 (No. 27 of 1939), is hereby amended by the insertion after “Where a public assistance district consists of a county borough and a county or part of a county” of “or consists of a part of a county borough and a part of a county”.

“(5) (a) Where a declaration is made under this section before the 7th day of July, 1954, the declaration shall have effect in relation only to a holder who by law is entitled to or may be granted a superannuation allowance on his resigning or otherwise ceasing to hold office and subsection (3) of this section shall, with respect to the declaration, be construed accordingly.
(b) Where a declaration is made under this section on or after the 7th day of July, 1954—
(I) the following provisions shall have effect:—
(i) the declaration shall have effect in relation only to—
(A) a holder who by law is entitled to or may be granted a superannuation allowance on his resigning or otherwise ceasing to hold office, and
(B) a holder who, if he continues to hold until he reaches a particular age greater than the specified age contained in the declaration, will then, and only then by law be entitled to or be capable of being granted a superannuation allowance on his resigning or otherwise ceasing to hold office,
(ii) the reference in the declaration to the said specified age shall have effect in the case of a holder specified in clause (B) of the foregoing subparagraph as if it were a reference to the particular age referred to in that clause,
and subsection (3) of this section shall, with respect to the declaration, be construed accordingly,
(II) the declaration may relate to all the offices in relation to which the declaring Minister is the appropriate Minister or to such of those offices as belong to a specified class, description or grade or to one or more specified such offices notwithstanding any other provision made by or under statute in relation to holding such offices, offices of such class, description or grade or such one or more specified offices (including, in particular, a provision for holding office until death, resignation or removal from office) and in any such case, the declaration and this section shall have effect notwithstanding such other provision.
(c) A declaration under this section may be framed either with or without indication of the effect of this subsection.”
